Research

New series from RAW, new Clusters now Online!

From 2012 to 2015, the RAW series will build research clusters in the field of Digital Humanities. The Digital will be used as a way of unpacking the debates in humanities and social sciences and look at the new frameworks, concepts and ideas that emerge in our engagement with the digital. We hope to build knowledge networks and production of new knowledge around questions of body, governance and cultural production in the digital times that we live in. Spearheaded by experts in the field of science, technology, society and culture the clusters aim to produce and document new conversations and debates that shape the contours of Digital Humanities in Asia.

Locating the Mobile: An Ethnographic Investigation into Locative Media in Melbourne, Bangalore and Shanghai

As yet we know little about the impact locative media is having, and will have upon people’s livelihoods and identity, or on public policy around privacy, identity, security and cultural production. Discourse in the field has opened up questions of art, innovation and experimentation. But there is a dearth of nuanced research on locative media that provides in-depth, contextual accounts of its socio-cultural and political dimensions. Not much work has been conducted into locative media as it migrates from art to the ‘messy’ area of everyday. The project seeks to address this knowledge gap by studying locative media in Bangalore, Melbourne and Shanghai.

Interface Intimacies

Users of technologies often express their engagement with technologies in affective terms. The interfaces that we see all around us constantly deflect our attention, emotions and desires on to different surfaces, creating flattened universes with the promises of deep immersion. Digging deep into interfaces, to examine peoples’ relationships with the digital interfaces around them the research cluster examines: What are the affective relationships that people have with their interfaces? What goes into anthropomorphising an interface? What are the larger politics of labour, performance and ownership that surround interface design? What are the ways in which people simulate presence and connections through their interfaces? How is the human presumed in computer-human interface design? What aesthetic and political moves are we witnessing with the rise of interface mediated publics? What and who is made opaque when interfaces become transparent? When interfaces get distributed, what are the possibilities and potential for art, theory and practice to move into new forms of politics?

Habits of Living: Global Networks, Local Affects
Wendy Chun (Professor, Brown University), Kelly Dobson, (Chair, Digital + Media, RISD, Providence), Matthew Fuller, David Gee (Reader in Digital Media, Center for Cultural Studies, Goldsmiths College, University of London) and Eivind Rossaak, (Associate Professor, Department of Research, National Library of Norway, Oslo).
This is a global collaborative project to renew the conceptual power of networks. It concentrates on changing the habits of living. The Department of Modern Culture and Media at Brown University will be an important locus. Habits are crucial to understanding networks not simply as broad organizational structures but also as structures created through constant actions that are both voluntary and involuntary.

Video Contest

Who’s the Everyday Digital Native? A global video contest finds the answer!
CIS and Hivos are excited to announce the top five videos. The finalists will each win EUR 500. According to Nishant Shah, the 12 video proposals show that the everyday digital native does not wake up in the morning and think, ‘today I will change the world’. Yet, in their everyday lives, when they see the possibility of producing a change in their immediate environments, they turn to the digital to find networks that can start a change.

The lecture focused more on the India against Corruption case-study rather than the theoretical framework to understanding revolutions.

ITU Tutorial on Audiovisual Media Accessibility (India International Centre, New Delhi, March 14 to 15, 2012): At the invitation of the Centre for Internet and Society, in cooperation with the ITU-APT Foundation of India, International Telecommunication Union organized a two-day Tutorial on Audio Visual Media Accessibility. The Tutorial was preceded by the fourth meeting of the Focus Group on Audio Visual Media Accessibility on March 13, 2012. Sunil Abraham participated in the event and was the Master of Ceremony on Day 1, March 14, 2012.

Consumers International Global Meeting 2012 (Kuala Lumpur, March 8 and 9, 2012): Pranesh Prakash participated in the global meeting organised by Consumers International and spoke on UN Consumer Guidelines. Robin Brown, Tobias Schönwetter and Guilherme Varella were the other speakers in the session.
Expert Meeting on Freedom of Expression and Intellectual Property Rights (London, November 18, 2011): The meeting was organized by ARTICLE 19. Nineteen international scholars, experts and human rights activists met to explore the antagonistic relationship between Intellectual Property (IP) and the rights to freedom of expression and information. Pranesh Prakash was one of the participants.

Open DataCamp — 2012 (Google, Old Madras Road, Bangalore, March 24, 2012): This was a one-day unconference for people working with data from various sectors to come together and share their projects and ideas. It was organised by the DataMeet group. Pranesh Prakash participated in the event. Google, India Water Portal, Gramener, Microsoft Research, Akshara Foundation, DataMeet, HasGeek and CIS were the sponsors.
Free Arduino Workshop (For Beginners): (CIS, Bangalore, March 3, 2012). The workshop drew participants such as interaction designers, artists and those enthusiastic to get started with creative projects but didn’t have prior experience with electronics. About 20 people participated in the workshop.

We are very glad that Shri Rajeeve has moved this motion, and we hope that it gets adopted in the Lok Sabha as well, and that the Rules get defeated, notes Pranesh Prakash.

India Explores the Balance Points between Freedom of Expression, Privacy, National Security and Law Enforcement (New Delhi, March 5, 2012). Sunil Abraham participated in this closed-door meeting jointly organised with the Global Network Initiative. Issues relating to freedom of expression and privacy were discussed in the meeting.
Climate Change and Controversy Mapping (Indian Institute of Science, Bangalore, March 19 to 21, 2012). The Devechia Centre for Climate Change, the Indian Institute of Science and CIS organized a three-day workshop with Professor Bruno Latour. Doctorate students doing empirical work in various types of ecological crisis participated in the event and experimented with some of the digital tools and methods developed within the "mapping controversies" consortium.
GeekUp with Erica Hagen (CIS, Bangalore, March 1, 2012). HasGeek organized a GeekUp with Erica Hagen of the GroundTruth Initiative. Erica gave a lecture on the theme: "From Information to Empowerment: Unpacking the Equation.
Cartonama Workshop (CIS, Bangalore, March 2 and 3, 2012). HasGeek organized a hands-on training for managing and building location based services. Twenty-two participants attended the workshop.

The Abrams Institute for Freedom of Expression at Yale Law School is holding a conference on global censorship from March 30 to April 1, 2012, at Yale Law School. The programme is sponsored by the Information Society Project at Yale Law School and Thomson Reuters. Rishabh Dara, Google Policy Fellow who worked at CIS office in Bangalore on freedom of expression and internet-related policy issues is participating in the event as a speaker in the panel on Case Studies of Censorship.

Analysis of the Copyright (Amendment) Bill 2012
Pranesh Prakash
There are some welcome provisions in the Copyright (Amendment) Bill 2012, and some worrisome provisions. Pranesh Prakash examines five positive changes, four negative ones, and notes the several missed opportunities. The larger concern, though, is that many important issues have not been addressed by these amendments, and how copyright policy is made without evidence and often out of touch with contemporary realities of the digital era. Copyright Madness (Lawrence Liang and Achal Prabhala, Indian Express, May 22, 2012): India’s Copyright Act allows owners of content the right to prevent infringement through the use of injunctions, but these injunctions have to be narrowly construed and applied only to specific instances of infringement. This is to say, take down the infringing video, not the whole website, and don’t intimidate the host. When injunctions threaten freedom of speech and expression, then free speech should necessarily trump copyright claims — and the courts cannot be used as convenient shopping forums for maladies that don’t exist.

