    <title>Know your Users, Match their Needs!</title>

        &lt;b&gt;As Free Access to Law initiatives in the Global South enter into a new stage of maturity, they must be certain not to lose sight of their users’ needs. The following post gives a summary of the “Good Practices Handbook”, a research output of the collaborative project Free Access to Law — Is it Here to Stay? undertaken by LexUM (Canada) and the South African Legal Institute in partnership with the Centre for Internet and Society.&lt;/b&gt;
        
&lt;p&gt;&lt;/p&gt;
&lt;p&gt;Almost ten years have passed since the Montreal Declaration on
Free Access to Law (FAL) was signed by eight legal information institutes and other
FAL initiatives. Today, the Free Access to Law Movement (FALM) is growing with over 30 initiatives having signed onto the Declaration and providing free, online
access to legal information. While the movement continues to gain momentum, the
big question no longer remains &lt;em&gt;why&lt;/em&gt; we need
free access to law, but instead &lt;em&gt;how&lt;/em&gt; FAL initiatives can continue to do so sustainably in the long-term. The principles of access
and justice underpinning the FALM have been well-argued and few would dispute the
notion that citizens ought to have access to the laws under which they are
governed. As the Montreal Declaration states: "Public legal information from
all countries and international institutions is part of the common heritage of
humanity…Maximizing access to his information promotes justice and the rule of
law" (2002).&lt;/p&gt;
&lt;p&gt;Regardless of legal system or political context, the
importance of securing free online access to the law has been recognized from a
variety of perspectives. Whether FAL is considered a critical democratic
function or simply an essential efficiency within any legal system, it is
difficult to contest that the internet has increased the accessibility of and
ease with which legal information is being published and shared online. Setting
the ideological and practical foundations of the movement aside, effectively
demonstrating the impact of FAL initiatives and to secure their sustainability in
the long-term remains the next big challenge for the FALM. Today, there is a
growing necessity for grounded and realistic indicators that can validate some
of the long-held assumptions around the impacts and outcomes of FAL initiatives.
Furthermore, and perhaps more importantly, there is also a need for a more
nuanced understanding of the factors that influence the sustainability of FAL
initiatives— particularly in resource-scarce and often nebulous legal systems of
the Global South.&lt;/p&gt;
&lt;p&gt;This blog post provides some insight into the questions
above through a brief summary of the results of the study &lt;a class="external-link" href="http://crdi.org/ar/ev-139395-201-1-DO_TOPIC.html"&gt;Free Access to Law—Is
it Here to Stay?&lt;/a&gt; This global comparative study was carried out by LexUM (Canada)
and the South African Legal Institute in partnership with the Centre for
Internet and Society. The project set out to begin providing answers to some of
these critical questions around the impacts and sustainability of the FALM. It
was initially hypothesized in the study that the sustainability of a FAL
initiative rests upon a particular string of contingent factors. To begin, a particular
condition would incentivize the creation of the FAL initiative — more often than
not meeting the unmet needs of those requiring access to legal information.&amp;nbsp; Next, if the FAL initiative is able to provide
the service within a favourable context, it was suspected that it would produce
favourable outcomes for both users and society at large. In turn, if the FAL
initiative was able to provide benefits to users, it was theorized that these benefits
would then stimulate reinvestment into the FAL initiative — forming a positive
and sustainable feedback loop.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;As the &lt;a class="external-link" href="http://www.informationjuridique.ca/docs/a2k/Best%20Practices%20Hand%20Book_03sept11.pdf"&gt;Good Practices Handbook&lt;/a&gt; highlights, the research
hypothesis provided an accurate reading of what the sustainability chain of a
FAL initiative might look like in&lt;em&gt; practice&lt;/em&gt;.
If unable to keep up with the evolving information requirements of their users,
this study suggests that FAL initiatives run the risk of FAL becoming outdated
and even outperformed by either government-based or private sector
initiatives.&amp;nbsp; This is why FAL initiatives
must continue to be innovative and find new ways to meet users’ needs. Approaches take my include keeping their
collections up to date, fine-tuning their services or even reinventing
themselves through the provision of value-added services. Gathered from the
experiences of the eleven countries across Africa and Asia examined in this
study, the following is a brief summary of the nine “Good Practices” that emerging
FAL initiatives can consider:&lt;/p&gt;
&lt;ol&gt;&lt;li&gt;&lt;strong&gt;The FAL initiative
should establish clear objectives&lt;/strong&gt;: Before doing anything, the FAL initiative
should decide what exactly it’s setting out to do…critical components such as
content selection, targeted audience, expected reach, search functionalities
and other website features help determine priorities and evaluate capacity to
achieve these objectives.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;How to be small and
do big things&lt;/strong&gt;: Most of the FAL initiatives studied as part of this project
were formed of small teams (often less than five individuals). Initially, this may
appear to pose a risk for sustainability. However, we saw a number of ways in
which small teams have proven to be innovative, flexible, and able to thrive in
environments of scarcity. However, as much as small teams can be seen as a
source of innovation, they may also pose a risk in the medium to long-term.&amp;nbsp;&lt;/li&gt;&lt;li&gt;&lt;strong&gt;FAL initiatives
require expertise in both IT and legal information&lt;/strong&gt;: Legal information management
experts understand how the law is applied, how different texts and parts of
texts speak to one another, and how these documents are used. IT experts can
imagine a variety of ways to address these needs. If both forms of expertise is
not available within the team of a FAL initiative, institutional partnerships
provide promising sites for collaborative support. For example, the FALM
