&lt;p class="body" style="text-align: justify; "&gt;For those with knowledge of Kannada and basic computer  skills, here is an opportunity for posting articles in Kannada on the  collaborative and free Wikipedia and facilitate the growth of Kannada  online.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;To help interested people learn the process  of posting their articles on Wikipedia, the Centre for Proficiency  Development Placement Service (CPDPS) of the University of Mysore will  conduct a one-day workshop on August 6 from 10 a.m. to 5 p.m.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;The  workshop will be conducted on the CPDPS premises, Manasagangotri, and  is being conducted by U.B. Pavanaja of the Centre for Internet and  Society, Bangalore.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;Niranjana Vanalli, Director, CPDPS, told &lt;i&gt;The Hindu&lt;/i&gt; that though Kannada has got the classical language tag and several  Kannada writers have got the Jnanpith, Kannada is among the least  represented language on Wikipedia in terms of articles in Indian  languages, and this workshop is a small step towards correcting these  lacunae.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;According to Mr. Pavanaja of CIS, Bangalore,  though Kannada Wikipedia was launched in June 2003 and this year marks  the 10th anniversary of the launch of the website, there are only 14,500  articles in Kannada.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;This is in contrast to nearly  1,00,000 Hindi articles, 52,000 Telugu articles about 52,000 articles in  Tamil, 25,000 in Bengali and 30,000 articles in Malayalam in the  Wikipedia. There are over 4.6 million articles in English. German and  French are close to English and so it is not merely Kannada but all  Indian languages that are lagging behind, said Mr. Pavanaja.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;However,  there is scope for improvement as 13 lakh people visit the Kannada  Wikipedia website every month. It definitely means that many people are  interested in reading articles in Kannada online, so there is scope for  posting more articles for their benefit.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;Interestingly  Wikipedia, which was launched in January 2001, has articles in 22  Indian languages and 256 languages around the world. There are over 3  crore articles and the number is growing by the day.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;There  are other significant aspects to the contribution of Indians to the  development of Wikipedia. While Kannadigas have taken to the enrichment  of Wikipedia in English their contribution to the enrichment of the  Kannada section has been abysmal. Incidentally, there are nearly 16 lakh  editors of Wikipedia all over the world of which about 5,500 are  Indians and of them 3,300 edit and contribute regularly in English. The  remaining 2,200 contribute in Indian languages.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;According  to Mr. Pavanaja, roughly 2 crore Indians regularly visit the Wikipedia  site but very few are either contributing or editing.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;“Indians  were definitely taking advantage of Wikipedia as it gets more than 2  crore hits every year. But the number of Indians contributing to enrich  the content is less, more so for Kannada”, he added. Mr. Vanalli, who is  a professor in the Department of Journalism and Mass Communication,  University of Mysore, pointed out that it was ironical that the Kannada  was the only Indian language to have an encyclopaedia of its own –  Kannada Vishwakosha – published by the University of Mysore. But when it  comes to the online collaborative project of Wikipedia, Kannada is  lagging behind and this should be reversed.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;The  workshop will introduce to the participants the features of Wikipedia,  and give hands-on demonstration on how to edit and contribute articles.  Participants can bring articles of their choice for editing and posting  on Wikipedia.         &lt;b&gt;Sunil Abraham and Pranesh Prakash participated in the meeting held on December 14, 2015 at National Law School in Delhi.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;Earlier this year, the Open Society Foundations convened a two-day meeting on access to knowledge strategy. Copyright emerged as a major issue and many of the attendees focused on a next-generation copyright reform strategy.  The discussion included identifying best user practices, capacity building, WIPO, and risk management.  By the end of the two-days, there was strong support to continue the dialogue with a further one-day meeting at the Global Congress.&lt;/p&gt;
&lt;p class="Default" style="text-align: justify; "&gt;&lt;b&gt;Agenda overview and guidelines &lt;/b&gt;&lt;/p&gt;

Their  publishers don't charge the readers as access to these journals is free,  but they charge the authors wanting to have their research papers  published in these journals.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Inspired by previous publishing "stings", Khan wanted to test whether  open access journals would publish an obviously absurd paper liberally  salted with nonsense for the sake of money from gullible authors anxious  to publish.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He created a spoof manuscript titled "Newer Tools to Fight  Inter-Galactic Parasites and their Transmissibility in Zygirion  Simulation", and submitted it to several suspect journals from the list  kept online by &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=jeffrey+beall" target="_blank"&gt;Jeffrey Beall &lt;/a&gt;-- an &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=associate+professor+and+librarian" target="_blank"&gt;associate professor and librarian &lt;/a&gt;at the &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=university+of+colorado" target="_blank"&gt;University of &lt;/a&gt;&lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=colorado" target="_blank"&gt;Colorado &lt;/a&gt;who coined the term "predatory journal" -- as a public service to his colleagues.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;All the hilarious fake names like "schleem", "dinglebop" and  "schwitinization", that do not make any sense, as well as images and  graphs published in the paper, were fabricated.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The "Zyrgion simulation", and "intergalactic parasites" are all  references to "Rick and Morty" -- a US Cartoon Network's animated  science &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=fiction" target="_blank"&gt;fiction &lt;/a&gt;programme about the misadventures of mad &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=scientist" target="_blank"&gt;scientist &lt;/a&gt;&lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=rick+sanchez" target="_blank"&gt;Rick Sanchez &lt;/a&gt;and his grandson &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=morty+smith" target="_blank"&gt;Morty Smith.&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Khan, a great fan of "Rick and Morty", submitted the paper with &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=beth+smith" target="_blank"&gt;Beth Smith &lt;/a&gt;(Rick's granddaughter in the cartoon show) as the corresponding &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=author" target="_blank"&gt;author &lt;/a&gt;and himself as co-&lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=author" target="_blank"&gt;author.&lt;/a&gt; Two other authors' names were made-up, and Sukant Khurana -- a &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=scientist" target="_blank"&gt;scientist &lt;/a&gt;at &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=central+drug+research+institute" target="_blank"&gt;Central Drug Research Institute &lt;/a&gt;in Lucknow, who offered to help Khan in this sting, was another author -- all affiliated to an institution in &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=morocco" target="_blank"&gt;Morocco &lt;/a&gt;that does not exist.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The so-called "Magnetic Oddities &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=radiation" target="_blank"&gt;Radiation &lt;/a&gt;Therapy" developed by the authors to treat the brain &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=infection" target="_blank"&gt;infection &lt;/a&gt;is again nothing but an expansion of "MORTY", a character in the cartoon show.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Anyone with commonsense would have noticed all the nonsense and  consigned the paper to trash, but Khan surprisingly found it was  accepted for publication by 10 journals for fees ranging from $75 to  $650.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;After some bargaining over fees, three scientific journals -- ARC  Journal of Pharmaceutical Sciences, IOSR Journal of Pharmacy and  Biological Sciences, and Clinical &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=biotechnology" target="_blank"&gt;Biotechnology &lt;/a&gt;and &lt;a class="storyTags" href="https://www.business-standard.com/search?type=news&amp;amp;q=microbiology" target="_blank"&gt;Microbiology &lt;/a&gt;-- published the paper without a second glance.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Khan says his "scientific prank" was intended to expose the seriousness  of predatory journal industry and to create awareness among people who  are beginning their careers in science. "These predatory journals are  polluting the scientific record with junk science and are also resulting  in fake news."&lt;/p&gt;

