    <title>No, India did NOT oppose the United Nations move to “make internet access a human right”</title>

        &lt;b&gt;Last Friday, the United Nations Human Rights Council (UNHRC) passed a resolution titled “The promotion, protection and enjoyment of human rights on the Internet.”&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;The article by Pranesh Prakash and Japreet Grewal &lt;a class="external-link" href="http://factordaily.com/no-india-not-oppose-united-nations-move-make-internet-access-human-right/"&gt;was published in Factordaily&lt;/a&gt; on July 13, 2016.&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;Several media outlets, including &lt;a href="http://www.theverge.com/2016/7/4/12092740/un-resolution-condemns-disrupting-internet-access"&gt;T&lt;/a&gt;&lt;a href="http://www.theverge.com/2016/7/4/12092740/un-resolution-condemns-disrupting-internet-access" target="_blank"&gt;he Verge&lt;/a&gt;, &lt;a href="http://indiatoday.intoday.in/technology/story/un-seeks-to-make-web-access-human-right-india-joins-saudi-arabia-in-opposing-it/1/707353.html"&gt;India Today&lt;/a&gt;, and &lt;a href="https://www.buzzfeed.com/sheerafrenkel/intentionally-banning-access-to-the-internet-is-not-ok-says?utm_term=.uxVr5YzNpQ#.xrwYvzrpLy" target="_blank"&gt;BuzzFeed&lt;/a&gt;,  reported that the resolution was ‘opposed’ by China, Russia, Saudi  Arabia, South Africa and India. The Verge, for instance, reported that  these countries “specifically opposed” a clause of the resolution that “&lt;i&gt;condemns unequivocally measures to intentionally prevent or disrupt access to or dissemination of information online&lt;/i&gt; &lt;i&gt;and calls for all countries to refrain from such measures&lt;/i&gt;”.   This is pure bunkum.  Some media organisations have also been reporting  that the UNHRC resolution “declares that access to the Internet is a  human right”. This too is fiction.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;What’s the truth?  The UNHRC resolution covers wide ground, including  the reaffirmations of two previous resolutions, which stated that the  same rights that people have offline must also be protected online as  well.  As ARTICLE19, an international free speech NGO, &lt;a href="https://www.article19.org/resources.php/resource/38428/en/unhrc:-reject-attempts-to-weaken-resolution-on-human-rights-and-the-internet" target="_blank"&gt;notes&lt;/a&gt;:  “The draft resolution goes further than its predecessors, including by  stressing the importance of an accessible and open Internet to the  achievement of the Sustainable Development Goals, as well as in calling  for accountability for extrajudicial killings, arbitrary detentions and  other violations against people for expressing themselves online.”   Importantly, the resolution “unequivocally condemns” internet shutdowns,  such as the one that happened in Kashmir just last week after security  forces killed guerrilla Burhan Wani.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;This resolution was, in fact, adopted without any opposition. So why the brouhaha over countries like India?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Here are the facts&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There were four separate amendments, two of which were proposed by Belarus, China and Russia (referred as &lt;a href="https://documents-dds-ny.un.org/doc/UNDOC/LTD/G16/139/31/PDF/G1613931.pdf?OpenElement"&gt;L85&lt;/a&gt;, &lt;a href="https://documents-dds-ny.un.org/doc/UNDOC/LTD/G16/138/28/PDF/G1613828.pdf?OpenElement"&gt;L86&lt;/a&gt; in this article) and the other two were proposed by Belarus, China, Russia and Iran (referred as &lt;a href="https://documents-dds-ny.un.org/doc/UNDOC/LTD/G16/138/37/PDF/G1613837.pdf?OpenElement"&gt;L87&lt;/a&gt; and &lt;a href="https://documents-dds-ny.un.org/doc/UNDOC/LTD/G16/138/52/PDF/G1613852.pdf?OpenElement"&gt;L88&lt;/a&gt;).   None of these amendments comment on the paragraph in the resolution  that condemns intentional disruption of access or dissemination of  internet services. So the headlines in most of the reports are just  plain wrong. Let’s examine each of these four amendments one by one&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In &lt;b&gt;L85&lt;/b&gt;, an amendment was suggested to a paragraph  that refers to past resolutions by the UNHRC and the UN General Assembly  relating to freedom of expression and the right to privacy online. The  amendment, which proposed including a reference to a previous UNHRC  resolution on the rights of children online, was later withdrawn.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In &lt;b&gt;L86&lt;/b&gt; the proposed amendments both added and  removed some text, and was hotly opposed by organisations like  ARTICLE19. The proposed amendment said that the same rights people have  offline must also be protected online, in particular, freedom of  expression and the right to privacy, in accordance with articles 17 and  19 of the International Covenant on Civil and Political Rights (ICCPR), a  multilateral treaty adopted by the United National General Assembly to  respect civil and political rights of individuals. Major additions: Some  text on right to privacy and a reference to Article 17 of the ICCPR,  which is about privacy. Major deletions: a reference to the Universal  Declaration on Human Rights, and language stating that that freedom of  expression is “applicable regardless of frontiers and through any media  of one’s choice”, which is present in article 19 of the ICCPR.  However,  article 19 of the ICCPR is incorporated by reference even in the  proposed amendment!  So is there a real loss in purely legal terms?  Not  really.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The amendments in &lt;b&gt;L87&lt;/b&gt; sought to replace the term  “human rights based approach” that stressed on the need to provide and  expand access to the internet, and to replace it with the term  “comprehensive and integrated approach.” The problem is that there is no  clarity about what a “human rights based approach” to providing and  expanding access to the internet is. What does it even mean? Is there a  “human rights based approach” to spectrum auctions and spectrum sharing?  Or the laying of fibre optic cables? Or anything else associated with  internet access?  If there is, indeed, a human rights based approach to  providing and expanding access to the internet, it should be spelt out,  rather than simply calling it that. Similarly, the term “comprehensive  and integrated approach” is equally vague.&lt;/p&gt;

&lt;blockquote&gt;
&lt;p&gt;Even  if one harbours reservations about these amendments, none of these  amendments could be reasonably be characterised as “opposing” the  condemnation of Internet shutdowns or “opposing” online freedoms.&lt;/p&gt;
&lt;/blockquote&gt;
&lt;/div&gt;
&lt;p style="text-align: justify; "&gt;Finally, in &lt;b&gt;L88&lt;/b&gt;, the amendments proposed that the UN  resolution should acknowledge concerns about using the internet and  information technology for spreading ideas about “racial superiority or  hatred, incitement to racial discrimination, xenophobia and related  intolerance.” In the light of this, it is difficult to understand how  adding concerns relating to hate speech to the resolution is seen as  “being opposed” to online freedoms, especially when there is no direct  action contemplated in the proposed amendment.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Indeed, in Paragraph 9, gender violence is mentioned, and in  Paragraph 11, incitement to hatred is mentioned.  Adding an additional,  more specific reference can &lt;a href="https://www.article19.org/data/files/pdfs/conferences/iccpr-links-between-articles-19-and-20.pdf"&gt;hardly be construed as being opposed to online freedoms&lt;/a&gt;.  After all, states have a positive obligation to enact laws to prohibit  hate speech under Article 20 (2) of the ICCPR, which is a centrepiece of  international human rights law.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Even if one harbours reservations about these amendments, none of  these amendments could be reasonably be characterised as “opposing” the  condemnation of Internet shutdowns or “opposing” online freedoms. And  factually, no states (including India, China, South Africa, Russia, and  more) voted against the resolution.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;A game of Chinese whispers&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;So why did so many prominent news organisations around the world get  it so wrong? My theory is that it happened because organisation like  ARTICLE19 put out press releases on what they perceived as the  ‘weakening’ of the resolutions by the amendments examined above, and  their regret that even democratic states like India and South Africa  voted for these amendments.  This was wrongly portrayed in much of the  media as opposition by these countries to the resolution itself, to  online freedoms, and particularly as opposition to the idea of  condemning internet shutdowns.  Thanks to the Chinese whispers nature of  news reporting, this mistaken idea spread far and wide without any of  the reporters bothering to check the original UN documents.&lt;/p&gt;

&lt;blockquote&gt;
&lt;p&gt;It  is shameful if India condemns internet shutdowns at the UNHRC while  deploying them for purposes such as preventing cheating during an  examinations, during Ganesha &lt;i&gt;visarjan&lt;/i&gt;, during Eid, during wrestling matches, and during protests.&lt;/p&gt;
&lt;/blockquote&gt;
&lt;/div&gt;
&lt;p style="text-align: justify; "&gt;However, regardless of the faulty reportage, there is a real crisis  in India, with organisations like Medianama and  the Software Freedom  Law Centre having counted at least nine internet shutdowns this year  alone, and at least 30 since 2013. It is shameful if India condemns  internet shutdowns at the UNHRC while deploying them for purposes such  as preventing cheating during an examinations, during Ganesha &lt;i&gt;visarjan&lt;/i&gt;, during Eid, during wrestling matches, and during protests.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;We at the Centre for Internet and Society have previously explained  why a Gujarat High Court order allowing for an internet shutdown during  riots &lt;a href="http://cis-india.org/internet-governance/blog/the-legal-validity-of-bans-on-internet-part-i"&gt;was wrong&lt;/a&gt; &lt;a href="http://cis-india.org/internet-governance/blog/the-legal-validity-of-internet-bans-part-ii"&gt;in law&lt;/a&gt;,  and violated our Constitution as well as our international human rights  obligations.  That is something the India media ought to be focussing  far more on, but aren’t.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Lastly, it would also be welcome for the individual civil society  organisations that signed an open letter to UNHRC members to explain why  they too believed that these amendments would have significantly harmed  our freedoms online.  We see it instead as a case of ‘human rights  politics’ being played out, when none of the proposed amendments would  have had much of a negative legal impact, but only a political impact.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Should civil society organisations really get worked up about these?&lt;/p&gt;

    <title>No access to pornography in cyber cafes, declare new rules</title>

        &lt;b&gt;Fresh guidelines, which are part of Information Technology (guidelines for cyber cafe) Rules 2011, will require cyber cafe owners to "tell users" not to surf websites that contain "pornographic or obscene material". Experts termed the rule arbitrary, saying that watching pornography is not an offence in India. This article by Javed Anwer was published in the Times of India on April 26, 2011.&lt;/b&gt;
        
&lt;p&gt;According to the rules notified on April 11, all cyber cafes in the country will have to register with an "agency as notified" by the government. While some of the guidelines deal with the security threat posed by "anonymous internet users", most aim to make sure that people don't use cyber cafes to access pornographic material.&lt;/p&gt;
&lt;p&gt;Pawan Duggal, a lawyer who specializes in IT laws, said the new guidelines were arbitrary. "Watching pornography is not illegal in India," he said. "It's absurd to ask cyber cafe owners to tell their customers not to access pornographic material even as law allows individuals to access adult websites unless it's not child pornography. The new rules require a second look."&lt;/p&gt;
&lt;p&gt;The new rules suggest cafe owners install filtering software and keep a log of all websites accessed by customers for at least one year. Cafe owners have also been asked not to build a cabin/cubicle with a height of more than four and half feet. In a cyber cafe where there are no cubicles, "owners will have to place computers with the screens facing outward" or towards open space. The move is aimed at reducing privacy a cyber cafe user can get.&lt;/p&gt;
&lt;p&gt;Duggal said if implemented earnestly, the new rules will put most of cyber cafe owners out of business.&lt;/p&gt;
&lt;blockquote class="webkit-indent-blockquote"&gt;
&lt;p&gt;Internet activists termed the guidelines "unconstitutional". Pranesh Prakash, a programme manager with Centre of Internet and Society, said the rules will violate privacy and will hamper internet users' ability to freely express themselves.&lt;/p&gt;
&lt;/blockquote&gt;
&lt;p&gt;The new rules make it mandatory for user to carry an identity card. Cyber cafe owners have been asked to give user logs to the "registration agency" every month as well keep these records along with the log of websites accessed at the cyber cafe safe for a period of one year. A few cafe owners said that technically, it would be a daunting task to keep a record of every website accessed using their computers for a year.&lt;/p&gt;
&lt;blockquote class="webkit-indent-blockquote"&gt;
&lt;p&gt;While minors, if carrying identity cards have been permitted to use computers in a cyber cafe, they won't be allowed inside cubicles if not accompanied by guardians or parents. There is also provision of photographing cyber cafe users using a webcam or other device. The photographs will have to be authenticated by the user. Prakash said that photographing users raises serious privacy questions, especially in the case of children.&lt;/p&gt;

