CIS Signs MoU with Odia Virtual Academy

On October 26, 2018, the Centre for Internet and Society (CIS) signed a Memorandum of Understanding with the Odia Virtual Academy (OVA) to work on drafting an open content policy for the state, to promote use of Wikimedia projects by various user types and to ensure sustainability of Wikimedia projects, and to facilitate development of relevant free and open source software projects. This partnership between OVA and CIS will be carried out from December 2018 to November 2019, and we are sharing an overview of the activities and their objectives in this post.

The internet is increasingly significant as a knowledge repository today. Especially relevant in this context is the online encyclopedia Wikipedia, which contains information on almost every topic under the sun, across many languages spoken globally, and is used extensively all people to seek information and produce knowledge.

From past one year (since July 2017), The Government of Odisha has been actively participating in the open knowledge movement by publishing the content of their seven websites and eight social media accounts under Creative Commons 4.0 International license. This active collaboration with Government of Odisha and an active Odia Wikimedia community seeking to create and distribute knowledge in Odia language over the internet has resulted in improving 1,200 articles on different Wikimedia projects, and together has received a near about 16 Million page views. Further, the Government of Odisha adopting an open content policy will provide a significant boost in institutionalising creation, sharing, and re-use of open knowledge resources - including government documents, official statistics, open educational resources, and open cultural resources - in Odia language.

Odia Virtual Academy (OVA) is an organisation established by Government of Odisha for development, promotion and popularization of Odia language, literature, and lexicography for general use. It is an organised initiative to encourage expeditious evolution and popularisation of Odia books, magazines, journals, old songs, manuscripts, assembly speeches, and archival records by digitising and providing internet based resources and opportunities for all odia people living across the globe.

On October 26, 2018, the Centre for Internet and Society (CIS) signed a MoU with the Odia Virtual Academy to work on drafting an open content policy for the state, to promote use of Wikimedia projects by various user types and to ensure sustainability of Wikimedia projects, and to facilitate development of relevant free and open source software projects.

This partnership between OVA and CIS will be carried out from December 2018 to November 2019, and its activities are structured by the following objectives:

Open Content Policy for the Government of Odisha: The open content policy will include guidelines for the use of open licenses and open standards to enable the resource (text, resources or otherwise) publishing entity to share resources in a manner that it can be easily and freely be accessed, shared, and re-used by entities, without asking for prior permission, while ensuring that full attribution to the creator/publisher is provided and the resources are not misused, or the creator/publisher is not misrepresented in the process.
Developing Digital and Open Knowledge Resources in Odia Language: The CIS team will undertake awareness-building, training, and outreach activities to develop Odia language content on Wikimedia ecosystem, as well as to enable content creators from across institutions, with a focus on state government officials at district headquarters and college students. The broad mandate of the digital resource generation workshop is to introduce teachers, students, and interested citizens to tools of collaborative knowledge production on the internet and methods for generating new online content or reintroduce offline content in Odia language.
‘Revive Odia’ Activities: Odia as a language has a long tradition and has been medium of expression for the native speakers of Odisha. While Odia as a language of communication is not under any immediate threat, its role and responsibility as a language of Knowledge needs to be examined carefully. ‘Revive Odia’ activities have a simple objective: To bring Odia under limelight in the digital domain. Wikimedia projects in Odia language are working actively to increase the presence of Odia language on the Internet. If such projects can be supported new projects can be incubated, Odia will emerge as the language of knowledge production and distribution as well.
GLAM (Galleries, Libraries, Archives, and Museums) Partnerships: Wikimedia ecosystem offer several platforms for using the power and opportunities of internet to (digitally) preserve, enable access to, and creative re-use of historical, cultural, and social artefacts, and channel the expertise of local populations to build narratives around these artefacts. The CIS team is particularly interested in initiating engagement with public GLAM institutions at various locations and levels, and work with academic and research community to build scientific metadata of these objects. The metadata will be used to represent the tangible and intangible cultural heritage of Odisha in projects such as Wikidata.
Building and Supporting FOSS for Odia Language: To promote and enable usage of Odia language on the web, the CIS team will facilitate development of an Odia font, an input tool, and a spell-check dictionary - all of which will be released as FOSS (Free and Open Source Software) resources.

