    <title>‘Miracle at Marrakesh’ to help visually impaired read</title>

&lt;p style="text-align: justify; "&gt;On Friday, in the same city that established the World Trade  Organisation nearly two decades ago, another significant treaty was  born. In Marrakesh, Morocco, international negotiators signed a treaty  that will make access to books for the visually impaired, blind and  print disabled easier.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;After a week of intense debate among the negotiators (facilitated by the  World Intellectual Property Organisation), the Marrakesh Treaty to  Facilitate Access to Published Works for Persons who are Blind, Visually  Impaired, or otherwise Print Disabled emerged.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;It will address the ‘book famine’ for the visually  impaired by “requiring its contracting parties to adopt national law  provisions that permit the reproduction, distribution and making  available of published works in accessible formats through limitations  and exceptions to the rights of copyright right holders.” Very simply,  it allows the waiver of copyright restrictions in order for books to be  available in formats such as formats such as Braille, large print text  and audio books.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;Pranesh Prakash of the Centre for  Internet and Society, in his closing remarks said: “It is historic that  today WIPO and its members have collectively recognised in a treaty that  copyright isn't just an ‘engine of free expression’ but can pose a  significant barrier to access to knowledge.”&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;To  recognise that copyright should not frustrate access for some groups of  people and thereby to free books from that ‘constraint’ is of  immeasurable significance for people otherwise unable to access books in  the conventional format.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;The treaty also provides  assurances to authors and publishers that that system will not expose  their published works to misuse or distribution to anyone other than the  intended beneficiaries. “There are no winners and no losers, this is a  treaty for everyone,” said Moroccan Minister of Communications Mustapha  Khalfi, going on to describe it as the “Miracle in Marrakesh.”&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;There  are an estimated 285 million blind and partially-sighted people in the  world, of which the largest percentage lives in India. Only 1 to 7 per  cent of all books published are available in formats accessible to them.  India’s key campaigner for the treaty, the late Rahul Cherian of  Inclusive Planet was full of beans when he spoke to &lt;i&gt;The Hindu&lt;/i&gt; in December last year, anticipating the possibility of a treaty half a year later.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;“It  is a breakthrough!” he said excitedly as he broke the news, “The  Extraordinary General Assembly of the World Intellectual Property  Organisation has referred the Treaty for Visually Impaired Persons to a  diplomatic conference in June of 2013.”&lt;/p&gt;

    <title>2015 USTR Report: Old Wine in New Bottle</title>

        &lt;b&gt;Every year, the Office of the United States Trade Representative (USTR) undertakes an elaborate exercise to castigate countries' domestic intellectual property (IP) law and policy. The criticisms and recommendations are presented in a document called the Special 301 Report. This year's edition puts India on the Priority Watch List for the twenty-sixth time in a row. Below, I rebut the report's prejudicial claims and demands, and argue that the report puts free speech, innovation and public interest in jeopardy. &lt;/b&gt;
        
