    <title>An online community platform for people with different needs</title>

        &lt;b&gt;An online community platform designed for the print-impaired, probably the first such in the country, seeks to make the internet accessible to people with different needs.&lt;/b&gt;
        
&lt;p&gt;The platform, inclusiveplanet.com, came about after Chennai based Rahul Cherian realised while taking part in the 2008 discussions of the world blind union centering around the WIPO treaty for the blind, that there was a 'massive resource' problem that technology would fix.&lt;/p&gt;
&lt;p&gt;Cherian said he represented India in Washington when WBU drew up a treaty with the aim of enabling people with disabilities.&lt;/p&gt;
&lt;p&gt;The platform is basically drawn up for the print-impaired with the aim of facilitating content-sharing, information sharing and relationship building, Cherian said.&lt;/p&gt;
&lt;p&gt;"The term 'print-impaired' implies that for some reason, physical (such as visual impairment or bodily paralysis) or cognitive (such as dyslexia), the person is unable to access content that is in a 'print' format i.e. words, images and symbols on paper or on screen."&lt;/p&gt;
&lt;p&gt;"For such persons content has to be accessed in a wholly different way. In the past, options were limited to Braille and human voice; today, the digital world enables other solutions 'including text-to-speech software,which effectively ensures that content in most text formats can be 'read out' to print impaired persons."&lt;/p&gt;
&lt;p&gt;Cherian and his team worked with organisations working with persons with print impairment to understand what the best solutions would be.&lt;/p&gt;
&lt;p&gt;"The more we were exposed to the nature of the problems faced by the community, the more apparent it became what the solutions needed to look like. It is an evolving iterative effort that has been changing shape to meet the problem intelligently. "&lt;/p&gt;
&lt;p&gt;It uses technology that helps converts text to speech. The screen readers assist visitors to navigate the website, including text-to-speech software, which effectively ensures that content in most text formats can be 'read out' to print impaired persons.&lt;/p&gt;
&lt;p&gt;"Inclusive Planet is a social enterprise and our object is to become sustainable through revenue generation and not through fund raising. We have been supported by the Centre for Internet and Society in Bangalore who have given us office space and countless hours of advice and help," he said.&lt;/p&gt;
&lt;p&gt;There are more than 250 million print-impaired persons in the world of whom over 150 million live in developing nations and the site has been designed to address the needs of this community.&lt;/p&gt;
&lt;p&gt;Currently, the platform is available in English, Turkish and Arabic. Members created the Turkish and Arabic versions.&lt;/p&gt;
&lt;p&gt;"We look forward to creating inclusiveplanet.com in various regional languages. Members from India are already sharing content in various regional languages, including Hindi, Tamil, Kannada, Bengali, Telugu and Gujarati," Cherian said.&lt;/p&gt;
&lt;p&gt;The platform was originally offered in English.&lt;/p&gt;
&lt;p&gt;Cherian said that most important is what these members have done and are doing' "they have shared 17500 pieces of accessible content (audio, books in text format etc.), created 260 topical channels for discussion and content sharing, published 13605 comment posts and had 100,000 plus conversations on the platform."&lt;/p&gt;
&lt;p&gt;Gopalakrishnan, Training Officer in Charge, National Institute of Visually handicapped, finds the site very useful and disabled friendly.&lt;/p&gt;
&lt;p&gt;Instead of going to the library, college-going students can upload and download books, utilising it, he said.&lt;/p&gt;
&lt;p&gt;He has also started an education channel on the site, beneficial for the disabled. "I post material on the site and those interested can download or upload it," he said.&lt;/p&gt;
&lt;p&gt;The software has been designed and created keeping in mind the needs and challenges of the print impaired community. However it is accessible to a wide range of people, due to the simple design, Cherian said.&lt;/p&gt;
&lt;p&gt;Asked if a visually impaired person can be taken for a ride while accessing a website like tourism travel, he said "Everything on the page is visible to the screen reader that is used by most visually impaired persons. There is no scope for a visually impaired person to be unaware of whatÂ’s happening on the page.&lt;/p&gt;
&lt;p&gt;For InclusivePlanet.com, it makes sense to be inclusive as the target market is the print impaired community.&lt;/p&gt;
&lt;p&gt;"We also believe that it makes business sense for all organisations to be inclusive as there are 250 million print impaired people across the world and they form an important market that have specific needs."&lt;/p&gt;
&lt;p&gt;There is a huge opportunity for various organisations to develop products and services that include the print impaired community. "For example the travel market in the US for persons with disabilities is a few billions dollars," Cherian said.&lt;/p&gt;
&lt;p&gt;Inclusive planet has a staff strength of 15 and is based out of Bangalore, Chennai and Kochi "with few of us living in each city," Cherian added.&lt;/p&gt;

Maureen asked questions regarding the status of disabled persons in Qatar, the level of ICT accessibility awareness for PWDs in Qatar, efforts of the Qatar Government towards Mada relating to policy measurements, schemes for PWDs, etc.&lt;/b&gt;
        
&lt;p class="callout"&gt;&lt;strong&gt;Following is the transcript of an interview by Maureen, a CIS consultant from Uganda with David Banes, Deputy Director, Mada Assistive Technology Centre, Qatar:&lt;br /&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;ol&gt;&lt;li&gt;&lt;strong&gt;What is the status of disabled persons in Qatar or Mada in terms of number, age and gender and the kind of the work Mada is engaged in?&lt;br /&gt;&lt;/strong&gt;There are officially some 10,000 disabled people in Qatar across a wide range of needs. This doesn’t include people who are ageing and acquiring moderate disabilities as a result of their age. Mada works with any disability, any age for any purpose, supporting both Qatari citizens and residents. We work with both men and women including the Arabic and non-Arabic speaking visitors.&amp;nbsp;&lt;/li&gt;&lt;li&gt;&lt;strong&gt;What is the level of ICT accessibility awareness for PWDs in Qatar?&amp;nbsp;&lt;/strong&gt;&lt;br /&gt;As more and more people in Qatar use ICT every day so the awareness of barriers is increasing. Mada has been working hard to raise public awareness through cinema, television and radio ads and even video ads in the local shopping malls! More importantly we are working hard to make sure that disabled people are aware of the potential of technology to change their lives, and so we work closely in partnership with other services for people with a disability to integrate accessibility activity.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Are there any efforts of the Qatar Government towards Mada in terms of policy measures, programmes, schemes for PWDs? How about efforts by companies or universities?&lt;/strong&gt;&lt;br /&gt;IctQatar currently has an e-accessibility policy out for consultation. The policy is wide ranging and offers detailed expectations across the public sector for websites, but also requires accessible ATM’s, telephone and emergency services to be introduced. &lt;br /&gt;&lt;br /&gt;&lt;img src="https://cis-india.org/home-images/David1.jpg/image_preview" title="Maureen Interview 1" height="266" width="330" alt="Maureen Interview 1" class="image-inline image-inline" /&gt;&lt;br /&gt;&lt;/li&gt;&lt;li&gt;&lt;strong&gt;What is the situation of copyright law in Qatar?&amp;nbsp;&lt;/strong&gt;&lt;br /&gt;Copyright and IPR are both respected in Qatar. We are delighted that creative commons is being introduced to the country allowing for alternative formats of documents to be more readily produced.&lt;br /&gt;&lt;em&gt;Do you have&amp;nbsp;an exception in your copyright law permitting conversion into any format for the disabled without permission?&lt;/em&gt;&amp;nbsp;&lt;br /&gt;Not yet.&amp;nbsp;&lt;/li&gt;&lt;li&gt;&lt;strong&gt;What is the level of development at Mada in terms of assistive technologies? Specifically screen readers in Arabic.&lt;/strong&gt;&lt;br /&gt;Mada is extremely busy in supporting both commercial and open source development of AT in Arabic. We have eight projects due to announce in the very near future. Screen readers are well developed in Arabic, but we are looking forward to seeing a more basic text to speech tool created to lower the cost of entry point for blind users on a limited budget.&lt;/li&gt;&lt;li&gt;&lt;span class="Apple-style-span"&gt;&lt;strong&gt;Does Mada have any collaborative development with surrounding Arabic nations?&lt;br /&gt;&lt;/strong&gt;We welcome collaborations across the region and internationally. We speak regularly to organisations in Dubai, Abu Dhabi and then more widely to Egypt and Tunisia. Collaboration is very much central to our approach.&lt;/span&gt;&lt;/li&gt;&lt;li&gt;&lt;span class="Apple-style-span"&gt;&lt;/span&gt;&lt;strong&gt;Approximately how many organizations are working actively in Qatar on accessibility for Persons with Disabilities? (Name any)&lt;/strong&gt;&lt;br /&gt;Mada is the hub for accessibility in Qatar. One ambition is to establish an online forum whereby the views of disabled people on priorities for digital inclusion can be gleaned.&amp;nbsp;&lt;/li&gt;&lt;li&gt;&lt;strong&gt;And what are the kinds of resources that PWDs would find useful if they had access to?&lt;/strong&gt;&lt;br /&gt;Great levels of Arabic accessible digital content and Arabic supported assistive technologies.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;There is a draft ICT accessibility legislation. What are your different target audiences?&lt;/strong&gt;&lt;br /&gt;Training people with a disability in both accessible IT training and assistive technologies&lt;br /&gt;Professionals including teachers and therapists&lt;br /&gt;Parents and family&lt;br /&gt;IT professionals including Web developers&lt;br /&gt;Human resource professionals and employers.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;How many people have you trained to date? &lt;/strong&gt;&lt;br /&gt;Over 200 including the first accredited AT training in Qatar for 20 participants.&amp;nbsp;&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Anything about Mada disability legislation which is relevant to ICT accessibility?&amp;nbsp;&lt;/strong&gt;&lt;br /&gt;N/A.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Did Qatar sign the UNCRPD? How is implementation going on?&lt;/strong&gt;&lt;br /&gt;Yes, Mada is a direct response to that action.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Any specific details about web accessibility, audits/ evaluations conducted to look at accessibility of public web sites- details. (Any report which is available in English?)&lt;/strong&gt;&lt;br /&gt;We are completing an initial benchmarking study currently – no details have yet been made available. We are completing around 2 full site audits a month on major private and govt sector websites and feedback is being provided directly to those organisations to develop an action plan.&lt;/li&gt;&lt;/ol&gt;

