Pune scientists hold a workshop with Marathi Vishwakosh to thrash out how to provide more vocabulary for scientific discourse in the language, to cater to a vast majority that is not comfortable looking up info in English.

City scientists have teamed up with the makers of the Marathi Vishwakosh and other organisations to promote the usage of the Marathi language for scientific discourse. Most of the scientific material available on the internet is in English. Thus, readers who wish to read this material in Marathi have fewer options. A workshop for the scientific scholars and authors was organised last week to urge them to write in Marathi. It was a joint effort by the Marathi Vishwakosh, Rawat’s Nature Academy, Centre for Internet Society and the Inter-University Centre for Astronomy and Astrophysics (IUCAA).

Mahtigar, the system operator of the Marathi Wikipedia, shared, “The number of scientists and scholars writing in Marathi has increased manifold, but there is still a long way to go as the number of Marathi readers are also increasing by the day. Also, I feel that even though the internet is a ready search tool, information is not that easy to avail of for the simple reason that it is not available in a layman’s language. For instance, if a person from the rural areas wishes to read and get information about the crops or agriculture, not much information is available in the language of his preference.”

He continued, “I still feel that initially, a bit of leniency to use technical words in English while writing scientific articles in Marathi should be given, since it will be easier to understand the material. Eventually, we can move on to using the technical Marathi words in articles.” It is being expected that by 2021, the number of Marathi readers of scientific journals will see a prominent incline. According to the KPMG and Google report, 80 per cent people in India will be using Indian languages to get information off the internet. Also, by 2021, around five crore of the Marathi population would prefer to operate the internet in Marathi only. Thus, efforts should be made to provide the material in the language.

Subodh Kulkarni, Marathi advocate from the Centre for Internet and Society, told Mirror,“The field of science is continuously expanding and evolving; the language has to do the same to stay on a par with it. Thus, continuous efforts have to be made to keep updating the dictionary and thesaurus of local languages. Supporting this cause, prominent scientist Jayant Narlikar among others has agreed to put his book on astrophysics on Wiki Source without copyrights. The book has been written in Marathi.” It has often been debated that usage of the internet is more in urban areas compared to villages. Surprisingly, on the contrary, the rural areas use the internet for 530 minutes per week, whereas city dwellers use only around 487 minutes per week.

Underscoring the immediate need for scientific content in Marathi, Pradip Rawat, director of Rawat’s Nature Academy, stressed, “Out of 12 crore Marathi speakers, only around 50,000 know English. What about the rest? Scant information is available for Marathi readers. Even though the fisherman and labourers have access to the internet via the smartphone, they can’t really decipher the information owing to the language barrier. The Marathi encyclopedia will now be linked to the Marathi Wikipedia, so that more and more information is available for the people. I think it is a watershed moment. During the workshop, we also discussed about a comparative chart of where the other Indian languages stand. We have to strengthen Marathi on the internet. This way we will be able to approach the commonest person of the country.”

Marathi Wikipedia - Vishwakosh Workshop for Science writers in IUCAA, Pune

A day-long workshop was organised for science writers at [https://en.wikipedia.org/wiki/Inter-University_Centre_for_Astronomy_and_Astrophysics Inter-University Centre for Astronomy and Astrophysics], Pune on 7 October, 2017. Eminent astrophysicist-mathematician couple en:Jayant Narlikar|Jayant^[+] and en:Mangala Narlikar|Mangala Narlikar^[+] , and renowned ecologist en:Madhav Gadgil|Madhav Gadgil^[+] were among the dignitaries present at the event.

The workshop was planned in three sessions. Presentations and discussions were conducted in first session, while second session was focused on actual editing demonstrations on Wikipedia. In the same session the new websites based on different subjects developed by Marathi Vishwakosh were presented. The process of content contribution in text, images, audio and video forms was explained in this session. The third session was to explore networking with Dyanmandals formed by :en:Marathi Vishwakosh|Marathi Vishwakosh Nirmiti Mandal^[+] . Insisting the expertise of invited authors to contribute the articles in their own chosen fields in a well-structured format, this session will not only train the authors in content generation but also make them understand the expectations of laymen and common readers.

