Executive Summary

Odisha has the highest percentage (2.78%) of persons with disabilities in the country. The state has framed the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Amended Odisha Rules 2012 to implement the provisions under the central Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act 1995. The state has issued two notifications in education, one notification in employment and one notification for health and rehabilitation.

Legal Provisions

The state of Odisha has framed the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Amended Odisha Rules 2012 to implement the provisions under the central Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act 1995 (Persons with Disabilities Act).[3] These rules have been issued as an amendment to the previous Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Odisha Rules 2003.

The government of Odisha has formed the Directorate for Welfare of Persons with Disabilities under the Women and Child Development Department to cater to the requirements of persons with disabilities in the state.[4] The government has appointed the Collectors of each district as Deputy Commissioners for Persons with Disabilities for their respective district to assist the State Commissioner for Persons with Disabilities in discharging their functions.[5]

The state in exercise of the powers conferred by sub-section (2) (i) and (2) (h) of Section 13 of the persons with Disabilities Act, appointed the State Commissioner for Persons with Disabilities (SCPD) and Chairperson, Odisha State Commission for Protection of Child Rights as members of the State Co-ordination Committee as constituted in the Department Notification No. 708-WCD, dated the 8th January 2003.[6]

The various provisions by the state of Odisha for the persons with disabilities are listed categorically as under:

Education
The government of Odisha has framed the guidelines for establishment, recognition and grant-in-aid to institutions imparting education to children with disabilities to fulfil the mandates under the Persons with Disabilities Act, National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act 1998 and the Right of Education Act, 2009. [7]

Odisha offers an integrated scholarship scheme for students with disabilities titled ‘Banishree – A Scholarship for Students with Special Needs’.[8] The scheme is open to students to continue their education from Class I to university education. Students from middle school and upwards (Class V and upwards) are eligible to apply under this scheme only if they do not receive any scholarship from the Government of India. Students from special schools registered under the Persons with Disabilities Act are eligible to apply provided that they are not in receipt of any grant-in-aid from the central or state government. Students with disabilities pursuing distance education through recognised universities and government organisation, or those pursuing professional, technical or professional courses in any of the recognised institutes are eligible to apply.

Applicants must fulfill the following eligibility criteria:
Should be bonafide resident of Odisha
Should be a regular student of the educational institution
Total income of the applicant’s family should not be more than Rs. 60,000 per annum.
Should not be in receipt of any assistance, stipend or scholarship from the central or state governments under any other scheme.
Should enrol and regularly attend any institution irrespective of whether the applicant has passed the examination or not in a particular year.

The rates of the scholarship offered under the scheme are given as below:

Within the state:

Class I – Class V: Rs. 100 per month
Class VI – Class XI: Rs. 140 per month
Class +2 and Class +3: Rs. 160 per month
University – Post Graduation: Rs. 190 per month
Technical and Vocational: Rs. 190 per month

Outside the state:

Students prosecuting normal course of study or technical/ vocational / professional education/training not available in the State and not covered by Govt. of India Scholarship are given a scholarship of Rs. 250 per month.

Reader allowance for students with visual impairment:

Primary school: Rs. 100 per month
Middle and High School: Rs. 150 per month
Other studies: Rs. 200 per month

Students with orthopaedic disabilities who have 75 per cent or more disability are eligible for a special transport allowance of Rs. 100 per month.

Employment

The government has made provisions to extend the benefits of the Odisha Revised Pay Rule 2008 to the teaching staff of the special schools for persons with disabilities.[9]

Health & Rehabilitation

The District Rehabilitation Centre (DRC) Bhubaneswar has been renamed as the State Institute of Disability Rehabilitation Bhubaneswar and will function as the nodal centre for disability rehabilitation in the state and will be under the control of the Directorate for Welfare of Persons with Disabilities.[10]

Survey on Banking Accessibility

The Global Initiative for Inclusive ICTs (G3ict) is launching a survey on the accessibility of financial services in banks for persons with disabilities around the world. The survey is looking at the kind of accommodations being made by different banks and assessing best practices for accessibility to financial services for persons with disabilities.

The object of the survey is to design options for banks to increase their customer base by enabling them to cater to a larger group than is currently able to access services or better serve their communities from a Corporate Social Responsibility standpoint. Executive Summary

According to the 2001 Census, nearly 20,367 persons or 3% of the State population are identified as persons living with disabilities. The responsibility of ensuring the welfare of these persons with disabilities primarily rests with the Social Welfare Division of the Social Justice, Empowerment and Welfare Department of the Government of Sikkim. This Government department implements various policies, programmes and schemes aimed at the welfare and empowerment of persons living with disabilities.

Screening camps and medical camps emphasising the medical welfare of persons with disabilities are periodically arranged by the Government of Sikkim in conjunction with the STNM Government Hospital. Vide Notification No. 02/HC, HS&FW dated 30.01.09 by the Department of Healthcare, Human Services and Family Welfare, disability screening camps are to be arranged on specific dates of the month by the District Medical Board members in the respective District Hospitals accompanied by officers of the Sikkim Department of Social Justice, Empowerment and Welfare and the staff of various Deendayal District Rehabilitation Centres.[1]

The Government of Sikkim has also introduced other measures such as the establishment of special schools for children with disabilities. The Social Welfare Department of Sikkim has established a Special School for Hearing impaired children in June 2004 at Sitchey Busty, Gangtok. The school is residential in nature, providing accommodation, education and other facilities towards ensuring the general welfare for children suffering from hearing impairments.[2]

Furthermore, the Sikkim Government attempts to spread its reach by collaborating with several non- governmental organisations or NGOs in the state. The Government of Sikkim provides certain NGOs with financial assistance, subject to the fulfilment of certain conditions. As a result, NGOs have been able to provide better treatment and rehabilitation facilities to persons suffering from disabilities and living in the State of Sikkim.[3]

Accessibility
The only measures introduced in Sikkim on accessibility is concessions in transport. Free travel facility to the blind is provided in state owned buses.

Apart from the the State’s IT Policy issued by the Department of Information Technology states that it will develop special software for providing IT access to persons with visual impairment, cerebral palsy, speech and hearing disorders in association with NGOs and local enterpreuners. It is not clear if such software has already been developed by the State.