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;a href="http://cis-india.org/a2k/blogs/2010-special-301"&gt;Keeping
in tradition &lt;/a&gt;, the 
2015 report yet again exposes US' hypocrisy by&amp;nbsp; faithfully serving Hollywood and Big Pharma.&amp;nbsp; In the past, countries 
such as Israel and Canada have
publicly rejected the USTR's  findings and derided the US for
unwarranted interference with domestic law and policy. Last year,
India too had refused to cooperate with a USTR initiated unilateral
investigation (Out of Cycle review) of its IP regime because the
investigation violated international law.
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p align="JUSTIFY"&gt;The
Electronic Frontier Foundation has released a hard-hitting response
to the report. It draws &lt;a href="https://www.eff.org/special-404"&gt;case
studies of countries&lt;/a&gt;
where overbroad IP law has affected public interest, free speech and
innovation. For instance, it mentions how Colombia's 'reformed'
copyright law has become a travesty. Colombia introduced extreme
enforcement and harsh criminal sanctions for unauthorised sharing of
works at the behest of the US. Last year, news surfaced that a
Colombian biodiversity researcher faced upto eight years in prison
for sharing an academic article on Scribd. Any balanced IP regime
(including India) permits such use of copyrighted works under the
fair use principle, however, Colombia's narrow fair use provision has
led to a situation where citizens now face prison for ordinary use of
academic works.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;This
year the Special 301 Report in its section on India approves the
Prime Minister's statements to align IP law with international
standards, which is a cause for concern. Firstly, what are these
“international standards” that both US and India refer to
exactly? The most comprehensive international agreement on IP that
binds 160 member nations is the WTO Agreement on Trade related
aspects of Intellectual Property (TRIPS Agreement). Ergo, this
agreement would qualify as the most accepted “international
standard”, which India already complies with. Secondly, the TRIPS
Agreement sets down certain &lt;em&gt;global&lt;/em&gt;
&lt;em&gt;minimum&lt;/em&gt;
standards for protecting and enforcing IP, simultaneously providing
countries a certain degree of flexibility. However, the US has
consistently pushed India to enact tougher provisions known as TRIPS
Plus provisions. This is reflected in the report as well.  Legally
speaking, under international law India is not obligated to accede to
such demands, and it should not if it wants a balanced IP regime to
protect and serve the interests both of rights holders and its
citizens.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p align="JUSTIFY"&gt;The
report shamelessly aligns its concerns with the financial interests
of foreign rights holders and American companies. It erroneously
projects IP as a tool to only maximise revenues, agnostic to public
interest. While
IP rights are temporary monopolies, they also are a tool to ensure
innovation, social, scientific and cultural progress and further
access to knowledge. It
is well established that flexible IP laws &lt;a href="http://www.altlawforum.org/intellectual-property/publications/articles-on-the-social-life-of-media-piracy/reconsidering-the-pirate-nation"&gt;enable
access to knowledge and promote innovation&lt;/a&gt;.
 Such a flexible regime is critical to developing countries like
India. The USTR
conveniently forgets that lax
IP law and enforcement for a large part of the 19th century helped
the US to accelerate into an economic powerhouse and a front-runner
in innovation. It also
brazenly threatens to impose unilateral sanctions against a country
designated as a Priority Foreign Country on the list. This treatment
is usually reserved for the worst offender on the list. Such
unilateral threats and sanctions are again a direct violation of
international law.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p align="JUSTIFY"&gt;Unsurprisingly,
the report is critical of India's under-enforcement of copyright laws
and the impact of patent law on pharmaceuticals.  It demands a
specific legislation to counter camcording and video piracy. The
prospective legislation is unnecessary because all movie theatres in
India prohibit camcorders and the prevailing Copyright Act, 1957
contains penalties to punish offenders. Instead of creating new
offences, we should re-evaluate the need of existing offences. &lt;a href="http://cis-india.org/a2k/blogs/2010-special-301"&gt;For
instance, copyright infringement on non-commercial scales should not
be a criminal offence at all&lt;/a&gt;&lt;a href="http://cis-india.org/a2k/blogs/2010-special-301"&gt;.&lt;/a&gt;
Instead, the law should provide convenient and affordable access to
such works to counter petty infringement.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p align="JUSTIFY"&gt;India
is home to the world's largest apothecary. The Indian pharmaceutical
and medical device industry provides affordable healthcare to the
citizens, and also exports drugs to countries in need. In fact, the
compulsory licensing mechanism has ensured affordable access to life
saving liver and kidney drugs in India. The report comments on the
undesirability of section 3(d) and the compulsory licensing mechanism
in Indian patent law. With respect to section 3(d), the US wishes
India to to change its patent law to enable large pharma companies to
patent new forms of known substances that aren't even better. This
alarmist outlook smacks of hypocrisy because the US, in fact, has a
higher rate of patent invalidation and compulsory license grants! It
also demands data exclusivity – which would extend proprietary
rights to patentees over government mandated drug data, and would be
detrimental to the local pharma industry. Further, the report states
that the Indian system is biased against enforcement of foreign
patent rights holders - which is mere speculation. T&lt;a href="http://spicyip.com/2015/04/modi-shames-india-calls-patent-laws-under-developed.html"&gt;here
is no evidence to draw such a conclusion.&lt;/a&gt;
The claims relating to localisation trends in pharma are half- baked
and speculative again.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p align="JUSTIFY"&gt;The
report observes that at the UNFCCC negotiations, India recognised
patents as an obstacle to dissemination of climate change
technologies. It wishes India understood the critical role of patent
protection and competitiveness to ensure innovation, which is a
flawed co-relation. While strong IP rights may protect inventors
against infringement and provide return on investment, however,
&lt;a href="https://www.american.edu/cas/faculty/wgpark/upload/Intellectual-Property-Rights.pdf"&gt;stronger
IP rights also raise the cost of innovation by raising the price of
technological inputs into innovation and lower the frequency of
innovation.&lt;/a&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p align="JUSTIFY"&gt;As
far as the issue of counterfeit medicines is concerned, a better
remedy lies in health safety laws and consumer laws, than the
trademark law. The report also approves of state legislatures'
version of the Goondas Act. These Acts &lt;a href="http://cis-india.org/a2k/blogs/fallacies-lies-and-video-pirates"&gt;provide
for detainment of criminals and lumpen elements in society,&lt;/a&gt;
and with recent amendments have expanded to include video pirates and
digital offenders. Karnataka's Goonda Act &lt;a href="http://spicyip.com/2014/08/guest-post-karnatakas-goondas-act-an-examination.html"&gt;enabling
preventive detention violates &lt;/a&gt;&lt;a href="http://spicyip.com/2014/08/guest-post-karnatakas-goondas-act-an-examination.html"&gt;constitutional rights&lt;/a&gt;.
While the Sixth Amendment to the United States Bill of rights
protects offenders against preventive detention, the US has no qualms
about approving such unconstitutional procedures in India.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;


