Highlights
Elonnai Hickok wrote a blog post which provided a high level comparison of the 2017 and 2015 DNA Profiling Bill - calling out positive changes, remaining issues, and missing provisions. Rohini Lakshane wrote a blog post on dataset for patent requirements and complex products. The dataset has been released under the Creative Commons-Attribution-Share Alike 4.0 License. A Marathi Wikipedia workshop was held in Sangli, Maharashtra. Subodh Kulkarni shared the developments in a blog post. In an emphatic endorsement of the right to privacy, a nine judge constitutional bench unanimously upheld a fundamental right to privacy. The events leading to this bench began during the hearings in the ongoing Aadhaar case, when in August 2015, Mukul Rohatgi, the then Attorney General stated that there is no constitutionally guaranteed right to privacy. CIS gave its statement on right to privacy judgment.

Access to Knowledge

Our Access to Knowledge programme currently consists of two projects. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

As part of the project grant from the Wikimedia Foundation we have reached out to more than 3500 people across India by organizing more than 100 outreach events and catalysed the release of encyclopaedic and other content under the Creative Commons (CC-BY-3.0) license in four Indian languages (21 books in Telugu, 13 in Odia, 4 volumes of encyclopaedia in Konkani and 6 volumes in Kannada, and 1 book on Odia language history in English).

Internet Governance

As part of its research on privacy and free speech, CIS is engaged with two different projects. The first one (under a grant from Privacy International and IDRC) is on surveillance and freedom of expression (SAFEGUARDS). The second one (under a grant from MacArthur Foundation) is on restrictions that the Indian government has placed on freedom of expression online.

Highlights

Researchers at Work programme has published a book titled Digital Activism in Asia Reader exploring in detail digital activism in Asia. The Reader was edited by Nishant Shah, P.P. Sneha, and Sumandro Chattapadhyay with support from Anirudh Sridhar, Denisse Albornoz, and Verena Getahun. The pre-publication drafts of two sections written by Sumandro Chattapadhyay for the third volume (2000-2010) of the Asia Internet History series edited by Prof. Kilnam Chon have been posted for open-review process. As part of the 'Studying Internets in India' series, RAW published blog entries on Governing Speech on the Internet and Mock-Calling - Ironies of Outsourcing and the Aspirations of an Individual. NVDA team conducted a workshop at Jeevan Jyoti School for the Blind, Varanasi from August 26 to 28, 2015. Eighty five students and 13 teachers took part in the training programme. NVDA team had conducted another workshop earlier in Nashik. The workshop was conducted in June. A batch of 17 Special Educators and teachers of the blind attended the workshop. Maggie Huang, Arpita Sengupta and Paavni Anand as part of the Pervasive Technologies project co-authored a research paper that seeks to compare the publicly available information on the websites of music collective management organizations ("CMOs") operating within India, the United States, and the United Kingdom. Amulya Purushothama, Nehaa Chaudhari and Varun Baliga in a blog entry have delved into the question of what the mandate of the Sectoral Innovation Council is, what its activities are, and what vision for IPR development in India has it put forth. An RTI Application has been filed by CIS to attain information on these issues. In a blog post, Amulya Purushothama announced our new MHRD IPR Chair Series and has charted the sequence of events, starting from the establishment of MHRD IPR Chairs, to discussions surrounding their purpose and functioning, to concerns surrounding the lack of information about the IPR Chairs, the first round of RTIs that CIS had filed in regard to this and the responses it solicited. Subhashish Panigrahi interviewed Prateek Pattanaik. Prateek has not just digitized as many as 54 Odia-language poetry dating early 18th century but has also annotated, both poetic and prosaic translation in his blogs "Sri Jagannatha" and "Utkal Sangeet". He has also published a complete book "Kisora chandranana champu" on Odia Wikisource. A recent entrant into the Odia Wikimedia community, Prateek is also the youngest Odia Wikimedian. Rohan George and Elonnai Hickok in a blog post analyzed consent, big data and data protection that examines in detail why the principle of consent is providing us increasingly less of an aegis in protecting our data. Elonnai Hickok, Vipul Kharbanda and Vanya Rakesh on behalf of CIS submitted a clause-by-clause comments on the Human DNA Profiling Bill that was circulated by the Department of Biotechnology on June 9, 2015. Sunil Abraham, Elonnai Hickok and Tarun Krishnakumar co-authored an article titled Security: Privacy, Transparency and Technology. The article was published by Observer Research Foundation, Digital Debates 2015: CyFy Journal Volume 2. Elonnai Hickok in a blog post titled A Review of the Policy Debate around Big Data and Internet of Things has done an analysis as to how regulators and experts across jurisdictions are reacting to Big Data and Internet of Things. The Supreme Court of India has deemed it fit to refer the question of the very existence of a fundamental right to privacy to a Constitution Bench to finally decide the matter, and define the contours of such right if it does exist. Vipul Kharbanda analyses this in a blog entry. Experts and regulators across jurisdictions are examining the impact of Big Data practices on traditional data protection standards and principles. This will be a useful and pertinent exercise for India to undertake as the government and the private and public sectors begin to incorporate and rely on the use of Big Data in decision making processes and organizational operations. Elonnai Hickok has provided an initial evaluation of how Big Data could impact India's current data protection standards. Elonnai Hickok has provided a comparison of Human DNA Profiling Bill 2012 vs. the Human DNA Profiling Bill 2015, CIS's main recommendations vs. the 2015 Bill, Sub-Committee Recommendations vs. the 2015 Bill, and the Expert Committee Recommendations vs. the 2015 Bill. CIS submitted its comments to the non-paper on the UNGA Overall Review of the Implementation of the WSIS outcomes, evaluating the progress made and challenges ahead. In a policy brief, Vipul Kharbanda has analyzed the different laws regulating surveillance at the state and central level in India and calls out ways in which the provisions are unharmonized. The brief then provides recommendations for the harmonization of surveillance law in India. Hardnews interviewed Sunil Abraham about the future of the internet in India. The article was published in their August edition. Shyam Ponappa in an Op-ed published by Business Standard has given an analysis on the reasons of the number of dropped calls on our mobile phones.

Accessibility and Inclusion

Under a grant from the Hans Foundation we are doing a project on developing text-to-speech software for 15 Indian languages. The progress made so far in the project can be accessed here. The project on creating a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India got over and the compilation has been printed.

Highlights

CIS published a policy guide on Privacy in Healthcare that seeks to understand the legal regulations governing data flow in the health sector - particularly hospitals, and how these regulations are implemented.
Nehaa Chaudhari wrote two articles on the Karnataka Goondas Act in Spicy IP. The first one is an overview on the various provisions of the law and discusses the potential impact of the amendment . The second one is a note on legislative competence .

Andhra Loyola College and CIS entered into a memorandum of understanding (MoU) to steward the growth of Telugu Wikipedia and to make available free knowledge in Telugu to all Telugus across the globe.
In July 2014, the Department of Biotechnology and the Department of Science, Ministry of Science and Technology, Government of India released a draft Open Access Policy. CIS participated in discussions along with experts brought on board by the Drafting Committee to develop and review the open access policy. As a follow-up, CIS prepared comments to the draft Policy .

Anandini K. Rathore wrote a report on the second privacy and surveillance roundtable held in New Delhi at the India International Centre on July 4, 2014.
As part of its project on mapping cyber security experts in Asia with funding from Citizen's Lab, CIS interviewed Tibetan monkGyanak Tsering and Saumil Shah, security expert.

