    <title>Living in the Archival Moment</title>

        &lt;b&gt;An extended survey of digital initiatives in arts and humanities practices in India was undertaken during the last year. Provocatively called 'mapping digital humanities in India', this enquiry began with the term 'digital humanities' itself, as a 'found' name for which one needs to excavate some meaning, context, and location in India at the present moment. Instead of importing this term to describe practices taking place in this country - especially when the term itself is relatively unstable and undefined even in the Anglo-American context - what I chose to do was to take a few steps back, and outline a few questions/conflicts that the digital practitioners in arts and humanities disciplines are grappling with. &lt;p&gt;In a rather delightful essay titled ‘Unpacking my Library’, Walter Benjamin (1968: 59-67) dwells upon the many nuances of the art of collecting (books in this particular case), on everything from the sometimes impulsive acquisition to the processes of careful selection and classification which go into creating a library. "Ownership is the most intimate relationship one can have with objects" (67) he says, and this becomes important given the many ways in which we can acquire books today, as well as the problems of copyright, authorship and authority over meaning and knowledge that become a bone of contention in the digital age. The collector defines the nature of the object here, because he lives in and through them. While describing the personal process that is collecting, Benjamin is also aware that it may not be a process that will last as it is - a foreboding of the age when the impulse to collect, hoard and categorise has only grown tremendously due to increased access to books owing to the internet, but also where the figure of the collector seems to have been slowly effaced, thus presenting a ‘chaos of memories’ (60) in unarranged collections spread over several hard disks instead of book shelves. The figure of the collector, and the idea of ‘ownership’ emerge as an important trope in understanding the notion of order, or rather disorder of the art of collecting in the digital space.&lt;/p&gt;
&lt;p&gt;This figure of the collector and practice of collecting are important to our understanding of a central concept in DH - the archive - particularly as it occupies a predominant space in the imagination of the field in India, and processes of knowledge production and the history of disciplines in general. The influx of digital technologies into the archival space in the last decade has been an impetus for the large scale digitisation of material, but it has also thrown up several challenges for traditional archival practice, including the preservation of analogue material, the problems of categorising and interpreting large volumes of data, and the gradual disappearance or re-definition of the traditional figure of the collector – a concern echoed across several spaces extending from private online archival efforts to large collaborative knowledge repositories like the Wikipedia. With the questions that DH seems to have posed to traditional notions of authorship or subject expertise, the 'digital humanist', when we imagine such a person, can be seen as a reinvention of this figure of the collector - a curator of materials and traces, here of course, digital traces.&lt;/p&gt;
&lt;p&gt;The concept of the archive has been important to knowledge production and particularly the development of academic disciplines; whether driven by concerns of the state or the impulses of the market, there have been different ways of defining and understanding the archive, not only as a documentary record of history, but as a metaphor for collective memory and remembrance which includes technology in its very imagination. One of the most elaborate formulations of the archive has been in the work of Jacques Derrida, where apart from proposing the death and preservation drives as primary to the archival impulse, he also highlights the process of archivisation, or the technical process of archive-building that shapes history and memory (1995). Michel Foucault in his concept of the archive looks at it as "a system of discursivity which establishes the possibility of what can be said," &lt;strong&gt;[1]&lt;/strong&gt; thus pointing to the archive as a space not just of preservation but also production, with an impact on the process of knowledge creation. There is today a consensus, at least in its academic understanding that archives cannot be relegated to being self-contained linear spaces of objective historical record, but that archival practice itself has political implications in terms of how collective memory and history, or as indicated by Foucault, histories are preserved and retold through a process of careful selection. Disciplines themselves may therefore be seen as archives of knowledge, and one may stretch this analogy to say that they may also appear as self-contained spaces with restrictions on entry for different ways of remembering and reading. More importantly, the question of what constitutes the archive and what objects or materials may be archived reflects a larger debate about problems with the definition of disciplines and shifting disciplinary boundaries &lt;strong&gt;[2]&lt;/strong&gt;. With the shift to the digital archive, new questions about access, sharing and collaboration have emerged, as illustrated by the number of new archival spaces that have emerged, and growth of expansive archives such at the Walt Whitman, Rossetti and Blake archives in the West (Drucker 2011). However, as is apparent, the conditions of access to such archives and their interpretation have not been problematised enough, if at all, particularly with respect to how they contribute to generating new kinds of knowledge or scholarship.&lt;/p&gt;
&lt;p&gt;While DH debates in the West have focussed quite significantly on archives and the possibilities that digital collections have now opened up research and creative practice involving archival material, in the Indian context it is the 'incompleteness of the archive' that still seems to be a bone of contention. Some of the scholars and practitioners interviewed as part of this study see archive creation as one of the key questions of DH as it has emerged in India, and the possibilities and challenges that this brings to the fore, (particularly in terms of access to rare materials and extending these debates to regional languages) as something that the field will need to contend with at some point. The role of digital technologies in fostering this activity of archive-building is stressed in these debates. In an earlier monograph titled Archives and Access produced as part of CIS-RAW, Aparna Balachandran and Rochelle Pinto trace a material history of archival practice in India, specifically looking at conflicts and debates surrounding state and colonial archives, and the politics of access, preservation and digitisation (2011). The monograph also points towards in some way the move of the archive from being solely the prerogative of the state to the now within the reach of the individual, engendered by increased access to technology, and the ‘publicness’ that the visual nature of the internet fosters. However they also talk of the possibility of continuing forms of state or market control over the archive precisely through the internet and digital technologies, with the nature of individual access and use again being mediated through digitisation. Abhijeet Bhattacharya, Documentation Officer with the archives at the Centre for Studies in Social Sciences, Kolkata who was also part of the Archives and Access project, and has been part of some early conversations on DH in India, speaks about this change &lt;strong&gt;[3]&lt;/strong&gt;. Even twenty years ago, it was difficult to define the archive, as it was considered the prerogative of the state, and this defined the nature of archival practice and management as well. From there it has slowly transformed into a practice that encompasses various methods of digitisation and has become increasingly personal. While digitisation may have resolved some issues of preserving content and the problems of physically accessing archives to a large extent, it may not always be the best option, as the archival or analogue material needs to be in good condition so as to make for good digitised copies, thus emphasising the need for more effective methods and better training in preservation practices. Also, as he point out, digitisation may be able to capture and preserve the content of an artifact, but not its form, which is equally important. He therefore rues the fact that even with technological advancements, there is still a lack of interest in archival practice, and often institutional mandates determine the archival agenda which may not be in the interest of generating more research and scholarship around material, as this is the only way to keep the archive alive.&lt;/p&gt;
&lt;p&gt;The growth of private collections, which create new kinds of intellectual and nostalgic spaces, has been an important shift here, with their focus on archiving the personal and the everyday, he says, though in many instances such material may not be available for public use or consumption. While on the subject of private collections and personal narratives, Dr. C S Lakshmi, writer and academic who is director of the Mumbai-based Sound and Picture Archives for Research on Women (SPARROW) &lt;strong&gt;[4]&lt;/strong&gt;, has particular concerns about digitalisation making large amounts of information available for consumption online, particularly with respect to women. While digitisation is an effective tool for preservation and offers several possibilities for documentation, unmediated access is problematic and often a breach of privacy. There is so much information out there that the digital sphere makes available, sometimes this excessive communication also contributes to certain silences and obscures or makes invisible people and their stories. So very often its not a question of just making information available to people. What are you making available, how much are you making available and to whom, for what purpose - these are all important questions that contour the notion of access and need to be addressed according to Dr. Lakshmi. Curation therefore emerges as an important process. The publicness or hyper-visibility that the visual nature of the internet and digital technologies accords to the archive is seen tied to a narrative of loss here, and against the rhetoric of preservation which is still in many spaces deemed to be the primary function and imagination of the archive. What this sets up is also a conflict between the possibilities of open access and sharing of material, and concerns of privacy, and the need to find a space where both these seemingly contradictory ends meet.&lt;/p&gt;
&lt;p&gt;The increased availability of space for data accumulation due to digital technologies contributes to a 'problem of excess', and that is where curation and building new kinds of tools come in as a critical and creative exercise. Dr. Amlan Dasgupta reiterates this opinion. He talks about the internet as fostering an 'age of altruism', where the proliferation of technological gadgets has brought about a culture of voluntarily sharing materials online. This of course challenges notions of authority and brings forth the problems of the unarranged library which Benjamin’s essay also points towards, but the archive can be used as a metaphor to understand how notions of authorship and authority are being challenged as is apparent in the DH discourse. The theory-practice divide is also something that ails this particular domain like many others; not only is there an inadequate understanding of how to access and use the archive on the part of students and researchers alike, but there is a lack of standardisation of the practice of archive management and the science itself, in terms of metadata, problems of ownership and copyright, and most importantly inadequate infrastructure, training and expertise on preservation of analogue materials. While it may not be within the ambit of DH to address all of these questions, the renewed interest in archival practice and the diversification of its modes is something is that would continue to be an integral aspect of its practice. In fact what digitisation has also led to is diversity in the modes of documentation itself, and the larger process of archiving, which has important implications for the kinds of questions one may ask within certain disciplinary formations, history being an important example. The nature of material in the archive is never quite the same, so is the manner of working with and interpreting them. Dr. Indira Chowdhury, who has been engaged with archival practice herself, and is now working on setting up oral history archives through the Centre for Public History, speaks of the changes that digital technologies have produced in studying oral history, specifically in terms of recording and interpretation of interviews. The mode of documentation, particularly the digital, adds a new layer to the manner in which the voice, sounds or even silence is recorded or interpreted. She refers to Alessandro Portelli’s work on oral history, which talks about the nuances of the sound, such as tone, volume and speed of speaking which are all bearers of meaning and can tell you so much about what the person is trying to say, but can never be fully translated into the written word.(2006, 32-42)  Although there are still some basic but crucial obstacles such as with transcription, the digital space may allow for tools that help with more nuanced interpretation of recorded material, and large volumes of it; a possibility that CPH is looking into at the moment. There are several institutions in India who want to set up their archives, most of their materials include many hours of interviews, with many people at a time and transcription is a problem, because it takes time, and there is still no software to aid or completely automate this process effectively. One of the approaches of DH may be to address these knowledge gaps through critical tool-building, in terms of how one may work with different ways of reading and interpreting material using digital tools.&lt;/p&gt;
&lt;p&gt;The digital archive is one space where many of these questions about the process of archive-creation and the separation between preservation and production that is often made in the existing discourse come into conflict, thus inflating the definition of the term much more. New technologies of publishing, the proliferation of electronic databases and growth of networks that in turn encourage production and the increasing amount of born-digital materials then present new questions for the concept of the archive and scholarship.&lt;/p&gt;
&lt;p&gt;The role of technology has been significant in the development of the concept of the archive; in fact the archive, in its very nature would be a technological object, or a space where one can trace a history of the disciplines in relation to technology. The introduction of the digital has added yet another dimension to this question. Dr. Ravi Sundaram, Fellow at the Centre for the Study of Developing Societies and one of the co-initiators of the Sarai programme at the Centre for Developing Societies (CSDS) &lt;strong&gt;[5]&lt;/strong&gt;, speaks of how the advent of the digital has brought about several shifts in the imagination of the archive, which he sees as two distinct phases. Sarai was one of the early models of a concept driven, networked archive, based on a culture of 'mailing lists' that built conversations around topics which in themselves constituted the archive. The shifts came with Web 2.0 with which archiving the everyday became a possibility, given the access to inexpensive gadgets and the pervasiveness of social media. While the model of the networked, curated and public archive still has valence today, a significant next step would be to see how one can extend these questions to thinking differently about the archive, by developing new protocols for entering, sharing and circulation of material, and producing new knowledge or concepts around these ideas. This would be crucial in terms of generating research and scholarship around the archive itself as a concept, and realising the full potential of network-generated information. Another pertinent question is that of information and technology infrastructure, which is a political question as well. The investment on infrastructure for the archive is determined by different kinds of interests and will play an important role in how archival efforts will ultimately develop. As Dr. Sundaram reiterates, the point to note is that new archival efforts are not only general repositories, but critical interventions in themselves. They foster new kinds of visibilities. The Pad.ma archive &lt;strong&gt;[6]&lt;/strong&gt;, for example, works with existing footage and reinvents or adds new layers of meaning to it through annotations and citations. This also opens up possibilities for new kinds of questions to be asked about existing material. Private archival efforts, many initiated by individuals are also becoming more niche and specific, driven by a specific research agenda, public interest in conservation or as critical and creative interventions in a particular area. Some examples of this are the Sound and Picture Archives for Research on Women (SPARROW), Pad.ma and Indiancine.ma &lt;strong&gt;[7]&lt;/strong&gt;, the Indian Memory Project &lt;strong&gt;[8]&lt;/strong&gt;, and Osianama &lt;strong&gt;[9]&lt;/strong&gt;. In some of these examples, the archive may be used as more of a metaphor rather than a description or classificatory term, because of the layers of meaning that they generate around an existing object or 'trace'.&lt;/p&gt;
&lt;p&gt;They are also reflective of a different milieu that came about with the digital turn in India. Shaina Anand, artist and filmmaker who set up the artist’s studio and collective CAMP in Mumbai &lt;strong&gt;[10]&lt;/strong&gt;, and is also part of the team behind the Pad.ma and Indiancine.ma platforms, speaks of the various factors that contributed to the setting up these two online archival spaces. As artists for them the larger concern was the ever-changing electronic media or technological landscape, as seen in some of their earlier projects such as Russel TV, which involved creating content around media ecologies and intellectual property in a sort of pro-piracy, and access to knowledge framework. The focus for them was the ecology or the landscape, and within that the sharp point was where there were irregularities and inequalities and there was a need to redistribute things in a certain way. Pad.ma grew out of a larger idea of understanding this changing milieu around the early 2000s, where the digital had already become pervasive – filmmakers were editing on a laptop or desktop computer, they had access to the internet and DIY tools, resources were cheaper and more accessible as the internet was opening up a world of possibilities. Therefore, as the team realised, if there was to be an archive of the contemporary, it had to be digital or visual, or video specifically, and located online. This was also the time when the independent filmmaker had become a prominent figure and the challenges and advantages of sharing unused and raw footage became quite possible and apparent with a platform like Pad.ma. The archive was created as something contemporary, non-state and non-canonical, with a wide range of stakeholders and contributors ranging across NGOs, activists, independent filmmakers to individuals with an interest in film and video. There were however several difficulties as well, chiefly in getting people to share material, issues of privacy, and a resistance to the use of this platform as a pedagogic and academic resource, which over the years have come down with the people becoming more open to using material on the platform as primary texts, and the development of more tools for editing and annotations. Indiancine.ma that way is more of a traditional form of film studies, but with more possibilities now for working with the film text.&lt;/p&gt;
&lt;p&gt;However, while entering the digital space may have enabled more sharing and dissemination of material, how much of these efforts also make their way into larger civil society and policy debates, scholarship and pedagogy is still a crucial question. Pad.ma and Indiancine.ma have been used by students, in media and film in particular but the efforts remain niche and restricted to certain disciplines only. Some part of this comes from a resistance to the film or a certain kind of text as academic, and therefore scholarly or relevant to a larger cross-section of research. This also stems from a predominant imagination of the archive as a static, linear repository. As Ashish Rajadhyaksha, film and cultural studies scholar, who was part of the team that created Pad.ma and Indiancine.ma, points out, the distinction between the archive as a repository space and an interpretive space is one that needs to be made clearly, and archives are clearly a form of the later. In fact the idea of the digital as a permanent medium is false, and it should not be the solution to problems of storage and preservation. Further, in a lot of expansive archives, whether digital or physical, it is seen that only up to five percent of the material is used, and more often than not it is the same five percent! This is because most people do know about the existence of certain kinds of material which is buried deep within the archive, and therefore do not access it. The emphasis of archival practice, and particularly in the time of the digital archive where space is not seen as a constraint, yet,  should be to enliven the archive to ensure that material from the 'dead space of the archive' is made more searchable and accessible for use.&lt;/p&gt;
&lt;p&gt;Curation then comes back again as an important aspect of the archive, even in the time of the digital. Indira Chowdhury sees this as one of the main shifts from the traditional archive, where the curator or the archivist performed the role of a custodian or gatekeeper who grants restricted access to the archive only to researchers or scholars. Now with the advent of the internet and shift to the digital, it’s more about collaboration, and adding to the archive, and this has encouraged a diversity of users, and uses of the archive. This comes with its own problems however, such as with metadata standards for instance, and particularly questions of format which become important from the perspective of technological obsolescence (as discussed in the earlier chapter). The digital archive has made practitioners think about what they are archiving, for whom and what purpose, and in what formats, but these questions also go back to the traditional archive, and in fact are dependent on how we think about and defined the archive itself, then and now how we imagine the virtual archive. These are as she says, questions that may be routed through technology, but not necessarily about technology. Also, even with the traditional archive, making material accessible and usable was a concern, and this is where the archivist or custodian played an important role. She speaks about using pre-digital archives, where there are handwritten descriptions of material, all meticulously preserved, indexed and cross-referenced, and you know what material to look for because the archivist knew what was in the archive and how to find it. She speaks of her own experience of setting up the archives at TIFR, which was not digital then, but has been digitised now, and even though she has not been associated with them for a while now she still gets the occasional email requesting help to find something in the archive, because she knows the material. A lot of the new digital archives therefore, despite their huge collection which are also searchable, need archivists and assistants who oversee the organisation of material, because those cross-references and connections have just not been made (often it is not humanly possible because of the sheer volume of data), which is really what the historians will look for, and that is the challenge here.&lt;/p&gt;
&lt;p&gt;Padmini Ray Murray, another faculty member at the Centre for Public History, also sees this as a problem of not imagining the archive as a database, but as this legacy where content is being held together under this one overarching frame. She finds that there is a metanarrative that is created at the level of the database, because of the context in which the archive becomes a database – the historical / institutional questions, and what is being used to create the archive. A point of divergence however could be that it’s easier to lie with the archive, because with the database there is the empirical identifier, so the truth claim is better. This is something that Dr. Chowdhury agrees upon as well, as she finds that because archives have the potential of being multilayered, and are therefore  complex, verification is difficult; it’s only another scholar who will check the materials referenced or used by one – and the interpretation would change, and this had implications for the way the archive generates scholarship. Another difference is pulling data from the archive in a way that it allows the making of computational hypotheses about other possibilities, which is the heart of DH – such as topic modelling and algorithmic shortcuts to crunch through data to posit some hypothetical claims. She feels that in India at the moment we are not doing in enough with the archive as database, which also restricts its many possibilities. Even in terms of access to the archive, which the digital archive is supposed to make easier, it comes with certain conditions, such as copyrights, privacy and even different kinds of Creative Commons licenses for open source content. It also depends on what Dr. Ray Murray describes as the ‘flavour of the archive’, something particularly relevant to a lot of new private archival spaces like the Indian Memory Project, or Indiancine.ma or Pad.ma, which focussed on 'building the archive', as opposed to working with an existing archive of material. As such these are somewhat ephemeral archives, always in the making, and where the digital intersects clearly with the archival space is in terms of finding an audience for it; the internet creates these niche spaces of interest, so you find that people want to access such spaces, and do it differently from the traditional archive, as the varied nature and functionalities of these two examples demonstrate.&lt;/p&gt;
&lt;p&gt;What the long discussion seems to illustrate then is the gradual shift of the archive to become something of a metaphor, as the way the archive has been previously imagined, and its functions have changed with the advent of the internet. As Wolfgang Ernst asks:&lt;/p&gt;
&lt;blockquote&gt;Does the archive become metaphorical in multimedia space? This is a plea for archiving the term archive itself for the description of multimedia storage processes. Digital archaeology, though, is not a case for future generations but has to be performed in the present already. In the age of digitalizability, that is, when we have the option of storing all kinds of information, a paradoxical phenomenon appears: cyberspace has no memory. (Ernst 2013: 138)&lt;/blockquote&gt;
&lt;p&gt;What Ernst suggests is that the Internet forms a different kind of multimedia archive, or anarchive, or is a phantasm, which differs from the printed of state archives because “the archive is a given, well-defined lot; the Internet, on the contrary, is a collection not just of unforeseen texts but of sound and images as well, an &lt;em&gt;anarchive&lt;/em&gt; of sensory data for which no genuine archival culture has been developed so far in the occident” (139). The internet, in documenting the discontinuities and ‘disorder’ of the history of multimedia forms thus gives rise to a new memory culture, and this is important to the process of understanding how new archival spaces are being created, and theorised.&lt;/p&gt;
&lt;p&gt;Archive-building has an impact on how knowledge is produced, organised and disseminated is a crucial aspect of meaning-making practices. Related to this is another issue in terms of the amount of data that is available in the archives by the sheer amount of material that it can now hold, which demands new protocols of access and collaboration, and the role of curation in making such data relevant and comprehensible. The problem of excess mentioned by many of the scholars and practitioners would be relevant to the question of big data; accessing or interpreting such large volumes of information would require critical tools and new kinds of architecture. These shifts also relocate the figure of the collector from traditional practices to new ways of visualising collections and the art of collecting itself, which are now beyond the scope of the human subject. As illustrated by practices such as distant reading, it is now humanly difficult to read, and process such large volumes of data that the digital archive now makes available to us. What this then throws up as questions for archival practice, and DH of course, is the new modes by which knowledge is produced through access to such corpora – for instance the impact such changes have on history, its reading and writing, the growth of public history and the role of the internet archive in fostering its growth. On a much broader level, it also points towards the implications of this shift for pedagogy and scholarship in the humanities, in the digital age, questions which will be discussed in the next chapter.&lt;/p&gt;