Education
The State of Sikkim provides special measures to children with disabilities in the pursuit of their education.

Stipends and Scholarship Schemes

A stipend of Rs. 500/- per month per child, and Rs.500 per annum towards their studies in special schools outside of the state are provided for by the Department of Social Justice, Empowerment and Welfare.
The Government also provides a scholarship amount of Rs. 50 per month to every child studying in Class I to VI, Rs. 60 per month to every child in Class VII and Class VIII, and finally Rs.85 per month for every student in Class IX to XII.
A scholarship amount of Rs. 800 per month is provided to students desirous of pursuing their higher education in institutions established outside of Sikkim, and Rs. 2000 for all those students wishing to pursue their higher education in institutions in the State of Sikkim.[4]

Special Schools
The Social Welfare Division has established a Special School for the Hearing impaired children in June 2004 at Sitchey Busty, Gangtok. It is a residential School where accommodation, education and general welfare for the hearing impaired children are provided.

Employment

Reservation in Government Jobs: By Office Order No. 5/SW dated 31.12.1990, in Grade 'C' and 'D' posts reservation are provided in direct recruitment for physically handicapped persons as indicated below:

Visually handicapped - 1%
Orthopaedically handicapped – 1%
Hearing handicapped - 1%

Conveyance Allowance: Government and PSU employees who are blind and locomotor disabled are provided conveyance allowance.
Self-Employment: Persons with disabilities receive assistance for self-employment.
Vocational Training: Vocational training is given to persons with disabilities in sheltered workshops.

Health and Rehabilitation

Aids and appliances: Persons with disabilities get free of cost prosthetic equipment.
Assistance to Disabled Persons for Purchase/Fitting of Aids and Appliances (ADIP) Scheme: As per the implementation of this Central Scheme, the Government of Sikkim provides assistance to those persons with disabilities who are in need of durable, sophisticated and scientifically manufactured, modern, standard aids and appliances. The purpose of this scheme is to ensure the promotion of the physical, social and psychological rehabilitation of persons with disabilities by reducing the effects of disabilities and to thereby enhance their economic potential. Aids and appliances that are provided include walking sticks, crutches, and wheel chairs. These appliances have been distributed to those persons with disabilities belonging to families living Below the Poverty Line (BPL).
Deendayal District Rehabilitation Scheme: Under this scheme, the Government of Sikkim has established a district disability rehabilitation centre in at STNM Hospital complex Gangtok in 2000. This DDRC has been working towards the rehabilitation of persons living with disabilities in Sikkim. In an effort to further facilitate the proper rehabilitation of persons with disabilities, the Government of Sikkim has made available the facilities of a Mobile Disability Van and a Mobile Rehabilitation Unit Van. In the Fiscal Year of 2009-10, 526 aids and appliances were distributed from the Deendayal District Rehabilitation Centre and 9 disability camps were conducted with two camps having been held in the Western district of the State, three in the South and East and one in the North.

Social Protection

Disability Pension: Persons with disability above 40 years of age are provided disability pension of Rs. 100/- per month. Blind persons also get Rs. 100/- per month.
Indira Gandhi National Disability Pension Scheme: The State of Sikkim provides social protection to persons with disabilities by way of local implementation of the Indira Gandhi National Disability Pension Scheme. The purpose of the scheme is to provide persons with disabilities in the age group of 18 to 64 years, who are members of families living below the poverty line, with a certain sum of money in order to provide for their welfare. The beneficiaries under this scheme include all those persons suffering from severe or multiple disabilities as defined under the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995and the ‘National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999 (National Trust Act 1999)’. In total, beneficiaries under this scheme receive an amount of Rs. 600/- per month.
Subsistence Allowance: Under the auspices of the Department of Social Justice, Empowerment and Welfare, the Sikkim Government provides a subsistence allowance amounting to Rs. 600 per month to persons with disabilities living in the state. In order to avail of the benefits under this scheme, beneficiaries must show that they are suffering from atleast 40% disability and that they should be a resident of the state of Sikkim. Furthermore, the beneficiary must hail from a family identified as a BPL or below the poverty line family.

A lifetime of five years on the internet

Centre for Internet and Society observes its fifth anniversary on Sunday.

Five years is a long time in the internet space. The past five years, certainly, has been. And so has it been for the Centre for Internet and Society that completes five years here.

When a group of citizens got together to come under a platform called CIS five years ago, they had wanted to work on policy issues about the internet that had a bearing on society. They, in fact, still do; except that the new media space itself has undergone a metamorphosis. Five years ago social media was just starting off, few people had smart phones, and online speech was not a burning issue.

Sunil Abraham, executive director of city-based CIS, affirms this, and goes on to assert: “Five years ago, privacy was not a mainstream concern. Today, many different actors and stakeholders are interested in the configuration of the draft Privacy Bill. We first warned the public about the draconian measures in the IT Act during the 2008 amendment. Four years later, many more people are familiar with problematic sections and are adopting various strategies to amend the Act and it’s associated rules.”

Likewise, five years ago, people dismissed “shared spectrum” as a pipe dream; today “shared spectrum” is mentioned in the National Telecom Policy. CIS usually thinks ahead, and works on a range of issues.

“For internet adoption in India to grow dramatically from the dismal statistics today, we need to ensure continued access to cheap devices and affordable and ubiquitous broadband,” says Abraham.

“With Ericsson suing Micromax for Rs100 crore, the mobile wars have come to India. If we have to protect innovation in sub-100 dollar devices, we need to configure our patent and copyright policy carefully.”

But since CIS works primarily on policy issues, shouldn’t it have been based in Delhi rather than in Bangalore? “We do have a small office in Delhi. But we are headquartered in Bangalore because we need to keep learning from technologists and the technical community,” explains Abraham.

When an organisation calling itself the Centre for Internet and Society (www.cis-india.org) observes its fifth anniversary, it shouldn’t surprise anyone that many of the activities related to the anniversary celebrations (May 20-23) have precious little to do with the internet, and is more about society itself. And yes, an entire evening is devoted to Kannada. There’s a talk by Chandrashekhara Kambara on ‘Kannada in the modern era,’ and another by UB Pavanaja titled ‘From Palm Leaf to Tablet – Journey of Kannada’.

