ITAG Business Solutions is organizing its Fifth International IPR conference "GIPC 2013" at Hotel LaLit Ashok, Bangalore, India on the theme "IPR: The Powerhouse of Tomorrow". Snehashish Ghosh is participating in the event and will speak on Pervasive Technologies: Access to Knowledge in the Market Place.

Fifth Annual IP Teaching Workshop

The V Annual IP Teaching Workshop- 2016 was organised by the Centre for Innovation, Intellectual Property and Competition (CIIPC), at National Law University Delhi in association with National Academy of Law Teaching, NLU-D, on March 31 and April 1, 2016 in Delhi. Nehaa Chaudhari was a speaker.

Concept Note

The annual IP teaching workshops have previously been hosted in association with University of Washington School of Law, Seattle. In 2012, the first such workshop identified several broad challenges faced by teachers of intellectual property law in India. In 2013, the second IP teaching workshop focussed was on IP teaching techniques, use of information and communications technology in IP teaching, research and publication. The third workshop in 2014 discussed various issues initiating IP clinics in India. In 2015, the IV annual IP Teaching workshop focused on diverse issues involving curriculum development, student participation in IP activities, empirical research in IP, academic contributions to IP policy-making, and IP teaching beyond law schools. All workshops have had key speakers and resource persons from India and abroad.

By bringing together a select gathering of IP teachers and scholars from different corners of India, the 2016 workshop in its fifth edition aims to focus on developing a thematic research agenda on contemporary legal issues involving “IP interfaces”. The general approach to the study and teaching of intellectual property in India tends to look at intellectual property in isolation to other areas of law. However, many scholars and teachers of intellectual property have in the past and present eschewed such an approach since it fundamentally limits critical thinking and holistic appreciation of intellectual property law, both in theory and in practice. Recent scholarship has focussed on the overlapping nature of issues within intellectual property. However, teachers and scholars of intellectual property do regularly encounter deeper and intricate questions involving IP interfaces in terms of their symbiotic relationship shared by IP with other areas of law, both- domestic and international law.

IP interfaces looks into the complex web of legal relationships and contestations between intellectual property law in India and other areas of law viz., the law of property, constitutional law, law of contracts, tort law, criminal law, international trade law, international investment law, competition law, technology and regulatory laws. Briefly, these areas of law pose important challenges in the development of IP law, which often have specific legal consequences. Taking recourse to the study of interfaces shared by IP with other areas of law may help us in placing decisive legal limits or in advancing potential legal interpretations that may have teleological consequences for various stakeholders implicated by the IP system. These key areas of law identified above are only indicative, and hence non-exhaustive.

The academic community is invited to contemplate on the theme of the conference by framing specific and focused research questions in different areas of IP law that raise legal implications in their interaction with other areas of law. To specifically scope the thematic discussions during the workshop, we look forward to research proposals that avoid pure policy questions that may govern such interfaces. The workshop aims to focus on legal argumentation, articulation and outcome by working on specific legal questions on IP interfaces. The aim to develop a concrete research agenda in order to discern legal principles that guide such legal relationships in terms of their conflicts, complementarities and contestations of IP interfaces. This is with an exclusive focus on several key areas of Indian/international law in its interaction with intellectual property law in India, as governed by different statutes, case-law jurisprudence and common law principles.

Relinquishment of Copyright

Analysis

The law in India allows anonymously and pseudonymously created works to be copyrighted as well, as is clear from section 23 of the Copyright Act. However, rule 8 as it currently is does not allow such authors to relinquish copyright. Relinquishment of copyright is a very different kind of act from registration of copyright, and hence it is not necessary to seek the same categories of information from both. Certain categories of information sought during registration of copyright ("class of work", "language of the work", "nationality of author") are required not because they help identify a work, but because they help in indexing the work ("class of work", "language of work") or in ensuring that the work is copyrightable in India ("nationality of author"). Such considerations do not matter when it comes to relinquishment of copyright, i.e., when a work is allowed to pass into the public domain. Further, technological progress has made it difficult to determine the answer to a question like "country of first publication", "nationality of the publisher", etc. If a work has been uploaded by an author on to his blog, is the publisher the author or the person hosting the blog? If an Indian author residing in India first publishes a work on the server located in Argentina, is the country of first publication India or Argentina? The answer to these questions does not make a difference to the issue of relinquishment of copyright. The only information that is required for relinquishment of rights is a) what work is being put in the public domain, b) by whom, c) from when.

Furthermore, the current requirements of rule 8 cannot easily be satisfied by using most of the popular means of relinquishing copyright (such as the CC0 — Creative Commons Zero — licence).

Recommendations

Rule 8 be modified to read: A public notice issued by an author relinquishing his or her rights as per subsection (1) of section 21 of the Copyright Act, shall include the following details: (a) Title of the work (b) Full name, or pseudonym, in case the work has not been created anonymously (c) Date of issuance of the notice (d) If copyright in the work is registered under section 45, the registration number.

Rule 9 be modified to read: Any one of the following shall constitute public notice of relinquishment of copyright: i. Mentioning of the notice on the work, or cover of the work, or in the metadata of the work if the work is electronic; or ii. Publication in a newspaper; or iii. Publication by the author on a publicly-accessible website

Rule 10 be modified to add the following sentence: The author shall forward a copy of the public notice to the Registrar of Copyright if copyright in the work has been registered under section 45 and on receiving such notice, the Registrar of Copyright shall post the same on the website of the Copyright Office.