    <title>Statement on the Proposed Treaty for the Protection of Broadcasting Organizations at WIPO SCCR 28</title>

        &lt;p style="text-align: justify; "&gt;Thank you, Mister Chair.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mister Chair, there are two things that I would like to talk about, on behalf of CIS- &lt;i&gt;first&lt;/i&gt;, on justifications for this Treaty; &lt;i&gt;second&lt;/i&gt; on the scope and the rights sought to be granted under this Treaty, which I will speak of together, if I may.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;On justifying the need for this Treaty, Mr. Chair, we would reiterate what we have said in past sessions of this Committee – there has been no conclusive demonstration on the need for this Treaty and on why existing mechanisms in international legal instruments, including, among others TRIPS and the Rome Convention are not sufficient to address the concerns of the broadcasters. We have heard that these are insufficient, but no justifications as to why- something that KEI also pointed out in their statement before us. Further, Mr. Chair, we’re concerned by the fact that the latest study on the unauthorised use of signals presented to this Committee is the one from 2010 at the 20&lt;sup&gt;th&lt;/sup&gt; Session of this Committee. We strongly support the proposal made by India, TWN, CCIA and TACD to update this study and include an impact assessment of ALL the stakeholders, something that the earlier study does not address; in order to more comprehensively assess not just the need, but also the impact of this proposed treaty, and address some of the questions and concerns raised by TACD and TWN in their statement earlier.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Without prejudice to this submission on the need for this treaty, Mr. Chair, we would also like to comment on the scope of, and the rights under this Treaty.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mr. Chair, we would continue to submit that this proposed treaty should be based on a signals based approach and not a rights based approach. We have heard submissions by broadcasters at this and at previous sessions of this Committee, where the basis of seeking additional protection for broadcaster is to protect the underlying investment. Mr. Chair, investments made in infrastructure for broadcasting in the traditional sense are very different from those required for an IP based transmission, even if the same broadcaster is engaging in both. Therefore, Mr. Chair, given that the rationale for seeking this additional layer of rights over and above existing copyright is the protection of investment for broadcasting in the traditional sense is the , IP based transmissions should not be covered in any way under this Treaty.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Further, Mr. Chair, fixation and post fixation rights envisaged under Article 9 of Working Document SCCR 27/2/ Rev. and indicated in the &lt;a href="https://cis-india.org/a2k/blogs/informal-discussion.pdf" class="internal-link"&gt;Informal Document&lt;/a&gt; circulated today, are inconsistent with a signals based approach. We are strongly opposed to all of the rights indicated in the Third Row of this Informal Discussion Document. This Document, we believe, is moving the discussion towards a rights based approached and not a signals based approach, which we find deeply concerning. We also believe, Mr. Chair, that it is not logical to prescribe a term of protection (beyond the life of a signal), least of all 20 or 50 year term (as under Article 11 of this Working Document) for a signal that lasts milliseconds.&lt;/p&gt;

    <title>Statement on the Limitations and Exceptions for Libraries and Archives at WIPO SCCR 28</title>

&lt;p style="text-align: justify;"&gt;Thank you very much, Mr. Chair.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;We thank the delegation of the United States for putting forward their Objectives and Principles for Exceptions and Limitations for Libraries and Archives, presented to this Committee in &lt;a href="http://www.wipo.int/edocs/mdocs/copyright/en/sccr_26/sccr_26_8.pdf"&gt;Document SCCR/ 26/8&lt;/a&gt;. I would like to comment on two of the topics that we have discussed today- one; the adoption of national exceptions and two; limitations and exceptions in a digital environment.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;&lt;em&gt;First&lt;/em&gt;, Mr. Chair, on the adoption of national exceptions: We appreciate the recognition of the ‘public service’ role of libraries and the importance of limitations and exceptions for them to perform their role of facilitating access to and the dissemination of knowledge and information, the goals of the copyright system. However, Mr. Chair, we do believe that the true and complete realization of these objectives would not be possible without an international legal instrument that lays out minimum international standards for countries to adopt and implement, that fosters a system for cross border exchange and creates an enabling environment to facilitate the implementation and adoption of limitations and exceptions at the national level.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;&lt;em&gt;Second, &lt;/em&gt;Mr. Chair, on limitations and exceptions in a digital environment; we appreciate the objective set out in the proposal made by the United States and welcome the statements by the delegations of Kenya, Chile and South Africa, that international regulation will grant a solution to the problems facing libraries and archives in the digital environment. Mr. Chair, the digital environment presents huge opportunities for countries such as India and perhaps others in the Global South for the preservation and dissemination of knowledge and in turn benefit education and research; with libraries and archives playing a crucial role. The digital environment, Mr. Chair, also presents a fair share of challenges. These include as IFLA, CLA, EIFL, IAB, the Karisma Foundation and others have also stated- multiplicity and complexity of licenses to be negotiated with various rights holders, the mandated use of particular platforms by publishers, difficulties in obtaining copyright clearances and limitations on remote access to name a few. Additional challenges are placed by technological measures of protection, (something that we also spoke about in our submission at the previous session of this Committee; where technological measures of protection often placed on master copies of files obtained by libraries and archives prevent basic preservation activities such as file format migration and limit the ways in which end users can utilize the work in question, rendering redundant, fair use or fair dealing provisions.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Therefore, Mr. Chair, we are of the opinion that an international legal instrument addressing the challenges faced by libraries and archives in the digital environment is necessary and the way forward for members of this Committee- and existing mechanisms in national laws of those nations that do have them are insufficient.&lt;/p&gt;

    <title>Statement of CIS, India, on the WIPO Broadcast Treaty at the 22nd SCCR</title>