“We are looking at the complete eco-system. For instance, during the digitalisation of TV in India, what will happen to the internet? Do TV promoting policies undermine the growth of broadband? On the second day we look at the connection between another older technology - cinema and the Internet.”

Global Accessibility Awareness Day (GAAD 2013) - CIS panel

Interested in understanding the importance of accessibility and how technology can become more accessible by persons with disabilities? Read this post on the Global Accessibility Awareness Day (GAAD)!

Last week, the Centre for Internet and Society (CIS) held a panel on the Global Accessibility Awareness Day which entailed a three hour discussion on how technology can become more accessible by persons with disabilities. GAAD is a community-driven effort with an aim to raise the profile of digital accessibility and people with different disabilities. The target audience of the panel was the design, development, usability and related communities who build, shape, fund and influence technology and its use. This event consisted of presentations by Accessibility professionals in the industry, as well as of hands on demonstrations of how people with disabilities can use technology.

Vivek Gaikwad started his presentation by defining the term “accessibility” as easy access and by pointing out that the World Health Organization considers “disability” an umbrella term covering impairment, activity limitation and participation restriction, which would not only entail the deaf and blind, but even pregnant women. Assistive technology was defined as a device, a technology or a process used by individuals with disabilities to perform functions which might otherwise have been impossible. Gaikwad emphasized that accessibility is an extremely significant issue in terms of legal compliance and would also help create new markets by including people with disabilities.

Section 508 of the U.S. Workforce Rehabilitation Act 1973 was pointed out by Gaikwad, as well as the Web Content Accessibility Guidelines (WCAG) - developed by the Web Accessibility Initiative- which provide an internationally recognized benchmark for accessibility of web content. Gaikwad argued that India should comply with such guidelines and that the best practices to adopt could be the following:

● Provide an appropriate alternative text for all images

● Provide meaningful and hierarchical heading structure

● Provide accessible colours

● Ensure that the application is usable by both the keyboard and the mouse

● Ensure that the focus caret is shown on the active control on the screen

● Ensure that the link purpose is clear

● Specify language of the page

● Understand ECAG 2.0/Section 508 thoroughly

● Educate teams/peers

● Create your own best practices and share them

● Learn how to use a screen reader/other testing tools

● Think in different ways to satisfy a guideline

Lavanya Lakshman started her presentation by introducing the the different types of disabilities and by emphasizing the significance of accessibility. In particular, Lakshman argued that accessibility is important not only because it is the right thing to do, but also because it is the law, it offers benefits for all users, it enhances innovative technology and it creates new market opportunities. Lakshman referred to the various assistive technologies used by persons with disabilities, such as screen readers, to use the computer. It was emphasized that SME testing is important because experts understand how the underlying technologies interact and that end-user testing is also crucial because they are the real experts in their own abilities and their own assistive technology. Accessibility can be tested through automated tools and manual testing and SME testing can be conducted through screening, tool based inspection and evaluation, and code inspection. Laksham highly emphasized that most assistive technologies for people with motor disabilities either work through the keyboard or emulate the functionality of the keyboard, which is why assistive technologies - such as an over sized trackball, an eye-tracker and a head-wand, were recommended.

Srividya Vaidyanathan argued that audio visual media accessibility is needed by everyone and that it should not only be restricted to persons with disabilities. Intelligence picture and sound, accessible players and access services are needed and as there is not much of TV and radio accessibility in India, this field should be further developed. Vaidyanathan also referred to the various types of access services, such as captions (closed and open), sign language and audio description.

Anusuya Das focused her presentation on the print disabled, which are persons who cannot read standard print because of visual impairment, cognitive disabilities (such as dyslexia, autism, ADHD and others), or physical disabilities that limit one´s ability to hold a book. In particular, she argued that braille books include print alternatives and that time and format are critical factors while creating accessible materials. Structure, navigation and simplicity are central concepts of accessible content and it should comply with the Digitial Accessibility Information System (DAISY) standards, which are international standards for accessible content. Das referred to the various advanced accessibility features, such as bookmarking, and emphasized that combined text and audio can increase learning effectiveness by nearly 50%. E-Pub is the mainstream standard, but the United Nations have recommended the DAISY standards. My Studio PC, Obi, Microsoft save as DAISY, Sigtuna DAR 3, Tobi and Dolphin Producer include authoring and production tools.

Das also referred to the various types of DAISY books which may include a full audio and navigation centre, text and no audio or text with audio. Das emphasized upon the need to create accessible word documents, as well as to give alternate text for images and to edit hyperlinks. Principles for regional languages were mentioned, along with the need to convert texts to other formats, such as converting word to HTML. Das also argued that accessible powerpoint files should be created, which would ensure that files have correctly-structured headings among other features. PlexTalk Portable Recorder includes a hardware option for people with disabilities, while Symbian Nokia phones include mobile phone options and other software options are included in the DAISY Book Players.

Rama Chari, the final panelist, referred to the various types of disabilities, as well as to the built needs of people with disabilities. She emphasized that easy navigation in a website is extremely important and that the architecture should be simplified. It was further argued that India should comply with the international standards for information accessibility and that some of the best practices need to be adopted to create new standards. However, such practices vary from state to state in India (e.g. the fire safety standards) which is problematic. Nonetheless, Chari mentioned an organization in Delhi called “Accessibility”, which has very useful guidelines; these include standards for ramps, staircases and washrooms, and it is significant to evaluate the challenges that people with different disabilities face in order to improve such standards.

A discussion on the various tools to increase accessibility followed the presentations of the five panelists, as well as a hands on demonstration by Vivek Gaikwad of how to use more accessible mobile phones. The outcome of the GAAD panel was that in the current Digital Age, persons with disabilities should not be marginalised, but should be included in the social, political and economic structures of the contemporary digitised world. The tools discussed throughout the panel could potentially provide a decisive step in ensuring that persons with disabilities have equal access to technology. As technology today is the gateway to the contemporary world, accessibility is a fundamental human right and persons with disabilities should not be excluded. Through the thorough examination of the various needs of persons with disabilities and the subsequent enactment of adequate laws, standards and guidelines, India should enhance accessibility to technology if it wants to be the democracy it claims to be.

