Can Judges Order ISPs to Block Websites for Copyright Infringement? (Part 1)

In a three-part study, Ananth Padmanabhan examines the "John Doe" orders that courts have passed against ISPs, which entertainment companies have used to block dozens, if not hundreds, of websites. In this part, he looks at the theory behind John Doe orders and finds that it would be wrong for Indian courts to grant "John Doe" orders against ISPs.

The Madras High Court, in its 2012 order in R.K.Productions v. B.S.N.L.,[1] has affirmed the possibility of a suit against internet service providers (ISPs) to block access to certain webpages upon notification by the copyright owner. Though this appears to be a reasonable order at first glance, keeping in mind the fact that access to identified copyrighted works alone is targeted and not websites in their entirety, the legal basis for the same is highly questionable. In this two-part study, Ananth Padmanabhan explores the legal sanctity of these orders, especially post the coming into force of the Copyright Amendment, 2012. The first part of this study explores the genesis of John Doe orders and proceeds to examine the conceptual problems arising from tagging along website blocking orders within the broad sweep of John Doe action. This part concludes that website blocking orders against ISPs stand separately from, and cannot be justified in the same manner as, John Doe orders.

[1]. (2012) 5 LW 626. Hereinafter referred to as R.K. Productions.

John Doe Orders and their Conceptual Understanding

The concept of John Doe Orders in ex parte proceedings for copyright infringement came in due to the peculiar character of copyright piracy. Orders of this nature were being passed in jurisdictions across the world till they were, probably for the first time, passed in India in 2003. Since then, such orders have become a somewhat regular feature. In short, such orders permit the plaintiff to enforce an injunction order against unidentified / unnamed defendants, ‘John Doe’ being a generic name for such defendants. To understand the nature and mechanism of such enforcement and the various guidelines governing such orders, exploring the genesis of these orders is imperative.

In Billy Joel v Various John Does,[2] one of the earliest instances of a John Doe order, the plaintiff who was a musician and a successful recording artist, found to his annoyance that his success had spawned an underground industry that capitalised on his popularity through the sale of merchandise, usually T-shirts bearing his picture and name. These sales were carried on by unauthorised persons who showed up at his concerts with the merchandise and sold them outside the concert halls where he was performing. The plaintiff had in fact granted his recording company the exclusive right to market such merchandise, and the company was doing so inside the concert halls. Obviously, the presence of the unauthorised vendors outside the concert halls hurt the company’s sales and the plaintiff’s revenue share. This compelled him to approach the district court in Wisconsin seeking injunctive relief against various "John Does" or unidentified defendants who were carrying on the unauthorised sale of merchandise. The order was specifically sought seeking an ex parte temporary restraining order prohibiting certain unnamed persons from selling merchandise bearing the plaintiff’s name or likeness outside the Milwaukee Arena where he was scheduled to perform on that day. Thus, the order sought was confined to one particular instance and the situation demanded expedient preventive action since the concert was on the very same day.

The district court, while finding the propriety of an order against unidentified defendants "troubling", still went ahead and passed the order sought for. The court felt that the problem of the defendants’ identities would be met if the copies of the summons, complaint, and restraining order itself were to be served on all persons from whom merchandise connected with the plaintiff was seized on the night of the concert. Additionally, the court clarified that all these parties would be entitled to have their names added as parties to the cause title and even otherwise, to contest the seizures. The plaintiff had also furnished a bond to cover damages that may arise due to the awarding of such relief. The court applied the principle of ubi jus ibi remedium – where there is a wrong done, there has to be a remedy in law – while granting this relief. This is clear from the last paragraph of the judgement where the Court says : "Were the injunction to be denied, plaintiffs would be without any legal means to prevent what is clearly a blatant infringement of their valid property rights. While the proposed remedy is novel, that in itself should not weigh against its adoption by this court. A court of equity is free to fashion whatever remedies will adequately protect the rights of the parties before it."

Subsequently, various courts in the United States have granted such relief. However, most such instances of judicial intervention in cases of piracy have confined themselves to specific instances of piracy as opposed to orders of wider applicability extending to more than one instance of apprehended or real piracy. For instance, in Brockum Intern., Inc. v Various John Does,[3] the plaintiff sought a nation-wide order prohibiting the same activity in other cities visited by the popular rock band, The Who, on its national tour. The court declined to do so.

The Metallica Order

In New Zealand, the High Court has specifically applied the principle of ubi jus ibi remedium while justifying the issuance of John Doe Orders. In Tony Blain Pty.Limited v Splain and other Persons Unknown,[4] the court likened this kind of relief sought against unidentified defendants, to an order in the nature of Anton Piller remedy. The court stated that both these orders involved a common feature, being an intrusion into the privacy of the defendants. However, such an intrusion would be justified applying the maxim of ubi jus ibi remedium. According to the court, "in circumstances where it is plain that persons are infringing proprietary interests which the law recognises, or deceiving the public by way of trade in a manner which may indirectly affect the commercial interests of others, the law should, if it reasonably can, provide a remedy". Emphasising on the conduct-centric nature of these reliefs, the court held that John and Jane Does will be known by their works.

However, in its attempt to bring in some safeguards before passing such an order, the court held that it would be better in the future to bring such applications a little in advance so that amicus curiae could be appointed to represent the view point of the John and Jane Does. Further, the court observed that it was important to build into the procedure appropriate protections, including means of informing persons served with orders for injunction in clear language and simple terms what their remedies were. These remedies, in turn, would include a right to apply to the court within twenty four hours for a review of the order and a right to claim damages in an appropriate case, not merely on the basis of the usual undertaking to be given by plaintiffs, but also on the basis of the tort of misfeasance of public office. It will also be necessary for the plaintiff to file before the court, a full report verified by affidavit, of the process of execution of the particular orders.