Cancel the Subscription (Prof. Subbiah Arunachalam, Indian Express, May 8, 2012): It has been a slow but steady move to make scholarship freely available... In India, though, there appears to be very little enthusiasm among the leaders of the science establishment. Neither the office of the principal scientific adviser nor the department of science and technology seems to have shown any interest in mandating open access to taxpayer-funded research. The National Knowledge Commission has recommended mandating open access to all publicly funded research, but it is not clear who will implement the recommendation. Right now, it is left to individuals to promote open access in India.

Google Policy Fellowship

Google Policy Fellowship Programme: Call for Applications: CIS is inviting applications for the Google Policy Fellowship programme. Google is providing a USD 7,500 stipend to the India Fellow, who will be selected by August 15, 2012. The focus areas for the present fellowship programme include Access to Knowledge, Openness in India, Freedom of Expression, Privacy, and Telecom. The duration of the fellowship will be for about ten weeks starting from August 2012 upto October 2012. CIS will select the India Fellow. Send in your applications for the position by June 27, 2012.

Digital Natives with a Cause? is a research inquiry that looks at the changing landscape of social change and political participation and the role that young people play through digital and Internet technologies, in emerging information societies. Citizen Action

Resisting Revolutions: Questioning the Radical Potential of Citizen Action (Nishant Shah, Development, Volume 55, Issue 2, May 2012): In this peer reviewed journal article, Nishant Shah looks into the radical claims and potentials of citizen action that have emerged in the last few years. He seeks to show how citizen action is not necessarily a radical form of politics and that we need to make a distinction between Resistances and Revolutions. It locates resistance as an endemic condition of governmentality within a State–Citizen–Market relationship and shows how it often strengthens the status quo rather than radically undermining it. He examines a campaign against corruption in India to see how the dissonance between the claims of the future and the practices of the present is produced in citizen action.

Telecom

While the potential for growth and returns exist for telecommunications in India, a range of issues need to be addressed. One aspect is more extensive rural coverage and the other is a countrywide access to broadband which is low. Both require effective and efficient use of networks and resources, including spectrum:

Course

Building Knowledge and Capacity around Telecommunication Policy in India: Ford Foundation has given a grant of $200,000 to CIS to build expertise in the area of telecommunications in India over a period of two years. The project involves creating a repository comprising information about telecommunications related issues and policies and online course materials designed for a multi-stakeholder audience, organising interactive public lectures and workshops around the country to disseminate information on telecom issues and using traditional and new forms of media to disseminate information to academia, civil society, policy makers and the general public.

Intermediary Liability in India: Chilling Effects on Free Expression on the Internet
Rishabh Dara, Google Policy Fellow
CIS in partnership with Google India conducted the Google Policy Fellowship 2011. This was offered for the first time in Asia Pacific as well as in India. Rishabh Dara was selected as a fellow. He researched upon issues relating to freedom of expression. The results of the paper demonstrate that the ‘Information Technology (Intermediaries Guidelines) Rules 2011’ notified by the Government of India on April 11, 2011 have a chilling effect on free expression.

The Centre for Internet & Society Joins the Global Network Initiative
CIS officially joined the Global Network Initiative. CIS would bring to GNI in-depth expertise on global internet governance as well as online freedom of expression and privacy in India. GNI Executive Director Susan Morgan said “We are delighted to add our first member based in India and welcome CIS’s engagement in support of transparency and accountability in technology.”

Accessibility

Around 70 million disabled persons in India are unable to participate in information societies as lack of compliance with accessibility standards make interfaces impossible to use, and retrograde copyright and patent policies make it impossible to access knowledge. Accessibility is denied in banking services, web and mobile interfaces, etc. Material for the disabled therefore needs to be converted into accessible formats. The programme has resulted in outputs such as Web Accessibility Policy Making, Making Mobile Phones and Services Accessible for Persons with Disabilities, Accessibility Policy Making: An International Perspective, e-Accessibility Policy Handbook for Persons with Disabilities, Universal Service for Persons with Disabilities: A Global Survey of Policy Interventions and Good Practices, etc.

Web Accessibility Policy Making: An International Perspective: G3ict and the Centre for Internet and Society are pleased to announce the publication of a new, improved edition of the Web Accessibility Policy Making: An International Perspective. The report published in cooperation with the Hans Foundation provides an updated synopsis of the many policies that governments have implemented around the world to ensure that the Internet and websites are accessible to persons with disabilities.

ITU Tutorial on Audiovisual Media Accessibility (India International Centre,New Delhi, March 14 to 15, 2012): At the invitation of the Centre for Internet and Society, in cooperation with the ITU-APT Foundation of India, International Telecommunication Union is organizing a two-day Tutorial on Audio Visual Media Accessibility. The Tutorial will be preceded by the fourth meeting of the Focus Group on Audio Visual Media Accessibility on March 13, 2012. The meeting will take place in the same venue and will be hosted by the Centre for Internet and Society in cooperation with the ITU-APT Foundation of India.

Access to Knowledge

With the emergence of digital technologies and the unprecedented growth of the Internet and other related technologies, intellectual property rights (IPRs) the questions of ownership and control of information have become crucial. The programme focuses on the inequitable distribution of IPR, royalty, outflows, and beneficiaries of intellectual property regimes, the lack of balance in current IPR regimes [local, national and international] between consumer rights and IPR-owners’/corporation’s rights. The programme has produced analyses such as WIPO Treaty for the Print Disabled, WIPO Broadcast Treaty, Copyright Amendment Bill and Parallel Importation of Books.

Openness

The advent of the Internet has radically defined what it means to be open and collaborative. Even the Internet is built upon open standards and free/libre/open source software. The broad rubric of the ‘Openness’ programme focuses to provide evidence based research that will help inform policy and practice of the local, national, regional, bilateral and international policies and practices around Open Government Data, Open Access to Scholarly Literature, Open Access to Law, Open Content, Open Video, Open Standards and Free/Libre/Open Source Software. The programme has resulted in reports such as Open Government Data Study, Online Video Environment in India, a reader on the Wikipedia titled Critical Point of View: A Wikipedia Reader and a film titled People are Knowledge – Experimenting with Oral Citations on Wikipedia.

Governments and private corporations are engaging in human rights violations online. Many different rights are impacted by internet governance policy changes. The growing phenomenon of illegal electronic surveillance by state and non-state actors and censorship of speech online are some specific problems that the Internet Governance programme seeks to address by providing evidence based research that will help inform policy and practice of the local, national, regional, bilateral and international privacy regime in the interests of the public in sectors key to information societies with a particular focus on information technology, privacy and freedom of expression. The programme has resulted in outputs such as Banking, Telecommunications, Consumer Protection, IT Act, Limitations, Copyright, Internet Protocol, Media, Sexual Minorities, UID and policy submissions such as, NIA Bill, IT Act, National Policy on Electronics, Cyber Café Rules, Security Practices Rules, and Intermediary Due Diligence Rules.

