    <title>Statutory Motion Against Intermediary Guidelines Rules</title>

        &lt;b&gt;Rajya Sabha MP, Shri P. Rajeev has moved a motion that the much-criticised Intermediary Guidelines Rules be annulled. &lt;/b&gt;
        &lt;h2&gt;Motion to Annul Intermediary Guidelines Rules&lt;/h2&gt;
&lt;p&gt;A &lt;a href="http://164.100.47.5/newsite/bulletin2/Bull_No.aspx?number=49472"&gt;motion to annul&lt;/a&gt; the &lt;a href="http://cis-india.org/internet-governance/resources/intermediary-guidelines-rules"&gt;Intermediary Guidelines Rules&lt;/a&gt; was moved on March 23, 2012, by &lt;a href="http://india.gov.in/govt/rajyasabhampbiodata.php?mpcode=2106"&gt;Shri P. Rajeeve&lt;/a&gt;, CPI(M) MP in the Rajya Sabha from Thrissur, Kerala.&lt;/p&gt;
&lt;p&gt;The motion reads:&lt;/p&gt;
&lt;p&gt;"That this House resolves that the Information Technology (Intermediaries Guidelines) Rules, 2011 issued under clause (zg) of sub-section (2) of Section 87 read with sub-section (2) of Section 79 of the Information Technology Act, 2000 published in the Gazette of India dated the 13th April, 2011 vide Notification No. G.S.R 314(E) and laid on the Table of the House on the 12th August, 2011, be annuled; and&lt;/p&gt;
&lt;p&gt;That this House recommends to Lok Sabha that Lok Sabha do concur on this Motion."&lt;/p&gt;
&lt;p&gt;This isn't the first time that Mr. Rajeeve is raising his voice against the Intermediary Guidelines Rules.  Indeed, even when the Rules were just in draft stage, he along with the MPs Kumar Deepak Das, Rajeev Chandrashekar, and Mahendra Mohan drew Parliamentarians' &lt;a href="http://rajeev.in/pages/..%5CNews%5Ccensorship_Blogs%5CBloggers_Internet.html"&gt;attention to the rules&lt;/a&gt;.  Yet, the government did not heed the MPs' concern, nor the concern of all the civil society organizations that wrote in to them concerned about human rights implications of the new laws.  On September 6, 2011, Lok Sabha MP &lt;a href="https://cis-india.org/internet-governance/blog/164.100.47.132/debatestext/15/VIII/0609.pdf"&gt;Jayant Choudhary gave notice&lt;/a&gt; (under Rule 377 of the Lok Sabha Rules) that the Intermediary Guidelines Rules as well as the Reasonable Security Practices Rules need to be reviewed.  Yet, the government has not even addressed those concerns, and indeed has cracked down even harder on online freedom of speech since then.&lt;/p&gt;
&lt;h2&gt;Fundamental Problems with Intermediary Guidelines Rules&lt;/h2&gt;
&lt;p&gt;The fundamental problems with the Rules, which deal with objectionable material online:&lt;/p&gt;
&lt;h3&gt;Shifting blame.&lt;/h3&gt;
&lt;p&gt;It makes the 'intermediary', including ISPs like BSNL and Airtel responsible for objectionable content that their users have put up.&lt;/p&gt;
&lt;h3&gt;No chance to defend.&lt;/h3&gt;
&lt;p&gt;There is no need to inform users before this content is removed.  So, even material put up by a political party can be removed based on &lt;em&gt;anyone's&lt;/em&gt; complaint, without telling that party.  This was done against a site called *CartoonsAgainstCorruption.com". This goes against Article 19(1)(a).&lt;/p&gt;
&lt;h3&gt;Lack of transparency&lt;/h3&gt;
&lt;p&gt;No information is required to be provided that content has been removed. It's a black-box system, with no one, not even the government, knowing that content has been removed following a request.  So even the government does not know how many sites have been removed after these Rules have come into effect.&lt;/p&gt;
&lt;h3&gt;No differentiation between intermediaries.&lt;/h3&gt;
&lt;p&gt;A one-size-fits-all system is followed where an e-mail provider is equated with an online newspaper, which is equated with a video upload site, which is equated with a search engine.  This is like equating the post-office and a book publisher as being equivalent for, say, defamatory speech.  This is violative of Article 14 of the Constitution, which requires that unequals be treated unequally by the law.&lt;/p&gt;
&lt;h3&gt;No proportionality.&lt;/h3&gt;
&lt;p&gt;A DNS provider (i.e., the person who gives you your web address) is an intermediary who can be asked to 'disable access' to a website on the basis of a single page, even though the rest of the site has nothing objectionable.&lt;/p&gt;
&lt;h3&gt;Vague and unconstitutional requirements.&lt;/h3&gt;
&lt;p&gt;Disparaging speech, as long as it isn't defamatory, is not criminalised in India, and can't be because the Constitution does not allow for it.  Content about gambling in print is not unlawful, but now all Internet intermediaries are required to remove any content that promotes gambling.&lt;/p&gt;
&lt;h3&gt;Allows private censorship.&lt;/h3&gt;
&lt;p&gt;The Rules do not draw a distinction between arbitrary actions of an intermediary and take-downs subsequent to a request.&lt;/p&gt;
&lt;h3&gt;Presumption of illegality.&lt;/h3&gt;
&lt;p&gt;The Rules are based on the presumption that all complaints (and resultant mandatory taking down of the content) are correct, and that the incorrectness of the take-downs can be disputed in court (if they ever discover that it has been removed).  This is contrary to the presumption of validity of speech used by Indian courts, and is akin to prior restraint on speech.  Courts have held that for content such as defamation, prior restraints cannot be put on speech, and that civil and criminal action can only be taken post-speech.&lt;/p&gt;
&lt;h3&gt;Government censorship, not 'self-regulation'.&lt;/h3&gt;
&lt;p&gt;The government says these are industry best-practices in existing terms of service agreements.  But the Rules require all intermediaries to include the government-prescribed terms in an agreement, no matter what services they provide. It is one thing for a company to choose the terms of its terms of service agreement, and completely another for the government to dictate those terms of service.&lt;/p&gt;
&lt;h2&gt;Problems Noted Early&lt;/h2&gt;

