    <title>In Twitter India’s Arbitrary Suspensions, a Question of What Constitutes a Public Space</title>

        &lt;b&gt;A discussion is underway about the way social media platforms may have to operate within the tenets of constitutional protections of free speech.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;The article by Torsha Sarkar was &lt;a class="external-link" href="https://thewire.in/tech/twitter-arbitrary-suspension-public-space"&gt;published in the Wire&lt;/a&gt; on December 7, 2019.&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;On October, 26 2019, Twitter suspended the account of senior advocate Sanjay Hegde. The reason? He had previously put up the famous photo of August Landmesser refusing to do the Nazi salute in a sea of crowd in the Blohm Voss shipyard.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;According to the social media platform, the image violated Twitter’s ‘hateful imagery’ guidelines, despite the photo being around for decades and usually being recognised as a sign of resistance against blind authoritarianism.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Twitter briefly revoked the suspension on October 27, but promptly suspended Hegde’s account again. This time, the action was prompted by Hegde quote-tweeting parts of a poem by Gorakh Pandey, titled ‘Hang him’, which was written in protest of the first death penalties given to two peasant revolutionaries in an independent India. This time, Hegde was informed that his account would not be restored.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Spurred by what he believed was Twitter’s arbitrary exercise of power, he proceeded to file a legal notice with Twitter, and &lt;a href="https://www.livelaw.in/news-updates/sr-adv-sanjay-hegde-serves-legal-notice-on-twitter-for-restoration-of-account-149579"&gt;asked&lt;/a&gt; the Ministry of Electronics and Information Technology (MeitY) to intervene in the matter. It is the subject matter of this ask that becomes of interest.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In his complaint, Hegde first outlines how the content shared by him did not violate any of Twitter’s community guidelines. He then goes on to highlight how his fundamental right of dissemination and receipt of information under Article 19(1)(a) were obstructed by the action of Twitter. Here, he places reliance to several key decisions of the Indian and the US Supreme court on media freedom, which provided thrust to his argument that a citizen’s right to free speech is meaningless if control was concentrated in the hands of a few private parties.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Vertical or horizontal?&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;One of the first things we learn about fundamental rights is that they are enforceable against the government, and that they allow the individual to have a remedy against the excesses of the all-powerful state. This understanding of fundamental rights is usually called the ‘vertical’ approach – where the state, or the allied public authority is at the top and the individual, a non-public entity is at the bottom.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;However, there is another, albeit underdeveloped, thread of constitutional jurisprudence that argues that in certain circumstances these rights can be claimed against another private entity. This is called the ‘horizontal’ application of fundamental rights.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In that note, Hegde’s contention essentially becomes this – claiming an enforceable remedy against the private entity for supposedly violating his fundamental right. This is clearly an ask for the Centre to consider a horizontal application of Article 19(1)(a) against large social media companies.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;What could this mean?&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Lawyer Gautam Bhatia has &lt;a href="https://indconlawphil.wordpress.com/2015/05/24/horizontality-under-the-indian-constitution-a-schema/"&gt;argued&lt;/a&gt; that there are several ways in which a fundamental right can be enforced against another private entity. It must be noted that he derives this classification on the touchstone of existing judicial decisions, which is different from seeking an executive intervention. Nevertheless, it is interesting to consider the logic of his arguments as a thought exercise. Bhatia points out that one of the ways in which fundamental rights can be applied to a private entity is by assimilating the concerned entity as a ‘state’ as per Article 12.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There is a considerable amount of jurisprudence on the nature of the test to determine whether the assailed entity is state. In 2002, the Supreme Court &lt;a href="https://indiankanoon.org/doc/471272/"&gt;held&lt;/a&gt; that for an entity to be deemed state, it must be ‘functionally, financially and administratively dominated by or under the control of the Government’. If we go by this test, then a social media platform would most probably not come within the ambit of Article 12.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;However, there is a thread of recent developments that might be interesting to consider. Earlier this year, a federal court of appeals in the US &lt;a href="https://int.nyt.com/data/documenthelper/1365-trump-twitter-second-circuit-r/c0f4e0701b087dab9b43/optimized/full.pdf#page=1"&gt;ruled&lt;/a&gt; that the First Amendment prohibits President Donald Trump, who used his Twitter for government purposes, from blocking his critics. The court further held that when a public official uses their account for official purposes, then the account ceases to be a mere private account. This judgment has a sharp bearing in the current discussion, and the way social media platforms may have to operate within the tenets of constitutional protections of free speech.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Although the opinion of the federal court clearly noted that they did not concern themselves with the application of the First Amendment rights to the social media platforms, one cannot help but wonder – if the court rules that certain spaces in a social media account are ‘public’ by default, and that politicians cannot exclude critiques from those spaces, then &lt;a href="https://www.forbes.com/sites/kalevleetaru/2017/08/01/is-social-media-really-a-public-space/#2ca9795b2b80"&gt;can&lt;/a&gt; the company itself block or impede certain messages? If the company does it, can an enforceable remedy then be made against them?&lt;/p&gt;