It is thus seen that the High Court, though keen to do justice by providing a remedy that is effective enough to protect the plaintiff’s rights, also tried to mitigate the harshness of the measures proposed by bringing in some safeguards. This decision gave birth to the Metallica Order in New Zealand, the New Zealander’s equivalent of a John Doe Order. It has to be added that the nature of the order passed by the High Court in this case is very detailed and can be used as precedent, even for the requisite format, by all courts that pass similar orders.[5]

John Doe Orders in India

The decision in Tej Television Ltd. v Rajan Mandal,[6] will have to find first mention since these kind of orders against unidentified defendants hit the shores of the Indian legal landscape through this decision. Here, the plaintiff owned the Ten Sports television channel and had procured the broadcasting rights to several important sporting events including the 2002 Football World Cup matches. Being a paid channel, the cable operators had to part with royalty to the plaintiff for airing the programs broadcasted on this channel. To the plaintiff’s consternation, many local cable operators were airing these sporting events without taking licenses from the plaintiff / its authorised marketing agency. This resulted in the channel approaching the Delhi High Court and seeking, for the first time, a John Doe order against unidentified defendants. The channel had some evidence of unauthorised broadcasting of the initial matches by certain cable operators and apprehended that this conduct by more operators would not only result in revenue loss but also cause the 1377 cable operators, who had taken licenses from the plaintiff, to re-think the very necessity of doing so when they could air the sporting events in an unauthorised manner without any fear of liability. Another concern was the ease with which those who carried on the practise of unauthorised transmission could destroy any evidence of such conduct. The prayer sought by the plaintiff was an ex parte order against six named cable operators and “John Doe” orders against a further fourteen unnamed persons who, the plaintiff claimed, were wrongfully transmitting the Ten Sports channel. The order against unidentified defendants was sought to be justified on two broad grounds: (i) Section 151 of the Code of Civil Procedure, 1908, which gives courts the inherent power to evolve a fair and reasonable procedure for meeting exigent situations, and (ii) international practise in the form of John Doe orders issued by courts in various countries including the United States, United Kingdom, Canada and Australia.

The High Court refused to grant a John Doe order on the facts and circumstances of this case but also clarified that in an appropriate situation, courts could well award a John Doe order even in India. The court granted relief to the plaintiff by appointing a Court Commissioner who was authorised to visit the premises of various cable operators, and search, make an inventory, and take into custody all equipment / wires used for the broadcast of the plaintiff’s channel. The court empowered the Commissioner to take the assistance of technical experts and police officials in carrying out this order, and directed him to prepare a report after gathering evidence of cable piracy in the form of video recordings and photographs. The court also considered itself at liberty, on the basis of this report, to issue notices to all alleged violators, and after the hearing, to initiate civil and criminal action against them in accordance with law. The Court Commissioner was also empowered to issue warnings to such prospective violators though there was no mention of any contempt proceedings against the violators for ignoring the warning given by the Commissioner. Upon close examination, this order was nothing but a mild modification of the power vested in the court under Order XXVI, Rule 9 of the CPC.

Final and Interim John Doe Orders

The Delhi High Court has, in some subsequent decisions, considered the possibility of a John Doe order without expressly granting the same. In Ardath Tobacco Co. Ltd. v Munna Bhai & Ors.,[7] the plaintiff was the proprietor of a tobacco brand, “State Express 555”. Aggrieved by the conduct of the defendants who were distributing "Peacock" cigarettes in packaging and trade dress that bore deceptive similarity to that of the plaintiff’s brand, the plaintiff sought a John Doe order against all such distributors including unidentified ones. From the report, it appears that an ex parte order appointing Court Commissioners, similar to the order in Tej Television, was awarded by the High Court initially. In the final order, the court was constrained to confine the order of permanent injunction to the named defendants since the plaintiff had failed to identify any John Does and add them to the array of parties for the purpose of securing injunctive relief. The same was again found to be the case in 3M Company v A. Patel,[8] where the final order of injunction was granted only against the 2 identified defendants.

Thus, in these cases, a distinction seems to be made between the interim orders that may be passed against the unidentified defendants, and the final relief granted by the court. The principle that emerges from these decisions is that orders against unidentified defendants can only go to the extent of collecting evidence against them through search of their premises by the Court Commissioner, or with the assistance of the Station House Officer (S.H.O) as was directed in ESPN Software India Private Ltd. v Tudu Enterprises.[9] No final relief can be granted against any person who is unnamed in the array of parties as a defendant. The purpose of an Ashok Kumar order (as such orders are branded in India) is only to bring such persons on record.

John Doe Orders – Procedure and Guidelines

Recently, the Delhi High Court has enunciated, with sufficient clarity, the procedure to be followed while granting interim orders against unidentified defendants. In Luxottica S.R.L v Mr. Munny & Ors.,[10] the plaintiff which owned the popular trade mark "Ray Ban" in respect of sunglasses, sought John Doe orders from the Delhi High Court with the aim of tacking rampant piracy and counterfeiting of its products. Surprisingly, there was no exigent necessity cited by the plaintiff for justifying the grant of such an order, unlike in Billy Joel, Metallica, Brockum, or Tej Television. Piracy had been going on in the past, and it continues to occur – that was broadly the case of the plaintiff here. Despite this, the Delhi High Court went on to issue an order of ex parte injunction restraining third parties from carrying on such counterfeiting activities. Extending the powers of the Court Commissioner, the High Court held:

The Commissioners are also authorized to visit any other premises/warehouse/store where they may have reason to suspect and/or information be received that counterfeit optical sunglasses bearing the Plaintiffs trademark RAY BAN are being stored/sold/offered for sale and thereafter. In respect of such Ashok Kumar Defendants, upon the seizure of any infringing/counterfeit products, the Commissioners shall forthwith serve such Ashok Kumar Defendants with a complete set of papers and a copy of the notice and summons. The Commissioners will seize and make an inventory of all the infringing goods including packaging material, cartons, stationery, literature, dyes, blocks, moulds, etc. bearing the impugned RAY BAN trademark and sign all books of accounts including ledgers, cash books, purchase and sale records etc., and return the seized goods on suprdari to such Ashok Kumar defendants and obtain undertakings from each of them that they will produce the seized goods as and when directed by the court.

