        &lt;b&gt;Amidst a raging controversy over the federal government’s proposal to monitor content in cyber space, UN Secretary General Ban Ki-moon on Friday said access to the Internet and various social media must not be blocked as a way to prevent criticism and public debate.
&lt;/b&gt;
        
&lt;p&gt;In his speech on the eve of the Human Rights Day which was released at the United Nations Information Centre, Ban said: “Today, within their existing obligation to respect the rights of freedom of assemble and expression, governments must not block access to the Internet and various forms of social media as a way to prevent criticism and public debate.”&lt;br /&gt;&lt;br /&gt;His comments came a few days after Telecom Minister Kapil Sibal said the government will take steps to stop offensive and defamatory content on Internet sites.&lt;br /&gt;&lt;br /&gt;Ban said: “Many of the people seeking their legitimate aspirations were linked through social media.”&lt;br /&gt;&lt;br /&gt;Sibal’s comments provoked anger and derision among Internet users. Sunil Abraham, executive director at the Centre for Internet and Society in Bangalore, said it would be “impractical on the level of scale and on the level of the objective test. What’s offensive for someone might be completely banal to somebody else,” he said. Any ham-fisted government crackdown would “have a high impact on our credibility as a democracy” and risk alienating India’s growing online community, Abraham said.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Indian media identified the woman as Shaheen Dhada, 21, who reportedly wrote, "People like Thackeray are born and die daily and one should not observe a bandh [shutdown] for that.”&lt;/p&gt;
&lt;p&gt;Police also arrested a friend of hers who "liked" the comment.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Facebook remark spurred angry backers of Thackeray, a controversial figure who once openly called for attacks on Muslims, to assault a clinic owned by Dhada' uncle. Analysts told the Associated Press that the arrests appeared to be a move by police to head off any further violence from Thackeray supporters.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Free-speech groups were outraged by the ransacking and arrests. In a blistering letter to the chief minister of Maharashtra state, a former Supreme Court justice who now heads the Press Council of India called the charges absurd and unlawful and demanded that the police officers involved be prosecuted.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"We are living in a democracy, not a fascist dictatorship," Markandey Katju wrote.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Maharashtra director-general of police ordered a probe into the arrests Monday, Indian television station &lt;a href="http://ibnlive.in.com/news/mumbai-after-outrage-dgp-orders-probe-into-girls-arrest-over-antithackeray-facebook-post/306336-37.html"&gt;IBN reported&lt;/a&gt;. The two women were reportedly released on bail during the day.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Shiv Sena political party that Thackeray founded has polarized Mumbai over the years with campaigns against Muslims and migrants. His death put the city on high alert over the weekend amid fears of violence. As shops were shuttered and taxis sat idle, some Mumbai residents grew frustrated.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"When tens of thousands were making similar comments ... how did the police single out Shaheen Dhada and her friend for arrest?” wrote Pranesh Prakash of the &lt;a href="https://cis-india.org/internet-governance/blog/bal-thackeray-comment-arbitrary-arrest-295A-66A"&gt;Center for Internet and Society&lt;/a&gt;. He added, "This should not be written off as a harmless case of the police goofing up."&lt;/p&gt;

    <title>Privacy Matters — Analyzing the Right to "Privacy Bill" </title>

        &lt;b&gt;On January 21, 2012 a public conference “Privacy Matters” was held at the Indian Institute of Technology in Mumbai. It was the sixth conference organised in the series of regional consultations held as “Privacy Matters”. The present conference analyzed the Draft Privacy Bill and the participants discussed the challenges and concerns of privacy in India.&lt;/b&gt;
        
&lt;p&gt;The conference was organized by Privacy India in partnership with the Centre for Internet &amp;amp; Society, International Development Research Centre, Indian Institute of Technology, Bombay, the Godrej Culture Lab and Tata Institute of Social Sciences. Participants included a wide range of stakeholders that included the civil society, NGO representatives, consumer activists, students, educators, local press, and advocates.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Na. Vijayashankar&lt;/strong&gt; (popularly known as &lt;strong&gt;Naavi&lt;/strong&gt;), a Bangalore based e-business consultant, delivered the key note address on the quest of a good privacy law in India.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;He described the essential features of good privacy legislation. In 
analyzing the Draft Privacy Bill’s definition of the right to privacy, 
he suggested it should be defined through the “right to personal 
liberty” rather than through what constitutes “infringements”.&amp;nbsp; Mr. 
Vijayashankar went on to explain that the “privacy right” should be 
taken beyond “information protection” and defined as a “personal privacy
 or a sense of personal liberty without constraints by the society”. He 
explained the various classifications and levels of protection 
associated with the availability and disclosure of data. He expressed 
concerns regarding monitoring of data processors and suggested that data
 controllers have contractual agreements between data processors, so as 
to ensure an obligation of data security practices. He also called for 
the simplification and division of offences and suggested numerous 
reasons as to why the Cyber Appellate Tribunal would not be an ideal

&lt;td&gt;Dr. Krishnaswamy started off the presentation by questioning the 
normative assumptions the Draft Privacy Bill makes. He referred to the 
controversy of Newt Gingrich's second marriage, to question the range of
 moral interests that were involved. The Bill falls short in accounting 
for dignity in relation to privacy.&lt;br /&gt;&lt;br /&gt;He described the Draft Privacy Bill as a reasonable advance, given where
 privacy laws were before. Although, he feels that it does fall short, 
in terms of a narrow position, on what privacy law should do. He also 
questioned if it satisfies constitutional standards. He stressed the 
importance of philosophical work around the Draft Privacy Bill 
considering that the nature of privacy is not neat and over-arching.&lt;br /&gt;&lt;/td&gt;

&lt;td&gt;Nappinai spoke on the constitutional right to privacy. She explained the
 substantial development of Article 21 of the Constitution of India to 
include the ‘right to privacy’ with regards to its interpretation and 
application. She described the different shift of the application of the
 right to privacy in the West in comparison to India. The West has moved
 from the right to privacy pertaining to property to the right to 
privacy concerning personal rights, whereas India moved from personal 
rights to property rights. She outlined three aspects of privacy: 
dignity, liberty and property rights. &lt;br /&gt;&lt;br /&gt;Ms. Nappinai dissected the Bill in its major components: interception, 
surveillance, method and manner of personal data, health information, 
collection, processing and use of personal data. Using these components,
 she questioned what precedence exists? What should be further protected
 or reversed? What lessons should legislators draw from?&lt;br /&gt;&lt;/td&gt;

&lt;p&gt;Shortcomings of the Draft Right to Privacy Bill falls include:&lt;/p&gt;
&lt;ol&gt;&lt;li&gt;The objects and reasons section in the Draft Privacy Bill declares the right to privacy to every citizen as well as delineates the collection and dissemination of data. Nappinai dismisses the need for this delineation on the grounds that data protection is an inherent part of the right to privacy, it is not exclusive.&lt;/li&gt;&lt;li&gt;Large focus on transmission of data. The provisions do not account for property rights pertaining to the right to privacy. Therefore, the ‘knock-and-enter’ rule, the ‘right to be left alone’ and the ‘right to happiness’ should be included.&lt;/li&gt;&lt;li&gt;Applicability of the Bill should extend to all persons as well as data residing within the territory. &lt;td&gt;Apar Gupta is an advocate based in Delhi who specializes in IP and 
electronic commerce law, spoke predominantly on the interplay between 
privacy and freedom of expression. He used the example of an advocate 
tweeting about his criticism of a judges’ ruling, to illustrate how 
different realms of online anonymity enable freedom of speech. He went 
beyond the traditional realm of journalistic architecture such as 
television channels or newspapers and explained online community 
disclosure.
&lt;p&gt;Mr. Gupta provided a practical example of Indian Kanoon, a popular 
online database of Indian court decisions. Because Indian Kanoon is 
linked to the Google search engine, many individuals involved in civil 
and criminal matters have requested Indian Kanoon to remove the court 
judgments, under privacy claims. This particularly occurs with 
individuals involved in matrimonial cases. However, as court judgment 
constitute public records India Kanoon only removes court judgments when
 requested by a court order.&lt;/p&gt;
&lt;p&gt;He described the several ways legislators can define privacy and 
freedom of expression. Considering that the privacy of an individual may
 border upon freedom of speech and expression, he questioned whether or 
not privacy should override the right to freedom of speech and 
expression. In addition, Mr. Gupta discussed the debate on whether or 
not the Privacy Bill should override all existing provisions in other 
laws.&lt;/p&gt;

various forms of speech to be blocked under privacy claims. He spoke 
about the dangers of a statutory right for privacy that does not 
safeguard freedom of speech and expression. Considering that the privacy
 statute may allow for a form of civil action permitting private parties
 to approach courts to stop certain publications, he stressed the 
importance for legislators to ensure balanced privacy legislation 
inclusive of freedom of speech and expression.&lt;/p&gt;
&lt;h3&gt;Sexual Minorities and Privacy&lt;br /&gt;&lt;/h3&gt;

&lt;td&gt;Danish examined the status of sexual minorities in the light of privacy 
framework in India. The tag of decriminalization has served to greatly 
alter the way institutions approach the question of privacy when it 
comes to sexual minorities. He used the Naz Foundation judgment as a 
chronological marker to map the developments in the right to privacy and
 sexual minorities over the years.
&lt;p&gt;He outlined four key effects on the right to privacy due to the Naz Foundation judgment:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;Prepared the understanding of privacy as a positive right and placed obligations on the state,&lt;/li&gt;&lt;li&gt;Discussed privacy as dealing with persons and not just places, it took into account decisional privacy as well as zonal privacy,&lt;/li&gt;&lt;li&gt;Connected privacy with dignity and the valuable worth of individuals, and&lt;/li&gt;&lt;li&gt;Included privacy on one’s autonomous identity.&lt;/li&gt;&lt;/ul&gt;
&lt;/td&gt;

