    <title>CIS' Submission to DIPP and CGPDTM at meeting with IP Stakeholders</title>

        &lt;b&gt;The Office of the Controller General of Patents, Designs and Trademarks held a meeting with IP stakeholders on December 7, 2017, chaired by the Secretary, DIPP, to take suggestions on improving procedures and functioning of the Office. Anubha Sinha attended the meeting and requested the DIPP to improve compliance of uploading Form 27s by patentees and ensure proper enforcement of related provisions within the Indian Patent Act, 1970. Additionally, we sent a detailed submission to the Office, drawing from our recent research. Thanks to Rohini Lakshane and Aman Goyal for their inputs. &lt;/b&gt;
        
&lt;h3 align="center" style="text-align: justify;"&gt;&lt;strong&gt;Submission to the Department of Industrial Planning and

&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p style="text-align: justify;" class="MsoListParagraphCxSpFirst"&gt;1. As the DIPP is aware, the Indian
mobile device manufacturing industry is mired in issues related to licensing of
standard essential patents (SEPs). Disputes have resulted in imposition of
heavy interim royalty rates on Indian manufacturers, payable to foreign SEP
holders. Section 146(2) of the Patent Act, 1970 mandates patentees to provide
information on working of patents, which is crucial for willing licensees to access patent working information in a timely manner.
This requirement, that the details of patent working be disclosed by patentees
supports the goal of making unworked patents available for compulsory licensing
in India, both to promote economic development and public access to patented
products. Penalties for failing to furnish such information (via Form 27) are
steep, potentially resulting in fines or imprisonment.&lt;/p&gt;
&lt;p style="text-align: justify;" class="MsoListParagraphCxSpMiddle"&gt;2. We note that in 2009, 2013 and 2015
the Controller issued public notices calling on patent owners to comply with
their obligations to file statements of working on Form 27. Further, on
February 12, 2013, the Indian Patent Office (IPO) announced plans to make Form
27 submissions for the year 2012 available to the public via the IPO website.&lt;/p&gt;
&lt;p style="text-align: justify;" class="MsoListParagraphCxSpMiddle"&gt;3. We commend the efforts of the IPO, however,
our empirical research on ICT innovations&lt;a name="_ednref1" href="#_edn1"&gt;&lt;span class="MsoEndnoteReference"&gt;&lt;span class="MsoEndnoteReference"&gt;[i]&lt;/span&gt;&lt;/span&gt;&lt;/a&gt; as well as by Prof. Shamnad
Basheer (on ICT and pharmaceutical sector)&lt;a name="_ednref2" href="#_edn2"&gt;&lt;span class="MsoEndnoteReference"&gt;&lt;span class="MsoEndnoteReference"&gt;[ii]&lt;/span&gt;&lt;/span&gt;&lt;/a&gt; reveals that there are serious
lapses as far as compliance and enforcement of statutory provisions mandating
filing of Form 27 are concerned.&lt;/p&gt;
&lt;p style="text-align: justify;" class="MsoListParagraphCxSpLast"&gt;4. In the past year, we studied data
available from 2009- 2016 for the mobile device sector, and could only identify
and access 4,916 valid Forms 27, corresponding to 3,126 mobile device patents,
leaving&amp;nbsp; 1,186 Indian patents for which a
Form 27 could have been filed, but was not found.&lt;a name="_ednref3" href="#_edn3"&gt;&lt;span class="MsoEndnoteReference"&gt;&lt;span class="MsoEndnoteReference"&gt;[iii]&lt;/span&gt;&lt;/span&gt;&lt;/a&gt; &amp;nbsp;For a surprising number of Form 27s (3%) the
working status of the relevant patent was not designated.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Even among the Form 27s that had been
obtained, almost none contained useful information regarding the working of the
subject patents or fully complying with the informational requirements of the
Indian Patent Rules. Many patentees simply omitted required descriptive
information from their forms without any explanation.&lt;a name="_ednref4" href="#_edn4"&gt;&lt;span class="MsoEndnoteReference"&gt;&lt;span class="MsoEndnoteReference"&gt;[iv]&lt;/span&gt;&lt;/span&gt;&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Via our research we also gathered
complaints raised by patentees and industry observers regarding the structure
of the Form 27 requirement itself. For example, patents covering complex,
multi-component products that embody dozens of technical standards and
thousands of patents may not necessarily be amenable to the individual-level