CIS anniversary

The Centre for Internet & Society (CIS) is celebrating 5 years of its existence with an exhibition showcasing its activities and accomplishments. The exhibition will be held at its offices in Bangalore and Delhi from May 20 to 23, 2013.

The four-day event will see renowned artists like Kiran Subbaiah, Tara Kelton, Navin Thomas and Abhishek Hazra featuring their work and also giving live demonstrations.

How will this change what we want, and pay for, on TV? Grappling with these questions, the talk will evaluate the rationale of the digital migration in cable currently underway, and the less talked about digital migration being planned for the public broadcaster. These scarcely debated and often contentious issues form the core of a recent Country Report on the Media in India, anchored by the speaker. 19.00 20.00	Slouching towards Tlön: An Encyclopedia for the 2nd century of Indian cinema — A Talk by Lawrence Liang Ashish Rajadhyaksha and Paul Willemen’s Encyclopedia of Indian cinema (1994) marked an important moment for the study of Indian film history. In the two decades since its publication we have seen a rise in the academic community working on Indian film history along with the rise of various new archival initiatives online. Materials that were hitherto unavailable have also made their way into the public domain via the efforts of film historians, cinephiles and other enthusiasts. It is perhaps fitting to think about what a collaborative encyclopedia of Indian cinema for the 21st century may look like. Using Rajadhayksha and Willemen’s Encyclopedia as a base, Lawrence has been working on an online version that incorporates moving images, photographs and archival materials and his presentation will open up questions of how one thinks of an online encyclopedia as well as larger conceptual questions of the relationship between the encyclopedias, the internet and moving image archives. 18.15 19.30	From Palm Leaf to Tablet – Journey of Kannada: A Talk by Dr. U.B. Pavanaja Kannada language which has a history of 2000 years and quite rich in literature started on palm leaves. Kannada advanced with modern times adopting the marvels of Information Technology. This is accomplished by successfully implementing Kannada in various facets of IT. It is being used everywhere from data driven applications to websites to hand held devices like tablets. These aspects will be brought out during the talk. About the Speakers

Vibodh Parthasarathi	Vibodh Parthasarathi works with the Centre for Culture and Media Governance, Jamia Millia Islamia, New Delhi. He is also a Board Member at the Centre for Internet and Society, Bangalore. He maintains a multidisciplinary interest in media and development policy, business history of creative industries, and governance of media infrastructure. At the Centre for Culture, Media & Governance, Jamia Millia Islamia, New Delhi, his ongoing research addresses media policy literacy, the TV news industry and the digital switchover in India. He is the co-editor of the critically acclaimed tri-series on Communication Process (Sage).
Lawrence Liang	Lawrence Liang is the Chairman of the Board at the Centre for Internet and Society. He is a graduate of the National Law School. He subsequently pursued his Masters degree in Law and Development at Warwick, on a Chevening Scholarship. His key areas of interest are law, technology and culture, the politics of copyright and he has been working closely with Sarai, New Delhi on a joint research project Intellectual Property and the Knowledge/Culture Commons. A keen follower of the open source movement in software, Lawrence has been working on ways of translating the open source ideas into the cultural domain. He has written extensively on these issues and is the author of The Public is Watching: Sex, Laws and Videotape and A Guide to Open Content Licenses. Lawrence has taught at NLS, the Asian College of Journalism, NALSAR, etc., and is currently working on a Ph.D. on the idea of cinematic justice at Jawaharlal Nehru University.
Maria Xynou	Maria Xynou is a Policy Associate on the Privacy Project at the CIS. She has previously interned with Privacy International and with the Parliament of Greece. Maria holds a Master of Science in Security Studies from the University College London (UCL).
Bernadette Langle	Bernadette Längle recently graduated in social and cultural anthropology, philosophy and computer science. She is also a so-called hacktivist together with one of the oldest hacker associations of the world, the Chaos Computer Club, having a lot of influence in German politics. As one of the core-team organizer of Chaos Communication Congress in Germany she also has a lot of experience in organizing events.
Laird Brown	Laird Brown is a strategic planner and writer. His core competencies are brand analysis, public relations, and resource management. Laird has worked at the United Nations in New York; high-tech ventures in North America, Europe, and India; and, is a guest speaker at ICT conferences internationally. He is currently working on a film project for CIS on cyber security in India with Purba Sarkar.
Purba Sarkar	Purba Sarkar is an associate producer with the cyber security film project. She holds a Bachelor in Technology degree from West Bengal University of Technology. Purba worked as a strategic advisor in the field of SAP Retail for 4 years before joining CIS in January, 2013.
Dr.Chandrashekhara Kambara	Dr. Chandrashekhara Kambara is a prominent poet, playwriter, folklorist, film director in Kannada language. He is also the founder-vice-chancellor of Kannada University in Hampi. He is known for his effective usage of North Karnataka dialect of Kannada language in his plays and poems and is often compared with D.R. Bendre. He has been conferred with many prestigious awards including the Jnanpith Award (the highest literary honour conferred in India) in 2011 for the year 2010, the Sahitya Akademi Award, the Padma Shri by Government of India, Kabir Samman, Kalidas Samman and Pampa Award. After his retirement, Kambara was nominated Member of Karnataka Legislative Council, to which he made significant contributions through his interventions.
Dr. U.B. Pavanaja	Dr U B Pavanaja holds a Master’s degree from Mysore University and Ph.D. from Mumbai University. He was a scientist at the Bhabha Atomic Research Centre, Mumbai, for about 15 years. He has done advanced research in Taiwan. He resigned from BARC in 1997 and dedicated himself fully for the cause of Computer and Indian languages. He has to his credit many firsts, viz., first Kannada website, first Kannada online magazine, first Indian language (Kannada) website to receive Golden Web Award, first Indian language (Kannada) editor for Palm OS, first Indian language (Kannada) editor for WinCE device (HP Jornado 720), first Indian language version (Kannada) of universally popular Logo (programming language for children) software, etc. His Kannada logo won the Manthan Award for the year 2006. He was a member of the technical advisory committee setup by the Govt. of Karnataka for Standardization of Kannada on Computers (2000). He is also a member of the Kannada Software Committee of Govt. of Karnataka (2008-current).