Unlicensed Spectrum-Policy Brief for Government of India NTP '11 by Satyen Gupta, Sunil Abraham and Yelena Gyulkhandanyan: The research paper aims to recommend unlicensed spectrum policy to the Government of India based on recent developments in wireless technology, community needs and international best practices, and seeks to demonstrate the need for and importance of unlicensed spectrum as a medium for inexpensive connectivity in rural/remote areas, as well as catalyzing innovation by being a barrier-free and cost-effective platform for the testing and implementing of new technologies.

Digital Natives with a Cause?

Digital Natives with a Cause? is a knowledge programme initiated by the Centre for Internet and Society, India and Hivos, Netherlands. It is a research inquiry that seeks to look at the changing landscape of social change and political participation and the role that young people play through digital and internet technologies, in emerging information societies. The programme has resulted in a four-book collective titled Digital AlterNatives with a Cause? and reports such as Digital Natives with a Cause? A Report and Digital Natives with a Cause? Thinkathon: Position Papers.

Events

Digital Natives Video Contest: Twenty-one candidates have been shortlisted, videos will be online soon. Voting begins from March 10, 2012. The Centre for Internet and Society is co-organising the video contest with Hivos, Netherlands.

Alternative Approaches to Social Change

“Observations about intangible aspects of a movement will keep a research from clinging to activism with a capital A, and start seeing a gradation in the social movement practices. It is constructive and opens the door to analyses of multi-dimensional movements such as the Blank Noise initiative (India). Drawing on methods of identifying new developments to the field of social movement, Maesy examines some aspects of it: the issue, strategy, site of action, and internal mode of organization.”

Accessibility

India has an estimated 70 million disabled persons who are unable to read printed materials due to some form of physical, sensory, cognitive or other disability. This includes persons with blindness, learning disabilities such as dyslexia, cerebral palsy and persons who do not have full control over their limbs. For these people, the material needs to be converted into alternate formats such as Braille, audio or video or electronic formats (text document, word document or PDF) which they can access using assistive technologies. Our key research has focused on a submission to amend the Indian Copyright to the HRD Ministry, publishing a policy handbook on e-accessibility, research on accessible mobile handsets in India and an analysis of the Working Draft of the Rights of Persons with Disabilities Act, 2010.

Featured Research

Making Mobile Phones and Services Accessible. CIS researched, edited and published this report in partnership with G3ict and ITU. The report contains a foreword, eleven chapters, a bibliography and glossary with contributions from Deepti Bharthur, Nirmita Narasimhan and Axel Leblois.

Upcoming Event

ITU Tutorial on Audiovisual Media Accessibility, organized by the International Telecommunication Union, India International Centre, 14-15 March 2012. CIS is hosting the meeting. The Tutorial will be preceded by the fourth meeting of the Focus Group on Audio Visual Media Accessibility (FG AVA) on 13 March 2012. This meeting will take place at the same venue and will also be hosted by CIS, in cooperation with the ITU-APT Foundation of India.

Access to Knowledge

Access to Knowledge is a campaign to promote the fundamental principles of justice, freedom, and economic development. It deals with issues like copyrights, patents and trademarks, which are an important part of the digital landscape. We prepared the India report for the Consumers International IP Watchlist, made submission to the HRD Ministry on WIPO Broadcast Treaty, questioned the demonization of pirates, and advocated against laws (such as PUPFIP Bill) that privatize public funded knowledge.

Gandhi, Freedom, and the Dilemmas of Copyright: To commemorate Mahatma Gandhi's death anniversary, CIS organised a public lecture. Prof. Shyamkrishna Balganesh of the University of Pennsylvania gave a lecture.

Openness

The advent of the Internet has radically defined what it means to be open and collaborative. Even the Internet is built upon open standards and free/libre/open source software. CIS has been committed and actively campaigned for promotion of open standards, open access and free/libre/open source software.

Summary of the Minutes of the Workshop on Biodiversity Informatics, organized by the Western Ghats Portal team to explore the contemporary state of biodiversity informatics at Ashoka Trust for Research in Ecology and Environment (ATREE), Bangalore on 25 November 2011.
Design!PubliC — Innovation and the Public Interest: On the 14th of October, 2011, the Center for Knowledge Societies organized the second edition of the Design Public Conclave, a conversation on how innovation can serve the Public Interest. The conclave was held at the National Gallery of Modern Art in Bangalore.
Report on the 'Open Access to Academic Knowledge' workshop: On Wednesday the 2nd of November, during Open Access Week, the Indian Institute of Science in conjunction with the Centre for Internet and Society held a workshop on Open Access at the National Centre for Science Information, in Bangalore. We recorded the meeting and published it online.

Internet Governance

The Tunis Agenda of the second World Summit on the Information Society has defined internet governance as the development and application by governments, the private sector and civil society, in their respective roles of shared principles, norms, rules, decision-making procedures and programmes that shape the evolution and use of the internet. CIS partnered with Privacy International and Society in Action Group which has produced outputs in banking, telecommunications, consumer rights, etc., submitted open letters to Parliamentary Committee on UID, feedbacks on NIA Bill, and IT Rules.

On January 21, 2012 a public conference “Privacy Matters” was held at the Indian Institute of Technology in Mumbai. It was the sixth conference organised in the series of regional consultations held as “Privacy Matters”. The present conference analyzed the Draft Privacy Bill and the participants discussed the challenges and concerns of privacy in India.

Future of Integrated Science Education in Higher Education in India
The Higher Education Innovation and Research Application (HEIRA) at the Centre for the Study of Culture and Society (CSCS) and the Centre for Contemporary Studies (CCS) at the Indian Institute of Sciences (IISc) hosted a two day workshop on 2 and 3 January 2012 on the Future of Integrated Science Education in Higher Education in India at the Centre for Contemporary Studies, IISc. Telecom

The growth in telecommunications in India has been impressive. While the potential for growth and returns exist, a range of issues need to be addressed for this potential to be realized. One aspect is more extensive rural coverage and the second aspect is a countrywide access to broadband which is low at about eight million subscriptions. An FAQ on the Copyright Amendment Bill, 2012, for the Benefit of Persons with Disabilities

The Copyright Amendment Bill 2012 introduced certain provisions for the benefit of persons with disabilities and as it has been passed by both houses of parliament (By the Rajya Sabha on May 17, 2012 and the Lok Sabha on May 22, 2012).

