    <title>Blocking Twitter: How Internet Service Providers &amp; telcos were caught between tweets and tall egos</title>

&lt;p style="text-align: justify; "&gt;&lt;span id="advenueINTEXT"&gt;In  the fight between netizens who spare no effort at lampooning the powers  that be and alarmingly frequent government flashes of rage at comments  that can range from the mildly disrespectful to downright defamatory,  telcos and ISPs find themselves much like the grass in the age-old  Swahili saying "When two elephants fight, it's the grass that suffers". &lt;br /&gt;&lt;br /&gt; The latest reminder of the hard place they find themselves in came  earlier this week when news first broke that the government had asked  for some accounts on social media site Twitter to also be part of  websites and Internet pages it wanted blocked by ISPs. The news  triggered a wave of outrage across cyberspace, with many users venting  their rage at the first entity they associate the web with - their ISP,  which in many cases is also their telecom operator. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;&lt;span id="advenueINTEXT"&gt;"We  acted immediately to the government's orders, but ended up being  targetted and criticised wrongly only because we acted first," explained  one official, who sought anonymity for himself and the company to avoid  offending bureaucrats. &lt;br /&gt;&lt;br /&gt; It's a common feeling. Telcos and ISPs  are increasingly finding themselves in a 'Damned if you do, Damned if  you don't' predicament these days, having to walk a tightrope between  government orders and a restive netizenry. &lt;br /&gt;&lt;br /&gt; And government  orders can range from the super-urgent to arbitrary to sometimes  ill-conceived. Very often, its 'one ban fits all' makes little allowance  for differences between social networking sites and regular websites. &lt;br /&gt;&lt;br /&gt; Executives in telecom companies recounted the instance when the  government on August 18 ordered a ban on bulk SMSes and restricted text  messages to five per day as part of efforts to combat the large-scale  migration of people of north-eastern origins from other states to their  home provinces fearing reprisal attacks. &lt;br /&gt;&lt;br /&gt; "Within an hour of the directive, we started getting calls seeking compliance," said a top executive with a leading &lt;a href="http://timesofindia.indiatimes.com/topic/telco"&gt;&lt;span&gt;telco&lt;/span&gt;&lt;/a&gt;.  But as the Centre was demanding compliance reports, operators were busy  trying to decipher its notification, which read: "(a) Block bulk SMS  (more than 5) for the next 15 days in the entire country across all  states/UTs (b) Block bulk MMS (more than 5) and all MMS with attachment  more than 25 KB for the next 15 days in the entire country across all  states/UTs." &lt;br /&gt;&lt;br /&gt; &lt;b&gt;Shoot first, talk later &lt;/b&gt; &lt;br /&gt;&lt;br /&gt; Telecom operators were nonplussed by the notification. Did it apply  only to senders of bulk text messages who use this facility for  commercial purposes? Or, did it mean customers could not send SMSes to  more than five people simultaneously? &lt;br /&gt;&lt;br /&gt; "When we sought  clarification, the explanation was completely different and took a new  dimension. It was five text messages per day per customer," said the  regulatory head of a GSM operator, requesting anonymity as he did not  want to offend the government. &lt;br /&gt;&lt;br /&gt; Mobile phone companies then  approached the department of telecom explaining that they did not have  any technology with which they could impose a five SMSes a day limit for  postpaid users. "The home and telecom ministries had not even realised  that a facility did not exist before issuing the directive," said the  marketing head of a leading telco. &lt;br /&gt;&lt;br /&gt; In this case, the government  accepted the operator's arguments and relented, but still told the  companies not to highlight the limitation. "This time around, our  arguments were accepted. Going by past instances, some operators had  feared that the government would slap a hefty penalty for non-compliance  without considering what we had to say," the marketing head said. &lt;br /&gt;&lt;br /&gt; Industry officials say the tendency of 'shoot first, talk later' among  bureaucrats and ministers long used to having their orders followed,  especially when it came to the world of social networking which very few  of them had any idea about, meant that it was safer to obey first and  correct later. &lt;br /&gt;&lt;br /&gt; "We don't even do any application of mind to the  government's notices on requests. We wholesale block them. We can't  even question the government's requests. A notice is a law in effect.  Violation means a potential penalty which can go up to the cancellation  of my licence and thus end to my business," said the head of a  Delhi-based ISP that serves business users. &lt;br /&gt;&lt;br /&gt; Executives with  several ISPs and telcos say most often, court orders, government  notifications and directives are not in public domain, and these result  in angry consumers assuming that their service provider is up to some  mischief. &lt;br /&gt;&lt;br /&gt; ISPs say public clarifications by the government  would go a long way in addressing the issue. "There has to be  transparency. The government should have proactively disclosed the names  of the websites it wanted blocked. The persons and intermediaries  hosting the content should have been notified and provided with 48 hours  to respond as required by the &lt;a href="http://timesofindia.indiatimes.com/topic/IT-Act"&gt;&lt;span&gt;IT Act&lt;/span&gt;&lt;/a&gt;," said &lt;a href="http://timesofindia.indiatimes.com/topic/Pranesh-Prakash"&gt;&lt;span&gt;Pranesh Prakash&lt;/span&gt;&lt;/a&gt; of the Centre for Internet and Society, a research organisation. &lt;/span&gt;&lt;span id="advenueINTEXT"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

