This is the case filed by UTV Software Communication against Home cable Network and other uknown network operators. restraining them from infringing the copyrights under Section 14(1) and Section 16 of the Copyright Act, 1957 for its movie '7 Khoon maaf' and 'Thank You' and the Court granted an interim injunction called 'john doe' order under Order 39 Rule 1 and Rule 3 of CPC, 1908.

Subject to the plaintiff taking steps within one week, issue summons in the suit to the defendants by ordinary process, registered cover and through approved courier, returnable on 14th July, 2011 before the Joint Registrar.
The summons to the defendants shall indicate that a written statement to the plaint shall be positively filed within four weeks of the receipt of the summons. Liberty is given to the plaintiff to file replicationand rejoinder within two weeks of the receipt of the advance copy of the written statement and reply.
In case the written statement is not filed within the time stipulated above, the same shall be taken on record only subject to imposition of heavy costs.
The parties shall file all original documents in support of their respective claims alongwith their respective pleadings. In case parties are placing reliance on a document which is not in their power and possession, its details and source shall be mentioned in the list of reliance which shall be also filed within the pleadings.
Admission/denial of documents shall be filed on affidavit by the parties within two weeks of the completion of the pleadings. The affidavit shall include the list of the documents of the other party. The deponent shall indicate its position with regard to the documents against the particulars of each document.
Learned counsel for the plaintiff submits that without prejudice to its rights, contentions and claims in the suit, his client would be willing to explore the possibility of settlement by recourse to mediation.
The summons shall indicate that it is open to the parties to access the facility of negotiating a settlement with the other side before the Delhi High Court Mediation and Conciliation Centre in the court complex. In case the defendants are so desirous of pursuing negotiations, it shall be open to them to do so. Such participation in the mediation shall be without prejudice to their rights and contentions in the suit.
In such eventuality, the defendant shall inform the plaintiff as well as his counsel of the same by a written notice. Such written notices shall be treated as consent of the parties to the mediation process.
The plaintiff and/or defendants may then approach the Delhi High Court Mediation and Conciliation Centre for facilitating mediation in the matter. Any or both of the parties shall place the copy of this order as well as the written notice before the Delhi High Court Mediation and Conciliation Centre which shall proceed in accordance with the rules of the Centre.
During the course of mediation, it shall be open to the mediator to join any other person(s) considered necessary for effective mediation and dispute resolution.
The Registry shall enclose the information brochure published by Samadhan the Delhi High Court Mediation and Conciliation Centre with the summons.
The parties shall appear before the Joint Registrar for marking of exhibits on 14th July, 2011.
The matter shall be fixed before the court for reporting outcome of the mediation/framing of issues on 15th September, 2011.
The schedule fixed by this order shall not be interdicted by the pendency of the matter in mediation. IA No. 5383/2011 (Under Order 39 Rule 1 and 2 CPC).
Issue notice, returnable on 15th September, 2011.
The plaintiff is the producer/co-producer/distributor of several movies detailed in the plaint including the film "7 Khoon Maaf" which has been recently released. It is asserted that the latest film produced by the plaintiff titled "Thank you" is to be released on 8th April, 2011.
The suit has been necessitated for the reason that the plaintiff has experienced large scale violation of its copyright in earlier films produced by it by several known and unknown cable operators who telecast pirated version of the films of the plaintiff on cable networks, violating rights of the plaintiff and causing irreparable loss and damage. A single telecast by the defendants and other operators would simultaneously reach several hundred thousand homes. As a result, the loss which results to the plaintiff is irreparable and cannot be computed in terms of money.
The plaintiff also complains that additionally the quality of the film which is telecast by these cable operators is inferior and impacts its reputation. Loss to the exchequer by way of collection of entertainment tax, etc. has been also pointed out.
Based on its past experience, it is urged by Mr. Vikas Singh, learned senior counsel for the plaintiff that an investigation was undertaken into the business being run by the defendant no.1 and extensive positive information with regard to the violation of the plaintiff?s copyright in the plaintiff's film "7 Khoon Maaf", has been received. The investigation report obtained by the plaintiff has been placed on record.
It has also been urged at great length that apart from the cable operators who have been arrayed as defendants, there are several other cable operators in the field who operate in an identical manner to cause violation of the plaintiff?s copyright. The plaintiff is not able to establish the full particulars of these persons which have consequently not been placed in the plaint. Such persons have been collectively arrayed as defendant nos.19 to 50 named as ?Mr. Ashok Kumar?. The plaintiff urges that these defendants are unknown identities who would also telecast the unauthorizedly and illegally telecast pirated version of the plaintiff's films by their network without any licence.
The plaintiff invokes the inherent power of this court under Section 151 of the CPC to evolve a fair and reasonable procedure to address the peculiar facts and circumstances over the pleaded violations by the defendants including defendant nos.19 to 50. In this regard, reliance is placed on the internationally adopted "John Doe" practice obtaining in USA, Canada, UK, Australia and other jurisdictions as well as this country's obligation under the TRIPPS agreement to effectively enforce IPR rights of parties including those as in the present one. It is urged that a similar order deserves to be passed in the present case.
In support of this submission, my attention has been drawn to a judgment dated 14th June, 2002 passed in CS(OS) No. 1072/2002 Taj Television Ltd. and Ors. vs. Rajan Mandal and Ors. reported at 2003 FSR 22 on similar facts, this court had noticed the following submissions of counsel for the plaintiff seeking a John Doe order:- 11. Mr. Anand submitted that conduct of various unscrupulous cable channel companies/distributors such as the defendants is well known. The aspect of channel is being illegally aired on the local cable networks has almost taken on a regular feature. He prayed that in the facts and circumstances apart from giving necessary directions be also given for defendant Nos. 7 to 20, in other words, the court may pass "John Doe" orders.

Mr. Anand placed reliance on Trade Marks Law of Canada in which it is mentioned that John Doe? orders enabling the order to be served upon persons whose identity is unknown to the plaintiff at the time the action was commenced, but whose activity falls within the scope of the action. This form of naming a party is considered a mere "misnomer", and as long as the "litigating finger" is pointed at such person then the misnomer is not fatal. This proposition has been taken from Jackson v/s Bubels (1972) 28 DLT. (3d) 500 (B.C.C.A.) and Dukoff vs.Teronto General Hospital (1986),54,O.R.(2d) 50(H.C.).

Mr. Anand submitted that ?John Doe? orders are passed by American, English, Canadian and Australian Courts frequently. He further submitted that this court also possesses enormous inherent powers to formulate the orders which are necessary to meet the peculiar facts and peculiar situations., In the first U.S. Federal "John Doe" order, Shaw vs Various John Does, No 80 Civ,722 (S.D.N.Y.Fe,6,1980) the court held that a court of equity was always free to fashion a decree in keeping with the needs of the litigants. Similarly, in Billy Joel vs. Various John Does, 1980 U.S. Dist LEXIS 12841 the Court held:

Were the Injunction to be denied, Plaintiffs would be without any legal means to prevent what is clearly a blatant infringement of their valid property rights. While the proposed remedy is novel, that in itself should not weigh against its adoption by this court. A court of equity is free to fashion whatever remedies will adequately protect the rights for the parties before it.

Mr. Anand placed reliance on the judgment of the Supreme Court in Manohar Lal Chopra vs. Rai Bahadur Rao Raja Seth Hiralal, AIR 1962 SC 527. The Court held that the inherent powers of the Court are in addition to the powers specifically conferred on the Court by the Code. They are complementary to those powers and therefore, it must be held that the court is free to exercise them for the purposes mentioned in Section 151 of the Code when the exercise of those powers is not in any way in conflict with what has been expressly provided in the Code or against the intentions of the legislature. Mr. Anand placed reliance on EMI Records Ltd . v. Kudhail and others (1985) FSR 36, (1983) Com LR 280.

