Life of a Tuple: National Register of Citizens (NRC) and the Reform of Citizen Identification Infrastructure in Assam

We are proud to announce that a research grant from the Azim Premji University has enabled us to initiate a study of the updation process of the National Register of Citizens (NRC) in Assam, and the resultant reform of citizen identification infrastructure in India. The study is being led by Khetrimayum Monish and Ranjit Singh, along with Sumandro Chattapadhyay.

The research focuses on two specific aspects of the NRC update:

Challenges of legal citizenship: In this context, we will investigate the constitutional acts and provisions for making citizenship claims in India, the historical narratives of identity politics in Assam and its culmination in the exercise of updating the NRC.

Challenges of procedurally implementing the NRC update: Here, we plan to explore the subsequent design process of updating the register.

Starting with the first aspect of legally defining Indian citizenship, the project will document and discuss the various legal processes of defining the bureaucratic process of updating NRC that emerge along two sets of concerns at different levels of Indian government. First, at the state level, we will explore the socio-political tensions around illegal immigration from Bangladesh and the history of identity-based politics in Assam. Second, at the level of the central government, we plan to investigate the constitutional and legal rules and provisions that are used to define citizenship in India.

Learning through Archives: A Colloquium on Digital Scholarship

Learn it Yourself

The peer-to-peer world of online learning encourages conversations and reciprocal learning, writes Nishant Shah in an article published in the Indian Express on 30 October 2011.

Technologies and learning have always had a close link. In the past, distance learning programmes of higher education through the postal service, remote education programmes using satellite TV and interactive learning projects using information and communication infrastructure, have all been deployed with varied results in promoting literacy and higher education. In the last two decades, the internet has also joined this technology ecology in trying to provide quality and affordable education to remotely located areas through “citizen service centres” envisioned to reach 6,40,000 Indian villages in the future.

These technology-based information outreach programmes expand the ability of traditional formal learning centres like universities, to cater to the needs of those who might not have access to learning resources. This vision of networked education relies on existing systems of centralised syllabus making, teacher-to-student information transfer, grade-based evaluation and accreditation systems, and a degree-centred approach to learning.

I was in New York last week, at an international summit on the future of learning, Mobility Shifts, organised by the New School, where more than 260 speakers from 21 countries discussed the possibility of learning beyond the bounds of the school and university system. Many discussions were around the declining public education system (with huge disinvestment moves from the government), privatisation of education, increasing tuition and fees, and the non-relevance of current education. However, along with this digital expansion of the traditional education system is an emerging trend that challenges the ways in which we understand education and learning – DIY Learning or Do It Yourself Learning.

DIY Learning is a product of the networked condition. It recognises that as more people get onto digital information networks, there is a possibility of producing peer-to-peer learning conditions, which do not have to follow our accepted models of learning and education.

We have seen the rise of various decentralised and democratised knowledge repositories like Wikipedia. The search based algorithms of search engines also take into consideration the idea that knowledge is personal. User generated content sites like eHow.com show that the individual learner is not merely a recipient of information and knowledge. Information seeking spaces like Quora have shown that knowledge-sharing communities can incite new conditions of learning. Our contexts, experiences, everyday practices, aspirations etc. equip us with valuable information, which not only shape how we learn but also what we find relevant to learn for ourselves. DIY Learning picks up on the idea that the infrastructure of education is not necessarily designed towards learning. Learning often happens outside the classrooms, in informal conversations.

Thus DIY Learning offers a new model of learning. It destabilises the established hierarchy of knowledge production and pedagogy and creates an each-one-teach-one model with a twist. Instead of a centralised board of curriculum designer who shape syllabi for the “average” student, you have the possibility of customised, highly individual, interest-based learning curricula where the student is a part of deciding what s/he wants to learn. DIY Learning doesn’t recognise the distinctions between teachers and students, but recognises them as “peers” within a network, encouraging conversations and reciprocal learning rather than information transfer based classroom models. Instead of mass-produced education that caters only to an imagined average, the DIY Learning model recognises that within the same student group, there are different rates and scales of learning, thus offering environments suited to the aptitude of the students.

Within the DIY Learning model, aspects of education, from the design of curriculum and learning methods, to grading and evaluation are geared towards individual preferences and aspirations.

Many people think of DIY Learning as an alternative to mainstream learning processes and structures. However, it is perhaps more fruitful to think of DIY Learning as a way of figuring out the problems that beset our traditional educational system. It allows us to rethink the relationships between learning, education, teaching and technologies. It recalibrates the space of the classroom and reconfigures the role of the teacher and the student.