The Artists

Kiran Subbaiah	Kiran Subbaiah studied sculpture at Santiniketan, MSU Baroda and the RCA London. He was an artist in residence at the Rijksakademie Amsterdam where he worked on art that incorporated informatics and electro-mechanics. He is also known for making videos using custom-built tools that enable him to perform multi-person film-making tasks single-handed. His art is shown extensively in India and abroad. Subbaiah is based in Bangalore and is represented by the Chatterjee and Lal gallery in Mumbai. Kiran will present the Spectator, a robot that can sense the presence of human beings around it. It tries to appreciate them as works of art.
Tara Kelton	Tara Kelton is an artist and designer. She has been living in Brooklyn, USA and Bangalore, India for the last three years. She received her MFA from the Yale School of Art in 2009. Kelton’s video, print, and web-based works investigate moments in which technology alters our perception of the physical world. Kelton has taught at the Srishti School of Art, Design, and Technology and has recently exhibited her work at Vox Populi (USA), Franklin Street Works (USA), GALLERYSKE (Bangalore) and the India Design Forum (Mumbai). Tara will present Trace, a surveillance camera feed drawn in real-time by anonymous online workers.
Navin Thomas	Navin Thomas is a multimedia artist and a professional scrap market junkie, he spends a good quality of his precious time looking for obscure cultural misfits... after destroying most of himself in the 90's, he now spends his time restoring your mother's brother’s tin space toys and other unusual situations.
Abhishek Hazra	Abhishek Hazra approaches his art with a particular emphasis on the study of the historiography of science. He uses videos and prints that often integrate textual fragments drawn from real and fictional scenarios. He has previously exhibited and performed at Science Gallery, Dublin, HEART Herning Museum of Contemporary Art, Denmark, Astrup Fearnley Museum of Modern Art, Oslo, Casino Luxembourg Forum d’art Contemporain, Experiment Marathon Reykjavik, Reykjavik Art Museum and Kunstmuseum Bern. Abhishek was most recently an artist in residence at SymbioticA, the Centre for Excellence in Biological Arts, University of Western Australia, Perth. It was first performed as part of Beam Me Up, curated by Reinhard Storz and Gitanjali Dang, which was acknowledged by Pro Helvetia, New Delhi and German Book Office, New Delhi. Abhishek will be presenting #cloudrumble56 (attempted to re-animate sections of the Indian parliamentary archives — specifically, the transcripts of the scientist M.N. Saha's (1893-1956) interventions — through a performance that was transmitted only through live tweets on Twitter).
Aditya Dipankar	Aditya Dipankar started fiddling with music at the age of 4 when he started learning the tabla and then went on to play it for a long time. Years later, he discovered his strong inclination towards singing. Now, under the noble guidance of Pandit Vijay Sardeshmukh (Senior disciple of Pandit Kumar Gandharva), he is trying to understand the simplicity and spontaneity in the rich tradition of Hindustani classical music.
Nirmita Narasimhan	Nirmita Narasimhan is a Policy Director at CIS and works on accessibility for persons with disabilities. She was awarded the national award for empowerment of persons with disabilities by the President of India and also received the NIVH Excellence Award. Nirmita Narasimhan is a disciple of Dr. Radha Venkatachalam and renowned maestro Prof. T.R. Subramanyam. She began learning music at the age of 5 and went on to complete her Ph.D. in this subject from the Delhi University. Nirmita has been performing since 1995 and received several accolades such as the Sahitya Kala Parishad Scholarship and prizes in several competitions. She received the Gold medal in MA for standing first in the University and also stood first in MPhil. She has released a CD on Ponnayya Pillai compositions and also sung in an album of varnams. Nirmita has performed in different places in India such as Delhi, Chennai, Tirupathi and Bangalore as well as in Singapore and has also given several thematic concerts such as Eka Raga Sandhya and Pallavi concerts.
Sharath Chandra Ram	Sharath Chandra Ram (Sharathchandra Ramakrishnan) has interests in multimodal art, cognitive science, accessibility, digital humanities and network cultures. He is a faculty at the Centre for Experimental Media Arts at the Srishti School of Art Design and Technology. At the Centre for Internet and Society he helped set up and manage activities at the Metaculture Media Lab : an open hackerspace and alternative platform for research and exchange. His writings and musings at CIS maybe found here: http://cis-india.org/author/sharath He graduated from the University of Edinburgh with a degree in Artificial Intelligence specializing in interactive virtual environments. Previously as a Research Associate at the National Institute of Mental Health and Neurosciences he received a special mention award at the International Conference on Consciousness (2012) held at the National Institute of Advanced Studies for his work on ‘Cross modal Integration’. As an amateur radio broadcaster, he is a proponent of the free use of airwaves for relief work, education and transmission art. He has also been a development related radio journalist (PANOS @ Nepal, Voices UNDP@Bangalore), speaker at the International Ham Radio Convention (Port Blair, 2006) and as a film enthusiast has been a Press Reviewer for the Edinburgh International Film Festival.

National Resource Kit: The Himachal Chapter (Call for Comments)

The National Resource Kit team is pleased to bring you its research on the state of laws, policies and programmes for persons with disabilities in the state of Himachal Pradesh.

Executive Summary

Himachal Pradesh has issued a state policy for persons with disabilities to implement the provisions in the central laws. The government has brought out an integrated scheme for persons with disabilities in 2008 to implement certain sections of the Persons with Disabilities Act 1995. Through this scheme the government has made provisions for education, employment, training, health, rehabilitation and social protection for persons with disabilities.

Legal Provisions

Himachal Pradesh has brought out a state policy for persons with disabilities to implement the provisions under the two central laws, namely:

Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act 1995 (Persons with Disabilities Act)

National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple disabilities Act 1998 (National Trust Act)

The government of Himachal Pradesh has passed an integrated scheme for persons with disabilities in 2008 to implement Section 25 (A), Section 25 (E), Section 26, Section 30 (D), Section 39, Section 38 (I) (a), Section 41 and Section 66 of the Persons with Disabilities Act 1995.[2] Through this scheme the government has created provisions for education, employment, training, health, rehabilitation and social protection for persons with disabilities.

