Free data, net neutrality: Discussion on TRAI paper

Given the complicated issues around net neutrality, an open house discussion was held in Hyderabad on October 24, 2016 on Telecom Regulatory Authority of India’s consultation paper on free data. The event was organized by TRAI. Udbhav Tiwari attended the open house discussion.

Times Group wants TRAI to save the Internet from greedy telcos via Net Neutrality

In an especially strong attack against perceived threats to its Internet-based business, the Times of India group has sought regulatory intervention to ensure what is popularly called Net Neutrality, or the concept that internet service providers must charge only from the end consumer.

The article was published in Real Time News on November 10, 2014. Sunil Abraham gave his inputs.

In other words, the Times of India group wants TRAI to ensure that internet service providers and telecom companies do not take payments from certain websites to give favorable treatment to those websites on their networks.

Such a situation already exists in India’s cable business, where channels who do not pay cable operators are often simply blocked out by the cable operator and the consumer is not able to watch those channels.

The Times Group, which operates a host of websites under its Times Internet subsidiary, believes that rules should be put in place so that telecom operators and other Internet companies do not block out websites who do not pay money to them as has happened in the cable industry. This will prevent small websites and blogs from reaching their customers without paying money to telecom operators, it warned.

In a letter to the TRAI, the Times Group said there are certain trends in the Indian market in which some operators are already giving favorable treatment to certain websites.

“Given the lack of formal rules, the danger is that ISPs in India will violate the principal of Net Neutrality,” it said in a letter.

“There have already been some incidents where Indian ISPs have ignored net neutrality. This sets a precedent that broadband providers can choose the content you want to access, by making it easier or harder to get that content. On the Net, ISPs can use differential bandwidth caps, speed limits and pricing on broadband consumption.”

In recent months, operators like telecom operators have been pushing the regulator to allow them to charge websites and Internet-based services like WhatsApp. They argue that these services take up bandwidth on their networks and that they must be compensated for the bandwidth used by consumers for services like WhatsApp, Facebook etc..

“Telecom Operators in India are gearing up to push for a regulation to get websites to pay to allow consumers to access them. The telecom industry’s lobbying arm, the Cellular Operators Association of India, has listed “revenue sharing agreements” with telecom operators one of the five items on their wishlist for the new government,” Times Group said.

The debate around net neutrality started in the US where internet service providers started promoting their own websites and services by giving lower rates for accessing them.

“Services like Netflix and Hulu have revolutionized digital content consumption and given users enormous flexibility, but they are coming under pressure by copycat services developed by cable companies, such as Comcast Xfinity. These services take advantage of owning the cable connection by offering better, unlimited connectivity when using their service, while offering limited or capped connectivity when accessing Hulu or Netflix. This is an anti-competitive move that stifles innovation and competition,” Times Group said.

Other excerpts from Times Group’s submissions follow –

“Net Neutrality is the principle that the internet users should be able to access web content, download or upload files and communicate in methods of their choice without restrictions or limitations imposed by their Internet Service Providers (ISPs). Net Neutrality means an Internet that enables and protects free speech1 and equal opportunities. This means that Internet service providers should not block or discriminate against any applications or content that ride over those networks, and should treat all data on the Internet equally, not discriminating or charging differentially by user, content, site, platform, application, type of attached equipment, and modes of communication or different speeds for different kinds of content.

“Underlying this, is the principle of whether or not India has enough safeguards to ensure that the ecosystem for content is a healthy and thriving one, and is not abused by distributors or last-mile operators aiming to create anti-competitive practices. This is a very real threat indeed, because while content may be king, distribution is God – and thousands of content owners are at the mercy of a few last mile owners who have become far more powerful than any media conglomerate could ever dream to be.

“It is hence critical that the government and regulators wake up to the fact that the only way to ensure a competitive media landscape with equal opportunities for all content-owners and their customers on Net and Mobile, is to ensure there are enough rules whereby customer connectivity is neutral to the content that rides on it. How net neutrality has shaped the internet : Net neutrality has shaped the internet in two fundamental ways: One, web users are free to connect to whatever website or service they want. ISPs do not bother with what kind of content is flowing from their servers.

“This has allowed the internet to grow into a truly global network and has allowed people to freely express themselves. For example, you can criticize your ISP on a blog post and the ISP will not restrict access to that post for its other subscribers, even though the post may harm its business. But more importantly, net neutrality has enabled a level playing field on the internet. To start a website, you don’t need lot of money or connections. Just host your website and you are good to go. If your service is good, it will find favour with web users.

“Unlike the cable TV where you have to forge alliances with cable connection providers to make sure that your channel reaches viewers, on the internet you don’t have to talk to ISPs to put your website online. This has led to the creation of Google, Facebook, Twitter and countless other services, all of which had very humble beginnings. They started as basic websites with modest resources. But they succeeded because net neutrality allowed web users to access these websites in an easy and unhindered manner. What will happen if there is no net neutrality : If there is no net neutrality, ISPs will have the power (and inclination) to shape internet traffic so that they can derive extra benefit from it.

“For example, several ISPs believe that they should be allowed to charge companies for services like YouTube and Netflix because these services consume more bandwidth compared to a normal website. Basically, these ISPs want a share in the money that YouTube or Netflix make. Without net neutrality, the internet as we know it, will not exist. Instead of free access, there could be “package plans” for consumers.

“For example, if you pay Rs 500, you will only be able to access websites based in India. To access international websites, you may have to pay more. Or there could be different connection speeds for different types of content, depending on how much you are paying for the service and what “add-on package” you have bought. This would clearly be a discriminatory practice between different websites and different kinds of content –and would men abuse of near-monopolistic powers of ISPs. Lack of net neutrality, would also spell doom for innovation on the web.

“It is possible that ISPs will charge web companies to enable faster access to their websites. Those who don’t pay, may see that their websites opening slowly. This means bigger companies like Google would be able to pay more to make access to Youtube or Google+ faster for web users but a startup that wants to create a different and better video hosting site, may not be able to do that and lose its business. Instead of an open and free internet, without net neutrality we are likely to get a web that has silos in it and to enter each silo, you will have to pay some “tax” to ISPs.

“The bottom line is that lack of net neutrality is an anti-consumer practice that will stifle competition and innovation in the digital economy, leaving power in the hands of telecom operators and broadband providers, rather than the thousands of emerging entrepreneurs in India. How Internet Neutrality may be jeopardized by ISPs, Telecom providers or other players in collusion: The case of Net and Mobile ISPs or Telecom players offering internet may try to get Internet companies to pay tolls and threaten to block or delay them if they don’t. They may do exclusive deals or other arrangements which may result in Internet blackouts or smaller websites being caught in the crossfire –, or websites, tweets, emails and texts may be mysteriously delayed or dropped, Videos would load slowly, if at all or the websites may end up working fine one minute, and time out another.

“More dangerously, this would enable a company to slow down its competitors or block political opinions it disagrees with. ISP would claim it is not their fault, and users would have no idea whom to blame –especially as there are currently no protections for Internet users. Further there is no competition in broadband, and even if there is, all ISPs may end up playing this game. On the Net, ISPs can use differential bandwidth caps, speed limits and pricing on broadband consumption. But on mobile, telecom operators can offer further favouritism towards preferred services, with additional benefits like selective billing integration and marketing/promotion.