Published a white paper on content removal best practices and put it up for feedback. The draft paper has been created to frame the discussion towards the creation of a set of principles for intermediary liability in consultation with groups of Internet-focused NGOs and the academic community.
Shyam Ponappa's monthly column Transformation, or Drift? published in Business Standard and Organizing India Blogspot was mirrored on the CIS website.
P.P. Sneha blogged on the emergence of the phenomenon of the alt-academy in the West and the nuances and possibilities of such a space in the Indian context .

Accessibility and Inclusion

Under a grant from the Hans Foundation we are doing two projects. The first project is on creating a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India. CIS in partnership with CLPR (Centre for Law and Policy Research) compiled the National Compendium of Policies, Programmes and Schemes for Persons with Disabilities (29 states and 6 union territories). The updated draft is being reviewed by the Office of the Chief Commissioner for Persons with Disabilities. The draft chapters and the quarterly reports can be accessed on the project page. The second project is on developing text-to-speech software for 15 Indian languages. The progress made so far in the project can be accessed here.

Welcome to the newsletter issue of August 2012 from the Centre for Internet & Society (CIS). The present issue features an analysis of the latest list of sites blocked by the Indian government from August 18, 2012 to August 21, 2012, the India Report for Consumers International IP Watchlist 2012, and press coverage related to the recent North East exodus.

Analysing Latest List of Blocked Sites (Communalism & Rioting Edition) (by Pranesh Prakash): Pranesh Prakash did a preliminary analysis on a leaked list of the websites blocked from August 18, 2012 till August 21, 2012 by the Indian government. There were a total of 309 specific items (those being URLs, Twitter accounts, img tags, blog posts, blogs, and a handful of websites) that were blocked. Telecom

While the potential for growth and returns exist for telecommunications in India, a range of issues need to be addressed. One aspect is more extensive rural coverage and the other is a countrywide access to broadband which is low. Both require effective and efficient use of networks and resources, including spectrum:

Building Knowledge and Capacity around Telecommunication Policy in India

Ford Foundation has given a grant of USD 2,00,000 to CIS to build expertise in the area of telecommunications in India. The knowledge repository deals with these modules: Introduction to Telecommunications, Telecommunications Infrastructure and Technologies, Government of India Regulatory Framework for Telecom, Telecommunication and the Market, Universal Access and Accessibility, The International Telecommunications Union and other international bodies, Broadcasting, Emerging Topics and Way Forward. Dr. Surendra Pal, Satya N Gupta, Paranjoy Guha Thakurta, Payal Malik, Dr. Rakesh Mehrotra and Dr. Nadeem Akhtar are the expert reviewers.

The following are the new outputs:

Auctioning and Allocation of Spectrum (by Snehashish Ghosh): Auction of spectrums was introduced in the telecommunication market after the failure of the administrative process of allocating spectrum. Auctions use a price mechanism to allocate spectrum. Auction of spectrum can be used to increase efficiency and earn maximum revenue.
The Telecom Regulatory Authority of India Act, 1997 (by Snehashish Ghosh): The main objective of the TRAI Act was to establish the TRAI and the Telecom Dispute Settlement Appellate Tribunal. Snehashish also touches upon the amendment to the TRAI Act, government control over TRAI, scheme of the TRAI Act, constitution of TRAI, its powers and functions, grounds and procedures for appeal to the tribunal, etc.
Broadband Wireless Access – Standards (by Jürgen Kock): Jürgen tells us about the broadband wireless access standards, why we need technical standards, who define BWA standards, WiMAX standards and long term evolution.
Mesh Networks (by Ravikiran Annaswamy): Ravikiran tells us the definition of Mesh Networks, its importance, applications and the things to explore in future.
National Telecom Policy, 2012 (by Snehashish Ghosh): The National Telecom Policy, 2012 was approved by the Union Cabinet on May 31, 2012. Snehashish tells us about the vision of the National Telecom Policy, 2012, its background, the strategies (broadband rural telephony and universal service obligation fund), licensing, convergence and value-added services, spectrum management, etc.
New Telecom Policy, 1999 (by Snehashish Ghosh): The New Telecom Policy, 1999 was formulated on the basis of the report of Group on Telecommunication. In this unit, Snehashish talks about the objectives of the Policy, its targets, the new category of service providers, role of the regulator, other mandates to the Policy, amendment to the New Telecom Policy, 1999, etc.
National Telecom Policy, 1994 (by Snehashish Ghosh): The National Telecom Policy, 1994 was formulated for the purpose of opening up the Indian markets for foreign direct investment as well as domestic investment in the telecom sector. Snehashish throws light on the objectives of the National Telecom Policy, 1994, the status of telecom services prior to the implementation of the aforesaid Policy; value added services, hardware and technological aspects, basic services, and outcomes of the National Telecom Policy.

Key Research

Consumers International IP Watchlist 2012 — India Report (by Pranesh Prakash): The India Report for Consumers International IP Watchlist 2012 was published on the A2K Network website. According to the report, India's Copyright Act is a relatively balanced instrument that recognises the interests of consumers through its broad private use exception, and by facilitating the compulsory licensing of works that would otherwise be unavailable. However, the compulsory licensing provision have not been utilized so far, because of both a lack of knowledge and more importantly because of the stringent conditions attached to them.

Copyright Law: More Than a Moral Obligation (by Jaya Bhattacharji Rose, Businessworld, August 9, 2012): “So far, things have worked well because sepia-tinted photographs have generally become part of the public domain. But now, only photographs by photographers who died before 1951 are part of the public domain. This has shrivelled up the public domain in photographs since it is even more difficult to trace the photographer...than to estimate the age of a photograph, determining whether a photograph is in the public domain is laden with uncertainty. Ring Side View: Update on WIPO Negotiations on the Treaty for the Visually Impaired (by Rahul Cherian): As the negotiations between Member States progressed it became clear that the United States and the European Union were blocking the Treaty while everybody else was pushing hard for the Treaty. The United States and the European Union were pushing for some form of non-binding instrument that would be more in the nature of a recommendation. Programme Director – Access to Knowledge: CIS is seeking a Programme Director for its New Delhi office. The Programme Director will manage CIS’s Access to Knowledge programme which is funded by the Wikimedia Foundation, to support the growth of Wikipedia and its sister projects and to advance access to free knowledge in India. The Programme Director will partner with the large Wikimedia community in India to focus on Indic and English languages and will manage a team of four staff members.
Programme Officer – Internet Governance: CIS is seeking an individual with a strong background in legal research and policy work to be part of its internet governance (IG) programme. The candidates must have good knowledge of Indian and international law on freedom of expression and privacy, demonstrable research skills, have strong communication skills and be media savvy with the ability to convey complex legal issues clearly to a general audience, open to travel and work independently.

Digital Natives with a Cause?

Digital Natives with a Cause? is a knowledge programme initiated by CIS and Hivos, Netherlands. It is a research inquiry that seeks to look at the changing landscape of social change and political participation and the role that young people play through digital and Internet technologies, in emerging information societies. Consolidating knowledge from Asia, Africa and Latin America, it builds a global network of knowledge partners who want to critically engage with the dominant discourse on youth, technology and social change, in order to look at the alternative practices and ideas in the Global South. It also aims at building new ecologies that amplify and augment the interventions and actions of the digitally young as they shape our futures.

Accessibility

Estimates of the percentage of the world's population that is disabled vary considerably. But what is certain is that if we count functional disability, then a large proportion of the world's population is disabled in one way or another. At CIS we work to ensure that the digital technologies, which empower disabled people and provide them with independence, are allowed to do so in practice and by the law. To this end, we support web accessibility guidelines, and change in copyright laws that currently disempower the persons with disabilities.