Mr. Anand , Learned counsel for the plaintiffs, has made references to a large number of Canadian, Australian, English and American cases but I would not like to burden this order with all the judgments on which reliance has been placed at this stage. Since ?John Doe? orders are passed in the court of Canada, America, England, Australia and in some other countries. The judicial systems of all these countries have basic similarity with our judicial system. Therefore, looking to the extra ordinary facts and circumstances of the case, in the interest of justice the courts in India would also be justified in passing "John Doe" orders. It is noteworthy that after such finding keeping in view the peculiar facts of the CS(OS) No. 1072/2002, a John Doe order was not passed.
My attention has also been drawn to an order dated 24th November, 2006 in CS(OS) No. 2189/2006 wherein the court has granted an injunction order in terms of the above observations. This court as such has the jurisdiction to pass an order in the nature of a John Doe order injunction unknown persons in circumstances as have been pleaded by the plaintiff in the present case. Mr. Vikas Singh, learned senior counsel for the plaintiff has placed reliance on the following observations of the court in Tej Television (Supra) in the context of cable operators:-
I have carefully considered the relevant documents, averments of the application and judgments of various courts. Undoubtedly, the cable operators in India have a long history of violating copyrights. A very large number of court orders are testimony to this. The cable operators are encouraged owning to the unique nature of cable piracy and the unstructured nature of the cable industry, the speed with which any trace of infringement can be erased by the cable operators, enforcement of rights in conservative nature is unlikely to effectively redress the plaintiffs' grievance.
The plaintiff has approached this court seeking protection of its valuable rights against such unwarranted, unauthorized and illegal actions of the defendants nos. 1 to 18 as well as the Mr. Ashok Kumars arrayed as defendant nos. 19 to 50 which have violated and diluted the exclusive copyright vested with the plaintiff in respect of the films "7 Khoon Maaf". The plaintiff has expressed apprehensions that the defendants would violate the plaintiff's rights in its film "Thank You".
The plaintiff has asserted violation of its rights and violations of the Copyright Act, 1957, the Cable Network (Regulation) Act, 1995 before this court. The material placed before this court would show that the plaintiff has copyright in the films produced by it and only authorized licensees can telecast the films.
The plaintiff has specifically averred that the defendants in the suit have not signed any agreement with regard to the film. As such telecast of these films is violative of section 14(1)(d) and 16 of the Copyright Act.
It is urged that unauthorized cable transmission of the plaintiff's films shall result in irreparable loss and damage to the plaintiff. It would also encourage other cable operators who have currently procured licenses/entered into agreements with the plaintiff and possess valid license/agreements, to also telecast the films without making necessary payments. In support of the grievance that the damage would be irreparable, it is pointed out that the cable industry has an unstructured composition and it would be impossible to assess the damages which may result on account of unauthorized telecast/broadcast/distribution.
The modus operandi adopted by unauthorized cable operators is to prepare poor copies of the films when they are being screened in the picture hall and telecast the same on their network to cable homes attached to them. It would appear that public interest would also suffer on account of poor programme quality. There is prima facie substance in the plaintiff's contention that the same would impact the plaintiffs reputation as well.
In view of the foregoing, it would prima facie appear that unlicensed broadcast of the reproduction rights vested in the plaintiff by telecasting the plaintiff's films "7 Khoon Maaf" and the forthcoming film "Thank You" in the foregoing manner is illegal, unfair and deserves to be prohibited. Consequently, unless injunction as prayed for is granted by this court, the business of the plaintiff herein would be irreparably impacted. Balance of convenience and interest of justice are in favour of the plaintiff and against the defendants.
It is accordingly directed as follows :-
(i) that the defendants/their agents, representatives, franchisees, sub-operators, head ends and/or anyone claiming under them are hereby restrained from telecasting or in any other manner communicating to the viewing pubic/subscribers either by means of wireless diffusion or by wire a pirated version of the films "7 Khoon Maaf" and "Thank You" and/or in any other manner infringing the copyright of the plaintiff therein.
(ii) It is further directed that till the present order is vacated or modified, the direction shall operate against the defendants, their agents,representatives, franchises, sub-operators or any person claiming under them an injunction.
(iii) Further injunction in terms of serial no. (i) above is passed against un-named and undisclosed persons who may be likewise committing breach of the rights of the plaintiff in a similar manner.
(iv) The SHO/Superintendent of the concerned police station(s) are directed to render assistance to the plaintiff should any be required for purposes of enforcement of the present order as it is the obligation of the police authorities and the State to enforce judicial orders passed.
(v) The plaintiff is permitted to publish the John Doe injunction order issued today in local newspapers in all states where it has expressed apprehensions of violation of its rights. Consequences in accordance with law would thereafter follow.
(vi) The plaintiff shall comply with the provisions of the proviso to rule 3 of order 39 of the CPC within a period of ten days from today.

Copy of this order be given dasti as well as dasti under the signatures of the court master of this court.

Ambika Tandon and Aayush Rathi have produced a research paper that contextualises the narrative around Industry 4.0 and the future of work with reference to the female labour force in India.
Gurshabad Grover, Nikhil Srinath and Aayush Rathi (with inputs from Anubha Sinha and Sai Shakti) presented a response to the Telecom Regulatory Authority of India’s Consultation Paper on Regulatory Framework for Over-The-Top (OTT) Communication Services. CIS appreciates the continual efforts of TRAI to have consultations on the regulatory framework that should be applicable to OTT services and Telecom Service Providers (TSPs).
Pranesh Prakash, Karan Saini and Elonnai Hickok authored a policy brief that recommends several changes pertaining to current legislation, policy and practice to the Government of India regarding coordinated vulnerability disclosure (“CVD”) for improving the overarching information and cyber security posture of the country.
The Global Commission on the Stability of Cyberspace, a multi-stakeholder initiative comprised of eminent individuals across the globe opened a public comment procedure to solicit comments and obtain additional feedback. Arindrajit Basu, Gurshabad Grover and Elonnai Hickok responded to the public call-offering comments on all six norms and proposing two further norms.

Highlights
The paper titled "Patent Working Requirements and Complex Products" has been published in the latest issue of the NYU Journal of Intellectual Property and Entertainment Law. It is one of the outputs of the Pervasive Technology project and has been authored by Prof. Jorge L. Contreras, Paxton M. Lewis, and Rohini Lakshané. CIS made a submission to the Department of Industrial Planning and Promotion on mobile patents. CIS offered its assistance on matters aimed at developing a suitable policy framework for SEPs and FRAND in India, and, working towards sustained innovation, manufacture and availability of mobile technologies in India The use of Artificial Intelligence (AI) in healthcare in India is increasing with new startups and large ICT companies offering AI solutions for healthcare challenges in the country. The report by by Yesha Paul, Elonnai Hickok, Amber Sinha and Udbhav Tiwari seeks to map the present state of AI in the healthcare sector in India. About 27% of India's population is still illiterate or barely literate. Most privacy policies and terms of services for web and mobile applications are in English and therefore it is only 10% of us who can actually read them before we provide our consent. The article by Sunil Abraham was published in Deccan Herald on January 20, 2018. CIS made a submission to TRAI Consultation on inputs to the National Telecom Policy. CIS in its submission also recommended what all should be the main objectives of TRAI while drafting the next edition of National Telecom Policy. Under a research grant from the Azim Premji University CIS has initiated a study of the ongoing updation process of the National Register of Citizens (NRC) in Assam and the resultant reform of citizen identification infrastructure in India. The 2G judgment of December 2017 provides a critique of how no proper evidence was presented on existence of an FCFS policy and its improper implementation, wrote Shyam Ponappa in his article in the Business Standard which was published on January 3, 2018.

