    <title>Open Data Hackathons are Great, but Address Privacy and License Concerns</title>

        &lt;b&gt;This is to cross-publish a blog post from DataMeet website regarding a letter shared with the organisers of Urban Hack 2015, Bangalore, in response to a set of privacy and license concerns identified and voiced during the hackathon by DataMeet members. Sumandro Chattapadhyay co-authored and co-signed the letter. The blog post is written by Nisha Thompson.&lt;/b&gt;
        
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Hackathons are a source of confusion and frustration for us. DataMeet actively does not do them unless there is a very specific outcome the community wants like&lt;a href="https://github.com/datameet/maps/tree/master/parliamentary-constituencies"&gt; freeing a whole dataset &lt;/a&gt;or introducing &lt;a href="http://datameet.org/2015/05/13/mumbai-meet-6-data-science-hackathon/"&gt;open data to a new audience&lt;/a&gt;. We feel that they cause burn out, are not productive, and in general don't help create a healthy community of civic tech and open data enthusiasts.&lt;/p&gt;
&lt;p&gt;That is not to say we feel others shouldn't do them, they are very good opportunities to spark discussion and introduce new audiences to problems in the social sector. &lt;a href="http://www.datakind.org/chapters/datakind-blr"&gt;DataKind&lt;/a&gt; and &lt;a href="https://rhokbangalore.wordpress.com/"&gt;RHOK&lt;/a&gt; and numerous others host hackathons or variations of them regularly to stir the pot, bring new people into civic tech and they can be successful starts to long term connections and experiments. A lot of people in the DataMeet community participate and enjoy hackathons.&lt;/p&gt;
&lt;p&gt;However, with great data access comes great responsibility. We always want to make sure that even if no output is achieved when a dataset is opened at least no harm should be done.&lt;/p&gt;
&lt;p&gt;Last October an open data hackathon,&lt;a href="https://www.hackerearth.com/sprints/urban-hack/"&gt; Urban Hack&lt;/a&gt;, run by Hacker Earth, &lt;a href="http://www.nasscom.in/"&gt;NASSCOM&lt;/a&gt;, &lt;a href="http://www.xrci.xerox.com/"&gt;XEROX&lt;/a&gt;, &lt;a href="https://console.ng.bluemix.net/?cm_mmc=EcoDISA-_-Bluemix_day-_-11-15-14::12-31-15-_-UrbanHack"&gt;IBM &lt;/a&gt;and &lt;a href="http://wri-india.org/"&gt;World Resource Institute India&lt;/a&gt; wanted to bring out open data and spark innovation in the transport and crime space by making datasets from &lt;a href="http://mybmtc.com/"&gt;Bangalore Metropolitan Transport Corporation (BMTC)&lt;/a&gt; and the Bangalore City Police available to work with. A DataMeet member (&lt;a href="http://www.lostprogrammer.com/"&gt;Srinivas Kodali&lt;/a&gt;) was participating, he is a huge transport data enthusiast and wanted to take a look at what is being made available.&lt;/p&gt;
&lt;p&gt;In the morning shortly after it started I received a call from him that there is a dataset that was made available that seems to be violating privacy and data security. We contacted the organizers and they took it down, later we realized it was quite a sensitive dataset and a few hundred people had already downloaded it. We were also distressed that they had not clarified ownership of data, license of data, and had linked to sources like &lt;a href="http://openbangalore.org/"&gt;Open Bangalore&lt;/a&gt;  without specifying licensing, which violated the license.&lt;/p&gt;
&lt;p&gt;The organizers were quite noted and had been involved with hackathons before so it was a little distressing to see these mistakes being made. We were concerned that the government partners (who had not participated in these types of events before) were also being exposed to poor practices. As smart cities initiatives take over the Indian urban space, we began to realize that this is a mistake that shouldn't happen again.&lt;/p&gt;
&lt;p&gt;Along with &lt;a href="http://cis-india.org/"&gt;Centre for Internet and Society&lt;/a&gt; and Random Hacks of Kindness we sent the organizers, Bangalore City Police and BMTC a letter about the breach in protocol. We wanted to make sure everyone was aware of the issues and that measures were taken to not repeat these mistakes.&lt;/p&gt;

&lt;p&gt;We are very proud of the DataMeet community and Srinivas for bringing this violation to the attention of the organizers. As people who participate in hackathons and other data events it is imperative that privacy and security are kept in mind at all times. In a space like India where a lot of these concepts are new to institutions, like the Government, it is essential that we are always using opportunities not only to showcase the power of open data but also good practices for protecting privacy and ensuring security.&lt;/p&gt;

    <title>A Megacorp’s Basic Instinct </title>

&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;Hours before the January 31 deadline for telecom regulator TRAI to give its opinion on Facebook’s controversial and expensive Free Basics pitch—which seeks to give India’s poor “free” access to certain partner websites—the consensus seems to be building up against the soc­ial media giant. “If there is cannibalising of the internet through services like Free Basics, the internet will be split; it will parcel out and slice the internet. Its future is at stake,” says a senior government official on condition of anonymity.&lt;br /&gt;&lt;br /&gt;In a climate where the tech-savvy Modi government is seen to be close to the online trinity of Facebook, Google and Twitter, TRAI’s defiant stance in favour of net neut­rality stands out. There’s a lot at stake. India’s position becomes crucial as few countries in the world have clearly defined laws on net neutrality or have taken a stand on it. For Facebook, there’s a lot more at stake. India is its second-largest user base after the US (it is banned in China), so it is leaving no stone unturned. The massive Rs 300-crore electronic and print media campaign is an indication of that.&lt;br /&gt;&lt;br /&gt;TRAI sources say they are ready for any adverse onslaught and they are under no pressure from the PMO. The view gaining ground in government is that FB is trying to create a walled garden where it controls what people see and surf and what they can access online. While this will be offered to consumers for free—the technical term is differential pricing—the websites part of Free Basics will have to pay for being on the platform. Outlook’s queries to FB remained unanswered at the time of going to press.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;At an ‘open house’ meeting to discuss TRAI’s consultation paper on  differential pricing last week, regulator Ram Sevak Sharma stood firm  against the barrage of pro-Free Basics opinions that flowed from FB,  telecom operators and some members of the public. TRAI’s message was  clear: FB’s tactics of moulding public opinion by stealth will not be  acceptable in India. In the past few weeks, there have been bitter  exchan­ges between TRAI and FB over the latter’s responses to a  consultation paper on differential pricing.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;TRAI’s defiant stand draws from an unp­recedented show of strength by civil society against Free Basics and FB’s intentions. Says former Aadhar man Nandan Nilekani, “Free Basics is certainly against net neutrality. How can a solution be neutral, if it disproportionately benefits a particular web­site or business on the internet? Today, 400 million Indians are online. They came online because of the inherent value the internet offers. How can a walled garden of 100-odd websites provide the same value?”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;What does Free Basics mean for PM Modi’s Digital India campa­ign? Being a walled garden, thousands of start-ups with­out adequate budgets to pay for such dedicated service will be forced to stay out of it. Similar questions are being raised about government services that are increa­singly coming online. The concern is that all government traffic will have to pass through FB servers. The senior government official quoted above agrees, “In such a scenario, the government will have to approach FB to make its websites accessible on the free service which is neither desirable nor safe.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The other fear is what happens to public data if it goes through a service like Free Basics. There is fear that a lot of government and public data will be put through Free Basics once government services start coming online. If Free Basics is for the poor who are also beneficiaries of government services, FB too can access this data. Says Prabir Purkayastha, chairman, Knowledge Commons, “FB says public service will be available through Free Bas­ics but can public service be given through a private initiative? Public data is valuable and can’t be handed over to a private company.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Few again are convinced by FB’s claim that Free Basics aims to make the internet accessible to the poor, with the many services offered through it. “The claim that the poor will get access to the internet is false,” warns Sunil Abraham, executive director, Centre for Internet and Society, Bangalore. “Free Basics gives access to less than 100 of the one billion plus websites on the world wide web. Those in the walled garden will be treated quite differently.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;What gives TRAI a shot in the arm is that, for the first time, academia has put its weight behind Free Basics opponents. In a signed statement, several IIT and IISc Bangalore professors have said that Free Basics won’t serve the purpose FB is proposing and is not good for the country. “The problem is the inter­net being provided (via Free Basics) is a shrunken and sanitised version of the real thing. Free Basics is not a good proposal for the long-term development of a healthy and democratic internet setup in India,” says Amitabha Bagchi, IIT Delhi professor and one of the signatories to the memo.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Of course, many of the experts &lt;i&gt;Outlook&lt;/i&gt; spoke to say that the  government, and not FB, should be responsible for providing free  internet to the people. Says Parminder Jeet Singh, executive director,  IT for Cha­nge, “The government is sitting on Rs 40,000 crore of USO  funds. It can surely utilise that to provide a free basic data package  to people in India. Basic government services and emergency services  should essentially be free.” Nilekani is also in fav­our of the  gover­nment providing free internet to people. “The internet is a  powerful poverty alleviation tool.... Government can do a direct benefit  transfer for data, a more mar­ket-neutral way of achieving the goal of  getting everyone on the internet,” he told &lt;i&gt;Outlook&lt;/i&gt;.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Legally, though, there may be issues in stopping FB from introducing its Free Bas­ics platform in India. Says Singh, “Techni­cally, the Indian government may not be able to stop FB from introducing Free Basics in India as it is just a platform. What the government has to do is to stop telcos from collaborating with it for free internet because Indian telcos, not FB, mediate access to the internet.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The demand for the government and TRAI to come clean on net neutrality has reached fever pitch. Experts like Nilekani feel that net neutrality, which does not allow zero rating and differential pricing based on telcos looking at the contents of the subscriber’s data packets, should be enshrined in law through an act of Par­liament, the way countries like the US have done. TRAI has also proposed two models where the internet is provided free initially and charged at a later stage and another where content providers and websites reim­burse the cost of browsing directly to consumers. Both these proposals have not found favour with experts who say that these are unworkable and only the government should disburse free internet.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In any case, all this is a matter of detail—important, no doubt. The key question is, what happens to Free Basics if TRAI rules in favour of net neutrality and goes against FB? “This is going to be a long-drawn-out battle as FB will certainly challenge this in court,” says the government official. After spending Rs 300 crore on publicity, there is no way it will roll over and die.&lt;/p&gt;

    <title>India, Egypt say no thanks to free Internet from Facebook</title>

        &lt;b&gt;ALWAR, India — Connecting people to the Internet is not easy in this impoverished farming district of wheat and millet fields, where working camels can be glimpsed along roads that curve through the low-slung Aravalli Hills.&lt;/b&gt;

