Cyber Security Policy Research

Tim Maurer will give a presentation on cybersecurity policy research at the Centre for Internet & Society's New Delhi office on October 18, 2015, from 2 p.m. to 5 p.m. Geetha Hariharan and Sunil Abraham will participate in this event.

Tim Maurer's talk will give an outline of the definitional issues involved, the various threats to the confidentiality, integrity, and availability of information and underlying infrastructure, the actors involved and international efforts to address cybersecurity. The talk will also provide an overview of existing and ongoing cyber security policy research.

Tim Maurer

Tim Maurer is an associate at the Carnegie Endowment for International Peace. His work focuses on cyberspace and international affairs, with a concentration on global cybersecurity norms, human rights online, Internet governance, and their interlinkages. He is writing a book on cybersecurity and proxy actors.

Maurer serves as a member of the Research Advisory Network of the Global Commission on Internet Governance, the Freedom Online Coalition’s cybersecurity working group “An Internet Free and Secure,” and co-chaired the Civil Society Advisory Board of the Global Conference on CyberSpace. In 2014, he developed the Global Cyber Definitions Database for the chair of the OSCE to support the implementation of the OSCE’s cyber confidence-building measures. In 2013 and 2014, Maurer spoke about cybersecurity at the United Nations in New York and Geneva and co-authored “Tipping the Scale: An Analysis of Global Swing States in the Internet Governance Debate,” published by the Global Commission on Internet Governance. His work has also been published by Jane’s Intelligence Review, TIME, Foreign Policy, CNN, Slate, and other academic and media venues.

Prior to joining Carnegie, Maurer was the director of the Global Cybersecurity Norms and Resilience Project at New America and head of research of New America’s Cybersecurity Initiative. He also gained experience with the United Nations in Rwanda, Geneva, and New York focusing on humanitarian assistance and the coordination of the UN system.

Communication Rights in the Age of Digital Technology

The Centre for Internet & Society (CIS) invites you to a conference to discuss the evolution of privacy and surveillance in India on Friday, October 30, 2015 at Deck Suite Hall, 5th Floor, Habitat Centre, Lodhi Road, Near Air Force Bal Bharti School, New Delhi - 110003, from 11 a.m. to 5 p.m.

The conference will be conducted in a round-table format. Topics to be discussed shall include, among others, the Human DNA Profiling Bill, 2012, the PIL questioning the data collection under the UID scheme, the draft National Encryption Policy and the Supreme Court judgement in Shreya Singhal v. Union of India, in the context of privacy and surveillance in India. The conference will be a forum for discussion, knowledge exchange and agenda building.

Background Note

In India, the Right to Privacy has been interpreted to mean an individuals’ right to be left alone. In the age of massive use of Information and Communications Technology, it has become imperative to have this right protected. The Supreme Court has held in a number of its decisions that the right to privacy is implicit in the fundamental right to life and personal liberty under Article 21 of the Indian Constitution, though Part III does not explicitly mention this right. Since the 1960s, the Apex Court has been dealing with this issue, primarily with respect to privacy being recognised as a fundamental or common law right and the standards that need to be satisfied in order to impose any restrictions on it.

In the year 2012, the Planning Commission constituted a Group of Experts under the chairmanship of Justice AP Shah, Former Chief Justice of the Delhi High Court to recommend a potential privacy framework for privacy in India. Previously in 2011 the Department of Personnel and Training had prepared a draft Bill on Right to Privacy which has yet to materialize into a comprehensive legislation on privacy. In 2014, a version of the revised Right to Privacy Bill was leaked. Amendments to the Bill aim to protect individuals against misuse of their data by the government or private agencies, and is in the process of being finalized by the Indian Government .

Of late, privacy concerns have gained importance in India due to the initiation of national programmes like the UID Scheme, DNA Profiling, the National Encryption Policy, etc. attracting criticism for their impact on the right to privacy. For example, DeitY introduced a draft National Encryption Policy in September this year to prescribe methods for encryption. However, the policy would have posed significant restriction on the ability of citizens to encrypt online communication. Backlash from the citizens, industry, social media and privacy experts led the Government to withdraw the policy as the measures included made the information system vulnerable in every sense.

