Welcome to the November 2016 newsletter of the Centre for Internet and Society (CIS).

Dear readers,

As we bring in the new year here at CIS, we thank you for your continued interest and support.

Over the course of the previous year, government services and functions became more dependent on information technologies, concerns over cybersecurity and the vulnerability of electronic infrastructure grew, and new developments and challenges arose in the fields of Internet governance and free speech and expression.

In the wake of this major year of developments, the work that CIS does is even more important. We look forward to engaging with these and other emerging issues, in 2017 and beyond.

Highlights
Geethanjali Jujjavarapu and Udbhav Tiwari undertook a high-level literature review of the most commonly used technological tools and processes in the big data life cycle. In the research paper the authors have argued that big data life cycle is a conceptual construct that can be used to study the various stages that typically occur in collecting, storing and analysing big data, along with the principles that can govern these processes. Nirmita Narasimhan in a blog post published by Your Story has thrown light on the various challenges which persons with disabilities have to overcome. She has stressed that promoting use of technology and open source software and imparting training at an early age will go a long way in making students with disabilities self-sufficient and independent. Government of India's work is not available under free and open licenses as is the case in various other nations. Tito Dutta has called upon the Indian government to make its work freely licensed, wherever possible and applicable. The 33rd WIPO-SCCR was held in Geneva from November 14 - 18, 2016. Anubha Sinha attended the meeting. CIS made its statements on the GRULAC Proposal for Analysis of Copyright in the Digital Environment and the Proposed Treaty for the Protection of Broadcasting Organizations. What if our phones were to go silent? Would you be able to deal with the silence? Nishant Shah has explored this in an article published in the Indian Express. In a consolidated compilation titled Privacy after Big Data we have put together a series of articles that we have developed as we explore the impacts – positive and negative – of big data. This is a growing body of research that we are exploring and is relevant to multiple areas of our work including privacy and surveillance. CIS has called for comments for this compilation. The second Internet Researchers' Conference (IRC17) is scheduled to take place in Bengaluru between March 3 - 5, 2017. From the 23 submitted session proposals CIS will select 10 to be part of the final Conference agenda. The selection will be done through votes casted by the teams that have proposed the sessions. This will take place in December 2016.

Access to Knowledge

Our Access to Knowledge programme currently consists of two projects. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

As part of the project grant from the Wikimedia Foundation we have reached out to more than 3500 people across India by organizing more than 100 outreach events and catalysed the release of encyclopaedic and other content under the Creative Commons (CC-BY-3.0) license in four Indian languages (21 books in Telugu, 13 in Odia, 4 volumes of encyclopaedia in Konkani and 6 volumes in Kannada, and 1 book on Odia language history in English).

As part of its research on privacy and free speech, CIS is engaged with two different projects. The first one (under a grant from Privacy International and IDRC) is on surveillance and freedom of expression (SAFEGUARDS). The second one (under a grant from MacArthur Foundation) is on restrictions that the Indian government has placed on freedom of expression online.

Highlights
-------------------------------

The Internet Governance Forum was held at Jao Pessoa in Brazil from November 10 to 13, 2015. The theme for IGF 2015 was Evolution of Internet Governance: Empowering Sustainable Development. Sunil Abraham, Pranesh Prakash and Jyoti Panday participated. Overall CIS spoke in 10 panels. Jyoti Panday has summarized the developments.
Draft Outcome Document of the UN General Assembly's Overall Review of implementation of WSIS Outcomes was released on 4 November 2015. Comments were sought on the Draft Outcome Document from diverse stakeholders. CIS responded to the call .
The first draft of the National IPR Policy was released last December. Comments and suggestions were submitted to the DIPP on this. Akshath Mithal in his blog post analysed the comments available online and the trends that he was able to find.
Ramya Chandrasekhar wrote a blog post that has deconstructed and explained some aspects of the various proposals to enhance ICANN's accountability.
Mangalore based cultural centre Maand Sobhaann recently relicensed 3 of their publications under a free license so that the books could be digitised on Konkani Wikisource and enrich Konkani Wikipedia. Rahmanuddin Shaik and Tanveer Hasan have captured the development in a blog post.
Japreet Grewal in a blog post has attempted to understand the domain in which censorship laws are penetrating today giving the example of the role of group admin in Whatsapp.
Elonnai Hickok in a policy brief has reviewed different oversight mechanisms from the US, UK, and Canada and provides recommendations for ways in which India can strengthen its present oversight mechanisms for state surveillance and the intelligence community.
Rohan George has reviewed the literature surrounding big data and predictive policing and has provided an analysis of the legal implications of using predictive policing techniques in the Indian context.
Large blocks of underused spectrum lie tantalizingly out of reach, waiting for enabling regulation, administration, and to some extent technology, to accelerate our move towards Digital India, according to Shyam Ponappa's column published in the Business Standard.
CIS in collaboration with T.A.J. Residency & SKE Projects and or-bits.com developed Silicon Plateau Vol-1. This book marks the beginning of an interdisciplinary artistic project, Silicon Plateau, the scope of which is to observe how the arts, technology and society intersect in the city of Bangalore.
P.P. Sneha has outlined a few questions/conflicts that the digital practitioners in arts and humanities disciplines are grappling with in the first among seven sections that has been published.
Centre for the Study of Culture and Society and CIS has set up the CSCS Digital Innovation Fund. The objective is to encourage, host, and provide seed funding for the development of digital tools and infrastructure for arts, humanities, and social science research in India. The fund will be administered by the RAW programme at CIS.

