&lt;p style="text-align: justify; "&gt;When  Muhammad Maiyagy Gery heard about a new mobile app from  &lt;a href="http://quotes.wsj.com/FB"&gt;Facebook&lt;/a&gt;&lt;span class="company-name-type"&gt; Inc.&lt;/span&gt;&lt;a class="chiclet-wrapper" href="http://quotes.wsj.com/FB"&gt; &lt;/a&gt; that provides free Internet access in his native Indonesia, he was excited.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But after testing it, the 24-year-old student from a mining town on  the eastern edge of Borneo soon deleted the app, called Internet.org,  frustrated that he was unable to access  &lt;a href="http://quotes.wsj.com/GOOG"&gt;Google&lt;/a&gt;.&lt;a class="chiclet-wrapper" href="http://quotes.wsj.com/GOOG"&gt; &lt;/a&gt;com and some local Indonesian sites.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mr. Gery said Facebook Chief Executive  &lt;a href="http://topics.wsj.com/person/Z/Mark-Zuckerberg/408"&gt;Mark Zuckerberg&lt;/a&gt; is an “inspiration in the tech world,” but added that the company’s free Internet effort is “inadequate.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mr.  Gery’s reaction illustrates the unexpected criticism Facebook has  encountered to its bold initiative to bring free Internet access to the  world’s four billion people who don’t have it, and to increase  connectivity among those with limited access. He is one of many users  who say a Facebook-led partnership is providing truncated access to  websites, thwarting the principles of what is known in the U.S. as net  neutrality—the view that Internet providers shouldn’t be able to dictate  consumer access to websites.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Since &lt;a class="none icon" href="http://www.wsj.com/articles/SB10001424127887323608504579025773163440460" target="_self"&gt;Mr. Zuckerberg’s announcement of the $1 billion project&lt;/a&gt; two years ago, Facebook has launched Internet.org in 19 countries  across Asia, Latin America and Africa by teaming up with mobile carriers  and technology giants including  &lt;a href="http://quotes.wsj.com/SSNHZ"&gt;Samsung Electronics&lt;/a&gt; Co.&lt;a class="chiclet-wrapper" href="http://quotes.wsj.com/SSNHZ"&gt; &lt;/a&gt;, chip maker  &lt;a href="http://quotes.wsj.com/QCOM"&gt;Qualcomm&lt;/a&gt; Inc.&lt;a class="chiclet-wrapper" href="http://quotes.wsj.com/QCOM"&gt; &lt;/a&gt; and telecom-equipment firm  &lt;a class="company-name" href="http://quotes.wsj.com/ERIC"&gt;Ericsson&lt;/a&gt;&lt;a class="chiclet-wrapper" href="http://quotes.wsj.com/ERIC"&gt; &lt;/a&gt; AB. Facebook says that through the initiative, in which it is also  experimenting with drones and satellites to deliver Web access, some  nine million people have come online.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;img src="https://cis-india.org/home-images/Facebook.png/@@images/3da859db-3161-493a-b3e2-8e6065109867.png" alt="Facebook" class="image-inline" title="Facebook" /&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Users with data-enabled feature phones can access a special website through a mobile browser, while those with smartphones can download the app from Google’s Play Store. Though arrangements vary by country, the Internet.org app typically provides a simplified, low-data version of Facebook, its Messenger service and selected local websites offering services like jobs, health information and sports updates. Facebook says it works with mobile operators, which provide free data, and governments to pick sites for the platform.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While some applaud the Internet initiative, the U.S. company is  dealing with a backlash from users in some of its fastest-growing  markets like Indonesia and India, which are key to its future expansion.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In  response to the criticism, Mr. Zuckerberg earlier this year wrote an  opinion article that appeared in two Indian newspapers defending the  project. He argued that the initiative is compatible with the principles  of net neutrality, and that if people “can’t afford to pay for  connectivity, it is always better to have some access and voice than  none at all.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But criticism about the initiative has placed  Facebook in an awkward position. The social network along with other  tech companies like  &lt;a href="http://quotes.wsj.com/AMZN"&gt;Amazon.com&lt;/a&gt; Inc.&lt;a class="chiclet-wrapper" href="http://quotes.wsj.com/AMZN"&gt; &lt;/a&gt; and  &lt;a href="http://quotes.wsj.com/TWTR"&gt;Twitter&lt;/a&gt; Inc.&lt;a class="chiclet-wrapper" href="http://quotes.wsj.com/TWTR"&gt; &lt;/a&gt; are members of the U.S. industry group Internet Association, which  advocates for net neutrality, among other issues. In markets like  Indonesia and India, critics say Facebook is more interested in  controlling which websites users can tap into than in ensuring free  Internet access. “It’s not Internet.org. It’s walled garden.org,” said  Sunil Abraham, head of the Bangalore, India-based Center for Internet and Society.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Facebook  wants to be seen as a pioneer “of the open and free Internet and not  the opposite,” said Neha Dharia, an analyst at telecommunications  research firm Ovum.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;On Thursday, Facebook said it was changing the name of the Internet.org app and mobile website to Free Basics by Facebook in order to better distinguish it from the company’s wider Internet.org initiative. Asked whether the change was related to criticism of the project, a Facebook spokeswoman said that the name will “more intuitively describe the product to consumers.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Chris Daniels, Facebook’s vice president in charge of the project,  said in a recent interview that he has been surprised by the criticism  of the project, noting that many people have gained access to the Web.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;a class="none icon" href="http://blogs.wsj.com/indiarealtime/2015/04/16/how-india-is-breaking-the-internet-while-trying-to-savetheinternet/" target="_self"&gt;This spring in India&lt;/a&gt;,  travel website Cleartrip, news channel NDTV and a mobile news app  pulled their content from the platform amid concerns over net  neutrality.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Cleartrip referred inquiries about its reasons for  leaving the initiative to an April statement it posted on its website.  In that statement, the company said the backlash in India “gave us pause  to rethink our approach to Internet.org and the idea of large  corporations getting involved with picking and choosing who gets access  to what and how fast.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Vishal Anand, chief product officer at  mobile news app Dailyhunt, said that “While we appreciate the effort to  give people Internet access, we fully support the principles of net  neutrality.” He declined to elaborate on the company’s specific  objections to Internet.org.&lt;/p&gt;