&lt;/table&gt;
&lt;p&gt;He described various incidents that took place before the Naz Foundation judgment, pre-Naz, that altered the way we conceived of queer rights in general and privacy in particular, including the Lucknow incidents, transgender toilets, passport forms, the medical establishment and lesbian unions. Post-Naz, he described two incidents including the Allahabad Muslim University sting operation as well as the TV9 “Expose” that captured public imagination.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;He concluded by asking: “What do these stories tell us about privacy?” The issues faced by the transgender community tell us that privacy doesn’t necessarily encompass a one-size-fits-all approach, and can raise as many questions as it answers. The issues faced by the Lucknow NGOs display the institutionalized disrespect for privacy and that has marginally more devastating consequences for the homosexual community by the spectre of outing. The issues faced by lesbian women evidence yet another need for breaching the public/private divide, demonstrating how the protection of the law might be welcome in the family sphere. Alternate sexual orientation and gender identity might bring the community under a common rubric, but distilling the components of that rubric is essential for engaging in any kind of useful understanding of the community and the kind of privacy violations it suffers – or engage with situations when the lack of privacy is empowering.&lt;/p&gt;
&lt;h2&gt;Session III: Privacy and National Security&lt;/h2&gt;
&lt;p&gt;&lt;strong&gt;Menaka Guruswamy&lt;/strong&gt;, Advocate, Supreme Court of India&lt;/p&gt;

&lt;td&gt;Menaka explored national security and its relationship to privacy. In
 her presentation, she compared the similar manner in which the courts 
approach national security and privacy issues. The courts feel national 
security and privacy issues are too complex to define, therefore, they 
take a case-by-case approach.&lt;br /&gt;
&lt;br /&gt;
&lt;p&gt;Ms. Guruswamy described three incidents that urged her to question 
national security and privacy. First, she was interested in the lack of 
regulation surrounding intelligence agencies and was involved in the 
introduction of the Regulations of Intelligence Agencies Bill as a 
private members bill. Second, national security litigation between the 
Salwa Judum judgment and the State of Chhattisgarh is an example of how 
national security triumphs constitutional rights and values. Third, 
privacy in the context of the impending litigation of Naz Foundation in 
the Supreme Court. She described the larger conversation of national security focus on 
values of equality and privacy. She discussed the following questions 
that serve in advancing certain conception of rights:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;How do we posit privacy which necessarily, philosophically as 
well as judicially, is carved out as the right of an individual to be 
left alone?&lt;/li&gt;&lt;li&gt;What are the consequences when national security, 
which is posited as the rights of the nation, is in conflict with the 
right of the individual to be left alone?&lt;/li&gt;&lt;li&gt;Considering that 
constitutional rights are posited as a public facet of citizenship how 
does a right to privacy play in that context?&lt;/li&gt;&lt;/ul&gt;

&lt;td&gt;Prof. Ramakumar spoke on UID, its collection of information and the 
threat to individual privacy. First, he provided a historical trajectory
 of national security that has led to increased identity card schemes. 
He described the concrete connection between UID and national security.
&lt;p&gt;&lt;br /&gt;He briefed the gathering on the objectives of the UID project. He 
described several false claims as proposed by the UIDAI. He explicitly 
disproved the UIDAI claim that Aadhaar is voluntary. He did this by 
comparing various legislations associated with the National Population 
Registrar that had provisions mandating the inclusion of the UID number.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;/td&gt;
&lt;/tr&gt;
&lt;/tbody&gt;
&lt;/table&gt;
&lt;p&gt;He went on to explain that the misplaced emphasis of technology to 
handle large populations remains unproven. He described two specific 
violations of privacy inherent in the UID system: convergence of 
information and consent. The UID database makes it possible for the 
linking or convergence of information across silos. In addition, consent
 is unaccounted for in the UID system. The UID enrollment form requires 
consent from a person to share their information. However, the software 
of the enrollment form automatically checks ‘yes’, therefore you are not
 asked. Even if you disagree, it automatically checks ‘yes’. Default 
consent raises the important question, “to what extent are we the owners
 of our information?” and “what are the privacy implications?”&lt;/p&gt;
&lt;p&gt;Mr. Ramakumar was once asked, by Yashwant Sinha in a Parliamentary Standing Committee meeting, “Is the Western concept of privacy important in developing country like India?”. Using this question posed to him, he stressed the importance of privacy to be understood as a globally valued right, entitlement and freedom. He also referred to Amartya Sen’s work on individual freedoms.&lt;/p&gt;
&lt;h2&gt;Conclusion&lt;/h2&gt;

    <title>Free Speech Policy in India: Community, Custom, Censorship, and the Future of Internet Regulation</title>

&lt;h3&gt;Preliminary&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;There has been legitimate happiness among many in India at the Supreme Court’s recent decision in the Shreya Singhal case to strike down section 66A of the Information Technology Act, 2000 ("IT Act") for unconstitutionally fettering the right to free speech on the Internet. The judgment is indeed welcome, and reaffirms the Supreme Court’s proud record of defending the freedom of speech, although it declined to interfere with the government’s stringent powers of website blocking. As the dust settles there are reports the government is re-grouping to introduce fresh law, allegedly stronger to secure easier convictions, to compensate the government’s defeat.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Case Law and Government Policy&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;India’s constitutional courts have a varied history of negotiating the freedom of speech that justifiably demands study. But, in my opinion, inadequate attention is directed to the government’s history of free speech policy. It is possible to discern from the government’s actions over the last two centuries a relatively consistent narrative of governance that seeks to bend the individual’s right to speech to its will. The defining characteristics of this narrative – the government’s free speech policy – emerge from a study of executive and legislative decisions chiefly in relation to the press, that continue to shape policy regarding the freedom of expression on the Internet.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India’s corpus of free speech case law is not uniform nor can it be since, for instance, the foundational issues that attend hate speech are quite different from those that inform contempt of court. So too, Indian free speech policy has been varied, captive to political compulsions and disparate views regarding the interests of the community, governance and nation-building. There has been consistent tension between the individual and the community, as well as the role of the government in enforcing the expectations of the community when thwarted by law.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Dichotomy between Modern and Native Law&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;To understand free speech policy, it is useful to go back to the early colonial period in India, when Governor-General Warren Hastings established a system of courts in Bengal’s hinterland to begin the long process of displacing traditional law to create a modern legal system. By most accounts, pre-modern Indian law was not prescriptive, Austinian, and uniform. Instead, there were several legal systems and a variety of competing and complementary legal sources that supported different interpretations of law within most legal systems. J. Duncan M. Derrett notes that the colonial expropriation of Indian law was marked by a significant tension caused by the repeatedly-stated objective of preserving some fields of native law to create a dichotomous legal structure. These efforts were assisted by orientalist jurists such as Henry Thomas Colebrook whose interpretation of the dharmasastras heralded a new stage in the evolution of Hindu law.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In this background, it is not surprising that Elijah Impey, a close associate of Hastings, simultaneously served as the first Chief Justice of the Supreme Court at Fort William while overseeing the Sadr Diwani Adalat, a civil court applying Anglo-Hindu law for Hindus, and the Sadr Faujdari Adalat, a criminal court applying Anglo-Islamic law to all natives. By the mid-nineteenth century, this dual system came under strain in the face of increasing colonial pressure to rationalise the legal system to ensure more effective governance, and native protest at the perceived insensitivity of the colonial government to local customs.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Criminal Law and Free Speech in the Colony&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;In 1837, Thomas Macaulay wrote the first draft of a new comprehensive criminal law to replace indigenous law and custom with statutory modern law. When it was enacted as the Indian Penal Code in 1860 ("IPC"), it represented the apogee of the new colonial effort to recreate the common law in India. The IPC’s enactment coincided with the growth and spread of both the press and popular protest in India. The statute contained the entire gamut of public-order and community-interest crimes to punish unlawful assembly, rioting, affray, wanton provocation, public nuisance, obscenity, defiling a place of worship, disturbing a religious assembly, wounding religious feelings, and so on. It also criminalised private offences such as causing insult, annoyance, and intimidation. These crimes continue to be invoked in India today to silence individual opinion and free speech, including on the Internet. Section 66A of the IT Act utilised a very similar vocabulary of censorship.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Interestingly, Macaulay’s IPC did not feature the common law offences of sedition and blasphemy or the peculiar Indian crime of promoting inter-community enmity; these were added later. Sedition was criminalised by section 124A at the insistence of Barnes Peacock and applied successfully against Indian nationalist leaders including Bal Gangadhar Tilak in 1897 and 1909, and Mohandas Gandhi in 1922. In 1898, the IPC was amended again to incorporate section 153A to criminalise the promotion of enmity between different communities by words or deeds. And, in 1927, a more controversial amendment inserted section 295A into the IPC to criminalise blasphemy. All three offences have been recently used in India against writers, bloggers, professors, and ordinary citizens.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Loss of the Right to Offend&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The two amendments of 1898 and 1927, which together proscribed the promotion of inter-community enmity and blasphemy, represent the dismantling of the right to offend in India. But, oddly, they were defended by the colonial government in the interests of native sensibilities. The proceedings of the Imperial Legislative Council reveal several members, including Indians, were enthusiastic about the amendments. For some, the amendments were a necessary corrective action to protect community honour from subversive speech. The 1920s were a period of foment in India as the freedom movement intensified and communal tension mounted. In this environment, it was easy to fuse the colonial interest in strong administration with a nationalist narrative that demanded the retrieval of Indian custom to protect native sensibilities from being offended by individual free speech, a right derived from modern European law. No authoritative jurist could be summoned to prove or refute the claim that native custom privileged community honour.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Sadly the specific incident which galvanised the amendment of 1927, which established the crime of blasphemy in India, would not appear unfamiliar to a contemporary observer. Mahashay Rajpal, an Arya Samaj activist, published an offensive pamphlet of the Prophet Muhammad titled Rangeela Rasool, for which he was arrested and tried but acquitted in the absence of specific blasphemy provisions. With his speech being found legal, Rajpal was released and given police protection but Ilam Din, a Muslim youth, stabbed him to death. Instead of supporting its criminal law and strengthening its police forces to implement the decisions of its courts, the colonial administration surrendered to the threat of public disorder and enacted section 295A of the IPC.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Protest and Community Honour&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The amendment of 1927 marks an important point of rupture in the history of Indian free speech. It demonstrated the government’s policy intention of overturning the courts to restrict the individual’s right to speech when faced with public protest. In this way, the combination of public disorder and the newly-created crimes of promoting inter-community enmity and blasphemy opened the way for the criminal justice system to be used as a tool by natives to settle their socio-cultural disputes. Both these crimes address group offence; they do not redress individual grievances. In so far as they are designed to endorse group honour, these crimes signify the community’s attempt to suborn modern law and individual rights.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Almost a century later, the Rangeela Rasool affair has become the depressing template for illegal censorship in India: fringe groups take offence at permissible speech, crowds are marshalled to articulate an imagined grievance, and the government capitulates to the threat of violence. This formula has become so entrenched that governance has grown reflexively suppressive, quick to silence speech even before the perpetrators of lumpen violence can receive affront. This is especially true of online speech, where censorship is driven by the additional anxiety brought by the difficulty of Internet regulation. In this race to be offended the government plays the parochial referee, acting to protect indigenous sensibilities from subversive but legal speech.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;The Censorious Post-colony&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Independence marked an opportunity to remake Indian governance in a freer image. The Constituent Assembly had resolved not to curb the freedom of speech in Article 19(1)(a) of the Constitution on account of public order. In two cases from opposite ends of the country where right-wing and left-wing speech were punished by local governments on public order grounds, the Supreme Court acted on the Constituent Assembly’s vision and struck down the laws in question. Free speech, it appeared, would survive administrative concerns, thanks to the guarantee of a new constitution and an independent judiciary. Instead Prime Minister Jawaharlal Nehru and his cabinet responded with the First Amendment in 1951, merely a year after the Constitution was enacted, to create three new grounds of censorship, including public order. In 1963, a year before he demitted office, the Sixteenth Amendment added an additional restriction.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Nehru did not stop at amending the Constitution, he followed shortly after with a concerted attempt to stage-manage the press by de-legitimising certain kinds of permissible speech.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Under Justice G. S. Rajadhyaksha, the government constituted the First Press Commission which attacked yellow journalism, seemingly a sincere concern, but included permissible albeit condemnable speech that was directed at communities, indecent or vulgar, and biased. Significantly, the Commission expected the press to only publish speech that conformed to the developmental and social objectives of the government. In other words, Nehru wanted the press to support his vision of India and used the imperative of nation-building to achieve this goal. So, the individual right to offend communities was taken away by law and policy, and speech that dissented from the government’s socio-economic and political agenda was discouraged by policy. Coupled with the new constitutional ground of censorship on account of public order, the career of free speech in independent India began uncertainly.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;How to regulate permissible speech?&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Despite the many restrictions imposed by law on free speech, Indian free speech policy has long been engaged with the question of how to regulate the permissible speech that survives constitutional scrutiny. This was significantly easier in colonial India. In 1799, Governor-General Richard Wellesley, the brother of the famous Duke of Wellington who defeated Napoleon at Waterloo, instituted a pre-censorship system to create what Rajeev Dhavan calls a “press by permission” marked by licensed publications, prior restraint, subsequent censorship, and harsh penalties. A new colonial regime for strict control over the publication of free speech was enacted in the form of the Press and Registration of Books Act, 1867, the preamble of which recognises that “the literature of a country is…an index of…the condition of [its] people”. The 1867 Act was diluted after independence but still remains alive in the form of the Registrar of Newspapers.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;After surviving Indira Gandhi’s demand for a committed press and the depredations of her regime during the Emergency, India’s press underwent the examination of the Second Press Commission. This was appointed in 1978 under the chairmanship of Justice P. K. Goswami, a year after the Janata government released the famous White Paper on Misuse of Mass Media. When Gandhi returned to power, Justice Goswami resigned and the Commission was reconstituted under Justice K. K. Mathew. In 1982, the Commission’s report endorsed the earlier First Press Commission’s call for conformist speech, but went further by proposing the appointment of a press regulator invested with inspection powers; criminalising attacks on the government; re-interpreting defamation law to encompass democratic criticism of public servants; retaining stringent official secrecy law; and more. It was quickly acted upon by Rajiv Gandhi through his infamous Defamation Bill.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;The contours of future Internet regulation&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The juggernaut of Indian free speech policy has received temporary setbacks, mostly inflicted by the Supreme Court. Past experience shows us that governments with strong majorities – whether Jawaharlal Nehru’s following independence or Indira Gandhi’s in the 1970s – act on their administrative impulses to impede free speech by government policy. The Internet is a recent and uncontrollable medium of speech that attracts disproportionately heavy regulatory attention. Section 66A of the IT Act may be dead but several other provisions remain to harass and punish online free speech. Far from relaxing its grip on divergent opinions, the government appears poised for more incisive invasions of personal freedoms.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;I do not believe the contours of future speech regulation on the Internet need to be guessed at, they can be derived from the last two centuries of India’s free speech policy. When section 66A is replaced – and it will be, whether overtly by fresh statutory provisions or stealthily by policy and non-justiciable committees and commissions – it will be through a regime that obeys the mandate of the First Press Commission to discourage dissenting and divergent speech while adopting the regulatory structures of the Second Press Commission to permit a limited inspector raj and forbid attacks on personalities. The interests of the community, howsoever improperly articulated, will seek precedence over individual freedoms and the accompanying threat of violence will give new meaning to Bhimrao Ambedkar’s warning of the “grammar of anarchy”.&lt;br /&gt;&lt;br /&gt;&lt;/p&gt;
        &lt;p&gt;