    <title>Blocked websites: Where India flawed</title>

&lt;p style="text-align: justify; "&gt;India is threatening to block Twitter as the latter has allegedly failed to respond to the government's order to remove some inflammatory posts.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;That has come to light as it is being widely covered in media, but there are hundreds of websites which have already been shut, apparently without due notice to the owners.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Apart from Facebook, Twitter and YouTube accounts, the blocked websites include which are sympathetic to Hindu and Muslim radical groups.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In an &lt;a href="http://www.ciol.com/News/News-Reports/Blocked-websites-Where-India-flawed/165165/0/%28http:/cis-india.org/internet-governance/blog/analysing-blocked-sites-riots-communalism%29" shape="rect" target="_self"&gt;analysis of 309 websites&lt;/a&gt; blocked in the wake of exodus of North eastern people from Bangalore, Pranesh Prakash of the Centre for Internet and Society (CIS), says the government has blocked these sites under the Information Technology Act, but it failed to provide the mandatory 48 hours to respond (under Rule 8 of the Information Technology Procedure and Safeguards for Blocking for Access of Information by Public, Rules 2009).&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He writes in his post: "The persons and intermediaries hosting the content should have been notified. Even if the emergency provision (Rule 9) was used, the block issued on August 18, 2012, should have been introduced before the "Committee for Examination of Request" by August 20, 2012 (within 48 hours), and that committee should have notified the persons and intermediaries hosting the content.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Internet censorship is acceptable as long as it is in the purview of the law and doesn't encroach one's freedom. In this case, some people and posts debunking rumours have been blocked, says Pranesh.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He points to some discrepancies in the way the websites are blocked:&lt;/p&gt;
&lt;ol&gt;
&lt;li style="text-align: justify; "&gt;Some of the items are not even web addresses (e.g., a few HTML img tags were included). Some of the items they have tried to block do not even exist (e.g., one of the Wikipedia URLs).&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;An entire domain was blocked on Sunday, and a single post on that domain was blocked on Monday.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;For some YouTube videos, the 'base' URL of YouTube videos is blocked, but for other the URL with various parameters (like the "&amp;amp;related=" parameter) is blocked. That means that even nominally 'blocked' videos will be freely accessible.&lt;/li&gt;
&lt;/ol&gt;
&lt;p style="text-align: justify; "&gt;He concludes: "All in all, it is clear that the list was not compiled with sufficient care."&lt;/p&gt;

&lt;p class="mceContentBody documentContent" style="text-align: justify; "&gt;Experts said the public display of extreme views on a  social networking platform has the potential to create social unrest,  leaving the government with few options but to regulate content, in turn  fuelling the Internet censorship debate further.&lt;/p&gt;
&lt;p class="mceContentBody documentContent" style="text-align: justify; "&gt;A senior government official said that in a situation in  which there are serious national security implications, the government  has no option but to "block content" in order to stop communal sentiment  from flaring up.&lt;/p&gt;
&lt;p class="mceContentBody documentContent" style="text-align: justify; "&gt;According to social web analytics firm Social Hues, the tweets reached an audience of 456,000 followers. However, according to &lt;span class="person"&gt;&lt;a href="http://www.livemint.com/Search/Link/Keyword/Vinita%20Ananth"&gt;Vinita Ananth&lt;/a&gt;&lt;/span&gt;,  chief executive of Social Hues, there were also messages that "condemned the call for ShauryaDiwas” tagging it ShameDiwas. "New  platforms like Twitter are providing real-time feedback on public  sentiment, which is unprecedented."&lt;span class="person"&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p class="mceContentBody documentContent" style="text-align: justify; "&gt;&lt;span class="person"&gt;&lt;a href="http://www.livemint.com/Search/Link/Keyword/Ashis%20Nandy"&gt;Ashis Nandy&lt;/a&gt;&lt;/span&gt;,  political and social analyst, said that even though very few Indians  are on platforms such as Twitter, communications over them give a hint  of what a certain section of the society is thinking about.&lt;/p&gt;
&lt;p class="mceContentBody documentContent" style="text-align: justify; "&gt;"It is a small representation of the middle class, which  is driven by ideology and some of the people with extreme opinions may  also belong to this group, so perhaps it could have some security  implications," he said.&lt;/p&gt;
&lt;p class="mceContentBody documentContent" style="text-align: justify; "&gt;Fringe groups such as those above tend to take extreme positions to get attention, said &lt;span class="person"&gt;&lt;a href="http://www.livemint.com/Search/Link/Keyword/Sunil%20Abraham"&gt;Sunil Abraham&lt;/a&gt;&lt;/span&gt;, executive director of Bangalore-based research organization, the Centre for Internet and Society.&lt;/p&gt;
&lt;p class="mceContentBody documentContent" style="text-align: justify; "&gt;Having learnt their lessons after the recent  Assam-related panic, intelligence agencies are now keeping a close watch  on the Internet, another government official said.&lt;/p&gt;
&lt;p class="mceContentBody documentContent" style="text-align: justify; "&gt;"If necessary, posts will be removed through legitimate  ways," the official said, adding that a debate was underway about how to  strike a balance between freedom of speech and the lawful requirement  of agencies. "Mischief by a few people creates nuisance in society. The  government is now looking for ways through which it can regionally block  or remove inflammatory tweets. We don’t want to curb freedom of speech  and the government doesn’t have any such intentions either," the  official said.&lt;/p&gt;
&lt;p class="mceContentBody documentContent" style="text-align: justify; "&gt;Hate messages on social media had sparked a panic exodus  of people from the north-east from cities such as Bangalore, Pune and  Chennai in August.&lt;/p&gt;

