    <title>Draft nonsense</title>

        &lt;b&gt;Seriously flawed and dodgily drafted provisions in the IT Act provide the state a stick to beat its citizens with.&lt;/b&gt;
        &lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;Pranesh Prakash's &lt;a class="external-link" href="http://www.timescrest.com/opinion/draft-nonsense-9274"&gt;op-ed was published in the Times of India&lt;/a&gt; on November 24, 2012.&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;Section 66A of the Information Technology Act once again finds itself in the middle of a brewing storm. It has been used in cases ranging from the Mamata Banerjee cartoon case, the Aseem Trivedi case, the Karti Chidambaram case, the Chinmayi case, to the current Bal Thackeray-Facebook comments case. In all except the Karti Chidambaram case (which is actually a case of defamation where 's. 66A' is inapplicable), it was used in conjunction with another penal provision, showing that existing laws are more than adequate for regulation of online speech. That everything from online threats wishing sexual assault (the Chinmayi case) to harmless cartoons are sought to be covered under this should give one cause for concern. Importantly, this provision is cognisable (though bailable), meaning an arrest warrant isn't required. This makes it a favourite for those wishing to harass others into not speaking.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Section 66A prohibits the sending "by means of a computer resource or a communication device" certain kinds of messages. These messages are divided into three sub-parts : (a) anything that is "grossly offensive or has menacing character";(b) information known to be false for the purposes of "causing annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, enmity, hatred or ill will" and is sent persistently;or (c) "for the purpose of causing annoyance or inconvenience or to deceive or to mislead the addressee or recipient about the origin of such messages". This carries with it a punishment of up to three years in jail and a fine without an upper limit. As even non-lawyers can see, these are very broadly worded, with use of 'or' everywhere instead of 'and', and the punishment is excessive. The lawyers amongst the readers will note that while some of the words used are familiar from other laws (such as the Indian Penal Code), they are never used this loosely. And all should hopefully be able to conclude that large parts of section 66A are plainly unconstitutional.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;If that is so obvious, how did we end up getting this law? We copied (and badly at that) from the UK. The sad part is that the modifications that were introduced while copying are the bits that cause the most trouble. The most noteworthy of these changes are the increase in term of punishment to 3 years (in the UK it's 6 months); the late introduction (on December 16, 2008 by A Raja) of sub-section (c), meant as an anti-spam provision, but covering everything in the world except spam;and the mangling up of sub-section (b) to become a witches brew of all the evil intentions in this world.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Further, we must recognise that our Constitution is much stronger when it comes to issues like free speech than the UK's unwritten constitution, and our high courts and Supreme Court have the power to strike down laws for being unconstitutional, unlike in the UK where Parliament reigns supreme. The most the courts can do there is accommodate the European Convention on Human Rights by 'reading down' laws rather than striking them down.&lt;br /&gt;&lt;br /&gt;Lastly, even if we do decide to engage in policy-laundering, we need to do so intelligently. The way the government messed up section 66A should serve as a fine lesson on how not to do so. While one should fault the ministry of communications and IT for messing up the IT Act so badly, it is apparent that the law ministry deserves equal blame as well for being the sleeping partner in this deplorable joint venture. For instance, wrongfully accessing a computer to remove material which one believes can be used for defamation can be considered 'cyber-terrorism'. Where have all our fine legal drafters gone? In a meeting, former SEBI chairman M Damodaran noted how bad drafters make our policies seem far dumber than they are. We wouldn't be in this soup if we had good drafters who clearly understand the fundamental rights guaranteed by our constitution.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There are a great many things flawed in this unconstitutional provision, from the disproportionality of the punishment to the non-existence of the crime. The 2008 amendment to the IT Act was one of eight laws passed in 15 minutes without any debate in the 2008 winter session of Parliament. For far too long the Indian government has spoken about "multi-stakeholder" governance of the internet at international fora (meaning that civil society and industry must be seen as equal to governments when it comes to policymaking for the governance of the internet). It is about time we implemented multi-stakeholder internet governance domestically. The way to go forward in changing this would be to set up a multi-stakeholder body (including civil society and industry) which can remedy this and other ridiculously unconstitutional provisions of our IT Act.&lt;/p&gt;

&lt;p class="p3" style="text-align: justify; "&gt;(B) knowingly or intentionally penetrates or accesses a computer resource without       authorisation or exceeding authorised access, and by means of such conduct obtains       access to information, data or computer database that is restricted for reasons of       the security of the State or foreign relations; or any restricted information, data       or computer database, with reasons to believe that such information, data or computer       database so obtained may be used to cause or likely to cause injury to the interests       of the sovereignty and integrity of India, the security of the State, friendly relations       with foreign States, public order, decency or morality, or in relation to contempt       of court, defamation or incitement to an offence, or to the advantage of any foreign       nation, group of individuals or otherwise,&lt;/p&gt;
&lt;p class="j1"&gt;commits the offence of cyber terrorism.&lt;/p&gt;

    <title>The Last Word: Is there a need to review Information Technology Act?</title>

        &lt;b&gt;Does the high-handed arrest of two young girls mean it's time to review and revise the IT Act?&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;Aryaman Sundaram, Pavan Duggal, Pranesh Prakash and Ravi Visvesvaraya Prasad took part in a discussion with Karan Thapar on section 66A of the IT Act. This was aired on CNN-IBN on November 20, 2012.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Pranesh Prakash said that it was just not a history of misuse of section 66A of the IT Act because that presumes that the law is otherwise fine and it has just been applied wrongly. This law is fundamentally flawed. It is unconstitutional. It is like a law in which there is a provision on rape, murder, theft, nuisance, everything put together in a single section with the same punishment being given for all of them. This obviously is not good law making but that is exactly what has been done in this case by taking bits from laws in the UK and from elsewhere and mashing them all up into one omnibust gargantuan monster which is unconstitutional.&lt;br /&gt;&lt;br /&gt;Pranesh Prakash also added that the fact is that if you have bad laws they will be used to harass people. Having good law is one part of that. Apart from that there has been also other laws which have been misapplied in this case. In all these recent cases, section 66A of the IT Act wasn't the only provision used. This particular section has been used in conjunction with some other laws. So section 66A of the IT Act independently is not required. There are other laws in the Indian Penal Code and elsewhere which are usually enough to cover all the things that section 66A of the IT Act is right now covering. It is just an add on provision that really can't justify its existence unless it is really reduced in scope.&lt;/p&gt;
&lt;hr /&gt;