Who does this amendment benefit?
This amendment benefits all persons with disabilities who cannot enjoy works in their normal format thus amongst others it would cover totally blind, low vision, learning disabled, the deaf and hard of hearing and orthopedically challenged people who are unable to hold books or turn its pages.
What can be done now that was not possible earlier?
Persons with disabilities who cannot access a work in their normal format and organizations can suitably modify a work so as to make it accessible to meet the specific needs of the person with disability. This means that a standard printed book, for example may be converted to an alternate format (not necessarily a special format) including Braille, large font, text readable by screen reader, audio (be it synthetic audio or human voice recording) without seeking the permission of the rights holder.
How is this different?
In the past, any alternate format creation would have been an infringement unless it was backed up by prior written permission from the rights holder. One had to seek the permission if one had to be on the right side of the law. Now these permissions are not needed for non-profit conversion and distribution.
Are there any restrictions? Yes, there are reasonable restrictions such as:
(a) conversion should be a not for profit activity. In case it is a for profit activity, there is a separate clause under which a special license can be obtained.-
(b) The accessible format copy has to be distributed to a bonafide print impaired person or organizations that serve them.

What is the meaning of a “work”?
A work means:
(a) a literary, dramatic, musical or artistic work;
(b) a cinematograph film;
(c) and a sound recording;
It includes all works which are available in India in the normal channels of business.
What activities are permitted for the benefit of persons with disabilities?
The adaption, reproduction, issue of copies or communication to the public of any work in any accessible format to facilitate persons with disability to access works.
Is permission required from publishers to undertake the above activities?
No, permission from publishers are not required to undertake the above activities subject to the points given below.
What are “accessible formats”?
Accessible formats include, Braille, audio (be it synthetic audio or human voice recording), Daisy, accessible pdf, large print, movies with subtitles etc.
What is the meaning of “adaption”?
“Adaption” in relation to any work, mean any use of such work involving its re-arrangement or alteration. Conversion of a work into an accessible format would be treated as an adaption
What is the meaning of “communication to the public”?
"Communication to the public" means making any work available for being seen or heard or otherwise enjoyed by the public directly or by any means of display or diffusion other than by issuing copies of such work. This includes making the accessible format copy available over the Internet or distributing it from a website.
Who can create and distribute accessible formats?
(a) Any person can create and distribute accessible formats if it is done for facilitating access by persons with disabilities. Parents, friends and persons with disabilities themselves can create accessible formats.
(b) An organization working for the benefit of the persons with disabilities can also create and distribute accessible formats.
Are there any preconditions on the type of organization that can undertake the activities?
Yes, the organization must satisfy one of the following conditions to undertake the activities:
(a) The organization must be registered under section 12A of the Income Tax Act, 1961 and work for the benefit of persons with disability; or
(b) The organization must be recognized under Chapter X of the Persons with Disabilities (Equal Opportunities Protection of Rights and Full Participation) Act, 1995; or
(c) The organization must receive grants from the Government for facilitating access to persons with disabilities; or
(d) The organization must be an educational institution or library or archives recognized by the Government.
Can accessible format copies be shared between persons with disabilities?
Yes, they can be shared
Can any of the activities be undertaken for profit?
No, for profit activities require a separate license from the copyright board. This license will prescribe several conditions including the royalty, if any, that must be paid. For further details, see point 23 of this note.
Can the costs of production of accessible format copies be recovered?
Yes the cost can be recovered.
Does this mean that the publisher has to give you a soft copy?
No. Publishers are not required to give a soft copy under the amendment.
What steps are required to be taken by organizations who undertake the activity?
The organization must ensure that the copies of works in such accessible format are made available to persons with disabilities and takes reasonable steps to prevent its entry into ordinary channels of business.
Can works be simplified so that people with psycho social disabilities or intellectual disabilities can enjoy the work?
Yes, this can be done since this will fall within the meaning of “adaption” as given above.
Can subtitles be added to movies and other audio visual work for the benefit of the deaf/hard of hearing?
Yes, this can be done since this will fall within the meaning of “adaption” as given above.
Can audio descriptions be added to movies and other audio visual works for the benefit of the blind/low vision?
Yes, this can be done since this will fall within the meaning of “adaption” as given above.
Can an organization in India import or export accessible format copies from/to organizations and beneficiaries abroad?
The Copyright Amendment Bill, 2012, does not address import and export and this depends on various factors and legal preconditions. In this case, it is advisable to check with your legal advisors before undertaking such an activity.
What is the wording of the section?
Section 52 (1)The following act shall not be an infringement of copyright, namely:
(zb) the adaptation, reproduction, issue of copies or communication to the public of any work in any accessible format, by —
(i) any person to facilitate persons with disability to access to works including sharing with any person with disability of such accessible format for private or personal use, educational purpose or research; or
(ii) any organization working for the benefit of the persons with disabilities in case the normal format prevents the enjoyment of such works by such persons:
Provided that the copies of the works in such accessible format are made available to the persons with disabilities on a nonprofit basis but to recover only the cost of production:
Provided further that the organization shall ensure that the copies of works in such accessible format are used by persons with disabilities and takes reasonable steps to prevent its entry into ordinary channels of business.
Explanation. For the purposes of the sub-clause, “any organization” includes an organization registered under section 12A of the Income Tax Act, 1961 and working for the benefit of persons with disability or recognized under Chapter X of the Persons with Disabilities (Equal Opportunities Protection of Rights and Full Participation) Act, 1995 or receiving grants from the Government for facilitating access to persons with disabilities or an educational institution or library or archives recognized by the Government.
What is the wording of the section relating to for profit activity?
³31B. (1) Any person working for the benefit of persons with disability on a profit basis or for business may apply to the Copyright Board, in such form and manner and accompanied by such fee as may be prescribed, for a compulsory license to publish any work in which copyright subsists for the benefit of such persons, in a case to which clause (zb) of sub-section (1) of section 52 does not apply and the Copyright Board shall dispose of such application as expeditiously as possible and endeavor shall be made to dispose of such application within a period of two months from the date of receipt of the application.
(2) The Copyright Board may, on receipt of an application under sub-section (1), inquire, or direct such inquiry as it considers necessary to establish the credentials of the applicant and satisfy itself that the application has been made in good faith.
(3) If the Copyright Board is satisfied, after giving to the owners of rights in the work a reasonable opportunity of being heard and after holding such inquiry as it may deem necessary, that a compulsory license needs to be issued to make the work available to the disabled, it may direct the Registrar of Copyrights to grant to the applicant such a license to publish the work.
(4) Every compulsory license issued under this section shall specify the means and format of publication, the period during which the compulsory license may be exercised and, in the case of issue of copies, the number of copies that may be issued including the rate or royalty: Provided that where the Copyright Board has issued such a compulsory license it may, on a further application and after giving reasonable opportunity to the owners of rights, extend the period of such compulsory license and allow the issue of more copies as it may deem fit.

Copyright Amendments – Empowering the Print Disabled

The much anticipated Copyright Amendment Bill, 2012 was passed with a few changes in the Rajya Sabha on 17th May 2012 after a very spirited debate and passed by the Lok Sabha on the 22nd May 2012 with unanimous consensus.