DIY Learning emphasises that merely building schools and universities is not enough to assure that learning happens. Learning happens through experiences, practice, conversations, internalisations and through making mistakes. DIY Learning offers these possibilities in an education universe that is constantly refusing to take risks, innovate and adapt to the needs of the present. By itself it might not be able to take on the roles and functions of the existing education systems. But it does warn us that we are preparing our students for our pasts rather than their futures. And the time to change is now.

Launch of Public Juris (An Online Archive of Legal Resources)

Aparna Balachandran, Rochelle Pinto, and Abhijit Bhattacharya announce the launch of Public Juris, an online archive of legal resources.

We are pleased to announce the launch of Public Juris, an online archive of legal sources and would like to elicit the active participation of the scholarly community in conceptualizing and building Public Juris as a site where we are able to provide access to material needed for law and social science research in South Asia. We would very much appreciate feedback, support and collaboration as we develop this project.

Who we are: We are two historians (Rochelle Pinto and Aparna Balachandran, Centre for the Study of Culture and Society, Bangalore) and an archivist (Abhijit Bhattacharya, Centre for the Study of Social Sciences, Kolkata) who are interested in issues of technology, users and access in relation to state and private archives in India (see blog).

The Project: We are soliciting contributions for an online digital archive of legal sources called “Public Juris” focusing on, but not limited to, South Asia. We hope this archive will be a useful and easily accessible resource for historians and other scholars interested in the study of different aspects of the law. We see this archive as particularly useful to students and teachers in South Asia and elsewhere who for logistical, economic or political reasons may not be able to travel to libraries and archives in order to access material of this kind. Eventually, we envisage that an online archive of this kind will allow students to broaden the thematic and regional range of their research.

How it will work: We do not have any strict definition of what constitute legal sources — they could range from acts and regulations to court cases, police records and petitions. For example, one set of records that has already been contributed to the archive centres on disputes over ceremonial privileges between the Valangi and Idangai castes in the city of Madras in the early nineteenth century. Documents that are not usually archived, such as leaflets, pamphlets, people’s enquiry reports, photographs, and advertisements, but which are critical to understanding the relationship between law and the public, can also find a space here. The material could be in any language.

As a community of scholars we are in possession of resources that can be harnessed usefully and inexpensively. All of us, for instance, have material collected from different locations that we have already used for our research or which is simply superfluous. This research could be shared. Since the archive inevitably leaves different traces for specific readings by different researchers, our research material could be put to other uses in other works. Hence, just as the Centre for the Study of Law and Governance has asked for your writings for their library, we would like to extend our request for collaborative energies within the LASS community to contribute to constructing a shared resource. Please do claim authorship of this archive by sharing with us material that you think should define and belongs in Public Juris.

Modalities: If you would like to contribute to this online archive, we request you to either bring the material with you when you attend the inaugural LASSNET conference in January, or if you prefer, send it by post to the Centre for Internet and Society (Centre for Internet and Society, No. D2, 3rd Floor, Sheriff Chambers, 14, Cunningham Road, Bangalore, Karnataka 560052, India). We will undertake to scan the material and make it available on the Public Juris website which is in the process of being constructed and designed. Labouring (on) the app: agency and organisation of work in the platform economy

Ambika Tandon and Abhishek Sekharan published an academic paper highlighting the importance of women’s networks of information sharing and care in navigating opaque platform design. The paper is part of an issue of Gender and Development on ‘Women, Work and the Digital Economy’. Gender and Development is one of the few academic journals that priorities practitioners' experiences over theoretical contributions.

Abstract

Women have a long history of organising in the informal economy, despite facing several challenges around geographical dispersion, time poverty, and lack of recognition. These challenges persist in the platform economy which pose similar concerns around precarious irregular work. Recent literature has documented the adoption of traditional and novel strategies to resist platform exploitation, through algorithmic manipulation, public demonstrations and logout strikes, and legal action. This paper explores the gendered realities that shape workers’ organising strategies and demands.

Using protests organised by women beauty workers in India as a case study, we discuss the factors underlying and leading to collectivisation. We find that women’s networks of information sharing and care are instrumental in navigating opaque and inefficient algorithms that fail to determine fully the organisation of work. We further examine the role of informal networks of information sharing in building workers’ identities which are instrumental in collective organising. Finally, we discuss the strategies and forms of organising adopted by women workers in this sector, which resonate with the rich history of organising in the informal economy.

