    <title>NE exodus: List containing 309 blocked URLs leaks online </title>

        &lt;b&gt;Latest reports coming in have confirmed that a list containing 309 URLs, whose ban the government had sought in light of the Assam violence and the subsequent NE exodus, has been leaked online.&lt;/b&gt;

&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;The aforementioned URLs comprise URLs, Twitter accounts, img tags, blog posts, blogs and a handful of websites, and were blocked between August 18, 2012 till August 21, 2012. In an analysis that Pranesh Prakash, programme manager at the Centre for Internet and Society (CIS), carried of the leaked items, among other things in his post, he wrote that, "It is clear that the list was not compiled with sufficient care."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In his post, he further noted that the censorship process itself has been riddled with egregious mistakes. Giving instances of the egregious mistakes, he added that even some people and posts debunking the rumours were blocked as part of the censorship. Further, he wrote that some of the items that were blocked were not even web addresses (e.g., a few HTML img tags were included). In his findings, Prakash also found that despite there having been a clear warning issued by the DIT pertaining to the blocking of "above URLs only" and not that of main websites, like www.facebook.com, www.youtube.com, some ISPs (like Airtel) went "overboard in their blocking". This incident,  in particular pertains to yesterday's reports, wherein it had been revealed that Airtel had blocked the entire YouTube short URL youtu.be in some cities.&lt;/p&gt;
&lt;p&gt;On account of the sensitivity of the issue, he writes that it &lt;i&gt;"would be premature to share the whole list&lt;/i&gt;." He, however, writes that CIS plans to make the entire list public soon. The list that CIS has released, however includes -&lt;/p&gt;

    <title>MPs to be taught ‘draconian’ IT Act Rules as India.net support galvanises for annul motion</title>

&lt;p&gt;Rajya Sabha’s member of parliament (MP) from Kerala, P Rajeeve, whose &lt;a class="external-link" href="http://164.100.47.5/newsite/bulletin2/Bull_No.aspx?number=49472"&gt;statutory motion&lt;/a&gt; to annul the IT (Intermediaries Guidelines) Rules 2011 is slated for discussion in Parliament tomorrow, aims to convene a meeting of MPs, internet societies, and bloggers in the first week of May to create awareness against the &lt;a class="external-link" href="http://www.legallyindia.com/201201182502/Legal-opinions/sopa-blackout-day-bah-wheres-the-kolaveri-about-indias-it-act-intermediaries-rules"&gt;draconian effect&lt;/a&gt; of the rules.&lt;/p&gt;
&lt;p&gt;“Most of the MPs need to know about this,” Rajeeve told Legally India, explaining that statutory motions are generally not easy to pass. “Actually we are trying to create awareness by organizing a session. The issue will be the IT Rules 2011 and how it is against the constitution, how it is against natural justice, how it is against due process of law.”&lt;br /&gt;&lt;br /&gt;“The motion has been accepted. The committee has allotted time for discussion on the twenty fourth. Thereafter it will come to the house. In this part of the session I am trying to coordinate other MPs to get support”, he said.&lt;/p&gt;
&lt;p&gt;Rajeeve’s motion of 23 March 2012, as first reported by &lt;a href="https://cis-india.org/internet-governance/blog/statutory-motion-against-intermediary-guidelines-rules/" class="external-link"&gt;CIS-India&lt;/a&gt;, was not his first attempt at bringing the IT rules into the spotlight. When the rules were in draft stage, he had made a &lt;a class="external-link" href="http://rajeev.in/pages/..%5CNews%5Ccensorship_Blogs%5CBloggers_Internet.html"&gt;zero hour mention&lt;/a&gt; against them for being in violation of freedom of speech and expression, by over-scrutinising bloggers, over-authorising intermediaries, and letting the government, individuals and institutions by-pass the due process of law.&lt;/p&gt;
&lt;p&gt;Rajeeve was one of the nine panelists in the open discussion on “Resisting Internet Censorship”, organised by the Centre for Internet and Society (CIS) and Foundation for Media Professionals, in Bangalore on Saturday, 21 April. The discussion, addressing an audience of 40, was moderated by veteran journalist Paranjoy Guha Thakurta.&lt;/p&gt;
&lt;p&gt;Other panelists included Mahesh Murthy, founder of digital marketing website Pinstorm, Sudhir Krishnaswamy, founding member of Centre for Law and Policy Research, Na Vijayashankar, director of Cyber Law College, and Siddharth Narain from the Alternative Law Forum.&lt;/p&gt;
&lt;p&gt;Also on the panel were Rishabh Dara,&lt;a class="external-link" href="http://www.google.com/policyfellowship/"&gt; Google policy fellow&lt;/a&gt; who conducted &lt;a href="https://cis-india.org/internet-governance/intermediary-liability-in-india" class="external-link"&gt;a study last year on intermediary liability in India and its chilling effects on free expression&lt;/a&gt;, BG Mahesh, founder of Oneindia.com, Ram Bhat, co-founder of community media collective Maraa, and Pranesh Prakash, programme manager at CIS.&lt;/p&gt;
&lt;p&gt;Prakash said that the discussion brought together different perspectives, even those of the entrepreneur, like BG Mahesh and Mahesh Murthy. “Transparency in the terms of censorship is good. We are not saying all censorship is bad, but that it should be transparent.”&lt;/p&gt;
&lt;p&gt;Prakash told Legally India about the various experiences shared by panelists, of the lack of transparency in the present system of censorship. While one faced harassment by the police over trivial procedural compliances, there was complaint for defamation against an article syndicated by another from a different publication’s press release. “And we read the article over and over and over again but couldn’t find anything which was remotely defamatory.”&lt;br /&gt;&lt;br /&gt;Legal experts on the panel, Kirshnaswamy and Vijayashankar, spoke about the constitutionalism behind free speech provisions. Narain shed light on the fact that while excessive energy has been expended on highlighting which content should not be banned, little has been spent on examining the operative procedures behind censorship.&lt;br /&gt;&lt;br /&gt;Dara spoke about his research and how it not only revealed that content was being frivolously removed on complaints to intermediaries, but also that the people whose content was being removed were not being informed of the same. There was no public notice of the removal.&lt;br /&gt;&lt;br /&gt;Bhat’s discourse drew attention to the history of censorship in India and elicited the fact that the Indian press has in fact been censored in an upsetting manner even since the revolt of 1857.&lt;/p&gt;
&lt;p&gt;Murthy made the observation that statistically speaking, in India the number of internet users exceeds television watchers, which has made social media unfathomably important while the internet is no longer elitist.&lt;br /&gt;&lt;br /&gt;A number of related Indian initiatives have been gathering momentum in recent months, such as&amp;nbsp;&lt;a class="external-link" href="http://softwarefreedom.in/index.php?option=com_content&amp;amp;view=article&amp;amp;id=97:campaign-for-freedom-on-the-internet&amp;amp;Itemid=83"&gt; signature campaigns&lt;/a&gt; for &lt;a class="external-link" href="https://www.change.org/petitions/mps-of-india-support-the-annulment-motion-to-protect-internet-freedom-stopitrules"&gt;internet freedom&lt;/a&gt;, and offline protests such as the &lt;a class="external-link" href="http://friendsofinternet.wikispaces.com/"&gt;Free Software Movement in Karnataka&lt;/a&gt; and the &lt;a class="external-link" href="http://kafila.org/2012/04/21/freedom-in-the-cage-22-april-2012/"&gt;Save your Voice in Delhi&lt;/a&gt;, are the order of the day. Other actions include &lt;a class="external-link" href="http://www.legallyindia.com/201201182502/Legal-opinions/sopa-blackout-day-bah-wheres-the-kolaveri-about-indias-it-act-intermediaries-rules"&gt;writing to MPs&lt;/a&gt;, asking them to vote in favor of Rajeeve’s statutory motion for annulment of the IT rules.&lt;/p&gt;
&lt;p&gt;Kerala-based advocate Shojan Jacob filed the f&lt;a class="external-link" href="http://www.legallyindia.com/201203062622/Bar-Bench-Litigation/read-first-writ-challenging-censorious-it-act-intermediaries-rules-in-kerala"&gt;irst ever writ challenging the rules&lt;/a&gt; in the Kerala High Court last month.&lt;/p&gt;
&lt;p&gt;The rules enable any individual or public or private institution to get content removed from websites, in most cases simply by notifying the website owners or intermediaries such as Google, Yahoo and others.&lt;/p&gt;
&lt;p&gt;Takedown requests can be based on any of &lt;a class="external-link" href="http://www.legallyindia.com/201201182502/Legal-opinions/sopa-blackout-day-bah-wheres-the-kolaveri-about-indias-it-act-intermediaries-rules"&gt;15 vaguely drafted parameters&lt;/a&gt;, without stating any reasons or requiring any judicial or quasi-judicial order in support.&amp;nbsp;&lt;/p&gt;