To undertake these activities, CIS will receive a grant of Rs 20,00,000 (~$28,000) from OVA.

Indic Wikisource Community Consultation 2018

A group of Indian Wikisource leader from 12 different language communities gathered in Kolkata to attend the Indic Wikisource Community Consultation 2018

There was a long time required of Optical Character Recognition (OCR) for Indic language computing. There was not at per OCR available in Indic languages before 2015. Most of the Indic subdomain was created in 2007 to 2011, but due to not availability of OCR, the Indic Wikisource Community used to type the whole book or import the Unicoded text from other non-reliable sources. In 2015 the after Google Drive OCR released Indic community relief from the typing era.

Later Shrinivasan T developed an OCR4wikisource script to use the Google Drive OCR as Bot. Since the implementation of the OCR, there has been a lot of progress in Indic Wikisource. But we have realized the there should be a common platform where we can share our knowledge. Then one-month planning we have organized Indic Wikisource Community Consultation 2018. in Kolkata. this is first such consultation at this scale, convened by the CIS A2K team.

The meeting had a representation of one volunteer from the Assamese, Bangla, English, Gujarati, Hindi, Kannada, Malayalam, Marathi, Odia, Punjabi, Telugu, and Sanskrit language Wikisource communities. The objectives of the consultation are:

Share views and preferences on the most effective ways to pursue our shared vision of creating and sharing free knowledge in India and in the Indian languages (including English) around the world through the Indic Wikisource Project.
Attempt to come to an agreement on a roadmap for a future where our resources are better utilized, our volunteers are better served, and progress on our mission is more steadily attained.

We have started our discussion on day zero with the agenda of the main aims of this consultation and what all participants want from this program. The discussion was started at 6 PM and ended at 10 PM night. After discussion, we have summarized and set-up for two days agenda which was actually coming from the participants. The CIS-A2K team arranged for the travel and stay of all participants, as well as a night stay for all participants between the zero and second day, to ensure that the programme started on time on.

Day one started with Introduction of Wikisource by me were introduce the workflow of Wikisource, adding text, finding the source, basic copyright checking, creating Index pages, OCRed the page, Proofreading, layout with typography, Validation, Transclusion and Finishing touch. Later on, Hrishikes Sen demonstrated each segment broadly. Bodhisattwa (Bengali) demonstrated Wikisource Tool, like IA-UPLOAD, Vicuna Uploader, URL2COMMONS, Fill index Gadget etc. And all participants implement hands-on. Bodhisatta showed the Bengali Wikisource promotional videos.

Day two was started with Google Drive OCR without using Bot solution developed by Jayprakash (Indic Tech team). Later on OTRS process by Jayanta Nath, Wikisource Roadmap by Tanveer Hasan, Institutional Partnership - by Subodh Kulkarni and Transclusion in Wikisource by Susant Salva presented. The most achievements of this meeting were the second day, Jayprakash leads the task myself to clear the Wikisource technical backlog.

There were also some ideas coming up by the session by Tanveer. This included awareness, outreach, followups, and evaluation. A report about this meeting was published at Asomiya Pratidin. Some feedback from the participants can be found here.

Punjabi Wikisource Training Workshop, Patiala

A two-day long First Indic Wikisource Workshop training programme was organised by Punjabi Wikimedian during November 17-18th 2018 in Patiala, Punjab to better capacity of Wikisourcers both technically, and outreach and community building.

This is the second time when I met Punjabi Community. They had organized a Wikisource Workshop at Patiala specific for Punjabi Wikisource. When I reached the workshop venue, I was showing that all fifteen participants were eager to learn. The workshop event page can be viewed here.

It was scheduled from 9:00 am to 6:00 pm on November 17-18th 2018. The advantage of this present Punjabi Wikimedia Community, most of the member is coming from Punjabi Literature students. And I was surprised that two of them are so little class, Eight Standard students. This was the first Workshop happening in India about Wikisource. Prior to the event, I had prepared with all Gadgets.