        &lt;b&gt;The twenty-second session of the Standing Committee on Copyright and Related Rights is being held in Geneva from June 15 to June 24, 2011. Nirmita Narasimhan and Pranesh Prakash are attending the conference. CIS delivered its statement, on the Broadcast Treaty, and made it available in print form as well.&lt;/b&gt;
        &lt;p&gt;The Centre for Internet and Society would like to associate itself with the comprehensive statement made by the Electronic Frontier Foundation (EFF). &amp;nbsp;We are one of the signatories of the joint statement, which EFF referred to, of the many civil society non-governmental organizations, cable casters and technology companies opposing an intellectual property rights based Broadcasting Treaty.&lt;/p&gt;
&lt;p&gt;We believe that the protection that may be afforded to broadcasters under existing international treaties, including &lt;a class="external-link" href="http://www.worldtradelaw.net/uragreements/tripsagreement.pdf"&gt;Article 14 of the TRIPS Agreement&lt;/a&gt;, are sufficient to safeguard the interests of broadcasters, and that the Broadcast Treaty, which has been under discussion for more than a decade without any progress is, as the WIPO Chair observed in the conclusion to the informal summary prepared after the 16th SCCR (SCCR/17/1/inf), an expenditure of "time, energy and resources to no avail". Without prejudice to that position, we would like to make a few points on the content of the treaty as well.&lt;/p&gt;
&lt;p&gt;There has been talk of ensuring a technology-neutral approach. &amp;nbsp;While a technology-neutral approach is useful since technology keeps changing, we believe that that necessarily means the differences between different technologies should be recognized. The capital costs and investments of traditional &amp;nbsp;broadcasters, which are—as has been highlighted in the many statements here today—the basis on which broadcasters' rights are demanded, are not in the least comparable with the capital costs and investments of webcasting.&lt;/p&gt;
&lt;p&gt;These differences have not come out adequately in the various regional seminars that WIPO helped organize, since those were mostly with traditional broadcasters and did not cover webcasters.&lt;/p&gt;
&lt;p&gt;"Communication to the public", while that is a technologically neutral formulation, is an element of copyright, and is not the same of broadcast rights, which is a related right.&lt;/p&gt;
&lt;p&gt;Any departure from a signal-based approach would require the assent of the WIPO General Assembly, which has in 2007 specifically requested for signal-based approach for the treaty.&lt;/p&gt;
&lt;p&gt;Specifically, we believe that Paragraph 16 of the WIPO Development Agenda, which relates to preservation of a vibrant public domain, will be endangered by a right being given to webcasters which is separate from the underlying content of the transmission.&lt;/p&gt;
&lt;p&gt;In this regard, we strongly support the delegations of South Africa and India, in their strong pronunciation of public interests while looking at such a treaty. We further support the delegation of Canada, for strongly emphasizing the need to allow countries the flexibility to opt-out of the provisions of the treaty for certain forms of broadcasting.&lt;/p&gt;

    <title>Statement of CIS on the Work of the Committee in the 21st SCCR</title>

        &lt;b&gt;The twenty-first session of the Standing Committee on Copyright and Related Rights was held in Geneva from 8 to 12 November 2010. Nirmita Narasimhan attended the conference and represented the Centre for Internet and Society.&lt;/b&gt;
        &lt;p&gt;The Centre for Internet and Society is pleased to note the collective intent on the part of member states to find a solution to the lack of accessible reading materials for persons with print disabilities around the world, as evidenced by the number of proposals which have been put forward since the past SCCR. It is clear that member states have been applying their minds to this problem and have presented us with several possible options, which they believe would adequately address this issue. We would however like to take this opportunity to remind them, that disability groups, from both developed and developing countries, who have been grappling with this issue for decades, have been unitedly stressing the urgent need for a legally binding international instrument as the only effective solution to achieve results at a global level.&lt;/p&gt;
&lt;p&gt;I would like to very quickly put forward a few thoughts for the consideration of this committee:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;We believe, that there should be an international treaty harmonising exceptions and limitations for access to reading materials for persons with print disabilities, and that achieving this should be the first priority for work in this committee&lt;/li&gt;
&lt;li&gt;Limitations and exceptions are important for promoting access to knowledge, encouraging creativity and furthering the overall development of humankind and hence, should be the subject matter of serious discussions at WIPO; WIPO should play an important role in the development of international copyright law to facilitate greater access to knowledge and information, especially in the context of digital technologies&lt;/li&gt;
&lt;/ul&gt;
&lt;ul&gt;
&lt;li&gt;Limitations and exceptions on all issues which further the development Agenda of WIPO, including exceptions for the print disabled, education, libraries and other issues, must be discussed amongst member states without delay in the forthcoming meetings of this committee&lt;/li&gt;
&lt;li&gt;We feel that there may be some merit in reserving separate sessions for discussing each issue, since this would facilitate more focused and comprehensive deliberations in an expeditious manner&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;Hence, we would like to urge member states to begin work on all these issues, ordering them on the basis of their maturity, with a view to achieving concrete outcomes, which should be informed by the collective wisdom of stakeholders affected by these instruments as to what are the ground realities prevailing in their countries.&lt;/p&gt;

    <title>Statement of CIS on the WIPO Broadcast Treaty at the 23rd SCCR </title>

Pranesh Prakash delivered this statement on a new proposal made by South Africa and Mexico (SCCR/23/6) on a treaty for broadcasters.

&lt;/b&gt;
        
&lt;p&gt;The Centre for Internet and Society would like to thank the South African and Mexican delegations for their hard work on this text before us.&lt;/p&gt;
&lt;p&gt;We wish to reiterate the statement on principles provided last SCCR by many civil society non-governmental organizations, cable casters and technology companies opposing a rights-based Broadcasting Treaty, and would like to associate ourselves with the statements made today by Public Knowledge, Computer &amp;amp; Communications Industry Association, Knowledge Ecology International, International Federation of Library Associations, and the Canadian Library Association.&lt;/p&gt;
&lt;h3&gt;Broadcasters Already Protected Online&lt;br /&gt;&lt;/h3&gt;
&lt;p&gt;Broadcasters make two kinds of investments for which they are protected.&amp;nbsp; They invest in infrastructure and they invest in licensing copyrighted works.&amp;nbsp; The first investment is protected by 'broadcast rights', and the latter investment is protected by copyright law.&lt;/p&gt;
&lt;p&gt;Broadcasters, being licensees of copyrighted works, generally already have rights of enforcement insofar as their licence is concerned.&amp;nbsp; Therefore there is no need to provide for additional protections with regard to broadcasters in order to enable them to proceed against acts that violate existing copyright laws: they already have those rights by way of licence.&amp;nbsp; This is often forgotten when talking about rights of broadcasters.&lt;/p&gt;
&lt;p&gt;The investments to be made in infrastructure in traditional broadcast and in IP-based transmission are very different, even if it is the same 'traditional broadcasters' who are indulging in both.&amp;nbsp; Given that this investment is the basis of additional protection for broadcaster over and above the rights provided to underlying copyright, IP-based transmissions should not be covered in any way even if it is traditional broadcast organizations that are engaged in them.&lt;/p&gt;
&lt;p&gt;Providing new and separate rights to large broadcasters for their online transmission, as is currently being done via the provision on 'retransmission' while excluding small webcasters will create a hierarchy and a class distinction without any basis in either principle or existing laws.&lt;/p&gt;
&lt;h3&gt;Support Countries' Concerns&lt;/h3&gt;
&lt;p&gt;We also wish to support the amendments suggested by the Indian delegation.&amp;nbsp; As we were reminded by the Indian delegation, the General Assembly mandate of 2007 only extends to traditional broadcasting and to a signal-based approach.&amp;nbsp; In this regard, we also wish to support the question posed by the United States delegation between signal-based and rights-based approaches, as also the strong statement by the Brazilian delegation on the need to ensure that cultural diversity and competition are protected and promoted by any international instrument on broadcasting, and we would like to add 'preservation of a vibrant public domain' as provided by Paragraph 16 of the WIPO Development Agenda.&lt;br /&gt;&lt;br /&gt;Thank you, Chair.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;/p&gt;