    <title>The Legal Validity of Internet Bans: Part II </title>

        &lt;b&gt;In recent months, there has been a spree of bans on access to Internet services in Indian states, for different reasons. The State governments have relied on Section 144, Code of Criminal Procedure 1973 to institute such bans. Despite a legal challenge, the Gujarat High Court found no infirmity in this exercise of power in a recent order. We argue that it is Section 69A of the Information Technology Act 2000, and the Website Blocking Rules, which set out the legal provision and procedure empowering the State to block access to the Internet (if at all it is necessary), and not Section 144, CrPC.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;&lt;span&gt;As we saw earlier, the Gujarat High Court held that Section 144, CrPC empowers the State apparatus to order blocking of access to data services. According to the Court, Section 69A, IT Act can be used to block certain websites, while under Section 144, CrPC, the District Magistrate can direct telecom companies like Vodafone and Airtel, who&lt;/span&gt;&lt;i&gt; &lt;/i&gt;&lt;span&gt;extend the facility of Internet access. In effect, the High Court agreed with the State government’s argument that the scope of Section 69A, IT Act covers only blocking of &lt;/span&gt;&lt;i&gt;certain &lt;/i&gt;&lt;span&gt;websites, while Section 144, CrPC grants a wider power.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;This is what the Court said (para 9 of the &lt;a href="http://indiankanoon.org/doc/29352399/"&gt;order&lt;/a&gt;):&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“&lt;i&gt;If the comparison of both the sections in the field of operations is made, barring certain minor overlapping more particularly for public order &lt;/i&gt;[sic]&lt;i&gt;, one can say that the area of operation of Section 69A is not the same as that of Section 144 of the Code. &lt;span&gt;Section 69A may in a given case also be exercised for blocking certain websites&lt;/span&gt;, whereas under &lt;span&gt;Section 144 of the Code, directions may be issued to certain persons who may be the source for extending the facility of internet access&lt;/span&gt;. Under the circumstances, we do not find that the contention raised on behalf of the petitioner that the resort to only Section 69A was available and exercise of power under Section 144 of the Code was unavailable, can be accepted.&lt;/i&gt;” (emphases ours)&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;We submit that the High Court’s reasoning failed to examine the scope of Section 69A, IT Act thoroughly. Section 69A does, in fact, empower the government to order blocking of access to data services, and it is a special law. Importantly, it sets forth a procedure that State governments, union territories and the Central Governments must follow to order blocks on websites or data services.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;I. Special Law Prevails Over General Law&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The IT Act, 2000 is a special law dealing with matters relating to the Internet, including offences and security measures. The CrPC is a general law of criminal procedure.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;When a special law and a general law cover the same subject, then the special law supersedes the general law. This is a settled legal principle. Several decisions of the Supreme Court attest to this fact. To take an example, in &lt;a href="http://www.asianlii.org/in/cases/cen/INSC/2010/526.html"&gt;&lt;i&gt;Maya Mathew &lt;/i&gt;v. &lt;i&gt;State of Kerala&lt;/i&gt;&lt;/a&gt;, (2010) 3 SCR 16 (18 February 2010), when there was a contention between the Special Rules for Kerala State Homoeopathy Services and the general Rules governing state and subordinate services. The Supreme Court held that when a special law and a general law both govern a matter, the Court should try to interpret them harmoniously as far as possible. But if the intention of the legislature is that one law should prevail over another, and this intention is made clear expressly or impliedly, then the Court should give effect to this intention.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;On the basis of this principle, let’s take a look at the IT Act, 2000. &lt;a href="http://cybercrime.planetindia.net/ch13_2008.htm"&gt;Section 81, IT Act&lt;/a&gt; expressly states that the provisions of the IT Act shall have overriding effect, notwithstanding anything inconsistent with any other law in force. Moreover, in the &lt;a href="http://cybercrime.planetindia.net/statement-objects-foritaa-2006.htm"&gt;Statement of Objects and Reasons&lt;/a&gt; of the IT (Amendment) Bill, 2006, the legislature clearly notes that amendments inserting offences and security measures into the IT Act are necessary given the proliferation of the Internet and e-transactions, and the rising number of offences. These indicate expressly the legislature’s intention for the IT Act to prevail over general laws like the CrPC in matters relating to the Internet.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Now, we will examine whether the IT Act empowers the Central and State governments to carry out complete blocks on access to the Internet or data services, in the event of emergencies. If the IT Act does cover such a situation, then the CrPC should not be used to block data services. Instead, the IT Act and its Rules should be invoked.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;&lt;strong&gt;II. Section 69A, IT Act Allows Blocks on Internet Access&lt;/strong&gt;&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Section 69A(1), IT Act says:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“Where the Central Government or any of its officer specially authorised by it in this behalf is satisfied that it is necessary or expedient so to do, in the interest of sovereignty and integrity of India, defence of India, security of the State, friendly relations with foreign States or public order or for preventing incitement to the commission of any cognizable offence relating to above, it may subject to the provisions of sub-section (2) for reasons to be recorded in writing, by order, direct any agency of the Government or intermediary to block for &lt;span&gt;access&lt;/span&gt; by the public or cause to be blocked for access by the public any&lt;span&gt; information &lt;/span&gt;generated, transmitted, received, stored or hosted in any &lt;span&gt;computer resource&lt;/span&gt;.” (&lt;i&gt;emphasis ours&lt;/i&gt;)&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Essentially, Section 69A says that the government can block (or cause to be blocked) for access by the public, any information&lt;i&gt; &lt;/i&gt;generated, transmitted, etc. in any computer resource, if the government is satisfied that such a measure is in the interests of public order.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Does this section allow the government to institute bans on Internet access in Gujarat? To determine this, we will examine each underlined term from above.&lt;/span&gt;&lt;/p&gt;
&lt;p style="padding-left: 90px; text-align: justify; "&gt;&lt;strong&gt;&lt;i&gt;Access&lt;/i&gt;&lt;/strong&gt;: &lt;a href="http://indiankanoon.org/doc/1890726/"&gt;Section 2(1)(a)&lt;/a&gt;, IT Act defines access as “...&lt;i&gt;&lt;span&gt;gaining entry into&lt;/span&gt;&lt;/i&gt;, instructing or communicating with… resources of a &lt;i&gt;&lt;span&gt;computer&lt;/span&gt;&lt;/i&gt;, &lt;i&gt;&lt;span&gt;computer system&lt;/span&gt;&lt;/i&gt; or &lt;i&gt;&lt;span&gt;computer network&lt;/span&gt;&lt;/i&gt;”.&lt;/p&gt;
&lt;p style="padding-left: 90px; text-align: justify; "&gt;&lt;strong&gt;&lt;i&gt;Computer resource&lt;/i&gt;&lt;/strong&gt;: &lt;a href="http://indiankanoon.org/doc/1768009/"&gt;Section 2(1)(k)&lt;/a&gt;, IT Act defines computer resource as “computer, computer system, computer network...”&lt;/p&gt;
&lt;p style="padding-left: 90px; text-align: justify; "&gt;&lt;strong&gt;&lt;i&gt;Information&lt;/i&gt;&lt;/strong&gt;: &lt;a href="http://indiankanoon.org/doc/146402352/"&gt;Section 2(1)(v)&lt;/a&gt;, IT Act defines information as “includes… data, message, text, images, sound, voice...”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;So ‘blocking for access’ under Section 69A includes preventing gaining entry or communicating with the resources of a computer, computer system or computer network, and it includes blocking communication of data, message, text, images, sound, etc. Now two questions arise:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;(1) Do 2G and 3G services, broadband and Wifi fall within the definition of ‘computer network’?&lt;/p&gt;
&lt;p style="padding-left: 90px; text-align: justify; "&gt;&lt;strong&gt;&lt;i&gt;Computer network&lt;/i&gt;&lt;/strong&gt;: &lt;a href="http://indiankanoon.org/doc/29924/"&gt;Section 2(1)(j)&lt;/a&gt;, IT Act defines computer network as “inter-connection of one or more computers or computer systems &lt;i&gt;&lt;span&gt;or communication device&lt;/span&gt;&lt;/i&gt;…” by “...use of satellite, microwave, &lt;i&gt;&lt;span&gt;terrestrial line, wire, wireless or other communication media&lt;/span&gt;&lt;/i&gt;”.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;(2) Do mobile phones that can connect to the Internet (we say smartphones for simplicity) qualify as fall within the definition of ‘computer resource’?&lt;/p&gt;
&lt;p style="padding-left: 90px; text-align: justify; "&gt;&lt;strong&gt;&lt;i&gt;Communication device&lt;/i&gt;&lt;/strong&gt;&lt;span&gt;: &lt;/span&gt;&lt;a href="http://indiankanoon.org/doc/59759075/"&gt;Section 2(1)(ha)&lt;/a&gt;&lt;span&gt;, IT Act defines communication device as “&lt;/span&gt;&lt;i&gt;cell phones&lt;/i&gt;&lt;span&gt;, personal digital assistance or combination of both or any other device &lt;/span&gt;&lt;i&gt;used to communicate, send or transmit any text, video, audio or image&lt;/i&gt;&lt;span&gt;”.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;So a cell phone is a communication device. A computer network is an inter-connection of communication devices by wire or wireless connections. A computer network is a computer resource also. Blocking of access under Section 69A, IT Act includes, therefore, gaining entry into or communicating with the resources of a computer network, which is an interconnection of communication devices, including smartphones. Add to this, the fact that &lt;i&gt;any information&lt;/i&gt; (data, message, text, images, sound, voice) can be blocked, and the conclusion seems clear.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The power to block access to Internet services (including data services) can be found within Section 69A, IT Act itself, the special law enacted to cover matters relating to the Internet. Not only this, the IT Act envisages emergency situations when blocking powers may need to be invoked.&lt;/span&gt;&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;III. Section 69A Permits Blocking in Emergency Situations&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Section 69A, IT Act doesn’t act in isolation. The Information Technology (Procedure and Safeguards for Blocking for Access of Information by Public) Rules, 2009 (“&lt;strong&gt;Blocking Rules&lt;/strong&gt;”) operate together with Section 69A(1).&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Rule 9 of the Blocking Rules deals with blocking of information in cases of emergency. It says that in cases of emergency, when “&lt;i&gt;no delay is acceptable&lt;/i&gt;”, the Designated Officer (DO) shall examine the request for blocking. If it is within the scope of Section 69A(1) (i.e., within the grounds of public order, etc.), then the DO can submit the request to the Secretary, Department of Electronics and Information Technology (DeitY). If the Secretary is satisfied of the need to block during the emergency, then he may issue a reasoned order for blocking, in writing as an interim measure. The intermediaries do not need to be heard in such a situation.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;After a blocking order is issued during an urgent situation, the DO must bring the blocking request to the Committee for Examination of Request constituted under Rule 7, Blocking Rules. There is also a review process, by a Review Committee that meets every two months to evaluate whether blocking directions are in compliance with Section 69A(1) [Rule 14].&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;We submit, therefore, that the Gujarat High Court erred in holding that Section 144, CrPC is the correct legal provision to enable Internet bans. Not only does Section 69A, IT Act cover blocking of access to Internet services, but it also envisages blocking in emergency situations. As a special law for matters surrounding the Internet, Section 69A should prevail over the general law provision of Section 144, CrPC.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt; &lt;/p&gt;