The event started half an hour later than planned, as most of the participants took longer to make it to the venue. We found it difficult to demonstrate the examples. The biggest challenge was not a technical one, but connecting with the audience. We ended up lecturing less and demonstrating more. I started with a small introduction to Wikisource with details What is Wikisource & What is the aim of the Wikisource and Indic Wikisource Stats explanation.

After introduction I explained and demonstrated the workflow of Wikisource, adding text, finding the source, basic copyright checking, creating Index pages, OCRed the page, Proofreading, layout with typography, Validation, Transclusion and Finishing touch. Then I was demonstrated Character Insert Tool: with Gadget-charinsert. After watching this all the participants were so happy because the proofreading will be reduced and make easy. Show the most used templates as best practice in Wikisource world.

In the workflow, we had started with uploading a file in commons and local as per copyrights status, as tool Chunked_upload and Vicuna uploader. The first day was ended with few edithon and interface change in Punjabi Wikisource.

2nd day was started with On the brighter side, there were many interesting and engaging queries from few of the participants who had already proofread pages on Wikisource. Next workflow started with creating an Index file with IndexForn.js Gadget and fill with all meta from commons and remaining data was filled by participants. Then I explained the method of OCR4Wikisource by python script and offline Tesseract OCR.

One of the best lessons we learned from the event was that it is very important to know the audience well in advance and to structure the workshop accordingly. The participants seemed to prefer the visual editor over editing the wiki markup for proofreading.

The final achievement was every participant understand the importance of Wikisource and the last one is the best for my motivation.

The event was a success in that it introduced the Wikisource to various ways of getting involved with the Wikimedia movement, thereby changing the perception that the only way to get involved is by proofreading online.

Indic Wikisource Community Consultation 2018 report at Asomiya Pratidin ePaper- Highest Circulated Assamese Daily

Volunteers from various Indic Wikisource projects took part in a discussion organized by Centre for Internet and society: access to knowledge (CIS:A2K) in Kolkata recently. Dr. Gitartha Bordoloi participated in this consultation on behalf of the Assamese Wikisource which included other Indic languages like Bengali, Odia, Marathi, Malayalam, Hindi, Kannada, Gujarati, Punjabi, Telugu and Sanskrit. It is worth mentioning here that Wikisource is another important project like Wikipedia, Wiktionary etc operated by Wikimedia Foundation. Anyone can contribute to this wikisource project which stores copyright-free books, plays, lyrics, speeches, translated works etc. Such works are first scanned and digitalized and then converted to unicode so that everything becomes searchable. Assamese Wikisource (as.wikisource.org), started in 2013, so far includes various literary works of Guru Sankardeva and Madhavdev, Jyotiprasad Agarwala, Lakshminath Bezbaroa, Padmanath Gogain Baruah, Chandraprasad Agarwala, Amulya Barua, Dandinath Kalita etc. Measures to popularize Wikisource among masses, increasing numbers of readers and contributors, correct techniques to digitalize a book etc were discussed at the event in Kolkata.

Highlights

CIS has published a statement on its website in response to the serious allegations against CIS members and the CIS workplace on social media. CIS has taken note of the concern raised on a social platform, and its Internal Committee (IC), constituted as per the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, has taken some critical steps. CIS has engaged POSH at Work to review the case and make recommendations to the Executive Director of CIS.
Anubha Sinha attended the 37th meeting of WIPO SCCR held in Geneva in the month of November 2018. During the week she made two statements on behalf of CIS and participated in a panel discussion and a closed door meeting to brief government delegates from the Asia pacific region on the WIPO limitations and exceptions agenda. CIS made statements on limitations and exceptions and the proposed treaty for the protection of broadcasting organizations. Transcript of her talk can be accessed here.
A memorandum outlining India's strategy to global cyber norms formulation processes authored by Elonnai Hickok and Arindrajit Basu and edited by Aayush Rathi and Shruti Trikanad. The memorandum seeks to summarise the state of the global debate in cyberspace; outline how India can craft it’s global strategic vision and finally, provides a set of recommendations for the Ministry of External Affairs as they craft their cyber diplomacy strategy.
The institution of open standards is as a formidable regulatory regime governing the Internet while facilitating its growth as a network of networks. As a nation digitising rapidly and facing concerns in cybersecurity and Internet governance, there is a need for the Government of India to meaningfully participate at standards development organisations to represent the interests of the Indian populace and become a voice for the global South. Authors Aayush Rathi, Gurshabad Grover and Sunil Abraham examine this in a policy brief.
The Convention on Cybercrime adopted in Budapest (“Convention”) is the first and one of the most important multilateral treaties addressing the issue of internet and computer crimes. Vipul Kharbanda has analyzed this in his research paper titled Budapest Convention and the Information Technology Act.
Amber Sinha was one of the stakeholders who provided inputs to the Danish Expert Group on Data Ethics in June 2018 during their visit to New Delhi. The Expert Group has prepared and submitted its final report.