&lt;h2&gt;About the Mada Centre&amp;nbsp;&lt;/h2&gt;
&lt;p&gt;&lt;strong&gt;Mada (Qatar Assistive Technology Centre)&lt;/strong&gt; is committed to using assistive technologies (AT) as a means of creating more accessible workplaces. As part of connecting people with disabilities to the world of information and communication technology, Mada launched a nationwide accessibility initiative with its partners, Qatar Telecom (Qtel) and Vodafone Qatar on 7 December 2010. The purpose of the initiative named "Connected" will ensure that persons with disabilities do not have to pay more than others to use mobile telecommunications technology.&lt;/p&gt;
&lt;p&gt;The centre enables adults and children with disabilities to use computers, mobile devices and the Internet at home by offering a full range of&amp;nbsp; services and resources related to assistive technologies. At Mada, people of all ages, with any type of disability are able to visit the interactive resources centre to try out the latest assistive technology and access assessment and training services. The Mada team is able to assist in choosing a suitable solution through impartial and expert advice.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Programme Manager&lt;/strong&gt;&lt;br /&gt;&lt;strong&gt;Centre for Internet and Society, India&lt;/strong&gt;&lt;br /&gt;&lt;a href="https://cis-india.org/" class="external-link"&gt;Centre for Internet and Society, India&lt;/a&gt;&lt;/p&gt;
&lt;p&gt;Nirmita Narasimhan is a Programme Manager with the Centre for Internet and Society and works on policy research and advocacy related to IP reform and technology access for persons with disabilities. She was awarded the National Award for Empowerment of Persons with Disabilities by the President of India in recognition of her work in December 2010. Her work ranges from research and policy drafting and review to advocacy through campaigns, workshops etc.&lt;/p&gt;
&lt;p&gt;Nirmita’s current work focuses on copyright reform, accessibility, engaging in international discussions on IP related instruments at the World Intellectual Property Organisation, working with disability organisations, governments and UN bodies in advocating for digital accessibility, promoting open access with the Government of India and other issues which are part of the policy space in ICT accessibility in India. Certain specific areas on which she has worked are formulation of the draft National Electronic Accessibility Policy (with the Department of Information Technology), reviewing the Indian Copyright Act and working towards amendments to the Act to include exceptions and limitations for the print challenged, working at a national level towards support of the World Blind Union treaty at the WIPO, organising workshops on web accessibility for web developers in different cities around the country, working towards making accessible materials available for the visually challenged, creating advocacy resources for disability organisations and policymakers on implementing different aspects of the UNCRPD related to ICT accessibility etc. Nirmita’s work can be viewed at www.cis-india.org. Nirmita has presented papers in international fora like the IGF and the Asia Pacific conference on mainstreaming ICT technologies which was held in Bangkok in August 2009. Her focus was primarily policy formulation for ICT and electronic accessibility. She has also contributed to the G3ICT -ITU e-accessibility toolkit for policymakers which was published on line in February 2010and was editor of its print handbook version which was released in Delhi in October 2010. Since then, Nirmita is also part of the G3ict editorial team. Nirmita participated in the Right to Read event held in the European parliament in May 2010 and participated in the UN expert committee on implementation of the UNCRPD with respect to ICT and electronic accessibility for persons with disabilities in developing countries in June 2010. Nirmita has prepared reports in the capacity of expert for ITU and UNESCO on accessible mobile telephony and accessible ICT for education in the Asia Pacific region.&lt;/p&gt;
&lt;p&gt;Nirmita is also a proficient Karnatic classical music singer and has been giving performances for many years now.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;What would you say are the most challenging and the most satisfying aspects of your work?&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;One of the most challenging aspects of my work has been to make people from diverse backgrounds realise the need for accessibility and take action on it. I often encounter ignorance about the needs of persons with disabilities and a lack of sensitivity to their need for independence and dignity. It is very difficult to remain objective when faced with attitudes that consider dependence on others as an inevitable side affect of disability, instead of trying to see how attitudes and procedures can be improved to encourage and support independence. Dealing with people who are closed to new ideas and bringing them to an intelligent comprehension of disability is a difficult task. Another really challenging aspect of my work has been to try and build consensus amongst different organisations to work together towards a common goal.&lt;br /&gt;&lt;br /&gt;The most satisfying aspect of my work is seeing the value it provides to people and how lives will become better because of some change I have worked towards bringing about. For instance as a result of the Right to Read campaign, the parliamentary Standing Committee recognised that the proposed wording in the new draft copyright bill was discriminatory and recommended that the concerns of disability groups be taken on board. This amendment will open up the world of books and knowledge to approximately 70 million persons with disabilities in India. Similarly when the Government comes out with an electronic accessibility policy, it will mean that eventually 7000 government web sites will become accessible to persons using assistive technologies. Another example of satisfaction was when the USOF started a process for including persons with disabilities in their pilot project scheme.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;What qualifications or certifications did you attain in order to reach your professional goals?&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;I have a Bachelors degree in law. But more than just qualifications or certifications, I have learnt and achieved mostly through my experience and interaction with people around me.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;If there is one message you would like to convey to young women to encourage them to consider a profession in the ICT sector, what would it be?&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;ICT can truly be a great equalizer since it opens up limitless opportunities for persons with disabilities and the world to benefit from each other. As a person with a disability myself, I have experienced firsthand the transforming power of ICT in my life. Despite not having an ICT background to start with, today I am working in the field of ICT and Accessibility. One of the lessons I have learnt on my journey is that one should not be afraid of trying new things for fear of failure or be hesitant to ask for help in the course of one’s life. Failures and dependence upon people are a part of every person’s life and should not be construed as a sign of individual weakness or weakness stemming from disability. For many people around the world, ICT has made it possible to live more or less independently and participate on an equal basis with the rest of society. I strongly urge all girls and women to take up a career using ICT as it will prove to be an invaluable tool to live a more independent life.&lt;/p&gt;

