    <title>CIS's Comments on the Draft Geospatial Information Regulation Bill, 2016</title>

        &lt;b&gt;The Centre for Internet and Society is alarmed by the Draft Geospatial Information Regulation Bill, 2016, and has recommended that the proposed law be withdrawn in its entirety.  It offered the following detailed comments as its submission.&lt;/b&gt;
        &lt;h1&gt;Comments on the Draft Geospatial Information Regulation Bill, 2016&lt;/h1&gt;
&lt;p&gt;by
&lt;em&gt;the Centre for Internet and Society&lt;/em&gt;&lt;/p&gt;
&lt;h2&gt;1. Preliminary&lt;/h2&gt;
&lt;p&gt;1.1. This submission presents comments and recommendations by the Centre for Internet and Society (“CIS”) on the &lt;a href="http://mha.nic.in/sites/upload_files/mha/files/GeospatialBill_05052016_eve.pdf"&gt;draft Geospatial Information Regulation Bill, 2016&lt;/a&gt; (“the draft bill” / “the proposed bill” / “the bill”).&lt;/p&gt;
&lt;h2&gt;2. Centre for Internet and Society&lt;/h2&gt;
&lt;p&gt;&lt;strong&gt;2.1.&lt;/strong&gt; The Centre for Internet and Society is a non-profit organisation that undertakes interdisciplinary research on internet and digital technologies from the perspectives of policy and academic research. The areas of focus include accessibility for persons with disabilities, access to knowledge, intellectual property rights, openness (including open data, free and open source software, open standards, open access, open educational resources, and open video), internet governance, telecommunication reform, digital privacy, and cyber-security. The academic research at CIS seeks to understand the reconfiguration of social processes and structures through the internet and digital media technologies, and vice versa.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;2.2.&lt;/strong&gt; This submission is consistent with CIS’ commitment to safeguarding the public interest, and particularly the representing the interests of ordinary citizens and consumers. The comments in this submission aim to further the principles of people’s &lt;em&gt;right to information&lt;/em&gt; regarding their own country, &lt;em&gt;openness-by-default&lt;/em&gt; in governmental activities, &lt;em&gt;freedom of speech and expression&lt;/em&gt;, and the various forms of &lt;em&gt;public good&lt;/em&gt; that can emerge from greater availability of &lt;em&gt;open (geospatial) data&lt;/em&gt; created by both public and private agencies, and the &lt;em&gt;innovations&lt;/em&gt; made possible as a result.&lt;/p&gt;
&lt;h2&gt;3. Comments&lt;/h2&gt;
&lt;h3&gt;3.1. General Remarks&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.1.1.&lt;/strong&gt; While CIS welcomes the intentions of the government to prevent use of geospatial information to undermine national security, the proposed bill completely fails to do so, infringes upon Constitutional rights, harms innovation, undermines the national initiatives of Digital India and Startup India, is completely impractical and unworkable, and it will lead to a range of substantial harms if the government actually seeks to enforce it.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.1.2.&lt;/strong&gt; There are already laws in place that prevent the use of geospatial information to undermine national security.  For instance, the &lt;a href="http://www.archive.india.gov.in/allimpfrms/allacts/3314.pdf"&gt;Official Secrets Act, 1923&lt;/a&gt; (“OSA”) already contains provisions — sections 3(2)(a), (b), and (c) — all of which would prevent a person from creating maps that undermine national security and would penalise their doing so. Section 5 of the OSA contains multiple provisions that penalise the possession and communication of maps that undermine “national security.” The penalties under the OSA range from imprisonment of up to 3 years all the way to imprisonment up to 14 years. Given this, there is absolutely no need to create yet another law to deal with maps that undermine “national security.” Indeed, it is the government’s stated policy to reduce the number of laws in India, whereas the proposed bill introduces a redundant new law that adds multiple layers of bureaucracy.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.1.3.&lt;/strong&gt; The &lt;a href="http://surveyofindia.gov.in/files/nmp/National%20Map%20Policy.pdf"&gt;National Mapping Policy, 2005&lt;/a&gt;, already puts in place restrictions on wrongful depictions of India’s international boundaries, and as we explain below in section 3.4 of this document, even the National Mapping Policy is over-broad. Even if the government wishes to provide statutory backing to the policy, it should be a very different law that is far more limited in scope, and restricts itself to criminalising those who misrepresent India’s international boundary with an intention to mislead people into thinking that that is the official boundary of India as recognised by the Survey of India. CIS would support a law of such limited scope and mandate, provided it has an appropriate penalty.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.1.4.&lt;/strong&gt; There would be much utility in a law that creates a duty on the Survey of India to make available, in the form of an open standard, an official electronic version of the maps that it creates, and expressly allows and encourages citizens and startups to reuse such official maps, however the Ministry of Home Affairs would not be the nodal ministry for such a law.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.1.5.&lt;/strong&gt; &lt;strong&gt;We recommend that the proposed law be scrapped in its entirety.&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.1.6.&lt;/strong&gt; We additionally provide an alternative manner of reducing the harms caused by this bill, in our comments below.  By no means should these further comments be seen as a repudiation of our above position, since we do not feel the proposed bill, even with the inclusion of all of our recommendations, would truly further its stated aims.  All our below recommendations would do is to reduce the bill’s harmful, and often unintended, consequences.&lt;/p&gt;
&lt;h3&gt;3.2. Definition of “Geospatial Information” is over-broad, all- encompassing&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.2.1.&lt;/strong&gt; The second part of the definition of “geospatial information” refers to all “graphic or digital data depicting natural or man-made physical features, phenomenon or boundaries of the earth or any information related thereto” that are “referenced to a co-ordinate system and having attributes.” (Section 2(1)(e)) As per the definition, this will include all geo-referenced information, and data, that is produced by everyday users as an integral part of various everyday uses of digital technologies. This will also include geo-referenced tweets and messages, location of public and private vehicles shared in the real-time with agencies tracking their location (from public transport authorities, to insurance agencies, etc.), location data of mobile phones collected and used by telecommunication service providers, location of mobile phones shared by the user with various kinds of service providers (from taxi companies to delivery agencies), etc.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.2.2.&lt;/strong&gt; We recommend that instead of regulating all kinds of geospatial information, and giving rise to a range of possible harms, the draft bill be revised to specifically address “sensitive geospatial information,” defined as geospatial information related to the “Prohibited Places” as defined in the Official Secrets Act 1923 (section 2(8)) which will allow the bill to effectively respond to its key stated concerns of ensuring “security, sovereignty and integrity of India.” Since the National Map Policy defines “Vulnerable Points” and “Vulnerable Areas” (para 3(b)) as the two main types of geospatial units associated with “Prohibited Places”, these terms should also be referred to in the revised version of the draft bill.&lt;/p&gt;
&lt;h3&gt;3.3. Unreasonable regulation of acquiring and end-use of geospatial information&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.3.1.&lt;/strong&gt; Section 3 of the draft bill states that “[s]ave as otherwise provided in this Act, rules or regulations made thereunder, or with the general or special permission of the Security Vetting Authority, no person shall acquire geospatial imagery or data including value addition” and “[e]very person who has already acquired any geospatial imagery or data ... including value addition prior to coming of this Act into effect, shall within one year from the commencement of this Act, make an application alongwith requisite fees to the Security Vetting Authority.” This effectively makes it illegal to acquire and maintain ownership of geospatial information that has not been subjected to security vetting.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.3.2.&lt;/strong&gt; This draft bill doesn’t apply just to geospatial information that may undermine national security but covers all manners of geospatial information and modern geospatial technologies embedded in everyday digital devices and intimately connected to various electronic products and services, from cars to mobile phones, result in the creation and acquiring of various kinds of geo-referenced information, ranging from the geo-referenced photographs to locations shared with friends. Even ordinary users who are unknowingly looking at maps that contain sensitive geospatial information, which are illegal under the Official Secrets Act, are committing an illegal act under the draft bill, because the users temporarily acquires such sensitive geospatial information in her/his digital device, as part of the very act of browsing the map concerned. This clearly cannot be the intention of the bill. Thus we recommend deletion of the word “acquire.”&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.3.3.&lt;/strong&gt; Further, the insertion of the phrase “including value addition” in both Section 3(1) and 3(2) appears to suggest that all users who have created derivative products using geospatial information that includes sensitive data (that is data related to Prohibited Places) may be held liable under this draft bill, even if these users have not themselves collected or created such sensitive geospatial information, which was part of the original geospatial information published by the source map agency. This too cannot be the intention of the bill. Thus, we recommend deletion of the phrase “including value addition.”&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.3.4.&lt;/strong&gt; In the definition of the “Security Vetting of Geospatial Information” itself, it is mentioned that the process will include “screening of the credentials of the end-users and end-use applications, with the sole objective of protecting national security, sovereignty, safety and integrity.” (Section 2(1)(o)) This appears to indicate that all end-users of all electronic and analog services and products using geospatial information will have to be individually vetted before such services and products are used, which would cover a large proportion of the Indian population. This imposes an enormous and impractical burden on the Indian digital economy in particular, and the entire national economy in general, without improving national security. This too cannot be the intention of the draft bill. Thus, we recommend deletion of this phrase, and ensure that end users are not covered by the law.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.3.5.&lt;/strong&gt; Given these specific characteristics of how modern geospatial technologies work, and how they provide a basis for various kinds of everyday use of electronic products and services, we would like to submit that the regulatory focus should be on large-scale and/or commercial dissemination, publication, or distribution of geospatial information, and not on the acts of acquiring, possessing, sharing, and using geospatial information. Further, the regulation in general should be aimed at the party owning the geospatial information in question, and not at the parties involved in its dissemination (say, Internet Service Providers) or in its generation or use (say, end-users).&lt;/p&gt;
&lt;h3&gt;3.4. Removal of journalistic, political, artistic, creative, and speculative depictions of India from the scope of Section 6&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.4.1.&lt;/strong&gt; Section 6 of the draft bill states that “[n]o person shall depict, disseminate, publish or distribute any wrong or false topographic information of India including international boundaries through internet platforms or online services or in any electronic or physical form.” Section 15 imposes a penalty for such wrong depiction of maps of India.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.4.2.&lt;/strong&gt; Depictions of India, which do not purport to accurately represent the international boundaries as recognised by the Indian government should not be penalised.  For instance, a map published in a newspaper article about India’s border disputes that shows the incorrect claims that the Chinese government has made over Indian territory would also be penalised as “wrong or false topographic information of India”, since there is a clear intention to depict the boundary as claimed by China.  Criminalising such journalism cannot be the legitimate intent of such a provision.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.4.3.&lt;/strong&gt; There are numerous instances which have been willfully depicting inaccurate and inauthentic maps of India with international borders for political ends. For instance, there are often depictions of India which show territories within present day Pakistan, Bangladesh, Bhutan, Nepal and Sri Lanka as part of an “Akhand Bharat.” Depictions of this sort should not be penalised. In doing so, would contradict the freedom of expression guaranteed under Article 19(1)(a) without being a reasonable restriction under Article 19(2).&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.4.4.&lt;/strong&gt; Even depictions of India for purposes of speculative fiction would be penalised under this proposed bill unless they depict the official borders. This is clearly undesirable and would not be allowed as a reasonable restriction under Article 19(2).&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;&lt;em&gt;*3.4.5.&lt;/em&gt;&lt;/strong&gt;* Even geography students in schools and colleges who mis-draw the official map of India would be liable to penalties under the draft bill. This plainly, cannot be the intention of the drafters of this bill. The creator of a rough and inaccurate tourist map of an Indian city can also be identified as committing a criminal act under the proposed bill as she would be depicting “… wrong or false topographic information of India …”&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.4.6.&lt;/strong&gt; In brief: Merely depicting, disseminating, publishing or distributing any “wrong or false topographic information of India” should not be penalised. unless a person publishes and widely circulates an incorrect map of India while claiming that that represents the official international boundaries of India, such should not be penalised.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.4.7.&lt;/strong&gt; CIS recommends that the bill should instead state: “No person shall depict, disseminate, publish, or distribute any topographic information purporting to accurately depict the international boundaries of India as recognised by the Survey of India unless he is authorised to do so by the Surveyor General of India; provided that usage by any person of the international boundaries as is electronically and in print made available by the Survey of India shall deemed to be usage that is authorised by the Surveyor General of India.”&lt;/p&gt;