&lt;p style="text-align: justify; "&gt;So when Facebook chief executive Mark Zuckerberg helicoptered in  about a year ago to visit a small computer lab and tout Internet for  all, Osama Manzar, director of India’s Digital Empowerment Foundation,  was thrilled.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But when Manzar tried Facebook’s limited free  Internet service, he was bitterly disappointed. The app, called Free  Basics, is a pared-down version of Facebook with other services such as  weather reports and job listings.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“I feel betrayed — not only  betrayed but upset and angry,” Manzar said. “He said we’re going to  solve the problem with access and bandwidth. But Facebook is not the  Internet.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Zuckerberg  launched his sweeping Internet.org initiative in 2013 as a way to  provide 4 billion people in the developing world with Web access, which  he says he sees as a basic human right.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But the initiative has  hit a major snag in India, where in recent months Free Basics has been  embroiled in controversy — with critics saying that the app, which  provides limited access to the Web, does a disservice to the poor and  violates the principles of “net neutrality,” which holds that equal  access to the Internet should be unfettered to all.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Activist groups such as &lt;a href="http://www.savetheinternet.in/" target="_blank"&gt;Save the Internet&lt;/a&gt;,  professors from leading universities and tech titans such as Nandan  Nilekani, the co-founder of Infosys, have spoken out against it. Another  well-known Indian entrepreneur dubbed it “poor Internet for poor  people.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The debate escalated in recent weeks after India’s  telecommunications regulator suspended Free Basics as it weighs whether  such plans are fair, with new rules expected by the end of the month.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;A  week later, Free Basics was banned in Egypt with little explanation,  prompting concern that the backlash could spread to other markets. More  recently, Google pulled out of the app in Zambia after a trial period.  An estimated 15 million people are using Free Basics in 37 countries,  including 1 million in India.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;“It’s  a very important test case for what will be India’s network neutrality  regime,” said Sunil Abraham of the Center for Internet and Society in  Bangalore.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India’s debate could affect the way other countries  address the question of whether it is fair for Internet service  providers to price websites differently. The U.S. Federal Communications  Commission’s rules on net neutrality went into effect only in June.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Officials  at Facebook launched an advertising blitz to counteract the negative  publicity. “Who could possibly be against this?” Zuckerberg wondered in a  Times of India editorial on Dec. 28.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“I think we’ve been a bit  surprised by the strong reaction,” said Chris Daniels, Facebook’s vice  president for Internet.org. “Fundamentally, the reason for the surprise  is that the program is doing good. It’s bringing people online who are  moving onto the broader Internet.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India, a country of 1.2 billion, has the second-highest number of  Internet users in the world, but an estimated 80 percent of the  population does not have Internet access.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India’s tech-savvy  prime minister, Narendra Modi, is trying to combat this with an  ambitious “Digital India” plan to link 250,000 village centers with  fiber-optic cable and extend mobile coverage. He has turned to the  Indian tech community as well as Silicon Valley for help, securing an  agreement with Google to provide free WiFi in railway stations.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India  has 130 million Facebook users, second only to the United States, and  is a key market as the social-media giant looks to expand beyond the  developed world, where its growth has slowed.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“If Facebook  manages to get another half a billion users in India, that’s a valuable  set of eyeballs to sell to a political party or corporation,” Abraham  said.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Facebook has long said that its program is about altruism, not eyeballs.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But  it does reap new customers. Those who buy a SIM card from Facebook’s  local mobile partner, Reliance Communications, are then prompted to pay  for additional data. About 40 percent who sign up for Free Basics buy a  data plan to move to the wider Web after 30 days, Daniels said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The  service is still running despite the India suspension. A Reliance  spokesman said it is in “testing mode” and is not being promoted.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“The  thing people forget about Free Basics is that it’s intended to be a  temporary transition for people to give them a taste of the Internet and  sign up. It’s a marketing program for the carrier in some sense,” said  David Kirkpatrick, author of “&lt;a href="http://www.amazon.com/gp/product/1439102120?ie=UTF8&amp;amp;camp=1789&amp;amp;creativeASIN=1439102120&amp;amp;linkCode=xm2&amp;amp;tag=thewaspos09-20" target="_blank" title="www.amazon.com"&gt;The Facebook Effect&lt;/a&gt;.”  But he added: “The idea that it’s some kind of alternative Internet  that’s a discriminatory gesture to the poor is the prevailing view among  the Indian intelligentsia. It’s fundamentally misunderstood.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Facebook  has pledged to open up to new scrutiny the selection process for  companies with new applications, Daniels said. That is a response to  concerns by many in India’s tech community that Facebook’s process put  India’s fledgling start-ups at a disadvantage.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The project’s proponents say that India’s needs are so great it cannot afford to suspend one program that could help.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Mahesh  Uppal, a telecommunications consultant, notes that more than 10 percent  of the country does not have mobile phone coverage and that India’s  progress in extending fiber-optic cable to village centers is proceeding  at a glacial pace. Modi had set a goal of linking all 250,000 by 2016,  but only 27,000 have cable so far and it is ready for use in only 3,200,  according to a government report.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In comparison, some 80 percent of China’s villages are linked by broadband.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;In Alwar district in the northern state of Rajasthan, many remember  when Zuckerberg came to visit but fewer know about Free Basics.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“I’ve  heard it’s free and by Facebook and you don’t have to pay for it,” said  Umer Farukh, 43, a folk musician. “But I don’t think Facebook should  control it. The Internet should be for everybody.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Farukh has  only been computer literate for two years, but he’s already emailing and  using YouTube to post videos and promote his band.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He’s become  such a proponent that he has donated space for one of Manzar’s computer  centers — part of a government initiative to build cyber-hubs in  minority communities — and encouraged the female members of his family  to take classes, which is rare in his conservative community.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Farukh  says that challenges to connecting India go far beyond data plans and  fiber-optic cable or the government broadband that often sputters out.  Wages are low, and hours are long. Only about half of the women in his  state are literate, and about a quarter of the young women in his  neighborhood are kept at home and not educated.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“This place is very backward,” he said. “India as a society is lagging far behind in terms of Internet.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In  the small nearby community of Roja Ka Baas, ringed by fields of  blooming mustard greens, residents are still awaiting the opening of  their planned WiFi center. They are struggling along on cheap mobile  phones with slow 2G spectrum until then, they said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Sakir Khan,  14, said that once the Internet finally arrived in this village, the  first thing he would do would be to sign up for Facebook.&lt;/p&gt;

    <title>Facebook’s Fight to Be Free</title>

&lt;hr /&gt;
&lt;p style="text-align: justify; "&gt;Thanks mostly to its mobile-ad profits, Facebook has had a great couple of years. According to its most recent earnings report, in November, the company’s quarterly ad revenue rose 45 percent, to $4.3 billion, from the same period in 2014. It has more than 1.5 billion monthly users, just over half of all the people online anywhere. Keeping up its rate of user growth—more than 100 million people each year—will only get tougher.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;A big part of the problem is that a lot of potential new eyeballs are in places where Internet access is patchy at best. Some of Facebook’s grander projects anticipated that issue: It has satellites and giant solar-powered planes that beam Wi-Fi down to areas that don’t have it. And then there’s Free Basics, the two-year-old project Chief Executive Officer Mark Zuckerberg has called an online 911. In about three dozen countries so far, Free Basics—also known as Internet.org—includes a stripped-down version of Facebook and a handful of sites that provide news, weather, nearby health-care options, and other info. One or two carriers in a given country offer the package for free at slow speeds, betting that it will help attract new customers who’ll later upgrade to pricier data plans.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Facebook says Free Basics is meant to make the world more open and connected, not to boost the company’s growth. Either way, online access is an especially big deal in India, where there are 130 million people using Facebook, 375 million people online, and an additional 800 million-plus who aren’t. (The social network remains blocked in China.) That may help explain why Zuckerberg spent part of the first few weeks of his paternity leave appealing personally to Indians to lobby for Free Basics. On Dec. 21 the Indian government suspended the program, offered in the country by carrier Reliance Communications, while it weighs public comments and arguments from Internet freedom advocates who say preferential treatment for Facebook’s services threatens to stifle competition.&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;“An emerging country like India needs to provide the consumer with incentives to get onto the Internet.” —Neha Dharia, an analyst at consulting firm Ovum&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Since the government’s telecommunications regulator announced the suspension, Facebook has bought daily full-page ads in major newspapers and plastered billboards with pictures of happy farmers and schoolchildren it says would benefit from Free Basics. Zuckerberg has frequently made the case himself via phone or newspaper op-ed, asking that Indians petition the government to approve his service. “If we accept that everyone deserves access to the Internet, then we must surely support free basic Internet services,” the CEO wrote in a column published in the Times of India, the nation’s largest daily paper, shortly before the new year. “Who could possibly be against this?”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Opponents, including some journalists and businesspeople, say Free Basics is dangerous because it fundamentally changes the online economy. If companies are allowed to buy preferential treatment from carriers, the Internet is no longer a level playing field, says Vijay Shekhar Sharma, founder of Indian mobile-payment company Paytm. A spokesman for Sharma confirmed that Zuckerberg called to discuss the matter but declined to comment further.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India’s Internet base will grow with or without Facebook’s help, says Nikhil Pahwa, a tech blogger and co-founder of the Save the Internet coalition, which opposes Free Basics. “We don’t see Free Basics as philanthropy. We see it as a land grab,” says Pahwa. When dealing with the famously protectionist Indian government, that’s a pretty good argument. An April attempt by India’s top mobile carrier to underwrite data costs for certain apps drew heavy criticism, and the carrier, Bharti Airtel, has put the program on hold.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;None of that means Facebook can’t help get more Indians online, says Neha Dharia, an analyst at consulting firm Ovum. “An emerging country like India needs to provide the consumer with incentives to get onto the Internet,” she says. “What Facebook Free Basics is doing is a bit extreme, but what you do need is a bit of a middle path.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Internet sampler packages such as Free Basics can also help carriers like Reliance, the fourth-largest in India, upgrade their often-struggling networks, Dharia says. That’s a symbiotic process, because customers may quickly grow frustrated with the bare-bones service and demand more. Free Basics doesn’t have Gmail, YouTube, Vimeo, Twitter, or Bollywood music streaming. (Video will account for 64 percent of India’s data traffic by March 2017, consulting firm Deloitte estimates.) It’s meant to be a steppingstone. Facebook says about 40 percent of Free Basics users start paying for data plans within a month.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But again, if Free Basics catches on in India, people may just keep paying for data to use more Facebook and forget about some of those other services, says Dharia. “Facebook is the Internet” to a lot of people in India, she says. Google, whose services are most conspicuously absent from the Free Basics roster, declined to comment.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;India’s telecommunications regulator says Facebook’s advocates and opponents have until Jan. 14 to file public comments; it’s received about 2.4 million responses so far, most of them form letters supporting Free Basics. The government’s decision could also ripple beyond India, says Pranesh Prakash, a Free Basics opponent and the policy director at the nonprofit Centre for Internet &amp;amp; Society in Bengaluru. In the weeks since India suspended Free Basics, Egypt, which had done the same back in October, once again shut down the Facebook plan, though the government wouldn’t say why. The India fight “will be a reputational challenge for Facebook,” says Prakash. “It will set the tone for Free Basics debate in other countries.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The bottom line: Facebook’s free data plan in India faces strong opposition from local businesses and Internet freedom advocates.&lt;/p&gt;