    <title>An India Where the Disabled have a Choice</title>

        &lt;b&gt;The Roundtable on Digital Access to the Disabled held in Bangalore brought forward many issues related to the topic. Dr. Nirmita Narasimhan, Policy Director, Centre for Internet and Society speaks to Dr. Archana Verma about the problems faced by the disabled while using technology. Being herself partially visually impaired, this is an interview from an expert as well as the personal experiences of a person from the disabled group.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;This interview was &lt;a class="external-link" href="http://www.dqindia.com/an-india-where-the-disabled-have-a-choice/"&gt;published in Dataquest&lt;/a&gt; on August 5, 2016.&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Q-Please throw some light on the  issue of the inaccessibility of mobile apps to the disabled, since these  have become essential for independent living today.&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While mobile apps are fast becoming the preferred and often the only  way to access services, these remain unavailable to a large section of  the Indian population living with disabilities. This is because they are  not designed in a way which conforms to standards of accessibility and  cannot be used by persons using assistive technologies such as screen  readers. Apps such as Ola, Uber, Big Basket, Make my trip, Flipkart,  Myntra and most others are not completely accessible. The  inaccessibility varies from total inaccessibility, where the screen  reader remains absolutely silent and is unable to give any information  to the user opening the app, to partially inaccessible, disallowing  persons using screen readers from accessing complete information or from  completing transactions. For instance, if one opens Flipkart, one hears  a button labelled home page banner and then the screen reader just  keeps saying button for whatever is pressed, without being able to give  any information on what the buttons are for or what is written there.  Similarly, if one opens Myntra, one doesn’t hear any information at all,  just a series of clicks, at one point one hears buttons labelled for  man, for women, for kids and then when one presses any of those, one is  again greeted by complete silence. The Big Basket app also has problems  such as unlabelled buttons and fields and makes it difficult to carry  out transactions such as changing the quantity, changing the address  etc.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is rather sad that the IT industry fails to realise that persons  with disabilities, a group which is the world’s largest minority and  account for a very large percentage of our population can potentially be  amongst the biggest consumers of these ICT products and services.  Consider before the advent of technology, a blind person could not read  mainstream books and newspapers, work in routine office environments,  shop alone or pay bills, file returns etc. on his/her own. Now, when  everything can be done on line and there is technology which can read  out and assist blind persons to use computers/ phones themselves, they  offer the opportunity to negate the limitations of disability. However,  this is not happening because products and services are not designed and  developed in compliance with standards of accessibility and universal  design, resulting in them being ineffectual or useless for persons using  assistive technology. If the apps and websites conform to accessibility  standards, Developers need not test their software against each and  every disability, which can get understandably complicated, they are  automatically accessible to persons with different disabilities in one  way or another.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While accessing necessary services and information itself  is challenging and often impossible for the disabled, the ability to  access and enjoy games like other people is completely beyond  imagination, not even something one could dream of said a friend of  mine. I asked my friend Dinesh Kaushal, an accessibility expert who  heads development of NVDA, an open source screen reader for the blind in  India what his experience with the new gaming app Pokemon Go was, which  is all the rage nowadays and he said that it was completely  inaccessible. There is absolutely no information on the game screen and  the Android screen reader Talk Back is absolutely silent. And this  according to him this is not uncommon in many gaming apps.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Q- Highlight some of the problems related to the inaccessibility of websites and content to the disabled.&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Web site inaccessibility very often hinders a person using assistive  technology from accessing information on the internet. A web site can be  inaccessible for different persons because of different reasons,  depending upon the disability. However, this can be solved by compliance  with standards. Inaccessibility of websites also hinders accessing  content on mobile phones or affects persons with limited bandwidth or  elderly persons.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While progress is being made to make government web sites accessible,  this has not yet been completely achieved. In addition, web sites of  important services and organisations such as banks, health care,  education etc. are often inaccessible. Often a person using a screen  reader may come across an important document which is an image file and  cannot be read by the screen reader or a deaf person cannot enjoy an  audio visual clip because there are no sub titles. Web sites with  frequent flashing and flickering, constantly changing pages, images  without descriptions and unlabelled form fields and headings, audio  visual media content without subtitles, image files of documents without  alternate accessible format options continue to populate the Internet.  Unless web site accessibility is taken seriously and is treated as a  non-negotiable ingredient of a contract for web site development and  maintenance, the Internet will continue to be inaccessible.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Q- Can you enumerate the policy and guidelines requiring web  site accessibility and the large spread of non-compliance with them?&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Although most transactions happen online today, the fact that  websites do not conform to universal standards of accessibility render  them unusable by persons with disabilities.&lt;br /&gt; The World Wide Web consortium has had accessibility standards for web  site accessibility for over a decade now and these have been adopted by  many countries around the world. This standard is known as the Web  Content Accessibility Guidelines (WCAG) 2.0. India also notified the  Guidelines for Indian Government Websites (GIGW) which borrows from the  WCAG 2.0 to ensure that government websites are accessible. The National  policy on universal electronic accessibility was notified in October  2013 and requires conformance to standards of accessibility. It mentions  W3C standards such as WCAG 2.0, ARIA and ATAG and identifies  procurement as a route to make electronic infrastructure accessible. It  also identifies strategies such as awareness raising, training, research  and development of assistive technology as vital to implementation of  the policy and allocates different roles to different stake holders,  including to ministries, departments, private organisations, etc. Other  commitments are to be found in the accessible India and digital India  campaigns, commitments under the UN Convention on the Rights of Persons  with Disabilities (UNCRPD) which requires government to make all ICT and  Internet available and accessible to persons with disabilities and  encourage private service providers to make their services accessible,  Access to ICTs are also covered under the goals of the Incheon Strategy  to make the rights real for persons with disabilities.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Q-&lt;/b&gt; &lt;b&gt;Give us some information about the work  of the Centre for Internet and Society (CIS) in the realm of the digital  and technological accessibility for the disabled.&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;We are an eight year old organisation. Our accessibility programme works in multiple ways, which include the following –&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;(A) Policy research and advocacy&lt;/b&gt; (initiating and  contributing to new and existing policy discussions to bring digital  accessibility on the agenda: We started our work on 3 issues:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;(a)Website and electronic accessibility&lt;/b&gt; – We  produced research on what different countries have in terms of policies,  guidelines and measures to promote website and electronic accessibility  and worked with the Department of Electronics and information  technology (DEITy) to formulate the National Policy on Universal  Electronics accessibility which was notified in 2013. We also serve on  the Implementation committee.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;(b) Getting an exception into the Indian Copyright Act&lt;/b&gt; to allow conversion of books and other copyrighted works into  accessible formats without the need to get permission from copyright  holders. We provided research to MHRD on what other countries have in  terms of copyright exceptions to promote access to published works for  persons who are blind, have low vision or other print disabilities, we  carried out a right to read campaign around India, provided submissions  to the standing committee and finally were able to positively influence,  along with other NGOs, the amendment to the Copyright Act in 2012.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;(c) Aiding the negotiation of a Treaty at the World Intellectual Property Organisation&lt;/b&gt; which would facilitate international sharing of books for persons with  print disabilities. We attended the negotiations at Geneva from 2010 and  are a permanent observer there now, intervening and providing research  advice on various issues. The Marrakesh Treaty to Facilitate Access to  Published Works for persons who are blind, visually impaired or  otherwise print-disabled was concluded in 2014 and India was the first  country to ratify it. The 20 ratifications required to bring the treaty  into force just got concluded on June 30th 2016 and the treaty will come  into force from 1st September 2016.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;(d) We also worked with the Universal Service Obligation Fund of India&lt;/b&gt; to launch a pilot scheme to fund projects for persons with disabilities in rural areas.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;(e) Apart from the above, we have produced global reports with international partners&lt;/b&gt; like the International Telecommunication Union and G3ict on topics such  as mobile accessibility and produced research which we sent to relevant  government agencies on topics such as banking and financial inclusion,  emergency and disaster management for persons with disabilities,  accessible broadcasting and so on.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;(f) We are implementing a project to develop text to speech for several Indian languages&lt;/b&gt; using an open source speak synthesiser called e-Speak and enhanced  working of NVDA an open source screen reader which works with English  and other Indian languages. We have also carried out several trainings  on this software around the country.&lt;br /&gt; We also provide advice to governments and organisations in other  countries on ICT accessibility related issues. We have also organised  trainings on web accessibility and other topics as may be required.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Q- What kinds of challenges are faced by the CIS in its work?&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Limited resources – very few donors fund the kind of work we do  although no one denies the criticality and usefulness of it. Neither do  we fall within the bracket of a traditional organisation serving persons  with disabilities, nor is accessibility as marketable a topic as say  something like privacy and cyber security, hence to have a team which  can actively carry on this work of research and advocacy, constantly  responding to policy developments, attending meetings is very difficult  and we are not able to do the kind of work we want.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Q- What kind of vision of empowerment would you propose for  the disabled through digital accessibility? How can this vision be  achieved?&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;My Vision- &lt;/b&gt;Every person with a disability in India  is able to access the Internet, content and facilities through an ICT  enabled device, be it computers or phones; where this access is  unhindered by barriers and is instantaneous, not retrospective. Further,  I speak for an India which is inclusive in the complete sense, i.e.  accessibility standards are part of mainstream standards and Universal  Design is the standard approach to creations and developments of all  kind and not where separate considerations need to be made for the  disabled on specific products and services. Where a person with a  disability has a choice, as do the other citizens and not where they are  given an option; they have access to the world at the same time on the  same terms; where there is true equality and we live a life with dignity  and pride.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;How Can We Achieve It?&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India has already taken certain steps to show her commitment to accessibility –&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;We have ratified the UNCRPD, are part of the Incheon Strategy to make  the rights real for persons with disabilities and are in the process of  passing a new Rights of Persons with disabilities legislation. We also  have a National Policy on Universal Electronics Accessibility,  Guidelines on Government Websites, the Accessible India and Digital  India campaigns and the Smart Cities Mission. There is ample opportunity  and scope for ensuring accessibility is implemented to give complete  effect to these. Some of the areas where action can be taken include:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;1. Web site accessibility&lt;/b&gt; should be taken up  immediately since it affects access for all on using different  platforms. The plan can identify number of web sites and different  stakeholders and the time lines by which they are required to make their  web sites compliant. Both self-certification as well as regular audits  should be carried out to check for compliance.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;2. Public Procurement &lt;/b&gt;is another critical tool in  the hands of the government to ensure that all public infrastructure and  all facilities/ resources/ products/ services procured out of public  money or for the consumption/ use of the public should be made  accessible. This is increasingly being adopted in countries around the  world. India has a draft procurement bill, several organisations serving  the disabled have given a request for the inclusion of accessibility  considerations within the procurement bill, we hope they will be taken  seriously. By including compliance with accessibility standards as part  of performance criteria in all government contracts and calls for  proposals and contracts for development and maintenance of products and  services, we can ensure not only that web sites etc. become accessible,  but that competence is generated in the market to create and market  accessible products and increase choice in the market for persons with  disabilities.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;3. Government&lt;/b&gt; ensuring that accessibility  requirements are integrated in all government schemes and programmes and  accessibility should be considered no longer a matter of choice, but of  necessity. There are budgets for different ministries and agencies,  there should be a mechanism to evaluate that all the budget set aside  for meeting the needs of persons with disabilities are expended  meaningfully and not accumulated or go back to the main kitty unspent.  There should be proactive disclosure on the part of all government  agencies on their spending on accessibility/ disability and they should  solicit advice from persons with disabilities and accessibility experts  who are part of the committee to review budget spending.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;4. Development of appropriate technologies-&lt;/b&gt; we need  to ensure that enough resources are pumped towards creating our own  research and development community to support development and  maintenance of assistive technology that caters to needs of specific  groups. Open source solutions are desirable for a country like India  because of the opportunity they offer for deployment, customisation and  improvements.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;5. Accessible Smart Cities-&lt;/b&gt; The Smart Cities Mission  should immediately ensure that their advisory panel includes  accessibility experts and that the smart cities which emerge as part of  this initiative are inclusive- this is the ideal opportunity to build an  accessible city, universal design should be the basic principle on  which these smart cities are developed; if this is not done, then there  will always remain two worlds- one for the world at large and one for  persons with disabilities, and the disparity between the two will always  continue.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;6. Finally the most important advice&lt;/b&gt; I would  reiterate is the inclusion of persons with disabilities across all work  of the government – only then will the accessibility perspective be  represented and taken into account everywhere. Otherwise we may have a  situation where accessibility is either missing, or where projects are  being implemented to aid the disabled, which are totally meaningless or  inappropriate and only serve to waste precious resources, time and  effort.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Q- What measures do you suggest for making digital  accessibility available to the disabled people across the divides of  class, gender and more developed and less developed regions?&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Digital accessibility should be implemented at the levels of content,  user interface and end user device. Hence accessibility of documents  and information on the Internet should conform to standards of  accessibility, such as EPUB 3.0, html etc.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;User interface-WCAG 2.0 for websites is a must for any device to  function effectively. Assistive software must be completely accessible.  For instance, it is not uncommon to find that an ATm which is termed  ‘accessible’ actually needs the input of a sighted person at some stages  of the transaction while some other points are completely prompted  through audio.   In such a case, the blind still cannot use this.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Schemes under the USOF and others may be used to provide devices and  connectivity to persons with disabilities in rural and far flung areas  and also targeting specific user groups such as women. For instance a  project under the USOF to promote women entrepreneurship in rural areas  by providing them with a mobile phone can easily be replicated for  disabled women. They could be funded for initiatives such as operating  public internet kiosks or public phone booths etc. Schools in villages  could be provided with computers fitted with assistive technology  (hardware and software as may be required) s that disabled children and  teachers have access and exposure to technology.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Providing mobile phones to all persons with disabilities will go a  long way to open up the world of books, information, communication  and access to emergency services to persons with disabilities.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Common Services Centres throughout the country are an excellent way  of reaching persons with disabilities and providing them access to  technology. By providing assistive technology on computers there, which  is not at all inexpensive if one were to use free and open source  software such as the NVDA screen reader and one trained person to impart  training to the disabled, who can also be a person with a disability,  we can make a lot of progress in terms of both building trained capacity  and providing access to technology for persons with disabilities.  Private employers and organisations also have a critical role to play in  promoting accessibility for the disabled.&lt;/p&gt;