        &lt;b&gt;A motion in the Rajya Sabha has sought annulment of the IT intermediary guidelines, writes Deepa Kurup in this article published in the Hindu on April 22, 2012.&lt;/b&gt;
        
&lt;p&gt;A research, or a sting operation, conducted by researchers at the Centre for Internet and Society in October 2011 — a few months after the Information Technology (Intermediary Guidelines) Rules were notified — revealed some inherent flaws in the guidelines laid down by the Indian government. The results of the study made news, particularly after Union Minister for IT, Kapil Sibal, asked Internet companies and Web service providers to screen content.&lt;br /&gt;&lt;br /&gt;The study revealed that companies were only too eager to comply with take-down notices or requests, in order to avoid further hassles, particularly legal ones.&lt;br /&gt;&lt;br /&gt;Rishab Dara, a researcher who was part of this ‘sting', pointed out that unless the content was commercial, or had potential commercial interest, companies preferred to err on the side of caution.&lt;br /&gt;&lt;br /&gt;Addressing an audience at a panel discussion, titled ‘Resisting Internet censorship: strategies for furthering freedom of expression in India', held at the Bangalore International Centre, Mr. Dara pointed out that search engines did not invest enough resources to check how valid the claims were, before taking down over 2,000 URLs related to a random complaint or take-down notice sent by them. His study underlined the need for debate and discussion on the intermediary guidelines, locating this in the larger context of freedom on the Web.&lt;br /&gt;&lt;br /&gt;The discussion, organised by the Centre for Internet and Society, was moderated by the former journalist and academic, Paranjoy Guha Thakurta. The audience and the panel comprised a diverse lot: from students, netizens and academics to those who were directly involved in the business of publishing content or hosting Web content. While a substantial part of the discussion dealt with the legal aspects of the notified rules, and how it may contradict the constitutional rights of citizens, a section of the debate also delved into whether the Web as a medium needed to be policed at all.&lt;br /&gt;&lt;br /&gt;If panellist Mahesh Murthy, Chief Executive Officer of Pinstorm, argued vociferously for unfettered freedom on the Web and accused the government of being threatened by movements such as the anti-corruption campaign led by Anna Hazare (which he said was largely mobilised on the Web), another panellist Na. Vijayshankar, Cyber Law College, who claimed he was among those instrumental in bringing down the pornographic cartoon portal Savitabhabhi.com, argued that though these rules need to be withdrawn, there are “boundaries” to what can be posted and said on the Web.&lt;br /&gt;&lt;br /&gt;Another section of the audience brought up the issues of hate speech on the Web, and pointed out that in some cases there was a need to pin liability on those who generate content that incites hatred.&lt;br /&gt;&lt;br /&gt;Sudhir Krishnaswamy, Centre for Law and Policy Research, pointed out that currently the way the issue was being played out in court, the discourse was more about companies.&lt;br /&gt;&lt;br /&gt;“The debate is not about users today. Companies are trying to duck liabilities, rather than deal with substantive issues of free speech,” he said, pointing to the complexities in locating liability for content.&lt;br /&gt;&lt;br /&gt;Speaking from the publisher's perspective, B.G. Mahesh, OneIndia.in, an online news and entertainment portal, spoke of specific cases where his portal had been targeted by the Chennai Cybercrime cell for hosting a news story (syndicated from a news agency) that was declared defamatory. “We took it down, but there was no answer from them when we asked for an explanation,” he said, adding that in such cases there is tremendous pressure and harassment from authorities, leaving publishers with no choice but to comply.&lt;br /&gt;&lt;br /&gt;Though the IT intermediary rules were notified in April 2011, the issue made headlines when Union Minister for Information and Communication Technology Kapil Sibal asked private companies or Web service providers to pre-screen content, a statement which he later withdrew.&lt;br /&gt;&lt;br /&gt;Also discussed in detail were the complexities posed by a medium like the World Wide Web, and what were the reasonable restrictions to free speech on the Web. Does one need a separate legal dispensation to deal with this medium, Mr. Thakurta asked. While emphasising that the solution does not lie in “knee-jerk reactions”, such as the rules that have been proposed, he pointed out that the bid to control flow of information was a simple manifestation of the utter helplessness and inability of the government — and governments worldwide — to control the Web. Be it in West Bengal, where a professor is held for sharing a cartoon, or with the Union government that beckons corporates to pre-screen the Web, these acts are a manifestation of a “combination of arrogance and stupidity”, he said.&lt;br /&gt;&lt;br /&gt;Subsequently, in February, Rajya Sabha member from Kerala, P. Rajeeve, moved a statutory motion in the Rajya Sabha seeking that these guidelines be annulled on the grounds that it allowed intermediaries protection from legal liability in return for trading away freedom of expression of users.&lt;br /&gt;&lt;br /&gt;In the Parliamentary session that will start next week, this is likely to come up for discussion, and across the country, rights activists are mobilising support and lobbying with legislators to garner support for this annulment.&lt;/p&gt;

        &lt;b&gt;The Centre for Internet and Society sent the following mail to ICANN regarding their attempt to impose their own charter for a Noncommercial Stakeholder Group (NCSG), instead of accepting the one drafted by the Noncommercial Users Constituency (NCUC).&lt;/b&gt;

&lt;p&gt;Greetings from the Centre for Internet and Society - Bangalore. We are a Bangalore based research and advocacy organisation promoting consumer and citizen rights on the Internet. We currently focus on IPR reform, IPR alternatives and electronic accessibility by the disabled. &lt;p&gt;It has come to our attention that ICANN is imposing the ICANN staff-drafted charter for a Noncommercial Stakeholder Group (NCSG) and ignoring the version drafted by civil society. As you know, the civil society version was drafted using a consensus process and more than 80 international noncommercial organizations, including mine, support it.&lt;/p&gt;
&lt;p&gt;This is an unacceptable situation since the governance structures contained within the NCSG charter determine how effectively noncommercial users can influence policy decisions at ICANN in years to come. On behalf of Internet users in India - I would strongly urge you to reject the staff drafted version of the charter and adopt the version drafted and endorsed by civil society.&lt;/p&gt;