CIS filed a request under the Right to Information Act in March 2016 as part of research for the paper: Patent Working Requirements and Complex Products: An Empirical Assessment of India's Form 27 Practice and Compliance (July 2017). Rohini Lakshané has captured the developments in a blog post. Last month’s judgment by the nine judge referral bench was an emphatic endorsement of the the constitutional right to privacy. Amber Sinha has dissected the various aspects of the right to privacy as put forth by the nine judge constitutional bench in the Puttaswamy matter. The papers on fundamental right to privacy can be accessed here. With offline as the theme of the third Internet Researchers' Conference (IRC18), CIS has invited teams of two or more members to submit sessions proposals by Sunday, October 22, 2017. The conference is expected to be held in Himachal Pradesh during February 22-24, 2018. The venue and dates will be confirmed soon. Anonymity-based internet apps like Sarahah may not be as vicious for those surrounded by the comfort of social status. If your experience of Sarahah has been positive, it might be good to reflect on your own cultural and social capital, wrote Nishant Shah in an article in the Indian Express, dated September 10, 2017.

RTI request to Indian Patents Office for Form 27 (Statement of Working of patents), March 2016

The Centre for Internet and Society filed this request under the Right to Information Act in March 2016 as part of research for the paper: Patent Working Requirements and Complex Products: An Empirical Assessment of India's Form 27 Practice and Compliance (July 2017). We sought forms pertaining to 61 of the patents found in our patent landscaping study. These forms were not available on the online public databases, InPASS and IPAIRS, at the time of the filing the RTI request. Research assistance was provided by intern Shreshth Wadhwa.

Patent landscaping study -- Patents and Mobile Devices in India: An Empirical Survey (April 2016)

We filed our first application under the RTI Act with the Controller General of Patents, Designs and Trade Marks in Mumbai in June 2015 for procuring Form 27 not available through their online databases, but received a generic response about how to download Form 27 from the online databases. The IPO also stated, “The desired information relates to about 1700 patents for all the years, to supply and trace out the information physical form requires huge humane resource and need to divert the office staff for some days which would hampers the day-todays- official work therefore, the information is proactively disclosed in the office website for the public”. In view of this response, we filed another RTI application with the same office in March 2016, and restricted the number of patents to 61. The patents represent a cross-section of owners in our landscaping study. (View methodology). We also stated in the RTI request that we had already searched the online databases for the forms and did not find any. The IPO replied in April 2016 that it could provide CIS with forms for eleven of the requested patents. As for the rest of the forms, the IPO stated, “As thousand of Form-27 are filed in this office, it is very difficult to segregate Form-27 for the patent numbers enlisted in your RTI application as it needs diversion of huge official/ staff manpower and it will affect day to day work of this office.”

A few days after CIS received the reply from the IPO, Form 27 pertaining to patents in the landscape happened to start appearing on InPASS and IPAIRS E-register portal.

Elonnai Hickok wrote a blog post which provided a high level comparison of the 2017 and 2015 DNA Profiling Bill - calling out positive changes, remaining issues, and missing provisions. Rohini Lakshane wrote a blog post on dataset for patent requirements and complex products. The dataset has been released under the Creative Commons-Attribution-Share Alike 4.0 License. A Marathi Wikipedia workshop was held in Sangli, Maharashtra. Subodh Kulkarni shared the developments in a blog post. Ladies and gentlemen, distinguished guests and my dear Wikimedia friends and colleagues,

I am deeply honoured to be asked to say the opening words for the Movement Strategy Salon being held today at Vijayawada. The problems of ill health prevent me from coming to be with you as I most dearly wish, but I do hope my few words and thoughts will make do instead. Let me introduce myself. I happen to be a retired army officer but I see myself as a citizen of the world, as a Wikipedian whose cherished dream is to make Jimmy Wales dream come true.

“Imagine a world where the sum of all knowledge is available to all mankind!”

The occasion for this conclave or salon is timely. The twenty first century paradigm of Open Culture, of sharing and collective intelligence are well established. Crowdsourcing, Wikipedia, Creative Commons, Project Gutenberg, the Internet Archive and so many other important global resources are proof.