    <title>Arbitrary Arrests for Comment on Bal Thackeray's Death</title>

        &lt;b&gt;Two girls have been arbitrarily and unlawfully arrested for making comments about the late Shiv Sena supremo Bal Thackeray's death.  Pranesh Prakash explores the legal angles to the arrests.&lt;/b&gt;
        &lt;h2 id="facts-of-the-case"&gt;Facts of the case&lt;/h2&gt;
&lt;p&gt;This morning, there was &lt;a href="http://www.mumbaimirror.com/article/2/2012111920121119043152921e12f57e1/In-Palghar-cops-book-21yearold-for-FB-post.html"&gt;a short report in the Mumbai Mirror&lt;/a&gt; about two girls having been arrested for comments one of them made, and the other 'liked', on Facebook about Bal Thackeray:&lt;/p&gt;
&lt;blockquote&gt;
&lt;p&gt;Police on Sunday arrested a 21-year-old girl for questioning the total shutdown in the city for Bal Thackeray’s funeral on her Facebook account. Another girl who ‘liked’ the comment was also arrested.&lt;/p&gt;
&lt;p&gt;The duo were booked under Section 295 (a) of the IPC (for hurting religious sentiments) and Section 64 (a) of the Information Technology Act, 2000. Though the girl withdrew her comment and apologised, a mob of some 2,000 Shiv Sena workers attacked and ransacked her uncle’s orthopaedic clinic at Palghar.&lt;/p&gt;
&lt;p&gt;“Her comment said people like Thackeray are born and die daily and one should not observe a bandh for that,” said PI Uttam Sonawane.&lt;/p&gt;
&lt;/blockquote&gt;
&lt;h2 id="what-provisions-of-law-were-used"&gt;What provisions of law were used?&lt;/h2&gt;
&lt;p&gt;There's a small mistake in Mumbai Mirror's reportage as there is no section "64(a)"&lt;sup&gt;&lt;a class="footnoteRef" href="#fn1" id="fnref1"&gt;1&lt;/a&gt;&lt;/sup&gt; in the Information Technology (IT) Act, nor a section "295(a)" in the Indian Penal Code (IPC). They must have meant &lt;a href="https://cis-india.org/internet-governance/resources/section-295a-indian-penal-code"&gt;section 295A of the IPC&lt;/a&gt; ("outraging religious feelings of any class") and &lt;a href="https://cis-india.org/internet-governance/resources/section-66A-information-technology-act"&gt;section 66A of the IT Act&lt;/a&gt; ("sending offensive messages through communication service, etc."). (Update: The Wall Street Journal's Shreya Shah has confirmed that the second provision was section 66A of the IT Act.)&lt;/p&gt;
&lt;p&gt;Section 295A of the IPC is cognizable and non-bailable, and hence the police have the powers to arrest a person accused of this without a warrant.&lt;sup&gt;&lt;a class="footnoteRef" href="#fn2" id="fnref2"&gt;2&lt;/a&gt;&lt;/sup&gt; Section 66A of the IT Act is cognizable and bailable.&lt;/p&gt;
&lt;p&gt;Update: Some news sources claim that &lt;a href="http://www.vakilno1.com/bareacts/indianpenalcode/s505.htm"&gt;section 505(2) of the IPC&lt;/a&gt; ("Statements creating or promoting enmity, hatred or ill-will between classes") has also been invoked.&lt;/p&gt;
&lt;h2 id="was-the-law-misapplied"&gt;Was the law misapplied?&lt;/h2&gt;
&lt;p&gt;This is clearly a case of misapplication of s.295A of the IPC.&lt;sup&gt;&lt;a class="footnoteRef" href="#fn3" id="fnref3"&gt;3&lt;/a&gt;&lt;/sup&gt; This provision has been frivolously used numerous times in Maharashtra. Even the banning of James Laine's book &lt;i&gt;Shivaji: Hindu King in Islamic India&lt;/i&gt; happened under s.295A, and the ban was subsequently held to have been unlawful by both the Bombay High Court as well as the Supreme Court. Indeed, s.295A has not been applied in cases where it is more apparent, making this seem like a parody news report.&lt;/p&gt;
&lt;p&gt;Interestingly, the question arises of the law under which the friend who 'liked' the Facebook status update was arrested. It would take a highly clever lawyer and a highly credulous judge to make 'liking' of a Facebook status update an act capable of being charged with electronically "sending ... any information that is grossly offensive or has menacing character" or "causing annoyance or inconvenience", or under any other provision of the IT Act (or, for that matter, the IPC).&lt;sup&gt;&lt;a class="footnoteRef" href="#fn4" id="fnref4"&gt;4&lt;/a&gt;&lt;/sup&gt; That 'liking' is protected speech under Article 19(1)(a) is not under question in India (unlike in the USA where that issue had to be adjudicated by a court), since unlike the wording present in the American Constitution, the Indian Constitution clearly protects the 'freedom of speech &lt;b&gt;and expression&lt;/b&gt;', so even non-verbal expression is protection.&lt;/p&gt;
&lt;h2 id="role-of-bad-law-and-the-police"&gt;Role of bad law and the police&lt;/h2&gt;
&lt;p&gt;In this case the blame has to be shared between bad law (s.66A of the IT Act) and an abuse of powers by police. The police were derelict in their duty, as they failed to provide protection to the Dhada Orthopaedic Hospital, run by the uncle of the girl who made the Facebook posting. Then they added insult to injury by arresting Shaheen Dhada and the friend who 'liked' her post. This should not be written off as a harmless case of the police goofing up. Justice Katju is absolutely correct in &lt;a href="http://www.hindustantimes.com/India-news/NewDelhi/Katju-demands-action-against-Mumbai-cops-for-arresting-woman/Article1-961478.aspx"&gt;demanding that such police officers should be punished&lt;/a&gt;.&lt;/p&gt;
&lt;h2 id="rule-of-law"&gt;Rule of law&lt;/h2&gt;
&lt;p&gt;Rule of law demands that laws are not applied in an arbitrary manner. When tens of thousands were making similar comments in print (Justice Katju's article in the Hindu, for instance), over the Internet (countless comments on Facebook, Rediff, Orkut, Twitter, etc.), and in person, how did the police single out Shaheen Dhada and her friend for arrest?&lt;sup&gt;&lt;a class="footnoteRef" href="#fn5" id="fnref5"&gt;5&lt;/a&gt;&lt;/sup&gt;&lt;/p&gt;
&lt;h2 id="social-media-regulation-vs.-suppression-of-freedom-of-speech-and-expression"&gt;Social Media Regulation vs. Suppression of Freedom of Speech and Expression&lt;/h2&gt;
&lt;p&gt;This should not be seen merely as "social media regulation", but as a restriction on freedom of speech and expression by both the law and the police. Section 66A makes certain kinds of speech-activities ("causing annoyance") illegal if communicated online, but legal if that same speech-activity is published in a newspaper. Finally, this is similar to the Aseem Trivedi case where the police wrongly decided to press charges and to arrest.&lt;/p&gt;
&lt;p&gt;This distinction is important as it being a Facebook status update should not grant Shaheen Dhada any special immunity; the fact of that particular update not being punishable under s.295 or s.66A (or any other law) should.&lt;/p&gt;

&lt;p&gt;Section 64 of the IT Act is about "recovery of penalty" and the ability to suspend one's digital signature if one doesn't pay up a penalty that's been imposed.&lt;a href="#fnref1"&gt;↩&lt;/a&gt;&lt;/p&gt;
&lt;/li&gt;
&lt;li id="fn2"&gt;
&lt;p&gt;The police generally cannot, without a warrant, arrest a person accused of a bailable offence unless it is a cognizable offence. A non-bailable offence is one for which a judicial magistrate needs to grant bail, and it isn't an automatic right to be enjoyed by paying a bond-surety amount set by the police.&lt;a href="#fnref2"&gt;↩&lt;/a&gt;&lt;/p&gt;
&lt;/li&gt;
&lt;li id="fn3"&gt;
&lt;p&gt;Section 295A of the IPC has been held not to be unconstitutional. The first case to &lt;a href="http://ibnlive.in.com/generalnewsfeed/news/pil-to-declare-sec-66a-as-unconstitutional-filed/1111666.html"&gt;challenge the constitutionality of section 66A of the IT Act&lt;/a&gt; was filed recently in front of the Madurai bench the Madras High Court.)&lt;a href="#fnref3"&gt;↩&lt;/a&gt;&lt;/p&gt;
&lt;/li&gt;
&lt;li id="fn4"&gt;
&lt;p&gt;One can imagine an exceptional case where such an act could potentially be defamatory, but that is clearly exceptional.&lt;a href="#fnref4"&gt;↩&lt;/a&gt;&lt;/p&gt;
&lt;/li&gt;
&lt;li id="fn5"&gt;