    <title>Arrests over Facebook posts: Why we’re on a dangerous slide</title>

        &lt;b&gt;The most bizarre thing about the arrest of Shaheen Dhada and Renu Srinivasan on Monday over  a Facebook post that questioned the wisdom of a bandh to mark Shiv Sena leader Bal Thackeray‘s death is that no laws were actually violated by the post.&lt;/b&gt;
        &lt;hr /&gt;
&lt;p&gt;Venky Vembu's &lt;a class="external-link" href="http://www.firstpost.com/politics/arrests-over-facebook-posts-why-were-on-a-dangerous-slide-528537.html"&gt;article was published in FirstPos&lt;/a&gt;t on November 20, 2012. Pranesh Prakash is quoted.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;In tone and in content, the post is remarkably restrained, particularly when compared to the rather more incendiary messages that  are commonplace on social media platforms. Nor was it even halfways defamatory in the way that many rants on Twitter and Facebook have unfortunately come to be.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Yet, the Mumbai police appear to have cravenly capitulated in the face of some arm-twisting by a local Sena strongman and gone ahead to arrest the two young women on charges that seem laughable even given the extraordinarily sweeping, catch-all clauses of the Information Technology Act.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is hard to see how Shaheen Dhada violated the two sections of the law under which she has been charged – Section 295A of the Indian Penal Code (“outraging religous feelings of any class”) or even the draconian Section 66A of the IT Act (“sending offensive messages through communication service, etc.”) – with her contemplative post, or what crimes Renu Srinivasan committed in merely ‘liking’ the post.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But it is a sign of the disquieting nature of the provision of the law, and the perverse manner in which it is being implemented, that there weren’t adequate checks and balances to inhibit the wilful deployment  of the law on such frivolous grounds. Ironically, the goons who actually wrecked the clinic of Dhada’s uncle haven’t been called to account.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;If that is bad enough, it is doubly perverse  for Kapil Sibal to claim in all innocence that he is “deeply saddened” by the arrest of the two young women and to insinuate that the IT Act, which he was instrumental in passing, was being misused on grounds of improper implementation.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The fact of it is that the IT Act that he fathered, and particularly &lt;a href="https://cis-india.org/internet-governance/resources/section-66A-information-technology-act" target="_blank"&gt;the notorious Section 66A&lt;/a&gt;, was deliberately worded to give maximum potential for mischief. There have been far too many egregious instances of its misuse by discredited governments and politicians for Sibal to claim that these are random incidents of misuse of the law. Just last month, Finance Minister P Chidambaram’s son Karti had a Puducherry businessmen and anti-corruption activist hauled up by the police for a Twitter post in which the businessman alleged that Karti had “amassed more wealth” than &lt;a href="http://www.firstpost.com/topic/person/sonia-gandhi-profile-2030.html" target="_self"&gt;Sonia Gandhi&lt;/a&gt;‘s son-in-law.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It’s important to get a sense of why the latest arrests take us further on the slippery slope towards curtailing free speech. Justice Markandeya Katju has repeatedly pointed to the egregious encroachment on the freedom of speech by this provision of law, and has been vocal in calling both  politicians and policemen to account whenever the law is abused in this manner.&lt;/p&gt;
&lt;p&gt;“It is absurd to say that protesting against the bandh hurts religious sentiments,” Katju observed in a letter to the Maharashtra Chief Minister. “Under Article 19 of our Constitution, freedom of speech is guaranteed fundamental right. We are living in a democracy, not a fascist dictatorship.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;If anything, Katju argued, “this arrest itself appears to be a criminal act since under Sections 341 and 342, it is a crime to wrongfully arrest or wrongfully confine someone who has committed no crime.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;As Pranesh Prakash at the Centre for Internet and Society &lt;a href="http://kafila.org/2012/11/19/social-media-regulation-vs-suppression-of-freedom-of-speech-pranesh-prakash/" target="_blank"&gt;points out&lt;/a&gt;, in the context of Monday’s arrests, “This should not be seen merely as ‘social media regulation’, but as a restriction on freedom of speech and expression by both the law and the police.” Section 66A, he says, makes certain kinds of speech-activities (“causing annoyance”) illegal if communicated online, but legal if that same speech-activity is published in a newspaper.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;This distinction is important, Prakash notes, since the mere fact that it was a Facebook status update “should not grant Shaheen Dhada any special immunity”. If anything, it is the fact that her update is not  punishable under Section 295 of the IPC or of Section 66A of the IT Act that should give her the immunity, he adds.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;With each instance in which Section 66A of the IT Act is being invoked, the potential for mischief embedded in the law is being exposed. Monday’s arrests – of two young women for crimes they did not even commit – are the most brazen instance of their abuse.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Of course, the perverse provision of law has been abused in the real world through selective and arbitrary invocation of the law. But the original sin lies in the law itself. It is the most potent threat to free speech online, and if the law isn’t amended to throw out these perverse provisions, India can kiss goodbye to any lingering pretensions to being a democracy of any sort.&lt;/p&gt;