    <title>India's Broken Internet Laws Need a Shot of Multi-stakeholderism</title>

        &lt;b&gt;Cyber-laws in India are severely flawed, with neither lawyers nor technologists being able to understand them, and the Cyber-Law Group in DEIT being incapable of framing fair, just, and informed laws and policies.  Pranesh Prakash suggests they learn from the DEIT's Internet Governance Division, and Brazil, and adopt multi-stakeholderism as a core principle of Internet policy-making.&lt;/b&gt;
        &lt;p&gt;(An edited version of this article was published in the Indian Express as &lt;a href="http://www.indianexpress.com/story-print/941491/"&gt;"Practise what you preach"&lt;/a&gt; on Thursday, April 26, 2012.)&lt;/p&gt;
&lt;p&gt;The laws in India relating to the Internet are greatly flawed, and the only way to fix them would be to fix the way they are made.  The &lt;a href="https://cis-india.org/internet-governance/blog/www.mit.gov.in/content/cyber-laws-security"&gt;Cyber-Laws &amp;amp; E-Security Group&lt;/a&gt; in the &lt;a href="http://www.mit.gov.in"&gt;Department of Electronics and Information Technology&lt;/a&gt; (DEIT, who refer to themselves as 'DeitY' on their website!) has proven itself incapable of making fair, balanced, just, and informed laws and policies.  The Information Technology (IT) Act is filled with provisions that neither lawyers nor technologists understand (not to mention judges).  (The definition of &lt;a href="http://www.vakilno1.com/bareacts/informationtechnologyact/s65.htm"&gt;"computer source code" in s.65 of the IT Act&lt;/a&gt; is a great example of that.)&lt;/p&gt;
&lt;p&gt;The Rules drafted under s.43A of the IT Act (on 'reasonable security practices' to be followed by corporations) were so badly formulated that the government was forced to issue a &lt;a href="http://pib.nic.in/newsite/PrintRelease.aspx??relid=74990"&gt;clarification through a press release&lt;/a&gt;, even though the clarification was in reality an amendment and amendments cannot be carried out through press releases.  Despite the clarification, it is unclear to IT lawyers whether the Rules are mandatory or not, since s.43A (i.e., the parent provision) seems to suggest that it is sufficient if the parties enter into an agreement specifying reasonable security practices and procedures.  Similarly, the "Intermediary Guidelines" Rules (better referred to as the Internet Censorship Rules) drafted under s.79 of the Act have been called &lt;a href="http://www.indianexpress.com/story-print/940682/"&gt;"arbitrary and unconstitutional" by many, including MP P. Rajeev&lt;/a&gt;, who has &lt;a href="http://cis-india.org/internet-governance/blog/statutory-motion-against-intermediary-guidelines-rules"&gt;introduced a motion in the Rajya Sabha to repeal the Rules&lt;/a&gt; ("Caught in a net", Indian Express, April 24, 2012).  These Rules give the power of censorship to every citizen and allow them to remove any kind of material off the Internet within 36 hours without anybody finding out.  Last year, we at the Centre for Internet and Society used this law to get thousands of innocuous links removed from four major search engines without any public notice.  In none of the cases (including one where an online news website removed more material than the perfectly legal material we had complained about) were the content-owners notified about our complaint, much less given a chance to defend themselves.&lt;/p&gt;
&lt;p&gt;Laws framed by the Cyber-Law Group are so poorly drafted that they are misused more often than used.  There are too many criminal provisions in the IT Act, and their penalties are greatly more than that of comparable crimes in the IPC.  Section 66A of the IT Act, which criminalizes "causing annoyance or inconvenience" electronically, has a penalty of 3 years (greater than that for causing death by negligence), and does not require a warrant for arrest. This section has been used in the Mamata Banerjee cartoon case, for arresting M. Karthik, a Hyderabad-based student who made atheistic statements on Facebook, and against former Karnataka Lokayukta Santosh Hegde.  Section 66A, I believe, imperils freedom of speech more than is allowable under Art. 19(2) of the Constitution, and is hence unconstitutional.&lt;/p&gt;
&lt;p&gt;While &lt;a href="http://indiankanoon.org/doc/1740460/"&gt;s.5 of the Telegraph Act&lt;/a&gt; only allows interception of telephone conversations on the occurrence of a public emergency, or in the interest of the public safety, the IT Act does not have any such threshold conditions, and greatly broadens the State's interception abilities.  Section 69 allows the government to force a person to decrypt information, and might clash with Art.20(3) of the Constitution, which provides a right against self-incrimination.  One can't find any publicly-available governmental which suggests that the constitutionality of provisions such as s.66A or s.69 was examined.&lt;/p&gt;
&lt;p&gt;Omissions by the Cyber-Law Group are also numerous.  The &lt;a href="http://www.cert-in.org.in"&gt;Indian Computer Emergency Response Team (CERT-In)&lt;/a&gt; has been granted &lt;a href="http://www.cert-in.org.in/"&gt;very broad functions&lt;/a&gt; under the IT Act, but without any clarity on the extent of its powers.  Some have been concerned, for instance, that the broad power granted to CERT-In to "give directions" relating to "emergency measures for handling cyber security incidents" includes the powers of an "Internet kill switch" of the kind that Egypt exercised in January 2011.  Yet, they have failed to frame Rules for the functioning of CERT-In.  The licences that the Department of Telecom enters into with Internet Service Providers requires them to restrict usage of encryption by individuals, groups or organisations to a key length of only 40 bits in symmetric key algorithms (i.e., weak encryption).  The RBI mandates a minimum of 128-bit SSL encryption for all bank transactions.  Rules framed by the DEIT under s.84A of the IT Act were to resolve this conflict, but those Rules haven't yet been framed.&lt;/p&gt;
&lt;p&gt;All of this paints a very sorry picture.  Section 88 of the IT Act requires the government, "soon after the commencement of the Act", to form a "Cyber Regulations Advisory Committee" consisting of "the interests principally affected or having special knowledge of the subject-matter" to advise the government on the framing of Rules, or for any other purpose connected with the IT Act.  This body still has not been formed, despite the lag of more than two and a half years since the IT Act came into force.  Justice Markandey Katju’s recent letter to Ambika Soni about social media and defamation should ideally have been addressed to this body. &lt;/p&gt;
&lt;p&gt;The only way out of this quagmire is to practise at home that which we preach abroad on matters of Internet governance: multi-stakeholderism.  Multi-stakeholderism refers to the need to recognize that when it comes to Internet governance there are multiple stakeholders: government, industry, academia, and civil society, and not just the governments of the world.  This idea has gained prominence since it was placed at the core of the "Declaration of Principles" from the first World Summit on Information Society in Geneva in 2003, and has also been at the heart of India's pronouncements at forums like the Internet Governance Forum.  Brazil has an &lt;a href="httphttp://www.cgi.br/english/"&gt;"Internet Steering Committee"&lt;/a&gt; which is an excellent model that practices multi-stakeholderism as a means of framing and working national Internet-related policies.  DEIT's &lt;a href="http://www.mit.gov.in/content/internet-governance"&gt;Internet Governance Division&lt;/a&gt;, which formulates India's international stance on Internet governance, has long recognized that governance of the Internet must be done in an open and collaborative manner.  It is time the DEIT's Cyber-Law and E-Security Group, which formulates our national stance on Internet governance, realizes the same.&lt;/p&gt;

        &lt;p&gt;Media reports across India are focusing on the new government and its Cabinet portfolios. In the midst of the celebration of and grief over the regime change, we found many reports indicating that civil society is wary of the new government’s stance towards Internet freedoms.&lt;span&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;i&gt;&lt;span style="text-decoration: underline;"&gt;Andhra Pradesh&lt;/span&gt;&lt;/i&gt;:&lt;/p&gt;
&lt;p&gt;Andhra MLA and All India Majlis-e-Ittihad ul-Muslimin member Akbaruddin Owaisi &lt;a href="http://www.asianage.com/mumbai/court-summons-owaisi-312"&gt;has been summoned to appear&lt;/a&gt; before a Kurla magistrate’s court on grounds of alleged hate speech and intention to harm harmony of Hinduism and Islam. Complainant Gulam Hussain Khan saw an online video of a December 2012 speech by Owaisi and filed a private complaint with the court. “&lt;i&gt;I am prima facie satisfied that it disclosed an offence punishable under Section(s) 153A and 295A of the Indian Penal Code&lt;/i&gt;,” the Metropolitan Magistrate said.&lt;/p&gt;
&lt;p&gt;&lt;i&gt;&lt;span style="text-decoration: underline;"&gt;Goa&lt;/span&gt;&lt;/i&gt;:&lt;/p&gt;
&lt;p&gt;A Goa Sessions Judge &lt;a href="http://timesofindia.indiatimes.com/city/goa/Comments-of-Devu-Chodankar-prima-facie-offensive-Judge/articleshow/35612485.cms"&gt;has dismissed&lt;/a&gt; shipbuilding diploma engineer Devu Chodankar’s application for anticipatory bail. On the basis of an April 26 complaint by CII state president Atul Pai Kane, Goa cybercrime cell registered a case against Chodankar for allegedly posting matter on a Facebook group with the intention of promoting enmity between religious groups in view of the 2014 general elections. The Judge noted, &lt;i&gt;inter alia&lt;/i&gt;, that Sections 153A and 295A of the Indian Penal Code were attracted, and that it is necessary to find out whether, on the Internet, “&lt;i&gt;there is any other material which could be considered as offensive or could create hatred among different classes of citizens of India&lt;/i&gt;”.&lt;/p&gt;
&lt;p&gt;&lt;i&gt;&lt;span style="text-decoration: underline;"&gt;Karnataka&lt;/span&gt;&lt;/i&gt;:&lt;/p&gt;
&lt;p&gt;Syed Waqas, an MBA student from Bhatkal pursuing an internship in Bangalore, was &lt;a href="http://www.thehindu.com/news/national/karnataka/student-from-bhatkal-held-for-antimodi-mms/article6047440.ece"&gt;picked up for questioning&lt;/a&gt; along with four of his friends after Belgaum social activist Jayant Tinaikar filed a complaint. The cause of the complaint was a MMS, allegedly derogatory to Prime Minister Narendra Modi.     <title>A Review of the Functioning of the Cyber Appellate Tribunal and Adjudicatory Officers under the IT Act</title>

