My First Wikipedia Training Workshop – Theatre Outreach Unit, University of Hyderabad

On March 8, 2013, a day-long Telugu Wikipedia training workshop was organized by the Centre for Internet and Society's Access to Knowledge (CIS-A2K) team at the Golden Threshold, Nampally, Hyderabad in collaboration with Theatre Outreach Unit, University of Hyderabad. This blog post gives a concise account of the event.

CIS-A2K had planned a day long Telugu Wikipedia training workshop in collaboration with Telugu Wikipedians at the English and Foreign Languages University (EFLU), Hyderabad on March 8, 2013. The intention was to target research students at EFLU who are using Telugu material or working on topics related to Telugu and Andhra Pradesh. This event was also to be part of the Wiki Women’s month events across India. However, this event had to be cancelled in the last minute as a Research Student of EFLU committed suicide on the campus and there was major unrest. The faculty from EFLU though had informed of the possible cancellation of the event earlier, had only confirmed it on March 7, 2013. Rahmanuddin Shaik (Telugu SIG, Wikimedia India Chapter) and Dr. Rajasekhar (Telugu Wikipedia Administrator) had already blocked an entire day for this training workshop. In fact a lot of background work was already done for the EFLU event.

When I got the news of cancellation of the workshop, initially I was very dejected at the thought of informing the two active Telugu Wikipedians about it, which I had to do. As my tickets were anyhow booked to Hyderabad and there was no point cancelling them, as I was already on my way to catch the flight, I decided to go ahead with my journey. I made some couple of quick calls and with some effort managed to organize a Wikipedia Training Workshop in collaboration with the Theatre Outreach Unit (TOU), University of Hyderabad (UoH). I was anyhow planning on visiting them to explore an institutional collaboration. The Project Director of TOU Dr. Peddi Ramarao, though agreed to spread the word about the workshop, yet was not sure how many would turn up at such a short notice of one night.

So on March 8, 2013 Rahmanuddin, Dr. Rajasekhar and I landed at the Golden Threshold hoping against hope to see at least 3 or 4 participants. But alas there were only 2 people when we reached the venue by 10 a.m.. By 10.25 a.m. we had 9 participants, which excited us all. The training workshop began with an introduction of all the participants. Following this a presentation was made on the significance of Wikipedia in the digital era and how Indian language-Wikipedias are pivotal in preserving the vernacular language and culture. This session was interactive with participants asking many questions. Dr. Peddi Ramarao, later, spoke about his experience of using Wikipedia as a reference tool and how he got introduced to contributing Wikipedia. Further, the discussion went on to the poor quality of articles on Telugu Wikipedia and how the participants can take part in improving the existing articles and contribute new articles. Rahmanuddin and Rajasekhar practically demonstrated the process of editing on Telugu Wikipedia. This was followed by a hands-on session where the participants actively participated in creating their Wikipedia User name on Telugu Wikipedia and did editing of few articles. The training programme was to officially end at Lunch time but even post lunch some of the participants were enthusiastic about learning more nuances of contributing on Telugu Wikipedia. The hands-on session thus continued until 4 p.m.

Post the Wikipedia training programme, I have had interactions with the Project Director of TOU to explore possible future collaborations. TOU, UoH agreed to offer space to host all Telugu Wikipedia meet-ups. As the Golden Threshold space was in the central part of the city, having this infrastructure accessible was a major boost for the Telugu Wikipedia community in Hyderabad. Further, in the discussions we have agreed to collaborate with TOU, UoH in hosting the first mega Telugu Wikipedia community event Telugu Wiki Mahotsavam 2013.

Outcomes and Impact:

Out of the 9 new Users, who were trained during this workshop, 5 people have done more than 5 edits.
One person has become a very active editor on Telugu Wikipedia with more than 1000 edits in 3 months. A detailed account of this event was put up by this user on Telugu Wikipedia here [*]
Because of CIS-A2K’s efforts, Telugu Wikipedians in Hyderabad now have a good meeting space.
The availability of this space has also encouraged the Telugu Wikipedians to meet more often than before. Since March 8, 2013 Telugu Wikipedians had a total of 6 meet-ups, and all these were held at Golden Threshold.
Golden Threshold also became a venue for hosting Telugu Wiki Mahotsavam 2013.
This visit to Hyderabad triggered a discussion about organizing Telugu Wiki Mahotsavam, which was successfully organized in a month’s time.

Looking back, though this event was done as a last minute measure without many expectations, yet it turned out to be a lucky break! Especially, because this was my first ever event as the CIS-A2K Programme Director. It will remain a very memorable one. More so because it was done in collaboration with two of the active Telugu Wikipedians. Even more so because it has created some positive energy for the Telugu Wikipedia community, which has since then become a home turf.

India- EU FTA: A Note on the Copyright Issues

Against the backdrop of ongoing negotiations dating back to 2007, and, more recently, with parties being unable to make substantial progress on the Indo-EU FTA[1] this note presents an overview on some of the provisions of the FTA and the copyright issues identified therein. This note deals with the issues on two levels- first to examine the impact of intellectual property right provisions in FTAs in general and second to apply these generic principles to the Indo- EU FTA specifically.