Education has received a huge fillip by the vastly increased amounts of data and knowledge on the Internet. Open sourcing has made its mark in the software side of the business world. Just as has open access publishing in Academia. Society as a whole has gained by all these manifestations of open culture.

And today, we are gathered here to begin thinking on the directions for the future of the Wikimedia movement in India.

What does this mean in our case? India is a country of many languages, dialects, people, communities, religions, tribes. Along with this are the collective efforts of 1.3 billion people to make a secular, democratic, economically strong nation. The ability to share learning, understanding, experiences are key to this process. And for this, collaboration is a vital necessity.

As of now the Wikimedia effort in India consists of a potpourri of projects, encyclopedia, quote, text repository and the use of Wikimedia Commons as a media repository. We have to grow this into a large, useful and versatile resource in each of our Indic languages.

The Wikimedians, a small band of volunteers to date, must take along the entire society of India so that we have betterment as a nation by first creating and using these resources. And today’s conclave with kindred souls from society, academia, industry.. is a beginning in this regard.

Now we are here to think what directions this Movement must take. I am envious that I can’t be part of this process with you. However, as a retired military person, let me say a few words on strategy and how it is decided.

All planning occurs at three levels. The most basic of activities to be done are referred to as tactics. Tactics are governed by operational planning which comprises of a worked out plan of how to achieve the overall plan or the goal.

The deciding of this overall plan or goal is referred to as strategy.

To be more specific..

“a high level plan to achieve one or more goals under conditions of uncertainty..”

And when we do this for a long period of the future, it is more appropriately termed as ‘grand strategy".

For this we have to ponder - What is our aim? What are our strengths? What are our challenges? What are our opportunities? What are our resources and what are our constraints? What path should we take to achieve our aim?

These are to be reduced into a few directions which are broad based, actionable and full of potential. A good strategy must open huge opportunities, new fields, new possibilities.

The is not easy to do or quick to make. It will take more than one session, more than one day, week or even a month to get our strategy right.

Most important of all is that we learn to think in the new paradigm of sharing and open culture. We should leave behind the mindset of scarcity, possessiveness and personal benefit and embrace the values of the common good, creation of opportunities and innovation.

On our success in making a good strategy, depends the fate of millions of our children and youth who will either benefit from our decisions or lose opportunities if we are not wise and generous. We have to believe in the future. We have to want to make that future great for our nation.

I wish you the very best in this endeavour. I repeat, that I am envious that I can't be with you today. I pray that the things we decide from today onward in this process of grand strategy for the Wikimedia movement in the decades to come.

At the very end, I would like to thank the Wikimedia movement in India, CIS-India, the organisers of this salon and of course, my young friend Krishna Chaitanya Velaga for this opportunity.

A paper titled Patent Working Requirements and Complex Products: An Empirical Assessment of India's Form 27 Practice and Compliance authored by Prof. Jorge Contreras and Rohini Lakshané, published in July 2017 presents an analysis of the dataset.

The patents chosen to be included in this dataset are a subset of the patents found in another study by the same authors, Patents and Mobile Devices in India: An Empirical Survey [PDF]. The dataset for the patent landscaping study is available under the CC-BY-SA 4.0 license.

Wikipedia Workshop on Template Creation and Modification Conducted in Bengaluru

A Wikipedia workshop on template creation, modification was conducted in Bengaluru on 30 July 2017. Here is a report.

A Wikipedia workshop on template creation, modification was conducted in Bengaluru on 30 July 2017. 9 Wikipedians, mostly associated with Karavali Wikimedians and Kannada Wikimedia projects attended the workshop. A template is a Wikipedia page created to be included in other pages. Templates usually contain repetitive material that might need to show up on any number of articles or pages. They are commonly used for boilerplate messages, standard warnings or notices, infoboxes, navigational boxes and similar purposes.¹ The workshop was requested by Kannada Wikimedians.

The workshop started with explaining template and its importance. This was followed by discussing structure of a template, and creation of a simple template with a couple of variables. This activity continued for sometime, and designing a template with CSS markup was shown. Following this different types of templates such as infobox, navbox, sidebar, informational templates such as Hatnote were shown and discussed. On Wikipedia there is a Special page with a list of wanted templates. The participants studied the page and started making a list of templates they should create or improve. It was found that a good number of templates on Kannada Wikipedia don't have proper documentation in native languages. The participants came to a conclusion that attempts should be made to properly localize the template. During the workshop the participants spent sometime to translate and localize some template documentations.