&lt;h3 style="text-align: justify; "&gt;What can be done?&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Of course, there is no straight answer to this question. On one hand, social media platforms, owing to the enormous concentration of power and opaque moderating policies, have become gatekeepers of online speech to a large extent. If such power is left unchecked, then, as Hegde’s request demonstrates, a citizen’s free speech rights are meaningless.&lt;/p&gt;
&lt;p class="_yeti_done" style="text-align: justify; "&gt;On the other hand, if we definitively agree that in certain circumstances, citizens should be allowed to claim remedies against these companies’ arbitrary exercise of power, then are we setting ourselves for a slippery slope? Would we make exceptions to the nature of spaces in the social media based on who is using it? If we do, then what would be the extent to which we would limit the company’s power of regulating speech in such space? How would such limitation work in consonance with the company’s need to protect public officials from targeted harassment?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;At this juncture, given the novelty of the situation, our decisions should also be measured. One way of addressing this obvious paradigm shift is by considering the idea of oversight structures more seriously.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;I have previously &lt;a href="https://cyberbrics.info/rethinking-the-intermediary-liability-regime-in-india/"&gt;written&lt;/a&gt; about the possibility of having an independent regulator as a compromise between overtly stern government regulation and allowing social media companies to have free reign over the things that go on their platforms. In light of the recent events, this might be a useful alternative to consider.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Hegde had also asked the MeitY to issue guidelines to ensure that any censorship of speech in these social media platforms is to be done in accordance with the principles of Article 19.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;If we presume that certain social media platforms are large and powerful enough to be treated akin to public spaces, then having an oversight authority to arbitrate and ensure the enforcement of constitutional principles for future disputes may just be the first step towards more evidence-based policymaking.&lt;/p&gt;

There have been over 5,800 restriction requests recorded in the second half of 2014, as per Facebook's Government Requests Report. &lt;/b&gt;

&lt;p style="text-align: justify; "&gt;Economic Times has reported that data and content restrictions across the globe are on the rise and India seems to have topped the list. The content restrictions from India have been constantly on the rise—it rose to 5,832 from 4,960 in the first half.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Things are not any different across the globe. "The amount of content restricted for violating local law increased by 11% over the previous half, to 9,707 pieces of content restricted, up from 8,774," said Monika Bickert, Facebook's head of global policy management, and Chris Sonderby, deputy general counsel, in a statement on the social networking website.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Other countries from where Facebook has observed an increased number of content restrictions requests are Turkey and Russia. Surprisingly, FET reported that the number of content restriction requests from Pakistan came down to 54 in the second half of 2014 from 1,773 in the first half.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is worth noting that India is the second largest market for Facebook, with 112 million users until last year, second only to the United States. While these figures are alarming, counsel for the Software Freedom Law Centre told ET , "...it would have been better if Facebook had also given us more information on the kind of data that was being asked for. Now we only have consolidated figures. So what kind of data was asked for, that would have been more useful."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Pranesh Prakash, policy director at the Centre for Internet and Society, on the other hand, feels that the number of content restriction requests is not only high on an absolute number, but even on a per-user basis.&lt;/p&gt;

    <title>ICANN takes one step forward in its human rights and accountability commitments</title>

&lt;hr style="text-align: justify;" /&gt;
&lt;p style="text-align: justify;"&gt;ICANN is the international non-profit organization that brings together various stakeholders to create policies aimed at coordinating the Domain Name System. Some of these stakeholders include representatives from government, civil society, academia, the private sector, and the technical community.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;During the recently concluded 66th International Meeting of the Internet Corporation for Assigned Names and Numbers (ICANN) in Montreal (Canada); the ICANN board adopted by consensus the recommendations contained within the Work Stream 2 (WS2) Final Report. This report was generated as part of steps towards accountability after the September 30th 2016 U.S. government handing over of its unilateral control over ICANN, through its previous stewardship role of the Internet Assigned Names and Numbers Authority (IANA).&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The Workstream 2 Recommendations on Accountability are seen as a big step ahead in the incorporation of human rights in ICANN’s various processes, with over 100 recommendations on aspects ranging from diversity to transparency. &amp;nbsp;An Implementation Team has been constituted which comprises the Co-chairs and the rapporteurs from the WS2 subgroups. They will primarily help the ICANN organization in interpreting recommendations of the groups where further clarification is needed on how to implement the same. As the next step, an Implementation Assessment Report has recently been published which looks at the various resources and steps needed. The steps are categorized into actions meant for one of the 3; the ICANN Board, Community and the ICANN organization itself. These will be funded by ICANN’s General Operating Fund, the Board and the org.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The report is divided into the following 8 issues: 1) Diversity, 2) Guidelines for Good Faith, 3) Recommendations for a Framework of Interpretation for Human Rights, 4) Jurisdiction of Settlement of Dispute Issues, 5) Recommendations for Improving the ICANN Office of the Ombudsman, 6) Recommendations to increase SO/ AC Accountability, 7) Recommendations to increase Staff Accountability and 8) Recommendations to improve ICANN Transparency.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;This blog will take a look at the essential human rights related considerations of the report and how the digital rights community can get involved with the effectuation of the recommendations.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;&lt;strong&gt;Diversity&lt;/strong&gt;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The core issues concerning the issue of diversity revolve around the need for a uniform definition of the parameters of diversity and a community discussion on the ones already identified; geographic representation, language, gender, age, physical disability, diverse skills and stakeholder constituency. An agreed upon definition of all of these is necessary before its Board approval and application consistently through the various parts of ICANN. In addition, it is also required to formulate a standard template for diversity data collection and report generation. This sub group’s recommendations are estimated to be implemented in 6-18 months. Many of the recommendations need to be analyzed for compliance with the General Data Protection Regulation (GDPR) such as collecting of information relating to disability. For now, the GDPR is only referenced with no further details on how steps considered will either comply or contrast the law.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;&lt;strong&gt;Good faith Guidelines&lt;/strong&gt;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The Empowered Community (EC) which includes all the Supporting Organizations, At-Large-Advisory-Committee and Government Advisory Council, are called upon to conceptualize guidelines to be followed when individuals from the EC are participating in Board Removal Processes. Subsequent to this, the implementation will take 6-12 months.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;&lt;strong&gt;Framework of Interpretation for Human Rights&lt;/strong&gt;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Central to the human rights conversation and finally approved, is the Human Rights Framework of Interpretation. However the report does not give a specific timeline for its implementation, only mentioning that this process will take more than 12 months. The task within this is to establish practices of how the core value of respecting human rights will be balanced with other core values while developing ICANN policies and execution of its operations. All policy development processes, reviews, Cross Community Working Group recommendations will need a framework to consider and incorporate human rights, in tandem with the Framework of Interpretation. It will also have to be shown that policies and recommendations sent to the Board have factored in the FOI.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;&lt;strong&gt;Transparency&lt;/strong&gt;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The recommendations focus on the following four key areas as listed below:&lt;br /&gt;1. Improving ICANN’s Documentary Information Disclosure Policy (DIDP).&lt;br /&gt;2. Documenting and Reporting on ICANN’s Interactions with Governments.&lt;br /&gt;3. Improving Transparency of Board Deliberations.&lt;br /&gt;4. Improving ICANN’s Anonymous Hotline (Whistleblower Protection).&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The bulk of the burden for implementation is put on ICANN org with the community providing oversight and ensuring ICANN lives up to its commitments under various policies and laws. Subsequent to this, the implementation will take 6-12 months.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;&lt;strong&gt;How the ICANN community can contribute to this work&lt;/strong&gt;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;This is a defining moment on the future of ICANN and there are great opportunities for the ICANN multistakeholder community to continue shaping the future of the Internet. Some of the envisioned actions by the community include:&lt;/p&gt;
&lt;ul style="text-align: justify;"&gt;
&lt;li&gt;monitoring and assessing the performance of the various ICANN bodies, and acting on the recommendations that emerge from those accountability processes. This will only be done through collaborative formulation of processes and procedures for PDPS, CCWGs etc to incorporate HR considerations and subsequently implementation of the best practices suggested for improving SO/ACs accountability and transparency;&lt;/li&gt;
&lt;li&gt;conducting diversity assessments to inform objectives and strategies for diversity criteria;&lt;/li&gt;
&lt;li&gt;supporting contracted parties through legal advice for change in their agreements when it comes to choice of law and venue recommendations;&lt;/li&gt;
&lt;li style="text-align: justify;"&gt;contributing to conversations where the Ombudsman can expand his/her involvement that go beyond current jurisdiction and authority&lt;/li&gt;&lt;/ul&gt;