Earlier this year, the Apex Court gave a historical judgement by striking down section 66A of the IT (Amendment) Act 2008. The Court upheld section 69A and the Information Technology (Procedure & Safeguards for Blocking for Access of Information by Public) Rules 2009 to be constitutionally valid, which accords the government with the authority to block transmission of information and websites when it deems it as necessary for reasons like sovereignty and integrity of India, public order, etc.

Another government initiative which has generated considerable controversy for its threat to privacy is the UID project which aims to issue a unique identification number to all citizens by the Unique Identification Authority of India, which can be authenticated and verified online. In August this year, the Supreme Court, vide an interim order, restricted the use of Aadhaar by declaring it to be optional for availing government benefits and services. Though the Government contended the right to privacy as a fundamental right in India, the Court deferred this issue to a larger Constitutional Bench, and the Supreme Court upheld its decision yet again in the month of October.

Similarly, the d raft Human DNA P rofiling B ill 2015 is being questioned on grounds of privacy invasion on a massive scale as it aims to collect and store the DNA samples of criminals, suspects, volunteers, and victims and regulate DNA laboratories and DNA sampling for use by law enforcement agencies. The Bill also fails to include comprehensive privacy safeguards and provisions regarding collection of DNA samples with or without the consent of an individual, making individual privacy an important concern.

Going by these ongoing debates, one can say that Privacy as a right has primarily evolved by way of judicial interpretation and continues to evolve in light of several controversial Government policies, projects and schemes. However its development is often undermined by tension between several competing national interests which calls for clear guidelines to protect this inviolable right of the citizens.

On September 19, 2015, celebrated globally as Software Freedom Day, a number of enthusiasts got together and collectively took a pledge.

We, who have gathered together for Software Freedom Day 2015, believe that software freedom is both a matter of ethical principle as well as a matter of pragmatism, and is necessary for a democratic, open society.

We believe that it is desirable that all people, but especially governments, use, contribute to, and spread open standards, free/libre/open source software, open APIs, openly-licensed content (including open data, open access, and open education resources), leading to a vibrant public domain, and ensure that all of the above are accessible for all, including persons with disabilities and other marginalised sections of society.

Given that, we pledge to:

use and spread free software amongst our family, friends, and neighbours, both in person and virtually.
demand that services we use in turn use open standards and open APIs, and thus be available for all using free/libre/open source software, without the payment of any royalties.
raise the issue of software freedom with our democratic representatives, to seek that they in turn respect and promote these principles.
as far as possible, making our own work openly available, and seek to convince our employers, publishers, producers, and other persons who might be in a position to restrict
work against any laws, policies — corporate or governmental — or technical restrictions that seek to prevent people from full exercise of their rights, and which are contrary to the above principles.

The Centre for Internet & Society (CIS) will host the Bangalore Chapter Meeting of Data Security Council of India (DSCI) on September 26, 2015 at its Bangalore office in Domlur. The event will be held from 2.30 p.m. to 5.30 p.m.

The first speaker will be Melissa Hathaway, Commissioner, Global Commission for Internet Governance. She is an internationally distinguished cyber security expert and has worked as cyber security adviser in two US Presidential Administrations, and is the former acting Senior Director for cyberspace at the National Security Council in the US. The topic she will be speaking on is "Connected Choices".

The second speaker will be Sunil Abraham, Executive Director, CIS (Center for internet & Society). Sunil is a renowned thought leader when it comes to internet governance, cyber space & its interface with civil society and actively contributes to DSCI and other forums. He will be presenting on "Anonymity in Cyberspace" - the SIG that he led over last 8 months along with a diverse group of members from the industry in Bangalore.

Edit-a-thon to improve Kannada-language science-related Wikipedia articles

A three-day Kannada Wikipedia edit-a-thon was conducted for science lecturers of institutions who gathered at the District Institute of Education and Training (DIET), Bengaluru this August 18. The idea of this event was to improve science-related articles that are part of the Government of Karnataka's high school syllabus.