The workshop was a preliminary one in nature and should be followed up by an advanced workshop.

RCEP IP Chapter: A Serious Threat to Access to Knowledge/ Cultural Goods?

Negotiators from sixteen countries are currently meeting in Hyderabad for discussing a free trade agreement titled Regional Comprehensive Economic Partnership (RCEP).

The blog post was published by Live Law.in on July 27, 2017.

Looking at the latest available IP chapter (leak dated October 15, 2015), RCEP stands to adversely affect nearly half of the world’s population on areas like access to knowledge and access to medicines. We would like to highlight five issues related to access to knowledge/ cultural goods, based on the leaked IP chapter.

Clear neglect of users’ rights

As different scholars and courts have tried to point out, copyright is not just about the rights of creators, but also those of users. The agreement will hurt this balance embedded in our copyright law. The balance within the copyright system is ensured by a set of limitations and exceptions which permit free uses for purposes like education, research, etc., thereby serving interests of students,researchers, educators, computer programmers, and persons with disabilities. Studies have also pointed out that industries that depend on limitations and exceptions also contribute substantially to economic growth. For example a recent study (by Computer and Communications Industry Association) in the US found that companies that extensively rely on limitations and exceptions, like media device manufacturers, software developers, internet search and web-hosting providers, and educational institutions, represent one-sixth of the US GDP. Thus, it follows that when countries revise their copyright legislations they should make sure that it fairly benefits right holders as well as users, and not just benefit right holders at the expense of the users which is what is transpiring at RCEP. The language of the agreement indicates that while it is mandatory for countries to increase protection for right holders, a commitment to restore balance via limitations and exceptions is only optional or worse, absent.

Broadcasters' Rights

The provisions regarding broadcasters’ rights also pose many concerns. First, RCEP engages in term extension without providing any economic rationale. The minimum term of protection stipulated under the Rome Treaty of 1961 (the major multilateral treaty in this area) is 20 years and India provides a term of 25 years for broadcasters rights.

The attempts to increase the term of protection to 50 years through RCEP, without conducting any impact assessment of the term extension on access to knowledge and cultural goods, is against public interest. Second, WIPO has been attempting to evolve a multilateral treaty on broadcasters’ rights for the last two decades and one of the major stumbling blocks in this regard is the lack of consensus among member states on what should be protected under the ‘broadcasters’ rights’ for purposes such as educational uses and private uses. RCEP provisions on broadcasters’ rights have conveniently ignored such exceptions and this again illustrates that the focus of RCEP is only on protecting the rightholders and not that of users.

Copyright enforcement

Many of the enforcement related provisions are as problematic. This includes proposals for taking into consideration suggested retail price (SRP) or market value of goods for valuation of the infringing goods as well as for making available pre-determined damages for copyright violations on the election of the right holder. In jurisdictions like the US, this has resulted in local courts being forced to grant millions in damages for even minor copyright infringements. It is also important to mention here that some of the enforcement related provisions can also result in serious privacy violations. This includes the suggestion for adding obligations on internet service providers to disclose to the rightholders the identity of users suspected to be engaging in infringing activities.

Ensuring transparency and accountability

The most troubling aspect of RCEP is that all the negotiations are being conducted in utmost secrecy without any public participation. Though the negotiators have already completed eighteen rounds of discussion, the negotiating text hasn’t been released officially and neither been a subject of parliamentary discussion nor public consultation. The public has a right to know what is being negotiated on their behalf and countries like India must take steps to release the negotiation text without any further delay. It is important to note that all these TRIPS-plus measures are being suggested without any consideration for the potential negative consequences on the society and therefore India must resist these TRIPS-plus provisions.

Marathi Wikipedia Workshop in Sangli, Maharashtra

A Marathi Wikipedia workshop was recently held in Sangli, Maharashtra

An introductory Marathi Wikipedia workshop was recently held at CSIBER Trust's V.P. Institute of Management Studies and Research, Sangli, Maharashtra. The workshop aimed to introduce Wikipedia and its sister projects to the participants.