In order to elicit all relevant information related to persons with disabilities, the government has modified the Families Survey Register of ICDS to give an updated survey year on year. This is intended to help in understanding the nature and type of disabilities, educational and social status of families of persons with disabilities, employment status of disabled family members and the status of benefits availed under various scheme by persons with disabilities.

Accessibility

The integrated scheme for persons with disabilities provides for awareness generation and orientation through awareness camps, seminars and workshops with an idea of creating sensitivity among policy makers and social workers regarding the requirements of persons with disabilities. It also aims to educate the masses regarding barrier free environment and create a pool of access auditors for creating free access to persons with disabilities in public places and buildings. The scheme provides funds for the workshops, seminars and awareness camps to be held at various state, district and block levels.

Education

The government provides scholarships to students with disabilities from Class I to post graduate level and for diploma / vocational / technical / professional education. Students with disabilities whose annual family income from all sources does not exceed Rs. 60,000 are eligible to apply in the prescribed format with copies of bonafide Himachal Pradesh domicile certificate, disability certificate issued by competent authority, annual progress report of the student for the last year from the educational institution and the income certificate of the family. The government provides three per cent reservations for students with disabilities in all the educational institutions under the regular budget and programmes of any of the government departments.

The state has set up special schools for children with visual impairment and hearing impairment at Sunder Nagar for girls and at Dali for boys under the DSJE and SPCCD respectively.

Employment & Training

The state policy provides three per cent reservation in all state government posts from Class I to Class IV for persons with disabilities divided into one per cent each for persons with visual impairment, hearing impairment and orthopaedic disability. The policy further provides that employees with severe disability – 60 per cent or more – will be posted to stations of their choice as far as possible.

The government of Himachal Pradesh offers vocational / technical / livelihood training to persons with disabilities in collaboration with nongovernmental organisations and industrial bodies to promote self employment among persons with disabilities. The ventures will be financed by government finance development corporations.

Persons with disabilities who fulfil the following criteria should respond to the government’s call for training programmes in the prescribed format: the applicant Should be a bonafide resident of HP, should be between the age of 18 to 45 years on the date of application, should have passed the minimum educational qualification as required for the particular training programme and the annual income of the family should not be more than Rs. 1,00,000.

During the training, candidates will be provided a maximum assistance of rs. 1000 per month by the Department of SJE.

The government has also made provisions to provide financial assistance in form of subsidy in addition to the loans being provided by the HP Minority Financial Development Corporation to persons with disabilities for encouraging self employment. Candidates should apply to the HP Minority Finance and Development Corporation. Subsidy payable will be 20 per cent of the project cost or Rs. 10,000 whichever is less.

Himachal Pradesh recognises and awards best employers of persons with disabilities and best employees with disabilities. One award of Rs. 25,000 with citation is given to an employer who fulfils the following conditions: employs maximum number of persons with disabilities within the organisation, provides barrier free access within the premises, offers equitable working conditions for persons with disabilities on par with the other employees and provides additional facilities like travel and housing for employees with disabilities. Three awards of Rs. 10,000 each are given along with citations to one employee with disability each in the categories of visual impairment, hearing impairment and orthopaedic disability. Candidates for the awards will be either nominated by their employers or by the Deputy Commissioner (Disabilities) or recommended by the DWO of their respective districts.

Health and Rehabilitation

The integrated scheme for persons with disabilities creates provisions for early detection and prevention of disabilities through screening of children at regular intervals. The examination of children upto the age of six years will be carried out by Anganwadi workers while the examination of children upto 12 years will be undertaken by the Health and Family Department.

The scheme further provides for medical camps to be conducted to carry out regular checkups for persons with disabilities and certify their disabilities, recommend suitable aids and appliances for them and for the distribution of disability identity cards.

Social Protection

The state policy for persons with disabilities provides three per cent reservation in all poverty alleviation schemes for persons with disabilities.

The government provides marriage grants for persons with disabilities through its integrated scheme for marriages where either one or both parties are with disabilities. The scheme provides for a grant of Rs. 8000 for the marriage of a person who has a disability between 40 per cent and 74 per cent. It provides a grant of Rs. 15,000 for the marriage of a person with more than 75 per cent disability. Application for the grant is to be submitted in the prescribed format with copies of the birth certificate, bonafide domicile certificate for Himachal Pradesh, disability certificate issued by the district medical board and marriage registration certificate of the applicant along with an undertaking from the applicant that such a grant has not been received before.

National Resource Kit: The Goa Chapter (Call for Comments)

The National Resource Kit team is pleased to bring you its research on the state of laws, policies and programmes for persons with disabilities in the state of Goa.

The chapter is an early draft and is in the process of being reviewed and updated. Comments and feedback are welcome.

Executive Summary

Goa has framed the Goa Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Rules 1997 and has formulated the state policy and plan of action for Differently Abled persons to implement the provisions under the three central laws.

The state policy makes provisions for barrier free access. The state has issued three notifications for education, four notifications for employment and one notification each for health and rehabilitation, social protection and transport.

Legal Provisions

Celebrating 5 Years of CIS
We at the Centre for Internet and Society celebrate 5 years of existence with an exhibition showcasing our work and accomplishments over this time. The exhibition will be held concurrently at both our Bangalore and Delhi offices from May 20 to 24, 2013, from 10 a.m. to 8 p.m.

Google Policy Fellowship
CIS is inviting applications for the Google Policy Fellowship programme. Google is providing a USD 7,500 stipend to the India fellow who will be selected by July 1, 2013. Fellowship focus areas include Access to Knowledge, Openness in India, Freedom of Expression, Privacy, and Telecom Send in your applications for the position by June 15, 2013.

Accessibility

CIS is doing two projects in partnership with the Hans Foundation. One is to create a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India and another is for developing a screen reader and text-to- speech synthesizer for Indian languages. CIS is also working with the World Blind Union and many other organisations to develop a Treaty for the Visually Impaired helped by the WIPO:

CIS Gets ITU-D Sector Membership: CIS has become a sector member of ITU-D.