During the span of three days the lecturers were taught about basics of Kannada Wikipedia, editing policies, Kannada input, creating and editing articles on Kannada Wikipedia, and they all participated in contributing to about 20 articles science-related article based on topics listed in the high school syllabus (as per the Karnataka state syllabus). Some of the lecturers who were first-timers faced problems with Kannada typing where most others took some time to understand the Wikipedia markup and citations. As this was the first iteration of the project, two more edit-a-thons will follow; one in November 2015 and another one in February 2016. We invite all Kannada Wikimedians to join and mentor these new Wikimedians.

Wikipedia Workshop in the Theme of "Sau Dhuni Teen" in Pune University

To celebrate this long time of the editor community's tireless effort to make it to the largest Odia-language online encyclopedia an event is being organised in Odisha' capital Bhubaneswar. Over 20 Wikipedians from various corners of India are participating for a public gathering that is planned on June 3 at the Institute of Physics at 5 pm. Freedom of Expression in a Digital Age: Effective Research, Policy Formation & the Development of Regulatory Frameworks in South Asia

The discussion will highlight the challenges in promoting and strengthening online freedom of expression and evaluating the application of existing regulatory frameworks in South Asia. Click to view the invite.

International Frameworks and Freedom of Expression

Freedom of expression-an important fundamental right in itself, is also critical for defending and upholding other freedoms and rights. We exercise this right in our day-to-day lives, through the exchange of ideas, opinions and information. Understanding the means and structures of communication, and the regulation of environments that facilitate such exchange therefore become crucial for those seeking to realize freedom of expression.

Freedom of expression is enshrined in Article 19 of both theUniversal Declaration of Human Rights (UDHR) and the International Covenant on Civil and Political Rights (ICCPR). The UDHR holds that " everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers" . The ICCPR holds that, " everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice".

Freedom of expression has also been enshrined in regional conventions and charters, for example the European Convention for the Protection of Human Rights and Fundamental Freedoms, the American Convention on Human Rights4, and the African Charter on Human and Peoples' Rights ("Banjul Charter") .

The former UN Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression, Frank La Rue, highlighted in his 2013 report report that these frameworks are applicable to actions that take place online.6 While there may be no disagreements on freedom of expression as a legal right, it is important to bear in mind that it is not a non-derogable right, and may therefore be limited subject to safeguards indicated, for example, in Article 19(3) of the ICCPR.

While there may be limitations are placed on the exercise of freedom of expression, there is limited clarity on when and how freedom of expression can be legitimately circumscribed. There have been attempts by civil society groups to articulate more clearly the specific conditions when freedom of expression may be derogated, most notably the Siracusa Principles on the Limitation and Derogation Provisions in the International Covenant on Civil and Political Rights ("Siracusa Principles" ), and the Johannesburg Principles on National Security, Freedom of Expression and Access to Information ("Johannesburg Principles").

Freedom of Expression and Communications

Over the years, the norms and standards required for freedom of expression in the traditional media world have received much attention. When regulating communication, some restrictions upon freedom of expression have been regarded necessary and are enforceable by national or international courts. Such restrictions have been defined in international human rights laws and cover issues such as defamation, incitement to violence and hate speech. While these restrictions are not affected by the introduction of new means of communication, the proliferation of digital communications does warrant the recognition that there are new forms of censorship, unsettled questions of jurisdiction, and the need to develop new norms and standards that can keep pace with the myriad forms of expression and information sharing.

Communication in the digital age has led to the evolution of the Internet as a medium that has revolutionised largely local capacity for communication into a worldwide phenomenon that encompasses everything from personal one-to-one emails, social networks and reaching out to large audiences globally. The proliferation of digital technologies has not only fostered unprecedented access to information; the very environment stands transformed by the introduction of new kinds of information from voice, sound, image, text and code, that are accessible on a range of devices and across several types of technologies.

These networks and services democratized communication by lowering barriers to access and creating new space for publishing and peer-to-peer collaboration. Bypassing traditional gatekeepers of other forms of media, users can take on the role of writers, broadcasters or publishers on the Internet thus creating limitless possibilities for producing, sharing and exchanging all kinds of content. From this view, the Internet has sprung up as a globally accessible means of communication that is free from traditional restraints on free speech and expression. However, there are other unintended consequences that the Internet has had on both forms of power and control in the regulation of content, as online content has become increasingly contested, enclosed in a nationalized sphere challenging the free flow of information and freedom of expression.