Access to Knowledge

Our Access to Knowledge programme currently consists of two projects. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

As part of the project grant from the Wikimedia Foundation we have reached out to more than 3500 people across India by organizing more than 100 outreach events and catalysed the release of encyclopaedic and other content under the Creative Commons (CC-BY-3.0) license in four Indian languages (21 books in Telugu, 13 in Odia, 4 volumes of encyclopaedia in Konkani and 6 volumes in Kannada, and 1 book on Odia language history in English).

Views on on the proposed WIPO Treaty for the Protection of Broadcasting Organizations at side-event organised by Knowledge Ecology International

On November 27, Knowledge Ecology International (KEI) organised a side event during deliberations of the 37th Session of the Standing Committee on Copyright and Related Rights (SCCR) of the World Intellectual Property Organization (WIPO). Centre for Internet & Society (CIS), Electronic Information for Libraries (eiFL.net), Corporacion Innovarte, Creative Commons, and Knowledge Ecology International appraised the current text for the proposed WIPO Treaty for the Protection of Broadcasting Organizations (Revised Consolidated Text on Definitions, Object of Protection, Rights to be Granted and Other Issues, SCCR/36/6). Speakers provided an overview of the treaty, explained the potential risks and problems caused, and proposed solutions to narrow the Treaty’s scope and limit the damage. Below is a transcript of the remarks made by Anubha Sinha who represented CIS at this event.

Good afternoon, everyone.

My presentation will be in reference to the revised consolidated text SCCR 36/6 and the US proposal SCCR 37/7.

In essence, this treaty is trying to create a new set of rights for broadcasters operating in both mediums (first, traditional – satellite, airwaves, cables, and second, the internet), ostensibly to counter signal piracy. We are looking at updating a neighbouring rights or related rights regime to protect signals across both mediums.

The intent of treaty is to exclude entities exclusively delivering their programmes over the internet. I fear that the results would create an unequal playing field between broadcasters and internet streaming entities. This would be the first, immediate impact. To then catch up, perhaps, internet streaming services would look to satisfy the treaty requirements to avail protection. This would involve satisfying the definition of a broadcasting organisation (as in SCCR 36/6), and for their country to have ratified the treaty. The characteristics of a broadcasting organisation can be satisfied by acquiring any traditional broadcasting service, for such an entity, as per the current text of the treaty. This would require serious capital, and most start up innovations in the area would not be in a position to undertake such a step. And then there is the question of asserting the rights and enforcing them in other countries – this will be an extremely expensive affair. The point I’m trying to make is that this treaty seems to be set to protect a narrow slice of broadcasters, with significant market power in their home markets.

My co-panelists will discuss specific harms that this will have on the building of commons, and other damaging effects on global efforts to build an affordable and accessible knowledge system. This is unfortunate, and hence we urgently need text that provides for a mandatory list of limitations and exceptions, and not work with the soft language that is present right now. We have to accept that multilateral norm-setting at the international level sets the tone for countries to enact their own national legislations – indeed, before the Marakkesh treaty there were hardly any developing countries which had an expansive beneficial copyright exception for the visually impaired (except India - that I'm aware of), and look who the first few countries to ratify the treaty were – India, Argentina, El Salvador, Paraguay, Uruguay, etc – all developing countries leading to adopt this international standard.