The object behind this order seems to be the prevention of any destruction of the evidence. In consonance with this object, the High Court has even made provision for return of the seized material to the unnamed defendants during the pendency of this order, and given them the option of approaching the court and vacating the ex parte order of injunction issued against them. This Luxottica decision can be considered as India’s equivalent of the Metallica Order, as it gives a clear roadmap for courts that pass such orders in the future. Considering that John Doe orders have attracted criticism on the ground that they make serious inroads into the rights of the defendant, these safeguards specifically articulated by the Court do go some way in addressing these concerns and mitigating the hardship caused to the defendants.

Website Blocking Orders

An extension of the John Doe orders discussed above is the recent spate of decisions from various High Courts blocking access to certain websites that upload, or permit the uploading of, copyrighted content such as sound recordings and cinematograph films, without authorisation from the copyright owner. The relief granted is either movie-specific but against unknown persons, or website-specific.

To give a sample of the movie-specific relief: For the foregoing reasons, defendants and other unnamed and undisclosed persons, are restrained from copying, recording or allowing camcording or communicating or making available or distributing, or duplicating, or displaying, or releasing, or showing, or uploading, or downloading, or exhibiting, or playing, and/or defraying the movie ‘DON2’ in any manner without a proper license from the plaintiff or in any other manner which would violate/infringe the plaintiff?s copyright in the said cinematograph film ‘DON2’ through different mediums like CD, DVD, Blue- ray disc, VCD, Cable TV, DTH, Internet services, MMS, Pen drives, Hard drives, Tapes, CAS or in any other like manner.[11]

Similarly, in R.K.Productions Pvt. Ltd. v B.S.N.L. & Ors.[12]an order of the above nature has been passed in respect of the Tamil film "3". There are a few more that have already been passed by the Delhi and Madras High Courts, indicating that these kind of protective orders under Or.XXXIX R.1 and 2, read with Section 151 of the Code of Civil Procedure, 1908 are well going to be the order of the day, especially when it comes to online piracy of copyrighted content.

The Indian Music Industry and a sound recording label have also approached the Calcutta High Court and obtained an order of the second kind, ie. a direction to the known defendants who are Internet Service Providers (ISPs), to block access to various websites listed in the Schedule to the Plaint, which are used exclusively for providing unauthorised access to copyrighted sound and video recordings. The order[13] is extracted below:

This is an application by the plaintiffs in aid of a suit complaining of copyright infringement. The plaintiff no. 1 and the members of the plaintiff no. 2 are the copyright owners of Hindi film songs. It is argued that the website mentioned in the prayers are posting and playing the songs, without any copyright or licence. This application is made ex parte on the apprehension that if notice of this application was served on the website they would shift their service to a different website.

In those circumstances, I pass an order of injunction in terms of prayer (a) of the Notice of Motion till further orders. I direct the respondent ISPs to indicate to the plaintiff the address of the website owner/operator referred to in the prayers.

I also make it clear that the above order of blocking should be confined to the above website only and should not otherwise interfere with internet service.

The last part of the last sentence extracted above has been emphasised as this is precisely what is happening as a consequence of the dual kind of orders discussed in this section. Though the first kind of order is, on its own terms, confined to only the film that is the subject matter of the suit, ISPs have used it to block access to entire websites in contravention of all recognised principles of network neutrality. Even in the case of the second kind of orders, there is absolutely no transparency as to how ISPs have been interpreting the order, and what websites are being targeted by them under the garb of such an order.[14] It is a well-established maxim that courts and judicial orders cannot be used as a vehicle for oppression, harassment, or to perpetrate abuse of power. This is precisely what has been witnessed since the last year in relation to the website blocking, and film-access blocking, orders passed by different courts. It is felt that legislative intervention is absolutely necessary in this field without any further delay to lay down parameters for exercise of judicial power under Section 151 of the Code of Civil Procedure, which power can otherwise be construed in any manner by any Court with little checks and balances on the possibility of such exercise of power.[15]

Conceptual Differences between John Doe and Website Blocking Orders

The most crucial point of distinction between these two types of orders is that while John Doe orders speak to the primary infringer, website blocking orders impose onerous responsibility on the ISP. John Doe orders as used in India thus far have served the purpose of a blanket search and seize mandate to gather evidence of direct infringement. As seen above, the final relief in the suit is granted only against those John Does who are subsequently identified and arrayed as parties to the main suit.[16] Website blocking orders, on the other hand, amount to granting the final relief at the interim stage itself, as access is blocked to web links hosted by unknown persons by taking recourse to the ISP.

Moreover, there is a vital difference between holding primary infringers liable and making mere conduits, such as ISPs. parties to a civil suit. The maxim ubi jus ibi remedium is clearly applicable in the former case, because the remedy is fashioned to bring on board the primary infringer and then afford him an opportunity of hearing before confirming the ex parte order against him. In the case of website blocking orders, the court straightaway directs the ISP to block access to the content, and the third party infringer is really a non-entity in the whole process as the attempt is not to bring him on board or to gather evidence. Hence, it is impermissible for an Indian court to grant an ex parte order directing the denial of access to a website or webpage by taking umbrage under its power to grant a John Doe order. However, Indian courts have done so, and the recent decision of the Madras High Court in R.K.Productions v. B.S.N.L.[17] has also affirmed the legality of such action. The court has judicially created a responsibility on ISPs that is akin to the take-down requirements thrust upon file-sharing websites, and which kicks in upon notice of infringing content given to the ISP by the copyright owner. This decision deserves serious critical evaluation, and an understanding of the different types of liability for copyright infringement is material for the same.