        &lt;b&gt;The arrest of 21-year-old Shaheen Dhada over her Facebook status update questioning the shutdown of Mumbai over Shiv Sena supremo Bal Thackeray‘s death, is a clear misapplication of section 295 A of the Indian Penal Code (“outrage religious feelings of any class”), according to Pranesh Prakash of the Centre for Internet and Society.&lt;/b&gt;

&lt;p style="text-align: justify; "&gt;The article was &lt;a class="external-link" href="http://www.firstpost.com/india/arrest-of-girl-over-thackeray-fb-update-clear-misuse-of-sec-295a-527779.html"&gt;published in FirstPost &lt;/a&gt;on November 19, 2012. Pranesh Prakash is quoted.&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;In comments to Firstpost, Prakash said that this law had been misused numerous times in the state of Maharashtra.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“Even the banning of James Laine’s book &lt;i&gt;Shivaji&lt;/i&gt; happened under section 295 A, and the ban was subsequently held to have been unlawful. What makes this seem ironic, and almost a parodic news report, is the fact that &lt;a href="http://www.firstpost.com/topic/person/bal-thackeray-profile-22424.html" target="_blank"&gt;Bal Thackeray&lt;/a&gt; probably violated this provision more times than most other politicians, but was only charged under it once or twice”, he said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Dhada’s status update reportedly read, “People like Thackeray are born and die daily and one should not observe a bandh for that.” A friend of hers who ‘liked’ the comment was also arrested.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Prakash said that the arrest called for a discussion on the regulation of speech and expression. “It being a Facebook status update should not grant it any special immunity; the fact of that update not being punishable under s.295 A should! It isn’t regulation of social media that needs to be discussed, but regulation of speech and expression”, he said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;News of the arrest has understandably drawn a lot of attention on social media, and forums like Facebook and Twitter reflected outrage at the news.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The &lt;i&gt;Times of India&lt;/i&gt; &lt;a href="http://m.timesofindia.com/city/mumbai/Sainiks-belie-Mumbais-fears-keep-the-peace-in-last-walk-with-general/articleshow/17274802.cms" target="_blank"&gt;also reported &lt;/a&gt;that a mob of Shiv Sena workers attacked and ransacked the girl’s uncle’s orthopaedic clinic at Palghar, even though she withdrew her comment and apologised.&lt;/p&gt;

        &lt;b&gt;Snehashish Ghosh does a further analysis of the leaked list of the websites blocked by the Indian Government from August 18, 2012 till August 21, 2012 (“leaked list”). &lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;&lt;b&gt;Unnecessary Blocks and Mistakes:&lt;/b&gt;&lt;/p&gt;
&lt;ol&gt;
&lt;li style="text-align: justify; "&gt;http://hinduexistance.files.wordpress.com/..., which appears on the leaked list, does not exist because the URL is incorrect. However, the correct URL does contain an image which, in my opinion, can be considered to be capable of inciting violence. It has not been blocked due to a spelling error in the order. Instead of blocking hinduexist&lt;b&gt;&lt;i&gt;e&lt;/i&gt;&lt;/b&gt;nce.wordpress.com/... the DoT has ordered the blocking of hinduexist&lt;b&gt;&lt;i&gt;a&lt;/i&gt;&lt;/b&gt;nce.wordpress.com/..., which does not exist.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;Two URLs in the block order are from the website of the High Council for Human Rights, Judiciary of the Islamic Republic of Iran. The reason for blocking these two links from this particular website is unclear.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;The website of the Union of NGOs of the Islamic World was blocked. Again, the reason for blocking this website remains unclear.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;URLs such as, http://farazahmed.com/..., mumblingminion.blogspot.com, were blocked. The content on these URLs was in fact debunking the fake photographs.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;Certain blocked Facebook pages did not have any bearing on the North East exodus which was the main reason behind the blocks. For example, Facebook link leading to United States Institute for Peace page was blocked.&lt;/li&gt;
&lt;/ol&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt; &lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Duration of the Block&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Department of Telecommunications (DoT) did not specify the period for which the block has been implemented in its orders. As a result of which certain URLs still remain blocked while a majority of the links in the leaked list can be accessed. Lack of clear directions from the DoT has resulted in haphazard blocking and certain internet service providers (ISPs) have lifted the block on certain links whereas some other ISPs have continued with a complete block.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt; &lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;How have the intermediaries reacted to the block orders?&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Going by the leaked list of websites blocked by DoT, it issued the block orders to ‘all internet service licensees’. Intermediaries that do not fall in the category of 'internet service licensees’ were also sent  a separate set of requests for taking down third party content. However, it is unclear under which provision of the law such request was made by the Government.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Internet Service Licensees&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;&lt;img src="https://cis-india.org/home-images/chart_1.png" alt="Implementation of the order at the ISP level" class="image-inline" title="Implementation of the order at the ISP level" /&gt;&lt;br /&gt;&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The internet service licensee or the ISPs have not followed any uniform system to notify that a particular URL or website in the leaked list is blocked according to DoT’s orders. The lack of transparency in the implementation of the block orders, have a chilling effect on free speech.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;For instance, BSNL returns the following messages:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"This website/URL has been blocked until further notice either pursuant to Court orders or on the Directions issued by the Department of Telecommunications" or “This site has been blocked as per instructions from Department of Telecom (DOT).”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;However, these messages are not uniform across all the URLs/websites in the leaked list. BSNL does not generate any response for the majority of the URLs in the leaked list. This results in ‘invisible censorship’ as the person who is trying to access the blocked URL does not have any means to know whether a particular URL is unavailable or certain sites are blocked by government orders.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Lack of notification does not only infringes upon the fundamental right  to freedom of speech and expression but also violates the fundamental  right to a constitutional remedy guaranteed under Article 32 of our  Constitution. The person aggrieved by such block orders cannot approach  the Court for a remedy because there is no means to figure out:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;(a) Description of the content blocked?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;(b) Who  has issued the block order/request?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;(c) Under which provision of the law such  block order/request has been issued?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;(d) Who has  implemented the block order/request? and&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;(e) What was the reason for the block?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The intermediaries should provide with the above notification details while implementing a block order issued by the Government. &lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Intermediaries hosting third party content: &lt;/b&gt;&lt;/p&gt;
&lt;p align="right" style="text-align: justify; "&gt;More than 100 out of the 309 blocks are Facebook (http and https) URLs. Facebook has not informed its users about the reasons behind unavailability of certain pages or content. This is another instance of invisible censorship. However, YouTube, a Google service, has maintained certain level of transparency, and informs the user that the content has been blocked as per ‘government removal request’. It is interesting to note that certain YouTube user accounts were terminated as well. It is unclear whether this was as a result of the block order. Furthermore, links associated with blogger.com, which is another service provided by Google, have been removed.&lt;/p&gt;

