Welcome to the newsletter of September 2012 from the Centre for Internet & Society (CIS). The present issue features a second analysis by Snehashish Ghosh on the latest list of sites blocked by the Indian government from August 18, 2012 to August 21, 2012, a research on the issues of internet governance by Smarika Kumar, publication of a report on Accessibility of Government websites in India by Nirmita Narasimhan, Mukesh Sharma and Dinesh Kaushal, the Access to Knowledge programme plan and updates from the Wikipedia community in India on Indic languages, updates from the Habits of Living workshop organised in Bengaluru, the events connected to the visits of international DNA experts, Helen Wallace and Jeremy Gruber in India, and introduce you to our Access to Knowledge team members.

Office in Delhi

New Team Members

Nitika Tandon: Nitika Tandon is a Program Officer with CIS. She has an MBA from Rotterdam School of Management, Netherlands and is a recipient of Dean's Fund Scholarship Program, Erasmus University.
Shiju Alex: Shiju Alex is a Consultant. His background is technical writing and he is interested in Indic language computing and community building for Indic language Wiki projects. Presently he works out of CIS office in Bengaluru.
Subhashish Panigrahi: Subhashish Panigrahi is a Programme Officer to CIS's Access to Knowledge programme and works out of CIS's Delhi office. His background is Business Development in Corporate Communications. He works on designing and implementing programs to provide on-wiki and off-wiki support for new editors.
Noopur Raval: Noopur Raval is working as Consultant - Communications for the Access to Knowledge team at CIS. Having previously worked in the media, she is currently pursuing her M.Phil in Cinema Studies from JNU, New Delhi.

Featured Research

Accessibility of Government Websites in India: A Report (by Nirmita Narasimhan, Mukesh Sharma and Dinesh Kaushal, September 26, 2012): This is a report on the accessibility of government websites in India. It was published in cooperation with the Hans Foundation. The report consists of an executive summary, introduction, methodology, findings and recommendations and interpretation and recommendations. Examples of errors are given as appendices.

Project

Creating a National Resource Kit for Persons with Disabilities: An Introduction (by Anandhi Viswanathan, September 28, 2012): CIS is engaged in a two-and-a-half year project starting from August 2012 to create a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India. This project is supported by the Hans Foundation. The Resource Kit will be brought out in both English and Hindi and disseminated to policy makers from panchayat to ministry levels throughout India. WIPO Treaty for the Visually Impaired — Moving from a Treaty on Paper to a Treaty that is Workable on the Ground (by Rahul Cherian, September 28, 2012): After many years of hard lobbying by the World Blind Union, it appears that the WIPO Treaty on limitations and exceptions for visually impaired persons/persons with print disabilities (TVI) could become a reality next year.
Breaking News on Electronic Accessibility (by Rahul Cherian, September 28, 2012): The Parliamentary Standing Committee constituted to study the Electronic Delivery of Services Bill has in its report explicitly recognized the concept of electronic accessibility and reasonable accommodation. This is the first time in the country that these two concepts have been reflected at the level of a Parliamentary Standing Committee in relation to a non-disability specific law.

Submission

Feedback to Draft Copyright Rules, 2012 (by Pranesh Prakash, September 29, 2012): submitted its written comments on the Draft Copyright Rules, 2012 to Mr. G.R. Raghavender, Registrar of Copyrights & Director (BP&CR), Ministry of Human Resource Development. Pranesh does a detailed analysis and provides recommendations on Rules 8,9,10, 29(6), 34(2), 37, 71(3), 72, 74(1), 74(6), 75, and 79 (3) and (4).

Projects

Access To Knowledge/Programme Plan: Pursuant to the announcement made on July 30, 2012 of a 22 months ‘grant’ (beginning from September 1, 2012 to July 31, 2014) of upto INR 26,000,000 and as reflected in the FAQ accompanying the announcement, the Wikimedia Foundation’s India Program will become a project of the Access to Knowledge (A2K) program of CIS. The prime objective is to support the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects and supporting India-focused efforts to improve the quality of India-relevant content on Indic languages and English Wikimedia projects.
Pervasive Technologies: Access to Knowledge in the Marketplace (by Jadine Lannon, September 25, 2012): Jadine Lannon gives an introduction to the new A2K research initiative. Pervasive technologies have flooded the Indian market and are changing the ways in which the average Indian accesses knowledge but very little is understood about these technologies, particularly when it comes to their legality. CIS hopes to do a research that aims to understand how pervasive technologies interact with Intellectual Property laws and what can be done to protect these technologies from being labelled “illegal” and eradicated from the Asian market.

An Introduction to the Issues in Internet Governance (by Smarika Kumar, September 23, 2012): Smarika provides a detailed analysis to the issues that we face in Internet Governance today. She tries to canvass the controversies in the areas of internet governance that broadly focus around the institutional structures to govern the internet, discusses the evolution of these models against the historical background of internet governance and then proceeds to present the criticisms of each of these models with an emphasis on the interests of the regular internet user.

