Late January. The buzz was palpable at the MLR Convention Centre in South Bengaluru. Developers were streaming into 50p, a conference organised by HasGeek, which has curated technology forums since 2011. But this wasn't just one of the six HasGeek communions that the programmers attend annually. 50p put the spotlight on digital payments, which meant the gathering would be more diverse than anything before.

In this chapter we attempt to build a catalogue of these various justifications, without attempting to be exhaustive, with the objective of arriving at a rough taxonomy of such frequently invoked terms. In addition we also examine some the more important justifications such as “public interest” and “security of the state” that have been invoked in statutes and upheld by courts to deprive persons of their privacy.

The laws of breach of confidentiality and breach of privacy at first glance seem very similar to each other. If a doctor releases health information relating to a patient that s/he is treating then such an act would give rise to a claim both under the law of privacy as well as under the law of confidentiality.

About Us

The Centre for Internet and Society (CIS) is a non-profit organisation that undertakes interdisciplinary research on internet and digital technologies from policy and academic perspectives. The areas of focus include digital accessibility for persons with disabilities, access to knowledge, intellectual property rights, openness (including open data, free and open source software, open standards, open access, open educational resources, and open video), internet governance, telecommunication reform, digital privacy, and cyber-security. The research at CIS seeks to understand the reconfiguration of social processes and structures through the internet and digital media technologies, and vice versa.

Through its diverse initiatives, CIS explores, intervenes in, and advances contemporary discourse and regulatory practices around internet, technology, and society in India, and elsewhere.
