Religious leaders in India are on a collision course with social media websites including Google, Facebook and Yahoo. Two Indian courts recently asked these American companies as well as 19 other websites to take down “anti-religious” material. They are now required to report their compliance by February. Betwa Sharma's blog post was published in SmartPlanet on 5 January 2012. Sunil Abraham has been quoted in it extensively.

The Tunis Agenda of the second World Summit on the Information Society has defined internet governance as the development and application by governments, the private sector and civil society, in their respective roles of shared principles, norms, rules, decision making procedures and programmes that shape the evolution and use of the Internet. As part of internet governance work we work on policy issues relating to freedom of expression primarily focusing on the Information Technology Act and issues of liability of intermediaries for unlawful speech and simultaneously ensuring that the right to privacy is safeguarded as well. We have worked with the UN Special Rapporteur on the Promotion and Protection of the Right to Freedom of Opinion and Expression, and helped him in the preparation of his 2011 report on freedom of speech on the Internet by organizing South Asia-wide consultations.

It seems to have become quite a fad, especially amongst journalists, to use this headline and claim that the right to privacy which we consider so inherent to our being, is under attack. However, when I use this heading in this piece I am not referring to the rampant illegal surveillance being done by the government, or the widely reported recent raids on consenting (unmarried) adults who were staying in hotel rooms in Mumbai. I am talking about the fact that the Supreme Court of India has deemed it fit to refer the question of the very existence of a fundamental right to privacy to a Constitution Bench to finally decide the matter, and define the contours of such right if it does exist.