IGF 2015 was held at Jao Pessoa in Brazil from November 10 to 13, 2015. The theme for IGF 2015 was Evolution of Internet Governance: Empowering Sustainable Development. Sunil Abraham, Pranesh Prakash and Jyoti Panday participated. Overall CIS spoke in 10 panels.

The Social Role of the Communications and the Strengthening of the Freedom of Expression Panel - "Cultural Diversity and Freedom of Expression" (Organized by Ministry of Culture and the Ministry of Communications of Brazil; Jao Pessoa, Brazil; November 9, 2015). Sunil Abraham was a panelist. Thirty-three participants took part in this pre-event.
Open Forum - DINL, Digital Infrastructure Association (Organized by Digital Infrastructure Netherlands Foundation; Jao Pessoa, Brazil; November 10, 2015). Jyoti Panday was a speaker at this workshop. CIS participated in the open forum to discuss the increase in government engagement with "the internet" to protect their citizens against crime and abuse and to protect economic interests and critical infrastructures. Thirteen participants attended the open forum.
Sustainable Development Goals (SDGs) and Internet Economy (Organized by Multistakeholder Advisory Group; Jao Pessoa, Brazil; November 11, 2015). Sunil Abraham was a panelist. Fifty five delegates attended the event. CIS participated in the discussions focusing on internet economy and internet role in sustainable development goals.
Cases on the right to be forgotten, what have we learned? (Jao Pessoa, Brazil; November 11, 2015). Jyoti Panday attended the event. CIS took part in the event to understand arguments, scope, discussions and current situation of the Right to be Forgotten outside the EU and around the world in rulings and legislations. Fifty four participants attended the event.
The Benefits and Challenges of the "Free Flow" of Data (Organized by Public Knowledge; Jao Pessoa, Brazil; November 12, 2015). Sunil Abraham was a panelist. Twenty-four delegates attended the event. CIS was part of the panel which discusssed the many benefits and challenges of the free flow of data. The workshop fostered a discussion of the ways in which stakeholders could address the underlying reasons for data flow restrictions.
Encryption and Anonymity: Rights and Risks (Organized by ARTICLE 19 and Privacy International; Jao Pessoa, Brazil; November 12, 2015). Pranesh Prakash was a speaker. CIS participated in the roundtable that discussed recommendations and the latest challenges to the protection of anonymity and encryption. Sixty three delegates attended.
A Dialogue on "Zero Rating" and Network Neutrality (Organized by Chalmers & Associates; Jao Pessoa; Brazil; November 12, 2015). Pranesh Prakash was a speaker. CIS took part in the discussion to promote access to expert insight and multi-stakeholder community discussion. Eighty five delegates attended the session.
Empowering the next billion by improving accessibility (Organized by Dynamic Coalition on Accessibility and Disability and Global Initiative for Inclusive ICTs; November 13, 2015). Sunil Abraham was a panelist. Pranesh Prakash participated in the discussions. CIS took part in the discussions that examined the technological and programmatic solutions available today for an effective removal of such barriers, potentially bringing a considerable number of new users to the Internet.
FOSS & a Free, Open Internet: Synergies for Development (Organized by Civil Society; Jao Pessoa, Brazil; November 13, 2015). Sunil Abraham and Pranesh Prakash spoke at the event. CIS took part in the discussions that explored links between the Free and Open nature of the Internet and the Free and Open Source Software through a series of experience sharing among the speakers as well as audiences.
Transnational Due Process: A Case Study in MS Cooperation (Organized by Internet & Jurisdiction Project; Jao Pessoa; November 13, 2015). Sunil Abraham was a panelist. The tension between the cross-border nature of the Internet and diverse national jurisdictions is a prime concern. The round-table described the method employed to develop this framework, challenges encountered and solutions found as well as the potential distribution of roles among the respective stakeholders in the operation of the diverse framework components. Twelve delegates attended this workshop.

We at the Centre for Internet & Society (CIS) welcome you to the eleventh issue of the newsletter (November 2014).

Highlights

On 13 November, 2014, the Department of Industrial Policy and Promotion had released a Call for Suggestions for India's proposed National IPR Policy. CIS sent its comments.
As part of the Pervasive Technologies we published four methodology documents: Rohini Lakshané wrote on Patent Landscaping for the Indian Mobile Device market ; Anubha Sinha wrote on Intellectual Property in Mobile Application Development in India ; Maggie Huang wrote on Access to Music through the Mobile; and Nehaa Chaudhari wrote on Sub Hundred Dollar Mobile Devices and Competition Law .
Odisha's most circulated newspaper Sambad has collaborated with CIS-A2K to relicense 19 books published by its sister concern "Ama Odisha".
Vipul Kharbanda in a blog entry examines the relationship between privacy and transparency in the context of the right to information in India .
Geetha Hariharan in a blog entry explores what India's ITU proposal means for Internet Governance.
Pranesh Prakash wrote an article in the Economic Times exploring net neutrality.
In her final blog post on the mapping exercise undertaken by CIS-RAW, P.P.Sneha summarises some of the key concepts and terms that emerged as significant in the discourse around Digital Humanities in India.