Internet Governance

Although there may not be one centralized authority that rules the Internet, the Internet does not just run by its own volition: for it to operate in a stable and reliable manner, there needs to be in place infrastructure, a functional domain name system, ways to curtail cyber crime across borders, etc. The Tunis Agenda of the second World Summit on the Information Society (WSIS), paragraph 34 defined Internet governance as “the development and application by governments, the private sector and civil society, in their respective roles, of shared principles, norms, rules, decision-making procedures, and programmes that shape the evolution and use of the Internet.” Its latest endeavour has resulted into these:

Public Lecture

The Mirror in the Enigma: How Germany lost World War II to a Mathematical Theorem (Rohit Gupta gave a lecture at CIS on August 12, 2011).

CIS is doing a project, ‘Privacy in Asia’. It is funded by Privacy International (PI), UK and the International Development Research Centre, Canada and is being administered in collaboration with the Society and Action Group, Gurgaon. The two-year project commenced on 24 March 2010 and will be completed as agreed to by the stakeholders. It was set up with the objective of raising awareness, sparking civil action and promoting democratic dialogue around challenges and violations of privacy in India. In furtherance of these goals it aims to draft and promote over-arching privacy legislation in India by drawing upon legal and academic resources and consultations with the public.

Political is as Political does
The Talking Back workshop has been an extraordinary experience for me. The questions that I posed for others attending the workshop have hounded me as they went through the course of discussion, analysis and dissection. Strange nuances have emerged, certain presumptions have been questioned, new legacies have been discovered, novel ideas are still playing ping-pong in my mind, and a strange restless excitement – the kind that keeps me awake till dawning morn – has taken over me, as I try and figure out the wherefore and howfore of things. I began the research project on Digital Natives in a condition of not knowing, almost two years ago. Since then, I have taken many detours, rambled on strange paths, discovered unknown territories and reached a mile-stone where I still don’t know, but don’t know what I don’t know, and that is a good beginning.

Civil Liberties and the amended Information Technology Act, 2000
This post examines certain limitations of the Information Technology Act, 2000 (as amended in 2008). Malavika Jayaram points out the fact that when most countries of the world are adopting plain English instead of the conventional legal terminology for better understanding, India seems to be stuck in the old-fashioned method thereby, struggling to maintain a balance between clarity and flexibility in drafting its laws. The present Act, she says, is although an improvement over the old Act and seeks to address and improve on certain areas in the right direction but still comes up short in making necessary changes when it comes to fundamental rights and personal liberties. The new Act retains elements from the previous one making it an abnormal document and this could have been averted if there had been some attention to detail.

At WIPO, Study On Copyright Exceptions Stimulates Broad Discussion With Author

During the recent meeting of the World Intellectual Property Organization copyright committee, a study was presented on exceptions and limitations to copyright for libraries and archives at the national level. The presentation spurred a full day of discussion about how to ensure libraries can continue to provide an indispensable service, and a substantive exchange with the author.

The 29th session of the Standing Committee on Copyright and Related Rights (SCCR) took place from 8-12 December.

On 10 December, Kenneth Crews, former director of the copyright advisory office at Columbia University and now in the private sector, presented an update [pdf] of his 2008 WIPO-commissioned study on Copyright Limitations and Exceptions for Libraries and Archives (IPW, WIPO, 12 December 2014).

The study provided safe ground for broad discussions on the sensitive issue of exceptions and limitations, and the role of WIPO in the issue, with a large number of countries taking the floor to offer comments on the study and its findings, providing specific details on their own legislation and/or asking questions.

Harmonisation

Mexico, for example, asked whether there was a general movement leading to a harmonisation exercise in international copyright law.

Crews answered there was no movement toward an era of harmonisation, but harmonisation could be an answer in the field of limitations and exceptions if it left sufficient policy space to countries.

On the one hand, he said, “there is virtue in harmonisation, in allowing for the predictability of the law … as your business activities move from one country to another.” It makes the law easier to understand, and easier to address some of the issues of cross-border exchange..,” he said.

But the major disadvantage of harmonisation would be the loss of opportunity for countries to “experiment, test new ideas in lawmaking, and to move in some new directions,” he added.

Maybe the answer lies in the middle, said Crews: harmonise the law to a certain extent, “and then leave some of the details to individual countries.”

The European Union delegate remarked that even in an integrated legal system such as the EU, very few exceptions to copyright are mandatory for EU members. Member states “remain free to implement most of the exceptions in the EU legislation in their national systems,” he said.

Implementation Issues

Tunisia stressed the issue of the implementation of copyright exceptions and limitations in developing countries, particularly for libraries. Libraries often are “fearful of the complications,” referring to the exceptions and limitations legislation, and simply do not use it, preferring “what is possible and available,” he said

Crews said it is important to find “the right formula” for drafting a statute that is detailed enough that users are law-abiding citizens, “and at the same time not be so complicated in the structure of the law that it is difficult or impractical for most – even trained professionals – to follow.”

Cross-Border Exchange, TPMs

Brazil said the study sheds light on certain areas where further cooperation would be welcome. The Brazilian delegate said this cooperation could take into account the dynamic evolution of digital technologies and the “growing cross-border cooperation among libraries and archives.”

The delegate said some factors pose concrete problems for cross-border cooperation, such as the fact that some 33 WIPO members do not provide exceptions for libraries, and a higher number of countries do not provide exceptions and limitations that “could be deemed adequate” to address the new challenges created by the digital environment, and limitations and exceptions provided by national legislation vary deeply from country to country.

Now that the research has started with the 2008 report has been updated, we can see that from the universe of the WIPO membership 33 countries still do not provide limitations and exceptions for libraries and archives in their national legislation. A even greater number of WIPO members do not seem to provide limitations and exceptions that could be deemed adequate in order to address the new challenges libraries and archives increasingly face with the emergence of the digital environment

He also said the study states that technological protection measures (TPM) can have a negative impact on countries’ ability to “legitimately implement exceptions and limitations,” which is a “growing concern as countries seek to better regulate and avoid abuses in the use of TPMs.”

Crews said the issue of cross-border activity and the difficulty in cooperation between countries induced by the difference in laws is perhaps one of the most important that WIPO could address. Part of the solution to that problem might be a trusted third party facilitating the transfer of copyrighted works, he said. A sharing of resources should be allowed while protecting the interest of right-holders, he said, “so that they can participate in this and encourage this activity as well.”

Many developing countries keep insisting that the major issue for libraries and archives is the digital era. The digital revolution “has barely begun,” Crews said. “The transformation of technology and the way we communicate and the way we share information is only beginning, so it is important not to prescribe exact details, but … to take some steps to open up the issue,” he said.

Chile also underlined the fact that the study showed a low number of countries providing exceptions for interlibrary loans.

According to Crews, using licences for cross-border activities is limited to the countries which the licence covers. The risks of having licences as a solution to cross-border exchange is that “it leaves the terms to private negotiations,” and many countries might not have laws on licensing.

Licensing Agreements

Sweden said the country has a dual system: “traditional limitations” in the law or preservation and replacement, for example, and a licensing agreement system. The two systems run side-by-side smoothly, he said.

Crews said that the licensing agreement system is not adaptable to all countries. “There are many reasons why it has not been adopted” in some countries, he said, adding, “I would express some concern about requiring it as an international matter.”

The European Union said exceptions and limitations and licences often coexist well. Those licences are often collectively negotiated, said the EU delegate, and sometimes cover broader uses than the exceptions themselves.

Crews said conceptually in the law-making process, countries need to reckon with the relationship not only of the rights of owners and the public rights of use or the copyright exceptions, but also the role of licences, and should they be allowed to override an exception that is in the law.

“That is a tough question,” he said. “It not only goes to the balance of rights,” he added, but lawmakers should decide to what extent an agreement can impede the statute they have worked hard to develop.

Countries Provide Clarifications, New Legislations

Some countries provided clarifications or additions to the study. For example, Saudi Arabia, which was mentioned in the study as one of the countries with no exceptions and limitations, said the 1984 copyright law provides an exception in paragraph 3.