Introduction

Investment agreements, of which bilateral investment treaties are a part, and investment chapters in various FTAs often result in an increase in the effective levels of intellectual property protection in one of the countries that is a part to the agreement. This can be done either explicitly, where ‘investment’ may be defined to include IP, or implicitly, for instance, through an expropriation provision.[2] This has concurrently witnessed the growing realization that the promotion of these increased IP standards is not suited to the need of developing countries. Therefore, it has been observed[3]that there is now an attempt by the developed countries to use FTAs as a forum to push for higher standards of IP protection in developing countries, and to restrict the scope of the flexibilities offered by TRIPS, most notably in the sectors of protection of plant varieties, patents and access to medicine, farmers rights and access to information.[4]This approach is inherently problematic, because it then infringes on the developing countries’ ability to achieve their developmental objectives.

Dismantling the Arguments In Favour of Increased IP Protection

A prevalent view of thought is that in order to increase Foreign Direct Investment (FDI), developing countries would have to increase their IP protection. This section of the paper seeks to argue that this might not necessarily be the case.

An illustration of the aforesaid proposition may be Heald’s criticism[5] levied on Mansfield’s paper[6] arguing that there was a direct correlation between the level of intellectual property protection in a country and the foreign direct investment into that country. Further, a study[7] conducted under the aegis of the United Nations has suggested that there was a ‘considerable incentive’ for countries to use the flexibilities provided under TRIPS to maximise net benefits for their development; stating that while in countries with a capacity to innovate stronger IPR protection can reap some benefits in terms of greater innovation at home and a greater diffusion of technology, the same cannot be said about nations without such a capacity, and may in fact impose additional costs.[8]

Specifically in the area of copyright, it has been observed that increased copyright protection can hamper the growth and development of knowledge based industries. Sanya Smith argues that those who control copyright have a ‘significant advantage’ in the knowledge based economy, and says that in the current scenario where ownership of copyright is largely in the hands of industrialized nations, this places developing nations, and smaller economies at a significant disadvantage.[9] She also goes on to argue that increasing copyright protection alone does not seem to be sufficient to stimulate industries, and there may other factors involved. Additionally, copyright could also significantly increase the cost of creative industries.[10] More fundamentally however, access to information and knowledge are amongst the most affected areas as a result of tightening of copyright laws, leaving students, academicians, researchers, scientists and persons with print disability significantly disadvantaged.

Implications of the Copyright Provisions in the Proposed Indo- EU FTA

Based on the general discussion earlier, this section of the paper seeks to examine the proposed and long debated Indo- EU FTA for the concerns enumerated earlier. As things currently stand, both parties have failed to reach a consensus on various substantial differences, and a ministerial meet originally scheduled for June seems unlikely to take place.[11]

It has been observed[12] that the Indo- EU FTA[13] includes various provisions that preserve the flexibilities offered under the TRIPS framework. This is extremely critical from the perspective of developing countries, given that access to knowledge is an extremely important ideal to be preserved. For instance, as noted by Knowledge Ecology International[14]the proposed FTA includes Articles 7 (Objectives) and 8 (Principles) of the TRIPS[15] by reference. Further, the language of Article 13 under the proposed FTA explicitly recognizes the importance of the Doha Declaration, which is a positive step.[16] It has been said however, that stronger language where the parties ‘affirmed’ their obligations under the Declaration could have been used.[17] However, this does not take away from the fact that many of the provisions of the proposed FTA are extremely problematic, as will be discussed in the forthcoming parts of this paper.

Problematic Provisions

The main concern that has emerged from this FTA is the fact that some of its provisions dealing with IPR go beyond the mandate as under the TRIPS Agreement. For instance, as pointed out by Shamnaad Basheer to Intellectual Property Watch, various provisions now provide for intermediary liability, which isn’t present in TRIPS. He also adds however, that if the initial stand of the government that India would not go TRIPS plus continues to hold, the government should indeed adopt a strong stance and not cave in to the said provisions.[18] An overview of some of the problematic provisions has been presented hereafter:

International Obligations

As per the proposed treaty, protection granted by the parties should be in accordance with the Berne Convention, the Rome Convention and the WIPO Copyright and Performance and Phonograms Treaties. Snehashish Ghosh in his blog post[19] writes that the EU stipulates compliance with Articles 1 through 22 of the Rome Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations (1961), Articles 1 through 14 of the WIPO Copyright Treaty – WCT (Geneva, 1996), Articles 1 through 23 of the WIPO Performance and Phonograms Treaty – WPPT (Geneva, 1996). It is critical to note that the Rome Convention is not in force in India[20], and that India is not a party to either the WCT[21] or the WPPT[22], and therefore, this provision would have the effect of substantially surpassing all obligations that India has at the moment under multilateral international agreements.

Technical Protection Measures (TPMs) and Digital Rights Management (DRM)

A TPM, understood simply, is a lock in a digital format, placed on digital material to prevent access to or copying of the material in question. The problem with such measures is that they can prevent even those forms of copying which are legal (for instance, the copying of a movie on which copyright has expired could be prevented), creating a potentially infinite monopoly over the product in question. India, in its negotiations with the EU, has agreed to sweeping language under this provision, where TPMs and DRM measures are broadly defined. The Agreement further provides for limitations on TPM protections only to persons who have “legal access to the protected work or subject matter”.[23]