►Job

Programme Officer (Access to Knowledge - Institutional Partnerships): CIS is seeking applications for the post of Programme Officer for its Access to Knowledge (A2K) Programme. The position will be based in its Bangalore office. Programme Officer will collaboratively work with the A2K Team and would report to the Programme Director, Access to Knowledge at CIS.

Accessibility and Inclusion

Under a grant from the Hans Foundation we are doing two projects. The first project is on creating a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India. CIS in partnership with CLPR (Centre for Law and Policy Research) compiled the National Compendium of Policies, Programmes and Schemes for Persons with Disabilities (29 states and 6 union territories). The publication has been finalised and is currently in the process of being printed. The draft chapters and the quarterly reports can be accessed on the project page. The second project is on developing text-to-speech software for 15 Indian languages. The progress made so far in the project can be accessed here.

Access to Knowledge

As part of the Access to Knowledge programme we are doing two projects. The first one (Pervasive Technologies) under a grant from the International Development Research Centre (IDRC) is for research on the complex interplay between pervasive technologies and intellectual property to support intellectual property norms that encourage the proliferation and development of such technologies as a social good. The second one (Wikipedia) under a grant from the Wikimedia Foundation is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

Highlights

CIS is pleased to announce the second "Institute on Internet and Society" to be held in Yashada, Pune from February 11 to 17, 2014. Any members from the civil society (students, research scholars, academicians, scientists, legal professionals, etc.) who engage in issues concerning Internet and Society are encouraged to apply.
The National Resource Kit team is pleased to bring you its research for the states of Tripura, Nagaland and Chattisgarh.
CIS-A2K team signed a memorandum of understanding (MoU) with Christ University in Bangalore to introduce Wikipedia in classrooms.
The Access to Knowledge narrative report capturing the work done by CIS-A2K team in the first ten months of the grant along with its strategy for the next 1 year is published.
Last month we organised the Seventh Privacy Round-table in collaboration with FICCI, DSCI, and Privacy International in Delhi. The developments are captured in a report by Elonnai Hickok.
Along with Wikimedia India and Acharya Narendra Dev College, we organised the Relaunch of Creative Commons in India. Dr. Shashi Tharoor was the chief guest.

Accessibility and Inclusion

Internet Governance

CIS is doing a project (under a grant from Privacy International and International Development Research Centre (IDRC)) on conducting research on surveillance and freedom of expression (SAFEGUARDS). So far we have organised seven privacy round-tables and drafted the Privacy (Protection) Bill. This month we bring you a report from the seventh privacy round-table held in Delhi, and an analysis on why Facebook is more dangerous than government spying. As part of its project (funded by Citizen Lab, Munk School of Global Affairs, University of Toronto and support from the IDRC) on mapping cyber security actors in South Asia and South East Asia we did an interview with Namita A Malhotra, a researcher and lawyer from Alternative Law Forum. Pathways for Learning in Higher Education

Accessibility

Estimates of the percentage of the world's population that is disabled vary considerably. But what is certain is that if we count functional disability, then a large proportion of the world's population is disabled in one way or another. At CIS we work to ensure that the digital technologies, which empower disabled people and provide them with independence, are allowed to do so in practice and by the law. To this end, we support web accessibility guidelines, and change in copyright laws that currently disempower the persons with disabilities.

CIS Comments on Finance Committee Statements to Open Letters on Unique Identity: The Parliamentary Finance Committee responded to the six open letters sent by CIS through an email on 12 October 2011. CIS has commented on the points raised by the Committee.
Comments on the National Policy of Information Technology: The NPIT 2011 has the laudable goal of making India a ‘knowledge economy with a global role’ by developing and deploying ICT solutions in all sectors to foster development within India and at a global level. CIS appreciates this initiative of the Department of Information Technology and offers brief comments to strengthen the draft.

CIS Responds to Privacy Approach Paper
A group of officers was created to develop a framework for a privacy legislation that would balance the need for privacy protection, security, sectoral interests, and respond to the domain legislation on the subject. Shri Rahul Matthan of Tri Legal Services prepared an approach paper for the legal framework for a proposed legislation on privacy. Nobel Laureate Richard Thaler's Views On Auctions

You may be surprised to learn that the central government has been applying ideas from this year’s Nobel Prize winner for economics, Richard Thaler, even before the award. According to press reports, a “Nudge” unit was set up last year (2016) by the Niti Aayog in association with the Bill & Melinda Gates Foundation. Its purpose is to apply behavioural insights in policymaking for initiatives such as Swachh Bharat, Jan-Dhan Yojana, and Digital India. There are issues about ethics and motivation in the use of “nudges”, of course, with the best nudges likened to effective GPS devices that make it easier for people to get where they want to go with enabling information, and without covert manipulation.

