Greetings from the Centre for Internet and Society! In this issue we are pleased to present you the latest updates about our research, upcoming events, and news and media coverage.

Researchers@Work

RAW is a multidisciplinary research initiative. CIS believes that in order to understand the contemporary concerns in the field of Internet and society, it is necessary to produce local and contextual accounts of the interaction between the Internet and socio-cultural and geo-political structures. To build original research knowledge base, the RAW programme has been collaborating with different organisations and individuals to focus on its three year thematic of Histories of the Internets in India. Monographs finalised from these projects are online for peer review.

Digital Natives with a Cause?

Digital Natives with a Cause? is a knowledge programme initiated by CIS and Hivos, Netherlands. It is a research inquiry that seeks to look at the changing landscape of social change and political participation and the role that young people play through digital and Internet technologies, in emerging information societies. Consolidating knowledge from Asia, Africa and Latin America, it builds a global network of knowledge partners who want to critically engage with the dominant discourse on youth, technology and social change, in order to look at the alternative practices and ideas in the Global South. It also aims at building new ecologies that amplify and augment the interventions and actions of the digitally young as they shape our futures.

Accessibility

Estimates of the percentage of the world's population that is disabled vary considerably. But what is certain is that if we count functional disability, then a large proportion of the world's population is disabled in one way or another. At CIS we work to ensure that the digital technologies, which empower disabled people and provide them with independence, are allowed to do so in practice and by the law. To this end, we support web accessibility guidelines, and change in copyright laws that currently disempower the persons with disabilities.

Internet Governance

Although there may not be one centralized authority that rules the Internet, the Internet does not just run by its own volition: for it to operate in a stable and reliable manner, there needs to be in place infrastructure, a functional domain name system, ways to curtail cyber crime across borders, etc. The Tunis Agenda of the second World Summit on the Information Society (WSIS), paragraph 34 defined Internet governance as “the development and application by governments, the private sector and civil society, in their respective roles, of shared principles, norms, rules, decision-making procedures, and programmes that shape the evolution and use of the Internet.” CIS involvement in the field of Internet governance has taken the following shape:

CIS is doing a project, ‘Privacy in Asia’. It is funded by Privacy International (PI), UK and the International Development Research Centre, Canada and is being administered in collaboration with the Society and Action Group, Gurgaon. The two-year project commenced on 24 March 2010 and will be completed as agreed to by the stakeholders. It was set up with the objective of raising awareness, sparking civil action and promoting democratic dialogue around challenges and violations of privacy in India. In furtherance of these goals it aims to draft and promote over-arching privacy legislation in India by drawing upon legal and academic resources and consultations with the public.

Making Voices Heard: Privacy, Inclusivity, and Accessibility of Voice Interfaces in India

We believe that voice interfaces have the potential to democratise the use of internet by addressing barriers such as accessibility concerns, lack of abilities of reading and writing on digital text interfaces, and lack of options for people to interact with digital devices in their own languages. Through the Making Voice Heard Project supported by Mozilla Corporation, we will examine the current landscape of voice interfaces in India.

Making Voices Heard: Project Announcement

Although voice enabled interfaces are being deployed there is a need to understand how they are beneficial, and what have been important knowledge gaps and challenges in their development, adoption, use, and regulation. Through the Making Voice Heard Project supported by Mozilla Corporation, we will be examining the current landscape of voice interfaces in India, and seek to address the following questions:

What is the broad (sectoral and functional) typology of available voice interfaces in Indian languages? How widely are these voice interfaces (in Indian languages) used, and what barriers prevent their further adoption and use?
What are concerns related to privacy and data protection that emerge with the growth of voice interfaces? What kind of protocols for data processing may need to be built into the design of these interfaces?
How accessible are these interfaces for persons with disabilities (PWDs)? What kinds of accessibility features, especially for Indian languages, may need to be developed to ensure effective use of voice technologies by PWDs?
Where do challenges in these three areas intersect? For instance, is compromising on users’ privacy, including weak or missing data protection regulations, required to create comprehensive speech datasets that may help develop better accessibility features, and address linguistic barriers?

In order to approach these questions we have begun mapping the various developers and users of voice interfaces in India. In the next stage of the process we will be looking at these interfaces through the lens of privacy, language, accessibility, and design. In order to add to the mapping and questions, we will be conducting interviews and workshops with users, developers, designers and researchers of voice interfaces in India, including the Common Voice team at Mozilla.

Making Voices Heard

We are happy to announce the launch of our final report on the study ‘Making Voices Heard: Privacy, Inclusivity, and Accessibility of Voice Interfaces in India. The study was undertaken with support from the Mozilla Corporation.

We believe that voice interfaces have the potential to democratise the use of the internet by addressing limitations related to reading and writing on digital text-only platforms and devices. This report examines the current landscape of voice interfaces in India, with a focus on concerns related to privacy and data protection, linguistic barriers, and accessibility for persons with disabilities (PwDs).