        &lt;p&gt;

&lt;p style="text-align: justify; "&gt;The &lt;a href="http://netmundial.br"&gt;NETMundial Global Multistakeholder Meeting on the Future of the Internet Governance&lt;/a&gt; will be held in São Paulo, Brazil on 23-24 April 2014.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Initiated by Brazilian President Dilma Rousseff and ICANN CEO Fadi Chehadé, and co-organized by the &lt;a href="http://CGI.br"&gt;Brazilian Internet Steering Committee&lt;/a&gt; and &lt;a href="http://1Net.org"&gt;/1Net&lt;/a&gt;,  the meeting will bring together a wide range of government, business,  technical community, civil society and academic participants from around  the world. The organizers describe its objectives as, “crafting  Internet governance principles and proposing a roadmap for the further  evolution of the Internet governance ecosystem.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The purpose of this NCUC conference is to provide a first opportunity  for intensive, F2F cross-community dialogue on the main substantive  topics likely to be addressed in São Paulo. Stakeholders from across the  ICANN community have expressed a range of views and uncertainties about  the meeting’s precise substantive focus, expected outcomes, and  potential significance in the continuing evolution of the global  Internet governance ecosystem.  It is hoped that the NCUC conference  will help the community to work through the issues at stake and to  prepare for its participation in the NETMundial.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;India’s Minister of Law &amp;amp; Justice and Minister of Electronics and Information Technology Ravi Shankar Prasad reiterated India’s commitment to the multistakeholder model during the Opening Ceremony of the Internet Corporation of Assigned Names and Numbers’ (ICANN’s) 57th Public Meeting. The meeting, also known as ICANN57, is taking place in Hyderabad, India, from November 3 – 9, 2016 and has convened thousands of the global Internet community members (both on-site and remotely) to discuss and develop policies related to the Internet’s Domain Name System (DNS). It is hosted by the Ministry of Electronics and Information Technology (MeitY), with support from the Government of Telangana.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;ICANN57 is the first post-IANA stewardship transition public meeting and also the first Annual General Meeting under the new Meetings Strategy. ICANN meetings are held three times a year in different regions to enable attendees from around the world to participate in person. These meetings offer a variety of sessions such as workshops, open forums and working meetings on the development and implementation of Internet policies.         &lt;b&gt;Users across social media platforms on Tuesday welcomed the Supreme Court's scrapping of the controversial Section 66A of the Information Technology Act, hailing it as a measure that will strengthen freedom of expression online.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;The article by Vishakha Saxena published in the &lt;a class="external-link" href="http://www.hindustantimes.com/india-news/i-dare-you-i-double-dare-you-social-media-celebrates-sec-66a-verdict/article1-1330012.aspx"&gt;Hindustan Times&lt;/a&gt; on March 25, 2015 quotes Pranesh Prakash.&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;"This is the first SC judgment since the 60s to plainly strike down a  law for free expression violation! #66A," tweeted Pranesh Prakash,  policy director at the Centre for Internet and Society in Bengaluru.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Prakash, who tweeted "I AM ECSTATIC!!" minutes after the judgement,  was one of the most vocal critics of Section 66A - which made offensive  comments online punishable with jail terms - and played a key role in  creating awareness about freedom of expression.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Apar Gupta, a representative of the People's Union for Civil  Liberties (one of the parties that petitioned the Supreme Court against  section 66A), also took to Twitter to jubilantly declare victory.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"My TL is a little crazy right now…This decision means a lot to me. Thank you. I am smiling." he posted.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Supreme Court advocate Karuna Nundy, who too represents PUCL, expressed her happiness on Facebook.&lt;/p&gt;
&lt;p&gt;The top court struck down the provision, described as draconian by  many internet rights activists, describing it as "unconstitutional" and a  "restriction on free speech".&lt;/p&gt;
&lt;p&gt;Section 66A, incorporated through an amendment of the IT Act in 2009,  prohibited the sending of information of a "grossly offensive" or  "menacing" nature through communication devices. It was used by several  states to arrest people over posts on social media that officials  claimed were "seditious" or "communally sensitive".&lt;/p&gt;
&lt;p&gt;Discussions on social media against the provision had gained pace hours  ahead of the court's ruling. Twitter, in fact, was abuzz as thousands  used the hashtag #No66A to voice their opinions.&lt;/p&gt;
&lt;p&gt;Reddit, known for being unabashed with opinion and language, wasn’t  far behind. The first post announcing the verdict was upvoted 96% and  garnered 460 points within four hours.&lt;/p&gt;
&lt;p&gt;"Supreme Court zindabad! Now can we abuse Azam Khan without any fear?" commented user Apunebolatumerilaila.&lt;/p&gt;
&lt;p&gt;Another user, Indian_galileo, wrote, "FINALLY, SOME SENSE HAS  PREVAILED PRAISE THE OVERLORDS AT SC THANK YOU SC THANK YOU VERY VERY  MUCH."&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;The two women &lt;a href="http://india.blogs.nytimes.com/2012/11/19/women-arrested-in-mumbai-for-complaining-on-facebook/#postComment"&gt;were&lt;/a&gt;&lt;a href="http://india.blogs.nytimes.com/2012/11/19/women-arrested-in-mumbai-for-complaining-on-facebook/#postComment"&gt; arrested&lt;/a&gt; Sunday under a section of the &lt;a href="http://eci.nic.in/archive/manuals/part2/acts_1d.htm"&gt;Indian Penal Code&lt;/a&gt; that outlaws spreading “statements creating or promoting enmity, hatred or ill- will between classes” after one complained about the citywide strike sparked by the death of the Shiv Sena leader Bal Thackeray and the second woman “liked” her statement. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But the incident was just the latest in a string of recent arrests,  detentions and account suspensions in India over online comments. If you  live in India and have an opinion someone might not like, but you don’t  want to become a target of the law, there’s one easy rule you need to  follow, experts say: stay off social media.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Right now, “there’s nothing one can do but to close up your social media  accounts” and stop voicing your opinion on the Internet entirely, if  you want to guarantee you won’t be arrested in India, said Sunil  Abraham, executive director at the Center for Internet and Society in  Bangalore. (To be sure, that’s not what most free speech advocates  recommend that you do. India Ink will soon have more on a social media  activist who is fighting India’s strict Internet controls.)