data requested by Form 27.&lt;/p&gt;
&lt;p style="text-align: justify;" class="MsoListParagraphCxSpFirst"&gt;5. Regardless, we submit that these
technical difficulties should not hinder the critical statutory requirement
placed on patent holders to diligently comply with Form 27 compliance. In the
context of licensing of SEPs, several stakeholders recently suggested solutions
as revealed from our study of the submissions made to the TRAI Consultation on
Promoting Local Telecom Manufacturing&lt;a name="_ednref5" href="#_edn5"&gt;&lt;span class="MsoEndnoteReference"&gt;&lt;span class="MsoEndnoteReference"&gt;[v]&lt;/span&gt;&lt;/span&gt;&lt;/a&gt;:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;Two
industry associations, namely Telecom Equipment Manufacturers Association of
India &amp;nbsp;(TEMA) and Telecom Equipment &amp;amp; Services Export Promotion Council (TEPC) and a telecommunication
enabler Vihan Network Limited recommended that a modified and longer version of Form 27 (Form 27S) may be designed for SEP
holders that should apply right at the filing stage. Section 159 of the
Patent Act, 1970 empowers the central government to make such modifications to the form, as necessary.&lt;a name="_ednref6" href="#_edn6"&gt;&lt;span class="MsoEndnoteReference"&gt;&lt;span class="MsoEndnoteReference"&gt;[vi]&lt;/span&gt;&lt;/span&gt;&lt;/a&gt;&lt;/li&gt;&lt;li&gt;Further,
Prof. T Ramakrishna (MHRD Chair on Intellectual Property Rights) at NLSIU, specifically
recommended that Form 27 may be amended
to include a new column, which may require the patent holder to declare
if their patent forms a part of any standard and in case of affirmative answer
– the name of the Standard Setting Organisation and corresponding standard of
which it is a part.&lt;/li&gt;&lt;/ul&gt;
&lt;p style="text-align: justify;" class="MsoListParagraphCxSpMiddle"&gt;&amp;nbsp;6. Further, we would like to draw
attention to how our study was limited by the technical capabilities of the
Indian Patent Office’s online Form 27 repository, such as&lt;a name="_ednref7" href="#_edn7"&gt;&lt;span class="MsoEndnoteReference"&gt;&lt;span class="MsoEndnoteReference"&gt;[vii]&lt;/span&gt;&lt;/span&gt;&lt;/a&gt;:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;IPAIRS
returned either a 404 error or Connection Time Out ("site is taking too
long to respond") &lt;a href="http://ipindiaonline.gov.in/patentsearch/search/index.aspx"&gt;http://ipindiaonline.gov.in/patentsearch/search/index.aspx&lt;/a&gt;. In our opinion, it could be
redirected to InPASS as it uses the same search engine as InPASS. &amp;nbsp;Further, &lt;a href="http://ipindia.nic.in/patsea.htm"&gt;http://ipindia.nic.in/patsea.htm&lt;/a&gt; returned a 404 error.&lt;/li&gt;&lt;li&gt;Some
PDFs of the forms comprise scanned image files without OCR of the text. This
makes them inaccessible to the visually impaired, and prevents search and
discoverability of their content. This also makes them less usable by
preventing copying and selection of text.&lt;/li&gt;&lt;li&gt;In some cases, it was difficult to identify
which one in the list of documents associated with a patent is Form 27, because
of obscure filenames.&lt;/li&gt;&lt;/ul&gt;
&lt;ul&gt;
&lt;ul&gt;&lt;li&gt;
&lt;p&gt;For
example, for Patent Number 262228, Form 27 was named 68.262228.pdf, as found on
IPAIRS.&lt;/p&gt;
&lt;/li&gt;&lt;li&gt;
&lt;p&gt;For
Patent number 260603, the filename for Form 27 was "ipindiaonline.gov.in_epatentfiling_online_frmPreview.asp.pdf"
on IPAIRS.&lt;/p&gt;
&lt;/li&gt;&lt;/ul&gt;
&lt;/ul&gt;
&lt;ul&gt;&lt;li&gt;Inconsistency in search results found on
IPAIRS. Searching for the peripheral documents of the patents, returned the
results, "No PDF found" for one full week. The next week, the
documents started showing. Some searches returned results for an entirely
different patent number.&lt;/li&gt;&lt;li&gt;Sometimes,
Form 27 found on InPASS was not found on IPAIRS and vice versa.&lt;/li&gt;&lt;li&gt;Runtime
errors occur due to browser caching.&lt;/li&gt;&lt;/ul&gt;
&lt;p style="text-align: justify;" class="MsoListParagraphCxSpLast"&gt;7. We are thankful to DIPP for the
opportunity to make these submissions. It would be our pleasure and privilege
to discuss these submissions and recommendations in details with the DIPP. We
also offer our assistance on other matters aimed at developing a suitable
policy framework for SEPs and FRAND in India, and, working towards sustained