    <title>NITI Aayog Discussion Paper: An aspirational step towards India’s AI policy</title>

The 115-page discussion paper attempts to be an all encompassing document looking at a host of AI related issues including privacy, security, ethics, fairness, transparency and accountability.&lt;/b&gt;

&lt;p style="text-align: justify; "&gt;&lt;span&gt;The 115-page discussion paper attempts to be an all encompassing document looking at a host of AI related issues including privacy, security, ethics, fairness, transparency and accountability. The paper identifies five focus areas where AI could have a positive impact in India.&lt;/span&gt;&lt;span&gt; It also focuses on reskilling as a response to the potential problem of job loss due the future large-scale adoption of AI in the job market.&lt;/span&gt;&lt;span&gt; This blog is a follow up to the comments made by CIS on Twitter&lt;/span&gt;&lt;span&gt; on the paper and seeks to reflect on the National Strategy as a well researched AI roadmap for India. In doing so, it identifies areas that can be strengthened and built upon.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Identified Focus Areas for AI Intervention&lt;/strong&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The paper identifies five focus areas—Healthcare, Agriculture, Education, Smart Cities and Infrastructure, Smart Mobility and Transportation, which Niti Aayog believes will benefit most from the use of AI in bringing about social welfare for the people of India.&lt;/span&gt;&lt;span&gt; Although these sectors are essential in the development of a nation, the failure to include manufacturing and services sectors is an oversight. Focussing on  manufacturing is fundamental not only in terms of economic development and user base, but also regarding questions of safety and the impact of AI on jobs and economic security. The same holds true for the service sector particularly since AI products are being made for the use of consumers, not just businesses. Use of AI in the services sector also raises critical questions about user privacy and ethics. Another sector the paper fails to include is defense, this is worrying since India is chairing the Group of Governmental Experts &lt;/span&gt;&lt;span&gt;on Lethal Autonomous Weapons Systems (LAWS) in 2018.&lt;/span&gt;&lt;span&gt; Across sectors, the report fails to look at how AI could be utilised to ensure accessibility and inclusion for the disabled. This is surprising, as  aid for the differently abled and accessibility technology was one of the 10 domains identified in the Task Force Report on AI published earlier this year. &lt;/span&gt;&lt;span&gt;This should have been a focus point in the paper as it  aims to identify applications with maximum social impact and inclusion.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;In its vision for the use of AI in smart cities, the&lt;/span&gt;&lt;span&gt; paper suggests the adoption of a sophisticated surveillance system as well as the use of social media intelligence platforms to check and monitor people’s movement both online and offline to maintain public safety.&lt;/span&gt;&lt;span&gt; This is at variance with constitutional standards of due process and criminal law principles of reasonable ground and reasonable suspicion. Further, use of such methods will pose issues of judicial inscrutability. From a rights perspective, state surveillance can directly interfere with fundamental rights including privacy, freedom of expression, and freedom of assembly. Privacy organizations around the world have raised concerns regarding the increased public surveillance through the use of AI.&lt;/span&gt;&lt;span&gt; Though the paper recognized the impact on privacy that such uses would have, it failed to set a strong and forward looking position on the issue - such as advocating that such surveillance must be lawful and inline with international human rights norms.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;&lt;strong&gt;Harnessing the Power of AI and Accelerating Research&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;One of the ways suggested for the proliferation of AI in India was to increase research, both core and applied, to bring about innovation that can be commercialised.&lt;/span&gt;&lt;span&gt; In order to attain this goal the paper proposes a two-tier integrated approach: the establishment of  COREs (Centres of Research Excellence in Artificial Intelligence) and ICTAI (International Centre for Transformational Artificial Intelligence).&lt;/span&gt;&lt;span&gt; However the roadmap to increase research in AI fails to acknowledge the principles of public funded research such as free and open source software (FOSS), open standards and open data. The report also blames the current Indian  Intellectual Property regime for being “unattractive” and averse to incentivising research and adoption of AI.&lt;/span&gt;&lt;span&gt; Section 3(k) of Patents Act exempts algorithms from being patented, and the Computer Related Inventions (CRI) Guidelines have faced much controversy over the patentability of mere software without a novel hardware component.&lt;/span&gt;&lt;span&gt; The paper provides no concrete answers to the question of whether it should be permissible to patent algorithms, and if yes, to  to what extent. Furthermore, there needs to be a standard either in the CRI Guidelines or the Patent Act, that distinguishes between AI algorithms and non-AI algorithms. Additionally, given that there is no historical precedence on the requirement of patent rights to incentivise creation of AI,  innovative investment protection mechanisms that have lesser negative externalities, such as compensatory liability regimes&lt;/span&gt;&lt;span&gt; would be more desirable.  The report further failed to look at the issue holistically and recognize that facilitating rampant patenting can form a barrier to smaller companies from using or developing  AI. This is important to be cognizant of given the central role of startups to the AI ecosystem in India and because it can work against the larger goal of inclusion articulated by the report.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;&lt;strong&gt;Ethics, Privacy, Security and Safety&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;In a positive step forward, the paper addresses a broader range of ethical issues concerning AI including transparency, fairness, privacy and security and safety in more detail when compared to the earlier report of the Task Force.&lt;/span&gt;&lt;span&gt; Yet despite a dedicated section covering these issues, a number of concerns still remain unanswered.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;&lt;strong&gt;Transparency&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The section on transparency and opening the Black Box has several lacunae.&lt;/span&gt;&lt;span&gt; First, AI that is used by the government, to an acceptable extent, must be available in the public domain for audit, if not under Free and Open Source Software (FOSS). This should hold true in particular for uses that impinge on fundamental rights. Second, if the AI is utilised in the private sector, there currently exists a right to reverse engineer within the Indian Copyright Act,&lt;/span&gt;&lt;span&gt; which is not accounted for in the paper. Furthermore, if the AI was involved both in the commission of a crime or the violation of human rights, or in the investigations of such transgressions, questions with regard to judicial scrutability of the AI remain. In addition to explainability, the source code must be made circumstantially available, since explainable AI&lt;/span&gt;&lt;span&gt; alone cannot solve all the problems of transparency. In addition to availability of source code and explainability, a greater discussion is needed about the tradeoff between a complex and potentially more accurate AI system (with more layers and nodes)  vs. an AI system which is potentially not as accurate but is able to provide a human readable explanation.&lt;/span&gt;&lt;span&gt; It is interesting to note that transparency within human-AI interaction is absent in the paper. Key questions on transparency, such as whether an AI should disclose its identity to a human have not been answered.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;&lt;strong&gt;Fairness&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;With regards to fairness, the paper mentions how AI can amplify bias in data and create unfair outcomes.&lt;/span&gt;&lt;span&gt; However, the paper neither suggests detailed or satisfactory solutions nor does it deal with biased historical data in an Indian context. More specifically, there seems to be no mention of regulatory tools to tackle the problem of fairness, such as:&lt;/span&gt;&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;&lt;span&gt;Self-certification&lt;/span&gt;&lt;/li&gt;
&lt;li&gt;&lt;span&gt;Certification by a self-regulatory body&lt;/span&gt;&lt;/li&gt;
&lt;li&gt;&lt;span&gt;Discrimination impact assessments&lt;/span&gt;&lt;/li&gt;
&lt;li&gt;&lt;span&gt;Investigations by the privacy regulator &lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&lt;span&gt;Such tools will proactively need to ensure&lt;/span&gt;&lt;span&gt; inclusion, diversity, and equity in composition and decisions.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Additionally, with reference to correcting bias in AI, it should be noted that the technocratic view that as an AI solution continues to be trained on larger amounts of data  , systems will self correct, does not fully recognize the importance of data quality and data curation, and is inconsistent with fundamental rights. Policy objectives of AI innovation must be technologically nuanced and cannot be at the cost of intermediary denial of rights and services.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Further, the paper does not deal with issues of multiple definitions and principles of fairness, and that building definitions into AI systems may often involve choosing one definition over the other. For instance, it can be argued that the set of AI ethical principles articulated by Google&lt;/span&gt;&lt;span&gt; are more consequentialist in nature involving a a cost-benefit analysis, whereas a human rights approach may be more deontological in nature. In this regard, there is a need for interdisciplinary research involving computer scientists, statisticians, ethicists and lawyers.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;&lt;strong&gt;Privacy&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Though the paper underscores the importance of privacy and the need for a privacy legislation in India - the paper limits the potential privacy concerns arising from AI to collection, inappropriate use of data, personal discrimination, unfair gain from insights derived from consumer data  (the solution being to explain to consumers about the value they as consumers gain from this), and unfair competitive advantage by collecting mass amounts of data (which is not directly related to privacy).&lt;/span&gt;&lt;span&gt; In this way the paper fails to discuss the full implications on privacy that AI might have and fails to address the data rights necessary to enable the right to privacy in a society where AI is pervasive. The paper fails to engage with emerging principles from data protection such as right to explanation and right to opt-out of automated processing, which directly relate to AI. Further, there is no discussion on the issues such as data minimisation and purpose limitation which some big data and AI proponents argue against. To that extent, there is a lack of appreciation of the difficult policy questions concerning privacy and AI. The paper is also completely silent on redress and remedy.  Further the paper endorses the seven data protection principles postulated by the Justice Srikrishna Committee.&lt;/span&gt;&lt;span&gt; However CIS has pointed out that these principles are generic and not specific to data protection.&lt;/span&gt;&lt;span&gt; Moreover, the law chapter of IEEE’s ‘&lt;/span&gt;&lt;em&gt;&lt;span&gt;Global Initiative on Ethics of Autonomous and Intelligent Systems’&lt;/span&gt;&lt;/em&gt;&lt;span&gt; has been ignored in favor of the chapter on ‘&lt;/span&gt;&lt;em&gt;&lt;span&gt;Personal Data and Individual Access Control in Ethically Aligned Design&lt;/span&gt;&lt;/em&gt;&lt;span&gt;’&lt;/span&gt;&lt;span&gt; as the recommended international standard.&lt;/span&gt;&lt;span&gt; Ideally, both chapters should be recommended for a holistic approach to the issue of ethics and privacy with respect to AI. &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;&lt;strong&gt;AI Regulation and Sectoral Standards&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The discussion paper’s approach towards sectoral regulation advocates collaboration with industry to formulate regulatory frameworks for each sector.  However, the paper is silent on the possibility of reviewing existing sectoral regulation to understand if they require amending. We believe that this is an important solution to consider since amending existing regulation and standards often takes less time than formulating and implementing new regulatory frameworks.&lt;/span&gt;&lt;span&gt; Furthermore, although the emphasis on awareness in the paper is welcome, it must complement regulation and be driven by all stakeholders, especially given India’s limited regulatory budget. The over reliance on industry self-regulation, by itself, is not advisable, as there is an absence of robust industry governance bodies in India and self-regulation raises questions about the strength and enforceability of such practices. The privacy debate in India has recognized this and reports, like the Report of the Group of Experts on Privacy, recommend a co-regulatory framework with industry developing binding standards that are inline with the national privacy law and that are approved and enforced by the Privacy Commissioner.&lt;/span&gt;&lt;span&gt; That said, the UN Guiding Principles on Business and Human Rights and its “protect, respect, and remedy” framework should guide any self regulatory action.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;&lt;strong&gt;Security and Safety of AI Systems&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;In terms of security and safety of AI systems the paper seeks to shift the discussion of accountability being primarily about liability, to that of one about the  explainability of AI.&lt;/span&gt;&lt;span&gt; Furthermore, there is no recommendation of immunities or incentives for whistleblowers or researchers to report on privacy breaches and vulnerabilities. The report also does not recognize certain uses of AI as being more critical than others because of their potential harm to the human. This would include uses in healthcare and autonomous transportation. A key component of accountability in these sectors will be the evolution of appropriate testing and quality assurance standards. Only then, should safe harbours be discussed as an extension of the negligence test for damages caused by AI software. Additionally, the paper fails to recommend kill switches, which should be mandatory for all kinetic AI systems.&lt;/span&gt;&lt;span&gt; Finally, there is no mention of mandatory human-in-the-loop in all systems where there are significant risks to safety and human rights. Autonomous AI is only viewed as an economic boost, but its potential risks have not been explored sufficiently. A welcome recommendation would be for all autonomous AI to go through human rights impact assessments.