&lt;div align="left"&gt;(Order of the Court was made by ELIPE DHARMA RAO, J)&lt;/div&gt;
&lt;ol&gt;&lt;li&gt;Heard the learned counsel appearing for the parties.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;&lt;li&gt;The present writ petition has been filed in public interest for 
the issuance of Writ of Mandamus directing the respondents 1 to 4 to 
forthwith formulate censor rules and regulations and appoint a 
regulatory body to strictly enforce those rules monitoring online 
publications in internet, prohibiting obscene and pornographic 
publications and penalising the Internet Service Providers (ISPs) and 
search engine companies for offences and violations of licence 
conditions committed by them.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;&lt;li&gt;Though no counter affidavit has been filed on behalf of 
Respondents 1 to 5, the learned Assistant Solicitor General by placing 
reliance upon a recent unreported decision of the Mumbai High Court in 
Janhit Manch and Others v. Union of India IPI1 No. 155 of 2009), 
disposed of on 3.3.2010, submitted that the prayer in the writ petition 
before the Mumbai High Court is very much similar to the present writ 
petition and, as has been observed in the said decision, the present 
writ petition may also be disposed of.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;&lt;li&gt;We have carefully gone through the aforesaid decision relied on by
 the learned Assistant Solicitor General of India. In the said decision,
 the prayer made by the petitioners therein was to direct the 
respondents therein to make co-ordinated and sustained efforts, to have a
 blanket ban on websites which according to them are displaying material
 pertaining to sex and harmful to the youth of the country. The Division
 Bench, after hearing the contentions made on either side, observed as 
follows :&lt;br /&gt;&lt;br /&gt;"By the present petition what the petitioner seeks is that this court 
which is a protector of free speech to the citizens of this country, 
should interfere and direct the respondents to make a coordinated and 
sustained efforts to close down the websites as aforestated. Once 
Parliament, in its wisdom has enacted a law and has provided for the 
punishment for breach of that law any citizen of this country including 
the Petitioner who is aggrieved against any action on the part of any 
other person which may amount to an offence has a right to approach the 
appropriate forum and lodge a complaint upon which the action can be 
taken if an offence is disclosed. Courts in such matters, the guardian 
of the freedom of free speech, and more so a constitutional court should
 not embark on an exercise to direct State Authorities to monitor 
websites. If such an exercise is done, then a party aggrieved depending 
on the sensibilities of persons whose views may differ on what is 
morally degrading or prurient will be sitting in judgment, even before 
the aggrieved person can lead his evidence and a competent court decides
 the issue. The Legislature having enacted the law a person aggrieved 
may file a complaint.&lt;br /&gt;&lt;br /&gt;In the light of that we are not inclined to interfere in the exercise of
 our extra-ordinary jurisdiction. If the petitioner comes across any 
website/s which according to him publishes or transmits any act which 
amounts to offence under section 67 or 67A of the Information Technology Act, 2000, it is upto him to file a complaint.&lt;br /&gt;&lt;br /&gt;With the above observations, Petition disposed of."&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;&lt;li&gt;From the facts of the Janhit Manch case and the observations made 
therein, we are of the considered opinion that the ratio of the said 
decision squarely applicable to the facts of the present case inasmuch 
as in the present writ petition the relief sought for by the petitioner 
is to strictly enforce the rules monitoring online publications in 
internet and punish the persons violating such rules, which is 
indirectly made in the Janhit Manch case. Therefore, applying the ratio 
of the aforesaid decision, the present writ petition is disposed of. 
Moreover, we make it clear that if any complaint is made against the 
publishing or transmitting any obscene or pornographic publications, 
necessary steps should be taken by the respondents in accordance with 
law.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;&lt;li&gt;The writ petition is disposed of with the above observations. No

        &lt;b&gt;The Information Technology (Intermediaries Guidelines) Rules 2011 (The Rules) continue to breathe after the statutory motion to annul them moved by member of parliament (MP) from Kerala P Rajeeve was defeated by voice vote in the Rajya Sabha yesterday.&lt;/b&gt;
        