CIS offered its assistance on matters aimed at developing a suitable policy framework for SEPs and FRAND in India, and, working towards sustained innovation, manufacture and availability of mobile technologies in India
The use of Artificial Intelligence (AI) in healthcare in India is increasing with new startups and large ICT companies offering AI solutions for healthcare challenges in the country. The report by by Yesha Paul, Elonnai Hickok, Amber Sinha and Udbhav Tiwari seeks to map the present state of AI in the healthcare sector in India.
About 27% of India's population is still illiterate or barely literate. Most privacy policies and terms of services for web and mobile applications are in English and therefore it is only 10% of us who can actually read them before we provide our consent. The article by Sunil Abraham was published in Deccan Herald on January 20, 2018.
CIS made a submission to TRAI Consultation on inputs to the National Telecom Policy. CIS in its submission also recommended what all should be the main objectives of TRAI while drafting the next edition of National Telecom Policy.
Under a research grant from the Azim Premji University CIS has initiated a study of the ongoing updation process of the National Register of Citizens (NRC) in Assam and the resultant reform of citizen identification infrastructure in India.
The 2G judgment of December 2017 provides a critique of how no proper evidence was presented on existence of an FCFS policy and its improper implementation, wrote Shyam Ponappa in his article in the Business Standard which was published on January 3, 2018.

Access to Knowledge

Our Access to Knowledge programme currently consists of two projects. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

Highlights
The Rights of Persons with Disabilities (RPD) Act, which was passed in December 2016, seeks to give effect to the rights and obligations enshrined in the United Nations Convention on the Rights of Persons with disabilities, which India signed and ratified nearly a decade ago. Nirmita Narasimhan in a blog entry has summarized the key provisions of the Act relating to digital accessibility. The latest judgment in the matter of Super Cassettes v. MySpace is a landmark and progressive ruling, which strengthens the safe harbor immunity enjoyed by Internet intermediaries in India. CIS was one of the intervenors in the case, and has been duly acknowledged in the judgment. Meena Gayathri became the first South Indian Wikiwoman to complete 100 Wikidays challenge. The challenge required Wikipedians to create one new article per day for one hundred days in a row. Gayathri's contribution and passion towards Telugu language and culture have transcended into a "knowledge revolution". The Committee on Digital Payments constituted by the Ministry of Finance and chaired by Ratan P. Watal, Principal Advisor, NITI Aayog, submitted its report on the "Medium Term Recommendations to Strengthen Digital Payments Ecosystem" on December 09, 2016. The report was made public on December 27, and comments were sought from the general public. CIS submitted its comments. The comments were authored by Sumandro Chattopadhyay. ICANN sought community input on the Proposed ICANN Community Anti-Harassment Policy on 7 November 2016. In response to this CIS submitted its comments. The comments were authored by Padma Venkataraman, Rohini Lakshané, Sampada Nayak and Vidushi Marda. The eleven sessions selected for the Internet Researchers' Conference 2017 (IRC17) to be held at the IIIT Bangalore campus during March 3-5, 2017 has been announced. The conference is being organised by the Centre for Information Technology and Public Policy (CITAPP) at IIIT Bangalore and CIS.

As part of our endeavour to make available accessible content for persons with disabilities, we are developing a text-to-speech software in 15 languages with support from the Hans Foundation. Highlights
CIS in collaboration with the Office of the Chief Commissioner for Persons with Disabilities, Department of Disability Affairs, Ministry of Social Justice & Empowerment, Government of India compiled the National Compendium of Laws, Policies, Programmes for Persons with Disabilities. Prasanna Kumar Pincha, Chief Commissioner for Persons with Disabilities wrote the Foreword for the Compendium. The Patent Office had put the Guidelines on Computer Related Inventions, 2015 in abeyance last month. This step was taken after several stakeholders including CIS made representations to the Office about serious substantive legal issues in the document. The Controller General of Patents Design Trademarks invited submissions from stakeholders on specific examples on exclusions from patentability under section 3(k) of the Patents Act, 1970, for possible incorporation in the Guidelines for Examination of Computer Related Inventions. CIS made its submissions. Rahmanuddin Shaik conducted an analysis of the growth of Odia Wikipedia and Konkani Wikipedia from a perspective based on Wikimedia statistics for the July to December 2015 period. The findings have been recorded in two separate blog entries. Nehaa Chaudhari made a presentation during the Global IP Congress held last month on the Curious Case of the CCI: Competition Law and SEP Regulation in India which discussed mobile phone patent litigation in India with competition law issues. Rohini Lakshané made a presentation on Patent landscaping in the sub-$100 mobile device market in India at the Global IP Congress. Anubha Sinha made a presentation on IP in Mobile Applications Development in India that discussed IP rights in mobile apps during the Global IP Congress. The Ministry of Finance held pre-budget consultations with different stakeholder groups in connection with the Union Budget 2016-17. CIS was invited to take part in the consultation for the IT (hardware and software) group organised on January 07, 2016, and submit a suggestion note. The submission was prepared and presented by Sumandro Chattapadhyay with contributions from Rohini Lakshané, Anubha Sinha and other members of CIS. CIS gave its comments on the failures of Cross Community Working Group on Enhancing ICANN Accountability (CCWG-Accountability) draft proposal as well as the processes that it has followed. Tanvi Mani gave an analysis of Big Data in the Global South. She pointed out that appropriate analysis of the Big Data generated would provide a valuable insight into the key areas and inform policy makers with respect to important decisions. Eight key privacy events in India in the year 2015: August 11, 2015 order on Aadhaar not being compulsory; No Right to Privacy - Attorney General to SC; Shreya Singhal judgment and Section 69A, IT Act; Circulation and recall of Draft Encryption Policy; Privacy concerns raised about Digital India; Issues with Human DNA Profiling Bill, 2015; Impact of the Schrems ruling on India; and The definition of "unfair trade practices" in the Consumer Protection Bill, 2015 has been summarized in a blog entry by Amber Sinha. In an article published in the Deccan Herald on January 3, 2016, Sunil Abraham argued that "Internet" is not a human right in most jurisdictions in light of a survey conducted by Facebook which declared that Internet is a human right and Free Basics can help bring Internet to all of India. The first Internet Researchers' Conference (IRC16), organised around the theme of 'studying internet in India,' will be held on February 26-28, 2016, at the Jawaharlal Nehru University (JNU), Delhi. CSCS Digital Innovation Fund (CDIF) is supporting the event. A consultation on 'digital futures of Indian languages' was held at the CIS office in Bangalore on December 12, 2015, to generate ideas and structure the Indian languages focus area of CDIF. The programme was led by Dr. Tejaswini Niranjana and Tanveer Hasan. The participants shared their digital Indian language experience at the meeting.

As part of its research on privacy and free speech, CIS is engaged with two different projects. The first one (under a grant from Privacy International and International Development Research Centre (IDRC)) is on surveillance and freedom of expression (SAFEGUARDS). The second one (under a grant from MacArthur Foundation) is on studying the restrictions placed on freedom of expression online by the Indian government.

Highlights

Forbes India in an article titled “Minds that (should) matter” names Sunil Abraham as one of the Thinkers who best explain a rapidly-changing India to the world (and the world to India).

Subhashish Panigrahi won the 2015 Opensource.com Community Awards under the category 'People's Choice Awards'.
Sumandro Chattapadhyay has joined CIS team as Research Director. Sumandro has replaces Nishant Shah who stepped down from the position.
Rishika on behalf of CIS prepared an analysis of the disability exceptions in Copyright Legislations . The blog post provides in detail the country-wise exceptions in copyright legislations.
NVDA team conducted a training programme on Malayalam eSpeak with NVDA in Thiruvananthapuram on January 24 and 25, 2015. Chakshumathi's main trainer Akhil M. took eSpeak Malayalam classes and Dr. Homiyar took classes on NVDA and accessible equipment.
The Department of Industrial Policy and Promotion, Government of India invited comments on the First Draft of India's National IPR Policy. CIS made its submission.
As part of the Pervasive Technologies project, Nehaa Chaudhari has produced a research methodology document which maps the existing literature around questions of competition law intersecting with intellectual property law on the specific issue of enabling access to sub hundred dollar mobile devices .
Maggie Huang, an intern at CIS as part of the Pervasive Technologies project has written a blog entry which documents, synthesizes, and analyses learnings from attending various music industry trade conferences.