    <title>Digital India: Did Modi get it wrong in Silicon Valley?</title>

&lt;p style="text-align: justify; "&gt;It was supposed to be a moment that rocked the virtual world. Mr  Modi, widely acknowledged as one of the world's most influential  politicians on social media, enveloped a slightly stunned Mark  Zuckerberg in a bear hug.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But what was it that really happened in  Menlo Park? Why did some people think Mr Modi wasn't acting in India's  best digital interests when he hugged Mr Zuckerberg?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India with an internet population of 354 million - which has already &lt;a class="story-body__link-external" href="ttp://articles.economictimes.indiatimes.com/2015-09-03/news/66178659_1_user-base-iamai-internet-and-mobile-association"&gt;grown by 17%&lt;/a&gt; in the first six months of 2015 - is an obvious target for not only  Facebook, but other Silicon Valley giants. And they have all been more  than happy to pledge their support for &lt;a class="story-body__link-external" href="http://www.digitalindia.gov.in/"&gt;digital India&lt;/a&gt; -  a recently launched government initiative  aimed at reinvigorating  an $18bn (£11.6bn) campaign to strengthen India's digital  infrastructure.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;a class="story-body__link-external" href="http://timesofindia.indiatimes.com/tech/tech-news/Free-Wi-Fi-at-500-railway-stations-with-Googles-help-PM-says/articleshow/49123998.cms"&gt;Google offered&lt;/a&gt; to provide 500 railway stations with free WiFi and Microsoft &lt;a class="story-body__link-external" href="http://thenextweb.com/microsoft/2015/09/28/microsoft-wants-to-bring-cheap-broadband-to-500000-indian-villages/"&gt;pledged to connect&lt;/a&gt; 500,000 Indian villages with cheap broadband access.&lt;/p&gt;
&lt;h2 class="story-body__crosshead" style="text-align: justify; "&gt;Digitally colonised?&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;But this huge show of support and the increased interest in India has caused some concern within the country.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"Is Digital India going to only make India a consumer of services  offered by global tech companies in lieu of data? Personal data is the  currency of the digital world. Are we going to give that away simply to  become a giant market for a Facebook or a Google? Look at the way the  tech world is skewed. Only China has been able to come up with companies  that can take on these MNCs" Prabir Purkayasta, chairman of the Society  for Knowledge Commons in India, told the BBC.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"The British ruled  the world because they controlled the seas," he said. "Is India going  to be content to just be a digital consumer? To being colonised once  again?"&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;img src="https://cis-india.org/home-images/Modi.jpg" alt="Narendra Modi" class="image-inline" title="Narendra Modi" /&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;And in the aftermath of the Facebook townhall in particular, some  talk has begun to surface about what Mr Zuckerberg's real India  ambitions are.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Soon after the townhall ended, both Mr Modi and Mr  Zuckerberg declared their support for digital India by using a special  Facebook filter to tint their profile pictures in the tri-colour of the  Indian flag.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Multitudes of Indians followed suit and timelines  were awash with snazzy tinted profile pictures, all in support of  "Digital India".&lt;/p&gt;
&lt;h2 class="story-body__crosshead" style="text-align: justify; "&gt;'Innocent mistake'&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;But then &lt;a class="story-body__link-external" href="http://www.nextbigwhat.com/facebook-tricolor-profile-297"&gt;a tech website&lt;/a&gt; released what it claimed to be a portion of Facebook's source code,  which allegedly "proved" that the "Support Digital India" filter was  actually a "Support Internet.Org" filter.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Facebook &lt;a class="story-body__link-external" href="http://indianexpress.com/article/technology/tech-news-technology/digital-india-profile-pic-tool-not-linked-to-support-for-internet-org-says-facebook/"&gt;quickly issued a denial&lt;/a&gt;, blaming the text in the code on an "engineer mistake" in choosing a shorthand name he used for part of the code.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But the "mistake" which has been coupled with a huge advertising blitz for Internet.Org &lt;a class="story-body__link-external" href="https://www.youtube.com/watch?t=1&amp;amp;v=JdUovve48No"&gt;across television channels&lt;/a&gt; and newspapers has raised suspicion about Facebook's motives. A  Facebook poll on Internet.Org that frequently appears on Indian user  timelines has also been ridiculed for not giving users an option to say  no.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Instead the answer options to the poll question  "Do you want India to have free basic services?" are "Yes" and "Not now".&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;img src="https://cis-india.org/home-images/Internet.png" alt="Internet" class="image-inline" title="Internet" /&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Internet.org (now called free basics), aims to extend internet  services to the developing world by offering a selection of apps and  websites free to consumers.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Facebook's vice-president of  infrastructure engineering, Jay Parikh has described the initiative as  an "attempt to connect the two-thirds of the world who do not have  access to the Internet" by trying to solve issues pertaining to  affordability, infrastructure and access.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;When Facebook launched  the initiative in India in February, it was criticised by Indian  activists who expressed concerns that the project threatened freedom of  expression, privacy and the principle of &lt;a class="story-body__link" href="http://www.bbc.co.uk/news/business-32592204"&gt;net neutrality&lt;/a&gt;.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;On the other end of the debate, Indian columnist Manu Joseph &lt;a class="story-body__link-external" href="http://www.hindustantimes.com/columns/net-neutrality-war-is-not-just-facebook-versus-internet-mullahs/story-s9eZpZnomaaiz4De8fYfaK.html"&gt;wrote in the Hindustan Times newspaper&lt;/a&gt;,  hitting out at the "selfish" stand on net neutrality. He said concerns  over the issue should be "subordinate to the fact that the poor have a  right to some Internet".&lt;/p&gt;
&lt;h2 class="story-body__crosshead" style="text-align: justify; "&gt;Wrong signal&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;A  massive campaign by India's Save the Internet Coalition exhorting  Indians to speak out against initiatives threatening net neutrality  caught public imagination and saw &lt;a class="story-body__link-external" href="http://tech.firstpost.com/news-analysis/net-neutrality-deadline-trai-receives-over-million-emails-from-netizens-asking-to-save-the-internet-264548.html"&gt;more than a million emails&lt;/a&gt; to India's regulator, the Telecom Regulatory Authority of India (TRAI),  demanding a free and fair internet in the country. Internet.Org was one  of the initiatives immediately affected.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;TRAI since released a draft policy &lt;a class="story-body__link" href="http://www.bbc.com/news/world-asia-india-33605253"&gt;on net neutrality&lt;/a&gt;,  but a question that has been asked is whether it was appropriate for Mr  Modi to visit Facebook given that the policy was still under  consideration.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;img src="https://cis-india.org/home-images/Modi1.png" alt="Narendra" class="image-inline" title="Narendra" /&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mr  Purkayasta is of the opinion that it could have been avoided. "It was  not the time or the place to go. Even if it was simply a publicity  gimmick, it still sends a signal to officials involved in drafting the  policy," he said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;However, Sunil Abraham from the Centre for  Internet and Society told the BBC he believed that while Facebook's  intentions were suspect, Mr Modi's visit had the potential to safeguard  net neutrality in India.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"India is a hugely important market for  Facebook, and the prime minister has the power to force positive changes  to its policies," he said. "We gain nothing by shutting them out."&lt;/p&gt;

    <title>How To Win Friends, FB Style </title>

        &lt;b&gt;True to form—and Facebook—there was a warm, friendly and familial feel to Prime Minister Narendra Modi’s townhall meeting at Melon, California, with Mark Zuckerberg on September 27. Modi got emotional (yet again) while talking about his mother. Zuckerberg, the youngish founder of the world’s largest social networking site, got his parents to meet and pose with Modi. &lt;/b&gt;

