Highlights
Open Access India recently released a statement to promote openness in science and research communities. CIS contributed to the text and introduced it to the participants of OpenCon 2018, Delhi. Marathi Language day is celebrated all over world on 27th February. Various events and activities were conducted by CIS-A2K in collaboration with community, institutions and government departments. Amber Sinha wrote a short series of three op-eds for Asia Times. The first article examines the debate around consent and the arguments made to discard it. The second article examines the substance of the argument of 'innovation' as a legitimate competing interest with respect to privacy. The third article looks at the two competing arms of regulation - enforcement and compliance, and how a balance of two is needed in India. Amber Sinha developed a visual guide to the story of privacy law in India and the recent judgment of Puttaswamy v. Union of India. Pooja Saxena designed and conceptualized the visual guide. CIS made a submission on the ‘White Paper of the Committee of Experts on a Data Protection Framework for India’ (“White Paper”) released by the Ministry of Electronics and Information Technology. CIS has collaborated with LabEx ICCA (Université Paris 13), UNESCO New Delhi, Centre for Social Sciences and Humanities (CSH), and Centre d'études de l'Inde et de l'Asie du Sud (CEIAS), to organise a Research Symposium on Digital Transitions in Cultural and Creative Industries in India. The symposium gathers researchers and practitioners engaging with the changing landscape of cultural and creative industries in India in the context of the rapid expansion of digital technologies and social media.

Access to Knowledge

Our Access to Knowledge programme currently consists of two projects. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

Internet Governance

As part of its research on privacy and free speech, CIS is engaged with two different projects. The first one (under a grant from Privacy International and IDRC) is on surveillance and freedom of expression (SAFEGUARDS). The second one (under a grant from MacArthur Foundation) is on restrictions that the Indian government has placed on freedom of expression online.

Welcome to the February 2017 newsletter of the Centre for Internet & Society (CIS).

We are pleased to bring you the Centre for Internet & Society's February newsletter. Previous issues of the newsletters can be accessed here.

Highlights
Submitted comments on the Vision Document 2030 published by the Department of Empowerment of Persons with Disabilities in February 2017. Our submission recommended that the vision articulate more clearly in terms of quantifiable targets what it seeks to achieve at different points of time and that these targets are not so minimally set as to undermine the aims of the Act and the national commitments outlined therein. Ting-Yi Chang wrote an article on the state of women editors in Wikipedia. In a write-up published by Your Story on February 7, Ting-Yi explored the reasons for the low percentage of women centric articles on the social media platform and how could the gender gap be bridged. In a research paper Anisha Gupta has assessed the privacy protections under 15 e-governance schemes. The paper analysed the schemes rolled out by the government, starting from 2010. Amber Sinha, Vanya Rakesh and Vidushi Marda authored a research paper that has sought to understand the most effective way of researching Big Data in the Global South. The second edition of the Internet Researchers' Conference, an annual conference initiated by CIS to bring researchers, academicians and others on a common platform to share insights and chart the way foreword was held in Bengaluru. Divij Joshi and Aditya Chawla in a report studied five Indian telecommunication companies and three Indian online service providers. The report has evaluated the practices and policies of companies which provide internet infrastructure or internet services, and are integral intermediaries to the everyday experience of the internet in India. General Data Protection Regulation (EU) 2016/679 was passed, which shall replace the present Data Protection Directive DPD 95/46/EC. This step is likely to impact the way of working for many organisations. In this light CIS requests you to take part in a survey aimed at understanding how various organisations view the changes in the Data Protection Regime in the European Union.

India has an estimated 70 million persons with disabilities who don't have access to read printed materials due to some form of physical, sensory, cognitive or other disability. As part of our endeavour to make available accessible content for persons with disabilities, we are developing a text-to-speech software in 15 languages with support from the Hans Foundation. The progress made so far in the project can be accessed here.

Highlights
The Researchers at Work programme organised the Internet Researchers' Conference 2016 (IRC16) on February 26-28. It was hosted by the Centre for Political Studies at the Jawaharlal Nehru University, and was generously supported by the CSCS Digital Innovation Fund. Subhashish Panigrahi won the Yuva Prerana Samman award. The award was conferred during the 2nd International Conclave of Odia Language (organized by Intellects, a Delhi-based progressive forum of intellectuals) at the India International Centre in New Delhi on February 20, 2016. Odisha News covered the event. Subhashish Panigrahi wrote an article for the Hoot on whether Wikipedia could revive dying Indian languages. Panigrahi stated that by encouraging content and involvement languages could be kept relevant. The article was republished by Pratham Books. Kannada Wikipedia just celebrated its 13th anniversary. As part of the WikipediansSpeak series Subhashish Panigrahi caught up with Vasanth to learn about his contributions to the Kannada Wikipedia. In the discussion Vasanth shared his long time involvement in the Wikimedia movement, and spoke about what drove him every day to edit Wikipedia and helping other fellow Wikimedians. Sunil Abraham's article on Facebook's Free Basics was published by First Post. He stated that there is more to come from TRAI in terms of net neutrality regulations especially for throttling and blocking. Nehaa Chaudhari wrote an article for the Socio Legal Review (National Law School of India University). The article seeks to examine legal and policy lever and the role of regulator in the development of an enabling environment for access to sub-hundred dollar mobile devices. In a recently published paper, Jahnavi Phalkey and Sumandro Chattapadhyay explore public initiatives in technological solutions for educating the poor and the disadvantaged in independent India. The United Nations Educational, Scientific and Cultural Organisation (UNESCO) had published a book in 2014 that examines free speech, expression and media development. The chapter contains a Foreword by Irina Bokova, Director General, UNESCO. Pranesh Prakash contributed to the Independence: Introduction - Global Media Chapter. The book was edited by Courtney C. Radsch. India should apply electronic toll collection systems to roads, and adapt road network concepts in organizing and managing communications networks wrote Shyam Ponappa in an Op-Ed published by the Business Standard.