Access to Knowledge and Openness

The Wikimedia Foundation awarded CIS a two year grant of INR 26,000,000 to support and develop the growth of Indic language communities and projects by community collaborations and partnerships. This is being carried out by the Access to Knowledge team based in Delhi. CIS is also doing a project (Pervasive Technologies) on examining the relationship between production of pervasive technologies and intellectual property. CIS also promotes openness including open government data, open standards, open access, and free/libre/open source software through its Openness programme.

Wikipedia
Beginning from September 1, 2012, Wikimedia Foundation awarded CIS a two-year grant of INR 26,000,000 to support and develop free knowledge in India. The A2K team consists of four members based in Delhi: T. Vishnu Vardhan, Nitika Tandon and Subhashish Panigrahi, and one team member Dr. U.B. Pavanaja who is working from Bangalore office. Noopur Raval, Programme Officer has left the organisation. April 24, 2013 was her last working day.

Internet Governance

The Internet Governance programme conducts research around the various social, technical, and political underpinnings of global and national Internet governance, and includes online privacy, freedom of speech, and Internet governance mechanisms and processes. CIS in partnership with the Ford Foundation is executing a project on Internet Access. It covers the history of the internet, technologies involved, principle and values of internet access, broadband market and universal access and will touch upon various polices and regulations which has an impact on internet access and bodies and mechanism which are responsible for formulation policies related to internet access. National Resource Kit: The Rajasthan Chapter (Call for Comments)

The National Resource Kit team is pleased to bring you its research on the state of laws, policies and programmes for persons with disabilities in the state of Rajasthan.

The 2001 Census revealed that in Rajasthan 2.5% of the population consisted of disabled persons. During the same year, the Rajasthan Government conducted a door to door survey in order to categorize the disabilities according to the seven categories listed in the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. Among the disabled, the highest number of 53.4 % was persons with visual impairment. Rajasthan also has 6.45% of the total disabled population in India, the sixth largest in the country.

The Department of Social Welfare and Empowerment, Rajasthan implements the various rules and schemes concerning persons with disabilities in Rajasthan. The State Government has also appointed a Commissioner for Disabilities. In May 2010, the Rajasthan Government appointed a task force on disability to develop a Comprehensive Disability Policy for the state. The policy aims at including disability rights, values and practices into government developmental strategies, planning and programs and development of an integrated management system for the coordination of disability planning. The policy is still in the pre-cabinet stage.

The State Government has also introduced various schemes for welfare of persons with disability. Out of these, schemes such as the Viswas Yojana to provide loan and subsidy for self-employment, Sukhad Jeevan Yojana to provide assistance for marriage of disabled persons and the Aastha Yojana etc. are some of the more important ones.

CIS Gets ITU-D Sector Membership

The Centre for Internet and Society (CIS) has become a sector member of ITU-D, the development sector of the International Telecommunication Union, the specialized UN Agency dealing with telecommunications and information communications (ICTs).

Over the past years, CIS has had the opportunity to work with ITU on specific accessibility related projects. With this membership, CIS will be able to participate more regularly in ITU activities and contribute to key policy and regulatory debates surrounding telecommunications and ICTs at the global level. CIS is one of six civil society organizations registered as ITU members from the Asia-Pacific region.

CIS Intervention on the Treaty for the Visually Impaired at SCCR/SS/GE/2/13

The informal session and special session of the Standing Committee on Copyright and Related Rights was organised by WIPO in Geneva from April 18 to April 20, 2013. Pranesh Prakash participated in the session and spoke about the rights of the visually impaired. An abridged version of this was read out during the meeting on Saturday, April 20, 2013, at 22:15 due to time restrictions.

Thank you, Mr. Chair. I represent the Centre for Internet and Society, a policy research organization based in India. India, as everyone who has been attending these SCCR meetings since 2008 would know, has the world's largest population of blind and visually impaired persons. Two of my colleagues at CIS — Nirmita Narasimhan and Anandhi Viswanathan — are blind, and another one of my CIS colleagues who passed away recently (and whose tireless efforts were remembered here at WIPO recently with a minute of silence) — Rahul Cherian — spent many years working extensively on policy issues related to persons with disabilities, and in particular worked here in WIPO as part of Inclusive Planet, and with the World Blind Union. Hence, this issue is not an abstract one for us, but a very real one.

I commend the delegates here for taking some steps forward during this meeting. However, very disappointingly, with those few steps forward, we have seen a few things we had taken as settled being opened up again, and many steps being taken backward. The already-onerous requirements and procedures laid down in this treaty are seen by a few countries as not being onerous enough. Blind people, it is believed, might 'wrongly' take advantage of these provisions. Worse yet, there is a fear that sighted persons might take advantage of these provisions relating to the blind.

The absurdity of these fears somehow seems to have escaped the notice of many involved in these discussions. There is nothing in these provisions that would convert infringement by sighted people — even if under the pretence of this treaty — magically into lawful acts. And, indeed, there are multifarious ways of infringing copyright without such resort to this treaty. Yet, these very same onerous requirements (such as the "commercial availability" requirement) and bureaucratic processes will unrealistically increase transaction costs for the visually impaired and render infructuous the very purpose of this treaty. Those delegations who are unrelenting on these issues seem to living in a bizarre world where sighted infringers deviously use exceptions granted in an international copyright treaty to engage in piracy; a bizarre world where scanners and the Internet have not been invented. And by refusing to acknowledge these ground realities, they are merely forcing the blind into wearing eye-patches and being 'pirates'.

In particular, I would like to deplore the stand taken by the European Union, being represented here by the European Commission, whose actions run contrary to the call made in May 2011 by the European Parliament to "to address the ‘book famine’ experienced by visually impaired and print-disabled people". This is despite the European Parliament having reminded "the Commission and Member States of their obligations under the UN Convention on the Rights of Persons with Disabilities to take all appropriate measures to ensure that people with disabilities enjoy access to cultural materials in accessible formats, and to ensure that laws protecting IPR do not constitute an unreasonable or discriminatory barrier to access by people with disabilities to cultural materials". The EU, and a few countries of Group B, including the United States, have been slowly bleeding this treaty to death through over-legislation and bureaucracy.

