Odia Wikipedia Workshop in IIMC, Dhenkanal

An Odia Wikipedia Workshop was conducted at IIMC, Dhenkanal on 31 January, 2017

Since 2013, the Odia Wikipedia community has collaborated with the Indian Institute of Mass Communication, Dhenkanal for enabling students of the institution to partake in and contribute to the Wikimedia movement. An Odia Wikipedia workshop was conducted for the students of the institution on 31 January, 2017. The students were given an orientation on the basics of editing Wikipedia on the web and on their smart phones in addition to an explanation of Wikipedia policies, history of Wikipedia and Wiki News.

The 45 English and Odia language students with a male: female ratio of 60: 40, who took part were given a live demonstration of these topics. Along with the help of supportive faculty members, the students were exposed to Commons and Incubator as well. Overall, the event saw the creation of 20 new editors on Odia Wikipedia. A follow-up workshop is also being planned for the students in the coming months.

Meet Telugu Wikipedian Surampudi Meena Gayathri – the first South Indian Wikiwoman completing 100Wikidays Challenge

In December 2016, Ms. Meena Gayathri and her fellow Telugu Wikipedians celebrated the Telugu Wikipedia Day and her accomplishment in the 100Wikidays Challenge – a challenge that requires Wikipedians to create one new article per day for one hundred days in a row. When asked about how it feels to take up the challenge and to become the first South Indian Wikiwoman who completed it, she replied “Like exericing, you would think it is hard to do it every day but if you try, it is really satisfying.” Ms. Meena Gayathri has been one of the few active female Telugu Wikipedians since 2014. Her contribution and passion towards her language and culture have transcended into what she called a “knowledge revolution.”

Ms. Meena Gayathri is an active Telugu Wikipedian who started her 100Wikidays challenge at the end of August 2016. Her motivation came from the support of her family, the satisfaction of creating articles, and her determination to be an inspiration for her fellow Wikipedians. Ms. Meena Gayathri had chosen topics from her interests, including freedom fighters from Andhra Pradesh, wherein articles were present on English Wikipedia but not in Telugu. “I think those are really basic things that Telugu Wikipedia should have but somehow there isn’t” she said. Meena Gayathri reached out to the Telugu community for assistance with MediaWiki’s content translation tools. She also had the support of CIS A2K for books and reference resources. Drawing inspiration from current events and Indian culture, Meena Gayathri also wrote articles on Hindu Goddesses on each the ten days of Dussehra in coordination with the worshiping of a different Goddess on each day of the festival.

The creation of articles on Hindu Goddesses also mark Meena Gayathri’s effort and passion in bridging the Wikipedia gender gap in content coverage. Half way through her challenge, in coordination with the Wikipedia Asian Month in November 2016, she started writing on biographies of Asian women, including female politicians in Sri Lanka and Pakistan. “It’s very interesting” she said, while mentioning her experience in researching and writing about these female figures, “(how) these women, under hard situations… are still securing their positions in the government and in the politics… I want to let people see how they gain and sustain their power as women.” Additionally, Meena Gayathri pioneered a new challenge called “100Women Wikidays Challenge” in which participants would write a woman-related article each day in an endeavor to balance the content gender gap on Wikipedia.

“People said to me that I am the first South India female Wikipedian to complete the 100WikiDays, and the first in the whole world to take up the 100Women Wikidays.”

Her attempt to complete the 100Women Wikidays challenge, however, stopped a few days ago due to the lack of internet connection and time. In fact, this is not the first time that she has faced such difficulty during the completion of her challenges. She described how during a family tour outside of the city, she used to bring a laptop and ensure stable internet connection just so she can wake up as early as possible each day to finish her daily articles for the 100Wikidays. She agrees that women usually seem to be occupied by different responsibilities and activities – family, work, and socializing. She was glad that her family and community have given her full support, materially and mentally, to complete the challenge. When asked about tips on sparing some time for Wikipedia every day, she answered, “The first thing I do in a day… (is to) plan each and every moment of what I need to do in my day. And I maintain a task list in my mind. I will say, just remind yourself twice or thrice a day, remind yourself what you really want to do and you can make some time for Wiki(pedia) too.”

