Public Debate on 'Differential Pricing': Series 1

The Centre for Internet and Society, in association with ICRIER and the Department of Civics and Politics, University of Mumbai, is pleased to announce “A Series of Public Debates on Differential Pricing” in the cities of Bangalore, Mumbai and New Delhi. The first public debate will be held at the Centre for Internet & Society office in Bangalore on February 1, 2016.

In light of the recent consultation paper released by the Telecom Regulatory Authority of India (TRAI), the objective of these debates will be to deconstruct the issue of differential pricing through a discussion on the variety of views this subject has attracted. Speakers will also discuss possible implications of differential pricing policy on questions of access, diversity, competition and entrepreneurship.

Each debate will comprise three rounds. In the first round, speakers will present the body of their arguments over 10 minutes each. The second round will be a rebuttal round, with each speaker being given 5 minutes. The third and final round will see the floor being opened to the audience who will engage the speakers with comments and questions.

Production Sprint — A Public Exhibition at CIS

What does 'Making Change' mean to you? What are the processes of change? The infrastructure of change? The actors of change? A round-table discussion and exhibition by 23 change makers from 15 countries in Asia, at the Centre for Internet & Society, Saturday, 7th June, 5 - 7 p.m. Please do come.

The Making Change project questions traditional understandings of change –where change is employed in the name of power, reduced to a ‘spectacle’ by global media and goes largely unquestioned in the public discourse- and aims to build more adequate frameworks to address the idea of change in the context of common knowledge, networked media and information societies.

Making Change is hosting focused, intensive, and production-oriented workshops called Production Sprints to facilitate the convergence of actors and ideas.These will be spaces of knowledge exchange between change-makers around processes, narratives and experiences of change and of experimentation with multi-modal forms and formats of knowledge production (text, image, sound, etc). Participants will be asked to group around four topics: concepts, crises ecologies and networks of change. These visions and practices, we hope will produce new ways of thinking about change.

During the Bangalore production sprint, we will document the various knowledges acquired through the pre-production stage and the 5 day intensive sessions on formats, storytelling and visual presentation modes; and we will close with an exhibition of the resulting narratives of change. We invite you to come and participate in the exhibition.

The Speakers

Jacob Kohnstamm	Before his appointment as Chairman of the Dutch Data Protection Authority in 2004, Jacob Kohnstamm was active in Dutch politics as member of the Lower House of the Dutch Parliament, as State Secretary for Internal Affairs and as member of the Senate of the Dutch Parliament (between 1981 and 2004). Before that, he worked as a lawyer in Amsterdam. Since February 2010, Jacob Kohnstamm is Chairman of the Art. 29 Working Party of European Data Protection Authorities. Since November 2011, Jacob Kohnstamm is also Chairman of the Executive Committee of the International Conference of Data Protection and Privacy Commissioners.
Chantal Bernier	Chantal Bernier was appointed Assistant Privacy Commissioner of Canada in December 2008. Ms. Bernier started her career in the federal government as a lawyer in the Department of Justice, Canada. She went on to hold a directorship at the Privy Council Office before being appointed Assistant Deputy Minister at Indian and Northern Affairs Canada, and later on at Public Safety Canada. She holds a Bachelor of Civil Law from the University of Sherbrooke and a Masters in Public International Law from the London School of Economics and Political Science.
Christopher Graham	Christopher Graham became UK Information Commissioner in June 2009, with responsibility for overseeing the Freedom of Information Act and Data Protection Act regimes — upholding information rights in the public interest, promoting openness by public bodies and data privacy for individuals. He is the Vice Chair of the Article 29 Working Party of the European Data Protection Authorities. Christopher was the director general of the Advertising Standards Authority (ASA) from April 2000 to June 2009. From 2003-5, he was chairman of the European Advertising Standards Alliance (EASA), the federation of advertising self-regulatory bodies across the EU Single Market. Prior to joining the ASA, Christopher was for three years Secretary of the BBC. Christopher first joined the broadcaster as a news trainee in 1973. He was a Current Affairs Producer for BBC Radio and TV before becoming Managing Editor of News Programmes for TV and Radio.