Recognise, however, that manipulation can cut both ways. It can be beneficial for those being influenced, as when we eat healthier, observe regulations, or manage waste better. It can also be detrimental, as when manipulators entice, persuade, or coerce us to act against our interests, whether it is the private sector, government or vote seekers. Examples are enticements or misleading consumer information, government pressure for compliance without appropriate regulatory bases, or populist measures for votes.

Incidentally, Mr Thaler also advises the $6-billion Undiscovered Managers Behavioral Value Fund, which reportedly does better than 97 per cent of its peers, with average annual returns of 16 percent.

Ironically, one of Mr Thaler’s powerful early insights has been ignored and is awaiting discovery and application especially in India. It is about the “winner’s curse” in auctions, the phenomenon that winners of highly contested auctions tend to overbid. This is because when there is strong contention for a desirable asset, the one who most overvalues the asset tends to bid the highest. Mr Thaler demonstrates that the curse occurs in two ways: Where the winning bid exceeds the value of the winnings, or where the gains are below expectations. Mr Thaler’s 1988 paper demonstrated these effects through examples including oil and gas leases, corporate takeovers, publishing rights for books, and bidding for baseball players.1 This is especially important for India because we need more effective resource management, whether of coal/fuel for power, or of spectrum for communications. We can ill-afford the high opportunity costs of bad policies.

To be fair to policymakers in India, findings by Mr Thaler and others on auctions have been ignored by other governments greedy for immediate revenue. The UK, Europe and the USA went through disastrous 3G auctions that bankrupted their telecommunications industries. The exceptions were the Scandinavian countries and others such as Japan, South Korea, and China, where circumstances were managed so that there were either no auctions, or less contentious auctions. Tomes have been written on the “success” of high bids that resulted in enormous government collections. The consequences for the operating companies, however, were devastating, because of the severe drain on their finances from the heavy up-front investments. This was aggravated by the collapse of the technology bubble in 2000.

All the following auctions had disastrous outcomes for services:2

1994: The first US auction netted huge bids. Soon after, a number of “successful” bidders declared bankruptcy.

In India, the 1994 auction was followed by chaos because of overbidding and default. The sector recovered only after the auction fees were set aside for revenue-sharing in 1999 through the New Telecom Policy (NTP 1999), and lower shares were set in 2003.

1995-1996: US “C”-Block auction — several “successful” bidders declared bankruptcy.

2000 UK and 2001 EU 3G auctions: Netted $35 billion in the UK. In Austria, Germany and Italy, bids netted over $100 billion, 10 times the expectation. Considered a huge success, but winners couldn’t repay their debts, and the markets took a decade to recover.

2010: India’s 3G and broadband wireless auction with over Rs 1 lakh crore bid was considered a great success. Having paid too much for spectrum, operators struggled thereafter and new systems are slow to roll-out.

Meanwhile, auction experts wrote disparagingly of “failures” (low fees) in countries such as the Netherlands, Switzerland, Sweden, and ignored countries such as South Korea, Japan and Finland where there were no auctions (until 2009). However, these “failures” had the best broadband services, according to a 2010 study by the Saïd Business School at Oxford.

After India’s 2015 auction, researchers at ICRIER observed that the anticipated growth dividend from telecom didn’t materialise. Their rhetorical question and answer: “Does this mean the much-needed mobile broadband ecosystem will be further pushed into the future? If so, this would be another case of lost opportunity in telecom.”3 And that’s what it has been so far.

Broadband is an essential aspect of infrastructure. For India to break out of its low-growth trajectory, our policies have to recognise the impediments caused by spectrum fragmentation and high-cost auctions, and create practicable alternatives such as shared networks including spectrum that is paid for only when it is used. Also, more open-access and light-licensed bands in line with global developments will help India reap the benefits of ecosystems of devices as they evolve, e.g., in 60 GHz and TV White Space bands (for which India is ideally positioned). Instead, these technologies are blocked as is the spectrum, which remains unused, creating more barriers for ourselves by having to devise high-cost workarounds. Our ministries – for communications, electronics and information technology, information and broadcasting, defence, and finance – need to address technology applications and policies collectively to induct and align our systems and practices with global developments now and for the future.

No, India did NOT oppose the United Nations move to “make internet access a human right”

Last Friday, the United Nations Human Rights Council (UNHRC) passed a resolution titled “The promotion, protection and enjoyment of human rights on the Internet.”

The article by Pranesh Prakash and Japreet Grewal was published in Factordaily on July 13, 2016.

Several media outlets, including T he Verge, India Today, and BuzzFeed, reported that the resolution was ‘opposed’ by China, Russia, Saudi Arabia, South Africa and India. The Verge, for instance, reported that these countries “specifically opposed” a clause of the resolution that “condemns unequivocally measures to intentionally prevent or disrupt access to or dissemination of information online and calls for all countries to refrain from such measures”. This is pure bunkum. Some media organisations have also been reporting that the UNHRC resolution “declares that access to the Internet is a human right”. This too is fiction.

What’s the truth? The UNHRC resolution covers wide ground, including the reaffirmations of two previous resolutions, which stated that the same rights that people have offline must also be protected online as well. As ARTICLE19, an international free speech NGO, notes: “The draft resolution goes further than its predecessors, including by stressing the importance of an accessible and open Internet to the achievement of the Sustainable Development Goals, as well as in calling for accountability for extrajudicial killings, arbitrary detentions and other violations against people for expressing themselves online.” Importantly, the resolution “unequivocally condemns” internet shutdowns, such as the one that happened in Kashmir just last week after security forces killed guerrilla Burhan Wani.