        &lt;b&gt;Tribunals and quasi-judicial bodies are a regular feature of the Indian judicial system, as they provide for easier and less onerous methods for dispute resolution, especially disputes which relate to technical areas and often require technical knowledge and familiarity with specialised factual scenarios.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;Further, quasi-judicial bodies do not have the same procedural restrictions as proper courts, which makes the adjudication of disputes easier. The Information Technology Act of India, which regulates several important aspects of electronic information, including the regulation of private electronic transactions as well as detailing civil and criminal offences relating to computers and electronic information, contemplates a specialised dispute resolution mechanism for disputes relating to the offences detailed under the Act. The Act provides for the establishment of quasi-judicial bodies, namely adjudicating officers under S.46, to hear disputes arising out of Chapter IX of the Act, namely, offences of a civil nature under S.43, 43A, 44 and 45 of the Act, as well as criminal offences described under Chapter XI of the Act. The adjudicating officer has the power to both award compensation as damages in a civil remedy, as well as impose penalties for the contravention of the Act,&lt;a href="#fn1" name="fr1"&gt;[1]&lt;/a&gt; and therefore has powers of both civil and criminal courts. The first appellate body provided in the Act, i.e. the authority that any party not satisfied by the decision of the adjudicating officer can appeal to, is the Cyber Appellate Tribunal, consisting of a Chairperson and any other members so prescribed by the Central Government.&lt;a href="#fn2" name="fr2"&gt;[2] &lt;/a&gt;The second appeal, if a party is aggrieved by the decision of the Cyber Appellate Tribunal, may be filed before the High Court having jurisdiction, within 60 days from the date of communication of the order.&lt;a href="#fn3" name="fr3"&gt;[3] &lt;/a&gt;&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Functioning of the Offices of the State Adjudicating Officers and the Cyber Appellate Tribunal&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The office of the adjudicating officer is established under S.46 of the IT Act, which provides that the person appointed to such a post must be a government officer of a rank not below that of a Director or an equivalent rank, and must have experience both in the field of Information Technology as well as legal or judicial experience.&lt;a href="#fn4" name="fr4"&gt;[4]&lt;/a&gt; In most cases, the appointed adjudicating officer is the Principle Secretary to the Department of Information Technology in the state.&lt;a href="#fn5" name="fr5"&gt;[5]&lt;/a&gt; The decisions of these adjudicating officers determine the scope and meaning of several provisions of the IT Act, and are instrumental in the development of the law in this field and filling a lacuna regarding the interpretation of these important provisions, particularly in areas such as data protection and privacy.&lt;a href="#fn6" name="fr6"&gt;[6] &lt;/a&gt;However, despite the large number of cyber-crime cases being registered across the country,&lt;a href="#fn7" name="fr7"&gt;[7] &lt;/a&gt;there is a lack of available judgements on the adjudication of disputes under Sections 43, 43A, 44 and 45 of the Act. Of all the states, only the websites of the Departments of Information Technology in Maharashtra,&lt;a href="#fn8" name="fr8"&gt;[8]&lt;/a&gt;, Tamil Nadu&lt;a href="#fn9" name="fr9"&gt;[9]&lt;/a&gt;, New Delhi&lt;a href="#fn10" name="fr10"&gt;[10]&lt;/a&gt;, and Haryana&lt;a href="#fn11" name="fr11"&gt;[11] &lt;/a&gt;have reported judgements or orders of the Adjudicating Officers.  The adjudicating officer in Maharasthra, Rajesh Aggarwal, has done a particularly commendable job, having disposed of 51 cases under the IT Act, with 20 cases still pending.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The first Cyber Appellate Tribunal set up by the Central Government is located at New Delhi. Although a second branch of the Tribunal was to be set up in Bangalore, no efforts seem to have been made in this regard.&lt;a href="#fn12" name="fr12"&gt;[12]&lt;/a&gt; Further, the position of the Chairperson of the Appellate Tribunal, has been left vacant since 2011, after the appointed Chairperson attained the age of superannuation and retired. Although judicial and technical members have been appointed at various points, the tribunal cannot hold hearings without a chairperson. A total of 17 judgements have been passed by the Cyber Appellate Tribunal prior to the retirement of the chairperson, while the backlog of cases is continuously growing.&lt;a href="#fn13" name="fr13"&gt;[13] &lt;/a&gt;Despite a writ petition being filed before the Karnataka High Court and the secretary of the Department of IT coming on record to state that the Chairperson would be appointed within 6 months (of September 2013), no action seems to have been taken in this regard, and the lacunae in the judicial mechanism under the IT Act continues. The proper functioning of adjudicating officers and the Cyber Appellate Tribunal is particularly necessary for the functioning of a just judicial system in light of the provisions of the Act (namely, Section 61) which bar the jurisdiction of ordinary civil courts in claims below the amount of Rs. 5 Crores, where the adjudicating officer or the CAT is empowered.&lt;a href="#fn14" name="fr14"&gt;[14]&lt;/a&gt;&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Analysis of Cases Filed under Section 43A&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Section 43A of the Information Technology Act was inserted by the 2008 Amendment, and is the principle provision governing protection of information held by intermediaries under the Act. Section 43A provides that “body corporates” handling “sensitive personal data” must implement reasonable security practices for the protection of this information. If it is negligent in providing or maintaining such reasonable security practices, the body corporate is to be held liable and must pay compensation for the loss occurred.&lt;a href="#fn15" name="fr15"&gt;[15] &lt;/a&gt;Rule 3 of the Draft Reasonable Security Practices Rules, defines sensitive personal data as including – passwords, user details as provided at the time of registration or thereafter, information related to financial information such as Bank account/ credit card /debit card /other payment instrument details of the users, physiological and mental health conditions, medical records and history, biometric information, information received by body corporate for processing, stored or processed under lawful contract or otherwise and call data records.&lt;a href="#fn16" name="fr16"&gt;[16]&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;All the decisions of appointed adjudicators are available for an analysis of Section 43A are from the adjudicating officer in Maharashtra, Mr. Rajesh Tandon, who despite having no judicial experience, has very cogent analysis and knowledge of legal issues involved in the cases, which is commendable for a quasi-judicial officer.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;One class of cases, constituting a major chunk of the claims, is where the complainant is claiming against a bank for the fraudulent transfer of funds from the claimants account to another account. In most of these cases, the adjudicating officer examined the compliance of the bank with “Know Your Customer” norms and guidelines framed by the Reserve Bank of India for prevention of banking fraud and, where such compliance was found to be lacking and information which allowed the bank accounts of the complainant was allowed to be accessed by fraudsters, the presumption is that the bank was negligent in the handling of “sensitive personal information”,&lt;a href="#fn17" name="fr17"&gt;[17] &lt;/a&gt;by failing to provide for reasonable security practices and consequently was liable for compensation under S.43A, &lt;i&gt;notwithstanding &lt;/i&gt;that the complainant also contributed to compromising certain personal information by responding to phishing mails,&lt;a href="#fn18" name="fr18"&gt;[18]&lt;/a&gt; or divulging information to other third parties.&lt;a href="#fn19" name="fr19"&gt;[19] &lt;/a&gt;These instances clearly fall within the scope of Section 43A, which protects “information related to financial information such as Bank account/ credit card /debit card /other payment instrument details of the users” as sensitive personal data from negligent handling by body corporates. The decisions of the adjudicating officer must be applauded for placing a higher duty of care on banks to protect informational privacy of its customers, given that they are in a position where they ought to be well equipped to deal with intimate financial information and holding them accountable for lack of proper mechanisms to counter bank fraud using stolen information, which reflects in the compensation which the banks have been liable to pay, not only as indemnification for losses, but also punitive damages.&lt;a href="#fn20" name="fr20"&gt;[20]&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In &lt;i&gt;Nirmalkumar Bhagerwal v IDBI Bank and Meenal Bhagerwal, &lt;/i&gt;the sensitive financial information of the complainant, namely, the bank statement, had been accessed by the complainants wife. In holding the bank to be liable for divulging the same, and that access to personal information by a spouse is also covered under S.43A, the officer seems to have imputed the loss of privacy on account of such negligence as ‘wrongful loss’ which deserves compensation. One anomalous decision of the officer was where the operator of an ATM was held liable for fraudulent credit card transactions in that Machine, due to “reasonable security practices” such as security personnel or CCTV footage, and therefore causing the loss of “sensitive personal data”. However, it is difficult to see how ATM operators can be held liable for failing to protect sensitive information from being divulged, when the case is simply of a person fraudulently using a credit card.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Another class of cases, generally linked with the above cases, is complaints against cell phone providers for divulging information through falsely procured Sim Cards. In such instances, the officer has held that by negligently allowing the issuance of duplicate sim cards, the phone company has &lt;i&gt;led to the access of sensitive personal data and thus caused wrongful loss to the complainant.&lt;/i&gt; This interpretation of Section 43A is somewhat confusing. The officer seems to have interpreted the provisions of Section 43A to include &lt;i&gt;carriers&lt;/i&gt; of the information which was originally sent through the computer resource of the banking companies. In this way, they are imputed the status of “handlers” of sensitive personal information, and their communications infrastructure through which the information is sent is the “computer resource” which it operates for the purpose of the Act. Therefore, through their negligence, they are &lt;i&gt;abetting &lt;/i&gt;the offence under 43A.&lt;a href="#fn21" name="fr21"&gt;[21]&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;For example, in the case of &lt;i&gt;Sanjay Govind Dhandhe v ICICI and Vodafone, &lt;/i&gt;the officer remarked that –“&lt;i&gt;A SIM card is a veritable key to person’s sensitive financial and personal information. Realizing this, there are clear guidelines issued by the DOT regarding the issuance of SIM cards. The IT Act also intends to ensure that electronic personal and sensitive data is kept secured and reasonable measures are used to maintain its confidentiality and integrity. It is extremely crucial that Telecom companies actively follow strict security procedures while issuing SIM cards, especially in wake of the fact that mobiles are being increasingly used to undertake financial transactions. In many a case brought before me, financial frauds have been committed by fraudsters using the registered mobile numbers of the banks’ account holders.&lt;/i&gt;” Therefore, intermediaries such as telecom companies, which peripherally handle the data, are also liable under the same standards for ensuring its privacy. The adjudicating officer has also held telephone companies liable for itemized phone bills as Call Data Records negligently divulged by them, which again clearly falls under the scope of the Reasonable Security Practices Rules.&lt;a href="#fn22" name="fr22"&gt;[22]&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Note:&lt;/b&gt;&lt;/p&gt;

This case&lt;/i&gt; holds  that banks and the National Payments Corporation of India were liable  under S. 43A for divulging information relating to transactions by their  customers to a software company which provides services to these banks  using the data, without first making them sign non-disclosure  agreements. The NCPI was fined a nominal amount of Rs. 10,000."&lt;/p&gt;