Ecuador said it is working on a substantial reform of its current intellectual property legislation, including exceptions and limitations for people with disabilities, teaching and educational institutions, and libraries and archives.

China said it is undergoing the third revision of its copyright law, and Thailand said in November it passed an amendment to its copyright law, on TPMs, and this amendment includes an exemption for the circumvention of TPM for libraries and archives, educational institutes, and public broadcasting organisations.

Crews said many countries, including the United States and those in the European Union, have exceptions for TPMs, with two basic procedures: an exception that allows the user to “do the act of circumventing the measures to access the content,” and a legal system that calls on the rights holder to provide the means to users to access the content.

The United States said the US Congress is currently reviewing elements of its domestic copyright law, including library-related exceptions and limitations.

In November, the Czech Republic introduced a new amendment to its copyright system, the delegate said, “and the amendment brought a new exception for libraries and archives and for other cultural and educational institutions and for public broadcasters,” enabling them to use orphan works existing in their collection, under specific terms and for certain specific uses.

NGO Questions and Comments

The representative of the Electronic Information for Libraries (eIFL) asked Crews how WIPO, as a United Nations agency with a commitment to enhance developing countries’ participation in the global innovation economy, could support countries to be at the forefront of digital developments. The representative also asked how libraries can accommodate their increasing need to send and receive information across border, within the realm of copyright law.

Many countries have either no exceptions, or have exceptions but very limited applications, which do not cover digital technology, Crews said, adding that WIPO is in a position to shape the next model.

The International Publishers Association said that legislation is one thing but to know whether they are implemented and how they work is another. The representative advised looking at what kind of practice, and also practical initiatives between stakeholders can solve issues at stake.

In many cases, the representative said, issues are solved by alternative means, citing collective licensing, but also solutions bringing together stakeholders, he said, which provide space and flexibility for adaptation and further change. On cross-border document delivery, he said, “It is not true that documents are not crossing continents or crossing borders.” He explained that there are many alternative ways of receiving content across borders.

Crews said he is supportive of alternatives outside of the law, however, they might not be optimal solutions, he said. In particular, it often takes no less time to develop those alternatives than writing law, he said. He added that those alternatives, such as licences, are available only with respect to certain types of works, whereas statues apply to all types of works.

“The private extra-legal systems are not going to solve all of the issues,” said Crews.

The International Federation of Library Associations and Institutions said the United Kingdom reform of its copyright law includes for the first time provisions that prevent contracts and licences from overriding the exceptions and limitations enjoyed by libraries and archives for non-commercial uses.

The Center for Internet and Society (India) asked about the interoperability of limitations and exceptions to allow for easier trans-boundary movement of works. Crews said the trans-border concept seldom appears in library exceptions. Trans-border sometimes is governed by copyright law and sometimes by some other part of national law, such as import and export, he said. Some degree of harmonisation can help with interoperability, he said.

In general terms, and following an intervention by the TransAtlantic Consumer Dialogue mentioning public involvement in the discussions, Crews said, “We are all copyright owners and we are all users of other people’s copyrights to some extent.”

The public does not realise that they are all owners and users of copyrighted works on a daily basis, he said, and they need to become participants in the process.

Knowledge Ecology International asked if the periodical revision of the Berne Convention’s standards for copyright exceptions, which ended in 1971, should be resumed. The KEI representative also asked whether the copyright three-step test contained in the World Trade Organization Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) applies to specific limitations and exceptions to remedies for infringement, in part III of TRIPS (Enforcement of Intellectual Property Rights).

Crews answered that the three-step test does not apply to the remedies, or other matters. The test is on “its own terms applicable to the limitations and exceptions,” he said.

On the revision on the Berne Convention, Crews said “the answer is yes” but it is a “bigger subject than we are convened here today to discuss.”

KEI also mentioned a Spanish tax which “apparently” is taken on snippets from news organisations and asked if this tax does not violate the two mandatory exceptions in the Berne Convention, which are news of the day, and quotations.

Crews said the issue might be about the interrelationship of copyright with other areas of the law. The Spanish tax mentioned might be relative to a tax law, he said.

At WIPO, Authors, Civil Society Watchful Of Rights For Broadcasters

Nongovernmental organisations attending the World Intellectual Property Organization copyright committee meeting which this week sought to breach differences on what a treaty protecting broadcasters should cover, expressed their views with some unusual coherence.

The WIPO Standing Committee on Copyright and Related Rights (SCCR) is meeting from 28 April to 2 May.

The SCCR heard NGO statements on broadcasting on the second day of the meeting. Representatives of libraries, commercial television, authors, recording industry, actors, musicians, rights management bodies, film producers, and civil society gave their perspectives. Most of them called for limitations on the rights the treaty is proposing to grant broadcasters.

Broadcasters Deny Risks, Ask for Protection against Pirates

Broadcasters’ organisations have contended that the treaty would respect authors’, performers’ and producers’ rights.

“All the right holders in the broadcast content automatically benefit from the broadcasters’ ability to take effective action against pirates,” says a document jointly written by several broadcasting organisations. “At the same time, content right holders are not refrained in exercising their own rights against third parties.”

The Association of Commercial Television (ACT) in Europe, which said it represents 33 media groups in Europe, both free-to-air channels and paying television channels, said a lot of members are simulcasting their signal on their website. All of their members, the representative said, are making their signal available to the public through catch-up television services. According to the database of the European Audiovisual Observatory, there are 1,132 catch-up television services in Europe, the representative added.

If those catch-up services were not to be protected by the treaty, it would be easy for pirates “to argue that they didn’t intercept the traditional signal but instead copied the on-demand signal of the broadcaster which would actually leave the broadcasters without any meaningful protection,” he said.

Authors Asks Recognition of Rights, Equitable Remuneration

But doubts are still out there. The International Confederation of Societies of Authors and Composers (CISAC) said royalties collected from broadcasters and other entities are major source of revenue for authors and the discussions on the broadcasters’ treaty was of key importance. CISAC represents 225 author societies which are referred to as collective management associations, from 120 countries.

“Protection for broadcasters should exist if and only if broadcasters themselves recognise and respect the rights of creators of the underlying content,” the CISAC representative said. The majority of royalties collected around the world on behalf of authors are collected for the communication to the public of their works, he said. Unfortunately, he added,” in a number of countries, authors still face reluctance from broadcasters to recognise authors’ rights and obtain licences for the content their transmit.” This is an issue that must be discussed in the context of any future broadcasters’ treaty, he said.

A strong statement was delivered by the representative of the International Federation of the Phonographic Industry (IFPI). One of the issues stemming from the discussions, he said, is the “inherent difficulties that arise when a broadcaster is given rights that seem to be very similar to the rights already enjoyed by those who created and own the rights to the content that they transmit.”

Beyond that issue, he said the federation’s concern “relates to certain rights for broadcasters that go beyond the rights enjoyed by those who create the content that is carried on broadcasters’ signals.”

IFPI asked that any broadcasting treaty considered by WIPO ensure that any grant of rights to broadcasters be made contingent upon respect and consideration for the rights and the interests of those whose content is carried on their signals. “It would be remarkable,” he said, “if a treaty for the protection of broadcasters gave broadcasters rights relating to musical recordings that are superior to the rights of those who create and produced those recordings. However, the current draft text threatens to do just that,” he added.

If the treaty gives broadcasters the right to prevent certain uses of their signals, he said, it should also “ensure that performers and producers of sound recordings enjoy either the right to prevent the use of their recordings by broadcasters or the right to equitable remuneration from broadcasters who use those recordings.”