“And since bandwidth on mobile is more limited than over broadband, restrictions or favouritism in bandwidth consumption offer telecom operators an even stronger, anti-competitive advantage. Worse, it sets a precedent that broadband providers can choose the content you want to access, by making it easier or harder to get that content. Further if freed from any legal restraints, ISPs can monitor everything users do and say online — and sell the information to the highest bidder. ISPs will have something that companies like Facebook and Google don’t: direct control over users’ connections to the Internet and the devices user use to connect to it. What is at stake is innovation and creativity, market competition, information availability and freedom of expression –and it is essential to protect thews ehard won freedoms only via Net Neutrality. International Scenario: Net neutrality has become a very heated issue in US and Europe, with significant momentum across civic groups, regulators and governments….

“While the internet only has 50-60 million users, its users can access vast amounts of content even as industries like e- commerce and travel have blossomed, creating economic value and real utility to consumers. Compare it to the MVAS world, where despite over 900 million users, the most common consumer sentiment is that they are being unfairly billed for irrelevant services. So what is the difference? On the internet, anyone can start a company and compete fairly for the consumers’ attention, spurring innovation and value. But in the mobile VAS world, only five major telecom operators control the services and choose the MVAS companies they want to patronize –even as they pay them rock bottom rates in revenue shares. The result is much less competition, and operators selling the same services (like caller ringback tones) increasingly aggressively to their customers, but with little or no innovation…

“As connectivity grows across the internet and mobiles, it is crucial that the government allows the same flourishing, open liberal ecosystem that has currently existed on the Web to continue across devices. India’s huge population and strong technical talent have the potential for global scale entrepreneurship and innovation, and can create a new dynamic India in the way IT had done in the 1990s. But it requires an infrastructure and atmosphere that is not controlled by last-mile connectivity providers who abuse their dominance.

“One should not confuse this with cross-media ownership –which is a non-issue, prompted by political motivations that fear a strong media. The real issue is whether or not we have enough safeguards to ensure that the ecosystem for content is a healthy and thriving one, and is not abused by distributors or last-mile operators aiming to create anti-competitive practices by expanding into content. This is a very real threat indeed, because while content may be king, distribution is God – and the thousands of content owners are at the mercy of a few last mile owners who have become far more powerful than any media conglomerate could ever be.

“It is high time, then, that the government and regulators wake up to the fact that the only way to ensure a competitive media landscape with equal voice for all content, is to ensure there are enough rules whereby customer connectivity is neutral to the content that rides on it. Survival of Net Neutrality : Net neutrality was earlier being implemented as a sort of a gentlemen’s agreement. It has survived so far because few people realized the potential of internet when it took off around 30 years ago. But now when the internet is not just an integral part of the society but an incredibly powerful –and disruptive— force as well,, ISPs across the world are trying to get the power to shape and control the traffic.

“But there are ways to keep net neutrality alive. Consumers should demand that ISPs continue their hands-off approach from the internet traffic. If consumers see a violation of net neutrality, they ought to take a proactive approach and register their displeasure with the ISP. They should also reward ISPs that uphold the net neutrality. At the same time, it is crucial to ensure that TRAI comes out with a set of clear and precise rules that protect the net neutrality.

“‘We have started seeing ISPs trying to take control of the traffic that flows from their servers but TRAI can regulate them. It can keep the internet open and consumer-friendly by forming rules that protect net neutrality. These are early days so it is easy to do. If ISPs manage to change the system, it may become too late,’ Sunil Abraham, director of Centre for internet and Society in Bangalore says.

“Conclusion: Internet has thrived because of its freedom of competition and ability for anyone with an internet connection to change the world. It is necessary to have safeguards – laws and checks and balances on the last mile of the consumer – to ensure last mile neutrality, which has now become the global movement across mediums. Taking advantage of last mile ownership throttles such innovation and competition.”

RTN's Take

We believe telecom operators and internet service providers should be allowed to offer ‘special offerings’ such as ‘Free Facebook’ by tying up with Facebook if companies like Facebook want to pay the internet access charges on behalf of the consumer.

However, such services should not be marketed as ‘Internet’ or ‘Web Access’ and must be clearly marketed as ‘Facebook Access’ or ‘Walled Garden Access’. Conversely, any consumer who pays for ‘Internet’ access should get neutral and unmanipulated access to all websites on an equal footing. There should be no behind-the-scenes tinkering with the traffic in such cases.

Highlights
CIS submitted comments on the draft Rights of Persons with Disabilities Rules for the consideration of the Department of Empowerment of Persons with Disabilities, Government of India. Anubha Sinha in a blog post has identified the various kinds of IP in an app and explained the protections available under Indian IPR law. CIS-A2K is conducting a Wiki internship project for students of New Law College, Pune under the guidance of Prof.Dr.Mukund Sarda, Dean and Principal of New Law College. In an Op-ed published in the Hindu, Sunil Abraham has stated that though biometrics may be appropriate for targeted surveillance by the state, it is wholly inappropriate for everyday transactions between state and law abiding citizens. CIS has published a survey that draws upon a range of literature including news articles, academic articles, and presentations and seeks to disaggregate the potential benefits and harms of big data, organising them into several broad categories that reflect the existing scholarly literature. CIS submitted comments on the Information Technology (Security of Prepaid Payment Instruments) Rules, 2017. The comments were in response to the Information Technology (Security of Prepaid Payment Instruments) Rules 2017. The Ministry of Electronics and Information Technology issued a consultation paper which called for developing a framework for security of digital wallets operating in the country. Ritam Sengupta, Dr. Richard Heeks, Sumandro Chattapadhyay, and Dr. Christopher Foster have co-authored a paper that presents exploratory research into “data-intensive development” that seeks to inductively identify issues and conceptual frameworks of relevance to big data in developing countries.

India has an estimated 70 million persons with disabilities who don't have access to read printed materials due to some form of physical, sensory, cognitive or other disability. As part of our endeavour to make available accessible content for persons with disabilities, we are developing a text-to-speech software in 15 languages with support from the Hans Foundation. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

Inflation Control Through Structural Reforms

Inflation will persist until supply increases. Policies must therefore address supply through structural reforms, e.g., in telecom and power.

It’s ironic that when our economy finally developed a head of steam after many false starts, the sky fell in, as crony deals like the spectrum and land allocation scandals unravelled. A sizeable transformation of upwardly mobile consumption powered the transition from a laggard to global front runner, despite misgovernance. Now, the legacy of poor infrastructure, scams and an “Indian spring” – with many valid anti-corruption demands but impractical solutions – threatens to derail stability, severely damping productive activity. This jeopardises the very basis of our economic momentum: a burgeoning market. Assorted blunders add to the chaos, eg, judicial rulings that contravene the sanctity of contracts, and misguided institutional action, like the Reserve Bank of India ( RBI) trying to force the government towards fiscal responsibility instead of concentrating on providing stability and support for growth. This is aggravated by a government that does not seem to act in the public interest, and a frustrated Opposition that stalls governance and parliamentary proceedings.

The result is a marked inability, or unwillingness, or both, to act rationally and comprehensively on forward-looking, achievement-oriented plans — except to tide over crises, stay in power somehow, and capture the treasury for opportunistic ends. The Empowered Group of Minister’s ( EGoM’s) decision last week to merely reduce the 1800 MHz spectrum reserve price by 30 per cent where there were no bids is a good example. To see why, compare the end results that would best serve our common interests with the consequences of the government’s approach and actions.

What is the effect on inflation of butterfly wings or a hurricane in telecom? To decipher this, consider the drivers of inflation in India, and how such decisions affect them.

Supply constraints need structural changes in capacity and productivity

Our inflation is driven by increasing fuel and high-technology imports, with rising oil and coal prices and structural constraints on capacity and productivity — aside from expanding demand as purchasing power increases. (There’s also the import of gold, of course, possibly fuelled by lacklustre financial alternatives.) This shows up in a steadily depreciating rupee after August 2011, falling 25 percent from Rs 44 per dollar to Rs 55.

