&lt;p style="text-align: justify; "&gt;ON 27 August, as the Congress and the BJP battled it out in Parliament and later through news conferences, the story on Twitter was a bit different. Congress supporters, who had been at the receiving end of the ‘Coalgate’ issue so far, finally started hitting back. Adopting a strategy they had so far been accusing right-wingers of, they launched into an all-out attack on anyone who supported the BJP. Every tweet was hashtagged with #RIPBJP. At the end of the day, #RIPBJP was trending, making it the most successful Congress campaign against the BJP — a first on Twitter.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“The social media battle against the BJP has just begun,” says a Congress supporter associated with the new project. “In the days to come, you will see our volunteers in a more combative mode.” However, he says it will not “replicate the negative campaign of the right-wing”.&lt;br /&gt;&lt;br /&gt;The Congress’ social media strategy is spearheaded by its tech-savvy General Secretary Digvijaya Singh. On Twitter for nearly nine months, Singh has been readying to take on the BJP on its own turf and influence the ‘voice of people’. Though serious doubt remains about how much of this voice is real and how much is a result of political propaganda.&lt;br /&gt;&lt;br /&gt;The push for the Congress to take the battle online comes from the recent ‘banning’ of Twitter handles of BJP sympathiser and senior journalist Kanchan Gupta. While the government insists that the handles were blocked due to security issues, Gupta claimed political martyrdom and launched a tirade against the Congress for imposing a second Emergency. Hashtags like #Emergency2012 and #GOIBlocks started trending, with BJP supporters turning their display pictures to black. "The fact remains none of the blockings were politically motivated,” says Pranesh Prakash, programme manager with Centre for Internet and Society. Prakash instead points to the UPA’s earlier request to IT companies like Google and Facebook to pull down certain pages, which displayed morphed photos and cartoons of Congress “functionaries” as clear example of politically motivated intervention.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Though no explanation was forthcoming from the government as to why specific handles were blocked temporarily through ISPs (Twitter has still not blocked them), the PMO issued a statement saying it has requested Twitter to take “appropriate action against six persons impersonating the PMO”. Certain handles like @PM0India (with a ‘zero’) were often accused of impersonating the actual @PMOIndia. But that’s another story.&lt;/p&gt;

&lt;td style="text-align: justify; "&gt;The day Gupta’s handle was ‘blocked’, former bureaucrat B Raman wrote a blog that gave an interesting insight into why the government might have targeted Gupta. Raman describes a meeting that took place in Ahmedabad in 2008 — just before the 2009 General Elections — attended by senior BJP leaders and sympathisers, including Gupta. Raman says the general feeling among BJP participants was that mainstream media was not giving enough opportunities to the BJP and other right-wing activists to air their views. Therefore, “it was suggested by some participants that the BJP could get  over this handicap by making good use of the online media”. Raman goes  on to point that supporters of Gujarat Chief Minister Narendra Modi and  other right-wingers have since then used online media superbly with help  of IT-savvy Hindutva supporters.&lt;/td&gt;

&lt;p style="text-align: justify; "&gt;What Raman wrote in his blog is confirmed by the BJP’s IT Cell Convener, Arvind Gupta. The BJP was not only the first political party in India to have a website in 1999, its social media network has been way ahead of any other political group in the country. From posting updates to engaging users, it has a well-oiled social media machinery in place. Arvind calls this the “listen, engage and inform” model. This includes Internet TV, YouTube and messenger chats. In fact, the next big thing on the party’s social media agenda is the interaction with Narendra Modi on Google+ Hangout.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;BUT IT is not political agenda that has left Digvijaya Singh singed. Speaking to TEHELKA, Singh points to abusive — and at times, factually incorrect — tweets posted by right-wing supporters. In many cases, the mere mention of anything against Modi or Baba Ramdev would have scores of right-wing supporters bombarding Twitter timelines with counter-criticism, and often, abuses. “Anything that incites hate is a problem,” he says.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Though what can be called ‘hate’ is a very subjective matter, Arvind Gupta feels social media reflects the mood of the young population. “People call themselves Internet Hindus. We, as a party, have nothing to do with this. People are so passionate about Modi that they take up his case (against anyone who posts anti-Modi tweets),” says Gupta. He also points towards a similar trend when it comes to people tweeting against Team Anna.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Many right-wing Twitter users are accused of posting sponsored tweets against specific people who they believe are anti-BJP. This accusation has not been proven so far, though many users claim to have tracked interaction between rightwing Twitter users on coordinated attacks on users with liberal or pro-Congress ideologies. “There is a belief — and let me tell you that it is wrong — that we hire people,” says Gupta. So can the high number of right-wing users be put down to an ideological stance alone? Gupta says it’s got to do with understanding politics better. “Our volunteers are generally more educated and understand the the Congress’ wrong policies. That category also forms a major part of the ecosystem in this new media,” he says.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Within minutes of talking to this correspondent, Gupta posts a new hashtag on Twitter — #MotaMaal — taking a cue from Sushma Swaraj’s accusation of corruption against the Congress in the coal scam. The next day, Twitter became all about #MotaMaal versus #RIPBJP. Handles like @BJP0fficials and @PMAdvani have been created to counter the right wing. Clearly, Congress supporters are hitting back even at the risk of adding to the cacophony of an already-chaotic medium.&lt;/p&gt;

&lt;p&gt;Even though Pitroda largely reiterated the government’s already announced plans in the space of digitization, the move to hold a press conference over Twitter has been largely construed as as a sign that the administration, criticised for attempting to rein in social media, is trying to come to terms with it.&lt;/p&gt;
&lt;p&gt;Sunil Abraham, executive director of Bangalore-based research organization Centre for Internet and Society, said too much shouldn’t be read into Pitroda holding a press conference on Twitter. One government bureaucrat available on Twitter for a fixed period doesn’t make up for the non-existence of the government on social media, he said. “They (government) should be available all the time.”&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;The department of electronics and information technology recently issued guidelines for government agencies on improved engagement with citizens through social media. Tuesday’s press conference may spark a trend of more such engagements on social media platforms by government agencies.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Pitroda said that the public information infrastructure (PII) will include a national knowledge network that will connect 1,500 nodes for universities, colleges, research labs and libraries along with connecting 250,000 panchayats in the country through fibre optics. The information network will be operational in the next two year, Pitroda said in the YouTube video.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The government’s open data platform (&lt;i&gt;http://www.data.gov.in&lt;/i&gt;), the beta site for which was launched some time ago, will provide access to government data and documents, he said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Even though the government’s battles with the Internet continue over issues of regulation, which have often been construed as censorship, an increasing number of political leaders and agencies have been using the route to get their message across.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Gujarat chief minister &lt;a href="http://origin-www.livemint.com/Search/Link/Keyword/Narendra%20Modi"&gt;Narendra Modi&lt;/a&gt; has sought to engage with people through video chat on &lt;a href="http://origin-www.livemint.com/Search/Link/Keyword/Google+"&gt;Google+&lt;/a&gt; Hangout. West Bengal chief minister and Trinamool Congress (TMC) chief &lt;a href="http://origin-www.livemint.com/Search/Link/Keyword/Mamata%20Banerjee"&gt;Mamata Banerjee&lt;/a&gt; has been using &lt;a href="http://origin-www.livemint.com/Search/Link/Keyword/Facebook"&gt;Facebook&lt;/a&gt; to make public her views on recent economic and political developments.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Prime Minister’s Office (PMO) has also been communicating over Twitter in the recent past. The authorities have sought to block accounts that style themselves as belonging to the Prime Minister. Account holders have said that some of these are satirical in nature.&lt;/p&gt;