The full submission that CIS and 21 other civil society organizations made to the Rajya Sabha Standing Committee on HRD (which is studying the Bill) is &lt;a title="Copyright Bill Analysis" class="internal-link" href="http://www.cis-india.org/advocacy/ipr/upload/copyright-bill-submission"&gt;available here&lt;/a&gt;.&amp;nbsp; Given below is the summary of our submissions:&lt;/p&gt;
&lt;h2 class="western"&gt;Existing Copyright Act&lt;/h2&gt;
&lt;p align="JUSTIFY"&gt;The Indian Copyright
Act, 1957 has been designed from the perspective of a developing
country. It has always attempted a balance between various kinds of
interests. It has always sought to ensure that rights of authors of
creative works is carefully promoted alongside the public interest
served by wide availability and usability of that material. For
instance, our Copyright Act has provisions for: &lt;/p&gt;
&lt;ul&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;compulsory and
	statutory licensing: recognizing its importance in making works
	available, especially making them available at an affordable rate.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;cover versions:
	recognizing that more players lead to a more vibrant music industry.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;widely-worded
	right of fair dealing for private use: recognizing that individual
	use and large-scale commercial misuse are different.&lt;/p&gt;
&lt;/li&gt;&lt;/ul&gt;
&lt;p align="JUSTIFY"&gt;These provisions of
our Act &lt;a class="external-link" href="http://a2knetwork.org/watchlist/report/india"&gt;have been lauded&lt;/a&gt;,&lt;sup&gt;&lt;a class="sdfootnoteanc" name="sdfootnote1anc" href="#sdfootnote1sym"&gt;&lt;/a&gt;&lt;/sup&gt;
and India has been rated as &lt;a class="external-link" href="http://a2knetwork.org/summary-report-2010"&gt;the most balanced copyright system in a
global survey&lt;/a&gt;&lt;sup&gt;&lt;a class="sdfootnoteanc" name="sdfootnote2anc" href="#sdfootnote2sym"&gt;&lt;/a&gt;&lt;/sup&gt;
conducted of over 34 countries by &lt;a class="external-link" href="http://www.consumersinternational.org/"&gt;Consumers International&lt;/a&gt;&lt;sup&gt;&lt;a class="sdfootnoteanc" name="sdfootnote3anc" href="#sdfootnote3sym"&gt;&lt;/a&gt;&lt;/sup&gt;.&lt;/p&gt;
&lt;p align="JUSTIFY"&gt;The Indian Parliament
has always sought to be responsive to changing technologies by paying
heed to both the democratisation of access as well as the securing of
the interests of copyright holders. This approach needs to be lauded,
and importantly, needs to be maintained.&lt;/p&gt;
&lt;p align="JUSTIFY"&gt;&lt;br /&gt;&lt;/p&gt;
&lt;h2 class="western"&gt;Proposed Amendments&lt;/h2&gt;
&lt;h3 class="western"&gt;Some positive amendments&lt;/h3&gt;
&lt;ul&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Fair
	Dealings, Parallel Importation, Non-commercial Rental&lt;/strong&gt;: All works
	(including sound recordings and cinematograph films) are now covered
	the fair dealings clause (except computer programmes), and a few
	other exceptions; parallel importation is now clearly allowed; and
	non-commercial rental has become a limitation in some cases.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Persons with
	disabilities&lt;/strong&gt;: There is finally an attempt at addressing the
	concerns of persons with disabilities.  But the provisions are
	completely useless the way they are currently worded.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Public
	Libraries&lt;/strong&gt;: They can now make electronic copies of works they
	own, and some other beneficial changes relating to public libraries.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Education&lt;/strong&gt;:
	Some exceptions related to education have been broadened (scope of
	works, &amp;amp; scope of use).&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Statutory and
	compulsory licensing&lt;/strong&gt;: Some new statutory licensing provisions
	(including for radio broadcasting) and some streamlining of existing
	compulsory licensing provisions.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Copyright
	societies&lt;/strong&gt;: These are now responsible to authors and not owners
	of works.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Open
	licences&lt;/strong&gt;: Free and Open Source Software and Open Content
	licensing is now simpler.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Partial
	exemption of online intermediaries&lt;/strong&gt;:
	Transient and incidental storage of copyrighted works has
	been excepted, mostly for the benefit of online intermediaries.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Performer’s
	rights&lt;/strong&gt;: The general, and confusing, exclusive right that
	performers had to communicate their performance to the public has
	been removed, and instead only the exclusive right to communicate
	sound/video recordings remains.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Enforcement&lt;/strong&gt;:
	Provisions on border measures have been made better, and less prone
	to abuse and prevention of legitimate trade.&lt;/p&gt;
&lt;/li&gt;&lt;/ul&gt;
&lt;h3 class="western"&gt;&lt;br /&gt;&lt;/h3&gt;
&lt;h3 class="western"&gt;Some negative amendments&lt;/h3&gt;
&lt;ul&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;WCT and WPPT
	compliance&lt;/strong&gt;: India has not signed either of these two treaties,
	which impose TRIPS-plus copyright protection, but without any
	corresponding increase in fair dealing / fair use rights.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Increase in
	duration of copyright&lt;/strong&gt;: This will significantly reduce the public
	domain, which India has been arguing for internationally.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Technological
	Protection Measures&lt;/strong&gt;: TPMs, which have been shown to be
	anti-consumer in all countries in which they have been introduced,
	are sought to be brought into Indian law.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Version
	recordings&lt;/strong&gt;: The amendments make cover version much more
	difficult to produce.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Moral rights&lt;/strong&gt;:
	Changes have been made to author’s moral rights (and performer’s
	moral rights have been introduced) but these have been made without
	requisite safeguards.&lt;/p&gt;
&lt;/li&gt;&lt;/ul&gt;
&lt;h3 class="western"&gt;&lt;br /&gt;&lt;/h3&gt;
&lt;h3 class="western"&gt;Missed opportunities&lt;/h3&gt;
&lt;ul&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Government-funded
	works&lt;/strong&gt;: Taxpayers are still not free to use works that were paid
	for by them.  This goes against the direction that India has elected
	to march towards with the Right to Information Act.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Copyright
	terms&lt;/strong&gt;: The duration of all copyrights are above the minimum
	required by our international obligations, thus decreasing the
	public domain which is crucial for all scientific and cultural
	progress.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Criminal
	provisions&lt;/strong&gt;: Our law still criminalises individual,
	non-commercial copyright infringement.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Libraries and
	archives&lt;/strong&gt;: The exceptions for ‘public libraries’ are still
	too narrow in what they perceive as ‘public libraries’.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Educational
	exceptions&lt;/strong&gt;: The exceptions for education still do not fully
	embrace distance and digital education.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Communication
	to the public&lt;/strong&gt;: No clear definition is given of what constitute a
	‘public’, and no distinction is drawn between commercial and
	non-commercial ‘public’ communication.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Internet
	intermediaries&lt;/strong&gt;: More protections are required to be granted to
	Internet intermediaries to ensure that non-market based
	peer-production projects such as Wikipedia, and other forms of
	social media and grassroots innovation are not stifled.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p align="JUSTIFY"&gt;&lt;strong&gt;Fair dealing
	and fair use&lt;/strong&gt;: We would benefit greatly if, apart from the

