Disability groups in India welcome progress on treaty for blind persons

Four years of struggle for a global treaty for the benefit of blind persons is finally bearing fruit. Member states of the World Intellectual Property Organisation have agreed to conclude a treaty for visually-impaired and print disabled persons by June 2013.

Print disabled persons are a group which includes those who are blind, visually-impaired, orthopaedically challenged or those living with hearing problems or learning disability. They have traditionally lacked access to an array of books , films and research material simply because they aren't available in formats which are accessible to them. For instance, blind persons have been denied access to books and films which aren't available in Braille.

The international treaty that is underway would ensure free exchange of work suitable to print impaired persons across borders. In other words, a book in Braille available in the United Kingdom could be freely imported by India for the benefit of visually-impaired persons here.

The treaty is particularly a huge boon for developing countries like India, many of which cannot afford the huge costs of translating works into print-friendly formats or importing them from more developed nations. There are roughly 285 million blind and partially sighted people in the world with the largest pool in India.

The desperate need for such a treaty is evident from the fact that only seven per cent of published books are made accessible to persons with disabilities. This estimate of the World Blind Union is largely for richer countries, with less than one per cent of work available to those in poorer countries.

Organizations like the Indian Right to Read Alliance which has been pushing for the treaty welcomed the June deadline. "This is an incredible development, and after a four year struggle we are looking forward to the treaty being concluded next year. This Treaty will revolutionize access to reading materials for persons with print disabilities around the world and we in India will hugely benefit from being able to import books in accessible formats from countries with large libraries such as the United Kingdom and the United States," said Rahul Cherian Jacob of the Inclusive Planet Centre for Disability Law and Policy, who is the legal advisor to the World Blind Union.

Sam Taraporevala, Director of the Xavier's Resource Centre for the Visually Challenged was elated by this development. "There is a library in the United States which has 10 million books in accessible digital formats which will be accessible to us once this treaty is passed. This is huge boost to our blind and visually impaired students who want to get into the field of research."

The treaty could transform the lives of million of people around the world, believes Nirmita Narasimhan, policy director, Centre for Internet and Society, a Bangalore based NGO which has played a crucial role in WIPO negotiations. She pointed out that breaking the barriers would make the Internet and accessible information and communications technologies more meaningful by expanding their potential for use.

Human Machine Interfaces: The History of an Uncertain Future

"Multimodal interfaces maybe re-engineered much more easily now and can transform the ways in which the physically,cognitively and sensorially disabled can access information and interact with the digital world", says Sharath Chandra Ram.

Fundamental inspirations in digital information practices sprouted from the hypothetical electro-mechanical device ‘Memex’ proposed by renowned scientist Vannevar Bush in 1945, who incidentally, as the graduate professor of Claude Shannon, also paved the way for digital circuit design theory. The Memex (Memory + Index) concept entailed a system where a user could add associative trails to notes, books, communication and audio-visual experiences involving both him and others. Memex in Bush’s view was to create trails of links in temporal sequences of subjective experiences of a person, accessible to him (and others) anytime — a sort of augmented and extended memory. So implausible was considered this ambitious proposal of his, that the word ‘vannevar’ has entered the dictionary as a noun used to describe something that is unfeasibly fantastic and imaginative.

Wholly new forms of encyclopedias will appear, readymade with a mesh of associative trails running through them, ready to be dropped into the memex and there amplified.[1]

The Memex idea had an immediate bearing on the conception of the World Wide Web and also influenced Ted Nelson’s coinage of ‘hyperlink’ that mapped a single word in a document to other associative content. Douglas Engelbart inspired by Bush’s essay, invented an interface that aided the very metaphor of pinpointed navigation through hyperlinks — the X-Y Indicator — that later came to be known to the world as the Computer Mouse. Not much has changed in the ways by which humans have interacted at the interface level. The WIMP paradigm (Windows, Icons ,Menus and Pointers) has been here to stay.

