    <title> Interoperability and Portability as a Lever to Enhance User Choice and Privacy in Messaging Platforms</title>

&lt;p style="text-align: justify;" dir="ltr"&gt;Since last year, digital platforms have been actively making the headlines in various countries for different acquisitions, raising questions around the anti-competitive nature of their behaviour. In the US, about 46 states filed an antitrust case against Facebook along with the Federal Trade Commission in December 2020, accusing them of buying out rivals such as WhatsApp, Instagram etc&lt;a href="#_ftn1"&gt;[1]&lt;/a&gt;. Recently, the US supreme court overturned the case by 46, stating it to be tardy and FTC’s case to be “legally insufficient”&lt;a href="#_ftn2"&gt;[2]&lt;/a&gt;.&amp;nbsp; However,&amp;nbsp; one of the solutions proposed for this problem by various experts and politicians is to break up Facebook&lt;a href="#_ftn3"&gt;[3]&lt;/a&gt;.&lt;/p&gt;
&lt;p dir="ltr"&gt;Influential people such as Vijay Shekhar Sharma (CEO, Paytm) in India argued similarly when Whatsapp updated its privacy policy to share data with Facebook. They suggested that the movement of users towards Signal could break Facebook's monopoly&lt;a href="#_ftn4"&gt;[4]&lt;/a&gt;. While it is conceivable that breaking up a platform or seeking an alternative for them will bring an end to their monopoly, well, in reality, is it so? This post will try to answer this question. In section 1, I discuss the importance of interoperability and portability amongst the messaging platforms for tackling monopoly, which, in turn, helps in enhancing user outcomes such as user choice and privacy. Section 2 discusses the enablers, legislative reimagining, and structural changes required in terms of technology to enable interoperability and portability amongst the messaging platforms. In section 3, I discuss the cost structure and profitability of a proposed message gateway entity, followed by the conclusion.&amp;nbsp;&lt;/p&gt;
&lt;p dir="ltr"&gt;&amp;nbsp;&lt;/p&gt;
&lt;h3&gt;1. Introduction&lt;/h3&gt;
&lt;p dir="ltr"&gt;&lt;br /&gt;In the case of the platform economy, the formation of a monopoly is inevitable, especially in messaging platforms, because of (a) network effects and (b) lack of interoperability and portability between messaging platforms&lt;a href="#_ftn5"&gt;[5]&lt;/a&gt;. As the network effect gets vigorous, more users get locked into a single messaging platform leading toward a lack of user choice (in terms of switching platforms) and privacy concerns (as the messaging platforms get more significant, it poses a high risk in terms of data breaches, third-party data sharing etc.). For instance, as a WhatsApp user, it is difficult for me to switch towards any other messaging platforms as my friends, family and business/work still operate on WhatsApp. Messaging platforms&amp;nbsp; also use the network effect towards their favour (a) by increasing the switching cost (b) by creating a high barrier to entry within the market&lt;a href="#_ftn6"&gt;[6]&lt;/a&gt;.&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p dir="ltr"&gt;If there was interoperability between the messaging platforms, I could choose between the platforms freely- thereby negating some of the aforementioned limitations. Therefore, to create a competitive environment amongst messaging platforms to enhance user choice and privacy, it is crucial to have an interoperability and portability framework. To deploy interoperability and portability, it is imperative to have coordination among platforms while still competing for individual market share&lt;a href="#_ftn7"&gt;[7]&lt;/a&gt;. Interoperability and portability will also bring in healthy competition, as platforms will be nudged to explore alternative value propositions to remain competitive in the market&lt;a href="#_ftn8"&gt;[8]&lt;/a&gt;. One of the outcomes of this could be better consumer protection through innovation of privacy safeguards, etc. In addition to this, interoperability and portability could enable a low barrier to entry (through breaking the network effect), which could, in turn, increase online messaging penetration in untapped geographies as more messaging platforms emerge in the market.&lt;/p&gt;
&lt;p dir="ltr"&gt;There are two kinds of interoperability, vertical interoperability – i.e., interoperability of services across complementary platforms and horizontal interoperability – i.e., interoperability of services between competing platforms. While vertical interoperability exists in the form of the cloud system, multiple system login, etc., horizontal interoperability is yet to experiment at the market level. Nonetheless, realising the competition concerns in the digital platforms’ market, the European Union (European Electronic Communications Code&lt;a href="#_ftn9"&gt;[9]&lt;/a&gt;, Digital Service Act etc&lt;a href="#_ftn10"&gt;[10]&lt;/a&gt;.), the US (Stigler Committee Report&lt;a href="#_ftn11"&gt;[11]&lt;/a&gt;) and the UK Competition and Markets Authority&lt;a href="#_ftn12"&gt;[12]&lt;/a&gt; are mulling a move towards interoperability amongst the digital platforms. Furthermore, Facebook has already commissioned its efforts towards horizontal interoperability&lt;a href="#_ftn13"&gt;[13]&lt;/a&gt; amongst its messaging platforms, i.e., Messenger, WhatsApp and Instagram direct messages. This again adds to the competition concerns, as one platform uses interoperability towards its favour.&lt;/p&gt;
&lt;p dir="ltr"&gt;Besides, one of the bottlenecks towards enabling horizontal interoperability is the lack of technical interoperability – i.e., the ability to accept or transfer data, perform a task etc., across platforms. In the case of messaging platforms, lack of technical interoperability is caused due to the presence of different kinds of messaging platforms operating with different technical procedures. Therefore, to have effective horizontal interoperability and portability, it is crucial to streamline technical procedures and have guidelines which will enable technical interoperability. In the following section, I discuss the enablers, legislative reimagining, and structural changes required in terms of technology to enable interoperability and portability amongst the messaging platforms.&lt;/p&gt;
&lt;p dir="ltr"&gt;&amp;nbsp;&lt;/p&gt;
&lt;h3&gt;2. Message Gateway Entity&lt;/h3&gt;
&lt;p align="center" style="text-align: left;"&gt;&lt;strong id="docs-internal-guid-c306c6ef-7fff-4a15-1cbb-08b262bb3c75"&gt;&lt;br /&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p dir="ltr"&gt;2.1. Formation of Message Gateway Entity to Enable Interoperability&lt;/p&gt;
&lt;p dir="ltr"&gt;To drive efficacious interoperability, it is imperative to form message gateway entities as for-profits that are regulated by a regulator (either an existing one such as TRAI or a newly established one). The three key functions of message gateway entities should be: (a) Maintain standard format for messaging prescribed by a standard-setting council, (b) Provide responsive user message delivery system to messaging platforms, (c) Deliver messages from one messaging platform to another seamlessly in real-time. There have to be multiple message gateway entities to enable competition, which will bring out more innovations, penetration, and effectiveness. Besides, it is prudent to have private players as message gateway entities as government-led message gateway entities for interoperability will not be fruitful as there will be a question of efficacy. Also, this might, in a way, bring the tender style business, which is problematic as the government could have a say in how and who it will provide its service (gatekeeping). However, the government has to set it up by itself only if it is a public good (missing markets) which might not be the case in message gateway entities.&lt;/p&gt;
&lt;p dir="ltr"&gt;Messaging platforms should be mandated through legislation/executive order to be a member of at least one of the message gateway entities to provide interoperability benefits to its users. Simultaneously, messaging platforms can also handle internal message delivery - User A to User B within the platform - amongst themselves.&lt;/p&gt;
&lt;p dir="ltr"&gt;While message gateway entities will enable interoperability between messaging platforms, it is crucial to have interoperability among themselves to compete in the market. For instance, a user from messaging platform under gateway A should be able to send messages to a user of a messaging platform under gateway B. Perhaps as we enable competition amongst the message gateways entities, the enrollment price will also become commensurate and affordable for small and new messaging platforms. In addition to this, to increase interoperability, message gateway entities should develop various awareness programs at the user level.&lt;/p&gt;
&lt;p dir="ltr"&gt;&amp;nbsp;Further, the regulatory guidelines for message gateway entities (governed by the regulator) must be uniform, with leeway for gateways to innovate technology to attract messaging platforms. Borrowing some of the facets from the various existing legislations, the below suggested aspects should advise the uniform guidelines,&lt;/p&gt;
&lt;ul&gt;&lt;li style="list-style-type: disc;" dir="ltr"&gt;
&lt;p dir="ltr"&gt;End-to-end encryption: As part of the uniform guidelines, message gateway entities should be mandated to enable end-end encryption for message delivery. In contrast, the recent Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021&lt;a href="#_ftn14"&gt;[14]&lt;/a&gt; tries to break the end-end encryption by mandating significant social media intermediaries to identify the first originator of a particular message (part II section 4 rule 2) sought through an order. As this mandate impinges upon user privacy and free speech, the Indian government should revise this rule to keep end-to-end encryption intact. Besides, WhatsApp (a significant social media intermediary) has moved to Delhi High Court to block the implementation of the rules, which came into force on May 27th, 2021&lt;a href="#_ftn15"&gt;[15]&lt;/a&gt;. Also, Rule 4(2) of IT Rules 2021 contradicts provisions of the PDP Bill 2019 such as privacy by design&lt;a href="#_ftn16"&gt;[16]&lt;/a&gt; (Section 22) and the right to be forgotten (Section 20).&lt;br /&gt;&lt;br /&gt;&lt;/p&gt;
&lt;/li&gt;&lt;li style="list-style-type: disc;" dir="ltr"&gt;
&lt;p dir="ltr"&gt;Neutrality: The guidelines should have a strict rule for enforcing non-discrimination (similar to the Indian Government's 2018 net neutrality principles&lt;a href="#_ftn17"&gt;[17]&lt;/a&gt;) in delivering messages by message gateway entities. Discrimination against both messaging platforms and other message gateway entities has to be scrutinised. In addition to that, to hold message gateway entities accountable, the guidelines should mandate monthly disclosure of information (at the messaging platform level with information on which gateway entity they are routed through) on message deliveries and failures in a prescribed user-friendly format to the public.&lt;br /&gt;&lt;br /&gt;&lt;/p&gt;
&lt;/li&gt;&lt;li style="list-style-type: disc;" dir="ltr"&gt;
&lt;p dir="ltr"&gt;Standard Format Setting: As various messaging platforms follow different formats for providing messaging services, to have seamless interoperability, message gateway entities must adhere to a standard format, which is compatible with formats followed within the market. This standard format has to keep up with technological evolution in this space and to be formulated by an independent standard-setting council (through stakeholder consultation) commissioned by the regulator. The maintenance of this standard format falls into the ambit of message gateway entities and should be governed by the regulator.&lt;br /&gt;&lt;br /&gt;&lt;/p&gt;
&lt;/li&gt;&lt;li style="list-style-type: disc;" dir="ltr"&gt;
&lt;p dir="ltr"&gt;&amp;nbsp;Uniform identification information: As the users of messaging platforms identify other users through various means, for instance, on WhatsApp, we use the telephone number, whereas, on Instagram, we use profile name; thus, the unique identification information (UII) of a user (which can be something existing like a phone number or a new dedicated identification number) has to be standardised. Message gateway entities should facilitate messaging platforms with this process, and the generation of UII should be seamless for the user. Besides, a user's unique identification information has to be an additional way to search for other users within a messaging platform and would be crucial for messaging across platforms.&lt;br /&gt;&lt;br /&gt;&lt;/p&gt;
&lt;/li&gt;&lt;li style="list-style-type: disc;" dir="ltr"&gt;
&lt;p dir="ltr"&gt;Consumer choice: While interoperability should be a default option for all the users, there has to be a user-friendly way of opt-out for the user who wishes to compartmentalise different kinds of messages depending upon the platform used. The unique identification information (in case of a new dedicated number) of a user who had opted out must be ceased to avoid misuse.One of the major reasons users opt-out of interoperability services could be to keep various digital public spheres (personal, leisure, professional, etc.) distant. To tackle this dilemma of the users, the messaging platforms should enable options such as (a) the optional notification for cross-platform messages with the snooze option, so that the user can decide if she wants the cross-platform message to hit the enrolled messaging platform at the given time. (b) The messaging platform should enable the “opt-out from messaging platform” setting for the users to disable messages from a list of platforms. Besides, users might choose to opt-out due to lack of trust. This has to be tackled by both the message gateway entities by creating awareness amongst the users on their rights and messaging platforms by providing a user-friendly privacy policy.&lt;br /&gt;&lt;br /&gt;&lt;/p&gt;
&lt;/li&gt;&lt;li style="list-style-type: disc;" dir="ltr"&gt;
&lt;p dir="ltr"&gt;​​Data Protection: As the emergence of message gateway entities creates new data flow, this new flow of data has to take a data minimisation approach. Message gateway entities should be recognised as the data processor (one who processes data for data fiduciary, i.e., messaging platforms). They should adhere to the upcoming Personal Data Protection regime&lt;a href="#_ftn18"&gt;[18]&lt;/a&gt; to protect the data principals' personal data and collect personal data as per the proportionality principle. Message gateway entities should not collect any non-personal data or process any form of data to infer the behavioural traits of the data principals or messaging platforms. In addition to this, the name of the message gateway entity enrolled by the messaging platform, data collected and processed by the message gateway entity should be disclosed to the data principals through the messaging platform’s privacy policy.&lt;br /&gt;&lt;br /&gt;&lt;/p&gt;
&lt;/li&gt;&lt;li style="list-style-type: disc;" dir="ltr"&gt;
&lt;p dir="ltr"&gt;Licensing: There should be a certain level of restriction on licensing to create a level playing field. Applicants for message gateway entities should not have an economic interest in any messaging platforms or social media intermediaries. Applicants have to ensure that the delivery failure of the messages should be at the level of 2% to 1%. Besides, to ensure low levels of delivery failure, data protection compliance and to check other requirements, message gateway entities have to go through technical and regulatory sandbox testing before issuing a license.&lt;br /&gt;&lt;br /&gt;&lt;/p&gt;
&lt;/li&gt;&lt;li style="list-style-type: disc;" dir="ltr"&gt;
&lt;p dir="ltr"&gt;Consumer Protection: Users should be given a choice to block another user (using unique identification information) for various reasons such as personal, non-personal, phishing etc. After a stipulated number of blocking by multiple users, the suspected user should be denied access (temporarily or permanently according to the reasons) to message gateway entities. Before denying access, the message gateway entities should indicate the messaging platforms to notify the user. There has to be a robust grievance redressal mechanism for users and messaging platforms to raise their complaints regarding blocking, data protection, phishing etc. Besides, unique identification information has to be leveraged to prevent bot accounts and imposters. In addition to this, message gateway entities should be compatible with measures taken by messaging platforms to prevent the spread of disinformation and misinformation (such as restrictions on the number of recipients for forward messages).&lt;/p&gt;
&lt;/li&gt;&lt;/ul&gt;
&lt;p dir="ltr"&gt;&amp;nbsp;&lt;/p&gt;
&lt;p dir="ltr"&gt;The figure below showcases the use case of the message exchange with the introduction of message gateway entities.&lt;/p&gt;