Events Organised

DNA Profiling Bill
International DNA experts Helen Wallace from GeneWatch UK, and Jeremy Gruber from the Council for Responsible Genetics from the United States visited Bengaluru and Delhi and shared their experience in DNA sampling and gave feedback to the DNA Profiling Bill. Meetings were conducted with lawyers and the plaintiff in the Pascal Mazurier's rape case and with VR Sudarshan and Hormis Tharakan. There was a coverage of the event in Kannada media. Public lectures were organised in Bengaluru and Delhi:

UK DNA Database and the European Court of Human Rights: Lessons that India can Learn from Its Mistakes (organised by CIS and Alternative Law Forum, September 24, 2012): Helen Wallace from GeneWatch, UK and Jeremy Gruber from the Council for Responsible Genetics in the United States gave a public lecture.
The DNA Profiling Bill: Developing Best Practices (India International Centre, New Delhi, September 27, 2012): International experts Helen Wallace from GeneWatch UK, and Jeremy Gruber from the Council for Responsible Genetics from the United States gave a public lecture. Indic Language Wikipedias – Statistical Report (January – June 2012) (by Shiju Alex, September 25, 2012): Shiju Alex provides a compilation of the statistical update of the Indic language Wikipedias from January to June 2012. He provides perspectives on the health of various Indic language communities as well as the state of various Indic language Wikipedias during the period.

Workshop Reports
Although most of the following workshops were conducted prior to the grant period, the report for all of these was written in the month of September, and hence, we are featuring these.

The First Punjabi Wikipedia Workshop (by Shiju Alex and Subhashish Panigrahi, September 27, 2012): This post is about the first Punjabi Wikipedia workshop held in Ludhiana, Punjab on July 28, 2012. Surinder Wadhawan, a Mumbai based Wikipedian played an important role in designing this workshop and introducing Punjabi Wikipedia to the Punjabi speakers. Long-term Punjabi wikipedian G.S.Guglani also joined this workshop. The event was covered in the Tribune, Hindustan Times, Punjab Infoline, and YesPunjab.com.
Punjabi Wikipedia Workshop at Punjabi University, Patiala (by Shiju Alex and Subhashish Panigrahi, September 28, 2012): A Wikipedia workshop was organized at the Punjabi University's Punjabi Department on August 16, 2012. Veteran Punjabi wikipedian G.S. Guglani came forward to spread the message of Punjabi Wikipedia among Punjabi speakers.
Punjabi Wikipedia Workshop at Amritsar (by Shiju Alex and Subhashish Panigrahi, September 30, 2012): The workshop was held at the Spring Dale Senior School, Amritsar on August 17, 2012. Nearly 50 participants including students and teachers from eight different schools apart from the students and teachers of Spring Dale School attended the workshop. One of the active and long-time Punjabi Wikipedian Guglani Gurdip Singh led the workshop with the active support from Shiju and Subhasish.
Wikipedia Workshop in British Library, Chandigarh (by Subhashish Panigrahi, September 27, 2012): A Wikipedia workshop was organized in Chandigarh by the British Library over two days on August 24 and 25, 2012. Bipin Kumar, Head of British Library and Christina, Deputy Manager had pivotal roles in designing this workshop with support from Piyush, a wikipedian. The session on Day 1 was conducted by Subhashish Panigrahi and the session on Day 2 was conducted by Subhashish and Piyush.
Kannada Wiki Workshop at Tumkur University (Tumkur, Karnataka, September 15, 2012): This was the first Kannada Wikipedia workshop at Tumkur. Prof. Ashwin Kumar from the Department of English, Tumkur University and Kannada wikipedians, Om Shiva Prakash, Hareesh, Tejus and Pavithra played vital roles in organising this workshop. Shiju Alex participated in this workshop. About 30 participants including students and teachers participated in this workshop.

Wikipedia comes to Hyderabad! (by Noopur Raval, September 30, 2012): A series of Wikipedia meetings were organized in Hyderabad on September 29 and 30, 2012. These workshops were a part of the larger effort to help Wikipedia contributors in the same city to meet each other and strengthen the local community. There was coverage about this event in the Hindu on September 28, 2012.

Event Organised

Thinking with Data@CIS (CIS, Bengaluru, September 16 – 18, 2012): The course offered at the National Institute of Advanced Studies was screened in CIS office.

HasGeek HasGeek creates discussion spaces for geeks and has organised conferences like the Fifth Elephant, Droidcon India 2011, Android Camp, etc. HasGeek is supported by CIS and works out from CIS office in Bengaluru. The following event was organised by HasGeek in the month of September: Cartonama Conference (TERI Complex, Bengaluru, September 22, 2012). The event was organised by HasGeek with support from CIS.