&lt;p&gt;&lt;a class="external-link" href="http://www.legallyindia.com/Social-lawyers/motion-to-kill-it-rules-defeated"&gt;This blog post by Prachi Shrivastava was published in Legally India on May 18, 2012&lt;/a&gt;&lt;/p&gt;
&lt;p&gt;Telecom Minister Kapil Sibal was heard on Rajya Sabha TV saying: “We are more liberal than US and Europe but let’s not cut our arms.”&lt;/p&gt;
&lt;p&gt;Sibal countered Rajeeve’s annulment motion arguing that the government needs to be armed to meet the “new challenges” posed by “new media”, according to &lt;a class="external-link" href="http://www.livemint.com/2012/05/17225536/Govt-pledges-to-review-plans-t.html"&gt;Mint&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;"Kapil Sibal reminds me of badly briefed counsels fumbling in the High Court" tweeted &lt;a class="external-link" href="https://twitter.com/#!/pranesh_prakash"&gt;Pranesh Prakash&lt;/a&gt; of the Centre for Internet and Society (CIS) as Sibal was mid-delivery in contending that online media not registered in India escaped the ambit of Indian legislation and thus created the peril of terrorism and increased drug peddling.&lt;/p&gt;
&lt;p&gt;Another person tweeted: "The gist of Sibal’s argument was that we need to censor the internet because people are doing drugs."&lt;/p&gt;
&lt;p&gt;Sibal’s answer to MP Ram Yadav’s attack on The Rules for being inconsistent with their parent act – the Information Technology Act 2000 (IT Act) – was that &lt;a class="external-link" href="http://www.mit.gov.in/sites/upload_files/dit/files/GSR314E_10511(1).pdf"&gt;Rule 3(2)&lt;/a&gt; which prescribes “due diligence” to be observed by an internet intermediary, originates from &lt;a class="external-link" href="http://www.lawzonline.com/bareacts/information-technology-act/section66A-information-technology-act.htm"&gt;Section 66A of the IT Act&lt;/a&gt;, thus making the rules consistent with the parent act.&lt;/p&gt;
&lt;p&gt;Section 3(2) obligates the intermediary to take down content posted on a website, on the basis of several undefined criteria.&lt;/p&gt;
&lt;p&gt;"Minister you have created perverse incentives for censoring speech through law. That is regulation, not merely a definition of due diligence” proclaimed Supreme Court advocate &lt;a class="external-link" href="https://twitter.com/#!/aparatbar"&gt;Apar Gupta&lt;/a&gt; in a tweet posted during Sibal’s defense of the rules.&lt;/p&gt;
&lt;p&gt;Prakash tweeted: "The IT Rules don’t just prescribe ‘due diligence’ but create a takedown mechanism. That’s not the same thing Mr. Sibal."&lt;/p&gt;
&lt;p&gt;Sibal went on to establish that the government’s motive was not censorious by stating: “It is your choice, you are free to work with the user who complains to an intermediary. Where does the government come in?”&lt;/p&gt;
&lt;p&gt;To which quipped Prakash: “Government is not censoring. It has created a system by which anyone can censor with impunity.”&lt;/p&gt;
&lt;h3&gt;Jaitley in-perspective&lt;/h3&gt;
&lt;p&gt;Leader of the opposition senior advocate Arun Jaitley objected to The Rules holding that terms such as “disparaging”, ”libellous”, “defamatory”&lt;a class="external-link" href="http://www.legallyindia.com/201201182502/Legal-opinions/sopa-blackout-day-bah-wheres-the-kolaveri-about-indias-it-act-intermediaries-rules"&gt; not defined in the Act or the Rules but enabling take-down of content&lt;/a&gt;, could be misused, according to &lt;a class="external-link" href="http://timesofindia.indiatimes.com/tech/news/internet/Internet-would-have-made-1975-Emergency-a-fiasco-Arun-Jaitely/articleshow/13219214.cms"&gt;Times of India&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;IBN Live reported him as urging Sibal to "reconsider the language of restraints".&lt;/p&gt;
&lt;p&gt;Sibal addressed the house inviting objections from MPs on specific “words” contained in The Rules which provide for control of speech over the internet, according to&lt;a class="external-link" href="http://ibnlive.in.com/generalnewsfeed/news/govt-for-consensus-on-rules-for-internet-content-control/999876.html"&gt; PTI&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;He further proposed to call a meeting of “stakeholders” to discuss the MPs’ objections, and assured that the consensus that emerges from the meeting will be implemented.&lt;/p&gt;
&lt;h3&gt;Draconian Censorious Rules&lt;/h3&gt;
&lt;p&gt;&lt;a class="external-link" href="http://www.legallyindia.com/Social-lawyers/mps-to-be-taught-draconian-it-act-rules-as-indianet-support-galvanises-for-annul-motion"&gt;Legally India&lt;/a&gt; reported last month how Rajeeve was trying to spread awareness among MPs about the draconian effect of the Rules which censor free speech and expression, by over-scrutinising users of the internet, over-authorising intermediaries to monitor content posted over the internet, and letting the government, individuals and institutions by-pass the due process of law.&lt;/p&gt;
