Whats & Hows of Wiki

The Kings School students of class 10 were blessed to have Nitika Tandon & Subhashish Panigrahi of Wikipedia Foundation to conduct a workshop on the whats & hows of Wiki, creating & editing Wiki pages, etc. Our students also got a hands on experience, and they edited the Bibinca page on Wiki.

A Kannada Wikipedia Workshop at Hubli

On Sunday, July 21, 2013, a day-long Kannada Wikipedia workshop was conducted at Hubli by the Centre for Internet and Society's Access to Knowledge (CIS-A2K) team. This blog post throws more light on the workshop.

On June 13, 2013, a Kannada news channel, Suvarna News 24x7, telecasted a panel discussion on Kannada Wikipedia. I participated as a panelist in the programme along with M.G. Harish, who is an admin of Kannada Wikipedia. In the panel discussion, the anchor Shetty asked us whether we conduct workshops to help people edit Wikipedia? I said yes, and also confirmed that if people (from whichever place they may hail from) want training on editing Wikipedia then I am willing to travel to that place and do a workshop.

One week after the programme was telecasted, one V S Hiremath called me from Hubli and requested me to conduct a Kannada Wikipedia workshop at Hubli. Many rounds of discussions took place. One condition that I had put forward was that participants should come with their own laptops and internet connections like data cards, dongles, etc., for the workshop. Unfortunately, majority of the people willing to participate in the workshop didn't have laptops albeit having desktops and internet connections in their homes. So we had to make alternative arrangements and the workshop was conducted at the computer lab of KLE Society's Institute of Management Studies and Research. The logistics were arranged by V. S. Hiremath of UNV Associates.

The programme was scheduled to start at 10 a.m. Due to the monsoon season, it was raining heavily. People started to come in a bit late. Hiremath had scheduled an inauguration and media briefing for the workshop. Dr. Prasad B.Roodagi, Director of IMSR, presided over the function. The inauguration was done by Sheelavantar of Hosa Digantha. Since Dr. Prasad B.Roodagi came almost one hour late, the workshop began late.

The actual hands-on workshop started after the tea-break at 11.30 a.m. People were very eager to learn about editing Wikipedia. There were 22 participants.

Wikipedia has a condition that only 6 new editors can register per day for a given IP address. The lab had static IP address. Once, 6 participants had registered, the remaining couldn't register.

So the rest registered using my laptop during lunch break. I taught them the features of Wikipedia, searching for a topic, posting new articles, formatting, inserting links, images, references, etc. Participants got to know all of these by using their respective sandboxes. Towards the end, I also showed them Kannada Wiktionary, Kannada Wikiquote and Kannada Wikisource.

The results have been positive. About 1-2 persons are adding new content to Kannada Wikipedia. Hope that the remaining participants will also add content over a period of time.

A special thanks to V.S. Hiremath for doing all local arrangements and giving wider publicity. Without his active interest and participation, the workshop wouldn't have happened.

IPR and competition laws in conflict or have provisions (in existing law) that already take care of this possible conflict?
What happens if an IP right holder acquires a ‘dominant position’ by virtue of these rights?
- Abuse of dominant position provisions get attracted if rights are beyond the boundaries of IPRs.
Anti-competitive agreements (and beyond the objective of preventing infringement)- then what happens?

V. LAKSHMI KUMARAN- MANAGING PARTNER, LAKSHMI KUMARAN AND SRIDHARAN- THEME ADDRESS

Trans-border transactions are normally of two types:
(a) trade (in goods and services) - WTO mandate is free trade of goods and services between nations;
(b) investment.
“Free” trade should also be “fair” trade.
Competition law will not question the grant of the IP rights. It will question how you use them, especially when/if you use in a way that is detrimental to competition.
Patent law places many restrictions on what you can and cannot do- these ‘can’t do actions’- if you perform them, you will be scrutinized under competition law.
Cases in US/Europe- challenging patents were withdrawn by ‘compromise’ but agreements really spoke of ‘something more’ promised by the patent holder if the challenging suit was withdrawn- scrutinized by competition law.