constitutes a rich source of expertise and has proven to be a site of
collaboration between established and emerging FAL initiatives. Further,
universities have proven to be a significant source of human and financial
resources for several FAL initiatives.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;FAL initiatives
should look to where they are headed (but not too far ahead)&lt;/strong&gt;: Because the
purpose of a FAL initiative is to provide free online access to the law, it
must secure access to this data for regular publication. How will legal
information be received and organized by the initiative? In what format will it
be published in? Early on, FAL initiatives need to develop both internal and
external workflow processes to ensure that the initiative is able to provide regular
access to updated information. Furthermore, an important finding of the study
suggests that context plays a much larger role in a project’s sustainability. Consideration
should be given to a country’s ICT infrastructure, the transparency of a
government and their access to information regimes, and the nature of the legal
information market when designing the workflows of an FAL initiative.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;FAL initiatives
should work with the ICT infrastructure in place&lt;/strong&gt;: The quality and
consistency of internet access varies across countries in the Global South. FAL
initiatives should remain aware of how stakeholders and users are accessing the
internet and develop their service accordingly. Considering the often
intermittent nature of internet connectivity in the Global South, providing
users with offline access to databases is a practical alternative.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;FAL initiatives
should use Free and Open Source Software&lt;/strong&gt;: FAL initiatives should maximise
their use of FLOSS. All FAL initiatives use FLOSS to some extent and without
these flexible and cost-effective alternatives, it would be safe to infer that
the FALM would have grown as quickly as it has.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;FAL initiatives
should be sensitive to culture&lt;/strong&gt;: FAL initiatives rely on stakeholders and
communities of users. Staying mindful of the professional and organizational
cultures within a country may provide the initiative with a source of community
support which may become a sustainability strategy.&amp;nbsp; Further, integrated or parallel social
networking platforms can play an essential role in community-building around
the FAL initiatives and can also serve as another source of content in
resource-scarce environments.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Find your users,
match their needs&lt;/strong&gt;: Project goals and appropriate strategies should be based
on an in-depth understanding of the needs of those using the FAL initiative. As
the sustainability chain suggests, when FAL initiatives produce positive
outputs and outcomes, stakeholders will reinvest in the initiative to ensure
its sustainability. If a user’s needs are effectively met by an FAL initiative,
this group can provide either the resources or impetus for its continued
success. Identifying who your users are and staying aware of their needs is a
good way to secure reinvestment into the project.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;FAL initiatives
should diversify funding sources&lt;/strong&gt;: This may be easier said than
done — reinvestment can be the most challenging aspect of sustaining a FAL
initiative. Early on, initiatives that receive donor-based funding benefit
substantially upon investment. However, these initiatives are put at
significant risk once initial seed funding has been depleted. Similarly, FAL
initiatives that partnerships with other during their start up phase face
similar fates as securing long-term service delivery can become a challenge.
Possible funding sources included throughout the study include, among others:
government, international development agencies or NGOs, the judiciary, law
societies and the sale of value-added services.&lt;/li&gt;&lt;/ol&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;In addition to these good practices, this study has emphasized
the role the that the FALM has played in helping redefine online legal information as a public good. Each
of the case studies demonstrates in a unique way the value openness plays in a
legal information ecosystem, and how a robust digital legal information commons can be of
benefit to users. Traditionally, the legal information market has been dominated by a select
number of commercial players. In response, the FALM has created an important
transnational space within which conversations around the provision of and
access to legal information as a political right &lt;em&gt;rather&lt;/em&gt; than a commodity to be bought and sold
can take place. Encouragingly, governments in the Global South are catching and FAL initiatives from the South have proven to be immense sources of innovation in their own right. In Indonesia, for example, FAL initiatives have laid the
groundwork for emerging government initiatives that are now&amp;nbsp; prioritizing the provision of free, online access to legal and other government information. Today, I believe that we are witnessing an important paradigm
shift as governments are beginning to recognize that “access” to legal information is a
right to be held by the public.&lt;/p&gt;
&lt;p&gt;Despite such headway, it is needless to say that FAL initiatives in the Global South
continue to face immense sustainability challenges. However, it is hoped that this
study can provide some practical insights for emerging initiatives
and partnerships. However, as more FAL initiatives begin entering into the next
stage of maturity and growth, it is more important than ever that they are
able to adapt to adverse environmental changes and form
long-lasting partnerships with information sources within government. Most
importantly, FAL initiatives must remain dynamic and responsive to users’
needs. To do so, they must be able to tailor and expand their services, offerings
and user-base. To secure their sustainability and relevance in the long term, they must also be continuously strengthening their ties and maintain open communication flows with
users. &amp;nbsp;If FAL initiatives are able to successfully make the
transition from being supply side initiatives to becoming demand driven services,
the FALM will be well-positioned for another decade of sustainable growth.&amp;nbsp;&lt;/p&gt;