&lt;p dir="ltr"&gt;2.2. Portability Feature to Compliment Interoperability&lt;/p&gt;
&lt;p dir="ltr"&gt;In the case of messaging platforms, when we talk about portability, it is essential to differentiate it into two: (a) portability of the unique identification information of the user from one platform to other seamlessly (b) portability of the user data from one platform to other followed by the portability of unique identification information. As the generation of unique identification information is facilitated by the message gateway entities, the portability of the same has to be done by the respective messaging gateway entity. Adopting some features of process and protocols from Mobile Number Portability&lt;a href="#_ftn19"&gt;[19]&lt;/a&gt; mandated by the Telecom Regulatory Authority of India, standard-setting council for messaging gateway entities (discussed above) should streamline the unique identification information portability process across messaging gateway entities.&lt;/p&gt;
&lt;p dir="ltr"&gt;Followed by the unique identification information porting, the message gateway entities should trigger a notification to the messaging platform (on behalf of the user) to transfer user data towards the requested platform. As mentioned in chapter V, section 19(1)(b) of The Personal Data Protection Bill, 2019, messaging platforms should transfer the user data towards the platform notified by the message gateway entity in the suggested or compatible format.&lt;/p&gt;
&lt;p dir="ltr"&gt;Globally since the emergence of the General Data Protection Regulation (GDPR) and other legislation that mandates data portability, platforms have launched the Data Transfer Project (DTP)&lt;a href="#_ftn20"&gt;[20]&lt;/a&gt; in 2018 to create a uniform format to port data. There are three components to the DTP, of which two are crucial, i.e., Data models and Company Specific Adapter. A Data Model is a set of common formats established through legislation to enable portability; in the case of messaging platforms, the standard-setting council can come up with the Data Model.&lt;/p&gt;
&lt;p dir="ltr"&gt;Under Company Specific Adapter, there are Data Adapters and Authentication Adapters. The Data Adapter converts the exporter platform’s data format into the Data Model and then into the importer platform’s data format. The Authentication Adapter enables users to provide consent for the data transfer. While Company Specific Adapters under DTP are broadly for digital platforms, adopting the same framework, message gateway entities can act as both a Data Adapter and as an Authentication Adapter to enable user data portability amongst the messaging platforms. Message gateway entities can help enrolled messaging platforms in format conversion for data portability and support users' authentication process using the unique identification information. Besides, as messaging gateway entities are already uniform and interoperable, cross transfer across message gateway entities can also be made possible.&lt;/p&gt;
&lt;p dir="ltr"&gt;&amp;nbsp;&lt;/p&gt;
&lt;h3&gt;3. Profitability of Message Gateway Entities&lt;/h3&gt;
&lt;p dir="ltr"&gt;As the message gateway entities would operate as for-profits, they may cost the messaging platform one-time enrolment fees for membership through which the member (messaging platform) can avail interoperability and portability services. The enrolment fees should be a capital cost that compensates the messaging gateway entities for enabling technical interoperability. In addition to this, message gateway entities may levy minimal yearly fees to maintain the system, customer (messaging platforms) service and grievances portal (for both users and messaging platforms). Besides, in terms of update (as per new standards) or upgradation of the system, message gateway entities may charge an additional fee to the member messaging platforms.&lt;/p&gt;
&lt;p dir="ltr"&gt;On the other hand, messaging platforms don’t charge&lt;a href="#_ftn21"&gt;[21]&lt;/a&gt; a monetary fee for the service because the marginal cost of providing the service is near zero, while they incur only fixed cost. Besides, nothing is free in the platform economy as we pay the messaging platforms in the form of our personal and non-personal (behavioural) data, which they sell to advertisers&lt;a href="#_ftn22"&gt;[22]&lt;/a&gt;.&amp;nbsp;&lt;/p&gt;
&lt;p dir="ltr"&gt;Therefore, messaging platforms have to consider the fee paid to the message gateway entities as part of their fixed cost such that they continue not to charge (monetary) users for the service as the cost-per-user would still be very low. Besides, messaging platforms also have economic incentives in providing interoperability as it could reduce multi-homing (i.e., when some users join or use multiple platforms simultaneously).&lt;/p&gt;
&lt;p dir="ltr"&gt;&amp;nbsp;&lt;/p&gt;
&lt;h3&gt;4. Conclusion&lt;/h3&gt;
&lt;p dir="ltr"&gt;While breaking up Facebook and other bigger social media or messaging platforms could bring a level playing field, this process could consume a large portion of resources and time. Irrespective of a breakup, in the absence of interoperability and portability, the network effect will favour few platforms due to high switching cost, which leads to a high entry barrier.&lt;/p&gt;
&lt;p dir="ltr"&gt;When we text users using Short Message Service (SMS), we don't think about which carrier the recipient uses. Likewise, messaging across messaging platforms should be platform-neutral by adopting interoperability and portability features. Besides, interoperability and portability will also bring healthy competition, which would act as a lever to enhance user choice and privacy.&lt;/p&gt;