Some economists and foreign exchange advisors consider this as salutary, because India’s goods and services become more competitively priced. A weak currency can be advantageous up to a point, but only if it is exploited through competitive product and service offerings to yield sustainable profit margins. If, however, there is no complementary rise in capacity and productivity to capitalise on market access through the weak rupee, we end as we are today — where the disadvantages of essential imports with a weak currency outweigh the benefits of thin margins in low-productivity labour arbitrage.

Likewise, structural supply constraints remain intractable in the absence of increases in production. Increasing supply involves improving entire process chains: extension services and inputs for agriculture, market organisation and logistics, even changes to cropping methods such as alternatives to flooding rice fields. In other words, deep and sweeping changes in areas where we have not achieved such so far. The requirements for productivity improvement, likewise, are improved infrastructure such as communications services, power supply, storage and delivery including logistics and transportation — again, areas of weakness and inability to deliver that are mired in a policy stalemate, such as in power supply and telecom.

In short, inflation is likely to continue unless supply increases through improvements in production capacity and productivity. Therefore, waiting for inflation to fall before cutting interest rates to stimulate growth is futile. While rate cuts alone are inadequate, as there need to be structural solutions in parallel to build capacity and productivity, it is equally true that without integrated, synchronised initiatives in all these aspects, supply constraints will drive inflation.

Over the last two years, the RBI has shown the inefficacy of raising interest rates to combat inflation. It has only succeeded in slowing growth to a painful rate of under 5.5 per cent, contributing to our social pressures and turmoil. Instead of playing chicken and trying to stare each other down, the government and the RBI need to address growth in tandem, the former by eschewing fiscal irresponsibility and taking bold steps in the public interest, the latter by cutting rates, while introducing real-time systems for selective credit management to minimise misallocation and asset bubbles.

Decisions on spectrum as an example of structural reforms

The EGoM’s decisions on spectrum policy have major implications for productivity and user services for everyone, apart from the operators. Communications services are a basic enabler for effectiveness and efficiency. Increases in supply are facilitated once the infrastructure is in place. For this, we need supportive policies and incentives. Our spectrum allocation approach does not serve these purposes, because the growth in the sector has been largely of voice services and the delivery has been skewed in favour of remunerative urban areas while rural areas have insufficient coverage. This is partly the consequence of allocating narrow bands of spectrum that suffice for voice services but are inadequate for data delivery, and partly because of costs.

Auctions are inappropriate for developing economies like India because (a) they add to infrastructure costs in place of investment in service delivery; and (b) they lead to the fragmentation of spectrum for exclusive use that is contrary to what’s needed for data delivery. Our operators have an average spectrum holding of about 10 MHz, whereas they need at least 2x20 MHz.

Our policy makers seem unaware that new technologies for broadband need much more spectrum. Advanced data services are not possible otherwise, and rural users in nearly two-thirds of India will continue to be deprived of high-speed data access. A radical change in approach by sharing available spectrum will make broadband access much more feasible as well as cost-effective. This is the way to build productivity gains and distributed capacity for supply. The EGoM’s decision has to unleash this sector, instead of merely loosening a revenue-focused stranglehold.

Highlights
In a report on the information security practices of Aadhaar, Amber Sinha and Srinivas Kodali documented numerous instances of publicly available Aadhaar numbers along with other personally identifiable information of individuals on government websites. CIS along with like minded organizations made a submission to the Government of India to frame a feasible accessibility guidelines for mobile apps since there is no single standard in existence at the moment. A two-day 100 Women Edit-a-thon was held in March 2017 by CIS-A2K team along with Odisha's biggest newspaper Sambad. The event was inspired by BBC’s 100 Women series and edit-a-thons with the same name in December 2016. More than 20 female journalists participated and registered as new Odia Wikipedians. On March 31, 2017, the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training released a Circular framing rules under the Right to Information Act, 2005 (“RTI Rules”). The Ministry invited comments on on the RTI Rules. CIS submitted its comments. In an article originally published in Hindu Businessline on March 31, Sunil Abraham lists out 11 reasons why Aadhaar is not just non-smart but also insecure. Shuttleworth Foundation has announced Sunil Abraham as Honorary Steward for its September 2017 fellowship round. CIS worked on a three part case study. Policies to Sustain India's Market

The question is whether policies can be better framed to harness the market potential. Why is so much investment flowing into India's securities markets?

Probably because of (a) India’s market size and (b) growth, despite all its inconsistencies and difficulties. Are higher price-earnings multiples desirable? Yes if they are sustained, because more capital is available for equivalent productivity; otherwise, no. The question is whether policies can be better framed to harness the market potential.

India’s large market with its headroom for prosperity seems propelled partly by its own momentum, and its stocks partly by liquidity. The net investment in mutual funds in 2016-17 of Rs 3.43 lakh crore was reportedly double the previous year, the highest in the last decade. Domestic investment in pure equity funds in the last two years exceeded foreign portfolio investment (FPI), because of lower FPI and higher domestic investment. Retail investors grew in the last three years from 28.6 million to 39.3 million. Other positive factors were a government with a strong mandate and falling oil prices.

Now, reasonable earnings from some large companies and rising global markets augur well, although earnings must improve broadly and a number of caveats remain. These relate to non-performing assets/loans (NPAs/NPLs), structural problems in sectors such as iron and steel, construction, power, telecom, transport, agriculture, continuing deficiencies in infrastructure and institutions, and in productivity. There are social pressures from divisive electioneering, a disturbing rise of exclusionary tendencies echoed globally, and government overreach. There are also self-induced crises because of inappropriate policies, as in telecom, unviable situations created by populism, or by judicial orders, as seen in telecom, coal and power. There could also be failure to improve productivity (by a third to 9 per cent, as during the growth years), or adverse external developments.

The room for improvement is epitomised by low per capita productivity. According to Bloomberg, the International Labour Organization’s output per worker for India in 2017 is 20 times lower than for Germany. Yet, expectations run high for India in reports from sources such as Euromonitor, the International Monetary Fund, London’s Centre for Economic and Business Research (CEBR), and PricewaterhouseCoopers (PwC). Euromonitor predicts India’s consumer market will be the third largest by 2030, ahead of Japan and Germany. Growth will be for products such as smartphones, automobiles, and durables such as TV sets, refrigerators and air conditioners. For instance, India is the third largest market for smartphones after China and the US. In automobiles, India is the fifth largest market with over 3.3 million cars sold in 2016 and continues to attract global manufacturers.

However, Euromonitor cautions against rising inequality with the Gini index rising from 39.9 per cent in 2011 to 41.6 per cent in 2016 and estimated at 43.4 per cent by 2030. The CEBR estimates that by 2028, India’s gross domestic product will be the third largest after China and the US. PwC forecasts that in 2050, India will be the second largest economy (in purchasing power parity) after China, the US being third and Indonesia fourth, with a caveat: “Emerging economies need to enhance their institutions and their infrastructure significantly if they are to realise their long-term growth potential.”

Can our policies better contribute to realising this market potential? Consider the options. One approach is open exploitation, unmindful of whether the ownership and distribution of profits is domestic or foreign. Prices are determined solely by supply and demand, without government regulation or any other authority. Another extreme is that the government decides everything, which has been seen to fail. A third option is a mix, with open-market principles in areas that can sustain them, such as in consumer goods, tempered with appropriate regulation, e.g., against harmful substances. Ideally, policies should be for the long-term common good with sustainable levels of equitable access. Regulation is essential where network economics apply with few players, as in electricity and communications. Our mix is not ideal because realpolitik and populism overwhelm the need for deep understanding followed by the objective and convergent deliberation needed to frame beneficial policies (through sound institutions, also lacking).