Digital Natives

Digital Natives with a Cause? examines the changing landscape of social change and political participation in light of the role that young people play through digital and Internet technologies, in emerging information societies. Consolidating knowledge from Asia, Africa and Latin America, it builds a global network of knowledge partners who critically engage with discourse on youth, technology and social change, and look at alternative practices and ideas in the Global South:

Newspaper Column

One. Zero. (Nishant Shah, Indian Express, September 16, 2012): “The digital world is the world of twos. All our complex interactions, emotional negotiations, business transactions, social communication and political subscriptions online can be reduced to a string of 1s and 0s, as machines create the networks for the human beings to speak.”

Pathways to Higher Education

The Pathways Project to Higher Education is a collaboration between the Higher Education Innovation and Research Applications at the Centre for the Study of Culture and Society and CIS. The project is supported by the Ford Foundation and works with disadvantaged students in nine undergraduate colleges in Maharashtra, Karnataka and Kerala, to explore relationships between Technologies, Higher Education and the new forms of social justice in India. Training workshops were organised in the month of September at Xaviers in Mumbai on September 6, 2012 and in Newman College, Thodupuzha from September 17 to 20, 2012. Each workshop had 25-30 undergraduate students from socio-economically disadvantaged backgrounds. They were trained to use digital technologies in order to think through problems of social justice.

Researchers at Work

From 2012 to 2015, the RAW series will build research clusters in the field of Digital Humanities. The Habits of Living: Global Networks, Local Affects is a global collaborative project to renew the conceptual power of networks. It concentrates on changing the habits of living. The Department of Modern Culture and Media at Brown University is an important locus.

While the potential for growth and returns exist for telecommunications in India, a range of issues need to be addressed. One aspect is more extensive rural coverage and the other is a countrywide access to broadband which is low. Both require effective and efficient use of networks and resources, including spectrum:

Building Knowledge and Capacity around Telecommunication Policy in India

Ford Foundation has given a grant of USD 2,00,000 to CIS to build expertise in the area of telecommunications in India. The knowledge repository deals with these modules: Introduction to Telecommunications, Telecommunications Infrastructure and Technologies, Government of India Regulatory Framework for Telecom, Telecommunication and the Market, Universal Access and Accessibility, The International Telecommunications Union and other international bodies, Broadcasting, Emerging Topics and Way Forward. Dr. Surendra Pal, Satya N Gupta, Paranjoy Guha Thakurta, Payal Malik, Dr. Rakesh Mehrotra and Dr. Nadeem Akhtar are the expert reviewers.

Cable Television (by Srividya Vaidyanathan, September 18, 2012): This unit brings you the history and evolution of cable television in India, talks about other cable based services, cable television digitization rule and the end consumer in India.
Private FMs (Commercial, Campus and Community Radios) (by Srividya Vaidyanathan, September 24, 2012): This unit introduces us to AM and FM, tells us the role of private FMs including what is a community radio and what is a campus radio.
Types of Radio Broadcasting in India (by Srividya Vaidyanathan, September 28, 2012): This unit tells us what is radio broadcasting, takes us through the history of radio broadcasting in India, explains what is AM and FM in the Indian context.

About CIS

CIS was registered as a society in Bangalore in 2008. As an independent, non-profit research organisation, it runs different policy research programmes such as Accessibility, Access to Knowledge, Openness, Internet Governance, and Telecom. Over the last four years our policy research programmes have resulted in outputs such as the e-Accessibility Policy Handbook for Persons with Disabilities with ITU and G3ict, and Digital Alternatives with a Cause?, Thinkathon Position Papers and the Digital Natives with a Cause? Report with Hivos. Creating a National Resource Kit for Persons with Disabilities: An Introduction

The Centre for Internet & Society is engaged in a two-and-a-half year project starting from August 2012 to create a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India. This project is supported by the Hans Foundation. The Resource Kit will be brought out in both English and Hindi and disseminated to policy makers from panchayat to ministry levels throughout India.

CIS hopes that this resource kit will immensely benefit the disabled community in India by providing them with a ready reference on the facilities given by the government.

More often than not a facility isn’t enjoyed by the public as no one knows about its existence. It becomes important then to make it accessible and give it exposure. The National Resource Kit of Laws, Policies and Programmes for Persons with Disabilities will fill this gap of lack of comprehensive information in this field.

The rights of persons with disabilities have for long been a topic of international discussion in various forums. It is essential to not just promote, protect and ensure the full and equal enjoyment of all human rights of persons with disabilities but also promote respect for their dignity. Making legal provisions for the rights of persons with disabilities is not only a mechanism that ensures that they have access to human rights but also a tool that enables them to contribute to the growth of their nation by providing them with the facilities that aid them in overcoming their challenges and enable them to lead fruitful lives.

To provide persons with disabilities in India equal opportunity for liberty, equality and dignity on par with all citizens, India has enacted three disability laws:

Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.
National Trust for Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disability Act, 1999.
Rehabilitation Council of India Act, 1992.

India is now in the process of drafting a new law on the rights of persons with disabilities that aims to fill the gaps in the earlier laws through a deeper understanding of the real issues faced by them and providing solutions and opportunities on par with international standards.