&lt;/strong&gt;&lt;/p&gt;
&lt;p align="JUSTIFY"&gt;The
arguments above underscore the irrelevance of the report. The Prime
Minister may have made appeasing statements to the USA, however, in a
welcome development Commerce and Industry Minister Nirmala Sithraman
in response to the report stated &lt;em&gt;“I&lt;/em&gt;&lt;em&gt;ndia
is fully aligned with international intellectual property rights
standards and "there is no need for anyone to question us."”
&lt;/em&gt;Our
IP
regime with its inherent flexibilities should be preserved and not
sacrificed at the altar of US' business interests. Using
compulsory licensing across sectors would indeed accelerate
technology transfer and diminish initial capex for manufacturers, a
move promoted by the National Manufacturing Policy. The ambitious
Make in India and Digital India campaigns are set to suffer if India
incorporates TRIPS plus standards into its IP regime. The &lt;a href="https://opensource.com/government/10/11/open-standards-policy-india-long-successful-journey"&gt;government
supports opennes&lt;/a&gt;&lt;a href="https://opensource.com/government/10/11/open-standards-policy-india-long-successful-journey"&gt;s&lt;/a&gt;
and has implemented policies mandating use of open standards and open
source software as a part of the Digital India campaign. India should
not let foreign hands dictate its IPR Policy, and proceed to develop
a policy
which is informed by broader principles of fairness and equity,
balancing intellectual property protections with limitations and
exceptions/user rights such as those for research, education and
access to medicines.&lt;/p&gt;

        &lt;b&gt;The Second Global Congress on Intellectual Property and the Public Interest will take place in FGV Law School, Rio De Janeiro, Brazil from December 15 to 17, 2012. The theme for this year’s Congress will be “Setting the positive agenda in motion.” We invite applications to attend the Congress, including proposals to chair workshops or deliver a paper or presentation related to the Congress’s theme.&lt;/b&gt;
        
&lt;h2&gt;Application and Cost &lt;br /&gt;&lt;/h2&gt;

&lt;p&gt;The first Global Congress on Intellectual Property and the Public Interest was convened in 2011 to define a positive agenda for policy reform, build a global network of scholars and advocates to promote the agenda and provide opportunities for the sharing of research and strategies. The nearly 200 inaugural participants from over 30 countries and 6 continents deliberated over three days through in-person meetings and web-based collaboration to produce the Washington Declaration on Intellectual Property and the Public Interest (&lt;a class="external-link" href="http://infojustice.org/washington-declaration"&gt;http://infojustice.org/washington-declaration&lt;/a&gt;) -- an action agenda for promoting the public interest in intellectual property and information law reform around the world.&lt;/p&gt;
&lt;p&gt;Sixteen months later, we come together to measure our progress and expand the positive agenda. To this end, we invite applications to attend the Congress and contribute to its deliberations identifying forums where policy is being developed, proposing policies or actions that promote public interest goals and principles, and identifying and planning to respond to research and analysis needs.&lt;/p&gt;
&lt;h2&gt;Presentation Opportunities&lt;/h2&gt;
&lt;p&gt;Because the primary purpose of the Congress is to promote deliberation and action planning, the opportunities for formal presentation will be somewhat limited. We will, however, have spaces for keynote presentations or panel discussions for each session (see below). In addition, as in the inaugural year, the Congress will host small works-in-progress workshops to allow participants to share their own work and solicit feedback from peers.&lt;/p&gt;
&lt;h2&gt;Draft Workshop Sessions&lt;/h2&gt;
&lt;p&gt;Six main tracks will include a half day workshop introduced by a 
lecture or panel discussion on one or more of the themes noted below. 
The keynote introduction will be followed by deliberation in which 
participants will, first, review progress and opportunity in existing or
 potential policy forums and, second, review the current state of 
research and identify policy and empirical research needs and resources.
 Tracks will also have opportunities to draft statements or action plans
 for adoption at the closing plenary of the Congress or for discussion 
and online after the Congress ends.&lt;/p&gt;
&lt;p&gt;We encourage applicants to identify specific sessions in which they would like to contribute.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Regulating Intellectual Property&lt;/strong&gt;: This session will survey 
recent developments and proposals to regulate uses of intellectual 
property through other legal doctrines that express and safeguard human 
values, including human rights, consumer protection, competition and 
privacy laws.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Valuing Openness and the Public Domain&lt;/strong&gt;: This
 session will survey recent developments and proposals to ensure that 
creative and innovative works ultimately become free for all to use as 
part of the public domain, including through open licensing, open 
access, open educational resources, open data, open standards, open 
government, and related open information policies.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Strengthening Limitations and Exceptions as Enabling Tools for Innovation and Expression&lt;/strong&gt;:
 This session will survey recent developments and proposals to use 
limitations and exceptions as positive enabling doctrines to ensure that
 intellectual property law fulfills its ultimate purpose of promoting 
essential aspects of the public interest.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Setting Public Interest Priorities for Patent and Research and Development Reform&lt;/strong&gt;:
 This session will survey recent developments and proposals to ensure 
that patent and other research and development policies serve all 
segments of society, and particularly the most disadvantaged, and 
accommodate the diverse needs of a complex world with a more diverse 
structure of incentives for innovation.&lt;br /&gt;&lt;br /&gt;Supporting Cultural 
Creativity: This session will survey recent developments and proposals 
to maximize opportunities for creativity while increasing access to 
creative works and helping to end disputes over practices like