&lt;p&gt;Fresh suit received by assignment. It be checked and registered.&lt;/p&gt;
&lt;p&gt;Present: Plaintiff in person with Ld. Counsel.&lt;/p&gt;
&lt;p&gt;Ld. Counsel for plaintiff prayed for ex-parte ad-interim injunction. He has filed the present suit for permanent and mandatory injunction against 22 defendants who are running their social networking websites under the name of Facebook, Google India (P) Ltd., Yahoo India (P) Ltd., Microsoft India (P) Ltd., Orkut, Youtube etc as shown in the memo of parties in the plaint.  It is submitted that plaintiff is an active citizen of India and residing at the given address and he believes in Secular, Socialist and Democratic India professing Muslim religion.  It is further submitted that the contents which are uploaded by some of the miscreants through these social networking websites mentioned above are highly objectionable and unacceptable by any set of the society as the contents being published through the aforesaid websites are derogatory, per-se inflammatory and defamatory which cannot be acceptable by any of the society professing any religion.  Even if the same is allowed to be published through these social networking websites and if anybody will take out the print and circulated amongst any of the community whether it is Muslim or Hindu or Sikh, then definitely there would be rioting at mass level which may result into serious law and order problem in the country. Where the miscreants have not even spare any of the religion, even they have created defamatory articles and pictures against the Prophet Mohammad, the Hindu goddess Durga, Laxmi, Lord Ganesha and many other Hindu gods which are being worshiped by the people of Hindu community. It is prayed by the counsel for plaintiff that the defendants may be directed to remove these defamatory and derogatory articles and pictures from their social websites and they should be restrained from publishing the same anywhere through Internet or in any manner.  It is further submitted that the social websites are being utilised by the every person of whatever age of he is whether he is 7 years old or 80 years old.  These defamatory articles will certainly corrupt not only young minds below the 18 years of age but also corrupt the minds of all age group persons. It is further submitted that even the miscreants have not spared the leaders of any political party whether it is BJP, Congress, Shiv Sena or any other political party doing their political activities in India, which may further vitiate the minds of every individual and may result into political rivalry by raising allegations against each other.&lt;/p&gt;
&lt;p&gt;I have gone through the record carefully wherein the plaintiff has also filed a CD containing all the defamatory articles and photographs, plaintiff also wants to file certain defamatory and obscene photographs of the Prophet Mohammad and Hindu Gods and Goddesses.  Photographs are returned to the plaintiff, although, the defamatory written articles are taken on record. Same be kept in sealed cover.&lt;/p&gt;
&lt;p&gt;In my considered opinion, the photographs shown by the plaintiff having content of defamation and derogation against the sentiments of every community. In such circumstances, I am of the view that the plaintiff has a prima facie case in his favour. Moreover, balance of convenience also lies against the defendants and in favour of the plaintiff.  Moreover, if the defendants will not be directed to remove the defamatory articles and contents from their social networking websites, then not only the plaintiff but every individual who is having religious sentiments would suffer irreparable loss and injury which cannot be compensated in terms of money.  Accordingly, in view of the above discussion, taking in consideration the facts and circumstances and nature of the suit filed by the plaintiff where every time these social networking websites are being used by the public at large and there is every apprehension of mischief in the public, the defendants are hereby restrained from publishing the defamatory articles shown by the plaintiff and contained in the CD filed by the plaintiff immediately on service of this order and notice. Defendants are further directed to remove the same from their social networking websites.&lt;/p&gt;
&lt;p&gt;Application under Order 39 Rule 1 &amp;amp; 2 CPC stands allowed and disposed of accordingly.&lt;/p&gt;
&lt;p&gt;Summons be issued to the defendants on filing of PF/RO/Speed Post.  The defendants having their addresses in different places may be served as per the provisions of Order 5 CPC. Reader of this court is directed to keep the documents and CD in a sealed cover.  Plaintiff is directed to get served the defendants along with all the documents. Plaintiff is further directed to ensure the compliance of the provisions under Order 39 Rule 3 CPC and file an affidavit in this regard. Copy of this order be given dasti.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;There was a lot of structural change between the draft rules and the official rules—many of the draft clauses were shuffled around and combined—but not a lot of change in content. Many of the changes that appear in the official rules serve to clarify parts of the draft rules.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Three definitions were added under clause (2), two to clarify later references to a “designated officer” and a “nodal officer” and the third to indicate a form appended to the official Rules.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Clause (3) of the official rules then clarifies who shall be named the “designated officer”, which was not done in the draft rules as there was no inclusion of an official title of the officer who would have the responsibilities of the “designated officer”. Interestingly, clause (3) of the draft rules requires the Secretary of the Department of Information Technology, Ministry of Communications &amp;amp; Information Technology, Government of India to name an officer, whereas clause (3) of the official rules states that the “Central Government” shall designate an officer, a change in language that allows for much more flexibility on the government's part.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Clause (5) in the draft rules and clause (4) in the official rules deal with the designation of a Nodal Officer, but omitted in the official rules are responsibilities of the designated officer, which includes acting on the “direction of the indian competent court”. This responsibility does not appear in any part of the official rules. Further, clause (4) of the official rules requires the organizations implicated in the rules to publish the name of the Nodal Officer on their website; this is an addition to the draft rules, and a highly useful one at that. This is an important move towards some form of transparency in this contentious process.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Clause (5) of the official rules significantly clarifies clause (4) of the draft rules by stating that the designated officer may direct any Agency of the Government or intermediary to block access &lt;i&gt;once a request from the Nodal Officer has been received&lt;/i&gt;.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Clause (7) of the official rules uses the word “information” instead of “computer resource”, which is used in the corresponding clause (12) in the draft rules, when referring to the offending object. This change in language significantly widens the scope of what can be considered offending under the rules.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The sub-sections (2), (3) and (4) of clause (9) of the official rules are additions to the draft rules. Sub-section (2) is a significant addition, as it deals with the ability of the Secretary of the Department of Information Technology's ability to block for public access any information or part thereof without granting a hearing to the entity in control of the offending information &lt;i&gt;in a case of emergency nature. &lt;/i&gt;The request for blocking will then be brought before the committee of examination of request &lt;i&gt;within 48 hours of the issue of direction&lt;/i&gt;, meaning that the offending information could be blocked for two days without giving notice to the owner/controller of the information of the reason for the blockage.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;An important clarification has been included in clause (15) of the official rules, which differs from clause (23) of the draft rules through the inclusion of the following phrase: “The Designated Officer shall maintain complete record of the &lt;i&gt;request received and action taken thereof &lt;/i&gt;[...] of the cases of blocking for public access”. This is a significant change from clause (23), which simply states that the “Designated Officer shall maintain complete &lt;i&gt;record&lt;/i&gt; [...] of the cases of blocking”. This could be seen as an important step towards transparency and accountability in the 69B process of blocking information for public access if clause (16) of the official rules did not state that all requests and complaints received and all actions taken thereof must be kept confidential, so the maintenance of records mentioned in clause (15) of the official rules appears to be only for internal record-keeping. However, just the fact that this information is being recording is a significant change from the draft rules, and may, if the sub-rules relating to confidentiality were to be changed, be useful data for the public.&lt;/p&gt;

    <title>Analysing Latest List of Blocked Sites (Communalism &amp; Rioting Edition)</title>