Copyright Expansion

There are various provisions under the proposed FTA that have the effect of copyright expansion. To begin with, the duration of protection for photographic works is not expressly mentioned in the proposed agreement.[24] Snehashish Ghosh concludes that the term of photographic works is unclear in the proposed FTA. He writes that the proposed FTA makes it mandatory for the parties to comply with the Berne Convention, and all literary and artistic work under the proposed FTA is to be construed as the same as the Berne Convention[25]. Photographic works are included under literary and artistic works under the Berne Convention, and the rights of an author in case of photographic works are protected for a minimum period of 25 years. However, the proposed FTA extends the period of protection to beyond that prescribed by the Berne Convention and states that protection is given to literary and artistic works (as defined in the Berne Convention) for a period of the duration of the life of the author plus fifty years after this death. It further states that works for which the period of protection is not calculated from the death of the author, and which have not been lawfully made available to the public within at least 50 years from their creation, the protection shall terminate.[26]

Article 7.6 (proposed by the EU), limits the resale rights of a downstream purchaser. It has been noted by Knowledge Ecology International[27] that this seems to give the author of an original work of art a right in perpetuity, to receive a royalty for the resale of the piece of art, where such right cannot be waived or transferred by the author of the work. Therefore, a situation would arise where each time a person who has purchased the work wants to resell the same, he would have to pay royalties to the original author.[28] The observations further go on to note that royalties are not limited, and the amount has to be determined by national legislation. Further complicating the situation is the fact that the provision does not cease to apply after a given number of re-sales, and continues to the death of the author (but might not into the 50 year protection post the death of the author).[29]

Exceptions and limitations for copyright have been covered under Article 7.9(1) of the proposed FTA, and they may be created “only” in accordance with the three step test, which is essentially that (a) the exceptions and limitations must apply in certain special cases; (b) must not be in conflict with the normal course of exploitation of the subject matter in question and (c) must not unreasonably prejudice the legitimate interests of the right holders.[30] It has been observed that this test is more restrictive than TRIPS, Berne Convention, Rome Convention or the WCT.[31]

On the plus side, temporary copies have been excluded from copyright protection, as per Article 7.9(2) of the proposed FTA, which would ensure the proper functioning of technology.

Persons with Disabilities

There is nothing that deals with the import/export or cross border exchange of files/documents/books etc. for persons with disabilities.

Cross Border Measures

Cross Border Measures have been dealt with under Article 30 of the proposed FTA. It is interesting to note that under this Article the EU has proposed the application of border measures to exports as well. This is contrary to the position laid down in the TRIPS Agreement, which has this requirement only for importing infringing goods.[32] Further, the EU also seeks to expand the applicability of such measures to include those goods which also infringe designs or geographical indications. Additionally, Article 30 also leaves out certain TRIPS safeguards, for instance, one that requires the right holder to provide adequate evidence for a prima facie case of infringement.[33]

Intermediary Liability

It has been suggested that the EU, under the garb of protecting intermediate service providers from liability for infringement by users, is purporting to place a greater burden on the providers in question, of policing user activity.[34] For instance under Article 35.1.1 of the proposed FTA, while service providers are not under any general obligation to seek facts or circumstances that could indicate illegal activity, they may be obligated to promptly inform competent authorities of these alleged illegal activities undertaken/information provided by recipients of their service. [35] Otherwise, the providers may also be required to communicate to the authorities, on their request, information that would enable the identification of their service with whom they have storage agreements, as per Article 35.1.2.[36] It has been rightly identified by Glover Wright, that such provisions would only serve to increase tensions between the users and their service providers, with relations dictated by concerns about liability, and barriers in the sending, receiving and storing of information freely. It would be a tricky question for intermediate service providers to check what would constitute ‘knowledge’ and how they were to best safeguard themselves from liability.[37] Therefore, the author is inclined to agree with Wright’s submission that India needs to reject all provisions of liability of intermediate service providers as discussed above.

IP Enforcement

There exist, as regards the enforcement of rights, many problematic provisions in the proposed FTA. For starters, the EU has proposed that interlocutory injunctions may also be issued under the same conditions against an intermediary whose services are being used by a third party to infringe intellectual property rights.[38] This may be found under Article 22.1 of the proposed FTA, and is inherently problematic for being a provision far beyond the mandate as laid down by TRIPS.

The EU is also pushing for the use of very explicit language as regards seizing movable and immovable property of the alleged infringer as a precautionary measure. This also extends to the blocking of the bank accounts and other assets of the said infringer, and to this end, competent authorities may even order the communication of bank, financial or commercial documents, or access to the said information.[39] It is critical to note that such a provision is greatly problematic as being rather vague in its approach, and very readily compromising privacy for ‘alleged’ acts of infringement.

It is further critical to note that while Article 20 states that courts should have the power to grant ex parte order to collect evidence that is allegedly infringing, there are no safeguards provided for protection of a bona fide defendant whose premises might have been raided wrongly. It is submitted that provisions that safeguard the interests of defendants are of prime importance, especially in the Indian set up, where courts are as it is rather generous in their granting of ex parte orders.

Concluding Observations

While India may stand to benefit from the proposed FTA with the EU, there remain significant IP related issues that need to be ironed out before India comes to any consensus about the agreement and ratifies the same. On the basis of the discussion over the course of this paper, it may be seen that the provisions on intellectual property rights are problematic on various levels, particularly in the areas of expansion of copyright, the inclusion of TRIPS plus provisions, cross border measures, TPMs, liability of service providers and enforcement mechanisms.