Statutory Licence for Cover Versions

Analysis

Rule 34(2) is redundant and does not contain any detail not already present in the existing proviso to section 31C(1) of the Copyright Act. Additionally, Rule 35 also does not contain any detail not already present in the existing parent provision, section 31C of the Copyright Act.

Recommendations

Rules 34(2) and 35 be deleted.
Rule 37 should be modified to add a sub-rule requiring maintenance of records online.

Indexes

Analysis

In rule 71(3), it requires that the indexes be maintained in the form of cards. These are presumably physical cards. It is unclear why the rule should not require the maintenance of these indexes online to facilitate search by the public. Further entries 13 and 14 of Schedule II are from a time when the transaction costs incurred by the Registrar of Copyright for providing extracts from an Index were non-negligible, and hence it would have been necessary to charge a person for such services. With the capabilities of electronic systems, such retrievals are almost costless, and can be done without the intervention of the Registrar of Copyright. Hence entries 13 and 14 should not be made applicable to online retrievals. If copyright societies can be required to provide information free of costs on their websites (as per rule 65), the Registrar of Copyright should be required to do so too.

Recommendation

Modify sub-rule (3) of rule 71 to read: "Every Index shall be available online as a downloadable database, with an online search facility."

Modify the second sentence in rule 72 to read: "The online search or inspection of the Register of Copyrights and Indexes can be utilised free of cost."

Storage of Transient or Incidental Copies of a Work

Analysis

It is not clear enough from the language of rule 74 that it applies only to s.52(1)(c) and not to s.52(1)(b). Since only s.52(1)(c) has a complaints mechanism, this should be made clear.

Importantly, to protect the interest of the public, the intermediaries should be asked to give public notice regarding the alleged infringing copy to ensure that the take-down mechanism is not abused, and secondly to ensure that the public can independently verify that intermediaries are following the requirement in rule 74(4) of restoring storage of the work if no court order is forthcoming within 21 days.

Lastly, there is no clear precedent in India to treat a uniform resource identifier (URI) as 'place' for purposes of section 51(a)(ii) of the Copyright Act, 1957. Therefore it is necessary to further clarify the meaning of the term 'place' as used in current Rule 74(2)(d). This would be best served by using the correct technological term ("URI") instead of the word "place".

Recommendation

Modify sub-rule (1) of rule 74 to: "Any owner of copyright may give a written complaint as per clause (c) of subsection (1) of section 52 of the Copyright Act to a person who has facilitated..."

Add sub-rule (6) to rule 74: "The person responsible for storage shall put up a public notice thereby notifying all persons requesting access to the alleged infringing copy by stating reasons for restraining such access whether during the period of 21 days from the complaint from the copyright owner, or pursuant to an order from a competent court."

Modify rule 74(2) to read: "Details of the specific uniform resource identifier (URI) where transient or incidental storage of the work may be taking place."

Making or Adapting the Work by Organizations Working for the Benefit of Persons with Disabilities

Analysis

Rule 75 requires organizations making use of the exception granted under s.52(1)(zb) to maintain records. This could not have been the intention of the legislature in passing s.52(1)(zb), since that provision does not require any maintenance of records. Indeed, none of the exceptions ennume-rated in s.52(1) require the maintenance of records. This is in contrast with s.31B, which is also applicable to organizations working for the benefit of persons with disabilities, but only those that are doing so as a for-profit venture. Rule 29(6) already requires the Registrar of Copyright to notify the grant of a licence under s.31B in the Official Gazette. That provision may be modified to add that the Registrar of Copyright maintains these records in a centralized database that can be queried online.

Recommendations

Delete rule 75, and modify rule 29(6) to include a centralized database.

Technological Protection Measures

Analysis

Most experts seem to hold that s.65A of the Indian Copyright Act does not affect circumvention tools, as it only deals with the act of unauthorized circumvention and not with the tools, in sharp contrast with s.1201(a)(2) of the Digital Millennium Copyright Act in the US, which criminalises the "manufacture, import, offer to the public, provision, or otherwise trafficking in any [circumvention] technology, product, service, device, component, or part thereof". The Indian law has conciously chosen not to emulate the DMCA in this respect, as the WIPO Copyright Treaty does not require it.

The broad understanding of "facilitation" contained the Copyright Rules unfortunately seem to undermine this clear distinction. If facilitation is understood to include offer to the public, provision, or distribution, as seems to be the case in Rule 79(3) and 79(4), then law becomes unworkable with each and every website that allows for the downloading of any software that can be used to play DVDs, etc., must specifically keep a register of downloaders from India. This is unnecessary, and goes beyond the intent of s.65A, which is to cover those who actively facilitate circumvention and not those who make available the tools to circumvent. This distinction should not be blurred.

Recommendation

Delete sub-rules (3) and (4) of rule 79.

Feedback on the Framework on OSS Adoption in E-Governance Systems

CIS gave its feedback to the Department of Electronics and Information Technology (DeitY) on the Framework on Open Source Software Adoption in E-Governance Systems on October 26, 2013.

In September, 2013, the DeitY invited comments on the Framework on the proposed adoption of Open Source Software in E-Governance Systems (available at https://egovstandards.gov.in/Public_review_Framework_on_oss).

The Framework, published in September, 2013, provides a set of recommendations and procedures to encourage, manage and increase the adoption of Open Source Software in E-Governance systems. Further, the Framework goes on to discuss various important issues, including the deployment of unified software for all major devices, with the utilization of a standards based web browser, the integration of OSS with other on-going initiatives, and the development of an eco-system consisting of institutions, industry, academia and other key stakeholders to promote and adopt OSS. The envisaged Centre of Excellence on OSS to realize this Framework is noteworthy.