&lt;/p&gt;
&lt;ol&gt;&lt;li&gt;&lt;strong&gt;Who does this amendment benefit?&lt;/strong&gt;&lt;br /&gt;This amendment benefits all persons with disabilities who cannot enjoy works in their normal format thus amongst others it would cover totally blind, low vision, learning disabled, the deaf and hard of hearing and orthopedically challenged people who are unable to hold books or turn its pages.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;What can be done now that was not possible earlier?&amp;nbsp;&lt;/strong&gt;&lt;br /&gt;Persons with disabilities who cannot access a work in their normal format and organizations can suitably modify a work so as to make it accessible to meet the specific needs of the person with disability. This means that a standard printed book, for example may be converted to an alternate format (not necessarily a special format) including Braille, large font, text readable by screen reader, audio (be it synthetic audio or human voice recording) without seeking the permission of the rights holder.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;How is this different?&lt;/strong&gt;&amp;nbsp;&lt;br /&gt;In the past, any alternate format creation would have been an infringement unless it was backed up by prior written permission from the rights holder. One had to seek the permission if one had to be on the right side of the law. Now these permissions are not needed for non-profit conversion and distribution.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Are there any restrictions? Yes, there are reasonable restrictions such as:&lt;/strong&gt;&lt;br /&gt;(a) conversion should be a not for profit activity. In case it is a for profit activity, there is a separate clause under which a special license can be obtained.-&amp;nbsp;&lt;br /&gt;(b) The accessible format copy has to be distributed to a bonafide print impaired person or organizations that serve them.&lt;br /&gt;(c) reasonable precaution need to be taken by all that the accessible copy is not misused commercially.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;What is the meaning of a “work”?&lt;/strong&gt;&lt;br /&gt;A work means:&lt;br /&gt;(a)&amp;nbsp;a literary, dramatic, musical or artistic work;&lt;br /&gt;(b)&amp;nbsp;a cinematograph film; &amp;nbsp;&lt;br /&gt;(c)&amp;nbsp;and a sound recording;&lt;br /&gt;It includes all works which are available in India in the normal channels of business.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;What activities are permitted for the benefit of persons with disabilities?&lt;/strong&gt;&lt;br /&gt;The adaption, reproduction, issue of copies or communication to the public of any work in any accessible format to facilitate persons with disability to access works.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Is permission required from publishers to undertake the above activities?&lt;/strong&gt;&lt;br /&gt;No, permission from publishers are not required to undertake the above activities subject to the points given below.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;What are “accessible formats”?&lt;/strong&gt;&lt;br /&gt;Accessible formats include, Braille, audio (be it synthetic audio or human voice recording), Daisy, accessible pdf, large print, movies with subtitles etc.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;What is the meaning of “adaption”?&lt;/strong&gt;&lt;br /&gt;“Adaption” in relation to any work, mean any use of such work involving its re-arrangement or alteration. Conversion of a work into an accessible format would be treated as an adaption&lt;/li&gt;&lt;li&gt;&lt;strong&gt;What is the meaning of “communication to the public”?&lt;/strong&gt;&lt;br /&gt;"Communication to the public" means making any work available for being seen or heard or otherwise enjoyed by the public directly or by any means of display or diffusion other than by issuing copies of such work. This includes making the accessible format copy available over the Internet or distributing it from a website.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Who can create and distribute accessible formats?&lt;/strong&gt;&lt;br /&gt;(a)&amp;nbsp;Any person can create and distribute accessible formats if it is done for facilitating access by persons with disabilities. Parents, friends and persons with disabilities themselves can create accessible formats.&lt;br /&gt;(b)&amp;nbsp;An organization working for the benefit of the persons with disabilities can also create and distribute accessible formats.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Are there any preconditions on the type of organization that can undertake the activities?&lt;/strong&gt;&lt;br /&gt;Yes, the organization must satisfy one of the following conditions to undertake the activities:&amp;nbsp;&lt;br /&gt;(a)&amp;nbsp;The organization must be registered under section 12A of the Income Tax Act, 1961 and work for the benefit of persons with disability; or&lt;br /&gt;(b)&amp;nbsp;The organization must be recognized under Chapter X of the Persons with Disabilities (Equal Opportunities Protection of Rights and Full Participation) Act, 1995; or&amp;nbsp;&lt;br /&gt;(c)&amp;nbsp;The organization must receive grants from the Government for facilitating access to persons with disabilities; or&amp;nbsp;&lt;br /&gt;(d)&amp;nbsp;The organization must be an educational institution or library or archives recognized by the Government.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Can accessible format copies be shared between persons with disabilities?&amp;nbsp;&lt;/strong&gt;&lt;br /&gt;Yes, they can be shared&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Can any of the activities be undertaken for profit?&lt;/strong&gt;&lt;br /&gt;No, for profit activities require a separate license from the copyright board. This license &lt;span class="Apple-tab-span"&gt;	&lt;/span&gt;will prescribe several conditions including the royalty, if any, that must be paid. For&amp;nbsp;further details, see point 23 of this note.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Can the costs of production of accessible format copies be recovered?&lt;/strong&gt;&lt;br /&gt;Yes the cost can be recovered.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Does this mean that the publisher has to give you a soft copy?&amp;nbsp;&lt;/strong&gt;&lt;br /&gt;No. Publishers are not required to give a soft copy under the amendment. &amp;nbsp;&lt;/li&gt;&lt;li&gt;&lt;strong&gt;What steps are required to be taken by organizations who undertake the activity?&lt;/strong&gt;&lt;br /&gt;The organization must ensure that the copies of works in such accessible format are made available to persons with disabilities and takes reasonable steps to prevent its entry into ordinary channels of business.&amp;nbsp;&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Can works be simplified so that people with psycho social disabilities or intellectual disabilities can enjoy the work?&lt;/strong&gt;&lt;br /&gt;Yes, this can be done since this will fall within the meaning of “adaption” as given above.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Can subtitles be added to movies and other audio visual work for the benefit of the deaf/hard of hearing?&lt;/strong&gt;&lt;br /&gt;Yes, this can be done since this will fall within the meaning of “adaption” as given above.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Can audio descriptions be added to movies and other audio visual works for the benefit of the blind/low vision?&lt;/strong&gt;&lt;br /&gt;Yes, this can be done since this will fall within the meaning of “adaption” as given above.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;Can an organization in India import or export accessible format copies from/to organizations and beneficiaries abroad?&lt;/strong&gt;&lt;br /&gt;The Copyright Amendment Bill, 2012, does not address import and export and this depends on various factors and legal preconditions. In this case, it is advisable to check with your legal advisors before undertaking such an activity.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;What is the wording of the section?&lt;/strong&gt;&lt;br /&gt;Section 52 (1)The following act shall not be an infringement of copyright, namely:&lt;br /&gt;(zb) the adaptation, reproduction, issue of copies or communication to the public of any work in any accessible format, by —&lt;br /&gt;(i) any person to facilitate persons with disability to access to works including sharing with any person with disability of such accessible format for private or personal use, educational purpose or research; or&lt;br /&gt;(ii) any organization working for the benefit of the persons with disabilities in case the normal format prevents the enjoyment of such works by such persons:&lt;br /&gt;Provided that the copies of the works in such accessible format are made available to the persons with disabilities on a nonprofit basis but to recover only the cost of production:&lt;br /&gt;Provided further that the organization shall ensure that the copies of works in such accessible format are used by persons with disabilities and takes reasonable steps to prevent its entry into ordinary channels of business.&lt;br /&gt;Explanation. For the purposes of the sub-clause, “any organization” includes an organization registered under section 12A of the Income Tax Act, 1961 and working for the benefit of persons with disability or recognized under Chapter X of the Persons with Disabilities (Equal Opportunities Protection of Rights and &lt;span class="Apple-tab-span"&gt;	&lt;/span&gt;Full Participation) Act, 1995 or receiving grants from the Government for facilitating access to persons with disabilities or an educational institution or library or archives recognized by the Government.&lt;/li&gt;&lt;li&gt;&lt;strong&gt;What is the wording of the section relating to for profit activity?&lt;/strong&gt;&lt;br /&gt;³31B. (1) Any person working for the benefit of persons with disability on a profit basis or for business may apply to the Copyright Board, in such form and manner and accompanied by such fee as may be prescribed, for a compulsory license to publish any work in which copyright subsists for the benefit of such persons, in a case to which clause (zb) of sub-section (1) of section 52 does not apply and the Copyright Board shall dispose of such application as expeditiously as possible and endeavor shall be made to dispose of such application within a period of two months from the date of receipt of the application.&lt;br /&gt;(2) The Copyright Board may, on receipt of an application under sub-section (1), inquire, or direct such inquiry as it considers necessary to establish the credentials of the applicant and satisfy itself that the application has been made in good faith.&lt;br /&gt;(3) If the Copyright Board is satisfied, after giving to the owners of rights in the work a reasonable opportunity of being heard and after holding such inquiry as it may deem necessary, that a compulsory license needs to be issued to make the work available to the disabled, it may direct the Registrar of Copyrights to grant to the applicant such a license to publish the work.&amp;nbsp;&lt;br /&gt;(4) Every compulsory license issued under this section shall specify the means and format of publication, the period during which the compulsory license may be exercised and, in the case of issue of copies, the number of copies that may be issued including the rate or royalty: Provided that where the Copyright Board has issued such a compulsory license it may, on a further application and after giving reasonable opportunity to the owners of rights, extend the period of such compulsory license and allow the issue of more copies as it may deem fit.&amp;nbsp;&lt;/li&gt;&lt;/ol&gt;