Freedom of Expression in South Asia

As a network of networks, the internet has no overarching jurisdiction and with no single entity governing the totality of the internet, there exists a jurisdictional vacuum over content on the web. Further, there are no means of regulating content internationally or even a broad consensus on the norms that should be applied for restricting freedom of expression either on traditional or modern media. This has led to adverse consequences such as states adopting arbitrary actions and standards or companies exercising private censorship with content online.

South Asia has an important role in global development, with its share of the world's largest working-age population, a quarter of the world's middle-class consumers, the largest number of poor and undernourished in the world, and several fragile states of global geopolitical importance. With inclusive growth, South Asia has the potential to change the global order and communications and technology continue to play a critical role in realising the region's potential. Unfortunately, the history of colonial rule, authoritarian governments and a turbulent geo-political landscape have resulted in a tendency to over-regulate speech. Governments have construed the advent of the Internet as a challenge to their authority and their anxiousness to restrict use of the medium by citizens has resulted in often regressive and sometimes draconian laws such as Myanmar's Electronic Transactions Law, India's IT Act and Pakistan's Prevention of Electronic Crimes Act.

As the Internet expands and provides greater access, it also places censorship and surveillance capacities in the hands of states and corporations. It is therefore crucial that there exist strong protections of the right to freedom of expression that balance state powers and citizen rights. While the Internet has thrown up its own set of challenges such as hate speech, the verbal online abuse of women and the use of the Internet to spread rumours of violence, the regulation of content is a question that is far from being settled and needs our urgent attention. What role can and should the law play? When is it justified for the government to intervene? What can be expected from intermediaries, such as social networks and ISPs? And what can users do to protect the right to free speech - their own and that of others?

Balancing freedom of expression with other rights is further complicated by the challenges of fast paced and changing regulatory environment. By highlighting these challenges and questioning the application of existing frameworks we aim to contribute to further promoting and strengthening the right to freedom of expression, in India and beyond.

Introduction to panel and conference:

This is the context in which the Centre for Internet and Society, the Observer Research Foundation, the University of Pennsylvania's Internet Policy Observatory, and the Programme for Comparative Media Law and Policy at Oxford University are coming together to organise an event under the title 'Freedom of Expression in a Digital Age'. About the Organisers

The Center for Global Communication Studies at the Annenberg School for Communication at the University of Pennsylvania-has created the Internet Policy Observatory (IPO) to research the dynamic technological and political contexts in which these Internet governance debates take place. The IPO serves as a platform for informing relevant communities of activists, academics, and policy makers, and for displaying collected data and analysis. The Observatory encourages and sponsors research and studies ongoing events, key decisions and proposals, on Internet policy. The IPO seeks to deepen understanding of the evolution of mechanisms and processes that affect domestic Internet policies in key jurisdictions and the legal, political, economic, international and social factors that influence the implementation, or non-implementation, of such policies.The IPO also seeks to understand the relationship between national efforts and international policy formations and the role of civil society in domestic Internet policy processes and control.

NASA International Open Data Challenge 2015

As part of the initial NASA Open Government 2.0 plan, the NASA International Open Data challenge brings together the FOSS community, citizen scientists, open data practitioners , open hardware enthusiasts and students for collaborative problem solving with the goal of producing relevant open-source solutions to address global needs applicable to both life on Earth and life in Space.

On April 11 and 12, 2015 2015, the event will be organized by the Centre for Internet and Society in collaboration with mentors from Team Indus, one of India's leading Space Technology Start-Ups. Amar is credited as being the youngest and first Indian amateur astronomer to have an Asteroid named after him in 2014 at the age of 29. (380607 Sharma) He will talk about CCD Astro Imaging and his travails and journey as a self-made astronomer and comet hunter.

We will then break off into teams to commence the hackathon that will end on Sunday,April 12, 2015 at 6pm, after which teams will upload and present their solutions for Local and Global Nominations.

David Heyman, former Assistant Secretary for Policy at the U.S. Department of Homeland Security and retired Software Engineer Reimagining and Transforming Cities, Governments, and Lives with the Internet of Things For the first time in human history more people live in cities than anywhere else.