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;&lt;strong&gt;Research and Education&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Being a government think-tank, the NITI Aayog could have dealt in detail with the AI policies of the government and looked at how different arms of the government are aiming to leverage AI and tackle the problems arising out of the use of AI. Instead of tabulating the government’s role in each area and especially research, the report could have also listed out the various areas where each department could play a role in the AI ecosystem through regulation, education, funding research etc. In terms of the recommendations for introducing AI curriculums in schools, and colleges,&lt;/span&gt;&lt;span&gt; the government could also ensure that ethics and rights are  part of the curriculum - especially in technical institutions. A possible course of action could include corporations paying for a pan-Indian AI education campaign.This would also require the government to formulate the required academic curriculum that is updated to include rights and ethics. &lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;&lt;strong&gt;Data Standards and Data Sharing&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Based on the amount of data the Government of India collects through its numerous schemes, it has the potential to be the largest aggregator of data specific to India. However the paper does not consider the use of this data with enough gravity. For example, the paper recommends Corporate Data Sharing for “social good” and making government datasets from the social sector available publicly.&lt;/span&gt;&lt;span&gt; Yet  this section does not mention privacy enhancing technologies/standards such as pseudonymization, anonymization standards, differential privacy etc. Additionally there should be provisions that allow the government to prevent the formation of monopolies by regulating companies from hoarding user data. The open data standards could also be applicable to the private companies, so that they can also share their data in compliance with the privacy enhancing technologies mentioned above. The paper also acknowledges that AI Marketplaces require monitoring and maintenance of quality. It recognises the need for “continuous scrutiny of products, sellers and buyers”&lt;/span&gt;&lt;span&gt;, and proposes that the government enable these regulations in a manner that private players could set up the marketplace. This is a welcome suggestion, but the legal and ethical framework of the AI Marketplace requires further discussion and clarification.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;&lt;strong&gt;An AI Garage for Emerging Economies&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The discussion paper also qualifies India as an “ideal test-bed”&lt;/span&gt;&lt;span&gt; for trying out AI related solutions. This is problematic since questions of regulation in  India with respect to AI have yet to be legally clarified and defined and India does not have a comprehensive privacy law. Without a strong ethical and regulatory framework, the use of new and possibly untested technologies in India could lead to unintended and possibly harmful outcomes.The government's ambition to position India as a leader amongst developing countries on AI related issues should not be achieved by using Indians as test subjects for technologies whose effects are unknown.&lt;/span&gt;&lt;/p&gt;
&lt;p&gt;&lt;span&gt;&lt;strong&gt;Conclusion&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;In conclusion, NITI Aayog’s discussion paper represents a welcome step towards a comprehensive AI strategy for India. However, the trend of inconspicuously releasing reports (this and the AI Task Force) as well as the lack of a call for public comments, seems to be the wrong way to foster discussion on emerging technologies that will be as pervasive as AI. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The blanket recommendations were provided without looking at its viability in each sector.&lt;/span&gt;&lt;span&gt; Furthermore, the discussion paper does not sufficiently explore or, at times, completely omits key areas. It barely touched upon societal, cultural and sectoral challenges to the adoption of AI — research that CIS is currently in the process of undertaking.&lt;/span&gt;&lt;span&gt;Future reports on Indian AI strategy should pay more attention to the country’s unique legal context and to possible defense applications and take the opportunity to establish a forward looking, human rights respecting, and holistic position in global discourse and developments. Reports should also consider infrastructure investment as an important prerequisite for AI development and deployment. Digitised data and connectivity as well as more basic infrastructure, such as rural electricity and well-maintained roads, require more funding to more successfully leverage AI for inclusive economic growth. Although there are important concerns, the discussion paper is an aspirational step toward India’s AI strategy. &lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;First up is our Tandem Partner &lt;a href="http://cdc.leuphana.com/people/#nishant-shah"&gt;Dr. Nishant Shah&lt;/a&gt;, Research Associate at Common Media Lab and Hybrid Publishing Lab. He is the co-founder and Director-Research at the &lt;a href="https://cis-india.org/"&gt;Centre for Internet and Society&lt;/a&gt; in Bangalore, India.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Julia Rehfeldt&lt;/b&gt;: Dr. Shah, can you introduce yourself briefly und tell us what you are currently concerned with in your research?&lt;br /&gt; &lt;br /&gt; &lt;b&gt;Dr. Nishant Shah&lt;/b&gt;: This is a question that has always flummoxed  me. I have spent all of the last decade trying to figure out how to  explain what I do and what my research concerns are and I never have one  straightforward answer to give.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The easiest way to answer this would be to say that I wear many hats.  I am deeply interested in looking at how the digital shift is changing  the way in which we see the world around us. And so my work spans  several sectors, disciplines and intersections, trying to look at the  mechanics and logics, logistics and structures of the world that we live  in.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;At the Hybrid Publishing Lab, as an International Tandem Partner, I  look at the knowledge infrastructures of the digital times. I learn from  the research and practice of my colleagues to explore the future of  academic publishing, and I try to critically think through questions of  Intellectual Property, Open Access movements, and concerns of Digital  Humanities in the global knowledge circuits. Apart from that, I like to  translate my research and knowledge for different stakeholders, to work  with practitioners, policy makers, artists, technologists, hackers,  legal scholars and development actors at the intersection of Internet  and Society. As the Director – Research at the Centre for Internet and  Society, Bangalore, I have been trying to develop South-based global  networks that examine the conditions of being human, being social, and  being political in emerging network societies. I also enjoy exploring  new forms and content of pedagogy for students in and out of the  classrooms, to develop new conditions of learning through and with  digital media and cultures.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;&lt;br /&gt; Rehfeldt:&lt;/b&gt; What was the most significant change, talk or lecture you  experienced in 2013 that had an impact on the rights of open access or  on your personal insights on that matter?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Dr. Shah&lt;/b&gt;: I think, on a very personal and a professional  level, the death of Aaron Swartz and the horrific face of Intellectual  Property tyrannies that surround the academic publishing which  ironically focuses on questions of human liberty, values, equity and  access, has had the most dramatic impact on me. Aaron Swartz committed  suicide just over a year ago, and the conditions of his persecution, on  the behalf of the American legal system, the intellectual property  conglomerates and a globally reputed university that claims to build  better futures for our digital worlds, has shocked most of us.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While playing the blame-game is redundant now – it is not going to  bring back a young man who only believed in dreams of utopic sharing and  commons – it is important to remind us that these battles of  information and intellectual property are not for niche circles. We are  increasingly living in worlds where more and more of our everyday life  is being mediated, mitigated and measured in big data and quantified  services.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;We don’t only live in information age, but we also live through  information, constantly producing data. And the technologies we use, the  applications we live with, the platforms we live on, the social  networks that we belong to, all take our information and data and  copyright it so that we have almost no rights over it. This problem  becomes only more amplified in the traditional academic knowledge  industries where publicly funded research and practice gets hidden  behind paywalls so that it remains in niche circles of access to those  with privilege. We are reaching a stage where not only our formal  knowledge but even our thoughts, desires and memories are quickly being  contained in forms and formats that are no longer accessible to us.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;2013 has shown that the more we lose control of our data, the more we  lose battles of access to our collective knowledge, the more we concede  our rights to information, which is the de facto currency of our times,  the more we are going to be at the service of private and governmental  conglomerates that shall control and contain the possibilities of  radical transformation and change in our future.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;&lt;br /&gt; Rehfeldt:&lt;/b&gt; You are currently involved in setting up a ‘Making Change’  project based on your paper ‘Whose change is it, anyway?’ published  April 2013. Can you tell us what prompted your reflections in that  paper, and what you seek to achieve with the project?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Dr. Shah:&lt;/b&gt; The ‘&lt;a href="http://cdc.leuphana.com/structure/common-media-lab/making-change/"&gt;Making Change&lt;/a&gt;‘  project is an example of the multi-stakeholder, multi-disciplinary,  knowledge methods and production that I am interested in. It is shaped  by the framework proposed in the ‘Whose Change is it anyway?’ concept  paper that proposes that in order to look at the change processes around  us, we need to change the ways in which forms, formats, conditions,  structures, processes, and life-cycles of knowledge practices need to be  re-examined. The project aims to build conceptual frameworks by  engaging different change actors in digital storytelling to understand  how we analyse and examine the radical processes of change in the times  to come.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Making Change is a knowledge exploration through which we seek to  unpack the form, function, and practice of social and political change  in emerging network societies. With this project, we will map existing  traditional and innovative change practices through new knowledge  methods and propose hybrid ways of building a knowledge commons that  helps consolidate, curate and disseminate these new insights for change  actors.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Hence, we will create a Knowledge Commons. The Knowledge Commons is a  mash-up of resources, which we will set in motion through four distinct  processes of getting insight into the mechanics, logistics, and  catalysts of social and political change:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;1.  In this project, we will use new methods of collaborative  knowledge production methods that bring in different knowledge  stakeholders and actors to reflect upon and consolidate their existing  projects.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;2.  We will develop new textual and visual practices to facilitate the transfer of knowledge worldwide.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;3.  We will work with existing knowledge communities – academia,  policy, and practice – to build pedagogic resources for training  knowledge visionaries about the future of change.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;4.  We will produce, curate and disseminate knowledge prototypes  through storytelling to debate, question and re-energize discussions on  important keywords and concepts in the change narratives.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The core of the Knowledge Commons will consist of new narratives and  prototypes of how these narratives might help other approaches for  social and political change. We shall further organize these narratives  to train and help social change actors to develop better strategies of  working within digital and network societies. The Knowledge Commons  seeks to generate cross-fertilization between different networks of  knowledge actors to generate critical insights to gain access, exchange  and contribute to knowledge dialogues.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Knowledge Commons is not just an online platform, but is built up  through a combination of knowledge generating workshops (production  sprints) as well as reflections, which are curated through online  dialogues and critique. The production sprints invite the key change  actors from our networks to incite conversations inspired by the thought  piece ‘Whose Change is it Anyway?’. The conversations will be further  annotated by the ‘Making Change’ white paper which offers more complex  and nuanced ways of looking at the contexts, catalyst and processes of  change embedded in particular movements.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Rehfeldt:&lt;/b&gt; There has been a lot of talk about ‘Twitter revolutions’  and ‘Blackberry riots’ – what would you say do digital technologies  contribute to contemporary social movements and political action in the  public sphere more generally?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Dr. Shah:&lt;/b&gt; I have spent some time trying to do away with the  binaries and polarised responses that phrases like ‘Twitter Revolutions’  and ‘Blackberry Riots’ produce. They seem to bring pre-defined  responses – they either suggest that the emergence of new digital  technologies and applications, by their very presence, are producing  radical change practices. They deny the historical conditions, the  political contexts, the social and cultural practices of the region, and  the structures of inequity and injustice that are often characteristic  to particularly geographies and cultures. They refuse to understand that  the digital does not merely produce things new – instead, it helps  extend the existing movements of social and political change and are a  part of a much larger paradigm shift. They alienate existing human  endeavours of change and create false dichotomies like the old and new  activisms, or traditional and digital movements.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;I think it is better to understand that the digital produces ruptures  and interruptions in the narrative of change; but the digital also has  historical continuities which need to be better embedded in the  geographical and political contexts of change. At the end of the day, we  need to debunk the idea that digital activism around the globe is the  same. Just because everybody uses Twitter to orchestrate people’s  movements in different countries, it doesn’t mean that they are doing  the same thing or in the same way. We need to do away with the  homogenizing rhetoric of the digital that presumes that digital cultures  are universal, and learn to look at the intersections of life that  inform and are shaped by the emergence of the digital technologies.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Rehfeldt&lt;/b&gt;: To finish up, is there an interesting online article,  or video you have read or seen lately which you could suggest to our  readers?&lt;/p&gt;

