    <title>No more 66A!</title>

        &lt;b&gt;In a landmark decision, the Supreme Court has struck down Section 66A. Today was a great day for freedom of speech on the Internet! When Section 66A was in operation, if you made a statement that led to offence, you could be prosecuted. We are an offence-friendly nation, judging by media reports in the last year. It was a year of book-bans, website blocking and takedown requests. Facebook’s Transparency Report showed that next to the US, India made the most requests for information about user accounts. A complaint under Section 66A would be a ground for such requests.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;Section 66A hung like a sword in the middle: Shaheen Dhada was arrested in Maharashtra for observing that Bal Thackeray’s funeral shut down the city, Devu Chodankar in Goa and Syed Waqar in Karnataka were arrested for making posts about Narendra Modi, and a Puducherry man was arrested for criticizing P. Chidambaram’s son. The law was vague and so widely worded that it was prone to misuse, and was in fact being misused.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Today, the Supreme Court struck down Section 66A in its judgment on a &lt;a class="external-link" href="http://cis-india.org/internet-governance/blog/overview-constitutional-challenges-on-itact"&gt;set of petitions&lt;/a&gt; heard together last year and earlier this year. Stating that the law is vague, the bench comprising Chelameshwar and Nariman, JJ. held that while restrictions on free speech are constitutional insofar as they are in line with Article 19(2) of the Constitution. Section 66A, they held, does not meet this test: The central protection of free speech is the freedom to make statements that “offend, shock or disturb”, and Section 66A is an unconstitutional curtailment of these freedoms. To cross the threshold of constitutional limitation, the impugned speech must be of such a nature that it incites violence or is an exhortation to violence. Section 66A, by being extremely vague and broad, does not meet this threshold. These are, of course, drawn from news reports of the judgment; the judgment is not available yet.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Reports also say that Section 79(3)(b) has been read down. Previously, any private individual or entity, and the government and its departments could request intermediaries to take down a website, without a court order. If the intermediaries did not comply, they would lose immunity under Section 79. The Supreme Court judgment states that both in Rule 3(4) of the Intermediaries Guidelines and in Section 79(3)(b), the "actual knowledge of the court order or government notification" is necessary before website takedowns can be effected. In effect, this mean that intermediaries &lt;i&gt;need not&lt;/i&gt; act upon private notices under Section 79, while they can act upon them if they choose. This stops intermediaries from standing judge over what constitutes an unlawful act. If they choose not to take down content after receiving a private notice, they will not lose immunity under Section 79.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Section 69A, the website blocking procedure, has been left intact by the Court, despite infirmities such as a lack of judicial review and non-transparent operation. More updates when the judgment is made available.&lt;/p&gt;

    <title>NGOs, individuals urge state CMs to curb Internet shutdown</title>

        &lt;b&gt;Amid rising instances of Internet curbs, a group of individuals and organisations have urged the chief ministers of 12 states to only restrict specific online content rather than resort to complete shutdown.&lt;/b&gt;

&lt;p style="text-align: justify; "&gt;SFLC.in, a Delhi-based not-for-profit organisation, along with  various Internet-related firms have sent letters in this regard to the  chief ministers of these states impacted by Internet shutdowns.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The letters have been written to the chief ministers of Uttar Pradesh, &lt;a class="key_underline" href="http://timesofindia.indiatimes.com/topic/Nagaland"&gt;Nagaland&lt;/a&gt;, Manipur, Maharashtra, J&amp;amp;K, &lt;a class="key_underline" href="http://timesofindia.indiatimes.com/topic/Jharkhand"&gt;Jharkhand&lt;/a&gt;, Rajasthan, Meghalaya, &lt;a class="key_underline" href="http://timesofindia.indiatimes.com/topic/Arunachal-Pradesh"&gt;Arunachal Pradesh&lt;/a&gt;, &lt;a class="key_underline" href="http://timesofindia.indiatimes.com/topic/Bihar"&gt;Bihar&lt;/a&gt;, &lt;a class="key_underline" href="http://timesofindia.indiatimes.com/topic/Gujarat"&gt;Gujarat&lt;/a&gt; and Haryana.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"The Internet shutdowns are imposed using state power under Section  144 by these specific states and not by the Union Government. The  central government is bound to follow the process under Section 69 IT  act.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"These letters to the chief ministers of all 12 states, which have  been affected by Internet shutdowns till date, are an effort by us to  address the source of the problem," SFLC.in President and Legal Director  Mishi Choudhary told .&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;As per Internet Shutdown tracker of SFLC, there have been 28  incidents of Internet closure in Jammu &amp;amp; Kashmir, 9 cases each in  Gujarat and Haryana, 8 in Rajasthan, 3 Nagaland, 2 cases each in Uttar  Pradesh, Bihar and Manipur and 1 incident each in Maharashtra,  Jharkhand, Meghalaya and Arunachal Pradesh since 2012.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;As per the tracker, far India has experienced a record number of 66  such incidents since 2012, with the number increasing more than  two-fold from 14 in 2015 to 31 in 2016.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The letters sent to the chief ministers urge them to "take  requisite action that would prohibit the issuance of orders that make  Internet services entirely inaccessible for a particular area, and  rather recommend that Section 69A and the procedure established by the  rules therein be applied to limit the restriction to certain specific  online content."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The signatories of the letters include the Centre for Internet and  Society, Digital Empowerment Foundation, Internet Democracy Project, IT  for Change and Society for Knowledge Commons, individuals like &lt;a class="key_underline" href="http://timesofindia.indiatimes.com/topic/Anivar-Aravind"&gt;Anivar Aravind&lt;/a&gt; (Executive Director, Indic Project), IIT Bombay professor &lt;a class="key_underline" href="http://timesofindia.indiatimes.com/topic/Kannan-Moudgalya"&gt;Kannan Moudgalya&lt;/a&gt; and others.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"We are hopeful that our efforts will make the government take in  account the enormous effects of Internet shutdowns on the  social-economic condition of our citizens and understand their plight,"  Choudhary said. PRS MKJ&lt;/p&gt;