 This session will survey recent developments and proposals to fully 
integrate the development dimension into intellectual property policy 
and norm-setting at all levels of international and national 
intellectual policy making. The session will have a special focus on 
developments in the BRICS group of emerging economies.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Targeted Research&lt;/strong&gt;:
 Given the spectrum of issues described above, what are the key research
 needs?&amp;nbsp; Given academic incentive structures, what kinds of research

The Chair, Martin Moscoso updated the Committee on the discussions and the developments that had taken place over the course of the past two days in the Informals. The Centre for Internet and Society made a brief pointed intervention on one of the documents being discussed in the Informals.&lt;/b&gt;

&lt;p style="text-align: justify; "&gt;First on the         making available these documents, we would like to echo what         CCIA and KEI said-         we would also like to see the informal papers made public, so         that we can have a         more informed discussion on these issues.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Second, very         briefly, on some of the rights to be granted- in one of the         Informal Discussion         Papers laid out, in -- in the third column, which are         essentially fixation and         post fixation rights, just very briefly, that whatever is done         in any case         after the signal is fixed is already covered by copyright law         and we find it         frightening and we see little sense in providing two sets of         incompatible, and         overlapping rights- copyright, that is already existing, and a         sort of a para-copyright         (that this treaty seeks to create) for the same underlying         content.&lt;/p&gt;

    <title>29th Session of the WIPO SCCR: CIS Intervention on the Proposed Treaty for the Protection of Broadcasting Organizations</title>

        &lt;b&gt;The Centre for Internet and Society (CIS) made its intervention on the proposed treaty in the ongoing WIPO session on December 9, 2014. &lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;Nehaa Chaudhari on behalf of CIS made the following statement:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Thank you, Mister Chair.&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;This intervention will be based on the chart detailing the ‘Concepts’ corresponding to the Definitions. We believe that certain elements of these concepts are inconsistent with a broadcast treaty based on a signals based approach; and over the course of the next few minutes, I will briefly discuss these.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;&lt;i&gt;First,&lt;/i&gt;&lt;/b&gt;&lt;b&gt; &lt;/b&gt;Mr. Chair in the first column- on broadcasting or cablecasting organizations (in the traditional sense); where communication of the signal has been listed under scope of responsibility. Mr. Chair, ‘communication’ itself is an element of copyright and is distinct from broadcast rights that are related rights. A signal, Mr. Chair, may be broadcast or transmitted. Accordingly, Mr. Chair under the element of Scope of Responsibility, we are of the opinion that it should read Broadcast or Transmission of the signal and not communication of the signal; and the focus should not be at regulating communication to the public.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;&lt;i&gt;Second, &lt;/i&gt;&lt;/b&gt;Mr. Chair, in the second column- on broadcasting and cablecasting transmission- we have three observations. First- under the means of transmission, we believe that transmission over computer networks encompasses IP based transmissions, and should be excluded, in order for the treaty to remain consistent with a signals based approach. Second- on the reception of the broadcast or cablecast transmission, we believe that it should be qualified using the phrase ‘general public’. We are of the opinion that there is a danger that a limited public (say family members) could possibly be covered by the term “public”, but would be excluded from “general public”; which in any case is the targeted audience of a broadcast. Third, Mr. Chair, on whether the transmission would be encrypted or not- which also flows into the third column on the Signal- and whether it is encrypted or not; which then also relates to whether broadcasting organizations will have the right to prevent unauthorized decryption. Mr. Chair, we don’t think that there should be a separate right to prevent unauthorized decryption. Given that signal theft is already a crime, having a specific right to prevent unauthorized decryption might result in an absurdity, where it could even cover decrypting an unauthorized retransmission without authorization from the retransmitter.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;This provision might result in an absurdity, where it would cover decrypting an unauthroised retransmission without authorization from the retransmitter, where the retransmission in the first instance was illegal to begin with.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;&lt;i&gt;Finally&lt;/i&gt;&lt;/b&gt;, Mr. Chair, on the third column and the meaning of signal- we submit that our preferred definition would be where the definition of a signal is confined, and it understood as an electronically generated carrier transmitting a broadcast or cablecast and NOT one which has the capability of such a transmission, as stated in the third column in your Chart on concepts.&lt;/p&gt;