&lt;li&gt;Rahmanuddin Shaik conducted an analysis of the growth of &lt;a class="external-link" href="http://cis-india.org/a2k/blogs/the-sad-state-of-odia-wikipedia"&gt;Odia Wikipedia&lt;/a&gt; and &lt;a class="external-link" href="http://cis-india.org/a2k/blogs/konkani-wikipedia-progress-from-july-to-december-2015"&gt;Konkani Wikipedia&lt;/a&gt; from a perspective based on 	Wikimedia statistics for the July to  December 2015 period. &lt;li&gt;Rohini Lakshané made a presentation on &lt;a class="external-link" href="http://cis-india.org/a2k/blogs/patent-landscaping-in-the-sub-100-mobile-device-market-in-india"&gt;Patent landscaping in the sub-$100 mobile device market in India&lt;/a&gt; at the Global IP Congress. &lt;/li&gt;
&lt;li&gt;Anubha Sinha made a presentation on &lt;a class="external-link" href="http://cis-india.org/a2k/blogs/ip-in-mobile-applications-development"&gt;IP in Mobile Applications Development in India&lt;/a&gt; that discussed IP rights in mobile apps during the Global IP Congress.&lt;/li&gt;
&lt;li&gt;The Ministry of Finance held pre-budget  consultations with different stakeholder groups in connection with the  Union Budget 2016-17. CIS was invited 	to take part in the consultation  for the IT (hardware and software) group organised on January 07, 2016,  and submit a suggestion note. &lt;a class="external-link" href="http://cis-india.org/openness/pre-budget-consultation-2016-submission-to-the-ministry-of-finance"&gt;The submission&lt;/a&gt; was prepared and presented by Sumandro Chattapadhyay with contributions from Rohini Lakshané, Anubha Sinha and other members of CIS. &lt;a href="http://cis-india.org/openness/pre-budget-consultation-2016-submission-to-the-ministry-of-finance"&gt;&lt;/a&gt;&lt;/li&gt;
&lt;li&gt;CIS &lt;a href="http://cis-india.org/internet-governance/blog/ciss-comments-on-the-ccwg-accountability-draft-proposal"&gt;gave its comments&lt;/a&gt; on the 		failures of Cross Community Working Group on Enhancing ICANN Accountability (CCWG-Accountability) draft proposal as well as the processes that it has followed. &lt;/li&gt;

&lt;li&gt; The &lt;a href="http://cis-india.org/raw/irc16-selected-sessions"&gt;first Internet Researchers' Conference&lt;/a&gt; (IRC16), organised around the theme of 		'studying internet in India,'  will be held on February 26-28, 2016, at the Jawaharlal Nehru University  (JNU), Delhi. CSCS Digital Innovation Fund 		(CDIF) is supporting the  event. &lt;/li&gt;

    <title>Facebook is no charity, and the ‘free’ in Free Basics comes at a price </title>

        &lt;b&gt;Who could possibly be against free internet access? This is the question that Mark Zuckerberg asks in a piece for the Times of India in which he claims Facebook’s Free Basics service “protects net neutrality”.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;Free Basics is the rebranded Internet.org, a Facebook operation where  by partnering with local telecoms firms in the developing world the  firm offers free internet access – &lt;a href="https://theconversation.com/facebooks-free-access-internet-is-limited-and-thats-raised-questions-over-fairness-36460"&gt;limited only to Facebook&lt;/a&gt;, Facebook-owned WhatsApp, and a few other carefully selected sites and services.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Zuckerberg was responding to the strong backlash that Free Basics has  faced in India, where the country’s Telecom Regulatory Authority  recently &lt;a href="http://indianexpress.com/article/technology/tech-news-technology/facebook-free-basics-ban-net-neutrality-all-you-need-to-know/"&gt;pulled the plug on the operation&lt;/a&gt; while it debates whether telecoms operators should be allowed to offer  different services with variable pricing, or whether a principle of &lt;a href="https://theconversation.com/the-uk-doesnt-need-net-neutrality-regulations-yet-38204"&gt;network neutrality&lt;/a&gt; should be enforced.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Not content to await the regulator’s verdict, Facebook has come out swinging. It has &lt;a href="http://mashable.com/2015/12/23/facebook-free-basics-net-neutrality-india/"&gt;paid for billboards&lt;/a&gt;, &lt;a href="http://techcrunch.com/2015/12/27/gatekeeper-or-stepping-stone/"&gt;full-page newspaper ads&lt;/a&gt; and television ad campaigns to try to enforce the point that Free  Basics is good for India’s poor. In his Times piece, Zuckerberg goes one  step further – implying that those opposing Free Basics are actually  hurting the poor.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He argued that “for every ten people connected to the internet,  roughly one is lifted out of poverty”. Without reference to supporting  research, he instead offers an anecdote about a farmer called Ganesh  from Maharashtra state. Ganesh apparently used Free Basics to double his  crop yields and get a better deal for his crops.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Zuckerberg stressed that “critics of free basic internet services  should remember that everything we’re doing is about serving people like  Ganesh. This isn’t about Facebook’s commercial interests”.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Zuckerberg’s indignation illustrates either how little he understands  about the internet, or that he’s willing to say anything to anyone  listening.&lt;/p&gt;
&lt;h2 style="text-align: justify; "&gt;This is not a charity&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;First, despite his &lt;a href="http://boingboing.net/2015/12/27/facebooks-fuddy-full-page-a.html"&gt;claims to the contrary&lt;/a&gt; Free Basics clearly runs against the idea of net neutrality by offering  access to some sites and not others. While the service is claimed to be  open to any app, site or service, in practice the &lt;a href="https://developers.facebook.com/docs/internet-org/platform-technical-guidelines"&gt;submission guidelines&lt;/a&gt; forbid JavaScript, video, large images, and Flash, and effectively rule  out secure connections using HTTPS. This means that Free Basics is able  to read all data passing through the platform. The same rules don’t  apply to Facebook itself, ensuring that it can be the only social  network, and (Facebook-owned) WhatsApp the only messaging service,  provided.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Yes, Free Basics is free. But how appealing is a taxi company that  will only take you to certain destinations, or an electricity provider  that will only power certain home electrical devices? There are &lt;a href="https://blog.mozilla.org/netpolicy/2015/05/05/mozilla-view-on-zero-rating/"&gt;alternative models&lt;/a&gt;: in Bangladesh, &lt;a href="http://m.grameenphone.com/"&gt;Grameenphone&lt;/a&gt; gives users free data after they watch an advert. In some African countries, users get free data after buying a handset.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Second, there is no convincing body of peer-reviewed evidence to  suggest internet access lifts the world’s poor out of poverty. Should we  really base telecommunications policy on an anecdote and a &lt;a href="https://www2.deloitte.com/content/dam/Deloitte/ie/Documents/TechnologyMediaCommunications/2014_uk_tmt_value_of_connectivity_deloitte_ireland.pdf"&gt;self-serving industry report&lt;/a&gt; sponsored by the firm that stands to benefit? India has a &lt;a href="http://indiatribune.com/indias-literacy-level-is-74-2011-census-2/"&gt;literacy rate of 74%&lt;/a&gt;,  of which a much smaller proportion speak English well enough to read  it. Literate English speakers and readers tend not to be India’s poorest  citizens, yet it’s English that is the predominant language on the web.  This suggests Free Basics isn’t suited for India’s poorest, who’d be  better served by more voice and video services.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Third, the claim that Free Basics isn’t in Facebook’s commercial interest is the most outrageous. In much the same way that &lt;a href="http://www.theguardian.com/sustainable-business/nestle-baby-milk-scandal-food-industry-standards"&gt;Nestlé offered free baby formula in the 1970s&lt;/a&gt; as development assistance to low-income countries – leaving nursing  mothers unable to produce sufficient milk themselves – Free Basics is  likely to impede commercial alternatives.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;By offering free access Free Basics disrupts the market, allowing  Facebook to gain a monopoly that can benefit from the network effects of  a growing user base. Sunil Abraham, executive director of the Centre  for Internet and Society, in India, has &lt;a href="http://cis-india.org/internet-governance/news/facebook-shares-10-key-facts-about-free-basics-heres-whats-wrong-with-all-10-of-them"&gt;aptly noted&lt;/a&gt; that expanding audience and consumer bases have long been as important  as revenues for internet firms. Against Facebook’s immensely deep  pockets and established user-base, homegrown competitors are thwarted  before they even begin.&lt;/p&gt;
&lt;h2 style="text-align: justify; "&gt;Poverty consists of more than just no internet&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;India will not always have low levels of internet access, this is not  the issue – in fact Indian internet penetration growth rates &lt;a href="http://geonet.oii.ox.ac.uk/blog/changing-internet-access/"&gt;are relatively high&lt;/a&gt;.  Instead the company sees Free Basics as a means to establish a  bridgehead into the country, establishing a monopoly before other firms  move in.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There is decades of &lt;a href="http://r4d.dfid.gov.uk/"&gt;research&lt;/a&gt; about how best to help farmers like Ganesh: access to good quality  education, healthcare, and water all could go a long way. But even if we  see internet access as one of the key needs to be met, why would we  then offer a restricted version?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In presenting Free Basics as an act of altruism Zuckerberg tries to  silence criticism. “Who could possibly be against this?”, he asks:&lt;/p&gt;
&lt;blockquote style="text-align: justify; "&gt;
&lt;p&gt;What reason is there for denying people free access to  vital services for communication, education, healthcare, employment,  farming and women’s rights?&lt;/p&gt;
&lt;/blockquote&gt;
&lt;p style="text-align: justify; "&gt;That is the right question, but Free Basics is the wrong answer.  Let’s call a spade a spade and see Free Basics as an important part of  the business strategy of one of the world’s largest internet  corporations, rather than as a selfless act of charity.&lt;/p&gt;