    <title>The Privatisation of Censorship: The Online Responsibility to Protect Free Expression</title>

        &lt;b&gt;Pranesh Prakash was a panelist at this workshop organised on November 5, 2012. It was organized by Index on Censorship.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;Much is known about state censorship,  but increasingly private corporations are implementing censorship either  at the behest of governments, or as part of a ‘walled garden’ approach.  This censorship takes many guises: whether the proactive take-down of  entirely legal material, the blocking of websites by overly zealous  ISPs, mobile filters that cut access to websites such as Index on  Censorship and the use of surveillance technology on behalf of  autocratic states. The combination of state-led censorship with the  privatisation of censorship requires a debate on the responsibilities of  corporations and the framework needed to protect free expression  online.&lt;br /&gt;&lt;br /&gt;This side session will focus on two key areas:&lt;br /&gt;1. Take-down, blocking and filtering of content&lt;br /&gt;2. The export of surveillance technology, privacy&lt;br /&gt;&lt;br /&gt;The  panel will explore the ways in which the above can affect free  expression online, and how civil society, governments and corporations  can and should approach these issues, addressing the following  questions:&lt;br /&gt;&lt;br /&gt;1. Whether, why and in what ways censorship and  surveillance is either as or more pervasive, intrusive and chilling than  offline, and the impact on free speech and press freedom?&lt;br /&gt;2. The  inappropriate, intrusive or excessive use of filters and firewalls  including how these impact directly and indirectly on access to media  and the nature of news provision&lt;br /&gt;3. Criminalisation of free speech  and free expression – chilling use of takedown requests (impacting on  public online debates, on media freedom including investigative  journalism), and constraints on comment and debate (twitter, trolls,  comment threads etc);&lt;br /&gt;4. Excessive and blanket surveillance and data-gathering&lt;br /&gt;5.     <title>Hacktivists deface BSNL website</title>

&lt;p style="text-align: justify; "&gt;The article by Kim Arora was &lt;a class="external-link" href="http://timesofindia.indiatimes.com/tech/tech-news/telecom/Hacktivists-deface-BSNL-website/articleshow/17603936.cms"&gt;published&lt;/a&gt; in the Times of India on December 13, 2012. Sunil Abraham is quoted.&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;A message on the home page said the attack was carried out by the hacktivist group, Anonymous India, as a protest against section 66 A of the &lt;a href="http://timesofindia.indiatimes.com/topic/IT-Act"&gt;IT Act&lt;/a&gt; and in support of cartoonist Aseem Trivedi, on an indefinite hunger strike at Jantar Mantar since Dec 8 for the same. The website was restored around 7 pm.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Trivedi said he had received a call from Anonymous around 1.30 in the afternoon informing him that the website has been defaced. On being asked if such a form of protest was valid, Trivedi said, "When the government doesn't pay heed to people's protests against its laws and arrests innocent people for Facebook posts, then such a protest is absolutely valid."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;For most of the afternoon and early evening, the BSNL website wasn't available directly. A cached version of the BSNL home page showed an image of cartoonist Trivedi with text that read "Hacked by Anonymous India. support &lt;a href="http://timesofindia.indiatimes.com/topic/Aseem-trivedi"&gt;Aseem trivedi&lt;/a&gt; (cartoonist) and alok dixit on the hunger strike. remove IT Act 66a databases of all 250 bsnl site has been d Hacked by Anonymous India (sic)". While this message was repeated over and over on the page, it ended with the line "Proof are (sic) here" followed by a link to a page containing the passwords to BSNL databases. BSNL officials were unaware of the attack until Thursday evening.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Late in the evening,  Anonymous India tweeted from their account @opindia_revenge: "BSNL  Websites hacked, passwords and database leaked... Anonymous India  demands withdrawal of Sec 66A of IT Act." &lt;br /&gt;&lt;br /&gt; In an open letter to  the Government of India posted on alternate media website Kafila in June  this year, Anonymous had explained they only carried out  &lt;a href="http://timesofindia.indiatimes.com/topic/Distributed-Denial-of-Service"&gt;Distributed Denial of Service&lt;/a&gt; (DDoS) attacks on Indian government websites, which is different from the act of hacking per se.&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;Contrary views too exist. Sunil Abraham, executive director,  &lt;a href="http://timesofindia.indiatimes.com/topic/Centre-for-Internet-and-Society"&gt;Centre for Internet and Society&lt;/a&gt;,  says the attack was unwarranted. "Speech regulation in India is not a  lost cause, the Minister is holding consultations, MPs are raising the  issue in Parliament, courts have been approached and there is massive  public outcry on social media. Therefore I would request Anonymous India  to desist from defacing websites," said Abraham. A group of MPs,  including Baijayant Jay Panda from Odisha, are scheduled to present a  motion in Parliament on Friday morning for the amendment of section 66A  of the IT Act.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Last month, two young girls were arrested in  Palghar, Maharashtra, for criticizing on Facebook the bandh that  followed the death of Shiv Sena supremo Balasaheb Thackeray. Before  that, Karti Chidambaram, son of finance minister P Chidambaram, took a  man to court for commenting on his financial assets on Twitter. In both  cases, the complainant 'used' section 66 A of the IT Act. The section  and the Act have since come in for wide debate regarding freedom of  speech.&lt;/p&gt;