&lt;h3&gt;Open Government Partnership&lt;/h3&gt;
&lt;p&gt;In January 2011, a small group of government and civil society leaders from around the world gathered in Washington, DC to brainstorm on how to build upon growing global momentum around transparency, accountability and civic participation in governance. The result was the creation of the Open Government Partnership (OGP), a new multi-stakeholder coalition of governments, civil society and private sector actors working to advance open government around the world — with the goals of increasing public sector responsiveness to citizens, countering corruption, promoting economic efficiencies, harnessing innovation, and improving the delivery of services.&lt;/p&gt;
&lt;p&gt;In September 2011, these founding OGP governments will gather in New York on the margins of the UN General Assembly to embrace a set of high-level open government principles, announce country-specific commitments for putting these principles into practice and invite civil society to assess their performance going forward. Also in September, a diverse coalition of governments will stand up and announce their intention to join a six-month process culminating in the announcement of their own OGP commitments and signing of the declaration of principles in January 2012.&lt;/p&gt;
&lt;h3&gt;'Opening Government' report&lt;/h3&gt;
&lt;p&gt;To help inform governments, civil society and the private sector in developing their OGP commitments, the Transparency and Accountability Initiative (T/A Initiative) reached out to leading experts across a wide range of open government fields to gather their input on current best practice and the practical steps that OGP participants and other governments can take to achieve it.&lt;/p&gt;
&lt;p&gt;The result is the first document of its kind to compile the state of the art in transparency, accountability and citizen participation across 15 areas of governance, ranging from broad categories such as access to information, service delivery and budgeting to more specific sectors such as forestry, procurement and climate finance.&lt;/p&gt;
&lt;p&gt;Each expert’s contribution is organized according to three tiers of potential commitments around open government for any given sector — minimal steps for countries starting from a relatively low baseline, more substantial steps for countries that have already made moderate progress, and most ambitious steps for countries that are advanced performers on open government.&lt;/p&gt;

&lt;p align="justify"&gt;CIS is an accredited organization with the World Intellectual Property Organisation (WIPO) and a regular participant at the meetings of the Standing Committee on Copyrights and Related Rights (SCCR), the Standing Committee on the Law of Patents (SCP), as well as the Committee on Development and Intellectual Property.&lt;/p&gt;
&lt;p align="justify"&gt;At the outset, we commend Your Excellency for signing the Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind, Visually Impaired, or Otherwise Print Disabled. As one of the contributors to this treaty, we appreciate the concern of the Holy See for those who are marginalised within our information society by their disabilities.&lt;/p&gt;
&lt;p align="justify"&gt;As Pranesh Prakash, Policy Director from CIS noted at Marrakesh during the adoption of this treaty, “When copyright doesn't serve public welfare, states must intervene, and the law must change to promote human rights, the freedom of expression and to receive and impart information, and to protect authors and consumers.”&amp;nbsp; We are happy to see this being done through a treaty as such.&lt;/p&gt;
&lt;p align="justify"&gt;Also said by Your Excellency, within the Holy See’s statement at the 9th Ministerial Conference of the World Trade Organization (WTO), “Among the most damaging concessions developing countries make in regional and bilateral agreements are those enhancing the monopolies on life-saving medicines, which reduce access and affordability and those that provide excessive legal rights to foreign investors, limiting the policy space for nations to promote sustainable and inclusive development.”&lt;/p&gt;
&lt;p align="justify"&gt;Given the Holy See’s demonstrated standpoint on the accessing of medicines and published works, we at the Centre for Internet and Society would like to request Your Excellency to also consider &lt;strong&gt;copyrights, patents or more generally, intellectual property rights (IPR)&lt;/strong&gt;, as&amp;nbsp; Permanent Observer of the Holy See to the United Nations and Other International Organizations in Geneva.&lt;/p&gt;
&lt;p align="justify"&gt;On behalf of CIS, I am honoured to be writing to Your Excellency and for this request to be considered.     <title>Online Pre-Censorship is Harmful and Impractical</title>

        &lt;b&gt;The Union Minister for Communications and Information Technology, Mr. Kapil Sibal wants Internet intermediaries to pre-censor content uploaded by their users.  Pranesh Prakash takes issue with this and explains why this is a problem, even if the government's heart is in the right place.  Further, he points out that now is the time to take action on the draconian IT Rules which are before the Parliament.&lt;/b&gt;
        