CIS commends the DeitY for this initiative, and appreciates the opportunity to provide feedback on the Framework.

The text of CIS Feedback is reproduced below:

PRELIMINARY

This submission presents comments from the Centre for Internet and Society[1] on the Framework on Open Source Software Adoption in ‘E-Governance’ (“Framework”), published by the Department of Electronics and Information Technology, Ministry of Communications and Information Technology, Government of India (DeitY).[2]

The Framework, published in September, 2013, provides a set of recommendations and procedures to encourage, manage and increase the adoption of Open Source Software in E-Governance systems.[3] Further, the Framework goes on to discuss various important issues, including the deployment of unified software for all major devices, with the utilization of a standards based web browser, the integration of OSS with other on-going initiatives, and the development of an eco-system consisting of institutions, industry, academia and other key stakeholders to promote and adopt OSS. The envisaged Centre of Excellence on OSS to realize this Framework is noteworthy.

CIS commends the DeitY for this initiative, and appreciates the opportunity to provide feedback on the Framework. CIS’ comments are as stated hereafter.

COMMENTS

Scope and Applicability

In the section pertaining to Scope and Applicability, the Recommendation proposed is to give priority to preferred areas for the adoption of this Framework.[4]

It is suggested that the preferred areas alluded to aforesaid be identified and disclosed. It is further suggested that the Framework identify a timeline for operationalization of all of the proposed recommendations, including the identification of the preferred areas and the adoption of the Framework in these areas. It is also suggested that a time frame be provided for the implementation of the Framework to all other areas, besides the preferred ones.

Preamble

In the section titled Preamble, the Recommendation proposed is to consider OSS along with Closed Source Software.[5] considering the socio- economic and strategic benefits provided by OSS.[6]

CIS appreciates the welcome measure in considering OSS alternatives along with CSS. While viewing this as indeed the first step in the right direction, CIS would suggest the development of a mechanism and the adoption of further measures in order to migrate entirely to an entirely OSS based system; with preference being given to OSS between OSS and CSS.

Factors Influencing the Adoption of OSS in Government

In the section dealing with Factors Influencing the Adoption of OSS in Government, the Framework states that the influencing factors are to be prioritized on the basis of feedback from managers/users.[7]

CIS proposes that it may be clarified who the managers/users being spoken of are, and what is the type and manner of feedback expected for the evaluation of influencing factors. CIS suggests that feedback also be sought in a more inclusive and holistic manner, after seeking consultation from other stakeholders as well.

Device Drivers

Under the section dealing with Device Drivers, the onus to ensure availability of device drivers for GNU Linux Operating Systems has been placed on the users.[8]

CIS strongly suggests that this be modified to state that the availability of device drivers for GNU Linux Operating Systems must be assured by vendors as a part of procurement requirements.

Procurement Guidelines

Under the section dealing with Procurement Guidelines, it has been recommended that vendors must provide justifications for excluding OSS in their response to proposals.[9]

CIS suggests that vendors be given a time frame within which to ensure compliance with the Framework, and thereafter be required to include OSS in their response to proposals, post which justifications ought not to be considered, as a matter of policy, but could be on an exceptional case to case basis.

CONCLUDING OBSERVATIONS

CIS welcomes the initiative of the DeitY towards the adoption of OSS in E-Governance Systems. This Framework, while indeed addressing the important issues associated towards the end of adoption of OSS in E- Governance, would be further strengthened by addressing the concerns enumerated above.
CIS is thankful to the DeitY for the opportunity to provide feedback on this Framework. As a non-governmental research organization working in the areas of Openness[10] and Access to Knowledge.[11] CIS appreciates this effort by the DeitY, and would be privileged to work with the Government on this and other matters in these areas.

Highlights for February 2019

Maharashtra is a state which is rich in diversity in terms of language and culture seen in its various regions such as Konkan, Marathwada, Western Maharashtra, Northern Maharashtra and Vidarbha. Awareness needs to be created to make Wikimedia movement inclusive and diverse in these geographical regions as well as in their social strata. Keeping this in view CIS-A2K conducted five workshops in different parts of the state.
Marathi language department of Goa University has initiated the process to document the culture of Goa on Marathi Wikipedia and Commons. Subodh Kulkarni reports this in a blog entry.
Khetrimayum Monish Singh and Rajiv K. Mishra co-authored a research paper which was presented at the Young Scholars International Conference on “Margins and Connections,” organised by the Special Centre for the Study of North East India, Jawaharlal Nehru University, on February 7-8, 2019.
Following consultations with data protection, civil society, industry and others, during the Cybercrime Convention Committee (T-CY) meeting from 29 November 2018 onwards, the Cybercrime Convention Committee had sought additional contributions regarding the provisional draft text for a Second Additional Protocol to the Budapest Convention on Cybercrime (“Budapest Convention”). Vipul Kharbanda submitted comments on behalf of CIS.
CIS responded to the call for submissions from the UN Special Rapporteur on Freedom of Speech and Expression. The submission was on the Surveillance Industry and Human Rights.
CIS and University of Munich, Germany are co-organizing an event 'Internet Speech: Perspectives on Regulation and Policy' at India Habitat Centre on April 5, 2019.
Akriti Bopanna on behalf of CIS provided comments on the proposed draft of ICANN’s FY20 Operating Plan and Budget along with their Five-Year Operating Plan Update.
Harsh Bajpai, Ambika Tandon, and Amber Sinha have co-authored a case study 'The Future of Work in the Automotive Sector in India'. The case study highlights the impact of technologies such as artificial intelligence, industry 4.0, internet of things, and so on at industry workplace. The case study was edited by Rakhi Sehgal. Manav Mehta provided research assistance.
In a response to the Draft of The Information Technology [Intermediary Guidelines (Amendment) Rules] 2018, CIS examined whether the draft rules meet tests of constitutionality and whether they are consistent with the parent Act. The submission also examined potential harms that may arise from the Rules as they are currently framed and make recommendations to the draft rules that may enable government to meet its objectives while remaining situated within the constitutional ambit.
A UN high-level panel on Digital Cooperation issued a call for inputs that called for responses to various questions. CIS responded to the call for inputs. The response was drafted by Aayush Rathi, Ambika Tandon, Arindrajit Basu and Elonnai Hickok.