&lt;h2 id="1"&gt;1. Introduction&lt;/h2&gt;
&lt;p&gt;The Reserve Bank of India published a Consultation Paper on Peer-to-Peer Lending on April 28, 2016 &lt;strong&gt;[1]&lt;/strong&gt;. The Paper notes that:&lt;/p&gt;
&lt;blockquote&gt;Although nascent in India and not significant in value yet, the potential benefits that P2P lending promises to various stakeholders (to the borrowers, lenders, agencies etc.) and its associated risks to the financial system are too important to be ignored. The Reserve Bank (the Bank) has therefore found it necessary to put out this discussion paper to elicit public opinion and views of the various stakeholders on the future course of action having regard to the current legal and regulatory framework in place to regulate the business of financial intermediation.&lt;/blockquote&gt;
&lt;p&gt;Here I present a summary of the Consultation Paper. The next post in this series will discuss in detail the different types of obligations that the Peer-to-Peer (henceforth, P2P) Lending Companies will have to satisfy if classified as Non-Bank Financial Companies, and other related issues.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2 id="2"&gt;2. Crowdfunding and P2P Lending&lt;/h2&gt;
&lt;p&gt;The Paper starts with discussing (and distinguishing) SEBI’s &lt;em&gt;Consultation Paper on Crowdfunding in India&lt;/em&gt;, published on June 17, 2014, to avoid overlap of jurisdiction &lt;strong&gt;[2]&lt;/strong&gt;. SEBI's paper classified crowdfunding initiatives in to:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;&lt;strong&gt;Community Crowdfunding:&lt;/strong&gt; 1) Social Lending, and 2) Reward Crowdfunding; and&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Financial Return Crowdfunding:&lt;/strong&gt; 1) Peer-to-Peer Lending, and 2) Equity Crowdfunding.&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;Traditionally, Start-ups are funded through private equity, angel investor or loan arrangements with a financial institution. Any offering of public equity takes place only after the product or business becomes commercially viable. However, in Equity based Crowdfunding solicitation is done at an earlier stage. It refers to fund raising by a business, particularly early-stage funding, through offering equity interests in the business to investors online through a crowdfunding platform website acting as the intermediary.&lt;/p&gt;
&lt;p&gt;Though, P2P lending did not appear to involve securities, loan/notes/contracts can be traded on a P2P platform or a secondary market. Thus, these loans may become securities, with the contract between the lender and the borrower being the security note.&lt;/p&gt;
&lt;p&gt;In summary, SEBI’s paper suggested that under Security Based Crowd funding, the possible routes that could be explored are the following:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;&lt;strong&gt;Equity based Crowd Funding (EbC):&lt;/strong&gt; Raising equity through a crowd funding platform.&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Debt Based Crowd Funding (DbC)&lt;/strong&gt; Raising of funds by issuing debentures or debt securities through a crowd funding platform.&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Fund Based Crowd Funding (FbC):&lt;/strong&gt; Raising of funds for pooling under an Alternative Investment Fund (AIF) through a crowd funding platform.&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2 id="3"&gt;3. Observations Made Regarding Current Practice of P2P Lending Companies&lt;/h2&gt;
&lt;ul&gt;&lt;li&gt;P2P lending is in relation to unsecured loans.&lt;/li&gt;
&lt;li&gt;The borrowers and the lenders can be both natural and juristic persons.&lt;/li&gt;
&lt;li&gt;The interest rate can range from a flat interest rate fixed by the platform to dynamic interest rates as agreed upon by the borrowers and the lenders to cost plus model (operational costs plus margin for platform and returns for lender).&lt;/li&gt;
&lt;li&gt;The companies often follow a reverse auction model in which the lenders bid for a borrower’s loan proposal and the borrower has the freedom to either accept or reject the offer.&lt;/li&gt;
&lt;li&gt;Borrowers are able to avail lower rates than those offered by money lenders/unorganized sector. Lenders can obtain higher returns than what conventional investment opportunities offer.&lt;/li&gt;
&lt;li&gt;Some of these are involved in the business targeted at micro finance activities with the stated primary goal being social impact and providing easier access of credit to small entrepreneurs.&lt;/li&gt;
&lt;li&gt;The borrowers pay an origination fee (either a flat rate fee or as a percentage of the loan amount raised) according to their risk category.&lt;/li&gt; 
&lt;li&gt;The lenders, depending on the terms of the platform, have to pay an administration fee and an additional fee if they choose to use any additional service (e.g. legal advice etc.), which the platform may provide.
&lt;/li&gt;&lt;li&gt;The platform provides the service of collecting loan repayments and doing preliminary assessment on the borrower’s creditworthiness.&lt;/li&gt;
&lt;li&gt;The regulatory concerns in such cases would relate to KYC and recovery practices. Since all payments are through bank accounts, the KYC exercise can be deemed to have been carried out by the banks concerned. The platform facilitates collection of post-dated cheques from the borrower in the name of the lender as a proxy for repayment of the loan.&lt;/li&gt;
&lt;li&gt;The platform does NOT profit from the difference in the deposit and the loan rates, as is the case with Banking Financial Institutions.&lt;/li&gt;
&lt;li&gt;In summary, while crowd funding - equity, debt based and fund based- would fall under the purview of capital markets regulator (SEBI), P2P lending would fall within the domain of the RBI.&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2 id="4"&gt;4. Types of Regulatory Regimes for P2P Lending Companies across the World&lt;/h2&gt;
&lt;ul&gt;&lt;li&gt;&lt;strong&gt;Complete Exemption / Non-regulation due to Lack of Definition:&lt;/strong&gt; Regulations already in place to be applicable which protect the borrowers from unfair interest rates, unfair credit provision, and false advertising. Hence no further, or specific, regulation is undertaken.&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Intermediary Regulation:&lt;/strong&gt; Registration required as an intermediary to enable it to access the market. Other rules and requirements determine how the platform should conduct its business (for example, the licensing needed to provide credit and/or financial services).&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Banking Regulation:&lt;/strong&gt; To be applicable due to their credit intermediation functions. As such, the platforms must obtain a banking licence; fulfil disclosure requirements and other such regulations.&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;US Model:&lt;/strong&gt; Involves two levels of regulation, involving a central agency (SEC in this case) and state legislations.&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2 id="5"&gt;5. Arguments against Regulation&lt;/h2&gt;
&lt;p&gt;The presence of regulation would lend credibility to P2P lending, attracting lenders with low awareness to these platforms who may not understand the risks involved specially in the context of susceptibility of these platforms to attract high risk borrowers. Regulation may stifle the growth of an innovative, efficient and accessible avenue for borrowers who either do not have access to formal financial channels or are denied loans by them. The market for P2P lending, currently in a nascent stage does not pose an immediate systemic risk nor any significant impact on monetary policy transmission mechanism.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2 id="6"&gt;6. Arguments for Regulation&lt;/h2&gt;
&lt;ul&gt;&lt;li&gt;Considering the significance of the online industry and the impact which it can have on the traditional banking channels/NBFC sector, it would be prudent to regulate this emerging industry. Regulation would reduce its potential to disrupt the financial sector and throw surprises. As P2P lending promotes alternative forms of finance, where formal finance is unable to reach and also has the potential to soften the lending rates as a result of lower operational costs. Therefore, the importance of these methods of financing needs to be acknowledged. If the sector is left unregulated altogether, there is the risk of unhealthy practices being adopted by one or more players, which may have deleterious consequences.&lt;/li&gt;
&lt;li&gt;Section 45S of RBI Act prohibits an individual or a firm or an unincorporated association of individuals from accepting deposits, if his or its business wholly or partly includes any of the activities specified in clause (c) of section 45-I (i.e. activities of a financial institution); or if his or its principal business is that of receiving of deposits under any scheme or arrangement or in any other manner, or lending in any manner. Contravention of Section 45S is an offence punishable under section 58B (5A) of RBI Act. As per the Act, ‘‘deposit’’ includes and shall be deemed always to have included any receipt of money by way of deposit or loan or in any other form, but does not include any amount received from an individual or a firm or an association of individuals not being a body corporate, registered under any enactment relating to money lending which is for the time being in force in any State. Since the borrowers and lenders brought together by a P2P platform could fall within these prohibitions, absence of regulation may lead to perpetrating an illegality.&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2 id="6"&gt;7. Proposed Regulatory Framework&lt;/h2&gt;
&lt;p&gt;RBI concludes that a regulatory mechanism would facilitate the creation of an alternative avenue of credit. It proposes to bring the P2P lending platforms under the purview of RBI's regulation by defining P2P platforms as NBFCs under section 45I(f)(iii) of the RBI Act by issuing a notification in consultation with the Government of India. After the notification, RBI can issue directions under sections 45JA and 45L of RBI Act to such platforms regarding registration requirements and prudential norms. Below are the features of the proposed regulation.&lt;/p&gt;
&lt;h3 id="7-1"&gt;7.1. Permitted Activity&lt;/h3&gt;
&lt;p&gt;Considering the present stage of development, the platform could be registered only as an intermediary. i.e. the borrowing and the lending activity could not be reflected on the Balance Sheet. The platform will be required to ensure that section 45S of the RBI Act is not attracted by its activities. The platforms will be prohibited from giving any assured return either directly or indirectly. The platforms will be allowed to opine on the suitability of a lender and creditworthiness of a borrower. Adequate regulations on advertisements will also be put in place. It will also be mandated that funds will have to necessarily move directly from the lender’s bank account to the borrower’s bank account to obviate the threat of money laundering. The guidelines would also prohibit the platforms being used for any cross-border transaction in view of FEMA provisions relating to transactions between residents and non-residents.&lt;/p&gt;
&lt;h3 id="7-2"&gt;7.2. Prudential Requirements&lt;/h3&gt;
&lt;p&gt;The prudential requirements will include a minimum capital of Rs 2 crore. With a view to ensure that there is enough skin in the game at a later date, leverage ratio may be prescribed so that the platforms do not expand with indiscriminate leverage. Given that the lenders may include uninformed individuals, prudential limits on maximum contribution by a lender to a borrower/segment of activity could also be specified.&lt;/p&gt;
&lt;h3 id="7-3"&gt;7.3. Governance Requirements&lt;/h3&gt;
&lt;p&gt;The guidelines in this regard will include fit and proper criteria for promoters, directors and CEO. A reasonable proportion of board members having financial sector background could be suggested. The guidelines may also require the P2P lender to have a brick and mortar place of business in India. The management and operational personnel of the platform would need to be stationed within the country.&lt;/p&gt;
&lt;h3 id="7-4"&gt;7.4. Business Continuity Plan (BCP)&lt;/h3&gt;
&lt;p&gt;The platforms need to put in place adequate risk management systems for its smooth operations. BCP and back up for the data needs to be put in place since the platform also acts as a custodian of the agreements/cheques etc. In case of failure of the platform to continue its operations, it should have a ‘living will’ or alternative arrangement in the form of an agreement for continuation of its operations.&lt;/p&gt;
&lt;h3 id="7-5"&gt;7.5. Customer Interface&lt;/h3&gt;
&lt;p&gt;Most of the platforms operating in India provide a credit score for the borrowers using their customized algorithms. Confidentiality of the customer data and data security would be the responsibility of the Platform. Transparency in operations, adequate measures for data confidentiality and minimum disclosures to borrowers and lenders would also be mandated through a fair practices code. The current regulations applicable to other NBFCs will be made applicable to the P2P platforms in regard to recovery practice. The operators would also be mandated to have a proper grievance redress mechanism to deal with complaints from both lenders and borrowers and require reporting to the Board.&lt;/p&gt;
&lt;h3 id="7-6"&gt;7.6. Reporting Requirements&lt;/h3&gt;
&lt;p&gt;In order to assist monitoring, the platforms will need to submit regular reports on their financial position, loans arranged each quarter, complaints etc. to the Reserve Bank. The Bank may come out with a detailed reporting requirement.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2 id="8"&gt;8. Scope of RBI's Regulation&lt;/h2&gt;
&lt;p&gt;It may be noted here that RBI has powers to regulate entities which are in the form of companies or cooperative societies. However, if the P2P platforms are run by individuals, proprietorship, partnership or Limited Liability Partnerships, it would not fall under the purview of RBI. Hence, it is essential that P2P platforms adopt company structure. The notification can therefore specify that no entity other than a company can undertake this activity. This will render such services provided under any other organisational structure illegal. Alternatively, the other forms of structure may be regulated by the State Governments.&lt;/p&gt;
&lt;p&gt;Comments are sought on following aspects of this discussion paper:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;Whether there is a felt need for regulating P2P lending platforms?&lt;/li&gt;
&lt;li&gt;Is the assessment of P2P lending and risks associated with it adequate?&lt;/li&gt;
&lt;li&gt;Are there any other risks which ought to be addressed?&lt;/li&gt;
&lt;li&gt;Is the proposed approach to regulating these platforms adequate?&lt;/li&gt;