&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;“The most amazing moment was when I talked about our families,” Zuckerberg wrote in a post, “and he (Modi) shared stories of his childhood....” That’s just the kind of stuff we would see and post on Facebook—the benign visage of a profitable, all-pervasive US-based corporation. (Needless to say, everyone who has worked on this story is a registered user).&lt;br /&gt;&lt;br /&gt;Of course, we know Modi too is on Facebook. No other Indian politician has so effectively utilised the power of ‘likes’: and he has got 30 million. The problem with this chummy approach is that one could almost forget that the PM is also the supreme leader of a country that is Facebook’s second-largest market in the world with 125 million users. A few days earlier, Zuc­kerberg flew to Seattle to meet Chinese President Xi Jinping. Facebook is not present in China. “On a personal note, this was the first time I’ve ever spoken with a world leader entirely in a foreign language,” wrote Zuckerberg in another post.&lt;br /&gt;&lt;br /&gt;In contrast, Modi and Zuckerberg were speaking the same language. In fact, they even jointly updated their profile picture on Facebook—wrapped in the shades of the Indian tricolour—to support the Modi government’s Digital India initiative. Millions of Indians followed suit. And that’s when the shit hit the internet—it was discovered that people supporting the Digital India campaign were also putting in a ‘yes’ vote for Facebook’s contentious initiative internet.org (free but restricted net access; see accompanying faqs for all the details). Immediately, Modi became a party to the raging debate in India over net neutrality. This is unfortunate as the Modi government is yet to put on paper its stand on net neutrality. The nervous reaction to this engagement is also a function of the new truism of our times—“with this government, you never know”.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;img src="https://cis-india.org/home-images/Modi2.png" alt="Modi" class="image-inline" title="Modi" /&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;What we do know is that the internet.org class name was built into the code for support for Digital India. Many experts feel this is not a coincidence; rather a clever ploy by Facebook to get the support of Indians and promote its internet.org initiative. This upset a vocal community of activists who see internet.org on the opposite camp. This led to the charge that Facebook was trying to influence the debate. Says Sunil Abraham, executive director with the Bangalore-based Centre for Internet and Society (CIS), “The moves by Facebook are quite juvenile as it is trying to use the Modi visit to further muddy the net neutrality debate. We should be concerned about Facebook trying to damage the debate in India to spin the PM’s participation in its own favour.” Of course, there are two sides to this debate. There are many people within the government who feel net neutrality is an elitist concern—increasing internet penetration, which Facebook and other such initiatives promise, is the way forward in a poor, unconnected country like India. “Today to talk about net neutrality is to talk about the 20 per cent who have access to the internet,” says telecom expert Mahesh Uppal. “It is unreasonable to dismiss out of hand anybody who offers free service to a subset of websites or services. Eventually, access to internet must come first before we talk about net neutrality.”&lt;br /&gt;&lt;br /&gt;Facebook promoted internet.org along with Samsung, Nokia, Qualcomm, Ericsson, MediaTek and Opera Software, the aim being to provide free internet service to developing nations. India, obviously, is a hot target for Facebook. Facebook has a partnership with Reliance in the country; the free internet service will be available only to Reliance users and the free access will be limited to Facebook’s partner sites. The debate over internet.org too has picked up steam in India—big media companies like NDTV and Times of India have pulled out of it on these issues. While Facebook has stressed that internet.org will ensure that the internet reaches people who do not have access to it, there have been concerns that it will restrict internet access only to sites that are internet.org’s partners.&lt;br /&gt;&lt;br /&gt;On its part, Facebook has been quick to refute the charge. A spokesperson in the US said, “There is absolutely no connection between updating your profile picture for Digital India and internet.org. An engineer mistakenly used the words ‘internet.org profile picture’ as a shorthand name he chose for part of the code.” The code was changed soon after. Despite repeated requests, representatives from Facebook India were unavailable for comment.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;img src="https://cis-india.org/home-images/Zuckerberg.png" alt="Zuckerberg" class="image-inline" title="Zuckerberg" /&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But the damage has been done. Many now openly question Facebook’s motives in India and whether they have been truthful or not. Given all this brouhaha, questions will naturally be raised about Modi’s alignment with Facebook. Digital India is many things—but obviously increasing net penetration is one its goals. “Now whatever he does on net neutrality, it will be seen in terms of whether it will benefit Google or Facebook. That is the risk he took. I would like to know why the diplomatic advisors took the risk of putting the PM in a bargaining position instead of a bonus at the end of a deal,” says Prof Narendar Pani, who teaches at the National Institute of Advanced Studies, Bangalore.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;All this matters because the Modi government positions itself as digital-friendly, even though its moves on this front have been invasive (the push for Aadhar despite a legal sanction and increasing reports of monitoring digital conversations), and contradictory (the abortive porn and WhatsApp bans, among others). “The PM is going way beyond the e-governance plan to a stage where the government will just sit and watch people speaking. It is scary,” says internet activist Usha Ramanathan. She feels it doesn’t make sense to have companies like Google sharing ideas with the government while Indian people are being kept out of the loop. “And now Facebook will be joining that gang, it doesn’t make sense. What has Facebook done to get that privilege?” she asks.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Here again there is a carefully worded counter-argument. Former telecom entrepreneur and Rajya Sabha MP Rajeev Chandrashekhar says, “Net neutrality is a definition that would be made in the public domain. It will not be influenced by the PM’s engagement with Facebook and Mark Zuckerberg. Anyone who tries to mess with the definition of net neutrality will be met with a public outcry and judicial intervention.” The substance of this view is that Modi was within his rights to speak to corporations to further Digital India, or Make in India for that matter, and that there should be an open debate on the future direction of net neutrality.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;img src="https://cis-india.org/home-images/copy5_of_Sunil.png" alt="Sunil" class="image-inline" title="Sunil" /&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Clearly, the political knives are out. “Either the prime minister is not being briefed properly or he does not read his brief properly,” says former UPA minister Manish Tewari. Arguing that governments should be discussing rules of engagement in cyberspace, and not stakeholders, he asks, “Is India comfortable with that construct especially when the bulk of the technology companies, the root servers which form the underlying hardware of the internet, are all based in the US, and one being in Europe?”&lt;br /&gt;&lt;br /&gt;Although the government is yet to firm up its decision on net neutrality and a policy on it is yet to be announced, the debate has already acquired political colour in India, with the Congress and Aam Aadmi Party putting their weight behind the people’s voice. This is the first time that there has been a nation-wide upsurge of such an unprecedented size and magnitude on an internet policy. Says AAP’s Adarsh Shastri, “Facebook, Google etc are just tools. People can use them at will. To make them the mainstay of your programme for digital empowerment is to step on the civil rights and liberties of citizens. Doing this is a complete no-no. Let people access internet as they want is the way to go.”&lt;br /&gt;&lt;br /&gt;A consultation paper floated by telecom regulator Telecom Regulatory Authority of India (TRAI) got almost 15 lakh responses from the Indian public in support of net neutrality. There was also strong opposition to zero rating platforms announced by telecom companies like Airtel which sought to provide free access to some websites on their platform in much the same way that internet.org proposes. And the reactions to the Facebook coding error are a pointer to what people in India think. Says Nikhil Pahwa, editor of Medianama and a leading net neutrality activist, “The reactions of the people to the Facebook event were heartening and showed that people are emotive and there is still mass support for net neutrality. The reaction to the TRAI paper was not a flash in the pan.”&lt;br /&gt;&lt;br /&gt;Interestingly, a couple of months ago, a department of telecommunications committee had said that internet.org was a violation of net neutrality and should not be allowed. It will be difficult for Modi and the government to overrule that and give it full and free access in India. Internet experts feel that the engagement with India and Modi was a desperate move by Facebook to get numbers from India. Says internet expert Mahesh Murthy, “Facebook is pulling out all stops to get favour for internet.org and is desperate about it. If India says yes, many others will say yes, but if India says no, other countries will follow.”&lt;br /&gt;&lt;br /&gt;Murthy says Facebook’s real problem is that it is finding it difficult to justify its price to earnings ratio as against its user numbers vis-a-vis Google which is much better in this respect. For this, it is desperately trying to get numbers, and with China banning Facebook, the only country left to get numbers is India. The massive electronic and print campaign at the cost of Rs 40-50 crore is a pointer towards this. He says everything about internet.org is about hooking Indians to it.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;No wonder, Facebook has been cultivating Indian media. The Modi visit has also been tarnished by the news that Facebook paid for the travel and accommodation of journalists from three Indian newspapers and one magazine to go and cover the Facebook-Modi meeting and get favourable coverage. Says writer-activist Arundhati Roy, “Many journalists covering the event for the Indian media were flown in from India by Facebook. So were some who asked pre-assigned questions at the event. I don’t know who sponsored the crocodile tears and the clothes.” It is also quite strange that the entire display picture and source code controversy got almost no play in the national media which chose instead to talk about Modi’s speech and his tears.&lt;br /&gt;&lt;br /&gt;All said and done, it is obvious that Facebook may be seeing India as an easy and vulnerable target which can be manipulated for its own advantage. Says Parminder Jeet Singh, executive director with IT for Change, an NGO working on information society, “India has low internet penetration and lots of people want to get on to the internet. But given the massive people’s response net neutrality has got vis-a-vis TRAI’s paper and also during the present Facebook issue, the outcome is predictable. Or so it seems. There’s a lot of money power at stake. For now, millions of internet Indians have already voted with that dislike button. And then, governments move in mysterious ways.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Companies here are still assessing how they will be impacted by the big  connectivity projects that Google, Microsoft and others announced when  Prime Minister Narendra Modi dropped in at Silicon Valley, the global  hub for innovation and technology, over the weekend.&lt;br /&gt;&lt;br /&gt; CEO Sunder Pichai said Google would tie up with the government to  provide free Wi-Fi at 500 railway stations across the country.  Microsoft's Satya Nadela said his company would take broadband  connectivity to five lakh villages across the country.&lt;br /&gt;&lt;br /&gt;And that its cloud services would operate out of India's data centres.&lt;br /&gt;&lt;br /&gt; Some smaller companies in Bengaluru hope they will get some business  when these giant projects are implemented. "Smaller companies like ours  would be hoping we get a share of the pie when it comes to  implementation. The government should ensure that," said Soujanya  Prakash, a General Manager at Vee Technologies, to NDTV. Vee one of the  companies assigned to implement part of the massive Aadhar identity card  project.&lt;br /&gt;&lt;br /&gt; Ms Prakash said companies like Microsoft and Google bring great technological expertise with them.&lt;br /&gt;&lt;br /&gt; Pranesh Prakash, Policy Director for the Centre for Internet and  Technology, had a word of caution as he voiced concern about the privacy  policies of some big global companies. "The government should push for a  strong data protection regime in India and force these companies to  abide by that," he said.&lt;br /&gt;&lt;br /&gt; Mr Prakash also said, "These companies need India more than we need them  since there are more than one billion customers here. The Indian  government must be wise in using this bargaining power."&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;The Internet has changed the way we communicate in more ways than we can  imagine. Apart from being a medium to share pictures and updates with  family and friends, social media has also become an arena where  political debates are a commonplace and people are quick to make  judgements. The social media space has become one where superlatives are  commonly used and videos or conversations about inappropriate behaviour  or even a tweet or Facebook post has a tendency to go viral and  snowball into a shaming of the individual or organisation in question,  without bothering to hear out the other side of the story. Outraging can  be over anything, from the faults of the Government, to lay people who  sometimes find themselves the subject of an online shaming campaign.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Recently, an FB user put up pictures of a person, who she claimed  misbehaved with her on a street in Delhi. Within a few hours, the man’s  picture went viral and he was arrested by the police, even as he was  called names and abused on social media networks. A few days later,  eyewitness accounts corroborated the man’s account of the incident. The  response online now put the girl at fault and blamed her for  politicising the issue. The initial response to the video of the Rohtak  sisters bashing up alleged molesters also saw the outrage shifting  sides.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;How does one deal with people making judgements with a click of a  button? Does online shaming dent the chances of people getting justice  in genuine cases of assault?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Rohini Lakshané, a researcher at the Centre for Internet and Society  says, “Online, public shaming is a useful and often effective strategy  for calling out unacceptable behaviour when recourse to other remedies  is tedious, time-consuming, or non-existent. Its flipside is that  shaming online could lead to mob justice or a witch-hunt. The onus  should be on the viewers or readers of such an act of shaming to not  take the law into their own hands and on the news media to do their  basic duty of checking facts before publishing or broadcasting  anything.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;She adds, “People use social networking sites, among other things, as  verandas where they can gather gossip, and talk about their interests.  If people jumping the gun and being judgemental offline isn’t a cause  for concern, I don’t see why it should be when it happens online.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;On checks, Rohini contends, “They would not be in the interest of free  speech. It would, of course, make a difference if social media users  paused to think.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;V. Shakti, Social Media and Branding Professional, points out that the  mass adoption of social media platforms has had positive and negative  effects. “It has ensured that anyone can reach out and get any  information. The flip side is that this power to reach millions needs to  be handled with care and responsibility. The Jasleen Kaur incident is a  glaring reflection. Such is the mindset of people online that anyone  who is shamed is assumed guilty and derided. Sometimes the shaming does  permanent damage to the target and the effects are life-long. The minute  Jasleen posted a picture online, even the media jumped in calling the  guy a ‘pervert’, if this were some other country, they would be sued. We  need to understand that un-shaming is not an option and hence be  careful when throwing mud at someone online. Remember, it could be you  tomorrow. Think, verify and then act. Like I always say, there are three  sides to every story - yours, mine and the truth.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;For psychiatrist and Integrative medicine specialist Shyam Bhatt, online  shaming is a combination of a sense of mob justice and the feeling of  participating in a cause. “It is easy to sign up for a cause online, you  can click share and feel good about yourself. People also tend to get  swayed by what their friend circles are talking about.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Social media user Praveen Rao feels an attempt to feel involved with causes is responsible for this phenomenon.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“It is important for people to check the authenticity and wait for a  clear picture to emerge before talking about something. However, in the  rush to appear clued in, people tend to share anything that goes viral,  without pausing to think if someone’s life could be ruined. It is a good  tool to call out genuine cases of misbehaviour and assault, but mob  justice should be avoided.”&lt;/p&gt;

    <title>Rise of the bot: all you need to know about the latest threat online</title>

The former minister told the police that his Facebook page had received more than 10,000 likes, within a span of 24 hours. While his allegation that the ‘likes’ were “fabricated” may be true, information technology experts believe a bot was at work.&lt;/b&gt;