Despite the existing legal provisions, the populace that continues to struggle with consuming issues like overpopulation, poverty, unemployment and lack of resources, often tend to neglect issues which concern persons with disabilities. An overwhelming public opinion that considers persons with disabilities to be incapable of making meaningful contribution to the society due to their disability has led to the exclusion of persons with disabilities from mainstream society.

One of the major reasons for this exclusion and neglect is the lack of awareness about the various facilities being extended by the government to persons with disabilities targeted at enabling them to overcome their challenges. Generating awareness by providing them with information that will help them gain access to education, vocational skills, employment training and opportunities and healthcare is a vital step in ensuring that the legal rights of persons with disabilities are enabled for them.

WIPO Treaty for the Visually Impaired — Moving from a Treaty on Paper to a Treaty that is Workable on the Ground

After many years of hard lobbying by the World Blind Union, it appears that the WIPO Treaty on limitations and exceptions for visually impaired persons/persons with print disabilities (TVI) could become a reality next year. However, due to pressure from the European Union and the United States, and their insistence on several untenable provisions, there is a real risk that the TVI could become unworkable on the ground.

The following is a list of concerns that must suitably be addressed if the TVI is to make a realistic dent in the “book famine” in which only a few per cent of books are available in accessible formats that persons with print disabilities can read.

Definition of authorised entity to be widened.
The current definition of authorized entity prescribes that only authorized entities that address the needs of beneficiary persons as one of their primary (in brackets) activities or institutional obligations can undertake conversion and distribution of books in accessible formats. This requirement is unacceptable since it will exclude many legitimate organisations and institutions that undertake these activities but who do not address the needs of beneficiary persons as a "primary" activity or institutional obligation. Some examples of such organisations/institutions are mainstream education institutions and mainstream libraries. Delhi University which has a large number of blind students will be excluded and this is unacceptable.
Authorised entities must be required to follow simple rules and procedures when converting and distributing works in accessible formats.
As is proposed now, authorized entities could be required to follow complex rules and procedures with respect to the permitted activities. In this connection it is critical to note that:
- Smaller organisations will not be in a position to keep organised records. Therefore smaller organisations that serve rural or small populations must not be subject to a requirement to keep records where they do not distribute accessible formats in electronic form.
- There must be no requirements for organisations to apply Technology Protection Measures to accessible formats in electronic form.
- While organisations can inform beneficiary persons to whom they supply accessible formats that there must be no subsequent distribution to non-beneficiary persons, an organisation should have no obligation to oversee the use by the beneficiary persons they supply accessible formats to, or any responsibility for misuse by beneficiary persons they supply accessible formats to.
- There must be no requirement to share the records that organisations are required to keep with any person or entity other than in the eventuality of copyright infringement proceedings.
The rules and procedures must therefore be simplified to reflect the above.
The exception must automatically kick in if the relevant accessible formats are not available in the market on the same day as the mainstream format.
At present there is no clarity on when the exception kicks in and the existing wording can be interpreted such that the exception may apply only after significant time has passed after the books are available in the market in the mainstream format. If a work is made available in the market in a mainstream format it is essential that beneficiary persons can enjoy the work in the relevant accessible format at the same time. Failure to do so is discriminatory towards beneficiary persons. In this connection, the TVI must expressly clarify that if the accessible format copy is not available on the same day as the mainstream format, the exception automatically applies and authorised entities and beneficiary persons can create accessible format copies on the same day that the mainstream format is commercial available.
This will also be an incentive for rights holders to take steps to ensure that accessible format copies are made commercially available on the same day as mainstream formats.
“Making available” to be possible through wire and wireless means.
One of the proposed changes to the TVI is the clarification that “making available” accessible format copies to the public should be as per Article 8 of the WIPO Copyright Treaty thereby expressly providing for communication to the public, by wire or wireless means, including the making available to the public in such a way that members of the public may access works from a place and at a time individually chosen by them. Given that technology is making it increasingly possible for beneficiary persons to access accessible format copies over wire and wireless means, this is clarification is very critical.
The Authorised Entity in the exporting country must not have any obligation to verify any form of legal eligibility in the importing country.
As per the current wording of the TVI an authorized entity in one Member State:
- Must, when exporting to beneficiary person in another Member State, verify whether that other Member State would permit that beneficiary person to make or import that accessible copy; and
- Can only export to an entity or organization in another Member State that the originating authorizing entity has identified as another authorized entity.
It is obvious that authorised entities in one country cannot verify the above with any degree of certainty and therefore it is impossible for authorised entities to comply with this requirement. Moreover, as in the case of all copyright exceptions and limitations, rights holders have the right to take copyright infringement action against any person or entity that operates outside, or exceeds, the exception. This requirement relating to the verification legal legibility must therefore be deleted.
Member states having the flexibility to decide whether to link exceptions to commercial availability.
At present, the draft TVI provides Member States the flexibility to decide whether to confine permitted activities to instances where there is no commercial availability of accessible format copies. This flexibility is critical for Member States since the economic and distribution ground realities in each Member State vary widely and only a Member State can decide this issue conclusively for its own circumstances. Any attempt to change this position in the TVI must be opposed.
In short, barring the above issues, the Treaty appears to heading in the right direction. The upcoming intersessionals in Geneva (17-19th October 2012) to discuss the text of the Treaty will be crucial to decide the fate of the Treaty. Watch this space.