The Bill now requires presidential assent to become a law. The Bill discusses various key aspects which have not been addressed in the present copyright regime due to reasons such as changing international standards, technological and scientific advancements. This blog post is limited to the new Section 52(1)(zb) which creates a new copyright exception for the benefit of persons with print disabilities, including persons with visual impairment and dyslexia.

Prior to the inclusive of Section 52(1)(zb) that the owner of copyright in a work had the exclusive right to adapt, make copies, communicate to the public etc. the work. Therefore, any conversion of a book into accessible formats such as Braille, Daisy, audio books, etc., for the benefit of persons with print disabilities could be undertaken only by the owner of copyright or with the permission of the owner of copyright. More often than not, owners of copyright are unwilling or disinterested to either undertake the conversion and sale of such accessible format copies or permit such conversion, for reasons varying from lack of profitability to limited target audience.

The Copyright Amendment Bill, 2012 does away with the necessity to seek the consent of the publishers for converting their books into accessible formats. To this extent, the Bill provides that it would not be an infringement of copyright for any person or any organization working for the benefit of the persons with disabilities and on a non-profit basis to create accessible format copies or distribute them to persons with disabilities who cannot enjoy the work in their normal formats. This provision is very wide and inclusive in its scope and also has some protection built in against unauthorized use by non-beneficiaries of the exception. For instance, the books so provided in accessible formats shall be for private or personal use, education or research only. Moreover, the persons or organizations providing such services have the obligation to ensure that such converted formats do not enter the mainstream business channels. While the new exception permits the recovery of the expenses incurred in converting the books, they do not permit the making of any profit under the exception. However, under a new Section 31 B any person working for the benefit of the persons with disabilities on a profit basis or for business can undertake conversion and distribution after obtaining a license from the Copyright Board in accordance with the procedure laid down in that section.

It is to be noted that the original wording of the amendment as proposed by the Copyright Office in 2006 was extremely limited in that it allowed conversion only into “specialized formats designed for persons with disabilities” and not into "all formats" as is the case now. The problem with "specialized formats" is that many persons with print disabilities, including those with dyslexia, person who lost their eyesight at a later age etc. cannot use specialized formats such as Braille and use mainstream formats such as .pdf or audio. By limiting conversion into “specialized formats” such as Braille, a large number of potential beneficiaries would have been excluded from the amendment. In order the attempt to change the wording of the proposed amendment to reflect technological developments and also benefit a larger number of persons with disabilities, the nationwide Right to Read Campaign was launched by Inclusive Planet, the Centre for Internet and Society, the Daisy Forum of India. As a result of sustained campaigning and high level advocacy during which over 70 Members of Parliament were met, we were invited to present evidence before the Parliamentary Standing Committee which fully endorsed our concerns. The Copyright Office then changed the wording from the 2006 wording to the current wording. It still took about a year and half for the amendments to be passed by both Houses of Parliament.

In conclusion, the Copyright Amendment Bill will enable persons with disabilities to be able to exercise their right to knowledge on an equal basis with others. It also shows that a small group of committed disability activists with the support of a handful of lawyers and the tool of high level advocacy can bring about effective change.

ITU Tutorial on Audiovisual Media Accessibility

The fourth meeting of the ITU-T Focus Group on Audio Visual Media Accessibility (FG AVA) took place at the India International Centre, New Delhi on March 13, 2012. The meeting was held in furtherance to an invitation of the Centre for Internet & Society (CIS), in cooperation with the ITU-APT Foundation of India. A two-day tutorial on Audio-Visual Media Accessibility followed the meeting on March 14 and 15, 2012 at the same venue. A total of 20 people participated in this event.

Sunil Abraham, Executive Director, CIS was the Master of Ceremony on Day 1, March 14, 2012. Mr. Ravi Shanker, Administrator, Universal Service Obligation Fund, Dr. Govind, CEO, National Internet Exchange of India, Ms. Swaran Lata, Director and Head of Department, TDIL Programme, DIT, Mr. R.N. Jha, Deputy Director General (International Relations), Department of Telecommunications and Ms. Archana Gulati, Financial Advisor, National Disaster Management Authority gave the welcome addresses. FG AVA chairman, Mr Peter Olaf Looms (European Broadcasting Union and Denmark) chaired the meeting assisted by the Working Groups coordinators.

The event provided an in-depth insight of topics and measures to improve the accessibility of AV media: Captioning (pre-prepared and live), Audio/Video Description and spoken captions, visual signing and sign language, emergency access services with examples referred from digital broadcast television and mobile telephony media. The participants gained a better understanding of:

How to Get started – that is, the strategies for establishing and expanding new accessibility services (how it can be done, what it costs, what business models exist to ensure the viability of accessibility services);
How standards can help developing countries plan and implement the transition from analogue to digital TV (what issues need to be addressed to optimize the Digital Dividend; making sure that various groups of vulnerable viewers are not disenfranchised by the digital switchover);
Human resource development for improved usability and accessibility (closely tied to work being done by the Audiovisual Media Accessibility Focus Group’s Working Parties).

Regulators and legislators working on measures to improve digital media’s compliance with international accessibility conventions and directives; accessibility service advocates from organizations representing persons with disabilities; media executives from public service and commercial TV channels seeking compliance with media accessibility regulation; consumer electronics manufacturers, wholesalers and retailers examining the business implications of demographic changes and media regulation participated in the meeting.

Peter Olaf Looms, Chairman, ITU-T, FG AVA made a presentation on Introduction to the Tutorials covering topics like what does this tutorial cover, what will I be able to do, focus on action, target groups, the rational of accessible media who needs them, what can be done to improve television accessibility, etc.

Dr. Takebumi Itagaki made a presentation on Producing and delivering access services – the options covering topics like the current situation in EU, chain of power / funding public broadcasting in EU, analogue to digital switchover, activity 9 TV standards and regulation, etc.

Mr. AK Bhatnagar, Engineer-in-Chief, Prasar Bharati (Broadcasting Corporation of India) also participated in this event.

An Analysis of the Comments by World Blind Union and the International Publishers Association

Rahul Cherian provides an analysis of the comments by the World Blind Union and the International Publishers Association after the 23rd session of the Standing Committee of Copyright and Related Rights.

Before the WIPO intersessionals held on March 23 and 24 at Geneva between some member states to discuss the pending issues related to the Treaty for the Visually Impaired, the World Blind Union and the International Publishers Association came out with their comments/versions on the Chair’s text dated December 16, 2011. The Chair's text with comments of Member States is available here. [PDF, 364 Kb]

The World Blind Union document, available here [PDF, 314 Kb], attempts to build consensus in the text based on suggestions given by various Member States to the Chair’s text dated December 16, 2011. The inputs of Member States that would be beneficial to the intended beneficiaries of the Treaty, namely persons with visual impairment, print disabilities, etc. were incorporated into the World Blind Union document while suggestions of Member States that were detrimental to the intended beneficiaries were not added. As can be seen by the WBU document, several changes suggested by many Member States, including the United States, the European Union, the African Group, Pakistan, India, etc were incorporated into the WBU document. As far as possible the WBU document has tried not to add new wording which were not suggested by Member States to the Chair's text. The WBU document is, in my opinion, a genuine attempt at building consensus between Member States on the Treaty for the Visually Impaired.