The X-Y indicator that previously mapped motions made on a two dimensional track pad onto the screen has simply been infused onto touch screens. While this may have eased the process of visual design automation, could our interaction be more natural, expressive, immersive and creative? Our experience in the real world is multi modal and we communicate with others using our body, hands, visual cues and sound. Is there a way by which our interaction in the virtual world could closely mimic our real world behavior?

The answer to the above questions came around the same time that the mouse was invented — Myron Kreuger's Videoplace. Unarguably the first and finest immersive virtual reality created way back in the 1970s, ‘Videoplace’ combined two cultural forces — the television (a purveyor of passive experience) and computer (symbol of forbidding technology) to create an expressive medium for communicating playfulness and active participation. Kreuger argued that "computer art which ignores responsiveness is using the computer only for visual design automation, rather than as a basis for a new medium." Kreuger used image processing and gestural interaction as early as in the 70s to interact with virtual objects in the digital world and has inspired a whole generation of computer vision artists including the likes of Golan Levin. If one recalls the seemingly futuristic gestural interface that Tom Cruise used in the film ‘Minority Report’ — be assured it’s already here! Jaron Lanier, a pioneer in virtual reality systems who headed the National Tele Immersion Initiative developed the entire working set of the film.

It seems Kreuger’s work had remained in a niche closet due to early commercialization and large scale adoption of the XY mouse and touch devices. ‘User centric design’ has become increasingly device dependent and really only caters to enticing users to information that the interface wants to disseminate rather than let the user engage with the interface intuitively.

Today, natural interfacing techniques are regaining much commercial interest. A landmark event was the massively viral YouTube video of Johnny Lee Cheung hacking the Nintedo Wiimote’s infrared sensor to track the head movement of a user in real time and provide an illusion of 3-Dimensional Virtual Reality. Within a year, Microsoft hired Cheung to develop the Kinect Camera for gestural interaction with it’s X-box gaming console and also bought all assets of 3DV system’s 3D sensor ‘ZCam’ -- the most affordable option available to new media artists until then. Within a week of the Kinect’s release, it’s drivers were hacked and exposed by the opensource art community that responded to Adafruit’s USD 2000 Kinect hack challenge.

With similar gestural devices by ASUS and the much-awaited Leap sensor, we are on the brink of a paradigm shift in the ways of accessing information that shall redefine concepts in human computer interaction. Cognitive interface solutions by NeuroSky and Emotiv Systems have already paved the way to neuronal signal activated interactions and games. The OpenEEG project has propelled research into open hardware schematics for brain computer interaction.

The linear presentation of search engine results on a browser across millions of pages , I predict, will change this decade as the GUI will transform into a 4 Dimensional Space layered in time, with relevant search results being clustered onto a connected graph node structure and distanced based on their mutual relevance. This calls for a more natural interface that depends not on the traditional keyboard-mouse interaction but on the use of intelligent interfaces such as eye-tracking , gaze , gesture ,speech and thought waves to sift through large databases that shall present themselves in totality along with multimodal feedback to the user.

While all this will transform the ways in which the specially-abled shall access digital information, such transparent interfaces shall also raise a number of policy questions related to privacy and who knows ,one day, even freedom of thought!!

On one hand, we would like to see the price of natural interfaces being made affordable to the commoner, on the other it will require us to unlearn traditional means of information interaction that we have been made quite comfortably accustomed to. Until then it is anyone’s guess what Microsoft’s recent acquisition of Skype along with the desktop version of the Kinect would turn bedroom and boardroom interactions into!

Telecom While the potential for growth and returns exist for telecommunications in India, a range of issues need to be addressed. One aspect is more extensive rural coverage and the other is a countrywide access to broadband which is low. Banking and Accessibility in India: A Study on Banking Accessibility in India — Call for Comments

The adoption of accessible features and technologies by banks in India is low despite there being legislative and executive push for it. It is important for the banks to understand not just their obligations but also the benefits that will accrue to them if they follow the suggested guidelines.