Korean Trans Cine-Media in Global Contexts: Asia and the World

Nishant Shah will be participating in this event as part of our collaboration with the Inter Asia Cultural Studies consortium, to launch a new research cluster around trans-cine-media in the global context along with Kim SoYoung and Earl Jackson. He will speak on "The Asian Intercourse : Reimagining the Inter-Asia moment through ‘net-porn’ In networks".

The conference is a response to what we see as a new epistemic shift, a new possibility for the reading of Korean cinema and Korean media texts. The previous “discovery” or “acceptance” of Im Kwon-Taek at Cannes, and the ambivalent Japanese obsession with “Winter Sonata” are moments in a recognition of Korean textual achievements that, at best, maintain a hierarchical (and highly circumscribed) “tolerance” of Korean cultural production. The subsequent achievements of other directors such as Pak Chan-wook and Kim Ki-duk deepened and expanded the hermeneutic situation internationally – a tendency that has continued in recent European conferences dedicated to Korean auteurs and most recently, Kim Ki-duk’s receiving the Golden Lion at the Venice Film Festival.

Moreover, Korean transformations of Japanese media texts have advanced a new kind of alchemical conversation across media that engages both the present and the past in new, multi-vocal ways. Beyond these mass-media events that can capture the attention of journalists, is the years of work of the scholars involved with the decentering of film history and canon in the work of scholars such the late Paul Willemen. And in addition to the “external” legitimation of the international film festival circuit are the internal developments within Korean cinema – namely the recent resurgence of a vital and engaged independent cinema – in both fiction documentary films. These events create an environment in which we can return anew to Korean cinema- past, present, and future – to read and realize in ways not-here-to-fore possible.

These readings will include taking Korean cinema seriously on its own terms, but also to set Korean cinema in dialogue with other East Asian Cinemas in a global context.

The outcome of the conference will be contributed to the project entitled as “A Compendium of History of Korean Cinema” sponsored by National Research Foundation of Korea.

Kashmir’s digital blackout marks a period darker than the dark side of the moon

While we mourn the loss of connection with the moon, remembering a digital blackout closer home.

When the news came, I was struck with a profound sense of loss. The iced coffee on my desk wept condensed tears as social media started flooding with the news that we have lost contact. There is a complete communication blackout. The last minutes which were the most critical, are now shrouded in mystery. We are doing all we can to reach out, to ping, to find a way to get some information — any information — that tells us that things are all right. People are waiting with bated breath to see if a connection will be made. There is widespread anxiety that comes from knowing that something historic has happened but there is a complete lack of knowledge about it.

At this point, all attempts at trying to get more information are proving to be futile. The devices that we have pinned our optimism to — seldom remembering that hardware fails — and the streams of communication that have become our digital default have let us down. At this point, in the absence of any clean data, we will be clinging to straws. Maybe one solitary ping will tell us that things are all right. We have given up on long stories, but just a cough, a sneeze, a chortle, a hiccup — anything right now, that tells us there is hope, there is a future, there is a tomorrow where we might be able to take back control, would be welcome. Scientists, journalists, politicians, and the common person on the street, all wait to hear more. But as of now, all we get, as we persistently update our screens and push at buttons, is silence.

That silence breaks us. To reach out and get nothing back. To have the entire infrastructure of digital and satellite communication and see it turn to nothing but technojunk in the split of a second. To depend, now, on the unknown — not sure what happens to those who cannot be heard and also those who wait to hear — is unnerving. We fill up the silences with many things — assurances from the Prime Minister about how this is a temporary glitch and we will do better; analysis from media about what could and would have gone wrong in this mission; opinions from people questioning the validity of this move and also bemoaning the validity of our expertise and knowhow; the viral cries of triumph from those who see this as a step in the right direction.

However, it is undeniable that the silence fills us up with sense of grief and loss, making us wonder what the future will hold. And this is not just an individual future but a collective one, where we start realising how technological control and regulation can define and determine our conditions of speech, silence, and connection. It is the moment where we question our brute optimism in science and technology and our soaring ambitions of impossible sounding futures, of singularity and connectivity.

Oh, and while I was trying to process the silence of stifled speech and throttled thoughts in Kashmir, which has been under an information and digital blackout for more than a month now, the news of the Chandrayaan-2’s possible failure and the last minute non-responsiveness from the Vikram lander also trickled in. When the lunar mission news unfolded, I earnestly thought that people were talking about Kashmir — so emotional, passionate, and human, was their interest in the well-being of the exploring robot. Had it landed safely? Was it still chugging along? Was it hurt? Did it get a lunar pellet stuck in its skin?