    <title>Internet users fume as govt blocks 32 sites</title>

&lt;p style="text-align: justify; "&gt;The ban has angered free-speech proponents who allege that the Narendra Modi government is using national security as a pretext to censor online content. On Wednesday, tweets criticising the restrictions were trending on #GOIBlocks. Senior lawyer Karuna Nandy said that she would challenge the DoT order in the Supreme Court.&lt;br /&gt;&lt;br /&gt;Apart from Dailymotion and Vimeo, Internet service providers have also been ordered to block Github and Pastebin, which are popular among programmers; Weebly, a free website creator; and Archive.org, a non-profit digital library.&lt;br /&gt;&lt;br /&gt;Some Internet users, however, were able to access some of the sites. This could be because their Internet service providers have not yet implemented the DoT order or because the government has lifted restrictions on some web addresses, according to activists monitoring the blockage of the websites.&lt;br /&gt;&lt;br /&gt;The order was issued under Section 69A (procedure for blocking public access) of the Information Technology Act, 2000. The section allows authorities to block websites without giving any formal reason or making any public announcement.&lt;br /&gt;&lt;br /&gt;However, Arvind Gupta, BJP's national head for information and technology, tweeted that the sites had been blocked over security concerns. "The Web sites have been blocked based on an advisory by Anti-Terrorism Squad, and were carrying Anti India content from ISIS.The sites that have removed objectionable content andor cooperated with the ongoing investigations, are being unblocked," he wrote.&lt;br /&gt;&lt;br /&gt;Gupta, however, did not explain how the sites were being misused by terrorists. Some of the sites are mostly frequented by programmers looking for open-source software and codes.&lt;br /&gt;&lt;br /&gt;Nandy, a Supreme Court lawyer who specialises in human rights litigations, criticised the ban. "I will challenge the order in the Su preme Court this week. I will seek directions to lift the secrecy surrounding such bans and also request for a right to appeal," she said.&lt;br /&gt;&lt;br /&gt;She added that censoring the Internet was against the idea of free expression guaranteed under the Constitution. "Such steps are not good for a healthy society," she said.&lt;br /&gt;&lt;br /&gt;Pranesh Prakash, a policy director with the Centre for Internet and Society and one of the most vocal opponents of the blockage, said that the people had the right to know why the websites had been blocked.&lt;br /&gt;&lt;br /&gt;"We still don't know why these blocks were issued: was it an overzealous copyright lawyer who found an indulgent judge to issue an overbroad and baseless order? Or was it a public servant who wrongly directed the Department of Electronics and IT to block the sites under the IT Act? We have no idea," said Prakash, who tweeted a picture of the DoT order on Wednesday.&lt;br /&gt;&lt;br /&gt;He added that websites were frequently blocked without clear evidence of wrongdoing. "These laws must be changed," Prakash said.&lt;br /&gt;&lt;br /&gt;Internet users also voiced their anger over the DoT order. "This only proves ATS is an idiot. If terrorists use buses, phones &amp;amp; Whatspp, you'll block whole system? #GOIBlocks," Poonam Sharma tweeted.&lt;br /&gt;&lt;br /&gt;Some users retweeted a Modi post from August 2012: "As a common man, I join the protest against crackdown on freedom of speech!"&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;What would have gone wrong if India’s telecom regulator Trai had decided to support programmes like Facebook’s Free Basics and Airtel’s Zero Rating instead of issuing the regulation that prohibits discriminatory tariffs? Here are possible scenarios to look at in case the discriminatory tarrifs were allowed as they are in some countries.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Possible impact on elections&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Facebook would have continued to amass its product — eyeballs. Indian eyeballs would be more valuable than others for three reasons 1. Facebook would have an additional layer of surveillance thanks to the Free Basics proxy server which stores the time, the site url and data transferred for all the other destinations featured in the walled garden 2. As part of Digital India, most government entities will set up Facebook pages and a majority of the interaction with citizens would happen on the social media rather than the websites of government entities and, consequently, Facebook would know what is and what is not working in governance 3. Given the financial disincentive to leave the walled garden, the surveillance would be total.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;What would this mean for democracies? Eight years ago, Facebook began to engineer the News Feed to show more posts of a user’s friends voting in order to influence voting behavior. It introduced the “I’m Voting” button into 61 million users’ feeds during the 2010 US presidential elections to increase voter turnout and found that this kind of social pressure caused people to vote. Facebook has also admitted to populating feeds with posts from friends with similar political views. During the 2012 Presidential elections, Facebook was able to increase voter turnout by altering 1.9 million news feeds.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Indian eyeballs may not be that lucrative in terms of advertising. But these users are extremely valuable to political parties and others interested in influencing elections. Facebook’s notifications to users when their friends signed on to the “Support Free Basics” campaign was configured so that you were informed more often than with other campaigns. In other words, Facebook is not just another player on their platform. Given that margins are often slim, would Facebook be tempted to try and install a government of its choice in India during the 2019 general elections?&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;In times of disasters&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Most people defending Free Basics and defending forbearance as the regulatory response in 2015/16 make the argument that “95 per cent of Internet users in developing countries spend 95 per cent of their time on Facebook”.&lt;br /&gt;&lt;br /&gt;This is not too far from the truth as LirneAsia demonstrated in 2012 with most people using Facebook in Indonesia not even knowing they were using the internet. In other words, they argue that regulators should ignore the fringe user and fringe usage and only focus on the mainstream. The cognitive bias they are appealing to is smaller numbers are less important.&lt;br /&gt;&lt;br /&gt;Since all the sublime analogies in the Net Neutrality debate have been taken, forgive us for using the scatological. That is the same as arguing that since we spend only 5% of our day in toilets, only 5% of our home’s real estate should be devoted to them.&lt;br /&gt;&lt;br /&gt;Everyone agrees that it is far easier to live in a house without a bedroom than a house without a toilet. Even extremely low probabilities or ‘Black Swan’ events can be terribly important! Imagine you are an Indian at the bottom of the pyramid. You cannot afford to pay for data on your phone and, as a result, you rarely and nervously stray out of the walled garden of Free Basics.&lt;br /&gt;&lt;br /&gt;During a natural disaster you are able to use the Facebook Safety Check feature to mark yourself safe but the volunteers who are organising both offline and online rescue efforts are using a wider variety of platforms, tools and technologies.&lt;br /&gt;&lt;br /&gt;Since you are unfamiliar with the rest of the Internet, you are ill equipped when you try to organise a rescue for you and your loved ones.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Content and carriage converge&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Some people argue that TRAI should have stayed off the issue since the Competition Commission of India (CCI) is sufficient to tackle Net Neutrality harms. However it is unclear if predatory pricing by Reliance, which has only 9% market share, will cross the competition law threshold for market dominance? Interestingly, just before the Trai notification, the Ambani brothers signed a spectrum sharing pact and they have been sharing optic fibre since 2013.&lt;br /&gt;&lt;br /&gt;Will a content sharing pact follow these carriage pacts? As media diversity researcher, Alam Srinivas, notes “If their plans succeed, their media empires will span across genres such as print, broadcasting, radio and digital. They will own the distribution chains such as cable, direct-to-home (DTH), optic fibre (terrestrial and undersea), telecom towers and multiplexes.”&lt;br /&gt;&lt;br /&gt;What does this convergence vision of the Ambani brothers mean for media diversity in India? In the absence of net neutrality regulation could they use their dominance in broadcast media to reduce choice on the Internet? Could they use a non-neutral provisioning of the Internet to increase their dominance in broadcast media? When a single wire or the very same radio spectrum delivers radio, TV, games and Internet to your home — what under competition law will be considered a substitutable product? What would be the relevant market? At the Centre for Internet and Society (CI S), we argue that competition law principles with lower threshold should be applied to networked infrastructure through infrastructure specific non-discrimination regulations like the one that Trai just notified to protect digital media diversity.&lt;br /&gt;&lt;br /&gt;Was an absolute prohibition the best response for TRAI? With only two possible exemptions — i.e. closed communication network and emergencies - the regulation is very clear and brief. However, as our colleague Pranesh Prakash has said, TRAI has over regulated and used a sledgehammer where a scalpel would have sufficed. In CIS’ official submission, we had recommended a series of tests in order to determine whether a particular type of zero rating should be allowed or forbidden. That test may be legally sophisticated; but as TRAI argues it is clear and simple rules that result in regulatory equity. A possible alternative to a complicated multi-part legal test is the leaky walled garden proposal. Remember, it is only in the case of very dangerous technologies where the harms are large scale and irreversible and an absolute prohibition based on the precautionary principle is merited.&lt;br /&gt;&lt;br /&gt;However, as far as network neutrality harms go, it may be sufficient to insist that for every MB that is consumed within Free Basics, Reliance be mandated to provide a data top up of 3MB.&lt;br /&gt;&lt;br /&gt;This would have three advantages. One, it would be easy to articulate in a brief regulation and therefore reduce the possibility of litigation. Two, it is easy for the consumer who is harmed to monitor the mitigation measure and last, based on empirical data, the regulator could increase or decrease the proportion of the mitigation measure.&lt;br /&gt;&lt;br /&gt;This is an example of what Prof Christopher T. Marsden calls positive, forward-looking network neutrality regulation. Positive in the sense that instead of prohibitions and punitive measures, the emphasis is on obligations and forward-looking in the sense that no new technology and business model should be prohibited.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;What is Net neutrality?&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;According to this principle, all service providers and governments  should not discriminate between various data on the internet and  consider all as one. They cannot give preference to one set of apps/  websites while restricting others.&lt;/p&gt;