Executive Summary

India is a signatory to the United Nations Convention on the Rights of Peoples with Disability, and has an obligation to provide equal opportunities and facilities to everyone, irrespective of any disabilities they might suffer from. This is guaranteed in the right to equality and the right to life, which are enshrined in the Fundamental Rights in the Constitution of India. There are also specific Reserve Bank of India notifications that mandate banks offer banking facilities in a non-discriminatory manner to all customers. However, there are still many problems faced by people with disabilities when accessing banking and financial services in India. Many banks and ATMs aren’t physically accessible, the staff has no training or expertise in dealing with customers who have special needs, and despite the existence of the technology, ATMs are not equipped to be used by people with disabilities.

There are several guidelines which are in place internationally which can be referred to when formulating policy on banking and accessibility in India. These include guidelines on ATM construction and modification (USA) and guidelines on making websites accessible for people with disabilities (the Web Content Accessibility Guidelines), as well as voluntary standards that have been taken up by Banking Associations in countries like Australia and New Zealand in order to making banking more accessible to people with disabilities and the older population.

Currently the adoption of accessible features and technologies in banks in India is very low, despite there being a legislative as well as executive push for the same. Banks which do not follow these guidelines are not meeting their legal requirements, and it is important for them to understand not just their obligations, but also the benefits that will accrue to them if they follow the suggested guidelines. To that end, this report looks at the current notifications and guidelines that govern this area, the problems faced by people with disabilities, and looks at guidelines from other countries to suggest solutions that can be incorporated by different banks in India.

The Hathitrust Judgment and its impact on TVI negotiations at WIPO

Those of you who have been following my earlier posts on the WIPO negotiations on the Treaty for the Visually Impaired will remember that one of the biggest concerns of the World Blind Union on the draft wording of the Treaty was with the definition of an “authorized entity” that can undertake conversion and distribution of accessible format copies.

Before the WIPO intersessionals began on October 17, 2012, the definition of “authorized entity” in the draft Treaty prescribed that only authorized entities that address the needs of beneficiary persons as one of their primary (in brackets) activities or institutional obligations can undertake conversion and distribution of books in accessible formats. This requirement is unacceptable since it will exclude many legitimate organisations and institutions that undertake these activities but who do not address the needs of beneficiary persons as a “primary” activity or institutional obligation. Some examples of such organisations/institutions are mainstream education institutions and mainstream libraries. Delhi University which has a large number of blind students will be excluded and this is unacceptable.

The main proponents pushing for the word "primary" was the United States and the European Union while India and other developing countries wanted the word to be deleted for obvious reasons. There was a virtual deadlock in the negotiations on this particular point.

The United States was pushing for the word “primary” because under US Copyright law, an authorized entity means a nonprofit organization or a governmental agency that has a primary mission to provide specialized services relating to training, education, or adaptive reading or information access needs of blind or other persons with disabilities. Under US law there was uncertainty as to whether educational institutions and libraries would be covered under the definition of “authorized entity”.

Enter the HathiTrust Judgment http://www.tc.umn.edu/~nasims/HathivAG10_10_12.pdf. The judgment, which was pronounced a few days before the October WIPO intersessionals by the New York Southern District Court, held that libraries and educational institutions fall under the definition of “authorized entities” under US law.

The US delegation to WIPO was instantly alerted about this judgment and was requested to negotiate broader wording for authorized entities under the Treaty as was now the position under US law.

At the intersessionals that concluded on October 19, as observers, we were not allowed into the room and the discussions were happening between the Member States but at the end of the intersessionals this is the proposed wording of authorized entity:

Authorized entity means an entity that is authorized or recognized by the government to provide education, instructional training, adaptive reading or information access to beneficiary persons on a non-profit basis. It also includes a government institution or non-profit organization that provides the same services to beneficiary persons as one of its primary activities or institutional obligations.

As can be seen from above, this definition is broader than the previous definition since the word primary has been deleted from the main definition and it explicitly covers educational institutions and libraries. It is also interesting to note that even for profit entities that provide the above services on a non-profit basis to beneficiaries are covered.