Breaking News on Electronic Accessibility

The Parliamentary Standing Committee constituted to study the Electronic Delivery of Services Bill has in its report explicitly recognized the concept of electronic accessibility and reasonable accommodation. This is the first time in the country that these two concepts have been reflected at the level of a Parliamentary Standing Committee in relation to a non-disability specific law.

This Bill, which deals with the electronic delivery of public services, had several drawbacks when it came to access of public services by persons with disabilities. Inclusive Planet Centre for Disability Law and Policy (www.inclusiveplanet.org.in) had submitted a note with inputs from 30 organisations, to submit to the Parliamentary Standing Committee on the Electronic Delivery of Services Bill. The submissions to the Standing Committee included the concerns of persons with disabilities and the possible solutions to address the gaps in the Bill. The Report of the Committee has now been made public. The Standing Committee has accepted the points made in the submissions.

The three major changes recommended by the Committee based on the submissions are the given below. The relevant extracts of the Committee’s report have been compiled by Vaishnavi Jayakumar and are available here (http://goo.gl/P3CKX).

a. Recognition of Electronic Accessibility

In response the questions raised by the Committee based on the input that was submitted, it is now proposed to amend the definition of “assisted access” from “assistance to access electronic services” to “assistance to access electronic services by the users including users with special needs” This is the first time that electronic access for persons with disabilities could be recognized by a non-disability specific legislation in India.

b. Recognition of the Necessity of Providing Various Forms of Assistance

The Committee emphasized that the specific needs of the differently-abled persons like providing hard copy documents/forms in Braille and large print or for using thumb impressions instead of signatures while submitting the form or receiving the services/provision for providing intermediaries/professional sign language, interpreters, locations for offices for availing services for the purpose of EDS at the ground floor, etc., should specifically be taken care of while formulating rules.

c. No Removal of Commissioners on the Ground of Disability Without Providing Reasonable Accommodation

The Committee has concluded that in light of India’s obligations under the UNCRPD, though the clauses relating to removal of Commissioners were on par with those in other Statutes, appropriate rules/amendments to the Bill could be moved to mandate reasonable accommodation. This again is potentially the first time that a non-disability specific legislation will include the prerequisite for reasonable accommodation to be provided to a person holding a statutory post who has a disability/becomes disabled during the course of his tenure.

News reports indicate that this Bill will be introduced in the winter session of Parliament. This Bill, if passed, will be a welcome precedent for the disability sector to replicate in other legislations.

Accessibility of Government Websites in India: A Report

The Centre for Internet & Society is pleased to announce the publication of a report on the accessibility of government websites in India. The report is published in cooperation with the Hans Foundation. Nirmita Narasimhan, Mukesh Sharma and Dinesh Kaushal are the authors.

Executive Summary

Website inaccessibility is the largest and most common barrier to implementing effective e-governance. In a country like India, where a very large percentage of the population is disabled, elderly, illiterate, rural, having limited bandwidth, speaks only a vernacular language or uses alternative platforms like mobile phones, having accessible websites becomes all the more important to ensure that government information and services which are available online are accessible and usable by these groups.

This report summarises the key findings of a test conducted to measure the accessibility of 7800 websites of the Government of India and its affiliated agencies against the Web Content Accessibility Guidelines (WCAG) 2.0, which is the universally accepted standard for web accessibility. It uses a combination of automated and manual testing to derive key findings. While the automated tool identified errors such as images without textual descriptions and HTML and CSS errors, manual testing was used wherever human decision was required, for instance, to judge whether a description of a link or image was indeed accurate, or to check for accessibility of forms.

'Sops can boost jobs for disabled persons'

A recent report commissioned by the government and the United Nations Development Programme (UNDP) has called for greater incentives to the private sector to boost employment for persons with disabilities (PWDs). Incentives such as grants can be used by the employer to make the workplace more accessible and for providing assistive technologies such as voice software or training.

The findings and suggestions of the report, 'Livelihood opportunities for PWDs', are expected to be included in the 12th Five Year Plan (2012-17), which aims to be more inclusive. The government sector has a mandatory quota of 3% for PWDs. For the private sector, the PWD Act, 1995, provides for incentives if at least 5% of the workforce comprises PWDs. Here, the government makes payment of the employer's contributions to the Employees Provident Fund and Employees State Insurance for the first three years as an incentive for PWD employees earning up to Rs 25,000 per month.