Our policies are often indifferent to where ownership lies, and sometimes, this is a problem. For example, heavy industries or electronics majors abroad often have government backing. Indian enterprises start with a disadvantage, because of restricted access to capital, and at higher cost. Another aspect is when the ownership of major local corporates with privileged access to markets changes to being majority foreign-owned, because the profits are sent abroad. Yet another is that we do not have ecosystems for manufacturing start-ups through commercialisation and scaling up, in terms of financing, production and procurement. Attention seems confined to early-stage start-ups or to small-and-medium enterprises, with no ecosystem to see them through to establishing scale, comparable, for instance, to the building up of Huawei through consistent procurement.

Our greatest deficiency, however, remains lack of good infrastructure. Correcting this requires a long view, capital, slow payback and long lead times for results, usually beyond election cycles. Easily sidelined for populist measures for immediate gains, this area needs concerted, bipartisan, societal convergence. A case in point is telecom and broadband, where spectrum auctions loom again, even as operators struggle with low revenues and high debt from previous auctions. Another is the recent Supreme Court ruling against compensatory tariffs for two ultra-mega power projects at Mundra, of 4,000 Megawatt (Mw) (Tata) and 4,620 Mw (Adani), based on whether a “change in law” applies only to Indian laws. If the tariffs were upheld, five buyer states would get a lower than average price paid, substantially below the current market price. If these projects become unviable, they will add to the deadweight of NPAs. The banks they owe will also suffer, and there will be the opportunity cost of benefits foregone from the lower-priced electricity.

There may be a case for prioritising infrastructure, beginning with defining our objectives and then framing policies to achieve them. For power projects, it’s reasonably priced electricity; for telecom, it’s reasonably priced services. Until these are made possible through appropriate policies, there’s little likelihood of realising our full potential.

Highlights
CIS compiled a report that highlighted four government projects run by various government departments that have made sensitive personal financial information and Aadhaar numbers public on the project websites. Article 19 had put out a call for applications for its Internet of Rights Fellowship in February 2017. Vidushi Marda was selected for Internet of Rights Fellowship. CIS gave inputs on a document on implementing digital accessibility to Ministry of Electronics and Information Technology on May 2, 2017. The 34th session of the Standing Committee on Copyright and Related Rights (SCCR) was held in Geneva from May 1 to 5, 2017. Anubha Sinha participated in the event and a summary report is available here. She made statements on behalf of CIS on the Discussion on Limitations and Exceptions for Libraries and Archives and on the Proposal for Analysis of Copyright Related to the Digital Environment. CIS-A2K’s widely well-regarded flagship skill building program, Train The Trainer and MediaWiki Training was conducted in Kolkata earlier this year. Tito Dutta captured the developments in a blog post. Although it has made the topographic maps or the Open Series Maps available to general public, Survey of India’s (SoI) Nakshe portal will have to go through a variety of litmus test, as the initiative fails to implement the mandates of public sharing of government data using open standards and open license as put forward by the NMP 2005 and NDSAP 2012, said Sumandro Chattapadhyay in an interview with Geospatial World on May 02, 2017. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

Don't let a virus stall initiatives and weaken the economy.

A recent column in this newspaper juxtaposed the way smart, experienced people have high expectations, only to be disappointed by our weak state’s predictable failures (Strong expectations from a weak state, May 25). Is there justification for any optimism, or at least hope? Here is an exploration of reasons for persisting in the face of continued odds, and pushing for economic recovery. Why should one persist with constructive efforts? Because a rising tide lifts all boats, and one’s contribution can affect outcomes. And because attempts at partial opening will not suffice.

There could be new economic opportunities by way of capacity, logistics or markets, or a wider array of sustainable consumer choices, whether for manufactured goods, services, or activities. Think back, and surely you have witnessed government action extend beyond the grind of just keeping everything going.

One instance of major change that affected the economy was in 1990, when the secretary of the Department of Electronics N Vittal worked in close consultation with industry. This resulted in path-breaking reforms, such as the setting up of “high-speed” links (of a mere 64 kilobits per second at the time) between Information Technology (IT) companies in Indian software technology parks and their international clients, and various tax incentives that followed much later. The offshore services industry gathered strength, and later expanded to cover IT-enabled services with call centres and business processing, extending to knowledge processing.

Likewise, telecommunications reforms began in 1990, when prime minister Chandra Shekhar led a shaky government for a brief period. The telecommunications ministry was looking for a private sector consultant. Through an invisible network, an investment banker who had been a management consultant in San Francisco was asked to look into telecommunications reforms. This led to the setting up of the Athreya Committee and its recommendations: On separating policy-making from operations, corporatising the Mahanagar Telephone Nigam as an operating company for Delhi and Mumbai, and Bharat Sanchar Nigam for the rest, while recommending access to private sector operators. All this was not smooth and painless, and took years, but did happen eventually, although the separation remains untidy.

By 1998, telecommunications operators were in a situation similar to the predicament some months ago, of weak revenues and a debt overhang, with some differences. There were many operators with heavy debt because of government charges and limited revenue generation capacity, because of smaller networks and less clients. This is the “winners’ curse” of auctions, when exorbitant amounts are paid to government for auctions, with nothing left for building and running networks and enterprises to generate the revenues to justify those payments. There are exceptions, as in the social democrat Nordic states, or state-controlled allocations as in China, or in Japan for a number of years.

Key people in government grasped this. The Prime Minister’s Office consulted with industry and external consultants, and took action. This resulted in the New Telecom Policy 1999 (NTP-99), whereby the major change was converting up-front licence fees to revenue sharing, although the policy was uneven because of cherry-picked recommendations. Initially, the government set the percentage share too high. It took years to reduce and trigger rapid growth. This came about through reduced government charges, calling party pays (which cut call costs), and a price war, brought on by the stealth entry of a new technology (CDMA) network, which the authorities allowed despite incumbent protests. Mobile services then grew exponentially from 2004, until the 2G spectrum scam surfaced in 2011.

A stream of articles advocated extending revenue-sharing to spectrum fees as for licence fees, and for shared infrastructure including spectrum. In 2011, a senior official in the DoT was sufficiently impressed to explore the possibility of evaluating alternatives using simulation models. But the 2G scam broke after the first few meetings of DoT officials, and this process was aborted. Instead of major changes based on simulations, a mere statement of intent about spectrum pooling and sharing made it into NTP-2012.

There were other incredible developments, although with no apparent results (yet). For instance, in 2013, a non-governmental organisation, the Centre for Internet and Society in Bengaluru, arranged for the former chief technology officer of the US Federal Communications Commission, Jon Peha, who had pioneered changes in America, to meet with top officials of the DoT, the Telecom Regulatory Authority of India, and some IIT professors. The latter conducted successful trials using TV White Space spectrum for the Ministry of Electronics and Information Technology. The details are many, but the point is that constructive advocacy can have an impact.

Reviving the Economy Now

We are in a difficult situation, with our economy and society battered by the lockdown and much else. We will need to do everything possible to recover, and it will take years. Attempts at partial opening will not suffice. Systemic revival calls for unrestricted flows of money, people, activity, and goods and services.

While reactivating the economy, we will need to be cautious through the pandemic (through “social distancing”, using masks to reduce infection, avoiding close contact with outsiders, and so on). But survivors have to live with this virus, as with other strains of viruses and bacteria, and other threats.