        &lt;b&gt;After Bal Thackeray's death, during the Mumbai Bandh, a 21-year-old criticised the shutdown on her Facebook page — her friend approved of it — next thing they know, they are facing a case, and this morning they were arrested. &lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;YP Singh, Alyque Padamsee, Rohan Joshi, Karuna Nundy and Pranesh Prakash took part in a discussion about the arrest of two girls over a Facebook comment. The discussion was aired in NDTV on November 19, 2012.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The anchor asked Pranesh Prakash:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Who are these people scrolling through people's Facebook posts and Twitter accounts, finding these comments and taking action?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Pranesh Prakash said that it could be anyone. The reality is doesn't really matter because the laws are written in such a way that if it is public and stuff that is on Facebook for different purposes can either be public or private, if it is public these laws can very often apply and that is a problem. We haven't quite figured out to what extent these laws apply. The IT Act section 66A for instance, is unconstitutional, section 295 A which has been applied, and section 505 which also seems to have been applied in this case make it a clear case of misappropriation of those provisions. These kind of arrests will happen. It doesn't quite matter if we have right laws at one level and it clearly doesn't help if we have bad laws. What we need to do at least in part to remedy the situation is to amend the IT Act to make it consonant and consistent with civil and political rights and to do so in multi-stakeholder fashion  involving civil society, industry and government. Right now it doesn't protect privacy and freedom of speech as much as it should.&lt;/p&gt;

        &lt;p style="text-align: justify; "&gt;&lt;b&gt;Unnecessary Blocks and Mistakes:&lt;/b&gt;&lt;/p&gt;
&lt;ol&gt;
&lt;li style="text-align: justify; "&gt;http://hinduexistance.files.wordpress.com/..., which appears on the leaked list, does not exist because the URL is incorrect. However, the correct URL does contain an image which, in my opinion, can be considered to be capable of inciting violence. It has not been blocked due to a spelling error in the order. Instead of blocking hinduexist&lt;b&gt;&lt;i&gt;e&lt;/i&gt;&lt;/b&gt;nce.wordpress.com/... the DoT has ordered the blocking of hinduexist&lt;b&gt;&lt;i&gt;a&lt;/i&gt;&lt;/b&gt;nce.wordpress.com/..., which does not exist.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;Two URLs in the block order are from the website of the High Council for Human Rights, Judiciary of the Islamic Republic of Iran. The reason for blocking these two links from this particular website is unclear.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;The website of the Union of NGOs of the Islamic World was blocked. Again, the reason for blocking this website remains unclear.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;URLs such as, http://farazahmed.com/..., mumblingminion.blogspot.com, were blocked. The content on these URLs was in fact debunking the fake photographs.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;Certain blocked Facebook pages did not have any bearing on the North East exodus which was the main reason behind the blocks. For example, Facebook link leading to United States Institute for Peace page was blocked.&lt;/li&gt;
&lt;/ol&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt; &lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Duration of the Block&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Department of Telecommunications (DoT) did not specify the period for which the block has been implemented in its orders. As a result of which certain URLs still remain blocked while a majority of the links in the leaked list can be accessed. Lack of clear directions from the DoT has resulted in haphazard blocking and certain internet service providers (ISPs) have lifted the block on certain links whereas some other ISPs have continued with a complete block.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt; &lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;How have the intermediaries reacted to the block orders?&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Going by the leaked list of websites blocked by DoT, it issued the block orders to ‘all internet service licensees’. Intermediaries that do not fall in the category of 'internet service licensees’ were also sent  a separate set of requests for taking down third party content. However, it is unclear under which provision of the law such request was made by the Government.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Internet Service Licensees&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;&lt;img src="https://cis-india.org/home-images/chart_1.png" alt="Implementation of the order at the ISP level" class="image-inline" title="Implementation of the order at the ISP level" /&gt;&lt;br /&gt;&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The internet service licensee or the ISPs have not followed any uniform system to notify that a particular URL or website in the leaked list is blocked according to DoT’s orders. The lack of transparency in the implementation of the block orders, have a chilling effect on free speech.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;For instance, BSNL returns the following messages:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"This website/URL has been blocked until further notice either pursuant to Court orders or on the Directions issued by the Department of Telecommunications" or “This site has been blocked as per instructions from Department of Telecom (DOT).”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;However, these messages are not uniform across all the URLs/websites in the leaked list. BSNL does not generate any response for the majority of the URLs in the leaked list. This results in ‘invisible censorship’ as the person who is trying to access the blocked URL does not have any means to know whether a particular URL is unavailable or certain sites are blocked by government orders.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Lack of notification does not only infringes upon the fundamental right  to freedom of speech and expression but also violates the fundamental  right to a constitutional remedy guaranteed under Article 32 of our  Constitution. The person aggrieved by such block orders cannot approach  the Court for a remedy because there is no means to figure out:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;(a) Description of the content blocked?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;(b) Who  has issued the block order/request?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;(c) Under which provision of the law such  block order/request has been issued?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;(d) Who has  implemented the block order/request? and&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;(e) What was the reason for the block?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The intermediaries should provide with the above notification details while implementing a block order issued by the Government. &lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Intermediaries hosting third party content: &lt;/b&gt;&lt;/p&gt;
&lt;p align="right" style="text-align: justify; "&gt;More than 100 out of the 309 blocks are Facebook (http and https) URLs. Facebook has not informed its users about the reasons behind unavailability of certain pages or content. This is another instance of invisible censorship. However, YouTube, a Google service, has maintained certain level of transparency, and informs the user that the content has been blocked as per ‘government removal request’. It is interesting to note that certain YouTube user accounts were terminated as well. It is unclear whether this was as a result of the block order. Furthermore, links associated with blogger.com, which is another service provided by Google, have been removed.&lt;/p&gt;

        &lt;b&gt;In an unprecedented move, the government, through the Department of Telecommunications and the Department of Electronics and Information Technology, has agreed to initiate dialogue on Internet censorship with mega Internet companies, social media giants such as Google and Facebook, members of civil society, technical community, media, ISPs and legal experts.&lt;/b&gt;

&lt;p style="text-align: justify; "&gt;The triggers for the discussion, which will be held on Wednesday, are the riots in Assam, Mumbai and Uttar Pradesh, as well as the mass exodus of north-east Indians from Bangalore, which resulted in bringing the government, civil society organisations and the media to a flashpoint.&lt;br /&gt;&lt;br /&gt;Two of India’s seniormost officers in the area of Internet censorship, DoT Secretary R. Chandrashekhar and Director General, CERT-IN, Gulshan Rai will engage with a range of stakeholders in a two-hour meeting titled ‘Legitimate Restrictions on Freedom of Online Speech: The need for balance – from Deadlock to Dialogue.’&lt;br /&gt;&lt;br /&gt;Other panellists include representatives from Google and Facebook; Pranesh Prakash from the Centre for Internet and Society (a civil society group); Prabir Purkayasta, Delhi Science Forum (technical community); Paranjoy Guha Thakurta, president, Foundation for Media Professionals; Rajesh Chharia, president, Internet Service Providers Association of India; and Apar Gupta, an advocate dealing with cyber issues.&lt;br /&gt;&lt;br /&gt;One analysis by the CIS has shown that 309 specific items, including URLs, Twitter accounts, IMG tags, blog posts and blogs were blocked. Complaints arose when blocking a page resulted in the blocking of an entire website — which has scores or hundreds of web pages. The government maintained that this was necessary as there was a sense of crisis. Home Minister Sushil Kumar Shinde insisted that the government was “taking strict action only against those accounts or people which are causing damage or spreading rumours.” However, the collateral damage of the move was the Twitter accounts of several people, including journalists like Kanchan Gupta, being blocked.&lt;br /&gt;&lt;br /&gt;“Mass censorship is like killing a fly with a sledgehammer. Rather than blocking the sites, the government should have used the same media, Facebook, Twitter and Google to counter terrorism and hate speech. I am glad that they are now open to dialogue,” says Mr. Thakurta.&lt;br /&gt;&lt;br /&gt;“It is an extremely productive move as it will generate awareness among content providers, government and users. In the absence of any dialogue, everyone was just sticking to their own positions without listening to the other stakeholders’ point of view,” says Mr. Chharia.&lt;br /&gt;&lt;br /&gt;The meeting is to bring several stakeholders in dialogue on a single platform.&lt;br /&gt;&lt;br /&gt;Nearly 50 other experts from industry, mobile service providers, Internet companies, intermediaries, academia and some international organisations as well as multilaterals are expected to join the conference, which will be held at 2.30 p.m. on September 4 at FICCI.&lt;br /&gt;&lt;br /&gt;While this is seen as a brave attempt by some, there are an equal number of sceptics who believe that the discussion may not yield the desired result given the national security objectives governing law enforcement agencies on the one hand and the desire of users, media and civil society to preserve free speech on the other. Clearly, ISPs, Internet companies and social media are in a tough spot since they face legal obligations on legitimate orders for blocking on one hand while needing to protect their user privacy and rights to unhindered access to information.&lt;br /&gt;&lt;br /&gt;If successful, it is possible that this dialogue will ensure that legitimate restrictions do not slide into illegitimate censorship.&lt;/p&gt;