    <title>An Analysis of the Comments by World Blind Union and the International Publishers Association</title>

        &lt;b&gt;Rahul Cherian provides an analysis of the comments by the World Blind Union and the International Publishers Association after the 23rd session of the Standing Committee of Copyright and Related Rights.&lt;/b&gt;
        
&lt;p&gt;Before the WIPO intersessionals held on March 23 and 24 at Geneva between some member states to discuss the pending issues related to the Treaty for the Visually Impaired, the World Blind Union and the International Publishers Association came out with their comments/versions on the Chair’s text dated December 16, 2011. The Chair's text with comments of Member States is available &lt;a href="https://cis-india.org/accessibility/chairs-text.pdf" class="internal-link" title="Chair's Text"&gt;here&lt;/a&gt;. &lt;p&gt;The World Blind Union document, &lt;a href="https://cis-india.org/accessibility/wbu-document.pdf" class="internal-link" title="The World Blind Union document"&gt;available here&lt;/a&gt; [PDF, 314 Kb], attempts to build consensus in the text based on suggestions given by various Member States to the Chair’s text dated December 16, 2011. The inputs of Member States that would be beneficial to the intended beneficiaries of the Treaty, namely persons with visual impairment, print disabilities, etc. were incorporated into the World Blind Union document while suggestions of Member States that were detrimental to the intended beneficiaries were not added. As can be seen by the WBU document, several changes suggested by many Member States, including the United States, the European Union, the African Group, Pakistan, India, etc were incorporated into the WBU document. As far as possible the WBU document has tried not to add new wording which were not suggested by Member States to the Chair's text. The WBU document is, in my opinion, a genuine attempt at building consensus between Member States on the Treaty for the Visually Impaired.&lt;/p&gt;
&lt;p&gt;On the other hand,&lt;a href="https://cis-india.org/accessibility/ipa-position.pdf" class="internal-link" title="Summary of the IPA Position"&gt; the document proposed by the International Publishers Association&lt;/a&gt; [PDF, 215 Kb] is a different story. Rather than trying and building consensus, the IPA has taken a stand that is so extreme that the only aspect I could find in the entire document was that it was progressive. In the first paragraph of the introduction the IPA finally recognizes that persons with print disabilities must have access to works at the same time as others. Unfortunately it is all downhill from there. Given below are some of the suggested changes of the IPA and my comments on the IPA document from the perspective of its impact on India and other developing countries.&lt;/p&gt;
&lt;ol&gt;&lt;li&gt;The IPA proposes the deletion of the following paragraph from the Preamble: “Needing to contribute to the implementation of the relevant recommendations of the Development Agenda of the World Intellectual Property Organization,” &lt;br /&gt;From this proposed change, it appears that the IPA is opposed to the Development Agenda of the World Intellectual Property Organization. This change is completely unacceptable and unfortunately the further suggestions of the IPA seemed to reflect the anti-development mentality of the IPA.&lt;/li&gt;&lt;li&gt;The IPA proposes that the exceptions and limitations cover only those works that are release in print format and excludes those works that are “born digital”. This implies that for new books which are going to be released only in digital formats, there should be no exceptions and that the beneficiaries should be able to convert those inaccessible versions into accessible versions. This is also unacceptable since persons with print disabilities must have equal access to all books and not only printed books.&lt;/li&gt;&lt;li&gt;The IPA proposes that only those organizations that have the “primary” objective of assisting persons with print disabilities by providing them with services relating to education, training, adaptive reading, or information access needs shall be entitled to convert or distribute accessible format copies. This would mean those educational institutions and other organizations that make material accessible but not on a primary basis will be excluded. This is totally counterproductive if persons with disabilities are to have really equal access to reading material.&lt;/li&gt;&lt;li&gt;The IPA proposes that authorized entities must maintain compliance policies and procedures regarding access and IT security that follow internationally recognized standards. It records appropriate usage information and provides this to rights holders in a transparent and timely manner. &lt;br /&gt;The compliance with this provision will prove extremely expensive and cumbersome for organizations, particularly those organizations in developing countries who are cash strapped. Moreover, it is unclear what these internationally recognized standards are. This addition is also unacceptable.&lt;/li&gt;&lt;li&gt;The IPA proposes that only organizations that actually create an accessible format copy can export that copy to organizations in other countries. This would mean that every organization that exports books would have to re-create the accessible format copy thereby leading to tremendous replication of effort and wastage of precious resources. This is extremely counterproductive.&lt;/li&gt;&lt;li&gt;The IPA proposes to add the following sentence to the text: Member States may choose other means for increasing the availability of accessible format copies, provided these means afford Beneficiaries with equally effective access to Works. &lt;br /&gt;By adding this one sentence the Treaty, which is intended to create minimum exceptions in each Member State, permits countries to move away from the E&amp;amp;L regime into a licensing regime. The benefits of the whole treaty could be negated with this one sentence. &lt;br /&gt;&lt;/li&gt;&lt;/ol&gt;
&lt;p&gt;Apart from these changes mentioned above, there are several other changes proposed by the IPA which are completely against the spirit of the Treaty. It is sad to note that instead of trying to reach a consensus the IPA has proposed some preposterous changes and negative changes to the text. But given the stand that they have taken in this document, possibly as a last ditch attempt to thwart the growing momentum for the Treaty, it is likely that the IPA’s disguise as a sheep has been blown away to reveal the wolf.&lt;/p&gt;

    <title>An “Advocacy” Saga and the Inspiring Legacy of Rahul Cherian</title>

        &lt;b&gt;For those interested in policy advocacy, the NUJS Law Review has an elaborate paper outlining the tireless advocacy efforts (spanning more than 10 full years) of a bunch of dedicated campaigners who strove valiantly to foster access for the disabled.&lt;/b&gt;
        &lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;The blog post by Shamnad Basheer was&lt;a class="external-link" href="http://spicyip.com/2013/12/an-advocacy-saga-and-the-inspiring-legacy-of-rahul-cherian.html"&gt; published by Spicy IP&lt;/a&gt; on December 16, 2013.&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;Their efforts resulted in the culmination of a newly introduced &lt;a href="http://www.inclusiveplanet.org.in/content/copyright-amendment-persons-disabilities-passed-parliament"&gt;section 52(1)(zb)&lt;/a&gt; to the copyright regime. As many of you know, this is one of the widest  possible copyright “disability” exceptions anywhere in the world,  providing effectively that any conversion of a copyrighted work to make  it more accessible to a disabled person (on a non- profit basis) will  not count as a copyright infringement.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;One name that stands out and will continue to stand out for all time to come in this advocacy campaign is that of &lt;a href="http://www.thebetterindia.com/6430/tbi-this-ability-rahul-cherian-working-towards-an-inclusive-planet/"&gt;Rahul Cherian&lt;/a&gt;,  a pioneering crusader for disability rights. Rahul not only led the  advocacy campaign that led to this revolutionary copyright exception for  India, but also played a stellar role with the WBU (World Blind Union)  in helping shape an international treaty on similar lines (the &lt;a href="http://spicyip.com/2013/07/the-marrakesh-miracle-salient-features.html"&gt;Marrakesh treaty) &lt;/a&gt; and bring it to fruition.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Unfortunately, even before the Marrakesh treaty was adopted, &lt;a href="http://www.thehindu.com/opinion/op-ed/a-lightness-of-spirit/article4394284.ece"&gt;Rahul&lt;/a&gt; was snatched away from us by a cruel twist of fate. However, his legacy  lives on and will continue to guide us for a long time to come. As  Lawrence Liang notes in this &lt;a href="http://www.thehindu.com/opinion/op-ed/a-lightness-of-spirit/article4394284.ece"&gt;moving piece&lt;/a&gt;:  “Rahul leaves behind an important legacy in terms of his work, but a  far more important one on how we understand the very idea of a free  spirit. His singularity, while irreplaceable, provides us with a  vocabulary of thinking of human rights struggles as really a right to  the maximum enjoyment of life and doing it with a sense of lightness.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It may interest you to note that Rahul began his career as an IP attorney with &lt;a href="http://www.globalipattorneys.com/company/id/1939/?company=Kurian+And+Kurian"&gt;Kurian and Kurian&lt;/a&gt;,  a Chennai based IP boutique. He later found his true calling in working  to improve the lot of the differently-abled. He founded &lt;a href="http://inclusiveplanet.org.in/"&gt;Inclusive Planet&lt;/a&gt;, a technology/policy outfit to create technology solutions to redress the book famine (by encouraging &lt;a href="http://inclusiveplanet.wordpress.com/about/"&gt;sharing of accessible literature&lt;/a&gt;) and undertake policy advocacy on behalf of disabled communities.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Disability Advocacy and Indian Copyright Amendment&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;It was a chance call from Rahul that got me into disability advocacy as  well; and in no time, his excitement and passion rubbed off on me. Along  with other outstanding disability activists and scholars (prominent  amongst them were &lt;a href="http://www.xrcvc.org/the_team.php"&gt;Prof Sam Taraporewala&lt;/a&gt;, &lt;a href="https://www.ashoka.org/fellow/dipendra-manocha"&gt;Dipendra Manocha&lt;/a&gt;, &lt;a href="http://girlsinict.org/profiles-of-women-in-ICT/nirmita-narasimhan"&gt;Nirmita Narasimhan&lt;/a&gt;, &lt;a href="http://en.wikipedia.org/wiki/Lawrence_Liang"&gt;Lawrence Liang&lt;/a&gt;, &lt;a href="http://www.blindwithcamera.org/2010/05/31/kanchan-pamnani/"&gt;Kanchan Pamnani&lt;/a&gt;, &lt;a href="http://www.sightsavers.org/about_us/media_centre/gat_spokespeople/17585.html"&gt;Ketan Kothari&lt;/a&gt; and &lt;a href="http://www.xrcvc.org/the_team.php"&gt;Neha Trivedi&lt;/a&gt;), we campaigned for a &lt;a href="http://spicyip.com/2010/11/special-copyright-victory-for-disabled.html"&gt;meaningful copyright exception&lt;/a&gt;,  made representations before the Parliamentary Standing Committee and  succeeded in getting this historic amendment through the legislature.  All this was possible owing to the stellar support of the government  (and in particular the untiring work of GR Raghavender, the copyright  registrar and Prof NSG, the governments’ key copyright advisor).&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;“In a momentous development, the Indian Copyright Act, 1957, was amended  to introduce one of the most progressive provisions ever in the history  of global copyright law. These amendments seek to foster access to  copyrighted works for the disabled by providing for the conversion and  distribution of copyrighted works without the risk of copyright  infringement. It is important to appreciate that these amendments did  not emerge overnight. Rather, they were the culmination of more than a  decade of advocacy, by a group of dedicated campaigners drawn from a  diverse set of stakeholders, including leaders of the disability  community, civil society activists and the academia. This paper provides  a ringside view of the evolution and progress of the campaign, with its  final culmination in the amendment. It tracks the advocacy effort  through the lens of ‘new social movements’, and focuses on the need to  bring together different stakeholders with complementary skills to  achieve shared goals of public interest. Additionally, this paper  reflects upon the scope of the amendment, the current international  efforts to secure a global treaty on this count and India’s role in  shaping it.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The authors of this paper were an integral part of the advocacy campaign  and worked extensively with several others to secure the introduction  of this critical amendment. Unfortunately upon completion of this paper,  we lost the most committed campaigner of all, Rahul Cherian. This paper  is dedicated to his memory and the boundless passion and enthusiasm  with which he brought so many of us together in his quest for creating a  better world for the disabled. Over the last few years, Rahul worked  tirelessly to champion the cause of the disabled in India and achieved  commendable progress on several fronts. However, the copyright amendment  will rate as his crowning glory, given the rather difficult political  terrain that had to be traversed. Rahul is to be credited for providing a  fresh fillip to the advocacy campaign and mediating differences between  a diverse set of people with different skill sets, ideologies and  expectations and ensuring that they worked together as ‘one’ team with a  common goal.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Rahul’s journey is far from over. Though we’ve lost him physically, his energy, spirit and &lt;a href="http://www.youtube.com/watch?v=r7Tnsb0VIe4"&gt;infectious enthusiasm&lt;/a&gt; will  continue to inspire many of us who struggle in our own little way to  make this planet more inclusive, habitable and humane.&lt;/p&gt;