17.15 18.15	Session on "new tools" to protect privacy and personal data. A case-study on (European) approach to privacy impact assessment This session will provide an overview to the main findings of the projects carried out by VUB-LSTS (predominantly) with regard to privacy impact assessments (PIA), starting with the EU co-funded PIAF (“A Privacy Impact Assessment Framework for data protection and privacy rights”; 2011-2012), which reviewed existing PIA frameworks worldwide, surveyed opinions of national data protection authorities (DPAs) on an optimal PIA policy and, finally, provided a set of recommendations for PIA policy-makers and practitioners. This session will be concluded by proposing adaptation of the so-called environmental democracy to the needs and reality of privacy. The points in this session will be contrasted with the experience of India.
18.15 18.45	Session on co-operation of data protection authorities "Improving Practical and Helpful cooperation between Data Protection Authorities", 2013-15. This session will provide a preliminary analysis of the (legal) factors that pose as obstacles to and/or encourage co-operation between DPAs worldwide in enforcing privacy and data protection laws. Such an analysis aims at creating a 'wish-list', i.e. at identifying what measures could be taken to reduce barriers and to further foster co-operation. This session will be concluded by discussing what DPAs' can learn about co-operation from European and international competition law. The points in this session will be contrasted with the experience of India.

The Speakers

Gertjan Boulet

Gertjan Boulet holds a joint LL.M/MPhil (2010) from Leuven University (Belgium) and Tilburg University (the Netherlands) where he successfully completed a Research Master of Laws programme focused on legal methods and interdisciplinary research. He started to work as a doctoral researcher at the Research Group on Law, Science, Technology and Society (LSTS) at the Vrije Universiteit Brussel in January 2013 for the EU-funded research project 'Improving Practical and Helpful cooperAtion bEtween Data PRotection Authorities' (PHAEDRA). Before, he was a freelance researcher at VUB, and became a member of the programming committee of the annual conference 'Computers, Privacy & Data Protection' (CPDP). Prior to joining the Vrije Universiteit Brussel, Gertjan worked for the Brussels Airport Company (2010) and the law firm DLA Piper (2011). He also completed internships at the Belgian Public Prosecutor (2007), the Constitutional Court of Belgium (2012) and the Belgian Privacy Commission (2013).

Dariusz Kloza

Dariusz (Darek) Kloza is a doctoral researcher at the Research Group on Law, Science, Technology, and Society (LSTS) and the Institute for European Studies (IES) at Vrije Universiteit Brussel (VUB). He holds both an LL.M. in Law and Technology (2010) from the Tilburg Institute for Law, Technology, and Society (TILT) at Tilburg University (with distinction) and a master degree in law from University of Białystok (2008). He was also an exchange student at University of Copenhagen (2007-2008). His research is focused on fundamental rights in the digital era (especially privacy and data protection), liability of intermediary service providers and private international law. His doctoral research focuses on positive procedural obligations for privacy and data protection from the European perspective.

He has been involved in researching privacy and data protection issues in a number of EU co-funded projects, such as PIAF (Privacy Impact Assessment Framework for data protection and privacy rights), PHAEDRA (Improving Practical and Helpful cooperAtion bEtween Data PRotection Authorities) and ADVISE (Advanced Video Surveillance archives search Engine for security applications). He has also contributed to the work of the European Commission’s Task Force for Smart Grids, aimed at ensuring high level of privacy and personal data protection in smart grids/metering.

Privacy and Surveillance Roundtable

Background and Context to the Roundtables

In India, lawful interception of communications may be conducted by the state in three ways: firstly, intercepting telephone calls and other telecommunications may take place under powers listed in the Telegraph Act, 1885 and procedure set out in the Telegraph Rules, 1951; secondly, intercepting written communications transmitted through the postal service or by private couriers may occur under the Post Office Act, 1898; and, thirdly, intercepting, de-crypting, and monitoring email messages and other electronic communications may take place under the Information Technology Act, 1950 and two sets of Rules issued in 2008.

The government’s intention to create a Central Monitoring System to automate the existing process of telephone tapping is significant for a number of reasons. It will bypass private telephone service providers; currently the active cooperation of TSPs is required and compelled in order to intercept and monitor a telephone conversation. This creates an extra layer of compliance activity for TSPs which is cumbersome and expensive. Interception orders from the state often do not comply with the procedure required by law. This uncertainty is compounded by the lack of an indemnity for TSPs.

However, while the CMS will release TSPs from legal liability, it will leave the government free to conduct telephone interceptions in absolute secrecy and without a credible system of oversight and checks and balances. Amongst the world’s major democratic countries, India is alone in refusing to overhaul its telephone tapping regime. The legal requirements of probable cause, judicial sanction, and warrant-based interception – which are followed with exceptions in democracies around the world – are not adequately protected in India. The same principles also apply to the interception of postal and electronic communications.