&lt;p class="body" style="text-align: justify; "&gt;&lt;span&gt;Over  the past week, the Ministry of Communications and IT has sent out  orders to ISPs (Internet service providers) to block over 300 unique  addresses on the Web, cracking down on websites, Facebook pages, YouTube  videos and even Twitter handles, ostensibly to prevent incitement to  communal tension and rioting.&lt;/span&gt;&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;&lt;span&gt;But  a closer look at the specific URLs (web addresses) blocked by the  government has given rise to doubts whether the government may have  acted high-handedly, in some instances cracking down on parody Twitter  handles.&lt;/span&gt;&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;&lt;span&gt;Through  four orders, one issued a day from August 18 to 21, the government sent  out lists of specific URLs to be blocked by the Internet service  providers.&lt;/span&gt;&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;&lt;span&gt;An  analysis of the leaked government orders by blogger Pranesh Prakash of  the Center for Internet and Society (www.cis-india.org) revealed the  extent of the government missive: in specific cases, it had asked for  blocking of some portions of a website — like Facebook pages or Twitter  handles — and in other instances asked for entire websites.&lt;/span&gt;&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;&lt;span&gt;The  government orders carried no specific reasons for the blockades. But in  the backdrop of the paranoia surrounding the exodus of northeast people  from South Indian cities, it appears that it may have been to disallow  the use of the Web for spreading information that incites communal  violence and rioting.&lt;/span&gt;&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;&lt;span&gt;Cyber  law expert N. Vijayashankar said though the government seemed to have  acted within the Rules of IT Act 2008, the onus fell on it to justify  the reasons why the specific websites were blocked and dispel doubts  that there may have been some political motives at least pertaining to  specific sites, especially in the blocking of some parody Twitter  accounts spoofing the official Twitter account of the Prime Minister’s  office (@PMOIndia).&lt;/span&gt;&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;&lt;span&gt;“No  website can be blocked permanently. Any blocked website must be taken  up for review by a committee in a span of two months,” Mr. Vijayashankar  added. “But sadly the review committee does not have any public  representatives. It comprises only the secretaries to government.”&lt;/span&gt;&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;&lt;span&gt;If  the websites had indeed been blocked considering the emergency of the  situation and keeping in mind national security, then the responsibility  for preparing the list falls with the Home Ministry.&lt;/span&gt;&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;&lt;span&gt;“Whatever be the case, this cannot pave the way for clamping down on websites at one swipe,” Mr. Vijayashankar added.&lt;/span&gt;&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;&lt;span&gt;The  news about the clampdown set the social networks abuzz through  Thursday. Popular humour Twitter account holder Ramesh Srivats tweeted:  “Am slightly worried that some government guy will notice that all the  offending sites have “http” in them, and then go ban that.”&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;As the Indian government sought to block bulk SMS, MMS, webpages and specific social media urls, justifying its step as an attempt to control viral rumor-mongering and “cyber-terrorism”, there was a lot of discussion on the mainstream media (MSM) about how social media was fast becoming a “&lt;a href="http://articles.timesofindia.indiatimes.com/2012-08-21/social-media/33302561_1_social-media-india-pages-twitter"&gt;double-edged sword&lt;/a&gt;” and how the recent events brought out the “&lt;a href="http://www.thehindu.com/news/national/article3781473.ece"&gt;mischief potential of social media in full play&lt;/a&gt;“. These MSM opinions, some of which offered tacit support the idea of reigning in social media, did not go unnoticed by netizens. For example, Media Crooks &lt;a href="http://www.mediacrooks.com/2012/08/assam-azad-maidan-how-msm-sibalises.html#.UDXXsNUe62V"&gt;asked&lt;/a&gt;:&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;So what’s with the rant against the Twitterati and social media by these media celebs?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;img src="http://globalvoicesonline.org/wp-content/uploads/2012/08/twitter-block.jpg" /&gt;&lt;/p&gt;
&lt;p&gt;Blogger Amrit Hallan at Writing Cave wondered if the MSM had an underlying motive for creating a hype around the ‘dangers' of social media. He &lt;a href="http://writingcave.com/india-becoming-blockistan/"&gt;wrote&lt;/a&gt;:&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;People in the mainstream media have always been at loggerheads with the free spirit of social networking websites that empowers everybody to express opinions and spread ideas…(they) have been gleefully recommending the curtailment (of social media). Social networking and blogging continuously make their job hard. The moment they try to spread some misinformation, it is countered by Twitter or blogs with factually correct information, often posted by people close to the ground.&lt;/p&gt;