    <title>The Internet Has a New Standard for Censorship</title>

&lt;p style="text-align: justify; "&gt;Ray Bradbury’s dystopian novel Fahrenheit 451 opens with the declaration, “It was a pleasure to burn.” The six unassuming words offer a glimpse into the mindset of the novel’s protagonist, ‘the fireman’ Guy Montag, who burns books. Montag occupies a world of totalitarian state control over the media where learning is suppressed and censorship prevails. The title alludes to the ‘temperature at which book paper catches fire and burns,’ an apt reference to the act of violence committed against citizens through the systematic destruction of literature. It is tempting to think about the novel solely as a story of censorship. It certainly is. But it is also a story about the value of intellectual freedom and the importance of information.&lt;br /&gt;&lt;br /&gt;Published in 1953, Bradbury’s story predates home computers, the Internet, Twitter and Facebook, and yet it anticipates the evolution of these technologies as tools for censorship. When the state seeks to censor speech, they use the most effective and easiest mechanisms available. In Bradbury’s dystopian world, burning books did the trick; in today’s world, governments achieve this by blocking access to information online. The majority of the world’s Internet users encounter censorship even if the contours of control vary depending on the country’s policies and infrastructure.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Online censorship in India&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;In India, information access  blockades have become commonplace and are increasingly enforced across  the country for maintaining political stability, for economic &lt;/span&gt;&lt;a href="http://www.indiantelevision.com/regulators/high-court/delhi-hc-restrains-200-websites-from-illegally-showing-balajis-kyaa-kool-hain-hum-3-160123" target="_blank"&gt;&lt;span&gt;reasons&lt;/span&gt;&lt;/a&gt;&lt;span&gt;, in defence of national security or preserving social values. Last week, the Maharashtra Anti-terror Squad &lt;/span&gt;&lt;a href="http://www.abplive.in/india-news/maharashtra-ats-blocks-94-isis-websites-brainwashing-the-youth-280192"&gt;&lt;span&gt;blocked&lt;/span&gt;&lt;/a&gt;&lt;span&gt; 94 websites that were allegedly radicalising the youth to join the  militant group ISIS. Memorably, in 2015 the NDA government’s ham-fisted &lt;/span&gt;&lt;a href="http://thewire.in/2015/08/03/the-government-does-not-want-you-accessing-porn-on-the-internet-anymore-7782/"&gt;&lt;span&gt;attempts&lt;/span&gt;&lt;/a&gt;&lt;span&gt; at enforcing a ban on online pornography resulted in widespread public  outrage. Instead of revoking the ban, the government issued yet another  vaguely worded and in many senses astonishing order. As reported by &lt;/span&gt;&lt;i&gt;&lt;a href="http://www.medianama.com/2015/08/223-porn-india-ban/"&gt;&lt;span&gt;Medianama&lt;/span&gt;&lt;/a&gt;&lt;/i&gt;&lt;span&gt;,  the revised order delegates the responsibility of determining whether  banned websites should remain unavailable to private intermediaries. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The state’s shifting reasons for  blocking access to information is reflective of its tendentious attitude  towards speech and expression. Free speech in India is messily  contested and normally, the role of the judiciary acts as a check on the  executive’s proclivity for banning. For instance, in 2010 the Supreme  Court &lt;/span&gt;&lt;a href="http://timesofindia.indiatimes.com/india/Supreme-Court-lifts-ban-on-James-Laines-book-on-Shivaji/articleshow/6148410.cms"&gt;&lt;span&gt;upheld&lt;/span&gt;&lt;/a&gt;&lt;span&gt; the Maharashtra High Court’s decision to revoke the ban on the book on  Shivaji by American author James Laine, which, according to the state  government, contained material promoting social enmity. However, in the  context of communications technology the traditional role of courts is  increasingly being passed on to private intermediaries. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The delegation of authority is  evident in the government notifying intermediaries to proactively filter  content for ‘child pornography’ in the revised &lt;/span&gt;&lt;a href="http://cis-india.org/internet-governance/resources/dot-morality-block-order-2015-07-31/view"&gt;&lt;span&gt;order&lt;/span&gt;&lt;/a&gt;&lt;span&gt; issued to deal with websites blocked as result of its crackdown on  pornography. Such screening and filtering requires intermediaries to  make a determination on the legality of content in order to avoid direct  liability. As international best practices such as the &lt;/span&gt;&lt;a href="https://www.manilaprinciples.org/"&gt;&lt;span&gt;Manila Principles on Intermediary Liability&lt;/span&gt;&lt;/a&gt; &lt;span&gt;point  out, such screening is a slow process and costly and  intermediaries  are incentivised to simply limit access to information. &lt;/span&gt;&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;&lt;span&gt;Blocking procedures and secrecy&lt;/span&gt;&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The constitutional validity of Section 69A of the Information Technology Act, 2008 which grants power to the executive to block access to information unchecked, and in secrecy was challenged in Shreya Singhal v. Union of India. Curiously, the Supreme Court upheld S69A reasoning that the provisions were narrowly-drawn with adequate safeguards and noted that any procedural inconsistencies may be challenged through writ petitions under Article 226 of the Constitution. Unfortunately as past instances of blocking under S69A reveal the provisions are littered with procedural deficiencies, amplified manifold by the authorities responsible for interpreting and implementing the orders.&lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Problematically, an &lt;/span&gt;&lt;a href="http://cis-india.org/internet-governance/blog/is-india2019s-website-blocking-law-constitutional-2013-i-law-procedure"&gt;&lt;span&gt;opaque&lt;/span&gt;&lt;/a&gt;&lt;span&gt; confidentiality criteria built into the blocking rules mandates secrecy  in requests and recommendations for blocking and places written orders  outside the purview of public scrutiny. As there are no comprehensive  list of blocked websites or of the legal orders, the public has to rely  on ISPs leaking orders, or media reports to understand the censorship  regime in India. RTI applications requesting further information on the  implementation of these safeguards have at best provided&lt;/span&gt; &lt;a href="http://cis-india.org/internet-governance/blog/response-deity.clarifying-procedures-for-blocking.pdf"&gt;&lt;span&gt;incomplete&lt;/span&gt;&lt;/a&gt;&lt;span&gt; information. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Historically, the courts in India have &lt;/span&gt;&lt;a href="http://www.livemint.com/Politics/hDIjjunGikWywOgSRiM7NP/SC-has-set-a-high-threshold-for-tolerance-Lawrence-Liang.html"&gt;&lt;span&gt;held&lt;/span&gt;&lt;/a&gt;&lt;span&gt; that Article 19(1)(a) of the Constitution of India is as much about the  right to receive information as it is to disseminate, and when there is  a chilling effect on speech, it also violates the right to receive  information. Therefore, if a website is blocked citizens have a  constitutional right to know the legal grounds on which access is being  restricted. Just like the government announces and clarifies the grounds  when banning a book, users have a right to know the grounds for  restrictions on their speech online. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Unfortunately, under the&lt;/span&gt;&lt;a href="http://cis-india.org/internet-governance/blog/deity-says-143-urls-blocked-in-2015"&gt; &lt;span&gt;present&lt;/span&gt;&lt;/a&gt;&lt;span&gt; blocking regime in India there is no easy way for a service provider to  comply with a blocking order while also notifying users that censorship  has taken place. The ‘&lt;/span&gt;&lt;a href="http://cis-india.org/internet-governance/resources/information-technology-procedure-and-safeguards-for-blocking-for-access-of-information-by-public-rules-2009"&gt;&lt;span&gt;Blocking Rules&lt;/span&gt;&lt;/a&gt;&lt;span&gt;’ require notice “person &lt;/span&gt;&lt;span&gt;or&lt;/span&gt;&lt;span&gt; intermediary” thus implying that notice may be sent to either the  originator or the intermediary. Further, the confidentiality clause &lt;/span&gt;&lt;a href="https://indconlawphil.wordpress.com/2015/03/25/the-supreme-courts-it-act-judgment-and-secret-blocking/"&gt;&lt;span&gt;raises&lt;/span&gt;&lt;/a&gt;&lt;span&gt; the presumption that nobody beyond the intermediaries ought to know about a block. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Naturally, intermediaries interested in self-preservation and avoiding conflict with the government become complicit in maintaining secrecy in blocking orders. As a result, it is often difficult to determine why content is inaccessible and users often mistake censorship for technical problem in accessing content. Consequently, pursuing legal recourse or trying to hold the government accountable for their censorious activity becomes a challenge. In failing to consider the constitutional merits of the confidentiality clause, the Supreme Court has shied away from addressing the over-broad reach of the executive. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Secrecy in removing or blocking access is a global problem that places limits on the transparency expected from ISPs. Across &lt;/span&gt;&lt;a href="https://books.google.co.in/books?id=s1LBBwAAQBAJ&amp;amp;pg=PA88&amp;amp;lpg=PA88&amp;amp;dq=transparency+and+blocking+orders&amp;amp;source=bl&amp;amp;ots=8kJ5LNJU5s&amp;amp;sig=gB9E01_gQ3QsjwFtnpa5KdIL8oA&amp;amp;hl=en&amp;amp;sa=X&amp;amp;ved=0ahUKEwirzr7ZlMzKAhXEt44KHdxkBxQQ6AEIOzAF#v=onepage&amp;amp;q=transparency%20and%20blocking%20orders&amp;amp;f=false"&gt;&lt;span&gt;many&lt;/span&gt;&lt;/a&gt;&lt;span&gt; jurisdictions intermediaries are legally &lt;/span&gt;&lt;a href="https://books.google.co.in/books?id=s1LBBwAAQBAJ&amp;amp;pg=PA88&amp;amp;lpg=PA88&amp;amp;dq=transparency+and+blocking+orders&amp;amp;source=bl&amp;amp;ots=8kJ5LNJU5s&amp;amp;sig=gB9E01_gQ3QsjwFtnpa5KdIL8oA&amp;amp;hl=en&amp;amp;sa=X&amp;amp;ved=0ahUKEwirzr7ZlMzKAhXEt44KHdxkBxQQ6AEIOzAF#v=onepage&amp;amp;q=transparency%20and%20blocking%20orders&amp;amp;f=false"&gt;&lt;span&gt;prohibited&lt;/span&gt;&lt;/a&gt;&lt;span&gt; from publicising filtering orders as well as information relating to  content or service restrictions. For example in United Kingdom, ISPs are  prohibited from revealing blocking orders related to terrorism and  surveillance. In South Korea, the &lt;/span&gt;&lt;a href="http://www.singo.or.kr/eng/01_introduction/introduction.php"&gt;&lt;span&gt;Korean Communications Standards Commission&lt;/span&gt;&lt;/a&gt;&lt;span&gt; holds public meetings that are open to the public. However, the sheer v&lt;/span&gt;&lt;a href="https://www.eff.org/deeplinks/2011/08/south-korea-only-thing-worse-online-censorship"&gt;&lt;span&gt;olume&lt;/span&gt;&lt;/a&gt;&lt;span&gt; of censorship (i.e. close to 10,000 URLs a month) makes it &lt;/span&gt;&lt;a href="https://www.eff.org/deeplinks/2011/08/south-korea-only-thing-worse-online-censorship"&gt;&lt;span&gt;unwieldy&lt;/span&gt;&lt;/a&gt;&lt;span&gt; for public oversight. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;As the Manila Principles &lt;/span&gt;&lt;a href="https://www.eff.org/files/2015/07/08/manila_principles_background_paper.pdf"&gt;&lt;span&gt;note&lt;/span&gt;&lt;/a&gt;&lt;span&gt;,  providing users with an explanation and reasons for placing  restrictions on their speech and expression increases civic engagement.  Transparency standards will empower citizens to demand that companies  and governments they interact with are more accountable when it comes to  content regulation. It is worth noting, for conduits as opposed to  content hosts, it may not always be technically feasible for to provide a  notice when content is unavailable due to filtering. A new standard  helps improve transparency standards for network level intermediaries  and for websites bound by confidentiality requirements. The recently  introduced HTTP code for errors is a critical step forward in  cataloguing censorship on the Internet. &lt;/span&gt;&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;&lt;span&gt;A standardised code for censorship&lt;/span&gt;&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;On December 21, 2015, the Internet Engineering Standards Group (IESG) which is the organisation responsible for reviewing and updating the internet’s operating standards approved the publication of 451-’An HTTP Status Code to Report Legal Obstacles’. The code provides intermediaries a standardised way to notify users know when a website is unavailable following a legal order. Publishing the code allows intermediaries to be transparent about their compliance with court and executive orders across jurisdictions and is a huge step forward for capturing online censorship. HTTP code 451 was introduced by software engineer Tim Bray and the code’s name is an homage to Bradbury’s novel Fahrenheit 451. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Bray began developing the code after  being inspired by a blog post by Terence Eden calling for a  censorship  error code. The code’s official status comes after two years of  discussions within the technical community and is a result of  campaigning from transparency and civil society advocates who have been  pushing for clearer labelling of internet censorship. Initially, the  code received pushback from within the technical community for reasons  enumerated by Mark Nottingham, Chair of the IETF HTTP Working Group in  his &lt;/span&gt;&lt;a href="https://www.mnot.net/blog/2015/12/18/451"&gt;&lt;span&gt;blog&lt;/span&gt;&lt;/a&gt;&lt;span&gt;.  However, soon sites began using the code on an experimental and  unsanctioned basis and faced with increasing demand for and feedback,  the code was accepted. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The HTTP code 451 works as a  machine-readable flag and has immense potential as a tool for  organisations and users who want to quantify and understand censorship  on the internet. Cataloguing online censorship is a challenging,  time-consuming and expensive task. The HTTP code 451 circumvents  confidentiality obligations built into blocking or licensing regimes and  reduces the cost of accessing blocking orders. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;The code creates a distinction  between websites blocked following a court or an executive order, and  when information is inaccessible due to technical errors. If implemented  widely, Bray’s new code will help &lt;/span&gt;&lt;a href="http://www.theverge.com/2015/12/21/10632678/http-status-code-451-censorship-tim-bray"&gt;&lt;span&gt;prevent&lt;/span&gt;&lt;/a&gt;&lt;span&gt; confusion around blocked sites. The code addresses the issue of the ISP’s misleading and inaccurate usage of &lt;/span&gt;&lt;a href="https://en.wikipedia.org/wiki/HTTP_403"&gt;&lt;span&gt;Error 403&lt;/span&gt;&lt;/a&gt;&lt;span&gt; ‘Forbidden’ (to indicate that the server can be reached and understood  the request, but refuses to take any further action) or 404 ‘&lt;/span&gt;&lt;a href="https://en.wikipedia.org/wiki/HTTP_404"&gt;&lt;span&gt;Not Found&lt;/span&gt;&lt;/a&gt;&lt;span&gt;’ (to indicate that the requested resource could not be found but may be available again in the future). &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;Adoption of the new standard is  optional, though at present there are no laws in India that prevent  intermediaries doing so. Implementing a standardised machine-readable  flag for censorship will go a long way in bolstering the accountability  of ISPs that have in the &lt;/span&gt;&lt;a href="http://www.medianama.com/2014/12/223-india-blocks-imgur/"&gt;&lt;span&gt;past&lt;/span&gt;&lt;/a&gt;&lt;span&gt; targeted an entire domain instead of the specified URL. Adoption of the  standard by ISPs will also improve the understanding of the burden  imposed on intermediaries for censoring and filtering content as  presently, there is no clarity on what constitutes compliance.  Of  course, censorious governments may &lt;/span&gt;&lt;a href="https://nakedsecurity.sophos.com/2015/12/23/welcome-to-http-error-code-451-unavailable-for-legal-reasons/"&gt;&lt;span&gt;prohibit&lt;/span&gt;&lt;/a&gt;&lt;span&gt; the use of the code, for example by issuing an order that specifies not  only that a page be blocked, but also precisely which HTTP return code  should be used. Though such sanctions should be &lt;/span&gt;&lt;a href="https://cdt.org/blog/censorship-transparency-comes-to-the-web/"&gt;&lt;span&gt;viewed&lt;/span&gt;&lt;/a&gt;&lt;span&gt; as evidence of systematic rights violation and totalitarian regimes. &lt;/span&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;span&gt;In India where access to software code repositories such as Github and Sourceforge are routinely &lt;/span&gt;&lt;span&gt;&lt;a href="http://cis-india.org/internet-governance/resources/2014-12-17_DoT-32-URL-Block-Order.pdf"&gt;restricted&lt;/a&gt;,&lt;/span&gt;&lt;span&gt; the need for such code is obvious. The use of the code will improve  confidence in blocking practices, allowing  users to understand the  grounds on which their right to information is being restricted.  Improving transparency around censorship is the only way to build trust  between the government and its citizens about the laws and policies  applicable to internet content.&lt;/span&gt;&lt;/p&gt;