&lt;h3&gt;3.5. Absence of Publicly Available and Openly Reusable Standardised National Boundary of India&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.5.1.&lt;/strong&gt; Given the lack of an reusable versions of maps of India, including of India’s official boundary as recognised by the Survey of India, it becomes impossible for people to accurately depict the boundary of India. We recommend that the bill requires the Survey of India to publish all  “Open Series Maps,”as defined in the National Mapping Policy, 2005, including maps depicting the official international and subnational political and administrative boundaries of India, using open geospatial standards and under an open licence allowing such geospatial data to be used by citizens and all companies.&lt;/p&gt;
&lt;h3&gt;3.6. Remove Requirement for Prior License for Acquire, Dissemination, Publication, or Distribution of Geospatial Information&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.6.1.&lt;/strong&gt; Section 9 of the draft bill refers to “any person who wants to acquire, disseminate, publish, or distribute any geospatial information of India” (emphasis added), which can be interpreted as the need for a prior license before any person decides to acquire (including creation, collection, generation, and buying) geospatial information. This creates at least two problems:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;
&lt;p&gt;modern digital geospatial technologies have enabled everyday digital devices (like smartphones) to instantaneously acquire, disseminate, publish, and distribute geospatial information all the time when the person holding that device is looking at online digital maps, say Google Maps, or sharing location with their friends, online platforms and services and service providers (both local and foreign); and&lt;/p&gt;
&lt;/li&gt;
&lt;li&gt;
&lt;p&gt;the requirement of prior license involves payment of a “requisite fees” to the Security Vetting Authority, which may act as an arbitrary (since the fee might be based upon the volume of geospatial information to be acquired that one may not know fully determine before acquiring) and effective barrier to acquiring, dissemination, publication, or distribution of geospatial information even if it does not violate the concerns of “security, sovereignty, and integrity” in any manner. This requirement also impedes competition in the market, because new entrants to the geospatial industry may not have enough upfront capital to procure licenses.&lt;/p&gt;
&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;&lt;strong&gt;3.6.2.&lt;/strong&gt; Further, the requirement of necessary prior license for acquiring geospatial information does not seem to be a crucial component of the security vetting process, since the geospatial information, once acquired by the agency concerned, is in any case directed to be shared with the Security Vetting Authority for undertaking necessary expunging of sensitive or incorrect information.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.6.3.&lt;/strong&gt; We recommend revision of this section so that no prior license and/or permission is required for collection, acquiring, distribution, and/or use of geospatial information; instead, a framework may be established for monitoring of published geospatial information for purposes of ensuring geospatial information pertaining to “Prohibited Places,” as defined under the Official Secrets Act, is not made available to the general public by any person or entity under Indian jurisdiction, including, for instance, Indian subsidiaries and branches of foreign corporations.. Such a framework must not address the end-user of such geospatial information, but its publishers.&lt;/p&gt;
&lt;h3&gt;3.7. Unenforceable jurisdictional scope&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.7.1.&lt;/strong&gt; Section 5 of the draft bill states “[s]ave as otherwise provided in any international convention, treaty or agreement of which India is signatory or as provided in this Act, rules or regulations made thereunder, or with the general or special permission of the Security Vetting Authority, no person shall, in any manner, make use of, disseminate, publish or distribute any geospatial information of India, outside India, without prior permission from the Security Vetting Authority.”&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.7.2.&lt;/strong&gt; In compliance with this section, domestic and foreign companies and platforms will be required to obtain permission from the Security Vetting Authority of India prior to publishing, distributing etc. geospatial information. Similarly in the preliminary, the draft bill holds in person who commits an offence beyond India under the scope of the bill. The bill is thus proposing extraterritorial applicability of its provisions, yet the extent and method of enforcement of the same on other jurisdictions are kept unclear.&lt;/p&gt;
&lt;h3&gt;3.8. Negative implications for rights of citizens&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.8.1.&lt;/strong&gt; There are a number of sections in the draft bill which have negative implications for the rights of all users and potentially impinge on the constitutional rights of Indian citizens. These include:&lt;/p&gt;
&lt;p&gt;a. Section 18(2) which empowers the Enforcement Authority to conduct a search without a judicial search order;&lt;/p&gt;
&lt;p&gt;b. Section 17(3) which empowers the Enforcement Authority to conduct undefined surveillance and monitoring to enforce the Act;&lt;/p&gt;
&lt;p&gt;c. Chapter (V) which penalises individuals with Rs. 1-100 Crores and/or seven years in prison for an offence under the act;&lt;/p&gt;
&lt;p&gt;d. Section 22 which allows the government to take ownership of a person’s  land if a financial penalty has not been paid;&lt;/p&gt;
&lt;p&gt;e. Section 30(1) which holds, in the case of the offense being committed by a company, every person in charge of and responsible for the conduct of business of the company, guilty and liable.&lt;/p&gt;
&lt;h3&gt;3.9. Overly broad powers and responsibilities of the Apex Committee and Enforcement  Authority, and lack of adequate oversight&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.9.1.&lt;/strong&gt; Section 7(2) states that “[t]he Apex Committee shall do all such acts and deeds that may be necessary or otherwise desirable to achieve the objectives of the Act, including the following functions:...” The wording in this section is broad and open ended, and allows for the responsibilities of the Apex Committee to be expanded without clear oversight of such expansion.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.9.2.&lt;/strong&gt; Similarly, section 17 established an “Enforcement Authority” for the purpose of carrying out surveillance and monitoring for enforcement of the draft bill. The Authority has been given a number of powers including the power of inquiry, the power to adjudicate, and the power to give directions. These powers have direct implications on the rights of individuals, yet the Authority is not subject to oversight or accountability requirements.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.9.3.&lt;/strong&gt; We recommend that the powers and responsibilities of the Apex Committee and Enforcement Authority are narrowly defined in the draft bill itself, limited by the principle of necessity, and subject to independent oversight and accountability requirements.&lt;/p&gt;
&lt;h3&gt;3.10. Remove the Security Vetting Authority’s power of delegation&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.10.1.&lt;/strong&gt; Section 8(3) allows the Security Vetting Authority to delegate to any constituent member of the Authority, other subordinate committee, or officer powers and functions as it may deem necessary except the power to grant a licence. In practice, this will allow security vetting to be done by another institution and risks potential involvement of private agencies and/or quasi-governmental bodies.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.10.2.&lt;/strong&gt; We recommend that the power of delegation should not be granted to the Security Vetting Authority.&lt;/p&gt;
&lt;h3&gt;3.11. Negative implications for innovation and India’s digital economy&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.11.1.&lt;/strong&gt; Section 3 of the draft bill states “[s]ave as otherwise provided in this Act, rules or regulations made thereunder, or with the general or special permission of the Security Vetting Authority, no person shall acquire geospatial imagery or data including value addition of any part of India either through any space or aerial platforms such as satellite, aircrafts, airships, balloons, unmanned aerial vehicles or terrestrial vehicles, or any other means whatsoever”. This effectively ensures that each and every user of geospatial data, products, services, and solutions — since all of these either include or are derivatives of geospatial information — would require prior permission from the Security Vetting Authority. This will substantially affect the existing and emerging digital economy in particular, and the entire economy in general.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.11.2.&lt;/strong&gt; Further, Section 9 of the draft bill mandates that any person submitting an application for geospatial information to be vetted must pay a fee. As the provisions of the bill mandate that users approach the Security Vetting Authority for license to use geospatial information, this will impose an immense burden on all users of digital devices in and outside of India. CIS submits that imposition of this fee for security vetting be removed.&lt;/p&gt;
&lt;h3&gt;3.12. Disproportionate penalty for acquisition of geospatial information&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.12.1.&lt;/strong&gt; Section 12 states that “&lt;em&gt;[p]enalty for illegal acquisition of geospatial information of India.- Whoever acquires any geospatial information of India in contravention of section 3, shall be punished with a fine ranging from Rupees one crore to Rupees one hundred crore and/or imprisonment for a period upto seven years&lt;/em&gt;.” Seven years in prison is disproportionate to the offense of acquiring geospatial information without vetting by the authority concerned. This is particularly true given the broad and all-encompassing definition of “geospatial information” in the draft bill, and the fact that the bill applies to individuals and companies both within and outside of India.&lt;/p&gt;
&lt;h3&gt;3.13. Improper and inconsistent usage of terms in the draft bill&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.13.1.&lt;/strong&gt; Section 4 of the draft bill regulates the visualization, publication, dissemination and distribution of geospatial information of India, while section 5 regulates use, dissemination, publication, and distribution of geospatial information outside of India. The definition of “visualization” remains unclear, and the act is only regulated in section 4. The section 6 of the draft bill uses the term ‘depict’, which is undefined as well. We submit that in this context terms are interchangeable, and the draft bill should either define them expressly to avoid ambiguity in interpretations, or consistently use only one throughout the draft bill.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.13.2.&lt;/strong&gt; Section 11 (3) of the draft bill requires licensees to “[d]isplay the insignia of the clearance of the Security Vetting Authority on the security-vetted geospatial information by appropriate means such as water-marking or licence as relevant, while disseminating or distributing of such geospatial information.” We observe that geospatial information includes graphical representation, location coordinates, inter alia. While the former may be represented visually on an “as is” basis after the completion of the vetting, the latter may be used to perform other complex functions at the “back-end” (i.e., vendor-facing side) in various technologies. Water-marking and/or displaying of insignia would place undue burden on the licensee, depending on the kind of platform, service, or individual.&lt;/p&gt;
&lt;h3&gt;3.14. Lack of reference to technical implementation guidance&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.14.1.&lt;/strong&gt; The regulation, harmonisation, and standardisation of the collection, generation, dissemination etc. of geospatial information is a complex process that goes beyond a process of security vetting and that will require extensive technical implementation guidance from the government. At a minimum this could include quality assurance considerations and standard operating procedures, yet the draft bill makes no reference to the need for technical standards or guidance.&lt;/p&gt;