&lt;p&gt;The Rules in their present form require intermediaries - providers of internet, telecom, e-mail or blogging services, including cyber cafes - to publish terms of use prohibiting users from publishing content of the nature specified in the Rules.&lt;/p&gt;
&lt;p&gt;Once the intermediaries have knowledge of posted content that is in violation of such terms of use, they are liable for compensation if they fail to initiate action for removal of the posted content.&lt;/p&gt;
&lt;p&gt;Some of the categories of prohibited content specified in the Rules are undefined, are not an offence under existing law, and &lt;a class="external-link" href="http://www.legallyindia.com/201203062622/Bar-Bench-Litigation/read-first-writ-challenging-censorious-it-act-intermediaries-rules-in-kerala"&gt;are claimed to be in violation of article 19(1) of the Constitution guaranteeing the freedom of speech and expression&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;CIS uncovered an additional problem the rules pose - that of &lt;a class="external-link" href="http://www.legallyindia.com/201112072434/Regulatory/kapil-sibal-to-sterilise-net-but-cis-sting-shows-6-out-of-7-websites-already-trigger-happy-to-censor-content-under-chilling-it-act"&gt;“over-complying” intermediaries&lt;/a&gt; who in order to minimize the risk of liability may block more content than required, adversely impacting the fundamental right guaranteed under article 19(1).&lt;/p&gt;
&lt;p&gt;"By and large, the impression is that India is going in the direction of censorship," Mint reported cyber law expert and supreme court lawyer Pavan Duggal as saying, yesterday.&lt;/p&gt;

&lt;p&gt;Petitioner by the present petition has approached this court, seeking
 relief to direct the respondents to make coordinated and sustained 
efforts, to have a blanket ban on websites which according to 
Petitioners are displaying material pertaining to sex and which in their
 opinion is harmful to the youth of this country in their formative 
years.&lt;/p&gt;
&lt;p&gt;Mr. Jalan, Petitioner No. 2 appearing in person draws our attention 
to amongst others to Section 67 and 67A of the Information &amp;amp; 
Technology Act, 2000. Under Section 67 if any person publishes or 
transmits or causes to be published or transmitted in the electronic 
form any material which is lascivious or appeals to the prurient 
interest or if its effect is such as to tend to deprave and corrupt 
persons who are likely, having regarding to all relevant circumstances, 
to read, see or hear the matter contained or embodied in it, shall be 
punished on first conviction with imprisonment of either description for
 a term which may extend to three years and fine which may extend to 
five lakh rupees. Section 67A pertains to publishing or transmitting or 
causing to be published or transmitted in the electronic form any 
material which contains sexually explicit act or conduct can be punished
 on first conviction with imprisonment of either description for a term 
which may extend to five years and with fine which may extend to ten 
lakh rupees.&lt;/p&gt;
&lt;p&gt;The Act therefore, makes provision for punishment of a person against
 whom a complaint is filed, if such person commits the offence which 
falls within the purview of section 67 or 67A as the case may be. Such 
person can be tried and convicted. For that prosecution will have to 
establish that an offence has been committed.&lt;/p&gt;
&lt;p&gt;By the present petition what the petitioner seeks is that this court 
which is a protector of free speech to the citizens of this country, 
should interfere and direct the respondents to make a coordinated and 
sustained efforts to close down the websites as aforestated. Once 
Parliament in its wisdom has enacted a law and has provided for the 
punishment for breach of that law any citizen of this country including 
the Petitioner who is aggrieved against any action on the part of any 
other person which may amount to an offence has a right to approach the 
appropriate forum and lodge a complaint upon which the action can be 
taken if an offence is disclosed. Courts in such matters, the guardian 
of the freedom of free speech, and more so a constitutional court should
 not embark on an exercise to direct State Authorities to monitor 
websites. If such an exercise is done, then a party aggrieved depending 
on the sensibilities of persons whose views may differ on what is 
morally degrading or prurient will be sitting in judgment, even before 
the aggrieved person can lead his evidence and a competent court decides
 the issue. The Legislature having enacted the law a person aggrieved 
may file a complaint.&lt;/p&gt;
&lt;p&gt;In the light of that we are not inclined to interfere in the exercise
 of our extra ordinary jurisdiction. If the petitioner comes across any 
website/s which according to him publishes or transmits any act which 
amounts to offence under section 67 or 67A of the Information &amp;amp; 
Technology Act, 2000, it is upto him to file a a complaint.&lt;/p&gt;
&lt;p&gt;With the above observations, Petition disposed of.&lt;/p&gt;