    <title>A provisional definition for the Cultural Last Mile</title>

        &lt;b&gt;In the first of his entries, Ashish Rajadhyaksha gives his own spin on the 'Last Mile' problem that has been at the crux of all public technologies. Shifting the terms of debate away from broadcast problems of distance and access, he re-purposes the 'last mile' which is a communications problem, to make a cultural argument about the role and imagination of technology in India, and the specific ways in which this problem features in talking about Internet Technologies in contemporary India.&lt;/b&gt;

&lt;p&gt;In its classical
form, the ‘last mile’ is a communications term defining the final stage
of providing connectivity from a communications provider to a customer,
and has been used as such most commonly by telecommunications and cable
television industries. There has however been a a specific Indian
variant, seen in its most classical avatar in scientist Vikram
Sarabhai’s contention that overcoming the last mile could solve the two
major challenges India has faced, of &lt;strong&gt;linguistic diversity &lt;/strong&gt;and &lt;strong&gt;geographical distance&lt;/strong&gt;,
and mounted as the primary argument for terrestrial television in the
early 1980s. (I will try and attach the Sarabhai paper a little later
to this posting).&lt;/p&gt;
&lt;p&gt;This specifically Indian variation, where technology was mapped onto
developmentalist-democratic priorities, has been the dominant
characteristic of communications technology since at least the
invention of the radio in the 1940s. For at least 50 years now, that
means, the last mile has become a mode of a techno-democracy, where
connectivity has been directly translated into democratic citizenship.
It has continuously provided the major rationale for successive
technological developments, from the 1960s wave of portable
transistors, the terrestrial transponders of the first televisual
revolution it the early 1980s (the Special Plan for the Expansion of
Television), the capacity of satellite since SITE and the INSAT series,
and from the 1990s the arrival of wired networks (LANs, Cable,
fibre-optic) followed by wireless (WLAN, WiMAX, W-CDMA). At each point
the assumption has been consistently made that the final frontier was
just around the corner; that the next technology in the chain would
breach a major barrier, once and for all.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;What I hope to do is to provide a historical account to
argue that the theory of the ‘last mile’ has been founded on
fundamental (mis)apprehensions around just what this bridge
constitutes. &lt;/strong&gt;Further, that these apprehensions may have been
derived from a misconstruction of democractic theory, to assume, first,
an evolutionary rather than distributive model for connectivity, and
second, to introduce a major bias for broadcast (or one-to-many) modes
as against many-to-many peer-to-peer formats. The book, whenever I
succeed in writing it, will hope to argue the following:&lt;/p&gt;
&lt;p&gt;1. It has been difficult to include &lt;strong&gt;human resource&lt;/strong&gt;
as an integral component to the last mile. Contrary to the relentlessly
technologized definition of the last mile, it may perhaps be best seen
historically as &lt;em&gt;also&lt;/em&gt;, and even perhaps &lt;em&gt;primarily&lt;/em&gt;, a
human resource issue. This is not a new realization, but it is one that
keeps reproducing itself with every new technological generation&lt;a href="http://culturallastmile.wordpress.com/#_ftn1"&gt;[1]&lt;/a&gt;,
with ever newer difficulties. The endemic assumption, derived from the
broadcasting origins of the definition is that it is primarily the &lt;em&gt;sender&lt;/em&gt;’s responsibility to bridge the divide, that &lt;em&gt;technology &lt;/em&gt;can
aid him to do so on its own, and that such technology can negate the
need to define connectivity as a multiple-way partnership as it reduces
the recipient into no more than an intelligent recipient of what is
sent (the citizen model). On the other hand, it is possible to show how
previous successful experiments bridging the last mile have been ones
where &lt;em&gt;recipients have been successfully integrated into the communications model &lt;/em&gt;both as peers and, even more significantly, as &lt;em&gt;originators &lt;/em&gt;as well as &lt;em&gt;enhancers &lt;/em&gt;of
data. Importantly, this paper will show, this has been evidenced even
in one-way ‘broadcast’ modes such as film, television and radio (in the
movie fan, community radio and the television citizen-journalist).&lt;/p&gt;