    <title>The Wikimedia India Program Trust</title>

        &lt;b&gt;A new entity, the “Wikimedia India Program Trust”, has now been formed and registered (in Delhi.) This will be the organization that will eventually drive India programs and house the team in India.&lt;/b&gt;
        
&lt;p&gt;For some time, efforts have gone into creating an organization that would provide an appropriate structure to support Wikimedia program activities in India. &amp;nbsp;Aspects such as the current regulatory framework (regarding funding, taxation, etc.) as well as the legal protection for the India team have been considered to determine this structure. In this context, a host of options (e.g. subsidiary, branch, Section 25) were evaluated and a determination was made towards an independent non-profit public trust. Legal advice has been taken at every stage in this decision.&amp;nbsp;&lt;/p&gt;
&lt;h3&gt;Why an Independent Public Trust?&lt;/h3&gt;
&lt;p&gt;The Trust will provide an effective vehicle within India to marshal resources to support programs and partner with local institutions. The objective of the Trust is to promote the objectives of the Wikimedia movement and work closely with the Wikimedia community on various projects with an India focus. It is important to understand that the Trust will not have any editorial control over content on any of the Wikimedia projects. The Trust is a not for profit organization.&lt;/p&gt;
&lt;h3&gt;Introduction of Trustees&lt;/h3&gt;
&lt;p&gt;Trustees have been identified based upon their support for Wikimedia movement's principles and plans in addition to having reputations for good governance and management.&amp;nbsp;Sunil Abraham and Rahul Matthan have been requested to be the initial Trustees. &amp;nbsp;Both are friends of Wikipedia and have extensive experience.&lt;/p&gt;
&lt;p&gt;Sunil is Executive Director of the Centre for Internet &amp;amp; Society (CIS), is a long term advocate of free software and IP reform and has been supporting the Wikimedia community and movement for some time now.&lt;/p&gt;
&lt;p&gt;Rahul is a partner and heads the technology practice at Trilegal. He brings deep expertise and relationships that will be valuable for the Trust.&lt;/p&gt;
&lt;p&gt;These initial Trustees will serve for a term of three years at the maximum. &amp;nbsp;All additional or subsequent Trustees will serve on rotation in accordance with a trustee selection plan that will be prepared.&lt;/p&gt;
&lt;p&gt;Trustees will not be compensated for their services.&amp;nbsp;Governance, Funding, Financial Standards &amp;amp; Communications of the Trust.&amp;nbsp;The Trust will be governed by Trustees who will provide oversight and guidance regarding the operations and governance of the Trust.&amp;nbsp;Since the Trust is an independent organization, it will require funding for its operations which is in compliance with the legal and regulatory framework in India. It will seek funding from private donors within India as well as external sources.&lt;/p&gt;
&lt;p&gt;The Trust has the support of the Wikimedia Foundation which is a United States based non-profit foundation. However, in India all non-profit organizations need to be in existence for 3 years before they can receive funding from sources outside India. In the interim, they can apply for prior-permission under the FCRA regulations to help expedite the process. As a result, the Trust will shortly be applying for approval to receive funds from the Wikimedia Foundation in the future.&lt;/p&gt;
&lt;p&gt;As a Trust, we are required to have an independent external auditor. We have appointed KPMG. KPMG is experienced in auditing non-profit companies and are also auditors for the Wikimedia Foundation.&amp;nbsp;Annually, the Trust will publicly disclose it's independently audited financial statements.&lt;/p&gt;
&lt;p&gt;The Trust will publish a monthly newsletter outlining its current activities and future plans. This will commence in December 2011.&lt;/p&gt;
&lt;h3&gt;Operations of the Trust&lt;/h3&gt;
&lt;p&gt;The trust deed under which the Trust must operate clearly states that the purpose of the Trust is to independently promote the growth of volunteer activities within India in support of effective and unrestricted dissemination of free knowledge to the public.&amp;nbsp;Hisham will serve as the Executive Director of the Trust. Once it is possible, additional employees will be brought on to the Trust.&amp;nbsp;The Trust will eventually have an office in Delhi.&amp;nbsp;In the interim, a temporary office space has been set up to facilitate establishing the Trust and its mission. It is located at Top Floor, G-15, Hauz Khas, New Delhi - 110 016. It's a couple of minutes walk away from IIT Flyover and Hauz Khas Metro. Do drop in! &lt;h3&gt;Conclusion&lt;/h3&gt;
&lt;p&gt;We continue to make progress in setting up program activities to support the growth of Wikimedia in India. &lt;div&gt;Rapid advancements in the domains of computer Science and information technologies have allowed&amp;nbsp;integration of biodiversity information and analytical capabilities to collaborate on social networks,&amp;nbsp;leading to the emergence of a new discipline, Biodiversity Informatics. The dynamics in this discipline&amp;nbsp;are defined by integrating multiplicity with the semantic web and enabling of democratic social&amp;nbsp;networks focused on biodiversity. We are bound to see tremendous diversification in the scope of&amp;nbsp;biodiversity informatics globally and in India.&lt;/div&gt;
&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;
&lt;div&gt;Harnessing technology for aggregating, storing, querying and analyzing biodiversity data has seen&amp;nbsp;major developments over the last decade. There has been a plethora of biodiversity information&amp;nbsp;resources that include mailing lists and discussions groups, occurrence records, geographical&amp;nbsp;databases, biodiversity image libraries, institutional databases, species description pages, specimen&amp;nbsp;records of herbaria and museum databases, and biodiversity focused Internet sites. The challenges&amp;nbsp;on the biodiversity informatics landscape are on two fronts: (1) A semantic web framework to link&amp;nbsp;these biodiversity information islands; and (2) Effective and flexible data exchange standards for&amp;nbsp;seamless information sharing among these sites.&lt;/div&gt;
&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;
&lt;div&gt;The evolution of social networks and communities around biodiversity information systems has&amp;nbsp;been a unique factor in influencing the ways in which these information systems have developed.&amp;nbsp;The assimilation and aggregation of user-generated biodiversity data and dissemination under&amp;nbsp;the 'commons' principle has gained momentum globally. It has changed the way scientific&amp;nbsp;collaborations are being made, and created possibilities for effective citizen-science initiatives. It is&amp;nbsp;now possible to ask fresh questions, with more data, newer methods, better tools and for citizens to&amp;nbsp;participate and report data from different geographies. With this, local-level data can be integrated&amp;nbsp;with large-scale data leading to a better understanding of biodiversity.&lt;/div&gt;
&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;
&lt;div&gt;With the increased penetration of the Internet into developing economies, and the widespread&amp;nbsp;adoption of web technologies, biodiversity informatics has spawned an impressive variety of&amp;nbsp;initiatives. These initiatives range from global knowledge bases and networks, national initiatives,&amp;nbsp;eco-region based initiatives, as well as sharply focused initiatives which address a single species or&amp;nbsp;event. There have been tangible advantages for stakeholders from these initiatives which has inspired&amp;nbsp;many other endeavours. Success stories exist at both global and local level, and learning from these&amp;nbsp;experiences can help one understand the multi-faceted nature of this discipline.&lt;/div&gt;

&lt;div&gt;
&lt;div&gt;The Western Ghats Portal team is organising a one-day workshop to explore the contemporary state&amp;nbsp;of biodiversity informatics as expressed in three spheres: i) technology behind biodiversity informatics,&amp;nbsp;ii) scientific commons and policy and iii) biodiversity portals in India. With these objectives in mind,&amp;nbsp;we welcome your active participation during the workshop.     <title>Open Access Week begins in Bangalore</title>