&lt;p&gt;Mr. Sibal is a knowledgeable lawyer, and according to a senior lawyer friend of his with whom I spoke yesterday, greatly committed to ideals of freedom of speech.  He would not lightly propose regulations that contravene Article 19(1)(a) [freedom of speech and expression] of our Constitution.  Yet his recent proposals regarding controlling online speech seem unreasonable.  My conclusion is that the minister has not properly grasped the way the Web works, is frustrated because of the arrogance of companies like Facebook, Google, Yahoo and Microsoft.  And while he has his heart in the right place, his lack of knowledge of the Internet is leading him astray.  The more important concern is the&lt;a class="external-link" href="http://www.mit.gov.in/sites/upload_files/dit/files/RNUS_CyberLaw_15411.pdf"&gt; IT Rules&lt;/a&gt; that have been in force since April 2011.&lt;/p&gt;
&lt;h3&gt;Background &lt;br /&gt;&lt;/h3&gt;
&lt;p&gt;The New York Times scooped a story on Monday revealing that Mr. Sibal and the &lt;a class="external-link" href="http://www.mit.gov.in/"&gt;MCIT&lt;/a&gt; had been &lt;a class="external-link" href="http://india.blogs.nytimes.com/2011/12/05/india-asks-google-facebook-others-to-screen-user-content/?scp=2&amp;amp;sq=kapil%20sibal&amp;amp;st=cse"&gt;in touch with Facebook, Google, Yahoo, and Microsoft&lt;/a&gt;, asking them to set up a system whereby they would manually filter user-generated content before it is published, to ensure that objectionable speech does not get published.  Specifically, he mentioned content that hurt people's religious sentiments and content that Member of Parliament Shashi Tharoor described as &lt;a class="external-link" href="http://zeenews.india.com/news/nation/i-am-against-web-censorship-shashi-tharoor_745587.html"&gt;'vile' and capable of inciting riots as being problems&lt;/a&gt;.  Lastly, Mr. Sibal defended this as not being "censorship" by the government, but "supervision" of user-generated content by the companies themselves.&lt;/p&gt;
&lt;h3&gt;Concerns &lt;br /&gt;&lt;/h3&gt;
&lt;p&gt;One need not give lectures on the benefits of free speech, and Mr. Sibal is clear that he does not wish to impinge upon it.  So one need not point out that freedom of speech means nothing if not the freedom to offend (as long as no harm is caused). There can, of course, be reasonable limitations on freedom of speech as provided in Article 19 of the &lt;a class="external-link" href="http://www2.ohchr.org/english/law/ccpr.htm"&gt;ICCPR&lt;/a&gt; and in Article 19(2) of our Constitution.  My problem lies elsewhere.&lt;/p&gt;
&lt;h3&gt;Secrecy &lt;br /&gt;&lt;/h3&gt;
&lt;p&gt;It is unfortunate that the New York Times has to be given credit for Mr. Sibal addressing a press conference on this issue (and he admitted as much). What he is proposing is not enforcement of existing rules and regulations, but of a new restriction on online speech.  This should have, in a democracy, been put out for wide-ranging public consultations first.&lt;/p&gt;
&lt;h3&gt;Making intermediaries responsible &lt;br /&gt;&lt;/h3&gt;
&lt;p&gt;The more fundamental disagreement is that over how the question of what should not be published should be decided, and how that decision should be  and how that should be carried out, and who can be held liable for unlawful speech.  I believe that "to make the intermediary liable for the user violating that code would, I think, not serve the larger interests of the market." Mr. Sibal said that in May this year &lt;a class="external-link" href="http://online.wsj.com/article/SB10001424052702304563104576355223687825048.html"&gt;in an interview with the Wall Street Journal&lt;/a&gt;. The intermediaries (that is, all persons and companies who transmit or host content on behalf of a third party), are but messengers just like a post office and do not exercise editorial control, unlike a newspaper.  (By all means prosecute Facebook, Google, Yahoo, and Microsoft whenever they have created unlawful content, have exercised editorial control over unlawful content, have incited and encouraged unlawful activities, or know after a court order or the like that they are hosting illegal content and still do not remove it.)

Newspapers have editors who can take responsibility for content published in the newspaper.  They can afford to, because the number of articles in a newspaper is limited.  YouTube, which has 48 hours of videos uploaded every minutes, cannot.  One wag suggested that Mr. Sibal was not suggesting a means of censorship, but of employment generation and social welfare for censors and editors.  To try and extend editorial duties to these 'intermediaries' by executive order or through 'forceful suggestions' to these companies cannot happen without amending s.79 of the Information Technology Act which ensures they are not to be held liable for their user's content: the users are.

Internet speech has, to my knowledge, and to date, has never caused a riot in India.  It is when it is translated into inflammatory speeches on the ground with megaphones that offensive speech, whether in books or on the Internet, actually become harmful, and those should be targeted instead.  And the same laws that apply to offline speech already apply online.  If such speech is inciting violence then the police can be contacted and a magistrate can take action.  Indeed, Internet companies like Facebook, Google, etc., exercise self-regulation already (excessively and wrongly, I feel sometimes).  Any person can flag any content on YouTube or Facebook as violating the site's terms of use.  Indeed, even images of breast-feeding mothers have been removed from Facebook on the basis of such complaints.  So it is mistaken to think that there is no self-regulation.  In two recent cases, the High Courts of Bombay (&lt;a href="https://cis-india.org/internet-governance/janhit-manch-v-union-of-india" class="internal-link" title="Janhit Manch &amp;amp; Ors. v. The Union of India"&gt;&lt;em&gt;Janhit Manch v. Union of India&lt;/em&gt;&lt;/a&gt;) and Madras (&lt;em&gt;R. Karthikeyan v. Union of India&lt;/em&gt;) refused to direct the government and intermediaries to police online content, saying that places an excessive burden on freedom of speech.&lt;/p&gt;
&lt;h3&gt;IT Rules, 2011 &lt;br /&gt;&lt;/h3&gt;
&lt;p&gt;In this regard, the IT Rules published in April 2011 are great offenders.  While speech that is 'disparaging' (while not being defamatory) is not prohibited by any statute, yet intermediaries  are required not to carry 'disparaging' speech, or speech to which the user has no right (how is this to be judged? do you have rights to the last joke that you forwarded?), or speech that promotes gambling (as the government of Sikkim does through the PlayWin lottery), and a myriad other kinds of speech that are not prohibited in print or on TV.  Who is to judge whether something is 'disparaging'?  The intermediary itself, on pain of being liable for prosecution if it is found have made the wrong decision.  And any person may send a notice to an intermediary to 'disable' content, which has to be done within 36 hours if the intermediary doesn't want to be held liable.  Worst of all, there is no requirement to inform the user whose content it is, nor to inform the public that the content is being removed.  It just disappears, into a memory hole.  It does not require a paranoid conspiracy theorist to see this as a grave threat to freedom of speech.

Many human rights activists and lawyers have made a very strong case that the IT Rules on Intermediary Due Diligence are unconstitutional.  Parliament still has an opportunity to reject these rules until the end of the 2012 budget session. Parliamentarians must act now to uphold their oaths to the Constitution.&lt;/p&gt;

    <title>Online Censorship: How Government should Approach Regulation of Speech</title>