    <title>Is India Ignoring its own Internet Protections?</title>

        &lt;b&gt;India’s information technology law of 2008 limits the liability of Internet companies for material posted on their Web sites by users, including anything government regulators deem objectionable. The firms are supposed to be notified of offensive content — by users or the authorities — and then remove it when legally warranted.&lt;/b&gt;
        
&lt;p&gt;If that’s how the system is supposed to work, then why did the Indian government just sanction a criminal lawsuit against Google, Facebook and 19 other companies that all but ignores those protections in the information technology law?&lt;/p&gt;
&lt;p&gt;That is one of the most puzzling elements of the legal drama over free speech on the Web that is unfolding in New Delhi.&lt;/p&gt;
&lt;p&gt;The case against the companies, brought by Urdu weekly journalist Vinay Rai, accuses them of violating various provisions of India’s criminal code by allowing material that is mocking or offensive to religious and political figures to stay on their social networking sites. There are charges of inciting communal passions and disturbing public order – catchall stuff normally meant to give police tools to rein in hooligans.&lt;/p&gt;
&lt;p&gt;The punishments for these criminal offenses can include several years of jail time and stiff fines. That these elements of the criminal code are now being used to target Internet companies is somewhat bizarre, especially when one considers the apparently careful lawyering that went into drafting protections for Internet companies a few years ago.&lt;/p&gt;
&lt;p&gt;As Google and others fight the charges – today they are continuing an appeal in Delhi High Court to quash the case – they will likely make the case that the courts cannot ignore India’s I.T. law. “It isn’t a trivial defense – the court cannot dismiss it,” said Sunil Abraham, executive director of the Bangalore-based Centre for Internet and Society, a civil liberties advocacy group. “The I.T. act provides immunity to (Internet companies) and that should be the default starting position.”&lt;/p&gt;
&lt;p&gt;A spokesman for India’s telecom ministry did not immediately respond to a request for comment. We’ve described Mr. Rai’s rationale for filing the lawsuit in a separate post.&lt;/p&gt;
&lt;p&gt;The crackdown on Web companies couldn’t come at a worse time for the emerging Internet sector in India, which many analysts believe has a potential to grow from about 100 million users to more than 300 million within a few years if nurtured. Facebook and Google representatives declined to comment on the case.&lt;/p&gt;
&lt;p&gt;The protections for Internet firms are fairly clear in Section 79 of the 2008 law, known as India’s I.T. Act Amendments. An “intermediary,” or Internet firm, “shall not be liable for any third party information, data or communication link.” There are several caveats, of course – the company can’t initiate or solicit the harmful post and can’t coordinate with the offender. Under the rules that India put into place last April to implement the act, companies must remove material that is “grossly harmful, harassing, blasphemous, defamatory” as well as anything “ethnically objectionable, disparaging” or “otherwise unlawful in any manner.”&lt;/p&gt;
&lt;p&gt;Internet companies and civil society advocates weren’t happy with those guidelines, finding them far too draconian and subjective. But at least the law required that the companies be notified of such content and be given a chance to remove it within 36 hours. (The punishments for not removing offensive content within 36 hours would depend on the underlying laws governing that content in India; in general, prison time and fines would both be possible.)&lt;/p&gt;
&lt;p&gt;In the case of the Vinay Rai lawsuit, such procedures don’t appear to have been followed. Google has told the court it hasn’t seen the allegedly offensive material or been notified about it. Mr. Rai says he didn’t flag the content to Google or others, because he believed his duty as a citizen was to notify the government.&lt;/p&gt;
&lt;p&gt;What was the point of passing the I.T. law if it’s being swept to the side?&lt;/p&gt;

        &lt;b&gt;The arrest of two girls over their Facebook post on shutdown in Mumbai for Bal Thackeray's funeral on Monday again opened a can of worms with netizens calling the move a "social media hijack by the powerful and the fundamentalists". Social media was abuzz with tweets and posts about the arrest, with most referring to the arrest as yet another move to curb freedom of speech on the Internet. &lt;/b&gt;