&lt;p&gt;&lt;/p&gt;
&lt;p&gt;Bangalore: The proposed amendment to the
Copyright Act 1957 will deprive over 70 million persons with disabilities in
India from exercising their Right to Education, according to the National
Access Alliance.&lt;/p&gt;
&lt;p&gt;The amendment, being introduced in the
budget session of the parliament will prevent non-governmental organisations,
educational institutions and persons with disabilities from converting reading
material, including textbooks and reference material, into audio, digital and
other formats.&lt;/p&gt;
&lt;p&gt;“The licence procedure for the conversion
of these formats is cumbersome, restrictive and lengthy. This will deprive
students with print disabilities of their Right to Education,” Sunil Abraham,
executive director, The Centre for Internet and Society, told presspersons here
on Thursday.&lt;/p&gt;

&lt;h3 style="text-align: justify; "&gt;Key Findings&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Civil society groups from the Global South are leading the charge to advocate for an Internet that remains open, pluralistic, and democratic. The nine case studies highlighted in this report demonstrate various ways groups in different countries have successfully fought for policies and norms that strengthen Internet freedom and digital rights. These strategies include awareness-raising, nonviolent direct action, regional and international coalition-building, and strategic litigation.&lt;/p&gt;
&lt;ul style="text-align: justify; "&gt;
&lt;li&gt;Media freedom advocates have been at the forefront of many Internet freedom efforts.&lt;/li&gt;
&lt;li&gt;Threats to independent media online and freedom of expression continue to mount as authoritarian regimes become more technologically savvy.&lt;/li&gt;
&lt;li&gt;Building broad civil society coalitions around Internet rights increases the chances of long-term success.&lt;/li&gt;
&lt;/ul&gt;
&lt;h3 style="text-align: justify; "&gt;Introduction&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The debate over whether the Internet is a better tool for democratic empowerment or authoritarian control misconstrues the nature of the democratic challenges of the digital age. The Internet is not a tool, but a complex domain of “competing forces and constraints.”1 These forces are comprised of powerful businesses, states, politicians, criminal enterprises, advocacy groups: in short, all of the elements present in any democracy. But in this cyber-democracy, forces compete in part on the shifting ground of the technological and physical infrastructure of the Internet, where some players wield more power than others with an ability to mold the terrain in their favor. Authoritarian states aware of what is at stake in the evolution of the Internet are beginning to engage in long-term and well-resourced efforts to undermine the democratic rights of citizens in this more fundamental way.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In a reference to the distributed denial-of-service (DDoS) attacks  that take down a specific website, these broader efforts represent what  some have called a &lt;a href="https://www.demworks.org/distributed-denial-democracy"&gt;“distributed denial-of-democracy” (DDoD)&lt;/a&gt; attack aimed at reducing the utility of the Internet for genuine  democratic discourse. These efforts, which are coordinated and well  resourced, are often more insidious, harder to detect, and have the  overall effect of undermining civic engagement and overall trust in the  media ecosystem.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;And while the diffuse and fast-changing nature of Internet can at  times make it difficult for authoritarian regimes to exert their  control, the complex interplay between technology, laws, infrastructure,  and socio-political factors shaping the Internet make it equally  difficult for democratic actors to counteract these DDoD strategies. As  an additional obstacle, the values that underpin Internet freedom can be  sidelined in the forums and governing bodies that set Internet  standards by the dominance in those spaces of private tech companies  concerned primarily with generating profits.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Formidable though they may be, these challenges are not  insurmountable. Civil society groups from the Global South are leading  the charge to advocate for an Internet that remains open, pluralistic,  and democratic. The nine case studies highlighted in this report  demonstrate various ways groups in different countries have successfully  fought for policies and norms that strengthen Internet freedom and  digital rights. These strategies include awareness-raising, nonviolent  direct action, regional and international coalition-building, and  strategic litigation.&lt;/p&gt;
&lt;p class="BodyA" style="text-align: justify; "&gt;Each of the following case studies corresponds to one of the nine guiding principles of a &lt;a href="https://openinternet.global/comment-draft-principles"&gt;Democratic Framework to Interpret Open Internet Principles&lt;/a&gt;.  This framework was collaboratively developed by a network of civil  society groups worldwide to illuminate the ways that an open Internet is  essential for the functioning of democratic societies. It was inspired  by the norms and standards developed by the &lt;a href="http://internetrightsandprinciples.org/site/"&gt;Internet Rights and Principles Dynamic Coalition (IRPC)&lt;/a&gt; of the United Nations &lt;a href="https://www.intgovforum.org/"&gt;Internet Governance Forum&lt;/a&gt;.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The framework is an important starting point for more effective,  coordinated effort to ensure that the Internet remains a welcoming place  for democratic life. Its aim is to create a consensus around the values  that should shape the future development of the Internet. But moreover,  it also provides an avenue for understanding and sharing knowledge on  the concrete strategies that can be put into practice in different  contexts to make sure that the Internet remains a level playing field.  The following nine examples demonstrate how citizen groups can mobilize  to enshrine such democratic principles in cyberspace.&lt;/p&gt;

&lt;div class="tsd-simple_content tsd-cima-module" style="text-align: justify; "&gt;
&lt;h2&gt;1. Freedom of Expression&lt;/h2&gt;
&lt;br /&gt;
&lt;p&gt;In the &lt;i&gt;Philippines&lt;/i&gt;, a cybercrime law introduced in 2012  proposed increasing penalties for libel and giving authorities unchecked  power to track information online. Internet freedom activists worried  several provisions of the law would infringe on freedom of expression by  preventing Filipinos from freely posting content on websites, and  participating in online forums and discussions without fear of being  blocked or facing serious penalties. In response, pro-democracy  organizations from across the political spectrum joined together to  challenge the constitutionality of the law. Through protests,  roundtables, and capacity building activities, they raised awareness and  encouraged advocacy efforts around the dangers the law posted to  freedom of expression and privacy. &lt;a href="http://fma.ph/"&gt;The &lt;/a&gt;&lt;a href="http://fma.ph/"&gt;Foundation for Media Alternatives (FMA&lt;/a&gt;&lt;a href="http://fma.ph/"&gt;)&lt;/a&gt;, a digital rights organization founded after the fall of the Marcos dictatorship and the &lt;a href="https://www.facebook.com/pg/PIFA.ph/about/?ref=page_internal"&gt;Philippine Internet Freedom Alliance (PIFA)&lt;/a&gt;,  a broad nationwide coalition of pro-democracy and Internet freedom  advocates, were among the organizations in the front lines on the  struggle. PIFA was even one of the 20 organizations to file 15 petitions  to the Supreme Court about the constitutionality of the law.&lt;/p&gt;
&lt;p&gt;Public efforts in the courts and actions in the streets contributed  to the takedown of three contested provisions of the law, including  provision that would allow government to block or restrict access to  computer data. The Supreme Court declared these provisions  unconstitutional and delayed implementation of the law. Despite public  concerns about the surviving provisions, the national campaign against  the cybercrime law led to a turning point for Filipino activists; it  showed the power of people coming together and fighting for the  importance of digital rights in the Philippines. Initially fragmented,  the campaign led to a larger movement unified under the goal of  protecting human rights and freedom of expression online. Thus, it took  the introduction of a flawed law and active public campaigns to initiate  a broader dialogue about privacy, surveillance, and digital security.  Digital rights &lt;a href="http://www.rstreet.org/2015/09/10/the-business-case-for-cambodian-Internet-freedom/"&gt;communities across Southeast Asia&lt;/a&gt; have been inspired by Filipino advocacy efforts, which they have  understood to be an example of how to communicate the balance required  between anti-cybercrime measures with fundamental rights to a public  audience.&lt;/p&gt;