        &lt;p style="text-align: justify; "&gt;In 2008, WIPO commissioned &lt;a class="external-link" href="http://www.wipo.int/meetings/en/doc_details.jsp?doc_id=109192"&gt;a study on Limitations and Exceptions for Libraries and Archives&lt;/a&gt;.This was prepared by Prof. Kenneth Crews. On December 10-11, 2014, at SCCR 29, Prof. Crews presented &lt;a class="external-link" href="http://www.wipo.int/meetings/en/doc_details.jsp?doc_id=109192"&gt;an updated (2014) version of this study&lt;/a&gt; and addressed comments and questions from Member States and Observers.&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;CIS Statement:&lt;br /&gt;&lt;br /&gt;Thank you, Madam Chair.&lt;br /&gt;&lt;br /&gt;Thank you very much, Professor Crews for your presentation yesterday, and for this comprehensive study on Limitations and Exceptions for Libraries and Archives, very timely, and very important to us, from the perspective of access to knowledge and information.&lt;br /&gt;&lt;br /&gt;I have two questions:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;My first question: Did you find, in your examination, that, in terms of/ or on the question of limitations and exceptions, did you find, that there was an equal or equitable treatment of digital resources in comparison to resources available in more traditional formats? And if not, where do you think that lever of change lies to ensure that fair dealing provisions are extended equitably to the digital environment as well?&lt;br /&gt;&lt;br /&gt;My second question, is on the interoperability of Limitations and Exceptions: Given that copyright is a very national thing, and, as your study has also well established, countries have a whole range of very diverse approaches and practices on Limitations and Exceptions; but also given that we live in an increasingly globalized world, we need a system that is interoperable with respect to the trans-boundary movement of works, with as little friction as possible, both- in the physical as well as in the digital environments. So, what did your examination show us of how interoperable- or not- the range of Limitations and Exceptions actually are?&lt;br /&gt;&lt;br /&gt;Those are my two questions.&lt;br /&gt;&lt;br /&gt;Thank you very much.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Response by Prof. Kenneth Crews:&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Thank you very much. On the second question, I'm afraid I might mind myself only repeating some of the concepts that have already said about transborder and really about in the statutes anyway, a lack of recognition of transborder. And the transborder concept, so I will add this piece to the conversation, the transborder concept seldom if ever appears in these library exceptions to the extent that we are going to find it in copyright law or some other part of a national law it may very well be over in the import/export kind -- area of the law. But that also goes to the interoperability which think we have answered a few times just this sort -- the lack of exact harmonization and as others have reminded me I have said before that I may not be a fan of exact precise harmonization and indeed it may not be possible or even desirable. But some degree of harmonization can help with that interoperability. Interesting question, you do -- you did raise a new point about digital. We have talked several times in this conversation about use of digital technologies in the exercise of the rights of use under the exception. However what I think you were asking about is the ability to apply the exception to works that are digital in the first place that are what we call born digital and that's a very interesting question. The statutes do not address that. Sometimes you will see a statute that refers to -- that says it applies to all these different kinds of works but not computer software. That tells you somebody was thinking it shouldn't apply to software but somehow software is different and there are problems with that. We know that software has changed and been incorporated in to many different works. But we generally see a statute almost always see a statute that's about books or archival materials or some other kind of work without specifying the technology. So can it apply to an e-book in addition to the paper book? The statutes don't go there. They don't sort that out. So in my common law tradition I look at that and see that as a question for interpretation. In a civil code system I might look at it and see it a little bit more firmly for lack of a better word about what the scope of that word book, for example, really means.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Really good question. And it is one that the statutes have not picked up on.&lt;/p&gt;

    <title>5th Global Congress On IP And The Public Interest: Successes, Strategies Highlighted</title>

        &lt;b&gt;More than 400 activists, academics and practitioners from over 50 countries gathered at this year’s Global Congress on Intellectual Property and the Public Interest, according to organisers.&lt;/b&gt;