    <title>Statement by the Centre for Internet and Society on the Broadcast Treaty at SCCR 30</title>

        &lt;b&gt;The 30th Session of the World Intellectual Property Organization's ("WIPO") Standing Committee on Copyright and Related Rights ("SCCR") is underway in Geneva from 29 June, 2015 to 03 July, 2015. While CIS was unable to attend this meeting, we have the following statement to make on negotiations on the Proposed Treaty for Broadcasting Organizations.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;This statement was prepared on behalf of CIS by Nehaa Chaudhari. Many thanks to Pranesh Prakash and Amulya Purushothama for their inputs.&lt;/p&gt;
&lt;hr style="text-align: justify; " /&gt;
&lt;p style="text-align: justify; "&gt;Mister Chair,&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Our intervention will speak to the presentations made by broadcasting organizations on Day 1 and Member and Group Statements on Days 1 and 2.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;First, Mr. Chair, generally on technical panels- If &lt;i&gt;this&lt;/i&gt; is the manner in which this Committee will be appraised of new developments, without prejudice to our reservations about this ad-hoc manner itself, we &lt;i&gt;strongly&lt;/i&gt; suggest that other interest groups and stakeholders be provided a similar opportunity to present their side of the story, in front of this Committee, for one entire day. Industry representatives, including those from telecommunications, information technology, consumers electronics, and performers- and not just various public interest NGOs have been expressing reservations and concerns about this Treaty from at least as far back as 2006, if not earlier. We appreciate Group B’s ask in their introductory statement to “continue to hear the voices of the real world” – We only ask that you award all stakeholders an equivalent, if not equal opportunity to be heard in the manner that you have the broadcasters; without privileging the interests of the broadcasters above the others. There must be a recognition of the rights of other stakeholders including content owners- not just in the Treaty as noted  by India yesterday, but also in the discussions leading up to it.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Second, Mr. Chair, on Technical Background Paper document SCCR 7/8 – which you had flagged off as relevant for this session in your summary of SCCR 29 – but, of course, I stand to be corrected if I have understood incorrectly. Mr. Chair, this document is more than a decade old – it seems to have seen no updates since 2002, and even in that form, it is wanting. The document excludes from its scope the rationale for the treaty as well as the scope for protection, which we find problematic, especially given as these have been among the most contentious topics in this Committee. Additionally in only dealing primarily with the Rome Convention with but a passing reference to other international instruments, if at all, it presents an incomplete overview of the legal framework already available to broadcasters. I also have other comments to this document, which I will send in writing. We’d strongly urge that an updated version of this document be presented to this Committee so that we can have a more accurate discussion, just like the one on market and technology trends has been updated as SCCR 30/5.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Third, Mr. Chair, on the presentations and statements themselves. A reason oft cited in this Committee, Mr. Chair, has been the need to protect the underlying investment and the purported loss of revenue. From their presentations on Day 1 Mr. Chair, it seems to us that the broadcasters are doing perfectly alright &lt;i&gt;without &lt;/i&gt;a Broadcast Treaty.  Mr. Knapp for IHS in fact said that &lt;b&gt;“&lt;/b&gt;&lt;b&gt;Despite digitization, TV homes, paid TV homes are growing globally”, &lt;/b&gt;stating also, that there was a very high average revenue per user in North America and a &lt;b&gt;“double digit growth in the pay TV sector”&lt;/b&gt; in other regions, which meant a &lt;b&gt;“fairly healthy industry despite all the digital disruption side”.&lt;/b&gt; We have also heard from TV Globo who told us of the progress made in advertising and pay TV and smartphone penetration in Brazil, and from Zee Telefilms from India who spoke of a booming broadcasting industry. &lt;b&gt;&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mr. Chair, Nothing we have heard so far addresses three important questions – why is there a need for a separate right? Why are protections under the Rome Convention inadequate? While piracy might well be an issue, why can’t it be covered under existing copyright law – all of which comes down to why we’re discussing the creation of a para copyright regime for broadcasting organizations.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;From the Caribbean Broadcasting Union, we heard about emerging technologies and the challenges due to piracy. There was also a mention of significant investment – but if that is to be the basis for this treaty, we would ask that detailed reports of these investments and losses also be placed before this Committee. Also, none of this addresses the lacunae in the Rome Convention or existing international copyright law.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mr. Chair, we have repeatedly heard from Group B and the European Union on the ‘significant economic value of broadcasting’, but, this economic value has had international law recognition for a while now. While the CEBS group, Japan and Russia speak highly of technological advancements to justify the need for the Broadcast Treaty, there has still been no discussion on the inadequacy of existing international law to address these technological advancements. There needs to be something more that justifies this attempt to give broadcasters an additional layer of rights. It might be useful to conduct a comprehensive study on signal theft and piracy and the legal frameworks in every member state to deal with signal theft and piracy, and an updated study on the international legal framework as well. This Committee has precedent on such an exercise in Prof. Kenneth Crews’ study on limitations and exceptions for libraries and archives that has been tabled at this SCCR.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mr. Chair, this para copyright we’re trying to create, especially without all stakeholders being heard equally, would in effect severely limit any competition that broadcasting organizations would face from the Internet and other emerging technologies; which is undesirable for any market, besides access to free knowledge and information, as well put by the delegation of Iran.&lt;/p&gt;

    <title>State of Odia Language in Computing and Future Steps</title>

        &lt;b&gt;I participated in a "National Level Seminar on, Computer Application and Odia Language" organized by the Institute of Odia Studies and Research in Bhubaneswar on July 6, 2014 as a panelist to discuss about the state of Odia language in computing, work in progress highlighting CIS-A2K's work in the knowledge and education sector and further steps.&lt;/b&gt;