    <title>NIE Steps in to Grow Konkani Wikipedia</title>

        &lt;b&gt;The Centre for Internet &amp; Society's Access to Knowledge team (CIS-A2K) signed a memorandum of agreement (MoU) with Nirmala Institute of Education, Goa to enhance digital literacy in Konkani in the education sector across Goa.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;The Access to Knowledge (A2K) programme of CIS, in its sustained efforts to enhance the content and reach of &lt;a class="external-link" href="https://incubator.wikimedia.org/wiki/Wp/gom/Mukhel_Pan"&gt;Kokani Wikepedia &lt;/a&gt;(which is in incubation), has signed an MoU for a     period of five years with &lt;a class="external-link" href="http://dhe.goa.gov.in/nongovtnirmalainstitute.html"&gt;Nirmala Insitute of Education&lt;/a&gt; (NIE), a Secondary  Teacher Education College established in  1963 by the Society of  the Daughters of the Heart of Mary in response to  the then urgent need  for trained teachers in post liberation Goa. The key objectives of this partnership are: a) to design, develop and execute a certificate course titled "Teaching in the Age of  Wikipedia", which is aimed at middle and high school teacher-trainees  and teachers; and b) to introduce Wikimedia projects into the pedagogic curriculum of NIE.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Both CIS and NIE share a mutual interest in conserving, developing and disseminating knowledge free of cost in Konkani, which incidentally is Goa’s     official language. Konkani as a language faces several challenges — it has no official script. The population who speak it are dispersed across the world and have little     motivation to further the cause of Konkani, and there are few educational venues that offer a formal course to study Konkani or offer Konkani based     curriculum. NIE Principal Dr. Denzil Martins welcomed this MoU and said that "it will guide our teacher-trainees to upload relevant information in Konkani that can be freely accessed by the local population" and "provide the volunteer-trainees with skills that they will be able to use to contribute and enhance the free knowledge in Konkani". The MoU was signed by Dr. Denzil Martins from NIE and T. Vishnu Vardhan (Programme Director, Access to Knowledge, CIS) in the presence of staff and students of NIE and volunteers Harriet Vidyasagar and Gayathri Rao Konkar. Dr. Rita Paes, ex-Principal of NIE who worked to forge this MoU sent her best wishes.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;CIS-A2K since 2013, has worked to develop partnerships with key educational institutions to promote and grow Konkani Wikipedia. It has previously     worked with NIE to design and implement a program to enroll 100 B.Ed. students to increase the amount of information available in     &lt;a href="https://meta.wikimedia.org/wiki/India_Access_To_Knowledge/Events/Goan_Towns_%26_Villages_@_Nirmala_Institute_of_Education"&gt; Goan villages and towns &lt;/a&gt; on Konkani Wikipedia. A2K has also been instrumental in convincing Goa University to     &lt;a href="http://cis-india.org/openness/blog/re-release-konkani-vishwakosh-under-cc-by-sa-3.0"&gt; re-release Konkani Vishwakosh (encyclopedia) under CC-BY-SA 3.0 &lt;/a&gt; , making it freely available to public, giving them the right to share, use and even build upon the work that has already been done.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The course ‘Teaching in the Age of Wikipedia’ will enable the teacher participant to have a) a comprehensive understanding of changes due to digital     technology to the knowledge domain; b) an introduction to various openness movements that inform the discourse on Open Educational Resources; c) exposure     and training to participate on open knowledge platforms like Wikipedia; and d) practical examples and best practices of using Wikipedia and sister projects     within the classroom context. The parties will also co-design and jointly implement programmes to introduce Wikipedia in the NIE curriculum. The curriculum     for this workshop is positioned within the context of indian languages (particularly Konkani) and school education to ensure that any learning is practical     and can be applied within the teachers immediate pedagogic environment. Speaking about the relevance of this course Gayathri and Harriet (who have been associated with NIE as volunteers) mentioned that "the Goa government has handed out tablets to all school going children in Goa. In order to use them effectively in the classroom will require teachers to rethink their role and teaching methodologies and this course is an important step towards that". Agreeing with this Denzil Martins feels that this course "will provide the teacher-trainees with ideas and inputs for using Wikipedia in creative ways in the classroom".&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;This partnership     could bring huge momentum and scale for the growth of Konkani as participants who graduate from this course will as teachers act as anchors and mentors     to teach and assign Wikipedia editing assignments in their respective schools and classrooms.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;As Gayathri feels "such courses once fine tuned should be made available to teachers from all over the country and should be part of the package for introducing the digital technology in the school system.  Today it ends with setting up computer labls in schools or distribution of hardware to students - they may have a 'computer teacher' but the class and subject teachers never become part of these new initiatives. Only when this happens can we move away from 'teaching computers' to using computers as tools to learn and teach, which is the primary objective of digital technology in schools".&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;CIS will develop this open course and welcomes anyone to partner in this effort, which will be made available for anyone to use it within their context. The efforts to build free and open knowledge platforms like Konkani Wikipedia will continue and partnerships like NIE will play a crucial role in building a robust knowledge society in India.&lt;b&gt; &lt;/b&gt;&lt;/p&gt;

    <title>NHA Data Sharing Guidelines – Yet Another Policy in the Absence of a Data Protection Act</title>

        &lt;b&gt;In July this year, the National Health Authority (NHA) released the NHA Data Sharing Guidelines for the Pradhan Mantri Jan Aarogya Yojana (PM-JAY) just two months after publishing the draft Health Data Management Policy.&lt;/b&gt;
        &lt;p&gt;Reviewed and edited by Anubha Sinha&lt;/p&gt;
&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;Launched in 2018, PM-JAY is a public health insurance scheme set to cover 10 crore poor and vulnerable families across the country for secondary and tertiary care hospitalisation. Eligible candidates can use the scheme to avail of cashless benefits at any public/private hospital falling under this scheme. Considering the scale and sensitivity of the data, the creation of a well-thought-out data-sharing document is a much-needed step. However, the document – though only a draft – has certain portions that need to be reconsidered, including parts that are not aligned with other healthcare policy documents. In addition, the guidelines should be able to work in tandem with the Personal Data Protection Act whenever it comes into force. With no prior intimation of the publication of the guidelines, and the provision of a mere 10 days for consultation, there was very little scope for stakeholders to submit their comments and participate in the consultation. While the guidelines pertain to the PM-JAY scheme, it is an important document to understand the government’s concerns and stance on the sharing of health data, especially by insurance companies.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Definitions: Ambiguous and incompatible with similar policy documents&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The draft guidelines add to the list of health data–related policies that have been published since the beginning of the pandemic. These include three draft health data management policies published within two years, which have already covered the sharing and management of health data. The draft guidelines repeat the pattern of earlier policies on health data, wherein there is no reference to the policies that predated it; in this case, the guidelines fail to refer to the draft National Digital Health Data Management Policy (published in April 2022). To add to this, the document – by placing the definitions at the end – is difficult to read and understand, especially when terms such as ‘beneficiary’, ‘data principal’, and ‘individual’ are used interchangeably. In the same vein, the document uses the terms ‘data principal’ and ‘data fiduciary’, and the definitions of health data and personal data, from the 2019 PDP Bill, while also referring to the IT Act SDPI Rules and its definition of ‘sensitive personal data’. While the guidelines state that the IT Act and Rules will be the legislation to refer to for these guidelines, it is to be noted that the IT Act under the SPDI Rules covers ‘body corporates’, which under Section 43A(1), is defined as “any company and includes a firm, sole proprietorship or other association of individuals engaged in commercial or professional activities;”. It is difficult to add responsibility and accountability to the organisations under the guidelines when they might not even be covered under this definition.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;With each new policy, civil society organisations have been pointing out the need to have a data protection act before introducing policies and guidelines that deal with the processing and sharing of the data of individuals. Ideally, these policies – even in draft form – should have been published after the Personal Data Protection Bill was enacted, to ensure consistency with the provisions of the law. For example, the guidelines introduce a new category of governance mechanisms under the data-sharing committee headed by a data-sharing officer (DSO). The responsibilities and powers of the DSO are similar to that of the data protection officer under the draft PDP Bill as well as the National Data Health Management Policy (NHDMP). This, in turn, raises the question of whether the DSO and the DPOs under both the PDP Bill and the draft NDMP will have the same responsibilities. Clarity in terms of which of the policies are in force and how they intersect is needed to ensure a smooth implementation. Ideally, having multiple sources of definitions should be addressed at the drafting stage itself.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Guiding Principles: Need to look beyond privacy&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The guidelines enumerate certain principles to govern the use, collection, processing, and transmission of the personal or sensitive personal data of beneficiaries. These principles are accountability, privacy by design, choice and consent, openness/transparency, etc. While these provisions are much needed, their explanation at times misses the mark of why these principles were added. For example, in the case of accountability, the guidelines state that the ‘data fiduciary’ shall be accountable for complying with measures based on the guiding principles However, it does not specify who the fiduciaries would be accountable to and what the steps are to ensure accountability. Similarly, in the case of openness and transparency, the guidelines state that the policies and practices relating to the management of personal data will be available to all stakeholders. However, openness and transparency need to go beyond policies and practices and should consider other aspects of openness, including open data and the use of open-source software and open standards. This again will add to transparency, in that it would specify the rights of the data principal, as the current draft looks at the rights of the data principal merely from a privacy perspective. In the case of purpose limitation as well, the guidelines are tied to the privacy notice, which again puts the burden on the individual (in this case, beneficiary) when the onus should actually be on the data fiduciary. Lastly, under the empowerment of beneficiaries, the guidelines state that the “data principal shall be able to seek correction, amendments, or deletion of such data where it is inaccurate;”. The right to deletion should not be conditional on inaccuracy, especially when entering the scheme is optional and consent-based.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Data sharing with third parties without adequate safeguards&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The guidelines outline certain cases where personal data can be collected, used, or disclosed without the consent of the individual. One of these cases is when the data is anonymised. However, the guidelines do not detail how this anonymisation would be achieved and ensured through the life cycle of the data, especially when the clause states that the data will also be collected without consent. The guidelines also state that the anonymised data could be used for public health management, clinical research, or academic research. The guidelines should have limited the scope of academic research or added certain criteria to gain access to the data; the use of vague terminology could lead to this data (sometimes collected without consent) being de-anonymised or used for studies that could cause harm to the data principal or even a particular community. The guidelines state that the data can be shared as ‘protected health information’ with a government agency for oversight activities authorised by law, epidemic control, or in response to court orders. With the sharing of data, care should be taken to ensure data minimisation and purpose limitations that go beyond the explanations added in the body of the guidelines. In addition, the guidelines also introduce the concept of a ‘clean room’, which is defined as “a secure sandboxed area with access controls, where aggregated and anonymised or de-identified data may be shared for the purposes of developing inference or training models”. The definition does not state who will be developing these training models; it could be a cause of worry if AI companies or even insurance companies have the potential to use this data to train models that could eventually make decisions based on the results. The term ‘sandbox’ is explained under the now revoked DP Bill 2021 as “such live testing of new products or services in a controlled or test regulatory environment for which the Authority may or may not permit certain regulatory relaxations for a&lt;br /&gt;specified period for the limited purpose of the testing”. Neither the 2019 Bill nor the IT Act/Rules defines ‘sandbox’; the guidelines should have ideally spent more time explaining how the sandbox system in the ‘Clean Room’ works.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Conclusion&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The draft Data Sharing Guidelines are a welcome step in ensuring that the entities sharing and processing data have guidelines to adhere to, especially since the Data Protection Bill has not been passed yet. The mention of the best practices for data sharing in annexures, including practices for people who have access to the data, is a step in the right direction, which could be made better with regular training and sensitisation. While the guidelines are a good starting point, they still suffer from the issues that have been highlighted in similar health data policies, including not referring to older policies, adding new entities, and the reliance on digital and mobile technology. The guidelines could have added more nuance to the consent and privacy by design sections to ensure other forms of notice, e.g., notice in audio form in different Indian languages. While PM-JAY aims to reach 10 crore poor and vulnerable families, there is a need to look at how to ensure that consent is given according to the guidelines that are “free, informed, clear, and specific”.&lt;/p&gt;