    <title>Digital Humanities in India?</title>

&lt;h2&gt;Background&lt;/h2&gt;
&lt;p&gt;It has only been a couple of years since I began hearing the term Digital Humanities (henceforth, DH) being uttered quite prominently, though mostly in academic circles. For the uninitiated, it almost sounds like an oxymoron. After all, for most practical purposes the digital and humanities have always been seen almost as contradictory terms, existing in distinct silos.  A couple of workshops and conferences, one national-level consultation, three new centres, and two academic courses later the term still needs a definition in India, if not also in other parts of the world. But what was by then, and even now, is interesting is the emergence of pockets of work in India either claiming to be DH or even remotely related to it, and the interest in the term, either as one full of a seemingly diverse, innovative, and generative potential for interdisciplinary work in academia and practice, or as something that is just a reinvention of old questions that have been the focus of humanistic enquiry for several decades now.&lt;/p&gt;
&lt;p&gt;The enquiry for this mapping began with the term itself, as a 'found' name for which I needed to excavate some meaning, context and location in India at the present moment. A consultation on Digital Humanities for Indian Higher Education organised in Bangalore in July 2013 &lt;strong&gt;[1]&lt;/strong&gt; and a proposed short course in ‘Digital Humanities and Cultural Informatics’ &lt;strong&gt;[2]&lt;/strong&gt; at Jadavpur University, Kolkata, were some of the early prominent instances of the use of the term. I later learnt from one of the people interviewed for this study that DH was already discussed in academic workshops as early as 2010 &lt;strong&gt;[3]&lt;/strong&gt;. The general interest in the term has steadily picked up in the last couple of years however, albeit in specific pockets of the country, and it would be safe to say that it has been approached in markedly different ways by several institutions.&lt;/p&gt;
&lt;p&gt;The source of the term itself is the history and body of literature around humanities computing in the UK and US, which essentially explores the use of computational methods in humanities research and practice. Roberto A. Busa (2010) describes it as “… precisely the automation of every possible analysis of human expression (therefore, it is exquisitely a "humanistic" activity), in the widest sense of the word, from music to the theater, from design and painting to phonetics, but whose nucleus remains the discourse of written texts”. However, locating such a history in India seems not only to be a difficult project, but largely a futile one. It seemed irrelevant to import a concept or discourse that in itself was (and still is to some extent) relatively unstable and undefined even in the Anglo-American context, and then try to locate it here. Instead, what I chose to do was to take a few steps back - firstly to outline a couple of questions/conflicts that seemed to be troubling about this concept to begin with:&lt;/p&gt;
&lt;ol&gt;
&lt;li&gt;Are ‘digital’ and ‘humanities’ really two contradictory terms that are being bridged together?  Is this a reiteration of the ‘two cultures’ (Snow 1990) debate?&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;What are the changes in the object(s) of enquiry in humanities disciplines due to the advent of the internet and digital technologies?&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;What methods are to be used to study and work with digital objects? How are these affecting the traditional methods of the humanities?&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;  
&lt;li&gt;Is DH a fringe academic phenomena, and can it be related to academic disciplines only? With several groups of practitioners engaging with questions and methods akin to DH outside universities, how do we define its institutional boundaries?&lt;br /&gt;&lt;br /&gt;&lt;/li&gt; 
&lt;li&gt;What are the new skills and tools emerging with, and in turn defining, DH practices in India?&lt;/li&gt;&lt;/ol&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;Context&lt;/h2&gt;
&lt;p&gt;An immediate context for the growth of DH has been the steady debate around a ‘crisis’ of the disciplines, the humanities in particular, and how DH in a strange paradox, seemed to be both the phenomenon posing this question and offering an answer to it. Particularly in the Anglo-American context, while there has been a sustained decline in funding for the arts, especially post the global recession in the late 1990s, the Science, Technology, Engineering and Math (STEM) and other disciplines in natural sciences still seem to be on a steady footing. The ‘crisis’ here exists here at several levels - budgetary cuts across universities for liberal arts and humanities programmes, a steep fall in gainful employment for graduates (whose numbers are much more than the jobs available in the market, the adjunct system that has become popular in the US, which has resulted in reduced full-time employment and poor compensation for faculty, and in general a lack of opportunities and resources for research in the arts and humanities. The problem however, of which these are only the symptoms, lies much deeper, at the heart of what is seen as the lack of interest due to the diminishing practical value of the humanities, which further makes them seem most dispensable in a moment of economic crisis. Martha Nussbaum calls this a ‘silent crisis’, spurred by the growth of a profit-driven model of education, which has led to an increased focus on science and technology programmes, and emphasized the fostering of certain specific skills in these domains much to the detriment of arts and humanities programmes at every level of formal education, thus also doing away with “cultivated capacities of critical thinking and reflection, which are crucial in keeping democracies alive and wide awake.”&lt;/p&gt;
&lt;p&gt;Gary Gutting on the other hand sees this definition of crisis in terms of numbers itself as misleading, but proposes that this decline also as a result of a cultural and economic system that is inhospitable to the humanities in general, and the ‘cultural middle class’ in particular. He writes:&lt;/p&gt;
&lt;blockquote&gt;Our economic system works well for those who find meaning in economic competition and the material rewards it brings. To a lesser but still significant extent, our system provides meaningful work in service professions (like health and social work) for those fulfilled by helping people in great need. But for those with humanistic and artistic life interests, our economic system has almost nothing to offer. Or rather, it has a great deal to offer but only for a privileged elite (the cultural parallel to our economic upper class) who have had the ability and luck to reach the highest levels of humanistic achievement. If you have (in Pierre Bourdieu’s useful term) the “cultural capital” to gain a tenured professorship at a university, play regularly in a major symphony orchestra or write mega bestsellers, you can earn an excellent living doing what you love. Short of that, you must pursue your passion on the side. (Gutting 2013)&lt;/blockquote&gt;
&lt;p&gt;Paul Jay and Gerald Graff locate the problem within the notion of the humanities as being inherently averse to a market-driven, utilitarian form of education, which emphasises only credentials, thus rendering the field esoteric and lacking when it comes to solving problems in the ‘real world’. Instead they favour the approach of humanities students developing diverse skill sets, in addition to traditional skills of their disciplines, and being open to engage with opportunities in the larger marketplace outside of academy as well. As the essay states:&lt;/p&gt;
&lt;blockquote&gt;We believe it is time to stop the ritualized lamentation over the crisis in the humanities and get on with the task of making them relevant in the 21st century.  Such lamentation only reveals the inability of many humanists to break free of a 19th-century vision of education that sees the humanities as an escape from the world of business and science. As Cathy Davidson has forcefully argued in her new book, Now You See It, this outmoded way of thinking about the humanities as a realm of high-minded cultivation and pleasure in which students contemplate the meaning of life is a relic of the industrial revolution with its crude dualism of lofty spiritual art vs. mechanized smoking factories, a way of thinking that will serve students poorly in meeting the challenges of the 21st century. (Jay and Duff 2002)&lt;/blockquote&gt;
&lt;p&gt;While many of the traditional humanities scholars may still look at this as the result of a certain techno capitalistic impulse - wherein a new research regime based on knowledge creation to fulfil corporate interests emerges – it is prudent to examine how and why fields like the digital humanities have now emerged around the time of such a crisis, as they seemingly fit well within this nebulous space, and what are their implications for the humanities, education and research at large.&lt;/p&gt;
&lt;p&gt;In the India, the context is a rather chequered one – with most conversations around the internet and digital technologies located within the domain of the development of Information and Communication technologies for Development (ICT4D), in sectors ranging from education to governance. The introduction to the digital has been in multifarious ways for countries in the global south, largely through rhetoric about its potential to address and even resolve social and economic problems, so much so that, as several of the people interviewed in this study also mentioned, now anything digital automatically translates to ‘good’ and ‘beneficial’. Addressing the digital divide has been a mandate of all stakeholders, whether the state and policy-makers, private organisations, NGOs or academia. With around 300 million internet users and counting, India has the second largest internet user base in the world. However, the conditions and quality of access to the internet and other digital technologies, and who is using these and for what purposes continue to remain a bone of contention. The ambitious Digital India initiative of the current government is the latest in a slew of measures undertaken to address some of these concerns in the last several years, and it proposes to do so by tackling three key areas – digital infrastructure, governance and services on demand, and empowerment of citizens through increased digital literacy &lt;strong&gt;[4]&lt;/strong&gt;. As such it seeks to resolve some of the challenges of last mile connectivity that have forever been an issue with many ICT4D initiatives, particularly with countries in the Global South. The advent of a techno-democracy or a model of governance that successfully integrates technology within a framework of rights and social development seems to be larger vision of these proposed initiatives.&lt;/p&gt;
&lt;p&gt;The ICT-fication of education has been a major objective and challenge within this larger vision, specifically with respect to the problem of access, and more importantly quality of access which stands out as pertinent, again a problem attributed to the lack of last mile connectivity. In 2009, the MHRD launched the ambitious National Mission in Education and Information and Communication Technologies (NMEICT) programme &lt;strong&gt;[5]&lt;/strong&gt;, which along with the National Commission for Higher Education and Research (NCHER) Bill &lt;strong&gt;[6]&lt;/strong&gt; and the recommendations of the Yashpal Committee report &lt;strong&gt;[7]&lt;/strong&gt;, was expected to address some long-standing concerns in making higher education more accessible and hospitable to students, particularly those from underprivileged backgrounds. Ashish Rajadhyaksha (2011) argues that the last-mile problem is a more of a conceptual or cultural problem than merely a technological one. This is illustrated in the manner of implementation of several projects under the NMEICT, particularly in the imagination, as Rajadhyaksha says, of technology as neutral and therefore capable of addressing issues of democratisation within higher education.&lt;/p&gt;
&lt;p&gt;Following the NMEICT, several initiatives such as the National Programme on Technology Enhanced Learning (NPTEL) &lt;strong&gt;[8]&lt;/strong&gt; programme, and the use of low-cost devices such as the Aakash tablets &lt;strong&gt;[9]&lt;/strong&gt; were also field tested to get a better understanding of how digital technologies could be integrated seamlessly into classroom instruction. The Indira Gandhi National Open University (IGNOU) &lt;strong&gt;[10]&lt;/strong&gt; and Information and Library Network (INFLIBNET) &lt;strong&gt;[11]&lt;/strong&gt;, and more recently the National Knowledge Network (NKN) &lt;strong&gt;[12]&lt;/strong&gt; are some of the more established efforts in distance education and open courseware. Digitisation initiatives were also launched on a large scale in the last decade, some notable ones being National Mission for Manuscripts &lt;strong&gt;[13]&lt;/strong&gt;, Digital Library of India &lt;strong&gt;[14]&lt;/strong&gt;, and National Library of India &lt;strong&gt;[15]&lt;/strong&gt;, among many others. There is also a growing number of closed/commercial archives, some examples being the South Asia Archive &lt;strong&gt;[16]&lt;/strong&gt; and Asia Art Archive &lt;strong&gt;[17]&lt;/strong&gt;.  Digitisation, while being taken up in the interest of preservation and record, also brought with it a number of challenges, particularly with respect to the manner in which the projects were implemented. Whether with regard to preservation of the original material, problems with copyright or defining metadata standards, digitisation has never been an easy process. The Google Books library project is an example of this, where many books were damaged and had to be discarded in the process of digitisation, and the project itself came under criticism for several copyright violations, errors produced due to conversion of scanned texts using Optical Character Recognition (OCR) software and incorrect or unavailable metadata.&lt;/p&gt;