Section 159 of the Patent Act, 1970 empowers the central government to make such modifications to the form, as necessary.&lt;a name="_ftnref6"&gt;&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;Further, Prof. T Ramakrishna (MHRD Chair on Intellectual Property Rights) at NLSIU, specifically recommended that Form 27 may be amended to include a new column, which may require the patent holder to declare if their patent forms a part of any standard and in case of affirmative answer â€“ the name of the Standard Setting Organisation and corresponding standard of which it is a part.&lt;/li&gt;
&lt;li&gt;Further, we would like to draw attention to how our study was limited by the technical capabilities of the Indian Patent Officeâ€™s online Form 27 repository, such as&lt;a name="_ftnref7"&gt;&lt;/a&gt;:&lt;/li&gt;
&lt;/ol&gt; 
&lt;ul&gt;
&lt;li&gt;IPAIRS returned either a 404 error or Connection Time Out ("site is taking too long to respond") &lt;a href="http://ipindiaonline.gov.in/patentsearch/search/index.aspx"&gt;http://ipindiaonline.gov.in/patentsearch/search/index.aspx&lt;/a&gt;. In our opinion, it could be redirected to InPASS as it uses the same search engine as InPASS. Â Further, &lt;a href="http://ipindia.nic.in/patsea.htm"&gt;http://ipindia.nic.in/patsea.htm&lt;/a&gt; returned a 404 error.&lt;/li&gt;
&lt;li&gt;Some PDFs of the forms comprise scanned image files without OCR of the text. This makes them inaccessible to the visually impaired, and prevents search and discoverability of their content. This also makes them less usable by preventing copying and selection of text.&lt;/li&gt;
&lt;li&gt;In some cases, it was difficult to identify which one in the list of documents associated with a patent is Form 27, because of obscure filenames. &lt;/li&gt;
&lt;li&gt;For example, for Patent Number 262228, Form 27 was named 68.262228.pdf, as found on IPAIRS.&lt;/li&gt;
&lt;li&gt;For Patent number 260603, the filename for Form 27 was "ipindiaonline.gov.in_epatentfiling_online_frmPreview.asp.pdf" on IPAIRS.&lt;/li&gt;
&lt;li&gt;Inconsistency in search results found on IPAIRS. Searching for the peripheral documents of the patents, returned the results, "No PDF found" for one full week. The next week, the documents started showing. Some searches returned results for an entirely different patent number.&lt;/li&gt;
&lt;li&gt;Sometimes, Form 27 found on InPASS was not found on IPAIRS and vice versa.&lt;/li&gt;
&lt;li&gt;Runtime errors occur due to browser caching.&lt;/li&gt;
&lt;/ul&gt;