On the other hand, the document proposed by the International Publishers Association [PDF, 215 Kb] is a different story. Rather than trying and building consensus, the IPA has taken a stand that is so extreme that the only aspect I could find in the entire document was that it was progressive. In the first paragraph of the introduction the IPA finally recognizes that persons with print disabilities must have access to works at the same time as others. Unfortunately it is all downhill from there. Given below are some of the suggested changes of the IPA and my comments on the IPA document from the perspective of its impact on India and other developing countries.

The IPA proposes the deletion of the following paragraph from the Preamble: “Needing to contribute to the implementation of the relevant recommendations of the Development Agenda of the World Intellectual Property Organization,”
From this proposed change, it appears that the IPA is opposed to the Development Agenda of the World Intellectual Property Organization. This change is completely unacceptable and unfortunately the further suggestions of the IPA seemed to reflect the anti-development mentality of the IPA.
The IPA proposes that the exceptions and limitations cover only those works that are release in print format and excludes those works that are “born digital”. This implies that for new books which are going to be released only in digital formats, there should be no exceptions and that the beneficiaries should be able to convert those inaccessible versions into accessible versions. This is also unacceptable since persons with print disabilities must have equal access to all books and not only printed books.
The IPA proposes that only those organizations that have the “primary” objective of assisting persons with print disabilities by providing them with services relating to education, training, adaptive reading, or information access needs shall be entitled to convert or distribute accessible format copies. This would mean those educational institutions and other organizations that make material accessible but not on a primary basis will be excluded. This is totally counterproductive if persons with disabilities are to have really equal access to reading material.
The IPA proposes that authorized entities must maintain compliance policies and procedures regarding access and IT security that follow internationally recognized standards. It records appropriate usage information and provides this to rights holders in a transparent and timely manner.
The compliance with this provision will prove extremely expensive and cumbersome for organizations, particularly those organizations in developing countries who are cash strapped. Moreover, it is unclear what these internationally recognized standards are. This addition is also unacceptable.
The IPA proposes that only organizations that actually create an accessible format copy can export that copy to organizations in other countries. This would mean that every organization that exports books would have to re-create the accessible format copy thereby leading to tremendous replication of effort and wastage of precious resources. This is extremely counterproductive.
The IPA proposes to add the following sentence to the text: Member States may choose other means for increasing the availability of accessible format copies, provided these means afford Beneficiaries with equally effective access to Works.
By adding this one sentence the Treaty, which is intended to create minimum exceptions in each Member State, permits countries to move away from the E&L regime into a licensing regime. The benefits of the whole treaty could be negated with this one sentence.

Apart from these changes mentioned above, there are several other changes proposed by the IPA which are completely against the spirit of the Treaty. It is sad to note that instead of trying to reach a consensus the IPA has proposed some preposterous changes and negative changes to the text. But given the stand that they have taken in this document, possibly as a last ditch attempt to thwart the growing momentum for the Treaty, it is likely that the IPA’s disguise as a sheep has been blown away to reveal the wolf.

Web Accessibility Policy Making: An International Perspective

G3ict and CIS are pleased to announce the publication of a new, improved edition of the Web Accessibility Policy Making: An International Perspective. The report published in cooperation with the Hans Foundation provides an updated synopsis of the many policies that governments have implemented around the world to ensure that the Internet and websites are accessible to persons with disabilities.

The report contains a Foreword by Axel Leblois, Founder and Executive Director of G3ict, an introduction and studies from countries like Australia, Canada, Germany, Ireland, Italy, Japan, South Korea, New Zealand, Philippines, Portugal, Sweden, Thailand, United Kingdom, United States, and the European Union. The report contains contributions from Prashanth Ramadas, Asma Tajuddin, G Aravind, Katie Reisner, Sucharita Narasimhan, Bama Balakrishnan and Nirmita Narasimhan. This third edition of our joint report with CIS “WEB ACCESSIBILITY POLICY MAKING: AN INTERNATIONAL PERSPECTIVE” provides an updated synopsis of the many policies that governments have implemented around the world to ensure that the Internet and web sites are accessible to persons with disabilities. With 153 countries parties to the Convention on the Rights of Persons with Disabilities as of December 2011, an increasing number of governments are now in the midst of developing policies and programs to ensure that web sites and services under their jurisdictions are accessible.

Indeed, the Preamble of the Convention on the Rights of Persons with Disabilities recognizes “the importance of accessibility to the physical, social, economic and cultural environment, to health and education and to information and communication, in enabling persons with disabilities to fully enjoy all human rights and fundamental freedoms”. Its article 9 stipulates that: “To enable persons with disabilities to live independently and participate fully in all aspects of life, States Parties shall take appropriate measures to ensure to persons with disabilities access, on an equal basis with others, to the physical environment, to transportation, to information and communications, including information and communications technologies and systems” (1). It further specifies that “State Parties shall also take appropriate measures to … Promote access for persons with disabilities to new information and communications technologies and systems, including the Internet” (2.g).

There is therefore no doubt that all State Parties have an obligation to act upon those commitments. However, as this report demonstrates it clearly, web accessibility policies and their levels of enforcement vary considerably among countries with some common denominators such as the compliance with the W3C – WAI guidelines on web accessibility.

G3ict and CIS hope that this new, improved edition, which will now be available in print as well as in electronic format, will help accelerate the development of web accessibility policies and programs around the world. Technology for Accessibility in Higher Education

Education for students with disabilities has long been a serious cause of concern in India, as also in other countries around the world. A person with a disability studying in mainstream educational institutions in India experiences many difficulties in navigating through the obstacle course of the Indian educational system, writes Nirmita Narasimhan in this IIMB Journal brought out on the occasion of the conference 'never-the-less - Enabling Access for Persons with Disabilities to Higher Education and Workplace - Role of ICT and Assistive Technologies.

Problems exist in many areas – course content, staff, facilities, resources as well as the educational and examination process. The relative physical inaccessibility of educational institutions, unavailability of accessible content in different languages, lack of trained and sensitive teachers, and the lack of awareness about developments in enabling technologies have hitherto rendered the educational environment itself rather difficult to access. In addition to the long waiting periods in getting the course materials digitized into accessible formats, as well as the assignment of scribes unfamiliar with subject topics for students to write the examinations put students with print disabilities at additional disadvantage – as if there weren’t enough problems already! Thus the educational experience often becomes a nightmare for a student who is disabled. However, compared with the situation from a decade earlier, the education scenario for persons with disabilities has, thanks to the sustained advocacy and interventions of disability organizations, gradually improved and promises to get better in the years to come.