&lt;h2&gt;&lt;b&gt;How many items have been blocked?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;There   are a total of 309 specific items (those being URLs, Twitter accounts,   img tags, blog posts, blogs, and a handful of websites) that have been   blocked. This number is meaningless at one level, given that it doesn't   differentiate between the blocking of an entire website (with dozens  or  hundreds of web pages) from the blocking of a single webpage.  However,  given that very few websites have been blocked at the  domain-level, that  number is still reasonably useful.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Please   also note, we currently only have information related to what telecom   companies and Internet Service Providers (ISPs) were asked to block  till  August 21, 2012. We do not have information on what individual web   services have been asked to remove. That might take the total count  much  higher.&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;Why have these been blocked?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;As far   as I could determine, all of the blocked items have content (mostly   videos and images have been targeted, but also some writings) that are related to communal issues and rioting. (Please note: I am not calling the content itself "communal" or "incitement to rioting", just that the   content relates to communal issues and rioting.) This has been done in the context of the recent riots in Assam, Mumbai, UP, and the mass   movement of people from Bangalore.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There   were reports of parody Twitter accounts having been blocked.  Preliminary  analysis on the basis of available data show that parody  Twitter  accounts and satire sites have &lt;i&gt;not&lt;/i&gt; been targetted solely  for  being satirical. For instance, very popular parody Twitter  accounts,  such as @DrYumYumSingh are not on any of the four orders  circulated by  the Department of Telecom. (I have no information on  whether such parody  accounts are being taken up directly with Twitter  or not: just that  they aren't being blocked at the ISP-level. Media  reports indicate &lt;a href="http://goo.gl/GI9jP"&gt;six accounts have been taken up with Twitter&lt;/a&gt; for being similar to the Prime Minister's Office's account.)&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;Are the blocks legitimate?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;The   goodness of the government's intentions seem, quite clearly in my   estimation, to be unquestionable. Yet, even with the best intentions,   there might be procedural illegalities and over-censorship.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There   are circumstances in which freedom of speech and expression may   legitimately be limited. The circumstances that existed in Bangalore   could justifiably result in legitimate limitations on freedom of speech.   For instance, I believe that temporary curbs — such as temporarily   limiting SMSes &amp;amp; MMSes to a maximum of five each fifteen minutes for   a period of two days — would have been helpful.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;However   it is unclear whether the government has exercised its powers   responsibly in this circumstance. The blocking of many of the items on   that list are legally questionable and morally indefensible, even while a   some of the items ought, in my estimation, to be removed.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;If the   government has blocked these sites under s.69A of the Information   Technology Act ("Power to Issue Directions for Blocking for Public   Access of Any Information through any Computer Resource"), the persons   and intermediaries hosting the content should have been notified   provided 48 hours to respond (under Rule 8 of the Information Technology   (Procedure and Safeguards for Blocking for Access of Information by   Public) Rules 2009). Even if the emergency provision (Rule 9) was used,   the block issued on August 18, 2012, should have been introduced before   the "Committee for Examination of Request" by August 20, 2012 (i.e.,   within 48 hours), and that committee should have notified the persons   and intermediaries hosting the content.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Importantly,   even though many of the items on that list are repugnant and do  deserve  (in my opinion) to be removed, ordering ISPs to block them is  largely  ineffectual. The people and companies hosting the material  should have  been asked to remove it, instead of ordering Internet  service providers  (ISPs) to block them. All larger sites have clear  content removal  policies, and encouraging communal tensions and hate  speech generally  wouldn't be tolerated. That this can be done without  resort to the  dreadful Intermediary Guidelines Rules (which were passed  last year)  shows that those Rules are unnecessary. It is our belief  that &lt;a href="https://cis-india.org/internet-governance/constitutional-analysis-of-intermediaries-guidelines-rules"&gt;those Rules are also unconstitutional&lt;/a&gt;.&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;Are there any egregious mistakes?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;Yes, there are numerous such examples of egregious mistakes.&lt;/p&gt;
&lt;ol&gt;
&lt;li style="text-align: justify; "&gt;Most importantly, some even &lt;b&gt;people and posts      debunking rumours have been blocked&lt;/b&gt;.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;Some   of the Twitter accounts are of prominent      people who write for the   mainstream media, and who have written similar      content offline. If   their online content is being complained about, their      offline   content should be complained about too.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;Quite  a  number of the links include articles      published and reports   broadcast in the mainstream media (including a Times      Now report, a   Telegraph picture gallery, etc.), and in print, making the      blocks   suspect. Only the online content seems to have been targeted for        censorship.&lt;/li&gt;
&lt;/ol&gt;
&lt;p style="text-align: justify; "&gt;There are numerous mistakes and inconsistencies that make blocking pointless and ineffectual.&lt;/p&gt;
&lt;ol&gt;
&lt;li&gt;Some of the items are not even web addresses      (e.g., a few HTML img tags were included).&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;Some of the items they have tried to block do not      even exist (e.g., one of the Wikipedia URLs).&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;An entire domain was blocked on Sunday, and a      single post on that domain was blocked on Monday.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;For   some Facebook pages, the secure version      (https://facebook.com/...)   is listed, for others the non-secure version        (http://facebook.com/...) is listed.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;For   some YouTube videos, the 'base' URL of      YouTube videos is blocked,   but for other the URL with various parameters      (like the   "&amp;amp;related=" parameter) is blocked. That means that      even   nominally 'blocked' videos will be freely accessible.&lt;/li&gt;
&lt;/ol&gt;
&lt;p&gt;All in all, it is clear that the list was not compiled with sufficient care.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Despite   a clear warning by the DIT that "above URLs only" should be blocked,   and not "the main websites like www.facebook.com, www.youtube.com,   www.twitter.com, etc.", it has been seen that some ISPs (like Airtel) &lt;a href="http://www.labnol.org/india/india-blocks-youtube/25028/"&gt;have gone overboard in their blocking&lt;/a&gt;.&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;Why haven't you put up the whole list?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;Given   the sensitivity of the issue, we felt it would be premature to share  the  whole list. However, we strongly believe that transparency should  be an  integral part of all censorship. Hence, this analysis is an  attempt to  provide some much-needed transparency. We intend to make the  entire list  public soon, though. (Given how porous such information  is, it is  likely that someone else will procure the list, and release  it sooner  than us.)&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;Why can I still access many items that are supposed to be blocked?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;One   must keep in mind that fresh orders have been issued on a day-by-day   basis, that there are numerous mistakes in the list making it difficult   to apply (some of these mistakes have been mentioned above), and the   fact that that this order has to be implemented by hundreds of ISPs.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Your   ISP probably has not have got around to enforcing the blocks yet. At the   time of this writing, most ISPs don't seem to be blocking yet. This   analysis is based on the orders sent around to ISPs, and not on the   basis of actual testing of how many of these have actually been blocked   by Airtel, BSNL, Tata, etc.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Additionally,   if you are using Twitter through a client (on your desktop, mobile,   etc.) instead of the web interface, you will not notice any of the   Twitter-related blocks.&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;So you are fine with censorship?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;No. I   believe that in some cases, the government has the legal authority to   censor. Yet, exercising that legal authority is usually not productive,   and in fact there are other, better ways of limiting the harms caused  by  speech and information than censorship. Limiting speech might even   prove harmful in situations like these, if it ends up restricting   people's ability to debunk false rumours. In a separate blog post (to be   put up soon), I am examining how all of the government's responses  have  been flawed both legally and from the perspective of achieving the   desired end.&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;So what should the government have done?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;Given   that the majority of the information it is targeting is on Facebook,   Youtube, and Twitter, the government could have chosen to fight &lt;i&gt;alongside&lt;/i&gt; those services to get content removed expeditiously, rather than fight &lt;i&gt;against&lt;/i&gt; them. (There are &lt;a href="http://www.firstpost.com/videos/govt-to-use-social-media-to-prevent-misuse-of-technology-sibal-426231.html"&gt;some indications&lt;/a&gt; that the government might be working with these services, but it certainly isn't doing enough.)&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;For   instance, it could have asked all of them to expedite their complaints   mechanism for a few days, by ensuring that the complaints mechanism is   run 24x7 and that they respond quickly to any complaint submitted about   communal incitement, spreading of panic, etc. This does not need the   passing of an order under any law, but requires good public relations   skills and a desire not to treat internet services as enemies. The   government could have encouraged regular users to flag false rumours and   hate speech on these sites. On such occasions, social networking sites   should step up and provide all lawful assistance that the government  may  require. They should also be more communicative in terms of the  help  they are providing to the government to curtail panic-inducing  rumours  and hate speech. (Such measures should largely be reactive, not   proactive, to ensure legitimate speech doesn't get curtailed.)&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The   best antidote for the rumours that spread far and wide and caused a mass   movement of people from Bangalore to the North-Eastern states would   have been clear debunking of those rumours. Mass outreach to people in   the North-East (very often the worried parents) and in Bangalore using   SMSes and social media, debunking the very specific allegations and   rumours that were floating around, would have been welcome. However,   almost no government officials actually used social media platforms to   reach out to people to debunk false information and reassure them. Even a   Canadian interning in our organization got a reassuring SMS from the   Canadian government.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is indeed a pity that the government &lt;a href="https://cis-india.org/internet-governance/resources/citizen-engagement-framework-for-e-governance-projects-and-framework-and-guidelines-for-use-of-social-media-by-government-agencies"&gt;notified a social media engagement policy today&lt;/a&gt;, when the need for it was so very apparent all of the past week.&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;And what of all this talk of cybersecurity failure and cyber-wars?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;Cybersecurity   is indeed a cause of concern for India, but only charlatans and the   ignorant would make any connection between India's cybersecurity and   recent events. The role of Pakistan deserves a few words. Not many   Pakistani websites / webpages have been blocked by the Indian   government. Two of the Pakistani webpages that have been blocked are   actually pages that debunk the fake images that have been doing the   rounds in Pakistan for at least the past month. Even Indian websites &lt;a href="http://kafila.org"&gt;like Kafila&lt;/a&gt; have noted these fake images long ago, and &lt;a href="http://kafila.org/2012/08/05/national-contestation-not-religion-responsible-for-the-plight-of-myanmars-rohingyas-ayesha-siddiqa/"&gt;Ayesha Siddiqa wrote about this on August 5, 2012&lt;/a&gt;, and &lt;a href="http://kafila.org/2012/08/13/how-to-start-a-riot-out-of-facebook-yousuf-saeed/"&gt;Yousuf Saeed wrote about it on August 13, 2012&lt;/a&gt;.   Even while material that may have been uploaded from Pakistan, it  seems  highly unlikely they were targeted at an Indian audience, rather  than a  Pakistani or global one.&lt;/p&gt;