In an effort to implement innovative projects for the students, in March 2017, the institution decided to integrate Wikimedia Projects and academic assignments for capacity building of students and faculty. The implementation started with the Wikipedia edit-a-thon on Environment Management at CSIBER Institute in Kolhapur on 30th March. The Institute in Sangli has also adopted the concept for this academic year. This workshop was organised for faculty and selected students who were taught basic editing skills on Wikipedia, searching for the concerned articles, categorisation and translation from other language wikis. Another focus of the workshop was to integrate academic assignments with Wikimedia projects.

In an article published in the Huffington Post on July 1, 2017, Nirmita Narasimhan stated that imposing taxes on assistive devices is unfair. It is unconscionable that disability aids and assistive technology are considered a luxury and taxed at a higher rate than rough semi-precious stones or cashew nuts. A research paper on patent working requirements and complex products in India authored by Prof Jorge L. Contreras, University of Utah, and Rohini Lakshané, CIS has been accepted for publication in the Jindal Global Law School Law Review 2017. Negotiators from 16 countries met in Hyderabad for discussing a free trade agreement titled Regional Comprehensive Economic Partnership. Anubha Sinha along with Arul George Scaria reported this in an article published by Live Law.in. Supreme Court of India while dismissing an appeal by the Indian Reprographic Rights Organization ruled that there was no copyright infringement and no licence was required since the activities fell under the education exception in Indian copyright law. In an article published by EIFL, Anubha Sinha discusses the judgment and what it means for access to educational materials in India. Odia Wikipedians, in conjunction with Indian Athletics Federation and Sports and Youth Services collaborated to document the 2017 Asian Athletics Championships. Hundreds of photos were uploaded and new Wikipedia content added to inform the event’s fans, wrote Sailesh Patnaik and Jnanaranjan Sahu in a blog post. As recently as May 27, 2016, the General Data Protection Regulation (REGULATION (EU) 2016/679 was adopted The Data Protection Directive (1995/46/EC) will be replaced by this Regulation. It is expected that under this Regulation data privacy will be strengthened. Aditi Chaturvedi analyses the developments in a report.

19th RCEP Meeting

Anubha Sinha participated in the 19th RCEP Meeting organized by the Ministry of Commerce, Government of India in Hyderabad between July 17 to July 28, 2017.

The 19th round of the Regional Comprehensive Economic Partnership (RCEP) Trade Negotiating Committee (TNC) meetings and other related meetings were held from 17 to 28 July 2017 in Hyderabad, India. RCEP is a proposed comprehensive regional economic integration agreement amongst the 10-ASEAN countries (Brunei Darussalam, Cambodia, Indonesia, Laos, Malaysia, Myanmar, Philippines, Singapore, Thailand, and Vietnam) and its six Free Trade Agreements (FTAs) partners, viz. Australia, New Zealand, Japan, China, Korea and India.

During the 19th round, parallel meetings were held by the three main Working Groups on Trade in Goods, Trade in Services and Investment, including their respective Sub-Working Groups. Working Groups in other areas like Intellectual Property, electronic commerce, Legal and Institutional Issues etc. also had their meetings.

The Meeting was inaugurated by Ms. Rita Teaotia, Secretary, Department of Commerce, Government of India on 24 July 2017. The Secretary mentioned that it is important that RCEP offers a positive and forward looking alternative in the face of growing protectionism across the world. The Secretary further highlighted that while RCEP is a beacon of hope for free trade, its real success will be measured by its ability to bring prosperity, economic growth, decent living standards, creation of jobs and greater business opportunities for the people of the region, in an equitable manner. The Secretary reiterated the importance of being guided by the Guiding Principles and Objectives for Negotiating the
RCEP, for direction and assessing whether we are pursuing the balanced and commercially meaningful ambition it envisages. She mentioned that keeping this larger picture in view, India is constructively engaged in RCEP and hopes that the 19th RCEP Round in Hyderabad would find innovative ways to provide impetus to the negotiations.

During the 19th round, a set of key elements for significant outcomes, envisaged to be achieved by the end of 2017, were agreed. The Meeting also highlighted the need to have balanced discussions to progress negotiation across all areas, and to continue to deliver outcomes.