It is my distinct pleasure to share with you the second issue of the CIS newsletter (February 2015).

Earlier this year, I joined the Centre for Internet and Society (CIS) as the Research Director. I have been fortunate to periodically work with CIS in various capacities since mid-2012, mostly focusing on the topics of open data, open access, and visual exploration of data. Most importantly perhaps for my present responsibilities, for the last year or so, I have been in communication with various projects teams at CIS and supported their efforts through workshops on research methodologies, and by discussing and co-designing their research questions and approaches.

As the Research Director, I look forward to take these works forward, along with leading the Researchers at Work (RAW) programme, which has been shaped by Prof. Nishant Shah to host an exciting range of critical research initiatives into how the Internet and digital technologies reconfigure social processes and structures, and vice versa. Please keep an eye on the newsletter for further updates from the RAW programme.

Highlights

Forbes India in an article titled " Minds that (should) matter" names Sunil Abraham as one of the Thinkers who best explain a rapidly-changing India to the world (and the world to India). Errata: This story was shared in the last newsletter but with an error, which is now rectified.

NVDA team organized three workshops during the month for training participants on using eSpeak with NVDA software. The languages covered werePunjabi,Oriya and Hindi.
The Department of Industrial Policy and Promotion (DIPP), Government of India invited comments on the First Draft of India's National IPR Policy. CIS sent its comments . CIS commended the DIPP for this initiative and appreciated the opportunity to provide comments on the National IPR Policy.

CIS sent out three different Right to Information (RTI) requests to find out more details about the constitution and working of the IPR Think Tank to draft the first national IPR Policy.
Anubha Sinha analyses the submission to the DIPP by Academia and Civil Society on the draft National IPR Policy from a public interest perspective.
In an Open Letter to the Prime Minister of India, CIS requests the Government of India to initiate the formation of a patent pool of critical mobile technologies and a five per cent compulsory license.
CIS's Access to Knowledge team (CIS-A2K) in collaboration with the Centre for Indian Languages (CILHE) at TISS, Mumbai conducted a two-day workshop at English and Foreign Languages University (EFLU) at Hyderabad on January 28 - 29, 2015. Tejaswini Niranjana captures the developments in a blog post.

Subhashish Panigrahi wrote an op-ed on the endangered languages in India. This was published by Odia daily Samaja on February 21 which is celebrated as the International Mother Language Day.
CIS-A2K team conducted the " Train the Trainer Program" (TTT 2015) at CEO Centre, Dodda Gubbi, Bangalore. About 25 delegates attended the programme.
CIS has joined an international campaign to allow anyone in the world to request whether Britain's intelligence agency GCHQ has illegally spied on them.
On January 30, 2015, Associated Chambers of Commerce & Industry of India (ASSOCHAM) held a consultation on Internet governance. A committee was set up to draft a report on Internet governance, with a focus on issues relevant to India. CIS is represented on the committee, and has provided its preliminary comments to ASSOCHAM .

As part of CIS's inquiry into 'Network Neutrality' in the developing world a set of definitions of the term from different sources was collected and published as a blog post.
Namita A. Malhotra in a blog entry examines the figure of the pornographer, as a mixed media figure entrenched in various networks of knowledge production, circulation and consumption.

Accessibility and Inclusion

Under a grant from the Hans Foundation we are doing two projects. The first project is on creating a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India. CIS in partnership with CLPR (Centre for Law and Policy Research) compiled the National Compendium of Policies, Programmes and Schemes for Persons with Disabilities (29 states and 6 union territories). The publication has been finalised and is being printed. The draft chapters and the quarterly reports can be accessed on the project page. The second project is on developing text-to-speech software for 15 Indian languages. The progress made so far in the project can be accessed here.

Training of the use of eSpeak Punjabi with NVDA (Organized by NVDA team; Asha Kiran Training Institute, Chandigarh; February 20-21, 2015). The workshop was inaugurated by Shri Tilak Raj, Director, Ministry of Social Justice and Empowerment, Government of Punjab.

Access to Knowledge

As part of the Access to Knowledge programme we are doing two projects. The first one (Pervasive Technologies) under a grant from the International Development Research Centre (IDRC) is for research on the complex interplay between pervasive technologies and intellectual property to support intellectual property norms that encourage the proliferation and development of such technologies as a social good. The second one (Wikipedia) under a grant from the Wikimedia Foundation is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

►Pervasive Technologies

As part of the Pervasive Technologies project, Rohini Lakshané wrote an Open Letter to India's Prime Minister, Shri Narendra Modi for creation of a patent pool of critical mobile technologies. And as part of broader Access to Knowledge work CIS submitted comments to DIPP on the National IP Policy.

2015 Opensource.com Community Awards : Every year, Opensource.com awards people from our community who have excelled in contributing and sharing stories about open source. Subhashish Panigrahi from the CIS-A2K team won the award under the category 'People's Choice Awards'.
CIS-A2K team also published the Telugu Wikipedia Stats tables. Most metrics have been collected from a partial dump (aka stub dump), which contains all revisions of every article, meta data, but no page content.

Highlights
-------------------------------

We published revised chapters for the states of Mizoram, Dadra and Nagar Haveli, Himachal Pradesh and Haryana, as part of our National Resource Kit project.
In the concluding blog post of a three-part study Ananth Padmanabhan looks at the Indian law in the Copyright Act and the Information Technology Act, and concludes that both those laws restrain courts and private companies from ordering an ISP to block a website for copyright infringement.
Telugu Wikipedia celebrated its 10^th anniversary. An event was co-organized in Vijaywada to celebrate the same.
The second Institute on Internet and Society was held in Pune from February 11 to 17. The proceedings from the workshop are captured in a blog post.
CIS announced an Open Call for Comments for the latest draft of the Privacy Bill, 2013 prepared by Bhairav Acharya.
Forbes India published its “30 Under 30 List”. Pranesh Prakash is featured in the list.
As part of the Making Change Project, Denisse Albornoz wrote a blog post that compares the production behind a performance with the process of storytelling.