2007- Agenda for Development at WIPO- Committee on Development and IP (CDIP) to supervise implementation of the AD and coordinate with other Committees.
WIPO- as of now, member states do not want to embark on negotiating processes on IP and Competition but rather want to better understand it.
WIPO- 2011-2012- Project on IP and Competition Law.
WIPO Goal- to establish WIPO as a global forum on IP and Competition policy.
Rationale (WIPO)- same as the 3 DA (2007) recommendations.

CHAITANYA PRASAD- IAS, CONTROLLER GENERAL OF PATENTS, DESIGNS AND TRADEMARKS- KEYNOTE ADDRESS

Monopoly- genesis of both IP and Competition Law (IPRs= regulated monopoly= not bad- IPRs= carefully granted essential monopolies regulated by State).
Competition Law and IP have common goals- better technology etc., and also economic growth and better quality of life for consumers.
IPRs- (a) industrial IPRs- GIs, patents, TMs, IDs, etc and (b) non industrial IPRs- copyright and related rights.
Patent Law- grant of Compulsory licences in some situations- Doctrine of Exhaustion of IPRs- domestic or international?- international committee divided on this.
READ- Adams v. Burke- 1873 SCOTUS.
DB- Delhi HC- parallel imports- allowed under Trademark Law?
New York Times- 06/06/13- generic drug market v. patent holder- anti competitive markets- SCOTUS decision.

Standards- especially in communication networks- generally have higher royalties- disclose existence of IPRs and agree to license at reasonable rates- REQUIREMENT.
IP Law- in built mechanisms to address abuse and these are furthered by competition law.
IP + CL- hand in hand for welfare of market and growth of economy.

ASHOK CHAWLA- CHAIRPERSON, CCI- INAUGURAL ADDRESS

“Very rightly” WIPO is not seeking to harmonize regime across nations- this has to be a domestic process of laws/jurisprudence.
Similarities/intersection of IP and competition law:
- IP + competition law- both put a premium on innovation – IP does this directly and competition law because there is a need to do better than other firms.
- Lead to technical and economic innovation.
- Goals – greater good for consumer and society.
Merger Control- crystal gazing on post merger scenario is required. Competition law authorities required to take nuanced approach in fast growing and tech. sectors- ex ante analysis- need to be upfront to scrutinize kind of restrictions being imposed under the deal- need to balance protection of knowledge of the mind with protecting the interests of the stakeholders as well.- this is the CCI approach.

The aforesaid balancing act is also going to be a critical area over the next twenty years- especially for policy makers.
Wider dissemination of advocacy is required.
Question to Chawla- ‘pay for delay’ agreements/reverses payments- our generic companies (what happens to them?)- what happens to the consumers? Is there going to be a study on this by the CCI?- Chawla said that in the generic drugs sector we are already strong- he said that this is going to be an issue Indian manufacturers will have to grapple with eventually (internationally)- but we will take care when it comes here.- Carvalho intervened and pointed out that ‘pay for delay’ agreements and reverse payments were different things.
Question to Chawla- IPR section on the CCI website does not have any content anymore- Chawla said that they will rectify this and understand that the section would be very useful in terms of clarifying the CCI’s stance on this intersection between Competition Law and IPRs.

Balanced IP- the Foundation of economic democracy.
Trade name- reputation- basis for survival in the market. Trade secret- sets you apart from competitors- IP not all about reputation- IP protects and promotes intangible differences that businesses introduce in their products/services- that is, differentiation. This could be of origin, quality, invention, creation, location, reputation, price etc. this differentiation is behind every IP asset.
What is balanced IP?
- IP in the right dosage- (not too much- examples of too much- IP for unmodified genes/functional signs/or common terms as trademarks.)- (not too little- example of too little- lack of protection for sound/smell designs, tolerance for counterfeit goods and piracy, no protection for new and inventive traditional knowledge etc).
- IP that is not abused.
- IP that is not distorted by external circumstances- regulation distorts competition and therefore distorts IP. Since IP is about differentiation, before innovation it promotes social, cultural and economic freedom. IP is the foundation of any free market economy based on consumers’ and entrepreneurs’ freedom.