&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;At the Congress, participants shared success stories, developed  strategies, and engaged in critical dialogue to re-think and re-invent  intellectual property systems that serve the public interest.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The &lt;a href="http://www.cvent.com/events/5th-global-congress-on-intellectual-property-and-the-public-interest/event-summary-cf2ca0aa63414d4d9dd9dafed6a09a4c.aspx"&gt;5th Global Congress on Intellectual Property and The Public Interest&lt;/a&gt; was hosted by American University Washington College of Law in  Washington, DC from 27-29 September. The core goal of the Congress,  according to the website, is “to promote evidence-based policy-making by  fostering partnerships between academics and policy advocates from  around the world.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Congress featured three concurrent, but interconnected, tracks  centred around copyright user rights, access to medicines, and trade. A  list of the many panels, workshops and other events of the Congress can  be found in the event &lt;a href="http://www.cvent.com/events/5th-global-congress-on-intellectual-property-and-the-public-interest/agenda-cf2ca0aa63414d4d9dd9dafed6a09a4c.aspx"&gt;agenda&lt;/a&gt;.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Key themes that emerged from the plenary sessions of the Congress  include the need to take a critical look at the association between  intellectual property and development, the important roles that both IP  activism and academic research play in shifting practice, and the  complex tension between pursuing incremental IP reform in the  short-term, while envisioning and building toward IP system change in  the long-term.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Participants were asked by organisers to contribute statements and to  vote in an online poll to chart and map participant perspectives at  this year’s Congress. The interactive results of the poll can be viewed &lt;a href="https://pol.is/report/r7k76vmnhmnann5npxdmk"&gt;here&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;&lt;b&gt;Access to Medicines Track&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;i&gt;Intellectual Property Watch&lt;/i&gt; followed the access to medicines  track throughout the Congress, to develop a broad picture of the  persistent challenges and new strategies in this field, and to identify  key initiatives to feature in the coming months. Below are some of the  themes that emerged over the course of the sessions, along with key  highlights.&lt;/p&gt;
&lt;p&gt;&lt;b&gt;Compulsory Licensing&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Some participants highlighted their countries’ use of compulsory  licensing to reduce drug prices and to maximise health budget capacity,  with notable examples from Ecuador, Chile and Malaysia. Participants  identified that many other countries, however, are not taking full  advantage of these flexibilities, which can be partly attributable to a  lack of awareness regarding these flexibilities, and a lack of systems  to employ them. They noted that this is often compounded by IP-centric  technical assistance that frames strong IP systems as necessary for  development. Many participants argued that compulsory licensing, along  with other intellectual property flexibilities, should be fully  normalised, and that IP law should be structured to maximize the use of  these flexibilities, rather than treat them as exceptions. Some also  argued for the institution of international or regional coordination  mechanisms for compulsory licensing.&lt;/p&gt;
&lt;p&gt;&lt;b&gt;Competition Law&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Many participants, representing activist organisations working for  access to medicines, noted that their campaigns were largely focused on  the price of a particular drug in a particular country. Pursuing access  to medicines on such a piecemeal basis, they explained, does not produce  sustainable change within the IP system itself. This, they noted, is a  similar challenge faced when issuing compulsory licences. Participants  explained that pursuing strategies based in competition law could  perhaps offer a more sustainable solution to address excessive pricing  across a range of drugs. This strategy, they explained, could move  forward key legal reforms to systemically challenge pharmaceutical  monopolies and bring about more competitive drug pricing.&lt;/p&gt;
&lt;p&gt;&lt;b&gt;Innovation&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;According to participants, the term innovation infers a particular  narrative, similar to “intellectual property,” and has been used by  industry to justify the pharmaceutical patent system. One participant  explained that patents are currently being granted on the basis of  utility, rather than real inventiveness. He explained that the term  innovation has come to represent the industry-led process of shaping  markets and cycles of consumption, and that therefore, we need to  reconsider our use of the term.&lt;/p&gt;
&lt;p&gt;&lt;b&gt;Research and Development&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Many participants highlighted the dysfunction of the current monopoly  incentive system for pharmaceutical research and development, and  advocated for other systems such as delinking the price of  pharmaceuticals from the cost of research and development and the volume  of sales. Others highlighted examples of how drugs for neglected  diseases can be developed and manufactured without intellectual property  incentives, and still others how drug licences can be efficiently  pooled to facilitate widespread generic drug production. Another  participant further illustrated the dysfunction of the current system,  noting that much of the research and development of patented  pharmaceuticals was publicly funded, and that there needs to be greater  public accountability in drug pricing.&lt;/p&gt;
&lt;p&gt;&lt;b&gt;Medicines as Non-Patentable&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;One important perspective, expressed by participants across tracks,  is simply that medicines should be non-patentable and accessible to all  people, without restriction.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;i&gt;Intellectual Property Watch&lt;/i&gt; will feature some of the key  access to medicines initiatives highlighted at the Congress in greater  depth and detail in the coming months.&lt;/p&gt;
&lt;p&gt;&lt;b&gt;Background of the Global Congress&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The First Global Congress on Intellectual Property and the Public  Interest was held in 2011 at American University Washington College of  Law in Washington, DC, and the specific policy goals of the Congress  were summarized in the 2011 &lt;a href="http://infojustice.org/washington-declaration-html"&gt;Washington Declaration on Intellectual Property and the Public Interest&lt;/a&gt;.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Congress was subsequently hosted in 2012 by Centro de Tecnologia e  Sociedade of FGV Direito, in Rio de Janeiro, Brazil, in 2013 by  University of Cape Town IP Unit, in Cape Town, South Africa, and in 2015  by the Centre for Internet and Society, in New Delhi, India.  Intellectual Property Watch has attended them all.&lt;/p&gt;

&lt;li style="text-align: justify; "&gt;Swaraj Paul Barooah made a presentation at the Microsoft Panel Event titled "Intellectual Property and Artificial Intelligence" held at the Microsoft Innovation and Policy Centre. His co-panelists were Pam Samuelson (Berkeley Law), Niva Elkin-Koren (Uni of Haifa) and Pedro Mizukami (Founder of Centro, Brazil). The session was moderated by Mike Carroll and Christine Farley (both of American University).&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;Anubha Sinha and Sunil Abraham along with Jorge Contreras (University of Utah), spoke on the panel titled "Fueling the Affordable Smartphone Revolution in India" where they presented work on the PT project.&lt;/li&gt;
&lt;li style="text-align: justify; "&gt;CIS signed on as supporting members to the Civil Society Proposal for a Treaty on Education and Research Activities (TERA) which was formally finalized and made ready for organizational and individual endorsements.         &lt;b&gt;The 4th Global Congress on Intellectual Property and the Public Interest was held from December 15 to 17, 2015 in New Delhi. This post provides a summary of the event.&lt;/b&gt;