The report features a visual mapping of 23 voice interfaces and technologies publicly available in India, along with a literature survey, a policy brief towards development and use of voice interfaces and a design brief documenting best practices and users’ needs, both with a focus on privacy, languages, and accessibility considerations, and a set of case studies on three voice technology platforms. Making Public Libraries Accessible to People with Disabilities

Dear Sir/Madam

Sub: Making Public Libraries Accessible for Persons with Disabilities

We, the organizations representing persons with disabilities listed at the end of this document would like to bring to your attention for your urgent remedial action on the barriers faced by persons with disabilities in accessing public libraries in the country.

As you are aware, India has approximately 150 million persons with disabilities[1]who have the inalienable fundamental right to life as enshrined in the Constitution including the right to seek knowledge and education. Public libraries play a critical role in creating an enabling environment for citizens to gain knowledge, information and education. This is particularly true in the case of persons with disabilities who have limited access to purchase books through mainstream shops due to various barriers including lack of physical access to shops, lack of availability of books in accessible formats like Braille, etc. India has signed and ratified the United Nations Convention on the Rights of Persons with Disabilities, and therefore India is required to "to take all appropriate measures, including legislation, to modify or abolish existing laws, regulations, customs and practices that constitute discrimination against persons with disabilities[2], "to develop, promulgate and monitor the implementation of minimum standards and guidelines for the accessibility of facilities and services open or provided to the public[3]” and take all appropriate measures to ensure that persons with disabilities enjoy access to libraries[4]

The recent copyright amendments enabling libraries to convert their collections into accessible formats free of cost for the benefit of persons with disabilities coupled with technological developments in the form of cost effective screen reading software have created an unprecedented opportunity to make libraries accessible to persons with visual impairment and dyslexia. Additionally increased clarity on standards for physical access also now enables libraries to be made physically accessible without expensive modifications to enable wheelchair users and those with limited mobility access the libraries.

We understand that the Ministry of Culture has constituted a high powered committee as part of the National Mission on Libraries to look into revamping the library system in the country. We urge that the issue relating to making public libraries accessible to persons with disabilities is taken up by the government on a fast track basis, a separate budget is allocated for this exercise and libraries are made accessible on a priority basis. Please find attached a brief note on the steps to be taken to make libraries accessible to persons with disabilities.

We recommend that regional consultations are conducted through which additional data can be gathered on regional/language/types of communication/availability of power and related issues. We also urge you take steps to extend library services to rural areas across the country. We are happy to assist the government in this initiative. Making Public Libraries Inclusive For Persons With Disabilities – An Overview

Problem Statement

It is estimated that India has approximately 150 million persons with disabilities[5] (“PWDs”). Depending on their disability, PWDs have varying degrees of problems in accessing libraries and the material available at libraries. PWDs cannot access the premises of libraries since the buildings themselves are not accessible. People who are blind or have low vision cannot access reading material in libraries since the reading materials are not in formats that are accessible. It is estimated that less than 0.5% of books are available in formats that are accessible by people who are blind or have low vision. It is therefore critical that libraries in India are made inclusive so as to become accessible by PWDs.

Suggestions For Improvement

Given below are suggestions to make the public library system inclusive to PWDs based on internationally recognized best practices:

Accessibility
Structural modifications must be made to the library to ensure that PWDs can use the library building easily and safely, without any barriers or obstructions. Some of the modifications required include accessible parking, clear paths of travel to and throughout the facility, entrances with adequate, clear openings or automatic doors, handrails, ramps and elevators, accessible tables and public service desks, and accessible public conveniences such as toilets, and drinking fountains. Other reasonable modifications may include visible alarms in toilets and general usage areas and signs that have Braille and easily visible character size, font, contrast and finish.

Accessible Formats and Library as a Distribution Centre
People, who are blind, have low vision, dyslexia and other print disabilities cannot access reading materials in printed formats. They require reading material in “accessible formats” such as Braille, large print, audio recordings and electronic formats including digital talking books. In addition, people with some disabilities may find it difficult to come to the library. Under the recently amended Copyright Act libraries can convert books into the accessible formats specified above free of cost and without requiring permission from publishers and can distribute them in physical form and in electronic form including over the Internet to persons with disabilities.