Patents Act- Section 140- certain prohibitions.
Section 107A of the Patents Act appears to provide for international exhaustion.- Delhi HC (2012)- Kapil Wadhwa v. Samsung International extended international exhaustion to trademarks also.
Areas of concern- ‘pay for delay’ agreements- will Section 3(5) of the Competition Act apply?
US- a granted patent is presumed to be valid. India does not envisage such a framework.
Getting a patent and getting the right to practice a patent are very different in patent law.
Acquiring patents by fraud attracts section 4 of the Competition Act.
Unfair pricing- not an offence to have excessive pricing in the US.
Standards- when you develop patents here, you AGREE to compulsory license on a FRAND basis. Only issue then is what are FRAND terms- won’t get injunctions on this issue here in India, since you can prove damages are enough of a remedy- so it all comes down to negotiations.

Overregulation leads to lack of innovation- this is his conclusion.
Content costs rise constantly- recouping them is very hard since channel prices have remained static for about eleven years now- supposed to have been an interim measure by the SC but TRAI is allowing it to continue.
Question by Barot- who decides how to price is going to be something interesting to debate.
(Sort of answering the ,above> question)- Mandatory Sharing Act- share feed w/ Prasar Bharathi- feed here refers to sporting events of national importance- the purpose is to give access to those who have terrestrial network (not cable/DTH)- but provision in the Cable Act says operators HAVE to carry two DD channels- so.. now operators don’t want to carry other (sports) channels, since Team India is available on DD anyway.

IPR and Competition Law are two sides of a coin aimed at furthering innovation.

Under Section 4 of the Competition Act, 2002, you cannot take the defence of “doing so to protect my IPRs’ stance for your actions.

CCI has not yet had an IPR+ competition law ‘meaty’ case yet.

Refusal to license IPRs- competition law cannot say that you HAVE to license, but MAY be construed as anti-competitive if not backed up by sound objective claims.

WIPO reaches agreement on treaty for blind

Officials at the World Intellectual Property Organisation have reached an agreement to provide wider access to books for the visually impaired in different countries, a long-pending demand of the World Blind Union and activist groups.

If officially approved, the treaty will help distribution of specially formatted books for the blind and visually impaired in different countries by removing copyright law hurdles. For instance, US-based Bookshare, which is an online library for people with sight disabilities, has about 200,000 books in its collection, but only about 75,000 of them can be distributed in the UK because of copyright restrictions.

According to the Intellectual Property Watch website that track international policy on the subject, the agreement was reached over the weekend in Marrakesh, Morocco, where a conference to facilitate access to published books for people with sight disabilities is being held.

“The text, which has not been presented to the conference plenary, nor adopted yet, also addresses the issue known as ‘the Berne gap’, which refers to countries which are not part of international treaties governing copyright, such as the Berne Convention for the Protection of Literary and Artistic Works, the World Trade Organization Agreement on Trade-Related Intellectual Property Rights (TRIPS), and the WIPO Copyright Treaty,” the website said in a report on 24 June.

According to the World Health Organisation (WHO), India has 63 million visually impaired people, of whom about 8 million are blind.

Experts such as Sunil Abraham of the Centre for Internet and Society said Indian negotiators played a crucial role in pushing for these amendments.

“India’s copyright law after the latest amendment has a very robust exception for the disabled. It is disability neutral and works neutral. We must applaud the Indian negotiators for exporting Indian best practice to global copyright policy. India continues to be a leader in WIPO when it comes to protecting the public interest and facilitating access to knowledge,” said Abraham.