&lt;p style="text-align: justify; "&gt;Sunil Abraham's article was &lt;a class="external-link" href="http://articles.economictimes.indiatimes.com/2012-12-02/news/35530550_1_internet-censorship-speech-unintended-consequences"&gt;published in the Economic Times&lt;/a&gt; on December 2, 2012.&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;Of course, we must get the basics right â€” bad law has to be amended, read down by courts or repealed, and bad implementation of law should be addressed via reform and capacity building for the police. But most importantly those in power must understand how to approach the regulation of speech.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;To begin with, speech is regulated across the world. Even in the US  â€” contrary to popular impression in India â€” speech is regulated both  online and offline.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;However, law is not the basis of most of  this regulation. Speech is largely regulated by social norms. Different  corners of our online and offline society have quite complex forms of  self-regulation.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The harm caused by speech is often proportionate  to the power of the person speaking â€” it maybe unacceptable for a  politician or a filmstar to make an inflammatory remark but that very  same utterance from an ordinary citizen may be totally fine.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;To  complicate matters, the very same speech by the very same person could  be harmful or harmless based on context. A newspaper editor may share  obscene jokes with friends in a bar, but may not take similar liberties  in an editorial.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The legal scholar Alan Dershowitz tells us, "The  best answer to bad speech is good speech." More recently the quote has  been amended, with "more speech" replacing "good speech".&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Censorship by the state has to be reserved for the rarest of rare  circumstances. This is because censorship usually results in unintended  consequences.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The "Streisand Effect", named after the  singer-actor Barbra Streisand, is one of these consequences wherein  attempts to hide or censor information only result in wider circulation  and greater publicity.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Maharashtra police's attempt to censor  the voices of two women has resulted in their speech being broadcast  across the nation on social and mainstream media. If the state had  instead focused on producing good speech and more speech, nobody would  have even heard of these women.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Circumventing Censorship&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Peer-to-peer technologies on the internet mimic the topology of human networks and can also precipitate unintended consequences when subject to regulation. John Gilmore, a respected free software developer, puts it succinctly: "The Net interprets censorship as damage and routes around it."&lt;br /&gt;&lt;br /&gt;Most of the internet censorship in the US is due to IPR-enforcement activities. This is why Christopher Soghoian, a leading privacy activist, attributes the massive adoption of privacy-enhancing technologies such as proxies and VPNs (virtual private networks) by American consumers to the crackdown on online piracy.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In India, and even when the government has had legitimate reasons to regulate speech, there have been unintended consequences.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;During the exodus of people from the North-east, the five SMS per day restriction imposed by the government resulted in another exodus from SMS to alternative messaging platforms such as BlackBerry Messenger (BBM), WhatsApp and Twitter.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In both cases the circumvention of censorship by the users has resulted in a worsening situation for law-enforcement organisations â€” VPNs and applications like WhatsApp are much more difficult to monitor and regulate.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Mixed Memes&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Regulation of speech also cannot be confused with cyber war or security. Speech can occasionally have security implications but that cannot be the basis for enlightened regulation.&lt;br /&gt;&lt;br /&gt;A cyber war expert may be tempted to think of censored content as weapons, but unlike weapons that usually remain lethal, content that can cause harm today may become completely harmless tomorrow. This is unlike a computer virus or malware. For example, during the exodus, the online edition of ET featured the complete list of 309 URLs that were in the four block orders issued by the government to ISPs.&lt;br /&gt;&lt;br /&gt;However, this did not result in fresh harm, demonstrating the fallacy of cyber war analogies. A cyber security expert, on the other hand, may be tempted to implement a 360Â° blanket surveillance to regulate speech, but as Gilmore again puts it, "If you're watching everybody, you're watching nobody."&lt;br /&gt;&lt;br /&gt;In short, if your answer to bad speech is more censorship, more surveillance and more regulation, then as the internet meme goes, "You're Doing It Wrong".&lt;/p&gt;

But is it feasible to pre-screen objectionable or provocative content, and reject it before posting so that there is no chance of such rumours?

&lt;p style="text-align: justify; "&gt;The government took the action after Home Minister RK Singh alleged that the exodus of northeastern people from southern states such as Bangalore, Mumbai and Pune was a result of the panic and rumours created because of the content uploaded on these websites, many according to him were created by elements across the border in Pakistan. Though many suspected that Mr Singh's claim was an excuse to save the government from its inefficiency in controlling the riots, and the exodus of the northeastern people who were seen boarding the trains to their home states with their belongings amid fears of reprisal attacks.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Was the action meant to pass on the inefficiency buck or not - the government has, at least, managed to shift the focus of the media from exodus to the debate - as to whether social networking sites or websites promoting hatred should be blocked or not - given the democratic rights of every citizen to freedom of speech and expression.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Around a hundred more websites have been reported promoting hate speech and &lt;a href="http://www.merinews.com/topics/business/Google"&gt;Google&lt;/a&gt;, &lt;a href="http://www.merinews.com/topics/business/facebook"&gt;Facebook&lt;/a&gt; and other social networking sites like &lt;a href="http://www.merinews.com/topics/business/Twitter"&gt;Twitter&lt;/a&gt; have been asked to remove such content as soon as possible but in this whole debate one question remains unanswered: How does removing a post from Twitter or Facebook make a difference, several hours after it was published? One might argue even an hour is enough for an inflammatory picture or comment to incite violence or hatred. As a consequence, one might demand that a comment is screened before it is posted on a website, otherwise it doesn't serve any purpose.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Whether pre-screening is technically possible, Pranesh Prakash maintains: "Given the amount of content uploaded on the larger social networks, pre-screening content is just not possible, while removal upon complaint is. They don't have editors like newspapers do; importantly, they shouldn't."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Perhaps, a mid way is to intervene prior to registration on social media websites. All those who register should be made aware of the content that's not permissible, and make them aware of relevant laws and repercussions of breaking them if their complicity is proved. Similarly, these sites can be asked by the Indian government to continuously remind registered users as well as general public, through mass media advertizing, about what kind of content is not permissible. The government, from its side, can strengthen cyber laws to empower sites such as Facebook and Twitter to curb posting of provocative content due to presence of these stringent laws.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Terming the government action unfortunate, Mr Prakash who is a programme manager with the Bangalore-based research and advocacy group, The Centre for Internet and Society believes that government botched up at so many levels. “I don't think the government should be going after Facebook, YouTube, or Twitter. It should be going to them, to work with them on removing content,” Mr Prakash suggests. "The larger social networks have dedicated complaints mechanisms, which the government could have asked them to run 24x7 for a few days, and to expedite that process, and both complained itself and asked the public to use the complaints process,” he adds.&lt;br /&gt; &lt;br /&gt; Though Pakistan has rubbished the claims that it has any role in fomenting trouble, but it has also asked the Indian government to provide it with evidence so that it could nab the accused. Whether or not there is any evidence is a secondary question, the primary blame will always rest with both the state and central governments who failed to stop the exodus of fear-stricken people from the northeast.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Experts like Mr Prakash are wondering why the government didn't pay back in the same coin by using the social media to dispel the rumours. “It is a pity that they notified a new policy to encourage governmental use of social media only today; they sorely needed it this last week,” Mr Prakash rues.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The government has blocked content related to thirty Twitter accounts but another surprising thing is that only accounts using the web interface have been blocked, and such accounts can still be accessed on BlackBerrys or other smartphones.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The only visible thing government did on ground when the exodus started taking place in Bangalore was the setting up of helplines but did they help in preventing the exodus - there are enough reasons to believe against it. "There were some complaints that the people attending some of these helplines could only speak in Kannada, and not the English or Hindi that people calling for help were expecting. Even such positive steps were executed badly." Mr Prakash informs.&lt;/p&gt;