&lt;p&gt;&lt;b&gt;&lt;i&gt;ଓଡ଼ିଆ&lt;/i&gt;&lt;/b&gt;&lt;b&gt;&lt;i&gt;: &lt;/i&gt;&lt;/b&gt;&lt;b&gt;&lt;i&gt;କାଲି ଓ ଆଜି&lt;/i&gt;&lt;/b&gt;&lt;/p&gt;
&lt;p align="JUSTIFY"&gt;କମ୍ପୁଟରରେ ଓଡ଼ିଆ ଭାଷାର ବ୍ୟବହାର ଆରମ୍ଭ ହେବାର ଦଶନ୍ଧିଟିଏ  ବିତିଯାଇଛି । ଏ ଦଶନ୍ଧିର ଶେଷ ଆଡ଼କୁ ଏହି ବର୍ଷ ଫେବ୍ରୁଆରି ୨୦ ତାରିଖରେ ଉଲ୍ଲେଖନୀୟ  ଘଟଣାଟିଏ ଘଟିଲା - ଓଡ଼ିଆ ଭାଷା ଷଷ୍ଠ ଭାରତୀୟ ଭାଷା ଭାବେ ଶାସ୍ତ୍ରୀୟ ମାନ୍ୟତା ପାଇଲା  । ସାଧାରଣ ମଣିଷର ମାନସିକତା ଦୋହଲେ ଅଦିନିଆ ଝଡ଼ି କିମ୍ବା ନଈ କୂଳ ଲଙ୍ଘିଲେ । ଏ  ଶାସ୍ତ୍ରୀୟ ମାନ୍ୟତା ପାଇବା ଥିଲା ସେମିତି ମନ-ଦୋହଲେଇବା ଭଳି ଘଟଣାଟିଏ । ଓଡ଼ିଆ  ମାଧ୍ୟମରେ ପଢ଼ୁଥିବା ପିଲାଙ୍କ ମନରେ ଅଧିକ ଚାକିରି ପାଇବାର ନୂଆ ନୂଆ ଆଶାଟିଏ ଗଜୁରିଲା  । ଘରୁ ଫେରିଥିବା ପ୍ରବାସୀ ଓଡ଼ିଆ ଦୋକାନୀଟିଏ ବେଙ୍ଗାଳୁରୁ ସହରରେ ଥିବା ତା' ଜଳଖିଆ  ଦୋକାନ ଆଗରେ ଓଡ଼ିଆରେ ନାମଫଳକଟିଏ ଲଗାଇଲା । ନିର୍ବାଚନରେ ବୋଧେ ପ୍ରଥମଥର ରାଜନୈତିକ  ଦଳଟିଏ ଓଡ଼ିଆ ବିଶ୍ୱବିଦ୍ୟାଳୟର ଯୋଜନା ନିର୍ବାଚନ ଇସ୍ତାହାରରେ ସାମିଲ କଲା ।  ଫେସବୁକରେ, ୱେବସାଇଟରେ ଅନେକ ଓଡ଼ିଆ ଏ ଆନନ୍ଦର ଉତ୍ସବ ପାଳନ କଲେ । ତେବେ ଏ ସବୁରି  ଆମୋଦ ଭିତରେ ବେଳ ଆସିଛି ଆମ ଏ ଶାସ୍ତ୍ରୀୟ ଓଡ଼ିଆକୁ ଆଧୁନିକ ଜ୍ଞାନକୌଶଳର ତରାଜୁରେ  ତଉଲିବା । ଆମ ଭାଷା ଗୋଟେ ପୁରାତନ ଭାଷା, ଆଉ ତା'ର ମାନେ ନୁହେଁ ଯେ ସେ କେବଳ  ହାତୀଗୁମ୍ଫାର କାନ୍ଥରେ କିବା ଗୁଡ଼ହାଣ୍ଡିରେ ଲୁଚିରହିବ ଶିଉଳି ଗହଣରେ । ଭାଷାର ଅତୀତ  ଯେତେ ପରିପୁଟ, ତା'ର ଅଧୁନା ବ୍ୟବହାରୀଙ୍କ ଉପରେ ନିର୍ଭର କରେ ସେ କେଉଁ ଦିଗରେ  ମୁହାଁଇବ - କେବଳ ପୁରାତନ ଭାଷାର ମାନ୍ୟତା ପାଇ ଜେଜେ ହୋଇ କଣ ଘରେ ବସିରହି ଦିନ ଗଣିବ,  ନାଁ ଆଧୁନିକ କୌଶଳକୁ ଆପଣେଇ ଆହୁରି ଅଧିକ ବ୍ୟବହାରରେ ଲାଗିବ । ଏକ ଭାଷା ପାଇଁ  ସବୁଠାରୁ ବଡ଼ ସମ୍ପତ୍ତିଟି ହେଉଛି ତାକୁ ଦୈନନ୍ଦିନ ବ୍ୟବହାର କରୁଥିବା ଲୋକେ, ବିଶେଷ  କରି ତା'କୁ ପଠନ ଓ ଲିଖନରେ ବ୍ୟବହାର କରୁଥିବା ଲୋକେ । ଏ ମୋବାଇଲ, କମ୍ପୁଟର ଓ  ଇଣ୍ଟରନେଟର ଯୁଗରେ ଆମ ଭାଷା ଯଦି ଇଂରାଜୀ ସହ ତାଳ ମିଳାଇ ଚାଲି ନ ପାରୁଛି ତାହେଲେ  ଆଗାମୀ ପିଢ଼ିଟି ଯେ ଆମ ଭାଷାକୁ ସମ୍ପୂର୍ଣ୍ଣ ପାଶୋରି ନ ପକାଇବ ତାହା ଲେଖକ ହଲପ କରି  କହିପାରେ । ଆମ ଭାଷାର ଆଧୁନିକତାର ସ୍ଥିତି ନିର୍ଦ୍ଧାରଣ କରିବା ଓ ଚଳିତ କାମମାନଙ୍କ  ବିଷୟରେ ଜାଣି ଆଗାମୀ ଦିନମାନଙ୍କ ପାଇଁ ଯୋଜନାର ରୂପରେଖ ତିଆରିବା ବୋଧେ ଏ ବେଳର ପ୍ରଥମ  କାମ ।&lt;/p&gt;
&lt;p align="JUSTIFY"&gt;ଓଡ଼ିଆ କମ୍ପୁଟରରେ ବ୍ୟବହାର ଉପଯୋଗୀ ହେଲା ଟିକେ ବିଳମ୍ବରେ,  ଏକବିଂଶ ଶତାବ୍ଦୀର କିଛି ବର୍ଷ ଆଗରୁ । ବାକି ଭାରତୀୟ ଭାଷା ସେତେବେଳକୁ କମ୍ପୁଟରରେ  ଦେଖିବାକୁ ମିଳିଲାଣି । ପ୍ରାରମ୍ଭିକ କାମ ଥିଲା ଓଡ଼ିଆରେ କମ୍ପୁଟରରେ ଟାଇପ କରି  ଲେଖିବା ଓ ଆଗର ବ୍ଲକ ଟାଇପିଙ୍ଗ ବଦଳରେ ସହଜରେ ଡିଟିପି କରି ଅଳ୍ପ ସମୟରେ ଛପାଇବା । ସେ  ବେଳରେ ସେ ଥିଲା ଗୋଟେ ବିରାଟ ସଫଳତା । ତିଆରି ହୋଇଥିଲା ନାନାଦି ଫଣ୍ଟ (font) ।  