This resolution was, in fact, adopted without any opposition. So why the brouhaha over countries like India?

Here are the facts

There were four separate amendments, two of which were proposed by Belarus, China and Russia (referred as L85, L86 in this article) and the other two were proposed by Belarus, China, Russia and Iran (referred as L87 and L88). None of these amendments comment on the paragraph in the resolution that condemns intentional disruption of access or dissemination of internet services. So the headlines in most of the reports are just plain wrong. Let’s examine each of these four amendments one by one

In L85, an amendment was suggested to a paragraph that refers to past resolutions by the UNHRC and the UN General Assembly relating to freedom of expression and the right to privacy online. The amendment, which proposed including a reference to a previous UNHRC resolution on the rights of children online, was later withdrawn.

In L86 the proposed amendments both added and removed some text, and was hotly opposed by organisations like ARTICLE19. The proposed amendment said that the same rights people have offline must also be protected online, in particular, freedom of expression and the right to privacy, in accordance with articles 17 and 19 of the International Covenant on Civil and Political Rights (ICCPR), a multilateral treaty adopted by the United National General Assembly to respect civil and political rights of individuals. Major additions: Some text on right to privacy and a reference to Article 17 of the ICCPR, which is about privacy. Major deletions: a reference to the Universal Declaration on Human Rights, and language stating that that freedom of expression is “applicable regardless of frontiers and through any media of one’s choice”, which is present in article 19 of the ICCPR. However, article 19 of the ICCPR is incorporated by reference even in the proposed amendment! So is there a real loss in purely legal terms? Not really.

The amendments in L87 sought to replace the term “human rights based approach” that stressed on the need to provide and expand access to the internet, and to replace it with the term “comprehensive and integrated approach.” The problem is that there is no clarity about what a “human rights based approach” to providing and expanding access to the internet is. What does it even mean? Is there a “human rights based approach” to spectrum auctions and spectrum sharing? Or the laying of fibre optic cables? Or anything else associated with internet access? If there is, indeed, a human rights based approach to providing and expanding access to the internet, it should be spelt out, rather than simply calling it that. Similarly, the term “comprehensive and integrated approach” is equally vague.

Even if one harbours reservations about these amendments, none of these amendments could be reasonably be characterised as “opposing” the condemnation of Internet shutdowns or “opposing” online freedoms.

Finally, in L88, the amendments proposed that the UN resolution should acknowledge concerns about using the internet and information technology for spreading ideas about “racial superiority or hatred, incitement to racial discrimination, xenophobia and related intolerance.” In the light of this, it is difficult to understand how adding concerns relating to hate speech to the resolution is seen as “being opposed” to online freedoms, especially when there is no direct action contemplated in the proposed amendment.

Indeed, in Paragraph 9, gender violence is mentioned, and in Paragraph 11, incitement to hatred is mentioned. Adding an additional, more specific reference can hardly be construed as being opposed to online freedoms. After all, states have a positive obligation to enact laws to prohibit hate speech under Article 20 (2) of the ICCPR, which is a centrepiece of international human rights law.

Even if one harbours reservations about these amendments, none of these amendments could be reasonably be characterised as “opposing” the condemnation of Internet shutdowns or “opposing” online freedoms. And factually, no states (including India, China, South Africa, Russia, and more) voted against the resolution.

A game of Chinese whispers

So why did so many prominent news organisations around the world get it so wrong? My theory is that it happened because organisation like ARTICLE19 put out press releases on what they perceived as the ‘weakening’ of the resolutions by the amendments examined above, and their regret that even democratic states like India and South Africa voted for these amendments. This was wrongly portrayed in much of the media as opposition by these countries to the resolution itself, to online freedoms, and particularly as opposition to the idea of condemning internet shutdowns. Thanks to the Chinese whispers nature of news reporting, this mistaken idea spread far and wide without any of the reporters bothering to check the original UN documents.

It is shameful if India condemns internet shutdowns at the UNHRC while deploying them for purposes such as preventing cheating during an examinations, during Ganesha visarjan, during Eid, during wrestling matches, and during protests.

However, regardless of the faulty reportage, there is a real crisis in India, with organisations like Medianama and the Software Freedom Law Centre having counted at least nine internet shutdowns this year alone, and at least 30 since 2013. It is shameful if India condemns internet shutdowns at the UNHRC while deploying them for purposes such as preventing cheating during an examinations, during Ganesha visarjan, during Eid, during wrestling matches, and during protests.

We at the Centre for Internet and Society have previously explained why a Gujarat High Court order allowing for an internet shutdown during riots was wrong in law, and violated our Constitution as well as our international human rights obligations. That is something the India media ought to be focussing far more on, but aren’t.

Lastly, it would also be welcome for the individual civil society organisations that signed an open letter to UNHRC members to explain why they too believed that these amendments would have significantly harmed our freedoms online. We see it instead as a case of ‘human rights politics’ being played out, when none of the proposed amendments would have had much of a negative legal impact, but only a political impact.