Wikipedia Editing as Assessment Tool in the Indian Higher Education Classroom

Getting students to create and edit Wikipedia entries in English and Indian languages can be a comprehensive assessment tool at the Bachelor’s and Master’s levels. Both levels of higher education require the demonstration of the ability to present knowledge in encyclopaedic form, which can be done by a good review of relevant literature and the showcasing of key arguments in the field.

Using the Dublin competency level descriptors,[*] we can put down what sorts of higher education skills Wikipedia editing can help evaluate. The most commonly accepted descriptors internationally are:

Demonstration of Knowledge and understanding

Applying knowledge and understanding

Making judgements

Communication abilities

Learning skills relevant to higher education

Wikipedia allows for assessing the ‘depth’ of an article which is the measure of the quality of an entry. The depth is a function of several parameters like the number of edits an article has seen, the length of discussion in the talk pages, the number of footnotes, references, hyperlinks and editors active on that page. In addition to this, providing Wiki-interlinks to key concepts within an article and categorization of articles exposes the students to a "semantic web" of interconnections between various fields of knowledge. Although, it may not be a complete substitute for the more formal modes of assessment, it provides a more rounded form of evaluation for student assessment. The ‘depth’ indicator also shows the relative significance of an article for the larger community of users, thereby providing a better model for student assessment in the long run.

Bachelor's Level

By getting students to edit on Wikipedia at the Bachelor’s Level, you can test the following, and appropriate weightage can be given to each aspect of the work:

Comprehension of the theory, concepts and processes pertaining to a field or fields of learning

Demonstration of knowledge, supported by the use of advanced textbooks and other reading materials, of one or more specialised areas

Ability to apply this knowledge and comprehension in a manner that indicates a thorough and informed approach to the work, and have competences typically demonstrated through devising and sustaining arguments

Ability to gather and interpret relevant data to inform independent judgements which include reflection on relevant social, scientific or ethical issues

Ability to communicate information, ideas, problems and solutions to both specialist and non-specialist audiences [in the case of Wikipedia, the audience would usually be a non-specialist one]

Master's Level

By getting students to edit on Wikipedia at the Master’s Level, you can test the following, and appropriate weightage can be given to each aspect of the work:

Demonstration of knowledge and comprehension that is founded upon, extends and enhances that associated with the Bachelor’s level and is at the forefront of a field of learning

Critical awareness of current problems and new insights, new tools and new processes within their field of learning (ability to do a good literature review, which can be seen through the citations provided for a Wikipedia entry)

Ability to apply their knowledge, comprehension, and critical awareness in broader or multidisciplinary areas related to their fields of study

Ability to integrate knowledge and handle complexity, to formulate judgements with incomplete or limited information, with an awareness of the social and ethical responsibilities linked to the application of their knowledge and judgements

Ability to communicate their conclusions, and knowledge, rationale and processes underpinning these, to specialist and non-specialist audiences clearly and unambiguously

Ability to reflect on one’s own writing by engaging with feedback received from a collaborative network.

Ability to form peer knowledge networks through collaboration and interaction with other contributors

Risks and Mitigation

It is helpful to be aware of the typical risks a faculty may face in using Wikipedia entries as an assessment tool.

New article creation: Wikipedias, especially the English Wikipedia, are closely monitored by thousands of volunteers from across the world. Often, articles created by new users come under a lot of scrutiny. It is advisable to first encourage the students to edit and improve the existing articles before creating a new article all by themselves. Also taking the help of an experienced Wikipedian will go a long way in mentoring the students on the nuances of the Wikipedia platform and the volunteer community that strives in good faith to preserve the quality of entries.

Copyright violation: Ctrl+c and Ctrl+v (i.e., plagiarism) is a major challenge for the higher education sector across the world. Often the students find that copy-pasting the content from various sources is an easy way of doing an assignment. On Wikipedia, plagiarism is taken very seriously and a student editor can get banned from further contribution to Wikipedia, which may de-motivate the entire class. It’s useful for the faculty to give a detailed orientation on this aspect before encouraging the students to take up writing a Wikipedia entry as an assignment. There are numerous resources (text and videos) made available by Wikimedians across the world explaining the problem of plagiarism. These could be used by the faculty.

If you are encouraging students to write an entry in an Indian language Wikipedia, special attention and support needs to be planned to train the students in typing in that particular Indian language script. Wikipedias have a useful tool called Universal Language Selector (ULS) which makes it very easy for the student to start typing in any script using the transliteration method. There is increasing support for Indian language scripts, however. You could check whether your University computer lab has Unicode compliant computers/systems. This will help the students to work offline on their assignment, if required.

One of the biggest challenges for a teacher is to get the student to see the value of taking up a Wikipedia entry as an assignment. Some of the students may see this as an additional task or extra-curricular activity and may not put in a committed effort, which could affect the goals you have set for your course. Faculties are encouraged to find various means of integrating/dovetailing the Wikipedia assignment into the curriculum or course.

Faculty may also feel this as an additional burden on them, especially in terms of evaluation of the assignment. There are various tools available to measure most of the assessment parameters set out above, which will not take much time. It is in fact possible to save faculty time if the evaluation is planned meticulously.