Some countries have a mandatory PWD job quota for the private sector with penal provisions - Germany (5%), Austria (4%), Poland (6%), Italy (a sliding scale of up to 7%), Spain (2%) and Japan (1.6%). Others like the USA rely on lucrative tax credit incentive schemes. Some, such as Japan use a carrot-and-stick approach and grants are also available to the private sector.

However, experts do not favour a quota regime because of perceived practical difficulties and its failure in the government sector. "There may be practical difficulties for PWDs to execute certain tasks, which would then lead employers to reserve certain types of jobs only for PWDs, leading creation of the kind of stereotypes which we are fighting against," said Nirmita Naraimhan, advocate and program manager, Centre for Internet & Society.

"Only a handful of companies employ PWDs. To boost private sector participation, the PWD employment incentive target (currently 5% of the workforce) must be realistic. Second, lucrative incentives could be a solution," said Javed Abidi, director, NCPEDP (National Centre for Promotion of Employment for Disabled People).

At this juncture, it is largely corporate philosophy that results in PWD hiring, especially in the hospitality and IT/ITeS sector. Cafe Coffee Day (CCD) has around 150 'Silent Brewmasters'. Other staff members are trained in the basics of sign language for optimal team functioning. "CCD's Silent Brewmasters specialize in brewing because of their heightened sense of smell and vision, thereby ensuring the most visually appealing presentation of our coffees. They are each cafe's best quality controllers," said K Ramakrishnan, president (Marketing), CCD.

"We have 110 PWDs in our team (5% of the total work force across 18 hotels) who are hearing and speech impaired. Initially, they functioned in back office operations, but some innovation such as numbered menu cards helps them interact with customers and results in an overall good factor," said Patu Keswani, chairman and MD, The Lemon Tree Hotel Company.

Nasscom Foundation helps create a proper ecosystem. "Not only are PWDs placed in the IT-ITES sector, but the companies are helped in undertaking accessibility audits, motivated to generate accessible tools and help others get access to such tools," explained Rita Soni, CEO Nasscom Foundation.

E-Vindhya, where 95% of the workforce comprises PWDs and the rest are hired based on their sensitivity towards their PWD colleagues, is perhaps an exception. But other companies are also adopting an inclusive approach. At MindTree and Mphasis, at least 1% of the workforce comprises PWDs. Infosys BPO, Aegis, Wipro, and IBM are some other companies that adopt an integrated approach in dealing with PWD employees.

Auctioning and Allocation of Spectrum (by Snehashish Ghosh): Auction of spectrums was introduced in the telecommunication market after the failure of the administrative process of allocating spectrum. Auctions use a price mechanism to allocate spectrum. Auction of spectrum can be used to increase efficiency and earn maximum revenue.
The Telecom Regulatory Authority of India Act, 1997 (by Snehashish Ghosh): The main objective of the TRAI Act was to establish the TRAI and the Telecom Dispute Settlement Appellate Tribunal. Snehashish also touches upon the amendment to the TRAI Act, government control over TRAI, scheme of the TRAI Act, constitution of TRAI, its powers and functions, grounds and procedures for appeal to the tribunal, etc.

Consumers International IP Watchlist 2012 — India Report (by Pranesh Prakash): The India Report for Consumers International IP Watchlist 2012 was published on the A2K Network website. According to the report, India's Copyright Act is a relatively balanced instrument that recognises the interests of consumers through its broad private use exception, and by facilitating the compulsory licensing of works that would otherwise be unavailable. However, the compulsory licensing provision have not been utilized so far, because of both a lack of knowledge and more importantly because of the stringent conditions attached to them.

Ring Side View : Update on WIPO Negotiations on the Treaty for the Visually Impaired

As a legal advisor of the World Blind Union and part of the World Blind Union delegation to the 24th meeting of the WIPO Standing Committee on Copyright and Related Rights (SCCR) that concluded on July 25, 2012 I had a ring side seat to the negotiations that happened between Member States in relation to the Treaty.

On call almost 24 x 7 to answer questions and clarify positions to Member States on aspects relating to the Treaty and the ground reality faced by the print disabled community, those were possibly the most grueling 10 days of my life.

Progress at the last 3 SCCRs was painfully slow. At the start of this SCCR on July 16 2012 the single biggest hurdle to progress on the Treaty was the stand that the African Group had taken at the earlier SCCRs with respect to a comprehensive text covering exceptions and limitations to copyright for education, libraries, archives and disabilities. See my discussion with Jamie Love from Knowledge Ecology International on this issue. It was evident that while a comprehensive text had its merits, it would be impossible to make progress on this comprehensive text because, other that for exceptions for disabilities, the issues relating to education, libraries and archives had not reached the level of maturity required to progress to a Treaty. So it was essential that exceptions for disabilities were de-linked from exceptions for education etc. This is exactly what the African Group did much to the excitement of the WBU team.