        &lt;b&gt;On Monday 24 October, the National Aerospace Laboratories in Bangalore held an event to mark the beginning of Open Access Week 2011&lt;/b&gt;
        
&lt;p&gt;During the event, &lt;a class="external-link" href="http://en.wikipedia.org/wiki/Padmanabhan_Balaram"&gt;Professor Balaram&lt;/a&gt; spoke on&lt;strong&gt; 'Issues of Access in Science Publishing'&lt;/strong&gt;,  and &lt;a class="external-link" href="http://nal-ir.nal.res.in/view/creators/Venkatakrishnan=3AL=3A=3A.html"&gt;Dr. L Venkatakrishnan&lt;/a&gt; gave a talk '&lt;strong&gt;Open Access: Promised Utopia or Eventual Reality?'&lt;/strong&gt;&lt;/p&gt;
&lt;div&gt;Before the speakers, Shyam Chetty framed the discussion by suggesting that India currently lags behind other nations in the adoption of Open Access. He said that the Indian &lt;a class="external-link" href="http://en.wikipedia.org/wiki/Council_of_Scientific_and_Industrial_Research"&gt;Council of Scientific and Industrial Research &lt;/a&gt;should lead an initiative to promote India's&amp;nbsp;&lt;a class="external-link" href="http://www.ncsi.iisc.ernet.in/OAworkshop2006/pdfs/NationalOAPolicyDCs.pdf"&gt;National Open Access Policy&lt;/a&gt;&amp;nbsp;and perhaps bring it into law.&amp;nbsp;&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;Prof. Balaram spoke next, and brought some refreshing realism and complexity to the Open Access discussion.&amp;nbsp;He noted that both as a reader and as an author he supports&amp;nbsp;Open Access, but there are costs involved in making research available, and these will have to be covered in some way. He shared first-hand experience of expensive subscriptions for Indian institutions, and how even the IISc has cancelled many journal purchases.
In a &lt;a href="https://cis-india.org/about/openness/professor-balaram-talks-open-access" class="external-link"&gt;later interview, Professor Balaram&lt;/a&gt; discusses some solutions to these problems.&amp;nbsp;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;Prof. Balaram highlighted that Closed Access journals do add value to scholarship ― in terms of peer review, editing, and aggregation&amp;nbsp;(the collection of related articles in useful ways).&amp;nbsp;While Open Access journals may offer these services too, Prof. Balaram suggested that some of the&amp;nbsp;strongest supporters of Closed Access journals are working academics who value the increased reputation and status they can offer.&amp;nbsp;This lead him to expressing an opposition to institutional Open Access mandates. Instead, he encouraged an approach where academics are motivated to open their work for self-interest, rather than by obligation.&amp;nbsp;&lt;/div&gt;
&lt;div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;Prof. Balaram also said that India must take an independent approach to Open Access and not expect western nations to lead the way. Increasingly India and China are seen as real competitors in the international field, and in the future may not receive concessions in journal subscriptions or other help currently offered to developing nations.

&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;Dr Venkatakrishnan was more skeptical towards Open Access. He emphasized that the price to make an article freely available in a Closed Access journal could be over USD $3000. From this he suggested that the&amp;nbsp;&lt;a class="external-link" href="http://en.wikipedia.org/wiki/Open_access_journal"&gt;Gold Route&lt;/a&gt;&amp;nbsp;to Open Access lacked potential because the costs involved are prohibitive. This does leave out&amp;nbsp;&lt;a class="external-link" href="http://oad.simmons.edu/oadwiki/OA_journal_business_models"&gt;alternative ways of financing&lt;/a&gt;&amp;nbsp;Open Access journals that do not involve the author paying for submission.&amp;nbsp;&lt;/div&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;Dr. Venkatakrishnan&lt;span class="Apple-style-span"&gt;&amp;nbsp;echoed Prof. Balaram in saying that a strong motivation to publish in top-tier Closed Access journals is the increased reputation or funding it can bring.&amp;nbsp;&lt;/span&gt;While it is true that academics can usually still upload their work to Open Access databases,&amp;nbsp;&lt;span class="Apple-style-span"&gt;Dr.&amp;nbsp;&lt;/span&gt;Venkatakrishnan&lt;span class="Apple-style-span"&gt;&amp;nbsp;&lt;/span&gt;&lt;span class="Apple-style-span"&gt;concluded that he did not know if Open Access was an 'open door' or a 'blind corner'.&amp;nbsp;&lt;/span&gt;&lt;/div&gt;
&lt;div&gt;&lt;span class="Apple-style-span"&gt;&lt;br /&gt;&lt;/span&gt;&lt;/div&gt;
&lt;div&gt;&lt;span class="Apple-style-span"&gt;This could be taken as a strange end to an Open Access celebration, but the implication seemed to be this: in order for more Indian academics to support Open Access, they must be convinced of the real benefits it can bring to their own reputation and career success.&lt;/span&gt;&lt;/div&gt;

        &lt;b&gt;The Centre for Internet and Society in partnership with the Center for Knowledge Societies, Venkataramanan Associates, Center for Law and Policy Research, Headstart Foundation, Chaia Innovation Accelerator, MXV Consulting, Mint Newspaper and Confederation of Indian Industry is organising the second edition of Design Public on October 14, 2011 at the National Gallery of Modern Art in Bangalore. There will be a series of pre-conference research outings on October 13, for which participants may register in advance.&lt;/b&gt;
        