The US delegation’s proposal, introduced yesterday, pushes the idea of limiting exclusive rights granted under this treaty to broadcasting organisations, so long as the countries provide adequate protection against piracy in other bodies of law. This seems like a promising idea – one that does not upend the legal theories of neighbouring rights and also shrinks the proposed model in the treaty that seeks to grant monopolistic property rights for a long and unclear period of time to powerful organisations – organisations that by their very nature and functions are chroniclers of our times and keepers of valuable cultural heritage.

At a seminar on this very treaty organised last month by KEI, Proffessor Bernt Hugenholtz flagged off the problematic justifications provided for increasing the strength of this neighbouring right. He said that the justifications should indicate a corresponding increase in cost of disseminating content. Should new exclusive rights be created for gradation-like increase in investment? He was not convinced that the costs had gone up significantly, and he also pointed out that this cost should not account for money spent on acquiring the rights to broadcast the content. Further, going back to the US proposal, the proposal recognises the persistent conceptual difficulties of distinguishing between signal protection and content protection. This very difficulty has been raised by many civil society organisations in the past, and more recently it cropped up at a discussion on the treaty in New Delhi, where both civil society organisations and representatives of broadcasters were present. Another practical challenge (that remains) will be to separate the computer network based operations from the non-computer network based operation; however, in this age, is it technically possible to do that?

To conclude, I think that fundamental concepts and terms need to be properly clarified to arrive at an understanding that is shared across all stakeholders; and a corresponding strengthening of limitations and exceptions is urgently needed.

37th SCCR: CIS Statement on the Agenda on Limitations and Exceptions

The Centre for Internet and Society is a civil society organisation based in India working on issues of openness and access to knowledge, amongst others.

India is a diverse country with thriving communities working on and promoting access to research, data, archival material, educational material, and developing material to benefit persons with other disabilities. As such, the regional seminars will be an excellent opportunity for such communities to interact with various stakeholders and government delegates; and help formulate concrete principles that should inform the international legal instrument that we hope is developed and discussed soon.

To enable comprehensive and substantive participation and discussions, I urge member states and WIPO to undertake steps to make the regional seminars as inclusive as possible. I request the secretariat and member states to actively work with civil society to identify and invite such community leaders.

37th SCCR: CIS Statement on the Proposed Treaty for the Protection of Broadcasting Organizations

There still remain concerns about the weak language on limitations and exceptions in the proposed treaty.

The proposed treaty is bound to have adverse effects on legally accepted existing practices of sharing and using online works. Libraries, archives, museums, educational and research institutions, public interest organisations such as Creative Commons, organisations and efforts directed at making orphan works available online - all perform critical roles to advance the progress of society. There is a looming threat on the continuation of their ability to access and to provide the public subsequent access to their collections. Thus, there is a dire need to incorporate robust solutions into the treaty text to not have unintended consequences on the society.

We must also make note of developments such as Facebook acquiring rights to stream La Liga matches in the Indian subcontinent and acquisition of Pandora by a broadcaster (Sirius XM). In such an environment, it is becoming impossible to technically eliminate the role of computer networks insofar as creating the signal and transmitting it is concerned. The treaty still envisages to not benefit those transmissions that occur exclusively on computer networks. In light of new business and technological realities, the deficiencies in the Committee's discussions are already apparent. We urge the committee to work to ensure that the resultant treaty is balanced in letter and spirit, both.

Van Bodh Workshop for content development on Forest Resources at Gadchiroli

Mumbai School of Economics and Public Policy, Bombay University has formulated and going to start a "Diploma course in Community Resource Management " with the support of TRTI, Pune from 2nd of oct 2018. This is a historic attempt to impart education of the level of a diploma to rural, especially tribal youth without any condition of academic qualification. The course was conducted at Mendha(Lekha) an hamlet in Dhanora taluk of Gadchiroli District. Agnidipto Tarafder and Arindrajit Basu in an article published in Socio-Legal Review has traced the journey of the recent 377 (Navtej Johar v Union of India) and assessed its societal implications.
CIS invites applications for *three Research Fellow positions* to undertake field studies of platform-work in two cities, including Bangalore and another city (to be decided). The project seeks to produce a comparative understanding of at least two different kinds of platform-work as unfolding across Indian cities. 5th Global Congress On IP And The Public Interest: Successes, Strategies Highlighted

More than 400 activists, academics and practitioners from over 50 countries gathered at this year’s Global Congress on Intellectual Property and the Public Interest, according to organisers.