&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mr. Abraham advises extreme caution because India’s free speech rules  have been historically weak (read more about India’s long history of  censorship &lt;a href="http://india.blogs.nytimes.com/2011/12/08/newswallah-censorship/"&gt;here&lt;/a&gt;), a relatively new Internet law is extremely broadly defined and police and &lt;a href="http://ibnlive.in.com/news/may-review-it-act-to-prevent-misuse-kapil-sibal-on-girls-arrest/306432-3-244.html"&gt;lawmakers themselves&lt;/a&gt; are sometimes confused about what the actual rules themselves say.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Late last month, Ravi Srinivasan, a Puducherry businessman and an India  Against Corruption volunteer, was arrested for his Twitter post  that  alleged Karti Chidambaram, the son of Finance Minister P. Chidambaram,  had amassed a large amount of wealth. Mr. Srinivasan was arrested Oct.  30 but was later released on bail.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Earlier in October, an associate professor of the National Institute for  Fashion Technology in Chennai was arrested after what the Tamil Nadu  singer Chinmayi said was a &lt;a href="http://www.chinmayisripada.com/2012/10/facing-abuse-and-backlash-of-rumours.html"&gt;long period of harassment on the Internet&lt;/a&gt;, including negative Twitter messages. In August, the Indian government demanded Internet service providers &lt;a href="http://india.blogs.nytimes.com/2012/08/23/indian-government-casts-a-wide-puzzling-net-over-internet/"&gt;suspend hundreds of Web pages&lt;/a&gt; to curb ethnic tension and asked Twitter to &lt;a href="http://india.blogs.nytimes.com/2012/08/24/outrage-in-india-over-twitter-crackdown-on-twitter-at-least/"&gt;suspend accounts&lt;/a&gt; parodying government officials. Last year, the central government asked social media companies to &lt;a href="http://india.blogs.nytimes.com/2011/12/05/india-asks-google-facebook-others-to-screen-user-content/"&gt;prescreen content&lt;/a&gt; about India for objectionable remarks.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The key culprits here are revisions to  India’s Information Technology Act made in 2008 and 2011, experts say,  that leave nearly everything that is transmitted via the Internet open  to interpretation by nearly everyone who reads it on the Internet.  Things that are considered “annoying” and “offensive” can, under the  law, land their sender in jail for up to three years.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While some of India’s nearly 50  million Facebook users and millions of Twitter users are up in arms  about the recent arrests in Mumbai and are sharing the woman’s original  post, under the theory that the police can’t arrest everyone,  conservative advocates don’t recommend that sort of action on the  Internet.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;V. Vijaya Baskar, an advocate with  Madras High Court practicing civil, criminal and family law for over 10  years, said that there are basic guidelines of free speech behavior that  should be followed, even by Internet users. The most important, he  said, is to avoid the use of obscene language and pictures, which are  considered a direct threat. He also advised against getting into  confrontations with people you don’t know or recognize on social media.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“If you have a true and verifiable  source or documented evidence, then making a public statement is not  defamation, but making passing comments of any person, particularly  people in public life, will amount to defaming the person and is  punishable,” he said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While India’s government and law  officials sometimes come across as not very tech-savvy, Pranesh Prakash,  policy director at the Center for Internet and Society, said that  lawmakers in many countries with a much higher Internet penetration are  just as challenged by the Internet. And in India, while the laws are  strict, people seldom land in jail for Internet-related offenses, he  said.&lt;/p&gt;
&lt;p&gt;“The detention law in India, sensibly, defaults to ‘bail, not jail,’ ” he said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mr. Prakash said he could not offer  any global guidelines to avoid being arrested, and concluded that “each  forum has its own rules of etiquette, which cannot be codified or  enforced by legislation.” Online speech can be disagreed upon and  opinions should be made known, since it is only the “natural tendency  for people with extreme views to be more vocal online.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Not surprisingly, the authorities in  India who have been involved in arrests insist they are just doing their  job, and doing it well. The Tamil Nadu police, for example, said they  acted appropriately in Mr. Srinivasan’s arrest.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;R. S. Krishna, inspector general for  law and order, told the media that the Puducherry police could not be  faulted for filing a First Investigation Report, the precursor to filing  charges, against Mr. Srinivasan.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“I am very clear that we have acted  purely on the basis of the merit of the complaint, in accordance with  the rule of law,” he said. “We are right on our part.”&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;India blocked 245 web pages for provocative content on Monday in an effort to prevent the spread of hate messages and lessen communal tensions in the country, and suggested via an official release on the website of the Press Information Bureau that more could follow.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;As was widely reported in the days that followed, most websites blocked were not related to the ethnic clashes in Assam.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Pranesh Prakash, programme manager with the Bangalore-based Centre for Internet and Society, analysed the sites which were listed by the government. In his analysis, 33% of all blocked addresses were on Facebook, 27.8% on YouTube, 9.7% on Twitter and the rest were spread over a number of different websites including Wikipedia, &lt;i&gt;Firspost.com&lt;/i&gt; and &lt;i&gt;TimesofIndia.Indiatimes.com.&lt;/i&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Prakash says, “I don’t believe that the decision to block sites was politically motivated, but I do believe that in trying to prevent harm, the government has gone overboard.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He also writes in his analysis, “Even though many of the items on that list do deserve (in my opinion) to be removed [...] the people and companies hosting the material should have been asked to remove it, instead of ordering the ISPs to block them.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Prakash also pointed out, “There are numerous egregious mistakes. Even people and posts debunking rumours have been blocked, and it is clear that the list was not compiled with sufficient care.