CIS-A2K team on December 28, 2014 organized a MediaWiki hackathon event for Telugu Wikimedia community members to enhance their skills and understanding of technical matters related to MediaWiki usage. The theme of the workshop was “Mediawiki, its extensions and tools to work around” and it aimed at allowing Wikipedians to use MediaWiki tools more effectively.

Subhashish Panigrahi authored an op-ed that highlights the need for taking Odia language to the international fora instead of keeping it confined in the books. The op-ed was published in the Samaja on January 30, 2015.

A journal article by Subbiah Arunachalam, Perumal Ramamoorthi and Subbiah Gunasekaran the steps taken by scientists and librarians in the West to reclaim ease of access to research findings with what is happening in India along with a few suggestions was published by the Indian National Science Academy Journals.
The Supreme Court, in Sabu George v. Union of India and Ors. (WP (C) 341/2008), is looking into the presence of material regarding pre-natal sex determination on search engines such as Google, Bing, and Yahoo that has been falling foul of section 22 of the Pre-Natal Diagnostic Techniques Act, 1994 as amended in 2002. Geeta Hariharan and Balaji Subramanian analyse this in their blog post.
As part of its Making Methods for Digital Humanities project, CIS-RAW organized two consultations on new figures of learning in the digital context. For a proposed journal issue on the theme of 'bodies of knowledge' which draws upon these conversations, participants were invited to write short sketches on these figures of learning. Tejas Pande wrote an abstract which examines the figure of the visual designer, and emerging practices of mapmaking.

Accessibility and Inclusion

Under a grant from the Hans Foundation we are doing two projects. The first project is on creating a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India. CIS in partnership with CLPR (Centre for Law and Policy Research) compiled the National Compendium of Policies, Programmes and Schemes for Persons with Disabilities (29 states and 6 union territories). The publication has been finalised and is being printed. The draft chapters and the quarterly reports can be accessed on the project page. The second project is on developing text-to-speech software for 15 Indian languages. The progress made so far in the project can be accessed here.

Access to Knowledge

As part of the Access to Knowledge programme we are doing two projects. The first one (Pervasive Technologies) under a grant from the International Development Research Centre (IDRC) is for research on the complex interplay between pervasive technologies and intellectual property to support intellectual property norms that encourage the proliferation and development of such technologies as a social good. The second one (Wikipedia) under a grant from the Wikimedia Foundation is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

2015 Opensource.com Community Awards : Every year, Opensource.com awards people from our community who have excelled in contributing and sharing stories about open source. Subhashish Panigrahi from the CIS-A2K team won the award under the category 'People's Choice Awards'.
CIS-A2K team also published the Telugu Wikipedia Stats tables. Most metrics have been collected from a partial dump (aka stub dump), which contains all revisions of every article, meta data, but no page content.

Digital Humanities

CIS is building research clusters in the field of Digital Humanities. The Digital will be used as a way of unpacking the debates in humanities and social sciences and look at the new frameworks, concepts and ideas that emerge in our engagement with the digital. The clusters aim to produce and document new conversations and debates that shape the contours of Digital Humanities in Asia:

Staff Movement

Sumandro Chattapadhyay has joined CIS as Research Director. His academic interests span over topics of history and politics of informatics in India, new media and technology studies, and data infrastructures and economies. He is also keenly interested in questions and techniques of digital humanities. Recently, Sumandro has completed a study on policy and practices of open data in India as part of the Open Data Research Network managed by the World Wide Web Foundation. He is an involved member of DataMeet, a leading community of open data and data science enthusiasts from India. Sumandro studied economics in Visva-Bharati, Shantiniketan, and in Jawaharlal Nehru University, New Delhi. He has variously worked on topics of urban development, information technology in governance, data visualisation, and early electronic governance in India with MOD Institute, Azim Premji University and the Sarai Programme at the Centre for the Study of Developing Societies.

Highlights

Amba Salelkar provides an analysis of the three stages of the Rights for Persons with Disabilities 2013 since it was initially commissioned.
We published revised chapters for the states of Andhra Pradesh and Chhattisgarh as part of our National Resource Kit project.
In the first of a three-part study Ananth Padmanabhan examines the "John Doe" orders that courts have passed against ISPs, which entertainment companies have used to block websites.
The second Institute on Internet and Society is being held in Pune from February 11 to 17.
CIS signed a memorandum of understanding (MoU) with KIIT University and Kalinga Institute of Social Sciences for furthering Odia Wikipedia.
Dr. Nishant Shah co-authored a chapter on video games in a book published by Palestinian Art Court-al Hoash.

Accessibility and Inclusion

As part of our project (under a grant from the Hans Foundation) on creating a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India, we bring you draft chapters for the states of Madhya Pradesh and Arunachal Pradesh, and the union territory of Daman and Diu. Accessibility

CIS is carrying out two projects in partnership with the Hans Foundation. The first one is to create a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India and the second one is for developing a screen reader and text to speech synthesizer for Indian languages. We are also working with the World Blind Union to develop the Treaty for Improved Access for Blind, Visually Impaired and other Reading Disabled Persons, and assisting in the negotiations at WIPO:

Anandhi Viswanathan from CIS and Manojna Yeluri from the Centre for Law and Policy Research are working in this project. Shruti Ramakrishnan has left the project. Draft chapters have been published. Feedback and comments are invited from readers for the chapter on Haryana:

The Haryana Chapter (by Anandi Viswanathan, January 31, 2012): The state implements the provisions under the central laws, particularly the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act 1995 and the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act 1999.

Government of Madhya Pradesh initiates ICT Accessibility in Public Communication (by Nirmita Narasimhan, January 31, 2013): CIS with Daisy Forum of India member Arushi in Bhopal submitted a request for a notification mandating that all communication by the Government of Madhya Pradesh should be accessible to persons with disabilities.

Access to Knowledge

In partnership with the International Development Research Centre we are doing a project on Pervasive Technologies examining the relationship between production of pervasive technologies and intellectual property. The Wikimedia Foundation’s India Program to support and develop free knowledge in India is now being executed by us. We are also supporting the Iraq government in developing an eGovernment Interoperability Framework:

Beginning from September 1, 2012, Wikimedia Foundation has awarded CIS a two-year grant of INR 26,000,000 to support and develop free knowledge in India. The A2K team consists of four members based in Delhi: T. Vishnu Vardhan, Nitika Tandon, Subhashish Panigrahi and Noopur Raval.

New Project Director

T. Vishnu Vardhan is the new Programme Director-Access to Knowledge at CIS. Vishnu has over the last 11 years worked in various capacities as researcher, grant manager, teacher, project consultant, information architect and translator. Vishnu managed the Art, Crafts and Culture portfolio of Sir Ratan Tata Trust and also worked as Research Coordinator at the Centre for the Study of Culture and Society.

New Distinguished Fellow at CIS

Tejaswini Niranjana, a Senior Fellow at the Centre for the Study of Culture and Society (CSCS), Bangalore, and Visiting Professor at the Tata Institute of Social Sciences (TISS), Mumbai is joining our team as an Adviser to the 'Access to Knowledge' project. She will guide the A2K team in expanding the Indian language Wikipedias and in increasing the number of active editors through strategic partnerships with Higher Education institutions across India.

Pervasive Technologies

The Pervasive Technologies project carries out research on the intellectual property implicated in the hardware, software and content available in low-cost mobile devices.The long-term outcome of this project is to create a legitimate, legal space for these technologies to exist on the Indian market.

Internet Access – Knowledge Repository
In partnership with Ford Foundation, CIS was tasked to produce and disseminate modules on various aspects of telecommunications including policy, regulations, infrastructure and market. However, as on November 9, 2012 there was a change in the mandate of the project. Currently, we are working on building a knowledge repository on “Internet Access”. This new repository will cover the history of the internet, technologies involved, principle and values of internet access, broadband market and universal access. It will also touch upon various polices and regulations which has an impact on internet access and bodies and mechanism which are responsible for such policy formulation. For this purpose we will be hosting a new website: www.internet-institute.in.
We are also organizing an “Institute on Internet and Society” in collaboration with the Ford Foundation India, which is to be held from June 8, 2013 to June 14, 2013. Call for registrations and relevant details will be soon announced on our website.