    <title>Digital native: Control A, Backspace</title>

&lt;p style="text-align: justify; "&gt;I remember the first time I made an edit on Wikipedia — it was almost 10 years ago, and it was a heady feeling, to realise that here is a global encyclopaedia being written, and that I could be a part of it. It felt strange, because I was brought up to believe that authors are special people with specialised knowledge, which can only be validated from special institutions, and that authorship required years of practice and perseverance.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;However, a historic experiment by Nature magazine showed, that despite the average age of the then Wikipedia editor as somewhere in the late teens, articles in Wikipedia were not any more prone to error than in other established, institutionalised fountains of knowledge like the Encyclopaedia Britannica. In fact, not only were the non-specialised editors of Wikipedia spot on with their knowledge outputs, but that because of its iterative nature, errors, once spotted on Wikipedia could be immediately corrected, thus leading to a more robust source of knowledge.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Two key principles helped Wikipedia establish this process of reliable and resilient knowledge systems — neutrality of viewpoint, and evidence-based knowledge. In the largely free and open space of Wikipedia editing, the one thing that remained constant is neutrality. Editors, despite their own biases, locations, contexts, experiences or embodied knowledges, could not introduce their opinions or original research into the Wikipedia articles. This necessarily meant that every truth and knowledge claim made in a Wikipedia article needs to be verified through a source. This source could come from different spaces and different formats, but it serves as objective evidence for the information being provided there. In instances — and there are thousands of them, if not more — where two editors disagreed on how to interpret an event, or how to describe a person or a thing, the edit-war was fuelled not by the I-said-You-said never-ending rhetoric, but by relying on the soundness of research conducted by external sources.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;For some years now, Wikipedia has become the de facto global reference system, which still relies on volunteers and non-specialised editors to contribute to complex, complicated and very specialised domains of human knowledge production. Even when the editors are experts or scholars, their contribution has value and merit, only when it is supported by externally verifiable source that supports their view points.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Wikipedia has become one of the foundational models of the information web, that makes it clear that knowledge can be freely produced, consumed and circulated, and more importantly, it can be negotiated and contested, thereby making our scientific research practices relevant and pertinent beyond the hallowed and often closed halls of the university. Wikipedia became a prime example of how information can be revised, changed, mutated, updated, upcycled, and subjected to deep scrutiny as long as it is informed by an alignment towards neutrality and supported by evidence produced through research.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;I invoke these principles that have fostered one of the most magnificent pieces of collaborative human effort because it directly puts into contrast the revisionist, biased, authoritative and closed practices by which the Indian educational councils seem to be editing textbooks. The removal of the names of historical figures, the rewriting of history to reflect a biased, narrow and unsubstantiated narrative, the erasure of alternative histories and voices of protest and dissent, and the false planting of information which is grounded in the school of “People say” and the university of “I have heard” is an alarming development. Many people unfortunately think of this political revisionism as mimicking the wisdom of the crowds recounting and contestation of information on spaces like Wikipedia.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is important to note that these attempts at revising known facts and of producing religious histories of exclusion and violence are not the digital mode of information upcycling. These revisions are firmly rooted in a political agenda that seeks to sanctify the discriminatory violences of our neo-authoritarian governments. They remain challenged by the scholars in the field who have enough evidence — of archives, of tracts, of data, and of information — that show that this information is false. They are entrenched in the politics of power that insist that this is the only true account of things, excluding public discourse, and performing acts of censorship that discourage all access to scientific learning.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The proponents who want to Make in India, cannot limit their rhetoric only to economic production, but have to extend collaborative and connected making to knowledge and information production. And this entails the unmaking of these authoritarian and fascist attempts at justifying rumours as information, hate speech as free speech, and revisions as conversations.&lt;/p&gt;