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Of course, India’s overall record on Internet censorship isn’t great, with the current laws encouraging Internet service providers (ISPs) to take down content without investigating individual cases properly. And that is not even taking into consideration official government orders, such as this decision to block websites.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The process of blocking content for an ISP is very simple. After all, any content that is coming from a website to your computer has to travel through the ISP, giving it ample opportunity to observe and censor banned content.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Think of it like this—you’re on an island, with no way to reach the mainland (Internet) where all the websites are. The ISP builds a bridge connecting you to the mainland, and charges you to let cars (data) from the sites come to you, by opening the road. Each web page has a unique ID, like a licence plate. If the government tells the ISP to block a specific page, it’s added to the blacklist, and isn’t allowed on the bridge. The government could also block a full domain, such as &lt;i&gt;Facebook.com&lt;/i&gt;, which would be like blocking all cars with DL plates, instead of specific numbers.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;New Delhi based cyber security consultant Dominic K. says, “The content is still there and can be accessed from outside India, so these measures are really very ineffective. People can use proxies or a virtual private network (VPN) to circumvent these measures with ease, by appearing to be a different site; so banning sites does nothing to deter malicious users.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Proxies are websites that load blocked sites for you—if the proxy is not using the ISP doing the block, they can still load the content from the blocked site and present it to the users, since the blocklists simply block websites, and not their content.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;VPNs work in a similar fashion, creating a virtual presence for the user outside of their own country. This can be done to circumvent blocks and access region-specific content, but is also a perfectly legitimate tool, and can increase your security greatly.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It’s a pretty crude system but it’s used around the world. In Australia, for example, the government has a page that directly lists their web censorship activities. It wants to block material that includes child sexual abuse imagery, bestiality, sexual violence, detailed instruction in crime, violence or drug use and/or material that advocates the doing of a terrorist act. However, as noted on the same page, these measures can be easily circumvented. Since the content remains on the Internet, and is only blocked, it can be accessed by “any technically competent user”.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;China, meanwhile, is frequently criticized for what is called, tongue-in-cheek, “the great firewall of China”. Reporters without Borders, a French organization that works for freedom of the press, has a list of countries that are “enemies of the Internet”. China, Iran, North Korea and Burma are some of the worst offenders, but Australia, India, Egypt, France and South Korea are also on the watchlist as “countries under surveillance”.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Saudi Arabia and the UAE publish detailed information on their filtering practices but other countries such as China return connection errors, and fake “file not found” errors.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There is a long history of Internet censorhip in India, and a perception that the laws have been used for political ends. Net censorship has been around for a while—in 1999, VSNL blocked access to Pakistani newspapers. Later, in 2006 the government wanted to block certain separatist groups of the Yahoo! Groups platform. While the government issued specific pages for the ban, initially, the whole Yahoo! Groups domain was blocked by ISPs. In 2007, Orkut was told to remove “defamatory” pages created by users.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Cartoon pornography website &lt;i&gt;Savitabhabi.com&lt;/i&gt; was also blocked in 2009, while several blogging services such as Typepad were blocked last year for a few weeks, and then the block was lifted, with no explanations.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Like Australia, in the UK too, child pornography is filtered by the government, though users there have to opt-in for this filtering. Other countries such as Denmark, Norway and Sweden also see such content being filtered. The Indian IT Act also notes various kinds of illegal content which is not permissible, such as child pornography and hate speech.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Other countries, such as the US, also have aggressive Internet censorship of copyrighted content. Prakash says, “Internet censorship is not restricted to India alone. Every country in the world has been doing this in different ways. The United States, for example, has even seized domains in copyright cases, which were legally hosted in other countries. With regards to political censorship, which some feel is a concern now, I don’t think that the Indian government is doing that. I believe that they are sincerely trying to address a serious issue, but people are going overboard.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He adds, “The biggest concern is that there is no transparency about what is being blocked, or why, and this leaves things open for active misuse in the future.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In Google’s 2011 &lt;i&gt;Transparency Report&lt;/i&gt;, released in June this year, India did not feature very favourably. According to Google, the number of content removal requests the company received increased by 49% from 2010. There were five court orders from India ordering the Internet giant to remove content and there were 96 other requests by Indian government agencies for 246 individual items.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In comparison, the US made only 77 requests in the same period. They also revealed that 70% of the content removal requests from India were related to defamation. National security and religious offence attracted far fewer removal requests. Google received only one request from Indian agencies from July to December 2011 for removal of pornographic content.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Our government might not be politically motivated in this instance—however, the possibility for abuse is high, and what’s more, the measures that are being taken are limited at best. Instead of ordering ISPs to block content directly, the government should be working with the content owners and platforms offering the content to have it taken down properly. Instead, we get crude measures which do nothing to deter malicious users, and only serve to inconvenience the general users.&lt;/p&gt;