It took me a while to process that the outpourings of grief and optimism were about the loss of the robotic vehicle’s data stream and not about the loss of voices from Kashmir. I had to reorient my thoughts to figure out that the disconnection from moon was more urgent than the disconnection from people who have been silenced through digital tyrannies. It did give me a pause to realise that the fate of a hurt robot on the moon seemed to generate more concern than the fate of hurt generations of people in the paradise on earth that we have sequestered from the external world.

I had to figure out why the Chandrayaan, made in India and a triumph of our space programme, was a global event, whereas the violation of universal human rights through a technological blackout was still internal matters. This technological silence, which will hopefully be a temporary disruption, and, at the most, an expensive lesson for future space missions, refuses to take my attention. I will go back to listening for a sign of voice, of hope, of dignity, and of respect from Kashmir, where the digital blackout continues to mark a period darker than the dark side of the moon.

Karnataka’s uniform fare policy—Do attempts at parity consider the impact on workers?

While policy interventions towards parity is a welcome step, the article highlights how inequalities and systemic barriers to parity remain for workers.

Calling for a worker justice lens to policy imaginations of parity

The Karnataka transport department’s February 2024 policy on uniform fares for aggregator (app-based) taxis and all other taxis is an encouraging step towards addressing disparities created by market-dominant platforms such as Ola Cabs and Uber. In a first, the policy attempts to bring parity between the app-based and offline taxi sectors by setting the same base and per kilometre fares for both categories. It also looks at a novel aspect of regulating app-based platforms through the prohibition of surge pricing.

This article views the policy against workers’ experiences with platforms’ management and income distribution practices. Policies such as these may well be one of many attempts to draw parity between aggregator platforms and other offline taxi firms. Yet, we find that workers have barely featured in these conversations of transport policy, whether on parity or otherwise.

The fare policy has been welcomed by some workers’ organisations as fulfilling a key demand for uniformity. However, it still remains silent on actual systemic issues and impacts for workers on platforms. This is a pressing issue in light of how workers face the worst impacts of platform practices that extract value and create disparities. CIS’ surveys showed that workers worked over 84 hours a week whilst only earning a median of Rs 5,000. For over half of them, these earnings were not sufficient to cover even basic household expenses. Further reflecting their vulnerability, 28% of workers had access to workplace accident insurance, and an even lower 6% had access to health insurance, while 57% depended on the government for benefits like food rations.

Operational and algorithmic accountability within a policy agenda on labour and data rights are inextricably linked to curbing disparities driven by dominant aggregator platforms. There is a need therefore to ensure that uniform fare policies are not limited only to customers, but also consider potential impacts on workers.