The treaty, which promotes sharing the books in any format for the blind or visually impaired, is expected to alleviate the “book famine” experienced by many of the WHO-estimated 300 million people suffering from such disability in the world, Intellectual Property Watch said.

“The treaty however is both disability specific, i.e. the visually impaired, and works specific, mostly targeted at ending the book famine,” Abraham said.

Indian Language Wikipedia Statistics (September 2012 – April 2013)

The Access to Knowledge team carried out a quantitative analysis to identify trends and growth patterns in Indian Language Wikipedias over the time period from September 2012 to April 2013.

It is difficult for the CIS-A2K programme to either take direct credit for the growth or direct blame for the lack of it in the Indian language Wikimedia projects. However, we believe that we have been one of the factors — and sometimes a key factor — in impacting the growth of the Wikimedia projects and communities in India since the commencement of the project.

Though the A2K programme has done some amount of work with almost all Indian language Wikipedias, the A2K team has had relatively more involvement in 10 Indic languages: Assamese, Bengali, Gujarati, Hindi, Kannada, Malayalam, Marathi, Odia, Punjabi and Telugu.

In addition to this based on the various outreach work done by A2K we have attempted to present an analysis of direct new Wikipedia users that have emerged in languages impacted by the A2K programme, keeping in mind that community mobilisation will always be an autonomous activity to some extent.

The growth momentum in Indian languages over the eight month period from September 2012 to April 2013 looks healthy.
Some language Wikipedias have been growing at a phenomenal rate than others in terms of percentage change since September 2012.
Assamese, Punjabi, Kannada and Odia Wikipedias have a growth rate of 58 per cent, 55 per cent, 30 per cent and 26 per cent respectively. These were the top four Indian language Wikipedia projects during the eight month period.
In terms of absolute number of articles, Tamil, Malayalam, Kannada and Hindi Wikipedias have grown by about 4,200; 3,600; 3,300; and 2,300 articles respectively.
However, given the small size of the Wikipedia communities in Assamese, Punjabi, Kannada and Odia (as given in Graph 2 below) the growth achieved by them is much commendable and all efforts have to be put to ensure that this momentum continues by strengthening these communities and also expanding them.

There is a fluctuation in the number of active editors in majority of the Indian language Wikipedias, except for Punjabi Wikipedia, which has seen a consistent growth. Starting from July 2012, the Wikimedia India Programs Team began working with the Punjabi community, an activity which we have continued at the A2K programme.
The active editors on Hindi, Marathi and Sanskrit Wikipedias have been consistently coming down, which is a cause of concern.
It is important to note that Kannada and Telugu Wikipedias where the number of Active Editors were in a declining trend as of September 2012 have shown a remarkable turnaround. The A2K programme has spent the last 3-4 months working closely with both the Kannada and Telugu communities.
Overall the active editors on Malayalam Wikipedia have crossed the 100 mark numerous times, making it the first Indian language Wikipedia to reach this benchmark.
Looking at the trends Tamil Wikipedia may soon reach the 100 active editor mark.
Even Bengali Wikipedia community could cross 100 active editors if concerted efforts are put in.
The Assamese Wikipedia, which received support from A2K programme until January 2013, had a consistent active editor population which was around 20 people. However, once the support from the A2K programme dwindled a declining trend (since February 2013) has set in. This is worrying as it gives rise to the possibility of building dependencies through the A2K programme. Going forward we need to address this and rectify by creating self-sustaining momentum in our outreach work that lasts beyond our involvement.

On an average 96 new editors have joined Indian language Wikipedias every month.
Bengali, Hindi, Malayalam and Tamil Wikipedias have consistently seen more than 10 new editors joining every month.
Assamese, Odia and Sanskrit Wikipedias did have many new editors joining.
A total of 673 new people have become editors for Indian language Wikipedia since September 2012.
However, the conversion rate of new editors into active editors is still a challenge across all Indian language Wikipedias.