&lt;p dir="ltr"&gt;Nichole Saad, Program Manager, Wikipedia Education Program, Wikimedia Foundation visited Christ University, Bengaluru to conduct a periodic review of the Wikipedia Education Program. The meeting was conducted along with CIS-A2K and Department of Language faculty: Dr. Mallika Krishnaswami, Dr. K.A. Sebastian, Dr. Rathi and Dr. Shivaprasad.&lt;/p&gt;
&lt;p&gt;&lt;strong id="docs-internal-guid-49701e61-659a-cb4a-79c1-b0c9232d01b5"&gt;&lt;br /&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p dir="ltr"&gt;The review kicked off with an introduction to Ms. Saad regarding the work that has been going on at the University. Registrar, Dr. Anil Pinto addressed the gathering of faculty of the Department of Languages and CIS-A2K team members. Student representative Shamama was also present.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;br /&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p dir="ltr"&gt;Upon giving an introduction to the University itself, Dr. Pinto spoke about the genesis of the Program which was, at its heart, a loss of interest in languages. He spoke of the various ways in which the program has engaged with language: promoting science in regional language, publishing Christ University books on Wikisource, digitising old/ rare books, in addition to editing of articles, creating articles and creating articles in their specialities. On the future of the program, he felt that moving ahead to asking "faculty member in other disciplines if they can accept assignments submitted in languages other than English(despite the fact that the medium of instruction is English)” would be a good way forward. Dr. Pinto continued, “Wikipedia is the best tool available to us to go digital. We are happy that Wikipedia builds in the process and our students also learn.” He said that there were also plans to get all PhD students to go through a Wikipedia workshop to create knowledge specific to their subject.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;br /&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p dir="ltr"&gt;Speaking next, Tanveer, Program Manager, CIS-A2K, expressed his gratitude to Christ University for enabling CIS-A2K to conduct the Wikipedia Education program at the University. He pointed out that even before the WMF started thinking about the New Readers program, CIS-A2K had engaging students at Christ University who had not previously engaged with Wikipedia. This marked a shifting away from digital learning to critical thinking in knowledge production and creation.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;br /&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p dir="ltr"&gt;Just as in other WEP programs, there has been an inclination towards a specific topic. For example, Pune University has been working on gender. When this all comes together, it gives a composite view of knowledge production in indian language. There is also the need to escalate the discussion to a core academic level- a fruitful engagement mode with different points of view.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;br /&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p dir="ltr"&gt;CIS-A2K’s WEP interventions have also been offering certificate courses for students as well as internships in order to understand a) the work their peers have done and b) the value addition they can do. This is exciting because this results in a large outreach and lends to learn and thinking on our feet constantly. As with every intervention, there are challenges that astonish that we need to think about and integrate into our work. In conclusion, he pointed out that the WEP at Christ is a challenge that CIS-A2K relishes.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;br /&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p dir="ltr"&gt;The attendees further discussed the need to not only keep the community abreast of WEP activities but to also acknowledge and understand the feeling of ownership that comes with working on Wikimedia projects. Another commendable feature of the WEP at Christ remains the fact that students take on the role of campus ambassadors. The outcomes of the program have been documented in the Kannada media with a paper presentation as well. The attendees discussed possible research outputs as well.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;br /&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p dir="ltr"&gt;Finally, Ms. Saad spoke of the importance of sharing wisdom and experiences in review meetings like these. She said that the focus of the Wikimedia movement is to go to places where people don’t have access and go to marginalised communities and make education accessible to them. This has the potential to change people’s lives as they will get access to information and skills to navigate a digitally literate world. Ms. Saad also spoke about using Wikimedia projects in classrooms. She said, “it can’t happen overnight, can’t become familiar with it right away or comfortable with it. However with pioneers like Christ University in this space, who areopen minded to it, the impact is greater than just number and statistics."&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;br /&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p dir="ltr"&gt;During the later sessions, Ms. Saad conducted activities that enabled students to ponder the following questions:&lt;/p&gt;