The meeting, also known as ICANN57, is taking place in Hyderabad, India, from November 3 – 9, 2016 and has convened thousands of the global Internet community members (both on-site and remotely) to discuss and develop policies related to the Internet’s Domain Name System (DNS). It is hosted by the Ministry of Electronics and Information Technology (MeitY), with support from the Government of Telangana.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;ICANN57 is the first post-IANA stewardship transition public meeting and also the first Annual General Meeting under the new Meetings Strategy. ICANN meetings are held three times a year in different regions to enable attendees from around the world to participate in person. These meetings offer a variety of sessions such as workshops, open forums and working meetings on the development and implementation of Internet policies. ICANN meetings offer the best opportunity for face-to-face discussions and exchange of opinions among attendees dedicated to the continued stable and secure operation of the Domain Name System.&lt;/p&gt;

    <title>UN Human Rights Council urged to protect human rights online</title>

        &lt;b&gt;63 civil society groups urged the UN Human Rights Council to address global challenges to freedom of expression, privacy and other human rights on the Internet. Centre for Internet &amp; Society joined in the statement, delivered on behalf of the 63 groups by Article 19. 
&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;The 26th session of the United Nations Human Rights Council (UNHRC) is currently ongoing (June 10-27, 2014). &lt;span&gt;On June 19, 2014, 63 civil society groups joined together to urge the United Nations Human Rights Council to protect human rights online and address global challenged to their realization. Centre for Internet &amp;amp; Society joined in support of the statement ("&lt;strong&gt;the Civil Society Statement&lt;/strong&gt;"), which was delivered by Article 19 on behalf of the 63 groups.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In its consensus resolution &lt;a class="external-link" href="http://ap.ohchr.org/documents/dpage_e.aspx?si=A/HRC/RES/20/8"&gt;A/HRC/20/8 (2012)&lt;/a&gt;, the UNHRC affirmed that the "&lt;span&gt;&lt;i&gt;same rights that people have offline must also be protected online, in particular freedom of expression, which is applicable regardless of frontiers and through any media of one’s choice&lt;/i&gt;". India, a current member of the UNHRC, stood in support of resolution 20/8. The protection of human rights online was also a matter of popular agreement at &lt;a class="external-link" href="http://netmundial.br/wp-content/uploads/2014/04/NETmundial-Multistakeholder-Document.pdf"&gt;NETmundial 2014&lt;/a&gt;, which similarly emphasised the importance of protecting human rights online in accordance with international human rights obligations. Moreover, the WSIS+10 High Level Event, organised by the ITU in collaboration with other UN entities, emphasized the criticality of expanding access to ICTs across the globe, including infrastructure, affordability and reach.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Civil Society Statement at HRC26 highlights the importance of retaining the Internet as a global resource - a democratic, free and pluralistic platform. However, the recent record of freedom of expression and privacy online have resulted in a deficit of trust and free, democratic participation. &lt;a class="external-link" href="http://www.nytimes.com/2014/03/21/world/europe/turkish-officials-block-twitter-in-leak-inquiry.html"&gt;Turkey&lt;/a&gt;, &lt;a class="external-link" href="http://www.bbc.com/news/blogs-trending-25756864"&gt;Malaysia&lt;/a&gt;, &lt;a class="external-link" href="http://www.washingtonpost.com/blogs/monkey-cage/wp/2014/05/27/thailands-cybercoup/"&gt;Thailand&lt;/a&gt;, &lt;a class="external-link" href="http://www.theguardian.com/world/2014/jun/02/egypt-police-monitor-social-media-dissent-facebook-twitter-protest"&gt;Egypt&lt;/a&gt; and &lt;a class="external-link" href="http://timesofindia.indiatimes.com/tech/tech-news/Facebook-under-fire-for-blocking-pages-in-Pakistan/articleshow/36194872.cms"&gt;Pakistan&lt;/a&gt; have blocked web-pages and social media content, while Edward Snowden's &lt;a class="external-link" href="https://www.eff.org/deeplinks/2014/05/looking-back-one-year-after-edward-snowden-disclosures-international-perspective"&gt;revelations&lt;/a&gt; have heightened awareness of human rights violations on the Internet.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;At a time when governance of the Internet and its institutions is evolving, a human rights centred perspective is crucial. Openness and transparency - both in the governance of Internet institutions and rights online - are crucial to continuing growth of the Internet as a global, democratic and free resource, where freedom of expression, privacy and other rights are respected regardless of location or nationality. In particular, the Civil Society Statement calls attention to &lt;a class="external-link" href="https://en.necessaryandproportionate.org/take-action/EFF"&gt;principles of necessity and proportionality&lt;/a&gt; to regulate targeted interception and collection of personal data.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The UNHRC, comprising 47 member states, is called upon to address these global challenges. Guided by resolutions A/HRC/20/8 and &lt;a class="external-link" href="http://www.un.org/ga/search/view_doc.asp?symbol=A/C.3/68/L.45/Rev.1"&gt;A/RES/68/167&lt;/a&gt;, the WSIS+10 High Level Event &lt;a class="external-link" href="http://www.itu.int/wsis/implementation/2014/forum/inc/doc/outcome/362828V2E.pdf"&gt;Outcome Documents&lt;/a&gt; (especially operative paragraphs 2, 8 and 11 of the Vision Document) and the &lt;a class="external-link" href="http://www.ohchr.org/EN/Issues/DigitalAge/Pages/DigitalAgeIndex.aspx"&gt;forthcoming report&lt;/a&gt; of the UN High Commissioner for Human Rights regarding privacy in the digital age, the UNHRC as well as other states may gather the opportunity and intention to put forth a strong case for human rights online in our post-2015 development-centred world.&lt;/p&gt;

    <title>WSIS+10 High Level Event: A Bird's Eye Report</title>

It aimed to evaluate the progress on implementation of WSIS Outcomes from Geneva 2003 and Tunis 2005, and to envision a post-2015 Development Agenda. Geetha Hariharan attended the event on CIS' behalf.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;&lt;span&gt;The World Summit on Information Society (WSIS) +10 &lt;/span&gt;&lt;a href="http://www.itu.int/wsis/implementation/2014/forum/"&gt;High Level Event&lt;/a&gt;&lt;span&gt; (HLE) was hosted at the ITU Headquarters in Geneva, from June 9-13, 2014. The HLE aimed to review the implementation and progress made on information and communication technology (ICT) across the globe, in light of WSIS outcomes (&lt;/span&gt;&lt;a href="http://www.itu.int/wsis/index-p1.html"&gt;Geneva 2003&lt;/a&gt;&lt;span&gt; and &lt;/span&gt;&lt;a href="http://www.itu.int/wsis/index-p2.html"&gt;Tunis 2005&lt;/a&gt;&lt;span&gt;). Organised in three parallel tracks, the HLE sought to take stock of progress in ICTs in the last decade (High Level track), initiate High Level Dialogues to formulate the post-2015 development agenda, as well as host thematic workshops for participants (Forum track).&lt;/span&gt;&lt;span&gt; &lt;/span&gt;&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;The High Level Track:&lt;/h3&gt;