    <title>No more blocking of entire websites?</title>

        &lt;b&gt;The Madras HC has taken one step to ensure that entire websites are no longer blocked, but it doesn't mean that arbitrary takedowns will cease. &lt;/b&gt;

&lt;p style="text-align: justify; "&gt;Vimeo’s back. As is Pastebin, and Pirate Bay and IsoHunt. For your, you know, legitimate file-sharing practices.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Having been approached by a consortium of Internet Service Providers, the Madras High Court has issued a welcome clarification of its “John Doe order” issued in favour of RK Productions for the films 3 and Dammu. Designed to protect against potential offences by yet-unidentified persons, the sweeping scope of the order left a very wide, undefined scope to ISPs dealing with potentially infringing material. The ISPs over-complied, a host of file-sharing websites were barred from Indian servers overnight — oh, and “Anonymous” got more annoyed. Note here that the vagueness of the order extended to not specifying any infringing websites in particular.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Following the representation from the ISPs, the Court has provided them a specific directive. The new order states that the interim injunction was granted only with respect to the particular URL which featured the infringing movie, and not the entire website. No more blocking entire websites — the ISPs are now required to be informed about the particulars of where the infringing movie is kept within 48 hours.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The clarification couldn’t have come at a more vital time, and will hopefully serve as a precedent to curb an alarming practice that can be traced back to 2002. Back then, the Delhi High Court was approached in a matter concerning the unauthorised transmission of Ten Sports by unlicensed cable operators. The result was the Court’s first John Doe order with respect to media transmission: a commissioner was appointed to search premises of unnamed cable operators and seize evidence by taking photographs and video films. This particular order was then relied on by the Court almost a decade later in pre-emptively injuncting piracy of UTV Software Communication’s Saat Khoon Maaf and Thank You. The trend escalated from there, with similar orders being obtained for a number of films including Don 2, Bodyguard, Kahaani and Department, to name a few.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Where the last few years have seen a steadily rising output of orders largely from the Delhi and Madras High Court, just last week it was the Bombay High Court that joined the fray. Approached by Viacom 18 Motion Pictures, it passed a John Doe pre-emptively banning the piracy of Viacom’s Gangs of Wasseypur prior to its June 22 release. Considering the Bombay High Court’s noted apprehension in granting ex-parte orders, this decision looked set to add further momentum to the John Doe juggernaut.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Instead, we get the Madras High Court’s welcome restraint. That vague injunctions are an abuse of process is a principle that has been noted time and again, with the Delhi High Court even noting that “vague and general injunction of anticipatory nature can never be granted”. This is coupled with the larger access to information and free speech issue that has been raised more vocally following the ire with the mass block of file-sharing websites. The antecedents to this scenario may well be the media infrastructure cases of the ‘50s and ‘60s, where newspaper content was indirectly being regulated by way of regulation of newsprint, advertisement space, etc. Recognising these indirect control mechanisms in their ultimate speech-restricting form, the Supreme Court struck them down as unreasonable restrictions to the right to free expression under Article 19(1)(a) of the Constitution.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Prevention isn’t always better than cure. The Madras High Court has thankfully taken one step in the direction. What is left dangling is the other big question — that of the intermediary rules. There may now be a barrier to blocking of entire websites in this manner, but as so many internet users have found, one doesn’t have to necessarily approach the Courts if they want internet service providers to take down content: the ISPs are happy to do that for free. As a Centre for Internet and Society study found, takedown requests sent to ISPs, no matter how trivial or flimsy, will for the most part be met by acquiescence of the order. Without appropriate checks and balances, the intermediary will over-comply.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While the ISPs’ intervention before the Madras High Court is an encouraging sign, it doesn’t mean that the arbitrary takedowns under the intermediary rules will cease to happen. The digital media site Medianama quotes an ISP representative citing concern that ISPs were being wrongfully vilified on the Internet — and (significantly) that it would adversely impact their business if video streaming was disabled for users. The same commercial considerations wouldn’t likely stand when it comes to the bit-by-bit requests that come forward under the IT rules. Along with focusing attention on the High Court’s clarification, we need to sustain the movement to strike down the intermediary rules and push for a more transparent and fair mechanism.&lt;/p&gt;

    <title>No Civil Society Members in the Cyber Regulations Advisory Committee</title>

        &lt;b&gt;The Government of India has taken our advice and reconstituted the Cyber Regulations Advisory Commitee. But there is no representation of Internet users, citizens, and consumers — only government and industry interests.&lt;/b&gt;
        &lt;p&gt;In multiple op-eds (&lt;a href="http://cis-india.org/internet-governance/blog/india-broken-internet-law-multistakeholderism"&gt;Indian Express&lt;/a&gt; and &lt;a href="http://cis-india.org/internet-governance/blog/livemint-opinion-november-28-2012-pranesh-prakash-fixing-indias-anarchic-it-act"&gt;Mint&lt;/a&gt;), I have pointed out the need for the government to reconstitute the &amp;quot;Cyber Regulations Advisory Committee&amp;quot; (CRAC) under section 88 of the Information Technology Act. That it be reconstituted along the model of the Brazilian Internet Steering Committee was also &lt;a href="http://docs.google.com/viewer?url=www.iigc.in%2Fhtm%2F2.pdf"&gt;part of the suggestions that CIS sent to the government&lt;/a&gt; after a &lt;a href="http://www.thehindu.com/todays-paper/tp-national/tp-newdelhi/government-to-hold-talks-with-stakeholders-on-internet-censorship/article3860393.ece"&gt;meeting FICCI had convened along with the government on September 4, 2012&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;Section 88 requires that people &amp;quot;representing the interests principally affected&amp;quot; by Internet policy or &amp;quot;having special knowledge of the subject matter&amp;quot; be present in this advisory body. The main function of the CRAC is to advise the the Central Government &amp;quot;either generally as regards any rules or for any other purpose connected with this Act&amp;quot;.&lt;/p&gt;
&lt;p&gt;Despite this important function, the CRAC had &amp;mdash; till November 2012 &amp;mdash; only ever met twice, &lt;a href="http://cis-india.org/internet-governance/resources/deity-response-to-rti-on-decisions-of-crac"&gt;both times in 2001&lt;/a&gt;. The response to an RTI informed us that the body had never provided any advice to the government.&lt;/p&gt;
&lt;h2 id="government-not-serious"&gt;Government Not Serious&lt;/h2&gt;
&lt;p&gt;The increasing pressure on the government for botching up Internet regulations has led it to reconstitute the CRAC. However, the list of members of the committee shows that the government is not serious about this committee representing &amp;quot;the interests primarily affected&amp;quot; by Internet policy.&lt;/p&gt;
&lt;p&gt;Importantly, this goes against the express wish of the Shri Kapil Sibal, the Union Minister for Communications and IT, who has repeatedly stated that he believes that Internet-related policymaking should be an inclusive process. Most recently, at the 2012 Internet Governance Forum he stated that we need systems that are:&lt;/p&gt;
&lt;blockquote&gt;
&amp;quot;collaborative, consultative, inclusive and consensual, for dealing with all public policies involving the Internet&amp;quot;
&lt;/blockquote&gt;