At the end of our conversation, we asked Gayathri to share some advice and encouragement to those who want to take up or are completing the 100Wikidays (or the 100Women Wikidays) Challenge. She answered without hesitation, “I will say, don’t feel afraid, that work you want to do is not that tough after all… It will be satisfying. You are contributing to the knowledge revolution... I think for Telugu, for the online knowledge in our linguistic background, this is going to be history. I will tell them ‘We’re creating a history.’”

Marathi Wikipedia Edit-a-thon at Rajarshi Chhatrapati Shahu College, Kolhapur

A Marathi Wikipedia Edit-a-thon was conducted at Rajarshi Chhatrapati Shahu College, Kolhapur on 23 January, 2017.

A Marathi Wikipedia edit-a-thon was conducted at Shivaji's University's affiliate Rajarshi Chhatrapati Shahu College in Kolhapur on 23 January, 2017. The edit-a-thon aimed to introduce Wikipedia to the students of the College and teach them basic editing skills. The students were trained in categorisation and translation from other language Wikipedias. In addition, the students were taught smart editing on their mobile phones using the Wikipedia app.

The theme of the edit-a-thon was to build resources on Marathi Wikipedia in the field of commerce, so as to keep it relevant to the students who study related subjects at the college. The three-hour-long edit-a-thon conducted at the Computer Lab of the college, involved 50 participants, a mix of male and female students.

Seminar on Rethinking Copyright and Licensing for Digital Publishing Today (Delhi, January 23)

Against the backdrop of a growing global and domestic digital publishing industry on one hand and the recent judgment by the Delhi High Court that upheld the education exception to reproduction of academic and literary works, Pro Helvetia - Swiss Arts Council, Goethe-Institut Max Mueller Bhavan New Delhi, and the Centre for Internet and Society (CIS) are organising a seminar to discuss and reflect on the relevance and functions of copyright and licensing within the transforming market practices and legal structures of the publishing industry today.

The two speakers at the seminar will be Dr. Philipp Theisohn, Professor of Modern German Literary Studies, Zurich University, and Ms. Kerstin Schuster, Droemer Knaur publishing group. The session will be chaired by Mr. Zakir Thomas, Additional Director General (Risk Assessment), Directorate of Income Tax, Government of India.

Dr. Theisohn will address the question of whether the digital age requires a new approach to copyright thinking, and Ms. Schuster will discuss the dynamics of the international market for licenses in the contemporary publishing world.

Philipp Theisohn

Philipp Theisohn, who was born in 1974, studied Modern German Literature, Medieval Studies and Philosophy in Tübingen and Zürich. He gained his doctorate in Jerusalem and Tübingen and, since 2013, has been Professor of Modern German Literary Studies at Zurich University. He has produced numerous publications on German and European literary history from the 13th to the 21st century, in particular on “literary future knowledge“, the perception of literary property, and Jewish Cultural Poetics.

The focal points of his work and research are the literature of Switzerland, literary property/plagiarism as a literary historical phenomenon, science fiction and futurology, realism, Franz Kafka and Early Modern Poetics of Knowledge.

Theisohn is intensely involved in the transmission of literature far beyond the academic environment. He is a member of the jury for the “Swiss Book Prize“ of the Publishers‘ Association, an expert for inter-disciplinary and literary projects for the Swiss Arts Council Pro Helvetia; he curates literary exhibitions, is active in a broad range of journalistic work, among other things for the Neue Zürcher Zeitung, and is in charge of the blog and website of the “Schweizer Buchjahr” which contributes significantly to contemporary literary discourse.

Among his most important book publications are: "Die Zukunft der Dichtung. Geschichte des literarischen Orakels 1450-2050" (“The Future of Poetry. The History of the Literary Oracle 1450-2050”); “Plagiat. Eine unoriginelle Literaturgeschichte”( “Plagiarism. An Unoriginal Literary History”) and “Literarisches Eigentum. Zur Ethik geistiger Arbeit im digitalen Zeitalter” (“Literary Property. On the Ethics of Intellectual Work in the Digital Age”).