As part of our project (under a grant from the Hans Foundation) on creating a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India, we bring you draft chapters for the states of Mizoram, Dadra and Nagar Haveli, Himachal Pradesh and Haryana. With this we have completed compilation of draft chapters for 35 states.

CIS is doing a project (under a grant from Privacy International and International Development Research Centre (IDRC)) on conducting research on surveillance and freedom of expression (SAFEGUARDS). So far we have organised seven privacy round-tables and drafted the Privacy (Protection) Bill. Gautam Bhatia gives an analysis of the right to privacy from a constitutional perspective. Bhairav Acharya prepared an updated version of the Privacy Protection Bill which was published for comments.

The Centre for Internet & Society (CIS) wishes you a great year ahead and welcomes you to the second issue of its newsletter for the year 2013. In this issue we bring you an overview of our research programs, updates of events organised by us, events we participated in, news and media coverage, and videos of some of our recent events.

Memorial

Rahul Cherian, an expert and policy activist in disability law, intellectual property and technology law passed away due to an illness while on a visit to Goa on February 7, 2013. Rahul was the founder of the Inclusive Planet Centre for Disability and Policy, and a fellow at CIS. He was also a partner at IndoJuris Law Offices in Chennai and was one of the experts who drafted the Treaty for the Visually Impaired currently being negotiated at the World Intellectual Property Organization. The Hindu (February 8, 2013), First Post (February 8, 2013), Legally India (February 7, 2013), and Bar & Bench (February 8, 2013) covered this story. Lawrence Liang wrote an obituary page, A Lightness of Spirit (The Hindu, February 9, 2013) and Nishant Shah wrote a column One For All (Indian Express, February 17, 2013).

CIS organised a memorial function for Rahul Cherian at the TERI, Southern Regional Centre in Bangalore on February 28, 2013.

Accessibility

CIS is doing two projects in partnership with the Hans Foundation. One of this is to create a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India and another is for developing a screen reader and text-to- speech synthesizer for Indian languages. CIS is also working with the World Blind Union and many other organisations to develop a Treaty for the Visually Impaired helped by the WIPO:

National Resource Kit for Persons with Disabilities

Anandhi Viswanathan from CIS and Manojna Yeluri from the Centre for Law and Policy Research are working in this project. Draft chapters have been published. Feedback and comments are invited from readers for the chapters on Bihar and West Bengal:

The Bihar Chapter (by Manojna Yeluri, February 14, 2013): The state of Bihar is in the process of formulating a comprehensive state policy on disability. The Bihar State Policy on Disability is an extension of the National Policy for Persons with Disabilities and is currently in a draft form awaiting government approval and notification.
The West Bengal Chapter (by Anandhi Viswanathan, February 28, 2013): The state of West Bengal has issued the West Bengal Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Rules, 1999 to implement the provisions under the central Persons with Disabilities (Protection of Rights, Equal Opportunities and Full Participation) Act, 1995.

Access to Knowledge

The Wikimedia Foundation awarded CIS a two year grant of INR 26,000,000 to support and develop the growth of Indic language communities and projects by community collaborations and partnerships. This is being carried out by the Access to Knowledge team based in Delhi. CIS is also doing a project (Pervasive Technologies) on examining the relationship between production of pervasive technologies and intellectual property. The project researches upon the noteworthy opportunities of the new types of low cost mobile devices, content and services as available in the market.

Wikipedia

Beginning from September 1, 2012, Wikimedia Foundation awarded CIS a two-year grant of INR 26,000,000 to support and develop free knowledge in India. The A2K team consists of four members based in Delhi: T. Vishnu Vardhan, Nitika Tandon, Subhashish Panigrahi and Noopur Raval, and one new team member Dr. U.B. Pavanaja who works from Bangalore office.

New Team Member

Dr. U.B. Pavanaja joined the A2K team as Programme Officer, India Language Initiatives on February 19, 2013. Dr. Pavanaja holds a Master’s degree from Mysore University and Ph.D. from Mumbai University. He was a scientist at Bhabha Atomic Research Centre, Mumbai, for about 15 years. He is one of the earliest editors of Kannada Wikipedia. He has to his credit many firsts, viz., first Kannada website, first Kannada online magazine, first Indian language (Kannada) website to receive Golden Web Award, first Indian language (Kannada) editor for Palm OS, first Indian language (Kannada) editor for WinCE device (HP Jornado 720), first Indian language version (Kannada) of universally popular Logo (programming language for children) software, etc. His Kannada logo won the Manthan Award for the year 2006. He was a member of the technical advisory committee setup by the Govt. of Karnataka for Standardization of Kannada on Computers (2000). He is also a member of the Kannada Software Committee of Govt. of Karnataka (2008-current).

Internet Access – Knowledge Repository

CIS in partnership with the Ford Foundation was executing the telecom knowledge repository project which included producing and disseminating modules on various aspects of telecommunications including policy, regulations, infrastructure and market. However, from November 2012 there was a change in the mandate of the project. The new repository will cover the history of the internet, technologies involved, principle and values of internet access, broadband market and universal access. It will also touch upon various polices and regulations which has an impact on internet access and bodies and mechanism which are responsible for formulation policies related to internet access. The blog posts and modules will be published in a new website: www.internet-institute.in.

Upcoming Event

We are hosting an “Institute on Internet and Society” in collaboration with the Ford Foundation India, which is to be held from June 8, 2013 to June 14, 2013. Call for registration and relevant details will be announced soon on our website.

Telecom

While the potential for growth and returns exist for telecommunications in India, a range of issues need to be addressed. One aspect is more extensive rural coverage and the other is a countrywide access to broadband which is low. Both require effective and efficient use of networks and resources, including spectrum:

Welcome to the Centre for Internet and Society newsletter! In this issue we bring you the updates of our research, events, media coverage and videos of the events organized by us during the month of February 2012!