Consider traffic accidents, which average over 145,000 deaths annually (data 2013-2017: https://ncrb.gov.in/sites/default/files/chapter-1A-traffic-accidents-2017_0.pdf). Extrapolating, this means a million fatalities in seven years, yet we don’t shut down all traffic. By comparison, Covid-19 had about 6,000 fatalities since January.

A proportion of the medical fraternity opines that (a) there is community spread of Covid-19, and (b) with many cases milder than the expected severity, that most patients need home care rather than hospitalisation. If these continue, our health systems will not be overwhelmed with severe cases. Also, so far, India has had a relatively low fatality rate of 2.8 per cent (see chart).

As long as these factors hold, our priority has to be unfettered economic activity. Countries with higher fatality rates, including Sweden, China, Japan and Germany in the chart, have open economic activity (with tremendous productivity). We will weaken and our problems will escalate if we are held back.

Changing Our Game

Adopting 'co-ordination models' like the Stag Hunt could reduce contention and improve outcomes.

Consider the handling of irregularities in spectrum allocation and in coal mining rights. Instead of swiftly ring-fencing problem areas where there are allegations of culpability supported by prima facie evidence, then striving for good policies going forward, the ruling coalition and the Opposition are in a war of attrition. What began with the United Progressive Alliance’s turning a blind eye to the spectrum awards has turned into the Bharatiya Janata Party’s heedless flailing to tear down their opponents. Meanwhile, the confusion created by the pronouncements of the Comptroller and Auditor General and previously of the Telecom Regulatory Authority of India has vitiated conditions for constructive reform. Any solution that fails a populist screen is likely to be guillotined in the streets.

Contention versus co-operation

There seems to be quite a contrast between our manifest contentiousness and our apparent friendliness. From our chaotic ways in traffic to dealing with each other and with our surroundings more generally, often, self-centred, short-term opportunism appears to override our better nature. As evidenced in the coalgate stand-off in Parliament, or our inability to establish adequate infrastructure, this cuts across all levels of individuals and groups. The irony is that no one gains, except the perpetrators and supporters of rip-offs and stand-offs. They, too, gain only in the short run, unless they’re not caught out. In the long run, everyone is worse off except the rogues who get away.

How did we get to this self-destructive state, and how might we get out? Insights from game theory could provide some perspective. One stark fact is that our interactions are predominately driven by self-interest that leads to contention, on the lines of a Prisoner’s Dilemma, [1] instead of a co-operative group- or common-interest model like the Stag Hunt.[2]

The two models are described briefly below. For those who want to skip the description, read on after the next two paragraphs.

Prisoner’s Dilemma

Two men attempting a burglary with a weapon, A and B, are caught, with insufficient incriminating evidence for the burglary. They are questioned separately and not allowed to communicate. If both deny the burglary, they escape a 10-year sentence and will be imprisoned for two years for possession of a weapon. A is told separately that if B pleads guilty and A does not, B will get a reduced sentence of four years, while A will get 10. So A has an incentive to confess and get four years, too. A is also told that if he confesses, he can go free, while B gets 10 years. Therefore, the logical choice for A is to confess. The same logic applies to B. So, both confess and get four years, instead of both denying and getting only two years. The logical trap is that acting in one’s self-interest without communication and co-operation leads to a worse position.

Stag Hunt

A group of hunters agree to wait for a stag in their assigned positions. If one sees a hare and shoots at it, the stag takes flight and the group loses out. The group and individuals gain most if individuals stick with their commitment and get the big prize. However, individuals may be tempted to defect by a less risky, smaller pay-off like a hare.

Logical trap: Self-interest leads to contention and lowest equilibrium

In zero-sum games like cricket, tennis or football, where the total pay-off is the same no matter who wins, one participant gains at the expense of another. In most real-world encounters, however, players can improve their outcomes by co-operation and co-ordination. In other words, many everyday situations can be likened to non-zero-sum games, where one party’s win is not necessarily another’s loss. If individuals (or teams/groups) pursue their self-interest without co-operating and co-ordinating with other players, the pattern is like the Prisoner’s Dilemma, and a logical trap leads to a position of lowest equilibrium (the Nash Equilibrium). This position results from each player/group making the best decision that he/she/they can while taking into account the decisions of the others, and no one can act independently without worsening their position.

Co-ordinating better outcomes

By contrast, if players can (a) co-operate and (b) decide through effective co-ordination, everyone gains. Examples are centrally sponsored projects executed in Opposition-run states – for highways or power, for example – or the backing of political parties for India’s 123 Agreement with America on nuclear co-operation.

Can we escape a logical trap and contention by adopting models that elicit co-operation and co-ordination? Game theory suggests that models based on trust and co-ordination like the Stag Hunt work for a big prize (the stag). The question is whether it is possible to move to a co-ordination model and, if so, how to do it. While there are no simple fixes, the University of Vienna’s evolutionary game theory models hold out some promise through providing insights into how patterns of co-operation can spread in populations.[3]

There’s also the long, slow haul of structured education and training in collaborative problem solving. The techniques that need incorporation in our curricula from junior school through higher education, vocational training, and at work, are co-operative problem solving as an approach, and project management as a method. The latter starts with a clear definition of goals and objectives, followed by standard operating procedures covering the gamut of the logic of process flow for tasks, setting milestones/sub-objectives, critical paths, and individual and group responsibilities on timelines.

A second aspect where governments have to step in is institutional design — boldly initiating systems and processes after eliciting convergence in each sector from all stakeholders on sound plans in the public interest. Driven by goal-directed project management, this requires systematic action braving populist pressure and distractions.

These initiatives would significantly improve India’s ability to act in the public interest.

The Wikimedia Foundation has given a grant to CIS to support and develop the growth of Indic language communities and projects by community collaborations and partnerships. This is being carried out by the Access to Knowledge team based in Delhi. CIS is also doing a project (Pervasive Technologies) on examining the relationship between production of pervasive technologies and intellectual property. CIS also promotes openness including open government data, open standards, open access, and free/libre/open source software through its Openness programme.

The Huawei pointer

Taking a cue from Huawei. Huawei has an awe-inspiring record of drive, perseverance, fortuitous circumstances, good strategy, execution, and success.

A Chinese communications company founded in 1987 in Shenzhen by a former army engineer, Ren Zhengfei, Huawei is now a legend. By 2012, it overtook industry leader Ericsson in global revenues. In 2017, its revenues were over $90 billion, two-thirds from outside China. It also has a significant and growing presence in India. How did they do it?

Part of Huawei’s mystique stems from its outstanding founder and its driven work culture. This may be unique and difficult to replicate, but it is a byword for hard-charging Chinese high-tech. A meme that epitomises the culture is “9-9-6” — that is, for 9:00 am to 9:00 pm, 6 days a week. Can factors driving its success to be adopted at the policy level and in enterprises in a democracy?

My previous column addressed the hollowing out of our manufacturing and other abilities. My suggestion is to replace obstructive policies with others that facilitate building infrastructure and local capacity, especially in growth areas. The example of Huawei provides a pointer. Perhaps some of what we learn can be applied at the governmental and the corporate levels.

Reports suggest these key factors in its success:

Strong leadership with a sense of purpose: A customer-first attitude. There’s an anecdote of the founder being willing to meet any customer, but ignoring a potential investor by delegating to a colleague a meeting with a Morgan Stanley team, led by Chief Economist Stephen Roach.
Broad employee ownership: In 2014, 84,000 employees out of 150,000 owned stock along with the founder, who owned only 1.4 per cent.2 They share an understanding that while an IPO would enrich some, the majority would lose their motivation. The essential requirements are hard work and dedication.
Government support: Huawei grew revenues by building market share in China to become a national champion, then got support from the China Development Bank. Initially for $10 billion, it is now $30 billion.3 Building networks in Africa and Latin America, and low prices helped win deals in Europe. Mr Ren himself has said that without policy support, Huawei would not exist.
Its unique culture and organisation: From inception, the founder was passionate about management, and about adapting methods and organisation. For instance, Huawei devised a top management model of a rotating CEO among three top executives, each of whom leads for six months, modelled on a flight of geese that change their order in arrowhead formation.4 Mr Ren is the mentor and coach. In March 2018 there was a change to a rotating Chairman position.