&lt;p&gt;The move towards digitisation also provided the much needed impetus for archival practice to make a transition to the digital space, this has been an inevitable but rather fraught endeavour to begin with, as some of the observations made in the later chapters will illustrate. The emergence of independent, private online archives, often seen as a fallout of the hegemony of state-funded archives is an important development of this time. An influx of funding from government and private donors, has led to a lot of work in media and communication technologies getting concentrated in so-called ‘alternative’ spaces outside the university. The growth of these in between spaces has been an interesting phenomenon, particularly with respect to the possibilities offered for different kinds of research and other creative practices that are often unable to find a space within the confines of a university or other large, established knowledge institutions.&lt;/p&gt;
&lt;p&gt;In the last decade or so, DH seems to have become one of the most highly funded areas in humanities research and practice. While this has seemingly helped to either save and/or reinvent some the humanities programmes, a lot of traditional humanists also view the field and the term with scepticism – as a threat to more traditional forms of humanities pedagogy and practice. Whether such a context exists in India and is still a matter of question, and hinges largely on how we understand the digital itself - as an object, concept or space. For that seems to be where the questions about the field, its emergence and its epistemological concerns lie.&lt;/p&gt;
&lt;p&gt;This report, therefore, takes a slightly broader look, somewhat like a scoping exercise to see what some present concerns are and what could be the possibilities of DH in India. The areas of focus are few – the notion of crisis, and disciplines, the archive and so forth which form the crux of the debate in India. It also looks at changes that have come about, and are imminent with the ‘digital turn’, from the perspective of selected disciplines, and practices of knowledge-making. More importantly, it tries to extrapolate, from the common issues and conflicts traced across several conversations, larger questions of a conflict of authority that disciplines in the humanities have come to undergo, and whether the digital has amplified of tried to resolve the same. The conflict is tied to questions of ownership/authorship and authenticity that emerge with new collaborative modes of knowledge production, and the politics of circulation. It is reflected in the shift from more traditional spaces of knowledge-making to newer methods, objects, figures and processes in the online world, which seem to at one level replace older ones. This perceived threat of irrelevance or obsolescence is one of the manifestations of this conflict of authority. The Wikipedia is one example of this conflict, wherein the authenticity and authority of its content and recognition as scholarship has been intensely debated owing to, among other things, the fact that it cannot be attributed to any single author. In the ways in which the digital now mediates such activities, what has become the space and understanding of the digital in our lives, in the ways we consume and produce information and knowledge, and increasingly become uneven stakeholders in a dynamic knowledge economy, are some of the questions explored therein.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;Methodology&lt;/h2&gt;
&lt;p&gt;With few 'digital humanists' (a term many DH scholars in India have consciously chosen to stay away from) and DH centres around, and the discourse being far from stable in India, the best way to explore this supposedly new phenomenon then seemed to be to understand some of the immediate problems and questions with the notion of the ‘digital’ itself. This approach was not just the result of constraints of the immediate context, but also turned out to be a productive methodological gesture, as it widened the scope of this mapping exercise to include several proto/perhaps-DH initiatives that have come up around the same time, or been in existence for a while and have been trying to work around similar questions. The mapping did not begin with an assumption of a field called DH as being extant in India, and therefore as an examination of its challenges and possibilities, but rather to understand how DH-like practices have evolved and converged at the moment under what appears to be like a place-holder term, and the implications of this for research and learning. Being located in India, it also provided a good vantage point to reflect on some of the literature and discourse around the term being produced in the Anglo-American context. 
The consultation on Digital Humanities for Indian Higher Education held in July 2013 was helpful in bringing together a number of people and key questions of what was then understood as something of a field. It is largely from the discussions at this consultation that this report approaches the term and what it may offer for humanities and related interdisciplinary research in India; somewhere it also hopes to serve as a point of departure. A major concern then was the lack of a proper definition of the field, and its instability, which continued to be a recurrent topic in my discussions with people as part of this exercise. However, the merits of embarking upon an exercise to ‘define DH in India’ were highly contentious, so the mapping took a more descriptive route, and did a discursive analysis of work in DH and allied fields and what people were saying about it in India. What I found were a range of views, some informed by practice and scholarship, others based on conjecture and some purely non-committal. As one of the people interviewed for this mapping pointed out, there is something provisional about which, if I may add, also inhibits us from saying anything definitive about it, just yet.&lt;/p&gt;
&lt;p&gt;Given that the lack of a definition of the field remained one of the main issues, I went into conducting the mapping with a working definition/assumption that DH ‘is an interdisciplinary area of research, practice and pedagogy that looks at the interaction of digital tools, methods and spaces with core concerns of humanistic enquiry’. This definition was developed based on a review of existing literature in the Anglo-American context on DH, and deliberately made expansive enough to include within its fold, the different kinds of practices that had already chosen to adopt the term, and others which seemed to be inclined towards similar theoretical and practical concerns. Another useful definition, from the Digital Humanities Quarterly useful was the following:&lt;/p&gt;
&lt;blockquote&gt;Digital humanities is a diverse and still emerging field that encompasses the practice of humanities research in and through information technology, and the exploration of how the humanities may evolve through their engagement with technology, media, and computational methods. (Digital Humanities Quarterly 2010)&lt;/blockquote&gt;
&lt;p&gt;Deliberating on the interaction between humanities and technology, Susan Schreibman, in one the earliest books on DH describes the 'field' as follows:&lt;/p&gt;
&lt;blockquote&gt;The digital humanities, then, and their interdisciplinary core found in the field of humanities computing, have a long and dynamic history best illustrated by examination of the locations at which specific disciplinary practices intersect with computation. (Schreibman et al 2004)&lt;/blockquote&gt;
&lt;p&gt;One of the popular and most quoted definitions, however, is an early one that appeared in the Digital Humanities Manifesto 2.0 (Institute for the Future of the Book 2009). This describes DH as &lt;em&gt;an array of convergent practices&lt;/em&gt;, and is also reproduced in the book &lt;em&gt;Digital Humanities&lt;/em&gt; (Burdick et al 2012):&lt;/p&gt;
&lt;blockquote&gt;Digital Humanities refers to new modes of scholarship and institutional units for collaborative, transdisciplinary, and computationally engaged research, teaching, and publication. Digital Humanities is less a unified field than an array of convergent practices that explore a universe in which print is no longer the primary medium in which knowledge is produced and disseminated. (Ibid., 122)&lt;/blockquote&gt;
&lt;p&gt;The notion that DH is a “less a unified field than an array of convergent practices” seems to be the most useful way to describe the observations and more so the conditions that led to this mapping exercise, which also seeks to outline some kind of a trajectory of practices that converge at this contemporary moment to engender new meanings of and around the digital, rather than produce a conceptual history of the term in the Indian context or even imagine an extant field of some sort.  This notion of a convergence, as stated in the last definition, although not apparent or expressed by anyone in India, seems to be the best possible way to describe the manner in which certain practices and a discourse has grown around the intersection of humanities and digital technologies in India. This rather organic growth of DH projects, practices and coursework in the absence of a meta-theory that would drive its epistemological concerns is an important conceptual question for the field itself, and a challenge for the study. Thus while the broader conversation around DH spans everything from instructional technology, new media and art practices, integrated science education to cultural analytics, the core concerns often remain the same, that of the intersection of previously separate domains of knowledge that are now coming together, and the crucial role played by the internet and digital technologies in bringing them together.&lt;/p&gt;
&lt;p&gt;Further, three immediate experiences in engaging with digital technologies and questions of knowledge production in India shaped the intellectual concerns of this study. The first of these is the series of monographs produced as part of the ‘Histories of Internets in India’ project at the Researchers at Work (RAW) programme in CIS, during 2008-2011. A key point foregrounded in these monographs was the critical need to approach the internet, as a plural technology, available in and actualised through different forms, practices, and experiences. The second one was the collaborative project on the quality of access to higher education in undergraduate educational institutions at the Higher Education Innovation and Research Applications programme at the Centre for the Study of Culture and Society, Bangalore.The project was conducted in nine undergraduate institutions across three states in India, and included interaction with students and teachers through workshops and campus projects.The experience of working with students – who ranged from those who could barely use a computer to students proficient with the latest software, multimedia tools and internet applications – led to many insightful learnings about the teaching-learning environment, and prevalence of digital technologies and the internet in these spaces. The third one, of course, is the consultation on DH held in Bangalore, which provided an immediate set of questions and a network of people to begin the mapping with.&lt;/p&gt;
&lt;p&gt;In this study, the fieldwork consisted of in-depth and semi-structured interviews with key people involved in the DH-like initiatives in India, and allied areas such as media, archives, art, and higher education. The sample size being small, the conversations were by no means exhaustive, but they were insightful in terms of the present nature of practice and the questions that they further pointed towards. The interviews were largely open-ended conversations focussing on, where possible, questions about DH: its emergence, theory, practice and pedagogy, but emphasising the notion of the ‘digital’ and is diverse perception and formulations. With respondents who were not from an academic space or not involved with DH directly, the questions were more related to the nature of changes that the digital has brought about in their practice, specifically the shifts in content and method. The crisis of disciplines and the move away from more traditional concerns of humanistic enquiry were also discussed. Issues of access, exclusivity and the move towards collaborative spaces of knowledge production and the democratic potential of the internet and digital technologies also came up quite prominently as points of discussion.&lt;/p&gt;
&lt;p&gt;The fieldwork tried to cover not just a range of people from different disciplines and areas of practice, but also institutions: Prof. Amlan Dasgupta, Prof. Sukanta Chaudhuri and Purbasha Auddy, (School of Cultural Texts and Records and Dept. of English), Dr. Moinak Biswas and Dr. Madhuja Mukherjee (Media lab and Dept. of Film Studies); Dr. Abhijit Roy (School of Communication and Culture) at Jadavpur University, Kolkata; Dr. Souvik Mukherjee (Dept. of English) and Dr. Milinda Banerjee (Dept. of History) at Presidency University, Kolkata; Abhijit Bhattacharya (Media Archives) at Centre for the Studies in Social Sciences, Kolkata; Dr. Ravi Sundaram (the Sarai Programme) at Centre for the Study of Developing Societies, New Delhi; Dr. Indira Chowdhury and Dr. Padmini Ray-Murray (Centre for Public History) at Srishti School of Art, Design and Technology, Bangalore; Dr. C. S Lakshmi at the Sound and Picture Archives for Research on Women, Mumbai; Shaina Anand, Namita Malhotra, Lawrence Liang, Jan Gerber, Sebastian Lutgert and Ashish Rajadhyaksha, who have all worked with CAMP, Mumbai and are part of the team behind Indiancine.ma and Pad.ma; Vikram Vincent at the Indian Institute of Technology, Mumbai and S.V. Srinivas, Azim Premji University, who was previously associated with the Centre for the Study of Culture and Society. The individuals and institutions mentioned here have been engaged with these concerns within their respective fields of research and practice. Three institutions - Jadavpur University, Presidency University and the Centre for Public History – have actively adopted the term DH for some of the work they have been doing, whereas the remaining have been working with digital technologies as part of research, pedagogy, and practice. The report presents some part of these conversations and in doing so provides a snapshot of the operational context of the term ‘DH’ in India as well. The attempt was to understand the nature of existing and possible institutional investment in the term, as well as digital technologies (beyond tools, platforms and processes) and their stake in taking these questions further.&lt;/p&gt;