&lt;p&gt;Interestingly, despite the Hon'ble Minster verbally inviting civil society organizations (on November 23, 2012) for a meeting of the CRAC that happened on November 25, 2012, the Department of Electronics and Information Technology refused to send us invitations for the meeting.  This hints at a disconnect between the political and bureaucratic wings of the government, at least at some levels.&lt;/p&gt;
&lt;p&gt;Interestingly, this isn't the first time this has been pointed out. Na. Vijayashankar was levelling similar criticisms against the CRAC &lt;a href="http://www.naavi.org/cl_editorial/edit_18aug00_1.html"&gt;way back in August 2000&lt;/a&gt; when the original CRAC was constituted.&lt;/p&gt;
&lt;h2 id="breakdown-by-stakeholder-groupings"&gt;Breakdown by Stakeholder Groupings&lt;/h2&gt;
&lt;p&gt;While there is no one universal division of stakeholders in Internet governance, but four goups are widely recognized: governments (national and intergovernmental), industry, technical community, and civil society. Using that division, we get:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;Government - 15 out of 22 members&lt;/li&gt;
&lt;li&gt;Industry bodies - 6 out of 22 members&lt;/li&gt;
&lt;li&gt;Technical community / Academia - 1 out of 22 members&lt;/li&gt;
&lt;li&gt;Civil society - 0 out of 22 members.&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="text-align: justify; "&gt;The government said it needed to improve the way in which it dealt with issues such as Internet hate messages besides blog posts and SMSes that seek to create panic so that it’s not accused of trying to gag free speech.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"We all have agreed that we need some combination of self-regulation and government interventions. But we need to do it in a proper way,” said department of telecom secretary R. Chandrasekhar, while addressing a Federation of Indian Chambers of Commerce and Industry (Ficci) conference on the issue of “legitimate restrictions on freedom of online speech".&lt;/p&gt;

&lt;p&gt;The Union government has been facing allegations of censorship after it sought to contain messages that led to communal violence and a panicexodus by people from the north-eastern states in some cities.&lt;/p&gt;
&lt;p&gt;Last month, the government ordered the blocking of almost 310 web pages for content deemed to be attacking particular communities. According to a post by Pranesh Prakash of the Centre for Internet and Society, 33% of them were on Facebook, 28% on Google Inc.’s YouTube and around 10% on Twitter.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Defending the government move, Gulshan Rai, chief of the Computer Emergency Response Team (CERT-in), said it was the first time that the emergency provision of the Information Technology Act 2008 had been exercised. Even though the list was not drawn up by his agency, due scrutiny was carried out before issuing orders to block the sites.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;This came after allegations that government may have also blocked bona fide posts as it sought to block content related to the North-East.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Twitter accounts of some journalists and other individuals associated with and sympathetic to right-wing causes were blocked, according to a list published earlier by The Economic Times.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"This is certainly not the last time we are seeing such a situation, so meaningful ways to respond to such complex situations will have to be devised," said Chandrasekhar.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He added that there was also a need to collaborate better with all stakeholders to devise not just defensive strategies during a crisis but also ways to contain its impact using the social media.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Ankhi Das, head of public policy at Facebook India, said that during the London riots of 2011, the UK government enlisted the support of social networking sites to dispel rumours.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"Social media can also be allies of the government at times like this," she said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Raman Jit Singh Cheema, a senior policy analyst at Google India, cited a similar example of authorities in Japan using such methods to send out correct information following the tsunami that hit the country in 2011.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"We need to collaborate on a continuing basis, so that when you are faced with such a crisis, you are able to deal with it," said Chandrasekhar.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The government has been facing allegations of Internet censorship for over a year after minister for communication and information technology Kapil Sibal raised the issue of regulating social networking sites. They had allegedly not complied with the government’s demand that offensive content be removed.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Chandrasekhar said that processes should be clearer, more transparent and well-defined.&lt;/p&gt;

    <title>NE exodus: List containing 309 blocked URLs leaks online </title>

&lt;p style="text-align: justify; "&gt;The aforementioned URLs comprise URLs, Twitter accounts, img tags, blog posts, blogs and a handful of websites, and were blocked between August 18, 2012 till August 21, 2012. In an analysis that Pranesh Prakash, programme manager at the Centre for Internet and Society (CIS), carried of the leaked items, among other things in his post, he wrote that, "It is clear that the list was not compiled with sufficient care."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In his post, he further noted that the censorship process itself has been riddled with egregious mistakes. Giving instances of the egregious mistakes, he added that even some people and posts debunking the rumours were blocked as part of the censorship. Further, he wrote that some of the items that were blocked were not even web addresses (e.g., a few HTML img tags were included). In his findings, Prakash also found that despite there having been a clear warning issued by the DIT pertaining to the blocking of "above URLs only" and not that of main websites, like www.facebook.com, www.youtube.com, some ISPs (like Airtel) went "overboard in their blocking". This incident,  in particular pertains to yesterday's reports, wherein it had been revealed that Airtel had blocked the entire YouTube short URL youtu.be in some cities.&lt;/p&gt;
&lt;p&gt;On account of the sensitivity of the issue, he writes that it &lt;i&gt;"would be premature to share the whole list&lt;/i&gt;." He, however, writes that CIS plans to make the entire list public soon. The list that CIS has released, however includes -&lt;/p&gt;

He adds that some ISPs may not have begun enforcing the blocks yet. &lt;i&gt;"This analysis is based on the orders sent around to ISPs, and not on the basis of actual testing of how many of these have actually been blocked by Airtel, BSNL, Tata, etc. Additionally, if you are using Twitter through a client (on your desktop, mobile, etc.) instead of the web interface, you will not notice any of the Twitter-related blocks," &lt;/i&gt;he elaborated further.&lt;/p&gt;