(The founder’s daughter, Meng Wanzhou (aka Sabrina Meng) is the Chief Financial Officer, and holds one of four vice-chair positions. His son Ren Ping works for a subsidiary providing reservations and trade show support.)

Another instance is Huawei’s Integrated Financial Services transformation program, which Ms Meng led since 2007. It was an eight-year partnership program between Huawei and IBM to develop data systems and resource allocation rules, operations, process optimisation, and internal controls.

Huawei reportedly invests 10 per cent of annual revenues on Research & Development.
Huawei also emphasises “the power of thinking”. Executives are urged to read beyond their domains, and books are everywhere.

These factors enable Huawei to solve problems for clients in diverse situations. Examples:

In its early days, networks were at risk from rats gnawing through circuitry in desert and rural areas in China. Multinational vendors did not consider this their problem and left it to their customers. Huawei, by contrast, treated it as their own problem, and developed sturdier equipment and materials such as chew-proof wires. This experience later helped gain large accounts in the Middle East where customers faced similar problems.
Other extreme environmental conditions have been addressed, such as base stations installed at high altitudes (at 6,500 metres on Mt Everest), or in the Arctic. These experiences helped a dedicated and committed workforce gain more clients. For instance, when expanding their 3G market in Europe, Huawei found that clients expected “base stations to be more compact, easier to install, greener, and more energy efficient, while offering wider coverage”. To cater to these needs, Huawei developed distributed base stations that could handle both large and small private networks, making them cheaper to deploy, which became popular with European carriers.
The employee-ownership arrangement and associated dedication enable planning for the long term, as with the Chinese government. Huawei plans for 10 years, whereas competitors have to contend with quarterly financial considerations.

Carriers buying Huawei network equipment get significant discounts in smartphones. Focusing on new technology not controlled by the giants of 3G such as Qualcomm, Ericsson, and Nokia, enabled Huawei to develop 4G, which is much faster and ideally suited for updating-apps, to the point that it competes with Samsung and Apple. Undercutting competitors has enabled it to sell to carriers, and its depth of products and technology has enabled it to meet customer needs, displacing competitors.

Huawei’s R&D Centre in Bangalore established in 1999 is its largest outside China, and it has offshore Global Network Operating Centres in Gurgaon and Bangalore, besides Romania and Nigeria. These GNOCs run networks not only in India but across the globe for a number of operators, offering managed network services integrating a range of equipment at low cost. With its market strength, depth of products, and access to funds, Huawei is likely to control network services in India and much of the world from now on through the 5G evolution cycle.

The only way for competition other than in-house NOCs in India is if the Government of India develops end-to-end supportive policies, transcends election cycles, and sponsors a consortium comprising a major transnational anchor, a system integrator, and local design and production wherever technological opportunities arise.

India's Draft Telecom Policy Needs to Bridge the Gap Between Intent and Execution

Earlier this week, India’s department of telecommunications (DoT) released a draft new telecom policy, titled ‘Draft National Digital Communications Policy 2018’.

The three pillars of the draft policy are ‘Connect India’, ‘Propel India’ and ‘Secure India’, which primarily seek to improve broadband connectivity, accelerate development of next-generation technologies and services and institute measures for data sovereignty, security and safety, respectively.

Several strategies have been devised under each pillar – few carry on from previous national telecom policies, and some are new proposals.

The document is high on aspirations, a lot of which it seeks to fulfil by 2022. It also proposes several favourable institutional and regulatory changes and simplifies obtaining of permissions.

However, it remains quite open-ended in terms of how the details could evolve. For example, while it endeavours to develop a fair, flexible, simple and transparent method for spectrum assignments and allocations, by pricing spectrum at an ‘optimal price’ and linking spectrum usage charges (SUC) to reflect costs of regulation and administration of spectrum, it cannot be said if these measures will fully rejuvenate a debt-ridden telecom sector.

Ideally, the policy should have explicitly mentioned that revenue maximisation is not a goal for the government anymore, to reassure the industry that licence fees and SUC will not be astronomically priced – especially as it is in no mood to change the model of spectrum allocation from auction to revenue sharing (circa NTP-99). A clear commitment would have helped inspire more confidence in this strained sector. Regardless, these changes will also need approval from the finance ministry, where stiff resistance is expected.

Expanding both wireless and wired broadband is a clear priority of the government. It sets out four initiatives, encouraging public-private partnerships to serve both rural and urban centres (BharatNet, GramNet, NagarNet, JanWiFi), and several additional measures to accelerate laying of optical fibre, mobile towers and increase sharing of infrastructure.

Although the previous telecom policies (NTP-99, NTP-2012 and recommendations in ‘Fixing Broadband Quickly’ (TRAI, 2015)) determined the similar gaps and objectives, little has translated into concrete results so far. In 2017, ITU and UNESCO reported that India was the largest unconnected market, with 49.5% (approx. 660 million) of our population still unconnected. The report further noted that the penetration of mobile broadband was much higher than fixed-line broadband connections – and urban centres were better served than rural areas. One hopes that the new strategies and objectives will be better realised this time around.

The policy also seeks to boost domestic innovation in the field of standards in communications technologies. This is reflected in its aims to strengthen domestic IP portfolios by providing financial incentives for the development of standard-essential patents (SEPs) and promote them at standard setting organisations. It mandates access to critical, mostly foreign-owned SEPs on a fair, reasonable and non-discriminatory basis (FRAND basis). This is an approach to patent licensing that has been endorsed by courts and the Competition Commission of India in the context of mobile phone technologies, as well as in other jurisdictions.

However, it remains to be seen how this mandate will be implemented in TRAI’s forthcoming recommendations on promoting telecom equipment manufacturing in India. This is a real opportunity for the telecom regulator to help the low-cost smartphone manufacturing industry in India to overcome their disadvantage in terms of having to pay exorbitant royalties to foreign-SEP holders and getting sued for infringement in the process. Another strategy that should have found place was the creation of government-controlled patent pools for SEPs, which could have solved the issue of uncertainty for local manufacturers and ensured payments to SEP holders to a great extent.

Additionally, the policy proposes a few consumer-oriented changes such as establishing a ‘Telecom Ombudsman’ and a centralised web-based complaint redressal system. In the third pillar of ‘Secure India’, although the document does not reveal the DoT’s approach to net-neutrality nor data protection and privacy, it does say that the government will be amenable to changing the terms of license to fulfill their core principles.

Curiously, in order to ‘facilitate security and safety of citizens’ it proposes to set up ‘lawful interception agencies with state of the art lawful intercept and analysis systems for implementation of law and order and national security’. This measure did not exist in TRAI’s version of the draft policy.

On next-generation tech in the field of IoT and cloud, it retained TRAI’s suggestion of setting up ‘light-touch’ licensing frameworks. This may prove to be a barrier to innovation in the field.

While the policy is broad and forward-looking, the true intent and meaning of the listed steps will only be understood when complementary legislative and granular policy actions to support these strategies are crystallised. That will make all the difference.