Access to Knowledge

Our Access to Knowledge programme currently consists of two projects. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

As part of the project grant from the Wikimedia Foundation we have reached out to more than 3500 people across India by organizing more than 100 outreach events and catalysed the release of encyclopaedic and other content under the Creative Commons (CC-BY-3.0) license in four Indian languages (21 books in Telugu, 13 in Odia, 4 volumes of encyclopaedia in Konkani and 6 volumes in Kannada, and 1 book on Odia language history in English).

Highlights

We published revised chapters for the states of Mizoram, Dadra and Nagar Haveli, Himachal Pradesh and Haryana, as part of our National Resource Kit project.
In the concluding blog post of a three-part study Ananth Padmanabhan looks at the Indian law in the Copyright Act and the Information Technology Act, and concludes that both those laws restrain courts and private companies from ordering an ISP to block a website for copyright infringement.
Telugu Wikipedia celebrated its 10^th anniversary. An event was co-organized in Vijaywada to celebrate the same.
The second Institute on Internet and Society was held in Pune from February 11 to 17. The proceedings from the workshop are captured in a blog post.
CIS announced an Open Call for Comments for the latest draft of the Privacy Bill, 2013 prepared by Bhairav Acharya.
Forbes India published its “30 Under 30 List”. Pranesh Prakash is featured in the list.
As part of the Making Change Project, Denisse Albornoz wrote a blog post that compares the production behind a performance with the process of storytelling.
Beli gives an introduction to spectrum sharing. The post looks at GSM and CDMA, and touches upon LTE, and how they might share spectrum.

The Centre for Internet & Society (CIS) wishes you a great year ahead and welcomes you to the second issue of its newsletter for the year 2013. In this issue we bring you an overview of our research programs, updates of events organised by us, events we participated in, news and media coverage, and videos of some of our recent events.

Memorial

Rahul Cherian, an expert and policy activist in disability law, intellectual property and technology law passed away due to an illness while on a visit to Goa on February 7, 2013. Rahul was the founder of the Inclusive Planet Centre for Disability and Policy, and a fellow at CIS. He was also a partner at IndoJuris Law Offices in Chennai and was one of the experts who drafted the Treaty for the Visually Impaired currently being negotiated at the World Intellectual Property Organization. The Hindu (February 8, 2013), First Post (February 8, 2013), Legally India (February 7, 2013), and Bar & Bench (February 8, 2013) covered this story. Lawrence Liang wrote an obituary page, A Lightness of Spirit (The Hindu, February 9, 2013) and Nishant Shah wrote a column One For All (Indian Express, February 17, 2013).

CIS organised a memorial function for Rahul Cherian at the TERI, Southern Regional Centre in Bangalore on February 28, 2013.

Accessibility

CIS is doing two projects in partnership with the Hans Foundation. One of this is to create a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India and another is for developing a screen reader and text-to- speech synthesizer for Indian languages. CIS is also working with the World Blind Union and many other organisations to develop a Treaty for the Visually Impaired helped by the WIPO:

Anandhi Viswanathan from CIS and Manojna Yeluri from the Centre for Law and Policy Research are working in this project. Draft chapters have been published. Feedback and comments are invited from readers for the chapters on Bihar and West Bengal:

The Bihar Chapter (by Manojna Yeluri, February 14, 2013): The state of Bihar is in the process of formulating a comprehensive state policy on disability. The Bihar State Policy on Disability is an extension of the National Policy for Persons with Disabilities and is currently in a draft form awaiting government approval and notification.
The West Bengal Chapter (by Anandhi Viswanathan, February 28, 2013): The state of West Bengal has issued the West Bengal Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Rules, 1999 to implement the provisions under the central Persons with Disabilities (Protection of Rights, Equal Opportunities and Full Participation) Act, 1995.

Access to Knowledge

The Wikimedia Foundation awarded CIS a two year grant of INR 26,000,000 to support and develop the growth of Indic language communities and projects by community collaborations and partnerships. This is being carried out by the Access to Knowledge team based in Delhi. CIS is also doing a project (Pervasive Technologies) on examining the relationship between production of pervasive technologies and intellectual property. The project researches upon the noteworthy opportunities of the new types of low cost mobile devices, content and services as available in the market.

Wikipedia

Beginning from September 1, 2012, Wikimedia Foundation awarded CIS a two-year grant of INR 26,000,000 to support and develop free knowledge in India. The A2K team consists of four members based in Delhi: T. Vishnu Vardhan, Nitika Tandon, Subhashish Panigrahi and Noopur Raval, and one new team member Dr. U.B. Pavanaja who works from Bangalore office.