&lt;h3 style="text-align: justify; "&gt;Wrap up note 1: Feedback on broad discussion in the IP and Dev track – set of collected key points:&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;This year, the discussions included attention to broad perspectives on clarifying the meaning and reality of open collaborative innovation, as well as significant focus on the sub-themes of economic development (innovation and software patents, clean technologies, climate change and green patenting, issues of branding and plain packaging); sustainable development (agriculture and geographic indicators [GI]); policy, law and regulation (role of governments, patenting, compulsory licensing [CL], global institutions [particularly WTO, WIPO and WHO] and national institutions [particularly patent offices]). Trade dominated the discussions across the IP and Dev track, including the TPP and other issues, reflecting the strong global trade agenda.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Missing areas in the track papers, workshops and panel discussions included the limited discussion on traditional knowledge (TK); the work of indigenous groups and how they are navigating the IP landscape; biodiversity; biotech and food security; innovation in the nanotechnology sphere; and inclusive development. Accessibility to innovations for low-income households, and accessibility to innovations at the country level needs greater attention. These topics can be brought out more strongly, more directly.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The value of building research networks to create explicit knowledge and coherence in research-based evidence for advocacy and policy-making was made visible in the workshop session presented by Open AIR, with the Open AIR network as the exemplar. The challenge is to translate the kinds of research and evidence presented at the GC into content and value for policy-making and trade negotiations.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Wrap up note 2: Value of the deliberations and future research:&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;This is a new track in the GC, introduced in 2015. It is an important track for this and future Global Congresses because it brings together the many strands of research, advocacy and other work that are related to topics in innovation, IP and development, but which are not specifically about openness, user rights or A2M. This is a very broad range of fields of study, from agriculture to nanotechnology. It was proposed that the track be renamed “Innovation and Development” to more explicitly describe its focus.&lt;br /&gt;&lt;br /&gt;From this GC, it has become clearer what future topics may be considered for papers and other inputs into the IP and Dev track. Such topics include counter-narratives to mainstream IP perspectives; bringing IP for development in multiple sectors to the fore – in education; in automotive manufacturing; in technology evolution; in agricultural production and food security; in the broad policy, law and regulatory environment pertinent to these and other sectoral perspectives. For example, in the paper on green patenting, reference was made to Tesla and Toyota releasing patents, but the session did not get to discuss that. The papers presented at the 4th GC suggest many areas of focus for future research and future GCs – perhaps the best way to think about this exploration is through greater attention to     innovation in a range of social and economic sectors; to consider the particular challenges of innovation, IP and development in LDCs; to study innovation ecosystems and where IP fits in these ecosystem. Cross-track sessions are also considered to be very important because of the knowledge sharing that takes place across sectors, for example the discussions on patent wars in the access to medicines (A2M) track provided food for thought with respect to emerging issues in     the software sector.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Wrap up note 3: Ideas and implications of GC sessions for future directions for research, collaborations and next GC:&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;For the next GC, mobilization is required across various geographic regions and a significant discussion is required on preparation and design of the sub-themes, based on the notes above. The requirement for more evidence-based research was noted. It was recommended that the future name of the track should be Innovation and Development. The core group, comprised of track leaders and sessions chairs, should continue the leadership of the track from GC to GC, bringing additional interested persons on board, in particular with respect to the design of sub-themes well in advance of the 5th GC, to guide prospective submissions.&lt;/p&gt;

        &lt;b&gt;An article by Nilanjana S Roy was published in the Business Standard on February 19, 2011. In this article Nilanjana Roy explains to us how a copyright amendment might change the way we read, write and publish in India.&lt;/b&gt;
        