&lt;h3&gt;Innovation and the Public Interest&lt;/h3&gt;
&lt;p&gt;Design Public is a series of conversations about whether and how Innovation can serve the&amp;nbsp;Public Interest.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;At our inaugural event, in New Delhi on March 18th earlier this year, we focused on the question of whether innovation in governance is needed and how it can be achieved. An excellent overview of the event can be found in a Mint Newspaper &lt;a class="external-link" href="http://www.livemint.com/2011/03/24204727/Using-design-principles-for-go.html"&gt;article&lt;/a&gt; by Aparna Piramal Raje. While we discovered wide agreement in principle as to the need for innovation in India, there was much uncertainty about how government systems relate to innovation, and some doubt as to whether governments are in fact capable of innovation. At our upcoming event, we aim to widen the ambit of the discussion, to ask how innovation serves the public interest, thereby opening up the question of innovation to the social sector, to corporations, to venture capitalists, designers, students, academics and more.&lt;/p&gt;
&lt;p&gt;Following Schumpeter, we understand
innovation to be a fundamental part of modern economic and social life -- in
fact the very source of the momentum that drives us forward into the future.
However, we have also found that innovation need not be limited to entrepreneurs in
the private sector, but can also be accomplished, in various ways, in
government, in the public sector, and by social and developmental agencies.
Moreover, if the specific components of innovation can be identified and
learned, it would be possible for many more&amp;nbsp;organizations and individuals to successfully drive beneficial social and technical change.&lt;/p&gt;
&lt;p&gt;If the term Innovation describes the business or economic dimension of the forward movement of society under capitalism, then the immanent, cognitive or mental aspect of this forward movement can be captured by the term Design. It is the multivariate, parallel, sometimes collaborative process of finding solutions to problems that have no obvious and available answer. Whereas the language of design gained prominence in the Industrial Age as a means for the rendering of surfaces and finishes for the more effective marketing of consumer products (posters and toasters), the concept has far wider application in the present. Design and Innovation are by definition the strategies through which the most intractable, complex, and multivariate challenges encountered by individuals or groups.&lt;/p&gt;
&lt;p&gt;At our event, therefore, we seek to articulate exactly how these strategies can be brought to bear on the Grand Challenges facing our society, in areas such as:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;Complete and Effective Healthcare for Mothers and Children&lt;/li&gt;&lt;li&gt;Increased Use and Acceptance for Toilets&lt;/li&gt;&lt;li&gt;Broad-based Higher Education&lt;/li&gt;&lt;li&gt;Participatory and Responsive Civic Administration&lt;/li&gt;&lt;/ul&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;div&gt;Over the course of the day-long event, we will consider different approaches and paradigms of innovation and how they may be applicable to these grand challenges. We will break out into sessions in order to apply these perspectives and approaches to specific challenge areas. At the end of the day we will seek to expand the circle of innovation in order establish new ways of collaborating and sharing knowledge such that we are able to accelerate and intensify the application of innovation to addressing these and other grand challenges facing the public.&lt;/div&gt;

It is a research inquiry that seeks to look at the changing landscape of social change and political participation and the role that young people play through digital and Internet technologies, in emerging information societies. Consolidating knowledge from Asia, Africa and Latin America, it builds a global network of knowledge partners who want to critically engage with the dominant discourse on youth, technology and social change, in order to look at the alternative practices and ideas in the Global South. It also aims at building new ecologies that amplify and augment the interventions and actions of the digitally young as they shape our futures.&lt;/p&gt;

At CIS we work to ensure that the digital technologies, which empower disabled people and provide them with independence, are allowed to do so in practice and by the law. &lt;p style="text-align: justify; "&gt;Although there may not be one centralized authority that rules the Internet, the Internet does not just run by its own volition: for it to operate in a stable and reliable manner, there needs to be in place infrastructure, a functional domain name system, ways to curtail cyber crime across borders, etc. The Tunis Agenda of the second World Summit on the Information Society (WSIS), paragraph 34 defined Internet governance as “the development and application by governments, the private sector and civil society, in their respective roles, of shared principles, norms, rules, decision-making procedures, and programmes that shape the evolution and use of the Internet.” Its latest endeavour has resulted into these:&lt;/p&gt;

The two-year project commenced on 24 March 2010 and will be completed as agreed to by the stakeholders.     <title>Open Government Data in India (v2)</title>

        &lt;b&gt;The first draft of the second version of the Open Government Data Report is now online. Nisha Thompson worked on updating the first version of the report. This updated version of the report on open government data in India includes additional case studies as well as a potential policy (National Data Sharing and Accessibility Policy) that would create a central government data portal. The report was distributed for peer review and public feedback.&lt;/b&gt;
        &lt;p&gt;There are additional government case studies regarding e-governance and how they are changing the way data is collected and distributed. The report also looks at the issues around open data at the city and panchayat level and profiles new projects that are working to fill that void. It also includes a deeper account account of the global perspective on open government data and how India's experience with open data will be different from what the west is doing.     <title>Open Access to Scholarly Literature in India: A Status Report: Call for Comments</title>

        &lt;b&gt;The Centre for Internet and Society welcomes comments on the first draft of "Open Access to Scholarly Literature in India: A Status Report". This report, on open access to scholarly literature, with a special focus on scientific literature, has been written by Prof. Subbiah Arunachalam and Madhan Muthu.  The report surveys the field of scholarly and scientific publication in India and provides a detailed history of the open access movement in India.&lt;/b&gt;
        &lt;p&gt;It notes that Indian science has "low but increasing research productivity helped by increasing investments on R&amp;amp;D, and low but moderately improving visibility", and that the best way to boost visibility and impact of Indian science are by pursuing a nation-wide open access policy.&lt;/p&gt;
&lt;p&gt;Thus, it recommends that all publicly funded research in India should be made open access and provides suggestions on how this could best be achieved.  It points out the need to go beyond open access mandates, to practical aspects like training of repository maintainers and of researchers for self-archiving. In addition, it points out the need for more effective advocacy and for a judicious mixture of both top-down and bottom-up approaches for bringing about the realization of the benefits of open access.&lt;/p&gt;

    <title>People are Knowledge – Experimenting with Oral Citations on Wikipedia</title>