        &lt;b&gt;Ever realised that the famous, red hot Naga Mirchi (a special variety of chilli from Nagaland) doesn’t have a Wikipedia page?&lt;/b&gt;

&lt;p style="text-align: justify; "&gt;And that Cannanore Home Furnishings — textile home furnishings from  Kannur — is a brand with geographical indication (GI) registration?  Wiki, which is an open and free repository of knowledge on the Internet,  does not have pages, in English and other recognised Indian languages,  on most GI-tagged Indian products.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Centre for Internet and Society-Access to Knowledge — popular as  CIS-A2K— which is a not-for-profit movement to promote the fundamental  principles of justice, freedom, and economic development, launched an  India Edit-a-thon for seven days from January 25 to generate Wikimedia  pages in English and Indian languages on Indian products recognised by  the GI Registry of India.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“Kerala alone boasts 23 products, mostly agricultural, with the GI tag.  But Malayalam Wiki doesn’t have information on all of them. Besides the  Aranmula Kannadi, none of the other GI-tagged products from Kerala have  Wiki pages in English. Nationally, there are about 213 GI-tagged  products and we know nothing of most of them. There isn’t a single  article on many of them even in English. It’s in this context that the  Edit-a-thon becomes extremely relevant. It’s being held to celebrate the  Republic Day,” says Wiki activist Manoj Karingamadathil.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;13 pages already&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The campaign, launched on Monday, has evoked enthusiastic response from Wiki activists who have begun to create pages on most of these products. At the time of going to press, 13 GI-tagged Kerala products have got Wiki pages and editors are at work to generate content for these products in English.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Apart from existing Wiki editors, freshers may also be part of the campaign. “All they have to do is to create a Wiki account before sending in researched content,” points out Mr. Manoj. The campaign will be on till January 31.&lt;/p&gt;

        &lt;b&gt;On 15 January, Wikipedia, the free online encyclopaedia celebrated its 15th birthday, meeting this milestone with 36 million articles in more than 290 languages (the English-language Wikipedia alone has crossed the 5-million article mark). But here I want to address some major questions that we need to ask as Indians. &lt;/b&gt;