Overall the “Page View” trends of Indian Language Wikipedias look positive.
Bengali, Odia and Punjabi Wikipedias have shown the highest percentage growth in page views since August 2012.
In absolute numbers Bengali Wikipedia has seen a spectacular growth of 14,00,000  page-views, Marathi and Tamil Wikipedias witnessed a growth of about 10,00,000 and 8,00,000 page-views respectively.
These clearly indicate the demand for knowledge and information in Indian languages on the internet.

In the below given Graph 5, we have also looked at the direct impact the A2K programme had in cultivating new editors on Indian language Wikipedias through various outreach programmes conducted during September 2012 to April 2013.

It should be noted that a total of 1,275 participants were reached out by the A2K programme. However, the username data for more than 700 participants could not be ascertained, due to inefficient data collection and input. This includes participants giving wrong usernames, trouble with the handwriting of some of the participants, etc. We have already taken note of this issue and have put in measures to efficiently capture the new user data. Hence, we have only presented an analysis of 558 participants, whose usernames are valid.

Of this it can be noted that more than 120 users have done more than 5 edits, which is 21 per cent of the participants. Further, 24 participants have done more than 100 edits on English and various Indian language Wikipedias, which constitutes 4 per cent of the total participants that the A2K programme has reached out to.

The Centre for Internet & Society (CIS) welcomes you to the sixth issue of its newsletter for 2013. Hivos published a White Paper by Nishant Shah titled Whose Change is it Anyway?, which attempts to reflect critically on existing patterns of making change and its implications for the future of citizen action in information and network societies. The Access to Knowledge team carried out a quantitative analysis to identify trends and growth patterns in Indian Language Wikipedias from September 2012 to April 2013. CIS drafted the Privacy Protection Bill and amended it as per feedback gained from the New Delhi, Bangalore, and Chennai Privacy Roundtable Events. CIS made closing statement on the Treaty for the Blind at the WIPO Diplomatic Conference which was concluded with the adoption of the Marrakesh Treaty to Facilitate Access to Published Works for Persons who are Blind, Visually Impaired, or otherwise Print Disabled. In a research paper Nehaa Chaudhari gives an analysis of patent pools, Sameer Boray gives an analysis of video piracy and Pranav Menon gives an analysis of India-EU FTA and issues surrounding data protection and security. In this period we organised the Institute on Internet and Society with support from the Ford Foundation at Golden Palms, Bangalore from June 8 to 14, 2013.

Celebrating 5 Years of CIS
CIS is now 5 years old and we just celebrated this by holding an open exhibition in our offices in Bangalore and Delhi from May 20 to 23, showcasing our work and accomplishments over the period. Access to Knowledge and Openness

The Wikimedia Foundation has given a grant to CIS to support and develop the growth of Indic language communities and projects by community collaborations and partnerships. This is being carried out by the Access to Knowledge team based in Delhi. CIS is also doing a project (Pervasive Technologies) on examining the relationship between production of pervasive technologies and intellectual property. CIS also promotes openness including open government data, open standards, open access, and free/libre/open source software through its Openness programme.

‘Miracle at Marrakesh’ to help visually impaired read

On Friday, in the same city that established the World Trade Organisation nearly two decades ago, another significant treaty was born. In Marrakesh, Morocco, international negotiators signed a treaty that will make access to books for the visually impaired, blind and print disabled easier.

After a week of intense debate among the negotiators (facilitated by the World Intellectual Property Organisation), the Marrakesh Treaty to Facilitate Access to Published Works for Persons who are Blind, Visually Impaired, or otherwise Print Disabled emerged.

It will address the ‘book famine’ for the visually impaired by “requiring its contracting parties to adopt national law provisions that permit the reproduction, distribution and making available of published works in accessible formats through limitations and exceptions to the rights of copyright right holders.” Very simply, it allows the waiver of copyright restrictions in order for books to be available in formats such as formats such as Braille, large print text and audio books.