There are several intelligence and police agencies in India that conduct interceptions of communications without central coordination. Previous cases in the Supreme Court of India and a few Indian High Courts reveal many cases of improper and even illegal surveillance. The sheer number of interested state agencies, the concerns of inadequate oversight, the lack of a credible legal regime, the constant leaks of private communications, and the poor legal protection given to TSPs and ISPs must be legally addressed.

Information about the Roundtables

The Privacy and Surveillance Roundtables are a CIS initiative, in partnership with the Cellular Operators Association of India (COAI). From June 2014 – November 2014, CIS and COAI will host seven Privacy and Surveillance Roundtable discussions across multiple cities in India. The Roundtables will be closed-door deliberations involving multiple stakeholders. Through the course of these discussions we aim to deliberate upon the current legal framework for surveillance in India, and discuss possible frameworks for surveillance in India. The provisions of the draft CIS Privacy Bill 2013, the International Principles on the Application of Human Rights to Communication Surveillance, and the Report of the Group of Experts on Privacy will be used as background material and entry points into the discussion. The recommendations and dialogue from each roundtable will be compiled and submitted to the Department of Personnel and training.

The Report of the Group of Experts on Privacy

In January 2012 Justice A.P. Shah formed a committee to create a report of recommendations for privacy legislation in India. The committee met seven times from January 2012 to September 2012. The Report is made up of six chapters and begins by reviewing the international best practices around privacy and the relevant Indian jurisprudence. The Report then recommends nine National Privacy Principles to be adopted by each sector in India. The Nine National Privacy Principles reflect international standards, as well as taking into consideration the Indian context. Along with the National Privacy Principles, the Report lays out a regulatory framework for privacy including privacy commissioners at the regional and national level, self regulating organizations at the industry level, and a system of complaints. Finally the report demonstrates how the National Privacy Principles could be used to harmonize existing legislation and practices.

The Draft CIS Citizens Privacy (Protection) Bill 2013

The Centre for Internet and Society has been researching privacy in India since 2010 with the objective of raising public awareness, completing in depth research, and driving a privacy legislation in India. As part of this work, the Centre for Internet and Society has drafted the Privacy (Protection) Bill 2013. The Citizens Privacy Protection Bill contains provisions that speak to data protection, interception, and surveillance. The Bill also establishes the powers and functions of the privacy commissioner, and lays out offenses and penalties for contravention of the Act. The Bill represents a citizens’ version of a privacy legislation, and will be shared with civil society, industry, and government. It is hoped that the review and revision of the Bill will be a participatory process, and thus comments and feedback to it’s’ provisions will be included as annex’s to the Bill.

The International Principles on the Application of Human Rights to Communication Surveillance

These principles were defined in 2013 in response to rapidly changing technologies and surveillance practices. The principles are the outcome of a global consultation with civil society groups, industry and international experts in communications surveillance law, policy and technology, spearheaded by the Electronic Frontier Foundation US and Privacy International UK. As technologies that facilitate State surveillance of communications advance, States are failing to ensure that laws and regulations related to communications surveillance adhere to international human rights and adequately protect the rights to privacy and freedom of expression. These principles attempt to explain how international human rights law applies in the current digital environment, particularly in light of the increase in and changes to communications surveillance technologies and techniques. These principles can provide civil society groups, industry, States and others with a framework to evaluate whether current or proposed surveillance laws and practices are consistent with human rights.

Poesis in the Information Age: Language and its Limit[ation]s

An examination of the limits/limitations of language(s) through the lens of contemporary Vietnamese poetics and print culture, aiming to open a deeper dialogue on the nature of self/state expression and censorship in the age of internet connectivity.

Alec Schachner

Alec graduated from Columbia College with a degree in Sociocultural Anthropology, English & Comparative Literature, Creative Writing and Music Theory/Composition. Alec currently resides in Vietnam, where he has served as lecturer on literature for 5 years with the Faculty of English Linguistics and Literature at the Vietnam National University of Social Sciences and Humanities HCMC. He is working on English translations of several anthologies of Vietnamese poetry, one of which - the purification festival in April - just went to print across VN earlier this month. He is also pursuing research into contemporary Saigonese print culture and the social/cyber mileus surrounding literary circles/movements in the post-Socialist cultural sphere.