Broadcasters Seen As Free Riders by Some

The IFPI representative also remarked on the 1996 WIPO Performances and Phonograms Treaty (WPPT), which he said gave the opportunity to countries to opt out of their obligation to give performers and producers of phonograms equitable remuneration from broadcasters. Later, the representative told Intellectual Property Watch that the United States and China had chosen to opt out.

“A treaty that requires signatories to give protection to broadcasters, while the same broadcasters could continue to broadcast recorded music without having to pay for that music or to obtain permission from those who own the rights in that music,” he said, “would be a treaty that condones misappropriation of creative content … for commercial gain, the very conduct that broadcasters purport to seek to curtail in pressing for a treaty.”

He later told Intellectual Property Watch that the committee should seek to address the loophole of the WPPT.

The International Federation of Actors said audiovisual work including feature films and television series add “great economic value” to the signal of broadcasters. Although sharing an interest in protecting the broadcasters’ signal, the representative said some of the proposals on the table go “beyond what we believe is necessary to protect a broadcast signal,” and blur the line between the protection of the signal and the protection of the content carried by that signal.

The International Federation of Musicians followed the same line and said it would be “incoherent” if broadcasting organisations were granted new rights by WIPO members “which violate those of the creators.”

“If piracy is the appropriation of a right from legitimate owners of that right, what are we seeing when broadcasters exploit musical recordings for which they make no payment to the performers or the producers of phonograms?” he asked.
According to the British Copyright Council, “an ability for a broadcasting organisation to prevent the misuse of its signal is … important for all rights holders who lie behind the authorisation of the signal.” But he also added that granting protection to broadcasters should also permit the underlying right owners “to continue to assert their own exclusive rights or their rights to equitable remuneration from broadcasters.”

The International Federation of Film Producers Association (FIAPF) said exclusive rights support the creativity of authors and allow film producers to get the funding they need to transform that creative ability into a cultural product. Broadcasters are important partners in the film production and distribution chain in many countries, the representative said. Although supportive of updating the protection for broadcasters, FIAPF called for a formulation of the treaty text that would avoid confusion between broadcasters’ rights and rights to audiovisual content.

Libraries, Civil Society Worried

The representative of the Electronic Information for Libraries and the International Federation of Library Associations and Institutions said both organisations see “no compelling public policy reason for a new international instrument on the protection of broadcasting organisations, because piracy of broadcast signals is already adequately dealt with under existing laws and treaties.” An additional layer of rights that could affect access to content is of great concern to librarians, she said, as it “imposes an additional barrier to access to knowledge, especially to content in the public domain.”

The Trans-Atlantic Consumer Dialogue (TACD) compared the potential treaty to an unidentified flying object “that has been buzzing around this room for years.” The representative said TACD “opposes the idea of granting any new layer of IP rights for broadcasters that would make it more expensive and more complex to legally obtain access and use of information.”

Fixation rights if not clearly limited could create problems for consumers, he said, adding that TACD supports strong exceptions to any new rights to protect access to works and their use.

The Center for Internet and Society also expressed concern on Article 9 of the draft treaty (Protection of broadcasting organisations) which they said could give broadcasters rights over the content that is being carried by the signal.

Knowledge Ecology International said the treaty was not “about copyright piracy but a special ride for broadcasters,” and warned against creating new layers of rights, which could create more obligations for consumers, libraries and businesses to pay more money not to copyright holders but to the distributors of content.

Assocham event sparks row over conflict of interest by CCI

An upcoming conference on intellectual property has triggered a controversy, as a section of the civil society has urged the Competition Commission of India (CCI) not to participate in the event, sponsored by Swedish multinational Ericsson, alleging it would be a conflict of interest since the watchdog is investigating cases against the telecom company on the very same issues that will be discussed in the function.

CCI Chairman Ashok Chawla is the key speaker of the conference, organised by industry chamber Assocham with Ericsson being the event partner. The conference scheduled for Friday also has three CCI members as participants, according to the event brochure.

In a letter, signed by six civil society organisations, argued that the participation of CCI in any form in a conference organised with the financial support of Ericsson would question the integrity and independence of CCI.

On the issue, Chawla said, "I am not aware of the point raised. (I) will see and take a position."

"The participation of CCI at this conference raises serious concerns of conflict of interest. Further, CCI's sharing of platforms with private actors would compromise the credibility and independence of CCI," said the letter sent to Chawla and also marked to Prime Minister Narendra Modi, the Chief Justice of India and several other ministries.

Ericsson is currently facing three CCI investigations on matters related to Standard Essential Patents and licensing of technologies on fair and equitable terms.

"Ericsson is not only an event partner but also giving a speech at the inaugural session," says the content of the letter. "We understand that the focus of the event is on two issues viz. Standard Essential Patents (SEPs) and the competition aspects of licensing agreements," the group has argued.

A CCI member on the condition of anonymity said, "As per the competition Act, 2002, it is our responsibility to raise awareness regarding competition issues. At such forums, the discussions which happen are of conceptual level only. No specific cases are ever discussed." "We have not got the letter as yet. We will take a decision as soon as we receive it," he added.

Unless there is an interaction, how can there be awareness about these issues faced by the country, asked Assocham.

D S Rawat, the chamber secretary general, said, "This is not the first time that Assocham is organising a function on the very same subject. It has in the past organised six-seven such functions, where CCI had participated."

CCI will give its view points and others including Ericsson will also give their view points, which will not have an impact on the watchdog's decisions on specific cases, he said.

"There will always be these disgruntled people who instead of contributing positively to the society, take negative stance," he added.

When contacted, an Ericsson spokesperson declined to comment on the issue.

Alternative Law Forum (Bengaluru), Centre for Internet and Society (Bengaluru), IT for Change (Bengaluru), Knowledge Commons Collective (New Delhi), National Working Group on Patent Laws (New Delhi) and Software Freedom Law Centre (New Delhi) are the six non-governmental organisations who have collectively raised the issue.

The letter argued that all the judicial or quasi judicial bodies are expected to avoid not only actual conflict of interest but also the perceived conflict of interest.

"As you know, the conflict of interest arises when there is an actual or perceived threat of the primary interest of the organisation (CCI) being influenced by the interest of another organisation/s (Ericsson)," it said.

It also pointed out that the issue of SEPs and licensing practices was an important public interest issue and the restrictive conditions and barriers to access SEPs would affect the technological and industrial development of India. Further, it would affect the consumers by creating economic barriers to access the benefits of communication technology equipment such as mobile phones.

Asian Athletics Championships 2017 Edit-a-thon

Odia Wikipedians, in conjunction with Indian Athletics Federation and Sports and Youth Services collaborated to document the 2017 Asian Athletics Championships. Hundreds of photos were uploaded and new Wikipedia content added to inform the event’s fans.

The Asian Athletics Championships is an intra-continental sports event organized bi-annually since 1973. The 22nd championship was held in July at the Kalinga Stadium in Bhubaneswar, India, where 655 athletes from 41 countries participated in 21 games. The Odia Wikipedia community worked with the event organizers in different ways, to document the event on Wikipedia, by holding edit-a-thons (editing workshops), to improve Wikipedia’s content about the championships and releasing official photos of the event under free Creative Commons licenses.

The original plan was for the Indian city of Ranchi, Jharkhand to host the 2017 athletics, but plans changed 90 days before the event when Bhubaneswar was selected as a venue instead. Preparing the Kalinga Stadium and getting ready for the championships in that short period was a challenge for the organizers. However, the state government of Odisha stepped in to assist, and as part of that freely shared the event website content under Creative Commons licenses.

The local Wikipedia community, along with the WikiTungi project in Bhubaneswar, were invited by R. Vineel Krishna, the State Department’s Director of Sports and Youth Services, to organize an edit-a-thon for the Championships. The scope was to improve Wikipedia’s content about the participating Asian athletes.