Accessibility

Around 70 million disabled persons in India are unable to participate in information societies as lack of compliance with accessibility standards make interfaces impossible to use, and retrograde copyright and patent policies make it impossible to access knowledge. Accessibility is denied in banking services, web and mobile interfaces, etc. Material for the disabled therefore needs to be converted into accessible formats. The programme has resulted in outputs such as Web Accessibility Policy Making, Making Mobile Phones and Services Accessible for Persons with Disabilities, Accessibility Policy Making: An International Perspective, e-Accessibility Policy Handbook for Persons with Disabilities, Universal Service for Persons with Disabilities: A Global Survey of Policy Interventions and Good Practices, etc.

Web Accessibility Policy Making: An International Perspective: G3ict and the Centre for Internet and Society are pleased to announce the publication of a new, improved edition of the Web Accessibility Policy Making: An International Perspective. The report published in cooperation with the Hans Foundation provides an updated synopsis of the many policies that governments have implemented around the world to ensure that the Internet and websites are accessible to persons with disabilities.

Event

ITU Tutorial on Audiovisual Media Accessibility (India International Centre,New Delhi, March 14 to 15, 2012): At the invitation of the Centre for Internet and Society, in cooperation with the ITU-APT Foundation of India, International Telecommunication Union is organizing a two-day Tutorial on Audio Visual Media Accessibility. The Tutorial will be preceded by the fourth meeting of the Focus Group on Audio Visual Media Accessibility on March 13, 2012. The meeting will take place in the same venue and will be hosted by the Centre for Internet and Society in cooperation with the ITU-APT Foundation of India.

Access to Knowledge

With the emergence of digital technologies and the unprecedented growth of the Internet and other related technologies, intellectual property rights (IPRs) the questions of ownership and control of information have become crucial. The programme focuses on the inequitable distribution of IPR, royalty, outflows, and beneficiaries of intellectual property regimes, the lack of balance in current IPR regimes [local, national and international] between consumer rights and IPR-owners’/corporation’s rights. The programme has produced analyses such as WIPO Treaty for the Print Disabled, WIPO Broadcast Treaty, Copyright Amendment Bill and Parallel Importation of Books.

Openness

The advent of the Internet has radically defined what it means to be open and collaborative. Even the Internet is built upon open standards and free/libre/open source software. The broad rubric of the ‘Openness’ programme focuses to provide evidence based research that will help inform policy and practice of the local, national, regional, bilateral and international policies and practices around Open Government Data, Open Access to Scholarly Literature, Open Access to Law, Open Content, Open Video, Open Standards and Free/Libre/Open Source Software. The programme has resulted in reports such as Open Government Data Study, Online Video Environment in India, a reader on the Wikipedia titled Critical Point of View: A Wikipedia Reader and a film titled People are Knowledge – Experimenting with Oral Citations on Wikipedia.

Internet Governance

Governments and private corporations are engaging in human rights violations online. Many different rights are impacted by internet governance policy changes. The growing phenomenon of illegal electronic surveillance by state and non-state actors and censorship of speech online are some specific problems that the Internet Governance programme seeks to address by providing evidence based research that will help inform policy and practice of the local, national, regional, bilateral and international privacy regime in the interests of the public in sectors key to information societies with a particular focus on information technology, privacy and freedom of expression. The programme has resulted in outputs such as Banking, Telecommunications, Consumer Protection, IT Act, Limitations, Copyright, Internet Protocol, Media, Sexual Minorities, UID and policy submissions such as, NIA Bill, IT Act, National Policy on Electronics, Cyber Café Rules, Security Practices Rules, and Intermediary Due Diligence Rules.

All India Privacy Symposium: (India International Centre, New Delhi, February 4, 2012): Experts gathered in Delhi for a public symposium on privacy, transparency, e-governance and national security in India. The event was organized by Privacy India in partnership with the International Development Research Centre, Canada, Privacy International, UK, Commonwealth Human Rights Initiative and Society in Action Group, Gurgaon. Digital Natives with a Cause? is a knowledge programme initiated by the Centre for Internet and Society, India and Hivos, Netherlands. It is a research inquiry that seeks to look at the changing landscape of social change and political participation and the role that young people play through digital and internet technologies, in emerging information societies. February 11: The Day We Fight Back Against Mass Surveillance

The expansive surveillance being perpetuated by governments and corporations is the single biggest threat to individual liberties in the digital age.

The expanding scope and extent of massive data collection and surveillance undertaken by bodies like the USA’s National Security Agency compromises our privacy and stifles our freedom of speech and expression in its most vital public spheres, affecting the civil liberties of citizens of countries all across the world.

The previous year has been a watershed year for reclaiming the internet as a free and open space, primarily through the exposure of the unwarranted systems of surveillance that threaten it, by whistle-blowers like Edward Snowden and WikiLeaks. Despite all these efforts, they have only managed a dent in the surveillance regimes, which continue unbridled, with the protection of the state and the surveillance industry. The future of a free internet depends upon the systematic challenge of these programs by the millions of internet users they affect.

February 11, 2014 is the day we fight back against mass surveillance. Organized by the Electronic Frontier Foundation, and supported by thousand of organizations like Mozilla and the Centre for Internet and Society, on this day of action, citizens around the world will demand an end to these programs that threaten the freedom of the internet. You can support this cause by signing and supporting the 13 Principles (International Principles on the Application of Human Rights to Communications Surveillance), and contacting your local media, petitioning your local legislators and telling your friends and colleagues about the topic. Publicizing the movement and creating a buzz around it will help spread the message to many others across the internet. FB & Google have already monopolised Indian cyberspace

In an interview with Catch, Sunil Abraham, executive director of Center for Internet & Society, puts the recent US-India cyber relationship framework into perspective. Abraham also talks about how Indian surveillance policies are outdated and why the country has failed to check the hegemonic tendencies of companies like Facebook and Google.