    <title>New intermediary guidelines: The good and the bad </title>

&lt;p&gt;The Government of India notified the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. The operation of these rules would be in supersession of the existing intermediary liability rules under the Information Technology (IT) Act, made back in 2011.&lt;/p&gt;
&lt;p&gt;These IL rules would have a significant impact on our relationships with internet ‘intermediaries’, i.e. gatekeepers and getaways to the internet, including social media platforms, communication and messaging channels.&lt;/p&gt;
&lt;p&gt;The rules also make a bid to include entities that have not traditionally been considered ‘intermediaries’ within the law, including curated-content platforms such as Netflix and Amazon Prime as well as digital news publications.&lt;/p&gt;
&lt;p&gt;These rules are a significant step-up from the draft version of the amendments floated by the Union government two years ago; in this period, the relationship between the government around the world and major intermediaries changed significantly.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The insistence of these entities in the past, that they are not ‘arbiters of truth’, for instance, has not always held water in their own decision-makings.&lt;/p&gt;
&lt;p&gt;Both Twitter and Facebook, for instance, have locked the former United States president Donald Trump out of their platforms. Twitter has also resisted to fully comply with government censorship requests in India, spilling into an interesting policy tussle between the two entities. It is in the context of these changes, therefore, that we must we consider the new rules.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;What changed for the good?&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;One of the immediate standouts of these rules is in the more granular way in which it aims to approach the problem of intermediary regulation. The previous draft — and in general the entirety of the law — had continued to treat ‘intermediaries’ as a monolithic entity, entirely definable by section 2(w) of the IT Act, which in turn derived much of its legal language from the EU E-commerce Directive of 2000.&lt;/p&gt;
&lt;p&gt;Intermediaries in the directive were treated more like ‘simple conduits’ or dumb, passive carriers who did not play any active role in the content. While that might have been the truth of the internet when these laws and rules were first enacted, the internet today looks much different.&lt;/p&gt;
&lt;p&gt;Not only is there a diversification of services offered by these intermediaries, there’s also a significant issue of scale, wielded by a few select players, either by centralisation or by the sheer number of user bases. A broad, general mandate would, therefore, miss out on many of these nuances, leading to imperfect regulatory outcomes.&lt;/p&gt;
&lt;p&gt;The new rules, therefore, envisage three types of entities:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;There are the ‘intermediaries’ within the traditional, section 2(w) meaning of the IT Act. This would be the broad umbrella term for all entities that would fall within the ambit of the rules.&lt;/li&gt;&lt;li&gt;There are the ‘social media intermediaries’ (SMI), as entities, which enable online interaction between two or more users.&lt;/li&gt;&lt;li&gt;The rules identify ‘significant social media intermediaries’ (SSMI), which would mean entities with user-thresholds as notified by the Central Government.&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;The levels of obligations vary based on these hierarchies of classification. For instance, an SSMI would be obligated with a much higher standard of transparency and accountability towards their users. They would have to fulfill by publishing six-monthly transparency reports, where they have to outline how they dealt with requests for content removal, how they deployed automated tools to filter content, and so on.&lt;/p&gt;
&lt;p&gt;I have previously argued how transparency reports, when done well, are an excellent way of understanding the breadth of government and social media censorships. Legally mandating this is then perhaps a step in the right direction.&lt;/p&gt;
&lt;p&gt;Some other requirements under this transparency principle include giving notice to users whose content has been disabled, allowing them to contest such removal, etc.&lt;/p&gt;
&lt;p&gt;One of the other rules from the older draft that had raised a significant amount of concern was the proactive filtering mandate, where intermediaries were liable to basically filter for all unlawful content. This was problematic on two counts:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;Developments in machine learning technologies are simply not up there to make this a possibility, which would mean that there would always be a chance that legitimate and legal content would get censored, leading to general chilling effect on digital expression&lt;/li&gt;&lt;li&gt;The technical and financial burden this would impose on intermediaries would have impacted the competition in the market.&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;The new rules seemed to have lessened this burden, by first, reducing it from being mandatory to being best endeavour-basis; and second, by reducing the ambit of ‘unlawful content’ to only include content depicting sexual abuse, child sexual abuse imagery (CSAM) and duplicating to already disabled / removed content.&lt;/p&gt;
&lt;p&gt;This specificity would be useful for better deployment of such technologies, since previous research has shown that it’s considerably easier to train a machine learning tool on corpus of CSAM or abuse, rather than on more contextual, subjective matters such as hate speech.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;What should go?&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;That being said, it is concerning that the new rules choose to bring online curated content platforms (OCCPs) within the ambit of the law by proposals of a three-tiered self-regulatory body and schedules outlining guidelines about the rating system these entities should deploy.&lt;/p&gt;
&lt;p&gt;In the last two years, several attempts have been made by the Internet and Mobile Association of India (IAMAI), an industry body consisting of representatives of these OCCPs, to bring about a self-regulatory code that fills in the supposed regulatory gap in the Indian law.&lt;/p&gt;
&lt;p&gt;It is not known if these stakeholders were consulted before the enactment of these provisions. Some of this framework would also apply to publishers of digital news portals.&lt;/p&gt;
&lt;p&gt;Noticeably, this entire chapter was also missing from the old draft, and introducing it in the final form of the law without due public consultations is problematic.&lt;/p&gt;
&lt;p&gt;Part III and onwards of the rules, which broadly deal with the regulation of these entities, therefore, should be put on hold and opened up for a period of public and stakeholder consultations to adhere to the true spirit of democratic participation.&lt;/p&gt;

    <title>New Delhi Expands Curbs on Web Content </title>

&lt;p style="text-align: justify; "&gt;Since last week, the government has blocked content that it claims has fueled continuing communal violence in the northeast of the country. That fighting, between Muslim settlers and members of an indigenous group in the state of Assam, has left more than 80 people dead and sent ripples of tension across India.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The government confirms it has blocked around 250 Web pages it says were inciting Muslims to attack northeasterners, including sites carrying doctored photos purporting to show Muslim victims of fighting in Assam. Officials say these images on the sites, coupled with mass SMS phone messages threatening reprisals, have caused panicked northeasterners to flee their homes in a number of large Indian cities.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In recent days, though, the government has quietly widened its offensive, drawing up lists of journalists' Twitter accounts and news stories by local and foreign media organizations to be blocked. The lists, some of which were reviewed by The Wall Street Journal and confirmed by two telecom operators, include Twitter handles of journalists who have been critical of the government and some who have parodied Prime Minister Manmohan Singh.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The government didn't respond to requests for comment.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The government's actions caused an uproar on Twitter, where hashtags such as #GOIBlocks and #Emergency2012 were trending Thursday. "The Emergency" refers to a period in the 1970s when Prime Minister Indira Gandhi cracked down on media freedoms and civil liberties.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"The government's move to block several Twitter handles is a clear case of administrative overreach," said Sunil Abraham, executive director at the Bangalore-based Centre for Internet and Society. "This action means citizens are less likely to believe that the government can use its powers responsibly."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Government officials said Internet curbs are necessary to maintain harmony in a multicultural nation of 1.2 billion people.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Pankaj Pachauri, a spokesman for Mr. Singh, acknowledged the government had asked for Twitter's help to block six accounts that impersonate the prime minister. One of those accounts appeared on the government's lists. Twitter, based in San Francisco, has agreed to review the requests, he said. A Twitter spokeswoman declined to comment. Mr. Pachauri said earlier this week that Indian cyber authorities unilaterally blocked those six accounts.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Those six Twitter accounts faced government scrutiny because they made remarks that could have increased tensions, not because they poked fun at the prime minister, Mr. Pachauri said. "We're all for media freedom and encourage criticism by the media," he added. "But when it comes to inciting trouble between communities then we have to take firm action."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;U.S. State Department spokeswoman Victoria Nuland said on Tuesday that "we are always on the side of full freedom of the Internet." She added that "we also always urge the government to maintain its own commitment to human rights, fundamental freedoms, rule of law."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India's Constitution allows restrictions on free speech for a number of reasons, including defense of "the sovereignty and integrity" of the country and in order to maintain "public order, decency or morality." Critics say the government has used the vague framing of the Constitution to clamp down on a widening array of Internet material, threatening India's democratic traditions.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Last year, the government framed new rules that require Internet companies to remove within 36 hours material that falls into a range of subjective categories—for instance, anything "ethnically objectionable," "grossly harmful," "defamatory" or "blasphemous."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India's telecoms minister, Kapil Sibal, in December urged &lt;a href="http://online.wsj.com/public/quotes/main.html?type=djn&amp;amp;symbol=GOOG"&gt;Google&lt;/a&gt; Inc., and other Internet companies to screen derogatory material from their sites. The requests came amid anger over content that parodied Mr. Singh and Sonia Gandhi, president of the ruling Congress party, as well as other leading politicians.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"One always wonders if the government is using the garb of hate speech and communalism to…limit political criticism online," said Apar Gupta, a cyberlaw expert at Advani &amp;amp; Co., a Delhi-based law firm.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Google and Facebook executives are facing criminal charges in a New Delhi court for allegedly hosting objectionable material on their sites. If found guilty, the executives could face jail time or fines. The companies have petitioned to have the charges dropped, arguing that they shouldn't be held liable for material posted by users. Both firms have said they will remove material that contravenes their own standards or local laws.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Google, Facebook and Twitter again came under fire from India this week amid violence in Assam. Google and Facebook said Tuesday that they were complying with Indian government requests to remove content. Twitter hasn't commented.&lt;br /&gt;&lt;br /&gt;Kanchan Gupta, a columnist who has been a fierce critic of the Congress party-led government, said his Twitter account had been temporarily blocked Wednesday night and Thursday. His name was on the government lists. "They thought they could do this slyly," he said. "They didn't anticipate the backlash on Twitter."&lt;br /&gt;&lt;br /&gt;Raghavan Jagannathan, editor in chief of FirstPost.com, an Indian news portal that was on the lists, said some of its stories had been blocked.&lt;br /&gt;&lt;br /&gt;"We understand that the government wants to stop the circulation of incendiary material that may inflame passions, but should it be blocking news and opinions on the subject?" he said. "I am not sure the decisions are well-thought-out."&lt;br /&gt;&lt;br /&gt;Doha, Qatar-based Al Jazeera, an international cable-news organization, was also on the list. An Al Jazeera spokesman said the company was seeking a response from the government on reports of media restrictions affecting it and other outlets.&lt;br /&gt;&lt;br /&gt;The government appeared unmoved. "Every company whether it's a construction company or an entertainment company or a social media company, it has to operate within the laws of the given country," Junior Minister for Communications Sachin Pilot told reporters on Wednesday.&lt;/p&gt;