At the Congress, participants shared success stories, developed strategies, and engaged in critical dialogue to re-think and re-invent intellectual property systems that serve the public interest.

The 5th Global Congress on Intellectual Property and The Public Interest was hosted by American University Washington College of Law in Washington, DC from 27-29 September. The core goal of the Congress, according to the website, is “to promote evidence-based policy-making by fostering partnerships between academics and policy advocates from around the world.”

The Congress featured three concurrent, but interconnected, tracks centred around copyright user rights, access to medicines, and trade. A list of the many panels, workshops and other events of the Congress can be found in the event agenda.

Key themes that emerged from the plenary sessions of the Congress include the need to take a critical look at the association between intellectual property and development, the important roles that both IP activism and academic research play in shifting practice, and the complex tension between pursuing incremental IP reform in the short-term, while envisioning and building toward IP system change in the long-term.

Participants were asked by organisers to contribute statements and to vote in an online poll to chart and map participant perspectives at this year’s Congress. The interactive results of the poll can be viewed here.

Access to Medicines Track

Intellectual Property Watch followed the access to medicines track throughout the Congress, to develop a broad picture of the persistent challenges and new strategies in this field, and to identify key initiatives to feature in the coming months. Below are some of the themes that emerged over the course of the sessions, along with key highlights.

Compulsory Licensing

Some participants highlighted their countries’ use of compulsory licensing to reduce drug prices and to maximise health budget capacity, with notable examples from Ecuador, Chile and Malaysia. Participants identified that many other countries, however, are not taking full advantage of these flexibilities, which can be partly attributable to a lack of awareness regarding these flexibilities, and a lack of systems to employ them. They noted that this is often compounded by IP-centric technical assistance that frames strong IP systems as necessary for development. Many participants argued that compulsory licensing, along with other intellectual property flexibilities, should be fully normalised, and that IP law should be structured to maximize the use of these flexibilities, rather than treat them as exceptions. Some also argued for the institution of international or regional coordination mechanisms for compulsory licensing.

Competition Law

Many participants, representing activist organisations working for access to medicines, noted that their campaigns were largely focused on the price of a particular drug in a particular country. Pursuing access to medicines on such a piecemeal basis, they explained, does not produce sustainable change within the IP system itself. This, they noted, is a similar challenge faced when issuing compulsory licences. Participants explained that pursuing strategies based in competition law could perhaps offer a more sustainable solution to address excessive pricing across a range of drugs. This strategy, they explained, could move forward key legal reforms to systemically challenge pharmaceutical monopolies and bring about more competitive drug pricing.

Innovation

According to participants, the term innovation infers a particular narrative, similar to “intellectual property,” and has been used by industry to justify the pharmaceutical patent system. One participant explained that patents are currently being granted on the basis of utility, rather than real inventiveness. He explained that the term innovation has come to represent the industry-led process of shaping markets and cycles of consumption, and that therefore, we need to reconsider our use of the term.

Research and Development

Many participants highlighted the dysfunction of the current monopoly incentive system for pharmaceutical research and development, and advocated for other systems such as delinking the price of pharmaceuticals from the cost of research and development and the volume of sales. Others highlighted examples of how drugs for neglected diseases can be developed and manufactured without intellectual property incentives, and still others how drug licences can be efficiently pooled to facilitate widespread generic drug production. Another participant further illustrated the dysfunction of the current system, noting that much of the research and development of patented pharmaceuticals was publicly funded, and that there needs to be greater public accountability in drug pricing.

Medicines as Non-Patentable

One important perspective, expressed by participants across tracks, is simply that medicines should be non-patentable and accessible to all people, without restriction.

Intellectual Property Watch will feature some of the key access to medicines initiatives highlighted at the Congress in greater depth and detail in the coming months.

Background of the Global Congress

The First Global Congress on Intellectual Property and the Public Interest was held in 2011 at American University Washington College of Law in Washington, DC, and the specific policy goals of the Congress were summarized in the 2011 Washington Declaration on Intellectual Property and the Public Interest.