Comments on the Telecom Commercial Communications Customer Preference Regulations

This submission presents comments by the Centre for Internet & Society, India (“CIS”) on the Telecom Commercial Communications Customer Preference Regulations which was released to the public by the Telecom Regulatory Authority of India (TRAI) on 29th May 2018 for comments and views.

Preliminary

This submission presents comments by the Centre for Internet & Society (“CIS”), India on ‘The Telecom Commercial Communications Customer Preference Regulations, 2018’ which were released on 29th May 2018 for comments and counter-comments.

CIS appreciates the intent and efforts of Telecom Regulatory Authority of India (TRAI) to curb the problem of Unsolicited Commercial Communication (UCC), or spam. Spam messages are constant irritants for telecom subscribers. Acknowledging the same, TRAI has proposed regulations which aim to empower subscribers in effectively dealing with UCC. CIS is grateful for the opportunity to put forth its views and comments on the regulations. This submission was made on 18th June 2018. This text has been slightly edited for readability.

The first part of the submission highlights some general issues with the regulations. While TRAI has offered a technological solution to the menace of UCC, the policy documents have no accompanying technical details. TRAI has not made a compelling case for why Distributed Ledger Technologies (DLTs) should be used for storing data instead of a distributed database. There is no clarity on the technical aspects of the proposed DLTs: the participating nodes in the network, how these nodes arrive at a consensus, whether they are independent of each other, are questions that remain unanswered. The draft regulations also mention curbing Robocalls, but technical challenges associated with the same have not been discussed. Spam which is non-commercial in nature remains out of the scope of the current regulations.

The second part of this submission puts forth specific comments related to various sections of the draft and suggests improvements therein. While CIS appreciates the extension of the deadline from 11th June to 18th June, we would like to highlight that the Draft was released on 29th May, and despite the extension, the time to submit comments remains less than a month. Considering the fact that the draft regulations hold significance for the entire telecom industry and nearly 1.5 billion subscribers, TRAI should have granted at least a month’s time for the stakeholder’s sound scrutiny.

General Comments

Distributed Ledger Technology (DLT)

The draft greatly emphasizes the fact that data regarding Consent, Complaints, Headers, Preferences, Content Template Register and Entities are stored on distributed ledgers. The intent is to keep data cryptographically secure with no centralized point of control. However, the regulations do not go into the technical details of the working of these distributed ledgers leading to several potential pitfalls.

As per the draft, every access provider has to establish distributed ledgers for Complaints, Consent, Content, Preference, Header, Entities and so on. There are specific entities mentioned which will act as nodes in the network, and these nodes are preselected.

Whenever a sender seeks to send commercial communications across a list of subscribers, the list is ‘scrubbed’ against the DL-Consent and DL-Preference, to check whether the subscriber has given consent and registered their preference. The sender can only send the commercial communication to the numbers which are present in the scrubbed list.

The objective of these regulations is to protect consumers’ rights but the consumer, i.e., the subscriber, is not a node in the distributed ledger. Since the primary benefits of decentralization are gained when the trust is devolved to the individual subscribers, and the individual users are not specified as participating nodes in the ledger, the justification behind a distributed ledger is unclear.

Additionally, the proposed regime requires the subscriber to place her trust in the access provider to register the complaint, thus offers no tangible benefit over the current regulation. While there are penalties for non-compliant Access Providers (APs), there are no business incentives for APs to expend the extra amount of resources required in for effective implementation of this technology, to act in the users’ interest. This builds a system where APs interests clash with subscribers, but they are nonetheless required to be the guardian of the subscribers’ concerns.

Further, the nodes are entities constituted by the access providers (APs), and there is no mechanism to ensure that they behave independently of each other. In such case, it is wholly possible that all nodes on a distributed ledger are run by the same entity, thus defeating the purpose of establishing consensus. The proposed regulations do not address this scenario.

One solution would be to add subscribers as nodes to the DLT network. But this would be impractical as the technical challenges associated therein, including generating public-private key pairs of each user, the computational complexity of the network, are immense. If this is indeed the intention of TRAI, this has not been spelled out clearly in the draft regulations. Additionally, in such a scenario, there would be no requirement for mandating every AP to maintain their own DLT for customer preference and consent artifacts.

Considering the points mentioned above, we request TRAI to publish the technical specifications of DLTs, which addresses the following issues:

Who can participate in the network other than the entities mentioned in the regulations? Are these participating entities independent of each other? If not, then how will the conflict of interest be resolved?
What is the consensus algorithm used in the DLTs?
Will the code to implement DLTs be open-source?

Our recommendations are three-fold in this regard:

If distributed ledger is used, then, mechanisms should be devised to ensure the integrity of the consensus. For this, participating nodes in the network must be independent of each other. Aforementioned points regarding consensus protocol should be taken into consideration as well.

In place of DLTs, we recommend the use of a distributed database with signature-based authentication and encryption of the data to be stored. The immutability and non-repudiation of data can be achieved in this way. Distributed ledgers such as DL-consent, DL-preference, DL-complaints are instances where authentication of data and subscriber can be done using simplers means such as OTP verification, etc. So, such ledgers need not necessarily utilize DLTs.

The regulations should mandate the open-source publication of the implementation of the DLTs. This will enable interoperability, add transparency to the functioning of the regulations, and enable security audits to ensure accountability of the APs.

Broadening the scope of the Regulations to non-commercial communication

The proposed regulations attempt to specifically curb unsolicited commercial communications as defined in Regulation 2(bt). But, there are other forms of communication which are unsolicited and non-commercial, including political messages and market surveys.

We recommend that the scope of the regulations should be broadened to include both commercial and non-commercial communications. And both of these should be grouped under the category of Institutional Communications. Wherever needed, changes should be made to the regulations dealing with UCC to suit the specific requirements of dealing with unsolicited non-commercial communications as well. At the same time, the regulations should ensure that individual communications are not brought within their ambit.

Technical challenges in combating Robocalls

Robocalls are defined in Regulation 2(ba) and in Schedule IV, provision 3, it has been clubbed with other kinds of spam. However, there are some specific technical challenges in regulating robocalls. Right now, ‘block listing’ is a prevalent model where one can identify a number and then block it so that it cannot be used further. But with robocalls, spoofing of other numbers is easily achievable which makes the blocking of the real identity of caller difficult. The proposed regulations do not adequately address this challenge.

The Alliance for Telecommunications Industry Solutions, with working groups of the Internet Engineering Task Force (IETF), has been working on a different approach to solve this problem. They are working on standards for all mobile and VoIP calling services which would enable them to do cryptographic digital call signing, “so calls can be validated as originating from a legitimate source, and not a spoofed robocall system. The protocols, known as ‘STIR’ and ‘SHAKEN,’ are in industry testing right now through ATIS's Robocalling Testbed, which has been used by companies like Sprint, AT&T, Google, Comcast, and Verizon so far”.

TRAI should take into account these developments and propose a specific regime accordingly. One possible way forward, for now, could be the banning of robocalls unless there is explicit opt-in by subscribers.

Registration of content-template

The draft envisages a distributed ledger system for registration of content template which would have both a fixed part and a variable part. The content template needs to be registered by the content template registrar, which would be an authorized entity.

Problematically, the content template is defined to include the fixed part as well as the variable part. Further, Schedule I, provision 4(3)(e) mandates that content template registration functions should be utilized to extract fixed and the variable portion from actual messages offered for delivery or already delivered. The variable portion of the message contains information specific to a customer, as defined in regulation 2(q)(ii). In addition to privacy concerns with accessing the variable part, there is no functional reason for variable portions to be extracted from the actual message, as only the fixed portion needs to be verified.