Cybersecurity, Privacy, and Emerging Technology

Following the MCA notification mandating disclosures of crypto currency holdings by companies, Aryan Gupta, in an issue brief, discusses the policy landscape in the United States of America, United Kingdom, and Japan with particular emphasis upon definition, accounting practices, and taxation, with respect to crypto currencies. We submitted comments in response to the Supreme Court E-committee’s draft vision document of phase III of the E-courts project. Aman Nair, Arinjay Vyas, Pallavi Bedi and Garima Saxena submitted their general comments and recommendations, and comparatively analysed the integration of digital technology into the judiciary in both South Asia and Africa. Google’s new Privacy Sandbox platform promises to preserve anonymity when serving tailored advertising. But does this new framework help users in any way? Maria Jawed’s analysis reveals that Google’s gambit to reorient the ad-tech ecosystem under the garb of privacy, ultimately ends up undermining it. [link]
Pandemic technology is taking a toll on data privacy, especially in the absence of any legal framework; these tools are being used for purposes beyond managing the pandemic. In an article published in the Deccan Herald, Aman Nair and Pallavi Bedi argue that India’s digital response to the pandemic has stoked concerns that surveillance could pose threats to the privacy of the personal data collected. In a piece for The Wire, Aman Nair analyses Tether, a lesser known crypto currency that is at the heart of a $3 trillion market. Issued by Tether Limited, Tether forms the foundation for modern day crypto trading and could potentially be one of the biggest schemes in financial history. [link]
India has 500 million internet users — over a third of its total population — making it the country with the second largest number of internet users after China. With this comes several kinds of digital threats that an average digital consumer in India must regularly contend with. Pranav M.B. attempts to identify the existing state of digital safety in India, with a report that maps digital threats in the country. [link]
Since last year, there have been regular questions around the anti-competitive practices of digital platforms. After 46 US states filed an antitrust case against Facebook along with the Federal Trade Commission (FTC) in December 2020, Kamesh Shekar analyzed these developments in a blog post. [link]
Recently, the Indian government mandated online messaging providers to enable identification of originators of messages on their platforms. In an academic paper for the NUJS Law Review, Gurshabad Grover, Tanaya Rajwade and Divyank Katira conduct a legal and constitutional analysis of this ‘traceability’ requirement, how it can be implemented, and how these methods come with serious costs to usability, security, and privacy. The National Digital Health Mission: Health Data Management Policy seeks to establish a digital health ecosystem by creating a unique health identity (UHID) for every Indian citizen. Pallavi Bedi points out that hasty implementation of the policy without adequate safeguards not only risks the privacy and security of medical data, but also undermines trust in the system leading to low uptake. The recent “Infodemic” clearly shows that disinformation costs people’s lives. CIS, and the Global Disinformation Index have published a report that examines the risk of disinformation on digital news platforms in India, creating an index that is intended to serve donors and stakeholders with a neutral assessment of news sites that they can utilise to defund disinformation. Torsha Sarkar, Gurshabad Grover, Raghav Ahooja, Pallavi Bedi and Divyank Katira examine the legality and constitutionality of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, highlighting potential benefits and harms that may arise from the rules, and making recommendations to retain the rules within constitutional bounds, and retain consistency with human rights based approaches to content regulation. The passage of the Intermediary Liability Rules, 2021, has also formalized the legal requirement for the utilization of automated tools in content moderation. In a blog-post for the KU Leuven’s Centre for IT and IP (CITIP) Blog, Shweta Mohandas and Torsha Sarkar analyze the requirement in light of concerns of freedom of expression of Internet users. [link]
Our comments to the Cinematograph (Amendment) Bill, 2021, authored by Tanvi Apte, Anubha Sinha, and Torsha Sarkar, examine the constitutionality and legality of the Bill and whether the proposed amendments are compatible with established constitutional principles, precedents, previous policy positions and existing law. Tanvi Apte and Torsha Sarkar, in a submission to the Facebook Oversight Board in Case 2021-008-FB-FBR: Brazil, Health Misinformation and Lockdowns, answer questions set out by the Board which concerned a post made by a Brazilian sub-national health official, and raised questions on health misinformation and enforcement of Facebook's community standards. In an essay for the Indian Journal of Law and Technology (IJLT), Torsha Sarkar analyzes issues rising out of the recent litigation between Trump and Twitter. Torsha examines intermediary liability issues under American law, and draws parallel for India, in light of the ongoing litigation around the suspension of advocate Sanjay Hegde’s Twitter account. Copyright & Access to Knowledge

The Indian Parliamentary Standing Committee on Commerce’s report weighs on several aspects of the Indian IPR system and issues of protection and enforcement. In a blog post, Anubha Sinha summarily notes the observations and recommendations of the Committee on the Copyright Act, 1957 which stand to impact access to knowledge. [link]
The 41st edition of the Standing Committee on Copyright and Related Rights (SCCR) organized by the World Intellectual Property Organization (WIPO) was held from 28 June to 1 July. Anubha Sinha participated in the event as a speaker and delivered statements on the Protection of Broadcasting Organisations [link], and on Limitations and Exceptions [link]. The CIS Access to Knowledge team published a comparative analysis of two prominent Wikimedia initiatives, Wikipedia Asian Month and Project Tiger, to understand prevailing challenges and opportunities, and strategies to address the same. Nitesh Gill in a two-part report outlines the research questions and methods of this study [link], and then presents some of the observations and learnings [link].

Labour and Social Justice

In a flagship report on domestic and care workers on digital platforms, Aayush Rathi and Ambika Tandon argue that digital platforms are complicit in discriminating against workers on the basis of their identities, and that domestic workers continue to remain in precarious positions without any legal recognition or support. This work was jointly authored between the Centre for Internet and Society and the Domestic Workers’ Rights Union. [link]
The ongoing pandemic has raised very valid questions of access and infrastructure in India, especially during a time when the Internet and digital technologies are essential, and in many ways the ‘new normal’. P.P. Sneha and Anasuya Sengupta write in Seminar Magazine, outlining some key challenges in digitalisation and representation of non-dominant/marginalised languages on the Internet, through reflections on two recent projects related to languages and the Internet. With the onset of the national lockdown on 24th March 2020 in response to the outbreak of COVID-19, the fate of millions of migrant workers was left uncertain. In addition, lack of enumeration and registration of migrant workers became a major obstacle for all state governments and the Central Government to channelize relief and welfare measures. Ankan Barman compiled a report to qualitatively assess health conditions of migrant workers and access to welfare during the first COVID-19 lockdown, in three host-states, Tamil Nadu, Maharashtra and Haryana. Between July to November 2019, Indian Federation of App-based Transport Workers (IFAT) and International Transport Workers’ Federation (ITF) conducted 2,128 surveys across six major cities: Bengaluru, Chennai, Delhi NCR, Hyderabad, Jaipur, and Lucknow, to determine the occupational health and safety of app-based transport workers. Findings from the survey have been compiled as a report which reveals the complete absence of social security and protection of workers in a digital platform economy. [link]