&lt;p&gt;Call this the war of the slogans. On one side, copyright lawyers and the Ministry of Human Resource Development offer the lure of cheaper books for Indian readers. On the other, publishers and authors speak of the death of Indian publishing as we know it.&lt;/p&gt;
&lt;p&gt;Section 2(m), a proposed amendment to India’s copyright law that would allow the parallel import of books, is a dry piece of legalese, but it’s sparked a blog war, a flurry of publisher white papers, and a wide debate on copyright and territory.&lt;/p&gt;
&lt;p&gt;The rationale is a legally sound one — to align Indian copyright law with Indian patent and trademark law, both of which follow the principle of “international exhaustion”: once a product has been legitimately sold, that product can be resold anywhere in the world without the consent of the owner of the copyright, be that the author or the publisher.&lt;/p&gt;
&lt;p&gt;According to the Association of Publishers of India, “This proviso would mean that books published in any country could be freely made available and sold in India, without this amounting to infringement of copyright.”&lt;/p&gt;
&lt;p&gt;Theoretically, parallel imports would allow a publisher or a printer who does not hold copyright to an Indian edition of a book to print his or her own editions of the book, under certain conditions, and release them back into the Indian market. There is also a fear among publishers that this might lead to widespread “dumping”, where the market is flooded with cheap, remaindered books.”&lt;/p&gt;
&lt;p&gt;When this applies to books, specifically, one side argues that allowing “parallel imports” of books would open up the Indian publishing market to competition and would allow readers access to cheaper books. The other side argues that authors and publishers would suffer, and that in the long run, so would the reader. Thomas Abraham, managing director, Hachette India, states his position succinctly: “This would be the death of publishing and writing as we know it in India — and ironically by a surfeit of books.”&lt;/p&gt;
&lt;p&gt;Step back from the rhetoric and the very complex issues involved about the intricacies of copyright law, territoriality in publishing, the book remainders market and book dumping, and here’s how the amendment is likely to affect readers, authors, publishers and booksellers.&lt;/p&gt;
&lt;h3&gt;Booksellers&lt;/h3&gt;
&lt;p&gt;Perhaps the sharpest summary comes from Landmark Bookstore’s Madhu Mohan: “As booksellers, we want to give our customers a wider range at a lower price. An open market immediately affords both: the cost of this is that publishers with Indian market rights might suffer. The more significantly affected parties are authors, publishers and readers. If, arguably, territorial rights are not sold, authors might earn lower advances. Publishers who have paid for territorial rights, are not able to get the full benefit of their monies. Readers should welcome the change, because at the outset they will get lower priced books.”&lt;/p&gt;
&lt;p&gt;His view is echoed across the bookselling industry, with reactions ranging from indifference to the possible repercussions to cautious alarm — for many booksellers, a weak or damaged Indian publishing industry is also a negative.&lt;/p&gt;
&lt;p&gt;Almost all booksellers agree that the short-term benefits of allowing parallel imports would be to lower the price of books. India already has among the lowest-priced English language books in the world, but it would be interesting to see if even lower prices reeled in a different kind of reader. As Mohan points out, book imports would be cheaper; books published in India by Indian or foreign authors would be adversely affected. The long-term scenario is another matter; if the Indian publishing industry is hit hard, we could be flooded with cheap, low-quality remainders, or lose price benefits in the long run.&lt;/p&gt;
&lt;h3&gt;Authors&lt;/h3&gt;
&lt;p&gt;For authors, what’s key about the 2(m) amendment is the way in which it would affect the writer’s copyright over his/ her work — and also the shifts it might bring about in the industry in general. Copyright lawyer Nandita Saikia observes that once a publisher effectively loses control over an edition of a book — if competing editions are allowed into the market — “This would significantly diminish the ability of publishers to invest in Indian authors and Indian writing.” From Abraham at Hachette to Chiki Sarkar at Random House to Tata McGraw Hill, there seems to be consensus on this aspect of the amendment.&lt;/p&gt;
&lt;blockquote class="webkit-indent-blockquote"&gt;
&lt;p&gt;In contrast, Pranesh Prakash of the Centre for Internet and Society argues strongly in favour of 2(m) and dismantling the “licence raj” that requires booksellers and distributors to have authorisation to import books: “Allowing people to import goods without permissions (with appropriate duties) is taken for granted in all other areas, so why not copyrighted works? After all, it is not the act of publication that gets affected, but the right of exclusive distribution.”&lt;/p&gt;
&lt;/blockquote&gt;
&lt;p&gt;But many authors point out that publishing and bookselling operate differently from other industries, and the dynamics of writing and bookselling are not comparable. Author Amit Varma puts forward the writer’s objections: “As the author of a book, I should have the right to assign the rights to sell my book to any publisher in India that I feel like, and the law should protect that right, and my contract with the publisher. Parallel import obviously makes a mockery of that right, and can deny me significant potential royalties.”&lt;/p&gt;
&lt;h3&gt;Publishers&lt;/h3&gt;
&lt;p&gt;At Penguin India, Andrew Phillips is blunt: “We stand firmly against the amendment. Penguin is both a ‘foreign’ publisher and an Indian publisher and we believe it will affect both parts of our business. We don’t believe the effects will be minor — to the contrary, this would have a fundamental impact on the publishing business both for international authors and Indian authors who aspire to be read outside India.”&lt;/p&gt;
&lt;p&gt;The publishers’ arguments are complex, but stripped of the technicalities, they rest on the question of territoriality. When publishing worldwide operates on the basis of territorial agreements — authors sell rights to their works for specific regions — opening up the market unilaterally makes little sense. India might open its market, via 2(m), to competing imports and editions; but Indian publishers don’t have the right to sell similar editions of books in the UK or US markets.&lt;/p&gt;
&lt;p&gt;In other words, the market would open up only in one direction — and this could diminish Indian publishers’ ability to nurture new writing, release Indian editions of foreign authors, and pay authors significant royalties.&lt;/p&gt;
&lt;p&gt;Behind the rhetoric, nothing about this proposed change in copyright laws is simple, and the repercussions for authors and publishers are likely to be both significant and adverse. There’s an interesting parallel in the Australian market, which, like the Indian publishing industry, is thriving but relatively young, and lacks the clout of the formidable US, UK and European markets.&lt;/p&gt;
&lt;p&gt;Two years ago, when the move to allow parallel imports of books was discussed in Australia, that discussion was fierce, impassioned and hotly contested. Nor was it limited to the industry; when readers realised that the debate was really over what they would get to read, which authors would benefit or lose out, and how this would impact their intellectual lives, the debate went public.&lt;/p&gt;
&lt;p&gt;In the case of Australia, it took a full year of discussion before it was finally decided not to introduce parallel imports for the publishing industry. Whatever the possible adverse effects — or benefits — of parallel imports, we haven’t had that discussion yet in India. It’s a necessary one, and it affects anybody equipped with a mind, a wallet and the ability to walk into a bookstore. This would be a good time to have it, before the law is set in stone.&lt;/p&gt;