Before the event, existing Wikipedia articles provided little information on the biographies and accomplishments of some of the participating athletes. Odia Wikipedians collaborated with the Sports and Youth Services Department of Odisha to bridge the dearth of information.

Edit-a-thon participants gathered at the office of CSM Technologies, an event partner for the championships. Fifteen Wikimedians from Bhubaneswar and Puri WikiTungi, with some CSM staff members and new editors participated in the edit-a-thon.

The collection includes images of the athletes during their Heats, Semi Finals, Final, and Medal ceremonies of all four days. 127 images are used in 269 pages on Wikipedia in 27 languages, and many articles added their first image from this collection. WikiProject Women in Red used the images in many female athlete articles. The Odia Wikipedia community and the Centre for Internet and Society are also planning to work with the Wikipedia Asian Month competition to use these images to illustrate Wikipedia articles they work on, in their next edition. Victuallers, one of the volunteers of Women in Red project, identified athlete photos from the games website collection and used them to illustrate their articles. He has also created new articles of other participating female athletes.

The event started with a basic Wikipedia orientation session for new participants. There was no Wikipedia article for the championships in Odia language, so participants created it in addition to improving the English Wikipedia article. Along with that, 10 new articles were improved and created on both Odia and English Wikipedia. The 2017 Championships page on the English Wikipedia received over 100,000 views during the championships week.

“Wikipedia has been the one-stop source of knowledge for me,” says Alankar Devta, an edit-a-thon participant. “It has helped me learn a lot and prepare for competitions. This is the first time, I got a chance to take part in any Wikipedia edit-a-thon. Apart from that, the articles about the athletes taking part in this year’s Championships are of great help for the readers who may want to search for the athletes with expectations to find useful information about them.”

Wikimedia community members were offered passes to attend the opening ceremony and take photos. We spent four hours taking photos of the 41 participating teams, athletes and cultural events. All were uploaded to Wikimedia Commons. Nearly 19% of the photos taken at the opening ceremony are used on Wikipedia articles.

A major outcome of the edit-a-thon was releasing the content and images of the championship’s official website under a Creative Commons license. 286 images from the websites were added to Wikimedia Commons, of which 47.2% are used on Wikipedia in several languages.

“I have worked with the Women in Red project since it started,” says Victuallers. “Over the past two years, we have helped raise the percentage [of female biographies on the English Wikipedia] from 15.5 to 17%. One of the things that hold us back, though, is that women are less likely to have images available. It’s, therefore, amazing to find that a major athletic event has released hundreds of images with a CC BY-SA license. Participating athletes are all notable and women are fairly well represented. I have downloaded over 100 pictures and cropped group photos to create portraits. We’ve been tweeting the new articles and pictures on @WikiWomenInRed and trying to encourage all to “one up” the Odisha people. It’s a great success and we need more people to follow suit.”

With such collaborative spirit from the Government institutes, the Odia community is planning to get more content from Odisha under a free license. The community has also partnered with the Bhubaneswar Development Authority, to run a global edit-a-thon named Bhubaneswar Heritage Editathon, for documenting the culture and heritage monuments of the city.

As Odia Wikipedia turns 13, what happens next?

Odia Wikipedia, one of several Indian-language Wikipedia projects, celebrated thirteen years of free knowledge contribution on June 3.

Launched in 2002—just a year after the English Wikipedia was launched—Odia Wikipedia has grown to be the largest content repository in the Odia language available in Unicode on the Internet. With over 8,900 articles and about 17 active editors (also known as “uikiali”) spread across various parts of India and abroad, the project has become more than just an encyclopedia. The voluntary editor community has put its efforts into acquiring valuable content, re-licensing them under Creative Commons (CC) licenses, and building tools for acquiring more encyclopedic content from various sources.

The community has also engaged over 2,500 people through various outreach programs, such as the Wikipedia Education Program. For its thirteenth anniversary, the community released a character-encoding converter that promises to unlock massive amounts of content—from government portals to journals, newspapers and magazines that have their content in various legacy encoding systems other than Unicode. This has been a major roadblock in the search for and reuse of digital content in the Odia language. During our thirteenth anniversary celebrations, the community spent a day assessing community needs, addressing issues, and identifying priority areas to focus on in the future. This was arguably the first time almost the entire community gathered in a physical space. This allowed Odia Wikipedia administrator, and the most active Odia Wikimedian, Mrutyunjaya Kar and I to design a needs assessment survey. Participating Wikimedians were asked to brainstorm various problems they face in two major areas: editing and outreach.

The community has also engaged over 2,500 people through various outreach programs, such as the Wikipedia Education Program. Aditya Mahar, the second-most active editor on the Odia Wikipedia, feels that the biggest setback for the Odia Wikipedia is a lack of interest in contributing in Odia language. He says many Odia speakers feel that Odia is not needed to acquire and share knowledge.

“Like many others, I have been very eager to learn and share more about my home state and culture,” he says. “That’s why I started to contribute to the Odia Wikipedia, to tell my people about our rich cultural heritage in my language.”

He adds that he is concerned by the way many have been alienating Odia with the excuse of learning English to connect to the rest of the world. “I want my future generation to find everything they want to learn in Odia—from the history of Odisha, our art, architecture, Odia language and people, and our cultural extravaganza,” he says.

Mrutyunjaya Kar, an administrator on the Odia Wikipedia and the most active contributor, feels that Wikipedia is like a marathon and there is a great need for fresh blood in the community. Asked if the community will ever die out, Mrutyunjaya feels that even with a small community, the Odia Wikipedia community is always going to thrive, even if, in the worst case, only one active Wikipedian remains. Mrutyunjaya adds that creating many short articles, known as “stubs”, is a necessary evil and essential for a project like the Odia Wikipedia, as they are drafted as a by-product of collaborative editing.

“It takes little longer for a small community like Odia to expand and enhance quality of stubs though,” he says. “Many-a-times, new editors learn about Wikipedia editing while creating stubs. However, all the active Wikipedians agreed during the thirteenth anniversary not to create or promote many stubs.”

ఏవిధమగు చిత్తరువులు వ్రాయుచుండిరో అవియు తెలియవచ్చినవి. దారుకావనములోని శివుడు, గోపికాకృష్ణులు, అహల్యా సంక్రందనులు, తారా చంద్రులు, మేనకా విశ్వామిత్రులు మొదలైనవి వ్రాయిస్తూ వుండిరి. చిత్తరువులను ‘మయ్యెర’తో వ్రాసిరి. (మయ్యెర అను వెంట్రుకలతో చేసిన బ్రష్షు అయి యుండును – మైర్ అన అరవములో వెంట్రుక అని యర్థము). ఓరుగల్లున ‘చిత్తరువులు వ్రాసే యిండ్లు 1500’ అని ఏకామ్రనాథుడు వ్రాసెను. భోగమువారు తమకు తగిన పటాలను వ్రాయించుకొనిన ఇతరులును వ్రాయించుకొన్న వారు కారు. ప్రజలు తమతమ అభిలాషల కొలది వ్రాయించుకొను చుండిరి. వీర పూజ కోరువారు వీరుల చిత్రాలు వ్రాయించిరి.” (కాకతీయ యుగము)