Highlights

Balbharati – the Maharashtra state bureau of textbook production and curriculum research – has issued a copyright policy that forces all publishers, digital educational-content creators, and coaching classes to obtain expensive licenses for developing material directly or indirectly relating to Balbharati’s content. This is an alarming development for Indian students reported Anubha Sinha in an article in the Asian Times on June 20, 2018.
CIS-A2K has started dialogue with the publishers for the last 6 months regarding FOSS, Open knowledge and content donation to Wikimedia Projects. As a result Akhil Bharatiya Marathi Prakashak Sangh, an apex body of publishers at all India level invited us for a orientation session at their annual gathering in Pune.
Submitted comments on the Draft Digital Communications Policy which was released to the public by the Department of Telecommunications of the Ministry of Communications on 1st May 2018 for comments and views.
Submitted comments on the Telecom Commercial Communications Customer Preference Regulations which was released to the public by the Telecom Regulatory Authority of India (TRAI) on 29th May 2018 for comments and views.
The Task Force on Artificial Intelligence was established by the Ministry of Commerce and Industry to leverage AI for economic benefits, and provide policy recommendations on the deployment of AI for India. Elonnai Hickok, Shweta Mohandas and Swaraj Paul Barooah wrote a blog entry on the artificial intelligence task force. The blog entry was edited by Swagam Dasgupta.
The world’s oldest networked infrastructure, money, is increasingly dematerialising and fusing with the world’s latest networked infrastructure, the Internet, wrote Sunil Abraham in an article published in the Economic Times on June 10, 2018.
An essay by P.P. Sneha was published in Summer Hill, a journal published by Indian Institute of Advanced Study. In the essay, edited by Dr. Bindu Menon, Sneha draws upon excerpts from a study on the field of digital humanities and related practices in India, to outline the diverse contexts of humanities practice with the advent of the digital and explore the developing discourse around digital humanities in the Indian context.
The inaugural conference of the Digital Humanities Alliance of India (DHAI) was held at the Indian Institute of Management (IIM), Indore on June 1-2, 2018. P.P. Sneha was a keynote speaker at the event. Her talk was titled ‘New Contexts and Sites of Humanities Practice in the Digital’.

Access to Knowledge

Access to Knowledge (A2K) is a campaign to promote the fundamental principles of justice, freedom, and economic development. It deals with issues like copyrights, patents and trademarks, which are an important part of the digital landscape. Our A2K program comprises 2 projects: Pervasive Technologies done under a grant from International Development Research Centre examining interplay between cost-effective pervasive technologies and intellectual property and encouraging development of such technologies for social good, and Wikipedia under a grant from Wikimedia Foundation to enable the growth of Indic language communities and cultivate new editors in different Indian languages.

Internet Governance

The Tunis Agenda of the second World Summit on the Information Society has defined internet governance as the development and application by governments, the private sector and civil society, in their respective roles of shared principles, norms, rules, decision making procedures and programs that shape the evolution and use of the internet. CIS is engaged in two different projects. The first one (under a grant from Privacy International and IDRC) is on surveillance and freedom of expression (SAFEGUARDS). The second one (under a grant from MacArthur Foundation) is on restrictions that the Indian government has placed on freedom of expression online.

Our newsletter for the month of June 2013 can be accessed below.

The Centre for Internet & Society (CIS) welcomes you to the sixth issue of its newsletter for 2013. Hivos published a White Paper by Nishant Shah titled Whose Change is it Anyway?, which attempts to reflect critically on existing patterns of making change and its implications for the future of citizen action in information and network societies. The Access to Knowledge team carried out a quantitative analysis to identify trends and growth patterns in Indian Language Wikipedias from September 2012 to April 2013. CIS drafted the Privacy Protection Bill and amended it as per feedback gained from the New Delhi, Bangalore, and Chennai Privacy Roundtable Events. CIS made closing statement on the Treaty for the Blind at the WIPO Diplomatic Conference which was concluded with the adoption of the Marrakesh Treaty to Facilitate Access to Published Works for Persons who are Blind, Visually Impaired, or otherwise Print Disabled. In a research paper Nehaa Chaudhari gives an analysis of patent pools, Sameer Boray gives an analysis of video piracy and Pranav Menon gives an analysis of India-EU FTA and issues surrounding data protection and security. In this period we organised the Institute on Internet and Society with support from the Ford Foundation at Golden Palms, Bangalore from June 8 to 14, 2013.