Telecom

While the potential for growth and returns exist for telecommunications in India, a range of issues need to be addressed. One aspect is more extensive rural coverage and the other is a countrywide access to broadband which is low. Both require effective and efficient use of networks and resources, including spectrum.:

CIS was registered as a society in Bangalore in 2008. Our Policy Director, Nirmita Narasimhan won the National Award for Empowerment of Persons with Disabilities from the Government of India and also received the NIVH Excellence Award.

Digital Natives with a Cause?

Digital Natives with a Cause? is a knowledge programme initiated by CIS, India and Hivos, Netherlands. It is a research inquiry that seeks to look at the changing landscape of social change and political participation and the role that young people play through digital and internet technologies, in emerging information societies. The major outputs have been a four book collective asking questions about theory and practice around 'digital revolutions' in a post MENA (Middle East - North Africa) world, a position paper, a scouting study and three international workshops.

Alternative Approaches to Social Change

“Observations about intangible aspects of a movement will keep a research from clinging to activism with a capital A, and start seeing a gradation in the social movement practices. It is constructive and opens the door to analyses of multi-dimensional movements such as the Blank Noise initiative (India). Drawing on methods of identifying new developments to the field of social movement, Maesy examines some aspects of it: the issue, strategy, site of action, and internal mode of organization.”

Accessibility

India has an estimated 70 million disabled persons who are unable to read printed materials due to some form of physical, sensory, cognitive or other disability. This includes persons with blindness, learning disabilities such as dyslexia, cerebral palsy and persons who do not have full control over their limbs. For these people, the material needs to be converted into alternate formats such as Braille, audio or video or electronic formats (text document, word document or PDF) which they can access using assistive technologies. Our key research has focused on a submission to amend the Indian Copyright to the HRD Ministry, publishing a policy handbook on e-accessibility, research on accessible mobile handsets in India and an analysis of the Working Draft of the Rights of Persons with Disabilities Act, 2010.

Featured Research

Making Mobile Phones and Services Accessible. CIS researched, edited and published this report in partnership with G3ict and ITU. The report contains a foreword, eleven chapters, a bibliography and glossary with contributions from Deepti Bharthur, Nirmita Narasimhan and Axel Leblois.

Upcoming Event

ITU Tutorial on Audiovisual Media Accessibility, organized by the International Telecommunication Union, India International Centre, 14-15 March 2012. CIS is hosting the meeting. The Tutorial will be preceded by the fourth meeting of the Focus Group on Audio Visual Media Accessibility (FG AVA) on 13 March 2012. This meeting will take place at the same venue and will also be hosted by CIS, in cooperation with the ITU-APT Foundation of India.

Access to Knowledge

Access to Knowledge is a campaign to promote the fundamental principles of justice, freedom, and economic development. It deals with issues like copyrights, patents and trademarks, which are an important part of the digital landscape. We prepared the India report for the Consumers International IP Watchlist, made submission to the HRD Ministry on WIPO Broadcast Treaty, questioned the demonization of pirates, and advocated against laws (such as PUPFIP Bill) that privatize public funded knowledge.

Gandhi, Freedom, and the Dilemmas of Copyright: To commemorate Mahatma Gandhi's death anniversary, CIS organised a public lecture. Prof. Shyamkrishna Balganesh of the University of Pennsylvania gave a lecture.

Openness

The advent of the Internet has radically defined what it means to be open and collaborative. Even the Internet is built upon open standards and free/libre/open source software. CIS has been committed and actively campaigned for promotion of open standards, open access and free/libre/open source software.

Summary of the Minutes of the Workshop on Biodiversity Informatics, organized by the Western Ghats Portal team to explore the contemporary state of biodiversity informatics at Ashoka Trust for Research in Ecology and Environment (ATREE), Bangalore on 25 November 2011.
Design!PubliC — Innovation and the Public Interest: On the 14th of October, 2011, the Center for Knowledge Societies organized the second edition of the Design Public Conclave, a conversation on how innovation can serve the Public Interest. The conclave was held at the National Gallery of Modern Art in Bangalore.
Report on the 'Open Access to Academic Knowledge' workshop: On Wednesday the 2nd of November, during Open Access Week, the Indian Institute of Science in conjunction with the Centre for Internet and Society held a workshop on Open Access at the National Centre for Science Information, in Bangalore. We recorded the meeting and published it online.

Internet Governance

The Tunis Agenda of the second World Summit on the Information Society has defined internet governance as the development and application by governments, the private sector and civil society, in their respective roles of shared principles, norms, rules, decision-making procedures and programmes that shape the evolution and use of the internet. CIS partnered with Privacy International and Society in Action Group which has produced outputs in banking, telecommunications, consumer rights, etc., submitted open letters to Parliamentary Committee on UID, feedbacks on NIA Bill, and IT Rules.

On January 21, 2012 a public conference “Privacy Matters” was held at the Indian Institute of Technology in Mumbai. It was the sixth conference organised in the series of regional consultations held as “Privacy Matters”. The present conference analyzed the Draft Privacy Bill and the participants discussed the challenges and concerns of privacy in India.

Future of Integrated Science Education in Higher Education in India
The Higher Education Innovation and Research Application (HEIRA) at the Centre for the Study of Culture and Society (CSCS) and the Centre for Contemporary Studies (CCS) at the Indian Institute of Sciences (IISc) hosted a two day workshop on 2 and 3 January 2012 on the Future of Integrated Science Education in Higher Education in India at the Centre for Contemporary Studies, IISc. RAW is a multidisciplinary research initiative. CIS believes that in order to understand the contemporary concerns in the field of Internet and society, it is necessary to produce local and contextual accounts of the interaction between the Internet and socio-cultural and geo-political structures. Although there may not be one centralised authority that rules the Internet, the Internet does not just run by its own volition: for it to operate in a stable and reliable manner, there needs to be in place infrastructure, a functional domain name system, ways to curtail cybercrime across borders, etc. The Tunis Agenda of the second World Summit on the Information Society (WSIS), paragraph 34 defined Internet governance as “the development and application by governments, the private sector and civil society, in their respective roles, of shared principles, norms, rules, decision-making procedures, and programmes that shape the evolution and use of the Internet.” Within the larger field of Internet governance, the Internet Governance Forum (IGF), a multi-stakeholder policy dialogue forum that was instituted by the WSIS processes and that is their only formal outcome, has fast emerged as one of the key institutions. As the definition quoted above indicates, a unique feature of the field of Internet governance is that, unlike many other governance spheres, it does not only involve governments. Historically, not only governments but also the technical community and private players have played a crucial role in the development of the Internet. In the context of the IGF, that role is not only explicitly acknowledged but also institutionalised as the IGF formally brings together governments, private players and civil society actors from all areas of and organisations involved in Internet governance. Moreover, now that the open and egalitarian potential of the Internet is increasingly under attack, this unique nature of the IGF, in addition to its WSIS roots, has made it a prime venue to remind stakeholders in all areas of Internet governance of the commitment they have made earlier to building a “people-centred, inclusive and development-oriented Information Society” (WSIS Geneva Principles, Para 1). CIS has undertaken many new and exciting projects. One of these, "Privacy in Asia", is funded by Privacy International (PI), UK and is being completed in collaboration with Society and Action Group. "Privacy in Asia" is a two-year project that commenced on 24 March 2010 and will complete within two years from the commencement date, unless otherwise agreed to by the parties. The project was set up with the objective of raising awareness, sparking civil action and promoting democratic dialogue around privacy challenges and violations in India. In furtherance of these goals it aims to draft and promote an over-arching privacy legislation in India by drawing upon legal and academic resources and consultations with the public.