    <title>NGO Profile: Knowledge Ecology International</title>

        &lt;b&gt;As CIS’ observer in Geneva, I will be profiling NGOs and other prominent actors at the WIPO. In the first in a series of blogs, I profile the work of Knowledge Ecology International (KEI) at the various International Organisations in Geneva.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;Knowledge Ecology International (KEI) is an NGO &lt;i&gt;that searches for better outcomes, including new solutions, to the management of knowledge resources&lt;/i&gt;. KEI is focused on social justice, particularly for the most vulnerable populations, including low-income persons and marginalized groups.&lt;a href="#fn1" name="fr1"&gt;[1] &lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;KEI has a strong presence in Geneva and their works revolves around the International Organisations that are located here. Their Geneva office is run by Thiru Balasubramaniam, who previously worked with the WHO.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;International Organisations in Geneva&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;KEI is active in the World Intellectual Property Organization (WIPO), the World Health Organisation (WHO) and the World Trade Organization (WTO) in Geneva. At the WHO KEI is represented at the World Health Assembly and the WHO Executive Board. KEI was alsoan active participant at the Intergovernmental Committee on Public Health, Innovation and Intellectual Property (IGWG), which existed from 2006-08.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;At the WTO, KEI is engaged in work around TRIPS council meetings- this includes technical assistance to Members and research and analysis of the outcomes of these meetings (the TRIPS Council unlike the WIPO is not open to Observers). KEI along with other NGO’s are also looking towards a possible Treaty on the Supply of Global Public Goods.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Work around WIPO&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;KEI is active at the following WIPO Committees: the General Assembly, the Standing Committee on the Law of Patents (SCP), the Standing Committee on Copyright and Related Rights (SCCR), the Committee on Development and Intellectual Property (CDIP). Their work in these areas is outlined below:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;KEI has been actively involved in the Development Agenda at the WIPO from the beginning. They have actively participated in shaping discussions related to the transfer of technology and access to knowledge (A2K). Jamie Love, the Director of KEI was commissioned by the WIPO to author a paper on Alternatives to the Patent System. KEI had also mooted the idea for a Global Conference on Open Collaborative Research in 2003. The idea had widespread support from the scientific community, which saw fruition with the organization of the conference in January, 2014.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;KEI was instrumental in the conception and passage of the Treaty for the Visually Impaired (TVI) at the WIPO. They are currently engaged in work surrounding the Broadcast Treaty and Limitations &amp;amp; Exceptions for Libraries and Archives. KEI’s stance&lt;a href="#fn3" name="fr3"&gt;[3] &lt;/a&gt;on the former is that the proponents of the Treaty have not made a strong enough case in favour of the Treaty and that it could potentially impede access to knowledge and create barriers to the enjoyment of the internet. On the latter, they believe that the Berne appendix must be revisited to recraft it to strengthen the education exception and that the Tunis Model Law on Copyright for Developing Countries (1976) should also be used as a way for developing countries to serve their education and libraries needs.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;In an unusual but ‘clean’ way of celebrating its fifth anniversary, a  city-based non-governmental organisation (NGO) has invited the general  public to inspect its books of accounts, check out its list of donors  and view contracts. At a time when several NGOs are under the scanner  for trying to shroud financial transactions in secrecy, The Centre for  Internet and Society (CIS), a non-profit research organisation that  defends consumer rights on the Internet, has upped its policy of  transparency a notch.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Located in Domlur and largely patronised by Bangalore’s tech  community, CIS’s books of accounts will be available for public scrutiny  during its fifth anniversary celebrations from May 20 to 23 and will  show how the NGO has spent the Rs 13.13 crore it has received from  donors since its launch.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Speaking to Bangalore Mirror, CIS executive director Sunil Abraham  admitted that the move was to dispel any lingering doubts on the motives  of his organisation. “These days, many NGOs have been in the news for  misappropriation of donations,” Abraham said. “We want to keep our books  of accounts open to the public. Apart from details like salaries drawn  by each board member, many other details like contractual obligations  with entities, details of donors and official travel expenses by board  members can also be obtained. Anybody can walk into our office and ask  to see the accounts. A photocopy of all the details will also be given  to them at the earliest.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In fact, a recent debate in the Rajya Sabha centred on the lack of  transparency among NGOs receiving contributions from overseas after the  Foreign Contribution Regulation Act (FCRA) was passed in 2010. With 17  donors, a majority of who are from overseas, CIS ensures that every  rupee obtained is well spent and accounted for.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“We have made public a list of donors and their share of  contributions to our society,” Abraham said. “This will give everybody a  clear picture of the funds we receive and where and how it is being  spent.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;CIS is primarily funded by the Kusuma Trust, The Wikimedia  Foundation and The Hans Foundation among others. The society was founded  in 2008 and has 17 staff of whom four are based in Delhi and the rest  in Bangalore. The society also has seven distinguished fellows and five  fellows.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It conducts policy research programmes on topics like  accessibility, access to knowledge, openness, internet governance and  telecom. The society has churned out 641 research items in five years  that include essays, books and blog entries on the topics. It has also  conducted research on the accessibility of the e-governance system and  has suggested ways to make it more disabled-friendly.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;As part of its anniversary celebrations, the society will hold a  four-day event in its office starting May 20 that will include an  exhibition showcasing its activities so far. Various artists like Kiran  Subbaiah, Tara Kelton, Navin Thomas and Abhishekh Hazra are expected to  participate and give live demonstrations.&lt;/p&gt;

    <title>New Release of IPR Chapter of India-EU Free Trade Agreement</title>

&lt;p&gt;A draft of the IPR chapter of the EU-India FTA, made &lt;a href="https://cis-india.org/a2k/upload/india-eu-fta-ipr-july-2010/at_download/file" class="external-link"&gt;publicly available for the first time&lt;/a&gt; (PDF, 296Kb), provides insight into India's response in July 2010 to several EU proposals on intellectual property protection and enforcement.

The consolidated draft which was prepared to serve as the basis of talks that took place from July 12-14, 2010, in New Delhi, reveals parties' negotiating stances in response to preliminary positions put forth earlier (see &lt;a class="external-link" href="http://www.bilaterals.org/spip.php?article17290"&gt;IPR Chapter May draft&lt;/a&gt;).&lt;/p&gt;
&lt;p&gt;In particular, this draft reflects India's rejection of many EU proposals that would require India to:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;exceed its obligations under the WTO's Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), e.g by providing data exclusivity for pharmaceutical products; &lt;br /&gt;&lt;/li&gt;&lt;li&gt;impose radical enforcement provisions, such as liability of intermediary service providers, border measures for goods in transit, and raised norms for damages and injunctions; or &lt;br /&gt;&lt;/li&gt;&lt;li&gt;require legislative change, e.g., on data protection, and to accommodate the full EU demands on geographical indicators. &lt;br /&gt;&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;

&lt;p&gt;Sources close to the negotiations have also confirmed that during the July talks India reiterated its refusal to go beyond TRIPS, and its refusal to discuss issues that require changes to Indian law. India appears to have also reiterated that it could not finalise FTA copyright provisions before passage of the Copyright Amendment Bill in the Indian Parliament.&lt;/p&gt;
&lt;p&gt;
It is hard to assess the current state of the negotiations on IP or to measure the outcomes of subsequently held talks without access to recent drafts, a public record of deliberations, or the schedule of full and intersessional rounds taking place. However, from press and other statements attributed to the European Commission and Indian officials after the December 2010 EU-India Summit in Brussels, it appears that:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;
both parties plan to conclude the FTA, the biggest ever for the EU, by Spring 2011; &lt;br /&gt;&lt;/li&gt;&lt;li&gt;the EU has not relaxed its pursuit of at least some "TRIPS plus" provisions such as data protection for pharmaceuticals &lt;br /&gt;&lt;/li&gt;&lt;li&gt;a mutually agreed solution to India's WTO case against the EU over the seizure of generic medicines may be round the corner. Its impact on the FTA is open to speculation. &lt;br /&gt;&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;Because the India-EU FTA is likely to set a new precedent for future trade agreements between developed and developing countries, and with enormous stakes for patients across the globe, India and the EU need to get it right and ensure no provision runs counter to the interests of millions of citizens.&lt;/p&gt;