A pragmatic challenge for the faculty would be to deal with a scenario where the entire class submits the assignments on Wikipedia on the last day. This will not only increase burden on the faculty but can also result in a lot of plagiarism. An effective way to address this challenge is to make the Wikipedia entry assignment part of a formative assessment, whereby the student develops the entry over a period of time (e.g. one month or during the course). There are various tools through which you can track the students’ contribution continuously and share feedback with them periodically.

Wikipedia at Forefront in Christ University

Wikipedia has entered Indian undergraduate language classroom in Christ University, Bangalore. Recently the Access to Knowledge team from the Centre for Internet and Society (CIS-A2K) organized a series of events in Christ University. This blog post provides a brief analysis of the outcome.

Every year, universities worldwide and in India recognise the need to revise their curriculum to provide up-to-date knowledge for their students. Fresh topics are identified and prescribed replacing the ones which have become obsolete. As technology advances, the need for redesigning the syllabus is not just restricted to the theoretical elements of the academic programme, as the need for a paradigm shift in emphasising the practical implications of the acquired knowledge is recognised universally.

In line with this, universities and colleges across the world have introduced innovative ways of making their curriculum more contemporary than traditional and more pragmatic than academic. One of the leading examples of such initiatives was the "WikiProject Medicine" started by the University of California, San Francisco School of Medicine (UCSF School of Medicine) which aimed at making quality article writing on medical subjects a quintessential part of the syllabus completion. The result of this exercise was startling — 25,825 articles produced under the project received 189,908,947 hits — a record achievement for any Wikipedia project (Source: http://bitly.com/wikiprojmed).

Universities and colleges in India also realise that internet is a boon for educational system. Students often refer to informative websites for their projects and assignments, with Wikipedia articles topping the list of the reference resources that are easily accessible. Although English Wikipedia is more viewed and referred by the students, of late there has been an increase in both readership and voluntary editorial contributions to the Indic language Wikipedias such as Hindi, Tamil, Kannada and other language versions of Wikipedia.

Keeping in view these developments, CIS entered into a memorandum of understanding (MoU) with Christ University, Bangalore to make article writing on Wikipedia a core exercise for their continuous internal assessment of its 1600 undergraduate students. The state-of-the-art university which also has a recording studio agreed to host the first of its kind Wikipedia video tutorials in two languages — Hindi and Kannada.

During the month of December 2013, 10 videos each were recorded in both Hindi and Kannada for the respective language Wikipedia editing. While the video scripts were prepared by CIS, the students of the Christ University played an active role for the introductory videos and rendered their voices for the other video tutorials which featured various Wikipedia editing screenshots. These videos have been uploaded on the Moodle Learning platform of the Christ University website, Wikimedia Commons and the "Access to Knowledge (CIS-A2K)" Channel on YouTube.

In order to help the students assess their grasp of the knowledge disseminated in each video, each uploaded video on the Christ University website ends with a set of objective questions. Students were also given the right answers along with their scores. The questions were designed by CIS staff in consultation with Christ University professors.

During December 2013 and January 2014 separate campus ambassadors’ orientation programmes were organized by CIS for Hindi and Kannada second language students at Christ University. A training programme was also held for Urdu students. An orientation programme for Tamil students was organized by CIS at Christ University with support from noted Tamil Wikipedian Bala Sundara Raman. Similarly, an orientation programme for Sanskrit students was organized by CIS at Christ University with the support from Shubha of Sanskrit Bharati.

Beginning from January 23 to the first week of February, 2014 is the timeline for Christ University students to finish their assignments. With the video tutorial, training and orientation programmes, constant monitoring by CIS, and with support from Christ University, it is hoped that students will contribute significantly to the five different language Wikipedias — Hindi, Kannada, Sanskrit, Tamil and Urdu.

Centre for Internet and Society is a Bangalore based Non profit organization which works primarily in the broader domains ofinternet and policy research, accessibility, open knowledge and open education.

The blog post was published by India Education Diary.com on January 20, 2014.

Its Access To Knowledge program is funded by the Wikimedia Foundation and works in fostering the volunteer Wikimedia community that contributes in enhancing Wikipedia and other Wikimedia projects. Its primary mandate is upbringing Wikipedia editors by outreach, creating primary resources for sources of reference in multiple ways that lead to enrich Wikipedia.

From a technical institution, Kalinga Institute of Industrial Technology has grown to a multidisciplinary world class University. KIIT University is a world class university spread over 25 sq. km. of land accommodating 20 sprawling wi-fi campuses with 10 million sq.ft. built up area. The university has 25 constituent schools offering more than 100 programmes. Being accredited by NAAC of UGC and NBA of AICTE, KIIT has 20,000 students pursuing under graduate and post graduate studies in the fields of Engineering, Computer Application, Management, Rural Management, Law, Biotechnology, MBBS, M.D., BDS, Nursing, Fashion Technology, Cinema & Media Studies and Languages. KIIT stands out as one of the finest universities in India declared under section 3 of the UGC Act of 1956. KIIT educational conglomerate is unique in offering a wide spectrum of academic programmes from kindergarten to postgraduate level, earning it a place in the Limca Book of Records.

Wikipedia has a critical stand in academia when it comes to peer academic research. But on the other side students ofter access and use Wikipedia for their assignment work despite of the non acceptance of Wikipedia content by the teacher community. The primary reason of Wikipedia's factual errors in many Indic related articles being Wikipedia's low contribution from the global south needs more contribution. Academicians and subject experts who are in charge of building the infrastructure of providing free knowledge to everyone often were stuck because of this setback.

This led to an conjugation of subject experts and Wikimedia contributor communities to set up a system called Wikipedia Education Program (WEP) where editing, correcting and enhancing Wikipedia articles become part of the curriculum.

To begin with the students in different schools at KIIT University the local Wikipedia community with the support from CIS-A2K is going to conduct classroom Wikipedia workshops to pilot Wikipedia contribution. KIIT University would be one of world's few universities to pilot student Wikipedia contribution as part oftheir curricula in any regional language.