&lt;li&gt;&lt;b&gt;2006&lt;/b&gt;: TRAI invites opinions regarding the regulation of net neutrality from various telecom industry bodies and stakeholders&lt;b&gt;Feb. 2012&lt;/b&gt;: Sunil Bharti Mittal, CEO of Bharti Airtel,  suggests services like YouTube should pay an interconnect charge to  network operators, saying that if telecom operators are building  highways for data then there should be a tax on the highway&lt;/li&gt;

        &lt;b&gt;Building on the workshop in Dagstuhl in June-July 2011 (International View of the State-of-the-Art of Cryptography and Security and its Use in Practice), Beijing  (International View of the State-of-the-Art of Cryptography and Security and its Use in Practice  II), and Athens (International View of the State-of-the-Art of Cryptography and Security and its Use in Practice  III) that set the stage for discussions on cryptography among a group of key researchers from Europe, Asia, and North America, the  one day workshop in Bangalore, following AsiaCrypt 2013  will again bring together internationally recognized scientists to discuss direction and development in  theoretical and applied cryptography and surrounding societal issues. &lt;/b&gt;

    <title>Indians Ask: Is Visiting a Torrent Site Really A Crime? </title>

        &lt;b&gt;India has banned various large-scale torrent sites for a long time — this is old news. But under a new federal policy in India, one can be jailed for three years and fined 300,000 Indian Rupees (~US $4464) for downloading content on any of these blocked websites.&lt;/b&gt;

&lt;p style="text-align: justify; "&gt;Netizens who regularly use these and similar services have become anxious about what the rule may mean for them. Last week, a new legal notice concerning copyright violations sparked widespread rumors that users could be penalized for simply viewing torrent sites.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The notice now appears when one visits any of the banned websites. It reads:&lt;/p&gt;
&lt;blockquote class="quoted" style="text-align: justify; "&gt;This URL has been blocked under the instructions of the Competent Government Authority or in compliance with the orders of a Court of competent jurisdiction. Viewing, downloading, exhibiting or duplicating an illicit copy of the contents under this URL is punishable as an offence under the laws of India, including but not limited to under Sections 63, 63-A, 65 and 65-A of the Copyright Act, 1957 which prescribe imprisonment for 3 years and also fine of upto Rs. 3,00,000/-. Any person aggrieved by any such blocking of this URL may contact at urlblock@tatacommunications.com who will, within 48 hours, provide you the details of relevant proceedings under which you can approach the relevant High Court or Authority for redressal of your grievance.&lt;/blockquote&gt;
&lt;p style="text-align: justify; "&gt;Soon after news of the notice began to circulate, the &lt;a href="https://en.wikipedia.org/wiki/Chennai_High_Court"&gt;Chennai High Court &lt;/a&gt;– one of the oldest courts in India — issued a John Doe &lt;a href="http://indiatoday.intoday.in/technology/story/830-more-websites-blocked-in-india-many-torrent-links-in-list/1/748565.html"&gt;order&lt;/a&gt; to block as many as 830 websites, including several &lt;a href="http://delhihighcourt.nic.in/dhcqrydisp_o.asp?pn=119642&amp;amp;yr=2014"&gt;torrent websites &lt;/a&gt;such as thepiratebay.se, torrenthound.com, and kickasstorrents.come.in.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Indian  tech news portal Medianama published a blog post arguing that it is the  downloading of pirated content from certain banned websites and not  accessing those website that should lead to the legal issues. The  problem, it seems, lies in the poor wording of the notice. Medianama  described this as “bizarre by any rational standard” and noted that,  taken literally, it does not comply with the Indian Copyright Act.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;a href="http://mhrd.gov.in/sites/upload_files/mhrd/files/upload_document/CprAct.pdf"&gt;Digital piracy legislation&lt;/a&gt; in India has been modified quite a lot in the recent times in general and over &lt;a href="http://indianexpress.com/article/blogs/torrent-ban-long-term-anti-piracy-strategy-or-just-scare-tactics-2990790/"&gt;last five years&lt;/a&gt; in particular (Sections 63, 63A and 65 of the &lt;a href="http://mhrd.gov.in/sites/upload_files/mhrd/files/upload_document/CprAct.pdf"&gt;Indian Copyright Act of 1957&lt;/a&gt; in particular.) But it has not been implemented with such force in the past.&lt;/p&gt;

&lt;h3&gt;What is a torrent?&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;A &lt;a href="https://en.wikipedia.org/wiki/Torrent_file"&gt;torrent&lt;/a&gt; is part of a system that enables &lt;a href="https://en.wikipedia.org/wiki/Peer-to-peer_file_sharing" title="Peer-to-peer file sharing"&gt;peer-to-peer file sharing&lt;/a&gt; (“P2P”) that is used to distribute data and electronic files over the &lt;a href="https://en.wikipedia.org/wiki/Internet" title="Internet"&gt;Internet&lt;/a&gt;. Known as &lt;a href="http://www.bittorrent.org/beps/bep_0003.html"&gt;BitTorrent&lt;/a&gt;, this file distribution system is one of the most common technical protocols for transferring large files, such as &lt;a href="https://en.wikipedia.org/wiki/Digital_audio" title="Digital audio"&gt;digital audio&lt;/a&gt; files containing &lt;a class="mw-redirect" href="https://en.wikipedia.org/wiki/TV_show" title="TV show"&gt;TV shows&lt;/a&gt; or &lt;a href="https://en.wikipedia.org/wiki/Video_clip" title="Video clip"&gt;video clips&lt;/a&gt; or &lt;a href="https://en.wikipedia.org/wiki/Digital_audio" title="Digital audio"&gt;digital audio&lt;/a&gt; files containing &lt;a href="https://en.wikipedia.org/wiki/Song" title="Song"&gt;songs&lt;/a&gt;.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Within this system, files labeled with the .torrent extension contain  meta data about files — e.g. file names, their sizes, folder structure  and cryptographic hash value for integrity verification. They do not  contain the content to be distributed, but without them, the system does  not work. (via &lt;a href="https://en.wikipedia.org/wiki/Torrent_file"&gt;Wikipedia&lt;/a&gt;)&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;This is not the first time India has put a blanket ban on such sites. In  December 2014, 32 websites — including including code repository &lt;a href="http://github.com" target="_blank"&gt;Github&lt;/a&gt;, video streaming sites &lt;a href="http://vimeo.com" target="_blank"&gt;Vimeo &lt;/a&gt;and &lt;a href="http://dailymotion.com" target="_blank"&gt;Dailymotion&lt;/a&gt;, online archive &lt;a href="http://archive.org" target="_blank"&gt;Internet Archive&lt;/a&gt;, free software hosting site &lt;a href="http://sourceforge.net" target="_blank"&gt;Sourceforge&lt;/a&gt; — were &lt;a href="https://globalvoices.org/2015/01/06/indian-netizens-criticize-online-censorship-of-jihadi-content/"&gt;banned&lt;/a&gt; in India. They were later unblocked after agreeing to remove some ISIS-related content.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;As they have in the past, tech-savvy netizens began &lt;a href="http://www.best-bittorrent-vpn.com/torrents-in-india-2.html?utm_expid=67369992-5.J37bjQyhR4O_JO3YAkii3g.1&amp;amp;utm_referrer=https%3A%2F%2Fwww.google.co.in%2F"&gt;suggesting hacks&lt;/a&gt; to mask or fake one's IP address. Sumiteshwar Choudhary, a practicing  criminal and matrimony lawyer, described on Quora how the law had  existed for quite some time but the government had never fully enforced  it:&lt;/p&gt;