Libraries now have the unprecedented opportunity to create an extensive collection of reading material in the accessible formats mentioned above in English and all Indian languages and make them available at the library in the form of physical copies, on CDs and other media, as well as over the Internet. The catalog of the collection must be in accessible formats. For digitization of books State Level Focal Points to be created for this purpose possibly at State level libraries. For further information on the standards to be adhered to when the library undertakes digitization see Annexure 2. State Level Focal Points will get production done through outsourcing or with some inhouse facilities for production of digital content. A National Level Focal point with full time staff will be required for standardization and networking between the State Level Focal Points and maintaining the central server as mentioned below. The central server will have a database containing digital copies of works in accessible formats created by the State Focal Points and other organizations that undertake the conversion of material into accessible formats such as the National Federation of the Blind[6], All India Confederation of the Blind[7], Daisy Forum of India[8] and the Indian Institute of Cerebral Palsy.[9] Requests for books in accessible formats can be sent to these organizations as well. The central server will also be connected to the Braille presses. Each public library at the district level will act as a distribution point for accessible formats and will be connected to the central server so that requests for books at each of the libraries can be sourced from the database on the central server. This is advantageous as the list of books available at each library will be constantly updated once they are added to the database. In addition, persons with disabilities must be able to download books in accessible formats from the database without coming to the library.

The website of each library must contain the catalog of material available in accessible formats and the services provided for persons with disabilities. The website of the libraries and the centralized database must adhere to the Web Content Accessibility Guidelines (WCAG) 2.0 as outlined by the World Wide Web Consortium (W3C) so that persons with print disabilities can access the websites and the database. Each library must take orders for accessible books from library users over the internet and over the telephone and source the books from other libraries. Libraries must work together to enable interlibrary exchange of books in accessible formats including hard copy Braille books.

All existing books published in India must be digitized over a period 7 years and all new books must be digitized within 60 days of their first publication in India. Special efforts must be made to provide accessible formats in Indian languages as these are extremely limited. An advisory committee consisting of specialist representatives from disability organizations, among others, may be constituted to oversee the implementation of this project. The expert committee will be associated with both the National Level Focal Points and the State Level Focal Points.
Assistive Aids and Equipment
PWDs require certain assistive aids and equipment to be able to fully utilize the services of the library and the information available therein. Some forms of accessible formats specified above can only be accessed using assistive aids. Libraries must provide the assistive aids/equipment specified in Annexure 3.
Training and sensitization
Adequate training and sensitization must be given to library staff to ensure that they are able to interact with PWDs. This training can be in the nature of a short refresher course and the training and sensitization programs must be evolved in consultation with the disability sector and must be conducted with the assistance of experts in the disability space.
Specialized personnel and services
The library should have a dedicated person to interact with persons with disabilities. This person should have a background in disability, highly motivated, familiar with sign language and also be responsible for providing specific assistance required by persons with disabilities such as guiding them to print out books in Braille, procuring books from the online database etc. The library should offer specialized services to PWDs including a telephonic help line and home delivery of books ordered online or over the phone and reading service at designated times at the library. It is pertinent to note that literature for the blind has no postal fees. Each library must have a specific section on disability related reading material. It is also essential to cooperate with other libraries around the world to share learning.

Accessibility

a. Outside the library

The main gate of the entrance of the library must be made accessible in accordance with applicable accessibility standards. If the main entrance cannot be made accessible, a secondary accessible entrance should be provided.
At least covered three parking spaces marked with the international symbol of Accessibility (wheelchair symbol) close to the library entrance must be provided.
Clear and easy to read signposting must be provided.
Unobstructed and well lit access paths from the main gate to the entrance of the library must be provided. All steps must be replaced/complimented with ramps having less than 5% gradient, with railings on both sides.
Smooth and non-slip surface must be used throughout.

b. Getting into the library

A person using any kinds of support such as wheelchair, crutches or walker, cane, or guide dog, should be able to enter through the door and pass through security check points, if any, without encountering obstacles.
All mobility aids and assistive devices including wheelchairs, walkers, communicators among others must be able to pass through security checkpoints, if any.
Applicable accessibility standards must be adhered to.
Sufficient space must be provided in front of the door to allow a wheelchair to turn around.
Entrance door should be wide enough to allow a wheelchair to enter.
Non-automatic doors should be operable using one hand.
Glass doors, if any, must be highlighted with contrast colour band at eye level to prevent persons with low vision banging into these.
Stairs and steps edges must be marked with a contrasting color band.
Pictogram signs must be provided for services and amenities such as toilets, elevators, stairways.
Elevators, if any, must be well lit with buttons and signs in Braille and synthetic speech.
Elevator buttons reachable from a wheelchair.
At least 5 wheelchairs (preferably motorized) or mobility scooters must be made available for use by persons with physical disabilities

c. Inside the library

All parts of the library should be accessible.
The catalogs must be available in accessible formats.
Clear and easy-to-read signs with pictograms must be provided.
Service desks should be located close to the entrance.
A certain number of tables and computer workstations should be adapted for persons in wheelchairs.
Shelves must ideally be reachable from a wheelchair
Chairs with sturdy armrests must be provided
Unobstructed aisles between bookcases must be provided and wide enough to accommodate wheelchairs and one person not on a wheelchair.
Visible and audible fire alarms must be provided.
Non-fluorescent lighting. In case fluorescent lighting is used there must be an area free of visual clutter and sharp light contrasts, with plain walls and cubicles.
Printers must be kept in areas away from reading areas to reduce sound in the reading areas.
Suitable sound insulation to be used to minimize sound in the reading areas.
Stack area should have clear aisle space for wheelchair and bi-lateral crutch users (3ft. min.). Where book stacking is in shelves and areas beyond reach of persons with disabilities using mobility aids, human assistance should be available to access books.
Plants inside the space can help with air filtering, which can make a huge difference to the level of comfort.