ଫଣ୍ଟ ହେଉଚି କମ୍ପୁଟରରେ ଏକ ଲିପିର ଅକ୍ଷର ସଜାଣି । ଆଉ ସବୁ ଫଣ୍ଟ ଦେଖିବାକୁ ଅଲଗା  ଅଲଗା । ତେବେ ଆରମ୍ଭରେ ତିଆରି ହୋଇଥିବା ଫଣ୍ଟସବୁ ତିଆରି ହୋଇଥିଲା ଏକା ଢାଞ୍ଚାରେ -  ଇଂରାଜୀ ବା ଲାଟିନ ପରିବାରର ଅକ୍ଷରସବୁର ବଦଳରେ ଓଡ଼ିଆ ଅକ୍ଷର ଖଞ୍ଜାଯାଇଥିଲା । ଯାହା  ଫଳରେ କିବୋର୍ଡ଼ରେ ଇଂରାଜୀ ଅକ୍ଷରଟିଏ ଟାଇପ କଲେ ଆସୁଥିଲା ଓଡ଼ିଆ ଅକ୍ଷର । ତେବେ  ଏକାଧିକ ଫଣ୍ଟ ନିର୍ମାତା ଭିନ୍ନ ଭିନ୍ନ ମାନକ ତିଆରି କରିବା ଫଳରେ ଅନେକ ଗୁଡ଼ିଏ ମାନକର  ଫଣ୍ଟ - ଯେଉଁମାନଙ୍କର ନିଜ ନିଜ ଭିତରେ ତାଳମେଳ ନ ଥିଲା - ତିଆରି ହେବାରେ ଲାଗିଲା ।  ତେଣୁ ଅମୁକ ଫଣ୍ଟରେ ଲେଖା ପାଠ ସମୁକ ଫଣ୍ଟରେ ପଢ଼ିବା ଦୁରୂହ ହୋଇପଡ଼ିଲା । ତେବେ  ଅଧିକାଂଶ ଛାପା ଓ ପ୍ରକାଶନ ସଂସ୍ଥା ଆକୃତି ନାମକ ସଫ୍ଟଓଏରଟିଏ ବ୍ୟବହାର କରୁଥିବାରୁ  ଅଲଗା କମ୍ପୁଟରରେ ଟାଇପ ହୋଇଥିବା ପାଠ ଭିତରେ ଗୋଟେ ପ୍ରକାର ସମାନତା ଥିଲା । ତେବେ  ଏସବୁ ଫଣ୍ଟରେ ଲେଖା ପାଠକୁ ନାଁ ଇମେଲରେ କାହାକୁ ପଠାଇହେଉଥିଲା, ନାଁ ୱେବସାଇଟରେ  ବ୍ୟବହାର କରିହେଉଥିଲା, ନାଁ ଗୁଗଲରେ ଖୋଜି ହେଉଥିଲା । ଏହି ସବୁ ଅସୁବିଧାକୁ ସୁଧାରିବା  ପାଇଁ ଇଉନିକୋଡ଼ ଫଣ୍ଟ ଆରମ୍ଭ କରାଗଲା । ଏହା ଥିଲା ଅଣ-ଲାଟିନ ଲିପିମାନଙ୍କ ପାଇଁ ଏକ  ବରଦାନ । ଏଥିରେ ସବୁ ଲାଟିନ/ଇଂରାଜୀ ଅକ୍ଷର ସହିତ ସବୁ ଓଡ଼ିଆ ଅକ୍ଷର ମଧ୍ୟ ରହୁଥିଲା ।  ଆଉ ଏ ଥିଲା ଏକ ବିଶ୍ୱସ୍ତରୀୟ ମାନକ । ଅର୍ଥାତ କେବଳ ଦୁଇଟି ଓଡ଼ିଆ ଫଣ୍ଟ ଭିତରେ  ସମାନତା ନୁହେଁ, ଓଡ଼ିଆ-ଗୁଜୁରାଟୀ ଭିତରେ ମଧ୍ୟ ସମାନତା ରହିଲା । ତେବେ ଆମର ପ୍ରକାଶନ  ସଂସ୍ଥାମାନ ଏହାକୁ ବ୍ୟବହାର କରିବା ପାଇଁ ମଙ୍ଗିଲେ ନାହିଁ । କାରଣ ଥିଲା ସେମାନେ  ବ୍ୟବହାର କରୁଥିବା ଡିଟିପି ସଫ୍ଟଓଏର (ଆଡୋବି ପେଜମେକର, କ୍ୱାର୍କ ଏକ୍ସପ୍ରେସ ଆଦି)ରେ  ଓଡ଼ିଆ ଇଉନିକୋଡ଼ରେ ଯୁକ୍ତାକ୍ଷର ଆଦି ଠିକରେ କାମ କରୁନଥିଲା । ଏଣୁ ଲକ୍ଷ ଲକ୍ଷ  ପୃଷ୍ଠା ବହିର ମଲାଟ ତଳୁ ବାହାରି କମ୍ପୁଟର ଓ ଇଣ୍ଟରନେଟର ପାଠକମାନଙ୍କ ପଢ଼ାହେବାରୁ  ବଞ୍ଚିତ ହେଲା । ଏହାର ଗୋଟେ ବାଟ ଥିଲା ଡିଟିପି ପାଇଁ ବ୍ୟବହୃତ ଫଣ୍ଟକୁ ଓଡ଼ିଆ  ଇଉନିକୋଡ଼ରେ ରୂପାନ୍ତର କରି ଇଣ୍ଟରନେଟରେ ଉପଲବ୍ଧ କରାଇବା । ବିଡ଼ମ୍ବନା ଏହିକି ଯେ,  ଆମ ଖବରକାଗଜମାନେ ତା' ନ କରି ଆପଣେଇଲେ ଲେଖାକୁ ଛବି କରି ନିଜ ୱେବସାଇଟରେ, ଆଉ ଥୋକେ  ଡାଇନାମିକ ଫଣ୍ଟ ନାମକ ଆଉ ଏକ ପନ୍ଥା ଧରିଲେ । ଛବି ହେଲେ ଲେଖା ସବୁ ଯେ ଖୋଜିହେବ  ନାହିଁ କିବା ଆଉ କେଉଁ କାମରେ ବ୍ୟବହାର କରିହେବ ନାହିଁ ତାହା କହିବା ବାହୁଲ୍ୟ ।  ଡାଇନାମିକ ଫଣ୍ଟରେ ମୂଳ ସର୍ଭରରୁ ଫଣ୍ଟଟିଏ ଲୋଡ଼ ହେଇଥାଏ, ଯାହା ଫଳରେ ପାଠକର  କମ୍ପୁଟରରେ ସେ ଫଣ୍ଟଟି ନ ଥିଲେ ମଧ୍ୟ ସେ ପଢ଼ିପାରେ । କିନ୍ତୁ ନାଁ ସେ ଲେଖାକୁ କପି  କରି କାମରେ ଲଗାଇହୁଏ ନାଁ ଗୁଗଲ ସର୍ଚରେ ସେ ଆସେ । ଓଡ଼ିଶାର ପ୍ରାୟ ସମସ୍ତ ପ୍ରକାଶିତ  ପାଠ ଭିତରୁ ଅଧା ଇଣ୍ଟରନେଟରେ ଆସେ ନାହିଁ, ଆଉ ଅଧକ ଆସେ ଏମିତିକା ମୃତ ଫରମାଟରେ ଯେ  ତା'କୁ ଆଉ କେହି କାମରେ ଲଗାଇପାରିବେ ନାହିଁ । ଯଦି ପାଠକଟିଏ ନିଜ ମୋବାଇଲ କି  କମ୍ପୁଟରରେ ଅବାଧରେ ନିଜ ଭାଷା ପଢ଼ିନପାରୁଛି ତାହେଲେ ସେ କେମିତି ଯେ ଭାଷାକୁ ଜାବୁଡ଼ି  ଧରିବ ତାହା ଆଲୋଚନାର ବିଷୟ । ପାଠ ବଢ଼ିଲେ ପାଠକମାନଙ୍କୁ ଅଧିକ ପଠନର ସୁଯୋଗ ମିଳିବ,  ବିକଳ୍ପ ମିଳିବ ବାଛିବା ପାଇଁ ନିଜ ପସନ୍ଦର ବହିଟିଏ । ଆଉ ତା ଯଦି ହୁଏ ସୁବିଧାରେ  ବ୍ୟବହାର କରିହେଉଥିବା ଭଳି ସାଧନରେ ତାହେଲେ ଇଂରାଜୀ ମାଧ୍ୟମରେ ପଢ଼ୁଥିବା ଓଡ଼ିଆ ଘରର  ପିଲାଟି ବି ଓଡ଼ିଆରେ ପଢ଼ିବାକୁ ଆଗଭର ହେବ ।&lt;/p&gt;