Should civil society organisations really get worked up about these?

No access to pornography in cyber cafes, declare new rules

Fresh guidelines, which are part of Information Technology (guidelines for cyber cafe) Rules 2011, will require cyber cafe owners to "tell users" not to surf websites that contain "pornographic or obscene material". Experts termed the rule arbitrary, saying that watching pornography is not an offence in India. This article by Javed Anwer was published in the Times of India on April 26, 2011.

According to the rules notified on April 11, all cyber cafes in the country will have to register with an "agency as notified" by the government. While some of the guidelines deal with the security threat posed by "anonymous internet users", most aim to make sure that people don't use cyber cafes to access pornographic material.

Pawan Duggal, a lawyer who specializes in IT laws, said the new guidelines were arbitrary. "Watching pornography is not illegal in India," he said. "It's absurd to ask cyber cafe owners to tell their customers not to access pornographic material even as law allows individuals to access adult websites unless it's not child pornography. The new rules require a second look."

The new rules suggest cafe owners install filtering software and keep a log of all websites accessed by customers for at least one year. Cafe owners have also been asked not to build a cabin/cubicle with a height of more than four and half feet. In a cyber cafe where there are no cubicles, "owners will have to place computers with the screens facing outward" or towards open space. The move is aimed at reducing privacy a cyber cafe user can get.

Duggal said if implemented earnestly, the new rules will put most of cyber cafe owners out of business.

Internet activists termed the guidelines "unconstitutional". Pranesh Prakash, a programme manager with Centre of Internet and Society, said the rules will violate privacy and will hamper internet users' ability to freely express themselves.

The new rules make it mandatory for user to carry an identity card. Cyber cafe owners have been asked to give user logs to the "registration agency" every month as well keep these records along with the log of websites accessed at the cyber cafe safe for a period of one year. A few cafe owners said that technically, it would be a daunting task to keep a record of every website accessed using their computers for a year.

While minors, if carrying identity cards have been permitted to use computers in a cyber cafe, they won't be allowed inside cubicles if not accompanied by guardians or parents. There is also provision of photographing cyber cafe users using a webcam or other device. The photographs will have to be authenticated by the user. Prakash said that photographing users raises serious privacy questions, especially in the case of children.

NITI Aayog Discussion Paper: An aspirational step towards India’s AI policy

The National Strategy for Artificial Intelligence — a discussion paper on India’s path forward in AI, is a welcome step towards a comprehensive document that reflects the government's AI ambitions. The 115-page discussion paper attempts to be an all encompassing document looking at a host of AI related issues including privacy, security, ethics, fairness, transparency and accountability.

The 115-page discussion paper attempts to be an all encompassing document looking at a host of AI related issues including privacy, security, ethics, fairness, transparency and accountability. The paper identifies five focus areas where AI could have a positive impact in India. It also focuses on reskilling as a response to the potential problem of job loss due the future large-scale adoption of AI in the job market. This blog is a follow up to the comments made by CIS on Twitter on the paper and seeks to reflect on the National Strategy as a well researched AI roadmap for India. In doing so, it identifies areas that can be strengthened and built upon.

Identified Focus Areas for AI Intervention

The paper identifies five focus areas—Healthcare, Agriculture, Education, Smart Cities and Infrastructure, Smart Mobility and Transportation, which Niti Aayog believes will benefit most from the use of AI in bringing about social welfare for the people of India. Although these sectors are essential in the development of a nation, the failure to include manufacturing and services sectors is an oversight. Focussing on manufacturing is fundamental not only in terms of economic development and user base, but also regarding questions of safety and the impact of AI on jobs and economic security. The same holds true for the service sector particularly since AI products are being made for the use of consumers, not just businesses. Use of AI in the services sector also raises critical questions about user privacy and ethics. Another sector the paper fails to include is defense, this is worrying since India is chairing the Group of Governmental Experts on Lethal Autonomous Weapons Systems (LAWS) in 2018. Across sectors, the report fails to look at how AI could be utilised to ensure accessibility and inclusion for the disabled. This is surprising, as aid for the differently abled and accessibility technology was one of the 10 domains identified in the Task Force Report on AI published earlier this year. This should have been a focus point in the paper as it aims to identify applications with maximum social impact and inclusion.

In its vision for the use of AI in smart cities, the paper suggests the adoption of a sophisticated surveillance system as well as the use of social media intelligence platforms to check and monitor people’s movement both online and offline to maintain public safety. This is at variance with constitutional standards of due process and criminal law principles of reasonable ground and reasonable suspicion. Further, use of such methods will pose issues of judicial inscrutability. From a rights perspective, state surveillance can directly interfere with fundamental rights including privacy, freedom of expression, and freedom of assembly. Privacy organizations around the world have raised concerns regarding the increased public surveillance through the use of AI. Though the paper recognized the impact on privacy that such uses would have, it failed to set a strong and forward looking position on the issue - such as advocating that such surveillance must be lawful and inline with international human rights norms.