By 2050 three-fourths of the world’s population will live in cities. As more and more people move to cities, more of the world’s challenges, from emerging infectious diseases, crime, economic growth, and environmental degradation, will be concentrated in cities. Citizens will expect and demand more from their leaders; and governments will face greater pressure to provide services better, faster, cheaper to more and more, potentially with less and less resources.

More than any other force driving change over the horizon, the Internet of Things (IoT) holds the potential to connect and infuse devices, business assets, infrastructures, and other elements of a city with greater intelligence and efficiencies to drive a new era of innovation and performance. And yet, this potential is juxtaposed against a backdrop of an explosion in cybercrimes and threats facilitated by the increased linkages between the physical and cyber world that is at the heart of IoT, and which affords malicious actors anywhere in the world the potential to disrupt services and lives on a far more consequential level than ever before.

In his remarks, David Heyman, former Assistant Secretary for Policy at the U.S. Department of Homeland Security, and retired software engineer, will discuss the extraordinary potential of the IoT, the barriers to adoption, and how governments and businesses can navigate this new frontier, work together, and re-imagine and transform cities—and nations—for tomorrow.

David F. Heyman

David F. Heyman has over two decades of experience as a leader in spurring innovation, risk management, and strategy development in the public and private sector. He is a leading expert in national security and international affairs, counterterrorism, cybersecurity, building resilience, and critical infrastructure protection, with broad experience in the U.S., Europe, Middle East and Asia. Heyman’s career includes service at the highest levels of the U.S. government, working in senior positions at the White House, the U.S. Department of Energy, the U.S. Department of Homeland Security, as well as in the private sector.

Most recently, Heyman concluded five years of service as Assistant Secretary of Policy (operating as an Under Secretary equivalent) at the U.S. Department of Homeland Security (DHS). As a member of the senior management team at DHS, Heyman was responsible for the Department’s strategic planning, risk and decision analysis, policy development, and thought leadership across all five departmental mission areas: counterterrorism, border security, immigration,
cybersecurity, and building resilience to disasters. During his tenure, Heyman helped transform the Department from a budget-driven to a strategydriven organization, and instituted an enterprise risk-management architecture for managing the Department’s $60 billion budget. He oversaw and initiated the Department’s largest expansion in global engagement, and in this role, led efforts to build new strategic partnerships with the World Customs Organization, the World Economic Forum, and some of the most consequential and complicated geopolitical relationships facing the United Stated today, including China, India, the European Union, and others. Heyman designed and launched multiple domestic, bilateral, and global initiatives to bolster U.S. security and prosperity. He was the chief architect of the nation’s first National Strategy for Homeland Security—the Quadrennial Homeland Security Review—which elevated and established cyber security and building national resilience as core homeland security missions. He led efforts around five Presidential Initiatives
to: empower communities to counter violent extremism; strengthen global supply chain security; expand travel and tourism to the United States; streamline and modernize the U.S. import and export system; and develop and implement a new perimeter approach to North American Security which resulted in the Beyond the Border Initiative signed by President Obama and Canadian Prime Minister Carper.

He led the creation of the Resilient STARTM program and the Rick Rescorla National Award for Resilience, and is wellknown for drafting the policy to eliminate the color-code Homeland Security Advisory System and replace it with a more disciplined National Terrorism Advisory System, now used by the U.S. government. Previously, Heyman founded and directed the Homeland Security Program at the Center for Strategic and International Studies (CSIS), one of the nation’s leading and most influential think tanks in international security and taught security studies and science and technology policy as an adjunct professor at Georgetown University. Heyman also served as a senior advisor to Energy Secretary Bill Richardson and oversaw development and implementation of a number of energy, infrastructure and technology initiatives, including leading and establishing a new portfolio approach to manage DOE’s $7 billion in research and development (R&D) investments.

Earlier in his career, Heyman was a senior policy advisor in national security and international affairs at the White House Office of Science and Technology Policy (OSTP), and was responsible for providing science, technology, and foreign policy advice to the President’s Science Advisor and the Vice President’s National Security Advisor. Before entering government, Heyman worked for nearly a decade as a computer systems software engineer, and head of international operations for a firm developing and deploying industrial automation, robotics, and supply-chain management systems for Fortune 100 companies. Heyman holds a Bachelor’s degree in biology from Brandeis University and a Master’s in international relations and economics from the Paul H. Nitze School of Advanced International Studies at Johns Hopkins University, where he graduated with the highest level of distinction. He is currently a member of the Aspen Homeland Security Strategy Group, Aspen’s U.S.-India Strategic Dialogue, and serves as co-chair of its Cyber Task Force.