    <title>CIS Welcomes Standing Committee Report on IT Rules</title>

        &lt;b&gt;The Centre for Internet and Society welcomes the report by the Standing Committee on Subordinate Legislation, in which it has lambasted the government and has recommended that the government amend the Rules it passed in April 2011 under section 79 of the Information Technology Act.&lt;/b&gt;
        &lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;&lt;a class="external-link" href="http://www.prsindia.org/uploads/media/IT%20Rules/IT%20Rules%20Subordinate%20committee%20Report.pdf"&gt;Click to read&lt;/a&gt; the Parliamentary Standing Committee Report on the IT Rules. A modified version was &lt;a class="external-link" href="http://www.ciol.com/ciol/news/185991/cis-welcomes-panels-anti-govt-stand-it-rules"&gt;published in CiOL&lt;/a&gt; on March 27, 2013.&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;These rules have been noted by many, including CIS, Software Freedom Law Centre, and Society for Knowledge Commons, and many eminent lawyers, as being unconstitutional. The Standing Committee, noting this, has asked the government to make changes to the Rules to ensure that the fundamental rights to freedom of speech and privacy are safeguarded, and that the principles of natural justice are respected when a person’s  freedom of speech or privacy are curtailed.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Ambiguous and Over-reaching Language&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The Standing Committee has noted the inherent ambiguity of words like "blasphemy", "disparaging", etc., which are used in the Intermediary Guidelines Rules, and has pointed out that unclear language can lead to harassment of people as has happened with Section 66A of the IT Act, and can lead to legitimate speech being removed.  Importantly, the Standing Committee recognizes that many categories of speech prohibited by the Intermediary Guidelines Rules are not prohibited by any statute, and hence cannot be prohibited by the government through these Rules.  Accordingly, the Standing Committee has asked the government to ensure "no new category of crimes or  offences is created" by these Rules.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Government Confused Whether Rules Are Mandatory or Advisory&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The Standing Committee further notes that there is a discrepancy in the government’s stand that the Intermediary Guidelines Rules are not mandatory, and are only "of advisory nature and self-regulation", and that "it is not mandatory for the Intermediary to disable the information, the rule does not lead to any kind of censorship". The Standing Committee points out the flaw in this, and notes that the language used in the rules is mandatory language (“shall act” within 36 hours). Thus, it rightly notes that there is a "need for clarity on the aforesaid contradiction".  Further, it also notes that there is "there should be safeguards to protect against any abuse", since this is a form of private censorship by intermediaries."&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Evidence Needed Against Foreign Websites&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The government has told the Standing Committee that "foreign websites repeatedly refused to honour our laws", however, it has not provided any proof for this assertion.  The government should make public all evidence that foreign web services are refusing to honour Indian laws, and should encourage a public debate on how we should tackle this problem in light of the global nature of the Internet.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Cyber Cafes Rules Violate Citizens’ Privacy&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The Standing Committee also pointed out that the Cyber Cafe Rules violated citizens’ right to privacy in requiring that "screens  of the computers installed other than in partitions and  cubicles should face open space of the cyber café".  Unfortunately, the Standing Committee did not consider the privacy argument against retention of extensive and intrusive logs. Under the Cyber Cafe Rules, cyber cafes are required to retain (for a minimum of one year) extensive logs, including that of "history of websites accessed using computer resource at cyber café" in such a manner that each website accessed can be linked to a person. The Committee only considered the argument that this would impose financial burdens on small cybercafes, and rejected that argument.  CIS wishes the Committee had examined the provision on log maintenance on grounds of privacy as well."&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Government’s Half-Truths&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;In one response, the government notes that "rules under Section 79 in particular have undergone scrutiny by High Courts in the country. Based on the Rules, the courts have given reliefs to a number of individuals and organizations in the country. No provision of the Rules notified under Sections 43A and 79 of the IT  Act, 2000 have been held &lt;i&gt;ultra vires&lt;/i&gt;."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;What the government says is a half-truth.  So far, courts have not struck down any of the IT Rules. But that is because none of the High Court cases in which the vires of the Rules have been challenged has concluded. So it is disingenuous of the government to claim that the Rule have "undergone scrutiny by High Courts".  And in those cases where relief has been granted under the Intermediary Guidelines, the cases have been ex-parte or have been cases where the vires of the Rules have not been challenged.  The government, if it wants to defend the Rules, should point out to any case in which the vires of the Rules have been upheld.  Not a single court till date has declared the Rules to be constitutional when that question was before it.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Lack of Representation of Stakeholders in Policy Formulation&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Lastly, the Standing Committee noted that it is not clear whether the Cyber Regulatory Advisory Committee (CRAC), which is responsible for policy guidance on the IT Act, has "members representing the interests of  principally affected or having special knowledge of the  subject matter as expressly stipulated in Section 88(2) of the  IT Act".  This is a problem that we at CIS also noted in November 2012, when the CRAC was reconstituted after having been defunct for more than a decade.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;CIS hopes that the government finally takes note of the view of legal experts, the Standing Committee on Delegated Legislation, the Parliamentary motion against the Rules, and numerous articles and editorials in the press, and withdraws the Intermediary Guidelines Rules and the Cyber Cafe Rules, and instead replaces them with rules that do not infringe our constitutional rights.&lt;/p&gt;
&lt;hr /&gt;

&lt;p&gt;Following a legal notice from Dina Nath Batra, publisher Orient BlackSwan &lt;a href="http://indianexpress.com/article/india/india-others/its-batra-again-book-on-sexual-violence-in-ahmedabad-riots-is-set-aside-by-publisher/"&gt;“set aside… for the present”&lt;/a&gt; &lt;i&gt;Communalism and Sexual Violence: Ahmedabad Since 1969&lt;/i&gt; by Dr. Megha Kumar, citing the need for a “comprehensive assessment”. Dr. Kumar’s book is part of the ‘Critical Thinking on South Asia’ series, and studies communal and sexual violence in the 1969, 1985 and 2002 riots of Ahmedabad. Orient BlackSwan insists this is a pre-release assessment, while Dr. Kumar contests that her book went to print in March 2014 after extensive editing and peer review. Dina Nath Batra’s civil suit &lt;a href="http://www.nybooks.com/articles/archives/2014/may/08/india-censorship-batra-brigade/"&gt;led Penguin India to withdraw&lt;/a&gt; Wendy Doniger’s &lt;i&gt;The Hindus: An Alternative History&lt;/i&gt; earlier this year.&lt;/p&gt;

&lt;p&gt;Chief Minister Omar Abdullah announced the &lt;a href="http://www.onislam.net/english/news/asia-pacific/473153-youth-cheer-kashmirs-sms-ban-lift.html"&gt;withdrawal of a four-year-old SMS ban&lt;/a&gt; in the state. The ban was instituted in 2010 following widespread protests, and while it was lifted for post-paid subscribers six months later, pre-paid connections were banned from SMSes until now.&lt;/p&gt;

&lt;p&gt;A young Muslim man was &lt;a href="http://indianexpress.com/article/india/politics/muslim-techie-beaten-to-death-in-pune-7-men-of-hindu-outfit-held/"&gt;murdered&lt;/a&gt; in Pune, apparently connected to the online publication of ‘derogatory’ pictures of Chhatrapati Shivaji and Bal Thackarey. Members of Hindu extremists groups &lt;a href="http://www.hindustantimes.com/india-news/pune-techie-killed-sms-boasts-of-taking-down-first-wicket/article1-1226023.aspx"&gt;celebrated&lt;/a&gt; his murder, it seems. Pune’s BJP MP, Anil Shirole, &lt;a href="http://timesofindia.indiatimes.com/India/Pune-techie-murder-BJP-MP-says-some-repercussions-to-derogatory-FB-post-natural/articleshow/36112291.cms"&gt;said&lt;/a&gt;, “some repercussions are natural”. Members of the Hindu Rashtra Sena &lt;a href="http://www.thehindu.com/news/national/other-states/seven-rightwing-activists-held-over-techies-killing-in-pune/article6081812.ece"&gt;were held&lt;/a&gt; for the murder, but it seems that the photographs were uploaded from &lt;a href="http://www.deccanchronicle.com/140606/nation-crime/article/pune-techie-murder-fb-pictures-uploaded-foreign-ip-addresses"&gt;foreign IP addresses&lt;/a&gt;. Across Maharashtra, 187 rioting&lt;a href="http://timesofindia.indiatimes.com/city/mumbai/Offensive-FB-posts-187-rioting-cases-filed-710-held/articleshow/36176283.cms"&gt;cases have been registered&lt;/a&gt; against a total of 710 persons, allegedly in connection with the offensive Facebook posts.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;The NDTV anchor asked Pranesh that this notice — the indicator coming from the government is that nobody seems to really know what section 66A is all about...and at the end of the day we are going to make a case by case decision.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Pranesh said that:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"This not just about 66A. This is actually about rule of law. We see that the arrest of Kanwal Bharti is actually a legal arrest. It goes against a judgment of the Allahabad High Court saying that routine arrests shouldn't be made in cases where the imprisonment term is less than 7 years. He actually hasn't been charged under 66A, he was charged under the IPC. It is not just about Internet censorship. It also very much about the rule of law and that completely breaking down in India and ... people's persectives and government's perspectives many times  are withering away when it comes offensive content or what they deem offensive or communal content being posted online...and if  something like what  Kanwal Bharti posted is actually deemed to be illegal under those provisions then lots of statements that the Prime Minister  of India has said should also be deemed to be equally illegal."&lt;/p&gt;