The youngster, who is now pursuing her masters in London, recalls the time her post on Facebook about Prime Minister Narendra Modi was reported for being offensive.&lt;br /&gt;&lt;br /&gt;“It was just a sentence about how I felt about Mr Modi. Nothing obscene but it still got reported,” she says. She believes the Internet to be “the last guard of freedom”, where free speech has real meaning because there is no government and corporate control.&lt;br /&gt;&lt;br /&gt;Forums propagating freedom on the World Wide Web too have applauded the verdict.&lt;br /&gt;&lt;br /&gt;T Vishnu Vardhan, programme director of Access to Knowledge at the Centre for Internet and Society, says the draconian aspect of the IT Act has finally been removed.&lt;br /&gt;&lt;br /&gt;The other laws coming under the IT Act’s ambit too need to be reviewed and changed, he said.&lt;br /&gt;&lt;br /&gt;Lawyers told Express that many times, they have advised clients to take down posts that could be construed as offensive under Section 66A.&lt;br /&gt;&lt;br /&gt;Lawrence Liang, a lawyer with the Alternative Law Forum, says, “Recently, we were approached by a woman saying she was being harassed by a mob after she tweeted about the beef ban in Maharashtra. We asked her to delete the tweet and lie low.”&lt;br /&gt;&lt;br /&gt;“But now, I won’t advise people to take down their posts from the internet. It is a good ruling and gives people their freedom of speech and expression on the Internet,” Lawrence says.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Change on the Horizon&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;With bans raining down in the country, many believe the apex court’s decision will bring about change.&lt;br /&gt;&lt;br /&gt;Yogita Dakshina, a freelance content writer who regularly posts about the hardships faced by the LGBT community, says she has always posted fearlessly but some of her family members were always scared that she would court trouble due to the provisions of Section 66A.&lt;br /&gt;&lt;br /&gt;Prabahan Chakravorty, a PhD student, is of the view that this will be a big lift for those in the creative field. “The rights to freedom and expression need to be given to all citizens, especially writers and artists. Some people may consider a few posts offensive, but then, the world is offensive and people need to deal with that.”&lt;br /&gt;&lt;br /&gt;On the responsibility that falls upon netizens with this verdict, Ankura Nayak, a student of Mount Carmel College, says, “People are responsible and they know what to post. There were a few people who posted irresponsible content even before this ruling. But these are few in number compared to responsible netizens.”&lt;/p&gt;

    <title>Net neutrality: Net activism packs a punch</title>

        &lt;b&gt;For the first time in the history of internet campaigns in India, a protest movement has successfully changed the course of a debate without having to take to the streets. The net neutrality movement is being fought almost totally in the virtual world. Hashtag activism isn't new in India. In recent times, several big campaigns have been bolstered by the internet which helped mobilize mass support and kept people constantly updated on events. Pink Chaddi, Jan Lokpal and the Nirbhaya movements were some examples of successful on-the-ground campaigns that were galvanized by social media. But they still needed public action — dharnas, candlelight vigils and actual pink undies — to make a difference.
&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;The article by Sandhya Soman was &lt;a class="external-link" href="http://timesofindia.indiatimes.com/tech/tech-news/Net-neutrality-Net-activism-packs-a-punch/articleshow/46973783.cms"&gt;published in the Times of India&lt;/a&gt; on April 19, 2015. Pranesh Prakash was quoted.&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;But the ongoing battle for internet freedom has proved that clicktivism  isn't just about passive engagement with a cause. While it's all too  easy to 'like' a cause, leading to what David Carr describes as  "favoriting fatigue" in an article in the New York Times, some clicks  can count in the real world.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It all started when the Telecom Regulatory Authority of India (Trai)  posted a vaguely worded and complicated discussion paper on net  neutrality and called for public responses to it. "Clearly, many people  understood that some of the proposals put forward by Trai in its paper  threatened the internet as they knew it," says Anja Kovacs, who directs  the Internet Democracy Project and has closely followed online activism  in India.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Soon, an unlikely collective of techies, lawyers, journalists and even  stand-up comics had banded together. Some of them — such as tech  entrepreneur Kiran Jonnalagadda and journalist Nikhil Pahwa — had been  writing and tweeting about the issue for a while but the Trai paper  galvanized them. "I dropped everything and asked for help. Kiran,  (lawyers) Apar Gupta amd Raman Chima, Sandeep Pillai, standup group All  India Bakchod and several Reddit India users (some of whom remain  anonymous), started getting involved," says Pahwa, who is the founder of  Medianama. The only common factor was their love for internet and an  acute worry what this policy consultation might do to destroy its open  and equal nature.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Though scattered across India, once they came together online, this  'apolitical collective' was able to rope in engineers, developers, open  source activists, entrepreneurs, policy experts, lawyers and journalists  as volunteers.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The best way to counter propaganda and opposition was to get people  involved. An abridged version of the voluminous Trai paper was posted  online, and a FAQ section created on a public Google Doc. "Many came  forward to answer the questions and that exercise helped create an  understanding of the situation," explains Pahwa. By the time,  Jonnalagadda and a few other developers set up the savetheinternet.in  website by April 1, there was enough information and data points.  Lawyers Gupta and Chima had also decoded the legalese and prepared  cogent answers to Trai's 20 questions. This was turned into a  ready-to-use email template for users to hit 'send'.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;And send they did. The flood of emails to the Trai inbox number is  already 803,723 and counting. The results of the social media backlash  are evident — with e-commerce retailer Flipkart pulling out of Airtel  Zero and several websites backing out of Facebook and Reliance's  internet.org. "I was hoping to get around 15,000 responses to counter,  say, 15 from the telecom lobby. Now, people make fun of me because I  said that," laughs Pahwa. In this case, what also struck a chord was the  idea of a bunch of young guys using tech to take on mismanagement by  the older generation and corporate greed, says entrepreneur Mahesh  Murthy. "We were telling them we like things on the internet as they are  now."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But it is hard to sustain online outrage without an action plan,  relentless groundwork and some comic warfare. So, when the contentious  paper came out on March 27, the website was followed by AIB's punchy  video that decoded the concept and took irreverent potshots at those who  wanted to limit access while urging people to write to Trai. A lot of  the lessons for the campaign came from the US where a John Oliver video  turned the tide in the net neutrality debate. "We had seen that several  people don't take internet petitions seriously. Also, we wanted to  follow the proper legal course in this issue and not hold dharnas," says  Jonnalagadda.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is also important for campaigns to result in doable action. As Kovacs  points out, savetheinternet.in and netneutrality. in gave users  practical tools to respond before the April 24 deadline. The team also  kept clarifying doubts and complex concepts on social media and also had  an AMA (ask me anything) chat on Scrollback on Saturday while the  'other side' stuck to big words and jargon.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Of course, like every movement, this one too has attracted criticism.  The proneutrality band has been branded as socialist and utopian and  there were intense arguments amongst supporters. "Disagreements and  arguments are not unique to the activism online," says Pranesh Prakash,  policy director at Centre for Internet and Society.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Earlier in the debate, Prakash had said he'd received strong pushback  from friends and allies when he spoke about the possible benefits of  non-competitive zero rating, an example would be allowing companies to  offer free access to their sites and apps via an arrangement with a  telecom company — if effective competition exists. Airtel Zero and  Reliance's Internet.org claim to do the same though most supporters  remain critical. Says Prakash: "There might've been differences. But the  fact that a lot of people are thinking about effects of 'free', and  comparing it to predatory pricing shows that #savetheinternet is one of  the better examples of engaged activism."&lt;br /&gt; &lt;br /&gt; Online campaigns have  previously also successfully mobilized people to get involved in issues  they do not know much about, says author Nilanajana Roy, who is an  influential voice on Twitter. The J&amp;amp;K flood relief efforts last year  started on Twitter but got volunteers moving on the ground, she says.  "People don't always realize what they care strongly about so, despite  the risk of compassion fatigue or armchair volunteerism, it's worth  having some online activism," says Roy.&lt;br /&gt; &lt;br /&gt; Meanwhile, those behind  the savetheinternet campaign are struggling with their new-found  identity as "activists". "I think of myself as a venture capitalist and  marketing consultant, not a khadi kurta-jholawala from JNU," says Mahesh  Murthy, among those who strongly support the movement.&lt;br /&gt; &lt;br /&gt; And at  the end of the day, most of these activists would like to go back to  their cubicles, free to browse or start a business. But not before  they've tried to keep the internet open.&lt;/p&gt;