It remains to be seen what form the definition of authorized entities will take but the HathiTrust judgment has definitely helped in the negotiation process.

The next meeting of the Standing Committee on Copyright and Related Rights takes place in Geneva between November 19 and November 23, 2012.

WIPO General Assemblies Approve Road Map on Treaty for the Visually Impaired

In a significant development the 50th session of Assemblies of WIPO member states reached a breakthrough decision on how to complete negotiations on a pact to improve access to copyrighted works for the many visually impaired or print disabled people around the world.

The meeting of the General Assembly which concluded on October 9, 2012 approved a road map that could lead in 2013 to a historic diplomatic conference for an international treaty focused on improving access to published works for persons who are visually impaired or print disabled. The Standing Committee on Copyright and Related Rights (SCCR) will hold inter-sessional meetings from October 17-19, 2012 to work on the text of the instrument. The SCCR will meet from November 19-23, 2012 and will continue discussions on the text with the objective of concluding or substantially advancing the text-based work on this topic. Member states agreed to convene an extraordinary meeting of the General Assembly in December 2012 to assess progress on the text and decide whether to convene a diplomatic conference in 2013. Some 300 million blind or visually impaired people around the world stand to benefit from a more flexible copyright regime adapted to current technological realities. Individuals with reading impairment often need to convert information into Braille, large print, audio, electronic and other formats using assistive technologies. Only a very small percentage of published books around the world are available in formats accessible to the visually impaired.

At the closing of the Assemblies, WIPO Director General Francis Gurry welcomed the "extremely constructive engagement of member states" in the work of the Organization as demonstrated in the decisions taken by the Assemblies. He underlined the progress made by member states in setting timetables for concluding negotiations on international instruments on access to copyrighted work by the visually impaired, design law and intellectual property and genetic resources, traditional knowledge and folklore. The Chair of the WIPO General Assembly, Serbia's Permanent Representative to the United Nations in Geneva, Ambassador Uglješa Zvekić, also welcomed the positive outcome of the Assemblies which took stock of the work of the Organization and set timetables to conclude normative work in several areas. Representatives of regional groups, and individual member states, also welcomed the outcome of the Assemblies and the positive spirit among member states. Regional groups specifically underlined decisions to move forward in discussions on a treaty to facilitate access to copyrighted works by the visually impaired or print disabled.

New Team Members

Nitika Tandon: Nitika Tandon is a Program Officer with CIS. She has an MBA from Rotterdam School of Management, Netherlands and is a recipient of Dean's Fund Scholarship Program, Erasmus University.
Shiju Alex: Shiju Alex is a Consultant. His background is technical writing and he is interested in Indic language computing and community building for Indic language Wiki projects. Presently he works out of CIS office in Bengaluru.
Subhashish Panigrahi: Subhashish Panigrahi is a Programme Officer to CIS's Access to Knowledge programme and works out of CIS's Delhi office. His background is Business Development in Corporate Communications. He works on designing and implementing programs to provide on-wiki and off-wiki support for new editors.
Noopur Raval: Noopur Raval is working as Consultant - Communications for the Access to Knowledge team at CIS. Having previously worked in the media, she is currently pursuing her M.Phil in Cinema Studies from JNU, New Delhi.

Project

Creating a National Resource Kit for Persons with Disabilities: An Introduction (by Anandhi Viswanathan, September 28, 2012): CIS is engaged in a two-and-a-half year project starting from August 2012 to create a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India. This project is supported by the Hans Foundation. The Resource Kit will be brought out in both English and Hindi and disseminated to policy makers from panchayat to ministry levels throughout India. Breaking News on Electronic Accessibility (by Rahul Cherian, September 28, 2012): The Parliamentary Standing Committee constituted to study the Electronic Delivery of Services Bill has in its report explicitly recognized the concept of electronic accessibility and reasonable accommodation. This is the first time in the country that these two concepts have been reflected at the level of a Parliamentary Standing Committee in relation to a non-disability specific law.