    <title>Developing Open Educational Resources in Indian Languages</title>

        &lt;b&gt;The Centre for Indian Languages in Higher Education (CILHE), Tata Institute of Social Sciences (TISS), in collaboration with the Access to Knowledge (CIS-A2K) programme at the Centre for Internet and Society (CIS), has been involved in organising workshops on developing open educational resources (OER) in Indian languages with undergraduate and postgraduate students across various partner institutions. The objective of these workshops is to introduce students to: a) tools of collaborative knowledge production on the Internet, and b) methods for generating new online content in Indian languages.&lt;/b&gt;
        &lt;p id="docs-internal-guid-6a5cf4f0-34dc-8053-8ba7-e604a4aef120" dir="ltr" style="text-align: justify; "&gt;During November 2015 - February 2016, four such workshops have been organised at TISS’ Mumbai and Tuljapur campuses, &lt;a href="http://www.srtt.org/casestudies/Pune_University_Case_Study%20-%202.pdf"&gt;Krantijyoti Savitribai Phule Women's Studies Centre&lt;/a&gt; (KSPWSC), Pune University, and at the &lt;a href="http://www.efluniversity.ac.in/"&gt;English and Foreign Languages University&lt;/a&gt; (EFLU), Hyderabad.&lt;/p&gt;
&lt;p dir="ltr" style="text-align: justify; "&gt;A one and half day workshop was organised at KSPWSC, Pune during January 22-23, 2016. A total of 20 students attended this workshop along with three faculty members from the Centre. This workshop is a part of CILHE's ongoing and sustained engagement with KSPWSC to generate and strengthen content pertaining to women's studies on the &lt;a href="https://mr.wikipedia.org/"&gt;Marathi Wikipedia&lt;/a&gt;.&lt;/p&gt;
&lt;p dir="ltr" style="text-align: justify; "&gt;&lt;strong&gt;Pune&lt;/strong&gt;&lt;br /&gt;On Day 1, after the opening address by Dr. Anagha Tambe from KSPWSC, Sohnee Harshey from CILHE, TISS spoke about the importance of creating open educational resources in Indian languages for social sciences and humanities. She sought responses from participants about the nature of their engagement with their research areas—which languages they used while collecting data, whether they had accessed reading material in languages other than English, and what were their sources of information. All the participants had used languages other than English in their learning process, some had even accessed Indian language Wikipedias, and all of them felt the need for more resources in Indian languages—especially in simpler and more accessible formats. Tanveer Hasan from CIS then spoke about the utility of Wikipedia for knowledge consumers and its immense potential for students to become knowledge producers, especially in the Indian languages.&lt;/p&gt;
&lt;p dir="ltr" style="text-align: justify; "&gt;In order to familiarize the participants with social sciences (specifically women's studies) terminology in Indian languages, an exercise was conducted, wherein they were asked to describe a concept (from a given list) without using the term itself. The idea behind this was to highlight what function a concept performs in a sentence and in the language context, and what assumptions are made while using this concept. This was followed up with another exercise where the participants were encouraged to choose two concepts and explain their denotation and connotation. This was done in order to familiarise them with the web of other concepts in which a concept is located. The concept of ‘labour’ or ‘shram’ (in Marathi) was chosen for discussion.&lt;/p&gt;
&lt;p dir="ltr" style="text-align: justify; "&gt;On Day 2 of the workshop, Abhinav Garule, Programme Associate with A2K-CIS, introduced the participants to the basics of Wikipedia editing through a hands-on activity. They navigated through both the English and Indian language Wikipedias to see how the edit, talk, and view history functions work, what the key characteristics of a good article are, and how one can read more about a certain topic through interwiki and external links and categories. This was interspersed with recalling the exercises done on the previous day and comparing the critical thinking process involved.&lt;/p&gt;
&lt;p dir="ltr" style="text-align: justify; "&gt;Since one of the simpler ways to populate Indian language Wikipedias is through translation of existing content in English, participants were encouraged to try this with an entry of their choice. They were asked to also list difficulties that they faced in the process of translation. At the end of this exercise, a range of ‘problems’ like lack of appropriate terminology for complex concepts, the dangers of oversimplification, differences between languages in terms of the structure of sentences, and lack of references in Indian languages, were highlighted by the participants. While they were still thinking about these problems, another challenge was put forth for them to look at two conflicting or opposing references for a topic (for example, a movie review, or reporting around an event) and come up with a ‘neutral’ write-up about it. Questions of what constitutes a valid reference, issues of plagiarism, personal opinion, codes of civility on Talk pages formed part of this discussion.&lt;/p&gt;
&lt;p dir="ltr" style="text-align: justify; "&gt;Following this, the participants chose one topic (each) on which they wished to create a Wikipedia article in an Indian language. Most of the participants worked on the Marathi Wikipedia. They worked in groups of 3-4 to edit and create a range of articles including ones on patriarchy, colonialism, masculinity, family, and tribes, among others. A total of 12 entries were created in this workshop. Participants also explored Wikimedia Commons, Meta, and Wikisource as allied repositories. The students have now become active as knowledge producers and will join the existing group of editors at KSPWSC in the wiki-sprints to generate new content every month.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Hyderabad: &lt;/strong&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Similar exercises were also conducted during the two-day workshop at EFLU, Hyderabad in February 2016. The participants worked on the Malayalam, Telugu, and Hindi Wikipedias. Articles were written on geographical entities like Tamil Eelam and West Godavari district, on academic figures like M.S.S. Pandian and Maxine Berstein, academic and literary works such as My Name is Red by Orhan Pamuk and Towards a World of Equals by Susie Tharu, among other topics. Since creating an article from scratch also involved deliberation regarding issues of translation, and the limits of concepts and their meanings in the Indian context, it is hoped that these new editors will find it useful for their own research to think critically about the process of generating content on the Indian language Wikipedias.&lt;/p&gt;

    <title>Comments on the RBI's Consultation Paper on Peer to Peer Lending</title>

        &lt;b&gt;The Reserve Bank of India published a Consultation Paper on Peer to Peer Lending on April 28, 2016, and invited comments from the public. CIS submitted the following response, authored by Elonnai Hickok, Pavishka Mittal, Sumandro Chattapadhyay, Vidushi Marda, and Vipul Kharbanda.&lt;/b&gt;
        
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;1. Preliminary&lt;/h2&gt;
&lt;p&gt;&lt;strong&gt;1.1.&lt;/strong&gt; This submission presents comments and recommendations by the Centre for Internet and Society (&lt;strong&gt;“CIS”&lt;/strong&gt;) on the Consultation Paper on Peer to Peer Lending (&lt;strong&gt;“the consultation paper”&lt;/strong&gt;) by the Reserve Bank of India (&lt;strong&gt;“RBI”&lt;/strong&gt;) &lt;strong&gt;[1]&lt;/strong&gt;.&lt;/p&gt;
&lt;h2&gt;2. The Centre for Internet and Society&lt;/h2&gt;
&lt;p&gt;&lt;strong&gt;2.1.&lt;/strong&gt; The Centre for Internet and Society, CIS &lt;strong&gt;[2]&lt;/strong&gt;, is a non-profit organisation that undertakes interdisciplinary research on internet and digital technologies from policy and academic perspectives. The areas of focus include digital accessibility for persons with diverse abilities, access to knowledge, intellectual property rights, openness (including open data, free and open source software, open standards, open access, open educational resources, and open video), internet governance, telecommunication reform, digital privacy, and cyber-security. The academic research at CIS seeks to understand the reconfiguration of social processes and structures through the internet and digital media technologies, and vice versa.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;2.2.&lt;/strong&gt; This submission is consistent with CIS’ commitment to safeguarding general public interest, and the interests and rights of various stakeholders involved. The comments in this submission aim to further the concerns of citizens’ and users’ rights in the context of products, services, and transactions facilitated by digital media technologies, the , the principle that regulation should be defined around functions of the acts concerned, and not the technologies of delivery. Our comments are limited to the clauses that most directly have an impact on these concerns.&lt;/p&gt;
&lt;h2&gt;3. Response&lt;/h2&gt;
&lt;h3&gt;3.1. Whether there is a felt need for regulating peer to peer lending platforms?&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.1.1.&lt;/strong&gt; Peer to peer (&lt;strong&gt;“P2P”&lt;/strong&gt;) lenders are platforms serving as marketplaces for the lenders and the borrowers of funds to connect. Their very business model does not render them as a provider of finance, as they aspire to function as pure intermediaries to enable lending and borrowing.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.1.2.&lt;/strong&gt; The Section 45I.(f)(iii) of the RBI Act, 1935 &lt;strong&gt;[3]&lt;/strong&gt;, provides RBI the authority to classify any financial institution as a non-banking financial company (&lt;strong&gt;“NBFC”&lt;/strong&gt;) “with the previous approval of the Central Government and by notification in the Official Gazette.” Since the P2P lending platforms do not provide any finance themselves, undertake acquisition of financial instruments, deliver financial and/or insurance services, or collect financial resources directly, the only ground for classifying such companies as “financial institutions” &lt;strong&gt;[4]&lt;/strong&gt; appears to be their involvement in “managing, conducting or supervising, as foreman, agent or in any other capacity, of chits or kuries as defined in any law which is for the time being in force in any State, or any business, which is similar thereto” &lt;strong&gt;[5]&lt;/strong&gt;. P2P lending platforms can be considered to be brokers and thus there are other aspects that merit scrutiny such as antitrust issues, obligations of either party, company activities and the transactional system involved, as we will discuss in this document.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.1.3.&lt;/strong&gt; The consultation paper itself states that the balance sheet of the platform cannot indicate any borrowing / lending activity, which entails that the platform cannot itself provide finance or receive any funds for the provision of loans to others. Platforms are not allowed to determine the interest rates as they are not a party to the transaction. Neither would they be liable in cases of default by the borrower. These rules, standard for P2P platforms in other jurisdictions as well, confirm the assumption that the platform itself is not providing finance and thus, cannot be entrusted with any liability, obligation from the transaction.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.1.4.&lt;/strong&gt; Further, with RBI raising the threshold asset size for an NBFC to be considered systemically important (NBFC-ND-SI) from Rs. 100 Crores to Rs. 500 Crores &lt;strong&gt;[6]&lt;/strong&gt;, and Economic Times reporting that one of the biggest Indian P2P lending platform’s enterprise valuation (which can be taken as indicative of its net assets) is Rs 50 Crores &lt;strong&gt;[7]&lt;/strong&gt;, we may assume that most P2P lending platforms will have net assets worth less than 500 crore, at least in the near future; although there is a possibility for exponential growth with some companies.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.1.5.&lt;/strong&gt; Given the limited sphere of operation, restricted ability (by design) of these platforms to shape interest rates and other features of financial instruments, and their generally non-systemically-important nature, we would submit that the regulation of such P2P lending platforms are kept to an absolute minimum, so that their economic viability is not undermined, and at the same time the key risks associated with their operations are addressed by RBI.&lt;/p&gt;
&lt;h3&gt;3.2. Is the assessment of P2P lending and risks associated with it adequate?&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.2.1.&lt;/strong&gt; CIS observes that the following are the key risks involved with the operations of the P2P lending platforms, and these are being respectively addressed by, or can be addressed by RBI in the following manners.&lt;/p&gt;
&lt;ol type="A"&gt;&lt;li&gt;&lt;strong&gt;Insufficient information about the conditions of lending, leading to defrauding of the borrower:&lt;/strong&gt; The borrower may not receive appropriate information about the terms of the loan, and/or the P2P lending platform may not act in a “fair” manner (say, in case of collusion between the P2P lending platform and the lender, or the lending platform and the borrower), which may lead to defrauding and/or economic loss of either party. By classifying P2P lending platforms as NBFCs, RBI will ensure that these companies follow the Guidelines on Fair Practices Code for NBFCs &lt;strong&gt;[8]&lt;/strong&gt;, which extensively addresses concerns related to this type of risks.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Insufficient information about the borrower, or her/his ability to repay the loan, may lead to non-repayment and economic loss of the lender:&lt;/strong&gt; If the P2P lending platform allows the lender to offer loans to borrowers without acquiring and/or providing sufficient information to the lender about the borrower’s credit history and/or ability to repay the loan, modes of formulating security for loans, this may heighten the risks of non-repayment of loans. By classifying P2P lending platforms as NBFCs, RBI will ensure that these companies follow the Master Circular – 'Know Your Customer' (KYC) Guidelines – Anti Money Laundering Standards (AML) - Prevention of Money Laundering Act, 2002 - Obligations of NBFCs &lt;strong&gt;[9]&lt;/strong&gt;, which extensively addresses concerns related to this type of risks.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Credit-related information of the lenders and the borrowers collected by P2P lending platforms may not be made available to other financial institutions and that will lead asymmetry in credit information available across various actors in the sector:&lt;/strong&gt; Credit information, related to both lending and borrowing practices of entities using the platform concerned, is a key asset of the P2P lending platforms. Lack of sharing of such information with Credit Information Companies, for economic reasons or otherwise, may however, lead to information asymmetry within the financial sector, which will structurally weaken the entire sector (with pieces of credit information being distributed across actors and not being shared internally). By classifying P2P lending platforms as NBFCs, RBI will ensure that these companies follow the Credit Information Companies (Regulation) Act, 2005 &lt;strong&gt;[10]&lt;/strong&gt;, which extensively addresses concerns related to this type of risks.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;P2P lending platforms diversifying their financial operations without informing RBI and hence without appropriate regulatory control:&lt;/strong&gt; It is possible that P2P lending platforms may decide to diversify their activities. There have been similar examples in other related sectors, say e-commerce marketplaces, that have started their own product re/selling companies that use the same online marketplace concerned. By classifying P2P lending platforms as NBFCs, RBI will ensure that these companies provide RBI with detailed and regular reports of their economic activities and investments, which is expected to address concerns related to this type of risks.&lt;/li&gt;&lt;/ol&gt;
&lt;h3&gt;3.3. Are there any other risks which ought to be addressed?&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.3.1.&lt;/strong&gt; CIS observes that as part of the usual transaction related activities of the P2P lending platforms, the companies will come into possession of what has been defined as “sensitive personal data or information” by the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 &lt;strong&gt;[11]&lt;/strong&gt;. The concerns related to this type of risk is directly addressed by the Rules concerned, and may not require additional attention from the RBI.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.3.2.&lt;/strong&gt; CIS observes that as borrowers and lenders start using specific P2P lending platforms, the data regarding their credit histories and/or “financial reputation” will be owned by these companies. While such information might be shared internally within the financial sector through the Credit Information Companies, the borrowers and lenders themselves may not get direct access to such data. Hence, the borrowers and lenders will not be able to move easily and smoothly to a new P2P lending platform and make use of their existing credit information and/or “financial reputation” when accessing services offered via the new P2P lending platform. In other words, the borrowers and lenders may face a &lt;em&gt;service provider lock-in&lt;/em&gt;, and inability to move between P2P lending platforms easily, without explicit access to their own credit history/reputation, and will not have the ability to migrate such information from one P2P lending platform to another (or to any other agency, for that matter). CIS submits that RBI must provide a mechanism to allow users to migrate between platforms as it has not been discussed in the consultation paper.&lt;/p&gt;
&lt;h3&gt;3.4. Is the proposed approach to regulating these platforms adequate?&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.4.1.&lt;/strong&gt; CIS observes that while classification of P2P lending platforms will appropriately address key risks associated with their operations (as listed in 3.2.1. A-D), it will not address a major risk emerging out of their operations that is unique to the technological basis of the business concerned (as mentioned in 3.3.2.), and further, it will impose substantial financial and management obligations that have a very high probability of undermining the economic viability of this emerging and niche sector of intermediated direct lending and borrowing.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.4.2.&lt;/strong&gt; CIS observes that these financial and management obligations may involve the following topics among others discussed: 1) minimum net worth requirement for registration, 2) minimum investments required to be made government securities, 3) transferring of minimum percentage of net profits to RBI, 4) guidelines regarding corporate governance &lt;strong&gt;[12]&lt;/strong&gt;, etc.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.4.3.&lt;/strong&gt; Given this, CIS submits that instead of classifying P2P lending platforms as “Misc NBFCs,” a new sub-classification is created under the category of NBFC for such platforms, that directly addresses the key risks associated with businesses of P2P lending platforms, and protects lenders as well as borrowers while enhancing transparency in operations. This new sub-classification of P2P lending companies should also be divided into systemically-important and non-systemically-important like other NBFCs, and requirements regarding financial operations and corporate management should only be enforced for the former category of P2P lending companies.&lt;/p&gt;
&lt;h3&gt;3.5. Any other relevant issues pertaining to P2P lending&lt;/h3&gt;
&lt;p&gt;Beyond the issues already discussed above, CIS seek clarity from the RBI around the following aspects:&lt;/p&gt;
&lt;ol&gt;&lt;li&gt;&lt;strong&gt;Transactional system pertaining to P2P lending:&lt;/strong&gt;
&lt;ol type="a"&gt;
&lt;li&gt;What are the requirements and prerequisites for mandating the collection of user identity?&lt;/li&gt;
&lt;li&gt;Establishing a maximum sum that can be transferred per transaction.&lt;/li&gt;&lt;/ol&gt;
&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Company activities:&lt;/strong&gt;
&lt;ol type="a"&gt;&lt;li&gt;Fees that can be charged by platforms.&lt;/li&gt;
&lt;li&gt;How data security can be best addressed.&lt;/li&gt;
&lt;li&gt;How the financial transactions are brokered.&lt;/li&gt;
&lt;li&gt;Modes of redressal.&lt;/li&gt;
&lt;li&gt;Restitution to users if something goes amiss in the transaction.&lt;/li&gt;
&lt;li&gt;Insurance that the company has to buy or capital on hand to support.&lt;/li&gt;&lt;/ol&gt;
&lt;/li&gt;&lt;/ol&gt;