During the meeting, all RCEP Participating Countries (RPCs) agreed that a good RCEP agreement has immense potential to deliver on new economic opportunities including job creation that are much needed in today’s world of uncertainty. The Meeting expressed shared commitment to work collectively and in a cooperative manner, to progress the negotiations in an accelerated way, and achieve a modern, comprehensive, high-quality and mutually beneficial agreement that addresses and balances the aspirations and sensitivities of participating countries.

On the sidelines of RCEP, two Stakeholder events – with Business Stakeholders and Civil Society Organizations (CSOs), were held to obtain feedback on the expectations and sensitivities of stakeholders from participating Countries. The CSO engagement was held with participation from over 28 international, regional and local CSOs. The RCEP Business Stakeholders’ Consultations were jointly organized by the Confederation of Indian Industries (CII) and the East Asia Business Council (EABC).

Telugu Wikisource Workshop

Recently, a Telugu Wikisource Workshop was conducted in Hyderabad between 22- 23 July, 2017

An introductory Wikisource workshop was recently held for Telugu Wikipedians in Hyderabad. This event was held in conjunction with the NTR Trust, an organisation working towards socio-economic change in Andhra Pradesh and Telangana.

Wikisource aims to build a library of source texts as well as translations. The workshop held between 22- 23 July was conducted for both existing Wikimedians and those new to the movement. Prior to the workshop, Telugu Wikipedians were consulted and were asked to take part in the event and provide their support. The participants were taught the basics of Wikisource and encouraged to contribute to it. They were given a tutorial on the entire process from uploading the book to completing it as an eBook. They were taught important aspects such as copyright, Creative Commons licenses as this would help them select books to upload on Wikisource.

Says participant Sri Ramamurthy "I am contributing to Telugu Wikisource for a long time, regularly. I could learn how to do some important aspects of Telugu Wikisource like indexing a book and techniques like OCR in this event. This turned out to be a very useful event. As resource persons are from Telugu language and sessions were in Telugu, I could easily and quickly grasp things."

Ten index pages were created during the event and 193 pages were uploaded onto Telugu Wikisource after the event. The event had only two female participants and eight male participants. CIS-A2K hopes to make more of a concerted effort to bridge this gap in participation between males and females.

Patent Working Requirements and Complex Products: An Empirical Assessment of India's Form 27 Practice and Compliance

India requires every patentee to file an annual statement, also known as “Form 27”, describing the working of each of its issued Indian patents. If a patent is not locally worked within three years of its issuance, any person may request a compulsory license, and if the patent is not adequately worked within two years of the grant of such a compulsory license, it may be revoked. The potency of India’s patent working requirement was demonstrated by the 2012 issuance of a compulsory license for Bayer’s patented drug Nexavar. In order to provide the public with information about patent working, India requires every patentee to file an annual statement on “Form 27” describing the working of each of its issued Indian patents.

We conducted the first comprehensive and systematic study of all Forms 27 filed with respect to a key industry sector: mobile devices. We obtained from public online records 4,916 valid Forms 27, corresponding to 3,126 mobile device patents. These represented only 20.1% of all Forms 27 that should have been filed and corresponded to only 72.5% of all mobile device patents for which Forms 27 should have been filed. Forms 27 were missing for almost all patentees, and even among Forms 27 that were obtained, almost none contained useful information regarding the working of the subject patents or fully complying with the informational requirements of the Indian Patent Rules. Patentees adopted drastically different positions regarding the definition of patent working, while several significant patentees claimed that they or their patent portfolios were simply too large to enable the reporting of required information. Many patentees simply omitted required descriptive information from their Forms without explanation.

The Indian government has made little or no effort to monitor or police compliance with Form 27 filings, undoubtedly leading to significant non-compliance. However, some of the complaints raised by patentees and industry observers may have merit. Namely, that patents covering complex, multi-component products that embody dozens of technical standards and thousands of patents are not necessarily amenable to the individual-level data requested by Form 27. We hope that this study will contribute to the ongoing conversation in India regarding the most appropriate means for collecting and disseminating information regarding the working of patents.