&lt;p&gt;Rajya Sabha’s member of parliament (MP) from Kerala, P Rajeeve, whose &lt;a class="external-link" href="http://164.100.47.5/newsite/bulletin2/Bull_No.aspx?number=49472"&gt;statutory motion&lt;/a&gt; to annul the IT (Intermediaries Guidelines) Rules 2011 is slated for discussion in Parliament tomorrow, aims to convene a meeting of MPs, internet societies, and bloggers in the first week of May to create awareness against the &lt;a class="external-link" href="http://www.legallyindia.com/201201182502/Legal-opinions/sopa-blackout-day-bah-wheres-the-kolaveri-about-indias-it-act-intermediaries-rules"&gt;draconian effect&lt;/a&gt; of the rules.&lt;/p&gt;
&lt;p&gt;“Most of the MPs need to know about this,” Rajeeve told Legally India, explaining that statutory motions are generally not easy to pass. “Actually we are trying to create awareness by organizing a session. The issue will be the IT Rules 2011 and how it is against the constitution, how it is against natural justice, how it is against due process of law.”&lt;br /&gt;&lt;br /&gt;“The motion has been accepted. The committee has allotted time for discussion on the twenty fourth. Thereafter it will come to the house. In this part of the session I am trying to coordinate other MPs to get support”, he said.&lt;/p&gt;
&lt;p&gt;Rajeeve’s motion of 23 March 2012, as first reported by &lt;a href="https://cis-india.org/internet-governance/blog/statutory-motion-against-intermediary-guidelines-rules/" class="external-link"&gt;CIS-India&lt;/a&gt;, was not his first attempt at bringing the IT rules into the spotlight. When the rules were in draft stage, he had made a &lt;a class="external-link" href="http://rajeev.in/pages/..%5CNews%5Ccensorship_Blogs%5CBloggers_Internet.html"&gt;zero hour mention&lt;/a&gt; against them for being in violation of freedom of speech and expression, by over-scrutinising bloggers, over-authorising intermediaries, and letting the government, individuals and institutions by-pass the due process of law.&lt;/p&gt;
&lt;p&gt;Rajeeve was one of the nine panelists in the open discussion on “Resisting Internet Censorship”, organised by the Centre for Internet and Society (CIS) and Foundation for Media Professionals, in Bangalore on Saturday, 21 April. The discussion, addressing an audience of 40, was moderated by veteran journalist Paranjoy Guha Thakurta.&lt;/p&gt;
&lt;p&gt;Other panelists included Mahesh Murthy, founder of digital marketing website Pinstorm, Sudhir Krishnaswamy, founding member of Centre for Law and Policy Research, Na Vijayashankar, director of Cyber Law College, and Siddharth Narain from the Alternative Law Forum.&lt;/p&gt;
&lt;p&gt;Also on the panel were Rishabh Dara,&lt;a class="external-link" href="http://www.google.com/policyfellowship/"&gt; Google policy fellow&lt;/a&gt; who conducted &lt;a href="https://cis-india.org/internet-governance/intermediary-liability-in-india" class="external-link"&gt;a study last year on intermediary liability in India and its chilling effects on free expression&lt;/a&gt;, BG Mahesh, founder of Oneindia.com, Ram Bhat, co-founder of community media collective Maraa, and Pranesh Prakash, programme manager at CIS.&lt;/p&gt;
&lt;p&gt;Prakash said that the discussion brought together different perspectives, even those of the entrepreneur, like BG Mahesh and Mahesh Murthy. “Transparency in the terms of censorship is good. We are not saying all censorship is bad, but that it should be transparent.”&lt;/p&gt;
&lt;p&gt;Prakash told Legally India about the various experiences shared by panelists, of the lack of transparency in the present system of censorship. While one faced harassment by the police over trivial procedural compliances, there was complaint for defamation against an article syndicated by another from a different publication’s press release. “And we read the article over and over and over again but couldn’t find anything which was remotely defamatory.”&lt;br /&gt;&lt;br /&gt;Legal experts on the panel, Kirshnaswamy and Vijayashankar, spoke about the constitutionalism behind free speech provisions. Narain shed light on the fact that while excessive energy has been expended on highlighting which content should not be banned, little has been spent on examining the operative procedures behind censorship.&lt;br /&gt;&lt;br /&gt;Dara spoke about his research and how it not only revealed that content was being frivolously removed on complaints to intermediaries, but also that the people whose content was being removed were not being informed of the same. There was no public notice of the removal.&lt;br /&gt;&lt;br /&gt;Bhat’s discourse drew attention to the history of censorship in India and elicited the fact that the Indian press has in fact been censored in an upsetting manner even since the revolt of 1857.&lt;/p&gt;
&lt;p&gt;Murthy made the observation that statistically speaking, in India the number of internet users exceeds television watchers, which has made social media unfathomably important while the internet is no longer elitist.&lt;br /&gt;&lt;br /&gt;A number of related Indian initiatives have been gathering momentum in recent months, such as&amp;nbsp;&lt;a class="external-link" href="http://softwarefreedom.in/index.php?option=com_content&amp;amp;view=article&amp;amp;id=97:campaign-for-freedom-on-the-internet&amp;amp;Itemid=83"&gt; signature campaigns&lt;/a&gt; for &lt;a class="external-link" href="https://www.change.org/petitions/mps-of-india-support-the-annulment-motion-to-protect-internet-freedom-stopitrules"&gt;internet freedom&lt;/a&gt;, and offline protests such as the &lt;a class="external-link" href="http://friendsofinternet.wikispaces.com/"&gt;Free Software Movement in Karnataka&lt;/a&gt; and the &lt;a class="external-link" href="http://kafila.org/2012/04/21/freedom-in-the-cage-22-april-2012/"&gt;Save your Voice in Delhi&lt;/a&gt;, are the order of the day. Other actions include &lt;a class="external-link" href="http://www.legallyindia.com/201201182502/Legal-opinions/sopa-blackout-day-bah-wheres-the-kolaveri-about-indias-it-act-intermediaries-rules"&gt;writing to MPs&lt;/a&gt;, asking them to vote in favor of Rajeeve’s statutory motion for annulment of the IT rules.&lt;/p&gt;
&lt;p&gt;Kerala-based advocate Shojan Jacob filed the f&lt;a class="external-link" href="http://www.legallyindia.com/201203062622/Bar-Bench-Litigation/read-first-writ-challenging-censorious-it-act-intermediaries-rules-in-kerala"&gt;irst ever writ challenging the rules&lt;/a&gt; in the Kerala High Court last month.&lt;/p&gt;
&lt;p&gt;The rules enable any individual or public or private institution to get content removed from websites, in most cases simply by notifying the website owners or intermediaries such as Google, Yahoo and others.&lt;/p&gt;
&lt;p&gt;Takedown requests can be based on any of &lt;a class="external-link" href="http://www.legallyindia.com/201201182502/Legal-opinions/sopa-blackout-day-bah-wheres-the-kolaveri-about-indias-it-act-intermediaries-rules"&gt;15 vaguely drafted parameters&lt;/a&gt;, without stating any reasons or requiring any judicial or quasi-judicial order in support.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;India’s information technology (IT) minister, Kapil Sibal appears to be running into rough weather over IT rules framed last year, which curb freedom of expression on the internet. The rules have incensed India’s growing blogging community and piqued at least a few of his fellow parliamentarians.&lt;/p&gt;
&lt;p&gt;On the opening day of the upcoming parliamentary session on Tuesday, the Rajya Sabha is set to vote on an annulment motion against the IT rules, moved by P. Rajeeve of the Communist Party of India (Marxist), a rediff.com report said. Ironically, the party that still treats Stalin as a hero (quoting him unfailingly in its political resolutions) has become the first to stand up for internet freedom.&lt;br /&gt;Rajeeve is of course not the only parliamentarian to take exception to the rules. Jayant Choudhry, a member of parliament (MP) from the Rashtriya Lok Dal, was the first to draw attention to the draconian rules late last year, and MPs from other regional parties such as the Samajwadi Party and the Asom Gana Parishad criticized the rules in a parliamentary discussion in December.&lt;br /&gt;&lt;br /&gt;Two sets of rules, one governing cyber cafes and the other relating to intermediaries have attracted most criticism. The rules relating to intermediaries such as internet service providers, search engines or interactive websites such as Twitter and Facebook are the most disturbing. Intermediaries are required under the current rules to remove content that anyone objects to, within 36 hours of receiving the complaint, without allowing content creators any scope of defence.&lt;br /&gt;&lt;br /&gt;The criteria for deciding objectionable content, laid down in the rules, are subjective and vague. For instance, intermediaries are mandated to remove among other things, ‘grossly harmful’ content, whatever that may mean.&lt;br /&gt;&lt;br /&gt;This is a unique form of ‘private censorship’ that will endanger almost all online content. In this age of easily offended sensibilities, it is virtually impossible to write anything that does not “offend” anyone. For instance, even this piece may be termed ‘grossly harmful’ to the CPI(M) party.&lt;br /&gt;&lt;br /&gt;However far-fetched this may sound, this has already become a reality. A researcher working with the Bangalore-based Centre for Internet and Society (CIS) tried out such a strategy with several different intermediaries, and was successful in six out of seven times, always with frivolous and flawed complaints, Pranesh Prakash of CIS wrote in a January blog-post. It has become much easier in India to ban an e-book than a book, Prakash pointed out.&lt;br /&gt;&lt;br /&gt;The rules regulating cyber cafes are no better. Cyber cafes are required to keep a log detailing the identity of users and their internet usage, which has negative implications for privacy and personal safety of users, analysis of the rules by PRS legislative research said.&lt;br /&gt;&lt;br /&gt;Internet freedom in India has declined over time and is only ‘partly free’, a 2011 report on internet freedom by US-based think tank, Freedom House said. India has joined a growing club of developing nations where, “internet freedom is increasingly undermined by legal harassment, opaque censorship procedures, or expanding surveillance,” the report noted.&lt;br /&gt;&lt;br /&gt;The only saving grace is that some of the IT rules are drafted in a language so arcane that anyone will find it hard to decipher them, leave alone implementing them. Sample this: “The intermediary shall not knowingly deploy or install or modify the technical configuration of computer resource or become party to any such act which may change or has the potential to change the normal course of operation of the computer resource than what it is supposed to perform thereby circumventing any law for the time being in force: provided that the intermediary may develop, produce, distribute or employ technological means for the sole purpose of performing the acts of securing the computer resource and information contained therein.”&lt;br /&gt;&lt;br /&gt;The first task at hand for Sibal may be to explain to fellow lawmakers what the above rule is supposed to mean, before he defends such rules.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;As the Indian government sought to block bulk SMS, MMS, webpages and specific social media urls, justifying its step as an attempt to control viral rumor-mongering and “cyber-terrorism”, there was a lot of discussion on the mainstream media (MSM) about how social media was fast becoming a “&lt;a href="http://articles.timesofindia.indiatimes.com/2012-08-21/social-media/33302561_1_social-media-india-pages-twitter"&gt;double-edged sword&lt;/a&gt;” and how the recent events brought out the “&lt;a href="http://www.thehindu.com/news/national/article3781473.ece"&gt;mischief potential of social media in full play&lt;/a&gt;“. These MSM opinions, some of which offered tacit support the idea of reigning in social media, did not go unnoticed by netizens. For example, Media Crooks &lt;a href="http://www.mediacrooks.com/2012/08/assam-azad-maidan-how-msm-sibalises.html#.UDXXsNUe62V"&gt;asked&lt;/a&gt;:&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;So what’s with the rant against the Twitterati and social media by these media celebs?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;img src="http://globalvoicesonline.org/wp-content/uploads/2012/08/twitter-block.jpg" /&gt;&lt;/p&gt;
&lt;p&gt;Blogger Amrit Hallan at Writing Cave wondered if the MSM had an underlying motive for creating a hype around the ‘dangers' of social media. He &lt;a href="http://writingcave.com/india-becoming-blockistan/"&gt;wrote&lt;/a&gt;:&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;People in the mainstream media have always been at loggerheads with the free spirit of social networking websites that empowers everybody to express opinions and spread ideas…(they) have been gleefully recommending the curtailment (of social media). Social networking and blogging continuously make their job hard. The moment they try to spread some misinformation, it is countered by Twitter or blogs with factually correct information, often posted by people close to the ground.&lt;/p&gt;
&lt;p&gt;Tweets too expressed similar concerns and sentiments:&lt;/p&gt;