Abraham was in New Delhi to speak on  the impact of media, social media and technology on governance and  democracy, organized by the Observer Research Foundation together with  the Rosa Luxemburg Stiftung. On the sidelines of the conference, he  talked about the role that online media will play in forthcoming  elections as well the behaviour of online readers of news.&lt;/p&gt;
&lt;div class="p" id="U191681512343dhE" style="text-align: justify; "&gt;Edited excerpts from the interview:&lt;/div&gt;
&lt;div class="p" style="text-align: justify; "&gt;&lt;b&gt;How important will digital media be for the forthcoming elections?&lt;/b&gt;&lt;/div&gt;
&lt;div class="p" id="U1916815123431q" style="text-align: justify; "&gt;I  think the Internet in India is very different from, say, the one found  in the US. So, our capacity to read from similar experience in their  elections is limited. If you take the extensive exposure that the (&lt;span class="person"&gt;&lt;a href="http://www.livemint.com/Search/Link/Keyword/Barack%29%20Obama"&gt;Barack) Obama&lt;/a&gt;&lt;/span&gt; campaign had on the online space and the manner in which it supposedly helped the campaign, I don’t see that happening here.&lt;/div&gt;
&lt;div class="p" style="text-align: justify; "&gt;&lt;/div&gt;
&lt;div class="p" id="U191681512343pXH" style="text-align: justify; "&gt;&lt;b&gt;Politicians and political parties very active on social media. You don’t think that will have an effect on elections?&lt;/b&gt;&lt;/div&gt;
&lt;div class="p" id="U191681512343VUC" style="text-align: justify; "&gt;I  think the missing part of the equation till now is that there has not  been any devising—to my knowledge—of targeting of voters through &lt;span class="brand"&gt;&lt;a href="http://www.livemint.com/Search/Link/Keyword/Facebook"&gt;Facebook&lt;/a&gt;&lt;/span&gt; or &lt;span class="brand"&gt;&lt;a href="http://www.livemint.com/Search/Link/Keyword/Twitter"&gt;Twitter&lt;/a&gt;&lt;/span&gt;.  Our digital footprint leads to immense big-data opportunities, which I  do not see politicians in India being able to exploit. Again, to give an  example from the United States, there were certain instances there from  where if you were member of a particular community, you could be  targeted by political campaigns. Here, I don’t see that happening that  easily.&lt;/div&gt;

&lt;div class="p" style="text-align: justify; "&gt;&lt;b&gt;So our politicians are wasting their time on social media?&lt;/b&gt;&lt;/div&gt;
&lt;div class="p" style="text-align: justify; "&gt;Not entirely. In my view, one of the good things that the Internet does  is that it has the capacity to democratize public opinion. One must also  keep in mind that networks such as the ones available through social  media are not homogenous. So nodes such as users who are opinion-makers  and journalists are active on these networks, and so politicians can use  these methods to reach out to more people.&lt;/div&gt;
&lt;div class="p" style="text-align: justify; "&gt;&lt;/div&gt;
&lt;div class="p" style="text-align: justify; "&gt;&lt;b&gt;Does the traditional media still have a role?&lt;br /&gt;&lt;/b&gt;Of course. Traditional media is more likely to determine political  outcomes in comparison to social media because most of the links that we  see in social media are related to content that is created on  traditional media. Now, of course, we can be sceptical of the role that  traditional media plays in influencing the general mood of the country,  but that is a different question.&lt;/div&gt;
&lt;div class="p" style="text-align: justify; "&gt;&lt;/div&gt;
&lt;div class="p" style="text-align: justify; "&gt;&lt;b&gt;Is there something peculiar about the manner in which readers interact with newspaper reports online?&lt;br /&gt;&lt;/b&gt;I think one can usually see the comments section of some news sites  littered with hurtful and hateful comments. So, some readers such as  myself basically go through these comments to look at trolling and also  sometimes for comic relief. But again, every news organization seems to  be dealing with this differently. &lt;i&gt;The Times of India&lt;/i&gt;, doesn’t, in my view, regulate its comments section. But one can see, say, in &lt;i&gt;The Hindu&lt;/i&gt;, that readers’ comments are regulated and are usually very thoughtful.&lt;/div&gt;
&lt;div class="p" style="text-align: justify; "&gt;&lt;/div&gt;
&lt;div class="p" style="text-align: justify; "&gt;&lt;b&gt;Is there any particular reason why certain news readers respond the way they do?&lt;br /&gt;&lt;/b&gt;
&lt;div class="p" id="U191681512343D1D"&gt;Well,  a part of the reason why people consuming news online comment and  interact the way they do is that anonymity produces a level of freedom  that allows people to be more brutal in their behaviour online.&lt;br /&gt;&lt;br /&gt;At  the same time, you can also see, in some instances, the chilling effects  of surveillance, where people end up censuring their thoughts on  issues. Of course, surveillance is not the answer. Societies need to  deal with hateful threats on their own terms.&lt;/div&gt;
&lt;div class="p"&gt;&lt;/div&gt;
&lt;div class="p"&gt;&lt;b&gt;What will it take for politicians and public figures to get their  message across, given the idiosyncrasies of the Indian digital media?&lt;br /&gt;&lt;/b&gt;I think two components are crucial: trust and authenticity. For example, in the case of Wikipedia, there is an assumed amount of trust that the user has. The trust relationship between public figures who are active online and the public also is a two-way street. Politicians must also trust their common party members to use their social media presence as and when they want to. For example, why don’t they allow each and every member of the political party to man their Twitter handle for a day?&lt;/div&gt;
&lt;div class="p"&gt;&lt;/div&gt;
&lt;div class="p"&gt;As for authenticity, the human mind can say whether an act by someone online is authentic or not.&lt;/div&gt;
&lt;div class="p"&gt;&lt;/div&gt;
&lt;div class="p"&gt;&lt;b&gt;Finally, what is your view on the role that larger Internet monopolies such as Facebook and &lt;span class="brand"&gt;&lt;a href="http://www.livemint.com/Search/Link/Keyword/Google"&gt;Google&lt;/a&gt;&lt;/span&gt; are playing across the digital plane?&lt;/b&gt;&lt;/div&gt;
&lt;div class="p"&gt;&lt;br /&gt;The Internet has also changed over the past 15 years. It used to be a  decentralized network. Everybody was hopeful that it would have  democratizing potential and, therefore, techno-utopianism was born. Now,  it is increasingly clear that a small proportion of websites have 90%  of the traffic and large corporations such as Google and Facebook play a  significant role in configuring the attention economy. They are now  also beginning to take this role very seriously themselves. In the case  of Google, increasingly Google is using its power over the attention  economy to play a role in the electoral process in India. They have been  holding Google Hangouts and what they have been able to do is bring the  public to the politicians.&lt;/div&gt;
&lt;div class="p"&gt;&lt;/div&gt;
&lt;div class="p"&gt;Other concerns such as Facebook and Twitter through their walled-garden  arrangements with telecom companies also play a similar role in  configuring the attention economy. One is more innocuous—like the manner  in which their algorithms are structured determining who shows up in  their feeds.&lt;/div&gt;
&lt;/div&gt;

&lt;p style="text-align: justify; "&gt;A specially-trained team of 20 police officers will staff the lab,  which was launched over the week end and will work around the clock to  keep an eye on issues being publicly discussed and track matters  relating to public order.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"They will work under Special Branch.  They will monitor and find out which topics are trending among the youth  so we can plan law and order in a good way," police spokesman  Satyanarayan Choudhary told AFP on Monday.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In November police  sparked outrage and fierce debate about India's Internet laws by  arresting two young women over a Facebook post criticising the shutdown  of Mumbai after the death of a local hardline politician.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The pair  were arrested under laws including section 66a of the Information  Technology Act, which forbids "sending false and offensive messages  through communication services" and can lead to three years in jail.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The case followed several arrests across the country for political cartoons or comments made online.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Sunil  Abraham, executive director of the Bangalore-based Centre for Internet  and Society research group, said the "natural reaction" was to worry  about the new police lab given the way the law has been used.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"Police  in the last four years have acted in an arbitrary and random fashion,  often using the IT Act to settle political scores," he told AFP.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"When there's no crisis for the police, proactively keeping an eye on what people are saying or doing is overkill," he said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Choudhary  said the lab was not set to censor comments, echoing a statement made  by police commissioner Satyapal Singh at the launch.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"By reading  the mindset of what people are writing on various modes of  communication, we will try to provide better and improved safety and  security to the Mumbai citizens," Singh said.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Like many of his peers in ministries across New Delhi, IT Minister Kapil Sibal's office recently sent an email inviting journalists to the launch of his new personal website using the free email service.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Others, including senior foreign ministry officials, the information and broadcasting minister and the health ministry secretary, also use Gmail, Hotmail or Yahoo instead of their government accounts.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;When asked why he continued to use his Hotmail for official use, Sibal declined to comment, but a senior bureaucrat in his ministry admitted that he personally preferred Gmail because it is "just a lot easier".&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"We keep moving, get different designations, go different places and with that, our emails change. You lose contacts and important emails, which you don't need to worry about with a Gmail account," the bureaucrat told AFP.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"To be honest, the quality of our official mail isn't that great yet. It still needs some work," he added on condition of anonymity.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Security concerns&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;IT security expert Sunil Abraham said the use of Gmail and the like was highly risky since the American services had their servers in the US and the National Security Agency has been known to tap into their database systems.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is unclear how many state and federal public workers actively use popular email services for office, but some of the estimates are startling.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"As much as 90 percent of government officials use private email (services) for official use... that's because their official email is not as stable or speedy," said Abraham, executive director of the Bangalore-based Centre for Internet and Society.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In September Sibal's ministry announced a new "Email Policy of the Government of India" in the wake of spying allegations about the NSA revealed by former NSA contractor Edward Snowden.&lt;br /&gt;NSA's tentacles not only crept into the Indian embassy in Washington and its UN office in New York, but also accessed email and chat messenger contact lists of hundreds of millions of ordinary citizens worldwide, according to media reports.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;During a single day last year, the NSA's Special Source Operations branch collected 444,743 email address books from Yahoo, 105,068 from Hotmail, 82,857 from Facebook, 33,697 from Gmail and 22,881 from unspecified other providers, The Washington Post said, according to an internal NSA presentation.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The $11 million Indian project aims to bring some five million public employees onto the government's email domain powered by the National Informatics Centre (NIC) as early as mid-December.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is awaiting clearances and suggestions from all ministries before the proposal goes to the cabinet this month.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;J. Satyanarayana, secretary of the department of electronics and IT, dismissed claims that the policy was too late and was a response to the Snowden scandal.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"The policy is not a reaction to any global spying revelations, it was already in the works. It is just a mere coincidence that both came around the same time," he said.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Fresh doubts&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Some cyber security experts say bringing millions aboard a centralised server could make a hacker's job easier, with all critical government information available on a single platform.&lt;br /&gt;More than 11,000 Indian websites were hacked or defaced between May and August this year, with a large number of attacks on the ".in" domain whose servers are in India, the Times of India reported last month.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"Making the use of a centralised government server is not the best way to proceed. Having everything on one platform makes it even more vulnerable to cyber attacks and hacking," said Abraham.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"It also brings about new worries of the NIC becoming the local snoop."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Some also predict that the ambitious policy would eventually fizzle out for lack of attention from ministers and bureaucrats, who work in government offices where stacks of yellowing files and papers are still a common sight.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"It's sad but most of these officials don't understand much about technology, so mastering email is something that is miles and miles away," said Vijay Mukhi, a Mumbai-based cyber security expert.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"These guys saw all the snooping news and suddenly they woke up and said 'lets make an email policy'. Enforcing this is not possible on a practical basis."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The IT ministry also plans to conduct workshops to teach employees about email security such as when to change passwords and user names and how to use email.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"Every employee should know how, what and when critical data can be vulnerable... with most work still done on paper, it is important to know the nitty-gritty of using email," Satyanarayana said.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;A confidential department of telecom  order – dated December 17, 2014 – instructing all internet service  licensees to block the websites appeared online on Wednesday.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;When contacted to verify the news, Dr  Gulshan Rai – Director of the Indian Computer Emergency Response Team  (CERT-In) – told, the directions had been issued to internet service  providers following a Mumbai Additional Chief metropolitan magistrate’s  November order directing the government’s Department of Electronics and  Information Technology (DeitY) to implement the same.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Pranesh Prakash – Policy Director at  Bengaluru-based Center for Internet and Society – questioned the lack of  transparency around the practice of blocking websites under the Indian  law. “Qn for govt: Why does the law require secrecy of web blocking  orders when it doesn’t allow such secrecy for books, films? #GoIBlocks,”  he tweeted, adding, “The 69A Rules don’t allow for transparency,  accountability, time-limits on blocks, etc. So easily misused by govt. +  courts + individuals.” The websites were blocked under section 69 A of  the IT Act, 2000 and the IT (Procedure and sdafeguards for Blocking of  Access of Information by Public) rules, 2009.&lt;/p&gt;