d. Toilets

The library should have at least one toilet for PWDs, equipped with the following:

Clear signs with pictogram indicating the location of the toilets
Door wide enough for a wheelchair to enter and sufficient space for a wheelchair to turn around
Room enough for a wheelchair to pull up next to the toilet seat
Toilet with handles and flushing lever reachable for persons in wheelchairs
Alarm button reachable for persons in a wheelchairs
Washbasin, mirror at the appropriate height

e. Information Desk and Circulation desk

The desks must be of adjustable height to enable persons in wheelchair to be able access the desk
Chairs must be provided at the desk
Induction loop system for hearing impaired persons

Annexure 2

Standards for material converted into digital formats by libraries

Master Digital Documents of converted material must be maintained in DAISY XML format.
All Master Digital Documents in Indic Languages must be encoded in Unicode [UTF8/16] and formatted using a royalty-free Open Type Font.
All Master Digital Documents must be tagged according to DAISY standards to capture semantic information for parts, units, chapter headings, subsections, pagination, ordered and un-ordered list, tables, images along with their alternative text, math equations, title, author, footnote, end-note, text box, abbreviation, acronym, etc.
Metadata information about the publication as prescribed in the DAISY Standards must be added to all Master Digital Documents.
Distribution of digital copies of the Master Digital Documents through web sites or otherwise must be done in epub format.
If other standards are used for different target populations those standards must be compliant with the National Open Standards Policy and the Interoperability Framework for E-Governance in India.

Assistance Aids/Equipment

For assisting persons with Visual Impairment or blindness or autism spectrum disorders:

Persons with vision impairments or blindness or autism spectrum disorders would benefit from software and hardware for enlarging displays on the monitor or reading material through a speech synthesizer.

Some of the most common assistive aids/equipment are:

For magnification

Screen-magnification software. This program allows people with low vision to access computer information by enlarging the screen display or tailoring the display to accommodate their disability.

Large magnification devices such as closed-circuit television magnifiers (CCTV). This system employs a video camera lens to enlarge text from three to thirty times normal text size

Handheld magnifiers

For Screen reading

Screen reader software programs enables individuals who are blind or visually impaired to access the information on a computer screen through voice output. Some examples are NVDA (an open source software) or Dolphin or Jaws (proprietary software). Screen reading software with Indian language support must be provided. Scanning and reading software helps those with low or no vision. Scans printed text and verbalizes the text via synthetic speech using optical character recognition technology.

At least one computer must face outward and not against the wall since people with autism spectrum disorders find it disturbing to have people walking behind them.

For Braille support -

Braille Translating Software - To produce correctly formatted and coded Braille one needs a Braille Translation Software. A document prepared by a word processing program is loaded into the translation software. The final document may be printed in Braille by a Braille embosser.
Braille Embosser - Braille embossers print Braille output from a computer by punching dots onto paper and enable users to make hard copies of documents.
Refreshable Braille displays and DAISY players.

All multimedia content to have audio descriptions

For Assisting people with Hearing Impairment or Deafness

Users with deafness or have hearing impairments do not have problems using the computer except problems will arise from programs and websites that have audio cues.

Sound Sentry This option directs the operating system to display a visual signal when a sound is generated by a Windows application. Sound sentry in built into Windows and Apple operating systems.
All multimedia content to have captions

For Assisting people with Learning Disabilities

Specialized software programs and hardware for people who have learning differences will display print as well as provide auditory reading of the text simultaneously.

For Assisting people with Physical Disabilities

Persons with physical disabilities may need assistance in using the computer apart from having physical accessibility. The following items increase computer usability and safety:

Special input devices such as trackballs, joysticks, switches, touch pads, and augmented keyboards (micro keyboards or oversize keyboards with enlarged keys)
A computer camera/tracker allows users to manipulate the cursor through head movement.
Software utilities that replaces the functionality of a standard keyboard with a full-featured, onscreen keyboard.
Speech to text software such as Dragon Naturally Speaking
Motorized wheelchairs to be used by physically impaired users especially motorized chairs whose seat can raise so that users can reach books on higher shelves on the rack.
Availability of reachers to access books that may be placed too low or too high on the book rack.

Linking Commercial Availability and Exceptions in the Treaty for Visually Impaired/Persons with Disabilities

After the landmark WIPO General Assembly meeting in December 2012 that decided to convene a diplomatic conference in June 2013 on the Treaty for Visually Impaired Persons/Persons with Print Disabilities, the Special Session of the Standing Committee on Copyright and Related Rights starting on February 18, 2013 is critical, says Rahul Cherian.