Harnessing the Power of AI and Accelerating Research

One of the ways suggested for the proliferation of AI in India was to increase research, both core and applied, to bring about innovation that can be commercialised. In order to attain this goal the paper proposes a two-tier integrated approach: the establishment of COREs (Centres of Research Excellence in Artificial Intelligence) and ICTAI (International Centre for Transformational Artificial Intelligence). However the roadmap to increase research in AI fails to acknowledge the principles of public funded research such as free and open source software (FOSS), open standards and open data. The report also blames the current Indian Intellectual Property regime for being “unattractive” and averse to incentivising research and adoption of AI. Section 3(k) of Patents Act exempts algorithms from being patented, and the Computer Related Inventions (CRI) Guidelines have faced much controversy over the patentability of mere software without a novel hardware component. The paper provides no concrete answers to the question of whether it should be permissible to patent algorithms, and if yes, to to what extent. Furthermore, there needs to be a standard either in the CRI Guidelines or the Patent Act, that distinguishes between AI algorithms and non-AI algorithms. Additionally, given that there is no historical precedence on the requirement of patent rights to incentivise creation of AI, innovative investment protection mechanisms that have lesser negative externalities, such as compensatory liability regimes would be more desirable. The report further failed to look at the issue holistically and recognize that facilitating rampant patenting can form a barrier to smaller companies from using or developing AI. This is important to be cognizant of given the central role of startups to the AI ecosystem in India and because it can work against the larger goal of inclusion articulated by the report.

Ethics, Privacy, Security and Safety

In a positive step forward, the paper addresses a broader range of ethical issues concerning AI including transparency, fairness, privacy and security and safety in more detail when compared to the earlier report of the Task Force. Yet despite a dedicated section covering these issues, a number of concerns still remain unanswered.

Transparency

The section on transparency and opening the Black Box has several lacunae. First, AI that is used by the government, to an acceptable extent, must be available in the public domain for audit, if not under Free and Open Source Software (FOSS). This should hold true in particular for uses that impinge on fundamental rights. Second, if the AI is utilised in the private sector, there currently exists a right to reverse engineer within the Indian Copyright Act, which is not accounted for in the paper. Furthermore, if the AI was involved both in the commission of a crime or the violation of human rights, or in the investigations of such transgressions, questions with regard to judicial scrutability of the AI remain. In addition to explainability, the source code must be made circumstantially available, since explainable AI alone cannot solve all the problems of transparency. In addition to availability of source code and explainability, a greater discussion is needed about the tradeoff between a complex and potentially more accurate AI system (with more layers and nodes) vs. an AI system which is potentially not as accurate but is able to provide a human readable explanation. It is interesting to note that transparency within human-AI interaction is absent in the paper. Key questions on transparency, such as whether an AI should disclose its identity to a human have not been answered.

Fairness

With regards to fairness, the paper mentions how AI can amplify bias in data and create unfair outcomes. However, the paper neither suggests detailed or satisfactory solutions nor does it deal with biased historical data in an Indian context. More specifically, there seems to be no mention of regulatory tools to tackle the problem of fairness, such as:

Self-certification
Certification by a self-regulatory body
Discrimination impact assessments
Investigations by the privacy regulator

Such tools will proactively need to ensure inclusion, diversity, and equity in composition and decisions.

Additionally, with reference to correcting bias in AI, it should be noted that the technocratic view that as an AI solution continues to be trained on larger amounts of data , systems will self correct, does not fully recognize the importance of data quality and data curation, and is inconsistent with fundamental rights. Policy objectives of AI innovation must be technologically nuanced and cannot be at the cost of intermediary denial of rights and services.

Further, the paper does not deal with issues of multiple definitions and principles of fairness, and that building definitions into AI systems may often involve choosing one definition over the other. For instance, it can be argued that the set of AI ethical principles articulated by Google are more consequentialist in nature involving a a cost-benefit analysis, whereas a human rights approach may be more deontological in nature. In this regard, there is a need for interdisciplinary research involving computer scientists, statisticians, ethicists and lawyers.

Privacy

Though the paper underscores the importance of privacy and the need for a privacy legislation in India - the paper limits the potential privacy concerns arising from AI to collection, inappropriate use of data, personal discrimination, unfair gain from insights derived from consumer data (the solution being to explain to consumers about the value they as consumers gain from this), and unfair competitive advantage by collecting mass amounts of data (which is not directly related to privacy). In this way the paper fails to discuss the full implications on privacy that AI might have and fails to address the data rights necessary to enable the right to privacy in a society where AI is pervasive. The paper fails to engage with emerging principles from data protection such as right to explanation and right to opt-out of automated processing, which directly relate to AI. Further, there is no discussion on the issues such as data minimisation and purpose limitation which some big data and AI proponents argue against. To that extent, there is a lack of appreciation of the difficult policy questions concerning privacy and AI. The paper is also completely silent on redress and remedy. Further the paper endorses the seven data protection principles postulated by the Justice Srikrishna Committee. However CIS has pointed out that these principles are generic and not specific to data protection. Moreover, the law chapter of IEEE’s ‘Global Initiative on Ethics of Autonomous and Intelligent Systems’ has been ignored in favor of the chapter on ‘Personal Data and Individual Access Control in Ethically Aligned Design’ as the recommended international standard. Ideally, both chapters should be recommended for a holistic approach to the issue of ethics and privacy with respect to AI.