US-India signed a cyber relationship framework earlier this month. Could you explain some of the takeouts that may have important implications in the near future?

In the framework, both sides have made a "commitment to the multi-stakeholder model of Internet governance" - in immediate practical terms that means India will accept the Internet Assigned Numbers Authority (IANA) transition proposed for the Internet Corporation for Assigned Names and Numbers (ICANN). Unfortunately, as my colleague Pranesh Prakash points out "U.S. state control over the core of the internet's domain name system is not being removed by the transition that is currently underway."

India along with Brazil and other emerging powers should have insisted that the question of jurisdiction be addressed before the transition. We must remember, that the multi-stakeholder model is just a fancy name for open and participatory self-regulation by the private sector. While the multi-stakeholder model is useful as a complement to traditional state-led regulation, it cannot be used to protect human rights or ensure the security of a nation state.

[That is precisely why - the very next sentence in the announcement for the the framework for the US-India Cyber Relationship says "a recognition of the leading role for governments in cyber security matters relating to national security". This is because ICANN-style multistakeholderism requires all stakeholders to be on "equal footing" without "distinct roles and responsibilities". In other words, the governments are saying that the multistakeholder model is fine for all Internet Governance areas with the exception of Cyber Security. Given the limits of the multistakeholder model this is indeed the wise thing to do. Since American corporations dominate the Internet, US foreign policy has historically pushed for the multistakeholder model as fig leaf for forbearance and reduced foreign regulatory burden American corporations operating in other jurisdictions. Therefore India must not drink the multistakeholder cool-aid whole sale. It cannot afford a laissez-faire approach where it waits for corporations to self-regulate - it must regulate whenever public interest or human rights are harmed. In other words, it must go beyond the multistakeholder model and produce appropriate regulation where necessary. Needless to add - it must also deregulate in areas where harms don't exist. Apart from this many of the details of the announcement are positive steps that will increase security in India and the USA, and indeed the also across the world.]

What are some aspects of Intellectual Property Rights that should be looked at, in the context of the framework?

There is some language around Intellectual Property Rights (IPR) that should be examined carefully too. The US corporations benefit from a maximalist IP regime. But Make in India, Digital India and Startup India all depend on flexibilities to the IP regime and therefore India should refuse signing. Trans-Pacific Partnership (TPP) obligations like the "Digital 2 Dozen" which the US is actively proselytizing across the Pacific. If we make that mistake, we will make zero progress in indigenous security research and product development and also many other areas of our economy, health sector and education sector will be severely compromised. Therefore it would be best to keep IP rights expansion and enforcement out of the framework for the US-India Cyber Relationship.

The PIL seeking a ban on WhatsApp was refused by the SC recently. Encrypted messaging services like Telegram however, have been used in the past by terror groups. What's your take on such end-to-end encryption services?

Privacy and security are two sides of the same coin. You cannot have one without the other. End-to-end encryption is the basis for online privacy. End-to-end encryption is a pre-requisite for many legitimate actions of law abiding citizens online such as commerce, banking, tele-medicine, protection of intellectual property, witness/source protection, client confidentiality etc. Therefore, banning end-to-end encryption would mean the death of individual privacy and national security.

If the government wants to promote cyber security it should promote the use of end-to-end encryption amongst law abiding citizens.

Terrorist have to be stopped through targeted profiling, surveillance and interception. Big data analytics may be useful to watch for patterns in the meta data but there is no replacement for good old fashioned police work.

Once suspects have been identified the encrypted channels can be compromised by:

Placing trojans on the end-user devices
Performing man-in-the-middle attacks and
Using brute force attacks with super computers.

Snowden's revelations have made it very clear that blanket and mass surveillance does not help foil terror attacks or stop organised crime. So far, research and government reports from across the world indicate that only a minority of terrorists use encryption. However, this situation may change.

We don't have any proper encryption policy under the IT Act yet. What's taking so long and what are the key points that any policy in this matter must include in future?

We need many different types of encryption policies. We need a policy that mandates encryption and digital signature for all government personnel and also for all government transactions. We need policies that promote research and development in cryptography and mathematics. We need to update our criminal procedure code so that encrypted communications and data can be targeted by law enforcement and used effectively in the criminal justice process.

However, we should not have any broad encryption policy that tries to regulate encryption as a technology. That would be a highly regressive move and will be impossible to enforce. That would breed contempt for rule of law.

Surveillance and the tech around it has been contentious for various governments. Where do we stand vis-a-vis regulating surveillance measures by the state?

Our surveillance and interception laws are outdated. They need to be modernized to deal with advancements in technology and also global developments when it comes to data protection and privacy law.

In fact, our organisation was part of a global effort called Necessary and Proportionate which identified 13 principles to modernise surveillance which are connected to various aspects such as Legality, Legitimate aim, Competent judicial authority, Integrity of communications and systems and more. Some of these principles may have to be customised for the Indian context. [For example, given the load on courts perhaps India should stay with executive authorization of interceptions and data access requests. However, getting the law correct is only half the job. For the law cannot fix what the technology has broken. Some surveillance projects are well designed. For ex. the NATGRID - from what I understand it is a standard and platform that which will allow 12 security, intelligence and law enforcement agencies to temporarily make unions of sub-sets of 21 data sources. These automated temporary databases will be created under existing data access provisions of the law. I also hope the NATGRID is also using cryptography to ensure the maintenance of a non-repudiable log that will identify all officers involved in authorizing the each request and accessing the resultant data. Unfortunately, other surveillance projects are unmitigated disasters. For example, UID or Aadhaar. Many Indians don't realize that Aadhaar is a surveillance project. Biometrics is just a fancy name for remote, covert and non-consensual identification technology. Using the UID database the government can identify every single Indian without their consent. The so called "consent layer" in the India Stack is being developed by volunteers outside the UIDAI to avoid transparency under the Right to Information Act. Nothing in the current layer of the "consent layer" allows citizens to revoke consent. There is no facility in the UID Act to delete yourself from the database. Identity information aka the UID number and authentication information aka your biometrics for about a billion Indians have been collected and stored in a centralized location. It is as if our parliamentarians have written an open letter to criminals and foreign governments says "here is the information you need to wreck whole sale damage - come and get it". Hopefully the Supreme Court will save us from this impending disaster.]