Apart from "Privacy in Asia" CIS is also participating in the " Privacy and Identity" project, which is funded by the Ford Foundation and managed by the Centre for Study of Culture and Society. The project is a research inquiry into the history of Privacy in India and how it shapes the contemporary debates around technology mediated identity projects like Aadhaar. The "Privacy and Identity" project started in August 2010.

He is a past recipient of an Open Society Institute fellowship for research into Open Information Policy, and has been affiliated with the Alternative Law Forum – a collective of lawyers in Bangalore engaged in human rights practice.

Prashant joined the Centre for Internet and Society as a lead researcher in the Privacy India project recently.

Telecom

The growth in telecommunications in India has been impressive. While the potential for growth and returns exist, a range of issues need to be addressed for this potential to be realized. One aspect is more extensive rural coverage and the second aspect is a countrywide access to broadband which is low at about eight million subscriptions. Both require effective and efficient use of networks and resources, including spectrum. It is imperative to resolve these issues in the common interest of users and service providers. CIS campaigns to facilitate this.

J&K social media ban: Use of 132-year-old Act can’t stand judicial scrutiny, say experts

Jammu and Kashmir's social media ban: Legal experts are not convinced this is a viable order

For residents of Jammu and Kashmir, there’s a blanket ban on social media for the next one month. This means no access to Facebook, WhatsApp, Twitter, Snapchat, Skype WeChat, YouTube, Telegram and other social networks.

As The Indian Express reported, this ‘social media ban’ was ordered by the state government after Chief Minister Mehbooba Mufti chaired a meeting of the Unified Command Headquarters in Srinagar. The total list includes 22 social media websites, and the order, a copy of which is available with The Indian Express, says this is being done “in the interest of maintenance of public order.”

The order to block the sites was issued by RK Goyal, Principal Secretary in the Home department, and cites Section 5 of Indian Telegraph Act, which “confers powers upon the Central government or the state government to take possession of license telegraphs and order stoppage of transmission or interception or detention of messages”.

The order reasons that social media sites are “being used by anti-national and anti-social elements by transmitting inflammatory messages in various forms”. It directs all ISPs to block these websites in the state of Jammu and Kashmir.

But questions are already being raised over its legality.

“This is an illegal order because the Telegraph Act and Rules, which the order cites, doesn’t give the government the power to block websites. The Telegraph Act is a colonial-era legislation first passed in 1885 in the aftermath of the Mutiny, making telegraphs a monopoly of the colonial British government, and restricting Indians’ access to communications technologies. In 1996, in the PUCL case, the Supreme Court laid down that powers to intercept or block transmission of messages cannot be exercised without procedural safeguards in place. In 2007, procedural safeguards were made for interception, but not for blocking of telegraphic communications,” points out Pranesh Prakash, Policy Director at Centre for Internet and Society.

Pavan Duggal, senior lawyer specialising in cyberlaw, concurs. “Legally, the order is not viable. This is because the IT Act applies for blocking, under Section 69 (A). Also Section 81 of the IT Act also make it clear that this is a special law, which will prevail over any other older law. The IT ACT deals with everything related to the internet.”

The IT ACT notes in Section 1, that “It shall extend to the whole of India and, save as otherwise provided in this Act, it applies also to any offence or contravention there under committed outside India by any person.”

But even blocking under the IT Act isn’t something that can be ordered over night, and the powers for this rest with the central government.

“There’s a provision (69A) in the Information Technology Act which provides for blocking of specific web pages for national security reasons, but only by the Central government. The J&K government, thus can only request the Central government to block. The central government has in the past denied requests by state governments as they were unlawful requests,” Prakash said.

However, blocking of URLs or in fact complete internet shutdowns is not new in India. “This is an example of Internet manipulation by the governments world over. The first casualty of any disturbance is now the Internet and the government, even the democratic ones living under rule of law have decided that is a-okay to prevent people from communicating in the name of law and order,” said Mishi Choudhary, President and Legal Director at SFLC.in

SFLC.in has also been keeping a track of internet shutdowns in India. It has a dedicated website Internetshutdowns.in which crowd-sources information on these bans, and India has already seen seven shut internet shutdowns in first three months of 2017. For instance, in the state of Nagaland internet and mobile services were down for nearly a month from January 30 to February 20.

The issue of url blocking and internet shutdowns inevitably gets linked to one of freedom of speech. While reasonable restrictions can be imposed under Article 19 (2) of the Constitution, experts are not convinced the current order makes enough of a case to justify such a blanket ban.

“The citizens of J&K are Indian citizens and can challenge the order as violative of Article 19 (1) (a) of the Constitution, violative of right to free speech and expression,” says Choudhary.

“Any kind of blocking must conform to the Constitutional guarantees of freedom of expression, and any blocking must be legally “reasonable” for it to be acceptable as a legitimate restriction under Art.19(2). This blanket ban of 22 arbitrarily chosen service — why block QQ or WeChat, but not LinkedIn — and that too for a month, cannot be called reasonable under any circumstances,” argues Prakash.

Prakash adds that the order also raises other international concerns for India. “It also violates India’s international legal obligations under the International Covenant on Civil and Political Rights (ICCPR), whose Article 19 protects the freedom of thought, opinion and expression. Only those restrictions that are provided by law, have a legitimate aim, are necessary with less restrictive option being available, and are proportionate to the harm being address are allowed. For instance, targeting of hate speech that is calling for genocide is reasonable. But such blanket bans of communications platforms are not,” he argues.

So can the citizens challenge such an order, which puts a blanket ban on social networks? The answer is yes, as in this case this order “is legally untenable,” explains Duggal.

On the practice of blocking, he points that in today’s world it can only be seen an antiquated practice. “To give an analogy it is like fixing a leaking roof with a band-aid. It will only increase traffic to the blocked websites, and there are indirect ways to reach these sites via proxies and other tools as well,” he adds.

The orders can always be reviewed by the courts. “While the IT Act allows for blocking, it should be remembered the process is always open to judicial review. Courts have final authority, and they can examine whether the principles of law were applied when passing such a blocking order,” explains Duggal.

The affected social media websites or ISPs don’t yet have a response to this order. When we reached out, Facebook said it did not have an official comment on the ban. Mobile internet service providers Vodafone and Airtel also refused to comment.

Whatsapp Says It’s Snoop-Proof Now, But There’s Always A Way In

WhatsApp says it has end-to-end encryption, so no one, not even WhatsApp, can snoop into calls.

Experts say any encryption can be broken by security agencies. Android phones can also get infected by malware.

For years, a Delhi power-broker used to call from nondescript landline numbers, changing them ever so often. Of late, he has started using WhatsApp calls for ‘sensitive’ conversations. He’s not alone. WhatsApp has revealed that over 100 million voice calls are being made on the social network every day. That’s over 1,100 calls a second! India is one of the biggest user bases of WhatsApp. And many Indian users are making the app their main engine for voice calls.

One reason for this shift is that WhatsApp calls are seen to be essentially free (though they indeed have data charges). But for a lot of people, the chief allure lies in the touted fact that WhatsApp calling is far more secure than mobile calling. In April, the app introduced end-to-end encryption for its messages and voice calls.

Consequent to this, Sudhir Yadav, a Gurgaon-based software engineer filed a PIL in the Supreme Court seeking a ban on WhatsApp on the grounds that its calls are so safe that it could be misused by ‘terrorists’. Last month, a court in Brazil issued orders to block WhatsApp for 72 hours after it failed to provide the authorities access to encrypted data.

Are WhatsApp calls really impenetrable? WhatsApp believes so and says that the encryption key is held by the two persons at the two ends of the message or call and no one, not even the company, can snoop in. “The calls are end-to-end encrypted so WhatsApp and third parties can’t listen to them,” a WhatsApp spokesperson told Outlook. This is precisely Yadav’s concern. “Because the encryption is end to end, the government can’t break it and WhatsApp cannot provide the decryption key,” he says.