    <title>New Modes and Sites of Humanities Practice</title>

        &lt;b&gt;An extended survey of digital initiatives in arts and humanities practices in India was undertaken during the last year. Provocatively called 'mapping digital humanities in India', this enquiry began with the term 'digital humanities' itself, as a 'found' name for which one needs to excavate some meaning, context, and location in India at the present moment. Instead of importing this term to describe practices taking place in this country - especially when the term itself is relatively unstable and undefined even in the Anglo-American context - what I chose to do was to take a few steps back, and outline a few questions/conflicts that the digital practitioners in arts and humanities disciplines are grappling with. &lt;h2&gt;Introduction&lt;/h2&gt;
&lt;p&gt;From a brief exploration of the problem of new objects and methods of research in the digital context, we have come to or rather returned to the problem of location or contextualising DH, and whether it may be called a field or discipline in itself, in India. As the previous sections may have illustrated, most of the prominent initiatives around DH in India have largely been within the university context, or have at least focused around the university as the centre of the processes of knowledge production, and emphasise a move away from more traditional ways of doing humanities, and at a larger level the more established and disciplinary modes of knowledge formation. In the context of pedagogy, DH seems to be developing in a very specific role, which is that of training in a certain set of skills and topics, which the existing disciplines have so far not been able to provide or even accommodate. These include tools for working with digitisation processes, digital archives, and the use of computational methods in the study of cultural artifacts. Thus processes such as topic modelling, data visualisation, cultural analytics, sentiment analysis and several more become increasingly prominent in discussions about DH. The university or more specifically the traditional classroom offers a particular kind of teaching-learning experience which may not always have within its ambit the necessary resources or strategies to foster new methods of knowledge production, and a lot of DH work has been posited as trying to plug knowledge gaps in precisely this area.&lt;/p&gt;
&lt;p&gt;Wikipedia and internet-based sources of information are entering classrooms with the proliferation of gadgets and tools, and with this there is a tendency towards adopting a more open, participatory and customised model of learning based on collaboration. DH has been characterised by many as a space, or method that intervenes in the traditional ‘hierarchies of expertise’ (Davidson and Goldberg, 2010) – not only in terms of people, but also spaces, methods and objects of learning - to present a significant ‘alternative’ that is now slowly becoming more mainstream. A rather direct example of this in the global discourse on DH is the growth of a number of ‘alt- academics’ &lt;strong&gt;[1]&lt;/strong&gt;: people with training in the humanities who now inhabit what earlier seemed to be a rather nebulous space between academics and an array of practices in computing, art and community development among many others. But it is the in-between, or the liminal space that holds the potential for new kinds of knowledge to be generated. The connotations of this notion however are many and problematic, as seen particularly in the emphasis on new kinds of skills or competences that are now required to inhabit such a space, as also the narrative of loss of certain critical skills that are part of the disciplinary method and the resistance from certain quarters within the university to acknowledge such a trend. Conversely, it is also reflective of how certain kinds of skills in writing, reading, visualisation and curation have now become essential and therefore visible. While the DH discourse in India has developed mostly within the university space, given its multidisciplinary interests and methods, it is often seen as bearing potential in terms of working outside the academic norm. Through an examination of changes in teaching-learning methods, creative and critical practices that come about with the adoption of the digital, it may be useful to explore whether it indeed opens up such alternate modes of humanities practice and how it informs the way we do DH in India; as practitioners, researchers, students, teachers or the lay person. The growth of the internet and digital tools and technologies has led to many changes in teaching-learning practices, and engendered new methods and forms of humanities practice, all of which may now be found within the university or academic space. It is therefore imperative to examine these new modes of research and practice, to arrive a better understanding of the changes in and possibilities available for humanities work after the digital. The notion of the ‘alternate’ is also an important concern here, and the emergence of these new modes of humanities practice help unpack and understand this term better.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;Technology in the Classroom&lt;/h2&gt;
&lt;p&gt;This state of being within and to a certain extent outside of a certain predominant discourse is a peculiar one with several possibilities, and DH, owing to its interdisciplinary content and methods, seems to be a suitable space to foster new and alternate knowledge-making practices. India is also still a multi-layered technological space very much in a moment of transition, and the debates remain largely confined to the English and History departments and to some extent library and archival spaces. Outside of the university circle however, there are a number of initiatives, such as online archival efforts, media, art and design practices and research, where one may see DH–related work being done. What remains an important part of the discourse in the context of the university is the access to and a more substantial and critical engagement with technology in the classroom.&lt;/p&gt;
&lt;p&gt;The use of technology in education has grown by leaps and bounds in the last decade or so in India, as evidenced by the number of initiatives taken to introduce ICTs in the classroom &lt;strong&gt;[2]&lt;/strong&gt;. However, the digital divide still persists, as a result of which many initiatives come with problems of their own, the most important being the lack of connection among practice, content and pedagogy &lt;strong&gt;[3]&lt;/strong&gt;. Vikram Vincent, a doctoral scholar in the Interdisciplinary Program in Educational Technology, Indian Institute of Technology, Mumbai, attributes this to a problem of understanding technology itself and what it can do for learning. He looks at technology as an extension of the human body and not something alien to it. Over the course of his research, he has found that the prevalent attitude to the use of technology in the classroom, particularly in early ICTs in education projects, has been more techno-centric rather than learner-centric, which is not the most effective approach &lt;strong&gt;[4]&lt;/strong&gt;. Technology has always been around in some form or the other, from drawing on walls to the blackboard to now the smart board; it has always been in the classroom. How you choose to use it determines the outcomes, and one needs to ensure that the learning environment evolves with the new technology that is introduced, because it does not happen automatically but over a period of time.&lt;/p&gt;
&lt;p&gt;The Wikipedia India Education programme pilot project, implemented in Pune in 2011 is an example of the number of challenges that the introduction of a new technology in the classroom brought forth, in terms of skills, content and pedagogy &lt;strong&gt;[5]&lt;/strong&gt;. The need to focus on the educational component of the technology, the improvement of skills of the learner in writing, research and communication, rather than on the tool itself has been an important learning from the programme, even as it continues in a different university today. As Vincent adds further, the problem arises with looking at technology as a disruptive element or merely a tool to aid learning, which prevents institutions from envisioning a more holistic model of learning that takes some amount of time and effort. This also requires the appropriate stimulus and other conditions such as training of teachers, access to resources and training in certain required skills, addressing barriers of language and so forth, which is a feature of some programmes, such as the IT @ school in Kerala which have seen a measure of success &lt;strong&gt;[6]&lt;/strong&gt;. Vincent further mentions examples of programmes he has been part of, some of them under the MHRD-NMEICT initiative which focussed on the teaching-learning process rather than the technology itself, key to which is building teacher capacity to use new and already available resources better &lt;strong&gt;[7]&lt;/strong&gt;. These would be crucial steps to take before envisioning a model of teaching-learning that is premised largely on digital technologies and the internet.&lt;/p&gt;
&lt;p&gt;While educational technology is a separate field in itself which looks at better interactions between teaching-learning practices and technology &lt;strong&gt;[8]&lt;/strong&gt;, it does form part of the context, or landscape in India within which DH would perhaps develop as a discipline, practice or a pedagogic approach.&lt;/p&gt;
&lt;p&gt;Another predominant discourse that informs DH is that of Information Communication Technologies for Development (ICT4D) which is often used as a rather broad, catch-all term, and has been variously defined and used by different groups and stakeholders across domains (Saith et al, 2008). ICT4D is premised largely around the question of access, and seeks to bridge the digital divide in terms of knowledge, resources, people and infrastructure, among other things. This has also been an intensely debated term, given its social and political implications, particularly in the manner in which it informs a larger discourse on development, technology and globalisation in the global South.(Sundaram, 2005)  It is important to understand whether DH has been posited as making an intervention into these prevailing systems of knowledge – so that the mode of understanding both technology and the humanities, and the interaction between the two domains (assuming that they are separate) undergoes a significant change. What then goes into promoting more institutional stability for DH, in other words, in teaching and learning it – will be a question to contend with in the years to come, as more universities take to incubating research around digital technologies and related components and incorporating this into the existing curricula.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;Towards a Digital Pedagogy&lt;/h2&gt;
&lt;p&gt;Dr. Abhijit Roy, Assistant Professor at the Department of Media, Communication and Culture, Jadavpur University is positive about the changes he sees in pedagogy and research with the advent of digital technologies. According to him, while a media or film studies department would be close to the concerns of DH, and use some form of digital technology such as video clips or blogs as part of coursework, it is particularly important to see what change it has brought about in traditional humanities disciplines like History and languages. While some of these changes are elementary, such as the use of digital technologies in classroom teaching and learning exercises, it is in the practice of research that he sees a vast change now. Many researchers, many of his students also, have found this a useful part of the research process, through the use of blogs and social media and the possibilities to publish and engage in discussions with other researchers through platforms and tools like Academia or Scalar &lt;strong&gt;[9]&lt;/strong&gt;. It not only makes the process more transparent, but also encourages an ethos of constant sharing, dissemination and a network of usage and storage online. This has transformed the way research and pedagogy can be imagined now, and opened up several possibilities for teaching-learning practices.&lt;/p&gt;
&lt;p&gt;It is in realising this potential for new research and pedagogical models that universities have slowly begun to adopt digital technologies, but the institutional efforts at building curricula specifically around DH-related concerns have been few, with the prominent ones in India being the courses at Jadavpur University and Presidency University in Kolkata, and more recently Srishti School of Arts, Design and Technology in Bangalore. The change is recent, as several researchers have pointed out. There have always been concerns about privacy and regulation of content, whether on a university archive or its network. The enthusiasm towards ‘anything digital is good’ is relatively new, and comes from a larger (and sometimes rather utopian) development discourse focussed around modernity and technology. Curricularisation comes with its own issues too, and they stem largely from the fact that one is still unable to understand fully the nature of the digital and its facets - we also inhabit a time when there is a transition from analogue to digital, and both modes exist simultaneously - but the rate of change is faster with the digital than with other domains of knowledge, so much so that the curricula developed may often seem provisional or arcane, which makes it doubly challenging to demonstrate its various facets in practice, particularly in the classroom. A useful distinction would be between DH being brought in as a problem-solving approach to address the extant issues of the humanities, thus also seen as threat to the disciplines themselves, but to see if it has its own epistemological concerns which may be related to but also distinct from the humanities - in short to help us ask new questions, or provide new ways of asking old ones.&lt;/p&gt;