&lt;p dir="ltr"&gt;The Centre for Internet and Society - Access to Knowledge program, in partnership with Christ University, is announcing its annual internship program for the 1200 students enrolled in the Wikipedia Education Program. The Wikipedia Education Program at Christ University, now in its fourth year, is an effort to bring together educators and students to use Wikipedia as an educational implement. CIS-A2K conducts the internship activity for passionate Christ University students to improve the quality of the articles created or edited by their fellow WEP peers. The internship will largely involve improving upon the articles created by their peers as well as gathering community consensus based on which these articles would be moved to the main namespace.&lt;/p&gt;
&lt;p&gt;&lt;strong id="docs-internal-guid-f831cc41-4682-753a-ab43-fabdf30eafba"&gt;&lt;br /&gt;&lt;/strong&gt;&lt;/p&gt;
&lt;p dir="ltr"&gt;The students will be working on Wikipedia over the course of 21 days in developing upon the content created by Christ University Wikipedia Education Program participants. The fledgling articles currently housed in the individual “sandboxes” of the WEP participants will be improved upon by the interns through addition of detailed content, images and info-boxes.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p dir="ltr"&gt;The students are selected based on three main criteria: fluency of language(written and spoken), knowledge of Wikipedia and its processes, and their personal interest levels. The applications are open from 13 to 17 December, 2017. Interested students can apply here:&lt;/p&gt;

        &lt;b&gt;CIS-A2K in conjunction with the Rotary Club of Salem, Tamil Nadu conducted a two-day Wikipedia orientation workshop for student members of the club.&lt;/b&gt;
        
&lt;p&gt;Over the December 9- 10 weekend, CIS-A2K, in conjunction with the Rotary Club of Salem, Tamil Nadu conducted a two-day Wikipedia orientation workshop. This workshop focussed on teaching the basics of Wikipedia to all the student members of the club. The overwhelming participation of women volunteers was the highlight of the event. The workshop was organised by the Rotary Club while Salem Tamil Sangam also lent its support to the program. The President of the Rotary Club of Salem implored the students to contribute to the Tamil language by involving themselves more deeply with the Wikimedia projects.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;With 13 female participants and 10 male participants, the participants were upbeat throughout both days. Veteran Tamil Wikipedian, Tamil Parithi acted as resource person along with CIS-A2K. Mr. Parithi explained the philosophy and history of the free knowledge movement which he felt was essential to the understanding of the wider Wikimedia movement. Usha Sanghamitra, a participant, reflects, "I previously thought some company was doing this but I am glad to note that it is people like you and me that are editing this information and creating such knowledge resources. I will surely take this up and continue to engage with Wikipedia."&lt;/p&gt;
&lt;p&gt;A follow-up workshop is on the cards in December 2017.&lt;/p&gt;

        &lt;b&gt;Anubha Sinha attended a DIPP meeting with stakeholders on December 7, 2017 in New Delhi. The meeting was organized by the Government of India. &lt;/b&gt;
        &lt;p&gt;Anubha made submissions pertaining to CIS' study on lack of compliance and enforcement in respect of filing statements of working of patents:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;Large percentage (~ 20%) of patents' Form 27s  were found to be missing (dataset of approx 5000 patents);&lt;/li&gt;
&lt;li&gt; 3% of the patents did not mention status on working of patents;&lt;/li&gt;
&lt;li&gt; Almost none of the available Form 27s provided any useful information - patentees did not bother filling out several parts of the Form.&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;In addition, I sent a brief on the issue drawn from Prof. Contreras' and Rohini's paper, and Rohini's older email to the IPO describing issues with the website.&lt;/p&gt;

&lt;p&gt;A Wikimedia Technical Workshop was conducted between 27- 28 November, 2017 at the Department of Mathematics,&amp;nbsp;Savitribai Phule Pune University. The objective of the workshops was us to understand how Wikipedia works and what career opportunities there are related to Wikipedia and how one can contribute to and enrich the open source knowledge for the benefit of all.&lt;/p&gt;
&lt;p&gt;On the first day, the students were given an introduction to Wikimedia projects as well as Marathi Wikipedia. They were also taught account creation and given a general introduction to Wikipedia , MediaWiki, and wikis in addition to&amp;nbsp;Wikipedia structure, article structure, name spaces, common.css and common.js pages, and gagdets. In the post-lunch session the participants were given an introduction to gadgets, scripts, tool and bots.&lt;/p&gt;
&lt;p&gt;On the second day, the participants continued where they left off by learning about advanced tools and bots like Archive Bot, Sign bot, Anti-vandalism bots as well as Phabricator. Finally, the session ended with talks about future projects and activities.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;22 participants attended the event.&lt;/p&gt;