New Team Member

Dr. U.B. Pavanaja joined the A2K team as Programme Officer, India Language Initiatives on February 19, 2013. Dr. Pavanaja holds a Master’s degree from Mysore University and Ph.D. from Mumbai University. He was a scientist at Bhabha Atomic Research Centre, Mumbai, for about 15 years. He is one of the earliest editors of Kannada Wikipedia. He has to his credit many firsts, viz., first Kannada website, first Kannada online magazine, first Indian language (Kannada) website to receive Golden Web Award, first Indian language (Kannada) editor for Palm OS, first Indian language (Kannada) editor for WinCE device (HP Jornado 720), first Indian language version (Kannada) of universally popular Logo (programming language for children) software, etc. His Kannada logo won the Manthan Award for the year 2006. He was a member of the technical advisory committee setup by the Govt. of Karnataka for Standardization of Kannada on Computers (2000). He is also a member of the Kannada Software Committee of Govt. of Karnataka (2008-current).

Internet Access – Knowledge Repository

CIS in partnership with the Ford Foundation was executing the telecom knowledge repository project which included producing and disseminating modules on various aspects of telecommunications including policy, regulations, infrastructure and market. However, from November 2012 there was a change in the mandate of the project. The new repository will cover the history of the internet, technologies involved, principle and values of internet access, broadband market and universal access. It will also touch upon various polices and regulations which has an impact on internet access and bodies and mechanism which are responsible for formulation policies related to internet access. The blog posts and modules will be published in a new website: www.internet-institute.in.

Upcoming Event

We are hosting an “Institute on Internet and Society” in collaboration with the Ford Foundation India, which is to be held from June 8, 2013 to June 14, 2013. Call for registration and relevant details will be announced soon on our website.

Telecom

While the potential for growth and returns exist for telecommunications in India, a range of issues need to be addressed. CIS was registered as a society in Bangalore in 2008. As an independent, non-profit research organisation, it runs different policy research programmes such as Accessibility, Access to Knowledge, Openness, Internet Governance, and Telecom. The policy research programmes have resulted in outputs such as the e-Accessibility Policy Handbook for Persons with Disabilities with ITU and G3ict, and Digital Alternatives with a Cause?, Thinkathon Position Papers and the Digital Natives with a Cause? Accessibility

Around 70 million disabled persons in India are unable to participate in information societies as lack of compliance with accessibility standards make interfaces impossible to use, and retrograde copyright and patent policies make it impossible to access knowledge. Accessibility is denied in banking services, web and mobile interfaces, etc. Material for the disabled therefore needs to be converted into accessible formats. The programme has resulted in outputs such as Web Accessibility Policy Making, Making Mobile Phones and Services Accessible for Persons with Disabilities, Accessibility Policy Making: An International Perspective, e-Accessibility Policy Handbook for Persons with Disabilities, Universal Service for Persons with Disabilities: A Global Survey of Policy Interventions and Good Practices, etc.

Web Accessibility Policy Making: An International Perspective: G3ict and the Centre for Internet and Society are pleased to announce the publication of a new, improved edition of the Web Accessibility Policy Making: An International Perspective. The report published in cooperation with the Hans Foundation provides an updated synopsis of the many policies that governments have implemented around the world to ensure that the Internet and websites are accessible to persons with disabilities.

ITU Tutorial on Audiovisual Media Accessibility (India International Centre,New Delhi, March 14 to 15, 2012): At the invitation of the Centre for Internet and Society, in cooperation with the ITU-APT Foundation of India, International Telecommunication Union is organizing a two-day Tutorial on Audio Visual Media Accessibility. The Tutorial will be preceded by the fourth meeting of the Focus Group on Audio Visual Media Accessibility on March 13, 2012. The meeting will take place in the same venue and will be hosted by the Centre for Internet and Society in cooperation with the ITU-APT Foundation of India.

Access to Knowledge

With the emergence of digital technologies and the unprecedented growth of the Internet and other related technologies, intellectual property rights (IPRs) the questions of ownership and control of information have become crucial. The programme focuses on the inequitable distribution of IPR, royalty, outflows, and beneficiaries of intellectual property regimes, the lack of balance in current IPR regimes [local, national and international] between consumer rights and IPR-owners’/corporation’s rights. The programme has produced analyses such as WIPO Treaty for the Print Disabled, WIPO Broadcast Treaty, Copyright Amendment Bill and Parallel Importation of Books.

Openness

The advent of the Internet has radically defined what it means to be open and collaborative. Even the Internet is built upon open standards and free/libre/open source software. The broad rubric of the ‘Openness’ programme focuses to provide evidence based research that will help inform policy and practice of the local, national, regional, bilateral and international policies and practices around Open Government Data, Open Access to Scholarly Literature, Open Access to Law, Open Content, Open Video, Open Standards and Free/Libre/Open Source Software. The programme has resulted in reports such as Open Government Data Study, Online Video Environment in India, a reader on the Wikipedia titled Critical Point of View: A Wikipedia Reader and a film titled People are Knowledge – Experimenting with Oral Citations on Wikipedia.

Internet Governance

Governments and private corporations are engaging in human rights violations online. Many different rights are impacted by internet governance policy changes. The growing phenomenon of illegal electronic surveillance by state and non-state actors and censorship of speech online are some specific problems that the Internet Governance programme seeks to address by providing evidence based research that will help inform policy and practice of the local, national, regional, bilateral and international privacy regime in the interests of the public in sectors key to information societies with a particular focus on information technology, privacy and freedom of expression. The programme has resulted in outputs such as Banking, Telecommunications, Consumer Protection, IT Act, Limitations, Copyright, Internet Protocol, Media, Sexual Minorities, UID and policy submissions such as, NIA Bill, IT Act, National Policy on Electronics, Cyber Café Rules, Security Practices Rules, and Intermediary Due Diligence Rules.