        &lt;b&gt;The post deals with what has been written about Savita Bhabhi in an attempt to make sense of her peccadiloes and with the seeming futility of Porn studies located in America to our different reality. I take the liberty of exploring my own experiential account of pornography since I feel that in that account (mine and others) when done seriously, certain aspects of pornography emerge that address questions that are about cinema, images, sex, philosophy and how desire works. The title is mischeviously inspired from Dr. Pek Van Andel's recent video of MRI images of people having sex.&lt;/b&gt;
        



&lt;p&gt;Jonathan James McCreadie Lillie in his article “Cyberporn,
Sexuality and the Net Apparatus” while talking about academic engagement with
pornography (by Kipnis, Hunt, Waugh, Kendrick) points to how they share “a
common concern with analysing pornography within the various cultural
constructs and social spaces in which it appears, and in which people encounter
it”. He says that a new agenda for cyberporn research has to acknowledge that
“people have produced pornography in many different forms for many different
purposes, and the reasons why people use it or do not use it, and what meanings
they make of it, are equally diverse”. (1)&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Lillie points towards cyberporn reception studies – the
home/office terminal as a site of cyberporn reception – as a possible starting
point of further work on cyberporn. My interest is located in how does one
understand your own consumption of internet porn, located as it is in the
context that is not the global North and more specifically not male and not heterosexual.
Attempting to do that through the readings in porn studies (Porn studies,
edited by Linda Williams) (2), or specifically net porn studies (C’lick me –
Net Porn Reader) (3), has not been entirely fruitful though what is talked
about is highly interesting. One of the problems perhaps lies in what Lillie
says about the need for analyzing pornography within the various cultural
constructs and social spaces in which it appears, rather than separate or
floating above them. The Internet does not entirely make protean beings
(cyborgs?) of us after all, and the relevance of porn studies elsewhere can
only be partially relevant to a study here.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;[Curiously though the debates within feminism and the
women’s movement around pornography in the global North – the familiar rhetoric
of the causal links between pornography and violence, do have a resonance in
similar debates in the women’s movement here. At a roundtable discussion on the
role of media at the recent Courts of Women organized by Vimochana (4), many of
the sentiments expressed by activists and organizations see a causal link
between explicit sexual material, violence and its direct negative impact on
morals, attitudes and behaviour of people.]&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Linda Williams begins the volume on Porn Studies by stating that
there has been a movement from the deadlock of pro-censorship and sex positive
feminist discourse on pornography, to a stage where there is a veritable
explosion of sexual material that is crying out for analysis, and that sexually
explicit imagery is a fixture in popular culture today (obviously referring to
America but to some extent true for other contexts as well). In some ways there
is an attempt amongst academics, intellectuals, journalists and other writers
here to make sense of the pornographic material that has crept into our media
saturated cities. Many recent articles spawned by the ban on Savita Bhabhi
attempt to understand the unleashing of desire around Savita Bhabhi (from a
rock song to unashamed fandom) and to analyse the reasons for the ban or rather
what makes Savita Bhabhi threatening.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Savita Bhabhi, the [porn] [toon] [star]&amp;nbsp; &lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;Itty Abraham undertakes a fairly detailed analysis of what
is happening in twelve episodes of Savita Bhabhi and perhaps unconvincingly
places the crux of the story of Savita Bhabhi on her cuckolded husband, Ashok
(5). He says “Their family life is relentless modern, nuclear, bourgeois, if
also gendered in familiar ways. The couple eats together (and at the same
time), they watch TV together in the evenings, and sleep in the same bed.” For
Abraham, the comic is about “these new sexual possibilities.. that begin from a
new kind of freedom to which the modern urban woman has access”. The article
suggests that we seem to be faced with a choice between the free untrammeled
Savita and her easy occupation of urban spaces protected by an aura of class
and her husband Ashok who is the hard worker earning enough to keep alive
her/our illusion of abundant urban neoliberal existence. Interestingly the
article is not attempting to make a point about pornography in relation to
ideas of culture, tradition, vulgarity or other familiar motifs in the debate
on obscenity.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Shohini Ghosh’s article takes on the task to find out what
precisely is so transgressive about Savita Bhabhi (6). Savita Bhabhi is poised
between the family and husband and illegitimate desires (similar to themes in
Charulata, Hum aapke hain kaun). She points that the pleasure of the comic is
not just that there are hard core sexual scenes as much as that the husband or
a similar character cannot look at what you look at. The Indian erotica (or
pornographic text) scene too is replete with tales of incest and transgressions
with domestic workers or servants|maids as they are called in the stories.
Ghosh while acknowledging the harm-violence debate within feminism on
pornography, states that she is anti-censorship – that although it is obvious
that media, images have an impact (otherwise why would they be cause of study)
there is no neat causal link between porn and sexual violence. She ends by
saying that “pornography then is a phantasmatic arena. It does not reflect
people’s ‘real’ sex lives so much as it articulates the desires and aspirations
for imagined ones.”&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Both articles make important linkages to other and pre-existing
debates on neo-liberal agendas, occupation of urban spaces, feminism and
obscenity. Ghosh seems to also be referring to a broader category of Indian porn and the problems posed by it. She also gestures towards the problems that might be posed if Savita Bhabhi were a real person and not a comic, but by and large most journalistic writing/analysis of Savita Bhabhi flattens out the field – asking questions as if comic characters were real persons, and not taking into account aesthetics, technology (mode of delivery) or where and how it is viewed (reception) by people. There is a difference in the way I respond to a comic about sex than to an MMS or hidden camera porn where I am aware of
the ‘realness’ of atleast some aspects of the image I’m looking at.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The ‘realness’ raises certain dilemmas – the anxiety is not
as severe and troubled as in the case of Mysore Mallige which is haunted by
urban legends of the couples or only the woman committing suicide, forced
marriage at a police station etc. Nonetheless to encounter the MMS video, when
the woman is looking directly at the camera often so it does not seem like a
hidden camera or non-consensual video, is to acknowledge the taking of pleasure
at the expense of someone else which may or may not bother you, but does render
the activity far more illicit and scary. My feeling of
fear|anxiety|secrecy|aloneness when surfing pornography, whether in the office,
home or anywhere where I can be discovered, is an added layer to the experience
even if the various aspects of violation of privacy, vulnerability of the woman
in the video or the existence of a pornography industry are not uppermost in
the mind when actually viewing the clips. One of the few works done that do
address this complicated set of affects that circulate and attach themselves to
pornography is Bharath Murthy’s film on Mysore Mallige ( the next post will be