&lt;p style="text-align: justify; "&gt;&lt;i&gt;Opening Ceremony, WSIS+10 High Level Event &lt;/i&gt;(&lt;a class="external-link" href="https://twitter.com/ITU/status/334587247556960256/photo/1"&gt;Source&lt;/a&gt;)&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The High Level track opened officially on June 10, 2014, and culminated with the endorsement by acclamation (as is ITU tradition) of two &lt;a href="http://www.itu.int/wsis/implementation/2014/forum/inc/doc/outcome/362828V2E.pdf"&gt;Outcome Documents&lt;/a&gt;. These were: (1) WSIS+10 Statement on the Implementation of WSIS Outcomes, taking stock of ICT developments since the WSIS summits, (2) WSIS+10 Vision for WSIS Beyond 2015, aiming to develop a vision for the post-2015 global information society. These documents were the result of the WSIS+10 &lt;a href="http://www.itu.int/wsis/review/mpp/"&gt;Multi-stakeholder Preparatory Platform&lt;/a&gt; (MPP), which involved WSIS stakeholders (governments, private sector, civil society, international organizations and relevant regional organizations).&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The &lt;strong&gt;MPP&lt;/strong&gt; met in six phases, convened as an open, inclusive consultation among WSIS stakeholders. It was not without its misadventures. While ITU Secretary General Dr. Hamadoun I. Touré consistently lauded the multi-stakeholder process, and Ambassador Janis Karklins urged all parties, especially governments, to “&lt;i&gt;let the UN General Assembly know that the multi-stakeholder model works for Internet governance at all levels&lt;/i&gt;”, participants in the process shared stories of discomfort, disagreement and discord amongst stakeholders on various IG issues, not least human rights on the Internet, surveillance and privacy, and multi-stakeholderism. Richard Hill of the Association for Proper Internet Governance (&lt;a href="http://www.apig.ch/"&gt;APIG&lt;/a&gt;) and the Just Net Coalition writes that like NETmundial, the MPP was rich in a diversity of views and knowledge exchange, but stakeholders &lt;a href="http://www.ip-watch.org/2014/06/16/what-questions-did-the-wsis10-high-level-event-answer/"&gt;failed to reach consensus&lt;/a&gt; on crucial issues. Indeed, Prof. Vlamidir Minkin, Chairman of the MPP, expressed his dismay at the lack of consensus over action line C9. A compromise was agreed upon in relation to C9 later.&lt;span&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Some members of civil society expressed their satisfaction with the extensive references to human rights and rights-centred development in the Outcome Documents. While governmental opposition was seen as frustrating, they felt that the &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;MPP had sought and achieved a common understanding&lt;/span&gt;&lt;/strong&gt;, a sentiment &lt;a href="https://twitter.com/covertlight/status/476748168051580928"&gt;echoed&lt;/a&gt; by the ITU Secretary General. Indeed, even Iran, a state that had expressed major reservations during the MPP and felt itself unable to agree with the text, &lt;a href="https://twitter.com/covertlight/status/476748723750711297"&gt;agreed&lt;/a&gt; that the MPP had worked hard to draft a document beneficial to all.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Concerns around the MPP did not affect the &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;review of ICT developments&lt;/span&gt;&lt;/strong&gt; over the last decade. High Level Panels with Ministers of ICT from states such as Uganda, Bangladesh, Sweden, Nigeria, Saudi Arabia and others, heads of the UN Development Programme, UNCTAD, Food and Agriculture Organisation, UN-WOMEN and others spoke at length of rapid advances in ICTs. The focus was largely on ICT access and affordability in developing states. John E. Davies of Intel repeatedly drew attention to innovative uses of ICTs in Africa and Asia, which have helped bridge divides of affordability, gender, education and capacity-building. Public-private partnerships were the best solution, he said, to affordability and access. At a ceremony evaluating implementation of WSIS action-lines, the Centre for Development of Advanced Computing (C-DAC), India, &lt;a href="https://twitter.com/covertlight/status/476748723750711297"&gt;won an award&lt;/a&gt; for its e-health application MOTHER.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The Outcome Documents themselves shall be analysed in a separate post. But in sum, the dialogue around Internet governance at the HLE centred around the success of the MPP. Most participants on panels and in the audience felt this was a crucial achievement within the realm of the UN, where the Tunis Summit had delineated strict roles for stakeholders in paragraph 35 of the &lt;/span&gt;&lt;a href="http://www.itu.int/wsis/docs2/tunis/off/6rev1.html"&gt;Tunis Agenda&lt;/a&gt;&lt;span&gt;. Indeed, there was palpable relief in Conference Room 1 at the &lt;/span&gt;&lt;a href="http://www.cicg.ch/en/"&gt;CICG&lt;/a&gt;&lt;span&gt;, Geneva, when on June 11, Dr. Touré announced that the Outcome Documents would be adopted without a vote, in keeping with ITU tradition, even if consensus was achieved by compromise.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;The High Level Dialogues on developing a post-2015 Development Agenda, based on WSIS action lines, were active on June 12. Introducing the Dialogue, Dr. Touré lamented the Millennium Development Goals as a “&lt;i&gt;lost opportunity&lt;/i&gt;”, emphasizing the need to alert the UN General Assembly and its committees as to the importance of ICTs for development.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;As on previous panels, there was &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;intense focus on access, affordability and reach in developing countries&lt;/span&gt;&lt;/strong&gt;, with Rwanda and Bangladesh expounding upon their successes in implementing ICT innovations domestically. The world is more connected than it was in 2005, and the ITU in 2014 is no longer what it was in 2003, said speakers. But we lack data on ICT deployment across the globe, said Minister Knutssen of Sweden, recalling the gathering to the need to engage all stakeholders in this task. Speakers on multiple panels, including the Rwandan Minister for CIT, Marilyn Cade of ICANN and Petra Lantz of the UNDP, emphasized the need for ‘smart engagement’ and capacity-building for ICT development and deployment.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;A crucial session on cybersecurity saw Dr. Touré envision a global peace treaty accommodating multiple stakeholders. On the panel were Minister Omobola Johnson of Nigeria, Prof. Udo Helmbrecht of the European Union Agency for Network and Information Security (ENISA), Prof. A.A. Wahab of Cybersecurity Malaysia and Simon Muller of Facebook. The focus was primarily on building laws and regulations for secure communication and business, while child protection was equally considered.&lt;span&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The lack of laws/regulations for cybersecurity (child pornography and jurisdictional issues, for instance), or other legal protections (privacy, data protection, freedom of speech) in rapidly connecting developing states was noted. But the &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;question of cross-border surveillance and wanton violations of privacy went unaddressed&lt;/span&gt;&lt;/strong&gt; except for the customary, unavoidable mention. This was expected. Debates in Internet governance have, in the past year, been silently and invisibly driven by the Snowden revelations. So too, at WSIS+10 Cybersecurity, speakers emphasized open data, information exchange, data ownership and control (the &lt;a href="https://cis-india.org/internet-governance/blog/ecj-rules-internet-search-engine-operator-responsible-for-processing-personal-data-published-by-third-parties"&gt;right to be forgotten&lt;/a&gt;), but did not openly address surveillance. Indeed, Simon Muller of Facebook called upon governments to publish their own transparency reports: A laudable suggestion, even accounting for Facebook’s own undetailed and truncated reports.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In a nutshell, the post-2015 Development Agenda dialogues repeatedly emphasized the importance of ICTs in global connectivity, and their impact on GDP growth and socio-cultural change and progress. The focus was on taking this message to the UN General Assembly, engaging all stakeholders and creating an achievable set of action lines post-2015.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;The Forum Track:&lt;/h3&gt;

&lt;p&gt;&lt;i&gt;Participants at the UNESCO session on its Comprehensive Study on Internet-related Issues&lt;/i&gt; (&lt;a class="external-link" href="https://twitter.com/leakaspar/status/476690921644646400/photo/1"&gt;Source&lt;/a&gt;)&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The HLE was organized as an extended version of the WSIS Forum, which hosts thematic workshops and networking opportunities, much like any other conference. Running in parallel sessions over 5 days, the WSIS Forum hosted sessions by the ITU, UNESCO, UNDP, ICANN, ISOC, APIG, etc., on issues as diverse as the WSIS Action Lines, the future of Internet governance, the successes and failures of &lt;a href="http://www.internetgovernance.org/2012/12/18/itu-phobia-why-wcit-was-derailed/"&gt;WCIT-2012&lt;/a&gt;, UNESCO’s &lt;a href="http://www.unesco.org/new/internetstudy"&gt;Comprehensive Study on Internet-related Issues&lt;/a&gt;, spam and a taxonomy of Internet governance.&lt;span&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Detailed explanation of each session I attended is beyond the scope of this report, so I will limit myself to the interesting issues raised.&lt;span&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;At ICANN’s session on its own future (June 9), Ms. Marilyn Cade emphasized the &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;importance of national and regional IGFs&lt;/span&gt;&lt;/strong&gt; for both issue-awareness and capacity-building. Mr. Nigel Hickson spoke of engagement at multiple Internet governance fora: “&lt;i&gt;Internet governance is not shaped by individual events&lt;/i&gt;”. In light of &lt;a href="http://www.internetgovernance.org/2014/04/16/icann-anything-that-doesnt-give-iana-to-me-is-out-of-scope/"&gt;criticism&lt;/a&gt; of ICANN’s apparent monopoly over IANA stewardship transition, this has been ICANN’s continual &lt;a href="https://www.icann.org/resources/pages/process-next-steps-2014-06-06-en"&gt;response&lt;/a&gt; (often repeated at the HLE itself). Also widely discussed was the &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;role of stakeholders in Internet governance&lt;/span&gt;&lt;/strong&gt;, given the delineation of roles and responsibilities in the Tunis Agenda, and governments’ preference for policy-monopoly (At WSIS+10, Indian Ambassador Dilip Sinha seemed wistful that multilateralism is a “&lt;i&gt;distant dream&lt;/i&gt;”).&lt;span&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;This discussion bore greater fruit in a session on Internet governance ‘taxonomy’. The session saw &lt;a href="https://www.icann.org/profiles/george-sadowsky"&gt;Mr. George Sadowsky&lt;/a&gt;, &lt;a href="http://www.diplomacy.edu/courses/faculty/kurbalija"&gt;Dr. Jovan Kurbalija&lt;/a&gt;, &lt;a href="http://www.williamdrake.org/"&gt;Mr. William Drake&lt;/a&gt; and &lt;a href="http://www.itu.int/wsis/implementation/2014/forum/agenda/session_docs/170/ThoughtsOnIG.pdf"&gt;Mr. Eliot Lear&lt;/a&gt; (there is surprisingly no official profile-page on Mr. Lear) expound on dense structures of Internet governance, involving multiple methods of classification of Internet infrastructure, CIRs, public policy issues, etc. across a spectrum of ‘baskets’ – socio-cultural, economic, legal, technical. Such studies, though each attempting clarity in Internet governance studies, indicate that the closer you get to IG, the more diverse and interconnected the eco-system gets. David Souter’s diagrams almost capture the flux of dynamic debate in this area (please see pages 9 and 22 of &lt;a href="http://www.internetsociety.org/sites/default/files/ISOC%20framework%20for%20IG%20assessments%20-%20D%20Souter%20-%20final_0.pdf"&gt;this ISOC study&lt;/a&gt;).&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There were, for most part, insightful interventions from session participants. Mr. Sadowsky questioned the effectiveness of the Tunis Agenda delineation of stakeholder-roles, while Mr. Lear pleaded that techies be let to do their jobs without interference. &lt;a href="http://internetdemocracy.in/"&gt;Ms. Anja Kovacs&lt;/a&gt; raised pertinent concerns about &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;including voiceless minorities in a ‘rough consensus’ model&lt;/span&gt;&lt;/strong&gt;. Across sessions, &lt;strong&gt;&lt;span style="text-decoration: underline;"&gt;questions of mass surveillance, privacy and data ownership rose&lt;/span&gt;&lt;/strong&gt; from participants. The protection of human rights on the Internet – especially freedom of expression and privacy – made continual appearance, across issues like spam (&lt;a href="http://www.itu.int/ITU-D/CDS/sg/rgqlist.asp?lg=1&amp;amp;sp=2010&amp;amp;rgq=D10-RGQ22.1.1&amp;amp;stg=1"&gt;Question 22-1/1&lt;/a&gt; of ITU-D Study Group 1) and cybersecurity.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Conclusion:&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The HLE was widely attended by participants across WSIS stakeholder-groups. At the event, a great many relevant questions such as the future of ICTs, inclusions in the post-2015 Development Agenda, the value of muti-stakeholder models, and human rights such as free speech and privacy were raised across the board. Not only were these raised, but cognizance was taken of them by Ministers, members of the ITU and other collaborative UN bodies, private sector entities such as ICANN, technical community such as the ISOC and IETF, as well as (obviously) civil society.&lt;span&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Substantively, the HLE did not address mass surveillance and privacy, nor of expanding roles of WSIS stakeholders and beyond. Processually, the MPP failed to reach consensus on several issues comfortably, and a compromise had to be brokered.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;But perhaps a big change at the HLE was the positive attitude to multi-stakeholder models from many quarters, not least the ITU Secretary General Dr. Hamadoun Touré. His repeated calls for acceptance of multi-stakeholderism left many members of civil society surprised and tentatively pleased. Going forward, it will be interesting to track the ITU and the rest of UN’s (and of course, member states’) stances on multi-stakeholderism at the ITU Plenipot, the WSIS+10 Review and the UN General Assembly session, at the least.&lt;/span&gt;&lt;/p&gt;