Feedback to Draft Copyright Rules, 2012 (by Pranesh Prakash, September 29, 2012): submitted its written comments on the Draft Copyright Rules, 2012 to Mr. G.R. Raghavender, Registrar of Copyrights & Director (BP&CR), Ministry of Human Resource Development. Pranesh does a detailed analysis and provides recommendations on Rules 8,9,10, 29(6), 34(2), 37, 71(3), 72, 74(1), 74(6), 75, and 79 (3) and (4).

Projects

Access To Knowledge/Programme Plan: Pursuant to the announcement made on July 30, 2012 of a 22 months ‘grant’ (beginning from September 1, 2012 to July 31, 2014) of upto INR 26,000,000 and as reflected in the FAQ accompanying the announcement, the Wikimedia Foundation’s India Program will become a project of the Access to Knowledge (A2K) program of CIS. The prime objective is to support the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects and supporting India-focused efforts to improve the quality of India-relevant content on Indic languages and English Wikimedia projects.
Pervasive Technologies: Access to Knowledge in the Marketplace (by Jadine Lannon, September 25, 2012): Jadine Lannon gives an introduction to the new A2K research initiative. Pervasive technologies have flooded the Indian market and are changing the ways in which the average Indian accesses knowledge but very little is understood about these technologies, particularly when it comes to their legality. CIS hopes to do a research that aims to understand how pervasive technologies interact with Intellectual Property laws and what can be done to protect these technologies from being labelled “illegal” and eradicated from the Asian market.

DNA Profiling Bill
International DNA experts Helen Wallace from GeneWatch UK, and Jeremy Gruber from the Council for Responsible Genetics from the United States visited Bengaluru and Delhi and shared their experience in DNA sampling and gave feedback to the DNA Profiling Bill. Meetings were conducted with lawyers and the plaintiff in the Pascal Mazurier's rape case and with VR Sudarshan and Hormis Tharakan. There was a coverage of the event in Kannada media. The First Punjabi Wikipedia Workshop (by Shiju Alex and Subhashish Panigrahi, September 27, 2012): This post is about the first Punjabi Wikipedia workshop held in Ludhiana, Punjab on July 28, 2012. Surinder Wadhawan, a Mumbai based Wikipedian played an important role in designing this workshop and introducing Punjabi Wikipedia to the Punjabi speakers. Long-term Punjabi wikipedian G.S.Guglani also joined this workshop. The event was covered in the Tribune, Hindustan Times, Punjab Infoline, and YesPunjab.com.
Punjabi Wikipedia Workshop at Punjabi University, Patiala (by Shiju Alex and Subhashish Panigrahi, September 28, 2012): A Wikipedia workshop was organized at the Punjabi University's Punjabi Department on August 16, 2012. Veteran Punjabi wikipedian G.S. Guglani came forward to spread the message of Punjabi Wikipedia among Punjabi speakers.
Punjabi Wikipedia Workshop at Amritsar (by Shiju Alex and Subhashish Panigrahi, September 30, 2012): The workshop was held at the Spring Dale Senior School, Amritsar on August 17, 2012. Nearly 50 participants including students and teachers from eight different schools apart from the students and teachers of Spring Dale School attended the workshop. One of the active and long-time Punjabi Wikipedian Guglani Gurdip Singh led the workshop with the active support from Shiju and Subhasish.
Wikipedia Workshop in British Library, Chandigarh (by Subhashish Panigrahi, September 27, 2012): A Wikipedia workshop was organized in Chandigarh by the British Library over two days on August 24 and 25, 2012. Bipin Kumar, Head of British Library and Christina, Deputy Manager had pivotal roles in designing this workshop with support from Piyush, a wikipedian. The session on Day 1 was conducted by Subhashish Panigrahi and the session on Day 2 was conducted by Subhashish and Piyush.
Kannada Wiki Workshop at Tumkur University (Tumkur, Karnataka, September 15, 2012): This was the first Kannada Wikipedia workshop at Tumkur. Prof. Ashwin Kumar from the Department of English, Tumkur University and Kannada wikipedians, Om Shiva Prakash, Hareesh, Tejus and Pavithra played vital roles in organising this workshop. Shiju Alex participated in this workshop. About 30 participants including students and teachers participated in this workshop.