The hash of the fixed portion of the message can be used to identify whether a user has received UCC or not. We, therefore, recommend that the variable portion of the message shall not be made accessible to entities because it is not required for the identification of a message as UCC.

‘Safe and Secure Manner’

Throughout the draft, reference is made to the data collected being stored and/or exchanged in a ‘safe and secure manner’, without any clarification as to what this term implies.

We recommend that the term be defined as ‘measures in accordance with reasonable security practices and procedures’ as given in section 43A of the Information Technology Act, 2008 read with section 8 of the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011.

Bulk Registration

In the Consultation paper published by TRAI, bulk registration was envisaged as a way to curb UCC wherein one member of the family can register on behalf of the family. Australia has already implemented this mechanism.

In India, evidence suggests that major victims of spam are the elderly and people with limited financial capacities. In such cases, consent and preference registration on behalf of these people by one person may help in the successful control of UCC.

Some telecom service providers argued against this by emphasizing the individual choice of a subscriber. However, in cases where there is authorization given by the customer, the primary user can register consent on his/her behalf. Similarly, since corporate connections are by definition owned and paid for by corporates, bulk registration in those situations can be also be done.

We recommend that given the situation in India, the provision for bulk registration be incorporated in the regulations for specific scenarios, as mentioned above. An authorization template giving the nominee power to register on behalf of a class can be incorporated to this effect. Also, an opt-out option must be incorporated in case an individual choice differs from the choice registered in the bulk-registration.

Specific Comments

Inferred Consent [Regulation 2(k)(II)(A)]

Comments
Regulation 2(k)(ii)(a) of the Draft defines consent as “voluntary permission given by the customer to the sender to receive commercial communication”. However, the draft also includes, “inferred consent”, which is defined as consent that can be “reasonably inferred from the customer’s conduct or the business and the relationship between the individual and the sender”.

When consent is derived from the customer’s conduct, rather than being given explicitly, it defeats its ‘voluntary nature’. The provision of consent being ‘reasonably inferred’ from the customer’s conduct is also vague, and there is no indication given in the draft as to what kind of conduct would lead to a reasonable inference of implied consent. The definition can also be interpreted to mean that customer’s conduct will be subject to monitoring, which raises privacy concerns.

Recommendations
Consent shall not be derived from the customer’s conduct unless the person provides it explicitly. We recommend amendment to the definition of ‘inferred consent’ accordingly.

Three years history to be stored in DL-Complaints [Regulations 24(3) and 24(4)]

Comments

Regulation 24(3) and (4) states that the DL-Ledger for Complaints (DL-Complaints) shall record ‘three years history’ of both the complainant and the sender, with details of complaints made, date, time and status of the resolution of the complaint. It is not clear from the regulation whether the mentioned set of data is exhaustive or not.

Recommendations
We recognize that the legislative intent behind drafting Regulation 24(3) and (4) was to curb frivolous or false complaints, which has already been a concern of TRAI. Storing both the complainant and the sender’s history, in such cases, may aid in resolving these.

We recommend that the language of the regulations may be amended to “three years history which only includes details of all complaint(s) made by him, with date(s) and time(s) . . .”, thereby giving a limiting qualification to the broad scope of the term.

The responsibility of the APs to ensure that the devices support the requisite permissions [Regulation 34]

Comments
Regulation 34 mandates that the APs are to ensure that the devices “registered in the network” shall support the requisite permissions of the Apps under this regulations.

In terms of jurisdiction, regulation of the functioning of electronic devices (which can be phones, tablets or smart watches) is outside the scope of the proposed regulations, and probably out of TRAI's regulatory competence.

Even if TRAI can impose the regulation on end devices, this regulation puts the burden on the APs to ensure that devices support the pertinent app permissions. Considering that TRAI itself has been weighing legal recourse against device manufacturers on similar grounds, it is unclear why TRAI assumes that APs have any legal or technical method to ensure control of a device which has neither been manufactured by them nor is it under their physical or remote control.

In modern smartphones, the end-user has full control over most app installations and permissions. This practice is consistent with a consumer's autonomy over the device and its functioning. Considering the fact that TRAI has not implemented basic security features in the 'Do Not Disturb' app, TRAI is putting at risk the privacy of millions of device owners by legally mandating permissions for an app with the second proviso. The proviso further gives TRAI the power to order APs to derecognize devices from their network. This regulation is draconic and inimical to the rights of consumers, who are at risk of losing network access and connectivity because of their device choice, which is a completely different business and market.

Recommendations
Reporting unsolicited messages or calls is a consumer right, and the regulations are in furtherance of the same goals. TRAI should enable consumer rights by giving subscribers the option to report spam and has no reason to force users to report spam possibly through legal overreach and privacy invasion. Accordingly, we recommend the removal of Regulation 34.

Additional Suggestions

Consumer and subscriber

The usage of the terms ‘customer’ and ‘subscriber’ in Regulation 3(1) implies that the terms have two different meanings. This interpretation, however, clashes with the actual definition given in Regulation 2(u) and 2(bk), whereby a customer is a subscriber. This is an inconsistent interpretation.

Either the definition of a ‘customer’ must be clarified or differentiated from that of a ‘subscriber’ in regulation 2, or regulation 3 must be amended to indicate what its actual object of regulation is - the customer or the subscriber.

Drafting misnumbering

There are a few instances of misnumbering of regulations and reference regulations which are non-existent.

Regulations 25(5)(b) and (c) make a reference to regulation 25(3)(a), which does not exist in the given draft. A bare reading of regulation 25, however, indicate that the intention was to refer to regulation 25(5)(a), and as such, this misnumbering should be rectified.

Regulation 34 makes a reference to regulation 7(2), which again, does not exist. In such case, either regulation 34 or regulation 7(2) must be amended to keep a consistent interpretation.

Ambiguous terms

‘Allocation and assignment principles and policies’ - Provision 4(1)(a) of Schedule I of the regulations indicate that header assignment should be done on the basis of ‘allocation and assignment principles and policies’, without any clarification to the meaning of this term. We recommend an amendment to this provision accordingly.

Balbharati – the Maharashtra state bureau of textbook production and curriculum research – has issued a copyright policy that forces all publishers, digital educational-content creators, and coaching classes to obtain expensive licenses for developing material directly or indirectly relating to Balbharati’s content. This is an alarming development for Indian students reported Anubha Sinha in an article in the Asian Times on June 20, 2018.
CIS-A2K has started dialogue with the publishers for the last 6 months regarding FOSS, Open knowledge and content donation to Wikimedia Projects. As a result Akhil Bharatiya Marathi Prakashak Sangh, an apex body of publishers at all India level invited us for a orientation session at their annual gathering in Pune.

Access to Knowledge (A2K) is a campaign to promote the fundamental principles of justice, freedom, and economic development. It deals with issues like copyrights, patents and trademarks, which are an important part of the digital landscape. Our A2K program comprises 2 projects: Pervasive Technologies done under a grant from International Development Research Centre examining interplay between cost-effective pervasive technologies and intellectual property and encouraging development of such technologies for social good, and Wikipedia under a grant from Wikimedia Foundation to enable the growth of Indic language communities and cultivate new editors in different Indian languages.

The Tunis Agenda of the second World Summit on the Information Society has defined internet governance as the development and application by governments, the private sector and civil society, in their respective roles of shared principles, norms, rules, decision making procedures and programs that shape the evolution and use of the internet. CIS is engaged in two different projects. The first one (under a grant from Privacy International and IDRC) is on surveillance and freedom of expression (SAFEGUARDS). The second one (under a grant from MacArthur Foundation) is on restrictions that the Indian government has placed on freedom of expression online.