&lt;p style="text-align: justify; "&gt;A bot is a software that mimics human behaviour on the Internet. Bots can be used to create artificial accounts on social media, provide numerous likes on a particular page, send tweets or visit various websites. All this is done without any human involvement.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Bots already constitute a significant percentage of Non Human Traffic (NHT) online, which has, according to some estimates, eclipsed human traffic. Comscore, a US-based Internet technology company noted on its blog that NHT, also known as Artificial Traffic, increased from approximately 6% of the total web traffic in 2011, to 36% in 2012. Last month, a report from Incapsula, a cloud-based security service, which aids the security and performance of websites, stated that more than 60% of web traffic was non-human in 2013. The figure was based on data collected from the 20,000 sites on Incapsula’s network .&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Other than bots, NHT on the web includes traffic generated by Internet routers and back end services used by websites to communicate with third parties.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India is not immune to the problem. According to the Symantec Internet Security Threat Report for 2012, there was a 280% increase in bot infections in India between 2011 and 2012. 17% of bot-infected computers, the highest in the world, are in India and 15% of global bot-net spam is generated here. The report also states that 69 Indian cities are prone to bot infections which includes Bhubaneswar, Surat, Cochin, Jaipur, Visakhapatnam, Indore, Kota, Ghaziabad and Mysore.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Bot spotting&lt;/b&gt;&lt;br /&gt;How do you spot a bot? When a bot or its friend is at work, the browser directs you to sites other than the ones you intend to visit, you get full-page pop ups and pop unders, and when you quit the browser, it gets relaunched after a few minutes. Chances are your computer is part of a chain of online events which create NHT on the web, the purpose of which may be to attack a site or a server.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Why you should be wary&lt;/b&gt;&lt;br /&gt;Malicious traffic, malware, hacking attempts, viruses slow down the Internet and delay legitimate traffic and services. Used to target systems or take down websites, NHT generates fake clicks on advertisements to increase website statistics.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;One of the perils of ignoring artificial web traffic is that it gets counted for real impressions for which clients end up paying. For example, a website owner may hire the services of a digital marketing firm to publicise the site. In the guise of increasing page views, the marketing firm can produce a bill for fake impressions, supplementing actual human traffic to the page with bot usage.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“Unless there is a curb on this practice of malicious NHT, one stands at risk of being duped by marketers, agencies and even clients,” said Chiragh Cherian, director, online PR at Perfect Relations, a brand management firm. Recent studies have estimated bot traffic to be between 4 - 31% of total web traffic in the US, which translates to between $650 million and $4.7 billion in wasted marketing spend. According to Miaozhen Systems, a leading Chinese advertising technology company, NHT caused advertisers in China to lose approximately US$ 1.6 billion between July 2012 and June 2013.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;How to combat Non-Human Traffic&lt;/b&gt;&lt;br /&gt;Most servers have defence mechanisms to tackle spam and cyber attacks. Websites are also now developing mechanisms such as asking for human authentication which is difficult for a bot to execute. “But even personal computers should be equipped with strong Internet security applications such as anti-virus and anti-spyware to prevent hacking and phishing attempts and to prevent being used as slave machines for distributed cyber attacks,” said Chintu Cherian Abraham, a digital media professional. Figures show that we need to watch out where and how we go online. According to Norton Report, 2013, 61% Indians access their social network accounts from unsecured wi-fi connections, while 42% access bank accounts and 44% shop online using unsecured wi-fi connections.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Social media companies are gradually devising mechanisms to filter bots. “When a page and a fan connect on Facebook, we want to ensure that connection involves a real person interested in hearing from a specific page and engaging with that brand’s content. As such, we have recently increased our automated efforts to remove Likes on Pages that may have been gained by means that violate our terms,” mentions Facebook’s site integrity policy.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Agency-client intervention is necessary to ensure that artificial traffic is not presented as real. “It’s also important to make all agencies, advertisers and clients aware of their responsibility to keep the Internet free from malicious NHT,” said Chiragh Cherian.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Government involvement is also needed to control the problem of malicious bots. “A lot needs to be done from the government’s side to tackle bots which can be used to target the country’s critical infrastructure such as banking websites,” said Jiten Jain, a cyber security analyst, adding, “Last year, I highlighted the flaws in HDFC’s net banking website which have been rectified now. They could have been exploited to block the net-banking service.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Until we have a robust mechanism to filter out bogus traffic from real, it will be difficult to say whether the social media followers of Bansal and other public figures are human or not.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;&lt;b&gt;Know your Bots&lt;/b&gt;&lt;br /&gt;Not all bots are used with a negative intent. Some help in research and monitoring.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;The Malicious&lt;/b&gt;&lt;br /&gt;Bots can be effectively used to impersonate and to hack accounts leading to financial losses and intellectual property theft. “Theft of personal details, username and password to operate one’s bank account is a classic example of how bots can lead to financial losses. It is an organised cyber crime,” explained Commander (Retd) Mukesh Saini, former national information security coordinator, Government of India. In May 2013, cyber criminals broke into the Mumbai-based account of the RPG group and siphoned off `2.4 crore. Three people were arrested in the case.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“The rate at which NHT is increasing is alarming,” says Tinu 	Cherian Abraham. “Any computer connected to the Internet is 	vulnerable to such attacks. The user will not get to know about it 	unless he or she has installed an Internet security application.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Besides bots, computers also generate other kinds of secondary 	activities, while the user is surfing the Internet. This activity 	remains in the background and is never seen by the user, unlike the 	bot-generated pop ups, observes Comscore. For example, your computer 	might be being used as a channel to reach a server with the 	intention of hacking it. And you will never know.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;The Good&lt;/b&gt;&lt;br /&gt;Not all NHT is bad, though. In fact, 	good bots such as scrapers can be effectively used to conduct 	research. “Wikipedia can be scraped to investigate the frequency 	of edits on a Wikipedia page and track the increase in the number of 	editors,” explained Snehashish Ghosh, policy associate at the 	Bangalore-based Centre for Internet &amp;amp; Society.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Good bots are also used by search engines to track content on 	websites and enhance their search results. Search bots and other 	good bots formed 31% of total bots, the Incapsula report noted.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;The Social&lt;/b&gt;&lt;br /&gt;Apart from malicious and good 	bots, there are social media bots too. “Extensive analysis is done 	on social media traffic for monitoring, business lead generation, as 	well as reputation management. This has amounted to a lot of 	automated or non-human traffic,” said Abraham.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;According to Facebook’s filings published in a Forbes report in 	February 2012, around 83 million of its users are bogus. “It’s a 	violation of our policies to use a fake name or operate under a 	false identity, and we encourage people to report any user they 	suspect of doing this, either through the report links we provide on 	the site or through the contact forms in our help centre,” a 	Facebook spokesperson told HT.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Twitter bots have also made its presence felt on the platform. 	“Twitter has witnessed very interesting bots which have found 	appreciation from the community for being funny and creative. The 	microblogging site cracked down on some harmful bots, but still some 	of the advanced level bots slip through the net,” said Ghosh.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In August 2012, London-based firm Digital Evaluators, which 	evaluates social media presence of worldwide companies, released an 	analysis of Twitter followers of the US Presidential Election 	candidates Barack Obama and Mitt Romney. 21.9% of Barack Obama’s 	17.82 million Twitter followers were found to be bogus.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;The Big Brother&lt;/b&gt;&lt;br /&gt;Ghosh said that the increase 	in NHT related to the Internet of things, the concept which enables 	communication between two or more devices, results in privacy 	issues. “Take a situation where your mobile device is constantly 	tracking your location for the purpose of switching on the air 	conditioner at your home before you reach. Such applications produce 	huge amounts of personal data and there is no clarity whether this 	data is being stored,” he said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“As the new networks link data from products, company assets, 	or the operating environment, they will generate better information 	and analysis, which can enhance decision making significantly. Some 	organisations are starting to deploy these applications in targeted 	areas, while more radical and demanding uses are still in the 	conceptual or experimental stages,” noted a McKinsey &amp;amp; Company 	report on Internet of things.&lt;/p&gt;

&lt;p&gt;That the twitterati can be brutal has been shown 	often enough this last year. When Tehelka editor Tarun Tejpal was 	mired in allegations of sexual harassment, his daughter was hounded 	on social media. Recently when novelist Lavanya Sankaran wrote an 	op-ed for New York Times defending the decent Indian man, she was 	royally derided, so much so that another journalist Rahul Bhatia 	tweeted in her defence, asking people to lay off.&lt;/p&gt;
&lt;p&gt;Sunanda's 	story hurtled towards a tragedy in a space of 48 hours after she 	went public. As Shah points out it wasn't as though there were no 	affairs and scandals before the dawn of social media but the tangle 	would have spun out differently and less brutally in another time 	and age. It all began, as Pushkar admitted to some papers and later 	denied, with the spilling of alleged BBMs sent by Pakistani 	journalist Mehr Tarar to Tharoor on his twitter account.&lt;/p&gt;
&lt;p&gt;Predictably, the effect of the first round of revelations was 	explosive. In fact, Pushkar herself appeared taken aback by the fact 	that a twitter spat ended up making front page headlines.&lt;/p&gt;
&lt;p&gt;The 	entire drama which, in another age, would have played out at home or 	a circle of family, friends and acquaintances — and at the most in 	far less dramatic gossip columns and on TV— was up on social 	media, provide enormous vicarious pleasure to thousands of social 	media bystanders. That Pushkar herself set the virtual assault in 	motion only adds to the bleak irony of it all. This was also not the 	first time Pushkar took a spat to twitter. @SPTVrocks tweeted about 	her fight with a journalist in Dubai earlier this month.&lt;/p&gt;
&lt;p&gt;Clinical 	psychologist Varkha Chulani says it is the personality behind the 	media usage not the form itself that is to be blamed. "People 	choose to talk about their private lives to impress others, to get 	attention. We forget what is real and what is virtual." Shah, 	however, believes that we live in a world of digital striptease and 	that the ubiquitous and pervasive technologies that surround us have 	forever blurred the lines between real and virtual.&lt;/p&gt;
&lt;p&gt;Activists 	have often pointed out that the social media has everything going 	for it — quick and vast connect and instant response — but what 	it lacks is empathy. It is easy enough to send out an RIP message, 	for instance, for someone you don't know or even care for, 	positioning yourself as a caring, empathetic soul in 140 characters.&lt;/p&gt;
&lt;p&gt;Post Pushkar's death, news anchor Barkha Dutt tweeted that we 	need to limit viciousness , stop judging and use greater compassion 	on twitter.&lt;/p&gt;
&lt;p&gt;Shah makes a similar plea for the human touch.&lt;/p&gt;
&lt;p&gt;"We 	are all so self-involved , creating narratives of our selves, 	bit-stripping every moment , instagramming every event, tweeting 	every encounter, and liking all the various things that happen 	around us, that we don't always have enough time to stop, to 	respond, to think and reflect upon other people's conditions . We 	have become jaded, to the various 'great' moments in people's time 	lines, but we are also becoming jaded to the pain that our 	involvement in these social networks can bring to those who are the 	subject of our attention," he says.&lt;/p&gt;