Kerstin Schuster

Having obtained a university degree in Romance Studies and Political Science, Kerstin Schuster worked in the bookselling trade. Since 1993 she is trading licenses for the international market. She has worked till 2001 for the literary agency Dr. Ray-Güde Martin, from 2001 until 2013 for the publishing house S. Fischer Verlag in Frankfurt, and since 2014 for the Droemer Knaur publishing group.

For many years now, Kerstin Schuster is also facilitating seminars on how to successfully offer and sell licenses in the international market.

Zakir Thomas

Mr. Thomas is an expert in the field of intellectual property. He has served as a former Registrar of Copyright for the Government of India, and as a project director of the Open Source Drug Discovery Initiative under the Council of Scientific & Industrial Research (a premier R&D org). His expertise spans across copyright, open source innovation, neglected diseases and innovation ecosystem in science and technology in India.

Marathi Wikipedia Edit-a-thon at Shivaji University, Kolhapur

A Marathi Wikipedia Edit-a-thon was held at Shivaji University, Kolhapur on 19 January, 2017

A Marathi Wikipedia edit-a-thon was conducted by CIS-A2K in collaboration with Rajya Marathi Vikas Sanstha at Shivaji Univeristy, Kolhapur on 19 January, 2017. This was similar in nature to the Wikipedia edit-a-thon conducted at Willingdon College in Sangli. The aim of the edit-a-thon was to introduce Wikipedia to the research and post-graduate students of the University.

The three-hour-long edit-a-thon conducted at the University's Marathi Language Computer Lab also focused on building resources in the field of linguistics on Marathi Wikipedia. In addition to equipping the participants with editing and categorisation skills, the workshop encouraged them to contribute to linguistics-related articles and biography articles of Marathi authors and litterateurs. With 50 participants overall, the event increased the reach of Marathi Wikipedia, introducing it to those previously unaware of its existence.

WikiSangamotsavam 2016

The Malayalam Wikipedia community jointly held its anniversary celebrations and annual gathering in Kasaragod district, Kerala from 26 to 28 December, 2016. The Centre for Internet and Society was invited to partake in the event.

The Malayalam Wikipedia community held its fifth annual gathering, WikiSangamotsavam, in Kasaragod, the northernmost district of the state of Kerala. The culturally diverse district is a melting pot of seven actively spoken languages- Malayalam, Kannada, Tulu, the Beary dialect, Tamil, Marathi and Konkani. It was a three day affair from the 26th to 28th December 2016, with the third day’s WikiVoyage incubator session fittingly held on a houseboat out in the Bekal lake! The event commemorated the regional Wikipedia’s completion of 14 years which fell on the 21st of the month. The community aims to build advanced technical support for its members in the next year.

The first day was marked by a seminar by Mr. Sathyaseelan, a differently abled Wikipedian who demonstrated(video from previous meetup here) how to convert voice to text using Optical Character Recognition (OCR) methods for visually challenged Wikipedians. This was followed by a session on Open Street Mapping by the newly elected Malayalam Wikipedia administrator Ranjith Siji. In a one-on-one sit down, Ranjit candidly spoke about the technical challenges that the Malayalam Wikipedia and the wider Wikipedia community faces today. He opines that the existing mobile support for editing wikis is proving insufficient and more robust apps need to be developed to make Wikipedia more mobile ready for on-the-go editors. He’s taking this up as his personal mission for the upcoming year. In light of using freely reusable data, Ranjit says, “collaborative editing must also be enabled as groups can work together to improve local knowledge.”