“గారడీ అను విద్యను ఇంద్రజాల మనిరి. ఇంగ్లండులోని ఇంగ్లీషు పత్రికలలో ఇంచుమించు 40 ఏండ్లనుండి యొక చర్చ కొన్నిమారులు చేసినారు. ఇంచుమించు 150 ఏండ్ల క్రిందట ఒక ఇంగ్లీషు వాడొక ఇంద్రజాల ప్రదర్శనమును హిందూస్థానములో చూచి దాన్ని చాలా మెచ్చుకొని అనాడే పత్రికలో వ్రాసెను. ఆ ఇంద్రజాలమ లో ఒకడు త్రాటి నొకదానిని పైకి నిలువుగా విసరి గాలిలోనిలబెట్టి దానిపై కెగబ్రాకి మాయము కాగా, వాని యంగములు ఖండ ఖండములుగా క్రిందబడె ననియు, మరి కొంతసేపటికి వాడు త్రాటినుండి గబ గబ దిగివచ్చెననియు వ్రాసెను. అది యబద్ద మనియు, అట్టి విద్యను ప్రదర్శించు వానికి ఇంగ్లండుకు రానుపోను వ్యయమును భరించి వేలకొలదిగా బహుమానము లిత్తుమనియు కొందరు ప్రకటించిరి. కాని కొరవి గోపరాజు ఒక కథలో ఇదేవిధమగు ఇంద్రజాలమును వర్ణించినాడు.
ఒకడు తనభార్య అనుదానిని వెంటబెట్టుకొని రాజసన్నిధిలో ఆమెను రక్షణార్థమై విడిచి, తాను దేవసహాయార్థమై యుద్ధముచేయ వెళ్ళుతున్నాని చెప్పి ఒక త్రాటిని పైకి నిలువుగా విసరి, దాన్ని నిలబెట్టి, దానిపై కెగబ్రాకి మాయమయైను. కొంతవడికి వాని కాలుసేతులు, తల, మొండెము తుంటలై క్రిందబడెను. వాడుంకువగా నుంచిపోయిన వానిభార్య రాజును వేడి సెలవు పొంది సహగమనము చేసెను.
వెంటనే త్రాడు పైకి ప్రాకిపోయిన భటుడు పైనుండి దిగివచ్చి తనభార్యను పంపుమనెను. రాజు విచారగ్రస్తుడై ఆమె సహగమనము చేసెనని చెప్పెను.” (రెడ్డిరాజుల కాలము)

“హిందూ సైనికులు ముసల్మానులవంటి సైనికభటులు కారు. ముసల్మాను సైన్యములో అరబ్బులు, ఖురాసానీ తురకలు, పారసీలు, అబిషీలు (అబిసీనియనులు), పఠానులు, బిల్లులు, మున్నగు అటవికులు ఉండిరి. తమ సైనికులు తురక భటులకు సరిరారని విజయనగర చక్రవర్తులు గుర్తించి, తురకలను తమ సైన్యములో భర్తీచేసి, వారికొక “తురకపేట”ను ప్రత్యేకించి వారికి మసీదులు కట్టించి సకల సదుపాయములు చేసిరి. అట్లు చేసినను వారికి హిందూ రాజులపై విశ్వాస ముండినటుల కానరాదు. వారు తమ ఏలికలకు సలాములు కూడ చేయుటకు ఇష్టపడనందున ఏదోవిధముగా తమ గౌరవము నిలుపుకొనుటకు తన గద్దెపై ఖురాను నుంచుకొని దానికిచేసిన తురక సలాములను తానును పంచుకొనెను.” (విజయనగర సామ్రాజ్య కాలము)

“కొల్లూరు పట్టణములో ఒకదేవుడు వెలిసెను. ప్రతి జనుడు ధాన్యమును తన మూత్రములో తడిపి ఆ దేవతా విగ్రహముపై వేసిన అవన్నీ రత్నాలై రవ్వ లవుచుండెనట. అందరును ఆ క్రియను చేయుచు మేడలు కట్టిరి. ఆ పట్టణములో ఒక పేద బాప డుండెను. అందరివలె నీవును చేసి సుఖపడరాదా అని అతనిభార్య తొందరపెట్టుచుండెను. ఏమైననుకాని నేనా తుచ్చపుపని చేసి అపచారము చేయనని అ శిష్టు డనుచుండెను. ఒకనాటి మద్యరాత్రి మరొక వృద్ధ బ్రాహ్మణు డా పేదబాపని కుటుంబ సహితముగా పట్టణము బయటకు పిలుచుకొని పోయి అదిగో కొల్లూరుపట్టణ వైభవము చూడు అని ధగద్ధగితముగా మండుచుండే పట్టణమును వారికి చూపి మాయమయ్యెనట. అది కొల్లూరు పట్టణం వలె వెలిగినది అనేకథ. ఆ కథ నిజముగా ఈ వజ్రాలగనికి సంబంధించినదని పైననే కనబడుచున్నది.” (క్రీ.శ. 1600 నుండి 1757 వరకు)

“ఆ కాలమందు కోర్టులు లేకుండెను. ప్రతిగ్రామమందు గ్రామపెద్దలు ప్రతిఫలాపేక్ష లేక తగవులు తీర్పుచేసిరి. విజ్ఞానేశ్వరీయమే ముఖ్యాధార భూతశాస్త్రము. బ్రాహ్మణులే సభాసదులు. వారి తీర్పులపై రాజువద్ద పునర్విమర్శ(అపీలు) కావచ్చును. సాధారణముగా వారి తీర్పునకు తిరుగు లేకుండెను. ధనోద్బవ (సివిల్), హింసోద్బవ (క్రిమినల్) అభియోగములను (కేసులను) వారే విచారించిరి. ముఖ్యమైన నేరములను రాజు స్వయముగా విచారించెనను. ‘సభ’వారిని పిలిచి వారి సహాయముతో తీర్పు చెప్పెడివారు.
“సభ”ను చావడిలోనో, దేవాలయమందో, ఊరిమధ్య నుండు “రచ్చ” కట్టపైననో చేసిరి. అందుచేత వివాదమునకు సభగా కూడుటకును “రచ్చ” యనిరి.” (విజయనగర సామ్రాజ్య కాలము)

“”కృష్ణ” అను పేరుగల విద్వాంసుడు రాయలవారికి సంగీతము నేర్పెను. అతడు రాయలకు వీణావాద్యముకూడా నేర్పినందులకుశిష్యుడు గురువునకు గురుదక్షిణముగా నిలువైన ముత్యాల హారాలను, వజ్రాల హారాలను నిచ్చెనని కర్ణాటభాషలో నారాయణ కవిచే వ్రాయబడిన రాఘవేంద్రవిజయములో తెలిపినారు. సంగీతము శాస్త్రప్రకారము అత్యంతాభివృద్ధి నొందెను. ఒక్కొక్క ఋతువులో ఒక్కొక్క రాగమునకు ప్రాధాన్యముండెను. వసంతకాలమందు హిందోళరాగము పాడిరి. రాయలకు పోర్చుగీసు రాయభారి తమ దేశపు వాద్యములను కానుక యివ్వగా వారు చాల సంతోషించిరట!” (విజయనగర సామ్రాజ్య కాలము)

ఆంధ్రుల సాంఘిక చరిత్ర పుస్తకాన్ని తెలుగు వికీసోర్సు సముదాయ సభ్యులు (శ్రీరామమూర్తి, డాక్టర్ రాజశేఖర్, ప్రభృతులు) యూనీకోడ్‌లో పాఠ్యీకరించి, ఇ-పుస్తకంగా తయారుచేశారు. ఈ పుస్తకం ఎవరైనా తిరిగి వాడుకోవచ్చు, పంచుకోవడానికి వీలుగా లభ్యమవుతోంది. 2018 మే మొదటి పక్షంలో ఈ పుస్తకాన్ని విశేషగ్రంథంగా తెలుగు వికీసోర్సు వారు ప్రదర్శిస్తున్నారు.