&lt;p&gt;A Kannada Wikipedia orientation workshop was held at the&amp;nbsp;Entrepreneurship Centre, SID, Indian Institute of Science, Bengaluru on 26 November, 2017. The day long event was aimed at adding content to Kannada Wikimedia projects on topics such as ecology, environment, wildlife and sciences of Karnataka. The event was organised by&amp;nbsp;Gubbi Labs in conjunction with CIS-A2K. Gubbi Labs is a research collective and social collective run by environmental scientists. The event was attended was attended by 8 participants of which one member was female.&lt;/p&gt;
&lt;p&gt;The participants created six articles and expanded one article. The impact of this workshop was the fact that participants were made aware of the importance of open access data. It helped initiate another similar workshop in Mysuru. Upon sharing the idea for projects like Wiki Loves Butterfly Idea, a participant was interested in starting a project titled 'Wiki Loves Spiders'. We are hoping to take this project forward on Kannada Wikipedia.&lt;/p&gt;

        &lt;b&gt;On November 21, 2017, Anubha Sinha attended a civil society workshop on  "WTO-MC11 in Buenos Aires:  What is at Stake for India and its People". The workshop was  co-organised ​by the Third World Network,  ​Focus on the Global South, ​South-Solidarity Initiative of Action Aid, ​and the Forum on FTAs  ​at the Seminar Hall 1 &amp; 2, New Block, India International Centre, 40 Max Mueller Marg, New Delhi.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;As the   ​Eleventh Ministerial Conference (MC11) of the World Trade Organisation (WTO) ​in Argentina ​draws near, it is important to create awareness among broad constituencies in India about the issues on the table, especially the challenges facing developing countries​. We need​ to jointly learn about the linkages between these global policy decisions ​and their grass root level impacts. The issues at stake during the forthcoming Ministerial​; agriculture domestic subsidies, ​permanent solution on public food stockholding (PDS), ​special safeguard mechanism, fisheries subsidies, and the new issues around e-commerce and investment facilitation are all of great interest to India  and its people and will ​impact a range of constituencies ​including farmers, trade unions, fisherfolk, internet and IP activists, patient groups, women and indienous communities and so on. So it is imperative that   ​all of us are involved and part of a wider consultation, so as to know   the negotiating process, what is on the table and most importantly to amplify peoples' voices both at the national and global levels.&lt;/p&gt;