The ISPs have been sent &lt;a href="http://kafila.org/2012/08/23/full-text-the-indian-governments-recent-orders-to-internet-service-providers-to-block-websites-webpages-and-twitter-accounts/"&gt;official communication&lt;/a&gt; to block webpages and twitter handles, including those of&lt;a href="http://timesofindia.indiatimes.com/tech/news/internet/Govt-blocks-Twitter-accounts-of-some-journalists/articleshow/15612767.cms"&gt;some journalists &lt;/a&gt;plus &lt;a href="http://www.watblog.com/2012/08/22/the-indian-government-asks-isps-to-block-fake-and-parody-pmo-twitter-accounts/"&gt;fake profiles &lt;/a&gt;created with the purpose of lampooning the Indian Prime Minister. Curiously, the Pakistani blogger Faraz Ahmed Siddiqui, who was the first to break the news about the morphed photos being used to incite communal tensions, also came under the ambit of censorship and his &lt;a href="http://blogs.tribune.com.pk/story/12867/social-media-is-lying-to-you-about-burmas-muslim-cleansi/"&gt;post&lt;/a&gt; was &lt;a href="http://tribune.com.pk/story/425161/india-blocks-tribune-blog-exposing-burma-muslim-killings/"&gt;inaccessible&lt;/a&gt; on some ISPs.&lt;/p&gt;
&lt;p&gt;AEIdeas, a blog from the American Enterprise Institute &lt;a href="http://www.aei-ideas.org/2012/08/shooting-the-messenger-in-india/"&gt;commented&lt;/a&gt; on the issue:&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;The Indian government ought to have given Mr. Siddiqui a medal for his investigative work. Instead it has blocked his post.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Social media users in India have been following the government actions closely and there is much&lt;a href="http://www.iphoneeinstein.com/2012/08/21/india-debates-misuse-of-social-media/"&gt;debate&lt;/a&gt; and &lt;a href="http://www.socialsamosa.com/2012/08/twitter-users-speak-out-on-isp-indian-government-blocking-twitter-accounts/"&gt;discussion&lt;/a&gt; about whether the crack down on social media is censorship of free speech in the guise of rumor control.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Some have termed the government's action as &lt;a href="http://uberdesi.com/blog/2012/08/23/indian-government-enters-new-era-of-censorship/?utm_source=rss&amp;amp;utm_medium=rss&amp;amp;utm_campaign=rss"&gt;Orwellian&lt;/a&gt;/&lt;a href="https://twitter.com/kiranmanral/status/238479576538423296"&gt;dystopian&lt;/a&gt;. Others have seen &lt;a href="http://www.livemint.com/2012/08/23212045/Views--India8217s-Net-nann.html?h=E"&gt;merit&lt;/a&gt; in the government's ‘intent' to curb inflammatory content but have been disappointed with the ineffective way the government went about the task - acting as “Net nannies” and “blocking communications, curbing speech, and banning websites”.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;At CIS India, Pranesh Prakash did an &lt;a href="https://cis-india.org/internet-governance/blog/analysing-blocked-sites-riots-communalism"&gt;analysis&lt;/a&gt; of the social media content blocked in India since August 18, 2012. &lt;p class="callout" style="text-align: justify; "&gt;instead of banning social media, the government can use it in its favor controlling the crisis of NE. The virality feature that our politicians are scared of can be used for killing rumors. Can’t the government get in touch with Facebook and Google India to find out ways to use social media in a better way? Can’t the Government start a social media campaign to&lt;b&gt; &lt;/b&gt;&lt;b&gt;“Save NE and Save India”?&lt;/b&gt;&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;Twitter is one of the tools that the government can use. A brilliant example is how Nirupama Rao, India’s Foreign Secretary &lt;a href="http://economictimes.indiatimes.com/news/politics/nation/nirupama-rao-breaks-barrier-tweets-on-libya-and-other-crises/articleshow/7611382.cms"&gt;used Twitter during the evacuation of Indians at the time of the Libyan crisis&lt;/a&gt;.&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;Social Media is not rocket science; it is about communicating with humans and for that you need to have the will to evolve and change. Banning social networks is not a solution to combat rumors but it is a half backed measure to cover the lid on the growing tensions.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The government, on it's part, &lt;a href="http://web2asia.blognhanh.com/2012/08/indian-government-issues-social-media.html"&gt;issued social media guidelines&lt;/a&gt; to be followed by government agencies. It remains to be seen how the situation develops on the ground and what impact the current stand-off between government and social media has on cyber-control policies in the days to come.&lt;/p&gt;

    <title>Blocked websites: Where India flawed</title>

&lt;p style="text-align: justify; "&gt;India is threatening to block Twitter as the latter has allegedly failed to respond to the government's order to remove some inflammatory posts.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;That has come to light as it is being widely covered in media, but there are hundreds of websites which have already been shut, apparently without due notice to the owners.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Apart from Facebook, Twitter and YouTube accounts, the blocked websites include which are sympathetic to Hindu and Muslim radical groups.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In an &lt;a href="http://www.ciol.com/News/News-Reports/Blocked-websites-Where-India-flawed/165165/0/%28http:/cis-india.org/internet-governance/blog/analysing-blocked-sites-riots-communalism%29" shape="rect" target="_self"&gt;analysis of 309 websites&lt;/a&gt; blocked in the wake of exodus of North eastern people from Bangalore, Pranesh Prakash of the Centre for Internet and Society (CIS), says the government has blocked these sites under the Information Technology Act, but it failed to provide the mandatory 48 hours to respond (under Rule 8 of the Information Technology Procedure and Safeguards for Blocking for Access of Information by Public, Rules 2009).&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He writes in his post: "The persons and intermediaries hosting the content should have been notified. Even if the emergency provision (Rule 9) was used, the block issued on August 18, 2012, should have been introduced before the "Committee for Examination of Request" by August 20, 2012 (within 48 hours), and that committee should have notified the persons and intermediaries hosting the content.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Internet censorship is acceptable as long as it is in the purview of the law and doesn't encroach one's freedom. In this case, some people and posts debunking rumours have been blocked, says Pranesh.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He points to some discrepancies in the way the websites are blocked:&lt;/p&gt;