&lt;p class="hs-text-container" style="text-align: justify; "&gt;&lt;span class="Italic Web"&gt;I Am a Troll: Inside the Secret World of the BJP’s Digital Army&lt;/span&gt;,  by the journalist Swati Chaturvedi, alleges that the party’s social  media warriors carry out organised harassment, threatening critics of  the BJP with assault, sexual violence and even murder.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Although other parties also have social media units, the BJP’s is particularly well organised and vociferous, Chaturvedi wrote.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The  BJP social media cell is active on Twitter and Facebook, as well as in  the comments sections of articles on news websites, Chaturvedi found.  Some of the abusive PRO-BJP Twitter handles are still followed by Mr  Modi’s official Twitter account.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span class="Italic Web"&gt;I Am a Troll&lt;/span&gt; is based largely upon the account of Sadhavi Khosla, now an activist  but formerly a volunteer for two years in the BJP’s social media cell,  which went into top gear during the parliamentary elections in 2014 when  Mr Modi beat the incumbent Congress party led by Sonia Gandhi and her  son Rahul.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mr  Modi campaigned on a platform of fervent nationalism, drawing upon the  BJP’s Hindu chauvinist credentials to attract votes. His party’s social  media cell responded accordingly.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"It was a never-ending drip  feed of hate and bigotry against the minorities, the Gandhi family,  journalists on the hit list, liberals, anyone perceived as anti-Modi,"  Ms Khosla told Chaturvedi.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The BJP has responded to the claims  made in the book by accusing Ms Khosla of political bias, saying she  "supports the Congress [and] has all reasons to publish unsubstantiated  claims". -In fact, she has never revealed her own political leanings, or  even whether she has any.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Arvind  Gupta, the head of the BJP’s information technology cell, denies the  party encouraged trolling or that Ms Khosla had been a member of any BJP  unit.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;By way of evidence, Ms Khosla shared with Chaturvedi  screenshots of instructions that were purportedly sent by Mr Gupta to  the operators of the social media cell. "If there was even an  unfavourable mention of [Modi] anywhere, Gupta’s digital tracking tools  would pick it up and the pack of hyena-like trolls would descend," Ms  Khosla said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;One specific campaign cited in &lt;span class="Italic Web"&gt;I Am a Troll&lt;/span&gt; took place in November last year, after the actor Aamir Khan, speaking  as the chief guest at a journalism awards ceremony, remarked upon the  growing intolerance in India. "There is a growing sense of disquiet and  despondency," he said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Ms Khosla said the BJP’s social media cell  was instructed to launch an all-out attack on Khan. She and her  colleagues were also asked to spread a petition calling upon SnapDeal, a  shopping website, to drop Khan as its brand ambassador.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"I  realised that my hero had become a ‘Muslim’," Ms Khosla said in the  book. "For me he had just been an Indian actor. I felt like my country  was changing."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;SnapDeal cut its ties with Khan in February. Ms  Khosla, who said she had been growing increasingly uncomfortable with  the social media cell’s tactics, quit not long after.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"I simply  could not follow directions anymore when I saw rape threats made against  female journalists," she said. "Every day some new person was a target  and they would attack like a swarm of bees with vile sexual innuendoes,  slander, rape and death threats."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Chaturvedi’s book calls for social media companies and police agencies to take such threats more seriously.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"In  the United States, which is a beacon for free speech laws, thousands  are arrested each year — and the courts uphold these allegations as  ‘actionable’ — based on complaints from people who have received violent  threats on social media," she wrote.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"Hate speech, targeted  harassment, threats of rape with graphic details of assault, incitement  to violence — all this is ‘actionable’ too but our police does not act."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Pranesh  Prakash, the policy director at the Centre for internet and Society, a  Bengaluru-based non-profit organisation, noted that although there are  no Indian laws specifically against abusive online behaviour, the  general laws that deal with verbal assault cover online cases as well.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"But I’m not sure how much these cases can be taken forward, given jurisdictional problems," Mr Prakash told &lt;span class="Italic Web"&gt;The National&lt;/span&gt;.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;When  a person complains to police about online abuse, "the first step would  be to establish against whom the case is being made, and doing that is  difficult", he said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Since most social media companies are based  in the US, police agencies would have to approach India’s foreign  ministry which could then invoke a bilateral treaty to gain this  information.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"This can take several months if not longer," Mr  Prakash said. "And most police stations are not equipped to handle such  treaty-based cases."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"Even if the police takes such complaints seriously — and it’s not always clear that they do — there’s no easy way to proceed."&lt;/p&gt;

&lt;div style="text-align: justify; "&gt;The  net neutrality debate has perplexed layman and policy experts alike.  For a developing country like India, where a majority of the population  doesn’t have access to internet, whether government should stick to the  core principles or should it allow flexibility in network management  practices to operators is still not clear yet. Whether India should go  for an overarching, prophylactic regulation (ex ante), prohibiting any  kind of zero rating, or should it adopt evidence-based, contextual  regulation (ex post facto)? Whether zero rating should be allowed and if  allowed then on what conditions? This is what experts from telecom  industry and civil society deliberated in a round table on network  neutrality jointly organised by Observer Research Foundation and Centre  for Internet and Society on Saturday.&lt;br /&gt; &lt;br /&gt; Neutrality refers to open and non-discriminatory nature of internet;  information (or say data packets) has always flown freely on the  network. Facebook, Google and many other internet businesses have  emerged as a result of free and non discriminatory nature of internet.&lt;br /&gt; &lt;br /&gt; Warning against taking a 'doctrinaire' approach to net neutrality, a  telecom industry expert  said that regulators must have flexibility to  respond to market demand in the telecom industry. Adding that Indian  market is unique with more than seven-ten telecom operators providing  internet facility, the expert said that net neutrality will play  differently in developing countries.&lt;br /&gt; &lt;br /&gt; He said if implemented properly, the zero-rating approach or sponsored  content followed by TSPs, “can be one of the ways to scale up internet  access” to the unconnected regions.&lt;br /&gt; &lt;br /&gt; Another industry expert said that the regulations on network neutrality  has to be contextualized in terms of geography. He criticized the  ‘savetheinternet’ movement, which galvanised support of one million  internet users in favour of strict neutrality, for preventing one  billion people from accessing ‘free’ internet. He said that telecom  operators’ revenue from zero rating plans is less than one percent.&lt;br /&gt; &lt;br /&gt; He was also against bringing net neutrality under the purview of  competition commission of India. He said that there are already several  laws related to consumer protection, information technology and monopoly  to deal with situations arising out of neutrality issue.&lt;br /&gt; &lt;br /&gt; An internet freedom activist said that zero rating can be allowed under  stringent conditions of transparency, non-exclusivity and reasonability.  He said that one way of setting the neutrality debate would be to allow  zero rating with an amount of equal rating. This means that telecom  players can offer toll free access to certain websites but they would  also have to provide free 100 Mb or 200 Mb data connectivity within  which a user can access any website or app for free.&lt;br /&gt; &lt;br /&gt; “Countries like the US can afford to debate on net neutrality as almost  90 percent of their population are connected to internet. Here (in  India) we should first worry about providing internet access to our  people,” an ORF researcher said, speaking on the sidelines of the  roundtable discussion. &lt;br /&gt; &lt;br /&gt; The neutrality debate is getting momentum again with TRAI’s consultation  paper being released on December 9. In its second paper, TRAI  suggested, “that TSPs could provide initial data consumption for free,  without limiting it to any particular content. Current examples of this  approach include allowing free browsing or discounted tariffs for  specified time windows, or giving away a certain amount of data for  free.”&lt;br /&gt; &lt;br /&gt; The regulator also called for regulation that “must seek a balance  between ensuring wider access to the internet,” and in the manner that  does not allow discrimination in charging tariffs from the users  consuming varied content. The regulator has asked all stakeholders in  telecom industry to come up with alternative methods in order to provide  free access of internet to the consumers, and keep competition and  innovation in the market intact.&lt;/div&gt;