Few recent developments in labour and employment have attracted as much attention as the expansion of platform economies. Spanning a range of services and industries, digital platforms have become a permanent fixture in upper-class urban consumption in India.

In this webinar, we will launch and present four research reports on digital labour in India, hosted at the Centre for Internet and Society. Together, they uncover aspects of labouring in three dominant industries of platform work: logistics, transportation, and domestic and care work. These works were supported separately by the Azim Premji University and Foundation, and the Feminist Internet Research Network (incubated by the Association for Progressive Communications).

Informed by deep ethnographic work, these reports unpack the contours of power, control and resistance that shape the experience and outcomes of working for digital platforms. The reports arrive at the ways in which platforms, as moving techno-social assemblages [1] distribute risk and reward in ways that implicate the livelihoods, agency, and bargaining power of actors across digital platforms’ value chains.

Each of these reports also contributes towards developing a southern understanding platform work. In contexts where there is an increasing reliance on technology providers for developmental outcomes and provision of public services, and informality is the dominant labour market structure, what does it mean to work on digital platforms? By situating the histories of informal work in India, and the intersectional identities constituting informality, these reports highlight how digital platforms can both reinforce and reorient the transaction of informal service work.

With restrictions on public mobility and the “hygiene theatre”[2]resulting from the outbreak of covid-19, digital labour platforms have sought to entrench their position in urban India as providers of ‘essential services’. As digital platforms gain centre-stage in India’s various marketplaces, it becomes all the more urgent to collectively reflect upon languages of strategic intervention that can enable a worker-first and southern imagination of digital platform work, and grassroots as well as policy thought around it.

We invite researchers, practitioners, activists and students from across disciplines to join us in this venture.

Simiran Lalvani (2019). Workers’ fictive kinship relations in Mumbai app-based food delivery.
This essay unpacks the kinship term bhai (brother) in order to understand the implications of such kinship sedimentations on food delivery work in Mumbai. Complicating the notion of an atomised worker, it details how having a fictive kinship ties with a bhai eases entry to platform work, upon joining ties guide negotiation with the discipline imposed by the employer and reflects on the experience of women workers. Sarah Zia (2019). Not knowing as pedagogy: Ride-hailing drivers in Delhi.
Ride-hailing platforms have “disrupted” public transport in India since their arrival but what hasn’t received enough attention is how these platforms create a deliberate regime of information invisibility and control to keep the drivers constantly on their toes which works to the companies’ advantage. This essay explores how the lack of transparency around algorithmic structures not only prohibits drivers from knowing completely and surely about their work (“why did I get this ride?”, “why did my ratings drop?”) but also how they build tactics of coping and earning from a place of unknowing. Anushree Gupta (2019). Ladies ‘Log’: Women’s Safety and Risk Transfer in Ridehailing.
Gig work produces new risks and safety concerns that require new mediations and negotiations. This post outlines the gendered cityscapes that drivers in the ride hailing sector navigate on an everyday basis. Building on insights from fieldwork in the ridehailing economy in Mumbai, the essay argues that drivers rely not only on their spatial knowledge of the city, but also on social knowledge that genders social exchange, predicates identities and draws boundaries. Analysing women’s presence as workers and passengers/customers, the author highlights the figure of the woman and the gendered forms of labour that underpin gig workers’ everyday realities. Noopur Raval (2019). Power Chronography of Food-Delivery Work.
This essay presents the observations around the design of temporality within app-based food-delivery platforms in India. It draws on semi-structured interviews by field-researcher Rajendra and his time spent “hanging out” with food-delivery workers who are also often referred to as “hunger saviors” and “partners” in the platform ecosystem in India. Simiran Lalvani (2021). Sexual contracts of app-based food delivery: An examination of social reproduction through feeding and being fed in Mumbai, India.
What happens to socially reproductive norms of feeding when apps seem to democratise work? How does this work mediate the tension between workers’, consumers’ choices and the prescription of dominant norms about feeding and being fed? This paper examines the socio-cultural burdens and risks that arise for workers and customers through 3 interrelated aspects – (i) household requirements of food delivery work, (ii) the definition, social meanings and anxieties associated with eating out and (iii) how platforms make anxiety inducing outside food popular, if not palatable. The Centre for Internet and Society (CIS) and the Say No to UID campaign invite you to a discussion on the UID and on the implications of the world's largest biometric data collection scheme in a post-Snowden era. The panel will take place on November 30th at the Institution of Agricultural Technologists in Bangalore.