HasGeek HasGeek creates discussion spaces for geeks and has organised conferences like the Fifth Elephant, Droidcon India 2011, Android Camp, etc. HasGeek is supported by CIS and works out from CIS office in Bengaluru. Digital Natives

Digital Natives with a Cause? examines the changing landscape of social change and political participation in light of the role that young people play through digital and Internet technologies, in emerging information societies. Consolidating knowledge from Asia, Africa and Latin America, it builds a global network of knowledge partners who critically engage with discourse on youth, technology and social change, and look at alternative practices and ideas in the Global South:

All our complex interactions, emotional negotiations, business transactions, social communication and political subscriptions online can be reduced to a string of 1s and 0s, as machines create the networks for the human beings to speak.”

Pathways to Higher Education

The Pathways Project to Higher Education is a collaboration between the Higher Education Innovation and Research Applications at the Centre for the Study of Culture and Society and CIS. The project is supported by the Ford Foundation and works with disadvantaged students in nine undergraduate colleges in Maharashtra, Karnataka and Kerala, to explore relationships between Technologies, Higher Education and the new forms of social justice in India. Training workshops were organised in the month of September at Xaviers in Mumbai on September 6, 2012 and in Newman College, Thodupuzha from September 17 to 20, 2012. Each workshop had 25-30 undergraduate students from socio-economically disadvantaged backgrounds. They were trained to use digital technologies in order to think through problems of social justice.

Researchers at Work

From 2012 to 2015, the RAW series will build research clusters in the field of Digital Humanities. The Habits of Living: Global Networks, Local Affects is a global collaborative project to renew the conceptual power of networks. It concentrates on changing the habits of living. The Department of Modern Culture and Media at Brown University is an important locus.

Building Knowledge and Capacity around Telecommunication Policy in India

Ford Foundation has given a grant of USD 2,00,000 to CIS to build expertise in the area of telecommunications in India. The knowledge repository deals with these modules: Introduction to Telecommunications, Telecommunications Infrastructure and Technologies, Government of India Regulatory Framework for Telecom, Telecommunication and the Market, Universal Access and Accessibility, The International Telecommunications Union and other international bodies, Broadcasting, Emerging Topics and Way Forward. Dr. Surendra Pal, Satya N Gupta, Paranjoy Guha Thakurta, Payal Malik, Dr. Rakesh Mehrotra and Dr. Nadeem Akhtar are the expert reviewers.

CIS was registered as a society in Bangalore in 2008. Creating a National Resource Kit for Persons with Disabilities: An Introduction

The Centre for Internet & Society is engaged in a two-and-a-half year project starting from August 2012 to create a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India. This project is supported by the Hans Foundation. The Resource Kit will be brought out in both English and Hindi and disseminated to policy makers from panchayat to ministry levels throughout India.

CIS hopes that this resource kit will immensely benefit the disabled community in India by providing them with a ready reference on the facilities given by the government.

More often than not a facility isn’t enjoyed by the public as no one knows about its existence. It becomes important then to make it accessible and give it exposure. The National Resource Kit of Laws, Policies and Programmes for Persons with Disabilities will fill this gap of lack of comprehensive information in this field.

The rights of persons with disabilities have for long been a topic of international discussion in various forums. It is essential to not just promote, protect and ensure the full and equal enjoyment of all human rights of persons with disabilities but also promote respect for their dignity. Making legal provisions for the rights of persons with disabilities is not only a mechanism that ensures that they have access to human rights but also a tool that enables them to contribute to the growth of their nation by providing them with the facilities that aid them in overcoming their challenges and enable them to lead fruitful lives.

To provide persons with disabilities in India equal opportunity for liberty, equality and dignity on par with all citizens, India has enacted three disability laws:

Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.
National Trust for Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disability Act, 1999.
Rehabilitation Council of India Act, 1992.