The second day began with a formal opening ceremony by P. Karunakaran, Member of Parliament for the Kasaragod constituency. He spoke on the importance of furthering the cause of knowledge in India’s most literate state. Then, the Malayalam Wikipedia community sat down for a transparent round table discussion on progress made and targets to be set for 2017. The community noted the success of programs and activities like Ente Gramam (which encouraged members to detail information regarding their village/ ancestral village), Olympics month, Wikipedia Asian Month, Wiki 100 Days, etc. The Wiki 100 Days in particular led to the creation of close to 80 articles a day in Malayalam Wikipedia. The number of articles also saw a surge post the Wiki Conference India 2016 held in Punjab. The discussion mulled on the aspects that need to be improved upon such as selected articles and selected photos on the Main Page which see unenthusiastic voting numbers amongst the community members. Manoj K, an active community member, proposed the strategy of targeting groups of editors(old/new) with niche knowledge of a specific subject or focus area. He related his own experience in this regard: “I’m part of many bird watching and environmental clubs and I talk to them about Wikipedia so that they can use their knowledge about conservation or birds to edit or create those specific wikis.” He also identified challenges that were administrative in nature. “When offline events increase, online participation tends to decrease due to the leg work involved”, he observes. In addition, he feels grant writing and documentation training would also benefit the community. He added that religious vandalism of articles on monuments by fringe groups is also an issue faced by the community.

Anil Kumar, another long time Wikipedian, spoke of the general increase in awareness regarding editing Wikipedia in smaller towns and districts in Kerala. He pointed out that reviving School Wiki would further increase awareness and, subsequently, participation. The Kerala government’s IT@School project is now leading the efforts behind reviving School Wiki which aims to document (in Malayalam) details of all the schools in the state. K. Anvar Sadat, the Executive Director of IT@School spoke to the Malayalam Wikipedia community in a video message enumerating the benefits of a detailed statewide school database. The community also aims to complete their target of 50, 000 Wikipedia articles by the end of the year. The second day came to a close with a seminar on mangalamkali, a local folk dance in the district by Master Ramachandran.

Ranjit Siji further outlined the agenda for 2017 saying that data scraping of public records onto Wikipedia and a tool to maintain edit-a-thons will be a key focus for the community this year. He said, “when data can flow from public record to a wiki, it makes editing much easier and accessible even for new editors.”

When asked Manoj added that the community plans to conduct more online and offline events for community bonding. He said, “monthly meetings and edit-a-thons will keep the community active.” 2017 will also see Wikipedians in the community being rewarded through recognition of their pioneering efforts, he said. However, he emphasised the need for public and social media branding of future events. The final day of the annual gathering was held on a houseboat in Nileshwar. Wikipedian Sajal Karikkan gave a presentation on the Malayalam WikiVoyage project, still in incubation, where users could provide travel guidance about areas they are most familiar with. It was enthusiastically received by the community members. While the event was timed between Christmas and New Year, it did see some enthusiastic participation. However, the community did lack significant participation of women to bridge the gender divide(see chart below). Smitha, a long time Wikipedian and oceanographer feels that working women find it harder. She says, “they simply don’t have the time with their work and family commitments.” With the community planning to create mobile apps for editing in Malayalam, this could be sufficiently addressed through focused efforts to involve more women.

Telugu Wikipedia Stall at Hyderabad Book Fair

Telugu Wikipedia community put up a stall at the Hyderabad Book Fair in December welcoming members of the public to join as editors on the regional encyclopaedia.

The Telugu Wikipedia community put up a stall at the 30th edition of the Hyderabad Book Fair from 15th to 26th December, 2016 at the NTR Stadium. Supported by The Centre for Internet and Society, the volunteers were long time Telugu Wikipedia community members. They helped visitors set up Wikipedia accounts and become editors on the free access encyclopedia. They also spoke to the visitors and explained how Wikipedia works and the collaborative efforts undertaken by various language communities in maintaining the regional language wiki pages. Additionally, a survey was conducted to find out what topics of interest are currently trending among the public. The Telugu Wikipedia community aims to take this feedback into consideration in order to update the topics they frequently edit.

Some visitors seemed interested in attending upcoming Wikipedia events and workshops. The organisers welcomed interested members of the public to attend the Hyderabad Wikipedia Monthly meetup on 22nd January, 2017.

Telugu Wikipedia Stall at Rajahmundry Book Fair

Telugu Wikipedia community put up a stall at the three day Rajahmundry Book Fair from 20 - 23 November 2016.