Today, technology has made it possible for persons with disabilities to read and work independently. Some institutions for higher learning around the country, like St Xavier’s College, Mumbai, Delhi University and Loyola College in Chennai have already set up ICT centres which facilitate reading and working students who are print impaired. They offer support through digitization, training, and facilities. Organisations like National Association for the Blind and other Daisy organizations convert study materials for blind students and make them available in formats and media of the students’ choice. Students themselves, through peer to peer networks and mailing lists are able to collaboratively produce and share accessible study materials on a variety of subjects ranging from graduation to competitive exams. Another really big boon is the advent of the mobile phone as a suitable platform for listening to books. Today, two international mobile screen reader software - Nuance Talks and Mobile Speak - are available in the Indian market at competitive prices and this has led to an increase in the incidence of mobile adoption amongst persons with print disabilities, at least in the metropolitan cities.

There are many areas of improvement, which institutions of higher education can adopt for enhancing the education experience for students. For instance, the provision of digitized reading materials, access to computers with assistive devices, choice of examination methods, maintaining accessible web sites, promoting open access and open educational resources will go a long way in furthering education amongst students who have disabilities. Institutions could explore new models of imparting education which are proving successful in other parts of the world. Furthermore, existing sources of information and knowledge, such as information in the public domain and knowledge imparted through distance education should be made accessible to a wider audience.

Mobile technologies and enlightened service packages help persons with disabilities connect to new opportunities

Innovative approaches from mobile hardware and applications developers as well as operators are helping connect the estimated 15% of the global population that lives with some form of disability to the power of information and communication technology.

A new report released jointly by ITU and civil society partner The Global Initiative for Inclusive ICTs (G3ict) on the occasion of the United Nations Conference on States Parties to the Convention on the Rights of Persons with Disabilities, (New York, 12-14 September), reveals a surge of interest in an as-yet untapped market, with new accessibility applications now being launched almost daily, offering unprecedented ways to empower persons with disabilities to communicate, access information and control their environment.

Senior citizens, people living with disabilities and the illiterate are often marginalized from the ‘mobile miracle’ however, because devices are not equipped with the right kind of accessibility features, or because the price of accessible mobile phones and services is out of reach. That’s now changing, with a host of exciting options coming onto the market.

New screen readers can make mobile phones easily usable for the blind, those with low vision and the illiterate. Visual or vibrating alerts, relay services and hearing aid compatibility devices are making mobile phones accessible for the deaf and hard of hearing, while features such as voice recognition and auto text are proving a boon to those with physical disabilities.

Examples of pioneering solutions highlighted in the report include special text-only billing plans for the deaf and hard-of hearing so that subscribers pay only for messaging and data; a new SMS-to-Avatar translation system being developed by the University of Tunis which converts typed text into real-time, online interpretation in sign language with the help of a dictionary of words and signs; and new GPS-based devices and services that help blind and partially sighted people navigate streets using an interface that announces the nearest points of interest and the user’s current location, with links to Braille readers over Bluetooth.

‘Digital accessibility’ is a relatively untapped market segment that offers potentially lucrative commercial opportunities for mobile service providers, manufacturers and smart phone application developers while ensuring the digital inclusion of persons with disabilities. A handful of leading mobile operators from around the world are already successfully addressing the needs of seniors and persons with disabilities, demonstrating the business case for promoting mobile accessibility.

Unfortunately, not all mobile operators and manufacturers are following suit, and affordability remains a major issue, especially for smart phone solutions and for subscribers in developing markets. “ITU encourages all Member States to implement regulatory and policy measures to promote access and ensure the accessibility needs of all people are met,” said Dr Hamadoun I. Touré, ITU Secretary-General. “This is especially timely given the widespread adoption of the Convention on the Rights of Persons with Disabilities which requires ICT accessibility of all its signatories, most of which are also ITU Member States.”

There are already six billion mobile cellular telephone subscriptions globally. By 2013, ITU estimates that there will be more mobile cellular telephone subscriptions than human beings on the planet. But while some people are hyper-connected, others are yet to be reached.

“This report will help guide all stakeholders as they implement business practices and policies to promote accessible mobile phones and services at home. We want to see affordable, accessible mobile phones and services used to ‘m-power’ persons with disabilities and other users around the globe,” said Brahima Sanou, Director of ITU’s Telecommunication Development Bureau, which led the preparation of the report.

The report also includes a checklist for policy makers which includes steps such as developing a roadmap with operators, supported by organizations of persons with disabilities, to identify and address mobile phone accessibility gaps; facilitating or holding capacity building programmes with mobile operators on disability awareness and ways to reach out and serve persons with disabilities; and identifying areas for which Universal Service/Access Funds may intervene to equalize access for users with disabilities.

Inputs for NTP 2011

The Centre for Internet and Society wishes to commend the DoT on the draft of the New Telecom Policy and offers its suggestions to improve the draft with specific changes.

The new draft contains several noteworthy initiatives and goals such as Delicensing additional frequency bands for public use, Network sharing, spectrum sharing, pooling and trading , recognizing that revenue generation is not the primary reason for licensing spectrum and that auctions often result in inordinate delays, identifying the mobile phone as a primary instrument for development and inclusion, Convergence of broadcast, telecom and cable infrastructure, promotion of cloud based technologies, Nationwide license, free roaming and one number, promotion of fixed mobile convergence to free up spectrum, promoting consumer interests by increasing choice and quality and addressing concerns of privacy, data security, etc and placing emphasis on research and development, awareness raising and capacity building.

We offer below suggestions to improve the draft with specific changes marked in bold print.

Spectrum Management

We endorse the approach to permit spectrum ‘pooling, sharing and later, trading for optimal and efficient utilization of spectrum’ as described in 4.1. In this regard, we would like to suggest that the Government may consider mandatory spectrum sharing as is being done in USA with respect to white spaces and digital dividends as a better approach over licensing spectrum to a single operator and allowing voluntary sharing since it could result in more dynamic and efficient use of spectrum with access being authorized as per requirement from a central data base driven system.

De-licensing additional spectrum

We agree with the approach to prioritise identification of additional frequency bands for license exempt use for the operation of low power devices, as stated in section 4.6 of the National Telecom Policy 2011. We also support the promotion of the use of technology such as Software Defined Radios (SDRs) and Cognitive Radios (CRs) in white spaces, as mention in section 4.9 of the NTP. These developments in the Indian Telecom policy show promise for the deployment and spread of affordable technologies operating in de-licensed frequencies, which will contribute to the bridging of the digital divide present in India. We offer certain recommendations in this regard:

WPC should have more unlicensed bands available for internet and multimedia to fuelinnovation and efficient spectrum utilization. Unlicensed bands need to be allocated inbigger chunks in various slots.
Frequencies in the 5.15GHz-5.35GHz bands, as well as 5.725-5.825GHz bands are delicensedfor indoor use only. These bands should be de-licensed for outdoor use as well in order to facilitate the creation of wider wireless communication networks and the use ofinnovative technologies.
Bands for the use of DECT technologies have already been de-licensed in Europe and theUnited states. The1800-1890MHz band, which is earmarked for the operations of DECT based devices in India, should be de-licensed for the use of low power cordless communication technologies in line with international practices.
The 433-434 Mhz band should be unlicensed for data telemetry as it is done in many other countries.
Unutilized slots in between TV channels (white spaces) should be made available for unlicensed/Class license usage.