&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;This is why I would insist that the comic is a different
space for a viewer – some things such as anxieties about who this person I’m
looking at is and what happened to her do disappear, while others such as a
comic is bright, colourful and highly visible on my computer screen (for
instance) become more important. It is harder to hide surfing Savita Bhabhi in
an office than reading erotica or even downloading and discreetly watching a
small video.&amp;nbsp; The aspect of how
Savita Bhabhi being a comic/drawn character changes how a viewer relates to the
material is an area of study that needs to be looked at more closely, perhaps
with the help of existing work that looks at the manga, anime, hentaii
phenomenon in Japan and parts of South East Asia.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The makers of Savita Bhabhi were anonymous till the ban and
after what seemed like a rather brief struggle with authority (SaveSavita
campaign on twitter and a blog) they vacated the public scene. As a consequence
of no real contest, the ban persists. But perhaps what is admirable is that
many people have learnt to use tools that allow them to still view Savita (and
to expose them here would be just foolhardy). In an interview online the makers
of Savita Bhabhi state .. “For one, it (comic) is a unique medium in the
context of Indian porn. We’ve had MMS’s, videos, stories, etc, but no porn
comics. Also a comic allows us to explore the fantasy in a much more vivid way
than any other medium.” This fantasy life however cannot be dismissed, as it is
indeed very real, or as they say – “based on real life fantasies of our authors
and fans. They are all something that a normal full blooded Indian male or
female would be fantasizing about on their commute to work or a lazy evening at
home.” In a short interview with the makers of the comic more recently and
subsequent to the ban they said that probably it was Savita Bhabhi’s popularity
that led to her downfall and that they set out to explore Indian sexuality,
which “obviously is a big No”.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;To return to Lillie’s call for a cyberporn reception studies
perhaps it is time in relation to looking at such material that we step away,
even if briefly, from these debates on feminism, vulgarity and obscenity in
Indian culture and others. In an interview dated 5th September, 2009, Ratheesh
Radhakrishnan says that what needs to be looked at when studying pornography,
is not the questions of Indian culture, religion, roles of women and gender (as
for questions related to obscenity) but the aesthetics of pornography. In his
own work Radhakrishnan deals precisely with this question in relation to the
category of ‘soft porn’ and how Shakeela becomes a star through soft porn
cinema – a star not entirely governed by the narrative of the film but
seemingly existing beyond the limit of the film itself. (8) By doing this, his
work deals with the question of how desire works in such films, which perhaps
is one of the more important question to ask about pornography. In the same
interview, he states that there is “something that takes place between the text
and the person watching” and that is what he is interested in.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h1&gt;Anti-porn&lt;/h1&gt;
&lt;p&gt;Radhakrishnan’s position is interesting in relation to this
project as it opens up questions that are beyond the feminist deadlock on
pornography and also goes beyond rhetoric of the liberating potential of the
explosion of the polymorphous perverse online. The latter is where a lot of
porn studies undertaken in the global North seems to get lost. The breathless
recounting of the pornographic in the everyday, does not help since it becomes
very obvious that any analysis would not be relevant to a vastly different
context in India. (9)&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Walter Metz in his article on Open Water (10) challenges the
ethics of porn studies – though he acknowledges that pornography is more a
symptom rather than a cause of anti-social behaviours that it is often linked
to (violent rape, aggressive behaviour, sexism etc.), but still raises the
question as to whether there are significant reasons to put the brakes on a
rabid, radical celebration of the liberating potential of pornography. Metz
talks about the need, within porn studies, to look at the positive and negative
impact of pornography (possibly he would extend that to looking at violent
martial arts film and other strands of cinema/new media).&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Metz’s paper as such deals with Open Water as an
anti-pornographic film (here referring to the generic practice of pornography
rather than political positions) and this might be an interesting productive
mode to understand the affect produced by pornography. Though Metz qualifies
that he’s not using pornography as a genre, but rather “as a reading frame. If
one keeps thinking about pornography while watching a non-pornographic film,
what is the resulting interpretation?” Since I haven’t seen the film Open Water
perhaps my interest in such an analysis is misfounded. Metz describes the
frustration depicted in the film Open Water between the audience expectations
for a reasonably good looking, tanned, blonde couple to get-it-on and what
happens to their bodies instead in the open water of the sea and prey to
sharks, is similar to the disjuncture that takes place in one of the films part
of the Destricted project. (11)&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Destricted is an interesting artistic|intellectual|new
media|film experiments in the global North around pornography. It is a series
of short films that resulted from an invitation to seven well known artists and
filmmakers to try to respond to sex and especially the phenomenon of
pornography in the contemporary. One of the films Death Valley by Sam
Taylor-Wood borrows from the Biblical tale of Onan and places a man
masturbating in the heaving, throbbing landscape of the Death Valley (the
hottest place in the Western hemisphere where the earth’s crust is constantly
changing and shifting). For precisely 7 minutes and 58 seconds, the protagonist
of the film masturbates uncomfortably without reaching ejaculation and/or
release. The painful un-release of this film, perhaps is meant to be juxtaposed
with the assumed ease of pornography’s answer to desire. However peculiarly it actually
is probably an accurate description of the experiential account of pornography
– of looking, searching, finding, downloading on painfully low speeds, watching
short clips that are blurred, shot only from one angle, badly drawn comics or
looking at largely uninspiring material which is not acquired or found easily.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;In some ways the experience of watching either of these
films sounds similar to watching certain kinds of MMS video porn. For instance,
one video was of a couple doing oral sex in a toilet cubicle. The angle of the
camera was from the top and perhaps the intention behind this was to obscure
the faces of the two persons, since only the top of their heads are visible. It
did not seem like the couple were unaware of the video camera, as much as
performing for it almost unwillingly and only if the anonymity was preserved.
The video was low quality and highly blurred, to the point of any features
being indistinct beyond blackness of hair (maybe) and generic skin tone which
could be Indian, Iranian or generic South Asian. The resemblance to the
Destricted video is because again of the time it takes to reach ejaculation –
there is a painfully long uninspiring blowjob sequence. The video remains scary
and leaves one with a feeling of claustrophobia, discomfort and peculiarly
boredom or distance from what is happening. Yet perhaps it is here that the
question of realness and the affect it produces enters again. The question that
intrigues me is whether the affect produced by the video is because
there are certain gestures of the woman that seem recognizable, because she
seems like you (ethnically, racially ofcourse but also in sexual spaces she
occupies and behaviour). After having accomplished the task of coaxing semen
out of the uninspiring penis she is faced with, she folds her legs and speaks
indistinctly. In that moment she seems uncomfortably familiar, like watching a
friend having sex or maybe an aspect of yourself.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;It is perhaps
interesting that it is amateur pornography these days that seems to inspire the
most complicated set of affects (unlike the schooled|disciplined and
predictable response to cinema) – shocked recognition of yourself and desire to
see it again, titillation, boredom but yet unwilling to look away, love for
celebrities, pleasure of viewing a body like yours and even sometimes a
recognition that this is what you look like during sex, fear about your own
privacy, disgust for what seems unacceptable and provokes the
moral|visual|auditory sensibilities and contempt for the material and the
people who possibly are genuinely engaged with it. The article on Pam and
Tommy’s video in Porn Studies infact displays these varied affects and
underlines William’s assertion that this bracket of material, behaviour and
practices that get termed pornography/pornographic does indeed deserve
analysis, otherwise a potentially unique and interesting way of understanding
the contemporary would be lost for squeamishness.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;There are many aspects of the Minette Hillyer’s
analysis (12) that are specifically relevant only to the American contexts –
the notoriety of both the stars, the pre-existence and glorification of home
videos in most families and the acknowledgement of amateur couple porn as even
a healthy practice, perhaps suggested for couples with dull sex lives. In
India, it was infact unknown people who were catapulted into the public eye with the circulation of their video, online and offline that was later titled Mysore Mallige ; not just
the private spaces, holidays and fucking habits of already-celebrities like Pam
and Tommy.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;What might be relevant here from Hillyer’s analysis is the
pre occupation with the realness of amateur pornography. The article follows the travels of the Pam and Tommy home video
between different categories/genres, depending on different aspects of its
realness. The video as such, contains scenes from the normal domestic lives of
the stars and a eight minute sequence of sex in an almost fifty minute length
video. So the questions of realness are answered not by the sex in the video,
but the mundane recording of their lives, holidays, house and other details.
This question of what exactly it is – home video or pornography (domestic/private
or pornographic/public) is relevant to questions of legality (for damages upto
90 million dollars), how it circulates (a pornographic video of Pam and Tommy
without the domestic padding perhaps would not be considered real and saleable)
and genre which relates to some aspects of how people respond to the work.&amp;nbsp; Ever since the advent of (cheap) video technology, pornography is rendered less
cinematic and more concerned with the presentational act (of sex) than its
representation (ibid). With MMS videos and hidden camera porn, though questions may no longer be about representation, they are still complicated questions about the aesthetics, reception of pornography and our relation to the technology that delivers it and for me viewing pornography today as only presentational does not help to understand the affects that surround and attach to it. Perhaps many strands of what is
explored in this article can be explored in relation to Mysore Mallige in the
next blog post.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Just as I finish this piece, after an interview with Nishant Shah at Center for Internet and Society, another question enters the frame in relation to pleasure, moving it beyond those raised above. Is pleasure now a question that
is less about finding the corporeal thrill through pornography online, as much as
pleasure that comes from simulation and the added rush of simulating cities,
lives, personalities online. And is that pleasure, pornographic?&lt;/p&gt;