All India Privacy Symposium: (India International Centre, New Delhi, February 4, 2012): Experts gathered in Delhi for a public symposium on privacy, transparency, e-governance and national security in India. The event was organized by Privacy India in partnership with the International Development Research Centre, Canada, Privacy International, UK, Commonwealth Human Rights Initiative and Society in Action Group, Gurgaon. Digital Natives with a Cause?

Digital Natives with a Cause? is a knowledge programme initiated by the Centre for Internet and Society, India and Hivos, Netherlands. It is a research inquiry that seeks to look at the changing landscape of social change and political participation and the role that young people play through digital and internet technologies, in emerging information societies. The programme has resulted in a four-book collective titled Digital AlterNatives with a Cause? and reports such as Digital Natives with a Cause? A Report and Digital Natives with a Cause? Thinkathon: Position Papers.

Events

Digital Natives Video Contest: Twenty-one candidates have been shortlisted, videos will be online soon. Voting begins from March 10, 2012. The Centre for Internet and Society is co-organising the video contest with Hivos, Netherlands.

Essay Review: Digital AlterNatives with a Cause: The monthly essay review for the four book collective of Digital AlterNatives with a Cause? was held from February 17 to February 26, 2012. The Centre for Internet and Society co-organized the “Essay Review” with Hivos, Netherlands.

RAW is a multidisciplinary research initiative. CIS believes that in order to understand the contemporary concerns in the field of Internet and society, it is necessary to produce local and contextual accounts of the interaction between the Internet and socio-cultural and geo-political structures. To build original research knowledge base, the RAW programme has been collaborating with different organisations and individuals to focus on its three year thematic of Histories of the Internets in India. Estimates of the percentage of the world's population that is disabled vary considerably. But what is certain is that if we count functional disability, then a large proportion of the world's population is disabled in one way or another. At CIS we work to ensure that the digital technologies, which empower disabled people and provide them with independence, are allowed to do so in practice and by the law. To this end, we support web accessibility guidelines, and change in copyright laws that currently disempower the persons with disabilities.

Internet Governance

Although there may not be one centralised authority that rules the Internet, the Internet does not just run by its own volition: for it to operate in a stable and reliable manner, there needs to be in place infrastructure, a functional domain name system, ways to curtail cyber crime across borders, etc. The Tunis Agenda of the second World Summit on the Information Society (WSIS), paragraph 34 defined Internet governance as “the development and application by governments, the private sector and civil society, in their respective roles, of shared principles, norms, rules, decision-making procedures, and programmes that shape the evolution and use of the Internet.” CIS involvement in the field of Internet governance has taken the following shape:

CIS is doing a project, ‘Privacy in Asia’. It is funded by Privacy International (PI), UK and the International Development Research Centre, Canada and is being administered in collaboration with the Society and Action Group, Gurgaon. The two-year project commenced on 24^th March 2010 and will be completed as agreed to by the stakeholders. It was set up with the objective of raising awareness, sparking civil action and promoting democratic dialogue around challenges and violations of privacy in India. In furtherance of these goals it aims to draft and promote over-arching privacy legislation in India by drawing upon legal and academic resources and consultations with the public.

The growth in telecommunications in India has been impressive. While the potential for growth and returns exist, a range of issues need to be addressed for this potential to be realized. One aspect is more extensive rural coverage and the second aspect is a countrywide access to broadband which is low at about eight million subscriptions. Both require effective and efficient use of networks and resources, including spectrum. It is imperative to resolve these issues in the common interest of users and service providers. FDC recognition for the Centre for the Internet and Society

The Wikimedia Foundation Board has published a resolution declaring the Centre for Internet and Society as eligible for funding through the Annual Plan Grants program.

The resolution was approved at the Board's November 2013 meeting.

Whereas, the Wikimedia Foundation (WMF) and the Centre for the Internet and Society (CIS) have engaged in a working relationship in support of the mission goals of the Wikimedia movement in India since September 1, 2012;

Whereas, the Board would like to ensure that the activities and initiatives of CIS and its grants and payments received from WMF in support of the mission goals of the Wikimedia movement are subject to the review and recommendations of the Funds Dissemination Committee (FDC) to ensure the best consideration and use of donor monies;

Whereas, the Board recognizes that the work of CIS is comparable to that of other Wikimedia-affiliated entities in support of the mission goals of the Wikimedia movement;

Resolved, that, for purposes of eligibility to submit funding requests to the FDC, the FDC should treat the CIS as it would treat an eligible Wikimedia-affiliated entity for the limited term of CIS’ agreement with WMF.

Father-son duo promote Punjabi online

A father-son duo has been working to include more information about Punjab and Punjabi on Wikipedia, the online encyclopaedia.

Charan Gill and his son Satdeep Gill have written hundreds of articles in English, Hindi and Punjabi in both Shahmukhi and Gurmukhi scripts. The father-son duo recently represented Punjabi in the first ever Train the Trainer Program in India, held at the Centre for Internet and Society (CIS-A2K) in Bangalore. The four-day event was organised for capacity building amongst Wikimedia volunteers for effective and efficient outreach programs in their respective regions to expand the Wikimedia movement in India, informed Charan Gill.