AI Regulation and Sectoral Standards

The discussion paper’s approach towards sectoral regulation advocates collaboration with industry to formulate regulatory frameworks for each sector. However, the paper is silent on the possibility of reviewing existing sectoral regulation to understand if they require amending. We believe that this is an important solution to consider since amending existing regulation and standards often takes less time than formulating and implementing new regulatory frameworks. Furthermore, although the emphasis on awareness in the paper is welcome, it must complement regulation and be driven by all stakeholders, especially given India’s limited regulatory budget. The over reliance on industry self-regulation, by itself, is not advisable, as there is an absence of robust industry governance bodies in India and self-regulation raises questions about the strength and enforceability of such practices. The privacy debate in India has recognized this and reports, like the Report of the Group of Experts on Privacy, recommend a co-regulatory framework with industry developing binding standards that are inline with the national privacy law and that are approved and enforced by the Privacy Commissioner. That said, the UN Guiding Principles on Business and Human Rights and its “protect, respect, and remedy” framework should guide any self regulatory action.

Security and Safety of AI Systems

In terms of security and safety of AI systems the paper seeks to shift the discussion of accountability being primarily about liability, to that of one about the explainability of AI. Furthermore, there is no recommendation of immunities or incentives for whistleblowers or researchers to report on privacy breaches and vulnerabilities. The report also does not recognize certain uses of AI as being more critical than others because of their potential harm to the human. This would include uses in healthcare and autonomous transportation. A key component of accountability in these sectors will be the evolution of appropriate testing and quality assurance standards. Only then, should safe harbours be discussed as an extension of the negligence test for damages caused by AI software. Additionally, the paper fails to recommend kill switches, which should be mandatory for all kinetic AI systems. Finally, there is no mention of mandatory human-in-the-loop in all systems where there are significant risks to safety and human rights. Autonomous AI is only viewed as an economic boost, but its potential risks have not been explored sufficiently. A welcome recommendation would be for all autonomous AI to go through human rights impact assessments.

Research and Education

Being a government think-tank, the NITI Aayog could have dealt in detail with the AI policies of the government and looked at how different arms of the government are aiming to leverage AI and tackle the problems arising out of the use of AI. Instead of tabulating the government’s role in each area and especially research, the report could have also listed out the various areas where each department could play a role in the AI ecosystem through regulation, education, funding research etc. In terms of the recommendations for introducing AI curriculums in schools, and colleges, the government could also ensure that ethics and rights are part of the curriculum - especially in technical institutions. A possible course of action could include corporations paying for a pan-Indian AI education campaign.This would also require the government to formulate the required academic curriculum that is updated to include rights and ethics.

Data Standards and Data Sharing

Based on the amount of data the Government of India collects through its numerous schemes, it has the potential to be the largest aggregator of data specific to India. However the paper does not consider the use of this data with enough gravity. For example, the paper recommends Corporate Data Sharing for “social good” and making government datasets from the social sector available publicly. Yet this section does not mention privacy enhancing technologies/standards such as pseudonymization, anonymization standards, differential privacy etc. Additionally there should be provisions that allow the government to prevent the formation of monopolies by regulating companies from hoarding user data. The open data standards could also be applicable to the private companies, so that they can also share their data in compliance with the privacy enhancing technologies mentioned above. The paper also acknowledges that AI Marketplaces require monitoring and maintenance of quality. It recognises the need for “continuous scrutiny of products, sellers and buyers”, and proposes that the government enable these regulations in a manner that private players could set up the marketplace. This is a welcome suggestion, but the legal and ethical framework of the AI Marketplace requires further discussion and clarification.

An AI Garage for Emerging Economies

The discussion paper also qualifies India as an “ideal test-bed” for trying out AI related solutions. This is problematic since questions of regulation in India with respect to AI have yet to be legally clarified and defined and India does not have a comprehensive privacy law. Without a strong ethical and regulatory framework, the use of new and possibly untested technologies in India could lead to unintended and possibly harmful outcomes.The government's ambition to position India as a leader amongst developing countries on AI related issues should not be achieved by using Indians as test subjects for technologies whose effects are unknown.

Conclusion

In conclusion, NITI Aayog’s discussion paper represents a welcome step towards a comprehensive AI strategy for India. However, the trend of inconspicuously releasing reports (this and the AI Task Force) as well as the lack of a call for public comments, seems to be the wrong way to foster discussion on emerging technologies that will be as pervasive as AI.

The blanket recommendations were provided without looking at its viability in each sector. Furthermore, the discussion paper does not sufficiently explore or, at times, completely omits key areas. It barely touched upon societal, cultural and sectoral challenges to the adoption of AI — research that CIS is currently in the process of undertaking.Future reports on Indian AI strategy should pay more attention to the country’s unique legal context and to possible defense applications and take the opportunity to establish a forward looking, human rights respecting, and holistic position in global discourse and developments. Reports should also consider infrastructure investment as an important prerequisite for AI development and deployment. Digitised data and connectivity as well as more basic infrastructure, such as rural electricity and well-maintained roads, require more funding to more successfully leverage AI for inclusive economic growth. Although there are important concerns, the discussion paper is an aspirational step toward India’s AI strategy.