    <title>MPs to be taught ‘draconian’ IT Act Rules as India.net support galvanises for annul motion</title>

&lt;p&gt;Rajya Sabha’s member of parliament (MP) from Kerala, P Rajeeve, whose &lt;a class="external-link" href="http://164.100.47.5/newsite/bulletin2/Bull_No.aspx?number=49472"&gt;statutory motion&lt;/a&gt; to annul the IT (Intermediaries Guidelines) Rules 2011 is slated for discussion in Parliament tomorrow, aims to convene a meeting of MPs, internet societies, and bloggers in the first week of May to create awareness against the &lt;a class="external-link" href="http://www.legallyindia.com/201201182502/Legal-opinions/sopa-blackout-day-bah-wheres-the-kolaveri-about-indias-it-act-intermediaries-rules"&gt;draconian effect&lt;/a&gt; of the rules.&lt;/p&gt;
&lt;p&gt;“Most of the MPs need to know about this,” Rajeeve told Legally India, explaining that statutory motions are generally not easy to pass. “Actually we are trying to create awareness by organizing a session. The issue will be the IT Rules 2011 and how it is against the constitution, how it is against natural justice, how it is against due process of law.”&lt;br /&gt;&lt;br /&gt;“The motion has been accepted. The committee has allotted time for discussion on the twenty fourth. Thereafter it will come to the house. In this part of the session I am trying to coordinate other MPs to get support”, he said.&lt;/p&gt;
&lt;p&gt;Rajeeve’s motion of 23 March 2012, as first reported by &lt;a href="https://cis-india.org/internet-governance/blog/statutory-motion-against-intermediary-guidelines-rules/" class="external-link"&gt;CIS-India&lt;/a&gt;, was not his first attempt at bringing the IT rules into the spotlight. When the rules were in draft stage, he had made a &lt;a class="external-link" href="http://rajeev.in/pages/..%5CNews%5Ccensorship_Blogs%5CBloggers_Internet.html"&gt;zero hour mention&lt;/a&gt; against them for being in violation of freedom of speech and expression, by over-scrutinising bloggers, over-authorising intermediaries, and letting the government, individuals and institutions by-pass the due process of law.&lt;/p&gt;
&lt;p&gt;Rajeeve was one of the nine panelists in the open discussion on “Resisting Internet Censorship”, organised by the Centre for Internet and Society (CIS) and Foundation for Media Professionals, in Bangalore on Saturday, 21 April. The discussion, addressing an audience of 40, was moderated by veteran journalist Paranjoy Guha Thakurta.&lt;/p&gt;
&lt;p&gt;Other panelists included Mahesh Murthy, founder of digital marketing website Pinstorm, Sudhir Krishnaswamy, founding member of Centre for Law and Policy Research, Na Vijayashankar, director of Cyber Law College, and Siddharth Narain from the Alternative Law Forum.&lt;/p&gt;
&lt;p&gt;Also on the panel were Rishabh Dara,&lt;a class="external-link" href="http://www.google.com/policyfellowship/"&gt; Google policy fellow&lt;/a&gt; who conducted &lt;a href="https://cis-india.org/internet-governance/intermediary-liability-in-india" class="external-link"&gt;a study last year on intermediary liability in India and its chilling effects on free expression&lt;/a&gt;, BG Mahesh, founder of Oneindia.com, Ram Bhat, co-founder of community media collective Maraa, and Pranesh Prakash, programme manager at CIS.&lt;/p&gt;
&lt;p&gt;Prakash said that the discussion brought together different perspectives, even those of the entrepreneur, like BG Mahesh and Mahesh Murthy. “Transparency in the terms of censorship is good. We are not saying all censorship is bad, but that it should be transparent.”&lt;/p&gt;
&lt;p&gt;Prakash told Legally India about the various experiences shared by panelists, of the lack of transparency in the present system of censorship. While one faced harassment by the police over trivial procedural compliances, there was complaint for defamation against an article syndicated by another from a different publication’s press release. “And we read the article over and over and over again but couldn’t find anything which was remotely defamatory.”&lt;br /&gt;&lt;br /&gt;Legal experts on the panel, Kirshnaswamy and Vijayashankar, spoke about the constitutionalism behind free speech provisions. Narain shed light on the fact that while excessive energy has been expended on highlighting which content should not be banned, little has been spent on examining the operative procedures behind censorship.&lt;br /&gt;&lt;br /&gt;Dara spoke about his research and how it not only revealed that content was being frivolously removed on complaints to intermediaries, but also that the people whose content was being removed were not being informed of the same. There was no public notice of the removal.&lt;br /&gt;&lt;br /&gt;Bhat’s discourse drew attention to the history of censorship in India and elicited the fact that the Indian press has in fact been censored in an upsetting manner even since the revolt of 1857.&lt;/p&gt;
&lt;p&gt;Murthy made the observation that statistically speaking, in India the number of internet users exceeds television watchers, which has made social media unfathomably important while the internet is no longer elitist.&lt;br /&gt;&lt;br /&gt;A number of related Indian initiatives have been gathering momentum in recent months, such as&amp;nbsp;&lt;a class="external-link" href="http://softwarefreedom.in/index.php?option=com_content&amp;amp;view=article&amp;amp;id=97:campaign-for-freedom-on-the-internet&amp;amp;Itemid=83"&gt; signature campaigns&lt;/a&gt; for &lt;a class="external-link" href="https://www.change.org/petitions/mps-of-india-support-the-annulment-motion-to-protect-internet-freedom-stopitrules"&gt;internet freedom&lt;/a&gt;, and offline protests such as the &lt;a class="external-link" href="http://friendsofinternet.wikispaces.com/"&gt;Free Software Movement in Karnataka&lt;/a&gt; and the &lt;a class="external-link" href="http://kafila.org/2012/04/21/freedom-in-the-cage-22-april-2012/"&gt;Save your Voice in Delhi&lt;/a&gt;, are the order of the day. Other actions include &lt;a class="external-link" href="http://www.legallyindia.com/201201182502/Legal-opinions/sopa-blackout-day-bah-wheres-the-kolaveri-about-indias-it-act-intermediaries-rules"&gt;writing to MPs&lt;/a&gt;, asking them to vote in favor of Rajeeve’s statutory motion for annulment of the IT rules.&lt;/p&gt;
&lt;p&gt;Kerala-based advocate Shojan Jacob filed the f&lt;a class="external-link" href="http://www.legallyindia.com/201203062622/Bar-Bench-Litigation/read-first-writ-challenging-censorious-it-act-intermediaries-rules-in-kerala"&gt;irst ever writ challenging the rules&lt;/a&gt; in the Kerala High Court last month.&lt;/p&gt;
&lt;p&gt;The rules enable any individual or public or private institution to get content removed from websites, in most cases simply by notifying the website owners or intermediaries such as Google, Yahoo and others.&lt;/p&gt;
&lt;p&gt;Takedown requests can be based on any of &lt;a class="external-link" href="http://www.legallyindia.com/201201182502/Legal-opinions/sopa-blackout-day-bah-wheres-the-kolaveri-about-indias-it-act-intermediaries-rules"&gt;15 vaguely drafted parameters&lt;/a&gt;, without stating any reasons or requiring any judicial or quasi-judicial order in support.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;A research, or a sting operation, conducted by researchers at the Centre for Internet and Society in October 2011 — a few months after the Information Technology (Intermediary Guidelines) Rules were notified — revealed some inherent flaws in the guidelines laid down by the Indian government. The results of the study made news, particularly after Union Minister for IT, Kapil Sibal, asked Internet companies and Web service providers to screen content.&lt;br /&gt;&lt;br /&gt;The study revealed that companies were only too eager to comply with take-down notices or requests, in order to avoid further hassles, particularly legal ones.&lt;br /&gt;&lt;br /&gt;Rishab Dara, a researcher who was part of this ‘sting', pointed out that unless the content was commercial, or had potential commercial interest, companies preferred to err on the side of caution.&lt;br /&gt;&lt;br /&gt;Addressing an audience at a panel discussion, titled ‘Resisting Internet censorship: strategies for furthering freedom of expression in India', held at the Bangalore International Centre, Mr. Dara pointed out that search engines did not invest enough resources to check how valid the claims were, before taking down over 2,000 URLs related to a random complaint or take-down notice sent by them. His study underlined the need for debate and discussion on the intermediary guidelines, locating this in the larger context of freedom on the Web.&lt;br /&gt;&lt;br /&gt;The discussion, organised by the Centre for Internet and Society, was moderated by the former journalist and academic, Paranjoy Guha Thakurta. The audience and the panel comprised a diverse lot: from students, netizens and academics to those who were directly involved in the business of publishing content or hosting Web content. While a substantial part of the discussion dealt with the legal aspects of the notified rules, and how it may contradict the constitutional rights of citizens, a section of the debate also delved into whether the Web as a medium needed to be policed at all.&lt;br /&gt;&lt;br /&gt;If panellist Mahesh Murthy, Chief Executive Officer of Pinstorm, argued vociferously for unfettered freedom on the Web and accused the government of being threatened by movements such as the anti-corruption campaign led by Anna Hazare (which he said was largely mobilised on the Web), another panellist Na. Vijayshankar, Cyber Law College, who claimed he was among those instrumental in bringing down the pornographic cartoon portal Savitabhabhi.com, argued that though these rules need to be withdrawn, there are “boundaries” to what can be posted and said on the Web.&lt;br /&gt;&lt;br /&gt;Another section of the audience brought up the issues of hate speech on the Web, and pointed out that in some cases there was a need to pin liability on those who generate content that incites hatred.&lt;br /&gt;&lt;br /&gt;Sudhir Krishnaswamy, Centre for Law and Policy Research, pointed out that currently the way the issue was being played out in court, the discourse was more about companies.&lt;br /&gt;&lt;br /&gt;“The debate is not about users today. Companies are trying to duck liabilities, rather than deal with substantive issues of free speech,” he said, pointing to the complexities in locating liability for content.&lt;br /&gt;&lt;br /&gt;Speaking from the publisher's perspective, B.G. Mahesh, OneIndia.in, an online news and entertainment portal, spoke of specific cases where his portal had been targeted by the Chennai Cybercrime cell for hosting a news story (syndicated from a news agency) that was declared defamatory. “We took it down, but there was no answer from them when we asked for an explanation,” he said, adding that in such cases there is tremendous pressure and harassment from authorities, leaving publishers with no choice but to comply.&lt;br /&gt;&lt;br /&gt;Though the IT intermediary rules were notified in April 2011, the issue made headlines when Union Minister for Information and Communication Technology Kapil Sibal asked private companies or Web service providers to pre-screen content, a statement which he later withdrew.&lt;br /&gt;&lt;br /&gt;Also discussed in detail were the complexities posed by a medium like the World Wide Web, and what were the reasonable restrictions to free speech on the Web. Does one need a separate legal dispensation to deal with this medium, Mr. Thakurta asked. While emphasising that the solution does not lie in “knee-jerk reactions”, such as the rules that have been proposed, he pointed out that the bid to control flow of information was a simple manifestation of the utter helplessness and inability of the government — and governments worldwide — to control the Web. Be it in West Bengal, where a professor is held for sharing a cartoon, or with the Union government that beckons corporates to pre-screen the Web, these acts are a manifestation of a “combination of arrogance and stupidity”, he said.&lt;br /&gt;&lt;br /&gt;Subsequently, in February, Rajya Sabha member from Kerala, P. Rajeeve, moved a statutory motion in the Rajya Sabha seeking that these guidelines be annulled on the grounds that it allowed intermediaries protection from legal liability in return for trading away freedom of expression of users.&lt;br /&gt;&lt;br /&gt;In the Parliamentary session that will start next week, this is likely to come up for discussion, and across the country, rights activists are mobilising support and lobbying with legislators to garner support for this annulment.&lt;/p&gt;