&lt;h2&gt;2. Freedom of Assembly and Association&lt;/h2&gt;
&lt;br /&gt;
&lt;p&gt;Social media is an important organizing tool for journalists and advocacy groups in &lt;i&gt;Uganda&lt;/i&gt;. Facebook, WhatsApp, and other messaging applications &lt;a href="https://books.google.com/books?id=2dmeBQAAQBAJ&amp;amp;pg=PA367&amp;amp;lpg=PA367&amp;amp;dq=using+facebook+for+organizing+uganda+-facebook.com&amp;amp;source=bl&amp;amp;ots=Agd54hNXbj&amp;amp;sig=KRs9Ndl7BJfVfBnW9LXHJgpyEv4&amp;amp;hl=en&amp;amp;sa=X&amp;amp;ved=0ahUKEwjjv6fKsdLWAhUK7mMKHVkmB5kQ6AEISzAI#v=onepage&amp;amp;q=using%2520facebook%2520for%2520organizing%2520uganda%2520-facebook.com&amp;amp;f=false"&gt;have been used to share&lt;/a&gt; political knowledge, connect leaders with supporters, and organize  events — even share information about government abuses. During national  ‘&lt;a href="https://en.wikipedia.org/wiki/Walk_to_work_protest"&gt;Walk to Work&lt;/a&gt;’  protests in 2011, organized to protest living costs after presidential  elections, Facebook and Twitter provided a steady stream of updates from  protestors, bystanders, and journalists.&lt;/p&gt;
&lt;p&gt;Using social media, however, can have dangerous consequences for  marginalized groups such as the LGBT community. The government of Uganda  has been known to collect user information and prosecute individuals  based on information shared on social media. Uganda is one of 76  countries where homosexuality is currently criminalized, and LGBT  activists fear that their online conversations will be monitored and  used against them. By posting information taken from photos and content  posted on Facebook, a local tabloid exposed the identity of numerous  members of the LGBT community in 2011 and again in 2014. The tabloid  stories in 2011 are believed to have contributed to the &lt;a href="https://www.theguardian.com/world/2016/jan/26/uganda-lgbt-groups-david-kato-murder-5-years-on"&gt;killing of David Kato&lt;/a&gt;, a prominent gay rights activist.&lt;/p&gt;
&lt;p&gt;&lt;a href="https://www.cima.ned.org/wp-content/uploads/2017/04/Illustration_p11_Network-graphic.jpg"&gt;&lt;img class="alignright wp-image-8162 size-medium" height="300" src="https://www.cima.ned.org/wp-content/uploads/2017/04/Illustration_p11_Network-graphic-300x300.jpg" width="300" /&gt;&lt;/a&gt;Furthermore,  the government has repeatedly restricted access for advocacy groups to  use the Internet to share political information. In 2016, the country’s  media regulator &lt;a href="http://www.bbc.com/news/world-africa-35601220"&gt;restricted the use&lt;/a&gt; of WhatsApp, Facebook, and Twitter to prevent the organizing of  protests before presidential elections in February as the government had  done before in 2011. In both cases, the electoral commission &lt;a href="https://freedomhouse.org/report/freedom-net/2016/uganda"&gt;enforced&lt;/a&gt; the social media shut-down.&lt;/p&gt;
&lt;p&gt;Civil society groups have responded in two ways. First, they have  sought to deepen their digital security capacity. To protect against  threats to journalists, LGBT organizations, and other groups have  learned how to use Facebook and social media applications more securely  and to implement other practices that increase their privacy. In the  lead up to the 2016 election this included the use of &lt;a href="https://en.wikipedia.org/wiki/Virtual_private_network"&gt;virtual private networks&lt;/a&gt; (VPNs) to share information. Civil society groups spread information  about how to use them through radio broadcasts. The fact that the  hashtag #UgandaDecides trended on Twitter shows how they were able to  spread their knowledge through local networks and connect with  international media. Secondly, civil society groups built coalitions  with international organizations to draw attention to abuses taking  place in Uganda. In 2016, &lt;a href="https://www.accessnow.org/"&gt;Access Now&lt;/a&gt; supported a coalition of groups to &lt;a href="https://www.accessnow.org/uganda-blocks-social-media-harms-human-rights/"&gt;demand&lt;/a&gt; that the government stop the Internet shutdown as part of the #KeepitOn campaign.&lt;/p&gt;
&lt;/div&gt;

&lt;h2&gt;3. Accessibility&lt;/h2&gt;
&lt;br /&gt;
&lt;p&gt;In &lt;i&gt;Nigeria&lt;/i&gt;, national broadband plans have overlooked  rural communities, leaving them with low bandwidth and high-cost options  for Internet access. This means that broadband and mobile data fees are  unaffordable to many in Nigeria, especially the poor. Fixed-line  broadband subscriptions cost an average of 39 percent of average income,  and mobile broadband packages cost 13 percent. Given that approximately  80 percent of Nigerians earn below the poverty line ($2 a day or less),  access to the Internet is out of reach and unaffordable for a majority  of citizens in Nigeria.&lt;/p&gt;
&lt;p&gt;&lt;a href="http://a4ai.org/"&gt;The &lt;/a&gt;&lt;a href="http://a4ai.org/"&gt;Alliance for Affordable Internet&lt;/a&gt;,  a global coalition working on Internet affordability, works with  Nigerian civil society leaders to raise awareness around this issue  through thematic working groups. The consumer advocacy and pricing  transparency working group, for instance, works closely with &lt;a href="http://a4ai.org/a4ai-nigeria-multi-stakeholder-coalition/a4ai-nigeria-coalition-members/"&gt;a coalition of Nigerian NGOs&lt;/a&gt; that have been leading campaigns to raise awareness about pricing and  taxation policies that have been proposed in Nigeria. One proposed  policy includes imposing a nine percent tax on voice, data, and SMS  services to consumers. This policy would make the Internet dramatically  more expensive for Nigerian consumers. Groups say they worry about the  consequences of the proposed policy in an environment where farmers are  forced to climb trees just to get a stable Internet connection.&lt;/p&gt;
&lt;p&gt;Civil society leaders who are part of the coalition have worked to  build a healthy dialogue between regulators, civil society, and the  government. A key strategy, according to activists, has been encouraging  groups to find constructive ways to work with government and leveraging  the interests of each of these groups to protect and drive down costs  for Nigerian consumers. They seek to build relationships with the  regulator and to inform them about ways to better communicate with and  engage consumer groups, such as sharing their content through social  media rather than press releases. Another important learning has been  identifying champions within government to work on these issues.&lt;/p&gt;

&lt;h2&gt;4. Privacy and Data Protection&lt;/h2&gt;
&lt;br /&gt;
&lt;p&gt;&lt;a href="https://www.cima.ned.org/wp-content/uploads/2017/11/Cell_phone_android_transparent.jpg"&gt;&lt;img class="alignleft wp-image-8896" height="358" src="https://www.cima.ned.org/wp-content/uploads/2017/11/Cell_phone_android_transparent-212x300.jpg" width="253" /&gt;&lt;/a&gt;In &lt;i&gt;Burma,&lt;/i&gt; gaps in the law have left citizens vulnerable when it comes to privacy  and data protection. Restrictions on privacy have eased since the  country’s transition from military rule, but a lack of data protection  laws and general lack of awareness around privacy and data protection  present significant challenges for protecting an open Internet.&lt;/p&gt;
&lt;p&gt;Messaging applications such as Viber and Facebook Messenger, for  example, are the de-facto tool for communication for activists and are  used to organize political events and activities. Cheaper than voice  calls, far more accessible than landlines, and easier to use than email,  these tools are the primary way people in Burma communicate. &lt;a href="https://www.fastcompany.com/40438242/jailed-for-a-facebook-poem-the-fight-against-myanmars-draconian-defamation-laws"&gt;Activists have received harsh penalties for sharing content that may be viewed as threatening state security&lt;/a&gt;.  These applications are often not secure, making it possible for Burma  state authorities or agents of the state to intercept their  conversations. &lt;a href="https://pen.org/sites/default/files/unfinished_freedom_lowres.pdf"&gt;During a crackdown on student protests in March 2015, mobile phones were taken by police&lt;/a&gt;. Activists worried at the time that information on these phones would eventually be used against them.&lt;/p&gt;
&lt;p&gt;Observing the need to protect activists and educate them about data  protection, activists in 2016 formed a coalition, Digital Rights MM. The  coalition, led by &lt;a href="http://phandeeyar.org/"&gt;Phandeeyar&lt;/a&gt;, &lt;a href="http://www.myanmar-responsiblebusiness.org/index.php"&gt;Myanmar Center for Responsible Business&lt;/a&gt;, &lt;a href="http://www.myanmarido.org/"&gt;Myanmar ICT for Development&lt;/a&gt;, and Free Expression Myanmar, has led a national conversation on the issue. &lt;a href="https://www.forbes.com/sites/chynes/2016/12/21/digital-rights-must-become-a-top-priority-in-myanmars-connectivity-revolution/#4fde153b2267"&gt;Drawing on expertise from the region and international organizations&lt;/a&gt;,  22 local Burma-based organizations have been successful in pointing out  gaps when it comes to privacy and freedom of expression in the &lt;a href="https://www.article19.org/resources.php/resource/38665/en/myanmar:-telecommunications-law"&gt;national telecommunications law&lt;/a&gt;,  a comprehensive law that oversees the development of the  telecommunications sector in Burma. They also participated in meetings  with the government and launched a &lt;a href="https://www.facebook.com/MMTelecomLaw/photos/a.821155664669495.1073741830.821091201342608/1347827635335626/?type=3&amp;amp;theater"&gt;public facing campaign #ourvoiceourhluttaw&lt;/a&gt; pushing to amend 23 articles, including one on lawful interception of data.&lt;/p&gt;