World' largest tribal residential institute Kalinga Institute of Social Studies (KISS) is going to initiate a project in collaboration with Centre for Internet and Society's Access To Knowledge program (CIS-A2K) to gather academic and research resources on tribal languages and diverse cultural heritage.

The report by Odisha Diary Bureau was published on January 20, 2014.

Kalinga Institute of Social Sciences (KISS) is the largest tribal residential institution in the world. It is home to over 20,000 tribal students from 64 tribes living in Eastern and North-Eastern parts of India that not only provide them accommodation, food, and free education from kindergarten to post graduation but also provide them 24/7 health care in the in-house hospital and many vocational trainings to empower them as able citizens of this nation ensuring their successful future. UNICEF in association with KISS has established a Children Development Resource Centre (CDRC) as part of the larger UNICEF-KIIT University joint initiative for the Centre for Children Studies (CCS) that aims in promoting evidence-based policy making by building a knowledge base thorough research and other development programmes on children's issues focusing on the state of Odisha.

KISS in collaboration with Bernard van Leer Foundation is currently devising education systems in native tribal languages that even do not have scripts. With over 17 Memorandum of Understanding (MoU)s and many more in process. KISS is bringing up a new stream of sustainable growth for tribals below poverty line by educating them and imparting knowledge in their own languages.

UNICEF, UNESCO, UNFPA, College of Charleson (USA), Bernard van Leer Foundation, Vedanta Foundation, NALCO Foundation, English Access Micro-Scholarship Program (Federal Govt.), Tata Institute of Social Sciences (TISS), Oracle Educational Foundation, Intel Technology, CPU Joint Volunteers (South Korea) are some of the organisations that KISS is working in tandem with to take the Indian tribal cultural diversity and heritage to the outside world by giving the aboriginal natives their space in this world.

Centre for Internet and Society is a Bangalore based Non profit organization which works primarily in the broader domains ofinternet and policy research, accessibility, open knowledge and open education.

This collaboration will bring detailed research and multilingual documentation about several aspects of tribals of India and would work as an Open Education Resources (OER) for academicians and researchers. This event is organized on 11th January 2014 atKalinga Institute of Social Studies premises at 11 am. KIITUniversity's Founder-Chairman Dr. Achyuta Samanta is going to inaugurate this project formally on this occasion.

WikiSangamotsavam, the annual conference of Malayalam Wikimedians, took place in Alappuzha, Kerala from December 21 to 23, 2013. The conference brought together around 200 Wikimedians and well-wishers from all over India.

The blog post originally published on Wikimedia Foundation's website was copy edited by Rohini Lakshane and published as an article in DNA on January 14, 2014.

The host town, Alappuzha is popularly known as the Venice of the East owing to its picturesque backwaters and canals. Alappuzha was chosen as the location for the conference in an attempt to draw attention to the region's diversity and touristic appeal, thereby increasing the town's representation on Wikipedia. A few pre-conference events including a bicycle rally, a meetup for young Wikimedians and several edit-a-thons were held.

Day 1
The first day of WikiSangamotsavam started with Wiki-Vidyarthi-Sangamam, a meetup of student Wikimedians. The digitisation of "Sri-Mahabharatham", a seven volume Malayalam epic was flagged off during the Wiki-Vidyarthi-Sangamam. Around 100 students from all over Kerala interacted with each other and learnt about Wikimedia projects in Malayalam. A Wikipedia workshop was conducted for physically impaired delegates. They were introduced to various means of accessibility by the DAISY Consortium. This session helped them learn about self-education tools, accessing knowledge platforms such as Wikipedia, and contributing in Malayalam online.

During a panel discussion on "Malayalam and Wikipedia" language and computing experts discussed the role of Wikipedia in the growth of the Malayalam language. Talks and presentations about topics relevant to Wikimedia were held in three parallel sessions.

The first day of the event also marked the Malayalam Wikipedia’s eleventh anniversary. The occasion was celebrated by cutting a cake. At the end of the day, Wikimedians entertained themselves by singing Malayalam folk songs.

Day 2
The second day started with the inaugural session. The event was inaugurated by Sashi Kumar, a media analyst and founder of India’s first regional satellite television channel.

Dr. Thomas Isaac, a former minister in Kerala, was the chief guest at the function. Mementos were given away to active Wikimedians who organised various Wikimedia events throughout 2013.

The QRpedia project was launched by Dr. Thomas Isaac at the Alappuzha lighthouse. QRpedia aims to make QR codes for tourist locations, which link to Wikipedia articles pertaining to the locations and monuments. By the start of the next year, all historical monuments and tourist destinations are set to be marked with QR codes. If successfully completed, Alappuzha would be the first town in India to be fully digitised with QR codes.

A Non-Malayalam Indic Wikimedia meetup was held for Wikimedians who contribute to Wikimedia projects in other Indic languages and English. There was a track to discuss how various collaborative projects could be built to have content creation drives for enriching Wikipedia.

Day 3
The third and final day of WikiSangamotsavam was devoted to taking Wikimedians on a boat trip amidst the flora of the Vembanad lake to experience its unique biodiversity. Experienced Wikimedians who have done extensive research on the region's biodiversity provided a guided tour onboard the boat.

The 126 acres of reclaimed wetland around the lake and its rare plant species serves as the location for a rich discussion and collaboration among bio-enthusiasts on Wikipedia. Wikimedians also discussed how to go about protecting the biodiversity of the R. Block of Vembanad lake.

The three-day long WikiSangamotsavam brought together many of the Malayalam Wikimedians under one roof and enabled them to share their best practices, ideas and visions for the future.