Probably one of the most important things that we learnt following the Edward Snowden revelations is that our data has value. In fact, what we learnt is that our data has immense value...since it is clearly worth billions of dollars — to say the least.

However, not only does India lack privacy legislation which could safeguard our data from potential abuse, but it is also currently implementing some of the most controversial surveillance schemes in the world, in addition to the world's largest biometric data collection scheme. What's probably more alarming is that such schemes, such as the UID, lack legal backing, as well as public and parliamentary debate!

We aim to change that. As such, the Centre for Internet and Society (CIS) and the Say No to UID campaign jointly invite you to attend a panel which will discuss all of these crucial topics.

On Friday, April 19, 2013, at the Centre for Internet and Society, Marialaura Ghidini will give a talk about the creation and activities of or-bits.com, a web-based curatorial platform that she founded in 2009.

Or-bits.com is devoted to supporting and developing practices, critical dialogues and audience engagement around artistic production, display and distribution online. Through presenting online group exhibitions and critical writing on its blog, the development of offsite gallery projects, print publishing and workshops, or-bits.com aims to instigate an exploration of the phenomena related to the spread and simplification of web-based technology across disciplines. It aims to propagate a model of artistic work that uses and reflects on the web as a language and a medium of production, display and distribution of contemporary art, both online and offline.

Marialaura's talk will then open up to present some issues related to curatorial/artistic work online and its relationship with offline activities of production, display and distribution in order to trigger further discussion in the form of a Q&A session.

Marialaura Ghidni

Marialaura Ghidini is a curator, writer and researcher based in the UK. She is founder director of or-bits.com and an AHRC-funded PhD researcher with CRUMB at the University of Sunderland, where she explores the field of online curation with a specific interest in the theory and practice of artists and curators operating through web-based platforms and in-between online and offline dimensions.

She has been in India since January as an International Research Fellow at SARAI/CSDS in Delhi and now as a curatorial resident with T.A.J. Residency & SKE Projects in Bangalore.

Open Knowledge Day at Mysore

Mysore University along with the Centre for Internet and Society's Access to Knowledge (CIS-A2K) team invites you to an Open Knowledge Day at the University of Mysore on July 15, 2014.

We signed a memorandum of understanding (MoU) with the University of Mysore earlier this year in January to re-release the first six volumes of their Kannada encyclopaedia under Creative Commons (CC) license.

CIS-A2K facilitated extracting the legacy text from the soft-copies, converting them to Unicode, distributing the files among volunteers and Christ University interns and uploading them to Kannada Wikisource. So far about 1200 articles have been added. These articles will feed to articles in Kannada Wikipedia.

To commemorate this, the University of Mysore and CIS-A2K is organizing this event. This will also coincide with the Open Knowledge Festival happening at Berlin from July 15 to 17, 2014.

Open House on Security Practices in FinTech

CIS in collaboration with Has Geek is organizing an Open House on security practices in FinTech.

The prevalence of fintech companies operating in India is growing with new actors entering the sector and traditional actors such as banks beginning to offer digital financial services. The push to digital payments has been particularly strong after the demonetization policy, the development and implementation of Aadhaar and India Stack. Services offered by Fintech firms can range from offering a loan or credit to a digital wallet and digital banking and payment services.

Presently, there is a regulatory gap for many of the fintech services and business models. The Reserve Bank of India has published consultation papers on Peer-to-Peer lending platforms as well as Account Aggregators, but comprehensive regulations, especially those surrounding minimum security practices, have yet to emerge – presenting a critical policy and research window. Furthermore, under Section 43A of the IT Act and its associated Rules, ‘body corporates’ are required to implement reasonably security procedures compliant with ISO27001 or a sectoral standard approved by the Central Government. However, currently such a sectoral standard is absent for the FinTech and Digital Payments space.

The growing prevalence of these fintech technologies and the criticality of security of the same to engender citizen trust, protect rights, and comprehensive national security posture demands debate and discussion.

On November 17th, the HasGeek in collaboration with the Centre for Internet and Society will be holding an Open House from 6pm - 8pm to discuss security practices in the fintech industry.

Pressing questions for discussion include: How secure are these services? What security standards are they adhering to? Who is holding them accountable for adherence to security standards? What can individuals do if there financial data is compromised?