RAW Lectures #01: Nishant Shah on 'Stories and Histories of Internet in India'

Dr. Nishant Shah will give a talk on 'Stories and Histories of Internet in India' at the Centre for Internet and Society's office in Bangalore on March 6, 2015 at 6 p.m. Please join us for tea and coffee before the lecture at 5.30 p.m.

Introducing the first research initiative at the Researchers at Work programme in the Centre for Internet and Society, Professor Nishant Shah wrote:

“Although many disciplines, organisations and interventions in various areas deal with internet technologies, there has been very little work in documenting the polymorphous growth of internet technologies and their relationship with society in India... We wanted to first propose that the Internet is not a monolithic object that exists in the same way across geographies and social borders. It is necessary to approach the Internets, as plural, available in different forms, practices and experiences to people from different locations and sections of the society... The second proposal was that while the digital and Internet technologies are new, they do not necessarily only produce new things. There is a need to map the histories and pre-histories of Internets.”

The Researchers at Work programme is initiating the RAW Lectures series to take stock, reflect, and chart courses into the studies of Internet in/from India. The lectures will address the experiences and practices of Internet in India as plural and intertwined with longer-duration processes, as foregrounded by Nishant above. The lectures will also critically respond to the questions around the methods of studying Internet in/from India, and the opportunities and challenges of studying Indian society on/through the Internet.

It gives us immense pleasure to invite Nishant to present the first lecture of the series on Friday, March 06, 2015. The title of the lecture is "Once There was the Internet: Of Stories and Histories of Internet in India."

Dr. Nishant Shah

Nishant is the Professor of Culture and Aesthetics of New Media at the Leuphana University Lüneburg, Research Associate at COMMON MEDIA LAB, Affiliate at DIGITAL CULTURES RESEARCH LAB, and International Tandempartner at HYBRID PUBLISHING LAB. He is the co-founder and former-Director-Research at the Centre for Internet and Society, Bangalore, India.

In his varied roles, he has been committed to producing infrastructure, frameworks and collaborations in the global south to understand and analyse the ways in which emergence and growth of digital technologies have shaped the contemporary social, political and cultural milieu. He edited a series of monographs on “Histories of Internet(s) in India” that looks at the complicated relationship that technologies have with questions of gender, sexuality, body, city, governance, archiving and gaming in a country like India. He was also the principal researcher for a research programme that produced the four-volume anthology “Digital AlterNatives With a Cause?” that examines the ways in which young people’s relationship with digital technologies produces changes in their immediate environments.

His Ph.D. thesis titled “The Technosocial Subject: Cities, Cyborgs and Cyberspace” builds a framework to examine the technosocial identities that are produced at the intersection of law, digital technologies and everyday cultural practices in emerging information societies like India. Nishant was an Asia Research fellow looking at the cost and infrastructure of building IT Cities like Shanghai. He is the author of a recent thought-piece titled “Whose Change is it Anyway? – Towards a future of digital technologies and citizen action in emerging information societies” that seeks to revisit the debates around digital activism and change in the global context. His current interests are in critically intervening in debates around Digital Humanities and conditions of change mediated by technologies.

The Centre for Internet and Society's Access to Knowledge team (CIS-A2K) welcomes you to attend the "Train the Trainer Program" in Bangalore.

Train the Trainer (TTT) is a residential training workshop to groom leadership skills among the Indian Wikimedia community members. CIS-A2K is organizing the Wikipedia Train the Trainer Program 2015 (TTT 2015). This is the second iteration of this program. TTT 2015 will be conducted by CIS-A2K during 26 February to 1 March 2015 in Bangalore, India.

Note: All selected participants will be expected to reach the event venue the previous night (i.e. February 25) and leave by the evening of March 1, 2015. The selected participants are requested to kindly confirm their participation by writing to tanveercis-india.org. Registration for TTT 2015 is closed. Please do not register..