&lt;hr style="text-align: justify; " /&gt;
&lt;p style="text-align: justify; "&gt;On October 28, 2017, a group of panelists in the faculty hall at &lt;a href="https://indiabioscience.org/orgs/iisc" target="_blank" title="Indian Institute of Science (IISc),"&gt;Indian Institute of Science (IISc),&lt;/a&gt; discussed  the framework of policies that can help academic institutions embrace  open access in letter, spirit and action. The discussion was a part of  week-long activities organised by &lt;span class="caps"&gt;DST &lt;/span&gt;Centre for Policy Research (&lt;span class="caps"&gt;DST&lt;/span&gt;–&lt;span class="caps"&gt;CPR&lt;/span&gt;) at IISc to increase awareness and acceptability for open access publishing in India.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;img src="https://cis-india.org/home-images/OA.png/@@images/3939a474-dc8c-4f7b-b3ee-20b19b8f0e18.png" alt="OA" class="image-inline" title="OA" /&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The panel included Jayant Modak, deputy director, IISc, Satyajit Mayor, director of &lt;a href="https://indiabioscience.org/orgs/ncbs" target="_blank" title="National Centre for Biological Sciences"&gt;National Centre for Biological Sciences&lt;/a&gt; and &lt;a href="https://indiabioscience.org/orgs/instem" target="_blank" title="inStem"&gt;inStem&lt;/a&gt;, Padmini Ray Murray, vice-chair, &lt;a href="http://www.globaloutlookdh.org/" target="_blank" title="Global Outlook: Digital Humanities"&gt;Global Outlook: Digital Humanities&lt;/a&gt;, &lt;span class="caps"&gt;N.V.&lt;/span&gt; Sathyanarayana, chairman and managing director, &lt;a href="http://www.informaticsglobal.com/" target="_blank" title="Informatics India Ltd"&gt;Informatics India Ltd&lt;/a&gt; and Madan Muthu, visiting faculty at &lt;a href="https://iiscdstcpr.wordpress.com/" target="_blank" title="DST-CPR at IISc."&gt;&lt;span class="caps"&gt;DST&lt;/span&gt;–&lt;span class="caps"&gt;CPR&lt;/span&gt; at IISc.&lt;/a&gt; The discussion was anchored and moderated by Sunil Abraham, executive director, &lt;a href="https://cis-india.org/" target="_blank" title="Centre for Internet and Society."&gt;Centre for Internet and Society.&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Open access is a form of publishing that makes the fruits of  research, such as journal papers and other forms of data accessible to  anyone interested in it, without a cost. World over, a large number of  universities and institutions are beginning to give up the library  subscription model of publishing to make way for open access, owing to  the latter’s lower cost and higher visibility.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In India too, funding agencies like &lt;span class="caps"&gt;DBT&lt;/span&gt; and &lt;span class="caps"&gt;DST&lt;/span&gt; have  laid out guidelines that require researchers to submit their research  output in open access repositories. Ironically though, most researchers  have shied away from submitting their work in the repositories. Which  raises the question, why?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In fact, this was one of the first questions that the panelists  debated upon. Abraham initiated the discussion by asking the panelists –  What are the weaknesses of &lt;span class="caps"&gt;DBT&lt;/span&gt;–&lt;span class="caps"&gt;DST&lt;/span&gt; policy  on open access? Why have a large number of scientists not followed the  guidelines laid by the policy? Is it because the policy document does  not talk about any punitive measures for scientists in the event of not  depositing their work in the institutional repositories (IRs)? And, how  can the policy be improved?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Modak opened the argument by saying that we as a nation are good at  making provisions but bad with implementation. He agreed that scientists  are yet to warm up to the idea of open access but was disinclined on  using punitive measures to force scientists into submitting their work  in IRs. Mayor, in agreement with Modak, said that the policy document is  advisory in nature and sort of lacks ‘teeth’. However, he too was  against the use of punitive measures.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Murray, the third academician on the panel said that though the  policy talks about staying away from publisher-based metrics like impact  factor to assess a scientist’s work, it does not provide any  information about what alternative metrics can be used to measure it.  She suggested that the accessibility of a scientist’s work and how much  effort she has put in to make it easily available to non-scientists  could be used as a metrics for measurement. She also drew attention to  the fact that the policy completely bypasses the requirements of  independent scholars and those working in languages other than English.  “Which institutional repository should they deposit their work in?”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Sathyanarayana, the fourth panelist and a strong advocate of open  access said, the policy document “lacks an aggressive strategy” to drive  a disruptive and “fundamentally voluntary model” of adopting open  access. He asked the other panelists and the audience, “why have  repositories like ResearchGate become so successful and attractive for  researchers? Why can’t open access IRs be modelled along the lines of  such repositories? His argument was that the IRs can be fashioned in a  way to make them a ‘convenient step in the process of research’”. One  suggestion that he offered was that IRs can be structured as a paper  submission platform. So that anybody who is interested in publishing  their work first puts it up in the &lt;span class="caps"&gt;IR&lt;/span&gt; and only after that the process of going to a journal begins.