However, experts do not buy this argument. They believe everything on the Internet is vulnerable. “Anything that uses a phone number is vulnerable,” says Kiran Jonnalagadda, founder of technology platform HasGeek. “Anyone can impersonate the phone number by getting a duplicate SIM and get access to a phone. There are also bugs in the system which security agencies use.”

WhatsApp uses a person’s phone number to open an account and authenticate a user. So, if the government or a security agency wants to get access to a WhatsApp call, it would be very easy. “Telecom companies cannot access these calls as they are encrypted before they reach the network. But the government can. It just has to replicate a SIM to access any number and its messages or voice calls,” says Aravind R.S., a volunteer for Save the Internet campaign and founder of community chat app Belong,

There are other modes of attack as well. It is a given that Android phones, which form the majority of mobile phones used in India today, are most vulnerable to malware attacks. So, even if the app itself is secure, the device is not and if the device is attacked, just about everything in it can be tapped into. For instance, there’s the ‘man in the middle’ mode of attack, where a third person gets into a call and mirrors the messages to both the sides and relays the messages or calls to a different server. There is also the SS7 signalling protocol that can help hackers get into networks and calls. These attacks can make even a WhatsApp encryption vulnerable.

Security agencies and hackers routinely implant viruses into the phones of people they are monitoring. Once a phone is “infected”, everything is accessible. And Android phones are extremely prone to attacks from malware. “It's not perfectly secure, especially if there is any virus in an Android phone, which is what security agencies work with. They have many more ways to get into a phone. There is no defence against that,” says Aravind,

Experts believe it is possible that US intelligence agencies like the FBI and the NSA may have access to or are capable of breaking into even the WhatsApp encryption. This is proven by the recent incident where the FBI, after being refused by Apple to open up an iPhone used by a terrorist, broke into the phone by itself.

“If you are on the NSA list, there is nothing you can do to protect yourself,” says Pranesh Prakash, policy director with the Centre for Internet and Society. “They will find a way to get into your phone. In WhatsApp, many things like photographs and videos are not encrypted; these can get access to a person’s account.”

In India, the debate on access to encrypted phones has been on since the government engaged with Blackberry a few years ago. “There is no law governing an Over The Top (OTT) service like WhatsApp. If the government orders decryption of a call and WhatsApp cannot comply, it will become illegal,” says cyber lawyer Asheeta Regidi. The government’s seeming comfort level with all this legal ambiguity is yet another indicator that all is not what is seems with WhatsApp. As for callers, they would do well to speak discreetly on any network.

It's September, and That Means It's Time for Software Freedom Day

Software Freedom Day (SFD), which celebrates the use of free and open software, is just around the corner on September 17. When the day first started in 2004, only 12 teams from different places joined, but it has since grown to include hundreds registered events around the world, depending on the year.

Supported by several global organizations like Google, Canonical, Free Software Foundation, Joomla, Creative Commons and Linux Journal, Software Freedom Day draws its inspiration from the philosophy promoted by people like Richard Stallman who argue that free software is all about the freedom and not necessarily free of cost but provides the liberty to users from proprietary software developers’ power and influence. SFD encourages everyone to gather in their own cities (here's a map of places where SFD is organized this year), educate people around them about free software, and promote the cause on social media (with the hashtag #SFD2016 this year). There's also hackathons (hacking free software to modify the code and create what one wants to have in it), running free software installation camps, and even going creative with flying a drone running free software.	What are FOSS, free software, open source, and FLOSS? Free and open source software (FOSS or F/OSS), and free/libre and open-source software (FLOSS) are umbrella terms that are used to include both free software and open source software. Adopted by noted software freedom advocate Richard Stallman in 1983, free software has many names — libre software, freedom-respecting software and software libre are some of them. As defined by the Free Software Foundation, one of the early advocates of software freedom, free software allows users not just to use the software with complete freedom, but to study, modify, and distribute the software and any adapted versions, in both commercial and noncommercial form. The distribution of the software for commercial and noncommercial form, however, depends on the particular license the software is released under. “Open source” was coined as an alternative to free software in 1998 by educational-advocacy organization Open Source Initiative. Open source software is generally created collaboratively, made available with its source code, and it provides the user rights to study, change, and distribute the software to anyone and for any purpose.

From South Asia, there are 13 celebratory events in India, eight in Nepal, one in Bangladesh and four in Sri Lanka.

South Asian countries have seen adoption of both free software and open source software by individuals, organizations and the government. The Free Software Movement of India was founded in Bengaluru, India, in 2010 to act as a national coalition of several regional chapters working to promote and grow the free software movement in India.

The Indian government has launched an open data portal at data.gov.in portal for sharing large datasets like the census data under free licenses. The government's new policy emphasizes on adopting open source software. Moreover government's Ministry of Communication and Information Technology asked vendors to include open source software applications while making requests for proposals.

Similarly, there are several free and open source communities and organizations operating from the subcontinent, like Mozilla India, Wikimedia India, the Centre for Internet and Society, Open Knowledge India, Mozilla Bangladesh, Wikimedia Bangladesh, Bangladesh Open Source Network, Open Knowledge Bangladesh, Mozilla Nepal, Wikimedians of Nepal, Open Knowledge Nepal, Wikimedia Community User Group Pakistan, and the Lanka Software Foundation in Sri Lanka.

Mohammad Jahangir Alam, a lecturer from Southern University Bangladesh, argues in a research paper that the use of open source software can help the government save a enormous amount of money that are spent in purchasing proprietary software:

A Large amount of money of government can be saved if the government uses open source software in different IT sectors of government offices and others sectors, Because government is providing computer to all educational institute from school to university level and they are using proprietary software. For this reason government is to expend a large amount of many for buying proprietary software to run the computers. Another one is government paying significant amount of money to the different vendors for buying different types of software to implement e-Governance project. So, the Government can use open source software for implanting projects to minimize cost of the projects.

It Took Just 355 Indians to Mine the Data of 5.6 Lakh Facebook Users. Here's How

Data privacy in India is still a nascent subject. Experts say cheap data has led to unprecedented Facebook penetration. Often, it is seen that those who open an account are not aware of the privacy concerns.

Over 5.6 lakh Indian Facebook profiles have allegedly been compromised and their data leaked to the controversial data analytics firm Cambridge Analytica. As per the company, only 335 people in India installed the App yet they managed to penetrate over half a million profiles.

So, how does this work?

Once a user downloaded the quiz app called “thisisyourdigitallife”, Global Science Research Limited got access to the entire treasure trove of data. There are two mechanisms which are used for this.

First, the Application Program Interface (API) of Facebook called ‘Social Graph’ allows any app to harvest the entire contact list and everything else that could be seen on a users’ friend’s profile. This would take place even for private profiles, says Sunil Abraham, Executive Director of Bangalore based research organization ‘Centre for Internet and Society’.

The second way is when users have a public profile. The algorithm seeks out public profiles from the friend list and would go on multiplying from one public profile to another without any of the users even coming to know what is happening. This is like the ‘True Caller’ application, for it to get your number, you don’t need to download the software. If anyone has the app and your number, then it gets automatically logged there.

Facebook says "Cambridge Analytica’s acquisition of Facebook data through the app developed by Dr Aleksandr Kogan and his company Global Science Research Limited (GSR) happened without our authorisation and was an explicit violation of our Platform policies."

GSR continued to access this data from all the Facebook profiles throughout the entire lifespan of the app on the Facebook platform, which was roughly two years between 2013 and 2015. This means, even if a user is careful enough to not download the application but his/her profile’s privacy settings are weak, the algorithm would infiltrate the data bank.

Amit Dubey, a Cyber Security Expert goes into the details of what the app did, “The app called 'thisisyourdigitallife', which was created for research work by Aleksandr Kogan, was eventually used for psychometric profiling of users and then manipulating their political biases. The app was offered to users on the pretext to take a personality test and it agreed to have their data collected for academic use only. But the app has exploited a security vulnerability of Facebook application.”

Facebook “platform policy” allowed only collection of friends’ data to improve user experience in the app and barred it from being sold or used for advertising.