&lt;p align="JUSTIFY"&gt;ଖାଲି ବହି ନୁହେଁ ଆମ ଖବରକାଗଜମାନ ମଧ୍ୟ ହେଲେ ଚଳନ୍ତି ଇତିହାସର  ରଥଚକ । ବହି, ପତ୍ରିକା ଆଉ ଖବରକାଗଜରୁ ତଥ୍ୟ ନେଇ ଭରିହେବ ଆମ ଭାଷାର ଉଇକିପିଡ଼ିଆକୁ ।  ଓଡ଼ିଆ ଉଇକିପିଡ଼ିଆ ଏକ ଆନ୍ତର୍ଜାତିକ ସଙ୍ଗଠନ ଉଇକିମିଡ଼ିଆର ଅଂଶବିଶେଷ । ଅନେକେ  ଇଂରାଜୀ ଉଇକିପିଡ଼ିଆରୁ ନିତି କେତେ ବିଷୟ ପଢୁଥିବେ, ହେଲେ ଥରେ ବୋଧେ ଭାବି ନଥିବେ  ଓଡ଼ିଆରେ ଉଇକିପିଡ଼ିଆ ଥିବା ବାବଦରେ । ୨୦୦୨ରୁ ଆରମ୍ଭ ହୋଇ ୨୦୧୧ ଯାଏ ସୁପ୍ତିରେ ଥିଲା  ଏହି ଅନଲାଇନ ଜ୍ଞାନକୋଷ । ତେବେ ବେଙ୍ଗାଳୁରୁଠାରେ କେତେଜଣ ଓଡ଼ିଆଙ୍କ ଉଦ୍ୟମରେ ପୁଣି  ତେଜିଲା ଆଉ କିଛି ଉତ୍ସାହୀ ଓଡ଼ିଆ, ଓଡ଼ିଶା ଓ ଭାରତର କୋଣ-ସନୁକୋଣରୁ ଏଥିରେ ଭାଗ ନେବା  ଆରମ୍ଭ କଲେ । ମାତ୍ର ୧୫ ଜଣ ସ୍ୱେଚ୍ଛାସେବୀ ଉଇକିଆଳି (ଉଇକିପିଡ଼ିଆର ସମ୍ପାଦକ)ଙ୍କ  ସମ୍ପାଦିତ ୮,୦୦୦ ରୁ ଅଧିକ ପ୍ରସଙ୍ଗରେ ଭରା ଓଡ଼ିଆ ଉଇକିପିଡ଼ିଆ ଓଡ଼ିଆ ଭାଷାର  ବିଶାଳତମ ଇନଲାଇନ ଜ୍ଞାନକୋଷ । ଜ୍ଞାନକୋଷ ଭିତ୍ତିକ ଲେଖା ବୋଧେ ଗୋପାଳ ପ୍ରହରାଜଙ୍କ  ପୂର୍ଣ୍ଣଚନ୍ଦ୍ର ଭାଷାକୋଷ ଓ ବିନୋଦ କାନୁନଗୋଙ୍କ ଜ୍ଞାନମଣ୍ଡଳ ପରେ ଆଉ ସାମୁହିକ ଭାବେ  ଲେଖାହୋଇନଥିବ । &lt;a href="http://or.wikipedia.org/"&gt;or.wikipedia.org&lt;/a&gt;ରେ  ଉପଲବ୍ଧ ଓଡ଼ିଆ ଉଇକିପିଡ଼ିଆରେ ସମସ୍ତେ ଭାଗନେଇ ନୂଆ ପ୍ରସଙ୍ଗ ଗଢ଼ିପାରିବେଓ ଆଗରୁ  ଥିବା ପ୍ରସଙ୍ଗର ସମ୍ପାଦନା କରିପାରିବେ । ଅନେକେ ଯେ ଗୁଗଲରେ ଆଉ ଫେସବୁକରେ ଓଡ଼ିଆ  ଆସୁନାହିଁ ବୋଲି ଗୁମାନ କରିବସନ୍ତି ତାକୁ ଆଣିବାର ଗୋଟେ ବାଟ ହେଲା ଉଇକିପିଡ଼ିଆରେ ନିଜ  ଅଞ୍ଚଳ, ପର୍ଯ୍ୟଟନ ସ୍ଥଳ, ନିଜ ପସନ୍ଦରେ ବ୍ୟକ୍ତିତ୍ୱ, ଆମର ଇତିହାସ ଓ ଆହୁରି ଅନେକ  ବିଷୟରେ ପ୍ରସଙ୍ଗମାନ ଲେଖିବା ।&lt;/p&gt;