Pranesh Prakash of the Centre for Internet and Society, in his closing remarks said: “It is historic that today WIPO and its members have collectively recognised in a treaty that copyright isn't just an ‘engine of free expression’ but can pose a significant barrier to access to knowledge.”

To recognise that copyright should not frustrate access for some groups of people and thereby to free books from that ‘constraint’ is of immeasurable significance for people otherwise unable to access books in the conventional format.

The treaty also provides assurances to authors and publishers that that system will not expose their published works to misuse or distribution to anyone other than the intended beneficiaries. “There are no winners and no losers, this is a treaty for everyone,” said Moroccan Minister of Communications Mustapha Khalfi, going on to describe it as the “Miracle in Marrakesh.”

There are an estimated 285 million blind and partially-sighted people in the world, of which the largest percentage lives in India. Only 1 to 7 per cent of all books published are available in formats accessible to them. India’s key campaigner for the treaty, the late Rahul Cherian of Inclusive Planet was full of beans when he spoke to The Hindu in December last year, anticipating the possibility of a treaty half a year later.

“It is a breakthrough!” he said excitedly as he broke the news, “The Extraordinary General Assembly of the World Intellectual Property Organisation has referred the Treaty for Visually Impaired Persons to a diplomatic conference in June of 2013.”

CIS's Closing Statement at Marrakesh on the Treaty for the Blind

Pranesh Prakash read out an abridged version of this statement as his closing remarks in Marrakesh, where the WIPO Treaty for the Blind (the "Marrakesh Treaty") has been successfully concluded. The Marrakesh Treaty aims to facilitate access to published works by blind persons, persons with visual impairment, and other print disabled persons, by requiring mandatory exceptions in copyright law to enable conversions of books into accessible formats, and by enabling cross-border transfer of accessible format books.

Thank you, Mr. President.

I am truly humbled to be here today representing the Centre for Internet and Society, an Indian civil society organization. If I may assume the privilege of speaking on behalf of my blind colleagues at CIS who led much of our work on this treaty, and the many blindness organizations we have been working with over the past five years who haven't the means of being here today, I would like to thank you and all the delegates here for this important achievement. And especially, I would like to thank the World Blind Union and Knowledge Ecology International who renewed focus on this issue more than 2 decades after WIPO and UNESCO first called attention to this problem and created a "Working Group on Access by the Visually and Auditory Handicapped to Material Reproducing Works Produced by Copyright".

While doing so, I would like to remember my friend Rahul Cherian — a young, physically impaired lawyer from India — who co-founded Inclusive Planet, was a fellow with the Centre for Internet and Society, and was a legal adviser to the World Blind Union. He worked hard on this treaty for many years, but very unfortunately did not live long enough to see it becoming a reality. His presence here is missed, but I would like to think that by concluding this treaty, all the distinguished delegations here managed to honour his memory and work.

I am grateful to all the distinguished delegations here for successfully concluding a reasonably workable treaty, but especially those — such as Brazil, India, Ecuador, Nigeria, Uruguay, Egypt, South Africa, Switzerland, and numerous others — who realized they were negotiating with blind people's lives, and regarded this treaty as a means of ensuring basic human rights and dignity of the visually impaired and the print disabled, instead of regarding it merely as "copyright flexibility" to be first denied and then grudgingly conceded. The current imbalance in terms of global royalty flows and in terms of the bargaining strength of richer countries within WIPO — many of who strongly opposed the access this treaty seeks to facilitate right till the very end — is for me a stark reminder of colonialism, and I see the conclusion of this treaty as a tiny victory against it.

It is historic that today WIPO and its members have collectively recognized in a treaty that copyright isn't just an "engine of free expression" but can pose a significant barrier to access to knowledge. Today we recognize that blind writers are currently curtailed more by copyright law than protected by it. Today we recognize that copyright not only may be curtailed in some circumstances, but that it must be curtailed in some circumstances, even beyond the few that have been listed in the Berne Convention. One of the original framers of the Berne Convention, Swiss jurist and president, Numa Droz, recognized this in 1884 when he emphasized that "limits to absolute protection are rightly set by the public interest". And as Debabrata Saha, India's delegate to WIPO during the adoption of the WIPO Development Agenda noted, "intellectual property rights have to be viewed not as a self contained and distinct domain, but rather as an effective policy instrument for wide ranging socio-economic and technological development. The primary objective of this instrument is to maximize public welfare."