    <title>Comments on the National Geospatial Policy (Draft, V.1.0), 2016</title>

        &lt;b&gt;The Department of Science and Technology published the first public draft of the National Geospatial Policy (v.1.0) on May 05, 2016, and invited comments from the public. CIS submitted the following comments in response. The comments were authored by Adya Garg, Anubha Sinha, and Sumandro Chattapadhyay.&lt;/b&gt;
        
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;1. Preliminary&lt;/h2&gt;
&lt;p&gt;&lt;strong&gt;1.1.&lt;/strong&gt; This submission presents comments and recommendations by the Centre for Internet and Society (&lt;strong&gt;"CIS"&lt;/strong&gt;) on the proposed draft of the National Geospatial Policy 2016 (&lt;strong&gt;"the draft Policy / the draft NGP"&lt;/strong&gt;) &lt;strong&gt;[1]&lt;/strong&gt;. This submission is based on Version 1.0 of the draft Policy released by the Department of Science and Technology (&lt;strong&gt;"DST"&lt;/strong&gt;) on May 5, 2016.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;1.2.&lt;/strong&gt; CIS commends the DST under the aegis of the Ministry of Science and Technology, Government of India, for its efforts at seeking inputs from various stakeholders to draft a National Geospatial Policy. CIS is thankful for this opportunity to provide a clause-by-clause submission.&lt;/p&gt;
&lt;h2&gt;2. The Centre for Internet and Society&lt;/h2&gt;
&lt;p&gt;&lt;strong&gt;2.1.&lt;/strong&gt; The Centre for Internet and Society, CIS, &lt;strong&gt;[2]&lt;/strong&gt; is a non-profit organisation that undertakes interdisciplinary research on internet and digital technologies from policy and academic perspectives. The areas of focus include digital accessibility for persons with diverse abilities, access to knowledge, intellectual property rights, openness (including open data, free and open source software, open standards, open access, open educational resources, and open video), internet governance, telecommunication reform, digital privacy, and cyber-security. The academic research at CIS seeks to understand the reconfiguration of social processes and structures through the internet and digital media technologies, and vice versa.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;2.2.&lt;/strong&gt; This submission is consistent with CIS’ commitment to safeguarding general public interest, and the interests and rights of various stakeholders involved. The comments in this submission aim to further the principle of citizens’ right to information, instituting openness-by-default in governmental activities, and the various kinds of public goods that can emerge from greater availability of open (geospatial) data created by both public and private agencies and crucially, by the citizens. The submission is  limited to those clauses that most directly have an impact on these principles.&lt;/p&gt;
&lt;h2&gt;3. Comments and Recommendations&lt;/h2&gt;
&lt;p&gt;&lt;em&gt;This section presents comments and recommendations directed at the draft policy as a whole, and in certain places, directed at specific clauses of the draft policy.&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.1.&lt;/strong&gt; The draft policy should make references to five policies applicable to geospatial data, products, services, and solutions&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.1.1.&lt;/strong&gt; CIS observes that the draft policy lists the key policies related to geospatial information and sharing of government data, namely the National Map Policy 2005, the Civil Aviation Requirement 2012, the Remote Sensing Data Policy 2011 and 2012, and the National Data Sharing and Accessibility Policy 2012 (“NDSAP”).&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.1.2.&lt;/strong&gt; CIS submits that apart from the policies mentioned above, Geospatial Data,Products, Services and Solutions (“GDPSS”) are also intricately linked to concepts of “open standards,” “open source software,” “open API,” “right to information,” and prohibited places” These concepts are governed by specific acts and policies, and are applicable to geospatial data, as follows:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;Adoption of Open Standards: CIS observes that the draft policy captures the importance of open standards in the section 1.4 of the draft policy. It states that “A very high resolution and highly accurate framework to function as a national geospatial standard for all geo-referencing activity through periodically updated National Geospatial Frame [NGF] and National Image Frame [NIF] by ensuring open standards based seamless interoperable geospatial data.”&lt;br /&gt;&lt;br /&gt;CIS submits that the Policy on Open Standards for e-Governance &lt;strong&gt;[3]&lt;/strong&gt; which establishes the Guidelines for usage of open standards to ensure seamless interoperability, and the Implementation Guidelines of the National Data Sharing and Accessibility Policy, 2012 &lt;strong&gt;[4]&lt;/strong&gt; listing two key open standards for geospatial data - KML and GML, should be mentioned in the draft policy.&lt;br /&gt;&lt;br /&gt;CIS recommends that the final version of the NGP embrace open standards as a key principle of all software projects and infrastructures within the purview of the Policy. This is essential for easier sharing and reuse of open (geospatial) data.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Adoption of Open Source Software:  The Policy on Adoption of Open Source Software for Government of India states that the “Government of India shall endeavour to adopt Open Source Software in all e-Governance systems implemented by various Government organisations, as a preferred option in comparison to Closed Source Software” &lt;strong&gt;[5]&lt;/strong&gt;. As the draft policy proposed to guide the development of GDPSS being developed and implemented both by the Government of India and by other agencies (academic, commercial, and otherwise), it must include an explicit reference and embracing of  this mandate for adoption of Open Source Software, for reasons of reducing expenses, avoiding vendor lock-ins, re-usability of software components, enabling public accountability, and greater security of software systems.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Implementation of Open APIs: To actualise the stated principle to “[e]nable promotion, adoption and implementation of emerging / state of the art technologies”  as well as to ensure the “[a]vailability of all geospatial data collected through public funded mechanism to all users,” CIS suggests that final version of the NGP must refer to and operationalise the Policy on Open Application Programming Interfaces (APIs) for Government of India &lt;strong&gt;[6]&lt;/strong&gt;. This will ensure that the openly available geospatial data is available to the public, as well as  to all the government agencies, in a structured digital format that is easy to consume and use on one hand, and is available for various forms of value addition and innovation on the other.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Right to Information Act 2005: The framework for reactive disclosure of information and data collected and held by the Government of India, as well as the basis for proactive disclosure of the same, is enshrined in the Right to Information Act 2005 &lt;strong&gt;[7]&lt;/strong&gt;. The draft NGP, CIS proposes, should refer to this Act, and ensure that whenever an Indian citizen request for such government data and/or information that is of geospatial in nature, and the requested data and/or information is both shareable and non-sensitive, the citizen must be provided with the geospatial data and/or information in an open standard and under open license, as applicable.&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;
&lt;li&gt;Refer to Official Secrets Act, 1923: The Official Secrets Act defines “Prohibited Places” and prohibits all activities involving “sketch, plan, model, or note which is calculated to be or might be or is intended to be, directly; or indirectly, useful to an enemy or (c) obtains collects, records or publishes or communicates to any other person any secret official code or password, or any sketch, plan, model, article or note or other document or information which is calculated to be or might be or is intended to be, directly or indirectly, useful to an enemy” &lt;strong&gt;[8]&lt;/strong&gt;. This provides the fundamental legal basis for regulation, expunging, and stopping circulation of geospatial data containing information about Vulnerable Points and Vulnerable Areas. CIS submits that this Act should be referred to in this context of ensuring non-publication of sensitive geospatial data (that is geospatial data related to Prohibited Places).&lt;br /&gt;&lt;br /&gt;&lt;/li&gt;&lt;/ul&gt;
&lt;h3&gt;3.2. Grant adequate permissions to the public to re-use geospatial data&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.2.1.&lt;/strong&gt; CIS observes that section 1.4 of the draft policy states that, “Geospatial data of any resolution being disseminated through agencies and service providers, both internationally and nationally be treated as unclassified and made available and accessible by Indian Mapping and imaging agencies.”&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.2.2.&lt;/strong&gt; CIS recommends the abovementioned section be broadened to include not only availability and accessibility of geospatial data, but also its re-use. Further, such accessibility, availability and re-use should not be only limited to public and private entities such as Indian mapping and imaging agencies, but as well as  to Indian people in general.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.2.3.&lt;/strong&gt; CIS further submits that section 1.4 be revised as  “[g]eospatial data of any resolution being disseminated through agencies and service providers, both internationally and nationally be treated as unclassified and made available, accessible, and reusable by Indian mapping and imaging agencies in particular, and by the people of India in general.”&lt;/p&gt;
&lt;h3&gt;3.3. Ensure Open Access to shareable and non-sensitive geospatial data&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.3.1.&lt;/strong&gt; CIS observes that the draft policy directs all “geospatial data generating agencies” to classify their data into “open access,” “registered access,” and “restricted access.” The document, however, neither defines “geospatial data generating agencies”, nor does it clarify what conditions the data must satisfy to be classified as one of the three types. Without a listing of such conditions (at least necessary, and not sufficient, conditions), nothing restricts the agencies from classifying all generated geospatial data as “restricted.”&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.3.2.&lt;/strong&gt; Further, CIS observes that the draft policy aims to provide geospatial data acquired through public funded mechanism to be made available to the public at free of cost. It is submitted that the policy should not only be made available for free of cost, but it should also be made available in open standard format under an open license.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.3.3.&lt;/strong&gt; As defined in the section 1.3, the National Data Sharing and Accessibility Policy (“NDSAP”) applies to “all shareable non-sensitive data available either in digital or analog forms but generated using public funds” &lt;strong&gt;[9]&lt;/strong&gt;. Clearly all shareable &lt;strong&gt;[10]&lt;/strong&gt; and non-sensitive &lt;strong&gt;[11]&lt;/strong&gt; geospatial data, either in digital or analog forms, and generated using public funds should be proactively disclosed by the government agency concerns in accordance to the NDSAP. CIS recommends that the draft policy makes an explicit reference to NDSAP when discussing the topic of Open Access geospatial data, and re-iterates the mandate of proactive publication of shareable and non-sensitive government data.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.3.4.&lt;/strong&gt; Further, the process for defining an open government data license to be applied to all open government data sets being published under the NDSAP, and through the Open Government Data Platform India, is in progress. Given this, it is absolutely crucial important that the draft NGP takes this into consideration, and mandates that Open Access geospatial data must be published using the open government data license to be defined by the Implementation Guidelines of the NDSAP, when applicable.&lt;/p&gt;
&lt;h3&gt;3.4. Lack of clarity regarding the clearances and permits required for data acquisition and dissemination, and the procedures thereof&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.4.1.&lt;/strong&gt; Section 1.8 of the draft policy states that “[a]ll clearances / permits, as necessary, for data acquisition and dissemination be through a single window, online portal. These clearances be provided within a time span of 30 days of filing the online request.” CIS observes that the draft policy does not specify the kind of clearances/permits needed before a public or private entity, or an individual, can undertake acquisition and dissemination of geospatial data. It neither clarifies under what circumstances and conditions application for such clearance / permits would be required for users.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.4.2.&lt;/strong&gt; Since the recently published draft Geospatial Information Regulation Bill (“GIRB”) 2016, directly addresses this topic of clearance / permit required to acquire and share geospatial information &lt;strong&gt;[12]&lt;/strong&gt;, it will be effective if the NGP can refer to this Bill and provide an overall governance framework for the same. Further, CIS noted that the time span of 30 days mentioned in the draft policy is inconsistent with the time period specified in the GIRB (which is 90 days).&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.4.3.&lt;/strong&gt; CIS recommends that the draft policy also be amended suitably to include the circumstances and conditions under which required permissions shall be issued. Accordingly, the draft policy should reference the standardised and time bound security vetting process envisaged in the GIRB.&lt;/p&gt;
&lt;h3&gt;3.5. Clarification Needed regarding “Cybersecurity is to be ensured through … use of Digital Watermarks for authentication of GDPSS”&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.5.1.&lt;/strong&gt; CIS submits that the draft policy does not elaborate on the use of  “Digital Watermarks” to ensure cybersecurity, neither it is explained who will authenticate GDPSS, under what conditions, and for what reasons. CIS recommends that the draft policy be amended suitably to specify the same.&lt;/p&gt;
&lt;h3&gt;3.6. Remove Classification of Non-Public (at Present) Satellite / Aerial Imagery as Restricted by Default&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.6.1.&lt;/strong&gt; CIS observes that the draft policy recommends that “[s]atellite/aerial images of resolution other than those currently made available on websites” should all be “classified for restricted access.”&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.6.2.&lt;/strong&gt; CIS submits that blanket categorisation of all satellite / aerial imagery of resolution that is not currently available through a public website (for whatever reason it might be) as “restricted access” should be re-evaluated, given the immense importance of such imagery to mapping agencies and industry participants using GDPSS.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.6.3.&lt;/strong&gt; CIS recommends that the section be revised to define clear principles for defining satellite /aerial imagery as “open,” “registered,” and “restricted.”&lt;/p&gt;
&lt;h3&gt;3.7. Governance of User-contributed Geospatial Data&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.7.1.&lt;/strong&gt; A key resource and feature of contemporary geospatial industry in particular, and the digital economy in general, is the proliferation of user-contributed and user-generated geospatial data and information. CIS observes that this crucial topic, as well as the unique governance concerns that it raises, has not been addressed in the draft policy at all. CIS requests the DST to consider this matter with due attention to the specific nature and values of such user-contributed and user-generated in the digital economy on one hand, and in emergency contexts such as natural disasters on the other, and prepare a framework for its appropriate governance as part of the NGP itself.&lt;/p&gt;
&lt;h3&gt;3.8. Protect Geospatial Privacy of Citizens by Defining Sensitive Personal Geospatial Data and Information&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.8.1.&lt;/strong&gt; CIS observes that the draft policy lacks rules for collection, use, storage, and distribution of geospatial data from an individual’s privacy standpoint. Further, neither does the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 address these concerns &lt;strong&gt;[13]&lt;/strong&gt;. Section 3 of the Rules define “Sensitive personal data or information”, which do not include geospatial information.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.8.2.&lt;/strong&gt; The argument of violation of constitutional right to privacy was pleaded  in a case against Google and other private mapping agencies in 2008 &lt;strong&gt;[14]&lt;/strong&gt;. In the judgment, Madras HIgh Court noted that there existed no legislation/guidelines to prohibit mapping programmes from conducting their activities indiscriminately, and the lack of one thereof prevented the Court from injuncting such activities. Thus, there exists a judicial ambiguity on the aspect of collection and use of geospatial data.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.8.3.&lt;/strong&gt; CIS submits that the draft policy may be suitably amended to ensure that collection, processing and dissemination of geospatial information is in consonance with the constitutionally protection of an individual’s privacy.&lt;/p&gt;
&lt;h3&gt;3.9. Clarification Needed regarding “Mechanisms to be put in place to evaluate / audit GDPSS creation, consumption and distribution”&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.9.1.&lt;/strong&gt; The draft policy suggests that “mechanisms to be put in place to evaluate/audit GDPSS creation, consumption and distribution” without clarifying the scope, purpose, and purview of this mechanism, and most crucially it does not describe what exactly will be evaluated / audited. CIS submits that this section is revised and expanded.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.9.2.&lt;/strong&gt; The same section also identifies the need for a “framework to be put in place to assess the data collection versus its utilization towards government program and socio-economic development.” CIS observes that this is a very promising and much welcome gesture by the DST, but this section must be developed as a separate and detailed mandate. At the least, the NGP may suggest that a more detailed guideline document regarding this framework will be developed in near future.&lt;/p&gt;
&lt;h3&gt;3.10.  Data Taxation and Geospatial Cess&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.10.1.&lt;/strong&gt; The draft policy refers to imposition of “data taxation (geospatial cess)” and use of “licensing” of geospatial data to raise money for geospatial activities of the Government of India. CIS is of the opinion will severely affect the geospatial industry in the country in particular, and will raise the monetary barrier to public use of geospatial data and maps in general; and hence must be strictly avoided.&lt;/p&gt;
&lt;h3&gt;3.11. Data Dissemination Cell&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.11.1.&lt;/strong&gt; CIS submits that instead of development of a separate Data Dissemination Cell within all government agencies to operationalise the mandate of the NGP, the Chief Data Officers within all government agencies identified under the implementation process of the NDSAP be given this complementary responsibility. This would ensure effective channelisation of human and financial resources to take forward the joint mandate of NGP and NDSAP towards greater public availability and use of (shareable and non-sensitive) government data.&lt;/p&gt;
&lt;h3&gt;3.12. Special Infrastructure for Governance, Management, and Publication of Real-time Geospatial Data&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.12.1.&lt;/strong&gt; A key term that the draft policy does not talk about is “big data.” The static or much-slowly-changing geospatial data such as national boundaries and details of Vulnerable Points and Vulnerable Areas are really a very small part of of the global geospatial information. The much larger and crucial part is the real-time (that is continuously produced, stored, analysed, and used in almost real-time) big geospatial data – from geo-referenced tweets, to GPS systems of cars, to mobile phones moving through the cities and regions. Addressing such networked data systems, where all data collected by digital devices can quite easily be born-georeferenced, and the security and privacy concerns that are engendered by them, should be the ultimate purpose of, and challenge for, a future-looking NGP.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.12.2.&lt;/strong&gt; Further, with increasing number of government assets being geo-referenced for the purpose of more effective and real-time management, especially in the transportation sector, the corresponding agencies (which are often not mapping agencies) are acquiring a vast amount of high-velocity geospatial data, which needs to be analysed and (sometimes) published in the real-time. CIS submits a sincere request to DST to highlight the crucial need for special infrastructure for such data, as well as its governance, and identify the key principles concerned in the next version of the draft NGP.&lt;/p&gt;
&lt;h3&gt;3.13. Sincere Request for Preparation and Circulation of a Second Public Draft of the National Geospatial Policy&lt;/h3&gt;
&lt;p&gt;&lt;strong&gt;3.13.1.&lt;/strong&gt; CIS commends the DST for publishing the draft policy, and facilitating a consultation process inviting stakeholders and civil society to submit feedback. The NGP envisages to address crucial concepts of privacy, licensing, intellectual property rights, liability, national security, open data, which cut across and impact various technology platforms, industries and the citizens.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.13.2.&lt;/strong&gt; In view of the multifarious issues highlighted that arise at the intersection of various legal and ethical concepts, CIS respectfully requests the DST to conduct another round of consultation after the publication of the second draft of the NGP. Multiple rounds of consultation and feedback would contribute to the robustness of the lawmaking process and ensure that the final policy safeguards the general public interest, and the interests and rights of various stakeholders involved.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;3.13.3.&lt;/strong&gt; CIS is thankful to DST for the opportunity to provide comments, and would be privileged to provide further assistance on the matter to DST.&lt;/p&gt;

        &lt;b&gt;Rohini Lakshané, Amber Sinha and Vidushi Marda have been selected to attend the two-day Young Scholars' Programme to be held in Zanzibar, Tanzania in early September this year. The programme is a part of the CPRSouth conference.&lt;/b&gt;

&lt;p style="text-align: justify; "&gt;Following highly successful joint Afro-Asian CPR conferences in Mauritius in 2012, and India in 2013, CPRafrica and CPRsouth formally merged under the banner of CPRsouth in 2014. Since then, CPRsouth has hosted conferences in the Cradle of Humankind in South Africa (2014), and at the Innovation Center for Big Data and Digital Convergence at Yuan Ze University, Taiwan (2015).&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;This year’s conference is co-hosted by&lt;em&gt; COSTECH &lt;/em&gt;and&lt;em&gt; TCRA &lt;/em&gt;in Zanzibar, and will include sessions on cutting-edge developments on ICT policy and regulation in the South and discussion of the research-policy interface.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;30 Young Scholars from Africa and the Asia-Pacific region will be selected to participate in a tutorial programme taught by recognised scholars and practitioners from Africa and Asia, and they will attend the main conference thereafter.&lt;/p&gt;

&lt;ul style="text-align: justify; "&gt;
&lt;li&gt;lowest-cost economy airfare to conference destination (less USD 150 registration fee);&lt;/li&gt;
&lt;li&gt;ground transfers between the conference venue and airport; and&lt;/li&gt;
&lt;li&gt;twin sharing accommodation on bed and breakfast basis, 5 lunches and 1 dinner for the duration of the conference and tutorials (6 – 10 September 2016). &lt;em&gt;Not all meals are covered.&lt;/em&gt;&lt;/li&gt;
&lt;/ul&gt;
&lt;p style="text-align: justify; "&gt;The registration fee for young scholars to attend the conference and tutorials is USD150, and airfares will be reimbursed less this registration fee.  Participants will be required to cover:&lt;/p&gt;

&lt;li&gt;transport to and from airports in their home countries;&lt;/li&gt;

&lt;p&gt;&lt;span style="text-align: justify; "&gt;For 24 months now, several Indian government and private organisations have been victims of highly-targeted and sustained cyberattacks by Suckfly. &lt;/span&gt;&lt;span style="text-align: justify; "&gt;Cyber security firm Symantec has been tracking Suckfly since April 2014 and believes it is a Chinese cyber-espionage group. According to Symantec, Suckfly uses stolen digital certificates to breach the internal networks of Indian organisations.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;While Symantec has declined to name any of the victims, it says the high-profile targets include one of India’s largest financial institutions, an e-commerce company and its primary shipping vendor, a leading Indian IT company, two government organisations, and an American health care provider’s Indian business unit.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;So far, the highest infection rate has been at a government organisation responsible for implementing network software across various ministries and departments of the Indian central government. Symantec’s investigation report says Suckfly uses custom malware called Backdoor.Nidiran to orchestrate the attacks. While Suckfly had used the same backdoor in its previous campaigns in other countries, in India the post-infection activity was significantly higher.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“We should be aware that this attack isn’t yet over. Suckfly has been targeting organisations since at least May 2014, and it very likely continues to have access to governmental and corporate servers in India thanks to the Nidiran backdoor,” says Pranesh Prakash, Policy Director, Centre for Internet and Society.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He added that, “Depending on what access Suckfly got, the damage could be anything from them having conducted fraudulent financial transactions to obtaining classified governmental secrets.”&lt;/p&gt;