With a sluggish US market, India has the biggest potential for companies like FB & Google, next only to China. Do you feel that in the quest to take over the Indian market, FB & Google are going to monopolise cyberspace in India?

I have news for you - they have already monopolised Indian cyberspace. They have completely wiped out competition in certain domains.

One of the many reasons they have done this is because we don't have laws and regulations to temper their hegemonic tendencies. For example, we could use data portability and interoperability mandates for social media to spark competition in markets where there are entrenched monopolies.

Competition law can be used to protect other firms from abuse of market power. Consumer protection law and privacy law could be used to ensure that user's rights are not compromised in the race for market share. In addition, a modern privacy law compliant with the best practices in the European Data Protection Regulation 2016, would allow emerging Indian companies to compete with giants like Facebook and Google on a level playing field. [Speaking of level playing field - only recently has the government introduced the "equalization levy". This was long overdue. Imagine the amount of tax that could have been collected so far and damage that has been done to competition. Regardless the current NDA government deserves our kudos for ensuring that Facebook and Google contribute their fair share of taxes. The new IPR Policy was also an opportunity to address the monopoly of Google and Facebook. There should have been a concerted attempt to use free/open source software, open standard and open content to bolster Indic language technologies. A billion dollars from every spectrum auction should be used to create incentives for Indian private sector, research and academic organisation who can contribute openly to the Indic cyberspace. This is the market where we can still build a highly competitive market. Today, given government inaction - millions of Indians are training Google's language platforms every time they use machine translation or speech to text technologies. This corpus of information will not be available for public interest research. Ideally we should also have Indians contributing to commons-based peer production projects like Wikipedia for their Indic language needs. Unfortunately the government totally missed this opportunity.]

Facial Recognition Technology in India

The Human Rights, Big Data and Technology Project, University of Essex, UK and the Centre for Internet & Society (CIS) have jointly published a research paper on facial recognition technology. Authors, Elonnai Hickok, Pallavi Bedi, Aman Nair and Amber Sinha, examine technological tools such as CCTV and FRT which are increasingly being deployed by the government.

Executive Summary

Over the past two decades there has been a sustained effort at digitising India’s governance structure in order to foster development and innovation. The field of law enforcement and safety has seen significant change in that direction, with technological tools such as Closed Circuit Television (CCTV) and Facial Recognition Technology (FRT) increasingly being deployed by the government.

Yet for all its increased use, there is still a lack of a coherent legal and regulatory framework governing FRT in India. Towards informing such a framework, this paper seeks to document present uses of FRT in India, specifically by law enforcement agencies and central and state governments, understand the applicability of existing legal frameworks to the use of FRT, and define key areas that need to be addressed when using the technology in India. We also briefly look at how the coverage of FRT has increased beyond law enforcement; it now covers educational institutions, employment purposes, and it is now being used for providing Covid-19 vaccines.

We begin by examining use cases of FRT systems by various divisions of central and state governments. In doing so, it becomes apparent that there is a lack of uniform standards or guidelines at either the state or central level - leading to different FRT systems having differing standards of applicability and scope of use. And while the use of such systems seems to be growing at a rapid rate, questions around their legality persist.

It is unclear whether the use of FRT is compliant with the fundamental right to privacy as affirmed by the Supreme Court in 2017 in Puttaswamy. While the right to privacy is not an absolute right, for the state to curtail this right, the restrictions will have to comply with a three-fold requirement— first, being the need for explicit legislative mandate in instances where the government looks to curtail the right. However, the FRT systems we have analysed do not have such a mandate and are often the result of administrative or executive decisions with no legislative blessing or judicial oversight.

We further locate the use of FRT technology within the country’s wider legislative, judicial and constitutional frameworks governing surveillance. We also briefly articulate comparative perspectives on the use of FRT in other jurisdictions. We further analyse the impact of the proposed Personal Data Protection Bill on the deployment of FRT. Finally, we propose a set of recommendations to develop a path forward for the technology’s use which include the need for a comprehensive legal and regulatory framework that governs the use of FRT. Such a framework must take into consideration the necessity of use, proportionality, consent, security, retention, redressal mechanisms, purpose limitation, and other such principles. Since the use of FRT in India is also at a nascent stage, it is imperative that there is greater public research and dialogue into its development and use to ensure that any harms that may arise in the field are mitigated.

Facial recognition at airports promises convenience in exchange for surveillance

If smart technology is promising you a few hours of convenience, what is it asking you to sign away?

I was checking in for a flight, when the desk manager asked me if I would like to participate in a beta-programme that they are deploying for their frequent flyers. “No more checking-in, no more boarding passes, no more verification queues,” she narrated with a beaming smile. Given the amount of travelling I do, and the continued frustrations of travelling with a passport that is not easily welcome everywhere, I was immediately intrigued. Anything that makes the way to a flight easier, and reduces the variable scrutiny of systemically biased algorithmic checks was welcome. I asked about the programme.

It is a biometric facial recognition programme. It recognises my face from the minute I present myself at the airport, and from there on, till I am in the flight, it tracks me, locates me, offers me a visual map of my traces, and gives me seamless mobility, alerting the systems that I am transacting with, that I am pre-approved. I saw some mock-ups, and imagined the ease of no longer fishing out passports and boarding passes at every interaction in the airport. I could also see how this could eventually be linked to my credit card or bank account, so that even purchases I make are just seamlessly charged to me, and if there is ever any change of schedule or emergency, I could be located and given the assistance that would be needed. It was an easy fantasy.