&lt;ol&gt;
&lt;li style="text-align: justify; "&gt;Some of the items are not even web addresses (e.g., a few HTML img tags were included). Some of the items they have tried to block do not even exist (e.g., one of the Wikipedia URLs).&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;An entire domain was blocked on Sunday, and a single post on that domain was blocked on Monday.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;For some YouTube videos, the 'base' URL of YouTube videos is blocked, but for other the URL with various parameters (like the "&amp;amp;related=" parameter) is blocked. That means that even nominally 'blocked' videos will be freely accessible.&lt;/li&gt;
&lt;/ol&gt;
&lt;p style="text-align: justify; "&gt;He concludes: "All in all, it is clear that the list was not compiled with sufficient care."&lt;/p&gt;

    <title>Northeast exodus: Is there a mechanism to pre-screen social media content?</title>

But is it feasible to pre-screen objectionable or provocative content, and reject it before posting so that there is no chance of such rumours?

&lt;p style="text-align: justify; "&gt;The article by Wahid Bukhari was &lt;a class="external-link" href="http://www.merinews.com/article/northeast-exodus-is-there-a-mechanism-to-pre-screen-social-media-content/15874014.shtml"&gt;published in merinews&lt;/a&gt; on August 23, 2012. Pranesh Prakash is quoted.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;The government took the action after Home Minister RK Singh alleged that the exodus of northeastern people from southern states such as Bangalore, Mumbai and Pune was a result of the panic and rumours created because of the content uploaded on these websites, many according to him were created by elements across the border in Pakistan. Though many suspected that Mr Singh's claim was an excuse to save the government from its inefficiency in controlling the riots, and the exodus of the northeastern people who were seen boarding the trains to their home states with their belongings amid fears of reprisal attacks.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Was the action meant to pass on the inefficiency buck or not - the government has, at least, managed to shift the focus of the media from exodus to the debate - as to whether social networking sites or websites promoting hatred should be blocked or not - given the democratic rights of every citizen to freedom of speech and expression.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Around a hundred more websites have been reported promoting hate speech and &lt;a href="http://www.merinews.com/topics/business/Google"&gt;Google&lt;/a&gt;, &lt;a href="http://www.merinews.com/topics/business/facebook"&gt;Facebook&lt;/a&gt; and other social networking sites like &lt;a href="http://www.merinews.com/topics/business/Twitter"&gt;Twitter&lt;/a&gt; have been asked to remove such content as soon as possible but in this whole debate one question remains unanswered: How does removing a post from Twitter or Facebook make a difference, several hours after it was published? One might argue even an hour is enough for an inflammatory picture or comment to incite violence or hatred. As a consequence, one might demand that a comment is screened before it is posted on a website, otherwise it doesn't serve any purpose.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Whether pre-screening is technically possible, Pranesh Prakash maintains: "Given the amount of content uploaded on the larger social networks, pre-screening content is just not possible, while removal upon complaint is. They don't have editors like newspapers do; importantly, they shouldn't."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Perhaps, a mid way is to intervene prior to registration on social media websites. All those who register should be made aware of the content that's not permissible, and make them aware of relevant laws and repercussions of breaking them if their complicity is proved. Similarly, these sites can be asked by the Indian government to continuously remind registered users as well as general public, through mass media advertizing, about what kind of content is not permissible. The government, from its side, can strengthen cyber laws to empower sites such as Facebook and Twitter to curb posting of provocative content due to presence of these stringent laws.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Terming the government action unfortunate, Mr Prakash who is a programme manager with the Bangalore-based research and advocacy group, The Centre for Internet and Society believes that government botched up at so many levels. “I don't think the government should be going after Facebook, YouTube, or Twitter. It should be going to them, to work with them on removing content,” Mr Prakash suggests. "The larger social networks have dedicated complaints mechanisms, which the government could have asked them to run 24x7 for a few days, and to expedite that process, and both complained itself and asked the public to use the complaints process,” he adds.&lt;br /&gt; &lt;br /&gt; Though Pakistan has rubbished the claims that it has any role in fomenting trouble, but it has also asked the Indian government to provide it with evidence so that it could nab the accused. Whether or not there is any evidence is a secondary question, the primary blame will always rest with both the state and central governments who failed to stop the exodus of fear-stricken people from the northeast.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Experts like Mr Prakash are wondering why the government didn't pay back in the same coin by using the social media to dispel the rumours. “It is a pity that they notified a new policy to encourage governmental use of social media only today; they sorely needed it this last week,” Mr Prakash rues.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The government has blocked content related to thirty Twitter accounts but another surprising thing is that only accounts using the web interface have been blocked, and such accounts can still be accessed on BlackBerrys or other smartphones.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The only visible thing government did on ground when the exodus started taking place in Bangalore was the setting up of helplines but did they help in preventing the exodus - there are enough reasons to believe against it. "There were some complaints that the people attending some of these helplines could only speak in Kannada, and not the English or Hindi that people calling for help were expecting.     <title>Analysing Latest List of Blocked Sites (Communalism &amp; Rioting Edition)</title>