&lt;h3&gt;Suckfly’s Modus Operandi&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;In 2015, between 22 April and 4 May, Suckfly conducted a multistage attack on an Indian e-commerce company.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It first identified a user – an employee of the e-commerce company – to attempt its initial breach into the e-commerce company’s internal network.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Symantec says, “We don’t have hard evidence of how Suckfly obtained information on the targeted user, but we did find a large open-source presence on the initial target. The target’s job function, corporate email address, information on work-related projects, and publicly accessible personal blog could all be freely found online.’&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Suckfly then exploited a vulnerability in the employee’s operating system (Windows) that allowed it to bypass the User Account Control and install the malware. It’s likely that Suckfly used a spear-phishing email to gain entry.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Having entered the employee’s system, Suckfly gained access to the employee’s account credentials and then used them to access the victim’s account and navigate the e-commerce company’s internal corporate network as though it were the employee.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Suckfly’s final step was to exfiltrate data off the victim’s network and onto Suckfly’s infrastructure.&lt;/p&gt;
&lt;h3&gt;Weekends Off&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The attack took place over 13 days, but Symantec discovered that Suckfly was active only Monday to Friday. There was no activity from the group on weekends. This could be because the attackers’ hacktools are command line driven and can provide insight into when operators are behind keyboards actively working.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Suckfly’s Motives?&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;According to Symantec, “Suckfly targeted one of India’s largest e-commerce companies, a major Indian shipping company, one of India’s largest financial organizations, and an IT firm that provides support for India’s largest stock exchange. All of these targets are large corporations that play a major role in India’s economy. By targeting all of these organisations together, Suckfly could have had a much larger impact on India and its economy. While we don’t know the motivations behind the attacks, the targeted commercial organisations, along with the targeted government organisations, may point in this direction. Symantec’s research shows that Suckfly is well-equipped to carry out targeted attacks for years while staying off the radar of security organisations.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Symantec refused to name the victims and when contacted, the National Stock Exchange (NSE) said its systems were secure and that it had not heard of any such attack on any of its tech vendors.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In the last two years, from 2013 to 2015, the total number of reported cyber breaches worldwide have increased 25%. India is amongst the most vulnerable – ranking third on the list of countries that have faced financial intrusion.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Smokescreen is a cybersecurity firm and CEO Sahir Hidayatullah claims virtually every large company in India has been compromised to varying degrees already.&lt;/p&gt;

Attacks against the financial sector are more commonly done by financially-motivated cybercriminals, however, nation state attackers have an interest here as well – being deeply embedded into critical systems affords opportunities for both mass data collection as well as the ability to cripple financial systems if required. &lt;p&gt;According to a 2015 survey conducted by PWC spanning 250 Indian companies, 72% of the respondents claimed they faced some sort of cyberattack over the last year. 63% claimed intrusions lead to financial losses and 55% claimed there was loss of sensitive information. But the worrying number is this – 78% have no cyber incident response plan. That’s good news for Suckfly and its comrades.&lt;/p&gt;

&lt;p style="text-align: justify;"&gt;The larger community including long-time Wikipedians and new members like the students faculty involved in Wikipedia Education Programs gathered to participate in a day long edit-a-thon and chalk out plans for the future. The event was organised by the Kannada Wikimedia community and Dr. Vishwanatha Badikana, Wikipedian and Assistant Professor of Kannada department at St. Aloysius College, who coordinated the event locally.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Prior to the event, four edit-a-thons were organised in four different cities of Karnataka. The local organisers also took the participants through a heritage walk in the village of Pilikula Nisarga Dhama, an open library of the rich cultural heritage of Karnataka. &lt;p style="text-align: justify;"&gt;117 people gathered at the event out of which 96 were active editors of the Kannada Wikipedia to celebrate thirteen years of&amp;nbsp;&lt;strong&gt;&lt;a href="https://kn.wikipedia.org/" rel="nofollow" target="_blank"&gt;Kannada Wikipedia&lt;/a&gt;&lt;/strong&gt;, arguably the largest online encyclopedia in&amp;nbsp;&lt;strong&gt;&lt;a href="https://en.wikipedia.org/wiki/Kannada" rel="nofollow" target="_blank"&gt;&lt;strong&gt;Kannada&lt;/strong&gt; language&lt;/a&gt;&lt;/strong&gt;. Noted Kannada-computing researcher Kinnikambla Padmanabha Rao (widely known as KP Rao) addressed the public event and engaged with the audience about defining Kannada Wikipedia’s large role in widening the language’s presence on the internet. The heritage walk resulted in over 300 image uploads on Wikimedia Commons ranging from the life and culture of coastal Karnataka to select rich heritage of the state. 20 new editors also participated in the event and they were oriented on basics of Wikipedia editing and&amp;nbsp;&lt;strong&gt;&lt;a href="https://creativecommons.org/licenses/" rel="nofollow" target="_blank"&gt;Creative Commons licenses&lt;/a&gt;&lt;/strong&gt;.&lt;/p&gt;

&lt;p&gt;Triveni K, one of the participants who is now pursuing her M.Sc at Christ University, called this event a great learning platform for learning core Wikipedia policies in detail. “I’m little occupied for my exams but when it is over, I will be back on Wikipedia”, shares Triveni.&lt;/p&gt;
&lt;p&gt;The&amp;nbsp;&lt;strong&gt;&lt;a href="https://kn.wikipedia.org/wiki/?diff=1" rel="nofollow" target="_blank"&gt;first ever edit&lt;/a&gt;&lt;/strong&gt; on Kannada Wikipedia was made on June 12, 2003 with a message saying “Kannada Vishwa Koshakke Suswaagatha!” (meaning ‘Welcome to the Kannada encyclopedia’). However it took over a year, July 12, 2004, before the first article, about a city&amp;nbsp;&lt;strong&gt;&lt;a href="https://en.wikipedia.org/wiki/Shimoga" rel="nofollow" target="_blank"&gt;Shimoga&lt;/a&gt;&lt;/strong&gt;, was created. Over the last decade, Kannada Wikipedia has been a great gamechanger for the&lt;strong&gt;&lt;a href="https://en.wikipedia.org/wiki/Kannada" rel="nofollow" target="_blank"&gt;Kannada language&lt;/a&gt;&lt;/strong&gt; where the Wikipedians have played a great role in making it a household name.&amp;nbsp;&lt;strong&gt;&lt;a href="https://commons.wikimedia.org/wiki/File:Kannada_Wikipedia_stats_%28December_2015%29.png" rel="nofollow" target="_blank"&gt;7,05,199 unique visitors&lt;/a&gt;&lt;/strong&gt; read the articles every month as per the December 2015 statistics. The annual average of active editors for last year was 48, 91 (in February) being the highest, 22 (in May) the lowest and 80 being the count in December 2015. The peaks and valleys also signify that major outreach like&amp;nbsp;&lt;strong&gt;&lt;a href="https://outreach.wikimedia.org/wiki/Education/Countries/India/Christ_University/CUWEP2015_NOVEMBER" rel="nofollow" target="_blank"&gt;Wikipedia Education Program at Christ University, Bengaluru&lt;/a&gt;&lt;/strong&gt; could have boosted the total number of editors during the months when the program was being rolled out. The project since its inception has gone through many ups and downs over time, the major one being a small community to edit and curate such a high level task of creating new articles in Kannada, editing and enriching them with more information and citations, and cleaning up many articles. The biggest hurdle, as&amp;nbsp;&lt;strong&gt;&lt;a href="http://www.hpnadig.net/blog/2011/10/22/how-google-irreparably-wounded-kannada-wikipedia/755" rel="nofollow" target="_blank"&gt;explained&lt;/a&gt;&lt;/strong&gt; by Wikimedian&amp;nbsp;&lt;strong&gt;&lt;a href="https://kn.wikipedia.org/wiki/User:HPNadig" rel="nofollow" target="_blank"&gt;Hari Prasad Nadig&lt;/a&gt;&lt;/strong&gt;, has been cleaning up the articles created by paid translations of Google when Kannada Wikipedia along with many other Indian language Wikipedias was used as testing ground for improving&amp;nbsp;&lt;strong&gt;&lt;a href="http://translate.google.com/" rel="nofollow" target="_blank"&gt;Google Translate&lt;/a&gt;&lt;/strong&gt;, a multilingual machine translation tool.&amp;nbsp;&lt;strong&gt;&lt;a href="https://kn.wikipedia.org/wiki/User:VASANTH_S.N." rel="nofollow" target="_blank"&gt;Vasanth SN&lt;/a&gt;&lt;/strong&gt;, a Kannada Wikipedian who has cleaned up over 60 such articles, prefers to use an existing good quality encyclopedia like the 14 volume Kannada Vishwakosha published by Mysore University and&amp;nbsp;&lt;strong&gt;&lt;a href="http://cis-india.org/openness/blog-old/university-of-mysore-releases-kannada-vishwakosha-under-cc-license" rel="nofollow" target="_blank"&gt;relicensed&lt;/a&gt;&lt;/strong&gt; under&amp;nbsp;&lt;strong&gt;&lt;a href="https://creativecommons.org/licenses/by-sa/3.0/us/" rel="nofollow" target="_blank"&gt;CC-BY-SA 3.0&lt;/a&gt;&lt;/strong&gt; by the university, as a resource to create and improve articles.&lt;/p&gt;

    <title>Modi’s New Intellectual Property Rights Policy Will Only Benefit Players with Deep Pockets</title>

&lt;p style="text-align: justify; "&gt;In November 2014, five national governments wrote to the Department of Industrial Policy and Promotion (DIPP) to inform the policy-making process of India’s first national intellectual property rights policy (IPR policy). The DIPP received 300 submissions from various other stakeholders, including NGOs and civil society, multinational companies, businesses and trade associations, cutting across various sectors. The policy-making process itself was marred by bizarre, unfair and unexplained steps such as the sudden disbanding of the first think tank put in charge for producing a draft policy, an opaque and long-drawn process of releasing a first draft, the leak of a near-complete final draft and no publication of responses (yet) of the 300 odd submissions that were made by stakeholders. Finally, the DIPP released the policy last week.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Despite the long and extensive drafting process, the policy is tilted in favour of right-holders, and places undue reliance on IPRs to stimulate innovation and growth. It obviously claims otherwise, but there are some fundamental flaws in the policy’s premise which render the DIPP’s claims meaningless. Delving briefly into the subject of IPRs, it is a matter of principle that a balanced intellectual property (IP) regime, i.e. a model that balances rights with adequate limitations/exceptions, contributes optimally to the holistic development and growth of the nation. Limitations or exceptions are flexibilities in the law, which cut down absolute monopoly conferred by IPRs, and ensure that use and sharing of knowledge for purposes such as research, education and access to medicines are not overridden by IP rightholders’ claims. The Trade-Related Aspects of Intellectual Property Rights agreement (TRIPS), which is the largest international agreement governing countries’ IPR regimes also promotes the use of these flexibilities to build balanced regimes. The policy does occasionally state its commitment to the TRIPS agreement and the Doha Declaration, but does not commit or spell out any new concrete steps. Thus, it fails to show any seriousness about upholding and promoting a ‘balanced’ regime – in stark comparison to the detailed and surgical manner in which it aims to raise awareness about IPRs and commercialise them.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Unfortunately for the policy, a myopic rationale captures the ambition of the document. The policy document states that, “The rationale… lies in the need to create awareness about the importance of IPRs as a marketable financial asset and economic tool.” As such, the policy fails to recognise the philosophy of welfare and balance embedded in IPRs: to ensure innovation, social, scientific and cultural progress and furtherance of access to knowledge. In all fairness, while the document pays a salutary tribute to objectives such as “achieve economic growth and socio-cultural development, while protecting public interest; also of advancing science and technology, arts and culture, traditional knowledge and biodiversity, transforming knowledge-owned into knowledge shared,” it never rises above its treatment of IPR as a tool to solely serve the interests of rights-holders.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The policy’s attempts to ‘create awareness’ about IPRs through massive outreach and promotion would perhaps be justified, if the singular aim was not the glorification of IPRs. This section implements several steps to induce positivity around IPRs in society to the extent of teaching young students about the benefits of IPRs, which is excessive. While I am of the opinion that awareness building may be important at research centres and industries, a lopsided rights-centric positive view of IPRs should not pass off for ‘awareness’. This is a dangerous view, and will only create a mad race to generate IP and acquire rights.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Chinese copycat?&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Unfortunately, it appears that the government is indeed on board with this. I say this because the lopsided view was endorsed by senior Indian Patent Office and DIPP officials at a recent national conference. It is likely that the idea to use the IPR policy as a tool for ‘IPR indoctrination’ to result in staggering IPR generation came to the Indian government from their Chinese counterparts. In 1995, China started conducting elaborate training of its officers, researchers and students to popularise a generation of IPRs and last year the country received 10 lakh patent filings – an international record. At the conference, the officials were in awe of the Chinese statistics, and they were confident of catching up in the next few years. This despite the fact that in China, the race to patent innovations has only led to a proliferation of low value innovations in high numbers. Less than 1% of China’s patents are of intermediate or high value. Thus, China despite its high patent filings shows only a weak innovative performance. Globally, there is enough evidence to show that there is no positive correlation between patent filings and cumulative innovative performance of a country.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Further, the policy in its bid to maximise IPR generation goes to the extent of encumbering public-funded research by IPRs. It suggests that R&amp;amp;D institutions and academia reward researchers based on the degree of IPR creation, which would obviously lead to IPR-driven research. Such an approach would mean that research on less profiteering sectors in terms of IPR revenues would be neglected. Is this how we want our fledgling research and development sector to shape up?&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;It is disappointing to see how the DIPP has used the policy to strengthen administrative, enforcement and adjudicatory mechanisms for only trade protectionist purposes. The policy is also in contrast with steps taken by other government departments to foster access to knowledge and openness in domains traditionally encumbered by various barriers, including IPRs. For instance, the Department of Biotechnology, Department of Science and Technology has adopted an open access policy applicable to all researchers – this policy ensures that all publications resulting from publicly funded research will be made freely accessible. The Ministry of Law and Justice is in the process of finalising a suitable licence to enable the distribution and sharing of government data. This policy seems at odds, therefore, with other commons-oriented approaches adopted within the government itself.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Next up, pharma&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;India’s generic drug industry has been a saviour for providing affordable drugs worldwide. The most critical provision to ensure a check on ‘evergreening’ of patents is section 3(d) of the Patents Act, 1970. This provision along with compulsory licensing mechanism has been regularly attacked by big pharma. However, the policy does not mention or affirm its commitment to using such tools effectively. Moreover, the policy also misses an opportunity to stress on enforcement of form 27 filings by patent-holders. Form 27 filings demonstrate if a patent is being ‘worked’ in a territory or not, and if it is not worked adequately, a third party can apply for a compulsory licence. Both the Indian Patent Office and patent holders have largely neglected providing form 27 in a timely manner. The policy also over-reaches in certain areas. It mandates the creation of a separate offence for illegal duplication of films – which is completely unwarranted and redundant. The creation of a new criminal penalty for what essentially is infringement and already punishable (under Indian Copyright Act, 1957) comes directly from lobbying by movie studios.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Finally, while it is laudable that the policy aims to step up the efficiency of all concerned IPR offices, there is little to suggest that the policy is capable of nurturing and protecting a balanced IP regime. The flawed assumption of a linkage between IPR generation and cumulative innovation underpins the document, which should have no place in any national IPR policy. It is common knowledge that India had been under pressure from western governments and industry lobbies to ‘strengthen’ its IPR regime to the likes of matured economies and societies. India, a fast developing country, could have secured its unique developmental needs through a more balanced and nuanced IPR policy. But the changes that have taken place will largely benefit a small fraction of the ecosystem, one with deep pockets and great power.&lt;/p&gt;