&lt;h2&gt;5. Personal Safety and Security&lt;/h2&gt;
&lt;br /&gt;
&lt;p&gt;In &lt;i&gt;Pakistan&lt;/i&gt;, women face threats of physical, sexual, and  psychological harassment online. Leaking explicit photos and threats of  blackmail are growing increasingly more common. &lt;a href="https://digitalrightsfoundation.pk/drfpcwstraining/"&gt;From  2014 to 2015, more than 3,000 cybercrimes were reported to the Federal  Investigation Agency and of those cases, nearly half were targeted to  women on social media&lt;/a&gt;. Observers estimate far more cases go unreported. In fact, in workshops conducted by the &lt;a href="https://digitalrightsfoundation.pk/"&gt;The Digital Rights Foundation&lt;/a&gt;, many female college students reported that they did not know cyber harassment was a crime.&lt;/p&gt;
&lt;p&gt;Online platforms are an important space for political engagement,  expression, and mobilization in Pakistan. Thus, online harassment  directly impacts the political participation of women, including female  journalists and women politicians. In 2016 the &lt;a href="https://digitalrightsfoundation.pk/"&gt;Digital Rights Foundation&lt;/a&gt; established a &lt;a href="https://digitalrightsfoundation.pk/cyber-harassment-helpline-completes-its-four-months-of-operations/"&gt;Cyber Harassment Helpline&lt;/a&gt; that women can reach out to for help when they are harassed on the  Internet. One of the main objective of the helpline is to help bridge  the trust deficit between survivors and law enforcement agencies. &lt;a href="http://digitalrightsfoundation.pk/wp-content/uploads/2017/04/4-Month-Report.Final_.pdf"&gt;An analysis of more than 400 cases &lt;/a&gt;showed  that the most common barriers to equal participation are non-consensual  use of information, impersonation, account hacking, black mailing, and  receiving unsolicited messages; the most targeted groups include women,  children, human rights defenders, and minority communities. The Digital  Rights Foundation has also been leading efforts to strengthen legal  protections for women and responding to survivors by recommendations to  law enforcement agencies and the government. Pakistan has a National  Response Centre for Cybercrime, but it has faced challenges serving  women outside of major cities.&lt;/p&gt;

&lt;h2&gt;6. Inclusion&lt;/h2&gt;
&lt;br /&gt;
&lt;p&gt;In &lt;i&gt;India&lt;/i&gt;, the population of people with disabilities is  estimated to be as high as 150 million people, and the recorded rates of  those who are vision-impaired are among the highest in the world.  Indian digital rights advocacy groups, like the &lt;a href="https://cis-india.org/"&gt;Centre for Internet and Society (CIS)&lt;/a&gt; have worked to ensure that these individuals are able to participate  fully online by promoting policies that prioritize accessibility. These  include the National Policy on Universal Electronics Accessibility, the  Rights of Persons with Disabilities Act, and &lt;a href="http://guidelines.gov.in/"&gt;Guidelines for Indian Government Web (GIGW)&lt;/a&gt;,  which all require government information be shared in formats that are  accessible. Advocacy groups, however, have successfully shown that  policies alone are not enough and have taken action to ensure persons  with disabilities have access to critical resources and information  online.&lt;/p&gt;
&lt;p&gt;Mobile phones in particular are a vital portal to access government  services, but mobile applications remain largely inaccessible to many  people with disabilities, especially those with vision disabilities. For  example, CIS observed in 2015 that the &lt;a href="https://www.mygov.in/"&gt;MyGov&lt;/a&gt;,  the Indian Government’s mobile citizen engagement platform and the  Prime Minister’s application was highly inaccessible: screens cannot be  navigated by visually impaired users and can also not be read using a  screen reader. Based on this, CIS with other advocacy organizations  worked on framing accessibility guidelines for mobile applications  recommended to the Government of India as a standard. Advocacy groups,  such as the &lt;a href="http://www.ncpedp.org/"&gt;National Centre for Promotion of Employment for Disabled People (NCPEDP)&lt;/a&gt;,  have also been appealing to the private sector to ensure products  designed to serve these needs are affordable and readily available to  people with disabilities. They appeal to Indian companies and  policymakers by advocating for the universal appeal of assistive  technology to ensure disabled communities are not left behind.&lt;/p&gt;
&lt;p&gt;Sustained advocacy, new legal mandates applied to public and private  sectors, and increased research in this domain have helped advance the  issue of accessibility of mobile applications. The country’s National  Informatics Centre has set up a committee to revise the GIGW to bring  them up to speed with international standards.&lt;/p&gt;

    <title>Accessible websites could become a reality</title>

&lt;p&gt;Centre for Internet and Society (CIS), a Bangalore-based NGO that researches on Internet's influence on families and individuals, had reported that about 99 per cent of government websites have failed in meeting with the accessibility guidelines issued by W3C (World Wide Web Consortium).&lt;/p&gt;
&lt;p&gt;As Kanchan Pamnani speaks about web accessibility, she relates to us an old story learnt at school. A crane called his long-time friend, a wolf, for dinner and showed a tall, narrow jar that had delicious fishes in it. Unable to put its head inside and eat, the bewildered wolf returned home hungry, as the crane enjoyed putting its long beak inside the jar and tasted its content.&lt;/p&gt;
&lt;p&gt;“What’s the point in information being available on the Internet? The visually challenged can’t access the content all the same, since the design and presentation of websites are not friendly to the screen reader software they use to access them through PC and laptops. And they need this the most, since it saves their time and energy when they get things done online,” Ms Pamnani said.&lt;/p&gt;
&lt;p&gt;Despite being home to the world’s largest visually impaired population, the problem of inaccessible websites has been common in India. What hurts Ms Pamnani, a visually challenged lawyer and folks like her is the irony that several website developers in India comply with accessibility norms while creating websites for their foreign clients for fear of their product getting rejected and ignore the same while making sites for home-based organisations.&lt;/p&gt;
&lt;p&gt;Some months ago, Centre for Internet and Society (CIS), a Bangalore-based NGO that researches on Internet's influence on families and individuals, had reported that about 99 per cent of government websites have failed in meeting with the accessibility guidelines issued by W3C (World Wide Web Consortium). It had highlighted CMC Velore, RBI and IIMB as some of the institutions whose websites are either too difficult or impossible for persons with visual impairment to access with their special screen reading software.&lt;/p&gt;
&lt;p&gt;“Someone has to take responsibility for this situation,” Pamnani mentioned. “Given that people from the IT community have created these websites, they will have to take the blame.”&lt;/p&gt;
&lt;p&gt;Screen readers, which the blind use to get content of a computer in voice, comprises of text to speech engine (a sort of virtual larynx) and the software that allows users to interface with the system. However, graphically rich webpages or features that are primarily visual in nature become a potential minefield to the screen reader since it doesn’t know how that information can be rendered “readable” to the TTS engine.&lt;/p&gt;
&lt;p&gt;Mindful of this bottleneck, the World Wide Web Consortium (W3C), which play the role of rule-makers in the way the web functions, designed a set of guidelines web developers must use while creating websites. For instance, it calls for giving heading levels which makes screen reader users to press “Shift and the number key depending on which heading level (one to five) they want to reach” and straight away go to the heading instead of going line by line.&lt;/p&gt;
&lt;p&gt;For webpages to be fully accessible, the guidelines ask developers to use HTML tags and create alternative, verbally described pages (to the graphically rich ones) that can be read by screen readers. Probably fearing the labour it takes, developers of websites are alleged to be overlooking the guidelines and disability activists say that the negligence is proving to be too costly for them.&lt;/p&gt;
&lt;p&gt;“These days, most of the government documents are available on the Internet,” said Javed Abidi, Chairman, National Centre for Promotion of Employment for Disabled Persons (NCPEDP). “The technology is available and there is also the necessary awareness, but web developers seem to be taking this issue too lightly.”&lt;/p&gt;
&lt;p&gt;Abidi and Pamnani have been talking about the situation with NASSCOM and were close to hosting a Dharna in front of the venue where the industry body was hosting its leadership summit on Wednesady. However, the protest was called off since NASSCOM agreed to focus on the issue.&lt;/p&gt;
&lt;p&gt;“As a first step, the body has agreed to make their own website accessible,” Abidi, the New Delhi-based, wheelchair-bound disability activist, said. “Then they have agreed to urge their members to follow suit. Also, despite their attempts to take up accessibility as a CSR (Corporate Social Responsibility) issue, we want them to consider this as a rights issue, since the United Nations Convention for Rights of Persons With Disability (UNCRPD), which India has signed and ratified, states (in article 9) that access to information is a right.”&lt;/p&gt;
&lt;p&gt;So Pamnani and several other visually challenged users of the Internet feel the day when they can log on to the website of an online store and purchase anything of their choice isn’t far away.&amp;nbsp;&lt;/p&gt;

    <title>Accessible Mobile Handsets in India: An Overview </title>

        &lt;b&gt;Over a thousand mobile handsets are sold in India today and new models are launched almost every few weeks. However, the number of accessible handsets continues to be disproportionately low.  The Centre for Internet and Society conducted a research on the mobile market to gauge how many handsets in India are accessible for persons with disabilities. Handsets were judged on the basis of a few common accessibility features and pricing. &lt;/b&gt;
        &lt;p&gt;The findings reveal that 108 handset models came with screen readers and 100 were magnifier compatible. Thirty one of them were touch phones and only 15 models had QWERTY keypads.&lt;/p&gt;
&lt;p&gt;The study found that the price of 60 of the available options was either high or very high (Rs. 10,000 and above) and only 48 handsets are available at a reasonable or low price.&lt;/p&gt;

&lt;p&gt;Some of the major cross platform and proprietary mobile operating systems were also examined for their accessibility features. These included Windows Mobile, iPhone for Apple, Blackberry, Android, Symbian and Windows Phone 7.  All the operating systems offer features such as font customization, menu style, menu icons and voice recognition. However, only two offer built-in screen readers and only one OS offers a built in screen magnifier. Three operating systems support third party screen readers and two also support third party screen magnifiers.&lt;/p&gt;