It is probably the last chance to sort out the major outstanding issues in the text of the document before the diplomatic conference and if some of these issues are not resolved soon, the diplomatic conference could end without a fruitful conclusion.

One of the most critical issues that remain outstanding is the desire that some government negotiators have to link the use of the treaty provisions or copyright exceptions to commercial unavailability of the work in accessible formats.

The publishing lobby, and consequently the European Union most notably, insist that the exceptions should kick in only when the works in accessible formats are not commercially available at reasonable prices. The definition of "reasonable price for developing countries" as it stands now "means that the accessible format copy of the work is available at prices that are affordable in that market, taking into account the needs and income disparities of persons who have limited vision and those with print disabilities". The definition of "reasonable price for developed countries" as it stands now "means that the accessible format copy of the work is available at a similar or lower price than the price of the work available to persons without print disabilities in that market." It is be noted that there are a few suggestions for changes of wording of the definition but in effect what this wording means is that exceptions should apply only when the accessible format copies are not available at a reasonable price.

At first glance this seems a perfectly sound proposition. I mean, if sighted people have to buy a book, then why shouldn’t beneficiaries under the Treaty also buy a book in an accessible format if it is available at a reasonable price?

The problems with this crop up if you look deeper. The linkage between commercial availability and the exceptions appear at two places in the Treaty. In Article C which deals with national exceptions the following is proposed: "A Member State/Contracting Party may confine limitations or exceptions under this Article to published works which, in the particular accessible format, cannot be obtained commercially under reasonable terms for beneficiary persons in that market".

In Article D which deals with exceptions for export of accessible format copies the following two alternatives are proposed:

Alternative A: [The Member State/Contracting Party may limit said distribution or making available of published works which, in the applicable accessible format, cannot be otherwise obtained within a reasonable time and at a reasonable price, in the country of importation].

Alternative B: [A Member State/Contracting Party should/shall(/may) prohibit said distribution or making available to published works where the exporting authorized entity, prior to making available or distribution, knew or should have known that a copy in the particular accessible format could have been obtained through the distribution channels customary to the beneficiary persons, (under reasonable terms, including) at prices that take account of the needs and incomes of beneficiary persons in the country of importation, (as well as the cost of producing and distributing the work)].

Concerns with linking commercial availability and exceptions

Impossibility of verifying commercial availability with any degree of certainty
Imagine that the recently introduced Indian copyright exceptions for persons with disabilities stated that the exceptions are not available to published works which, in the particular accessible format, can be obtained commercially under reasonable terms (luckily this is not the case currently). What would this mean practically? It would mean that every person with disability who benefits from the exception and every NGO working for the person with disability would firstly have to conduct an in-depth due diligence to see whether the book can be purchased firstly anywhere in the country in an accessible format.

Secondly, if the due diligence reveals that a book in the relevant accessible format can be purchased the question will be whether the price of the accessible format copy is "affordable in India, taking into account the needs and income disparities of persons who have limited vision and those with print disabilities". As you can see these are impossible mountains to climb for persons with disabilities and largely underfunded NGOs who provide services to persons with disabilities.

The situation gets much more complicated when it comes to exceptions relating to cross border exchange. Imagine that the United Kingdom introduces a provision in their copyright law allowing the Royal National Institute of Blind People to export accessible format copies to people with visual impairment in Chennai but only after verifying that the accessible format copy cannot be otherwise obtained within a reasonable time and at a reasonable price. Remember that "reasonable price" in India means that the accessible format copy of the work is available at prices that are affordable in that market, taking into account the needs and income disparities of persons who have limited vision and those with print disabilities. How can the RNIB based in the UK even begin to undertake this exercise, which would require it to:

Check whether the accessible format copy is available in India; then
Understand the needs and income disparities of those with limited vision and print disabilities; and then
Check the cost of the accessible format copy and determine whether the cost of the accessible format copy is reasonable based on the above point.

It will be impossible for RNIB to do this.

In addition to the above there is the added concern that linking commercial availability and exceptions as mentioned in Article C (national exceptions) will lead to countries such as India being put under pressure from the European Union and the United States to amend our Copyright Act and linking our exceptions to commercial availability. The same applies to countries that want to introduce copyright exceptions after the Treaty.

As you can see, the linking of commercial available and exceptions while in theory is sound, in practice it will be impossible to comply with thereby killing all effectiveness of the Treaty.

Lawyers get socially involved: The Right to Read

"Imagine life without books, without having anything to read. Wouldn't it get suffocating?" asks Moiz Tundawala, a visually impaired student at NUJS Kolkata.

A number of engaged lawyers have been working hard to address the suffocation by trying to make books accessible to all in the Right to Read campaign.