    <title>Know your Users, Match their Needs!</title>

        &lt;b&gt;As Free Access to Law initiatives in the Global South enter into a new stage of maturity, they must be certain not to lose sight of their users’ needs. The following post gives a summary of the “Good Practices Handbook”, a research output of the collaborative project Free Access to Law — Is it Here to Stay? undertaken by LexUM (Canada) and the South African Legal Institute in partnership with the Centre for Internet and Society.&lt;/b&gt;
        
&lt;p&gt;&lt;/p&gt;
&lt;p&gt;Almost ten years have passed since the Montreal Declaration on
Free Access to Law (FAL) was signed by eight legal information institutes and other
FAL initiatives. Today, the Free Access to Law Movement (FALM) is growing with over 30 initiatives having signed onto the Declaration and providing free, online
access to legal information. While the movement continues to gain momentum, the
big question no longer remains &lt;em&gt;why&lt;/em&gt; we need
free access to law, but instead &lt;em&gt;how&lt;/em&gt; FAL initiatives can continue to do so sustainably in the long-term. The principles of access
and justice underpinning the FALM have been well-argued and few would dispute the
notion that citizens ought to have access to the laws under which they are
governed. As the Montreal Declaration states: "Public legal information from
all countries and international institutions is part of the common heritage of
humanity…Maximizing access to his information promotes justice and the rule of
law" (2002).&lt;/p&gt;
&lt;p&gt;Regardless of legal system or political context, the
importance of securing free online access to the law has been recognized from a
variety of perspectives. Whether FAL is considered a critical democratic
function or simply an essential efficiency within any legal system, it is
difficult to contest that the internet has increased the accessibility of and
ease with which legal information is being published and shared online. Setting
the ideological and practical foundations of the movement aside, effectively
demonstrating the impact of FAL initiatives and to secure their sustainability in
the long-term remains the next big challenge for the FALM. Today, there is a
growing necessity for grounded and realistic indicators that can validate some
of the long-held assumptions around the impacts and outcomes of FAL initiatives.
Furthermore, and perhaps more importantly, there is also a need for a more
nuanced understanding of the factors that influence the sustainability of FAL
initiatives— particularly in resource-scarce and often nebulous legal systems of
the Global South.&lt;/p&gt;
&lt;p&gt;This blog post provides some insight into the questions
above through a brief summary of the results of the study &lt;a class="external-link" href="http://crdi.org/ar/ev-139395-201-1-DO_TOPIC.html"&gt;Free Access to Law—Is
it Here to Stay?&lt;/a&gt; This global comparative study was carried out by LexUM (Canada)
and the South African Legal Institute in partnership with the Centre for
Internet and Society. The project set out to begin providing answers to some of
these critical questions around the impacts and sustainability of the FALM. It
was initially hypothesized in the study that the sustainability of a FAL
initiative rests upon a particular string of contingent factors. To begin, a particular
condition would incentivize the creation of the FAL initiative — more often than
not meeting the unmet needs of those requiring access to legal information.&amp;nbsp; Next, if the FAL initiative is able to provide
the service within a favourable context, it was suspected that it would produce
favourable outcomes for both users and society at large. In turn, if the FAL
initiative was able to provide benefits to users, it was theorized that these benefits
would then stimulate reinvestment into the FAL initiative — forming a positive
and sustainable feedback loop.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;As the &lt;a class="external-link" href="http://www.informationjuridique.ca/docs/a2k/Best%20Practices%20Hand%20Book_03sept11.pdf"&gt;Good Practices Handbook&lt;/a&gt; highlights, the research
hypothesis provided an accurate reading of what the sustainability chain of a
FAL initiative might look like in&lt;em&gt; practice&lt;/em&gt;.
If unable to keep up with the evolving information requirements of their users,
this study suggests that FAL initiatives run the risk of FAL becoming outdated
and even outperformed by either government-based or private sector
initiatives.&amp;nbsp; This is why FAL initiatives
must continue to be innovative and find new ways to meet users’ needs. Approaches take my include keeping their
collections up to date, fine-tuning their services or even reinventing
themselves through the provision of value-added services. Gathered from the
experiences of the eleven countries across Africa and Asia examined in this
study, the following is a brief summary of the nine “Good Practices” that emerging
FAL initiatives can consider:&lt;/p&gt;
&lt;ol&gt;&lt;li&gt;&lt;strong&gt;The FAL initiative
should establish clear objectives&lt;/strong&gt;: Before doing anything, the FAL initiative
should decide what exactly it’s setting out to do…critical components such as
content selection, targeted audience, expected reach, search functionalities
and other website features help determine priorities and evaluate capacity to
achieve these objectives.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;How to be small and
do big things&lt;/strong&gt;: Most of the FAL initiatives studied as part of this project
were formed of small teams (often less than five individuals). Initially, this may
appear to pose a risk for sustainability. However, we saw a number of ways in
which small teams have proven to be innovative, flexible, and able to thrive in
environments of scarcity. However, as much as small teams can be seen as a
source of innovation, they may also pose a risk in the medium to long-term.&amp;nbsp;&lt;/li&gt;&lt;li&gt;&lt;strong&gt;FAL initiatives
require expertise in both IT and legal information&lt;/strong&gt;: Legal information management
experts understand how the law is applied, how different texts and parts of
texts speak to one another, and how these documents are used. IT experts can
imagine a variety of ways to address these needs. If both forms of expertise is
not available within the team of a FAL initiative, institutional partnerships
provide promising sites for collaborative support. For example, the FALM
constitutes a rich source of expertise and has proven to be a site of
collaboration between established and emerging FAL initiatives. Further,
universities have proven to be a significant source of human and financial
resources for several FAL initiatives.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;FAL initiatives
should look to where they are headed (but not too far ahead)&lt;/strong&gt;: Because the
purpose of a FAL initiative is to provide free online access to the law, it
must secure access to this data for regular publication. How will legal
information be received and organized by the initiative? In what format will it
be published in? Early on, FAL initiatives need to develop both internal and
external workflow processes to ensure that the initiative is able to provide regular
access to updated information. Furthermore, an important finding of the study
suggests that context plays a much larger role in a project’s sustainability. Consideration
should be given to a country’s ICT infrastructure, the transparency of a
government and their access to information regimes, and the nature of the legal
information market when designing the workflows of an FAL initiative.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;FAL initiatives
should work with the ICT infrastructure in place&lt;/strong&gt;: The quality and
consistency of internet access varies across countries in the Global South. FAL
initiatives should remain aware of how stakeholders and users are accessing the
internet and develop their service accordingly. Considering the often
intermittent nature of internet connectivity in the Global South, providing
users with offline access to databases is a practical alternative.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;FAL initiatives
should use Free and Open Source Software&lt;/strong&gt;: FAL initiatives should maximise
their use of FLOSS. All FAL initiatives use FLOSS to some extent and without
these flexible and cost-effective alternatives, it would be safe to infer that
the FALM would have grown as quickly as it has.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;FAL initiatives
should be sensitive to culture&lt;/strong&gt;: FAL initiatives rely on stakeholders and
communities of users. Staying mindful of the professional and organizational
cultures within a country may provide the initiative with a source of community
support which may become a sustainability strategy.&amp;nbsp; Further, integrated or parallel social
networking platforms can play an essential role in community-building around
the FAL initiatives and can also serve as another source of content in
resource-scarce environments.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Find your users,
match their needs&lt;/strong&gt;: Project goals and appropriate strategies should be based
on an in-depth understanding of the needs of those using the FAL initiative. As
the sustainability chain suggests, when FAL initiatives produce positive
outputs and outcomes, stakeholders will reinvest in the initiative to ensure
its sustainability. If a user’s needs are effectively met by an FAL initiative,
this group can provide either the resources or impetus for its continued
success. Identifying who your users are and staying aware of their needs is a
good way to secure reinvestment into the project.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;FAL initiatives
should diversify funding sources&lt;/strong&gt;: This may be easier said than
done — reinvestment can be the most challenging aspect of sustaining a FAL
initiative. Early on, initiatives that receive donor-based funding benefit
substantially upon investment. However, these initiatives are put at
significant risk once initial seed funding has been depleted. Similarly, FAL
initiatives that partnerships with other during their start up phase face
similar fates as securing long-term service delivery can become a challenge.
Possible funding sources included throughout the study include, among others:
government, international development agencies or NGOs, the judiciary, law
societies and the sale of value-added services.&lt;/li&gt;&lt;/ol&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;In addition to these good practices, this study has emphasized
the role the that the FALM has played in helping redefine online legal information as a public good. Each
of the case studies demonstrates in a unique way the value openness plays in a
legal information ecosystem, and how a robust digital legal information commons can be of
benefit to users. Traditionally, the legal information market has been dominated by a select
number of commercial players. In response, the FALM has created an important
transnational space within which conversations around the provision of and
access to legal information as a political right &lt;em&gt;rather&lt;/em&gt; than a commodity to be bought and sold
can take place. Encouragingly, governments in the Global South are catching and FAL initiatives from the South have proven to be immense sources of innovation in their own right. In Indonesia, for example, FAL initiatives have laid the
groundwork for emerging government initiatives that are now&amp;nbsp; prioritizing the provision of free, online access to legal and other government information. Today, I believe that we are witnessing an important paradigm
shift as governments are beginning to recognize that “access” to legal information is a
right to be held by the public.&lt;/p&gt;
&lt;p&gt;Despite such headway, it is needless to say that FAL initiatives in the Global South
continue to face immense sustainability challenges. However, it is hoped that this
study can provide some practical insights for emerging initiatives
and partnerships. However, as more FAL initiatives begin entering into the next
stage of maturity and growth, it is more important than ever that they are
able to adapt to adverse environmental changes and form
long-lasting partnerships with information sources within government. Most
importantly, FAL initiatives must remain dynamic and responsive to users’
needs. To do so, they must be able to tailor and expand their services, offerings
and user-base. To secure their sustainability and relevance in the long term, they must also be continuously strengthening their ties and maintain open communication flows with
users. &amp;nbsp;If FAL initiatives are able to successfully make the
transition from being supply side initiatives to becoming demand driven services,
the FALM will be well-positioned for another decade of sustainable growth.&amp;nbsp;&lt;/p&gt;

&lt;p&gt;The Centre for Internet and Society (CIS), India, is an 11-year old non-profit organisation that undertakes interdisciplinary research on internet and digital technologies from policy and academic perspectives. Through its diverse initiatives, CIS explores, intervenes in, and advances contemporary discourse and regulatory practices around internet, technology, and society in India,and elsewhere. Current focus areas include cybersecurity, privacy, freedom of speech, labour and artificial intelligence. CIS has been taking efforts to mainstream gender across its programmes, as well as develop specifically gender-focused research using a feminist approach.&lt;/p&gt;