    <title>Facebook and its Aversion to Anonymous and Pseudonymous Speech</title>

        &lt;b&gt;Jessamine Mathew explores Facebook's "real name" policy and its implications for the right to free speech. &lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;The power to be unidentifiable on the internet has been a major reason for its sheer number of users. Most of the internet can now be freely used by anybody under a pseudonym without the fear of being recognised by anybody else. These conditions allow for the furtherance of free expression and protection of privacy on the internet, which is particularly important for those who use the internet as a medium to communicate political dissent or engage in any other activity which would be deemed controversial in a society yet not illegal. For example, an internet forum for homosexuals in India, discussing various issues which surround homosexuality may prove far more fruitful if contributors are given the option of being undetectable, considering the stigma that surrounds homosexuality in India, and the recent setting-aside of the Delhi High Court decision reading down Section 377 of the Indian Penal Code. The possibility of being anonymous or pseudonymous exists on many internet fora but on Facebook, the world’s greatest internet space for building connections and free expression, there is no sanction given to pseudonymous accounts as Facebook follows a real name policy. And as the &lt;a href="http://www.nytimes.com/2014/06/27/technology/facebook-battles-manhattan-da-over-warrants-for-user-data.html?_r=0"&gt;recent decision&lt;/a&gt; of a New York judge, disallowing Facebook from contesting warrants on private information of over 300 of its users, shows, there are clear threats to freedom of expression and privacy.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;On the subject of using real names, Facebook’s Community Standards states, “Facebook is a community where people use their real identities. We require everyone to provide their real names, so you always know who you're connecting with. This helps keep our community safe.” Facebook’s Marketing Director, Randi Zuckerberg, &lt;a href="http://www.dailymail.co.uk/news/article-2019544/Facebook-director-Randi-Zuckerberg-calls-end-internet-anonymity.html"&gt;bluntly dismissed&lt;/a&gt; the idea of online anonymity as one that “has to go away” and that people would “behave much better” if they are made to use their real names. Apart from being a narrow-minded statement, she fails to realise that there are many different kinds of expression on the internet, from stories of sexual abuse victims to the views of political commentators, or indeed, whistleblowers, many of whom may prefer to use the platform without being identified. It has been decided in many cases that humans have a right to anonymity as it provides for the furtherance of free speech without the fear of retaliation or humiliation (&lt;i&gt;see &lt;/i&gt;Talley v. California).&lt;i&gt; &lt;/i&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While Facebook’s rationale behind wanting users to register for accounts with their own names is based on the goal of maintaining the security of other users, it is still a serious infraction on users’ freedom of expression, particularly when anonymous speech has been protected by various countries. Facebook has evolved from a private space for college students to connect with each other to a very public platform where not just social connections but also discussions take place, often with a heavily political theme. Facebook has been described as &lt;a href="http://www.thenational.ae/news/uae-news/facebook-and-twitter-key-to-arab-spring-uprisings-report"&gt;instrumental&lt;/a&gt; in the facilitation of communication during the Arab Spring, providing a space for citizens to effectively communicate with each other and organise movements. Connections on Facebook are no longer of a purely social nature but have extended to political and legal as well, with it being used to promote movements all through the country. Even in India, Facebook was the &lt;a href="http://timesofindia.indiatimes.com/home/news/Facebook-Twitter-Google-change-face-of-Indian-elections/articleshow/34721829.cms"&gt;most widely adopted medium&lt;/a&gt;, along with Twitter and Facebook, for discourse on the political future of the country during, before and after the 2014 elections. Earlier in 2011, Facebook was &lt;a href="https://cis-india.org/news/web2.0-responds-to-hazare"&gt;used intensively&lt;/a&gt; during the India Against Corruption movement. There were pages created, pictures and videos uploaded, comments posted by an approximate of 1.5 million people in India. In 2012, Facebook was also used to &lt;a href="http://timesofindia.indiatimes.com/tech/social-media/Delhi-gang-rape-case-FacebookTwitter-fuels-rally-at-India-Gate/articleshow/17741529.cms"&gt;protest against the Delhi gang rape&lt;/a&gt; with many coming forward with their own stories of sexual assault, providing support to the victim, organising rallies and marches and protesting about the poor level of safety of women in Delhi.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Much like its content policy, Facebook exhibits a number of discrepancies in the implementation of the anonymity ban. Salman Rushdie found that his Facebook account had been &lt;a href="http://www.nytimes.com/2011/11/15/technology/hiding-or-using-your-name-online-and-who-decides.html?pagewanted=all&amp;amp;_r=0"&gt;suspended&lt;/a&gt; and when it was reinstated after he sent them proof of identity, Facebook changed his name to the name on his passport, Ahmed Rushdie instead of the name he popularly goes by. Through a series of tweets, he criticised this move by Facebook, forcing him to display his birth name. Eventually Facebook changed his name back to Salman Rushdie but not before serious questions were raised regarding Facebook’s policies. The Moroccan activist Najat Kessler’s account was also &lt;a href="https://www.google.co.in/url?sa=t&amp;amp;rct=j&amp;amp;q=&amp;amp;esrc=s&amp;amp;source=web&amp;amp;cd=5&amp;amp;cad=rja&amp;amp;uact=8&amp;amp;ved=0CD8QFjAE&amp;amp;url=http%3A%2F%2Fjilliancyork.com%2F2010%2F04%2F08%2Fon-facebook-deactivations%2F&amp;amp;ei=O1KxU-fwH8meugSZ74HgAg&amp;amp;usg=AFQjCNE7oUt2dyrSjpTskK7Oz3Q1OYXudg&amp;amp;sig2=bsOu46nmABTUhArhdjDCVw&amp;amp;bvm=bv.69837884,d.c2E"&gt;suspended&lt;/a&gt; as it was suspected that she was using a fake name. Facebook has also not just stopped at suspending individual user accounts but has also removed pages and groups because the creators used pseudonyms to create and operate the pages in question. This was seen in the case of Wael Ghonim who created a group which helped in mobilizing citizens in Egypt in 2011. Ghonim was a Google executive who did not want his online activism to affect his professional life and hence operated under a pseudonym. Facebook temporarily &lt;a href="http://www.newsweek.com/how-wael-ghonim-sparked-egypts-uprising-68727"&gt;removed&lt;/a&gt; the group due to his pseudonymity but later reinstated it.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While Facebook performs its due diligence when it comes to some accounts, it has still done nothing about the overwhelmingly large number of obviously fake accounts, ranging from Santa Claus to Jack the Ripper. On my own Facebook friend list, there are people who have entered names of fictional characters as their own, clearly violating the real name policy. I once reported a pseudonymous account that used the real name of another person. Facebook thanked me for reporting the account but also said that I will “probably not hear back” from them. The account still exists with the same name. The redundancy of the requirement lies in the fact that Facebook does not request users to upload some form identification when they register with the site but only when they suspect them to be using a pseudonym. Since Facebook also implements its policies largely only on the basis of complaints by other users or the government, the real name policy makes many political dissidents and social activists the target of abuse on the internet.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Further, Articles 21 and 22 of the ICCPR grant all humans the right to free and peaceful assembly. As governments increasingly crack down on physical assemblies of people fighting for democracy or against legislation or conditions in a country, the internet has proved to be an extremely useful tool for facilitating this assembly without forcing people to endure the wrath of governmental authorities. A large factor which has promoted the popularity of internet gatherings is the way in which powerful opinions can be voice without the fear of immediate detection. Facebook has become the coveted online space for this kind of assembly but their policies and more particularly, faulty implementation of the policies, lead to reduced flows of communication on the site.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Of course, Facebook’s fears of cyberbullying and harassment are likely to materialise if there is absolutely no check on the identity of users.  A possible solution to the conflict between requiring real names to keep the community safe and still allowing individuals to be present on the network without the fear of identification by anybody would be to ask users to register with their own names but still allowing them to create a fictional name which would be the name that other Facebook users can see. Under this model, Facebook can also deal with the issue of safety through their system of reporting against other users. If a pseudonymous user has been reported by a substantial number of people for harassment or any other cause, then Facebook may either suspend the account or remove the content that is offensive. If the victim of harassment chooses to approach a judicial body, then Facebook may reveal the real name of the user so that due process may be followed. At the same time, users who utilise the website to present their views and participate in the online process of protest or contribute to free expression in any other way can do so without the fear of being detected or targeted.  Safety on the site can be maintained even without forcing users to reveal their real names to the world. The system that Facebook follows currently does not help curb the presence of fake accounts and neither does it promote completely free expression on the site.&lt;/p&gt;

&lt;h3&gt;Specific Issues of Discussions &amp;amp; Description&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Internet usage in the Asia Pacific region has been growing at a phenomenal rate and online service providers have benefited enormously from this growth. However, the region poses challenges for online service providers in terms of legal risks involved with respect to user generated content. Across the world from Europe to the US, it has been an accepted policy that service providers on the Internet cannot be held liable for user-generated content and this principle has found place in legislations enacted in this field in most countries. However, the Asian region has often seen blocking of services and websites due to user-generated content that is deemed to be illegal. There needs to be a debate on safe harbour provisions for intermediaries and the take-down provisions in legislations to ensure that the right to freedom of expression of citizens are protected while maintaining an environment that permits innovation in this space.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The workshop will also consider the different classes of intermediaries, how they differ functionally and if their differing roles should bear an impact on their responsibility with regards to protection of rights of users. Traditional models of consumer protection are based on distinguishing the roles and responsibilities of suppliers, facilitators and consumers. While developing consumer protection models for online intermediary platforms, their evolving roles and responsibilities as a supplier and a facilitator need to be considered. Intermediary platforms have also created and highlighted new consumer relations and issues that call for robust and fluid reddressal mechanisms.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The need to reflect on reddressal mechanisms for consumer issues pertaining to online intermediaries is also necessary, given the economic implications associated with intermediary liability. Failure to protect intermediaries stems innovation and restricts growth of start-ups and small to medium enterprises in the digital economy and has negative financial implications. Moreover, intermediaries are crucial in connecting developing countries to global markets and a failure to protect them, creates a barrier to information exchange and capacity building.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The panel will discuss the following issues:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;Take-down procedures and Put-back provisions used in various countries in the region&lt;/li&gt;
&lt;li&gt;Safe-harbour provisions for intermediaries&lt;/li&gt;
&lt;li&gt;Need for classification of Intermediaries for the purpose of a take-down regime and user rights&lt;/li&gt;
&lt;li&gt;Rights of users of services provided by online intermediaries &lt;/li&gt;
&lt;li&gt;Recommendations for a balanced intermediary liability regime&lt;/li&gt;