&lt;p style="text-align: justify;"&gt;My love for Wikimedia&amp;nbsp;started while I was reading an article about the &lt;a href="https://en.wikipedia.org/wiki/Bangladesh_Liberation_War" target="_blank"&gt;Bangladesh Liberation war&lt;/a&gt; on the English Wikipedia after my 10th board exam (like, an annual exam for&amp;nbsp;10th grade students in America). By mistake I clicked on a link that took me to an India&amp;nbsp;Wikipedia article, and I started reading. Something was written in&amp;nbsp;Odia&amp;nbsp;on the lefthand&amp;nbsp;side of the article, so I clicked on that, and reached a &lt;a href="https://or.wikipedia.org/s/d2" target="_blank"&gt;ଭାରତ/Bhārat&lt;/a&gt; article on the Odia Wikipedia. I was excited to find a Wikipedia article in my native language!&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;A banner inviting readers to be part of the 2nd Bhubaneswar workshop on April 1, 2012 sparked my curiousity. I had never contributed to Wikipedia before, only used it for research, and I wasn't familiar with open source and the community contribution process. Plus, I was only 15 years old. I registered. There were many&amp;nbsp;language enthusiasts at the workshop, and all&amp;nbsp;older than me. My father encouraged me to the participate despite my fear; he&amp;nbsp;has played an important role—he's not&amp;nbsp;a Wikimedian, like me, but his encouragement has helped me change Odia Wikipedia and participate in community activities.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;I believe that&amp;nbsp;knowledge about&amp;nbsp;Odia language and literature needs to improve—there are many misconceptions and knowledge gaps—so, I help organize events and workshops for Odia Wikipedia. On my accomplished list at the point, I have:&lt;/p&gt;
&lt;li style="text-align: justify;"&gt;initiated three major edit-a-thons in Odia Wikipedia: Women's Day 2015, Women's Day 2016, abd&amp;nbsp;&lt;a href="https://or.wikipedia.org/s/toq" target="_blank"&gt;Nabakalebara edit-a-thon 2015&lt;/a&gt;&lt;/li&gt;
&lt;li style="text-align: justify;"&gt;initiated&amp;nbsp;a photograph contest to get more&amp;nbsp;&lt;a href="https://commons.wikimedia.org/wiki/Commons:The_Rathyatra_Challenge" target="_blank"&gt;Rathyatra&lt;/a&gt; images from all over the India&lt;/li&gt;
&lt;li style="text-align: justify;"&gt;represented Odia Wikipedia during&amp;nbsp;two events by Google (&lt;a href="http://cis-india.org/openness/blog-old/odia-wikipedia-meets-google-developer-group" target="_blank"&gt;Google I/O extended&lt;/a&gt; and Google Dev Fest)&lt;/li&gt;
&lt;li style="text-align: justify;"&gt;spoke at&amp;nbsp;&lt;a href="http://perception.cetb.in/events/odia-wikipedia-event/" target="_blank"&gt;Perception&lt;/a&gt; 2015 and the first&amp;nbsp;&lt;a href="https://opencon2015kolkata.sched.org/speaker/sailesh.patnaik007" target="_blank"&gt;Open Access India&lt;/a&gt; meetup&lt;/li&gt;
&lt;p style="text-align: justify;"&gt;I was just an editor to Wikipedia projects until last year, in January 2015, when I attended&amp;nbsp;&lt;a href="https://meta.wikimedia.org/wiki/Bengali_Wikipedia_10th_Anniversary_Celebration_Kolkata" target="_blank"&gt;Bengali Wikipedia's 10th anniversary conference&lt;/a&gt; and &lt;a href="https://www.facebook.com/vishnu.vardhan.50746?fref=ts" target="_blank"&gt;Vishnu&lt;/a&gt;,&amp;nbsp;the&amp;nbsp;director of the&amp;nbsp;&lt;a href="http://cis-india.org/" target="_blank"&gt;Center for Internet and Society&lt;/a&gt; at the time,&amp;nbsp;invited me to attend&amp;nbsp;the&amp;nbsp;&lt;a href="https://meta.wikimedia.org/wiki/CIS-A2K/Events/Train_the_Trainer_Program/2015" target="_blank"&gt;Train the Trainer Program&lt;/a&gt;.&amp;nbsp;I was inspired to&amp;nbsp;start doing&amp;nbsp;outreach for Odia Wikipedia and hosting&amp;nbsp;meetups&amp;nbsp;for &lt;a href="https://en.wikipedia.org/wiki/Wikipedia:GLAM" target="_blank"&gt;GLAM&lt;/a&gt; activities and training new Wikimedians. These experience taught me&amp;nbsp;how to work with a community of contributors.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;&lt;a href="https://www.facebook.com/ravidreams?fref=ts" target="_blank"&gt;Ravi&lt;/a&gt;, the director of Wikimedia India at the time, also played an important role in my journey.&amp;nbsp;He trusted me and made me a part of &lt;a href="https://commons.wikimedia.org/wiki/Commons:Wiki_Loves_Food" target="_blank"&gt;Wiki Loves Food&lt;/a&gt;,&amp;nbsp;a public photo competition on Wikimedia Commons, and the&amp;nbsp;organizing committee of &lt;a href="https://meta.wikimedia.org/wiki/WikiConference_India_2016" target="_blank"&gt;Wikiconference India 2016&lt;/a&gt;.&amp;nbsp;During Wiki Loves Food 2015, my team helped add&amp;nbsp;10,000+ CC BY-SA images on Wikimedia Commons. Ravi further solidified my commitment by sharing a lot of information with me about the Wikimedia movement, and his own journey, during&amp;nbsp;&lt;a href="https://or.wikipedia.org/s/sml" target="_blank"&gt;Odia Wikipedia's 13th anniversary&lt;/a&gt;.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Less than a year later, in December 2015, I became&amp;nbsp;a Program Associate at the&amp;nbsp;Center&amp;nbsp;for Internet and Society's &lt;a href="https://meta.wikimedia.org/wiki/CIS-A2K" target="_blank"&gt;Access to Knowledge program&lt;/a&gt; (CIS-A2K). One of my proud moments was at a&amp;nbsp;workshop&amp;nbsp;in&amp;nbsp;Puri, India where we&amp;nbsp;helped bring 20 new Wikimedian editors to the&amp;nbsp;Odia Wikimedia community. Now, I mentor Wikimedians during an informal meetup called &lt;a href="https://or.wikipedia.org/s/xgx" target="_blank"&gt;WikiTungi&lt;/a&gt; Puri. I am working with this group to make Odia Wikiquotes a live project. I am&amp;nbsp;also dedicated to bridging&amp;nbsp;the gender gap in Odia Wikipedia.&amp;nbsp;&lt;a href="https://or.wikipedia.org/s/ysg" target="_blank"&gt;Eight female editors&lt;/a&gt; are now helping&amp;nbsp;to organize&amp;nbsp;meetups and&amp;nbsp;workshops,&amp;nbsp;and participate in&amp;nbsp;the&amp;nbsp;&lt;a href="https://or.wikipedia.org/s/ynj" target="_blank"&gt;Women's History month edit-a-thon&lt;/a&gt;.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;During my brief but action-packed journey during the four years since,&amp;nbsp;I have also been involved in the&amp;nbsp;&lt;a href="https://outreach.wikimedia.org/wiki/Education" target="_blank"&gt;Wikipedia Education Program&lt;/a&gt;,&amp;nbsp;the&amp;nbsp;&lt;a href="https://outreach.wikimedia.org/wiki/Talk:Education/News#Call_for_volunteers" target="_blank"&gt;newsletter team&lt;/a&gt;, and&amp;nbsp;two global edit-a-thons:&amp;nbsp;&lt;a href="https://en.wikipedia.org/wiki/User_talk:Saileshpat#Barnstar_for_Art_.26_Feminism_Challenge" target="_blank"&gt;Art&amp;nbsp;and Feminsim&lt;/a&gt; and &lt;a href="https://opensource.com/life/15/11/tasty-translations-the-open-source-way" target="_blank"&gt;Menu Challenge&lt;/a&gt;. &lt;p style="text-align: justify; "&gt;The author has analysed all the data received through which, the author seeks to trace the presence of unjustified underutilisation of funds by the aforementioned university as provided by the MHRD during the period of 2013-2014. To collect the information for the given study, an RTI application was filed to NLSIU on 17/11/2014 by the Centre for Internet and Society. &lt;h3&gt;Comparative Analysis between University Response and the guidelines of MHRD Scheme Document&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The Scheme Document of MHRD (http://copyright.gov.in/Documents/scheme.pdf) is a comprehensive document which consists of guidelines regarding Intellectual Property Education, Research and Public Outreach. It talks about a list of objectives, purposes, conditions and eligibility criteria for a University to ensure in order to implement IPERPO in a truest sense. This document provides the procedural as well as qualifying conditions for an Institute to ensure or fulfil before applying for the MHRD grant. Some of these conditions include maintenance of utilization certificates, audit reports, expenditure statements and event information which would be open to access on demand by MDHR or Comptroller and Auditor General of India.&lt;/p&gt;
&lt;p&gt;A. Objectives &lt;br /&gt; In order to fulfil the objectives mentioned in the scheme document, NLSIU undertook following activities:&lt;/p&gt;
&lt;ol&gt;
&lt;li&gt;Introduction of UG and PG level courses on IPR&lt;/li&gt;
&lt;li&gt;Introduction of PhD fellowships in the field of IPR.&lt;/li&gt;
&lt;li&gt;Conducting multiple workshops over the years to further the training of teachers as well as at a student level&lt;/li&gt;
&lt;li&gt;Hosting numerous conclaves on the subject of IPR and their relation to business &lt;/li&gt;
&lt;li&gt;Providing short term course on training of teachers in the field of IPR&lt;/li&gt;
&lt;li&gt;Held various symposiums, seminars and conferences for the furtherance of IPR&lt;/li&gt;
&lt;li&gt;Invited esteemed professors from the field for guest lectures&lt;/li&gt;
&lt;li&gt;Established an IPR library in the IPR cell&lt;/li&gt;
&lt;li&gt;Website on IPR launched&lt;/li&gt;
&lt;/ol&gt;
&lt;p&gt;B. Eligibility &lt;br /&gt; NLSIU is recognized by the University Grants Commission. Therefore, it fulfils the eligibility criteria mentioned in the scheme document.&lt;/p&gt;