&lt;p style="text-align: justify; "&gt;This post was &lt;a class="external-link" href="http://ibnlive.in.com/news/netizens-flay-mumbai-girls-arrest-over-facebook-post/306360-3.html"&gt;published by IBN Live&lt;/a&gt; on November 20, 2012. Pranesh Prakash is quoted.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Noted journalist Gautam Chikermane tweeted "First Pondicherry businessman, now 21 year old Palghar girl. Next: all of us. Social media hijack by the powerful and the fundamentalists". Minister of State (Communications and IT) Milind Deora tweeted: "To learn who rules over you, simply find out who you are not allowed to criticize ~ Voltaire".&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Communication specialist Alyque Padamsee expressed shock at the arrest and the vandalism at the clinic of one of the girl's uncle. "I want to know how these girls have broken the law when all they said is that why should Mumbai come to a standstill. There is nothing derogatory against Thackeray. I do not see anything illegal in that," he said. Padamsee further said the Constitution provides everyone free speech and that "no one should be arrested on such flimsy grounds".&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Pavan Duggal, Cyber law Expert and an advocate with Supreme Court also voiced similar views. "This is high time for the government for the review of the law. The government should amend the IT Act so as to narrow down its provisions as some of the these violate our constitutional right of free speech."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He added that it would be a bigger challenge for the prosecution to prove that the statement could incite communal disharmony and violence. "This should not be seen merely as "social media regulation", but as a restriction on freedom of speech and expression by both the law and the police," Centre for Internet and Society Policy Director Pranesh Prakash said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The two girls--Shaheen Dhada and Renu--were sent to 14-day judicial custody by a court before which they were produced today but were granted bail within hours after they furnished personal bonds. There was also an attack on the clinic of an uncle of one of them by Sena activists.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The arrests also sparked an outrage with Press Council of India chief Markandey Katju today demanding "immediate" action against police personnel involved. While Dhada was arrested for the post, Dhada's friend Renu was arrested for 'liking' the post. "Police arrested both of them under section 505(2) (statements creating or promoting enmity, hatred or ill-will between classes). Today, they were granted bail," their advocate Sudhir Gupta said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The duo was arrested following a police complaint lodged by a local Sena leader. After the comment was posted, a mob of nearly 40 Shiv Sainiks allegedly barged into Dhada's uncles's orthopaedic hospital at Palghar and vandalised the place on Sunday. However, no arrests were made in connection with the attack.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Some other tweets in support of the girls read: "Hatred of minorities, liberals is an epidemic on Twitter. &lt;p style="text-align: justify; "&gt;Earlier this month, thousands of people from the country's remote northeast began fleeing cities in southern and western India, as rumors swirled that they would be attacked in retaliation for &lt;a href="http://economictimes.indiatimes.com/topic/ethnic-violence"&gt;ethnic violence&lt;/a&gt; against Muslims in their home state.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Last weekend, the government said the rumors were fed by gory images - said to be of murdered Muslims - that were actually manipulated photos of people killed in cyclones and earthquakes. Officials said the images were spread to sow fear of revenge attacks.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;After that, the government began interfering with hundreds of websites, including some Twitter accounts, blogs and links to certain news stories. The government also ordered telephone companies to sharply restrict mass text messages.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is unclear who has been spreading the inflammatory material. Experts say that despite the government's electronic interference, there are many ways to access the blocked sites.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"The government has gone overboard and many of its efforts are legally questionable,'' said Pranesh Prakash, who studies internet governance and freedom of speech at The Center for Internet and Society, a research organization in the southern city of Bangalore.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The center has published a list of over 300 internet links blocked in the last two weeks. &lt;p style="text-align: justify; "&gt;Earlier this month, thousands of people from the country's remote northeast began fleeing cities in southern and western India, as rumors swirled that they would be attacked in retaliation for ethnic violence against Muslims in their home state.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Last weekend, the government said the rumors were fed by gory images — said to be of murdered Muslims — that were actually manipulated photos of people killed in cyclones and earthquakes. Officials said the images were spread to sow fear of revenge attacks.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;After that, the government began interfering with hundreds of websites, including some Twitter accounts, blogs and links to certain news stories. The government also ordered telephone companies to sharply restrict mass text messages.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is unclear who has been spreading the inflammatory material. Experts say that despite the government's electronic interference, there are many ways to access the blocked sites.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"The government has gone overboard and many of its efforts are legally questionable," said Pranesh Prakash, who studies Internet governance and freedom of speech at The Center for Internet and Society, a research organization in the southern city of Bangalore.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The center has published a list of more than 300 Internet links blocked in the last two weeks. These include some pages on Facebook, YouTube and news items on the sites of Al Jazeera, Australia's ABC, and a handful of Indian and Pakistani news sites.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;On Friday, the Twitter account of Milind Deora, India's junior communications minister, appeared blocked. A message at his (at)milinddeora account said "the profile you are trying to view has been suspended."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Deora told the Press Trust of India news agency that his account was being verified and was only temporarily suspended. PTI said Deora had been tweeting in defense of the government blocking efforts before the account was suspended.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;The government's actions have sparked outrage on social networking sites, with hashtags critical of the government quickly becoming top trending topics on Twitter's India site.&lt;/p&gt;