    <title>Is India's Digital Health System Foolproof?</title>

&lt;hr /&gt;
&lt;p&gt;Introduced in 2013 and subsequently updated in 2016, the Ministry of Health and Family Welfare (MHFW) published a document laying out the standards for electronic health records (EHRs). While there exist varying interpretations of what constitutes as EHRs, some of its characteristics include electronic medical records (EMRs) of individual patients, arrangement of these records in a time series, and inter-operable linkages of the EMRs across various healthcare settings (Häyrinen et al 2008; OECD 2013).&lt;/p&gt;
&lt;p&gt;To work effectively, EHRs are required to be highly interoperable so that they can facilitate exchange among health information systems (HIS) across participating hospitals. For this, the Integrated Health Information Platform (IHIP) is being developed so as to assimilate data from various registries across India and provide real-time information on health surveillance (Krishnamurthy 2018).&lt;/p&gt;
&lt;h3&gt;&lt;strong&gt;EHR Implementation: Unpacking the (Dis)incentive Structure&lt;/strong&gt;&lt;/h3&gt;
&lt;p&gt;As the implementation of EHR standards is voluntary, anecdotal evidence indicates that their uptake in the Indian healthcare sector has been very slow. Here, the opposition of the Indian Medical Association to the Clinical Establishments (Registration and Regulation) Act, 2010, resulting in nationwide protests and subsequent legal challenges to the act, is instructive. To start with, the act prescribes the minimum standards that have to be maintained by clinical establishments which are registered or seeking registration (itself mandatory to run a clinic under the act) &lt;strong&gt;[1]&lt;/strong&gt;. Further, Rule 9(ii) of the Clinical Establishments (Registration and Regulation) Rules, 2012, drafted under the act, requires clinical establishments to maintain EMRs or EHRs for every patient. However, with health being a state subject in India, the act has only been enforced in 11 states and all union territories except the National Capital Territory of Delhi (Jyoti 2018). The resistance to the act is largely due to protests by stakeholders from within the medical fraternity regarding its adverse impact on small- and medium-sized hospitals (Jyoti 2018).&lt;/p&gt;
&lt;h3&gt;&lt;strong&gt;Contextualising Clinicians' Inertia&lt;/strong&gt;&lt;/h3&gt;
&lt;p&gt;Another major impediment to the adoption of EHRs by health service providers is reluctance on the part of individual physicians to transition to an EHR system. This is because compliance with EHR standards requires physicians to input clinical notes themselves.&lt;/p&gt;
&lt;p&gt;Comparing the greater patient load faced by doctors in India vis-à-vis the United States (US), the chief medical officer of an EHR vendor in India estimates that the average Indian doctor sees about 40–60 patients a day, whereas in the US it may be around 18–20 patients (Kandhari 2017). This is suggestive of the wide disparity in the number of physicians per 1,000 citizens in both countries (World Bank nd). Given this, doctors in India tend to be more problem-oriented, time-strapped, and pay less attention to clinical notes (Kandhari 2017). Thus, clinicians will consider a system to be efficient only if the system reduces their documentation time, even if the time savings do not translate into better patient care (Allan and Englebright 2000). The inability of EHRs to help reduce documentation time deters clinicians from supporting their implementation (Poon et al 2004). Additionally, research done in the United States indicates that there is no evidence to suggest that an information system helps save time expended by clinicians on documentation (Daly et al 2002). Moreover, the use of an information system is stated to have had no impact on patient care, but doctors have acknowledged its use for research purposes (Holzemer and Henry 1992).&lt;/p&gt;
&lt;h3&gt;&lt;strong&gt;Prohibitive Costs of Implementation&lt;/strong&gt;&lt;/h3&gt;
&lt;p&gt;While national-level EHRs have been adopted globally, their distribution across countries is telling. In a survey published in 2016 by the World Health Organization, wealthier countries were over-represented, with two-thirds from the upper-middle-income group and roughly half from the high-income countries having introduced EHR systems. On the other hand, only a third of lower-middle-income countries and 15% of low-income countries reported having implemented EHRs (World Health Organization 2016). A major reason for the slow uptake of EHRs in poorer countries is likely to be funding as EHR implementation requires considerable investment, with most projects averaging several million dollars (US) (Kuperman and Gibson 2003). Although various funding models for EHR implementation are being utilised globally, it is unclear what model will be adopted in India to bring in private healthcare service providers within its ambit  (Healthcare Information and Management Systems Society 2007). This absence of funding direction for private actors poses to be a significant impediment in the integration of private databases with other public ones.&lt;/p&gt;
&lt;p&gt;In general, poorer countries are also more likely to have less developed infrastructure and health Information and Communication Technology (ICT) to support EHR systems. Besides this, they not only lack the capacity and human resources required to develop and maintain such complex systems (Tierney et al 2010; McGinn et al 2011), but training periods have also been found to be long and more costly than expected (Kovener et al 1997).&lt;/p&gt;
&lt;h3&gt;&lt;strong&gt;Socio-economic Exclusions and Cross-cultural Barriers&lt;/strong&gt;&lt;/h3&gt;
&lt;p&gt;There exists scant research investigating the existing use of EHRs in India, though preliminary work is being undertaken to assess EHR implementation in other developing countries (Tierney et al 2010; Fraser et al 2005). Even in the context of developed countries, where widespread adoption of EHRs has been gaining traction for some time now, very little data exists around implementation and efficacy in underserved regions and communities. This is further problematised as clinical information systems and user populations also vary in their characteristics and, for this reason, individual studies are unable to identify common trends that would predict EHR implementation success.&lt;/p&gt;
&lt;p&gt;Underserved settings may lack the infrastructure needed to support EHRs. The risk of exclusion already exists in parts such as difficulties inherent in delivering care to remote locations, barriers related to cross-cultural communication, and the pervasive problem of providing care in the setting of severe resource constraints. Equally important is the fact that health workers who already report significant existing impediments in their delivery of routine care in these settings do not necessarily see EHRs as being useful in catering to the specific needs of their patient population (Bach et al 2004). Moreover, experience with EHRs also reveals that there are cultural barriers to capturing accurate data (Miklin et al 2019). What this could mean is that stigma associated with the diagnosis of conditions such as HIV/AIDS or induced abortions will result in their under-reporting even within EHR systems.&lt;/p&gt;
&lt;h3&gt;&lt;strong&gt;Stick or Twist?&lt;/strong&gt;&lt;/h3&gt;
&lt;p&gt;Other modalities have been devised to nudge healthcare providers into adopting EHR standards voluntarily. The National Accreditation Board for Hospitals and Healthcare Providers (NABH), India, a constituent board of the Quality Council of India (a public–private initiative), has been reported to have incorporated the EHR standards within its accreditation matrix. NABH accreditation, considered an indicator of high quality patient care, is highly sought–after by hospitals in India in order to attract medical tourists as well as insurance companies: two prominent sources of income for hospitals (Kandhari 2017). Additionally, NABH accreditation is valid for a term of three years, thus requiring hospitals seeking to renew their accreditation to adopt EHR standards as well.&lt;/p&gt;
&lt;p&gt;Another commercial use of EHR has been in health insurance. The Federation of Indian Chambers of Commerce and Industry (FICCI) and the Insurance Regulatory and Development Authority (IRDAI) have both voiced their support for expediting the implementation of the EHR standards (EMR Standards Committee 2013). Both, the FICCI and IRDAI have placed emphasis on adopting EHRs, seeing it as a necessary move for formalising the health insurance industry (FICCI 2015). They have also had representation on the committee that sent recommendations to the MHFW on the first version of the EHR standards in 2013 (FICCI 2015). FICCI had additionally played a coordination role in having the recommendations framed for the 2013 EHR standards.&lt;/p&gt;
&lt;h3&gt;&lt;strong&gt;Fluid Data Objectives&lt;/strong&gt;&lt;/h3&gt;
&lt;p&gt;The push for EHR implementation is emblematic of a larger shift in the healthcare approach of the Indian state, that of an indirect targeting of demand-side financing by plugging data inefficiencies in health insurance.&lt;/p&gt;
&lt;p&gt;The draft National Health Policy (NHP), published in 2015, reflected the mandate of the Ministry of Health and Family Welfare to strengthen the public health system by creating a right to healthcare legislation and reaching a public spend of 2.5% of the gross domestic product by 2018. The final version of the NHP, published in 2017, however, codified a shift in healthcare policy by focusing on strategic purchasing of secondary and tertiary care services from the private sector and a publicly funded health insurance model.&lt;/p&gt;
&lt;p&gt;In line with the vision of the NHP 2017, in February 2018, the Union Minister for Finance and Corporate Affairs, Arun Jaitley, announced two major initiatives as a part of the government’s Ayushman Bharat programme (Ministry of Finance 2018). Administered under the aegis of the Ministry of Health and Family Welfare, these initiatives are intended to improve access to primary healthcare through the creation of 150,000 health and wellness centres as envisioned under the NHP 2017, and improve access to secondary and tertiary healthcare for over 100 million vulnerable families by providing insurance cover of up to ₹ 500,000 per family per year under the Pradhan Mantri–Rashtriya Swasthya Suraksha Mission/National Health Protection Scheme (PM–RSSM/NHPS) (Ministry of Health and Family Welfare 2018). The NHPS, modelled along the lines of the Affordable Care Act in the US, was later rebranded as the Pradhan Mantri–Jan Arogya Yojana (PM-JAY) at the time of its launch in September 2018. It is claimed to be the world’s largest government-funded healthcare programme and is intentioned to provide health insurance coverage for vulnerable sections in lieu of the Sustainable Development Goal-3 (National Health Authority nd).&lt;/p&gt;
&lt;p&gt;To enable the implementation of the Ayushman Bharat programme, the NITI Aayog then proposed the creation of a supply-side digital infrastructure called National Health Stack (NHS) (NITI Aayog 2018). As outlined in the consultation and strategy paper, the NHS is “built for NHPS, but beyond NHPS.” The NHS seeks to leverage the digitisation push through IndiaStack, which seeks to digitalise “any large-scale health insurance program, in particular, any government-funded health care programs.” The synergy is clear, with the NHPS scheme also aiming to be “cashless and paperless at public hospitals and empanelled private hospitals" (National Health Authority nd) &lt;strong&gt;[2]&lt;/strong&gt;.&lt;/p&gt;
&lt;p&gt;The NHS is also closely aligned with the NHP 2017, which draws attention to leveraging technologies such as big data analytics on data stored in universal registries. The Vision document for the NHS emphasises the fragmented nature of health data as an impediment to reducing inequities in healthcare provision. The NHS, then, also seeks to be the master repository of health data akin to the IHIP. By creating a base layer of registries containing information about various actors involved in the healthcare supply chain (providers such as hospitals, beneficiaries, doctors, insurers and Accredited Social Health Activists), it potentially allows for recording of data from both public and private sector entities, plugging a significant gap in the coverage of the HIS currently implemented in India. With the provision of open, pullable APIs, the NHS also shares the motivations of the IndiaStack to monetise health data.&lt;/p&gt;
&lt;p&gt;A key component of the proposed NHS is the Coverage and Claims platform, which the vision document describes as “provid[ing] the building blocks required to implement any large-scale health insurance program, in particular, any government-funded healthcare programs. This platform has the transformative vision of enabling both public and private actors to implement insurance schemes in an automated, data-driven manner through open APIs " (NITI Aayog2018). A post on the iSPIRT website further explains the centrality of this Coverage and Claims platform in enabling a highly personalised medical insurance market in India: “This component will not only bring down the cost of processing a claim but ... increased access to information about an individual’s health and claims history ... will also enable the creation of personalised, sachet-sized insurance policies." These data-driven customised insurance policies are expected to generate “care policies that are not only personalized in nature but that also incentivize good healthcare practices amongst consumers and providers … [and] use of techniques from microeconomics to manage incentives for care providers, and those from behavioural economics to incentivise consumers" (Productnation Network 2019). The Coverage and Claims platform, and especially the Policy (generation) Engine that it will contain, is aimed at intensive financialisation of personal healthcare expenses, and extensive experiments with designing personalised nudges to shape the demand behaviour of consumers.&lt;/p&gt;
&lt;p&gt;The imagination of healthcare the NHS demonstrates is one where broadening health insurance coverage is equated to providing equitable healthcare and as a panacea for the public healthcare sector. The first phase of this push towards better healthcare provision is to focus on contextualising the historical socio-economic divide. The next phase is characterised by digitalisation: the introduction of ICT to bridge the socio-economic divide in healthcare provision. In this process, the resulting data divide has been invisibilised in reframing better healthcare as an insurance problem for which data needs to be generated. Each policy innovation is then characterised by further marginalisation of those that were originally identified as underserved. This is a result of increasing repercussions of the data-divide, with access to benefits increasingly being mediated by technology.&lt;/p&gt;
&lt;h3&gt;&lt;strong&gt;Concluding Remarks&lt;/strong&gt;&lt;/h3&gt;

&lt;p&gt;The objective of health data collection has evolved over the course of the institution of the HIS in 2011, to the development of the NHPS and National Health Policy in 2017. What began as a solution to measure and address gaps in access and quality in healthcare provisioning through data analysis has morphed into data centralisation and insurance coverage. Shifting goalposts can also be found in the objectives behind introducing digital systems to collect data.&lt;/p&gt;
&lt;p&gt;In recent iterations of the healthcare imaginary, such as the IHIP and the NHS, data ownership by the beneficiaries is stressed upon. In the absence of a rights-based framework dictating the use of data, the role of ownership should be interrogated, especially in the context of a prevalent data divide (Tisne 2019). The legitimisation of data capture can be seen in the emergence of opt-in models of consent, data fiduciaries managing consent on the data subject’s behalf, etc. (Zuboff 2019).&lt;/p&gt;
&lt;p&gt;This framing forecloses a discussion about the quality and kind of data being used. The push towards datafication needs to be questioned for its re-indexing of categorical meaning away from the complexities of narrative, context and history (Cheney-Lippold 2018). Instead, the proposed solution is one that stores datafied elements within a closed set (reproductive health= [abortion, aids, contraceptive,...vaccination, womb]). While this set may be editable, so new interpretations can be codified, it inherently remains stable, assuming a static relationship between words and meaning. Health is then treated as having an empirically definable meaning, thus losing the dynamism of what the health and wellness discourse could entail.&lt;/p&gt;
&lt;p&gt;It has been historically demonstrated in the Indian context that multiple tools and databases for health data management are a barrier to an efficient HIS. However, generating centralised or federated databases without addressing concerns in data flows, quality, uses in existing data structures, and the digital divide across health workers and beneficiaries alike will lead to the amplification of existing exclusions in data and, consequently, service provisioning.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;[1]&lt;/strong&gt; Section 2 (a) of the Clinical Establishments (Registration and Regulation) Act, 2010: A hospital, maternity home, nursing home, dispensary, clinic, sanatorium or institution by whatever name called that offers services, facilities requiring diagnosis, treatment or care for illness, injury, deformity, abnormality or pregnancy in any recognised system of medicine established and administered or maintained by any person or  body of persons, whether incorporated or not.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;[2]&lt;/strong&gt; The National Health Stack, then, is the latest manifestation of the Indian government’s push for a “Digital India.” A key component of Digital India has been e-governance, financial inclusion, and digitisation of transaction services. The nudge towards cashless modes of transaction and delivery, also accelerated by India’s demonetisation drive in November 2016, has led to rapid uptake of digital payment services in particular, and that of the IndiaStack initiative in general. Developed by iSPIRT, IndiaStack (https://indiastack.org/) aspires to transform service delivery by public and private actors alike through its “presence-less, paperless, and cashless” mandate.&lt;/p&gt;