Discussions in the first half of this paper have demonstrated that increased IP protections do not necessarily translate into increased FDI and may in fact stifle innovation. Further, the warning to developing countries against adopting IPR standards fixed by developed nations has been sounded many times over, and is one that needs to be heeded to very closely for developing nations to achieve their developmental objectives.

India has over a period of time established an IP regime that is consumer friendly. In adopting the proposed FTA in its current form, she risks endangering this regime that has thus far been instrumental in proliferating emerging technologies in the county.[40] Given that India has already acceded to international standards for IPRs as a result of being a member of the WTO and being TRIPS compliant, there is no cogent reason to be made out that warrants the accession to an FTA with TRIPS plus provisions. India ought to continue to push back strongly on these fronts, bearing in mind that its stance could very well set the tone for other such agreements in South Asia. From the way things stand at the moment, it is indeed a matter of some relief that the ratification of this proposed FTA still appears to be at a considerable distance.

A Feature on Wikipedia and Telugu Wikipedians on HMTV

Based on the Telugu Wiki Mahotsavam, HMTV (one of the leading Telugu News channels in Andhra Pradesh) has produced a half an hour feature on Wikipedia and Telugu Wikipedians.

This feature gives a concise history of the growth of Wikipedia and the efforts being put in developing Indian Language Wikipedias. Done in collaboration with Telugu Wikipeidans, this feature also showcases some of the key Telugu Wikipedians who have attended Telugu Wiki Mahotsavam — a community event supported by CIS-A2K and WMI Chapter. This feature was broadcast on May 30 and was repeated on May 31.

A Telugu Wiki Meetup @ CIS, Bangalore

On June 2, 2013, the Centre for Internet and Society (CIS) hosted a Telugu wiki meetup in its Bangalore office. Updates from the meetup is shared in this blog post.

Unfortunately, I was unable to attend the Telegu Wiki Mahotsavam held in Hyderabad earlier this year (in April 2013) due to personal and professional constraints even though Arjuna Rao called me twice and requested me to attend it. However, when he called again recently about a planned meetup in Bangalore, I willingly took up the initiative.

I used the "Category: Wikipedians in Bangalore" and communicated with all the Telugu users. I met T. Vishnu Vardhan, Programme Director, Access to Knowledge, Centre for Internet and Society and personally and took his views. Myself and Arjuna took the initial steps to organize this meeting. Arjuna managed to invite Dr. T. Ramakrishna and Gudipati Narayana for this meetup. He also managed to announce about this event in the press.

We finally met at CIS and had a two-hour session:

An introduction was given to Telugu Wiki projects with practical examples. (Using, searching, editing, interaction and getting help)
Guests’ doubts were clarified by the Telugu Wikipedians Ravichandra, Arjuna and Sasi
Dr. Ramakrishna suggested that parallel to the Telugu Wikipedia development, Telugu should be encouraged to be used in administration. This should start with interactions with the officials and the organizations working towards it
Gudipati Narayana conveyed his view that Telugu Wikipedia can be used to increase the standards in Telugu teaching
Both the guests promised that they will do their bit in organizing the Wikipedia awareness events in the organizations know to them

Wikipedia Live Phone-in Programme on HMTV

Vishnu Vardhan took part in a one hour live phone-in programme on Wikipedia. This was telecasted in HMTV on June 1, 2013.

Dr. Rajasekar, Administrator on Telugu Wikipedia; Malladi Kameshwararao, Journalist and Telugu Wikipedian; Rahimanuddin Shaik, Telugu SIG, Wikimedia India Chapter; and T. Vishnu Vardhan Programme Director, CIS-A2K participated in a one-hour live phone-in programme on Telugu Wikipedia broadcast by HMTV (a Telugu News Channel) on June 1, 2013. This is probably for the first time a television news channel in India has done a live phone-in programme on Wikipedia. HMTV had also done a half-an-hour feature on Wikipedia which was broadcast on May 30 and May 31, 2013.

Governance in the Age of the Internet and Free Trade Agreements

In the age of accelerated international trade and the promotion of free flowing cross-border data transactions, countries and regions are working towards forming a commonly agreed modus operandi and protocols. These protocols seek to facilitate the growth of e-trade, ensure a secure data flow(economic transactions) and protection of its data in the network. In the recent, there has been strong attention by consumers and businesses with the growing scope and content of these agreements addressing Intellectual Property (IP). Emerging trend studies show that there is a growing practices to incorporate mutually exclusive arrangements without involving other stakeholders which happens in closed door negotiations i.e. government to government.

For instance, the European’s Anti-Counterfeiting Trade Agreement (ACTA) proposal and the U.S. Trans-Pacific Partnership Agreement (TPP).

The bigger concern raised by other stakeholders has been the secrecy of these arrangements and the insufficient protection of consumers and citizens rights in its consideration. So far, the lack of legitimacy and proportionality of legal policy measures has created unintended consequences and collateral damages in far reaching manners whether socially, economically or technologically. Citing practices of filtering technology, deep packet inspection, and Internet cut-off, are introduced by internet service providers to meet legal requirements. Activities in question may vary from country to country, some focus on violations of intellectual property, some on the control of political voices.

Notably, list of concerns have been raised explicitly by UN Special Rapporteur to adhere to the promotion and protection of the right to freedom of opinion and expression were recommended.

This workshop is aim to create discussion on the related topics among stakeholders both in Thailand and in the region of the direct and indirect implications of various developments.