&lt;p style="text-align: justify; "&gt;First, what is the state of Indian-language Wikipedia projects? What does India have to take from and give to Wikipedia?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;With the growth of free and open source software in India, &lt;a href="http://www.gndec.ac.in/%7Elibrarian/sveri/dbit2306009.pdf" target="_hplink"&gt;people are equipped with more freedom than ever.&lt;/a&gt; Especially with the recent &lt;a href="https://opensource.com/government/15/6/indian-government-includes-open-source-rfps" target="_hplink"&gt;federal policy-level changes&lt;/a&gt;, the nation is enjoying better collaboration with people of different cultures speaking different languages.&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;According to UNESCO, 197 of the total of 1652 Indian languages are dying despite having a long literary and linguistic heritage.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;However, there is a huge gap in the access to knowledge on the internet domain. Of a population of about 1.26 billion only about 15-18% people are connected online, largely from mobile devices. A tiny fraction of this population comprises the technical community. It would be useful to have a metric on the percentage of this community's contribution to grow the languages of this country and its cultural heritage.&lt;/p&gt;
&lt;h3&gt;Wikipedia as a family&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Wikipedia is not just an encyclopaedia. It is also a "family" of several other Open Knowledge members. Wikipedia itself is available in over 290 languages, but it also has other multilingual sister projects such as Wikisource (an online library of many public domain and other important texts), Wikimedia Commons (the world's largest repository of media files and documents), Wikibooks (a free library of educational textbooks), Wikivoyage (a free and open travel guide) and Wiktionary (a database of various languages).&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;These projects don't just house millions of images, videos, documents  and texts, but allow anyone to contribute their knowledge to this ever  deepening pool of information. Four Indian languages made an early entry  to the Wiki-world back in 2002 -- &lt;a href="http://as.wikipedia.org/" target="_hplink"&gt;Assamese&lt;/a&gt;, &lt;a href="http://ml.wikipedia.org/" target="_hplink"&gt;Malayalam&lt;/a&gt;, &lt;a href="http://or.wikipedia.org/" target="_hplink"&gt;Odia&lt;/a&gt; and &lt;a href="http://pa.wikipedia.org/" target="_hplink"&gt;Punjabi&lt;/a&gt;.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;img src="https://cis-india.org/home-images/UNESCO.png" alt="UNESCO" class="image-inline" title="UNESCO" /&gt;&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Language neutrality&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;According to UNESCO, 197 of the total of 1652 Indian languages are dying despite having a long literary and linguistic heritage. It's quite shocking. In a blog post on content localisation, social entrepreneur Rajesh Ranjan asks if free and open source software can help save these dying languages. In the context of Wikipedia, there are already 23 South Asian-language projects. Out of these 20 are languages listed in the 8th schedule of the Constitution of India. Many might not have noticed that the "en" in the URL of Wikipedia that denotes the language code of English could be altered with "or" for Odia Wikipedia or "pa" for Punjabi Wikipedia.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Most Wikipedia projects in Indian language projects are relatively small compared to their counterparts. But the Wikimedia communities are thriving.&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;There are a fairly large number of native speakers waiting out there to access knowledge in their own languages.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;When only parts of government websites are available in Hindi, the Hindi  Wikipedia has crossed 10 million articles already. The Tamil and  Malayalam Wikipedia communities have played a central part in  implementing Wikipedia basics learning in the state-run school syllabus.  Needless to say that these communities have played a significant role  in implementing several free and open source software by pushing for  policy-level change. Many Indian languages are in the pipeline to become  active Wikipedia projects under the scope of the  &lt;a href="https://incubator.wikimedia.org/wiki/Category:Incubator:Test_wikis/code/valid" target="_hplink"&gt;Wikimedia Incubator&lt;/a&gt;.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;a href="http://blog.wikimedia.org/2014/09/08/a-focused-approach-for-maithili-wikipedia/" target="_hplink"&gt;Maithili Wikipedia&lt;/a&gt; and &lt;a href="http://blog.wikimedia.org/2015/07/15/konkani-wikipedia-goes-live/" target="_hplink"&gt;Goan Konkani Wikipedia&lt;/a&gt; are the two Indian-language Wikipedias that have gone live in recent  years. The world has seen how digital activism has brought a new life to  the Hebrew language. There are a fairly large number of native speakers  waiting out there to access knowledge in their own languages. Wikipedia  could be a great tool for digital activism with openness and sharing.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;India &lt;a href="http://indianexpress.com/article/explained/gender-inequality-index-in-south-asia-india-leads-in-poor-condition-of-women/" target="_hplink"&gt;tops South Asia in the gender inequality index&lt;/a&gt; in the entire South Asia. The &lt;a href="http://www.unfpa.org/swp/2009/en/pdf/EN_SOWP09_ICPD.pdf" target="_hplink"&gt;female literacy rate is an alarmingly low 65.46%&lt;/a&gt; as compared to 82.14% for men. This disparity is evident in many other sectors as well as in politics.&lt;/p&gt;
&lt;p class="callout" style="text-align: justify; "&gt;Digital India aims at digital literacy and availability of digital resources/services in Indian languages. This is closely aligned with the Wikimedia movement's goal....&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But gender bias is not just a problem in India. The global free and open  source software (FOSS) community has always been worried about the &lt;a href="https://books.google.co.in/books?id=AJpACwAAQBAJ&amp;amp;pg=PT49&amp;amp;lpg=PT49&amp;amp;dq=gender+bias+in+foss+community&amp;amp;source=bl&amp;amp;ots=HqLdhzKwcD&amp;amp;sig=bewvZdJG3wGtbqWXxSIS9qLIxSM&amp;amp;hl=en&amp;amp;sa=X&amp;amp;ved=0ahUKEwjkwfznvqTKAhVKH44KHZFVBMQQ6AEIJzAB#v=onepage&amp;amp;q=gender%20bias%20in%20foss%20community&amp;amp;f=false" target="_hplink"&gt;low presence of women&lt;/a&gt; contributors -- in the &lt;a href="https://people.cs.umass.edu/%7Ewallach/talks/2011-04-05_JHU.pdf" target="_hplink"&gt;range of 2-5% range.&lt;/a&gt; Wikimedia Foundation's former executive director admitted that  Wikipedia, like many other collaborative and open projects, does not  have a conducive environment for women. But the Wikimedia community and  Wikimedia Foundation are both working on improving this state of  affairs. Indian-language Wikipedia projects are directly impacted by  this global drive, be it the Women's History Month edit-a-thon where  Wikipedia content largely related to women are improved every year or  the &lt;a href="https://meta.wikimedia.org/wiki/Lilavati%27s_Daughters_Edit-a-thon" target="_hplink"&gt;Lilavati's Daughters project &lt;/a&gt;where biographies of Indian women scientists were created and enriched in Wikipedia projects.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Complementing Digital India&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;With a population of over &lt;a href="http://dazeinfo.com/2015/09/05/internet-users-in-india-number-mobile-iamai/" target="_hplink"&gt;354 million&lt;/a&gt; netizens India still has a long way to go in  &lt;a href="http://tdil.mit.gov.in/wsi/papers/Issues_&amp;amp;_Challenges_for_Enabling_Mobile_web_in_Indian_Languages.pdf" target="_hplink"&gt;increasing Indian language content on the web&lt;/a&gt;. The Government of India's new campaign &lt;a href="http://www.digitalindia.gov.in/content/vision-and-vision-areas" target="_hplink"&gt;Digital India&lt;/a&gt; aims at &lt;a href="http://www.cmai.asia/digitalindia/" target="_hplink"&gt;digital literacy and availability of digital resources/services in Indian languages&lt;/a&gt;.  This is closely aligned with the Wikimedia movement's goal to provide  free access to the sum of all human knowledge. In addition to Wikipedia,  many other open educational resources and free knowledge projects that  are not already a part of the Digital India campaign signal the need for  the federal-run campaign to be more collaborative and open.  Community-government collaborations like the &lt;a href="https://blog.creativecommons.org/2013/08/14/india-launches-national-repository-of-open-educational-resources/" target="_hplink"&gt;NROER project&lt;/a&gt; to make NCERT books under Creative Commons licenses and &lt;a href="https://www.itschool.gov.in/glance.php" target="_hplink"&gt;IT@School project&lt;/a&gt; in the state of Kerala to provide education using free and open tools  have gained massive traction and helped more Indian language content  come online.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;"It was a very lively consultation, the hall was full. We will take all these into account and hope that by the end of the month, we should be able to come out with our position," Trai chairman Ram Sewak Sharma said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;img src="https://cis-india.org/home-images/Companies.png" alt="Companies" class="image-inline" title="Companies" /&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He, however, refused to link this consultation paper to the broader topic of net neutrality . "Net neutrality is a different subject. First we will decide differential pricing, then we will look at other issues. I cannot say at this time what Trai will do on the larger issue of net neutrality , but we will certainly take a call," Sharma said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The open house saw a near packed house, with representatives from Trai, several telecom companies, civil society organisations, industry bodies, and individuals, but the debate did not turn out to be as explosive as the acrimonious lead-up to it.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Facebook India's policy head Ankhi Das, whose presence was hugely anticipated after a recent round of high octave communication between Trai and Facebook was made public, did not turn up.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;A representative of Facebook, whose zero-rated programme called Free Basics has been at the cent re of the controversy surrounding the differential pricing paper, said: "As a company we have commented. With Free Basics we hope to bring people online in a non-discriminatory manner... We hope Trai will encourage Free Basics.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"Telcos  including  Bharti AirtelBSE -0.37 %,  Idea CellularBSE 0.05 %,   Reliance CommunicationsBSE -1.58 %, Sistema Shyam, Tata Communications,   VideoconBSE -0.54 % Telecom, and Vodafone made a case for allowing  differential pricing, and most cited extending the practice from voice  to data services.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"Differential pricing should be incorporated as were done in voice telephony. Data should be encouraged while the content part can be taken up in another consultation paper," a Vodafone representative said.&lt;br /&gt;&lt;br /&gt;The volunteer-led savetheinternet.in coalition said: "Internet is not a marketplace. Though telcos advocate differential pricing in the name of different customer classes, but when they charge for third party content, it becomes a problem."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Civil society organisations also made detailed submissions, explaining their positions. While most, including industry body Internet and Mobile Association of India, said they were against differential pricing, some took a slightly cautious view. "What hasn't been discussed is that there is already differential pricing and this is undocumented," said a representative of Centre for Internet and Society. "Free Basics isn't following certain protocol standards, and this is a concern. We don't have enough data on internet usage, costs, user experience, to take a decision now," he added.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;A  representative of  Tata CommunicationsBSE 0.58 % said "sponsored data  services" exist around the world and argued citing an example that  providing free voice service does not confer competitive advantage.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"If there are two pizza vendors: one with a toll-free service for taking orders and the other where you pay money to order without a toll-free service. The uptake in the pizza depends on the quality and the price of the pizzas. It is not because it is a toll free call," he said.&lt;br /&gt;&lt;br /&gt;This comparison drew laughter in the open house, and became the butt of jokes on Twitter from internet freedom advocates. "Btw, I think a new analogy from the telco guys today, comparing the internet with pizza. How creative," tweeted Nikhil Pahwa, who under the banner of savetheinternet.in has been campaigning for net neutrality.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;IAMAI  president Subho Ray's candid  commentary on submissions, calling some  of them "badly done homework", did not go down well with some members of  the audience.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Individual entrepreneurs made a case for not having differential pricing, as that would mean the telcos would get to decide the access for their business. Some people suggested alternatives. Digital Empowerment Foundation founder Osama Manzar said unlicensed spectrum or Wi-Fi could be used to provide access in the rural areas.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Trai launched the differential pricing consultation paper on December 9, which was followed by Facebook starting a mass campaign, asking its users to support Free Basics, urging them to email Trai in support of "digital equality" and supporting Free Basics.&lt;/p&gt;