Satdeep Gill, a graduate student at Punjabi University, Patiala was already a contributor to the Punjabi Wikipedia when he attended a workshop held by veteran Punjabi Wikipedian G.S. Guglani. Satdeep became quite active after the workshop and soon his father too joined in. Charan informs he has contributed around 2700 articles, while Satdeep who is one of the administrators, has written around 600 pages. When he started there were around 3000 articles and there were too many factual and other errors, said Charan. He started editing older articles and adding newer ones along with Satdeep. There were others who joined in and now it has around 8700 articles. "Our target is to reach 10,000 by April," said Charan.

FAQ: CIS' Proposal for Compulsory Licensing of Critical Mobile Technologies

Earlier this year, the Centre for Internet & Society (CIS) had proposed that the Government of India (GoI) initiate the formation of a patent pool of critical mobile technologies and mandate a five percent compulsory license. The proposal was made in light of ongoing litigation in India over standard essential patents pertaining to mobile technology, and the government's own “Make in India” and “Digital India” programmes.

1. How did CIS arrive upon the figure of 5 percent as the compulsory licensing fee for the patent pool?

As part of foreign technology agreements, the Department of Industrial Development (DID) introduced a ceiling of 5 percent on the royalty rates charged for domestic sale and 8 percent for export of goods pertaining to "high priority industries" in the year 1991. Royalties higher than 5 percent or 8 percent, as the case may be, required securing approval from the government[1]. While 1991 was too early for the mobile device manufacturing industry to be listed among high priority industries, the public announcement by the government covered computer software, consumer electronics, and electrical and electronic appliances for home use[2]. In 2009, another department under the Ministry of Commerce and Industry, the Department for Industrial Policy and Promotion, revoked the cap on royalty rates[3]. Sanjana Govil throws some light on why government regulation on intellectual property was introduced in the early 90s and how it succeeded in reducing the flow of money out of India: Putting a Lid on Royalty Outflows — How the RBI can Help Reduce India 's IP Costs.

The situation in 1991 is somewhat analogous to the current one where most of the patent holders in the mobile device technology domain are multinational corporations, which results in large royalty amounts leaving India. At the same time, litigation over patent infringement in India has thwarted the manufacture and sale of mobile devices of homegrown brands. Additionally, these developments are detrimental to the Modi government’s aim of encouraging local manufacturing as well as strengthening India’s intellectual property regime.

2. How would royalties be distributed among patent holders in a patent pool where a single fee of 5 percent is being charged?

A patent pool formed for the purpose of compulsorily licensing the patents contained in it can be managed by combining government intervention with the governance structure of a voluntary patent pool. Vikrant Narayan Vasudeva enumerates the different approaches to setting royalty rates in a patent pool once a “royalty base” has been established[4]:

3. The letter implicitly suggests that litigation intended to protect the interests of patent holders could potentially have a chilling effect on government initiatives, local innovation and the interests of consumers. Is there evidence to support this?

Though there is a thin line between legitimate application of legal remedies and chilling effects, the ramifications of the acitivies of non-practising entities (NPEs), of strategic lawsuits against public participation (SLAPP suits), and of frivolous lawsuits provide plenty of evidence to support making such a proposal.

Fab to Fabless: Understanding the Process of Chip Manufacturing (Interviews with Semiconductor Industry - Part 2)

This is the second of a four-part blog series highlighting findings from a small sample of interviews with fabless semiconductor industry professionals in Taiwan. These industry insiders was approached for the intent of understanding expert knowledge on the process of integrated circuit design. This post explores the process of chip manufacturing and the foundry business model.

Studies have shown that Taiwan's integrated circuit manufacturing sector have shown spatial and industrial knowledge spillover, resulting in "increased information diffusion, interaction and communication, innovation, and intellectual capital.". Market research company IC Insights found that Taiwanese and Chinese companies represented five of the eight fastest-growing fabless integrated circuit ("IC") suppliers in 2013.

The Pervasive Technologies: Access to Knowledge in the Marketplace project is looking at the accessibility of networked communication technologies in the mass market within the sub-100 dollar range. This has resulted in a narrowing of the research scope to the mobile phone due to the pervasiveness of the mobile for accessing Internet, as understood by exploring the trends in technology usage models as explored in Part I of this blog post series: Trends and Changes in Technology (Part I of IV).

The need to understand the full story of the mobile phone production led CIS to Taiwan to understand the beginnings of the manufacturing process - the development of an integrated chip. The interviewed professionals all represented fabless IC semiconductor design companies which operated via a foundry business model where the actual fabrication is outsourced.

According to one expert whose company earned 50% of its revenue from mobile chipsets alone, the process of the mobile phone manufacturing begins at the fabless design stage, where fabless IC design companies design a chip following consultation with the fabricators to specify the mechanical constraints of the process (the size of the die, the minimum size of the wiring line, etc.) to ensure design requirements are met, and to negotiate the costs of production. Another interviewee highlighted that during this design phase, there are three clear goals: 1) Upgrade performance, 2) Reduce cost by integrating features, and 3) Reduce power consumption.

These particular companies provided insight to some of the commonly licensed technology that went into a smartphone chipset. This included the central processing unit (CPU) from ARM Holdings, who in 2010 held 95% of the CPU marketshare in smartphone technology, and have only increased since then. One of the interviewed companies also uses the graphics processing unit (GPU) intellectual property from Imagination Technologies, which after Qualcomm had the 2nd largest market share of IP for personal devices in 2013. Qualcomm who owns the most patents to the 3G standard with over 250 licenses in its CDMA portfolio has made considerable revenue gains thus far, but some analysts predict due to a transition into 4G technology without the same dominant 3G portfolio, they will lose their dominant market position.