Expected Outcomes

Understanding the dynamics of free trade agreements (i.e. APEC, TPP, and ACTA) and its implications on Internet regulations, national sovereignty, and civil rights from various perspectives. (Big picture)
Basic understanding of how various policy and technology related measures or solutions (i.e. digital rights management technology and deep-packet inspection) are used to address Intellectual Property (IP) and how it directly impacts freedom of expression and individual privacy.
Looking Ahead: The developments and upcoming legislations/regulation challenges in both Thailand and the region i.e. new draft of Computer-related Crime Act, new draft of Copyright Act, and the Personal Data Protection Bill.

Digital Humanities for Indian Higher Education

The Access to Knowledge team from the Centre for Internet and Society in collaboration with HEIRA-CSCS, Tumkur University, CILHE-TISS and CCS (IISc) is hosting a one day Digital Humanities consultation on July 13, 2013 at the Indian Institute of Science in Bangalore.

Note: Following is a draft text which will be updated soon.

The digital age has had a huge impact on higher education in the last decade, transforming the modalities of both teaching and research. Consequently the very foundations of the systems of knowledge production and dissemination are being re-examined. This is due to the impact that the digital turn has had on already established systems, and to the exciting possibilities that it offers for radically transforming these systems. In tertiary education for instance, one of the ways in which the digital impact has made itself felt is to move the classroom online or to make resources freely available online, thereby providing access for new constituencies.

For researchers, digital archiving and digital publishing has made possible the same widening of access, while also enabling innovative ways of reading traditional objects of inquiry through the use of computational methods. While these developments are not confined to a specific domain of knowledge, the term most often used to reference them has been ‘Digital Humanities’. The term has gained currency worldwide perhaps because of the seeming incongruity of the relationship between the conventional humanities disciplines and what is deemed a technological development. This is a relationship that has not only produced new approaches to old material, but perhaps — even more significantly — reconfigured the objects and domains of inquiry themselves, and re-tooled the modes by which we conduct our research.

The five host institutions have engaged with each other in different collaborative initiatives over the years. Most significant among them have been (a) the exploration of integration, inter-disciplinarity and dialogue between the natural sciences and the social sciences/humanities; and (b) the production and deployment of critical resources in Indian languages in the higher education sector. We seek to bring these interests together in the proposed consultation aimed at setting agendas for digital humanities in India.

Exploring the possible connections between the human sciences and the digital domain could throw up many productive directions for the higher education system. One of the biggest challenges facing the system in India today is the issue of access and the quality of that access. In the coming decade, Indian higher education is estimated to achieve a Gross Enrolment Ratio of at least 20% (from the existing 12%). This immense new inflow into the education system poses significant institutional and pedagogic challenges. With English emerging as the global language for knowledge production, there is pressure on the Indian higher education system to move towards English-based teaching and learning. Simultaneously, here is a cognitive issue: of effective comprehension. Students who are first-generation learners are finding it increasingly difficult to negotiate with the English-only curriculum that presents itself to many as an insurmountable hurdle.

A new set of possibilities could open up if one were to examine this issue from the perspective of the Indian languages. For over 150 years these languages have been used in all modern institutions and practices (from banking to statecraft) and have developed their own concept ecologies and rich traditions of public intellectual discourse. Currently these languages and practices are being thrust into the background by the globalization of higher education. Re-inserting them into our classrooms and institutional arrangements would be crucial from two perspectives: a) providing newer avenues for students to re-negotiate curricular content which is predominantly in English and b) infusing new source materials into social, political, economic and cultural research on India, thereby increasing the relevance and dynamism of Indian social sciences and humanities. Needless to say, technology will play a major role in this context. Not only will technology figure prominently in addressing the question of access, equity and outreach, it will also help in bringing hitherto inaccessible intellectual resources into easily available and distributable forms. Also crucial to the question of access is the scalability that digital technology offers.

Through this interdisciplinary consultation, we hope to chart out the possible directions for digital humanities in India, which would include, among others, a strong engagement with Indian languages as well as a rethinking of how the sciences and the humanities could intersect. All of this is likely to hold paradigm-changing consequences for higher education: involving for example online learning, technologically enhanced learning, archival practices, new research methodologies, and the production of new and locally relevant knowledges.

We invite participants to make short presentations of 15 minutes each reflecting on the questions raised in this note, and bringing to the table issues raised by the initiatives in which they have taken part so far.

The Centre for Internet & Society (CIS) welcomes you to the fifth issue of its newsletter for 2013. We bring you an overview of our research, report of events held by us and announcement of upcoming ones, events we participated in, and recent media coverage.

Celebrating 5 Years of CIS
CIS is now 5 years old and we just celebrated this by holding an open exhibition in our offices in Bangalore and Delhi from May 20 to 23, showcasing our work and accomplishments over the period. We had about 170 visitors from the general public coming in to our office. Renowned artists like Tara Kelton, Kiran Subbaiah, Navin Thomas, Abhishek Hazra and Sharath Chandra Ram exhibited their work. The four day event attracted press coverage: Bangalore Mirror (May 18, 2013), DNA (May 19, 2013), Hindu (May 22, 2013), Prajavani (May 23, 2013), Udayavani (May 25, 2013) and Bangalore Mirror (May 31, 2013). CIS is inviting applications for the Google Policy Fellowship programme. Google is providing a USD 7,500 stipend to the India fellow who will be selected by July 1, 2013. Accessibility

CIS is doing two projects in partnership with the Hans Foundation. One is to create a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India and another for developing a screen reader and text-to- speech synthesizer for Indian languages. CIS is also working with the World Blind Union and other similar organisations to develop a Treaty for the Visually Impaired helped by the WIPO:

Access to Knowledge and Openness

The Wikimedia Foundation awarded CIS a two year grant of INR 26,000,000 to support and develop the growth of Indic language communities and projects by community collaborations and partnerships. This is being carried out by the Access to Knowledge team based in Delhi. CIS is also doing a project (Pervasive Technologies) on examining the relationship between production of pervasive technologies and intellectual property. CIS also promotes openness including open government data, open standards, open access, and free/libre/open source software through its Openness programme.