The initiative was supported by The Centre for Internet and Society and NTR Trust. The stall was run by long time community advocates and editors of Telugu Wikipedia. The volunteers distributed pamphlets and explained to the visitors the basics of editing Wikipedia. They distributed a survey to understand current topics of interest in order to update the Telugu wiki pages. Some visitors utilized the expertise of the volunteers and set up Wikipedia accounts at the stalls.

The book fair in the river side city didn’t see many takers this time round considering the move to demonetise was announced the previous week. The organizers had not made alternative payment arrangements at such short notice. Volunteer Pranay Raj said, “although there were uncontrollable factors at play, the city has great potential and Telugu Wikipedia plans to expand its editor base in the city through institutional partnerships from schools and colleges.”

Mini Workshop on Tools: Wikipedia Monthly Meetup, Hyderabad

Telugu Wikipedia community held its monthly meet-up in Hyderabad on 28 August 2016.

The event was marked by a presentation on quick tools by Pavan Santhosh, Community Advocate and long time member of the Telugu Wikipedia community. He demonstrated the use of PrepBio, a tool that helps create infoboxes on biographical articles. “This make the process of editing and updating edits easier,” he said. He also spoke about Wiki ToDo, a tool that helps find articles with specific edits or improvements required. “This ensures that even new editors can contribute to quality improvement on wikis,” he pointed out. At the end of the session, the community members engaged in an activity that gave them a hands on insight into using these tools.

Marathi Wikipedia Edit-a-thon at Sangli, Maharashtra

A Marathi Wikipedia Edit-a-thon was conducted at Willingdon College, Sangli on 18 January, 2017

A Marathi Wikipedia edit-a-thon was conducted in collaboration with Rajya Marathi Vikas Sanstha at Willingdon College on 18 January, 2017. The goal of the workshop was to begin the building of resources in the field of linguistics on Marathi Wikipedia. To begin with, the edit-a-thon introduced the participants to editing Wikipedia and contributing to Wiki projects. With about 50 participants(of which around 6 were female), the three-hour-long edit-a-thon involved the post-graduate and research students of the Willingdon College.

The edit-a-thon conducted at the Marathi Language Computer Lab of the College also focused on creating/editing Wikipedia pages related to Marathi literature and language. Extensive discussion on these issues was also conducted to develop the concept and theme of the edit-a-thon. While participants were taught basic Wikipedia editing, they were also trained in searching for relevant articles, categorisation and translation from other language Wikipedias.

Super Cassettes v. MySpace (Redux)

The latest judgment in the matter of Super Cassettes v. MySpace is a landmark and progressive ruling, which strengthens the safe harbor immunity enjoyed by Internet intermediaries in India. It interprets the provisions of the IT Act, 2000 and the Copyright Act, 1957 to restore safe harbor immunity to intermediaries even in the case of copyright claims. It also relieves MySpace from pre-screening user-uploaded content, endeavouring to strike a balance between free speech and censorship. CIS was one of the intervenors in the case, and has been duly acknowledged in the judgment.

On 23rd December 2016, Justice Ravindra Bhat and Justice Deepa Sharma of the Delhi High Court delivered a decision overturning the 2012 order in the matter of Super Cassettes Industries Limited v. MySpace. The 2012 order was heavily criticized, for it was agnostic to the technological complexities of regulating speech on the Internet and cast unfathomable burdens on MySpace. In the following post I summarise the decision of the Division Bench. Click here to read the judgment.

Brief Facts

In 2007, Super Cassettes Industries Limited (SCIL) filed a suit against MySpace, a social networking platform, alleging copyright infringement against MySpace. The platform allowed users to upload and share media files, inter alia, and it was discovered that users were sharing SCIL’s copyrighted works sans authorisation. SCIL promptly proceeded to file a civil suit against MySpace for primary infringement under section 51(a)(i) of the Copyright Act as well as secondary infringement under section 51(a)(ii).