        &lt;b&gt;We published a Call for Researchers on January 10, 2020, to invite applications from researchers interested in writing a narrative essay that interrogates the modes of surveillance that people of LGBTHIAQ+ and gender non-conforming identities and sexual orientations are put under as they seek sexual and reproductive health (SRH) services in India.  We received 29 applications from over 10 locations in India in response to the call, and are truly overwhelmed by and grateful for this interest and support. We eventually selected applications by 3 researchers that we felt aligned best with the specific objectives of the project. &lt;p&gt;Kaushal is persuing his MPhil in Sociology at Delhi School of Economics, University of Delhi. He completed his Master's in Sociology at Centre for the Study of Social Systems, Jawaharlal Nehru University after getting a BSc honors degree in Biomedical Sciences from Delhi University. He is one of the founding members of Hasratein: a queer collective, New Delhi. He has been an active spokesperson for Queer and Trans Rights in India and have been on a number of panel discussion on Trans Act 2019 in various campuses. He has also delivered a lecture series on Colonialism and Medicine in Ambedkar University, Kashmiri Gate, Delhi. &lt;h3&gt;Introduction&lt;/h3&gt;
&lt;p&gt;On November 16, 2019, The Centre for Internet and Society invited officials from the Department of Labour (Government of Karnataka), members of domestic worker unions, domestic workers, company representatives, and civil society researchers at the Student Christian Mission of India House to discuss preliminary findings of an
ongoing research project and facilitate a multistakeholder consultation to understand the contemporaneous platformisation of domestic work in India.&lt;/p&gt;
&lt;p&gt;This collaborative project is being led by the the Centre for Internet and Society, India (CIS) together with Domestic Workers Rights Union (DWRU) in Bangalore. The research team comprises of Geeta Menon, Parijatha G.P., Sumathi, Radha K., and Zennathunnisa from DWRU, and Aayush Rathi and Ambika Tandon from CIS. Through a collective research process, this research team has explored the proliferation of digital platforms as a key intermediary in the domestic work sector, and in supporting or challenging deeply rooted structural inequities. This work forms part of the ​ Association for Progressive Communications’ &lt;a href="https://www.apc.org/en/project/firn-feminist-internet-research-network" target="_blank"&gt;Feminist Internet Research Network&lt;/a&gt;​ project, supported by the International Development Research Centre​, Ottawa, Canada.&lt;/p&gt;
&lt;p&gt;The multistakeholder consultation was structured in two segments: a) a presentation outlining initial observations and analysis, and b) a semi-moderated open discussion. Together, these sessions aimed to initiate conversations pertaining to the role of digital platforms, the legal classification of domestic and gig workers, and devising regulatory solutions to improve conditions of work. Preliminary findings were based on qualitative in-depth interviews with workers, platform companies, unions, skilling agencies, and labour officials in both Bengaluru and
New Delhi. Feminist approaches were employed in conducting these interviews, and participatory, consensual, reflexive and collaborative research was prioritised.&lt;/p&gt;
&lt;p&gt;Situating the lived realities of domestic workers, the event sought to centre the voice of domestic workers in the consultation around the future of their work. The event had attendance from multilingual attendees. The original presentation was made in English, and Geeta Menon translated the presentation and the discussion that followed in Kannada [2].&lt;/p&gt;

    <title>Between Platform and Pandemic: Migrants in India's Gig Economy</title>

        &lt;b&gt;In response to the rising number of COVID-19 cases in India, the central government announced a nationwide lockdown in March 2020. &lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;Initially this was organised for three weeks, but it stretched on for over three months. With a mere four hours’ notice before banning all non-‘essential’ economic activities overnight, the Indian government imposed what has been described as &lt;a href="https://scroll.in/article/957564/not-china-not-italy-indias-coronavirus-lockdown-is-the-harshest-in-the-world"&gt;one of the most stringent lockdowns worldwide&lt;/a&gt;. It shut down the railways, inter-state bus services, and all industrial, commercial, cultural and religious activities, bringing the economy to a standstill. In the weeks that followed this announcement, hundreds of poor migrant workers &lt;a href="https://www.washingtonpost.com/world/asia_pacific/india-coronavirus-lockdown-migrant-workers/2020/03/27/a62df166-6f7d-11ea-a156-0048b62cdb51_story.html"&gt;walked&lt;/a&gt; thousands of kilometers from major cities back to their villages, as the lockdown gutted their livelihood without providing any safety nets. Images of migrant workers traveling by foot for days forced the Indian public to acknowledge the existence and struggles of migrant workers. The pandemic has exposed the frailty of their livelihoods and brought their vulnerability into sharp focus.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The ‘gig’ economy in particular shapes the lives and livelihoods of a large migrant workforce. Gig workers working for on-demand platform services have been adversely impacted by the Covid-19 pandemic. Cab-hailing services &lt;/span&gt;&lt;a href="https://indianexpress.com/article/cities/chandigarh/coronavirus-india-lockdown-wheels-stuck-but-worries-are-many-for-ola-uber-drivers-6346527/"&gt;came to a standstill&lt;/a&gt;&lt;span&gt; in several Indian cities as the central government imposed a nationwide lockdown for over two months, restricting people’s movements. Food delivery and home-based services were &lt;/span&gt;&lt;a href="https://www.indiatoday.in/technology/news/story/covid19-lockdown-online-delivery-of-food-items-is-essential-service-but-don-t-rely-on-it-for-your-dinner-1659490-2020-03-25"&gt;deemed ‘essential’ services&lt;/a&gt;&lt;span&gt; and continued to operate during the lockdown. However, migrant workers received &lt;/span&gt;&lt;a href="https://scroll.in/article/959766/by-crowdfunding-benefits-for-embattled-workers-app-based-services-are-evading-their-own-obligations"&gt;little support&lt;/a&gt;&lt;span&gt; from the platform companies as well as the government. Despite the overwhelming presence of migrants in the workforce, discussions of the so-called ‘platform economy’ have rarely focused on their vulnerabilities.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;&lt;strong&gt;Neither here nor there&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;In 2000, Omer (all names are pseudonyms) migrated to Hyderabad from a village in the neighbouring Nagarkurnool district. He worked as a cab driver for a travel agency in the city. After working in the city for five years, he brought his wife and children to live with him. When Uber and Ola launched in Hyderabad in 2014, he became a ‘driver partner’ providing on-demand cab services. The nationwide lockdown since March 2020 gutted his livelihood, as movement was severely restricted. The burden of rent and living expenses in the absence of his regular income forced Omer to return to his village in Nagarkurnool district. He weighed his earning potential as a cab driver against the risk of being infected and chose to leave the city.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;However, the choice to leave the city did not exist for all. Mani, a cab driver now based in Chennai, had moved to the city 10 years ago from a neighbouring town, Ranipet, to find employment as a driver. Before joining Ola, he worked as a night shift driver for an IT company in the city. In the wake of the pandemic and lockdown, he avoided returning to his hometown fearing the wrath of lenders he owed money to. He had taken out a loan while he could still work over 10 hours a day. Lenders in towns such as Ranipet are known to visit the homes of borrowers and harass them in the presence of family and neighbours. Fearing public humiliation, Mani decided to stay in Chennai. Similarly, Jagan, another driver in Hyderabad, also chose not to return to his village which was just 80kms from the city. He explained that only those who owned land could afford to return to the village. Without any land or house, he had nothing to go back to.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Jagan and Mani were unable to earn their livelihood during the lockdown. Fuel prices were a major concern for workers in cab-hailing services as well as food delivery. Within three months of the lockdown, the price of petrol was increased by about Rs. 14 (approx. $0.19). Far from accounting for this rise in fuel prices, on-demand platforms reduced the per kilometer rates for workers. For instance, Swiggy, a popular on-demand food delivery company, &lt;a href="https://thewire.in/labour/swiggy-delivery-executives-strike-in-chennai-and-hyderabad-over-reduction-in-payment"&gt;brought down&lt;/a&gt; the per-kilometer rate for its delivery executives from Rs. 35 (approx. $0.48) per delivery to Rs.15 (approx. $0.21). Since the lockdown in March, platform workers have staged &lt;a href="https://inc42.com/infocus/year-end-review-2020/from-swiggy-to-ola-a-year-of-protests-by-indias-gig-workers/"&gt;repeated strikes&lt;/a&gt;, protesting against the plummeting rates, suspension of incentives and demanding extension of moratorium on loan repayments.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Those who were unable to return to their hometown or village had to find alternate sources of income to continue to sustain their families’ basic needs. Both Jagan and Mani began working as contract labour in nearby construction sites.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;For Omer, who returned to his village, things were not great either. A couple of months after his return, he was still on the lookout for a job while occasionally driving a tractor or lorry. Having lived in the city for close to two decades, returning to his village had not been easy. Besides the struggle to find gainful employment, adjusting to rural life had been a challenge:&lt;/p&gt;
&lt;p&gt;&lt;em&gt;I am 40 years old – the chances of me getting a job is negative… my situation has become like ‘Dhobi ka kutta na ghar ka na ghat ka’ [I belong neither here nor there] &lt;/em&gt;– Omer&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Migrant Workers in a Gig Economy&lt;/strong&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Even though the above narratives of migrant workers are specific to the challenges presented by COVID-19, the labour and livelihood outcomes are a result of structural conditions long preceding the pandemic’s outbreak.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Reports suggest that a &lt;a href="https://www.livemint.com/companies/start-ups/delhi-and-not-bengaluru-is-the-place-to-be-for-gig-economy-workers-1555013405684.html"&gt;significant proportion of platform workers in Indian cities are migrants&lt;/a&gt; who moved there in search of employment. While the exact magnitude of migrants engaged in digital platforms is hard to discern, our interviews with trade union leaders and migrant platform workers indicated that intra-state migrants from neighboring peri-urban and rural districts constitute a large part of the platform workforce. Dharmendra, who heads Indian Delivery Lions—a union of food delivery partners in Jaipur – pointed out that as rural India remains starved of adequate livelihood opportunities, people are pushed to the city in search of greener pastures. &lt;a href="http://labourbureau.gov.in/RLE%202K%204-5%20Chapter%202.htm"&gt;Even for those engaged in farm activities, seasonal unemployment is a recurrent phenomenon&lt;/a&gt;. This is amplified by the deteriorating climatic conditions, which further pushes seasonal agrarian workers into the urban informal sector. Thus, &lt;a href="https://www.academia.edu/39244178/Climate_change_Agrarian_distress_and_the_role_of_digital_labour_markets_evidence_from_Bengaluru_Karnataka"&gt;rural agrarian workers facing seasonal unemployment engage in digital labour markets as a short-term adaptive strategy.&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In terms of demographic profiles, recent migrants to the city, especially those hailing from a different state, and younger migrants typically opt to work in the food delivery sectorSuch financial constraints also impact migrant workers engaged with ride-hailing apps, as they are less likely to own a car. Owning a bike (for food delivery) is far less expensive than owning a car (for transportation services), which incurs more expenses and leads to a higher debt burden and longer repayment commitments. Instead, they usually &lt;a href="https://cis-india.org/raw/files/ifat-itf-protecting-workers-in-digital-platform-economy-ola-uber-occupational-health-safety-report/"&gt;drive leased cars&lt;/a&gt; from the on-demand service companies, or are employed at a fixed wage by car-owners who have attached themselves to Ola or Uber. In both these arrangements, migrant gig workers are under pressure to pay a fixed daily fee (for the lease) or meet the car-owners’ targets. Hence, they do not enjoy much, if any, agency over their time or work.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Migrant workers who are already in cities tend to transition to on-demand gig work. For migrant workers like Mani and Omer, on-demand work with its lucrative incentives and promise of flexibility presented an appealing alternative to their under-paying jobs that hardly met their needs. Migrant workers are economically more vulnerable; most of their earnings go into paying rent and repaying debt while barely managing their living expenses or sending remittances back home. Vinay Sarathy, the President of Food Delivery Partners Struggle Committee, pointed out that &lt;em&gt;“many migrant bachelors live together cramped up in a single room, to save on rent and send more remittance to cope with financial hardship back home.”&lt;/em&gt; Such struggles, unique to migrants, often remain invisible.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;em&gt;“Landlords are not accommodative, security is an issue. Everything is so much more expensive. Schooling, for instance, is costly. In the village, Rs. 3000 ($41 approx) is sufficient for school fees, but in the city, it is not less than Rs. 8000 ($109 approx). Rent is a major concern too. 80% of income goes on rent and school fees. Only the remaining can be for daily expenditure&lt;/em&gt;”.    – Omer, a gig worker in the transportation sector&lt;/p&gt;
&lt;p&gt;The lack of social institutions to support migrant gig workers in the city and the government’s failure to provide long-due welfare measures frequently leave them on the city’s fringes.&lt;/p&gt;
&lt;p&gt;Against such a backdrop, the platforms’ lucrative income stream fulfilled migrant workers’ basic desire to secure a stable livelihood. So much so that even migrant workers like Mani and Jagan, who were previously engaged in salaried driving jobs, switched to platforms, tempted by the prospect of improved earnings. The chance to be a ‘partner’ with the ‘flexibility’ to decide one’s work timings made platforms an appealing alternative to low-waged precarious work in the &lt;a href="https://www.firstpost.com/business/covid-19-impact-informal-economy-workers-excluded-from-most-govt-measures-be-it-cash-transfers-or-tax-benefits-8354051.html"&gt;unorganised sector, where migrant workers are generally employed&lt;/a&gt;.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While the initial motivation to join platforms resulted from the expectation of better income, improved working conditions, and the perceived social standing of being attached to a company, these &lt;a href="https://www.epw.in/engage/article/ola-uber-workers-platform-gig-economy-earnings"&gt;aspirations remain unfulfilled.&lt;/a&gt; Inadvertently, migrant workers’ movement towards on-demand work ensured a steady supply of gig workers for on-demand service companies, which consolidated their presence in the service sector. After successfully capturing the market, companies started &lt;a href="https://www.theindiaforum.in/article/confronting-precarious-work"&gt;slashing incentives&lt;/a&gt; for all workers. Such impunity and indifference wielded by platforms, in large part, can be attributed to the guaranteed supply of migrant workers. The acute vulnerability of being unemployed compels distressed rural migrants from nearby districts and suburbs to take up any job, regardless of how exploitative it may be. This latent supply of migrant workers gives platform companies the leverage to arbitrarily depress incentives, extract larger commissions, and even dismiss workers. Migrant workers thus become the de-facto &lt;a href="https://rupe-india.org/70/reserve.html#note29"&gt;“reserve army of labour”&lt;/a&gt; for on-demand companies.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Comply or quit?&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;In the aftermath of the Covid-19 lockdown, migrant gig worker’s livelihoods have been reduced to a hand-to-mouth existence, foregrounding the fatal overlap between the two axes of vulnerability: migration and gig work.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Historically, migrant workers have been concentrated in occupations characterised by precarity and informal work arrangements without fixed-pay or binding contracts. Workers who transitioned to on-demand platforms were motivated by the promise of better conditions of work and pay. The initial appeal led them to view platforms as a dignified alternative to their profession. Many were also lured by the notion of independence and flexibility afforded by the platform. To be one’s boss and not be answerable to anyone was unheard of and a welcome change to the subservience that most workers had grudgingly internalized as a professional prerequisite. However, contrary to the big claims and initial promises, platforms began to  replicate work arrangements in the informal sector. The result is that workers are rarely provided fair wages, social security, or paid leave. There is no meaningful choice for them to exercise, as they are effectively left with two alternatives—comply or quit.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Trapped between exploitative working conditions and being unemployed, workers lack any real negotiating power. Even as gig workers across the country continue to protest for better work conditions, platforms remain indifferent, assured of the guaranteed labour supply. As summarized by Dharmendra, &lt;em&gt;“the agenda of the platforms presently is to recruit new workers – they have already begun advertising for jobs even amidst the pandemic, as incidents of protests keep rising! We’re expecting that they’ll fire old workers (engaged in protests) and recruit those who are presently unemployed”&lt;/em&gt;.&lt;/p&gt;