Access to Knowledge (Wikipedia)
Beginning from September 1, 2012, Wikimedia Foundation awarded CIS a two-year grant of INR 26,000,000 to support and develop free knowledge in India. The A2K team consists of three members based in Bangalore: T. Vishnu Vardhan, Dr. U.B. Pavanaja and Subhashish Panigrahi and one team member Nitika Tandon who is working from Delhi office. Noopur Raval, Programme Officer has left the organisation. April 24, 2013 was her last working day.

CIS Signs MOU with TISS, Mumbai

The Access to Knowledge (A2K) team from the Centre for Internet and Society (CIS) has signed a MOU with the Tata Institute of Social Science (TISS), Mumbai.

Institutional partnerships (especially in the higher education context) is a cross-cutting activity across A2K's various language plans and also the pilot project. A2K Team is happy to share with you an important outcome on this front.

CIS-A2K has signed a MoU with TISS as part of which we will collaboratively work towards building Digital Knowledge Partnerships with select higher education institutions. The objective is to enhance digital literacy in the Indian languages and facilitate collaborative knowledge production and free dissemination. A2K along with TISS will co-design and jointly implement relevant training programmes to achieve this. Further, within TISS campuses we will endeavour to bring teaching-learning processes onto free and open digital platforms, including Indian language Wikipedias. The A2K team would like to acknowledge the pivotal role played by our Adviser Dr. Tejaswini Niranjana in buildig this collaboration.

We'll keep you posted as and when new developments shape up and would like to actively involve Mumbai Wikipedians in planning, designing and rolling out Wikipedia training programmes.

Introductory note

Context

The Wikimedia Foundation has approved a grant of ₹26,000,000 to the Centre for Internet and Society (CIS) in Bangalore to expand their Access to Knowledge (A2K) program in India; of this, ₹11,000,000 has been released. The purpose of the grant is to enable the A2K team to work with the Wikimedia community of volunteers in India to expand on Wikimedia’s Indic-language free-knowledge projects. In addition, the grant aims to generate improvements in India-relevant free knowledge in Wikimedia’s English projects, and the wider distribution of Wikimedia’s free knowledge within India.

Objective

The main objective of this document is to present a detailed Annual Work Plan for 2013–14, setting out the expected outcomes and impact of the A2K program activities. The overall objectives of the A2K Team are here.

Methodology

In putting together this Work Plan the A2K team has, over the last two months extensively engaged with various stakeholders. These include a) some Wikimedia India Community members across various Indian-language Wikimedia projects; b) some English-language Wikimedia community members from India; c) Wikimedia India chapter executive committee; d) some potential institutional partners; e) a few like-minded advocates of free knowledge; f) A2K Program Adviser Dr. Tejaswini Niranjana; and g) a few of the Wikimedia Foundation staff.

A draft of each of the language plan will be shared with the particular language community through respective language Wikipedia village pumps, mailing lists; feedback will be collected in finalizing the plan.

A2K’s method of work

A2K principally sees itself as working hand-in-hand with the Indian Wikimedia community and the Wikimedia India chapter, and with all formal and informal groupings within the Wikimedia movement in India. A2K will mostly engage in catalytic kind of work; however, depending on the requirements of each language-area, the A2K team may also undertake the hands-on implementation of some activities that would otherwise be done by the community. The planned A2K program activities are mostly in the south and south-east of India, and it makes better programmatic sense to have the A2K team located in Bangalore. This will not only save the A2K program from relatively larger overhead spending for the project (which could be productively used for programmatic work) but will enable the A2K team to be more in touch with the Wikimedia India community and in proactively undertaking collaborative activities with the community on the ground. Thus the entire A2K team will relocate to Bangalore and work out of the existing CIS office. Please kindly note that the A2K team will hire a new space in Bangalore, once the work plan is finalized, and the intention is that this space will be open to free use by the WM India community and chapter alike.

How to read this Annual Work Plan

This plan is not set in stone and will be periodically (right now quarterly) reviewed and revised. The intention of this Work Plan is to continually ensure better design and better engagement. The broader aspects of the plan have been outlined here. Thus this document is more towards evolving a sense of granularity of the A2K team’s work along with micro level outcome and impact metrics.

We have worked towards developing an Annual Work Plan that is language-specific. The A2K team has not adopted ONE single model, because we believe that each language area has a) specific strengths that we need to build on; b) particular needs for support that we could offer; and c) specific challenges that require localized solutions. Thus there are chances that you might see repetitions in the strategies mentioned across language areas.