When copyright doesn't serve public welfare, states must intervene, and the law must change to promote human rights, the freedom of expression and to receive and impart information, and to protect authors and consumers. Importantly, markets alone cannot be relied upon to achieve a just allocation of informational resources, as we have seen clearly from the book famine that the blind are experiencing. Marrakesh was the city in which, as Debabrata Saha noted, "the damage [of] TRIPS [was] wrought on developing countries". Now it has redeemed itself through this treaty.

This treaty is an important step in recognizing that exceptions and limitations are as important a part of the international copyright acquis as the granting of rights to copyright holders. This is an important step towards fulfilling the WIPO Development Agenda. This is an important step towards fulfilling the UN Convention on the Rights of Persons with Disabilities. This is an important step towards fulfilling Article 27 of the Universal Declaration of Human Rights, Article 15 of the International Covenant on Economic Social and Cultural Rights and Article 30 of the UN Convention on Persons with Disabilities, all of which affirm the right of everyone — including the differently-abled — to take part in cultural life of the community.

While this treaty is an important part of overcoming the book famine that the blind have faced, the fact remains that there is far more that needs to be done to bridge the access gap faced by persons with disabilities, including the print disabled.

We need to ensure that globally we tackle societal and economic discrimination against the print disabled, as does the important issue of their education. This treaty is a small but important cog in a much larger wheel through which we hope to achieve justice and equity. And finally, blind people can stop being forced to wear an eye-patch and being pirates to get access to the right to read.

I also thank the WIPO Secretariat, Director General Francis Gurry, Ambassador Trevor Clark, Michelle Woods, and the WIPO staff for pushing transparency and inclusiveness of civil society organizations in these deliberations, in stark contrast to the way many bilateral and plurilateral treaties such as Anti-Counterfeiting Trade Agreement, the India-EU Free Trade Agreement, and the Trans-Pacific Partnership Agreement have been, and are being, conducted. I hope we see even more transparency, and especially non-governmental participation in this area in the future.

I call upon all countries, and especially book-exporting countries like the USA, UK, France, Portugal, and Spain to ratify this treaty immediately, and would encourage various rightholders organizations, and the MPAA who have in the past campaigned against this treaty and now welcome this treaty, to show their support for it by publicly working to get all countries to ratify this treaty and letting us all know about it.

I congratulate you all for the "Miracle of Marrakesh", which shows, as my late colleague Rahul Cherian said, "when people are demanding their basic rights, no power in the world is strong enough to stop them getting what they want".

A 'Kannada' Wikipedia Workshop for Bloggers

On Sunday, June 23, 2013, a day-long Kannada Wikipedia workshop was conducted at Suchitra, Bengaluru for Kannada bloggers by the Centre for Internet and Society's Access to Knowledge (CIS-A2K) team. This blog post gives a report on the workshop.

There was a demand from Kannada bloggers that they need some orientation on editing Kannada Wikipedia. There were informal talks on this since the last 2-3 months on when and how the event should be organised. CIS-A2K collaborated with Suchitra Film and Cultural Society, Bengaluru and Avadhi. G N Mohan of Avadhi and Prakash Belavadi of Suchitra helped in getting the conference room of Suchitra available for the workshop.

Announcement was made in the KannadaWikipedia group of Facebook. This group has more than 2000 members. One member even sent a message questioning the wisdom of inviting everyone for the workshop. He asked, "can we accommodate all the people if they turn up?" However, I was quite sure that not more than 25 will turn up. The reason being the condition that participants should come with their own laptops and internet connections. As the workshop date neared, more and more people began registering for participation. The number reached 56 on the previous night. I sent a message requesting people to reconfirm the participation as the conference room could accommodate 25 people only. Few people withdrew and only 13 persons reconfirmed.