The 2012 order was extremely worrisome as it had turned the clock several decades back on concepts of internet intermediary liability. The court had held MySpace liable for copyright infringement despite it having shown no knowledge about specific instances of infringement; that it removed infringing content upon complaints; and that Super Cassettes had failed to submit songs to MySpace's song ID database. The most impractical burden of duty that the court pronounced was that MySpace was required to pre-screen content, rather than relying on post-infringement measures to remove infringing content. This was a result of interpreting due diligence to include pre-screening.

The court injuncted MySpace from permitting any uploads of SCIL's copyrighted content, and directed to expeditiously execute content removal requests. To read CIS' analysis of the Single Judge's interim order, click here.

In the instant judgment, the bench limited their examination to MySpace’s liability for secondary infringement, and left the direct infringement determination to the Single Judge at the subsequent trial stage. In doing so, the court answered the following three questions:

1) Whether MySpace could be said to have knowledge of infringement so as to attract liability for secondary infringement under Section 51(a)(ii)?

No. According to the Court, in the case of internet intermediaries, section 51(a)(ii) contemplates actual knowledge and not general awareness.

Elaborating re the circumstances of the case, the Court held that to attract liability for secondary infringement, MySpace should have had actual knowledge and not mere awareness of the infringement. Appreciating the difference between virtual and physical worlds, the judgment stated “the nature of internet media is such that the interpretation of knowledge cannot be the same as that is used for a physical premise.”

As per the court, the following facts only amounted to a general awareness, which was not sufficient to establish secondary liability:

Existence of user agreement terms which prohibited users from unauthorised uploading of content;
Operation of post-infringement mechanisms instituted by MySpace to identify and remove content;
SCIL sharing a voluminous catalogue of 100,000 copyrighted songs with MySpace, expecting the latter to monitor and quell any infringement;
Modifying videos to insert ads in them: SCIL contended that MySpace invited users to share and upload content which it would use to insert ads and make revenues – and this amounted to knowledge. The Court found that video modification for ad insertion only changed the format of the video and not the content; further, it was a pure automated process and there was no human intervention.

Additionally, no constructive knowledge could be attributed to MySpace to demonstrate reasonable ground for believing that infringement had occurred. A reasonable belief could emerge only after MySpace had perused all the content uploaded and shared on its platform – a task that was impossible to perform due to the voluminous catalogue handed to it and existing technological limitations.

The Court imposed a duty on SCIL to specify the works in which it owned copyright and being shared without authorisation on MySpace. It held that merely giving names of all content it owned without expressly pointing out the infringing works was contrary to the established principles of copyright law. Further, MySpace contended and the judge agreed, that in many instances the works were legally shared by distributors and performers – and often users created remixed works which only bore semblance to the title of the copyright work.

In such cases it becomes even more important for a plaintiff such as MySpace to provide specific titles, because while an intermediary may remove the content fearing liability and damages, an authorized individual’s license and right to fair use will suffer or stand negated. (Para 38 in decision)

Thus, where as MySpace undoubtedly permitted a place of profit for communication of infringing works uploaded by users, it did not have specific knowledge, nor reasonable belief of the infringement.

2) Does proviso to Section 81 override the "safe harbor" granted to intermediaries under Section 79 of the IT Act, 2000?

and

3) Whether it was possible to harmoniously read and interpret Sections 79 and 81 of the IT Act, and Section 51 of the Copyright Act?

No, the proviso does not override the safe harbor, i.e. the safe harbor defence cannot be denied to the intermediary in the case of copyright actions.The three sections have to be read harmoniously, indeed.

The judgment referred to the Parliamentary Standing Committee report as a relevant tool in interpreting the two provisions, declaring that the rights conferred under the IT Act, 2000 are supplementary and not in derogation of the Patents Act or the Copyright Act. The proviso was inserted only to permit copyright owners to demand action against intermediaries who may themselves post infringing content – the safe harbor only existed for circumstances when content was third party/user generated.