But this kind of data scrapping is not just limited to Cambridge Analytica. The Social Media Algorithm is often abused in the world of data scavenging and analytics. Even law enforcement agencies have often used similar means to locate possible miscreants.

According to Shesh Sarangdhar, Chief Executive Officer in Seclabs & Systems Pvt Ltd, similar data scrapping helped them unearth the terror module behind one of the attacks at an airbase last year. Shesh said that through Social Media Algorithm they would often narrow down on unknown terror modules. What his team did was to connect to the profile the whereabouts of multiple known nods converging. That is how the mastermind was located.

Often, it is seen that those who open an account are not aware of the privacy concerns. But as Sunil Abraham puts it, Caveat emptor or ‘Let the Buyers Beware’ does not even apply here. It is not possible for anyone to go through the entire privacy policy.

“So it is not even right to ask if the consumer can protect his/her own interest. Thus, the state should proactively regulate the industry,” said Abraham.

Facebook has brought in a number of changes to its privacy settings. It now allows you to remove third-party apps in bulk. This welcome change has come after sustained pressure on the tech giant from users and a number of regulatory bodies across the world.

IT Act if enforced will leave internet use in India no freer than in China

The Centre for Internet & Societies (CIS), a Bangalore-based NGO, recently filed an RTI query with the Department of Information Technology (DIT), asking for a list of websites blocked by the Indian government under the IT Act. The department handed them a list of 11 websites. It was just one department’s list, but this was the first time such a list was being made public. "The information given was not comprehensive. For instance, we still don’t know who ordered these blocks," says Sunil Abraham, executive director, CIS, "We will file another RTI application to get those details out."

As of now, Indians enjoy considerably free access to information online, and the right to freedom of expression is protected by the Constitution. But you run into a veil of secrecy when trying to find out what sort of information is being blocked online, who is doing it, and for what reason. The list of 11 revealed by the DIT is only representative — no one can even guess the real number because, well, there is no way of knowing when a website gets blocked.

What is more disturbing is that the government has formulated a set of rules that can block content considered "disparaging", "harassing", or "blasphemous", besides a whole range of other labels that are vague and hence open to interpretation. The rules put the onus of removing such material on intermediaries such as ISPs (internet service providers) and websites that host the content — within 36 hours of a complaint being filed. And just about anyone can request that the content be taken down — all they have to do is write a letter or an email with an electronic signature. There is no provision for the intermediary to challenge the complainant’s assessment of the content in question.

Users will be afraid

In other words, censorship will now be a free-for-all exercise. Protests, such as the one we saw during the Jan Lokpal agitation, can be nipped in the bud since anyone, including politicians, can claim that they are being "harassed". Information revealed by websites like WikiLeaks can be blocked because they may "threaten friendly relations with foreign states".

There is a sense of shock among the handful of netizens who are aware of these rules and the potential for their misuse. "What are we, Saudi Arabia? We don’t expect this from India. This is something very serious," Pushkar Raj, general secretary of the People’s Union for Civil Liberties, has been quoted as saying. MediaNama, a website reporting on the media industry, points out, "Who defines 'blasphemous'?... India doesn’t even have a blasphemy law, so who interprets what is blasphemous or not?" Media watchdog The Hoot’s Geeta Seshu says, "This is chilling. Websites will be wary of putting up content. How can one appeal? How can one have a free discussion on anything at all online?"

Vishal Anand, product manager at Burrp, an online startup that hosts user-generated reviews of restaurants, is worried about the impact it will have on the discussions happening on the website. "I hope the ecosystem is not impacted. Users may be more afraid to respond, and businesses will be afraid about the content they host."

Guilty until proven innocent

The fundamental issue is that the onus is on the carrier or host to prove that the content is inoffensive, if any objection is raised. "The regulation is placing the burden on the intermediary so that there is no need to go to court (to get content blocked). This is going to lead to a lot of private intervention. You will have to go to court to get the content back up online, rather than the other way around," says Delhi-based lawyer Apar Gupta.

In fact, intermediary liability is a contentious topic globally, and this is not the first time it has caused a controversy in India. Back in 2004, Ebay India’s CEO Avinash Bajaj was arrested because a user tried to sell a pornographic CD on its website. This set off a furious debate on the issue, with the government finally agreeing to amend the IT Act. Gupta notes on his blog, "Even after the IT Act was amended, the government failed to make any rules… In the absence of rules, intermediaries continued to be dragged to court and to the police station. This includes a recent incident where an FIR was registered against Facebook."

Checks and balances exist

These developments lend credence to a recent report on internet freedom released by US-based NGO Freedom House, which ranks India 14th out of the 37 countries surveyed. Stating that the internet in India is only "partly free", the report notes, “Pressure on private intermediaries to remove certain information in compliance with administrative censorship orders has increased since late 2009, with the implementation of the amended IT Act. The revised law grants (the government) the authority to block internet material that is perceived to endanger public order or national security… and assigns up to seven years' imprisonment for representatives of a wide range of private service providers… if they fail to comply with government blocking requests." What is even more troubling is that the current rules weren’t even in place when this report was being prepared.

The new rules could worsen India’s internet freedom rankings. Responding to DNA, Sarah Cook, Asia research analyst and assistant editor, Freedom House, said, “We would have concerns over some of the rules and how they came about. This includes broad and vaguely worded censorship criteria, apparent initiation of the regulations "quietly" without significant consultation with key stakeholders, and absence of an appeals process for those who might disagree with censorship decisions."

Legal experts in India too are puzzled by the new restrictions when there are already reasonable restrictions on freedom of expression that the Constitution defines.

"There are anti-defamation provisions in the law. Then why include 'disparaging' in the new rules? Why is impersonating being made illegal? For example, on online dating websites for gays, users may not feel comfortable revealing their identities straightaway. And if somebody is impersonating to commit fraud, there are laws that already exist that deal with it. Instead of incorporating existing offences, the scope of what may be considered illegal is being broadened," says CIS’s Abraham.

The new rules are so broad-based that anyone can claim they are offended and demand that content be taken down, even out of business rivalry.

For example, Zone-H.org, run by Italy-based Roberto Preatoni, was one of the 11 websitesblocked by the Department of Information Technology. This was done after the Delhi High Court passed an ex-parte interim order (where the other party is not present) in the E2 Labs versus Zone-H case to block the website.

"This seems unnecessary since it is some kind of private business battle between E2 Labs and Zone H. Where was the need for the Indian government to get involved?" asks Abraham.

Bangalore-based cyber law expert N Vijayashankar agrees. "Websites are being blocked using interim orders. There is no national interest involved in some of these cases. Plus, there is no need to block the entire website, just a particular page could be blocked."

In fact, one of the webpages blocked was an opinion piece Vijayashankar had written about the Zone-H case on BloggerNews.net. "I had no intimation that the webpage was being blocked," says Vijayashankar, who got to know about the blockage only after CIS published the DIT’s response.

Learn from the world

Globally, excessive regulation of online discussions, particularly those related to political and social issues, can kill the open exchange of information. "In many countries, we saw that new laws, prosecutions, or proactive government censorship contributed to greater self-censorship among users. This is particularly pernicious when it affects discussions that relate to public interest or that affect people's well-being — such as an Indonesian housewife facing high fines for circulating critical comments about a local hospital, the Chinese authorities censoring content on torture in police custody, or the Korean government prosecuting a blogger who posted pessimistic predictions about the country’s economy," says Cook.

Cook acknowledges that balancing the right to freedom of expression against security threats, hate speech or child pornography is quite difficult — even for nations that rank high in their study. But there are a few best practices that India could learn from. "Examples of good practices would include no criminal defamation provisions (though criminal penalties for inciting violence would be appropriate), immunity for online content providers from being held liable for the information posted by their users (there is such a law in the United States), and multi-stakeholder consultations prior to the passing of regulations related to the internet/digital media."

The new rules India has come up with fly in the face of such best practices. Authorities and netizens alike should be on the guard, lest we go the China way.