"Just place yourself in the shoes of the print disabled and try evaluating," posits Tundawala. "Why deprive them of a fair opportunity to participate in society especially when you have the technology to make things easier?"

By contrast the situation as it stands today in India is simple: if you can not read printed text for whatever reason, most books will remain forever closed to you.

Pesky laws

And while technology is making headway towards accessibility it stumbles upon myriad legal roadblocks.

The biggest spoilsport is the India Copyright Act, which does not explicitly permit the conversion of books into accessible formats without breaching their copyrights.

Three organisations active in the field have now joined hands to launch the Right to Read campaign in India, following the eponymous global campaign by the World Blind Union. The Indian campaign is supported by social enterprise Inclusive Planet with its first product BookBolé, the Center for Internet and Society (CIS) and the non-profit organisation Daisy Forum of India.

And throughout lawyers have been vital in getting the campaign off the ground.

"We believe that the right to read is a fundamental right and persons with disabilities should be able to enjoy this right just like any other person," says CIS programme manager Nirmita Narasimhan. She is an LLB graduate of Campus Law Centre, Delhi University and has years of experience in working in the courts and with intellectual property (IP).

"Nearly 70 million print disabled Indians are being deprived of this right because they are unable to read in the same manner as other persons," she continues. "This goes against our constitutional guarantees of rights to equality and non-discrimination."

The movement does not restrict itself to the blind and visually impaired and the Right to Read campaigners are quick to point out that the term print disabled is a wider term and includes persons who have dyslexia, learning disabilities and persons who due to physical disability are unable to hold books or turn pages.

The campaign therefore aspires to reach to all those who do not have access to knowledge due to the non-availability of books in accessible formats.

Technology's outer limits

Inclusive Planet's co-founder and policy head Rahul Cherian is also the founder and managing partner of IndoJuris Law Offices.

He and Narasimhan co-wrote a letter to the IPR Division of the Federation of Indian Chambers of Commerce and Industry (FICCI).

In it they explained why formats like audio files and Braille cannot fully address the issue of accessibility and what should be done about it.

"Audio files have to be played serially and navigation is severely limited. In the case of Braille, the printing costs are expensive and reading a Braille book is up to 4 times slower than a normal book," they wrote.

"Moreover, Braille is extremely difficult to learn if you lose sight at a later age, and persons using Braille can communicate only with others who know Braille. Braille cannot be used by persons with other print impairments such as dyslexia or persons with physical disabilities".

Perhaps more innovative technologies are necessary but technology also has some serious limitations, such as not being able to cater to India's multilingual needs, points out Narasimhan.

Tundawala's first-hand experience with technology is instructive.

"Audio brings in the human element," he says, "but a lot depends on the reader. Some are naturally good readers, some others are not. Listening to monotonous voices is not at all enjoyable."

Cost is a big hurdle too. "A wonderful device that is in the markets in places like the US is the portable reader. It is a hand held device and comes with a camera with OCR (Optical Charachter Recognition) and TTS (Text To Speech) installed on it. How I wish to get hold of it. But this comes at a whopping two thousand dollars", says Tundawala.

Even screen reading software that converts the text on screen to speech such as JAWS for Windows comes at a mind-boggling fifty thousand rupees.

The co-founder and CEO of Inclusive Planet Sachin Malhan, who is perhaps best-known for starting up the CLAT preparation service Law School Tutorials after a stint in a law firm, defends technology.

"Any large solution will have imperfections," says Malhan, "but one must keep in mind how small these obstacles are when compared with the opportunities."

Being Good: the subtle art of Dharma

Issues of cost and accessibility are serious. Inclusive Planet, which is run as a for-profit social organisation, will face the challenge of making its first product BookBolé pay for itself.

Cherian is optimistic. "The cost of printing, stocking and distributing books which is huge in regular books is virtually nil in our model," he says.

"We are in the process of convincing a few publishers about the possibility of tapping into the needs of the millions in need of books in accessible formats. The World Blind Union has given the phrase 'Same day. Same price' for books to be made available to the print disabled and we want to live up to it."

And going by the magnitude of response BookBolé has been able to generate it already sounds like a success story.

Cherian told Legally India that Inclusive Planet has five new products and projects lined up for the disabled. Two among these will cater exclusively to needs of the visually impaired and according to Cherian will truly revolutionize the ecosystem for the visually impaired, making their world happier and more inclusive.

Tundawala, however, disagrees with this approach and argues: "If we start selling technology through the market mechanism, it may not serve the needs of the vast multitude."

Legal Samaritans

The Right to Read has journeyed well and is picking up momentum with legal activists forming the vanguard.

"The prominent people behind our freedom struggle were lawyers so the legal community owes a special responsibility in this case to help bring about a change for the better," insists Tundawala. "Their support will give a sense of hope to millions of individuals that the people who know the law empathise with them and think the way they do about this problem."

For Cherian help from the corporate sector has made life easier. "None of this would have been possible without the collaboration of corporate lawyers. Corporate lawyers have helped in the legal research and strategy."