But we need to do it in a proper way,” said department of telecom secretary R. Chandrasekhar, while addressing a Federation of Indian Chambers of Commerce and Industry (Ficci) conference on the issue of “legitimate restrictions on freedom of online speech".&lt;/p&gt;

&lt;p&gt;The Union government has been facing allegations of censorship after it sought to contain messages that led to communal violence and a panicexodus by people from the north-eastern states in some cities.&lt;/p&gt;
&lt;p&gt;Last month, the government ordered the blocking of almost 310 web pages for content deemed to be attacking particular communities. According to a post by Pranesh Prakash of the Centre for Internet and Society, 33% of them were on Facebook, 28% on Google Inc.’s YouTube and around 10% on Twitter.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Defending the government move, Gulshan Rai, chief of the Computer Emergency Response Team (CERT-in), said it was the first time that the emergency provision of the Information Technology Act 2008 had been exercised. Even though the list was not drawn up by his agency, due scrutiny was carried out before issuing orders to block the sites.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;This came after allegations that government may have also blocked bona fide posts as it sought to block content related to the North-East.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Twitter accounts of some journalists and other individuals associated with and sympathetic to right-wing causes were blocked, according to a list published earlier by The Economic Times.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"This is certainly not the last time we are seeing such a situation, so meaningful ways to respond to such complex situations will have to be devised," said Chandrasekhar.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He added that there was also a need to collaborate better with all stakeholders to devise not just defensive strategies during a crisis but also ways to contain its impact using the social media.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Ankhi Das, head of public policy at Facebook India, said that during the London riots of 2011, the UK government enlisted the support of social networking sites to dispel rumours.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"Social media can also be allies of the government at times like this," she said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Raman Jit Singh Cheema, a senior policy analyst at Google India, cited a similar example of authorities in Japan using such methods to send out correct information following the tsunami that hit the country in 2011.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"We need to collaborate on a continuing basis, so that when you are faced with such a crisis, you are able to deal with it," said Chandrasekhar.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The government has been facing allegations of Internet censorship for over a year after minister for communication and information technology Kapil Sibal raised the issue of regulating social networking sites. They had allegedly not complied with the government’s demand that offensive content be removed.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Chandrasekhar said that processes should be clearer, more transparent and well-defined.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"These need to be brought out in the form of some kind of a standard operating procedure, so that they (stakeholders) are expected to know how to conduct themselves and how they can expect the government to deal if a contingency arises," he said.&lt;/p&gt;

    <title>NE exodus: List containing 309 blocked URLs leaks online </title>

        &lt;b&gt;Latest reports coming in have confirmed that a list containing 309 URLs, whose ban the government had sought in light of the Assam violence and the subsequent NE exodus, has been leaked online.&lt;/b&gt;

&lt;p style="text-align: justify; "&gt;The aforementioned URLs comprise URLs, Twitter accounts, img tags, blog posts, blogs and a handful of websites, and were blocked between August 18, 2012 till August 21, 2012. In an analysis that Pranesh Prakash, programme manager at the Centre for Internet and Society (CIS), carried of the leaked items, among other things in his post, he wrote that, "It is clear that the list was not compiled with sufficient care."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In his post, he further noted that the censorship process itself has been riddled with egregious mistakes. Giving instances of the egregious mistakes, he added that even some people and posts debunking the rumours were blocked as part of the censorship. Further, he wrote that some of the items that were blocked were not even web addresses (e.g., a few HTML img tags were included). In his findings, Prakash also found that despite there having been a clear warning issued by the DIT pertaining to the blocking of "above URLs only" and not that of main websites, like www.facebook.com, www.youtube.com, some ISPs (like Airtel) went "overboard in their blocking". This incident,  in particular pertains to yesterday's reports, wherein it had been revealed that Airtel had blocked the entire YouTube short URL youtu.be in some cities.&lt;/p&gt;
&lt;p&gt;On account of the sensitivity of the issue, he writes that it &lt;i&gt;"would be premature to share the whole list&lt;/i&gt;." He, however, writes that CIS plans to make the entire list public soon. The list that CIS has released, however includes -&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;&lt;span id="advenueINTEXT" style="float: left; "&gt;Half  a century ago, India banned the DH Lawrence classic, Lady Chatterley's  Lover. The ban, though lambasted for its Victorian view of modesty and  obscenity, was fair and square; the matter was debated in the Supreme  Court, which upheld the ban. Over 50 years later, a diverse spectrum of  civil society has slammed a much more insidious and far less transparent  ban on internet pornography.&lt;br /&gt;&lt;br /&gt;For starters, the 857 sites that  vanished from India's internet sphere haven't been officially banned,  they just don't show up when you type the url. The order blocking them  isn't public. For a list of the 857 sites, one must rely on leaked  documents put out on Twitter by Pranesh Prakash, policy director, Centre  for Internet and Society. "The ban on Lady Chatterley's Lover was  public. As for the blocked websites, the government has gone out of its  way to hide the list of sites pulled down. A secret order banning  material violates all principles of transparency in a democracy," says  Prakash.&lt;br /&gt; &lt;br /&gt; The document, with 'Restricted' written on it, is a  letter from the department of telecom asking ISPs to disable 857 sites  as they bear content related to "morality" and "decency," violating  Article 19 (2).&lt;br /&gt; &lt;br /&gt; Strangely, the order's been issued under Sec 79  (3)(b) of the IT Act dealing with intermediaries having to remove  material used to commit unlawful acts. "Watching porn isn't illegal in  India. Disseminating 'obscene' content can be illegal, but for that, the  government must file a case against the sites, and they must be allowed  a representation," says Prakash.&lt;br /&gt; &lt;br /&gt; "Sec 79 (3)(b) of the IT act  isn't the section under which governments can block sites. It should use  Sec 69 that has a review process," says Nikhil Pahwa, a champion of  internet freedom.&lt;br /&gt; &lt;br /&gt; The government drew up its list of 857 sites  even as SC is in the process of hearing a petition to ban porn and is  yet to pass an order. It includes playboy.com that, says Prakash, is a  legitimate adult site. Pahwa points to the ban's "bizarrely moralistic  undertones".&lt;br /&gt; &lt;br /&gt; "As society evolves, government and regulatory  regime are stuck in medieval ages," he says, adding a ban on websites  will be rendered ineffective, pushing users to VPNs, a black hole for  government monitoring mechanisms.&lt;br /&gt; &lt;br /&gt; "A government that hasn't  succeeded with Make in India is trying to prevent Make out in India,"  says venture capitalist Mahesh Murthy, who earlier backed net  neutrality.&lt;br /&gt; &lt;br /&gt; "The government is blocking websites to keep  Rightwing lunatic fringes happy after its unsuccessful bid to pass the  land bill," says Murthy.&lt;br /&gt; &lt;br /&gt; "It isn't merely looking at blocking  porn, but is trying to bring back Sec 66A (IT Act), ruled  unconstitutional by the SC," he adds. "It's part of the bid to restrict  individual freedom, create an artificial separation between Indian  culture and anything erotic, driven by a diktat from Hindutva forces.  It's ironic as Modi came to power as someone looking to activate  individual agency. Now he's wary about where that leads to," says Subir  Sinha, professor at the School of Oriental and African Studies (London).  Murthy and Sinha believe the issue stems from a refusal to accept  Indian culture in totality. "Victorian morality is considered Hindu,  Khajuraho isn't," says Murthy.&lt;br /&gt; &lt;br /&gt; "The government seems to be  acting in a more high-handed manner than previous ones. The press and  public opinion should wake up to this," says sociologist Andre Beteille.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;Ld. Counsel for plaintiff prayed for ex-parte ad-interim injunction. He has filed the present suit for permanent and mandatory injunction against 22 defendants who are running their social networking websites under the name of Facebook, Google India (P) Ltd., Yahoo India (P) Ltd., Microsoft India (P) Ltd., Orkut, Youtube etc as shown in the memo of parties in the plaint.  It is submitted that plaintiff is an active citizen of India and residing at the given address and he believes in Secular, Socialist and Democratic India professing Muslim religion.  It is further submitted that the contents which are uploaded by some of the miscreants through these social networking websites mentioned above are highly objectionable and unacceptable by any set of the society as the contents being published through the aforesaid websites are derogatory, per-se inflammatory and defamatory which cannot be acceptable by any of the society professing any religion.  Even if the same is allowed to be published through these social networking websites and if anybody will take out the print and circulated amongst any of the community whether it is Muslim or Hindu or Sikh, then definitely there would be rioting at mass level which may result into serious law and order problem in the country. Where the miscreants have not even spare any of the religion, even they have created defamatory articles and pictures against the Prophet Mohammad, the Hindu goddess Durga, Laxmi, Lord Ganesha and many other Hindu gods which are being worshiped by the people of Hindu community. It is prayed by the counsel for plaintiff that the defendants may be directed to remove these defamatory and derogatory articles and pictures from their social websites and they should be restrained from publishing the same anywhere through Internet or in any manner.  It is further submitted that the social websites are being utilised by the every person of whatever age of he is whether he is 7 years old or 80 years old.  These defamatory articles will certainly corrupt not only young minds below the 18 years of age but also corrupt the minds of all age group persons. It is further submitted that even the miscreants have not spared the leaders of any political party whether it is BJP, Congress, Shiv Sena or any other political party doing their political activities in India, which may further vitiate the minds of every individual and may result into political rivalry by raising allegations against each other.&lt;/p&gt;
&lt;p&gt;I have gone through the record carefully wherein the plaintiff has also filed a CD containing all the defamatory articles and photographs, plaintiff also wants to file certain defamatory and obscene photographs of the Prophet Mohammad and Hindu Gods and Goddesses.  Photographs are returned to the plaintiff, although, the defamatory written articles are taken on record. Same be kept in sealed cover.&lt;/p&gt;
&lt;p&gt;In my considered opinion, the photographs shown by the plaintiff having content of defamation and derogation against the sentiments of every community. In such circumstances, I am of the view that the plaintiff has a prima facie case in his favour. Moreover, balance of convenience also lies against the defendants and in favour of the plaintiff.  Moreover, if the defendants will not be directed to remove the defamatory articles and contents from their social networking websites, then not only the plaintiff but every individual who is having religious sentiments would suffer irreparable loss and injury which cannot be compensated in terms of money.  Accordingly, in view of the above discussion, taking in consideration the facts and circumstances and nature of the suit filed by the plaintiff where every time these social networking websites are being used by the public at large and there is every apprehension of mischief in the public, the defendants are hereby restrained from publishing the defamatory articles shown by the plaintiff and contained in the CD filed by the plaintiff immediately on service of this order and notice. Defendants are further directed to remove the same from their social networking websites.&lt;/p&gt;
&lt;p&gt;Application under Order 39 Rule 1 &amp;amp; 2 CPC stands allowed and disposed of accordingly.&lt;/p&gt;
&lt;p&gt;Summons be issued to the defendants on filing of PF/RO/Speed Post.  The defendants having their addresses in different places may be served as per the provisions of Order 5 CPC. Reader of this court is directed to keep the documents and CD in a sealed cover.  Plaintiff is directed to get served the defendants along with all the documents. Plaintiff is further directed to ensure the compliance of the provisions under Order 39 Rule 3 CPC and file an affidavit in this regard. Copy of this order be given dasti.&lt;/p&gt;