Much was left to be done over the next few days including discussion on the text of the working document which prepared by Chair after SCCR 23, available here. Normally, discussions on text happen at the plenary session attended by Member States as well as accredited organizations such as the World Blind Union, my organization Inclusive Planet Centre for Disability Law and Policy and others. This process, while adding to transparency and more participation is sometimes slow and the request of some Member States considering the urgency of the matter, discussions were taken out of plenary into a closed room round table discussion. All Member States could participate and many did. Unfortunately, accredited organizations were not invited to attend. Full credit to Member States in terms of effort put into this effort as they worked well beyond normal working hours on most days in an attempt to reach consensus on the text.

Another critical outcome we had hoped for was that there would be consensus between Member States that the instrument would be in the form of a Treaty. As the negotiations between Member States progressed it became clear that the United States and the European Union were blocking the Treaty while everybody else was pushing hard for the Treaty. The United States and the European Union were pushing for some form of non-binding instrument that would be more in the nature of a recommendation. Further coverage of this is at Huffington Post and in the Guardian. The drawbacks of a soft law as opposed to a Treaty is obvious in that a soft law has no binding force as opposed to a Treaty. Rumor has it that the reason for the United States not supporting the Treaty is that the publishing lobby is apparently a huge contributor to President Obama’s re-election campaign and that he could ill afford to alienate this lobby by pushing for the Treaty. The European Union’s opposition to a binding Treaty was despite a resolution adopted by the European Parliament in February 2012 calling on the European Union to support a binding Treaty.

We had hoped that SCCR 24 would close with agreement on the text, agreement that it would be a Treaty and finally that the SCCR referring the Treaty to the upcoming General Assembly in October 2012 to call for a Diplomatic Conference in 2013 to expressly agree on the Treaty.

However, this was not to be. Although much progress was made on the text, the text remains incomplete, with a lot of brackets in the text on undecided points. There was no consensus that the instrument should be a treaty. And lastly there was no decision on referring the issue to a diplomatic conference.

The next steps as outlined in the conclusions to SCCR 24 are the following:

an inter-sessional meeting of the SCCR be held in Geneva between the 2012 General Assembly and the 25th session of the SCCR to continue work;
the 25th session of the SCCR will attempt to conclude or advance substantially the text of the document; and
that the General Assembly convene an extraordinary session to be held in December 2012 to evaluate the text from SCCR/25 and to make a decision on whether to convene a diplomatic conference in 2013.

SCCR 24 made more progress on this issue that any of the previous SCCRs I have attended. We are very optimistic that the Treaty will become a reality of the next 18 to 24 months with the increased pressure being exerted on the US and the European Union by the blind groups in these jurisdictions respectively. Needless to say, the Treaty will benefit developing countries the most since the majority of persons with print disabilities are in these countries. India and other developing countries are mindful of this and are pushing as hard as possible to make it happen.

My next post will be on the pros and cons of the text that was proposed at the end of SCCR 24.

Ford Foundation has given a grant of USD 200,000 to CIS to build expertise in the area of telecommunications in India. The following are the latest outputs:

Fixed Line Telephones (by Jürgen Kock): This module discusses the features and the various stages of the development of fixed line telephones, its early history, the basic principle of a fixed line telephone system, plain old telephone service, digital telephones, cordless phones to today's features of fixed line telephones.
Different Forms of Video Communication (by Tina Mani): In this module, Tina Mani takes us through some of the common forms of video communication such as video calling, video conferencing, telepresence and video sharing.
Broadband Policy, 2004 (by Snehashish Ghosh): In this module, Snehashish Ghosh tells us that the Policy was laid down by the Government of India in order to realize the potential of broadband services. US and EU blocking treaty to give blind people access to books

The US and the EU are blocking a treaty that would give the world's blind and visually impaired people – 90% of whom live in the developing world – easier access to published works in formats they can use.

A "treaty for blind people" has been under discussion at the World Intellectual Property Organisation (Wipo) since 2008, but negotiations have made little progress. In the latest round of talks in Geneva, which ended on Wednesday 25 July, negotiators deferred a decision on the issue once again, to the dismay of activists.

"This is not just a legal issue – for us, this is a moral issue. It's about human rights," said Teresa Hackett, programme manager at Electronic Information for Libraries, a non-profit group based in the Netherlands.

There are about 256 million visually impaired people in the developing world, according to an estimate by the World Health Organisation. In many rich countries, blind people have ready access to works that have been translated into braille and other accessible formats such as audio and large-print books, although, according to the EU, only 5% of books are accessible to blind people in wealthy states.

However, under existing copyright law, poorer countries can't access those translations without getting the express permission of the copyright holder. Few developing country governments have managed to do that, meaning that their blind and visually impaired populations are left with barely anything to read. The EU estimates that less than 1% of books are accessible to blind people in poorer countries.

"The Spanish organisation Once has well over 100,000 [translated] books that they would like to send to Latin American countries, but they can't simply because of this copyright barrier," said Dan Pescod of theRoyal National Institute of Blind People. Libraries in five Latin American countries – Colombia, Nicaragua, Mexico, Uruguay and Chile – have fewer than 9,000 accessible books between them, he said.