&lt;h2&gt;&lt;b&gt;How many items have been blocked?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;There   are a total of 309 specific items (those being URLs, Twitter accounts,   img tags, blog posts, blogs, and a handful of websites) that have been   blocked. This number is meaningless at one level, given that it doesn't   differentiate between the blocking of an entire website (with dozens  or  hundreds of web pages) from the blocking of a single webpage.  However,  given that very few websites have been blocked at the  domain-level, that  number is still reasonably useful.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Please   also note, we currently only have information related to what telecom   companies and Internet Service Providers (ISPs) were asked to block  till  August 21, 2012. We do not have information on what individual web   services have been asked to remove. That might take the total count  much  higher.&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;Why have these been blocked?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;As far   as I could determine, all of the blocked items have content (mostly   videos and images have been targeted, but also some writings) that are related to communal issues and rioting. (Please note: I am not calling the content itself "communal" or "incitement to rioting", just that the   content relates to communal issues and rioting.) This has been done in the context of the recent riots in Assam, Mumbai, UP, and the mass   movement of people from Bangalore.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There   were reports of parody Twitter accounts having been blocked.  Preliminary  analysis on the basis of available data show that parody  Twitter  accounts and satire sites have &lt;i&gt;not&lt;/i&gt; been targetted solely  for  being satirical. For instance, very popular parody Twitter  accounts,  such as @DrYumYumSingh are not on any of the four orders  circulated by  the Department of Telecom. (I have no information on  whether such parody  accounts are being taken up directly with Twitter  or not: just that  they aren't being blocked at the ISP-level. Media  reports indicate &lt;a href="http://goo.gl/GI9jP"&gt;six accounts have been taken up with Twitter&lt;/a&gt; for being similar to the Prime Minister's Office's account.)&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;Are the blocks legitimate?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;The   goodness of the government's intentions seem, quite clearly in my   estimation, to be unquestionable. Yet, even with the best intentions,   there might be procedural illegalities and over-censorship.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There   are circumstances in which freedom of speech and expression may   legitimately be limited. The circumstances that existed in Bangalore   could justifiably result in legitimate limitations on freedom of speech.   For instance, I believe that temporary curbs — such as temporarily   limiting SMSes &amp;amp; MMSes to a maximum of five each fifteen minutes for   a period of two days — would have been helpful.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;However   it is unclear whether the government has exercised its powers   responsibly in this circumstance. The blocking of many of the items on   that list are legally questionable and morally indefensible, even while a   some of the items ought, in my estimation, to be removed.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;If the   government has blocked these sites under s.69A of the Information   Technology Act ("Power to Issue Directions for Blocking for Public   Access of Any Information through any Computer Resource"), the persons   and intermediaries hosting the content should have been notified   provided 48 hours to respond (under Rule 8 of the Information Technology   (Procedure and Safeguards for Blocking for Access of Information by   Public) Rules 2009). Even if the emergency provision (Rule 9) was used,   the block issued on August 18, 2012, should have been introduced before   the "Committee for Examination of Request" by August 20, 2012 (i.e.,   within 48 hours), and that committee should have notified the persons   and intermediaries hosting the content.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Importantly,   even though many of the items on that list are repugnant and do  deserve  (in my opinion) to be removed, ordering ISPs to block them is  largely  ineffectual. The people and companies hosting the material  should have  been asked to remove it, instead of ordering Internet  service providers  (ISPs) to block them. All larger sites have clear  content removal  policies, and encouraging communal tensions and hate  speech generally  wouldn't be tolerated. That this can be done without  resort to the  dreadful Intermediary Guidelines Rules (which were passed  last year)  shows that those Rules are unnecessary. It is our belief  that &lt;a href="https://cis-india.org/internet-governance/constitutional-analysis-of-intermediaries-guidelines-rules"&gt;those Rules are also unconstitutional&lt;/a&gt;.&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;Are there any egregious mistakes?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;Yes, there are numerous such examples of egregious mistakes.&lt;/p&gt;
&lt;ol&gt;
&lt;li style="text-align: justify; "&gt;Most importantly, some even &lt;b&gt;people and posts      debunking rumours have been blocked&lt;/b&gt;.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;Some   of the Twitter accounts are of prominent      people who write for the   mainstream media, and who have written similar      content offline. If   their online content is being complained about, their      offline   content should be complained about too.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;Quite  a  number of the links include articles      published and reports   broadcast in the mainstream media (including a Times      Now report, a   Telegraph picture gallery, etc.), and in print, making the      blocks   suspect. Only the online content seems to have been targeted for        censorship.&lt;/li&gt;
&lt;/ol&gt;
&lt;p style="text-align: justify; "&gt;There are numerous mistakes and inconsistencies that make blocking pointless and ineffectual.&lt;/p&gt;
&lt;ol&gt;
&lt;li&gt;Some of the items are not even web addresses      (e.g., a few HTML img tags were included).&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;Some of the items they have tried to block do not      even exist (e.g., one of the Wikipedia URLs).&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;An entire domain was blocked on Sunday, and a      single post on that domain was blocked on Monday.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;For   some Facebook pages, the secure version      (https://facebook.com/...)   is listed, for others the non-secure version        (http://facebook.com/...) is listed.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;For   some YouTube videos, the 'base' URL of      YouTube videos is blocked,   but for other the URL with various parameters      (like the   "&amp;amp;related=" parameter) is blocked. That means that      even   nominally 'blocked' videos will be freely accessible.&lt;/li&gt;
&lt;/ol&gt;
&lt;p&gt;All in all, it is clear that the list was not compiled with sufficient care.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Despite   a clear warning by the DIT that "above URLs only" should be blocked,   and not "the main websites like www.facebook.com, www.youtube.com,   www.twitter.com, etc.", it has been seen that some ISPs (like Airtel) &lt;a href="http://www.labnol.org/india/india-blocks-youtube/25028/"&gt;have gone overboard in their blocking&lt;/a&gt;.&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;Why haven't you put up the whole list?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;Given   the sensitivity of the issue, we felt it would be premature to share  the  whole list. However, we strongly believe that transparency should  be an  integral part of all censorship. Hence, this analysis is an  attempt to  provide some much-needed transparency. We intend to make the  entire list  public soon, though. (Given how porous such information  is, it is  likely that someone else will procure the list, and release  it sooner  than us.)&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;Why can I still access many items that are supposed to be blocked?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;One   must keep in mind that fresh orders have been issued on a day-by-day   basis, that there are numerous mistakes in the list making it difficult   to apply (some of these mistakes have been mentioned above), and the   fact that that this order has to be implemented by hundreds of ISPs.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Your   ISP probably has not have got around to enforcing the blocks yet. At the   time of this writing, most ISPs don't seem to be blocking yet. This   analysis is based on the orders sent around to ISPs, and not on the   basis of actual testing of how many of these have actually been blocked   by Airtel, BSNL, Tata, etc.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Additionally,   if you are using Twitter through a client (on your desktop, mobile,   etc.) instead of the web interface, you will not notice any of the   Twitter-related blocks.&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;So you are fine with censorship?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;No. I   believe that in some cases, the government has the legal authority to   censor. Yet, exercising that legal authority is usually not productive,   and in fact there are other, better ways of limiting the harms caused  by  speech and information than censorship. Limiting speech might even   prove harmful in situations like these, if it ends up restricting   people's ability to debunk false rumours. In a separate blog post (to be   put up soon), I am examining how all of the government's responses  have  been flawed both legally and from the perspective of achieving the   desired end.&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;So what should the government have done?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;Given   that the majority of the information it is targeting is on Facebook,   Youtube, and Twitter, the government could have chosen to fight &lt;i&gt;alongside&lt;/i&gt; those services to get content removed expeditiously, rather than fight &lt;i&gt;against&lt;/i&gt; them. (There are &lt;a href="http://www.firstpost.com/videos/govt-to-use-social-media-to-prevent-misuse-of-technology-sibal-426231.html"&gt;some indications&lt;/a&gt; that the government might be working with these services, but it certainly isn't doing enough.)&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;For   instance, it could have asked all of them to expedite their complaints   mechanism for a few days, by ensuring that the complaints mechanism is   run 24x7 and that they respond quickly to any complaint submitted about   communal incitement, spreading of panic, etc. This does not need the   passing of an order under any law, but requires good public relations   skills and a desire not to treat internet services as enemies. The   government could have encouraged regular users to flag false rumours and   hate speech on these sites. On such occasions, social networking sites   should step up and provide all lawful assistance that the government  may  require. They should also be more communicative in terms of the  help  they are providing to the government to curtail panic-inducing  rumours  and hate speech. (Such measures should largely be reactive, not   proactive, to ensure legitimate speech doesn't get curtailed.)&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The   best antidote for the rumours that spread far and wide and caused a mass   movement of people from Bangalore to the North-Eastern states would   have been clear debunking of those rumours. Mass outreach to people in   the North-East (very often the worried parents) and in Bangalore using   SMSes and social media, debunking the very specific allegations and   rumours that were floating around, would have been welcome. However,   almost no government officials actually used social media platforms to   reach out to people to debunk false information and reassure them. Even a   Canadian interning in our organization got a reassuring SMS from the   Canadian government.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is indeed a pity that the government &lt;a href="https://cis-india.org/internet-governance/resources/citizen-engagement-framework-for-e-governance-projects-and-framework-and-guidelines-for-use-of-social-media-by-government-agencies"&gt;notified a social media engagement policy today&lt;/a&gt;, when the need for it was so very apparent all of the past week.&lt;/p&gt;
&lt;h2&gt;&lt;b&gt;And what of all this talk of cybersecurity failure and cyber-wars?&lt;/b&gt;&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;Cybersecurity   is indeed a cause of concern for India, but only charlatans and the   ignorant would make any connection between India's cybersecurity and   recent events. The role of Pakistan deserves a few words. Not many   Pakistani websites / webpages have been blocked by the Indian   government. Two of the Pakistani webpages that have been blocked are   actually pages that debunk the fake images that have been doing the   rounds in Pakistan for at least the past month. Even Indian websites &lt;a href="http://kafila.org"&gt;like Kafila&lt;/a&gt; have noted these fake images long ago, and &lt;a href="http://kafila.org/2012/08/05/national-contestation-not-religion-responsible-for-the-plight-of-myanmars-rohingyas-ayesha-siddiqa/"&gt;Ayesha Siddiqa wrote about this on August 5, 2012&lt;/a&gt;, and &lt;a href="http://kafila.org/2012/08/13/how-to-start-a-riot-out-of-facebook-yousuf-saeed/"&gt;Yousuf Saeed wrote about it on August 13, 2012&lt;/a&gt;.   Even while material that may have been uploaded from Pakistan, it  seems  highly unlikely they were targeted at an Indian audience, rather  than a  Pakistani or global one.&lt;/p&gt;