    <title>MPs oppose curbs on internet; Sibal promises discussions</title>

        &lt;b&gt;With MPs raising concerns over open-ended interpretations of restrictive terms in the rules seeking to regulate social media and internet, the government promised to evolve a consensus on points of contention.&lt;/b&gt;

&lt;p&gt;Telecom minister Kapil Sibal's assurance came at the end of an engrossing debate in Rajya Sabha on a motion moved by CPM MP P Rajeeve who said the rules violated freedom of expression and free speech.&lt;/p&gt;
&lt;p&gt;He found support from leader of opposition &lt;a class="external-link" href="http://timesofindia.indiatimes.com/topic/Arun-Jaitley"&gt;Arun Jaitley&lt;/a&gt; who picked several examples to point out that terms or descriptions like "harmful", "blasphemous" and "defamatory" did not lend themselves to precise legal definitions.&lt;/p&gt;
&lt;p&gt;Jaitley said what the government may find defamatory may not be seen in similar light by its critics. He also pointed to the difficulties of controlling technology and asked if it was desirable to do so.&lt;/p&gt;
&lt;p&gt;Assuring MPs who sought the annulment of 'rules' which are aimed at regulating internet content, &lt;a class="external-link" href="http://timesofindia.indiatimes.com/topic/United-Company-RUSAL"&gt;Sibal&lt;/a&gt; said, "My assurance to the House is that I will request the MPs to write letters to me objecting to any specific words. I will then call a meeting of the members as well as the industry and all stakeholders. We will have a discussion and whatever consensus emerges, we will implement it."&lt;/p&gt;
&lt;p&gt;The move to put rules in place flows from the government's annoyance with what it sees as scurrilous and disrespectful comments about senior Congress leaders. It had suggested pre-screening of content which service providers were reluctant to consider.&lt;/p&gt;
&lt;p&gt;The motion for annulling the Information Technology (Intermediaries Guidelines) Rules notified in April 2011 was, however, defeated by a voice vote. Justifying the rules, the minister said "these are sensitive issues" as most internet companies were registered abroad and not subjected to Indian laws.&lt;/p&gt;
&lt;p&gt;TOI was first to report about the new rules that put a lot of the onus on intermediaries like internet service providers, Facebook and Twitter, to manage and monitor content produced by their users. Web activists believe the IT rules are open to arbitrary interpretation and can be misused to silence freedom of speech.&lt;/p&gt;
&lt;p&gt;Google, which participated in the public consultative process before the rules were framed, had told TOI, "If Internet platforms are held liable for third party content, it would lead to self-censorship and reduce the free flow of information."&lt;/p&gt;
&lt;p&gt;Moving the motion, Rajeeve said, "I am not against any regulation on internet but I am against any control on internet... In control, there is no freedom... These rules attempt to control internet and curtail the freedom of expression."&lt;/p&gt;
&lt;p&gt;Complimenting the CPM member, Jaitley said, "I think he (Rajeeve) deserves a compliment for educating us on this rule that Parliament has a supervisory control as far as subordinate legislations are concerned, and, if need be, we can express our vote of disapproval to the subordinate legislations."&lt;/p&gt;
&lt;p&gt;MPs felt the government should consider a regime where offensive content can be removed immediately after being posted rather than trying to sieve it out.&lt;/p&gt;
&lt;p&gt;Noting that it is extremely difficult, if not impossible, to defy technology and that the days of withholding information have gone, Jaitley urged the minister to "reconsider the language of restraints" to prevent its misuse. He pointed to certain words - harmful, harassing, blasphemous, defamatory - used in the rules, explaining how these could be interpreted/misinterpreted at any stage.&lt;/p&gt;
&lt;p&gt;The MPs did note that the internet had a risk of inciting hate speech and frenzy in society and therefore it needed to be restrained but the device could be swift identification of objectionable content.&lt;/p&gt;
&lt;p&gt;Pranesh Prakash of Centre for Internet and Society, an organization that has been advocating withdrawal of the rules, said he was sad with the outcome in Rajya Sabha. "The IT minister has promised to hold consultations but the ideal way to do so would have been to scrap the rules and start from scratch," he said.&lt;/p&gt;
&lt;p&gt;"It's not only about language in these rules. There is a problem with provisions like the one that empowers intermediaries to remove content without notifying the user who had uploaded the content or giving users a chance to explain themselves."&lt;/p&gt;