It also ordered&lt;/span&gt;&lt;a class="storyTags" href="http://www.business-standard.com/search?type=news&amp;amp;q=Whatsapp" target="_blank"&gt;WhatsApp&lt;span class="Apple-converted-space"&gt; &lt;/span&gt;&lt;/a&gt;&lt;span&gt;not           to share data collected before September 25 with Facebook for           users who had not opted out.&lt;/span&gt;&lt;br /&gt; &lt;br /&gt; &lt;span&gt;"The           decision makes a strong statement on privacy," said Sunil           Abraham, executive director of the Centre for Internet           Society. According to him, a user trusts a platform and           provides access to his data. As another firm acquires the           platform, it gains access to the data.&lt;/span&gt;&lt;br /&gt; &lt;br /&gt; &lt;span&gt;"Facebook           owns Whatsapp. It has to look at ways of monetising it," said           Nikhil Pahwa, co-founder of SavetheInternet.in.&lt;/span&gt;&lt;br /&gt; &lt;br /&gt; &lt;span&gt;"With           so much digital data being generated, there is a need for a           privacy law in the country," said Pahwa.&lt;/span&gt;&lt;br /&gt; &lt;br /&gt; &lt;span&gt;"Facebook's           consent interface is confusing. It can make a person who wants           to opt out let the company access his data," said Abraham,           adding a law would take care of such intricacies. The           government is working on a privacy bill.&lt;/span&gt;&lt;br /&gt; &lt;br /&gt; &lt;span&gt;Saroj           Kumar Jha, partner, SRGR Law Offices, said there were few           judgments on privacy in India based on constitutional rights.&lt;/span&gt;&lt;br /&gt; &lt;br /&gt; &lt;span&gt;"While           the Information Technology Act enables courts to pass           judgments on global companies on privacy, enforcing the orders           is difficult," he said.&lt;/span&gt;&lt;br /&gt; &lt;br /&gt; &lt;span&gt;"What           is required is a privacy law that can protect user data and           uphold the individual's right to privacy," he added.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;What the government is looking to do now is draft rules for Section 67C of the Information Technology Act, and this will be done by a committee that has been set up for the purpose. The rules — whose drafting has been waiting since 2008 — will spell out what type of data has to be stored, in which format, and for how long, according to three members of the newly-formed committee. All this so that law-enforcement agencies can access the information if they need it.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Sharing of information between foreign firms and the Indian government has been a contentious issue, and experts said the mandate may be impossible to implement for firms such as WhatsApp that promise end-to-end encryption. Or for Snapchat – a chat app where messages disappear within seconds and are not even stored on the company’s servers.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Firms may also oppose the diktat, especially since most of them are not governed by Indian laws and also due to the high cost of data retention.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;img class="gwt-Image" src="http://img.etimg.com/photo/54839953/.jpg" /&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The committee is headed by additional secretary in the ministry of electronics and IT (MEITY), Ajay Kumar, and has one representative each from the ministry of home affairs, department of telecom, department of personnel and training, Nasscom, Internet Service Provider Association of India (ISPAI), along with an advocate specialising in cyber law and a few officers from MEITY. The first meeting of the committee took place in the last week of September.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“This is a fairly complex issue, compounded by the general lack of understanding of mobile apps and over the top service providers,” said a person on the committee who did not wish to be identified. This person said that most technology players are based in the United States and they have always been at loggerheads about sharing of information with the government. “Even if it is for national security reasons, how much are these companies answerable to the Indian security establishment? And we do know how Apple refused to unlock the phone even for FBI."&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Supreme Court lawyer and cyber law expert Pavan Duggal said the section has been drafted in very “broad” terms and the move may be driven by the realisation that these companies are huge data repositories – some of which might be relevant to law enforcement investigations. “It will have to be a huge balancing act and will be interesting to see what this committee decides,” added Duggal.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While Section 67C refers to the obligation of the service providers to retain information, the nature of the data to be retained and the time period is not specified. Companies which do not comply with the law can be levied fine and its officers sent to jail.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Another member on the committee said the ambit of this task is huge. “In the last meeting we argued that the rules should be the same for everybody and there should be no differential treatment for foreign companies such as Google or Microsoft,” he said. This person said that ambiguity is rampant as various government arms have different sets of rules for data retention.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;For instance, the Department of Telecommunications (DoT) asks for data to be stored for six months, while the Registrar of Companies mandates some information to be retained for one year while the income-tax rules mandate data storage for six-seven years. “There has only been one meeting so far. It is a long procedure and will require several rounds of consultation,” said a third person on the committee.&lt;/p&gt;
&lt;p&gt;Privacy  activists like Pranesh Prakash of the Centre for Internet and Society  said that one of the principles that’s frequently cited while discussing  international practices on surveillance is that data retention should  not be required of service providers.&lt;/p&gt;
&lt;p&gt;And internationally too, there is no standard on this issue. “There were norms at the European Union-level regarding data retention, but they were struck down in 2014 by the European Court of Justice as being violative of human rights,” he said.&lt;/p&gt;

&lt;p&gt;It was a reference to Delhi Chief Minister Arvind Kejriwal urging the  Prime Minister to counter Pakistan’s propaganda over surgical strikes.&lt;/p&gt;
&lt;p&gt;Within hours, India Post tweeted an apology saying that the account was hacked.&lt;/p&gt;
&lt;p&gt;This is the latest in a series of opinions and statements posted from  official twitter handles of government departments and bodies. Of late,  the Twitter handles meant to broadcast information related to  government programmes have appeared like personal accounts tweeting  slander and criticism.&lt;/p&gt;
&lt;p&gt;Last month, the Twitter handle of Digital India tweeted a poem in  Hindi calling on the Indian Army to persistently fire at protesters in  Kashmir.&lt;/p&gt;
&lt;p&gt;In August, the Twitter handle of Startup India retweeted a post  suggesting that the Indian Army should ‘take care’ of #Presstitutes, a  reference to sections of Indian media critical of the government.&lt;/p&gt;
&lt;p&gt;The tweets expose loopholes in the government’s social media policy  and raise questions about the norms followed in the recruitment of  social media professionals for ministries and government institutions.&lt;/p&gt;
&lt;p&gt;&lt;b&gt;Work in Progress&lt;/b&gt;&lt;/p&gt;
&lt;p&gt;The process of adopting new tools is work in progress. While the  government agencies are trying to leverage social media to enhance  citizen engagement, for the vast majority of government bodies, it is  unexplored territory. Babus who have traditionally been dealing in  paperwork and file notings are overwhelmed to see hash tags and trends.  With a tech- savvy Prime Minister at the helm, every government  department is trying to increase its digital footprint. At the same  time, they face the challenge of reinterpreting existing work ethics and  codes of conduct and applying them to the use of social media.  Ministries such as the Ministry of External Affairs, Information &amp;amp;  Broadcasting and the Prime Minister’s Office which have cohesive  programmes and big mandate, have separate social media wings of their  own with well- defined protocols. But these are exceptions.&lt;/p&gt;
&lt;p&gt;Overall, the government bodies lack social media guidelines for their  own efforts or which others can learn from. According to Chinmayi Arun,  executive director, Centre for Communication Governance, National Law  University, Delhi, mistakes are bound to happen given that everyone is  new to social media. But it should be non-negotiable that when anything  is said using an official governmental handle, the government should  take more responsibility than just saying ‘oops’. “One of course is a  clear and unequivocal statement apologising and taking back whatever was  said. However, it should take pro-active measures to train and test  people who handle its public-facing accounts and publish a clear  monitoring and accountability mechanism by which they can be called to  account. It should not be open to anyone to misuse the government’s  official handles in this manner,” said Arun.&lt;/p&gt;
&lt;p&gt;One of the areas where the lack of sensitisation is apparent is the  usage of the same mobile device for multiple twitter handles – the most  common reason for such goof-ups cited by social media consultants  attached to various government departments. “I believe these were  inadvertently posted by people handling these accounts. It may neither  have been their mandate nor their intention. It happens when the person  has configured multiple twitter handles from the same device and ends up  posting from the wrong account,” said Amit Malviya, BJP’s National  Convener, IT.&lt;/p&gt;
&lt;p&gt;The majority of ministries and government departments do not give  phones to members of the social media teams. It is up to the individual  to use his personal device or get an additional one to manage the  professional handle (s). A mistake will happen if a comment which was to  be posted from the personal handle is posted from the official handle.&lt;/p&gt;
&lt;p&gt;&lt;b&gt;Twitter Goof-ups from GoI Accounts&lt;/b&gt;&lt;/p&gt;

&lt;p&gt;“Because of the personalised and individual nature of social media,  it is easy to forget that they are representing an institution and not  themselves when using these handles. This also suggests the lack of  public usage training in these organisations, and the need to educate  our public actors in using social media with more responsibility as  office bearers of an institution rather than a personal expression or an  opinion,” said Nishant Shah, co-founder of the Centre for Internet and  Society, Bangalore.&lt;/p&gt;
&lt;p&gt;Another issue is that access to the account is given to multiple  people. “Each one of them brings their individual personality and  politics to their operation of the handle,” said Shah.&lt;/p&gt;
&lt;p&gt;&lt;b&gt;Hiring Issues&lt;br /&gt; &lt;/b&gt;&lt;/p&gt;
Part of the problem lies in the fact that there is no standard  protocol on who can access the twitter handle of Indian government  bodies and how this person or team is hired.
&lt;p&gt;A few ministries (example: the ministry of railways) have a team  comprising of government employees and staff of private agencies  handling their account. Others have outsourced the job to agencies.&lt;/p&gt;
&lt;p&gt;During the campaigning for the 2009 election, political parties got  outside expertise to mark their presence online. The selection  parameters of social media consultants – established public relations  firms in some cases and individuals in others – was not uniform.&lt;/p&gt;

&lt;p&gt;Unlike the traditional public relations officers who are from the  Indian Information Services cadre, the social media consultants were  selected based on their expertise in the field, political affiliation,  and proximity to a party or leader.&lt;/p&gt;
&lt;p&gt;Those who started handling social media accounts of political parties  and leaders included trolls and social media influencers. “Parties got  youngsters who were politically motivated and willing to work for  political parties. They became cheaper alternatives for social media  experts,” said Ishan Russel, political communication consultant.&lt;/p&gt;
&lt;p&gt;After the NDA came to power, almost every ministry outsourced its  digital expertise to agencies. Many individuals who were earlier  directly working with leaders and parties got back with them via  agencies. “If an agency is looking for people to handle the twitter  account or Facebook page of a certain ministry in the BJP government,  then those who are politically inclined towards the BJP will apply for  the vacancies and their chances of getting hired are also much higher  than someone who is neutral or known to be an AAP sympathiser,” said  Vikas Pandey, 32-year-old software engineer, who headed the “I Support  Namo” campaign on Facebook and Twitter, as a volunteer for the BJP.&lt;/p&gt;
&lt;p&gt;Last year, the Prime Minister felicitated more than a dozen social  media enthusiasts, including Vikas. The move raised eyebrows because  many felt that the government was encouraging trolls. “It illuminates  the fact that trolls have found gainful employment in the Government of  India. Also that the entire edifice of the centre is being taken over by  woefully undereducated bigots,” said Swati Chaturvedi, senior  journalist and author.&lt;/p&gt;