A treaty at WIPO could change that. A binding agreement would mean people in the global south could get immediate access to books that have already been translated into accessible formats in other countries. A treaty would also lead to enormous cost savings, as expensive translation has to be replicated in every country that wants to produce an accessible form of a given book.

The European parliament passed a resolution in February calling on the EU to support a binding treaty for the blind, but it does not appear to be having much impact. "The EU and the Americans are blocking the treaty – that's what's going on," said James Love, director of Knowledge Ecology International (KEI). "It's shameful what they're doing." He added that the administration of President Barack Obama has changed its position on the treaty over the past few years. In 2008 Obama's transition team were making positive noises, but since then the administration has become less enthusiastic.

Europe and the US are home to some of the world's biggest publishing companies, many of which don't like the idea of an international treaty that would restrict their intellectual property rights. Observers speculate that the Obama administration may be loth to upset the publishing industry, a major campaign supporter, this late in an election year. "What we can see in the [negotiating] room is that primarily it's the business interests that dominate," said Hackett.

Activists are hoping for a legally binding treaty, but US and European delegates have been pushing for a softer "instrument" that would offer only guidelines and recommendations.

"We really don't want to establish a precedent of developing a series of treaties that specifically focus on … limitations and exceptions to the rights of copyright owners," said Alan Adler of the Association of American Publishers, in an online interview with KEI. Discussions are due to begin again in November, after the US election.

Despite the setback, activists insist they will keep lobbying for a binding treaty. "We in developing countries have found our voice and we are not going to back down," said Rahul Cherian, of Inclusive Planet, an Indian nonprofit, in a statement to Wipo delegates last week. "When people are demanding their basic rights, no power in the world is strong enough to stop them getting what they want."

Advocates of visual disability groups from across the world urged the United States to get off the fence at the global copyright negotiations in Geneva this week and actively back a strong treaty that allows blind people access to copyrighted published works.

The proposed treaty would make it obligatory for countries to allow copyrighted printed published works to be converted into an accessible format for people with visual and reading disabilities and shared around the world without seeking permission from the copyright holder.

The United States and European Union agree in principle to disability access but are not committed to a legally binding global treaty. Disability advocates at the ongoing negotiations of the United Nations agency, the World Intellectual Property Organization, say that if the U.S. backs their demand, the European Union will automatically fall in line.

“The American publishers industry, comprising of the publishing giants, does not want it to be a treaty and only want it to be a set of recommendations,” said James Love, director of the Washington-based nonprofit group Knowledge Ecology International that is part of the campaign in Geneva. “The U.S. has the biggest collection of accessible English language books. It all boils down to the American government’s will. Do you or do you not believe that the American libraries should cooperate with blind people in other parts of the world?”

But American publishers say they are opposed to a treaty that has the potential to set the stage for similar exceptions and limitations to the rights of copyright owners in other areas as well.

“We are not against allowing an exception for people with print disabilities, but our concern is that a treaty will establish a precedent that they will then apply in the other areas like educational uses, library and archives,” said Allan Adler, vice president of legal and government affairs at the Association of American Publishers in a telephone interview. “Generally, international treaties establish the minimal rights of the copyright owners first, and not the limitations and exceptions to those rights.”

Adler’s view was echoed in what a U.S. delegate, Justin Hughes, told negotiators in Geneva on Thursday: “We do not accept any form of linkage between the effort on behalf of the world’s print disabled people and any other project. To us, such a linkage between the print disabilities effort and an effort for business affairs would be unprincipled, it would be unethical, and the United States will not have any part of it.”

The U.S. government also is advocating a softer, nonbinding alternative to a legally binding treaty, delegates in Geneva say.

But many disability rights groups say mere recommendations place no obligations and would be toothless.

Disability advocates say that the needs of visually impaired people are being neglected in this battle over what legal shape the agreement ultimately takes.

“The lack of access to information and knowledge is central to the debate about exclusion of visually impaired people,” said George Abraham of Score Foundation, a New Delhi-based group that supports the campaign to produce a treaty.

Time is running out, advocates of the treaty say. The negotiations began as early as 1981 but have now reached a conclusive stage that could result in a treaty by next year. The Geneva discussions end Wednesday, and lack of consensus this week would put off the negotiations to 2014. By then, most negotiators would have moved on, treaty supporters say.

This urgency has driven developing nations like India to take a strong stand. While the exact number is uncertain, experts agree that India has a high proportion of the world’s blind population, with estimates ranging from one-quarter to one-half. G.R. Raghavender, who represents the Indian government at the negotiations, said the Indian delegation “will not return empty-handed.”

Earlier this year, India passed key amendments to its domestic copyrights law to permit people with visual disabilities to freely convert text material into an accessible format. But only a global treaty can allow visually disabled Indians to import and use accessible books without taking permission from the copyright-holder.