An offline study conducted by market research firm TNS and Google India suggested similar shifts.&lt;br /&gt; &lt;br /&gt;The Facebook tracker (&lt;a href="http://on.fb.me/1g6ZJ3k"&gt;http://on.fb.me/1g6ZJ3k&lt;/a&gt;) will help India’s 93 million Facebook users to see which parties and candidates as well as issues are trending.&lt;br /&gt; &lt;br /&gt;Social-media platforms are likely to be influential in 160 of India’s 543 Parliament constituencies, making Facebook and Twitter users the nation’s newest voting bloc, according to the IAMAI survey.&lt;br /&gt; &lt;br /&gt;These are constituencies where 10% of the voting population uses social media sites such as Facebook, or where the number of social media users is higher than the winning candidate’s margin of victory at the last election.&lt;br /&gt; &lt;br /&gt;Research shows that social media is more persuasive than television ads. Nearly 100 million Indians, or more than Germany’s population, use the Internet each day. Of this, 40 million have assured broadband, the ones most likely to have at least one social media account.&lt;br /&gt; &lt;br /&gt;“Unlike Obama who used social media directly for votes, Indian politicians have tended to use it more to mould public discourse,” says Sunil Abraham, the CEO of The Centre for Internet and Society.&lt;br /&gt; &lt;br /&gt;“I think these trends are over-hyped and the impact, if any, would only be marginal,” said Communist Party of India MP, Gurudas Dasgupta, who created a Facebook account only last month.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;So when Facebook chief executive Mark Zuckerberg helicoptered in  about a year ago to visit a small computer lab and tout Internet for  all, Osama Manzar, director of India’s Digital Empowerment Foundation,  was thrilled.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But when Manzar tried Facebook’s limited free  Internet service, he was bitterly disappointed. The app, called Free  Basics, is a pared-down version of Facebook with other services such as  weather reports and job listings.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“I feel betrayed — not only  betrayed but upset and angry,” Manzar said. “He said we’re going to  solve the problem with access and bandwidth. But Facebook is not the  Internet.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Zuckerberg  launched his sweeping Internet.org initiative in 2013 as a way to  provide 4 billion people in the developing world with Web access, which  he says he sees as a basic human right.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But the initiative has  hit a major snag in India, where in recent months Free Basics has been  embroiled in controversy — with critics saying that the app, which  provides limited access to the Web, does a disservice to the poor and  violates the principles of “net neutrality,” which holds that equal  access to the Internet should be unfettered to all.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Activist groups such as &lt;a href="http://www.savetheinternet.in/" target="_blank"&gt;Save the Internet&lt;/a&gt;,  professors from leading universities and tech titans such as Nandan  Nilekani, the co-founder of Infosys, have spoken out against it. Another  well-known Indian entrepreneur dubbed it “poor Internet for poor  people.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The debate escalated in recent weeks after India’s  telecommunications regulator suspended Free Basics as it weighs whether  such plans are fair, with new rules expected by the end of the month.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;A  week later, Free Basics was banned in Egypt with little explanation,  prompting concern that the backlash could spread to other markets. More  recently, Google pulled out of the app in Zambia after a trial period.  An estimated 15 million people are using Free Basics in 37 countries,  including 1 million in India.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;“It’s  a very important test case for what will be India’s network neutrality  regime,” said Sunil Abraham of the Center for Internet and Society in  Bangalore.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India’s debate could affect the way other countries  address the question of whether it is fair for Internet service  providers to price websites differently. The U.S. Federal Communications  Commission’s rules on net neutrality went into effect only in June.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Officials  at Facebook launched an advertising blitz to counteract the negative  publicity. “Who could possibly be against this?” Zuckerberg wondered in a  Times of India editorial on Dec. 28.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“I think we’ve been a bit  surprised by the strong reaction,” said Chris Daniels, Facebook’s vice  president for Internet.org. “Fundamentally, the reason for the surprise  is that the program is doing good. It’s bringing people online who are  moving onto the broader Internet.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India, a country of 1.2 billion, has the second-highest number of  Internet users in the world, but an estimated 80 percent of the  population does not have Internet access.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India’s tech-savvy  prime minister, Narendra Modi, is trying to combat this with an  ambitious “Digital India” plan to link 250,000 village centers with  fiber-optic cable and extend mobile coverage. He has turned to the  Indian tech community as well as Silicon Valley for help, securing an  agreement with Google to provide free WiFi in railway stations.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India  has 130 million Facebook users, second only to the United States, and  is a key market as the social-media giant looks to expand beyond the  developed world, where its growth has slowed.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“If Facebook  manages to get another half a billion users in India, that’s a valuable  set of eyeballs to sell to a political party or corporation,” Abraham  said.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Facebook has long said that its program is about altruism, not eyeballs.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But  it does reap new customers. Those who buy a SIM card from Facebook’s  local mobile partner, Reliance Communications, are then prompted to pay  for additional data. About 40 percent who sign up for Free Basics buy a  data plan to move to the wider Web after 30 days, Daniels said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The  service is still running despite the India suspension. A Reliance  spokesman said it is in “testing mode” and is not being promoted.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“The  thing people forget about Free Basics is that it’s intended to be a  temporary transition for people to give them a taste of the Internet and  sign up. It’s a marketing program for the carrier in some sense,” said  David Kirkpatrick, author of “&lt;a href="http://www.amazon.com/gp/product/1439102120?ie=UTF8&amp;amp;camp=1789&amp;amp;creativeASIN=1439102120&amp;amp;linkCode=xm2&amp;amp;tag=thewaspos09-20" target="_blank" title="www.amazon.com"&gt;The Facebook Effect&lt;/a&gt;.”  But he added: “The idea that it’s some kind of alternative Internet  that’s a discriminatory gesture to the poor is the prevailing view among  the Indian intelligentsia. It’s fundamentally misunderstood.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Facebook  has pledged to open up to new scrutiny the selection process for  companies with new applications, Daniels said. That is a response to  concerns by many in India’s tech community that Facebook’s process put  India’s fledgling start-ups at a disadvantage.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The project’s proponents say that India’s needs are so great it cannot afford to suspend one program that could help.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mahesh  Uppal, a telecommunications consultant, notes that more than 10 percent  of the country does not have mobile phone coverage and that India’s  progress in extending fiber-optic cable to village centers is proceeding  at a glacial pace. Modi had set a goal of linking all 250,000 by 2016,  but only 27,000 have cable so far and it is ready for use in only 3,200,  according to a government report.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In comparison, some 80 percent of China’s villages are linked by broadband.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;In Alwar district in the northern state of Rajasthan, many remember  when Zuckerberg came to visit but fewer know about Free Basics.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“I’ve  heard it’s free and by Facebook and you don’t have to pay for it,” said  Umer Farukh, 43, a folk musician. “But I don’t think Facebook should  control it. The Internet should be for everybody.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Farukh has  only been computer literate for two years, but he’s already emailing and  using YouTube to post videos and promote his band.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He’s become  such a proponent that he has donated space for one of Manzar’s computer  centers — part of a government initiative to build cyber-hubs in  minority communities — and encouraged the female members of his family  to take classes, which is rare in his conservative community.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Farukh  says that challenges to connecting India go far beyond data plans and  fiber-optic cable or the government broadband that often sputters out.  Wages are low, and hours are long. Only about half of the women in his  state are literate, and about a quarter of the young women in his  neighborhood are kept at home and not educated.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“This place is very backward,” he said. “India as a society is lagging far behind in terms of Internet.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In  the small nearby community of Roja Ka Baas, ringed by fields of  blooming mustard greens, residents are still awaiting the opening of  their planned WiFi center. They are struggling along on cheap mobile  phones with slow 2G spectrum until then, they said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Sakir Khan,  14, said that once the Internet finally arrived in this village, the  first thing he would do would be to sign up for Facebook.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Politicians are taking part in Google+ Hangouts, televised interviews  organised by Facebook and using the Facebook-owned smart phone messaging  app WhatsApp to connect with millions of tech-savvy urban voters.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India's 16th general election - to be held in &lt;a href="http://www.bbc.com/news/world-asia-india-26445322" title="India names general election dates"&gt;nine phases&lt;/a&gt; over April and May - will be closely fought, with some observers saying  social media will play a vital role in deciding which party wins the  most seats.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;According to a report published in April 2013 by the Internet and Mobile  Association of India (IAMAI) and the Mumbai-based Iris Knowledge  Foundation, Facebook users will "wield a tremendous influence" over the  results of the polls in 160 of India's 543 constituencies.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It's a finding political parties have taken note of, with major  contenders like the ruling Congress party and main opposition Bharatiya  Janata Party (BJP) earmarking 2-5% of their election budgets for social  media, according to an October 2013 study by IAMAI and Mumbai-based  market researcher IMRB International.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Big data&lt;/h3&gt;
&lt;p&gt;During the last general election in 2009, social media usage in India was minuscule.&lt;/p&gt;
&lt;p&gt;Today, however, Facebook has 93 million users and Twitter has an estimated 33 million accounts in the country. Many political parties have beefed up their online presence as a result.&lt;/p&gt;
&lt;p&gt;The main opposition BJP's prime ministerial candidate, Narendra Modi, was among the first Indian politicians to set up a website and today is on Twitter, Facebook and Google+.&lt;/p&gt;
&lt;p&gt;His main rival, Rahul Gandhi, the Congress party's undeclared candidate for PM, however, doesn't have a website and doesn't use any of the three major social networks.&lt;/p&gt;
&lt;p&gt;Anti-corruption campaigner-turned-politician Arvind Kejriwal has amassed 1.5 million followers on Twitter since joining in November 2011, a year before he launched his Aam Aadmi Party (AAP) and over two years after Mr Modi, who has 3.6 million followers, opened his account.&lt;/p&gt;
&lt;p&gt;"Now no serious politician is seen as being able to avoid social media  altogether," said Congress government minister Shashi Tharoor, who until  he was overtaken by Mr Modi last July, was the most followed Indian  politician on Twitter.&lt;/p&gt;
&lt;p&gt;"It does have a significant reach in certain segments of the population  and as far as we're concerned, that's important enough to pay attention  to and clearly the opposition is paying attention to it too," he added.&lt;/p&gt;
&lt;p&gt;Taking a leaf from US President Barack Obama's presidential campaigns,  India's parties are using tools to crunch the insurmountable amounts of  information social media generates - what's known as big data analytics.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Pinstorm, a digital marketing agency used by some of India's biggest  companies to monitor what is being discussed online, now has political  parties as clients.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;From its Mumbai office, the agency has been collecting,  storing and analysing tens of thousands of political statements from  over 100 online platforms daily for the past six months to allow parties  to find supporters and tweak their political message.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The agency is able to track conversations at national and  local level, making it a useful tool for both national and regional  parties.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The anti-corruption AAP, taking part in its first general  election after an impressive debut in local polls in Delhi last year,  uses Pinstorm to "compare how we are faring against others", said Ankit  Lal, the party's social media strategist.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Professor Amit Sheth and a team of researchers at the Ohio  Centre of Excellence in Knowledge-enabled Computing at Wright State  University have also been &lt;a href="http://knoesis-twit.cs.wright.edu/twitris_dev/indiaelection/insights/"&gt;tracking political sentiment online&lt;/a&gt; since July.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He says data collected from social media could in the future  replace opinion polls, which many observers say are often rigged in  India.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"With social media data, we can measure sentiments, for  example, before a rally, during the rally, and post-analysis. It's much  more frequent [than opinion polls]," Mr Sheth said.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;'Dipstick of the elite'&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;There are some, however, who are doubtful about social media's expected effect.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Social media "is not a true dipstick. It really is only a dipstick of the elite," said Sunil Abraham, executive director of the Bangalore-based Centre for Internet and Society.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Sceptics believe with so many Indians illiterate and lacking internet access, particularly in rural swathes of the country, it is still essential for political leaders to hold rallies and spend on billboard and newspaper advertising to reach the majority of the 814 million-strong electorate.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Parties are also interacting with voters on their mobile devices and it makes sense.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;"Mobile is very integral to our strategy," said Arvind Gupta, who heads the BJP's IT and social media cell.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;One of the BJP's most unique electioneering tools allows potential voters to listen in on Mr Modi's rally speeches in real time on their phones from anywhere in India. "It's our own innovation," said Mr Gupta.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The number of smartphone users is growing in India and it's how most of the country's web users go online.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;That's why WhatsApp, recently purchased by Facebook, is being used by the likes of the BJP and Congress to send photos, videos and messages to potential voters.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"No other medium gives as much mass, simultaneous reach as mobile phones in India today," said Milind Pathak from One97 Communications, a Delhi-based mobile marketing firm.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Political parties like AAP have signed up tens of thousands of members by urging people to give them a missed call for free - party officers then get in touch and formally enrol them as supporters.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"Looking forward, I think the medium will continue to be a heavily-invested area for a political party," Mr Pathak said.&lt;/p&gt;