I was almost tempted to sign up for it, when out came a data consent form. It was about two-pages long, with tiny print that makes you think of ants crawling on paper in orchestrated unison. I stared at those pages for a while, and turned to the manager. “How exactly does this system work?” She was startled for a second and then gave me a long, reassuring answer. It didn’t have much information, but it did have all the buzzwords in it — “machine learning”, “artificial intelligence”, “self-learning”, “data-driven”, “intuitive”, “algorithmic” and “customized” were used multiple times. That’s the equivalent of asking somebody what a piece of poetry could mean and they say, “nouns”, “verbs”, “adjectives”, “adverbs”, and “participles”.

Her answer was a non-answer. So I cut through all of it, and asked her to tell me who will collect my data, how it will be stored, and whether I will be able to see how it will be used. She pointed at the unreadable two pages in front of me, and said that I would find all the information that I need in there. I walked off to my flight, without signing on the dotted line or the consent forms, but I was surprised at how uncanny this entire experience was. I had just been asked to submit myself to extreme surveillance for a trade-off that would have saved a few hours a year in my life, and enabled some imagined ease of mobility in purchasing things. It wasn’t enough that I was going to pay money, I was also going to pay with my data.

In that fluffy dream of easy movement and transacting, I had accepted the fact that this service, which was being presented as a privilege, was an extremely invasive process of surveillance. I had also skipped the due diligence of who will use this data of my body and being, and for what purposes. When I asked for information, I was given a black box: a legal contract that is as inscrutable as it is unreadable, and empty words that pretend to describe a system when all they produce is an opaque description of concept-words. Had I not asked the couple of extra questions, and if I was not more persistent in getting actual information, I would have just voluntarily entered a system that would track, trace, and record me at a level that turns the airport into a zoo.

This is the trope that SMART technologies have perfected — trading surveillance for promised convenience. The airport is already a highly surveilled space, but when these SMART technologies enter our everyday spaces, the amount of information they collect and store about us is alarming. The possibility that every surface in the city is an observation unit, that every move we make is recorded, that our lives are an endless process of silent verifications that seamlessly authorise us, is scary. Because, by corollary, when we become deviant, unintelligible, or undesirable, the same checks can turn hostile and be used for extreme persecution and punishment. I am not a technology sceptic but I am also getting wary of smart technologies being presented as magic where we don’t need to worry about how it is done, and just look at the sleight of hand that keeps on showing us the illusion while hiding the menace.

Facebook’s Libra: A bit too ambitious?

A social network must remain a social network and first prove it is indeed one. Not a bank. Damning revelations concerning ethics, privacy and transparency notwithstanding.

For a tech giant with an exclusive window to our private lives, launching its own currency is of course the natural course, to coax us back into compliance, away from brewing skepticism.

Facebook’s sketchy white paper on Libra, its proposed virtual currency, probably drawing much from the libertarian Bitcoin, is no doubt an attempt to capitalise on the 2.4 billion users it has collected in such a short span, eventually to wield a grip on the still vulnerable global financial system gradually recovering from a crisis.

However, the brute power of big tech looms large over sovereign nation states.

In his piece in The Atlantic, professor Eric Posner of the University of Chicago Law School writes Libra will replicate all the current problems generated by Facebook. “In the name of eliminating inefficiency and injustice in the financial system around the globe, Facebook’s new cryptocurrency threatens to replay what’s become a familiar story—of tech companies blithely reshaping the world around them, and significantly increasing their power over people’s lives, while being accountable to no one,” the professor goes on to say.

Power finds ways to propagate at the slightest hint of losing lustre, which the social network is beginning to experience at the moment.

To salvage that lost credibility, Facebook has teamed up with a group of corporates including Visa, Uber, Spotify, PayPal and the like to form the Libra Association, a Geneva-based not-for-profit, just to disrupt and dominate the global economic future.

Given the social network’s massive reach, the proposal, if realised, could transform international payments. That said, the intent is suspect.

“The main concern with Facebook entering the cryptocurrency market is a question of competition law. Facebook can use its market dominance in online advertising, end-to-end encrypted messaging and social media to engage in anti-competitive behaviour, warns Sunil Abraham of The Centre for Internet and Society, a Bengaluru-based not-for-profit.

Facebook stands 90th in the world in terms of GDP, along with many other firms of such standing which would want to effect and dictate global monetary policy if the project goes ahead and realises its commercial goal, which in all likelihood is very much possible. Because, Facebook has built its applications and networks already. It doesn’t require to sign people up. Lambs for slaughter indeed.

The argument that the network puts forward of uplifting billions excluded from the financial ecosystem in the emerging world, in earnest is a genuine cause. But, one doesn’t need a brand new private currency pepped up by a big tech consortium for that. For instance, in India, where the network has at least 300 million users, Libra cannot operate within the existing norms. Moreover, a foreign private entity controlling the sovereign is rather dystopian.

“So far, India has taken quite a conservative policy towards cryptocurrencies because of concerns from a counter-terrorism and taxation perspective. It is perhaps good that policymakers were waiting and watching. Now the policy will have to address the challenge posed by Facebook entering this market,” notes Abraham.