&lt;p&gt;The development of courses on DH in three universities in India, and the manner in which the field has been ‘curricularised’ so to say, would be an indication of its specific academic concerns in the Indian context, and the disciplinary challenges and questions that it may throw up for the teaching-learning process. Expectedly, the three courses mobilise a set of resources and expertise that the schools have built over the course of many years. In doing so they also foray into areas that existing humanities courses at the university may not have explored enough, within their own disciplinary framework. For example the course on Digital Humanities and Cultural Informatics at Jadavpur University &lt;strong&gt;[10]&lt;/strong&gt; comprises of components on software studies and digital music preservation, building on work done at the large archives at the School of Cultural Texts and Records. Similarly, the course at Presidency University &lt;strong&gt;[11]&lt;/strong&gt; has components on storytelling in digital media through video games, while the course at Srishti &lt;strong&gt;[12]&lt;/strong&gt; has a focus on design practice and critical making amongst other interests. The courses therefore follow a decidedly interdisciplinary framework, which no doubt interesting, also makes curriculum development and course assessment a challenge. While the ‘digital’ aspect of ‘DH’ forms a significant part of these explorations, the manner in which it is being studied is an important point of focus – whether as a condition, space, concept or object, rather than just a set of tools and methods that facilitate the enquiry of the humanities. Digitisation significantly alters the cultural artifact, and there is a need to understand and theorise this digital object better. As Padmini Ray Murray points out, the digital is one way to mediate the material object, particularly those that are not textual, since that kind of experiential access can only be provided by the digital, especially in the case of archival objects. A critical understanding of the digital needs to therefore be a key aspect of such an enquiry in DH.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;Alternate Spaces of Humanities Practice&lt;/h2&gt;
&lt;p&gt;While these are the developments within academia or the university space, there are a number of spaces outside this circle that have also been asking similar questions, and producing new kinds of scholarship and research around these ideas. The Indiancine.ma and Pad.ma archives have not only served as rich repository of material on film and video, used by scholars and film enthusiasts alike, but also as a pedagogic tool in spaces like the Media Lab at Jadavpur University. Through an innovative fellowship programme, Pad.ma has supported research and film making using the archive as a platform. An interesting example here would be a documentary film on power plants in Chhattisgarh made by Sunil Kumar. Available as a film treatment/script on Pad.ma, Kumar’s work is based on research in mainly two districts of Chhattisgarh, where he met and spoke with people, collected documents and shot several hours of video, which he then published in the form of 80 footage series on Pad.ma &lt;strong&gt;[13]&lt;/strong&gt;. There are several other examples on Pad.ma, such as the video-art project on the Radia tapes, and the work on "perfume arts" in Bangalore &lt;strong&gt;[14]&lt;/strong&gt;. The Sound and Picture Archives for Research on Women (SPARROW) through its workshops on oral and visual history has tried to engage with the more pedagogic aspects of the archive &lt;strong&gt;[15]&lt;/strong&gt;. While the possibilities are many, the uptake of such platforms in universities has been slow, due to issues that range from lack of internet connectivity to a discomfort or unfamiliarity with the internet and other kinds of technology. This eventually relegates initiatives like these to the space of an alternate, extracurricular or outlier, even though they seem to be asking the same questions as the mainstream institutions and doing similar work.&lt;/p&gt;
&lt;p&gt;What this also refers to is the space for new modes of knowledge production that an increased interaction with digital and internet technologies now engenders or even brings to the fore in already existing practices. With these however, also come the questions about the legitimacy of these forms and methods of knowledge production, as seen in the rather polarised positions around DH in its global discourse. The Wikipedia is one example of this, and illustrates some of the core concerns of and about DH as it calls into question notions about authorship, expertise and established models of pedagogy and learning. Lawrence Liang (2011) describes this as a larger conflict over the authority of knowledge, the origins of which he locates in the history of the book, and specifically in the print revolution and pre-print cultures of the 15th -18th centuries. He likens the debate over Wikipedia’s credibility, or more broadly over technologies of collaborative knowledge production ushered in by the Internet to similar phenomena seen before in early print culture and how it contributed to the construction and articulation of the idea of authority itself. He says:&lt;/p&gt;
&lt;blockquote&gt;The authority of knowledge is often spoken of in a value-neutral and ahistorical manner. It would therefore be useful to situate authority in history, where it is not seen to be an inherent quality but a transitive one 6 located in specific technological changes. For instance, there is often an unstated assumption about the stability of the book as an object of knowledge, but the technology of print originally raised a host of questions about authority. In the same way, the domain of digital collaborative knowledge production raises a set of questions and concerns today, such as the difference between the expert and the amateur, as well as between forms of production: digital versus paper and collaborative versus singular author modes of knowledge production. Can we impose the same questions that emerged over the centuries in the case of print to a technology that is barely ten years old?&lt;/blockquote&gt;
&lt;p&gt;He further goes on to elaborate that the question of the authority of knowledge should ideally be located within a larger ‘knowledge apparatus’, comprising of certain technologies and practices, (in this case that of reading, writing, editing, compilation, classification and creative appropriations) which help inflate the definitions of authority and knowledge even more.&lt;/p&gt;
&lt;p&gt;The above argument throws into sharp relief the notion of the ‘alternate’–often posited as the outlier or a vantage point, or even as being in resistance to a certain dominant discourse or body of knowledge. While resistance itself is discursive; the ‘alternate’ has also always existed in various forms,  such as the pre-print cultures illustrated in the argument above, and particularly in India where several kinds of prominent practices and occupations are but alternatives - from alternative medicine to education - to the already established or mainstream system in place. As mentioned earlier, these practices may just be increasingly visible and acknowledged now. The attempts to subsume these alternate practices under a unifying term such as DH, which began as and may perhaps have been relegated to the status of a sub-culture for long, within academia then seem to be one way of trying to circumvent the authority of knowledge question.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;Humanities and Technology: A Twinned History&lt;/h2&gt;
&lt;p&gt;Another factor in this reduced visibility of the alternate and now re-emergence is the invisible ‘technologised’ history of the humanities, which prompts us to rethink the separation between the humanities and technology as mutually exclusive domains. Therefore by extension then, the term DH itself may be a misnomer or yet another creative re-appropriation of various knowledge practices already in existence. David Berry (2012) in his essay on the computational turn speaks of possibilities that computationality, and specifically new software and code offer in terms of unifying multiple kinds of knowledge in the university. He says that:&lt;/p&gt;
&lt;blockquote&gt;In trying to understand the digital humanities our first step might be to problematize computationality, so that we are able to think critically about how knowledge in the 21st century is transformed into information through computational techniques, particularly within software. It is interesting that at a time when the idea of the university is itself under serious rethinking and renegotiation, digital technologies are transforming our ability to use and understand information outside of these traditional knowledge structures. This is connected to wider challenges to the traditional narratives that served as unifying ideas for the university and, with their decline, has led to difficulty in justifying and legitimating the postmodern university vis-à-vis government funding. (5)&lt;/blockquote&gt;
&lt;p&gt;Berry therefore indicates that this turn towards computationality is the result of an emerging need to demonstrate the relevance of the university structure to processes of knowledge production, therefore reiterating the ‘crisis’ argument. The notion of the postmodern university has been examined in detail by Bill Readings, who Berry quotes in his paper. Readings (1997) is sceptical of the term postmodern, preferring instead the idea of a post historical university, which is divested from the notion of the nation-state and further culture as a unifying idea, and is moving towards a notion of excellence that he sees as techno-bureaucratic, a result of several factors including globalisation and the fact that processes of knowledge production and institutionalisation are no longer centred around a liberal subject. If the demonstrated project of the university has changed, the emergence of such new discourse, and specifically concepts and terms such as the ‘alt – academy’ has relevance to how one may now imagine new spaces, objects, processes and figures of knowledge itself.&lt;/p&gt;
&lt;p&gt;The significance of the university system to knowledge production has been a recurring point of much debate and discussion in India. Although not explicitly stated as a crisis in humanities by the people interviewed, there are problems of content, pedagogy, infrastructure, and vision that continue to plague higher education at large &lt;strong&gt;[16]&lt;/strong&gt;, and very often technological fixes are seen as a solution to these, in some part due to the imagination of a techno-democracy as described in the introduction to this report. As Berry points out then, computationality is a promise, or possibility to do things differently, which is then also inherently assumed to be a way of doing things better. The computational possibilities of DH still need to be explored, but how much of these contribute qualitatively to addressing or even furthering certain disciplinary concerns, still remains an open question. As Jan and Sebastian point out from their experience of working on Indiancine.ma and Pad.ma, the computational aspects of the archives are still to be developed, as there are still restrictions in terms of speed and feasibility (see chapter on infrastructure &lt;strong&gt;[17]&lt;/strong&gt;); the kind of new questions it produces for cinema studies at large will remain a contention. Further, as Padmini Ray Murray observes, drawing on archival material, or data to develop new computational hypotheses would be a direction to work towards, as not much work has been done in this respect in India (See chapter on archives &lt;strong&gt;[18]&lt;/strong&gt;). The challenges with computationality then demand, as Berry argues, a more critical exploration of the term itself, and in fact can be extended to a critical analysis of the state of digitality more broadly.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;Final Notes&lt;/h2&gt;
&lt;p&gt;The problems with the crisis in the humanities and the contribution of technology to these changes could be located to this change in what has traditionally been seen as the space of culture and reason, which has now moved on to something else, a notion of excellence in Readings’ example, thereby changing the questions at the centre as well. This is perhaps the underlying challenge to the ontological and epistemological stake in the field. At best then DH may be seen as the result of a set of changes in the last couple of decades, the advancements in technology being at the forefront of them, whereby certain new and alternative modes of humanities practice have been brought to the foreground, but have also challenged the manner in which we asked questions before to a certain extent. As the field gains institutional stability, it remains to be seen what the new areas of enquiry that emerge shall then be in the years to come. Some of the questions or points or focus that open up are as follows:&lt;/p&gt;
&lt;ol&gt;&lt;li&gt;The role of extra-institutional/non-academic or alternate spaces in humanities practice, and in producing and creating new kinds of knowledge.&lt;/li&gt;
&lt;li&gt;The increased visibility of new objects and methods within informal and marginal spaces of knowledge production. This demands different, and often innovative methods of enquiry, and whether they alter disciplinary modes of humanities practice and research.&lt;/li&gt;
&lt;li&gt;The notion of a moving away from established modes of humanities practice, research and scholarship (therefore the question of a ‘crisis’) which would open up a larger debate around the authority of knowledge.&lt;/li&gt;
&lt;li&gt;The ontological and epistemological stake of DH, in short the kinds of new questions it enables us to ask.&lt;/li&gt;&lt;/ol&gt;
&lt;p&gt;As important and visible as the idea of the alternate is in DH, it also presents the mainstream itself as fractured space that imbibes several contradictions of the practices in question, which cannot be confined to these watertight silos of formal/informal, academic or creative. Nevertheless, the mainstream spaces remain crucial for widening and deepening creative digital practice and research in arts and humanities disciplines, and will be the spaces to watch to understand the development of a substantive DH discourse in India.&lt;/p&gt;