Having taken into account these IP into the design process, the design is then sent to fabricators such as the Taiwan Semiconductor Manufacturing Industry (TSMC) who in 2013 owned at least 50% of the world's global maker share in fabrication, and others like the United Microelectronics Corporation (UMC) and Global Foundries). According to the interviewee, the fabrication process requires about 2-3 months.

This foundry business model is a result of increased efficiency and division of labour. Fabrication plants require large amounts of investments into manufacturing facilities. According to interviewees, one would have to spend an average of 5-10 billion USD to built a fabrication plant now. Since plants like TSMC exists, semiconductor industries can now focus on their area of expertise, which is design and customer relationship, and optimize their synergistic relationship for gains for all.

One of the recent revolutionary developments which have contributed to low-cost smartphone manufacturing has been the turnkey solution chipset, which includes the hardware reference design, the printed circuit board, the software, and instructions for how to create a mobile phone. This turnkey solution, amongst other electronic parts, are sent for white box packaging, then shipped to a distributor like WPG Holdings who are the largest electronics distributor in Asia. WPG and others will then distribute these chips and other related products to their customers, the smartphone manufacturers. This entire production cue takes about 3-4 months.

The turnkey solution as mentioned before vastly contrasts the traditional manufacturing process of a mobile phone, where a chip could be designed, given to the original equipment manufacturer (OEM) who would then design all the remaining parts. There used to be a very clear division of labour. Now, one interviewee explained, manufacturers will "buy a turnkey solution, open a factory, take a chassis (case), screw it all together, and sell it. This is what's driven the demand, and that's what created this low cost-market."

According to our interviewees, the low-cost production of this turnkey chip solution is the reason how so many of the phones in the sub-$100 dollar market exist today.

Exploring Wikimedia platforms in Dialogue on the Urban Rivers of Maharashtra

INTACH (Indian National Trust for Art and Cultural Heritage) and SANDRP (South Asian Network of Dams, Rivers and People) organized “A Dialogue on the Urban Rivers of Maharashtra” on 20-21 April 2018 from 9:00am-5:30pm at Yashada, Pune.

In the last year, we have developed good rapport with organisations and citizen science groups working on water related issues. Thematic workshops and awareness sessions were conducted with some of them. We have started discussing about 'Wiki Meets/Takes River' Campaign with these networks. INTACH and SANDRP are two potential groups which work on rivers across India with commitment. We have opportunity to collaborate in other states also.

We gave inputs on 'Exploring Wikimedia platforms for spreading knowledge about Water, Dams & Rivers'.

Outcome

The river dialogue was very meaningful and action oriented. Last month, we were able to launch process to build knowledge repository called - Van Bodh - related to biodiversity, forest and tribals with Tribal Research & Training Institute & other thematic groups. Through this dialogue, various thematic groups & Govt organisations formed consensus on evolving - Jal Bodh - a knowledge repository on Water related issues. Prof Madhav Gadgil and myself prepared a concept note for further discussions and process development. Yashada will be nodal agency to execute the project.

Exploring the Internals of Mobile Devices — Report from a One-day Workshop at TERI

On October 27, 2012, the Centre for Internet & Society (CIS) organised a one-day workshop on exploring the internals of mobile technologies at the TERI Southern Regional Centre in Bangalore. The workshop received more than 140 registrants, of which approximately 40 attended. In this post, Jadine Lannon explores the discussions and the developments that took place at the workshop.

The event brought together professional and non-professional individuals and communities interested in exploring mobile technologies. The aim of the workshop was the provide participants with the knowledge and tools to better understand the internals of mobile technologies as well as familiarize the attendees with CIS's "Pervasive Technologies" research project.

Anil Kumar Pugalia, Sudar Muthu and Pankaj Bharadiya were the expert speakers. The event was supported by the well-established online security, hardware and software domain communities NULL, SecurityXploaded, Computer Club India and Bangalore Android User Group.

Sudar Muthu: Capabilities of Arduino

Capabilities of Arduino (including Due) from Sudar Muthu	Sudar Muthu began the workshop with a talk on the capabilities of Arduino and the ways in which Arduino can be used to interface with different external devices. He discussed with us different types of Arduino, the technical specifications of Arduino, the ways that Arduino can be used to interface with external boards and the interfacing that he has been able to accomplish using Arduino and various devices. Anil Kumar Pugalia: Mobile Hacking using Linux Drivers

Anil Kumar Pugalia followed Sudar's presentation with an exploration of methods of mobile hacking using Linux drivers. He discussed various Linux kernel hacking techniques as well as tools that can be used to perform reverse-engineering on a mobile device. The following two talks were delivered by Pankaj Bharadiya from Texas Instruments. In his first presentation, he explored hardware hacking and board/chips capabilities. His second talk was on porting open software on hardware. In addition to his discussions, he also covered porting Android on open hardware. The slides from his presentations will be posted shortly.

After all the presentations, the participants were invited to handle and open up the 12 mobile devices that CIS purchased for our Pervasive Mobile Technologies research project. The participants worked in teams of two to five members to open up the mobile devices and observe their internals. We asked the participants to record any information about the internals of the mobiles that they were able to find, including the make, model, and serial numbers of the components. Pictures from this part of the workshop will be posted shortly.

All of the collected information was recorded and distributed among the participants so that the group could continue to work on identifying the mobile internals and the various data sheets associated with each component. This data will be added to the specifications of each mobile device as it is collected. CIS hopes to continue to collaborate with the individuals and communities who participated in this workshop as well as other interested individuals who may have been unable to attend the one-day workshop to proceed with this process of identification. We also hope to hold a second event, a one- to two-day hackathon, sometime in December to continue the exploration of our mobile devices.