Please note that the A2K team has some language area plans worked out in greater detail than others. This is mainly because we intend to prioritize working on five language areas during the coming year. This does not mean that we will not support other language areas/communities, but our engagement will be activity/project-specific, based on requests made to the A2K team by the community. The A2K team will continue its efforts in actively exploring to include a few more language areas, and will share such plans after they reach a certain stage.

Risk and mitigation

The message that comes across, after a cursory glance at Indian-language Wikipedias, is that there is a huge potential to increase the number of editors, especially active editors, along with the expansion of article entries. On one hand, unfortunately there is no fool-proof formula or plan that either the Wikimedia India community, Wikimedia India chapter or A2K can immediately bank on. This does not mean, on the other hand, that there are no ideas, experiences, learnings and failures, that can inform a strategy. An important point is that what we (the community, WMI chapter, WMF and A2K) all are attempting to do is to achieve something that sounds very simple (increase the number of editors, increase the articles, and build article quality) but yet complex to achieve. In addition to this, improving the Indian-language Wikipedias becomes even more complex for some the following reasons:

Lack of reference material available online in Indian languages.
Typing in Indian languages is a major challenge.
Relative dearth of quality content available in digital format.
Relative lack of research/academic standards, which is transferred on to Indian language Wikipedias.
Various technical issues like input, browser compatibility, font display, which deter new users.

Thus it should be noted that we should extend our work beyond Wikipedia, if we are to grow Indian-language Wikipedias. We need to think of a holistic intervention that would also involve enabling, facilitating and forming localized language-based virtual communities. That this has never been done before, and Indian language Wikipedias have a huge potential to do so.[1] This is also the significance of Indian-language Wikipedias, which are a potential (often the only) medium/platform for migrating Indian languages into the digital era. Also Wikipedia can be leveraged to further the much-needed active research culture in India and Indian culture. As a collective, we are doing something cutting edge and have too much of a risk of failure, time and again. This kind of work has failure fore-written. The only mitigation by which we can aim to be successful is by being open to learning, working as a collective, being supportive of each other, picking ourselves up whenever we fall down, and celebrating the little successes.

Language area work plans

As indicated above, the A2K team has prioritized the five languages and developed a detailed plan. We had initially set out to work with a different set of languages. The language set has slightly changed during the past two months.

Some of the key factors that determined the selection of languages areas have included:

Networking of institutions and groups. The A2K team has put together a list of knowledge institutions, groups and individuals with whom it has some connections and believes that it can bring them into the Wikimedia movement. These collaborations will not only result in significant quality-content contributions, but will lead to the diversification and increase in that particular language Wikimedia community.
Willingness of that particular language community to interact and engage with the A2K team. Though we tried approaching other language communities, we were given to understand that they would like to consider engaging with us at a later point. We have respected the community's decision and are open to work with a couple of language areas later in time.
Work on one incubation project. During our interaction with Wikimedia India Chapter EC about the A2K plans, they have actively encouraged the A2K team to take up at least one project under incubation. Based on their suggestion we have taken up Konkani as we have some institutional contacts that could be leveraged to build the Konkani Wikipedia. The A2K team has also conducted some outreach work in Goa over the past 3–4 months that could be built on.
Familiarity of the A2K team members with the language. Each of us are editors/can edit in most of the above language Wikipedias. This will give us an insider's perspective of what is happening in that particular language community and the Wikimedia projects.

As mentioned earlier, A2K team's prioritization of working actively with these five language projects does not mean that A2K team will not support other language areas/communities. The A2K team will continue to provide overall support to all Wikipedia Communities in India. Our engagement will be activity/project-specific, based on the requests made to the A2K team by community members.

Pilot Project – Performing Arts in India

India has a wide range of performing arts. A lot of work is done on performing arts by various individuals and institutions, which offers rich knowledge about the aesthetics, artists, institutions, performance spaces/infrastructure, and policies, across various geographies and languages. This pilot is premised on a theme and seeks to create a multilingual repository of knowledge on Indian performing arts that is interdisciplinary, dynamic and ever evolving. On the Unfortunate Rise of the Indian SLAPP Suit

It is not news in this country when the law or other institutions of the state, are used as tools by which to threaten or intimidate citizens into submission to a particular course of action or to a particular point of view. Unfortunate as that is, today’s post will deal with the rising incidence of SLAPP suits, an abuse of the adjudicatory process that is also a feature in a number of jurisdictions elsewhere.

Our interest in them arises from two sources. The first is the particular damage that this device is able to do free speech. Its effects were quite picturesquely described in the following terms by the Delhi High Court in M/S. Crop Care Federation Of India v. Rajasthan Patrika (Pvt) Ltd. “Short of a gun to the head, a greater threat to First Amendment expression can scarcely be imagined.” [Rajasthan Patrika in turn borrowed this language from Gordon v. Marrone, a case in the New York Supreme Court.] The second is this piece of news.

About the Phenomenon
The term “Strategic Lawsuits Against Public Participation” is rather self-explanatory. Nevertheless, some of its features bear the explicit articulation:

First, there is always, and necessarily, a power imbalance between the parties in such cases: the plaintiff or complainant will always have greater and often disproportionately greater access to the resources necessary to enter and sustain a litigation, in addition to social, political or corporate power. A simple shorthand for SLAPP suits will always be Deep Pockets v. Free Expression. And so it has been in India, as this article evidences.