        &lt;b&gt;The Centre for Internet and Society in association with the Wikimedia Foundation has produced a documentary film "People are Knowledge". The film evolved out of a project on Oral Citations in India and South Africa funded by the Wikimedia Foundation, and undertaken by Wikimedia Foundation Advisory Board Member Achal Prabhala as a short-term fellowship, to help overcome a lack of published materials in emerging languages on Wikipedia. New Delhi-based filmmaker Priya Sen has directed the film, with additional assistance from Zen Marie who handled the shooting in South Africa. The film explores how alternate methods of citation could be employed on Wikipedia, documenting a series of specific situations with regards to published knowledge, and subsequently, with oral citations.  &lt;/b&gt;
        &lt;p&gt;&lt;span class="Apple-style-span"&gt; &lt;/span&gt;&lt;/p&gt;
&lt;h3&gt;The Problem&lt;/h3&gt;
&lt;p&gt;Imagine a world with every individual having open access to the sum of human knowledge. But there is a problem — the sum of human knowledge is far greater than the sum of printed knowledge. For example, in India and South Africa, the number of books produced every year is nowhere near to the number of books being producing in UK. There is very little citable, printed material to rely on in the indigenous languages of India or South Africa. So it is difficult for the languages of these countries to grow its own Wikipedia. While there are significant media markets for Indian languages within and outside India, there is very little scholarly publishing in any language other than English. On the other hand, South African languages with the exception of English and Afrikaans have had a largely oral existence and only in recent times have started a publishing tradition, which is in nascent stages.&lt;/p&gt;

&lt;p&gt;As a result of such disparity, everyday, common knowledge — things known, observed and performed by millions of people — do not enter Wikipedia as facts because they haven’t been written down in a reliably published source. Hence, Wikipedia in countries like India and South Africa lose out on opportunities for growth.&lt;/p&gt;
&lt;p&gt;While we are enthused about the rise of “small language Wikipedias”, it may not happen soon. Not with the present rules at least. Even if we were to convince every single person in the South with Internet access to become an active editor on Wikipedia, there is still a problem that they are going to run up against. That problem that currently bedevils everyone working in local languages in Asia and Africa, and nobody seems to have a control over it.&lt;/p&gt;
&lt;p&gt;For Wikipedias in languages of the South, citations aren’t a problem when the articles being added are translations (for universally important topics, reliable citations are already there in English and other European languages). Assuming, however, that we all want the sphere of knowledge to be universally expanded — and not merely translated from languages of the North to languages of the South — there are two specific problems with finding citations for important local subject matters.&lt;/p&gt;
&lt;ul style="list-style-type: square; "&gt;
&lt;li&gt;Published, citable resources may simply not exist. This is not just true of Sub-Saharan African languages (many of which use Latin script, have a relatively recent written history, and small or non-existent publishing markets) but also of several South Asian languages (even though they have non-Latin scripts, a relatively ancient written history and thriving publishing markets in news and entertainment).&lt;/li&gt;
&lt;li&gt;Even when published scholarly resources exist, they may be inaccessible and thus effectively rendered invisible to Wikipedians. Libraries and archives in India and South Africa are usually not electronically indexed. Furthermore, they are not always conveniently located, and often impose a massive bureaucratic burden on the user to search, see, borrow from or even enter. &lt;/li&gt;
&lt;/ul&gt;
&lt;div&gt;
&lt;h3&gt;Oral Citations as a Possible Solution&lt;/h3&gt;
&lt;p&gt;Hindi Wikipedia has over 65,000 articles, Malayalam Wikipedia has about 15,000, and Northern Sotho Wikipedia has about 600. Many of these articles — especially when concerning subjects that are specific to a particular people or place — have no citations whatsoever. Yet, an editor — often several editors — created the articles in question. How? Simply put, and barring laziness and carelessness where citations are available, the basis of fact therein is orally circulated knowledge. Even today, in several parts of the world, people are knowledge. Therefore, an exercise where oral citations are collected and assembled — in a manner not different to that by which print sources are cited on Wikipedia, i.e., with diverse viewpoints, several sources, a rationale for authenticity — might be one way to capture this knowledge in a form that is recognisable to Wikipedia.&lt;/p&gt;
&lt;p&gt;Anthropologists have been doing this for years — in the academy, it is called field work. The average Wikipedians certainly don’t have the capacity to replicate the arduous research programme of a doctoral student but they do have common sense and access to basic telecommunication facilities. So oral citations can:&lt;/p&gt;
&lt;ol&gt;
&lt;li&gt;Create externally verifiable authentication for a Wikipedia article that is based on experiential facts, but lacks citations simply because no printed source has recorded these facts to date.&lt;/li&gt;
&lt;li&gt;Add to the set of published scholarly resources that document an existing fact, for example, in cases where the published sources are archaic or primarily foreign, and thus complete existing knowledge or correct its biases.&lt;/li&gt;

&lt;p&gt;Achal Prabhala worked with Wikipedians across three languages in two different countries — Malayalam (40 million speakers) and Hindi (250 million speakers) in India and Northern Sotho (5 million speakers) in South Africa to see how oral citations might be received in the language communities they can benefit, discuss this idea with Wikipedians at large, not as a final solution but as a first step in understanding how we may expand our definition of reliable sources of knowledge beyond what is published in print, and what benefits such an expansion may bring and show this is an idea that takes hold, to create a set of clearly laid-out initial templates that others can use and build upon. Four collaborators: Shiju Alex, Mayur, Mohau Monaledi and Achal Prabhala, with additional help from Vijayakumar Blathur were finalised. Parts of the experiment were then filmed as an edited documentary.&lt;/p&gt;
&lt;h3&gt;The Pitfalls&lt;/h3&gt;
&lt;p&gt;There are numerous potential pitfalls[&lt;a href="#1"&gt;1&lt;/a&gt;] the most glaring of which is the principle of ‘No original research’. Naturally, we’re going to have to find a way to justify our approach, or work around it, or expand its meaning. Several people will welcome it, several people will object on all kinds of grounds, and several others possibly misusing and misinterpreting oral citations (i.e., without care to authenticity, diversity of opinion) in their work on Wikipedia.&lt;/p&gt;
&lt;p&gt;However, this is the right thing to do. The problem is real. The solution being presented is a first step, not a final answer. Sure, people might have a problem with it, and sure, there may be heated objections to it; but overall, if it’s the right thing to do, it should be done, however strange it seems and however unsettling it is.&lt;/p&gt;
&lt;p&gt;After all, if the status quo had to be respected absolutely, we wouldn’t have Wikipedia.&lt;/p&gt;