    <title>How India Makes E-books Easier to Ban than Books (And How We Can Change That)</title>

        &lt;b&gt;Without getting into questions of what should and should not be unlawful speech, Pranesh Prakash chooses to take a look at how Indian law promotes arbitrary removal and blocking of websites, website content, and online services, and how it makes it much easier than getting offline printed speech removed.&lt;/b&gt;
        &lt;h2&gt;E-Books Are Easier To Ban Than Books, And Safer&lt;/h2&gt;
&lt;p&gt;Contrary to what Mr. Sibal's recent hand-wringing at objectionable online material might suggest, under Indian laws currently in force it is far easier to remove material from the Web, by many degrees of magnitude, than it is to ever get them removed from a bookstore or an art gallery.  To get something from a bookstore or an art gallery one needs to collect a mob, organize collective outrage and threats of violence, and finally convince either the government or a magistrate that the material is illegal, thereby allowing the police to seize the books or stop the painting from being displayed.  The fact of removal of the material will be noted in various records, whether in government records, court records, police records or in newspapers of record.    By contrast, to remove something from the Web, one needs to send an e-mail complaining about it to any of the string of 'intermediaries' that handle the content: the site itself, the web host for the site, the telecom companies that deliver the site to your computer/mobile, the web address (domain name) provider, the service used to share the link, etc.  Under the &lt;a href="https://cis-india.org/internet-governance/resources/intermediary-guidelines-rules"&gt;'Intermediary Guidelines Rules'&lt;/a&gt; that have been in operation since 11th April 2011, all such companies are required to 'disable access' to the complained-about content within thirty-six hours of the complaint.  It is really that simple.&lt;/p&gt;

&lt;p&gt;"That's ridiculous," you think, "surely he must be exaggerating."  Think again.  A researcher working with us at the Centre for Internet and Society tried it out, several times, with many different intermediaries and always with frivolous and flawed complaints, and was successful &lt;a class="external-link" href="http://www.cis-india.org/news/chilling-impact-of-indias-april-internet-rules"&gt; six out of seven times &lt;/a&gt;.  Thus it is easier to prevent Flipkart or Amazon from selling Rushdie's Midnight's Children than it is to prevent a physical bookstore from doing so: today Indira Gandhi wouldn't need to win a lawsuit in London against the publishers to remove a single line as she did then; she would merely have to send a complaint to online booksellers and get the book removed.  It is easier to block Vinay Rai's Akbari.in (just as CartoonsAgainstCorruption.com was recently blocked) than it is to prevent its print publication.  Best of all for complainants: there is no penalty for frivolous complaints such as those sent by us, nor are any records kept of who's removed what.  Such great powers of censorship without any penalties for their abuse are a sure-fire way of ensuring a race towards greater intolerance, with the Internet — that republic of opinions and expressions — being a casualty.&lt;/p&gt;

&lt;h2&gt;E-Book Bans Cannot Be Challenged&lt;/h2&gt;
&lt;p&gt;In response to some of the objections raised, the Cyberlaw Division of the Department of Information Technology, ever the dutiful guardian of free speech, noted that if you have a problem with access to your content being 'disabled', you could always &lt;a href="http://www.pib.nic.in/newsite/erelease.aspx?relid=72066"&gt;approach a court&lt;/a&gt; and get that ban reversed.  Unfortunately, the Cyberlaw Division of the Department of Information Technology forgot to take into account that you can't contest a ban/block/removal if you don't know about it.  While they require all intermediaries to disable access to the content within thirty-six hours, they forgot to mandate the intermediary to tell you that the content is being removed.  Whoops.  They forgot to require the intermediary to give public notice that content has been removed following a complaint from person ABC or corporation XYZ on such-and-such grounds.  Whoops, again.&lt;/p&gt;

&lt;p&gt;So while records are kept, along with reasons, of book bans, there are no such records required to be kept of e-book bans.&lt;/p&gt;