Given the supplementary nature of the provisions- one where infringement is defined and traditional copyrights are guaranteed and the other where digital economy and newer technologies have been kept in mind, the only logical and harmonious manner to interpret the law would be to read them together. Not doing so would lead to an undesirable situation where intermediaries would be held liable irrespective of their due diligence. (Para 49 in decision)

Regarding section 79, the court reiterated that the section only granted a limited immunity to intermediaries by granting a measured privilege to an intermediary, which was in the nature of an affirmative defence and not a blanket immunity to avoid liability. The very purpose of section 79 was to regulate and limit this liability; where as the Copyright Act granted and controlled rights of a copyright owner.

The Court found Judge Whyte’s decision in Religious Technology Centre v. Netcom Online Communication Services (1995), to be particularly relevant to the instant case, and agreed with its observations. To recall, Netcom was the landmark US ruling which established that when a subscriber was responsible for direct infringement, and the service providers did nothing more than setting up and operating tech systems which were necessary for the functioning of the Internet, it was illogical to impute liability on the service provider.

On MySpace Complying with Safe Harbor Requirements under Section 79 of the IT Act, 2000 (and Intermediary Rules, 2011)

The court held that MySpace's operations were in compliance with section 79(2)(b). The content transmission was initiated at the behest of the users, the recipients were not chosen by MySpace, neither was there modification of content. On the issue of modification, the court reasoned that since modification was an automated process (MySpace was inserting ads) which changed the format only, without MySpace's tacit or expressed control or knowledge, it was in compliance of the legislative requirement.

Despite several safeguard tools and notice and take down regimes, infringed videos find their way. The remedy here is not to target intermediaries but to ensure that infringing material is removed in an orderly and reasonable manner. A further balancing act is required which is that of freedom of speech and privatized censorship. If an intermediary is tasked with the responsibility of identifying infringing content from non-infringing one, it could have a chilling effect on free speech; an unspecified or incomplete list may do that. (Para 62 in decision)

On the second aspect of due-diligence, the court held that Mypace complied with the due diligence procedure specified in the Rules - it published rules, regulations, privacy policy and user agreement for access of usage. Reading Rule 3(4) with section 79(2)(c), the court held that it due diligence required MySpace to remove content within 36 hours of gaining actual knowledge or receiving knowledge by another person of the infringing content. If MySpace failed to take infringing content down accordingly, then only will safe harbour be denied to MySpace.

This liberal interpretation of due diligence is a big win for internet intermediaries in India.

Additional Issues Considered by the Court

MySpace also tried to defend its activities by claiming the shield of the fair dealing section of the Indian Copyright Act. However, the Court refused, stating that the fair dealing defence was inapplicable to the case as the provisions protected transient and incidental storage. Whereas, in the instant circumstances, the content in question was stored/hosted permanently.

MySpace also contended that the Single Judge's injunction order was vague and general and had foisted unimplementable duties on MySpace, disregarding the way the Internet functioned. If MySpace had to strictly comply with the order, it would have to shut its business in India. The Court said that the Single Judge's order, if enforced, would create a system of unwarranted private censorship, running contrary to the principles of a free speech regime, devoid of considerations of peculiarities of the internet intermediary industry. Private censorship would also invite upon the ISP the legal risk of wrongfully terminating a user account.

Finally, the Court urged MySpace to explore and innovate techniques to protect the interests of traditional copyright holders in a more efficient manner.

Relief Granted

Setting aside the Single Judge's order aside, the Court directed SCIL to provide a specific catalogue of infringing works which also pointed to the URL of the files. Upon receiving such specific knowledge, MySpace has been directed to remove the content within 36 hours of the issued notice. MySpace will also keep an account of the removals, and the revenues earned from ads placed for calculating damages at the trial stage.

Telugu Wikipedia stall at Vijayawada Book Festival

The Telugu Wikipedia community put up a stall at the Vijayawada Book Festival in January, in order to increase reach of the regional language encyclopaedia.

Last in a series of book stalls set up across the Telugu-speaking region, the Telugu community set up shop at the 27th Vijayawada Book Festival from 3 to 11 January 2017 at the PWD Grounds. The community had previously set up similar book stalls in Rajahmundry and Hyderabad. Considered one of the largest book festivals in India with deep-rooted cultural significance in the Telugu literary circles, the Telugu community aims to increase the reach and visibility of Telugu Wikipedia through the setting up of this stall.