India is now in the process of drafting a new law on the rights of persons with disabilities that aims to fill the gaps in the earlier laws through a deeper understanding of the real issues faced by them and providing solutions and opportunities on par with international standards.

Despite the existing legal provisions, the populace that continues to struggle with consuming issues like overpopulation, poverty, unemployment and lack of resources, often tend to neglect issues which concern persons with disabilities. An overwhelming public opinion that considers persons with disabilities to be incapable of making meaningful contribution to the society due to their disability has led to the exclusion of persons with disabilities from mainstream society.

One of the major reasons for this exclusion and neglect is the lack of awareness about the various facilities being extended by the government to persons with disabilities targeted at enabling them to overcome their challenges. Generating awareness by providing them with information that will help them gain access to education, vocational skills, employment training and opportunities and healthcare is a vital step in ensuring that the legal rights of persons with disabilities are enabled for them.

WIPO Treaty for the Visually Impaired — Moving from a Treaty on Paper to a Treaty that is Workable on the Ground

After many years of hard lobbying by the World Blind Union, it appears that the WIPO Treaty on limitations and exceptions for visually impaired persons/persons with print disabilities (TVI) could become a reality next year. However, due to pressure from the European Union and the United States, and their insistence on several untenable provisions, there is a real risk that the TVI could become unworkable on the ground.

The following is a list of concerns that must suitably be addressed if the TVI is to make a realistic dent in the “book famine” in which only a few per cent of books are available in accessible formats that persons with print disabilities can read.

Definition of authorised entity to be widened.
The current definition of authorized entity prescribes that only authorized entities that address the needs of beneficiary persons as one of their primary (in brackets) activities or institutional obligations can undertake conversion and distribution of books in accessible formats. This requirement is unacceptable since it will exclude many legitimate organisations and institutions that undertake these activities but who do not address the needs of beneficiary persons as a "primary" activity or institutional obligation. Some examples of such organisations/institutions are mainstream education institutions and mainstream libraries. Delhi University which has a large number of blind students will be excluded and this is unacceptable.
Authorised entities must be required to follow simple rules and procedures when converting and distributing works in accessible formats.
As is proposed now, authorized entities could be required to follow complex rules and procedures with respect to the permitted activities. In this connection it is critical to note that:
- Smaller organisations will not be in a position to keep organised records. Therefore smaller organisations that serve rural or small populations must not be subject to a requirement to keep records where they do not distribute accessible formats in electronic form.
- There must be no requirements for organisations to apply Technology Protection Measures to accessible formats in electronic form.
- While organisations can inform beneficiary persons to whom they supply accessible formats that there must be no subsequent distribution to non-beneficiary persons, an organisation should have no obligation to oversee the use by the beneficiary persons they supply accessible formats to, or any responsibility for misuse by beneficiary persons they supply accessible formats to.
- There must be no requirement to share the records that organisations are required to keep with any person or entity other than in the eventuality of copyright infringement proceedings.
The rules and procedures must therefore be simplified to reflect the above.
The exception must automatically kick in if the relevant accessible formats are not available in the market on the same day as the mainstream format.
At present there is no clarity on when the exception kicks in and the existing wording can be interpreted such that the exception may apply only after significant time has passed after the books are available in the market in the mainstream format. If a work is made available in the market in a mainstream format it is essential that beneficiary persons can enjoy the work in the relevant accessible format at the same time. Failure to do so is discriminatory towards beneficiary persons. In this connection, the TVI must expressly clarify that if the accessible format copy is not available on the same day as the mainstream format, the exception automatically applies and authorised entities and beneficiary persons can create accessible format copies on the same day that the mainstream format is commercial available.
This will also be an incentive for rights holders to take steps to ensure that accessible format copies are made commercially available on the same day as mainstream formats.
“Making available” to be possible through wire and wireless means.
One of the proposed changes to the TVI is the clarification that “making available” accessible format copies to the public should be as per Article 8 of the WIPO Copyright Treaty thereby expressly providing for communication to the public, by wire or wireless means, including the making available to the public in such a way that members of the public may access works from a place and at a time individually chosen by them. Given that technology is making it increasingly possible for beneficiary persons to access accessible format copies over wire and wireless means, this is clarification is very critical.
The Authorised Entity in the exporting country must not have any obligation to verify any form of legal eligibility in the importing country.
As per the current wording of the TVI an authorized entity in one Member State:
- Must, when exporting to beneficiary person in another Member State, verify whether that other Member State would permit that beneficiary person to make or import that accessible copy; and
- Can only export to an entity or organization in another Member State that the originating authorizing entity has identified as another authorized entity.
It is obvious that authorised entities in one country cannot verify the above with any degree of certainty and therefore it is impossible for authorised entities to comply with this requirement. Moreover, as in the case of all copyright exceptions and limitations, rights holders have the right to take copyright infringement action against any person or entity that operates outside, or exceeds, the exception. This requirement relating to the verification legal legibility must therefore be deleted.
Member states having the flexibility to decide whether to link exceptions to commercial availability.
At present, the draft TVI provides Member States the flexibility to decide whether to confine permitted activities to instances where there is no commercial availability of accessible format copies. This flexibility is critical for Member States since the economic and distribution ground realities in each Member State vary widely and only a Member State can decide this issue conclusively for its own circumstances. Any attempt to change this position in the TVI must be opposed.
In short, barring the above issues, the Treaty appears to heading in the right direction. The upcoming intersessionals in Geneva (17-19th October 2012) to discuss the text of the Treaty will be crucial to decide the fate of the Treaty. Watch this space.