    <title>Standing Committee's recommendations are at odds with Access to Knowledge </title>

        &lt;b&gt;The Indian Parliamentary Committee's report weighs on several aspects of the Indian IPR system and issues of protection and enforcement. This blog post summarily notes the observations and recommendations of the Committee on the Copyright Act, 1957 which stand to impact access to knowledge. The primary issue dealt with was the claim that copyright exceptions were affecting the publishing industry and authors. The recommendations include narrowing of copyright exceptions, barring digital storage and copying, promotion of libraries, and adopting the Berne Convention as the benchmark on limitations and exceptions. &lt;/b&gt;
        
&lt;p&gt;Last week, the Rajya Sabha &lt;strong&gt;Parliamentary Standing Committee on Commerce&lt;/strong&gt; (Committee) tabled its &lt;a class="external-link" href="https://rajyasabha.nic.in/rsnew/Committee_site/Committee_File/ReportFile/13/141/161_2021_7_15.pdf"&gt;review of the IPR regime in India&lt;/a&gt;. The Committee had initiated work in October, 2020, and during the process consulted with law firms, industry associations, and government departments.&lt;/p&gt;
&lt;p&gt;The Committee agreed with the contention of the stakeholders that limitations
and exceptions contained in section 52(1) of the Copyright Act, 1957 were
having a detrimental impact on the publishing industry and authors. In addition, the Department of Promotion of Industry and Internal Trade (DPIIT) also presented its “corrective measures” to narrow down section 52(1)(i) of the
Copyright Act – the copyright exception that had been the bone of contention in
the &lt;a class="external-link" href="https://eifl.net/blogs/course-packs-education-ruled-legal-india"&gt;DU photocopying case&lt;/a&gt;. They included 1) permitting only the making of print
copies of literary works which are available in libraries at government-owned
educational institutions, to “avoid any commercial gains from the work of
publishers”; 2) quantitatively restricting the reproduction (in cases of books)
to ten percent of the total number of pages of the book; and alarmingly also 3)
barring the storage of material in the form of scanned or digital formats.&lt;/p&gt;
&lt;div&gt;
The Committee further expressed its concerns about the conflict between
copyright holders and educational institutions caused by section 52(1)
of the Act. Section 52(1) is the provision that contains limitations and exceptions. The Committee suggested that the protection of books and works be
balanced against public accessibility of works at an affordable rate. In its
recommendation, it directed the DPIIT to amend section 52(1) to ‘facilitate’ a
fair and equitable ecosystem of literary culture. The measures suggested are: &lt;br /&gt;&lt;br /&gt;&lt;/div&gt;
&lt;ul&gt;&lt;li&gt;Permitting the copying of works only in government-owned educational institutions and storing it in libraries
for easy access to students; &lt;/li&gt;&lt;li&gt;

limitations on unrestricted copying of books and literary works and storage of copied
works in digital formats;&lt;/li&gt;&lt;li&gt;

Promotion of
establishing of community libraries and upgrading existing libraries in the country
for easy access to works of foreign publishers which are exorbitantly priced
and difficult to access;&lt;/li&gt;&lt;li&gt;National
Mission on Library, a venture of Central Government to strengthen the library
system, should be implemented at the earliest;&lt;/li&gt;&lt;li&gt;

DPIIT
to undertake a study of the Berne Convention to inform the copyright regime,
and the Berne Convention should be referred to in matters of limitations and
exceptions in the country.&lt;/li&gt;&lt;/ul&gt;
&lt;div&gt;&amp;nbsp;&lt;/div&gt;
&lt;p&gt;Separately,
the report also makes certain recommendations in respect of registration of
copyright societies and treating internet/ digital streaming platforms as broadcasters
for purposes of section 31D license.&lt;/p&gt;
&lt;p&gt;The recommendations to narrow copyright exceptions and limit digital uses of works are very concerning. It appears that the recommendations shift the financial burden of 
ensuring access to educational material on public libraries, yet at the same 
time, restrict the permissible uses of works in libraries.&lt;/p&gt;
&lt;p&gt;Since
2020, both government and Parliament have conducted separate consultations on
the IPR regime without hearing all stakeholders. In the case of the consultation
exercise initiated by DPIIT, details still have not been made public. In the
Parliament’s case, it is concerning that key stakeholders and beneficiaries on education and research such as institutions, libraries, teachers, researchers etc. have not been consulted. Neither the substantive part nor the minutes discuss any research or evidence on the issues. As &lt;a class="external-link" href="https://www.bloombergquint.com/law-and-policy/a-parliamentary-standing-committee-report-that-challenges-the-fine-balances-within-the-ip-system"&gt;noted &lt;/a&gt;by
Prof. Scaria, this is hardly a balanced exercise and the report is nowhere
close to the level of rigor and depth expected from a Parliamentary Standing
Committee.&lt;/p&gt;
&lt;p&gt;&lt;/p&gt;

    <title>Standard Essential Patents on Low-Cost Mobile Phones in India: A Case to Strengthen Competition Regulation?</title>

        &lt;b&gt;The realization of the promise of the sub hundred dollar mobile device as a facilitator of access to knowledge is contingent inter alia on its availability in the market place. In turn, the market availability of the sub hundred dollar mobile device is influenced by the existence of an enabling environment for producers to produce, and consumers to consume. From a regulatory perspective, the enabling environment itself is a function of existing laws and policies, and the ‘developmental effects’ of certain laws and policies (Saraswati, 2012).&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;This article seeks to examine one such legal and policy lever and the role of a regulator in the development of an enabling environment for access to sub hundred dollar mobile devices. This paper is founded on four assumptions: first, that access to sub hundred dollar mobile devices is influenced by their price; second, that the question of access necessitates conversation between the intellectual property regime and several other actors, sites and tools; third, that one of the fundamental goals of regulatory reform is the creation of a ‘stable, open and future- proof environment’ (Guermazi and Satola, 2005) that encourages access to these devices; and fourth, that there exist public law implications of intellectual property that justify the involvement of State actors and regulators in matters that may arise out of private transactions.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;This article will examine whether there is a role to be played by competition law in this narrative of innovation, intellectual property and access to sub hundred dollar mobile devices.  In light of increasing litigation around standard essential patents, and the inability of FRAND and International Standard Setting Organizations to find a comprehensive solution, this paper will question the efficacy of competition law as an ex post solution to a problem that might be better addressed by ex ante regulation from a specialized body.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In an attempt to address these questions, this article will examine the role of the Competition Commission of India and the Indian Judiciary. Orders of the Competition Commission will be studied from its inception till March, 2015, in order to draw conclusions about the role that the Commission identifies for itself and the nature of disputes it adjudicates. This article will also examine the role of similarly placed institutions in the United States of America as well as some member states of the European Union.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It will be argued that while Competition Law might address some of the issues arising out of litigation around standard essential patents, and might be a tool to increase access to sub hundred dollar mobile devices, its efficacy as a long term solution in light of its nature as an ex post solution, is questionable. Consequently, it might be prudent to have a conversation leaning towards exante regulation of the market place by a specialized regulator.&lt;/p&gt;