&lt;p style="text-align: justify; "&gt;&lt;b&gt;Jyoti Panday&lt;/b&gt;, Center for Internet and Society, Civil Society, India &lt;br /&gt;Jyoti Panday is Programme Officer at the Centre for Internet and Society working on Internet governance and on issues related to the role and responsibility of intermediaries in protecting user rights and freedom of expression.  She has experience in strategy, campaign management and research on issues and processes related to the development agenda, sustainability and democracy. She has completed her MSc in Public Policy from Queen Mary, University of London.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Shahzad Ahmed&lt;/b&gt;, Bytes for All Pakistan, Civil Society, Pakistan&lt;br /&gt;Shahzad Ahmad is the Country Coordinator of Bytes for All, Pakistan and founder of the Digital Rights Institute (DRI). He is currently working on issues of ICT policy advocacy, internet rights and freedom of expression. He is a development communications expert and is at the forefront of the Internet Rights movement in Pakistan.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mr. Ahmad is a Diplo Fellow, Executive Board Member of the Association for Progressive Communications, Advisory Board Member of .PK ccTLD and a member of the International Advisory Board of Privacy International, UK. He regularly contributes to various publications and research studies on ICTs for development, freedom of expression and gender related issues. Widely travelled, he regularly participates in various forums at local, regional and global level. Mr. Ahmad maintains a strong engagement with broader civil society networks and strongly believes in participation and openness.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Professor KS Park&lt;/b&gt;, Korea University Law School Professor &lt;br /&gt;One of the founders of Open Net Korea, Professor Park has written and is active in internet, free speech, privacy, defamation, copyright, international business contracting, etc. He has given expert testimonies in high-profile free speech cases including the /Minerva /case, the internet real name verification case, the military’s subversive book blacklisting case, the newspaper consumers’ boycott case, and the Park Jung-Geun Retweet case.  As a result, the “false news” crime and the internet real name verification laws were struck down as unconstitutional, Park Jung-Geun and Minerva acquitted, the soldiers challenging book blacklisting reinstated, the newspaper boycotters acquitted partially as to the “secondary boycotting” charge (2010-2013).&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Since 2006, he serves as the Executive Director of the PSPD Law Center, a non-profit entity that has organized several impact litigations in the areas of free speech, privacy, and copyright.  There, the Law Center won the world’s first damage lawsuit against a copyright holder for “bad faith” takedown (2009) and the first damage lawsuit against a portal for warrantless disclosure of the user identity data to the police (2012).&lt;/p&gt;

        &lt;h3&gt;Thematic Area of Interest&lt;/h3&gt;
&lt;ul&gt;
&lt;li&gt;Enhanced Cooperation &amp;amp; the Multi-stakeholder model&lt;/li&gt;
&lt;/ul&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Introduction&lt;/b&gt;:&lt;br /&gt;Today, multi-stakeholderism is the catchphrase in Internet governance. With the display of a multi-stakeholder model at NETmundial, controversies and opinions regarding the meaning, substance and benefits of multi-stakeholderism have deepened. As the recent meeting of the Working Group on Enhanced Cooperation of the United Nations Commission on Science, Technology and Development demonstrates, questions and concerns regarding meaning of multi-stakeholderism, the&lt;br /&gt;&lt;br /&gt;legitimacy and desirability of its processes, and the successes and disappointments of its outcomes now dominate the discussion. At this juncture, clarity and consensus are imperative to determine the future of multi-stakeholderism in Internet governance.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Roles and responsibilities of stakeholders&lt;/b&gt;:&lt;br /&gt;The debates surrounding stakeholder-roles in Internet governance began with ¶ 49 of the Geneva Declaration of Principles and ¶ 35 of the Tunis Agenda, which delineated clear roles and responsibilities. It created a ‘contributory’ multi-stakeholder model, where states held sovereign authority over public policy issues, while business and civil society were contributed to ‘important roles’ at the ‘technical and economic fields’ and the ‘community level’, respectively. At the same time, it set forth an agenda for enhanced cooperation.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;As the WGEC meeting (April 30-May 2, 2014) demonstrated, there is as yet no consensus on stakeholder-roles. Certain governments remain strongly opposed to equal roles of other stakeholders, emphasizing their lack of accountability and responsibility. Civil society is similarly splintered, with a majority opposing the Tunis Agenda delineation of stakeholder-roles, while others remain dubious of permitting the private sector an equal footing in public policy-making. Still others question the wisdom of seeking a ‘fix’ when ‘nothing is broken’. In this session, we aim to interrogate the benefits and disadvantages of an ‘equal footing’ model, as opposed to a ‘contributory’ model.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Specific Issues of Discussions &amp;amp; Description&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Who are the stakeholders? Should a multi-stakeholder model of Internet governance grant all stakeholders ‘equal footing’? Should such ‘equal footing’ be relegated to issues other than substantive public policy-making? On the other hand, is a ‘contributory’ model safer? Are states better equipped to represent interests inclusively? How can governments and businesses best perform their role as trustees of the public interest of interest users?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In view of the formidable consolidation by the private sector at NETmundial, while civil society splintered on issues of intellectual property and intermediary liability, can a ‘participative model’ better prevent detrimental outcomes?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Multi-stakeholderism beyond NETmundial&lt;/b&gt;:&lt;br /&gt;As important as the meaning of multi-stakeholderism is the process of its execution. The need to fashion safe and sustainable processes for multi-stakeholder participation was highlighted by the successes and failures of private sector and civil society at NETmundial. From the ICANN and IGF models to stakeholder coalitions, premeeting coordination and governmental policy participation, this session shall expand on the quest for effective and beneficial stakeholder participation and representation in both the ‘equal footing’ and ‘contributory’ models, with a focus on enhancing developing country participation.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Particularly, lessons that Internet governance may draw from multi-stakeholder governance processes across areas shall be discussed. For instance, deliberative democracy, enterprise associations or unions (such as in the International Labour Organisation) may all be of value. Similarly, multi-stakeholder processes in environmental and corporate governance and the development sector may benefit Internet governance. In determining the value of these processes to Internet governance, public interest of users is an important consideration. The capability and initiative of governments to implement an effective bottom-up model of Internet governance is equally important and will be considered.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;We aim to conduct a 90-minute workshop (2 panels of 45 minutes each), inclusive of 15-30 minutes in all for Q&amp;amp;A from audience, panellists and moderators.&lt;/p&gt;

    <title>Poor Guarantee of Online Freedom in India</title>

        &lt;b&gt;The debate over the "Intermediaries Guidelines" as part of the Information Technology Act, 2000 in Parliament brought focus to the issue of censorship and lack of accountability of governing bodies vis-à-vis the internet in the country. This cannot be divorced from the larger questions related to the threats to freedom of expression from both the state and various societal actors today.&lt;/b&gt;
        