“Cryptocurrency is ‘virtual money’ which should only be used for non-financial purposes along the lines of loyalty points, airline miles, etc. which could be exchanged for real cash transactions such as discounts. It poses the danger of fraud. If Facebook uses Libra to clock up loyalty points, that’s fine. But can’t link it to your bank account,” cautions Kiran Mazumdar-Shaw.To digress, bitcoin works as people trust it over government-regulated money. It has no reserve. It appreciates if more people are using it. Now, Facebook is offering a tweak. Unlike Bitcoin, Libra will have a reserve set up by the consortium. In short, don’t trust the government, not the liberal bitcoin, but a private entity with a reserve.
Facebook’s argument may be convincing provided the clout, security infrastructure and reach. But what is worrying is Facebook-led big tech now wants to be a virtual country, with its own economy, not having to bow down to nation states and regulators, because they think they are powerful enough to do so.
This would definitely have banks and regulators in a fix. “While Facebook might have a surveillance friendly position on KYC requirements for users, it might be in greater consumer interest for the government to ensure there is an interoperable competitive oligopoly of cryptocurrency service providers that prevent the winner takes all phenomenon,” observes Abraham.
What’s Libra anyway?
Libra is a virtual currency proposed by a Facebook-led private consortium, with a reserve, unlike the Bitcoin. That means Libra would have an initial capital funded by the consortium to help make it a stable currency such as the dollar. Users could trade globally enjoying lower costs, enhanced speed and high security - on platforms run by Facebook (Calibra) and associates. According to Facebook, Libra is intended to ensure financial inclusion. But how this will be achieved in countries like India, where the currency would not charm the people, government or regulators easily, is not yet quite clear.

Facebook, my boyfriend is lousy

On the flip side, when Savita and Vinay’s (name changed) baby was about to be born a couple of years ago, the couple’s friend live-tweeted the whole childbirth process and the proud parents didn’t mind.

Oversharing on social networks by young people can have damaging results, say internet experts. Why does it happen?

"These days youngsters hook on to social networking sites, and you cannot blame them for seeking each other’s company because that is how they are at that age. There are more restrictions on children these days because of security and abuse issues which the earlier generation may not have encountered. For example, sleepovers which were much common earlier may now not be readily allowed. Their time outside their house is also monitored. Many schools these days have surveillance cameras or some form of curbs that might restrict students from having a private interaction. That is why they seek such interactions through the internet and social networks. Still in India, there is not really a need to press the panic button saying that they are becoming Facebook addicts," says Sunil Abraham, executive director of the Centre for Internet and Society, who is an internet behaviour expert.

Sunil quotes an analysis done in Poland to show how much social networking has become a part of young people’s lives. It showed that teenage girls who meet every day in school, go back home and immediately switch on their PCs and start interacting with each other again. And all through the day, they are on Skype and can see every single thing that each one of them are doing in their rooms in their respective homes. Studies done in the Philipines demonstrate how personal life is becoming public. A study by the Institute of Philippine Culture showed that many of those assessed were on Friendster and allow full access to information on their accounts and readily share details of activities, interests and contacts.

Is the situation different in India? Bhavana, a business management graduate in her 20s, says that what she puts up on her social networking account depends solely on her state of mind. But she ensures that messages are not too personal because earlier she had put up posts which backfired.

"Sometime ago we were celebrating my brother’s birthday and some misunderstanding happened during the celebrations and I was heaped with blame by friends and relatives on FB when I tried to justify myself. I was taken aback. Now, I am more careful about posting messages about sensitive topics," she says.

And when you let people know where you are through Google Latitude, you need to watch against saying offensive things.

"There have been instances of people gate-crashing parties following a Twitter or FB post; in China, mobs of people have attacked those whose views they oppose," adds Sunil.

What makes some people, who would never dream of whipping up controversies in the real world, so reckless when they are online?

"Most often, it is a way of being noticed, of getting attention. Everyone wants to have a popular public profile and telling the world about your opinions and your activities is a way of gaining attention. But new forms of communication are being invented every other day and each has an etiquette of its own," says Sunil.

According to Dr Thomas M J, there are two kinds of people who are the net — attention-seeking and anonymous. The anonymous generally never put personal details about themselves on social networks. "But the other group consists of those who are externally controlled. For such people any open media acts as a place to talk about themselves and they love being in that public space. Moreover, social networks give internet users the courage to say whatever they want because they can avoid face-to-face contact. Even if there is a response, it is muted because because it is not direct and they can escape confrontation," says Thomas.

Facebook, Google face censorship in India

Religious leaders in India are on a collision course with social media websites including Google, Facebook and Yahoo. Two Indian courts recently asked these American companies as well as 19 other websites to take down “anti-religious” material. They are now required to report their compliance by February. Information technology minister Kapil Sibal also met with a delegation of different faith groups who are worried that certain internet content could lead to communal discord. India’s 1.2 billion people are made up of majority Hindus but it also has the third largest population of Muslims as well as large number of Christians, Sikhs, Buddhists, Jains and other faiths.

India has an estimated 100 million internet users–the third largest in the world after U.S and China. The proposed restrictions are not at all comparable to China’s but is the internet free enough for the world’s largest democracy?

Some observers are suspicious that promoting religious or social harmony is a front for censoring the internet. Sunil Abraham, head of Bangalore-based Centre for Internet and Society (CIS), said that "traditional intellectual property rights holders like movie studios, music companies and software vendors are trying to protect their obsolete business models by pushing for the adoption of blanket surveillance and filtering technologies."

"They have found common cause with both totalitarian and so-called democratic regimes across the world interested in protecting the political status-quo after upheavals like the Arab Spring, Occupy Wall Street, Anonymous and the Pirate Party," he said.

The Indian government has tried to reassure the public that it is not trying to censor. Google’s Transparency Report, however, recorded that out of the 358 items requested to be removed by the Indian government from Jan-June 2011, 255 had to do with government criticism and only a handful with hate speech.

Sibal has also been speaking to executives from Facebook, Yahoo and Google in India. But no agreement has been reached on taking down hate speech. New rules, issued in April, require internet intermediaries like Facebook and Yahoo to check for “unlawful” material and take it down.

CIS will soon be releasing a report called “Intermediary Liability in India: Chilling Effects on Free Expression on the Internet 2011." For the report, CIS conducted a sting operation by sending flawed takedown notices to seven intermediaries. The results showed that six intermediaries over-complied with the notices. "From the responses from the intermediaries don’t have sufficient legal competence or unwilling to dictate resources to determine legality of an online expression," Abraham said.

"Various pretexts like national security, protection of children, crackdown on online crime and terrorism, defense against cyber war etc are used to compromise civil liberties and clamp down on freedom of expression," he added.