    <title>Transparency in Surveillance</title>

        &lt;b&gt;Transparency is an essential need for any democracy to function effectively. It may not be the only requirement for the effective functioning of a democracy, but it is one of the most important principles which need to be adhered to in a democratic state.&lt;/b&gt;
        &lt;h2 style="text-align: justify; "&gt;Introduction&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;A democracy involves the state machinery being 	accountable to the citizens that it is supposed to serve, and for the citizens to be able to hold their state machinery accountable, they need accurate and 	adequate information regarding the activities of those that seek to govern them. However, in modern democracies it is often seen that those in governance 	often try to circumvent legal requirements of transparency and only pay lip service to this principle, while keeping their own functioning as opaque as 	possible.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;This tendency to not give adequate information is very evident in the departments of the government which are concerned with surveillance, and merit can be 	found in the argument that all of the government's clandestine surveillance activities cannot be transparent otherwise they will cease to be "clandestine" 	and hence will be rendered ineffective. However, this argument is often misused as a shield by the government agencies to block the disclosure of all types 	of information about their activities, some of which may be essential to determine whether the current surveillance regime is working in an effective, 	ethical, and legal manner or not. It is this exploitation of the argument, which is often couched in the language of or coupled with concerns of national 	security, that this paper seeks to address while voicing the need for greater transparency in surveillance activities and structures.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In the first section the paper examines the need for transparency, and specifically deals with the requirement for transparency in surveillance. In the 	next part, the paper discusses the regulations governing telecom surveillance in India. The final part of the paper discusses possible steps that may be 	taken by the government in order to increase transparency in telecom surveillance while keeping in mind that the disclosure of such information should not 	make future surveillance ineffective.&lt;/p&gt;
&lt;h2 style="text-align: justify; "&gt;Need for Transparency&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;In today's age where technology is all pervasive, the term "surveillance" has developed slightly sinister overtones, especially in the backdrop of the 	Edward Snowden fiasco. Indeed, there have been several independent scandals involving mass surveillance of people in general as well as illegal 	surveillance of specific individuals. The fear that the term surveillance now invokes, especially amongst those social and political activists who seek to 	challenge the status quo, is in part due to the secrecy surrounding the entire surveillance regime. Leaving aside what surveillance is carried out, upon 	whom, and when - the state actors are seldom willing and open to talk about how surveillance is carried out, how decisions regarding who and how to target, 	are reached, how agency budgets are allocated and spent, how effective surveillance actions were, etc. While there may be justified security based 	arguments to not disclose the full extent of the state's surveillance activities, however this cloak of secrecy may be used illegally and in an 	unauthorized manner to achieve ends more harmful to citizen rights than the maintenance of security and order in the society.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Surveillance and interception/collection of communications data can take place under different legal processes in different countries, ranging from 	court-ordered requests of specified data from telecommunications companies to broad executive requests sent under regimes or regulatory frameworks 	requiring the disclosure of information by telecom companies on a pro-active basis. However, it is an open secret that data collection often takes place 	without due process or under non-legal circumstances.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is widely believed that transparency is a critical step towards the creation of mechanisms for increased accountability through which law enforcement 	and government agencies access communications data. It is the first step in the process of starting discussions and an informed public debate regarding how 	the state undertakes activities of surveillance, monitoring and interception of communications and data. Since 2010, a large number of ICT companies have 	begun to publish transparency reports on the extent that governments request their user data as well as requirements to remove content. However, 	governments themselves have not been very forthcoming in providing such detailed information on surveillance programs which is necessary for an informed 	debate on this issue.&lt;a href="#_ftn1" name="_ftnref1"&gt;[1]&lt;/a&gt; Although some countries currently report limited information on their surveillance 	activities, e.g. the U.S. Department of Justice publishes an annual Wiretap Report (U.S. Courts, 2013a), and the United Kingdom publishes the Interception 	of Communications Commissioner Annual Report (May, 2013), which themselves do not present a complete picture, however even such limited measures are 	unheard of in a country such as India.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is obvious that Governments can provide a greater level of transparency regarding the limits in place on the freedom of expression and privacy than 	transparency reports by individual companies. Company transparency reports can only illuminate the extent to which any one company receives requests and 	how that company responds to them. By contrast, government transparency reports can provide a much greater perspective on laws that can potentially restrict the freedom of expression or impact privacy by illustrating the full extent to which requests are made across the ICT industry.	&lt;a href="#_ftn2" name="_ftnref2"&gt;[2]&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In India, the courts and the laws have traditionally recognized the need for transparency and derive it from the fundamental right to freedom of speech and 	expression guaranteed in our Constitution. This need coupled with a sustained campaign by various organizations finally fructified into the passage of the 	Right to Information Act, 2005, (RTI Act) which amongst other things also places an obligation on the sate to place its documents and records online so 	that the same may be freely available to the public. In light of this law guaranteeing the right to information, the citizens of India have the fundamental 	right to know what the Government is doing in their name. The free flow of information and ideas informs political growth and the freedom of speech and 	expression is the lifeblood of a healthy democracy, it acts as a safety valve. People are more ready to accept the decisions that go against them if they 	can in principle seem to influence them. The Supreme Court of India is of the view that the imparting of information about the working of the government on 	the one hand and its decision affecting the domestic and international trade and other activities on the other is necessary, and has imposed an obligation 	upon the authorities to disclose information.&lt;a href="#_ftn3" name="_ftnref3"&gt;[3]&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Supreme Court, in &lt;i&gt;Namit Sharma&lt;/i&gt; v. &lt;i&gt;Union of India&lt;/i&gt;,&lt;a href="#_ftn4" name="_ftnref4"&gt;[4]&lt;/a&gt; while discussing the importance of 	transparency and the right to information has held:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"The Right to Information was harnessed as a tool for promoting development; strengthening the democratic governance and effective delivery of 	socio-economic services. 	&lt;i&gt; Acquisition of information and knowledge and its application have intense and pervasive impact on the process of taking informed decision, resulting in 		overall productivity gains &lt;/i&gt; .&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;……..&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Government procedures and regulations shrouded in the veil of secrecy do not allow the litigants to know how their cases are being handled. They shy away 	from questioning the officers handling their cases because of the latters snobbish attitude. Right to information should be guaranteed and needs to be given real substance. In this regard, the Government must assume a major responsibility and mobilize skills to ensure flow of information to citizens.	&lt;i&gt;The traditional insistence on secrecy should be discarded.&lt;/i&gt;"&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Although these statements were made in the context of the RTI Act the principle which they try to illustrate can be understood as equally applicable to the 	field of state sponsored surveillance. Though Indian intelligence agencies are exempt from the RTI Act, it can be used to provide limited insight into the 	scope of governmental surveillance. This was demonstrated by the Software Freedom Law Centre, who discovered via RTI requests that approximately 7,500 - 	9,000 interception orders are sent on a monthly basis.&lt;a href="#_ftn5" name="_ftnref5"&gt;[5]&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While it is true that transparency alone will not be able to eliminate the barriers to freedom of expression or harm to privacy resulting from overly broad 	surveillance,, transparency provides a window into the scope of current practices and additional measures are needed such as oversight and mechanisms for 	redress in cases of unlawful surveillance. Transparency offers a necessary first step, a foundation on which to examine current practices and contribute to 	a debate on human security and freedom.&lt;a href="#_ftn6" name="_ftnref6"&gt;[6]&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is no secret that the current framework of surveillance in India is rife with malpractices of mass surveillance and instances of illegal surveillance. 	There have been a number of instances of illegal and/or unathorised surveillance in the past, the most scandalous and thus most well known is the incident 	where a woman IAS officer was placed under surveillance at the behest of Mr. Amit Shah who is currently the president of the ruling party in India 	purportedly on the instructions of the current prime minister Mr. Narendra Modi.&lt;a href="#_ftn7" name="_ftnref7"&gt;[7]&lt;/a&gt; There are also a number 	of instances of private individuals indulging in illegal interception and surveillance; in the year 2005, it was reported that Anurag Singh, a private 	detective, along with some associates, intercepted the telephonic conversations of former Samajwadi Party leader Amar Singh. They allegedly contacted 	political leaders and media houses for selling the tapped telephonic conversation records. The interception was allegedly carried out by stealing the genuine government letters and forging and fabricating them to obtain permission to tap Amar Singh's telephonic conversations.	&lt;a href="#_ftn8" name="_ftnref8"&gt;[8]&lt;/a&gt; The same individual was also implicated for tapping the telephone of the current finance minister Mr. 	Arun Jaitely.&lt;a href="#_ftn9" name="_ftnref9"&gt;[9]&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is therefore obvious that the status quo with regard to the surveillance mechanism in India needs to change, but this change has to be brought about in 	a manner so as to make state surveillance more accountable without compromising its effectiveness and addressing legitimate security concerns. Such changes 	cannot be brought about without an informed debate involving all stakeholders and actors associated with surveillance, however the basic minimum 	requirement for an "informed" debate is accurate and sufficient information about the subject matter of the debate. This information is severely lacking in 	the public domain when it comes to state surveillance activities - with most data points about state surveillance coming from news items or leaked 	information. Unless the state becomes more transparent and gives information about its surveillance activities and processes, an informed debate to 	challenge and strengthen the status quo for the betterment of all parties cannot be started.&lt;/p&gt;
&lt;h2 style="text-align: justify; "&gt;Current State of Affairs&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;Surveillance laws in India are extremely varied and have been in existence since the colonial times, remnants of which are still being utilized by the 	various State Police forces. However in this age of technology the most important tools for surveillance exist in the digital space and it is for this 	reason that this paper shall focus on an analysis of surveillance through interception of telecommunications traffic, whether by tracking voice calls or 	data. The interception of telecommunications actually takes place under two different statutes, the Telegraph Act, 1885 (which deals with interception of 	calls) as well as the Information Technology Act, 2000 (which deals with interception of data).&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Currently, the telecom surveillance is done as per the procedure prescribed in the Rules under the relevant sections of the two statutes mentioned above,	&lt;i&gt;viz. &lt;/i&gt;Rule 419A of the Telegraph Rules, 1951 for surveillance under the Telegraph Act, 1885 and the Information Technology (Procedure and 	Safeguards for Interception, Monitoring and Decryption of Information) Rules, 2009 for surveillance under the Information Technology Act, 2000. These Rules put in place various checks and balances and try to ensure that there is a paper trail for every interception request.	&lt;a href="#_ftn10" name="_ftnref10"&gt;[10]&lt;/a&gt; The assumption is that the generation of a paper trail would reduce the number of unauthorized 	interception orders thus ensuring that the powers of interception are not misused. However, even though these checks and balances exist on paper as 	provided in the laws, there is not enough information in the public domain regarding the entire mechanism of interception for anyone to make a judgment on 	whether the system is working or not.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;As mentioned earlier, currently the only sources of information on interception that are available in the public domain are through news reports and a 	handful of RTI requests which have been filed by various activists.&lt;a href="#_ftn11" name="_ftnref11"&gt;[11]&lt;/a&gt; The only other institutionalized 	source of information on surveillance in India is the various transparency reports brought out by companies such as Google, Yahoo, Facebook, etc.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Indeed, Google was the first major corporation to publish a transparency report in 2010 and has been updating its report ever since. The latest data that 	is available for Google is for the period between January, 2015 to June, 2015 and in that period Google and Youtube together received 3,087 requests for 	data which asked for information on 4,829 user accounts from the Indian Government. Out of these requests Google only supplied information for 44% of the 	requests.&lt;a href="#_ftn12" name="_ftnref12"&gt;[12]&lt;/a&gt; Although Google claims that they "review each request to make sure that it complies with both 	the spirit and the letter of the law, and we may refuse to produce information or try to narrow the request in some cases", it is not clear why Google 	rejected 56% of the requests. It may also be noted that the number of requests for information that Google received from India were the fifth highest 	amongst all the other countries on which information was given in the Transparency Report, after USA, Germany, France and the U.K.