Global Congress On IP and Public Interest Adopts Principles for Negotiations

A recent conference on intellectual property and the public interest concluded with the adoption of public interest principles to guide international trade negotiations and international organisations.

This article by William New was published in the Intellectual Property Watch on January 6, 2014.

The Open African Innovation Research (Open A.I.R.) conference and the Global Congress on IP & the Public Interest took place in Cape Town, South Africa from 9-13 December. The conference hosted by the University of Cape Town was funded by Canada’s International Development Research Centre (IDRC), and Germany’s Gesellschaft für Internationale Zusammenarbeit (GIZ), among others.

Principles adopted at the conference included transparency, preservation of rights within international agreements such as national flexibilities, protection for internet service providers, strengthening of the public domain, and access to knowledge and to medicines.

The event included a fairly diverse representation, and not all participants necessarily signed on to the principles that emerged from the event.

According to infojustice.org, some 200 people have signed the “Global Congress Declaration on Public Interest Principles for International IP Negotiations,” which is available here.

The declaration calls for “’a positive agenda in international intellectual property law making’ which would include a more open negotiating process, respect for stakeholders’ social and economic welfare, and preserve states’ freedoms to protect access to knowledge goods,” infojustice.org said.

In particular, the declaration took aim at the Trans-Pacific Partnership agreement (TPP) being negotiated by 12 countries led by the United States. It urged negotiators of the TPP and future negotiations to ensure the “ongoing release of proposed legal provisions for public comment and maximize the ability of all interested persons and organizations to observe and participate in negotiation processes.”

Other principles, which echo debates at international organisations in Geneva, include ensuring that nations: retain sovereignty to take actions in their public interest without constraint from intellectual property rights, be able to use anti-circumvention measures without liability, and that IP enforcement measures be “reasonable and proportional.”

Additional principles called for avoiding “the creation of new dispute resolution fora parallel to, and that may conflict with, the multilateral system,” and ensuring that IP agreements are “consistent with international law, including international human rights law and the Convention on Biological Diversity.”

Finally, the declaration said: "We record our serious concerns about the closed and secretive processes being used for current international negotiations while acknowledging the efforts of some countries to promote positive proposals within them."

Statement on Global Fund IP Policy and Generics

Also at the Cape Town event, a statement was adopted raising concern over a policy being considered by the Global Fund for AIDS, Tuberculosis and Malaria that would establish tiered pricing for medicines.

“We note with growing concern the weakening of the Global Fund’s support for expanding access to safe, affordable generic medications as the answer to unaffordable essential drugs,” the statement said. “We are extremely concerned about the recent announcement of a ‘blue-ribbon Task Force’ on tiered-pricing of medicines in middle-income countries.”

In addition, the statement raised concern about a new Global Fund partnership with the International Federation of Pharmaceutical Manufacturers and Associations on “fake medicines.” It said the effort could create confusion in consumers’ minds about generic medicines. For them, the best approach would be “strong drug regulatory agencies together with effective technology transfer.”

"The Global Fund should retain its public interest focus and disentangle the interests of public health from the interests of those who claim intellectual-property over drugs," it said. "Regressive policy suggestions and public campaigns that undermine generic competition are counter to the Fund’s public mission."

Open A.I.R.

One aspect of the Open A.I.R. project is that the fellows who have been trained over the past few years now will go out and spread the word.

Seble Baraki, legal researcher at the Justice and Legal Systems Research Institute in Addis Ababa, Ethiopia, told Intellectual Property Watch, “I go and tell people what I’ve learned and see how it is going to help” on issues like health or branding to ensure high quality products.

"By being here, I think I have brought the issue of IP in my government," she said. For instance, they have a conference on law and development with the United Nations Development Programme (UNDP), and she has consistently mentioned that they should include something on development and IP. Now, they have agreed to do it, she said.

From studying in the North (Sweden), she had a certain idea about intellectual property. "Being part of this project helped me to see how to look at how to use IP from a public interest and development perspective.

Now, she said, she plans to go home and look at how it really makes a difference in her city, to see how IP can be used. Being part of this project, she added, "changed how you think about IP."

Other Highlights

The weeklong conference was packed with speakers and activities, and involved many of the leading figures in the public interest movement related to intellectual property rights. It also involved a first-time training on traditional knowledge related to IP rights.

The death of South African leader and “father” Nelson Mandela profoundly impacted the meeting. For example, a participant from Côte d’Ivoire said he was going to “live tweet” a journey through Mandela’s whole life, traveling from country to country.

Separately, Diane Peters, general counsel at Creative Commons, suggested a focus on a positive agenda, not taking away the right of another. There are ways to structure a dialogue so that everyone’s needs are addressed, she said.

“We are all part of some ecosystem,” she said, thinking and learning from the ideas of others. Limitations and exceptions are a right, Peters said. Authors should recognise that they also are re-using others’ ideas, same for the people who re-use and remix. “I’m really happy with how the dialogue-shaping is going,” she said.

Peters also said Creative Commons takes the view that their licences are not an answer to the problems of the copyright system. (CC licences include the version used by Intellectual Property Watch allowing re-use of our content for non-commercial purposes with attribution).

[Update: Creative Commons recently issued a policy statement on copyright reform].

The Struggle for Balance

Discussions during the week showed the diversity of topics and interests in fields affected by intellectual property rights. There were few vocal champions of the IP system, but there also was no blanket condemnation of it. Rather, discussions were attempts to address specific opportunities within IP, or concerns about its effects in certain cases. Not everyone held the same view and there were some debates during the week.

But given the variety and number of advocates from different sectors, such as the access to medicines and access to knowledge movements, there were some rallying cries around certain issues.