Till the time the government staff is well versed with social media  tools, attributing the mistakes to an ‘outside agency’ appears to be the  norm.
&lt;p&gt;In the case of the twitter goof-up involving Startup India, Commerce  and Industry minister Nirmala Sitharaman blamed a private agency that  was managing the account of Startup India. “The retweets were done by an  employee of the agency hired by the department of industrial policy and  promotion. The person assigned by the agency for this particular job is  not decided by the department and is the sole prerogative of the  agency,” she said.&lt;/p&gt;
&lt;p&gt;S Radha Chauhan, CEO of National e-Governance Division, attributed  the controversial post from Digital India’s twitter handle to an agency  called Trivone. “The person responsible had mistakenly tweeted from the  official handle what he wanted to tweet from his personal account,” said  Chauhan.&lt;/p&gt;
&lt;p&gt;Those familiar with the functioning of the government’s social media  verticals say that agencies are mentioned to cover up for mistakes often  committed by someone from the government staff. “When in crisis, blame  the agency, is the thumbrule the government follows. The fact is that  each twitter post is approved by the client before it is posted,” said a  senior executive with a digital marketing firm attached to a ministry  which has recently earned lot of praise for its social media  initiatives.&lt;/p&gt;
&lt;p&gt;Nishtha Arora, social media and digital consultant in a reputed ad  agency, was handling a political account till very recently. She said  that the client required her to just randomly tweet or RT to be heard by  the followers of a tech-savvy minister and be his digital mouthpiece.  “I often had to draft tweets which looked like press releases,” she  said.&lt;/p&gt;
&lt;p&gt;“Digital faux pas is blamed on to someone who might be an expert in  the field but yet has to bow down to the client pressure so that their  agenda for the day is met and the said government body or ministry  remains in the news,” she added.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;“In accordance with the Audience Network Policy, we do not integrate or display ads in apps or sites containing content that is illegal, misleading or deceptive, which includes fake news,” Facebook said in a statement. The company said its team will continue to closely vet all prospective publishers and monitor existing ones to ensure compliance.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;False news stories have become a sore point after the U.S. presidential elections with critics blaming internet companies like Twitter and Facebook for having had an influence on the outcome of the elections as a result of the fake content.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The controversy also reflects concerns about the growing power of social  networks to influence people and events, as well as help people to  communicate and organize. Facebook &lt;a href="http://computerworld.com/article/3140723/internet/zuckerberg-says-fake-news-on-facebook-didn-t-tilt-the-elections.html"&gt;promotes democracy by letting candidates communicate directly&lt;/a&gt; with people, Facebook CEO Mark Zuckerberg said recently in an interview.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Google had its own embarrassing moments on Sunday with a false story  that claimed that President-elect Donald Trump had won the popular vote  in the U.S. presidential elections &lt;a href="http://www.mediaite.com/uncategorized/now-even-google-search-aiding-in-scourge-of-fake-inaccurate-news-about-election-2016/"&gt;figuring atop some Google search results&lt;/a&gt;. Trump’s Democratic rival Hillary Clinton is leading in the popular vote.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“We've been working on an update to our publisher policies and will  start prohibiting Google ads from being placed on misrepresentative  content, just as we disallow misrepresentation in our ads policies,”  Google said Monday in a statement. “Moving forward, we will restrict ad  serving on pages that misrepresent, misstate, or conceal information  about the publisher, the publisher's content, or the primary purpose of  the web property.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Google evidently expects that the threat of a cut in revenue from ads will dissuade sites from publishing fake content.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Zuckerberg has described as “crazy” the criticism that fake news on  Facebook's news feed had influenced the vote in favor of Trump. “Of all  the content on Facebook, more than 99% of what people see is authentic.  Only a very small amount is fake news and hoaxes,” Zuckerberg &lt;a href="https://www.facebook.com/zuck/posts/10103253901916271"&gt;said in a post over the weekend&lt;/a&gt;. The hoaxes are not limited to one partisan view, or even to politics, he added.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Identifying the "truth" is complicated, as while some hoaxes can be  clearly identified, a greater amount of content, including from  mainstream sources, often gets the basic idea right but some details  wrong or omitted, or expresses a view that some people will disagree  with and flag as incorrect even when it is factual, Zuckerberg wrote.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There are concerns that the monitoring of sites for fake news and the  penalties could give internet companies more power. &lt;p&gt;Last week, Facebook agreed to address the concerns of the ICO; in India, it didn’t have to.&lt;/p&gt;
&lt;h3&gt;WhatsApp: New Privacy Policy&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;In August 2016, WhatsApp issued a revised privacy policy that allowed it to share user information with parent company Facebook. Any user who didn’t want her information to be shared with Facebook had a 30-day period to opt out of the policy. Opting out meant that a user’s account information would not be shared with Facebook to improve ads and product experiences. But, there was a caveat.&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;The Facebook family of companies will still receive and use this information for other purposes such as improving infrastructure and delivery systems, understanding how our services or theirs are used, securing systems, and fighting spam, abuse, or infringement activities.&lt;br /&gt;&lt;b&gt;WhatsApp Support Team statement on its website &lt;/b&gt;&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Facebook’s Commitment To ICO&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The ICO decided to delve deeper into what Facebook intended to do with the WhatsApp user data. Elizabeth Denham, Information Commissioner, ICO stated in her blog that users haven’t been given enough information about what Facebook plans to do with the information, and WhatsApp hasn’t got valid consent from users to share the information.&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;I also believe users should be given ongoing control over how their information is used, not just a 30-day window.&lt;br /&gt;&lt;b&gt;Elizabeth Denham, Information Commissioner, ICO&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Denham further elaborated ICO’s stand - that it’s important users have control over their personal information, even if services don’t charge them a fee.&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;We’ve set out the law clearly to Facebook, and we’re pleased that they’ve agreed to pause using data from U.K. WhatsApp users for advertisements or product improvement purposes.&lt;br /&gt;&lt;b&gt;Elizabeth Denham, Information Commissioner, ICO&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The ICO has now asked Facebook and WhatsApp to sign an undertaking committing to better explaining to users how their data will be used, and to giving users ongoing control over that information. Additionally, the ICO also wants WhatsApp to give users an unambiguous choice before Facebook starts using that information and for them to be given the opportunity to change that decision at any point in the future. Facebook and WhatsApp are yet to agree to this, Denham stated.&lt;/p&gt;
&lt;pre style="text-align: justify; "&gt;If Facebook starts using the data without valid consent, it may face enforcement action from my office.&lt;br /&gt;&lt;b&gt;Elizabeth Denham, Information Commissioner, ICO&lt;/b&gt;&lt;/pre&gt;
&lt;p style="text-align: justify; "&gt;In the U.K., protections in the European Data Protection Directive have been incorporated into local law via the Data Protection Act 1998. The ICO is both the privacy regulator and the transparency (right to information) regulator, Sunil Abraham, executive director at the Centre for Internet and Society pointed out. The regulator can issue enforcement notices and also fine errant actors in the market place, he said.&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;This is a regulator with expertise, experience and teeth. Come May 25, 2018, the General Data Protection Regulation will come into force and this will give more comprehensive powers to the regulator to investigate and remedy cases like this. The regulator will take each principle from the Directive or Regulation and examine Facebook’s actions comprehensively before deciding on a response. &lt;br /&gt;&lt;b&gt;Sunil Abraham, Executive Director, Centre for Internet and Society&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;For example, if the regulator determines that the principle of choice and consent has not been complied with, it can force Facebook to reverse its decisions and provide greater transparency and clearer choices, Abraham added.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Karmanya Sareen’s Grievance&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Back home in India, just two months ago, Karmanya Sareen, a WhatsApp user, argued before the Delhi High Court against the company’s new privacy policy. The argument was that WhatsApp’s August 2016 notice to its users about the proposed change in the privacy policy violated the fundamental rights of users under Article 21 of the Constitution. Article 21 promises protection of life and personal liberty.&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;Proposed change in the privacy policy of WhatsApp would result in altering/changing the most valuable, basic and essential feature of WhatsApp i.e. the complete protection provided to the privacy of details and data of its users.&lt;br /&gt;&lt;b&gt;Karmanya Sareen vs Union of India&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Delhi High Court struck down the Article 21 argument saying that the Supreme Court was still deliberating over including right to privacy as a fundamental right. It also pointed to WhatsApp’s 2012 Privacy Policy that allowed the company to transfer user information in case of an acquisition or merger with a third party. The 2012 policy also allowed WhatsApp to change the terms periodically.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Consequently, the Delhi High Court held that it is not open to the users now to contend that WhatsApp should be compelled to continue the same terms of service. However, the court gave WhatsApp two directions to protect users.&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;WhatsApp to delete from its servers and not share with Facebook or its group companies any information belonging to users who delete their account.&lt;/li&gt;
&lt;/ul&gt;
&lt;ul&gt;
&lt;li style="text-align: justify; "&gt;Users who continue to be on WhatsApp, their existing information up to September 25, 2016 cannot be shared with Facebook or any of its group companies.&lt;/li&gt;
&lt;/ul&gt;
&lt;h3 style="text-align: justify; "&gt;Did The Delhi High Court Go Easy On Facebook And WhatsApp?&lt;/h3&gt;
&lt;p&gt;Apar Gupta, an advocate specializing in information technology, points out that the directions given by the Delhi High Court to WhatsApp did not contemplate any additional protection to a user than what was already provided by WhatsApp.&lt;/p&gt;
&lt;p class="callout"&gt;The Delhi Court essentially reproduced WhatsApp’s privacy policy. It did not compel or provide any additional safeguard.&lt;br /&gt;&lt;b&gt;Apar Gupta, Lawyer&lt;/b&gt;&lt;/p&gt;
&lt;p&gt;Apar attributes this to the absence of a regulatory framework.&lt;/p&gt;
&lt;p class="callout"&gt;The lack of substantive safeguard and enforcement framework in India led to the Delhi High Court upholding WhatsApp’s new privacy policy.&lt;br /&gt;&lt;b&gt;Apar Gupta, Lawyer&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Abraham added that the court did not examine the privacy policy from the perspective of data protection principles as would have been the case in EU or any other jurisdictions with a proper data protection law.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The court too admitted this in its order that there existed a regulatory vacuum in India and asked TRAI to look into the matter. Facebook did not respond to BloombergQuint’s query on whether it would implement its U.K. commitments in India as well.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;The government said Wednesday that the one-month ban was necessary for public safety because social media were being "misused by anti-national and anti-social elements." Videos depicting the alleged abuse of Kashmiris by Indian forces fueled protests have been shown on social media in recent days.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"It's being felt that continued misuse of social networking sites and instant messaging services is likely to be detrimental to the interests of peace and tranquility in the state," the public order said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The sites remained online Thursday as the local telecom company struggled to block them.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Pranesh Prakash, policy director for the Indian advocacy group the Center for Internet and Society, called the ban a "blow to freedom of speech" and "legally unprecedented in India."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;An official with Kashmir's state-owned telecom company, Bharat Sanchar Nigam, said engineers were still working on shutting down the 22 sites, including Facebook and Twitter, but so far had been unable to do so without freezing the internet across the Himalayan region. The official spoke on condition of anonymity because he was not authorized to give technical details of the effort to the media.&lt;br /&gt;&lt;br /&gt;Meanwhile, 3G and 4G cellphone service has been suspended for more than a week, but slower 2G service is still available.&lt;br /&gt;&lt;br /&gt;Residents of Srinagar, the region's main city, were busily downloading documents, software and applications onto their smartphones which would likely be able to circumvent the social media block once it goes into effect. Many expressed relief to still have internet access Thursday morning.&lt;br /&gt;&lt;br /&gt;"It was a welcome surprise," said Tariq Ahmed, a 24-year-old university student. "It appears they've hit a technical glitch to block social media en mass."&lt;br /&gt;&lt;br /&gt;While the government has halted internet service in Kashmir in previous attempts to prevent anti-India demonstrations, this is the first time they have done so in response to the circulation of videos and photos showing alleged military abuse.&lt;/p&gt;