Celebrating 5 Years of CIS
CIS is now 5 years old and we just celebrated this by holding an open exhibition in our offices in Bangalore and Delhi from May 20 to 23, showcasing our work and accomplishments over the period. We had about 170 visitors from the general public coming in to our office. Videos of the event are here.

CIS is doing two projects in partnership with the Hans Foundation. Access to Knowledge and Openness

The Wikimedia Foundation has given a grant to CIS to support and develop the growth of Indic language communities and projects by community collaborations and partnerships. This is being carried out by the Access to Knowledge team based in Delhi. CIS is also doing a project (Pervasive Technologies) on examining the relationship between production of pervasive technologies and intellectual property. The conference concluded with the adoption of the Marrakesh Treaty to facilitate access to published works by blind persons, persons with visual impairment, and other print disabled persons, by requiring mandatory exceptions in copyright law to enable conversions of books into accessible formats, and by enabling cross-border transfer of accessible format books. Knowledge Repository on Internet Access

Highlights for July 2019
CIS presented its comments on the proposed rules 29,30,31 of the Draft Copyright (Amendment) Rules, 2019 to the Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, Govt. of India. The comments were made in response to Notification G.S.R 393(E) published in the Gazette of India on May 30, 2019. CIS submitted that in the domestic approach to modernising our copyright legislation, we must refrain from considering distribution of born-digital/ digitised works over the public Internet equivalent to the function of broadcasting works over cable/ satellite. The Indian National Trust for Art & Heritage Pune Chapter is working with various organisations to preserve the natural heritage places like rivers in Pune district of Maharashtra, India. After the presentation of 'Project Jalbodh' by CIS-A2K in River Dialogue organised by INTACH in April 2018, several organisations have shown keen interest in collaboration. Subodh Kulkarni shares some insights in his report. ICANN has Advisory Committees which help guide the policy recommendations that the ICANN community develops while its Supporting Organizations are charged with developing policy recommendations for a particular aspect of ICANN's operations. ICANN publishes a combined budget for all these bodies under the head of policy development. CIS inquired about the financial resources allocated to each of them specifically. CIS in partnership with the Internet Society organized an event on the impact of consolidation in the Internet economy. It was divided into two roundtable discussions, the first one focusing on the policies and regulation while the latter dealt with the technical evolution of the Internet. The roundtables aimed to analyze how growing forces of consolidation, including concentration, vertical and horizontal integration, and barriers to market entry and competition would influence the Internet in the next 3 to 5 years. The report by Akriti Bopanna and Gurshabad Grover provides an insight into the developments. As part of its Researchers at work programme on key thematics at the intersections of internet and society, CIS called for abstracts for essays that explore social, economic, cultural, political, infrastructural, or aesthetic dimensions of the ‘list’. Ten abstracts would be shortlisted by August 9 from the list of submissions and the selected authors would be requested to submit the full essay of their draft by September 15. Final versions of the essays are expected to be published in October. With the rise and popularity of app-based platforms such as Ola, Uber, Swiggy Zomato, and others, there is a growing public conversation about regulation of such 'gig-work' platforms and the working conditions of people who work for them. To explore this further CIS conducted a panel discussion at its Bangalore office. Researchers associated with the project presented their preliminary findings. Panelists preliminary field insights along with reflections on what it meant to do such studies, how they went about studying gig-work, and challenges that arose in their work. An excerpt from an essay by Maya Indira Ganesh, written for and published as part of the Bodies of Evidence collection of Deep Dives titled You auto-complete me: romancing the bot explains human relations with bots. The Bodies of Evidence collection, edited by Bishakha Datta and Richa Kaul Padte, is a collaboration between Point of View and the Centre for Internet and Society, undertaken as part of the Big Data for Development Network supported by International Development Research Centre, Canada.

Internet Governance

The Tunis Agenda of the second World Summit on the Information Society has defined internet governance as the development and application by governments, the private sector and civil society, in their respective roles of shared principles, norms, rules, decision making procedures and programmes that shape the evolution and use of the Internet. As part of internet governance work we work on policy issues relating to freedom of expression primarily focusing on the Information Technology Act and issues of liability of intermediaries for unlawful speech and simultaneously ensuring that the right to privacy is safeguarded as well.