Second, there is always one object: to intimidate a target into silence or apology by way of legal action or the threat of it. SLAPPs are a win-win play for those that employ them: targets are likely to bow to the pressure given that they will not have access to the resources to mount a legal defense. Even where the defendants’ (relatively scarce) resources are diverted to the defense of their speech, even assuming that the threat and costs of litigation, the civil damages and/or penal consequences do not intimidate them, their opportunity cost will be considerably higher than that of the other party. Given the ordinary rigours of the adjudicatory process and the ubiquitous delays associated with it in India, however, the harassment function of the SLAPP is always achieved.

Third, SLAPP suits are always characterized by a flimsy, frivolous or even non-existent cause of action. They will have done their damage irrespective of, and before, the outcome of the suit is decided. The question of legal tenability, and in these cases, its absence is really not one of any relevance. The real damage is done by forcing defendants to bear the trouble (monetary and otherwise) with preparing and mounting the legal response/defense itself, rather than by the litigation’s ultimate success or failure. A little amusing then that in the latest instance, which I describe later in this post, it is a law student, presently in law school and writing for a legal blog who finds herself on the receiving end of such threats.

Defamation SLAPPs
Defamation is a classic tool by which contrary opinions are sought to be silenced by those in (political, social or corporate) power. Rajeev Dhavan argues here that defamation is becoming an increasingly popular tool by which the “politics of exposé” and whistleblowers participating in it are being threatened. [SLAPPs in India have arisen on the back of other causes of action as well. See, for instance, the case of S. Khushboo v. Kanniammal and Frontline discussing it.] Lawrence Liang details a number of older instances in which defamation has been used in Indian courts to silence speech here.

Much more recently, Tata Sons Ltd. v. Greenpeace International, involved intellectual property and defamation claims in a game designed to bring attention to the threat to Olive Ridley turtles from developmental activity in Orissa. The IIPM saga that rose to prominence in February this year is another instance of such litigation. It is also one that carries the added ignominy that a university, whose function one would presume is to foster critical thinking and the ability to constructively respond to criticism, would sue for defamation against criticism and use the state apparatus to employ opaque means by which to silence the allegedly offending content online [see here and here]. IIPM also demonstrates how SLAPPs will involve what have been called “creative ways” to abuse of process: more than one suit can be filed, and they can be filed in more than one jurisdiction or in jurisdictions in which it is difficult for the target of the suit to appear or defend him or herself.

On Attempts at Silencing Academic Opinion
While the Activist v. Corporation trope is by now a tired one, it appears that the incidence of SLAPP proceedings, both civil and criminal, against commentators and academics are on the rise:

Ajay Shah’s case has been a well-documented one [see here and here], and one in which the Bombay High Court did not appear to appreciate the SLAPP dynamic. Closer to home, Shamnad Basheer [see here and here] a professor at NUJS and founder of SpicyIP saw a defamation SLAPP suit for what appears to be an exercise in only academic analysis.

As of the 21^st of this month, it was reported that a student contributor at the same blog, Aparajita Lath faces similarly suspect allegations of defamation from a newspaper [see here and here]. Here is a case not of Activist v. Corporation or Whistleblower v. Government, but of Academic Opinion v. Press. There is a special and truly unfortunate irony in the press having recourse to tools like the defamation suit, and even more egregiously, the criminal complaint.

Why We Worry
A number of rights of the target are ordinarily affected by SLAPP suits. In what was a significant case for the United Kingdom involving a defamation suit brought by McDonald’s against two authors of a pamphlet criticizing it, the European Court of Human Rights (‘ECtHR’) recognized in Steel and Morris v. United Kingdom a number of the following rights:

First, there is the right to free expression itself. Violations of this right would arise on two levels, although the second may not be actionable. First, there is the right of the defendant to the SLAPP suit. Steel and Morris affirmed that the fact that the defendants to the defamation suit were not journalists did not mean that the scope of their free speech protection would differ [¶89]. Instead, it held that “the limits of acceptable criticism” where “large public companies” were concerned was wider than those that would otherwise apply [¶ 94]. India’s Supreme Court has, in one notable instance, disagreed on the proposition that bloggers should have similar rights to journalists. Next, there is the chilling effect: others placed similarly to the targets of SLAPP suits would self-censor to avoid legal retaliation for their views and the significant cost of defending themselves.

The importance of Steel and Morris however comes from this latter set of holdings. The ECtHR found that the right to fair trial, in civil and criminal cases, which included the right of access to court and to justice presumed an “equality of arms” as between contesting parties [¶ 59]. It held to this effect on the understanding that European Convention on Human Rights, the underlying rights instrument, was a guarantee of practical and effective rights. In the circumstances of that case, it found that since the financial disadvantage of the defendants in the defamation suit disallowed them the opportunity to mount an effective defence, there was a clear inequality of arms with McDonalds that rendered the trial unfair for the purpose of Convention Article 6 (1) [¶72].

The IIPM blocks add a further dimension to the problem. When the content complained against is online, India’s lack of clear legal principles to determine, and more crucially limit, where the cause of action will have arisen and can be tried will only exacerbate the blogger’s situation, given the arguably global spread of an audience for online content.

A final point about this trend, particularly as it relates to silencing academic comment, is that it is a dangerous one, and one against which we must all speak out: these cases, in which the challenged content offers studied comment against the powers that be, will be a good acid test for the strength of our speech protections as they fall squarely within the class of speech which constitutional protections seek to maximize and disinhibit. It should be the very minimum that the Article 19(1)(a) guarantee entails.