A Facebook post by Kashmiri writer Arif Ayaz Parrey said the ban showed "the Indian government has decided to take on the collective subversive wisdom of cyberspace humanity."&lt;br /&gt;&lt;br /&gt;Indian police and paramilitary officials accuse agitators of using social media to instigate violence.&lt;br /&gt;&lt;br /&gt;An international journalists' rights group urged Indian authorities to immediately revoke the "sweeping censorship of social media," saying it "will bring neither peace nor order" in the region.&lt;br /&gt;&lt;br /&gt;"Such broad censorship clearly violates the democratic ideals and human rights India purports to uphold," said Steven Butler, Asia Program coordinator at the New York-based Committee to Protect Journalists.&lt;br /&gt;&lt;br /&gt;Kashmiris have been uploading videos and photos of alleged abuse for some years, but several recently posted clips, captured in the days surrounding a violence-plagued local election on April 9, have proven to be especially powerful and have helped to intensify anti-India protests.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;One video shows a stone-throwing teenage boy being shot by a soldier from a few meters (yards) away. Another shows soldiers making a group of young men, held inside an armored vehicle, shout profanities against Pakistan while a soldier kicks and slaps them with a stick.&lt;br /&gt;&lt;br /&gt;The video pans to a young boy's bleeding face as he cries. Yet another clip shows three soldiers holding a teenage boy down with their boots and beating him on his back.&lt;br /&gt;&lt;br /&gt;The video that drew the most outrage was of young shawl weaver Farooq Ahmed Dar tied to the hood of an army jeep as it patrolled villages on voting day. A soldier can be heard saying in Hindi over a loudspeaker, "Stone throwers will meet a similar fate," as residents look on aghast.&lt;br /&gt;&lt;br /&gt;Protests and clashes are an almost daily occurrence in Indian-administered Kashmir, where anti-India sentiment runs deep among the mostly Muslim population after decades of military crackdowns. &lt;p style="text-align: justify; "&gt;She went on broadcasting to the world all that was happening around her. "Illegally being held here at Parliament St Police Station Delhi w/ 15 other women. Terrified, pls RT," she tweeted. It worked. In a flash, more than 1,700 people retweeted her SOS. &lt;a href="http://timesofindia.indiatimes.com/topic/Social-media"&gt;Social media&lt;/a&gt; analytics firm Favstar later said the message reached over two lakh people.&lt;br /&gt; &lt;br /&gt; Police later contested many of Sambhavi's claims. Yet, there was no denying it was her voice that was heard. Her tweets triggered a social media frenzy. The media reacted swiftly. Lawyers volunteered, activists landed up at the police station. Celebrities condemned the action. The police stood no chance.&lt;br /&gt; &lt;br /&gt; For the government and keepers of law, it was a PR disaster. They had lost a battle they were accustomed to winning hands down. Now, there was a pesky entity — the public — seeking to change the rules of the game. A teenager armed with a smartphone had used the magic platform called social media to devastating effect, catching the agents of the state flatfooted.&lt;br /&gt; &lt;br /&gt; India might have tasted the power of the smartphone first in 2011 when Anna Hazare's stinging anti-corruption message rode the social media wave. But this year saw social media creating a new phenomenon — the rise of the virtually connected Indian youth — which is likely to redraw the terms of engagement between the state and its urban population.&lt;br /&gt; &lt;br /&gt; &lt;b&gt;The networking tool that's now a weapon&lt;/b&gt;&lt;br /&gt; &lt;br /&gt; Finance minister P Chidambaram recently tried to sum up the phenomenon by likening social media-driven snap protests to a flash-mob phenomenon. "Flash mob is a new phenomenon... sometimes they gather to dance and sing. But sometimes they gather to protest... I don't think we are fully prepared to deal with it." Going by the last fortnight, when the government fumbled in dealing with widespread protests over Nirbhaya, the minister's admission was an understatement. Let alone being "fully prepared", they didn't have a clue.&lt;br /&gt; &lt;br /&gt; The unbridling of the power of the social media was undoubtedly a top, if not no. 1, trend of 2012 in India. In many cases, it set the agenda of public discourse. As in Palghar, where young Shaheen Dhada's Facebook comment on the shutdown of Mumbai after Bal Thackeray's death kicked off a storm, the virtual world triggered several real-world controversies.&lt;br /&gt; &lt;br /&gt; In fits and starts, politicians and the government realized the folly of not joining the fast-unfolding revolution, the exceptions being the Twitter-savvy Shashi Tharoor and Omar Abdullah. The @PMOIndia &lt;a href="http://timesofindia.indiatimes.com/topic/Twitter"&gt;Twitter&lt;/a&gt; handle was born, and today 3.5 lakh people follow it. A host of politicians soon hopped on, realizing the freedom the platform offered for comment on issues, which TV studios didn't.&lt;br /&gt; &lt;br /&gt; For Bollywood celebs and cricketers, it became a great way to keep in touch with fans. But the real power of this irreverent and often insolent medium lay with the young aam admi who used social media fearlessly. They voiced their opinion and unsparingly ridiculed leaders with hashtags like #theekhai, making powerful headlines out of what otherwise would have been just whistling in the air.&lt;br /&gt; &lt;br /&gt; What's the USP of the social media? On this platform, free speech is unhindered. It's a virtual megaphone with a global reach, as the numbers show. Whether it's Twitter or Facebook, India is a huge presence. Facebook has more than 65 million active users here, putting the country among the top five worldwide in terms of users. Twitter, which has 200 million active users globally, doesn't provide country-specific numbers. But SemioCast, a Paris-based research firm, said in a report in July that India had around 18 million Twitter accounts, placing it sixth among the biggest Twitter nations.&lt;br /&gt; &lt;br /&gt; A lot of this social media boom happened in 2012. Research firm SocialBakers estimated in November that the number of Indian Facebook users swelled by 14 million in the past six months. While internet penetration in India is just 11% — three times lower than the global average — around 137million users make the country third biggest in terms of web-connected citizens. Most of these users are urban and young. A Comscore report says 75% of web users here are under-35.&lt;br /&gt; &lt;br /&gt; Unlike youngsters in many other countries, Indians are politically active on the web. A Pew Research study this December established that nearly 45% of Indian web users, most of them from urban areas, connect on social media to discuss politics. Only Arab countries scored higher than India on this account. The numbers are backed by GlobalWebIndex, which noted in a September report that India is the third most socially active country with around 78 points.&lt;br /&gt; &lt;br /&gt; But this unfettered, unfiltered flow of information and messages showed its ugly side as well. The mischievous rumour-mongering in the wake of the Assam riots was a case in point, as MMSs and incendiary text messages triggered an exodus of people belonging to the northeast from Bangalore, Pune, Chennai and Hyderabad.&lt;br /&gt; &lt;br /&gt; Facebook and Twitter started off as friendship and networking tools. But, they have evolved into potent weapons of social mobilization. In a way, India Against Corruption can be credited with starting it in mid-2010. "If you have a worthy cause, social media provides you an unbiased, unfiltered avenue," says Shivendra Chauhan, social media manager for the outfit. "Without it, we wouldn't have got the kind of overwhelming support we received from the youth."&lt;br /&gt; &lt;br /&gt; But Sunil Abraham, executive director of the Bangalore-based Centre for Internet and Society, cautions against being overly technologically deterministic. "Technology doesn't have agency; human beings do. Transferring energy from social media on to the streets isn't something that'll happen every time. It depends on whether the message resonates," he says.&lt;br /&gt; &lt;br /&gt; While the anti-corruption movement ran on a sophisticated social media strategy and campaign, the ongoing anti-rape protests have no single organizer or banner, just a message that resonates, says Abraham. On the other hand, when Anonymous India called for boots on the ground at its protests against internet censorship, the turnout was poor, far lower than the number of hashtags on Twitter would have indicated, he adds.&lt;br /&gt; &lt;br /&gt; Abraham points out there are close linkages between internet, text messages, social media and mainstream media. "These channels leak into each other and the causal connection becomes unclear," he says. Madhuresh Kumar, national coordinator of the National Alliance of People's Movements (NAPM), an umbrella organization of grassroots movements of the marginalized, agrees. "We use social media, not so much to mobilize people to come to our protests, but to mobilize the mainstream media."&lt;br /&gt; &lt;br /&gt; The message determines the power of the medium. If it's something that connects viscerally, like the Nirbhaya protests, its power and reach can be beyond imagination. If it is a more niche message, like an SOS for a dwindling fish species, it will reach a smaller, targeted audience such as environmentalists. But it will reach — unhindered in the palm of your hand.&lt;br /&gt; &lt;br /&gt; Look at it any which way, it is here to stay. So, it's time for the state to learn to deal with the new power of the ordinary citizen.&lt;/p&gt;