Telecom

The growth in telecommunications in India has been impressive. While the potential for growth and returns exist, a range of issues need to be addressed for this potential to be realized. One aspect is more extensive rural coverage and the second aspect is a countrywide access to broadband which is low at about eight million subscriptions. Both require effective and efficient use of networks and resources, including spectrum.

Highlights

Paul Kurien and Akriti Bopanna carried out an analysis of the diversity of participation at the ICANN processes by taking a close look at their mailing lists.
CIS-A2K organized 6 events: partnership discussions with Misimi Telugu monthly magazine; partnership activity in Annamayya Library, Guntur, a workshop in Tumakur University; a workshop of river activists for building Jal Bodh; a workshop of publishers and writers on unicode, open source and wikimedia projects; and a Telugu literary conference.
CIS had worked with the Research and Advisory Group (RAG) of the Global Commission on the Stability of Cyberspace (GCSC). The work looked at the negotiation processes and strategies that various players may adopt as they drive the cyber norms agenda. In continuation CIS has brought out a report which focuses more extensively on the substantive law and principles at play and looks closely at what the global state of the debate means for India.
The debate surrounding privacy has in recent times gained momentum due to the Aadhaar judgement and the growing concerns around the use of personal data by corporations and governments. In this light CIS has made comments and recommendations to the India Privacy Code, 2018.
CIS drafted a response to a Notice of Inquiry (NOI) issued by the U.S. Commerce Department's National Telecommunications and Information Administration (NTIA) on "International Internet Policy Priorities." CIS commented on the free flow of information and jurisdiction, mult-stakeholder approach to internet governance, privacy and security.
Elonnai Hickok, Shweta Mohandas and Swaraj Paul Barooah compiled the AI Task Force Report, India's first step towards an AI framework. The Task Force on Artificial Intelligence was established by the Ministry of Commerce and Industry to leverage AI for economic benefits, and provide policy recommendations on the deployment of AI for India.

The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

Internet Governance

As part of its research on privacy and free speech, CIS is engaged with two different projects. The first one (under a grant from Privacy International and IDRC) is on surveillance and freedom of expression (SAFEGUARDS). The second one (under a grant from MacArthur Foundation) is on restrictions that the Indian government has placed on freedom of expression online.

Highlights
In an article published in the Huffington Post on July 1, 2017, Nirmita Narasimhan stated that imposing taxes on assistive devices is unfair. It is unconscionable that disability aids and assistive technology are considered a luxury and taxed at a higher rate than rough semi-precious stones or cashew nuts. A research paper on patent working requirements and complex products in India authored by Prof Jorge L. Contreras, University of Utah, and Rohini Lakshané, CIS has been accepted for publication in the Jindal Global Law School Law Review 2017. Negotiators from 16 countries met in Hyderabad for discussing a free trade agreement titled Regional Comprehensive Economic Partnership. Anubha Sinha along with Arul George Scaria reported this in an article published by Live Law.in. Supreme Court of India while dismissing an appeal by the Indian Reprographic Rights Organization ruled that there was no copyright infringement and no licence was required since the activities fell under the education exception in Indian copyright law. In an article published by EIFL, Anubha Sinha discusses the judgment and what it means for access to educational materials in India. Odia Wikipedians, in conjunction with Indian Athletics Federation and Sports and Youth Services collaborated to document the 2017 Asian Athletics Championships. Hundreds of photos were uploaded and new Wikipedia content added to inform the event’s fans, wrote Sailesh Patnaik and Jnanaranjan Sahu in a blog post. As recently as May 27, 2016, the General Data Protection Regulation (REGULATION (EU) 2016/679 was adopted The Data Protection Directive (1995/46/EC) will be replaced by this Regulation. It is expected that under this Regulation data privacy will be strengthened. Aditi Chaturvedi analyses the developments in a report.

India has an estimated 70 million persons with disabilities who don't have access to read printed materials due to some form of physical, sensory, cognitive or other disability. As part of our endeavour to make available accessible content for persons with disabilities, we are developing a text-to-speech software in 15 languages with support from the Hans Foundation. The progress made so far in the project can be accessed here.

As part of the project grant from the Wikimedia Foundation we have reached out to more than 3500 people across India by organizing more than 100 outreach events and catalysed the release of encyclopaedic and other content under the Creative Commons (CC-BY-3.0) license in four Indian languages (21 books in Telugu, 13 in Odia, 4 volumes of encyclopaedia in Konkani and 6 volumes in Kannada, and 1 book on Odia language history in English).