&lt;h3&gt;Open Government Partnership&lt;/h3&gt;
&lt;p&gt;In January 2011, a small group of government and civil society leaders from around the world gathered in Washington, DC to brainstorm on how to build upon growing global momentum around transparency, accountability and civic participation in governance. The result was the creation of the Open Government Partnership (OGP), a new multi-stakeholder coalition of governments, civil society and private sector actors working to advance open government around the world — with the goals of increasing public sector responsiveness to citizens, countering corruption, promoting economic efficiencies, harnessing innovation, and improving the delivery of services.&lt;/p&gt;
&lt;p&gt;In September 2011, these founding OGP governments will gather in New York on the margins of the UN General Assembly to embrace a set of high-level open government principles, announce country-specific commitments for putting these principles into practice and invite civil society to assess their performance going forward. Also in September, a diverse coalition of governments will stand up and announce their intention to join a six-month process culminating in the announcement of their own OGP commitments and signing of the declaration of principles in January 2012.&lt;/p&gt;
&lt;h3&gt;'Opening Government' report&lt;/h3&gt;
&lt;p&gt;To help inform governments, civil society and the private sector in developing their OGP commitments, the Transparency and Accountability Initiative (T/A Initiative) reached out to leading experts across a wide range of open government fields to gather their input on current best practice and the practical steps that OGP participants and other governments can take to achieve it.&lt;/p&gt;
&lt;p&gt;The result is the first document of its kind to compile the state of the art in transparency, accountability and citizen participation across 15 areas of governance, ranging from broad categories such as access to information, service delivery and budgeting to more specific sectors such as forestry, procurement and climate finance.&lt;/p&gt;
&lt;p&gt;Each expert’s contribution is organized according to three tiers of potential commitments around open government for any given sector — minimal steps for countries starting from a relatively low baseline, more substantial steps for countries that have already made moderate progress, and most ambitious steps for countries that are advanced performers on open government.&lt;/p&gt;

    <title>Comments on the draft National Data Sharing and Accessibility Policy</title>

        &lt;b&gt;A draft of the 'National Data Sharing and Accessibility Policy', which some hope will be the open data policy of India, was made available for public comments in early May.  This is what the Centre for Internet and Society submitted.&lt;/b&gt;
        