Delhi Chalo!

The Indian campaign, which was launched in September, is also closely allied to the global debate and involves many issues and organisations.

"We are actively involved in The Treaty for the Blind, Visually Impaired and other Reading Disabled presently tabled before the Standing Committee on Copyright and Related Rights (SCCR) at the WIPO and are working with the World Blind Union to help from an India level," explains Nirmita.

She adds that earlier this month they also organised a meeting with the Director General of WIPO in Delhi and submitted a statement document on behalf of the Indian visually impaired community.

And the Right to Read, explains Cherian, will soon be taken up to India's Human Resources Development (HRD) minister Kapil Sibal.

"We plan to organise 4 more road shows in different cities, culminating with a large event in Delhi," he says.

"We will also be submitting a research paper to the HRD Ministry on the constitutional, domestic and international law compulsions that require the amendment of the copyright act for the benefit of persons with disability."

Konkani voice to guide the blind

Those visually-impaired and well-versed only with the language of Konkani, now need not worry. Neither their blindness nor the language barrier will come between them and the use of mobile phones, computers and other technology.

The article by Gauree Malkarnekar was published in the Times of India on August 9, 2015.

Konkani will soon join 50-odd languages from across the globe, whose text will be recognized by the online engines for the visually impaired that converts text on mobile phone and computer screens into speech, enabling the blind to use the devices. The bank of sounds of Konkani alphabets for this purpose has been developed by Delhi-based NGO Saksham with the help of staffers of Goa's state central library at Patto, Panaji.

Users will be able to take the benefit of the initiative and have Konkani texts read out to them by making use of the open source or free for use text to speech engine eSpeak.

"Saksham, under Centre for Internet Society in Bangalore, is on the quest to enable text in all Indian languages to be converted into speech for the visually-impaired. We approached them to begin work on Konkani as we realized that while Romi Konkani can be read out because of its Roman alphabets, there was no correct pronunciation of the Devanagri Konkani sounds. The Marathi and Hindi alphabets have a different sound," said Taha Haaziq, incharge of the resource room for the disabled at Goa's central library.

A staffer of the library spoke out the entire range of sounds of Devanagri Konkani alphabets, which was recorded and sent by the library to the NGO in Delhi in January, based on which the sounds for use on eSpeak were developed.

"Work is nearly complete and Konkani speaking visually-impaired the world over will be able to benefit from this initiative. Regular Konkani speakers who prefer to use the text to speech option on their mobile phones instead of reading can also make use of Konkani version of eSpeak," said Haaziq.

The text to speech will also help the blind in the use of refreshable Braille display, which enables the visually-impaired to use computers as the display text on their screens are read out to them, in this case, now in Konkani said Central library curator Carlos Fernandes.

CIS conducted a training on eSpeak Tamil Computing with NVDA in Tirunelveli in the month of June. Sixteen delegates attended the event.
The 30th Session of the World Intellectual Property Organization's ("WIPO") Standing Committee on Copyright and Related Rights ("SCCR") was held from June 30 to July 3, 2015. CIS was unable to attend the meeting. However, CIS had a statement to make on negotiations on the Proposed Treaty for Broadcasting Organizations .
The Ministry of Information and Broadcasting, Government of India had called for comments on the technical background paper prepared by the WIPO Secretariat in relation to the Broadcast Treaty. CIS submitted its comments .
Rohini Lakshané in a blog post analysed the commonalities in big-ticket patent infringement lawsuits pertaining to mobile devices.

Sumandro Chattapadhyay co-authored a report on open data intermediaries in developing countries . The report concluded by saying that consideration needs to be given to the presence of multiple intermediaries in an open data ecosystem, each of whom may possess different forms of capital to enable the use and unlock the potential impact of open data.
Odia language Wikipedia has grown to 800k page views in a month. The Odia Wikipedia community gathered in Bhubaneswar on June 3 to celebrate Odia Wikipedia's 13^th anniversary. Subhashish Panigrahi wrote about this.
Sunil Abraham in an article titled "The generation of e-Emergency" published by Livemint on June 22 argued that the next generation of censorship technology is expected to be 'real-time content manipulation' through ISPs and Internet companies.
In two separate blog entries, Jyoti Panday provided insights into IANA Transition Stewardship & ICANN Accountability. The first part gives a background to the IANA transition and updates on the ensuing processes in an attempt to familiarise people with the issues at stake and the second part provides an overview of submitted proposals and highlights the areas of concern that will need attention moving forward .

Sumandro Chattapadhyay co-designed and co-facilitated a workshop for government officials from Bhutan, Maldives, Meghalaya, Sikkim, and Tripura, on open data policy and implementation, organised by UNDP India.
Shyam Ponappa in his monthly column published in the Business Standard stated that government can't control market forces but can and must fix regulatory issues.