&lt;p&gt;2. The one-way broadcast versus peer-to-peer versus two/multiple-way
debate needs to he historically revisited. The need to redefine the
beneficiary of a connectivity cycle as a full-fledged partner tends to
come up against a bias written into standard communications models –
and therefore several standard revenue models – that consistently tend
to underplay what this paper will call the &lt;em&gt;significant sender/recipient&lt;/em&gt;.
While both terrestrial and satellite systems require some level of
peer-to-peer transmission systems to facilitate last-mile
communications, it has been a common problem that unless &lt;em&gt;either&lt;/em&gt; a clear focus exists on geographic areas &lt;em&gt;or&lt;/em&gt;
significant peer-to-peer participation exists, broadcast models
inevitably find themselves delivering large amounts of S/N at low
frequencies without sufficient spectrum to support large information
capacity. While it is technically possible to ‘flood’ a region in
broadcasting terms, this inevitably leads to extremely high wastage as
much of the radiated ICE never reaches any user at all. As information
requirements increase, broadcast ‘wireless mesh’ systems small enough
to provide adequate information distribution to and from a relatively
small number of local users, require a prohibitively large number of
broadcast locations along with a large amount of excess capacity to
make up for the wasted energy.&lt;/p&gt;
&lt;p&gt;This problem, importantly, springs as much from a built-in &lt;em&gt;ideological &lt;/em&gt;commitment
to one-way broadcasting formats, as from technological limitations. The
technology itself poses further problems given the bias of different
systems to different kinds of connectivity, and with it different types
of peer-to-peer possibilities. Rather than attempting a
one-size-fits-all model for all models to follow, we need to work out
different &lt;em&gt;synergies &lt;/em&gt;between broadcast-dependent and peer-to-peer-enabled platforms.&lt;/p&gt;
&lt;p&gt;This book will eventually hope to study the history of peer-to-peer
and multiple-way structures as systems where sending has become a
component part of receiving. Key technological precedents to the
present definition of the sender-communication ‘partner’ would be &lt;strong&gt;community radio&lt;/strong&gt;, &lt;strong&gt;low-power transmission-reception systems &lt;/strong&gt;(most famously the Pij experiment in Gujarat conducted by ISRO), and various &lt;strong&gt;internet-based networking models&lt;/strong&gt;.&lt;/p&gt;
&lt;p&gt;3. The need to revisit the technological community is therefore
critical. The key question is one of how technological communities have
been produced, and how they may be sustained. In January 2007, the
attack by V.S. Ailawadi, former Chairman, Haryana Electricty Regulatory
Commission, on India’s public sector telecom giants BSNL and MTNL for
keeping their ‘huge infrastructure’ of ‘copper wire and optic fibre’ to
themselves, when these could be used by private operators as cheaper
alternatives to WiMAX, W-CDMA and broadband over power lines, shows the
uneasy relationship between new players and state agencies. Mr.
Ailawadi’s contention that the ‘unbundling’ of the last mile would
bring in competition for various types of wireless applications and
broadband services not just for 45 million landlines but also for 135
million mobile users of various service providers, also therefore needs
to be revisited from the perspective of community formation. How would
the new 135 million mobile users be effectively tapped for their
capacity to become what we are calling significant senders?&lt;/p&gt;
&lt;p&gt;In defining the last mile as to do with the recipient-as-sender, and thus the &lt;strong&gt;community&lt;/strong&gt;, this paper will focus on a history of community action along specific models of connectivity. These are: cinema’s &lt;strong&gt;movie fan&lt;/strong&gt;, internet’s &lt;strong&gt;blogger&lt;/strong&gt; and &lt;strong&gt;networker&lt;/strong&gt;, solar energy’s &lt;strong&gt;barefoot engineer&lt;/strong&gt;, software’s &lt;strong&gt;media pusher&lt;/strong&gt; and television’s &lt;strong&gt;citizen-journalist. &lt;/strong&gt;A specific focus for study will be the models of &lt;strong&gt;participatory learning&lt;/strong&gt; in the classroom, using &lt;strong&gt;film&lt;/strong&gt;, the &lt;strong&gt;vinyl disc&lt;/strong&gt;, the &lt;strong&gt;audio cassette&lt;/strong&gt;, the &lt;strong&gt;radio&lt;/strong&gt;, the &lt;strong&gt;television&lt;/strong&gt;, the &lt;strong&gt;web &lt;/strong&gt;and now the &lt;strong&gt;mobile phone&lt;/strong&gt;.&lt;/p&gt;