&lt;p&gt;These are the comments that we at the Centre for Internet and Society submitted to the National Spatial Data Infrastructure on the draft &lt;a class="external-link" href="http://dst.gov.in/NDSAP.pdf"&gt;National Data Sharing and Accessibility Policy&lt;/a&gt;.&lt;/p&gt;
&lt;h2&gt;Comments on the National Data Sharing and Accessibility Policy by the Centre for Internet and Society&lt;/h2&gt;
&lt;p&gt;We would like to begin by noting our appreciation for the forward-thinking nature of the government that is displayed by its pursuit of a policy on sharing of governmental data and enabling its use by citizens. We believe such a policy is a necessity in all administratively and technologically mature democracies. In particular, we applaud the efforts to make this applicable through a negative list of data that shall not be shared rather than a positive list of data that shall be shared, hence making sharing the default position. However, we believe that there are many ways in which this policy can be made even better than it already is.&lt;/p&gt;
&lt;h2&gt;1. Name&lt;/h2&gt;
&lt;p&gt;We believe that nomenclature of the policy must accurately reflect both the content of the policy as well as prevailing usage of terms. Given that 'accessibility' is generally used to mean accessibility for persons with disabilities, it is advisable to change the name of the policy.&lt;/p&gt;
&lt;h3&gt;Recommendation:&lt;/h3&gt;
&lt;p&gt;A. We would recommend calling this the "National Open Data Policy" to reflect the nomenclature already established for similar policies in other nations like the UK. In the alternative, it could be called a "National Public Sector Information Reuse Policy". If neither of those are acceptable, then it could be re-titled the "National Data Sharing and Access Policy".&lt;/p&gt;
&lt;h2&gt;2. Scope and Enforceability&lt;/h2&gt;
&lt;p&gt;It is unclear from the policy what all departments it covers, and whether it is enforceable.&lt;/p&gt;
&lt;h3&gt;Recommendation:&lt;/h3&gt;
&lt;p&gt;A. This policy should cover the same scope as the Right to Information (RTI) Act: all 'public authorities' as defined under the RTI Act should be covered by this policy.&lt;/p&gt;
&lt;p&gt;B. Its enforceability should be made clear by including provisions on consequences of non-compliance.&lt;/p&gt;
&lt;h2&gt;3. Categorization&lt;/h2&gt;
&lt;p&gt;The rationale for the three-fold categorization is unclear. In particular, it is unclear why the category of 'registered access' exists, and on what basis the categorization into 'open access' and 'registered access' is to be done. If the purpose of registration is to track usage, there are many better ways of doing so without requiring registration.&lt;/p&gt;
&lt;h3&gt;Recommendation:&lt;/h3&gt;
&lt;p&gt;A. Having three categories of:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;Open data&lt;/li&gt;&lt;li&gt;Partially restricted data&lt;/li&gt;&lt;li&gt;Restricted data&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;B. Data that is classified as non-shareable (as per a reading of s.8 and s.9 of RTI Act as informed by the decisions of the Central Information Commission) should be classified as ‘restricted’.&lt;/p&gt;
&lt;p&gt;C. The rationale for classifying data as 'open' or 'partially restricted' should be how the data collection body is funded. If it depends primarily on public funds, then the data it outputs should necessarily be made fully open. If it is funded primarily through private fees, then the data may be classified as 'partially restricted'. 'Partially restricted' data may be restricted for non-commercial usage, with registration and/or a licence being required for commercial usage.&lt;/p&gt;
&lt;h2&gt;4. Licence&lt;/h2&gt;
&lt;p&gt;No licence has been prescribed in the policy for the data. Despite India not allowing for database rights, it still allows for copyright over original literary works, which includes original databases. All governmental works are copyrighted by default in India, just as they are in the UK. To ensure that this policy goes beyond merely providing access to data to ensure that people are able to use that data, it must provide for a conducive copyright licence.&lt;/p&gt;
&lt;h3&gt;Recommendation:&lt;/h3&gt;
&lt;p&gt;A. The licence that has been created by the UK government (another country in which all governmental works are copyrighted by default) may be referred to: http://www.nationalarchives.gov.uk/doc/open-government-licence/&lt;/p&gt;
&lt;p&gt;B. However, the UK needed to draft its own licence because the concept of database rights are recognized in the EU, which is not an issue here in India. Thus, it would be preferable to use the Open Data Commons - Attribution licence:&lt;/p&gt;
&lt;p&gt;http://www.opendatacommons.org/licenses/by/&lt;/p&gt;
&lt;p&gt;The UK licence is compatible with both the above-mentioned licence as well as with the Creative Commons - Attribution licence, and includes many aspects that are common with Indian law, e.g., bits on usage of governmental emblems, etc.&lt;/p&gt;
&lt;h2&gt;5. Integrity of the data&lt;/h2&gt;
&lt;p&gt;Currently, there is no way of ensuring that the data that is put out by the data provider is indeed the data that has been downloaded by a citizen.&lt;/p&gt;
&lt;h3&gt;Recommendation:&lt;/h3&gt;
&lt;p&gt;It is imperative to require data providers to provide integrity checks (via an MD5 hash of the data files, for instance) to ensure that technological corruption of the data can be detected.&lt;/p&gt;
&lt;h2&gt;6. Authenticity of the data&lt;/h2&gt;
&lt;p&gt;Currently, there is no way of ensuring that the data that is put out by the data provider indeed comes from the data provider.&lt;/p&gt;
&lt;h3&gt;Recommendation:&lt;/h3&gt;
&lt;p&gt;It is preferable to require data providers to authenticate the data by using a digital signature.&lt;/p&gt;
&lt;h2&gt;7. Archival and versioning&lt;/h2&gt;
&lt;p&gt;The policy is silent on how long data must be made available.&lt;/p&gt;
&lt;h3&gt;Recommendation:&lt;/h3&gt;
&lt;p&gt;There must be a system of archival that is prescribed to enable citizens to access older data. Further, a versioning and nomenclature system is required alongside the metadata to ensure that citizens know the period that the data pertains to, and have access to the latest data by default.&lt;/p&gt;
&lt;h2&gt;8. Open standards&lt;/h2&gt;
&lt;p&gt;While the document does mention standards-compliance, it is preferable to require open standards to the greatest extent possible, and require that the data that is put out be compliant with the Interoperability Framework for e-Governance (IFEG) that the government is currently in the process of drafting and finalizing.&lt;/p&gt;
&lt;h3&gt;Recommendation:&lt;/h3&gt;
&lt;p&gt;A. The policy should reference the National Open Standards Policy that was finalised by the Department of Information Technology in November 2010, as well as to the IFEG.&lt;/p&gt;
&lt;p&gt;B. The data should be made available, insofar as possible, in structured documents with semantic markup, which allows for intelligent querying of the content of the document itself. Before settling upon a usage-specific semantic markup schema, well-established XML schemas should be examined for their suitability and used wherever appropriate. It must be ensured that the metadata are also in a standardized and documented format.&lt;/p&gt;
&lt;h2&gt;9. Citizen interaction&lt;/h2&gt;
&lt;p&gt;One of the most notable failings of other governments' data stores has been the fact that they don't have adequate interaction with the citizen projects that emerge from that data. For instance, it is sometimes seen that citizens may point out flaws in the data put out by the government. At other times, citizens may create very useful and interesting projects on the basis of the data made public by the government.&lt;/p&gt;
&lt;h3&gt;Recommendation:&lt;/h3&gt;
&lt;p&gt;A. The government's primary datastore (data.gov.in) should catalogue such citizen projects, including open and documented APIs that the have been made available for easy access to that data.&lt;/p&gt;
&lt;p&gt;B. Additionally the primary datastore should act as a conduit for citizen's comments and corrections to the data provider. Data providers should be required to take efforts to keep the data up-to-date.&lt;/p&gt;
&lt;p&gt;C. Multiple forms of access should preferably be provided to data, to allow non-technical users interactive use of the data through the Web.&lt;/p&gt;
&lt;h2&gt;10. Principles, including 'Protection of Intellectual Property'&lt;/h2&gt;
&lt;p&gt;It is unclear why ‘protection of intellectual property’ is one of the guiding principles of this policy. Only those ideals which are promoted by this policy should be designated as ‘principles’. This policy, insofar as we can see, has no relation whatsoever with protection of intellectual property. The government is not seeking to enforce copyright over the data through this policy. Indeed, it is seeking to encourage the use of public data. Indeed, the RTI Act makes it clear in s.9 that government copyright shall not act as a barrier to access to information.&lt;/p&gt;
&lt;p&gt;Given that, it makes no sense to include ‘protection of intellectual property’ amongst the principles guiding this policy. Further, there are some other principles that may be removed without affecting the purpose or aim of this document: ‘legal conformity’ (this is a given since a policy wouldn’t wish to violate laws); ‘formal responsibility’ (‘accountability’ encapsulates this); ‘professionalism’ (‘accountability’ encapsulates this); ‘security’ (this policy isn’t about promoting security, though it needs to take into account security concerns).&lt;/p&gt;
&lt;h3&gt;Recommendation:&lt;/h3&gt;
&lt;p&gt;A. Remove ‘protection of intellectual property’, ‘legal conformity’, ‘formal responsibility’, ‘professionalism’, and ‘security’ from the list of principles in para 1.2.&lt;/p&gt;