The ISPs have been sent &lt;a href="http://kafila.org/2012/08/23/full-text-the-indian-governments-recent-orders-to-internet-service-providers-to-block-websites-webpages-and-twitter-accounts/"&gt;official communication&lt;/a&gt; to block webpages and twitter handles, including those of&lt;a href="http://timesofindia.indiatimes.com/tech/news/internet/Govt-blocks-Twitter-accounts-of-some-journalists/articleshow/15612767.cms"&gt;some journalists &lt;/a&gt;plus &lt;a href="http://www.watblog.com/2012/08/22/the-indian-government-asks-isps-to-block-fake-and-parody-pmo-twitter-accounts/"&gt;fake profiles &lt;/a&gt;created with the purpose of lampooning the Indian Prime Minister. Curiously, the Pakistani blogger Faraz Ahmed Siddiqui, who was the first to break the news about the morphed photos being used to incite communal tensions, also came under the ambit of censorship and his &lt;a href="http://blogs.tribune.com.pk/story/12867/social-media-is-lying-to-you-about-burmas-muslim-cleansi/"&gt;post&lt;/a&gt; was &lt;a href="http://tribune.com.pk/story/425161/india-blocks-tribune-blog-exposing-burma-muslim-killings/"&gt;inaccessible&lt;/a&gt; on some ISPs.&lt;/p&gt;
&lt;p&gt;AEIdeas, a blog from the American Enterprise Institute &lt;a href="http://www.aei-ideas.org/2012/08/shooting-the-messenger-in-india/"&gt;commented&lt;/a&gt; on the issue:&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;The Indian government ought to have given Mr. Siddiqui a medal for his investigative work. Instead it has blocked his post.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Social media users in India have been following the government actions closely and there is much&lt;a href="http://www.iphoneeinstein.com/2012/08/21/india-debates-misuse-of-social-media/"&gt;debate&lt;/a&gt; and &lt;a href="http://www.socialsamosa.com/2012/08/twitter-users-speak-out-on-isp-indian-government-blocking-twitter-accounts/"&gt;discussion&lt;/a&gt; about whether the crack down on social media is censorship of free speech in the guise of rumor control.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Some have termed the government's action as &lt;a href="http://uberdesi.com/blog/2012/08/23/indian-government-enters-new-era-of-censorship/?utm_source=rss&amp;amp;utm_medium=rss&amp;amp;utm_campaign=rss"&gt;Orwellian&lt;/a&gt;/&lt;a href="https://twitter.com/kiranmanral/status/238479576538423296"&gt;dystopian&lt;/a&gt;. Others have seen &lt;a href="http://www.livemint.com/2012/08/23212045/Views--India8217s-Net-nann.html?h=E"&gt;merit&lt;/a&gt; in the government's ‘intent' to curb inflammatory content but have been disappointed with the ineffective way the government went about the task - acting as “Net nannies” and “blocking communications, curbing speech, and banning websites”.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;At CIS India, Pranesh Prakash did an &lt;a href="https://cis-india.org/internet-governance/blog/analysing-blocked-sites-riots-communalism"&gt;analysis&lt;/a&gt; of the social media content blocked in India since August 18, 2012. &lt;p&gt;However, not everyone is amused. Amrit Hallan &lt;a href="http://writingcave.com/india-becoming-blockistan/"&gt;asks&lt;/a&gt;:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Are we going to follow the footsteps of Pakistan and China and turn into a Blockistan? No matter how much it makes some of the English-speaking mainstream journalists happy, blocking isn’t possible, at least sustained blocking. The Internet has empowered the silent majority and there is going to be a big backlash if the government, or another agency tries to take this power back. In what form this backlash is going to manifest? It remains to be seen.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In a guest post on &lt;a href="http://trak.in/"&gt;Trak.In&lt;/a&gt;, blogger Prasant Naidu &lt;a href="http://trak.in/tags/business/2012/08/21/government-ban-social-media/"&gt;suggests how &lt;/a&gt;the government could use social media positively.  He says:&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;instead of banning social media, the government can use it in its favor controlling the crisis of NE. The virality feature that our politicians are scared of can be used for killing rumors. Can’t the government get in touch with Facebook and Google India to find out ways to use social media in a better way? Can’t the Government start a social media campaign to&lt;b&gt; &lt;/b&gt;&lt;b&gt;“Save NE and Save India”?&lt;/b&gt;&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;Twitter is one of the tools that the government can use. A brilliant example is how Nirupama Rao, India’s Foreign Secretary &lt;a href="http://economictimes.indiatimes.com/news/politics/nation/nirupama-rao-breaks-barrier-tweets-on-libya-and-other-crises/articleshow/7611382.cms"&gt;used Twitter during the evacuation of Indians at the time of the Libyan crisis&lt;/a&gt;.&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;Social Media is not rocket science; it is about communicating with humans and for that you need to have the will to evolve and change. Banning social networks is not a solution to combat rumors but it is a half backed measure to cover the lid on the growing tensions.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The government, on it's part, &lt;a href="http://web2asia.blognhanh.com/2012/08/indian-government-issues-social-media.html"&gt;issued social media guidelines&lt;/a&gt; to be followed by government agencies. It remains to be seen how the situation develops on the ground and what impact the current stand-off between government and social media has on cyber-control policies in the days to come.&lt;/p&gt;