        &lt;b&gt;The Centre for Internet and Society sent the following mail to ICANN regarding their attempt to impose their own charter for a Noncommercial Stakeholder Group (NCSG), instead of accepting the one drafted by the Noncommercial Users Constituency (NCUC).&lt;/b&gt;
        
&lt;p&gt;Dear Sir or Madam,&lt;/p&gt;
&lt;p&gt;Greetings from the Centre for Internet and Society - Bangalore. We are a Bangalore based research and advocacy organisation promoting consumer and citizen rights on the Internet. We currently focus on IPR reform, IPR alternatives and electronic accessibility by the disabled. Please see our website &amp;lt;http://cis-india.org&amp;gt; for more information about us and our activities.&lt;/p&gt;
&lt;p&gt;It has come to our attention that ICANN is imposing the ICANN staff-drafted charter for a Noncommercial Stakeholder Group (NCSG) and ignoring the version drafted by civil society. As you know, the civil society version was drafted using a consensus process and more than 80 international noncommercial organizations, including mine, support it.&lt;/p&gt;
&lt;p&gt;This is an unacceptable situation since the governance structures contained within the NCSG charter determine how effectively noncommercial users can influence policy decisions at ICANN in years to come. On behalf of Internet users in India - I would strongly urge you to reject the staff drafted version of the charter and adopt the version drafted and endorsed by civil society.&lt;/p&gt;