&lt;h2&gt;E-Book Censors Are Faceless&lt;/h2&gt;
&lt;p&gt;Vinay Rai is a brave man.  He is being attacked by fellow journalists who believe he's disgracing the professional upholders of free-speech, and being courted by television channels who believe that he should be encouraged to discuss matters that are sub judice.  He is viewed by some as a man who's playing politics in courts on behalf of unnamed politicians and bureaucrats, while others view him as being bereft of common-sense for believing that companies should be legally liable for not having been clairvoyant and removing material he found objectionable, though he has never complained to them about it, and has only provided that material to the court in a sealed envelope.    I choose, instead, to view him as a scrupulous and brave man.  He has a face, and a name, and is willing to openly fight for what he believes in.  However, there are possibly thousands of unscrupulous Vinay Rais out there, who know the law better than he does, and who make use not of the court system but of the Intermediary Guidelines Rules, firmly assured by those Rules that their censorship activities will never be known, will never be challenged by Facebook and Google lawyers, and will never be traced back to them.&lt;/p&gt;
&lt;h2&gt;Challenging Invisible Censorship&lt;/h2&gt;
&lt;p&gt;Dear reader, you may have noticed that this is a bit like a trial involving Free Speech in which Free Speech is presumed guilty upon complaint, is not even told what the charges against it are, has not been given a chance to prove its innocence, and has no right to meet its accusers nor to question them.  Yet, the Cyberlaw Division of the Department of Information Technology continues to issue press releases defending these Rules as fair and just, instead of being simultaneously Orwellian and Kafkaesque.  These Rules are delegated legislation passed by the Department of Information Technology under &lt;a href="https://cis-india.org/internet-governance/resources/section-79-information-technology-act"&gt;s.79 of the Information Technology Act&lt;/a&gt;.  The Rules were laid before Parliament during the 2011 Monsoon session.  We at CIS believe that these Rules are *ultra vires* the IT Act as well as the Constitution of India, not only with respect to what is now (newly) proscribed online (which in itself is enough to make it unconstitutional), but how that which is purportedly unlawful is to be removed.  We have prepared an alternative that we believe is far more just and in accordance with our constitutional principles, taking on best practices from Canada, the EU, Chile, and Brazil, while still allowing for expeditious removal of unlawful material.  We hope that the DIT will consider adopting some of the ideas embodied in our draft proposal.&lt;/p&gt;

&lt;p&gt;As Parliament passed the IT Act in the midst of din, without any debate, it is easy to be skeptical and wonder whether Rules made under the IT Act will be debated.  However, I remain hopeful that Parliament will not only exercise its power wisely, but will perform its solemn duty — borne out of each MP's oath to uphold our Constitution — by rejecting these Rules.&lt;/p&gt;

    <title>Historic day for freedom of speech and expression in India</title>

        &lt;b&gt;In a petition that finds its origin in a simple status message on Facebook, Shreya Singhal vs Union of India marks a historic reinforcement of the freedom of speech and expression in India.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;The article by Vidushi Marda was published in &lt;a class="external-link" href="http://www.bangaloremirror.com/columns/views/Historic-day-for-freedom-of-speech-and-expression-in-India/articleshow/46681364.cms"&gt;Bangalore Mirror&lt;/a&gt; on March 25, 2015.&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;&lt;span id="advenueINTEXT"&gt;Hearing a batch of writ  petitions, the bench comprising Justices Rohinton F Nariman and J  Chelameswar considered the constitutionality of three provisions of the  Information Technology Act, 2000. The provisions under consideration  were Section 66A, dealing with punishment of sending offensive messages  through communication services, Section 69A which discusses website  blocking and Section 79, dealing with intermediary liability.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;&lt;span id="advenueINTEXT"&gt;The intent behind Section  66A was originally to regulate spam and cyber stalking, but in the last  seven years not a single spammer has been imprisoned.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;&lt;span&gt;&lt;span id="advenueINTEXT"&gt;Instead, innocent  academics have been arrested for circulating caricatures. The Court  struck down the section in its entirety, declaring it unconstitutional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span id="advenueINTEXT"&gt;It held that the language  of the section was "nebulous" and "imprecise" and did not satisfy  reasonable restrictions under A. 19(2) of the Constitution of India.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span id="advenueINTEXT"&gt;Section 79 was meant to  result in the blossoming of free speech since it stated that  intermediaries will not be held liable for content created by their  users unless they refused to act on take-down notices. Unfortunately,  intermediaries were unable to decide whether content was legal or  illegal, and when the Centre for Internet and Society in 2011 sent  flawed take-down notices to seven prominent national and international  intermediaries, they erred on the side of caution and over-complied,  often deleting legitimate content. By insisting on a court order, the  Supreme Court has eliminated the chilling effect of this Section.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span id="advenueINTEXT"&gt;Block orders issued by the Indian government to telecom operators and ISPs were shrouded in opacity.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span id="advenueINTEXT"&gt;The process through which  such orders were developed and implemented was not within public  scrutiny. When a film is banned, it becomes part of public discourse,  but website blocking does not enjoy the same level of transparency. The  person whose speech has been censored is not notified or given an  opportunity to be heard as part of the executive process. Unfortunately,  in dealing with Section 69A, the Court chose to leave it intact,  stating that it is a "narrowly drawn provision with several safeguards."&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span id="advenueINTEXT"&gt;On balance, this is a  truly a landmark judgment as it is the first time since the 1960s that  the Supreme Court has struck down any law in its entirety for a  violation of free speech.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

        &lt;b&gt;Another day and another opaque order asking Indian service providers to block websites that allegedly offer or advertise escort services in India. In total, the government has ordered ban on 237 websites. But as it happens whenever the Indian government bans website, there has been no public communication about the same. &lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;The article was &lt;a class="external-link" href="http://indiatoday.intoday.in/technology/story/govt-blocks-239-indian-escorts-service-websites/1/692381.html"&gt;published in India Today&lt;/a&gt; on June 16, 2016&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;Also, it has not been explained what, if any, process was followed before these websites were banned and what norms were applied for the order that the internet service providers have received.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;However, now Centre for Internet and Society has caught hold of the list of the websites that have been banned. Here is what &lt;a href="http://cis-india.org/internet-governance/blog/list-of-blocked-escort-service-websites" target="_blank"&gt;the organisation says,&lt;/a&gt; "Unfortunately, the government does not make available publicly the  list of websites they have ordered ISPs to block. Given that knowledge  of what is censored by the government is crucial in a democracy, we are  publishing the entire list of blocked websites." &lt;/span&gt;&lt;/p&gt;