    <title>India's ‘Facebook ruling’ is another nail in the coffin of the MNO model</title>

&lt;p style="text-align: justify; "&gt;Nobody could accuse India’s telecoms regulator, TRAI, of being in the operators’ pockets. This month it has, once again, set eye-watering reserve prices for the upcoming 700 MHz spectrum auction (see separate item), and now it has taken one of the toughest stances in the world on net neutrality, in effect banning zero rated or discounted content deals like Reliance Communications’ Facebook Basics, or Bharti Airtel’s Zero.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In a ruling last Monday, TRAI said telecoms providers are banned from offering discriminatory tariffs for data services based on content, and from entering deals to subsidize access to certain websites. They have six months to wind down any existing arrangements which contravene the new rules. Its stance is even stricter than in other countries with strong pro-neutrality laws, such as Brazil and The Netherlands.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“This is the most extensive and stringent regulation on differential pricing anywhere in the world,” Pranesh Prakash, policy director at the Centre for Internet and Society, said. “Those who suggested regulation in place of complete ban have clearly lost.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Such decisions, combined with high spectrum costs, will quickly make the traditional cellular business model unworkable in India, and the more that happens, the more wireless internet innovation will switch to open networks running on Wi-Fi and unlicensed spectrum. R.S. Sharma, chairman of TRAI, was careful to tell reporters that the zero rating ruling would not affect any plans to offer free Wi-Fi services, like those planned by Google in a venture with Indian Railways.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;A disaster for MNOs, not Facebook&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt; &lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Facebook pronounced itself “disappointed” at TRAI’s ruling, having lobbied aggressively for a more flexible approach since RCOM was forced to suspend the Basics offering in December while the consultation process took place. But while the ruling bars the Basics offering – which provided free, low speed access, on RCOM’s network, to a selection of websites, curated by Facebook – it does not stop the social media giant pursuing other initiatives within its internet.org umbrella. These include projects to extend access using its own networks, powered by drones and unlicensed spectrum, to the unserved of India and other emerging economies.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;So while the TRAI decision may be a setback for Facebook, it is not the body blow that it represents for the MNOs with their huge debt loads and infrastructure costs, and low ARPUs. Facebook, with 130m users in India, has a comparable reach to the Indian MNOs (only three, Bharti Airtel, Vodafone and Idea, have more subscribers than Facebook has users), and is better skilled at monetizing those consumers.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt; &lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The challenge for companies like Facebook is that strict neutrality rules reduce their ability to harness others’ networks in order to reach out to new users. There are about 240m people in India who are online, but don’t use Facebook, and about 800m who are not connected, so the growth potential is far larger than in the other 37 countries where Basics is offered, such as Kenya or Zambia (Facebook is blocked in China). Using RCOM’s network and marketing activities was a far cheaper way to reach some of those people than launching drones, but Facebook has other options too, including its existing efforts to make its services more usable on very basic handsets and connections; the ability to leverage the WhatsApp brand; and partnerships with Wi-Fi providers.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt; &lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The drones may have less immediate results than Basics, but they are a high profile example of an ongoing shift towards open networks, which has been going on for years, driven more by Wi-Fi proliferation than neutrality laws. The latter will be an accelerant, however.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;All internet will be free, not zero rated&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Currently, zero rating is an increasingly popular tactic to lure users with an apparently cheap deal and then, hopefully, see them upgrade to richer data plans, or spend money on m-commerce and premium content, in future. Zero rating involves allowing users access to selected websites and services without it affecting their data caps or allowances.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The US regulator has so far tolerated the practice, but the debate is raging, there and elsewhere, over whether it infringes neutrality laws, by offering different pricing for different internet services. If other authorities take the stance adopted by TRAI in India, operators will have to find new ways to attract customers and differentiate themselves.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Increasingly, access to a truly open internet will be the baseline, and priced extremely low. That low pricing will be made commercially viable by rising use of Wi-Fi to reduce cost of data delivery, whether for MNOs, wireline providers or web players like Google and Facebook, which are moving into access provision. Providers, whether traditional or new, will have to stop regarding access to the internet as a premium service or a privilege – it will be more akin to connecting someone to the electricity grid, just the base enabler of the real revenue model.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Just as it’s only when users plug something into that grid that they start to pay fees, so the operators will charge for higher value offerings which ride on top of the internet – premium content, enterprise services, cloud storage, freemium applications and so on.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The mobile operators have not embraced these ideas willingly. For years, the ability to access the internet from a mobile device was regarded as a value-add, almost a miracle. Now that the wireless network is often the primary access method, they need to change their ideas and be more like the smarter cablecos – which have tacked internet access onto a model driven by paid-for content and services – or the web giants, which have worked out ways to monetize ‘free’ access, from advertising to big data.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;This, of course, is one of the goals of internet.org and Google’s similar initiatives involving drones, white space spectrum and satellites. The more users are able to access the internet, preferably for free, and the more they see Google or Facebook as their primary conduits to the web, the more data these companies have to feed into their deep learning platforms, their context aware services and their advertising and big data engines.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;So while critics of TRAI said the zero rating decision was a setback to the goal of getting internet access into the hands of the huge underserved population of India, that population is too large and potentially rich for Facebook and its rivals to give up at the first hurdle.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Facebook CEO Mark Zuckerberg wrote in a blog post: "While we're disappointed with today's decision, I want to personally communicate that we are committed to keep working to break down barriers to connectivity in India and around the world. Internet.org has many initiatives, and we will keep working until everyone has access to the internet."&lt;/p&gt;