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Facebook's transparency report for the period between January, 2015 to June, 2015 reveals that Facebook received 5,115 requests from the Indian Government 	for 6,268 user accounts, out of which Facebook produced data in 45.32% of the cases.&lt;a href="#_ftn13" name="_ftnref13"&gt;[13]&lt;/a&gt; Facebook's 	transparency report claims that they respond to requests relating to criminal cases and "Each and every request we receive is checked for legal sufficiency 	and we reject or require greater specificity on requests that are overly broad or vague." However, even in Facebook's transparency report it is unclear why 	55.68% of the requests were rejected.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Yahoo transparency report also gives data from the period between January 1, 2015 to June 30, 2015 and reveals that Yahoo received 831 requests for 	data, which related to 1,184 user accounts from the Indian Government. The Yahoo report is a little more detailed and also reveals that 360 of the 831 	requests were rejected by Yahoo, however no details are given as to why the requests were rejected. The report also specifies that in 63 cases, no data was found by Yahoo, in 249 cases only non content data&lt;a href="#_ftn14" name="_ftnref14"&gt;[14]&lt;/a&gt; was disclosed while in 159 cases content	&lt;a href="#_ftn15" name="_ftnref15"&gt;[15]&lt;/a&gt; was disclosed. The Yahoo report also claims that "We carefully scrutinize each request to make sure 	that it complies with the law, and we push back on those requests that don't satisfy our rigorous standards."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;While the Vodafone Transparency Report gives information regarding government requests for data in other jurisdictions,	&lt;a href="#_ftn16" name="_ftnref16"&gt;[16]&lt;/a&gt; it does not give any information on government requests in India. This is because Vodafone interprets 	the provisions contained in Rule 25(4) of the IT (Procedure and Safeguards for Interception, Monitoring and Decryption of Information) Rules, 2009 	(Interception Rules) and Rule 11 of the IT (Procedure and Safeguards for Monitoring and Collecting Traffic Data or Information) Rules, 2009 as well as Rule 	419A(19) of the Indian Telegraph Rules, 1954 which require service providers to maintain confidentiality/secrecy in matters relating to interception, as 	being a legal prohibition on Vodafone to reveal such information.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Apart from the four major companies discussed above, there are a large number of private corporations which have published transparency reports in order to 	acquire a sense of trustworthiness amongst their customers. Infact, the Ranking Digital Rights Project has been involved in ranking some of the biggest 	companies in the world on their commitment to accountability and has brought out the Ranking Digital Rights 2015 Corporate Accountability Index that has 	analysed a representative group of 16 companies "that collectively hold the power to shape the digital lives of billions of people across the globe".&lt;/p&gt;
&lt;h2 style="text-align: justify; "&gt;Suggestions on Transparency&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;It is clear from the discussions above, as well as a general overview of various news reports on the subject, that telecom surveillance in India is 	shrouded in secrecy and it appears that a large amount of illegal and unauthorized surveillance is taking place behind the protection of this veil of 	secrecy. If the status quo continues, then it is unlikely that any meaningful reforms would take place to bring about greater accountability in the area of 	telecom surveillance. It is imperative, for any sort of changes towards greater accountability to take place, that we have enough information about what 	exactly is happening and for that we need greater transparency since transparency is the first step towards greater accountability.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Transparency Reports&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;In very simplistic terms transparency, in anything, can best be achieved by providing as much information about that thing as possible so that there are no 	secrets left. However, it would be naïve to say that all information about interception activities can be made public on the altar of the principle of 	transparency, but that does not mean that there should be no information at all on interception. One of the internationally accepted methods of bringing 	about transparency in interception mechanisms, which is increasingly being adopted by both the private sector as well as governments, is to publish 	Transparency Reports giving various details of interception while keeping security concerns in mind. The two types of transparency reports that we require 	in India and what that would entail is briefly discussed below:&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;i&gt;By the Government&lt;/i&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The problem with India's current regime for interception is that the entire mechanism appears more or less adequate on paper with enough checks and 	balances involved in it to prevent misuse of the allotted powers. However, because the entire process is veiled in secrecy, nobody knows exactly how good 	or how rotten the system has become and whether it is working to achieve its intended purposes. It is clear that the current system of interception and 	surveillance being followed by the government has some flaws, as can be gathered from the frequent news articles which talk about incidents of illegal 	surveillance. However, without any other official or more reliable sources of information regarding surveillance activities these anecdotal pieces of 	evidence are all we have to shape the debate regarding surveillance in India. It is only logical then that the debate around surveillance, which is 	informed by such sketchy and unreliable news reports will automatically be biased against the current mechanism since the newspapers would also only be 	interested in reporting the scandalous and the extraordinary incidents. For example, some argue that the government undertakes mass surveillance, while 	others argue that India only carries out targeted surveillance, but there is not enough information publicly available for a third party to support or 	argue against either claim. It is therefore necessary and highly recommended that the government start releasing a transparency report such as the one's 	brought out by the United States and the UK as mentioned above.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There is no need for a separate department or authority just to make the transparency report and this task could probably be performed in-house by any 	department, but considering the sector involved, it would perhaps be best if the Department of Telecommunications is given the responsibility to bring out 	a transparency report. These transparency reports should contain certain minimum amount of data for them to be an effective tool in informing the public 	discourse and debate regarding surveillance and interception. The report needs to strike a balance between providing enough information so that an informed 	analysis can be made of the effectiveness of the surveillance regime without providing so much information so as to make the surveillance activities 	ineffective. Below is a list of suggestions as to what kind of data/information such reports should contain:&lt;/p&gt;
&lt;ul style="text-align: justify; "&gt;
&lt;li&gt;Reports should contain data regarding the number of interception orders that have been passed. This statistic would be extremely useful in 	determining how elaborate and how frequently the state indulges in interception activities. This information would be easily available since all 	interception orders have to be sent to the Review Committee set up under Rule 419A of the Telegraph Rules, 1954.&lt;/li&gt;
&lt;li&gt;The Report should contain information on the procedural aspects of surveillance including the delegation of powers to different authorities and 	individuals, information on new surveillance schemes, etc. This information would also be available with the Ministry of Home Affairs since it is a 	Secretary or Joint Secretary level officer in the said Ministry which is supposed to authorize every order for interception.&lt;/li&gt;
&lt;li&gt;The report should contain an aggregated list of reasons given by the authorities for ordering interception. This information would reveal whether 	the authorities are actually ensuring legal justification before issuing interception or are they just paying lip service to the rules to ensure a proper 	paper trail. Since every order of interception has to be in writing, the main reasons for interception can easily be gleaned from a perusal of the orders.&lt;/li&gt;
&lt;li&gt;It should also reveal the percentage of cases where interception has actually found evidence of culpability or been successful in prevention of 	criminal activities. This one statistic would itself give a very good review of the effectiveness of the interception regime. Granted that this information 	may not be very easily obtainable, but it can be obtained with proper coordination with the police and other law enforcement agencies.&lt;/li&gt;
&lt;li&gt;The report should also reveal the percentage of order that have been struck down by the Review Committee as not following the process envisaged 	under the various Rules. This would give a sense of how often the Rules are being flouted while issuing interception orders. This information can easily be 	obtained from the papers and minutes of the meetings of the Review Committee.&lt;/li&gt;
&lt;li&gt;The report should also state the number of times the Review Committee has met in the period being reported upon. The Review Committee is an 	important check on the misuse of powers by the authorities and therefore it is important that the Review Committee carries out its activities in a diligent 	manner.&lt;/li&gt;
&lt;/ul&gt;
&lt;p style="text-align: justify; "&gt;It may be noted here that some provisions of the Telegraph Rules, 1954 especially sub-Rules 17 and 18 of Rule 419A as well as Rules 22, 23(1) and 25 of the 	Information Technology (Procedure and Safeguards for Monitoring and Collecting Traffic Data or Information) Rules, 2009 may need to be amended so as to 	make them compliant with the reporting mechanism proposed above.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;i&gt;By the Private Sector&lt;/i&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;We have already discussed above the transparency reports published by certain private companies. Suffice it to say that reports from private companies 	should give as much of the information discussed under government reports as possible and/or applicable, since they may not have a large amount of the 	information that is sought to be published in the government reports such as whether the interception was successful, the reasons for interception, etc. It 	is important to have ISPs provide such transparency reports as this will provide two different data points for information on interception and the very 	existence of these private reports may act as a check to ensure the veracity of the government transparency reports.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;As in the case of government reports, for the transparency reports of the private sector to be effective, certain provisions of the Telegraph Rules, 1954 	and the Information Technology (Procedure and Safeguards for Monitoring and Collecting Traffic Data or Information) Rules, 2009, viz. sub-Rules 14, 15 and 	19 of Rule 419A of the Telegraph Rules, 1954 and Rules 20, 21, 23(1) and 25 of the Information Technology (Procedure and Safeguards for Monitoring and 	Collecting Traffic Data or Information) Rules, 2009.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Overhaul of the Review Committee&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The Review Committee which acts as a check on the misuse of powers by the competent authorities is a very important cog in the entire process. However, it 	is staffed entirely by the executive and does not have any members of any other background. Whilst it is probably impractical to have civilian members in 	the Review Committee which has access to potentially sensitive information, it is extremely essential that the Committee has wider representation from 	other sectors specially the judiciary. One or two members from the judiciary on the Review Committee would provide a greater check on the workings of the 	Committee as this would bring in representation from the judicial arm of the State so that the Review Committee does not remain a body manned purely by the 	executive branch. This could go some ways to ensure that the Committee does not just "rubber stamp" the orders of interception issued by the various 	competent authorities.&lt;/p&gt;
&lt;h2 style="text-align: justify; "&gt;Conclusion&lt;/h2&gt;
&lt;p style="text-align: justify; "&gt;It is not in dispute that there is a need for greater transparency in the government's surveillance activities in order to address the problems associated 	with illegal and unauthorised interceptions. This paper is not making the case that greater transparency in and by itself will be able to solve the 	problems that may be associated with the government's currency interception and surveillance regime, however it is not possible to address any problem 	unless we know the real extent of it. It is essential for an informed debate and discussion that the people participating in the discussion are "informed", 	i.e. they should have accurate and adequate information regarding the issues which are being discussed. The current state of the debate on interception is 	rife with individuals using illustrative and anecdotal evidence which, in the absence of any other evidence, they assume to be the norm.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;A more transparent and forthcoming state machinery which regularly keeps its citizens abreast of the state of its surveillance regime would be likely to 	get better suggestions and perhaps less criticisms if it does come out that the checks and balances imposed in the regulations are actually making a 	difference to check unauthorized interceptions, and if not, then it is the right of the citizens to know about this and ask for reforms.&lt;/p&gt;

        &lt;b&gt;In Sagara, Karnataka, a Kannada Wikipedia edit-a-thon is being planned to be organised during January 26-27.&lt;/b&gt;
        
&lt;p&gt;Kannada Wikipedia has turned 13 this year. Started in June 2003, the 
free Kannada-language online encyclopedia is one of the major resources 
in the language on the Internet. With over 19700 and even with many 
broader topics like art, literature, politics, science and culture 
covered in Kannada Wikipedia, there is significantly low content about 
Mechanical Engineering. Mechanical Engineering enthusiasts of the city 
are coming together to bridge this gap by creating and enhancing content
 in Kannada on the internet. Out of the three days, the whole day of the
 25th is dedicated for clicking pictures of historical places of the 
city which will additionally contribute to articles related to the city.
 The event is being organised by the Kannada Wikimedia community that 
voluntarily contributes to grow Kannada Wikipedia and several other 
Kannada Wikimedia projects, and the Centre for Internet and Society's Access to Knowledge programme. The edit-a-thon will
 include demonstration and practice sessions of input in Kannada script,
 basics of Wikipedia editing and its policies and guidelines, searching 
for references from various journals and notable books, and translation