June 23, being a Sunday, the personnel at Suchitra came to open the room only at 9.50 a.m. Myself and some participants were there at 9.20 a.m. itself. Once everyone settled down, there was an issue with the projector. My ultrabook has only a mini HDMI port. I keep an HDMI-to-VGA converter and have been using it from the last 2-3 workshops. It worked well at those places. But on June 23, it refused to work. I then exchanged my ultrabook with another participant and the presentation and workshop begun. I had sent some tutorial files to all those who confirmed participation. All of them came and surprisingly, there were two more participants, who hadn't confirmed their participation. That accelerated the participation by them. This itself was very encouraging. That means the participants who came that day were really serious of editing Wikipedia.

The workshop was conducted intermixing presentation and hands-on. By evening everyone had learnt how to edit Wikipedia, how to create headings, sub-headings, bulleted lists, text, numbered text, how to insert Wiki links as well as external links, etc. People picked up inserting reference as well quite quickly. Since majority of them were bloggers, they already knew the concepts but wanted to know the Wiki syntax which they picked up by the end of the workshop.

Harish M G, who is an admin with Kannada Wikipedia joined the workshop and helped in clearing many advanced doubts.

The result of the workshop is quite encouraging. Most of them have added contents and edited some existing pages as well. Thanks are due to Suchitra for sponsoring the venue and to Avadhi for co-organising this event.

A Treat for the Blind

The WIPO treaty will provide copyright exceptions on books making them available to blind people in formats they can use.

For millions of visually impaired people around the globe, it’s a landmark treaty that could open up the kingdom of books for them. After days of intense deliberations at Marrakesh in Morrocco, about 600 World Intellectual Property Organisation (Wipo) negotiators, including delegates from India, reached a consensus on a treaty that will provide copyright exceptions on books making them available to blind people in formats they can use.

Wipo, a United Nations agency, is dedicated to the use of intellectual property as a means of stimulating innovation and creativity. The agency has 186 member states.

Sure, content is king. But for the visually impaired, the right platform for accessing content is what makes the difference. Thanks to audio books, a host of apps, and digital platforms such as Bookshare, which provides content in accessible formats, the technology is already there to bring the rich world of 'hardcovers' and 'paperbacks' alive for those who cannot see. What’s more, these books are compatible with all kinds of devices from mobile phones to tablets to PCs.

Now, at last, there is legal sanction as well to content that was not being made available in accessible formats by the copyrights holders. For the 15 million people who are blind in India, the treaty is expected to open education doors as well as provide entertainment needs. India has the world’s largest number of blind people.

Bangalore-based Centre for Internet Society, a policy research organisation, has been at the forefront of negotiations at WIPO to get the treaty through. Minutes after the session concluded, Pranesh Prakash, policy Director at CIS and his colleague Sunil Abraham were tweeting ecstatically about the “win”.

For five long years, this Wipo treaty has witnessed contentious discussions on issues such as including exports of copyrighted works, translations of copyrighted works and so on. According to Prakash, who responded over twitter, “On Exports we won, but re-exports which was earlier permitted has become much more difficult.”

There are also other grainy areas such as commercial availability of the books. According to a post on the Intellectual Property Watch website, soon after the agreement was reached, commercial availability still stands under Article 4 (National Law Limitations and Exceptions on Accessible Format Copies) but has disappeared from Article 5 (cross border exchange of accessible format copies).

Although blind music legend Stevie Wonder, one of the most ardent supporters of the treaty, must be crooning Signed, Sealed, Delivered... it’s early days yet. The draft of the treaty has to be ratified by governments before being adopted.

But for five long years, it has been a long hard battle between copyright owners and those fighting for human rights of the visually impaired. Finally, as one observer, put it: 'a rare victory is in sight for human rights'.