The book festival, open for the public from 11 am to 11 pm, was inaugurated by Kendra Sahitya Akademi winner Rachapalem Chandrasekhar Reddy, with a collection of 235 stalls to browse from. The festival was organised in partnership with the Andhra Pradesh Department of Language and Culture and NTR Trust. The stall was set up by Telugu Wikipedia community members with support from CIS-A2K and NTR Trust.

More than 150 individuals were engaged through this event. Interested members of public would receive follow-up through "Know-How" videos of Telugu Wikipedia. This provides basic information regarding editing and contributing to Wikipedia and its sister projects. They would also receive invitations to offline events taking place in Vijayawada in the future.

Telugu Wikipedia editor User:Pranayraj1985 said of his experience in talking to the public about Telugu Wikipedia, "I learnt a lot about what people know about Wikipedia and what they didn't know. In general, many of the visitors exclaim when they [come to] know, there is Wikipedia in Telugu language. But, in contrast, here in Vijayawada, we could at least find handful of people who knew there is something called Telugu Wikipedia.

Google-translated Telugu articles prioritisation exercise: January iteration

The January iteration of the Google-translated Telugu articles prioritisation exercise took place online.

The Google-translated Telugu articles prioritization is an online exercise intended to prioritize and improve over 1,900 machine-translated articles on Telugu Wikipedia. This project began from 2009- 2011 when Google translation project took place on Telugu Wikipedia in several rounds. Jointly organised by the Telugu Wikipedia community and CIS-A2K, this exercise saw the participation of 1 female Wikipedian and 4 male Wikipedians.

12 machine translated articles were improved and 39 have been deleted due to their poor quality. In addition to this, 42 articles have been prioritised for further improvement. Says Telugu Wikipedian User:Meena gayathri.s, "people who wanted to improve Google-translated article waited [for a] long time to get a priority list of articles to be improved and in that aspect, this exercise is very useful."

Mini TTT and MWT held in Kolkata

A regional version of Train The Trainer and MediaWiki Training was recently conducted in Kolkata.

CIS-A2K’s widely well-regarded flagship skill building program was conducted in Kolkata between 7- 8 January 2017, in partnership with the West Bengal Wikimedians User Group. The two-day event was held at the West Bengal National University of Juridical Sciences. There were 20 participants at the event, of which 18 were male and only two female.

There were three thematic sessions, each broadly dealing with: Wikipedia, Wikimedia Commons and Wikisource. The participants were taught article enrichment and how to upgrade articles into good category articles on Wikipedia. The participants learnt reference resources in detail in addition to discussing the different types of syntax required to apply the references meaningfully. The participants were also exposed to advanced search techniques on Google in order to gather relevant references.

During the Commons session, the participants were taught the basics of creating categories and subcategories in order to help narrow down searches and hence, image utility on Commons. Facilitating easy identification of an image helps enrich articles in need of descriptive photos. Additionally, participants were encouraged to give specific file names to their images along with a detailed description of the same. This was followed by a technical session on the following popular tools and gadgets that help frequent uploaders on Commons:

Cat-a-lot is a JavaScript gadget that helps with moving images (or subcategories) between categories or adding categories to search results
Google Images tab: On File pages, adds a new tab to easily search for similar images on the Internet using Google Images
OTRS is a tool used by the Wikimedia projects, including Commons, to manage and archive email conversations. The main use of OTRS in relation to Commons is to verify and archive licensing permissions.
Flickr2Commons - Tool to easily upload single and multiple files from Flickr to Commons. This tool uses OAuth to upload files to Commons.

In addition to these on-wiki discussions, a broader discussion took place on photography tips such as the rule of thirds which helps enhance the effect and purpose of the image.

The final thematic session was on Wikisource. Participants had a hands on lesson in proofreading methodology in addition to learning about image formatting, formatting table of contents, table access page break, text divider, and tools and script of Wikisource.