&lt;p&gt;&lt;a class="external-link" href="http://www.epw.in/commentary/poor-guarantee-online-freedom-india.html"&gt;This article by Geeta Seshu was published in the Economic &amp;amp; Political Weekly, Vol XLVII No. 24, June 2012&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;An annulment motion against the Information Technology (Inter-­mediaries Guidelines) Rules, 2011 moved by Member of Parliament (MP) ­P ­Rajeev of the Communist Party of ­India (Marxist) in the Rajya Sabha, was the first serious attempt by internet freedom activists to get the Information Technology (IT) Act, 2000 discussed and reviewed by the country’s lawmakers.&lt;/p&gt;
&lt;p&gt;Not unexpectedly, the motion, specifically against the rules governing intermediaries – clause (zg) of subsection (2) of Section 87 read with subsection (2) of Section 79 of the &amp;gt;IT Act, 2000 – was not carried. However, the discussion that preceded it at least demonstrated the concerns of parliamentarians about what internet freedom activists have termed the “draconian” provisions of the IT Act.&lt;br /&gt;&lt;br /&gt;It is about time, really, that parliamentarians sit down to review what they very quickly acquiesced to in December 2009. It is also about time that the ­debate over the provisions of the IT Act be conducted in the public domain, ­instead of in closed-door meetings with expert groups and committees comprising a narrow set of stakeholders ­favoured by the government or its ­various wings.&lt;br /&gt;&lt;br /&gt;The discussion in the Rajya Sabha largely centred around the vague and sweeping terminology of the range of content that anyone could take objection to. P Rajeev said that while he supported the regulation of the internet, he was not in favour of its control. The rules were ultra vires the IT Act, he said. ­Echoing his concern, leader of the opposition Arun Jaitley of the Bharatiya Janata Party, D Raja of the Communist Party of India and N K Singh of the Janata Dal (United) – to name just a few – also said that the internet was different from other media and censoring it was untenable.&lt;br /&gt;&lt;br /&gt;Finally, union minister for information technology, Kapil Sibal, was forced to give an assurance to the house that he would call a meeting of MPs, industry and all stakeholders and implement whatever consensus emerges after a discussion on the speci­fic words members had objections to.&lt;br /&gt;&lt;br /&gt;There was no mention from the minister on a host of other problem areas in the rules as they are currently framed, including the very sweeping definition of an “intermediary” itself (any entity which on behalf of another receives, stores or transmits any electronic record – which means internet service provi­ders, web hosting providers, search ­engines, online payment sites, cyber­cafes and bloggers too). No mention ­either of the rules for intermediaries to takedown notices within 36 hours of ­receiving a complaint, irrespective of whether these are fair and reasonable. No ­mention of whether the rules need to provide procedures for hearing and adjudicating complaints before any ­content is taken down.&lt;/p&gt;
&lt;h3&gt;The IT Guidelines&lt;/h3&gt;
&lt;p&gt;In several ways, the rules have gone way beyond what was laid down in the IT Act, but they also add considerably to the original reasonable restrictions laid down under Article 19 (2) of the Constitution of India. Some of the terms that can invite objections under the guidelines are:&lt;br /&gt;&lt;br /&gt;(a) Belongs to another person and to which the user does not have any right to;&amp;nbsp; (b) grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophiliac, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; (c) harm ­minors in any way; (d) infringes any patent, trademark, copyright or other proprietary rights; (e) violates any law for the time being in force; (f) deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature; (g) impersonate another person; (h) contains software ­viruses or any other computer code, files or programmes designed to interrupt, destroy or limit the functionality of any computer resource; (i) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting any other nation.&lt;br /&gt;&lt;br /&gt;With this wide-ranging and entirely arbitrary set of potential violations, the possibility of misuse is also immense. In its comments submitted in response to the draft rules, Privacy India and the Centre for Internet and Society (CIS) pointed out that Sections 79(1) and (2) of the amended IT Act itself did provide for exemptions for third party liabilities of intermediaries, something that the rules have now virtually set aside.&lt;a name="fr1" href="#fn1"&gt;[1]&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;Other comments submitted by these organisations about security and privacy of cybercafe users deal with minors and with the general architecture of cybercafes. In the first instance, the organisations expressed concern that undue restrictions on the use of the ­internet by minors (photo identity cards, accompanied by adults, etc) would hamper their access to the internet and would actually discourage poorer children from using the internet.&lt;br /&gt;&lt;br /&gt;In the second instance, the detailed restrictions on the layout of the cyber­cafés – the height of cabins and the ­directions of the screens, etc, would, they felt, be intrusive and violate the ­privacy of internet users in cybercafes. Besides, vulnerable sections like sexual minorities or HIV positive patients may even be open to identity theft, they feared.&lt;br /&gt;&lt;br /&gt;The discussion on the rules unfortunately did not come close to addressing these fears. While the lawmakers gene­rally accepted the importance of regulation of the internet and electronic communication, there is still very little clarity on exactly how this must be done, the extent to which regulation must take place and the agency that will be entrusted with this task.&lt;br /&gt;&lt;br /&gt;The IT Act, 2000 was first passed in an era when the country was transitioning to an electronic age. E-commerce was uppermost in the minds of policymakers, their eyes firmly fixed on the new economy. But soon enough, it was clear that techno­logy was developing rapidly and an ­expert committee was consti­tuted to ­revise the act and suggest amendments that would incorporate technological changes.&lt;/p&gt;
&lt;h3&gt;Lack of Accountability&lt;/h3&gt;
&lt;p&gt;In the wake of the 26 November 2008 ­attack in Mumbai, national security and intelligence were powerful emotional catchwords and few questioned some of the sweeping provisions laid down by the rules under the IT Act. While the annulment motion focuses on the pernicious nature of the guidelines for intermediaries, this is only one amongst a ­series of rules that seek to change the very manner in which Indians can ­access and use the internet. Other rules relate to ­decrypting, monitoring and blocking of communication, data security and privacy (Section 69: inter­ception, monitoring and decryption of information, Section 69 A: blocking, Section 69 B: monitoring of traffic data or information) and of course, the complete ­absence of checks and balances for the powers given to authorities like Com­puter Emergency Response Team ­India (CERT-In).&lt;br /&gt;&lt;br /&gt;In fact, there has been little or no ­review of the responsibility vested in an agency like CERT-In, which describes itself as the nodal agency to oversee the security of the nation. Conflating secu­rity concerns with content that may be ­objectionable to some is one thing but also providing this agency with the powers to block sites without even the crea­tors of these sites getting to know about it is another.&lt;br /&gt;&lt;br /&gt;Most of our attention today is on the censorship rampant on the internet in India. Most recently, there have been several instances of internet sites being blocked and takedown notices sent to bloggers. In the last few months, we have had the arbitrary blocking of the website cartoonsagainstcorruption.com which was run by Kanpur-based cartoonist Aseem Trivedi, the arrest of Jadavpur University professor Ambikesh Mohapatra and the controversial move last year by the Indian government to get internet service providers to remove so-called objectionable content on Facebook, Orkut and Youtube, apart from other sites. A complaint against these sites by journalist Vinay Rai followed soon after, though it strangely did not invoke provisions of the IT Act, preferring to cite alleged violations under the Indian Penal Code.&lt;br /&gt;&lt;br /&gt;Trivedi did not even know that his site was blocked till some friends called him to tell him that they could not access his site. After an exchange of emails with his webhost, the portal “Big Rock”, he was informed that the site was sus­pended because it contained cartoons that showed disrespect to national emblems. A complaint had been received by ­Mumbai’s cybercrime cell by a Mumbai-based advocate, R P Pandey. The Kanpur resident also learnt later from news­paper reports that another case, this time under charges of sedition, were lodged against him in Beed district of Maharashtra.&lt;/p&gt;
&lt;p&gt;While this method of embroiling someone in cases in far-flung geographical areas is not new (the complaint by the Indian Institute of Planning and Management against New Delhi-based Caravan magazine in Silchar, Assam is a good case in point), Trivedi quickly moved the content on his site onto ­another blogging platform, also got ­together friends and supporters to launch “Saveyourvoice”, an online and offline campaign, with a cheeky celebration of All Fool’s Day on 1 April 2012 with a greeting to the minister Kapil Sibal “for his&amp;nbsp; foolish attempts to try censoring ­internet” and another campaign – “Freedom in a cage” – at Jantar Mantar, Delhi, in April 2012.&lt;br /&gt;&lt;br /&gt;Other internet freedom activists have got together to secure information on censorship. Last year, a right-to-information (RTI) application by the CIS revealed that 11 websites were blocked on orders from the department of ­information techno­logy. A writ petition against the IT Act has been filed in the Kerala High Court and the Software Freedom Law Centre, which was instrumental in campaigning for the annulment motion in the Rajya Sabha, has launched an online petition against the IT Act rules that refers to government authority to censor facebook posts, ­monitor emails and skype conversations, access private information and mine sensitive personal data.&lt;a name="fr2" href="#fn2"&gt;[2]&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;Governments the world over are exercised about the need to impose restrictions on online freedom and a good indication is the bi-annual Google Transparency Report that monitors the number and categories of requests sent by different governments to take down content. In the last report for the period January to June 2011, the report recor­ded requests to remove 358 items and 68 content removal requests, 58% of which were fully or partially complied with. In addition, there were government requests to remove Youtube videos that were protests against local leaders or used offensive language against religious leaders, besides 236 communities and profiles from Orkut which were ­critical of a local politician.&lt;br /&gt;&lt;br /&gt;Interestingly, while content removal requests for the Orkut profiles remained as Google maintained it did not fit its own community standards or local law, Google chose to “locally” restrict the videos that may incite enmity between communities. With minor variations, this is a stance adopted by other online companies, like Facebook and Twitter, with the latter coming out with a policy earlier this year that it would remove content that appeared to violate local laws.&lt;/p&gt;
&lt;p&gt;In the struggle to keep the internet free and protect communication from surveillance and blocking by governments, it would be naive to expect ­commercially-driven internet companies to put up much of a stand. Most of these stakeholders have agreed with lawmakers that the internet does need regulation. On their part, the Indian government, which has flexed its desire to regulate the internet, has also been sensitive to criticism of its role in censo­ring online freedom. Other stakeholders – the vast community of users of the internet, bloggers, website hosts, creators and producers of online videos, file-sharers, software developers, etc, are only engaged in a race to protect their content and shift it to more amenable sites every time they run into trouble.&lt;/p&gt;
&lt;h3&gt;Threats to Freedom of Expression&lt;/h3&gt;
&lt;p&gt;However, it must be noted that the censorship of online media is but a reflection of the curbs on freedom of expression in general. The attacks on freedom of expression in “offline” media, the attacks on journalists and the deaths of eight journalists since 2010,&lt;a name="fr3" href="#fn3"&gt;[3]&lt;/a&gt; the alarming regularity with which we are witnessing a ban on books and cinema, art or theatre, the increasing intole­rance of dissenting or differing opinions in society, the abject fear of free and ­independent debate and discussion and the role of the government in actively furthering this intolerance are suggestive of a dangerous trend.&lt;br /&gt;&lt;br /&gt;Almost all these instances are marked by the clear absence of any due pro­cedure in addressing the content that becomes objectionable to someone or some sections of society, instead arbitrarily and speedily removing this content from the public domain. Whether it is the withdrawal of Rohinton Mistry’s book Such a Long Journey, a prescri­bed textbook by Bombay University, midway through the academic year, or that of recent issue of the National Council of Educational Research and Training (NCERT) textbook on the Constitution of India, institutional redressal mechanisms were simply not given a chance.&lt;br /&gt;&lt;br /&gt;The woeful absence of similar redressal mechanisms for so-called objectionable content under the rules of the amended IT Act only exacerbates this situation further.&lt;/p&gt;

I. The
Multi-stakeholder Advisory Group to the IGF organised a discussion on
&lt;em&gt;&lt;strong&gt;Sustainable
Development Goals (SDGs) and Internet Economy&lt;/strong&gt;&lt;/em&gt;&lt;em&gt;
&lt;/em&gt;at
the Main Meeting Hall from 9:00 am to 12:30 pm on 11 November, 2015.
The
discussions at this session focused on the importance of Internet
Economy enabling policies and eco-system for the fulfilment of
different SDGs. Several concerns relating to internet
entrepreneurship, effective ICT capacity building, protection of
intellectual property within and across borders were availability of
local applications and content were addressed. The panel also
discussed the need to identify SDGs where internet based technologies

and Anonymity: Rights and Risks&lt;/strong&gt;&lt;/em&gt;

protection of anonymity and encryption and ways in which law
enforcement demands could be met while ensuring that individuals

UNESCO, Council of Europe, Oxford University, Office of the High
Commissioner on Human Rights, Google, Internet Society organised a
workshop  on hate speech and youth radicalisation at Room 9 on
Thursday, November 12. UNESCO shared the initial outcome from its
commissioned research on online hate speech including practical
recommendations on combating against online hate speech through
understanding the challenges, mobilizing civil society, lobbying
private sectors and intermediaries and educating individuals with
media and information literacy. The workshop also discussed how to
help empower youth to address online radicalization and extremism,
and realize their aspirations to contribute to a more peaceful and

A
workshop on &lt;em&gt;&lt;strong&gt;FOSS
&amp;amp; a Free, Open Internet: Synergies for Development&lt;/strong&gt;&lt;/em&gt;
was organized at Workshop Room 7 from 2:00 pm to 3:30 pm on 13
November, 2015. The discussion was focused on the increasing risk to
openness of the internet and the ability of present &amp;amp; future
generations to use technology to improve their lives. The panel shred
different perspectives about the future co-development
of FOSS and a free, open Internet; the threats that are emerging; and
ways for communities to surmount these. Sunil
Abraham emphasised the importance of free software, open standards,
open access and access to knowledge and the lack of this mandate in
the draft outcome document for upcoming WSIS+10 review and called for
inclusion of the same. Pranesh Prakash further contributed to the
discussion by emphasizing the need for free open source software with
end‑to‑end encryption and traffic level encryption based
on open standards which are decentralized and work through federated
networks. The