But the issue is one of criminal prosecution – whether that should happen or not, and with regard to the interesting dichotomy that Shivam pointed out some people are calling for somethings to be banned but not others. I think that kind of hypocrisy should be pointed out. I am happy that these small incidents of hate mongering are actually being blown out of proportion on social media because it actually gets people to react...to say wait a second...that is not right I might have a certain leanings towards Hindutva but that kind of speech is not what I support, or I might have a certain leanings towards what is called "pseudo-secularism" but that kind of speech is not what I support. So getting out that discussion out is important.&lt;/p&gt;
&lt;p&gt;If we were on one hand a society where we had communal peace and then social media were focusing on these small kinds of incidents and blowing it out of proportion then that would be a problem.&lt;/p&gt;

    <title>Hard to broad ban!</title>

&lt;p style="text-align: justify; "&gt;The Haryana government on February 19 suspended mobile internet services in the districts affected by the agitation caused by the Jat community over reservation. The ban was imposed under section 144 of criminal procedure code (CrPC) to control the situation from being fanned by rumours or inflammatory messages.Similar ban was imposed in Gujarat last year during violent protests stirred by Hardik Patel over reservation of Patel community. In a similar manner internet connectivity was snapped in Nagaland, Rajasthan and Jammu and Kashmir last year under section 144 in order to contain law and order situation.&lt;br /&gt;&lt;br /&gt; The CrPC section allows an official authorised by the state government to “direct any person to abstain from a certain act or to take certain order” which is “likely to prevent, or tends to prevent, obstruction, annoyance or injury to any person lawfully employed or danger to human life, health or safety, or a disturbance of the public tranquility, or a riot, of an affray”. “An order under this section may, in cases of emergency or in cases where the circumstances do not admit of the serving in due time of a notice upon the person against whom the order is directed, be passed ex parte,” the section states.&lt;br /&gt;&lt;br /&gt; However, the civil rights lawyers claim that section 144 is a general law. “Section 144 is a means to curb apprehended danger and nuisance in emergencies, but its use to ban internet access for a region is an excessive and arbitrary use  of powers granted to the state government under this provision,” says Mishi Choudhary, legal director, software freedom law centre (SFLC).&lt;br /&gt;&lt;br /&gt; They, moreover, believe that the above section is not specific and contextual in cases of communication ban. So what is the correct law that comes in disposal of state authorities during emergencies that call for an urgent step? It’s  section 5 of the Indian Telegraph Act, 1885. The act specifically deals with blocking web domains or web pages or blanket ban. Section 5(2) says that states or central government can prevent transmission of any message(s) that cause  incitement to unlawful situation. Looking carefully, this section focuses only on blocking of inflammatory message(s), not a blanket ban.&lt;br /&gt;&lt;br /&gt; In the case of Gujarat, for example, Hardik Patel, leading the agitation, used WhatsApp to spread the word for Bharat bandh, which consequently caused a blanket ban on data services by the state authorities. Under section 5(2), the  authorities could have gone ahead only with banning social media websites and messaging application, instead of a blanket ban.&lt;br /&gt;&lt;br /&gt; Section 5(2) of the telegraph Act also allows the authorities to lawfully intercept messages during public emergency. The central government has laid out clear guidelines in 2014, defining circumstances that demands phone tapping and in what manner. Similar guidelines are not there for suspending internet services under same law, however.&lt;br /&gt;&lt;br /&gt; “The way in which the ban is imposed is unreasonable. Problem is in the method that is being used in absence of guidelines, defining circumstances under which they can impose a restriction on internet sites,” says Arun Kumar, head of cyber initiatives at Observer Research Foundation (ORF).&lt;br /&gt;&lt;br /&gt; If government formulates these rules or guidelines it will set a threshold for state or central authorities, which will define the urgency of imposing ban on internet services. It will also make authorities answerable, limiting the misuse of power under the section 144 of the CrPC.&lt;br /&gt;&lt;br /&gt; The civil rights lawyers cite example of section 69 A of the IT Act, 2000, which grants power to the central government to direct notice to intermediaries (for example, Facebook and Twitter), to block public access to any information that could stir violence in the country. In this case the government formulated blocking rules in 2009, providing for examination of complaints. The authority to employ this power however lies with the central government, and so, a state not using this law for taking down any message or domain from public view is understandable, during riot-like situation.&lt;br /&gt;&lt;br /&gt; For states to legitimately use their power, it is essential to have similar blocking rules for section 5(2) of telegraph act.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Is blanket ban needed, anyway?&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt; “Blocking all internet access is clearly an unnecessary and disproportionate measure that cannot be countenanced as a ‘reasonable restriction’ on freedom of expression and the right to seek and receive information, which is an integral part of the freedom of expression,” says Pranesh Prakash, policy director, Centre for Internet and Society (CIS).&lt;br /&gt;&lt;br /&gt; For instance, he adds, a riot-affected woman seeking to find out the address of the nearest hospital cannot do so on her phone. “Instead of blocking access to the internet, the government should seek to quell rumours by using social networks to spread the truth, and by using social networks to warn potential rioters of the consequences,” he says.&lt;br /&gt;&lt;br /&gt; Former Mumbai police commissioner Rakesh Maria used WhatsApp to counter rumours spread after circulation of a fake photo in January 2015. A similar approach could have been taken by state authorities in the case of Gujarat or Haryana; countering miscreants, informing public about the truth and emergency help details.&lt;br /&gt;&lt;br /&gt; “Instead of doing that, we saw that in Gujarat, the police themselves engaged in acts of violent vandalism (caught on CCTV cameras), and in Manipur the police shot dead nine Manipuri tribals, including a 11-year-old child,” retorts Pranesh.&lt;br /&gt;&lt;br /&gt; Blocking internet should be used as a last resort, and taking a balanced approach that considers interest of every stakeholder in a society is essential, argue civil rights lawyers. It is also imperative on the part of the government to formulate guidelines or a rule book to tackle the arbitrariness exercised by the states and security forces.&lt;/p&gt;