&lt;p&gt;But Prakash was as dismissive of that reaction as he was of the government attempts at censorship.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The government's actions reek of "the kind of incompetence one has come to expect," he said, "but the hashtags (hash)Emergency2012 etc. suffer from a lack of perspective, too."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Kapil Sibal, the senior minister of communications and information technology, said in a statement that Facebook and Google were cooperating with the government and shutting down some sites that the government had pointed out as objectionable. Sibal said Twitter had also said it was ready to talk with the government.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But he said that "the accusations that we are aggressively targeting someone's account or websites are incorrect."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;On Thursday, Victoria Nuland, spokeswoman for the U.S. State Department, had told reporters that it was urging the Indian government "to take into account the importance of freedom of expression in the online world" while addressing its security concerns. She said the U.S. was ready to help India's efforts to talk to social networks regarding the issue."&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Officials in New Delhi, who have had disagreements with the companies over restrictions on free speech, say the sites are not responding quickly enough to their requests to delete and trace the origins of doctored photos and incendiary posts aimed at people from northeastern India. After receiving threats online and on their phones, tens of thousands of students and migrants from the northeast have left cities like Bangalore, Pune and Chennai in the last week.&lt;br /&gt;&lt;br /&gt;The government has blocked 245 Web pages since Friday, but still many sites are said to contain fabricated images of violence against Muslims in the northeast and in neighboring Myanmar meant to incite Muslims in cities like Bangalore and Mumbai to attack people from the northeast. India also restricted cellphone users to five text messages a day each for 15 days in an effort to limit the spread of rumors.&lt;br /&gt;&lt;br /&gt;Officials from Google and industry associations said they were cooperating fully with the authorities. Some industry executives and analysts added that some requests had not been heeded because they were overly broad or violated internal policies and the rights of users.&lt;br /&gt;&lt;br /&gt;The government, used to exerting significant control over media like newspapers, films and television, has in recent months been frustrated in its effort to extend similar and greater regulations to Web sites, most of which are based in the United States. Late last year, an Indian minister tried to get social media sites to prescreen content created by their users before it was posted. The companies refused and the attempt failed under withering public criticism.&lt;br /&gt;&lt;br /&gt;While just 100 million of India’s 1.2 billion people use the Internet regularly, the numbers are growing fast among people younger than 25, who make up about half the country’s population. For instance, there were an estimated 46 million active Indian users on Facebook at the end of 2011, up 132 percent from a year earlier.&lt;br /&gt;&lt;br /&gt;Sunil Abraham, an analyst who has closely followed India’s battles with Internet companies, said last week’s effort to tackle hate speech was justified but poorly managed. He said the first directive from the government was impractically broad, asking all Internet “intermediaries” — a category that includes small cybercafes, Internet service providers and companies like Google and Facebook — to disable all content that was “inflammatory, hateful and inciting violence.”&lt;br /&gt;&lt;br /&gt;“The Internet intermediaries are responding slowly because now they have to trawl through their networks and identify hate speech,” said Mr. Abraham, executive director of the Center for Internet and Society, a research and advocacy group based in Bangalore. “The government acted appropriately, but without sufficient sophistication.”&lt;br /&gt;&lt;br /&gt;In the days since the first advisory went out on Aug. 17, government officials have asked companies to delete dozens of specific Web pages. Most of them have been blocked, but officials have not publicly identified them or specified the sites on which they were hosted. Ministers have blamed groups in Pakistan, a neighbor with which India has tense relations, for creating and uploading many of the hateful pages and doctored images.&lt;br /&gt;&lt;br /&gt;A minister in the Indian government, Milind Deora, acknowledged that officials had received assistance from social media sites but said officials were hoping that the companies would move faster.&lt;br /&gt;&lt;br /&gt;“There is a sense of importance and urgency, and that’s why the government has taken these out-of-the-way decisions with regards to even curtailing communications,” Mr. Deora, a junior minister of communications and information technology, said in a telephone interview. “And we are hoping for cooperation from the platforms and companies to help us as quickly as possible.”&lt;br /&gt;&lt;br /&gt;Indian officials have long been concerned about the power of modern communications to exacerbate strife and tension among the nation’s many ethnic and religious groups. While communal violence has broadly declined in the last decade, in part because of faster economic growth, many grievances simmer under the surface. Most recently, fighting between the Bodo tribe and Muslims in the northeastern state of Assam has displaced about half a million people and, through text messages and online posts, affected thousands more across India.&lt;br /&gt;&lt;br /&gt;Officials at social media companies, speaking on the condition of anonymity to avoid offending political leaders, said that they were moving as fast as they could but that policy makers must realize that the company officials have to follow their own internal procedures before deleting content and revealing information like the Internet protocol addresses of users.&lt;br /&gt;&lt;br /&gt;“Content intended to incite violence, such as hate speech, is prohibited on Google products where we host content, including YouTube, Google Plus and Blogger,” Google said in a statement. “We act quickly to remove such material flagged by our users. We also comply with valid legal requests from authorities wherever possible.”&lt;br /&gt;&lt;br /&gt;Facebook said in a statement that it also restricts hate speech and “direct calls for violence” and added that it was “working through” requests to remove content. Twitter declined to comment on the Indian government’s request.&lt;br /&gt;&lt;br /&gt;Telecommunications company executives criticized the government’s response to the crisis as being excessive and clumsy. There was no need to limit text messages to just five a day across the country when problems were concentrated in a handful of big cities, said Rajan Mathews, director general of the Cellular Operators Association of India.&lt;br /&gt;&lt;br /&gt;“It could have been handled much more tactically,” he said.&lt;br /&gt;&lt;br /&gt;Others said the government could have been more effective had it quickly countered hateful and threatening speech by sending out its own messages, which it was slow to do when migrants from the northeast began leaving Bangalore on Aug. 15.&lt;br /&gt;&lt;br /&gt;“It has to also reach out on social networking and Internet platforms and dismantle these rumors,” Mr. Abraham said, “and demonstrate that they are false.”&lt;/p&gt;