The United States' and EU's stand on technological protection measures, if accepted, would mean that publishers will technologically be able to prevent the blind from enjoying accessible works, even when they can't do so legally on the basis of copyright law. The European Union's stand on all issues has been extraordinarily harmful, and seems to have an aim to make this treaty as unwieldy and unworkable as possible. They seem to regard the Berne Appendix as their model in this regard: an international agreement that exists on paper for the benefit of developing countries, but because of its bureaucratic processes is little used, and is widely regarded as a failure.

Here is what it boils down to: when it comes to the economic rights of copyright owners, current international law insists that there be no formalities, yet when it comes to the human rights of visually impaired person to access information — a right specifically guaranteed to them under the UN Convention on the Rights of Persons with Disabilities — some delegates in this room wish to ensure as many formalities as possible.

The rights of the visually impaired are being buried under unnecessary and complicated requirements and bureaucratic practices. This injustice must stop: the delegates here have the power to do so. And if the EU does not wish to be viewed as villains by all persons with print disabilities and all persons with conscience, it should stop trying to make this an ineffectual treaty. Many have quipped that this is fast becoming "A Treaty for Rightholders Against Persons with Visual Impairments and Print Disabilities" or alternatively "A Treaty for Morally Impaired Persons and Persons with Ethical Disabilities". That is an international shame.

Having colonized much of the world into using English, French, and Spanish, these European countries along with the USA are now in a position to be both culturally dominant and to refuse to sign up to this treaty if it helps blind persons outside of the EU and the USA who seek access to texts in these languages. These remnants of colonialism must be stamped out.

Dr. U.B. Pavanaja holds a Master’s degree from Mysore University and Ph.D. from Mumbai University. He has vast experience and has dedicated himself fully for the cause of Computer and Indian languages. He is one of the oldest editors of Kannada Wikipedia.

Global Accessibility Awareness Day (GAAD 2013)

The Centre for Internet and Society is pleased to invite you to participate in the Global Accessibility Awareness Day (GAAD) at The Energy and Resources Institute (TERI) in Bangalore on May 9, 2013. The event begins at 4.00 p.m. and will end by 7.00 p.m.

The purpose of the day is to get people talking, thinking and learning about digital (web, software, mobile, etc.) accessibility and users with different disabilities. The target audience of GAAD is the design, development, usability, and related communities who build, shape, fund and influence technology and its use. While people may be interested in the topic of making technology accessible and usable by persons with disabilities, the reality is that they often do not know how or where to start. Awareness comes first.

This will be an opportunity for you to understand the importance of accessibility and how accessibility impacts several users and increase your customer base. About the Speakers

Vivek Gaikwad	Vivek is an individual, passionate about accessibility, who digs out all the possible ways to make an application accessible to persons with disabilities. For past 7 years, he is consistently doing R&D on how to make applications, games, e-learning and mobile apps which are built in various technologies/platforms such as Flash, HTML, iOS and Android, PDF, etc., accessible. His emphasis is on providing feasible accessibility solutions by understanding the scenario and the compliance required. His various roles so far in his career such as a developer, tester, trainer and consultant apprehends in finding the exact fit solution for any accessibility related issue. This also helps in understanding and filling the gap between management and the delivery team for accessibility projects. He doesn't work only for compliance of any product, but tries to make it 100 per cent accessible for all the users. Vivek also loves trekking and getting involved in creative things.
Srividya Vaidyanathan	Srividya has a B.Tech in Electrical Engineering from NIT Warangal and is currently working as a Consultant for the Centre for Internet & Society. She more than 13 years of experience in the software industry with TCS, Oracle etc with her latest stint being a co-founder of PixelMat Software a company that makes development of pure native mobile apps easier. A very hands-on mom who loves to play ball with her son in her free time.
Lavanya Lakshman	Lavanya has done BE in Electronics Engineering and MS in Networking from Symbiosis, Pune. She has close to 10 years of experience with over 5 and a half years with Yahoo alone. She is working as principal engineer on font end development and works mainly on platform products varying from user profile experience to application development network. She is currently working on Geo Platform for serving location based experience across Yahoo. She has submitted papers in various forums which includes: White paper titled “Strategic Choice of Test Automation Framework”. This was selected for plenary presentation at SteP-IN Summit 2009. White paper titled “A New Era of Accessibility Testing”. This was selected for publication at the USID Conference 2009. White paper titled “Accessibility: An Emerging field of Usability” for Step-IN Summit 2010.
Rama Chari	Rama Chari has about two decades of work experience in the field of disability. She started her career as an Educator for children with disabilities in the rural community based project of Action for Ability Development & inclusion (AADI) (Formerly, Spastics Society of Northern India (SSNI), She prepared children with disabilities for integrating them into regular schools in the villages of Haryana. She then joined National Centre for Promotion of Employment for Disabled People (NCPEDP), a leading national level advocacy organisation. At NCPEDP, she headed the Legislation, Networking and Communication Units. As part of the core management team of NCPEDP, she played an important role in bringing about several policy changes vis-à-vis disability in the country. In November 2005, she took up a consultancy with Infosys BPO, for setting up their Equal Opportunity Programme. In July 2007, she along with four other professionals set up DEOC. She is serving as an Honorary Board Member of ARUNIM, a marketing initiative for promoting products and services made by disability groups and NGOs. She is also part of the NCPEDP’s National Committee on the Rights of Persons with Disability, which focuses on advocacy for appropriate policies in the country. She is also a Core Group Member of the Disability Forum of Confederation of Indian Industry – Karnataka Chapter. She has travelled widely and has made several presentations on the subject, in national and international conferences / seminars.
Anusuya Das	Anusuya graduated in Computer Engineering from Mumbai University in 2004, and worked as a Software Engineer for 2½ years. Later, she changed her field and completed Masters Degree in Social Work from Nirmala Niketan College of Social Work, Mumbai University. During the 2 years, she gained valuable experience and insight while working for various causes such as Child labour, Disaster Management and Disability. Since 2010, she is working as Chief Coordinator at Mitra Jyothi, Bangalore. It is an NGO working towards the education, training and empowerment of the visually impaired. She is mainly handling the DAISY production unit, Braille Transcription Centre and Digital Talking Book Library at Mitra Jyothi, and is a certified trainer in DAISY content creation.