        &lt;b&gt;A motion in the Rajya Sabha has sought annulment of the IT intermediary guidelines, writes Deepa Kurup in this article published in the Hindu on April 22, 2012.&lt;/b&gt;
        
&lt;p&gt;A research, or a sting operation, conducted by researchers at the Centre for Internet and Society in October 2011 — a few months after the Information Technology (Intermediary Guidelines) Rules were notified — revealed some inherent flaws in the guidelines laid down by the Indian government. The results of the study made news, particularly after Union Minister for IT, Kapil Sibal, asked Internet companies and Web service providers to screen content.&lt;br /&gt;&lt;br /&gt;The study revealed that companies were only too eager to comply with take-down notices or requests, in order to avoid further hassles, particularly legal ones.&lt;br /&gt;&lt;br /&gt;Rishab Dara, a researcher who was part of this ‘sting', pointed out that unless the content was commercial, or had potential commercial interest, companies preferred to err on the side of caution.&lt;br /&gt;&lt;br /&gt;Addressing an audience at a panel discussion, titled ‘Resisting Internet censorship: strategies for furthering freedom of expression in India', held at the Bangalore International Centre, Mr. Dara pointed out that search engines did not invest enough resources to check how valid the claims were, before taking down over 2,000 URLs related to a random complaint or take-down notice sent by them. His study underlined the need for debate and discussion on the intermediary guidelines, locating this in the larger context of freedom on the Web.&lt;br /&gt;&lt;br /&gt;The discussion, organised by the Centre for Internet and Society, was moderated by the former journalist and academic, Paranjoy Guha Thakurta. The audience and the panel comprised a diverse lot: from students, netizens and academics to those who were directly involved in the business of publishing content or hosting Web content. While a substantial part of the discussion dealt with the legal aspects of the notified rules, and how it may contradict the constitutional rights of citizens, a section of the debate also delved into whether the Web as a medium needed to be policed at all.&lt;br /&gt;&lt;br /&gt;If panellist Mahesh Murthy, Chief Executive Officer of Pinstorm, argued vociferously for unfettered freedom on the Web and accused the government of being threatened by movements such as the anti-corruption campaign led by Anna Hazare (which he said was largely mobilised on the Web), another panellist Na. Vijayshankar, Cyber Law College, who claimed he was among those instrumental in bringing down the pornographic cartoon portal Savitabhabhi.com, argued that though these rules need to be withdrawn, there are “boundaries” to what can be posted and said on the Web.&lt;br /&gt;&lt;br /&gt;Another section of the audience brought up the issues of hate speech on the Web, and pointed out that in some cases there was a need to pin liability on those who generate content that incites hatred.&lt;br /&gt;&lt;br /&gt;Sudhir Krishnaswamy, Centre for Law and Policy Research, pointed out that currently the way the issue was being played out in court, the discourse was more about companies.&lt;br /&gt;&lt;br /&gt;“The debate is not about users today. Companies are trying to duck liabilities, rather than deal with substantive issues of free speech,” he said, pointing to the complexities in locating liability for content.&lt;br /&gt;&lt;br /&gt;Speaking from the publisher's perspective, B.G. Mahesh, OneIndia.in, an online news and entertainment portal, spoke of specific cases where his portal had been targeted by the Chennai Cybercrime cell for hosting a news story (syndicated from a news agency) that was declared defamatory. “We took it down, but there was no answer from them when we asked for an explanation,” he said, adding that in such cases there is tremendous pressure and harassment from authorities, leaving publishers with no choice but to comply.&lt;br /&gt;&lt;br /&gt;Though the IT intermediary rules were notified in April 2011, the issue made headlines when Union Minister for Information and Communication Technology Kapil Sibal asked private companies or Web service providers to pre-screen content, a statement which he later withdrew.&lt;br /&gt;&lt;br /&gt;Also discussed in detail were the complexities posed by a medium like the World Wide Web, and what were the reasonable restrictions to free speech on the Web. Does one need a separate legal dispensation to deal with this medium, Mr. Thakurta asked. While emphasising that the solution does not lie in “knee-jerk reactions”, such as the rules that have been proposed, he pointed out that the bid to control flow of information was a simple manifestation of the utter helplessness and inability of the government — and governments worldwide — to control the Web. Be it in West Bengal, where a professor is held for sharing a cartoon, or with the Union government that beckons corporates to pre-screen the Web, these acts are a manifestation of a “combination of arrogance and stupidity”, he said.&lt;br /&gt;&lt;br /&gt;Subsequently, in February, Rajya Sabha member from Kerala, P. Rajeeve, moved a statutory motion in the Rajya Sabha seeking that these guidelines be annulled on the grounds that it allowed intermediaries protection from legal liability in return for trading away freedom of expression of users.&lt;br /&gt;&lt;br /&gt;In the Parliamentary session that will start next week, this is likely to come up for discussion, and across the country, rights activists are mobilising support and lobbying with legislators to garner support for this annulment.&lt;/p&gt;

This was followed by the Modi government’s proposal to amend the Information Technology rules for social media platforms like WhatsApp, Facebook and Twitter to “proactively identify, remove or disable access to unlawful information or content” in order to curb fake news online.&lt;/b&gt;

&lt;h3 style="text-align: justify; "&gt;No concrete steps taken by either NDA or UPA to enact laws for surveillance reform&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The &lt;a href="http://egazette.nic.in/WriteReadData/2018/194066.pdf"&gt;MHA order&lt;/a&gt; which  gives 10 government agencies the power to intercept, monitor and  decrypt ‘any information’ generated, transmitted, received, or stored in  any computer, reaffirms the sorry state of communication surveillance  law in India. This is reflected in the lack of judicial review, minimal  legislative oversight and no regard for the principles of necessity,  proportionality, user notification and transparency.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Despite detailed &lt;a href="http://planningcommission.nic.in/reports/genrep/rep_privacy.pdf"&gt;recommendations&lt;/a&gt; by  the Committee of Experts led by Justice AP Shah back in 2013, there  have been no concrete steps taken by either the current NDA government  or the previous UPA government to enact laws for surveillance reform.  The &lt;a href="http://meity.gov.in/writereaddata/files/Personal_Data_Protection_Bill,2018.pdf"&gt;draft bill&lt;/a&gt; by  the committee led by Justice Srikrishna does refer to the principles of  necessity and proportionality, but stops short of recommending an  overhaul of the surveillance regime. This notification is but merely the  logical next step in the existing framework for communications  surveillance.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;On the other hand, the &lt;a href="http://meity.gov.in/writereaddata/files/Draft_Intermediary_Amendment_24122018.pdf"&gt;draft amendments&lt;/a&gt; to  the IT Act regulations seek to address the problem of ‘unlawful  content’ and seem to stem largely from concerns about the use of  platforms like Facebook and WhatsApp to spread disinformation and impact  electoral processes in India. To that extent, these steps are misguided  and betray a failure to engage with the actual problem. Already, the  powers of content moderation exercised by online platforms suffer from  problems of transparency and accountability. The draft regulations will  only serve to compound this problem while unreasonably expecting the  platforms to exercise powers which should require judicial  determination.&lt;/p&gt;

for Internet and Society have been studying website blocking by internet
 service providers (ISPs) in India. We have learned that major ISPs 
don’t always block the same websites, and also use different blocking 
techniques. &lt;strong&gt;To take this study further, and map net neutrality violations by ISPs, we need your help.&lt;/strong&gt;
 We have developed CensorWatch, a research tool to collect empirical 
evidence about what websites are blocked by Indian ISPs, and which 
blocking methods are being used to do so.  in India. Through their work, they demonstrated that major ISPs in 
India use different techniques to block websites, and that they don’t