Accessibility and Inclusion

Under a grant from the Hans Foundation we are doing two projects. The first project is on creating a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India. CIS in partnership with CLPR (Centre for Law and Policy Research) compiled the National Compendium of Policies, Programmes and Schemes for Persons with Disabilities (29 states and 6 union territories). The publication has been finalised and is being printed. The draft chapters and the quarterly reports can be accessed on the project page. The second project is on developing text-to-speech software for 15 Indian languages. The progress made so far in the project can be accessed here.

Highlights

Nehaa Chaudhari participated in a Stakeholders Consultation organized by the Planning Commission and the Ministry of Human Resource Development in New Delhi, February 21, 2014, on Mapping Institutions of Intellectual Property. She blogged about the outcome in a two-part series. The first part discusses establishment of a National Institute of Intellectual Property Rights and the second part deals with the documents introduced at the Stakeholders’ Consultation for India’s National Programme on Intellectual Property.
For the first time in the history of Indian books, 10 Telugu books by a single author were released under Creative Commons license (CC-BY-SA 3.0). These books will be uploaded on Telugu Wikisource and converted into Unicode (searchable) text. This will ensure that these books are freely read, both online and offline in various formats like PDF, epub, mobi, text, etc. This is a major milestone initiative by CIS-A2K to make the sum of all knowledge in Telugu freely available to all Telugus over the internet.
ICANN published a call for public comments on "Enhancing ICANN Accountability" in the wake of the IANA stewardship transition spearheaded by ICANN and related concerns of ICANN's external and internal accountability mechanisms. CIS submitted its comments.
ICANN sought comments on the existing barriers to Registrar Accreditation and operation and suggestions on how these challenges might be mitigated. CIS sent its comments.
Vodafone, the world’s second largest mobile carrier released a report disclosing to what extent governments can request their customers’ data. Joe Sheehan analyses the report to tell us that if more companies were transparent about the level of government surveillance their customers were being subjected to then the public would press the government for stronger privacy safeguards and protections.

The Centre for Internet & Society (CIS) welcomes you to the sixth issue of its newsletter for 2013. Hivos published a White Paper by Nishant Shah titled Whose Change is it Anyway?, which attempts to reflect critically on existing patterns of making change and its implications for the future of citizen action in information and network societies. The Access to Knowledge team carried out a quantitative analysis to identify trends and growth patterns in Indian Language Wikipedias from September 2012 to April 2013. CIS drafted the Privacy Protection Bill and amended it as per feedback gained from the New Delhi, Bangalore, and Chennai Privacy Roundtable Events. CIS made closing statement on the Treaty for the Blind at the WIPO Diplomatic Conference which was concluded with the adoption of the Marrakesh Treaty to Facilitate Access to Published Works for Persons who are Blind, Visually Impaired, or otherwise Print Disabled. In a research paper Nehaa Chaudhari gives an analysis of patent pools, Sameer Boray gives an analysis of video piracy and Pranav Menon gives an analysis of India-EU FTA and issues surrounding data protection and security. In this period we organised the Institute on Internet and Society with support from the Ford Foundation at Golden Palms, Bangalore from June 8 to 14, 2013.

Celebrating 5 Years of CIS
CIS is now 5 years old and we just celebrated this by holding an open exhibition in our offices in Bangalore and Delhi from May 20 to 23, showcasing our work and accomplishments over the period. We had about 170 visitors from the general public coming in to our office. Videos of the event are here.

Google Policy Fellowship
CIS has initiated processing of applications for the Google Policy Fellowship programme. Shortlisted candidates would be informed about their interview. However, as of now there will be a 20 days delay in announcing the list for the interview.

Access to Knowledge and Openness

The Wikimedia Foundation has given a grant to CIS to support and develop the growth of Indic language communities and projects by community collaborations and partnerships. This is being carried out by the Access to Knowledge team based in Delhi. CIS is also doing a project (Pervasive Technologies) on examining the relationship between production of pervasive technologies and intellectual property. CIS also promotes openness including open government data, open standards, open access, and free/libre/open source software through its Openness programme.

Pranesh Prakash participated in the WIPO Diplomatic Conference to Conclude a Treaty to Facilitate Access to Published Works by Visually Impaired Persons and Persons with Print Disabilities in Marrakesh, Morocco, June 17 to 28, 2013. The conference concluded with the adoption of the Marrakesh Treaty to facilitate access to published works by blind persons, persons with visual impairment, and other print disabled persons, by requiring mandatory exceptions in copyright law to enable conversions of books into accessible formats, and by enabling cross-border transfer of accessible format books. Knowledge Repository on Internet Access

CIS in partnership with the Ford Foundation is executing a project on Internet Access. It covers the history of the internet, technologies involved, principle and values of internet access, broadband market and universal access. It will also touch upon various policies and regulations which has an impact on internet access and bodies and mechanism which are responsible for formulation of policies related to internet access.