    <title>Consultation on Figures of Learning in the Digital Context - Report</title>

        &lt;b&gt;The Researchers at Work (RAW) programme at the Centre for Internet and Society organised a consultation on ‘Figures of Learning in the Digital Context’ on September 22, 2014 in Bangalore. &lt;/b&gt;
        
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Conducted as part of its ‘Making Methods for Digital Humanities’ project, the discussion was an attempt to examine changes in the learning environment with the advent of digital technologies and new modes of knowledge production by mapping concepts and changes around a set of figures of learning, old and new, to understand the discursive shifts that produce and locate them in the contemporary moment. (See the &lt;a href="https://cis-india.org/raw/events/consultation-on-new-figures-of-learning-in-digital-context" class="external-link"&gt;concept note here&lt;/a&gt;).&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The Making Methods project seeks to make specific interventions in structures of learning, methods of storing and documenting information, and processes of interaction and interface design, in an effort to describe and queer the contours of what we understand as the field of Digital Humanities today.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The consultation brought together a small but diverse set of people from different fields. Participants presented on figures of learning drawn from their own fields of research and practice. Archana Prasad, artist and founder of &lt;a href="http://jaaga.in/"&gt;JAAGA,&lt;/a&gt; Bangalore spoke about the organisation and its growth as an alternative space for learning through collaborative processes in art, design and technology – the studio space made of pallet racks, its various projects and groups that converge at JAAGA reflect this diversity and interdisciplinarity. She spoke about changes in her own role from being a facilitator for diverse groups to come together, to becoming more of a mentor in the later years, the problems of sustainability of such a space and the efforts made through different projects in emphasising learning though peer-to-peer methods. Interesting projects in focus were the participatory artwork and reality game called &lt;a href="http://investmentzone.info/"&gt;Investmentzone&lt;/a&gt; which is an effort to collaboratively work and transform public spaces and the JAAGA residential study programme. The discussions were useful in understanding processes that can be used to foster alternative and participatory learning environments.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Asim Siddiqui, Ph.D. student at the &lt;a href="http://barefootphilosophers.wordpress.com/"&gt;Manipal Centre for Philosophy and Humanities&lt;/a&gt;, used the figure of the ‘performer’ to talk about his research enquiry into the philosophy of performative art traditions and the role of the body, performance and practice in learning. He spoke about the relative passivity of the body in the classroom, and the predominance of certain normative discourses within which teaching-learning practices operate and therefore produce a sort of instrumental form of knowledge, which he found problematic. He drew from examples of embodied action in dance, theatre and music to look at how some of these nuances and conflicts may be brought into classroom pedagogy to make it more illustrative and inclusive. This led to an interesting discussion around problems with current teaching-learning practices and the lack of adequate measures to make them contextual and relevant to students’ lived experience. The digital now bringing in a different dimension to learning and the lack of an understanding of the body in the digital space as preventing the possibility of a somatic element to knowledge was also discussed. The problem of disciplinary constraints and the separation of humanities and social sciences came up with reference to technology becoming more prominent in classrooms.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Bitasta Das, instructor and coordinator of the &lt;a href="http://www.iisc.ernet.in/ug/"&gt;UG Humanities programme&lt;/a&gt; at the Indian Institute of Science, Bangalore spoke further on this issue of separation of the disciplines from her experience of teaching in the UG programme. Her presentation on the ‘distracted inventor’ focussed on the role of technology in the classroom, and how there is a need for teachers to constantly innovate to keep students engaged, particularly in a course such as this. The notion of distraction was a useful contrast to the attention economy debates that have become increasingly prevalent. The possibility of distraction as serendipitous and productive, particularly in science which is also a space of invention and discovery was discussed as one way of taking the idea forward. Some of the work done by students in the programme, under the larger rubric of integration of disciplines, was also presented in the consultation.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Nishant Shah presented on the idea of the production of error in computing, which is also the result of a deliberate and long process or history which can be traced from scribes copying texts to print culture and now to the machine itself, which also produces or re-produces error. He spoke about the gap between the interface and the information that a person consumes in the digital context, which is contrary to what is understood by abbreviations such as Garbage In Garbage Out (GIGO). He sought to critically examine this notion of transparency that the digital supposedly provides, when in effect the notion of error is as much present, but is being effectively effaced in various ways. The production of error therefore is an interesting process in signifying the limits of knowledge, and he proposed the idea of using the figure of the hipster to further explore this process of error or the glitch as a productive one.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Ekta Mittal , media practitioner and one of the founder-members of the media and arts collective &lt;a href="http://maraa.in/about/our-team/"&gt;Maraa&lt;/a&gt; presented on the figure of the worker, drawing on her research and work on a film on the Bangalore Metro construction workers. The attempt was to break through the existing discourse and simple binaries to present multiple meanings of the city, migrant labour, development, and new narratives of freedom and pleasure. Through documentation of the lives of labourers who belong to different parts of the country and their stories of migration, some of them illegal, and the question of identity and livelihood the film tries to dislocate the figure of the worker from a certain predominant discourse of the marginalised and invisible. The figure of the worker as a ghost, poet, wanderer, and now a lurker who often favours his condition of anonymity and invisibility is something that the presentation also focussed on as a way to take these ideas forward.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The consultation brought together a small but interesting set of people and ideas, this time specifically looking at diverse art and classroom teaching - learning practices. It also brought to the fore several unconventional processes of learning such as gamification, distraction, performance and embodied action that are outside the traditional notion of learning in the context of digital technologies. These ideas would contribute to further initiatives in engaging with larger questions about technology and processes of knowledge production.&lt;/p&gt;

    <title>Life of a Tuple: National Register of Citizens (NRC) and the Reform of Citizen Identification Infrastructure in Assam</title>

        &lt;b&gt;We are proud to announce that a research grant from the Azim Premji University has enabled us to initiate a study of the updation process of the National Register of Citizens (NRC) in Assam, and the resultant reform of citizen identification infrastructure in India. The study is being led by Khetrimayum Monish and Ranjit Singh, along with Sumandro Chattapadhyay. &lt;/b&gt;
        &lt;p&gt;The research focuses on two specific aspects of the NRC update:&lt;/p&gt;
&lt;ul&gt;
&lt;li style="text-align: justify; "&gt;Challenges of legal citizenship: In this context, we will investigate the constitutional acts and provisions for making citizenship claims in India, the historical narratives of identity politics in Assam and its culmination in the exercise of updating the NRC.&lt;/li&gt;
&lt;/ul&gt;

&lt;li style="text-align: justify; "&gt;Challenges of procedurally implementing the NRC update: Here, we plan to explore the subsequent design process of updating the register.&lt;/li&gt;

&lt;li style="text-align: justify; "&gt;Starting with the first aspect of legally defining Indian citizenship, the project will document and discuss the various legal processes of defining the bureaucratic process of updating NRC that emerge along two sets of concerns at different levels of Indian government. First, at the state level, we will explore the socio-political tensions around illegal immigration from Bangladesh and the history of identity-based politics in Assam. Second, at the level of the central government, we plan to investigate the constitutional and legal rules and provisions that are used to define citizenship in India.&lt;/li&gt;

    <title>Archive and Access: Call for Review</title>

        &lt;b&gt;The Archive and Access research project by Rochelle Pinto, Aparna Balachandran and Abhijit Bhattacharya is a part of the Researchers @ Work Programme at the Centre for Internet and Society, Bangalore. The project that attempts to look at the ways in which the notion of the archive, the role of the archivist and the relationship between the state and private archives that has undergone a transition with the emergence of Internet technologies in India has been put up for public review. &lt;/b&gt;
        &lt;p&gt;The Researchers At Work Programme, at the Centre for Internet and Society, advocates an Open and transparent process of knowledge production. We recognise peer review as an essential and an extremely important part of original research, and invite you, with the greatest of pleasures, to participate in our research, and help us in making our arguments and methods stronger.&lt;/p&gt;
&lt;p&gt;Laying out a theoretical review of the history of technologies of archiving in the country, the project aims at building case studies of public and private archives in the country and the needs for a local capacity building network of historians, archivists, technologists and state bodies which exploits the digital and Internet technologies for building new archives of Indian material.&lt;/p&gt;
The monograph has emerged out of the "&lt;em&gt;Archive and Access&lt;/em&gt;" project that was initiated in September 2008. The first draft of the monograph is now available for public review and feedback.Please click on the links below to choose your own format for accessing the document:

    <title>We, the Cyborgs: Challenges for the Future of being Human</title>

        &lt;b&gt;The Cyborg  - a cybernetique organism which is a combination of the biological and the technological – has been at the centre of discourse around digital technologies. Especially with wearable computing and ubiquitous access to the digital world, there has been an increased concern that very ways in which we understand questions of life, human body and the presence and role of technologies in our worlds, are changing. In just the last few years, we have seen extraordinary measures – the successful production of synthetic bacteria, artificial intelligence that can be programmed to simulate human conditions like empathy and temperament, and massive mobilisation of people around the world, to fight against the injustices and inequities of their immediate environments. &lt;/b&gt;
        
&lt;p&gt;&lt;strong&gt;Rationale&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;All of these, in some way or the other, hint at new models of 
cyborgification which we need to unpack in order to understand a few 
questions which have been at the helm of all philosophical inquiry and 
practical design around Internet and Society:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;How do we understand ourselves as human? What are the technologies that define being human?&lt;/li&gt;&lt;li&gt;How
 do conceptualise the technological beyond prosthetic imaginations? How 
do we understand technology (especially the digital) as a condition?&lt;/li&gt;&lt;li&gt;What are the new challenges we shall face in law, ethics, life and social sciences as we increasingly live in Cyborg societies?&lt;br /&gt;&lt;/li&gt;&lt;/ul&gt;
&lt;em&gt;We , the Cyborgs&lt;/em&gt;, is a first of its kind research inquiry that 
locates these questions in a quickly digitising India to see the 
challenges of being human in the time of technological futures. In her 
seminal body of work on Cyborgs, Donna Haraway had posited the cyborg as
 a creature of fiction and ironies; a monster, a trickster, a boundary 
creature that is irreducible to the existing binaries of 
human-technology, technology-nature, nature-regulation.
In imagining the cyborg as simultaneously fictitious and embodied in 
practices of care and labour, Haraway was further hinting at a set of 
questions that have never really entered discourse on cyborgs: Who are 
we when we become cyborgs? What do we do with the cyborgs we have 
produced? What are the other kinds of cyborgs? What are the new places 
them? What are the other ways of understanding cyborgs? Asha Achuthan in
 her monograph Re:Wiring Bodies, maps these questions along the axes of 
Presence, Access, Inclusion and Resistance to understand ‘attitudes to 
technology’.
Achuthan talks about a moment of elision where technology is separated 
from the human body in the space of policy and critique. In those 
moments of separation, there is the production of a cyborg body that is 
suddenly vulnerable because it does not have the support of the 
technological which was an essential part of its bodily experience. How 
does this body get assimilated in our technology practices? What are the
 axes of discrimination and inequity that are attributed to these bodies
 in the process of cyborg making? Who are the actors that play a part in
 designing these cyborg bodies and selves? In the Indian context, where 
there has been a legacy of being technosocial subjects and cyborg 
citizens in the nation’s own technoscience imagination of itself, we 
need to locate the cyborg in new sites and contexts to see what the 
regulation of technology and its integration in everyday life.
&lt;strong&gt;&lt;br /&gt;&lt;br /&gt;Methodology&lt;/strong&gt;
&lt;p&gt;Building upon her work, We, The Cyborgs, seeks to locate the cyborg 
in India, on 3 interdisciplinary but connected sites to&amp;nbsp; examine how 
bodies, in their interaction with the design and practice of different 
processes of regulation and control, are in the process of becoming 
cyborgs. The inquiry locates the cyborg at intersections of Health Care,
 Planning and Gender, to start unpacking the different futures of the 
body-technology relationships that have been posited in terms like 
post-human, techno-social, simulated bodies, bodies as traffic, etc. In 
the process, it hopes to unravel the questions of methods, frameworks, 
ethics and practices of bodies in conditions of technology.
&lt;em&gt;We, The Cyborgs&lt;/em&gt;, aims to bring together a wide range of 
researchers and practitioners from different disciplinary locations 
including but not limited to – Art, Anthropology, Law, Planning, 
Architecture and Design, Gender and Sexuality studies, Cultural Studies,
 Life Sciences, Medicine, New Media Studies, etc. – to start a debate 
around some of the key issues around cyborgs and cyborg-making in their 
fields.&lt;/p&gt;
&lt;p&gt;&lt;br /&gt;&lt;strong&gt;&lt;/strong&gt;&lt;/p&gt;