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Muthu, the fourth panelist and a long-time crusader for open access  in India said that scientists in India have stayed away from the open  access publishing because they don’t fully realise that in traditional  models of publishing, you surrender all copyrights of your work to the  publisher. He added that more scientists can be encouraged to adopt the  open access model of publishing by making IRs institute-managed, easier  to use and as a mandatory step in the process of publishing.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mayor added to this argument by saying that the idea of submitting (unpublished) work in an &lt;span class="caps"&gt;IR&lt;/span&gt; is  quite similar to the concept of pre-print archives which are fast  becoming a powerful way of sharing work. Almost all top journals accept  work that has been published in a pre-print archive. In fact, in the  physical sciences, people have been using pre-print archives for a long  time and now slowly, even the biology community is warming up to it.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Murray emphasised on the need to talk to students about open access  and making them aware of the ways to design their metadata so that it is  amenable to open access repositories.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;As the discussion inched closer to its final moments, it veered off  towards the costs of open access publishing. Modak said that in the last  year alone, the amount of money IISc has spent for publishing papers  has doubled. If all researchers start opting for open access (&lt;span class="caps"&gt;OA&lt;/span&gt;) journals/hybrid-&lt;span class="caps"&gt;OA&lt;/span&gt; journals  that charge the authors nearly double of what traditional journals do,  then publishing papers will become unsustainable.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;To this, Sathyanarayana said, it may appear that the cost of publishing in &lt;span class="caps"&gt;OA&lt;/span&gt; journals  is high, but on a macro-level, when you consider the cost of publishing  and accessing all the papers published in a year, then the &lt;span class="caps"&gt;OA&lt;/span&gt; model  costs much lesser. He added that scientific publishing is the only  business in the world where authors (creators of proprietary material)  give away all their rights to publishers.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Backing up the points made by Sathyanarayana, Murray said that in  traditional models of publishing the publishers make close to 400%  profits. We need to think about, “how much labour we as academics put in  for publishers’ profits?”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is authors’ inertia that is stopping open access from becoming the obvious model of publishing, said, Muthu.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In conclusion, Abraham summed up the arguments and acknowledged that  there are many dimensions to open access and an institutional policy on &lt;span class="caps"&gt;OA&lt;/span&gt; cannot be framed in a vacuum. Common people need to participate in the debate to shape the direction the policy takes.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;i&gt;Apart from the panel discussion a poster competition and a quiz competition were organised as part of the &lt;span class="caps"&gt;OA&lt;/span&gt;-week activities. &lt;span class="caps"&gt;DST&lt;/span&gt;–&lt;span class="caps"&gt;CPR&lt;/span&gt; was joined by the student’s council at IISc, Centre for Contemporary Studies, &lt;span class="caps"&gt;JRD&lt;/span&gt; Tata Library and IndiaBioscience in organising the activities.&lt;/i&gt;&lt;/p&gt;

    <title>35th SCCR: CIS' Question to Dr. Rostama on her Study on the Impact of the Digital Environment on Copyright Legislation</title>

        &lt;b&gt;Anubha Sinha, attending the 35th Session of the World Intellectual Property Organization (“WIPO”) Standing Committee on Copyright and Related Rights (“SCCR”) at Geneva from 13 November, 2017 to 18 November, 2017, posed this question on the agenda 'Other Matters' on behalf of CIS on Day 5, 17 November, 2017. &lt;/b&gt;
        
&lt;p&gt;&lt;/p&gt;
&lt;p&gt;&lt;/p&gt;
&lt;p&gt;Thank you for the presentation, Dr. Rostamma.&lt;/p&gt;
&lt;p&gt;My question relates to provisions allowing reverse
engineering of computer programmes. You mentioned that 81% of member states (with the scope of your study)
have exceptions for compilation and interoperability of computer programmes.&lt;/p&gt;
&lt;p&gt;Can you comment, qualitatively, on how open/ strict you have
found the limitations and exceptions to be in your study? Is there a member
state that stands out in its treatment of limitations and exceptions for
computer programmers, and/or users of such digital objects?&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Answer: I would not like to make any
qualitative comments.&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