One relatively common area was the Trans-Pacific Partnership agreement (TPP), as concerns are high about raising IP protection levels without the participation of public interest groups. A speaker asserted that the United States is using the TPP to target BRIC countries (Brazil, Russia, India, China) as it did in the negotiations for the 1994 World Trade Organization Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).

There also were a number of discussions about the meaning of “open,” in issues like open access, open education, and open source. On a related note, Sunil Abraham, executive director of the Bangalore, India-based Centre for Internet and Society, said there are different types of open standards, and that using digital signatures instead of biometrics gives a decentralised system that protects human rights.

One speaker said they had been struck during the week by the need for a South-South network. Another asked how developing countries can use IP frameworks that have been predetermined in the North and that are not appropriate.

Participants repeatedly expressed positive attitudes about such a large and high-energy gathering (which the beautiful setting did nothing to diminish), allowing endless networking opportunities. But there was an urgency about the gathering for many, as global efforts to strengthen the IP system are working against their goals.

“We are seeing an assault on pretty much every single level,” one public health advocate said at the closing session. “Even when we win” and are able to advance the cause for access to medicines, the judges have been trained by the North (meaning with a pro-IP slant) and “turn the whole thing over.”

George Washington University Prof. Susan Sell described the “forum-shifting” that occurs with forces seeking to strengthen global intellectual property rules, as they seek international organisations where they can effect change in their favour. She likened it to a “cat and mouse” situation. She also said that IP policy is not an end in itself, but is public policy.

A participant from Jordan said that country did not play “cat-and-mouse” very well as when it signed its bilateral free trade agreement with the United States it took in all the bad aspects of the US copyright law.

Another speaker said the IP system does not encourage innovation for need but rather innovation for profit. He said governments in countries with strong rights holders are “captured,” and that governments need to be recaptured. He said organisations like the Gates and Clinton foundations are promoters of strong IP protection. Developing countries, activists, need to stop being the mouse, he said, and “start becoming the dog that chases the cat.”

“How do we forum-shift to all of the spaces we can win,” another speaker asked later, “[and] push the IP maximalist agenda to where we are not always on the defensive?”

“We are seeing an assault on pretty much every single level,” said a third. “Even when we win and are able to insert an agenda for [access to medicines], the judges have been trained by the North and turn the whole thing over.”

The mood, as Sell characterised it, is that “we can never stop and congratulate ourselves too much, because it just keeps coming.”

The annual event will continue next December, this time in Kuala Lumpur.

Social media is set to grow in India in a big way with Google and Facebook gearing up to tap the regional languages market.

The interview was published in the Tribune on January 12, 2014.

The programme director of Access to Knowledge at the Centre for Internet and Society, Bangalore, T Vishnu Vardhan is leading the growth of Wikipedia and Wikimedia projects in Indian languages as part of grant from the Wikimedia Foundation. His experience spans across academics, industry (media) and not-for-profit sectors. He talks about the spread of the Internet and social media in India and their impact on the traditional media. Excerpts:

How powerful are the Internet and social media today?

One way to answer the question is to throw some data. There is 83 per cent of mobile connectivity, so and so per cent of Internet connectivity over computer in India, and so on. The data is important to understand the extent of penetration of digital technology in India, particularly through the mobile telephone rather than the PC-based or laptop-based access to the Internet.

When you say mobile phones, are you talking about smartphones?

These could be smartphones or feature-phones also. So many feature-phones are available in the market now. These phones do not cost much. Hardware, therefore, is not going to be anymore a deterrent for access to Internet. I have seen the elderly also getting accustomed to using computers so they can keep in touch with their children who live abroad.

What about social media and its power in India?

It is very powerful. At least it is believed to be powerful because right from political parties and politicians to small vendors, all are trying to leverage it. During the last five years, there has been a tectonic shift in this regard. It will be very interesting to see how the story unfolds in India.

What is unique about India?

Social media is set to become bigger and bigger in India with companies like Google and Facebook gearing up to tap the regional languages market.

Is English increasingly becoming strong and all pervasive in India?

I would believe it and get worried on that score. But the Internet is bringing in a lot of changes. Font problem has been solved too. The ramification of what takes place when this new regional language enabled market comes on board in social media platforms is still not very clear. But it is certainly going to be huge.

Whatever is happening in India now must be an old story in developed countries?

In the US and Europe, Internet penetration took place in the PC age. But we have bypassed the PC. Internet access in India through phone is growing rapidly. India is taking a completely new path for this.

Some social media websites are also trying to get into the news domain. Have you come across instances where news has been first broken in the social media?

There are many such instances. One of the Wikipedians, Kartik Naga, took some pictures of the Mumbai terror attack and posted on commons. These were available to the world much before the traditional journalists could capture images of the incident. Real-time information about tsunami also came from people.

In the West, some print publications — newspapers and magazines — have closed down because people have apparently switched over to the Internet.

The real issue here is whether traditional media wants to stick to a particular technology or it is ready to embrace a new technology for the production and dissemination of news, which is its core activity. If traditional media is averse to embracing the new technology, there will be all kinds of problems like the paper will shut down or some completely new random players will come and corner an old veteran and so on. But if the new technology is embraced, there will be new ways and means of benefiting from it. It depends on how a traditional media entity is looking at Internet and social media. In the last two or three years, we have also seen so many news stories that got made by social media. There is a buzz about social media, and traditional media picks it up and makes it even a bigger story. I do not agree with this drawing of lines between social and traditional media. I think it is a mixed media.

You mean to say there is no threat to traditional media from social media in the long run?

There is no threat. At the end of the day, production of news is not the business of people active on social media portals. Traditional media could actually thrive by the clever use of Internet and social media.

What about news that breaks in social media and is imaginary or based on rumours. What happens then?

These things do happen. People are working on finding out ways to verify news contents on social media. There are already people whose mission in life is to prevent rumour mongering on the Internet.