    <title>India's Broken Internet Laws Need a Shot of Multi-stakeholderism</title>

        &lt;b&gt;Cyber-laws in India are severely flawed, with neither lawyers nor technologists being able to understand them, and the Cyber-Law Group in DEIT being incapable of framing fair, just, and informed laws and policies.  Pranesh Prakash suggests they learn from the DEIT's Internet Governance Division, and Brazil, and adopt multi-stakeholderism as a core principle of Internet policy-making.&lt;/b&gt;
        &lt;p&gt;(An edited version of this article was published in the Indian Express as &lt;a href="http://www.indianexpress.com/story-print/941491/"&gt;"Practise what you preach"&lt;/a&gt; on Thursday, April 26, 2012.)&lt;/p&gt;
&lt;p&gt;The laws in India relating to the Internet are greatly flawed, and the only way to fix them would be to fix the way they are made.  The &lt;a href="https://cis-india.org/internet-governance/blog/www.mit.gov.in/content/cyber-laws-security"&gt;Cyber-Laws &amp;amp; E-Security Group&lt;/a&gt; in the &lt;a href="http://www.mit.gov.in"&gt;Department of Electronics and Information Technology&lt;/a&gt; (DEIT, who refer to themselves as 'DeitY' on their website!) has proven itself incapable of making fair, balanced, just, and informed laws and policies.  The Information Technology (IT) Act is filled with provisions that neither lawyers nor technologists understand (not to mention judges).  (The definition of &lt;a href="http://www.vakilno1.com/bareacts/informationtechnologyact/s65.htm"&gt;"computer source code" in s.65 of the IT Act&lt;/a&gt; is a great example of that.)&lt;/p&gt;
&lt;p&gt;The Rules drafted under s.43A of the IT Act (on 'reasonable security practices' to be followed by corporations) were so badly formulated that the government was forced to issue a &lt;a href="http://pib.nic.in/newsite/PrintRelease.aspx??relid=74990"&gt;clarification through a press release&lt;/a&gt;, even though the clarification was in reality an amendment and amendments cannot be carried out through press releases.  Despite the clarification, it is unclear to IT lawyers whether the Rules are mandatory or not, since s.43A (i.e., the parent provision) seems to suggest that it is sufficient if the parties enter into an agreement specifying reasonable security practices and procedures.  Similarly, the "Intermediary Guidelines" Rules (better referred to as the Internet Censorship Rules) drafted under s.79 of the Act have been called &lt;a href="http://www.indianexpress.com/story-print/940682/"&gt;"arbitrary and unconstitutional" by many, including MP P. Rajeev&lt;/a&gt;, who has &lt;a href="http://cis-india.org/internet-governance/blog/statutory-motion-against-intermediary-guidelines-rules"&gt;introduced a motion in the Rajya Sabha to repeal the Rules&lt;/a&gt; ("Caught in a net", Indian Express, April 24, 2012).  These Rules give the power of censorship to every citizen and allow them to remove any kind of material off the Internet within 36 hours without anybody finding out.  Last year, we at the Centre for Internet and Society used this law to get thousands of innocuous links removed from four major search engines without any public notice.  In none of the cases (including one where an online news website removed more material than the perfectly legal material we had complained about) were the content-owners notified about our complaint, much less given a chance to defend themselves.&lt;/p&gt;
&lt;p&gt;Laws framed by the Cyber-Law Group are so poorly drafted that they are misused more often than used.  There are too many criminal provisions in the IT Act, and their penalties are greatly more than that of comparable crimes in the IPC.  Section 66A of the IT Act, which criminalizes "causing annoyance or inconvenience" electronically, has a penalty of 3 years (greater than that for causing death by negligence), and does not require a warrant for arrest. This section has been used in the Mamata Banerjee cartoon case, for arresting M. Karthik, a Hyderabad-based student who made atheistic statements on Facebook, and against former Karnataka Lokayukta Santosh Hegde.  Section 66A, I believe, imperils freedom of speech more than is allowable under Art. 19(2) of the Constitution, and is hence unconstitutional.&lt;/p&gt;
&lt;p&gt;While &lt;a href="http://indiankanoon.org/doc/1740460/"&gt;s.5 of the Telegraph Act&lt;/a&gt; only allows interception of telephone conversations on the occurrence of a public emergency, or in the interest of the public safety, the IT Act does not have any such threshold conditions, and greatly broadens the State's interception abilities.  Section 69 allows the government to force a person to decrypt information, and might clash with Art.20(3) of the Constitution, which provides a right against self-incrimination.  One can't find any publicly-available governmental which suggests that the constitutionality of provisions such as s.66A or s.69 was examined.&lt;/p&gt;
&lt;p&gt;Omissions by the Cyber-Law Group are also numerous.  The &lt;a href="http://www.cert-in.org.in"&gt;Indian Computer Emergency Response Team (CERT-In)&lt;/a&gt; has been granted &lt;a href="http://www.cert-in.org.in/"&gt;very broad functions&lt;/a&gt; under the IT Act, but without any clarity on the extent of its powers.  Some have been concerned, for instance, that the broad power granted to CERT-In to "give directions" relating to "emergency measures for handling cyber security incidents" includes the powers of an "Internet kill switch" of the kind that Egypt exercised in January 2011.  Yet, they have failed to frame Rules for the functioning of CERT-In.  The licences that the Department of Telecom enters into with Internet Service Providers requires them to restrict usage of encryption by individuals, groups or organisations to a key length of only 40 bits in symmetric key algorithms (i.e., weak encryption).  The RBI mandates a minimum of 128-bit SSL encryption for all bank transactions.  Rules framed by the DEIT under s.84A of the IT Act were to resolve this conflict, but those Rules haven't yet been framed.&lt;/p&gt;
&lt;p&gt;All of this paints a very sorry picture.  Section 88 of the IT Act requires the government, "soon after the commencement of the Act", to form a "Cyber Regulations Advisory Committee" consisting of "the interests principally affected or having special knowledge of the subject-matter" to advise the government on the framing of Rules, or for any other purpose connected with the IT Act.  This body still has not been formed, despite the lag of more than two and a half years since the IT Act came into force.  Justice Markandey Katju’s recent letter to Ambika Soni about social media and defamation should ideally have been addressed to this body. &lt;/p&gt;
&lt;p&gt;The only way out of this quagmire is to practise at home that which we preach abroad on matters of Internet governance: multi-stakeholderism.  Multi-stakeholderism refers to the need to recognize that when it comes to Internet governance there are multiple stakeholders: government, industry, academia, and civil society, and not just the governments of the world.  This idea has gained prominence since it was placed at the core of the "Declaration of Principles" from the first World Summit on Information Society in Geneva in 2003, and has also been at the heart of India's pronouncements at forums like the Internet Governance Forum.  Brazil has an &lt;a href="httphttp://www.cgi.br/english/"&gt;"Internet Steering Committee"&lt;/a&gt; which is an excellent model that practices multi-stakeholderism as a means of framing and working national Internet-related policies.  DEIT's &lt;a href="http://www.mit.gov.in/content/internet-governance"&gt;Internet Governance Division&lt;/a&gt;, which formulates India's international stance on Internet governance, has long recognized that governance of the Internet must be done in an open and collaborative manner.  It is time the DEIT's Cyber-Law and E-Security Group, which formulates our national stance on Internet governance, realizes the same.&lt;/p&gt;

&lt;p&gt;India’s information technology (IT) minister, Kapil Sibal appears to be running into rough weather over IT rules framed last year, which curb freedom of expression on the internet. The rules have incensed India’s growing blogging community and piqued at least a few of his fellow parliamentarians.&lt;/p&gt;
&lt;p&gt;On the opening day of the upcoming parliamentary session on Tuesday, the Rajya Sabha is set to vote on an annulment motion against the IT rules, moved by P. Rajeeve of the Communist Party of India (Marxist), a rediff.com report said. Ironically, the party that still treats Stalin as a hero (quoting him unfailingly in its political resolutions) has become the first to stand up for internet freedom.&lt;br /&gt;Rajeeve is of course not the only parliamentarian to take exception to the rules. Jayant Choudhry, a member of parliament (MP) from the Rashtriya Lok Dal, was the first to draw attention to the draconian rules late last year, and MPs from other regional parties such as the Samajwadi Party and the Asom Gana Parishad criticized the rules in a parliamentary discussion in December.&lt;br /&gt;&lt;br /&gt;Two sets of rules, one governing cyber cafes and the other relating to intermediaries have attracted most criticism. The rules relating to intermediaries such as internet service providers, search engines or interactive websites such as Twitter and Facebook are the most disturbing. Intermediaries are required under the current rules to remove content that anyone objects to, within 36 hours of receiving the complaint, without allowing content creators any scope of defence.&lt;br /&gt;&lt;br /&gt;The criteria for deciding objectionable content, laid down in the rules, are subjective and vague. For instance, intermediaries are mandated to remove among other things, ‘grossly harmful’ content, whatever that may mean.&lt;br /&gt;&lt;br /&gt;This is a unique form of ‘private censorship’ that will endanger almost all online content. In this age of easily offended sensibilities, it is virtually impossible to write anything that does not “offend” anyone. For instance, even this piece may be termed ‘grossly harmful’ to the CPI(M) party.&lt;br /&gt;&lt;br /&gt;However far-fetched this may sound, this has already become a reality. A researcher working with the Bangalore-based Centre for Internet and Society (CIS) tried out such a strategy with several different intermediaries, and was successful in six out of seven times, always with frivolous and flawed complaints, Pranesh Prakash of CIS wrote in a January blog-post. It has become much easier in India to ban an e-book than a book, Prakash pointed out.&lt;br /&gt;&lt;br /&gt;The rules regulating cyber cafes are no better. Cyber cafes are required to keep a log detailing the identity of users and their internet usage, which has negative implications for privacy and personal safety of users, analysis of the rules by PRS legislative research said.&lt;br /&gt;&lt;br /&gt;Internet freedom in India has declined over time and is only ‘partly free’, a 2011 report on internet freedom by US-based think tank, Freedom House said. India has joined a growing club of developing nations where, “internet freedom is increasingly undermined by legal harassment, opaque censorship procedures, or expanding surveillance,” the report noted.&lt;br /&gt;&lt;br /&gt;The only saving grace is that some of the IT rules are drafted in a language so arcane that anyone will find it hard to decipher them, leave alone implementing them. Sample this: “The intermediary shall not knowingly deploy or install or modify the technical configuration of computer resource or become party to any such act which may change or has the potential to change the normal course of operation of the computer resource than what it is supposed to perform thereby circumventing any law for the time being in force: provided that the intermediary may develop, produce, distribute or employ technological means for the sole purpose of performing the acts of securing the computer resource and information contained therein.”&lt;br /&gt;&lt;br /&gt;The first task at hand for Sibal may be to explain to fellow lawmakers what the above rule is supposed to mean, before he defends such rules.&lt;/p&gt;