Licensing, Convergence and Value Added Services

With respect to allowing the sharing of network mentioned in 3.6, we would like to propose a similar model as suggested for spectrum sharing, which is more along the lines of Singapore or Australia’s NGN, with the network(s) being run by public private partnership (PPP) consortiums, but led by a private operator.

Accessibility for Persons with Disabilities

Persons with disabilities should be mentioned specifically within the policy and steps should be taken to enable access to telecommunications facilities for them. These would include steps like formulating a Code of good practice for manufacturers and service providers, identifying accessibility standards in different areas, investing in R&D in accessible technologies, setting up a nationwide emergency and relay service, mandating broadcast accessibility to ensure that set-top boxes are accessible and that at least 50 per cent of all TV programmes are captioned, carrying out regular surveys to gather statistics on use of telecommunications services by persons with disabilities, etc.

To facilitate an institutional framework to establish nationwide Unified Emergency Response Mechanism by providing nationwide single access number for emergency services and to ensure that the same are also accessible to persons with disabilities.

Broadband and universal service

Given that the uptake of broadband has been rather slow in comparison with mobile phones, a useful step to scaling up broadband penetration and providing ubiquitous broadband services could be to identify broadband as an ‘essential service’ under the Essential Services Maintenance Act, 1981. This could be recognized as an objective in the policy and will help to ensure provision of affordable and reliable provision of broadband.

3. Recognize broadband as an ‘essential service’ under the Essential Services Maintenance Act and provide affordable and reliable broadband on demand by the year 2015 and to achieve 175 million broadband connections by the year 2017 and 600 million by the year 2020 at minimum 2 Mbps download speed as well as making available higher speeds of at least 100 Mbps on demand.

Multi stakeholder approach

All activities such as setting up a council under 2.3, advisory groups in 2.4, 2.10, etc should necessarily include participation from civil society to ensure a balanced representation of the public interest perspective.

Implementation and monitoring

While the policy identifies several laudable objectives and initiatives, there is little indication as to time lines and mechanisms for enforcement with measurable indicators. It would be useful to clearly specify these to ensure smooth and effective implementation of the policy.

Protection of consumer interests

Any initiatives taken in this regard, such as formulation of a Code etc, must necessarily involve consumers. The policy also needs to recognize that special effort is required to ensure that information is made available to consumers and more steps are taken towards consumer outreach. This also includes making web sites more user friendly and accessible to consumers. At present even the web sites of the DoT, USOF, and TRAI etc are extremely inaccessible.

Regulation

While it is important to create a conducive regulatory framework for India’s development agenda, we would nevertheless like to caution against over regulation, especially in cases where market forces themselves take care of the situation. It is best to have a light handed approach based on need. It is also suggested that a review of the TRAI act as proposed under 12.1 could result in vesting the sector regulator with greater autonomy and independence.

Universal Service for Persons with Disabilities: A Global Survey of Policy Interventions and Good Practices

The Global Initiative for Inclusive Information and Communication Technologies and the Centre for Internet and Societies in cooperation with the Hans Foundation have published the Universal Service for Persons with Disabilities: A Global Survey of Policy Interventions and Good Practices. The book consists of a Foreword by Axel Leblois, an Introduction and four chapters. Deepti Bharthur, Axel Leblois and Nirmita Narasimhan have contributed to the chapters.

Foreword

Universal Service definitions have been developed by 125 countries and are the foundation for policies and programs ensuring that telecommunications are available to all categories of population. Universal service funds are the main vehicle used to fund those programs, primarily addressing imbalances such as lack of availability of services in rural areas. While geographic coverage has vastly improved over the past decade with wireless infrastructure, the scope of Universal Service has expanded to include other categories of underserved populations.

Among those, persons with disabilities and senior citizens, who represent 15% of the world population[1] are an increasing concern for legislators and regulators. Basic accessibility features for public telephone booths, fixed line or wireless handsets, customer services in alternate formats such as Braille, or assistive services such as relay services for hard of hearing or deaf persons are in fact not implemented in a majority countries.[2]

To address those issues, several countries have expanded the scope of their national definition of Universal Service Obligation to include persons with disabilities allowing programs promoting the accessibility of information and communication technologies to be covered by Universal Service Funds.

The adoption of the Convention on the Rights of Persons with Disabilities by over 150 countries since March 31st, 2007 will likely accelerate this trend: States Parties have an obligation to ensure that Information and Communication Technologies and Services are made accessible to persons with disabilities. This can be done by aligning the definition of Universal Service Obligation with article 9 of the Convention and expanding the charter of Universal Service Funds to cover programs promoting accessibility for persons with disabilities. This report is the first attempt to document how Universal Service definitions and related policies and programs have been implemented by various countries to ensure that persons with disabilities have full access, on an equal basis with others,to telecommunication services.G3ict would like to express its sincere appreciation to the Center for Internet and Society for its support of this project, to Nirmita Narasimhan for researching and editing this report;to the International Telecommunication Union for providing references and helping identify countries to be surveyed, and to the Hans Foundation for funding the print version of the report. Introduction

The advent of the Internet and accessible information and communication technologies (ICT) has opened up exciting possibilities and opportunities for persons with disabilities.The United Nations Convention on the Rights of Persons with Disabilities (the ‘UNCRPD’)3 has explicitly recognized the right of persons with disabilities to seek, receive and impart information on an equal basis with others4 and has placed specific obligations on member states to ensure that all ICT based facilities and services (which include telecommunications services) must be made available and accessible to all. To this end, member states are required to formulate and implement appropriate laws and policies at national, regional and global levels. In an age where almost all spheres of life are inextricably woven with and dependent on ICT, Article 9 of the UNCRPD on Accessibility is possibly one of the most powerful and critical tools in the hands of policy makers to ensure that persons with disabilities are assured of basic human rights such as education, health, employment and access to information and participation.While the lack of awareness amongst governments is undeniably a serious impediment to implementing accessible ICT in any country, an equally serious and perhaps more realistic problem is the lack of resources which is plaguing many countries, especially developing nations. The fact that governments are already struggling to ensure basic human rights for all citizens by judiciously dividing their limited resources for the whole gamut of needs makes it difficult for them to outlay separate and substantial budgets which may be required for implementing ICT accessibility. In such a scenario it becomes very important to look around and identify sources of funding, new or existing, which can be leveraged by governments to fulfill their obligation towards making all ICT based applications and services accessible and promoting assistive technologies for persons with disabilities.

This report aims to highlight the extreme suitability of leveraging the Universal Service Fund (USF) to implement accessibility and assistive technologies in telecommunications. It examines the evolution of the concept of USF, its minimum mandate and scope, funding sources, as well as project implementation mechanisms and showcases countries which are using the USF to fund accessibility projects through policies and programmes.