&lt;br /&gt;&amp;gt;WE, THEREFORE, SEE NO OPPOSITION WHATSOEVER BETWEEN MULTI- -- OR THE MULTILATERAL AND THE MULTISTAKEHOLDER NATURE OF THE INTERNET.  ACTUALLY, THE OPPOSITE OF THAT WOULD BE A ONE-SIDED UNILATERAL INTERNET WHICH IS UNTENABLE.
&lt;br /&gt;&amp;gt;AN INTERNET THAT IS ULTIMATELY SUBJECT TO INTERGOVERNMENTAL ARRANGEMENTS THAT EXCLUDE OTHER SECTORS OF SOCIETY IS NOT DEMOCRATIC.
&lt;br /&gt;&amp;gt;MULTISTAKEHOLDER ARRANGEMENTS THAT ARE IN TURN SUBJECT TO OVERSIGHT BY ONE OR FEW STATES ARE NOT ACCEPTABLE EITHER.
&lt;br /&gt;&amp;gt;WE TRULY WANT TO MAKE RELATIONS BETWEEN GOVERNMENTS AND SOCIETIES MORE DEMOCRATIC, AS WELL AS THE RELATIONS AMONG GOVERNMENTS.  WE WANT MORE, NOT LESS, DEMOCRACY.
&lt;br /&gt;&amp;gt;THE TASK OF PROVIDING A GLOBAL DONATION TO THE ORGANIZATIONS THAT ARE CURRENTLY RESPONSIBLE FOR CENTRAL FUNCTIONS OF THE INTERNET IS NOT ONLY NECESSARY, BUT ALSO AN UN-POSTPONABLE TASK.
&lt;br /&gt;&amp;gt;THE COMPLEXITY OF THE TRANSITION AT HAND, WHICH ON THE ONE HAND INVOLVES JURISDICTIONAL COMPETENCE, AS WELL AS ACCOUNTABILITY AND AN AGREEMENT WITH MULTIPLE STAKEHOLDERS, DOES NOT, NEVERTHELESS, MAKE IT LESS URGENT A TASK.
&lt;br /&gt;&amp;gt;THAT IS WHY I'D LIKE TO AGAIN WELCOME THE RECENTLY VOICED INTENTION OF THE UNITED STATES GOVERNMENT TO REPLACE ITS INSTITUTIONAL LINKAGE WITH THE AUTHORITY FOR -- OR WITH THE INTERNET AUTHORITY FOR NUMBER ASSIGNMENT, IANA, AND THE INTERNET CORPORATION FOR NAMES AND NUMBER ASSIGNMENTS, ICANN, BY A GLOBAL MANAGEMENT OF THESE INSTITUTIONS FROM NOW ONWARDS, A NEW INSTRUMENTAL AND LEGAL ARRANGEMENT OF THE ISDN UNDER THE RESPONSIBILITY OF IANA AND ICANN SHOULD BE BUILT IN SUCH A WAY AS TO INCLUDE BROAD-RANGING INVOLVEMENT OF ALL SECTORS THAT HAVE AN INTEREST IN THE MATTER WAY BEYOND THE TRADITIONAL STAKEHOLDERS OR PLAYERS.
&lt;br /&gt;&amp;gt;EACH SECTOR, OF COURSE, PERFORMS DIFFERENT ROLES BASED ON LIKEWISE DIFFERENTIATED RESPONSIBILITIES.
&lt;br /&gt;&amp;gt;THE OPERATIONAL MANAGEMENT OF THE INTERNET SHOULD CONTINUE BEING LED BY ITS TECHNICAL COMMUNITY.  MAY I, AT THIS POINT, VOICE MY PUBLIC RECOGNITION -- AND THIS IS ON BEHALF OF MY GOVERNMENT -- TO THESE PEOPLE WHO DEVOTE THEIR TIME AND ENERGY ON A DAY-TO-DAY BASIS TO KEEPING THE INTERNET AS AN OPEN, STABLE, AND SECURE PLATFORM, A KEY EFFORT WHICH REMAINS LARGELY INVISIBLE IN THE EYES OF MOST OF US END USERS.
&lt;br /&gt;&amp;gt;MATTERS PERTAINING TO SOVEREIGNTY SUCH AS CYBERCRIME, BREACH OF RIGHTS, ECONOMIC ISSUES OR TRANSNATIONAL ECONOMIC ISSUES, AND THREATS OF CYBER-ATTACKS ARE THE PRIMARY RESPONSIBILITY OF STATES.
&lt;br /&gt;&amp;gt;THE TASK AT HAND IS, ABOVE ALL, TO ENSURE THAT STATES WILL HAVE AT THEIR AVAIL THE TOOLS THAT WILL ALLOW THEM TO FULFILL THEIR RESPONSIBILITIES BEFORE THEIR CITIZENS, TO INCLUDE THE GUARANTEE OF FUNDAMENTAL RIGHTS.  RIGHTS WHICH ARE ENSURED OFFLINE SHOULD BE EQUALLY INSURED  ONLINE.
&lt;br /&gt;&amp;gt;THESE RIGHTS THRIVE UNDER THE SHELTER AND NOT IN THE ABSENCE OF THE STATE.
&lt;br /&gt;&amp;gt;IN ORDER FOR THE GLOBAL INTERNET GOVERNANCE TO BE TRULY DEMOCRATIC, MECHANISMS ARE REQUIRED TO ENABLE GREATER PARTICIPATION OF DEVELOPING COUNTRIES IN ALL DIFFERENT SECTORS.
&lt;br /&gt;&amp;gt;THE MATTERS THAT ARE IN THE INTEREST OF THESE COUNTRIES THAT ARE THE HEAVY-DUTY USERS OF THE INTERNET, TOPICS SUCH AS, FOR EXAMPLE, EXPANDING CONNECTIVITY, ACCESSIBILITY, AND THE RESPECT TO DIVERSITY, SHOULD BE CENTRAL ON THE INTERNATIONAL AGENDA.
&lt;br /&gt;&amp;gt;IT IS NOT ENOUGH FOR FORA TO BE OPEN FROM A PURELY FORMAL STANDPOINT.  WE MUST FURTHER IDENTIFY AND REMOVE THE VISIBLE AND INVISIBLE BARRIERS TO ACTUAL PARTICIPATION OF THE ENTIRE POPULATION OF EVERY COUNTRY OR ELSE WE WOULD BE ULTIMATELY RESTRICTING OR LIMITING THE DEMOCRATIC ROLE AND THE SOCIAL AND CULTURAL REACH OF THE INTERNET.
&lt;br /&gt;&amp;gt;THE EFFORT AT HAND FURTHER REQUIRES THAT THE INTERNET GOVERNANCE FORUM BE FURTHER STRENGTHENED AS A DIALOGUE FORUM CAPABLE OF PRODUCING RESULTS AND RECOMMENDATIONS.
&lt;br /&gt;&amp;gt;IT ALSO REQUIRES A COMPREHENSIVE, BROAD-RANGING REVIEW OF THE 10 YEARS FOLLOWING THE SUMMIT -- WORLD SUMMIT MEETING OF INFORMATION SOCIETY AS WELL AS A DEEPER DISCUSSION ON ETHICS AND PRIVACY AT THE UNESCO LEVEL.
&lt;br /&gt;&amp;gt;GIVEN THE ABOVE, MAY I SAY THAT WE ARE STRONG BELIEVERS THAT THE CYBER-SPACE -- AND I'M SURE THAT BELIEF IS SHARED BY ALL OF US -- THE CYBER-SPACE SHOULD BE THE TERRITORY OF TRUST, HUMAN RIGHTS, CITIZENSHIP, COLLABORATION, AND PEACE.
&lt;br /&gt;&amp;gt;TO ACHIEVE THESE OBJECTIVES, WE MUST AGREE ON BASIC PRINCIPLES THAT WILL ULTIMATELY GUIDE INTERNET GOVERNANCE.
&lt;br /&gt;&amp;gt;AS REGARDS PRIVACY, THE RESOLUTION PASSED BY THE UNITED NATIONS ORGANIZATION WAS AN IMPORTANT STEP IN THE RIGHT DIRECTION, BUT WE MUST -- BUT WE STILL HAVE MUCH PROGRESS TO MAKE.
&lt;br /&gt;&amp;gt;ANY DATA COLLECTION OR TREATMENT SHOULD ONLY BE CARRIED OUT WITH FULL AGREEMENT OF THE PARTIES INVOLVED OR AS LEGALLY PROVIDED FOR.
&lt;br /&gt;&amp;gt;HOWEVER, THE DISCUSSION ON PRINCIPLES IS MUCH MORE COMPREHENSIVE.  IT SHOULD -- AND I STRESS IT SHOULD -- INCLUDE UNIVERSAL INTERNET ACCESS, WHICH IS ABSOLUTELY KEY FOR THE WEB TO SERVE AS A TOOL FOR HUMAN AND SOCIAL DEVELOPMENT SO AS TO ULTIMATELY HELP BUILD INCLUSIVE, NONDISCRIMINATORY SOCIETIES.
&lt;br /&gt;&amp;gt;IT SHOULD ALSO INCLUDE FREEDOM OF EXPRESSION AND NET NEUTRALITY AS AN SINE BRAZIL HAS ITS CONTRIBUTIONS TO MAKE FOLLOWING A BROAD RANGING DISCUSSION, DOMESTIC PROCESS THAT HAS ULTIMATELY LED TO THE PASSING OF THE INTERNET CIVIL FRAMEWORK ACT AS PASSED YESTERDAY BY CONGRESS IN WHICH I HAD THE HONOR OF SANCTIONING JUST A FEW MINUTES AGO.  THE  LAW -- AND I MAY QUOTE TIM BERNERS-LEE WHO QUOTED THE LAW AS A PRESIDENT TO THE WEB ON THE OCCASION OF THE 20th -- OR 25th ANNIVERSARY AS SUCH THE LAW CLEARLY SHOWS THE FEASIBILITY AND SUCCESS OF OPEN MULTISECTORIAL DISCUSSIONS AS WELL AS THE INNOVATIVE USE OF THE INTERNET AS PART OF ONGOING DISCUSSIONS AS A TOOL AND A INTERACTIVE DISCUSSION PLATFORM.
&lt;br /&gt;&amp;gt;I THINK IT IS FAIR TO SAY THAT THE PROCESS THAT LED UP TO THE CIVIL FRAMEWORK ACT CAN BE DESCRIBED AS A VIRTUOUS PROCESS IN THAT OUR CIVIL FRAMEWORK, AS IT CURRENTLY STANDS, HAS BEEN EVEN FURTHER APPRECIATED GIVEN THE PROCESS THAT PRECEDED THE EFFORTS TO ESTABLISH IT AS SUCH.
&lt;br /&gt;&amp;gt;MAY I, THEREFORE, CALL TO MIND THAT OUR CIVIL FRAMEWORK ESTABLISHES PRINCIPLES, GUARANTEES AND USER RIGHTS, CLEARLY ASSIGNING DUTIES AND RESPONSIBILITIES OF THE DIFFERENT STAKEHOLDERS AND GOVERNMENT AGENCIES ON AN ONLINE ENVIRONMENT.  AND EQUALLY IMPORTANT, IT ENSHRINES NETWORK NEUTRALITY AS A KEY PRINCIPLE, A MAJOR GAIN WHICH WE WERE ABLE TO MATERIALIZE AS A CONSENSUS IN THE PROCESS.
&lt;br /&gt;&amp;gt;IT ENSHRINES NETWORK NEUTRALITY BY ESTABLISHING THE TELECOMMUNICATIONS COMPANY SHOULD TREAT ANY DATA PACKAGES ON IN A --- FASHION WITH ACCOUNT TO AGENT, DESTINATION, SERVICE, TERMINAL OR APPLICATION.  THE LAW OR FRAMEWORK AS HAS TRULY  ENSHRINED NETWORK NEUTRALITY.  FURTHERMORE, COMPANIES MAY NOT BLOCK, MONITOR, FILTER OR ANALYZE THE CONTENT OF DATA PACKAGES.
&lt;br /&gt;&amp;gt;THE CIVIL FRAMEWORK PROTECTS CITIZENS' PRIVACY IN THE ONLY IN THE RELATION WITH THE  GOVERNMENTS BUT ALSO WITH RELATION WITH THE INTERNET COMPANIES.  COMMUNICATIONS ARE, BY DEFINITION, NON-VIABLE EXCEPT BY A SPECIFIC COURT ORDER TO THAT EFFECT.  THE RECENTLY PASSED LAW FURTHER CONTAINS CLEAR RULES GOVERNING WITHDRAWAL OF CONTENT FROM THE INTERNET.  ALWAYS, OF COURSE, WITH A VIEW TO ENSURING THAT THE APPLICABLE COURT ORDERS BE AVAILABLE.
&lt;br /&gt;&amp;gt;THE CIVIL NETWORK IS AN EXAMPLE OF THE FACT THAT THE INTERNET DEVELOPMENT CANNOT DO IT WITHOUT A DISCUSSION PROCESS AND THE INVOLVEMENT OF NATIONAL STATES.  AS SUCH, IT STANDS AS AN INNOVATIVE BENCHMARK MILESTONES BECAUSE IN ITS DEVELOPMENT PROCESS, WE HEARD THE VOICES OF THE STREETS, THE NETWORKS AND OF DIFFERENT INSTITUTIONS.
&lt;br /&gt;&amp;gt;FOR ALL OF THE ABOVE, IT IS OUR FIRM CONVICTION THAT ON A NETWORK, EACH NODE MATTERS.  THE LARGE NODES SUCH AS THE MEGA PORTALS TO WHICH A SUBSTANTIAL AMOUNT OF WORLD TRAFFIC  CONVERGES AND SMALL NODES ARE EQUALLY IMPORTANT.
&lt;br /&gt;&amp;gt;AT THIS TIME, I WOULD LIKE TO BRING TO THE FORE A KEY FUNDAMENTAL ISSUE AND TALK ABOUT THE FACT THAT THIS COUNTRY HAS TAKEN A MAJOR STEP FORWARD AS PART OF THE ONGOING PROCESS WHEREBY WE NOT ONLY INCLUDE BUT ALSO GUARANTEE A STEADY STREAM OF INCOME TO A SUBSTANTIAL SHARE OF THE POPULATION.
&lt;br /&gt;&amp;gt;INCOME AND ACCESS ARE EQUALLY IMPORTANT.  WE BELIEVE THAT IT IS EQUALLY IMPORTANT TO ENSURE WE HAVE PLACE IN SOCIETY WHERE CITIZENS HAVE THEIR OWN VIEWS AND THEY ARE ABLE TO VOICE THEIR VIEWS FREELY.  HENCE, THE  INVALUABLE DEGREE OF IMPORTANCE WE ATTACH TO THE INTERNET IN OUR SOCIETY.
&lt;br /&gt;&amp;gt;WE ALSO HAVE YET ANOTHER MAJOR ASSET.  I'M TALKING ABOUT  BRAZIL'S ETHNIC CULTURAL, POLITICAL AND RELIGIOUS DIVERSITY.  IT IS OURS TO NOT ONLY RESPECT BUT ALSO PROMOTE AND FOSTER OUR CULTURAL DIVERSITY.  WE DO NOT WISH TO IMPOSE BELIEFS, CUSTOMS, VALUES OR POLITICAL VIEWS ON ANYONE.
&lt;br /&gt;&amp;gt;MAY I PARTICULARLY HIGHLIGHT THE THOUSANDS OF USERS THAT MULTIPLY ON A DAY-TO-DAY BASIS NOT ONLY HERE BUT IN ALL THE DEVELOPING COUNTRIES IN THE OUTSKIRTS OF LARGE URBAN AREAS AND ALSO IN TRADITIONAL COMMUNITIES OUT THERE.  ALL OF THESE NEW USERS ENRICH THE NETWORK WITH NEW ALTERNATIVE IDEAS AND ACCOUNTS OF THE WORLD, NEW WORLD VISIONS.  THESE PEOPLE MAKE THE INTERNET A STRONGER AND MORE UNIVERSAL PLATFORM.