    <title>'Anonymous' hackers to protest Indian Internet laws</title>

&lt;p&gt;The call for demonstrations by the Indian arm of the group follows a 
March 29 court order issued in the southern city of Chennai demanding 15
 Indian Internet providers block access to file-sharing websites such as
 Pirate Bay.&lt;/p&gt;
&lt;p&gt;The order has resulted in access being denied to a host of websites 
that carry pirated films and music among other legal content, including &lt;a class="external-link" href="http://www.isohunt.com/"&gt;www.isohunt.com&lt;/a&gt; and &lt;a class="external-link" href="http://www.pastebin.com/"&gt;www.pastebin.com&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;On Wednesday, the Anonymous forum fired an opening shot by attacking 
the website of state-run telecom provider MTNL, pasting the logo of the 
group -- the mask of 17th century revolutionary Guy Fawkes -- on &lt;a class="external-link" href="http://www.mtnl.net.in"&gt;www.mtnl.net.in&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;In an open letter the same day, the group accused the government of 
trying to create a "Great Indian Firewall" to establish control on the 
web and issuing a "declaration of war from yourself... to us."&lt;/p&gt;
&lt;p&gt;Internet users and supporters have been asked to join peaceful 
rallies in cities including the capital New Delhi and the tech hub of 
Bangalore, with detailed instructions issued online to participants.&lt;/p&gt;
&lt;p&gt;Tech website &lt;a class="external-link" href="http://www.pluggd.in/"&gt;www.pluggd.in&lt;/a&gt;
 reported the demonstrators have been asked to wear Guy Fawkes' masks, 
download a recorded message to play to police, and are to chant "United 
as one! Divided as zero! We are Anonymous! We are legion!"&lt;/p&gt;
&lt;p&gt;Concerns about Internet freedom in India go beyond the court order in
 Chennai, however, and stem from an update to India's Information 
Technology Act that was given by the IT and communications ministry in 
April last year.&lt;/p&gt;
&lt;p&gt;The new rules regulating Internet companies -- providers, websites 
and search engines -- instruct them that they must remove "disparaging" 
or "blasphemous" content within 36 hours if they receive a complaint by 
an "affected person".&lt;/p&gt;
&lt;p&gt;Groups such as the Center for Internet and Society, a Bangalore-based
 research and advocacy group, have waged a year-long campaign for 
amendments to the rules, which were quietly released in April.&lt;/p&gt;
&lt;p&gt;Industry groups have also objected, saying they are unclear on the 
changes which are in any case impossible to implement when it comes to 
acting on individual complaints about specific content.&lt;/p&gt;
&lt;p&gt;"A lot of education is required in this field," secretary of the 
Internet Service Providers Association of India S.P. Jairath told AFP.&lt;/p&gt;
&lt;p&gt;The government has also become embroiled in a row with social 
networks after Telecoms Minister Kapil Sibal held a series of meetings 
with IT giants Google, Yahoo! and Facebook last year to discuss the 
pre-screening of content.&lt;/p&gt;
&lt;p&gt;The minister was said to have shown Internet executives examples of 
obscene images found online that risked offending Muslims or defamed 
politicians, including his boss, the head of the ruling Congress party, 
Sonia Gandhi.&lt;/p&gt;
&lt;p&gt;Since these meetings, 19 Internet firms including Google, Yahoo! and 
Facebook have been targeted in criminal and civil cases lodged in lower 
courts, holding them responsible for content posted by users of their 
platforms.&lt;/p&gt;
&lt;p&gt;Anonymous is a secretive "hacker-activist" network and is thought to 
be a loosely knit collective with no clearly defined leadership 
structure.&lt;/p&gt;
&lt;p&gt;It has claimed dozens of online attacks on sites ranging from the 
Vatican to Los Angeles Police Canine Association, but is increasingly 
the target of law enforcement agencies who have arrested dozens of 
members.&lt;/p&gt;