Arguments Against the PUPFIP Bill

The Protection and Utilisation of Public Funded Intellectual Property Bill (PUPFIP Bill) is a new legislation being considered by Parliament, which was introduced in the 2008 winter session of the Rajya Sabha. It is modelled on the American Bayh-Dole Act (University and Small Business Patent Procedures Act) of 1980. On this page, we explore some of the reasons that the bill is unnecessary, and how it will be harmful if passed.

Arguments

How is the legislation unnecessary?

1) The Indian government does not have vast reserves of underutilized patents, as the U.S. did in 1980.

The idea behind the Bayh-Dole Act was that the research funded by the government (and owned, in the US, by the government) was being underutilized. In 1980, over 28,000 unlicensed patents lay with the U.S. government.[1] The Act shifted the title of such works from the government to the University or small business that conducted the research, thus allowing them to take out patents on the research outputs. In India, under present laws, the researcher(s) own the rights over their research whether they be government-funded or not. Usually, due to employment contracts, the research institutes already have the right to patent their inventions. Thus, currently, there is no need for an enabling legislation in this regard, as there was in the U.S.

In fact, currently, the Council of Scientific and Industrial Research (CSIR) has over 5173 patents (counting both those in force and those under dispute), while only 222 patents are licensed (with 68 of them being under dispute). Thus, even with the IP being in the institute's hands, there is a "problem" situation similar to that which necessitated Bayh-Dole in the U.S. Thus, quite contrary to the aims of the Act, further patenting will only lead to a situation of even more underutilized patents.

2) Technology transfer is very important, but pushing IPRs aggressively is not the best way of ensuring technology transfer.

At a recent seminar held at NUJS Kolkata on the PUPFIP Bill, it was revealed that while IIT-Kharagpur’s TTO-equivalent (called the Sponsored Research & Industrial Consultancy division - SRIC) currently handles over Rs.300 crores through 850 projects, only around Rs. 5-15 crores (exact figures weren't available) are currently made through its patent portfolio.[2] Thus patents don't seem, on the face of things, to be the best way of ensuring technology transfer. Indeed, the oft-cited 28,0000 unlicensed patents held by the U.S. government were composed primarily of patents for which industry had refused to take exclusive licences.[3]

Many contend that one of the most important functions of a patent is to get inventors to disclose their inventions rather than keep them as secrets. This reason for awarding a patent is invalidated if stronger protection is granted to trade secrets (no term limit, for instance) than for patents. Secondly, this reason for granting patents is not valid in case of government-funded research in academia and research institutes. The culture of publication and the economy of reputation are sufficient to ensure disclosure. Even without these intrinsic factors, there grant requirements can necessitate publication. If mere publication is believed to be insufficient, then the government would do well to ask for technology dissemination plans before grants are made. At any rate, monopoly rights in the form of patents are thoroughly unnecessary.

How is the legislation harmful?

1) Excessive patenting lead to gridlocks and retard innovation.

It sees protection of IPR as the sole means of encouraging innovation and driving research to the doorstep of consumers. The trend around the world is that of exploring alternative forms of spurring innovation. Even in India, CSIR has gone for an innovative "Open Source Drug Discovery" project, which has proven very successful so far. Furthermore, recent literature shows that excessive patenting is harming research and innovation by creating gridlocks.[4] If platform technologies and basic research (such as SNP) gets mired in patents, then the transaction costs increase (not only in terms of money, but more importantly in administrative terms). This ends up in research clearances getting blocked, and thus retards innovation. It must be remembered that intellectual property is not only an output, but also an input. The more aggressively the outputs are guarded and prevented from being shared, the more the inputs will be affected. The study of patent thickets and gridlocks has reached such a stage that the U.S. law has been changed to reflect this. Firstly, the Bayh-Dole Act was amended in 2000 to state that the objectives of the Bayh-Dole Act were to be carried out "without unduly encumbering future research and discovery". Now, the courts (in the Bilski case) have increased the standard of obviousness in patent law (which means that less patents will be granted). Furthermore, the U.S.P.T.O. and the U.S. Senate are currently considering means of overhauling the U.S. patent system, which many fear is close to breaking down due to over-patenting. All these are signs that the footsteps we are seeking to follow are themselves turning back.

2) The legislation makes mandatory that which is optional now, and is anyway being followed in many institutions.

While the CSIR labs pursue patents aggressively, they also run the OSSD project. The latter might not be permissible if the Act is passed as it stands. Furthermore, this would increase the number of underutilized patents, which is a problem faced currently by CSIR, which has had an aggressive patent policy since the 1990s. Unlicensed patents constitute around 93% of CSIR's total patent portfolio. (In contrast, MIT averages around 50% licensing of patents.) If aggressive patenting is made mandatory, it adds substantially to administrative costs of all institutes which receive any grants from the government. These institutes might not be large enough to merit a dedicated team of professionals to handle

3) Copyright, trademark, etc., seem to be covered under the definition of "public funded IP".

This leads to a ridiculous need to attempt to commercialise all government-funded research literature (and the government funds science research, social sciences, arts, etc.). Furthermore, while the definition of "public funded IP" includes copyrights, trademarks, etc., yet the substantive provisions seem to only include those forms of IP which have to be registered compulsorily (copyright and trademark don't -- copyright comes into existence when an original work is expressed in a medium, and trademark can come into existence by use). Importantly, seeking to commercialise all copyrighted works of research would hamper the movement for open access to scholarly literature. The inititative towards open access to scholarly literature is something that National Knowledge Commission has recommended, and is a move that would result in increased dissemination of public-funded research, which seems to be an aim of the PUPFIP Bill as well.

4) It will result in a form of double taxation for research, and will increase the consumer cost of all products based on publicly-funded research.

This bill would increase the consumer cost of all products based on publicly-funded research, because of the additional burden of patent royalties.

Public funds research -> Institute patents research -> Pharma MNC gets exclusive license over research -> Drug reaches market.

Assuming an exclusive licence: Cost of the drug = cost of manufacturing, storage, etc. + mark-up (monopolistic) cost + cost of licence.

Thus, in effect, the public has to pay twice for the research: it pays once to enable the scientist to conduct the research, and once again in the form of royalties to have that research brought to the marketplace.

5) It could have unintended consequences of varied kinds, including discouraging fundamental research as well as discouraging industrial research.

The former could happen since institutions and individual scientists have a financial incentive to shift their focus away from fundamental research; the latter, conversely, because the filings and bureaucracy involved could drive scientists away from reporting or even engaging in industrial research [pdf]. Faculty and researcher involvement in the business of licensing is a sub-optimal usage of their talents, and there are scientists who would rather stay away from business (as is shown by the intake of former industry-researchers into government-funded labs such as those of CSIR).

6) Non-disclosure requirements in the Bill restricts the dissemination of research within the academic community, and curtails freedom of speech.

This will bring about a shift in science and research which is always done upon others' work. This is why in the U.S., the National Institute of Health (N.I.H.) has sought to ensure (without any legal authority) that it only finances that research that on single nucleotide polymorphism (S.N.P.) which is not patented, and is shared freely amongst scholars. Since this requirement of the N.I.H.'s does not have any legal backing (since it is contradictory to the Bayh-Dole Act), institutions are free to get the grant from N.I.H. and then go ahead and patent their inventions.

7) Exclusive licensing enables restriction on the dissemination of academic research in the marketplace, and increase in cost of products based on public-funded research.

The bill allows for both assignment of licences as well as exclusive licences. Both of these enable monopolistic pricing to be undertaken by the licensee/assignee. There are not even any mechanisms in the Act to ensure, for instance, that a public call is made to ascertain that no parties are willing to consider a non-exclusive licence. Patents are generally said to grant a monopoly right because of the opportunity to recover costs of research and development. When the research is being done by public-funded money, there is no justification for monopoly rights on that research, since there are no excessive costs to recover.