Breaking News on Electronic Accessibility

The Parliamentary Standing Committee constituted to study the Electronic Delivery of Services Bill has in its report explicitly recognized the concept of electronic accessibility and reasonable accommodation. This is the first time in the country that these two concepts have been reflected at the level of a Parliamentary Standing Committee in relation to a non-disability specific law.

This Bill, which deals with the electronic delivery of public services, had several drawbacks when it came to access of public services by persons with disabilities. Inclusive Planet Centre for Disability Law and Policy (www.inclusiveplanet.org.in) had submitted a note with inputs from 30 organisations, to submit to the Parliamentary Standing Committee on the Electronic Delivery of Services Bill. The submissions to the Standing Committee included the concerns of persons with disabilities and the possible solutions to address the gaps in the Bill. The Report of the Committee has now been made public. The Standing Committee has accepted the points made in the submissions.

The three major changes recommended by the Committee based on the submissions are the given below. The relevant extracts of the Committee’s report have been compiled by Vaishnavi Jayakumar and are available here (http://goo.gl/P3CKX).

a. Recognition of Electronic Accessibility

In response the questions raised by the Committee based on the input that was submitted, it is now proposed to amend the definition of “assisted access” from “assistance to access electronic services” to “assistance to access electronic services by the users including users with special needs” This is the first time that electronic access for persons with disabilities could be recognized by a non-disability specific legislation in India.

b. Recognition of the Necessity of Providing Various Forms of Assistance

The Committee emphasized that the specific needs of the differently-abled persons like providing hard copy documents/forms in Braille and large print or for using thumb impressions instead of signatures while submitting the form or receiving the services/provision for providing intermediaries/professional sign language, interpreters, locations for offices for availing services for the purpose of EDS at the ground floor, etc., should specifically be taken care of while formulating rules.

c. No Removal of Commissioners on the Ground of Disability Without Providing Reasonable Accommodation

The Committee has concluded that in light of India’s obligations under the UNCRPD, though the clauses relating to removal of Commissioners were on par with those in other Statutes, appropriate rules/amendments to the Bill could be moved to mandate reasonable accommodation. This again is potentially the first time that a non-disability specific legislation will include the prerequisite for reasonable accommodation to be provided to a person holding a statutory post who has a disability/becomes disabled during the course of his tenure.

News reports indicate that this Bill will be introduced in the winter session of Parliament. This Bill, if passed, will be a welcome precedent for the disability sector to replicate in other legislations.