&lt;h3&gt;Comparative Analysis between University Response and the guidelines of MHRD Scheme Document&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;The Scheme Document of MHRD (http://copyright.gov.in/Documents/scheme.pdf) is a comprehensive document which consists of guidelines regarding Intellectual Property Education, Research and Public Outreach. It talks about a list of objectives, purposes, conditions and eligibility criteria for a University to ensure in order to implement IPERPO in a truest sense. This document provides the procedural as well as qualifying conditions for an Institute to ensure or fulfil before applying for the MHRD grant. Some of these conditions include maintenance of utilization certificates, audit reports, expenditure statements and event information which would be open to access on demand by MDHR or Comptroller and Auditor General of India.&lt;/p&gt;
&lt;p&gt;A. Objectives &lt;br /&gt; In order to fulfil the objectives mentioned in the scheme document, NLU Jodhpur undertook following activities:&lt;/p&gt;
&lt;ol&gt;
&lt;li&gt;Introduction of UG and PG level courses on IPR&lt;/li&gt;
&lt;li&gt;Conducting lecture series on the subject of IPR.&lt;/li&gt;
&lt;li&gt;Conducting multiple workshops over the years to further the training of teachers as well as at a student level&lt;/li&gt;
&lt;li&gt;Hosting numerous conclaves on the subject of IPR and their relation to business &lt;/li&gt;
&lt;li&gt;Providing short term course on training of teachers in the field of IPR&lt;/li&gt;
&lt;li&gt;Held various symposiums, seminars and conferences for the furtherance of IPR&lt;/li&gt;
&lt;li&gt;Invited esteemed professors from the field for guest lectures&lt;/li&gt;
&lt;li&gt;Established an IPR library in the IPR cell&lt;/li&gt;
&lt;/ol&gt;
&lt;p&gt;B. Eligibility &lt;br /&gt; NLU, Jodhpur is recognized by the University Grants Commission. Therefore, it fulfils the eligibility criteria mentioned in the scheme document.&lt;/p&gt;

Following the inadequacy of the response by the institute, the Centre for Internet and Society filed a second RTI application on 09/02/2015. The reply to this application was received on 12/03/2015. &lt;p style="text-align: justify; "&gt;The Scheme Document of MHRD (http://copyright.gov.in/Documents/scheme.pdf) is a comprehensive document which consists of guidelines regarding Intellectual Property Education, Research and Public Outreach. It talks about a list of objectives, purposes, conditions and eligibility criteria for a University to ensure in order to implement IPERPO in a truest sense. This document provides the procedural as well as qualifying conditions for an Institute to ensure or fulfil before applying for the MHRD grant. Some of these conditions include maintenance of utilization certificates, audit reports, expenditure statements and event information which would be open to access on demand by MDHR or Comptroller and Auditor General of India.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;A. &lt;h2&gt;Introduction&lt;/h2&gt;
&lt;p&gt;From a brief exploration of the problem of new objects and methods of research in the digital context, we have come to or rather returned to the problem of location or contextualising DH, and whether it may be called a field or discipline in itself, in India. As the previous sections may have illustrated, most of the prominent initiatives around DH in India have largely been within the university context, or have at least focused around the university as the centre of the processes of knowledge production, and emphasise a move away from more traditional ways of doing humanities, and at a larger level the more established and disciplinary modes of knowledge formation. In the context of pedagogy, DH seems to be developing in a very specific role, which is that of training in a certain set of skills and topics, which the existing disciplines have so far not been able to provide or even accommodate. These include tools for working with digitisation processes, digital archives, and the use of computational methods in the study of cultural artifacts. Thus processes such as topic modelling, data visualisation, cultural analytics, sentiment analysis and several more become increasingly prominent in discussions about DH. The university or more specifically the traditional classroom offers a particular kind of teaching-learning experience which may not always have within its ambit the necessary resources or strategies to foster new methods of knowledge production, and a lot of DH work has been posited as trying to plug knowledge gaps in precisely this area.&lt;/p&gt;
&lt;p&gt;Wikipedia and internet-based sources of information are entering classrooms with the proliferation of gadgets and tools, and with this there is a tendency towards adopting a more open, participatory and customised model of learning based on collaboration. DH has been characterised by many as a space, or method that intervenes in the traditional ‘hierarchies of expertise’ (Davidson and Goldberg, 2010) – not only in terms of people, but also spaces, methods and objects of learning - to present a significant ‘alternative’ that is now slowly becoming more mainstream. A rather direct example of this in the global discourse on DH is the growth of a number of ‘alt- academics’ &lt;strong&gt;[1]&lt;/strong&gt;: people with training in the humanities who now inhabit what earlier seemed to be a rather nebulous space between academics and an array of practices in computing, art and community development among many others. But it is the in-between, or the liminal space that holds the potential for new kinds of knowledge to be generated. The connotations of this notion however are many and problematic, as seen particularly in the emphasis on new kinds of skills or competences that are now required to inhabit such a space, as also the narrative of loss of certain critical skills that are part of the disciplinary method and the resistance from certain quarters within the university to acknowledge such a trend. Conversely, it is also reflective of how certain kinds of skills in writing, reading, visualisation and curation have now become essential and therefore visible. While the DH discourse in India has developed mostly within the university space, given its multidisciplinary interests and methods, it is often seen as bearing potential in terms of working outside the academic norm. Through an examination of changes in teaching-learning methods, creative and critical practices that come about with the adoption of the digital, it may be useful to explore whether it indeed opens up such alternate modes of humanities practice and how it informs the way we do DH in India; as practitioners, researchers, students, teachers or the lay person. The growth of the internet and digital tools and technologies has led to many changes in teaching-learning practices, and engendered new methods and forms of humanities practice, all of which may now be found within the university or academic space. It is therefore imperative to examine these new modes of research and practice, to arrive a better understanding of the changes in and possibilities available for humanities work after the digital. The notion of the ‘alternate’ is also an important concern here, and the emergence of these new modes of humanities practice help unpack and understand this term better.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;Technology in the Classroom&lt;/h2&gt;
&lt;p&gt;This state of being within and to a certain extent outside of a certain predominant discourse is a peculiar one with several possibilities, and DH, owing to its interdisciplinary content and methods, seems to be a suitable space to foster new and alternate knowledge-making practices. India is also still a multi-layered technological space very much in a moment of transition, and the debates remain largely confined to the English and History departments and to some extent library and archival spaces. Outside of the university circle however, there are a number of initiatives, such as online archival efforts, media, art and design practices and research, where one may see DH–related work being done. What remains an important part of the discourse in the context of the university is the access to and a more substantial and critical engagement with technology in the classroom.&lt;/p&gt;
&lt;p&gt;The use of technology in education has grown by leaps and bounds in the last decade or so in India, as evidenced by the number of initiatives taken to introduce ICTs in the classroom &lt;strong&gt;[2]&lt;/strong&gt;. However, the digital divide still persists, as a result of which many initiatives come with problems of their own, the most important being the lack of connection among practice, content and pedagogy &lt;strong&gt;[3]&lt;/strong&gt;. Vikram Vincent, a doctoral scholar in the Interdisciplinary Program in Educational Technology, Indian Institute of Technology, Mumbai, attributes this to a problem of understanding technology itself and what it can do for learning. He looks at technology as an extension of the human body and not something alien to it. Over the course of his research, he has found that the prevalent attitude to the use of technology in the classroom, particularly in early ICTs in education projects, has been more techno-centric rather than learner-centric, which is not the most effective approach &lt;strong&gt;[4]&lt;/strong&gt;. Technology has always been around in some form or the other, from drawing on walls to the blackboard to now the smart board; it has always been in the classroom. How you choose to use it determines the outcomes, and one needs to ensure that the learning environment evolves with the new technology that is introduced, because it does not happen automatically but over a period of time.&lt;/p&gt;
&lt;p&gt;The Wikipedia India Education programme pilot project, implemented in Pune in 2011 is an example of the number of challenges that the introduction of a new technology in the classroom brought forth, in terms of skills, content and pedagogy &lt;strong&gt;[5]&lt;/strong&gt;. The need to focus on the educational component of the technology, the improvement of skills of the learner in writing, research and communication, rather than on the tool itself has been an important learning from the programme, even as it continues in a different university today. As Vincent adds further, the problem arises with looking at technology as a disruptive element or merely a tool to aid learning, which prevents institutions from envisioning a more holistic model of learning that takes some amount of time and effort. This also requires the appropriate stimulus and other conditions such as training of teachers, access to resources and training in certain required skills, addressing barriers of language and so forth, which is a feature of some programmes, such as the IT @ school in Kerala which have seen a measure of success &lt;strong&gt;[6]&lt;/strong&gt;. Vincent further mentions examples of programmes he has been part of, some of them under the MHRD-NMEICT initiative which focussed on the teaching-learning process rather than the technology itself, key to which is building teacher capacity to use new and already available resources better &lt;strong&gt;[7]&lt;/strong&gt;. These would be crucial steps to take before envisioning a model of teaching-learning that is premised largely on digital technologies and the internet.&lt;/p&gt;
&lt;p&gt;While educational technology is a separate field in itself which looks at better interactions between teaching-learning practices and technology &lt;strong&gt;[8]&lt;/strong&gt;, it does form part of the context, or landscape in India within which DH would perhaps develop as a discipline, practice or a pedagogic approach.&lt;/p&gt;
&lt;p&gt;Another predominant discourse that informs DH is that of Information Communication Technologies for Development (ICT4D) which is often used as a rather broad, catch-all term, and has been variously defined and used by different groups and stakeholders across domains (Saith et al, 2008). ICT4D is premised largely around the question of access, and seeks to bridge the digital divide in terms of knowledge, resources, people and infrastructure, among other things. This has also been an intensely debated term, given its social and political implications, particularly in the manner in which it informs a larger discourse on development, technology and globalisation in the global South.(Sundaram, 2005)  It is important to understand whether DH has been posited as making an intervention into these prevailing systems of knowledge – so that the mode of understanding both technology and the humanities, and the interaction between the two domains (assuming that they are separate) undergoes a significant change. What then goes into promoting more institutional stability for DH, in other words, in teaching and learning it – will be a question to contend with in the years to come, as more universities take to incubating research around digital technologies and related components and incorporating this into the existing curricula.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;Towards a Digital Pedagogy&lt;/h2&gt;
&lt;p&gt;Dr. Abhijit Roy, Assistant Professor at the Department of Media, Communication and Culture, Jadavpur University is positive about the changes he sees in pedagogy and research with the advent of digital technologies. According to him, while a media or film studies department would be close to the concerns of DH, and use some form of digital technology such as video clips or blogs as part of coursework, it is particularly important to see what change it has brought about in traditional humanities disciplines like History and languages. While some of these changes are elementary, such as the use of digital technologies in classroom teaching and learning exercises, it is in the practice of research that he sees a vast change now. Many researchers, many of his students also, have found this a useful part of the research process, through the use of blogs and social media and the possibilities to publish and engage in discussions with other researchers through platforms and tools like Academia or Scalar &lt;strong&gt;[9]&lt;/strong&gt;. It not only makes the process more transparent, but also encourages an ethos of constant sharing, dissemination and a network of usage and storage online. This has transformed the way research and pedagogy can be imagined now, and opened up several possibilities for teaching-learning practices.&lt;/p&gt;
&lt;p&gt;It is in realising this potential for new research and pedagogical models that universities have slowly begun to adopt digital technologies, but the institutional efforts at building curricula specifically around DH-related concerns have been few, with the prominent ones in India being the courses at Jadavpur University and Presidency University in Kolkata, and more recently Srishti School of Arts, Design and Technology in Bangalore. The change is recent, as several researchers have pointed out. There have always been concerns about privacy and regulation of content, whether on a university archive or its network. The enthusiasm towards ‘anything digital is good’ is relatively new, and comes from a larger (and sometimes rather utopian) development discourse focussed around modernity and technology. Curricularisation comes with its own issues too, and they stem largely from the fact that one is still unable to understand fully the nature of the digital and its facets - we also inhabit a time when there is a transition from analogue to digital, and both modes exist simultaneously - but the rate of change is faster with the digital than with other domains of knowledge, so much so that the curricula developed may often seem provisional or arcane, which makes it doubly challenging to demonstrate its various facets in practice, particularly in the classroom. A useful distinction would be between DH being brought in as a problem-solving approach to address the extant issues of the humanities, thus also seen as threat to the disciplines themselves, but to see if it has its own epistemological concerns which may be related to but also distinct from the humanities - in short to help us ask new questions, or provide new ways of asking old ones.&lt;/p&gt;
&lt;p&gt;The development of courses on DH in three universities in India, and the manner in which the field has been ‘curricularised’ so to say, would be an indication of its specific academic concerns in the Indian context, and the disciplinary challenges and questions that it may throw up for the teaching-learning process. Expectedly, the three courses mobilise a set of resources and expertise that the schools have built over the course of many years. In doing so they also foray into areas that existing humanities courses at the university may not have explored enough, within their own disciplinary framework. For example the course on Digital Humanities and Cultural Informatics at Jadavpur University &lt;strong&gt;[10]&lt;/strong&gt; comprises of components on software studies and digital music preservation, building on work done at the large archives at the School of Cultural Texts and Records. Similarly, the course at Presidency University &lt;strong&gt;[11]&lt;/strong&gt; has components on storytelling in digital media through video games, while the course at Srishti &lt;strong&gt;[12]&lt;/strong&gt; has a focus on design practice and critical making amongst other interests. The courses therefore follow a decidedly interdisciplinary framework, which no doubt interesting, also makes curriculum development and course assessment a challenge. While the ‘digital’ aspect of ‘DH’ forms a significant part of these explorations, the manner in which it is being studied is an important point of focus – whether as a condition, space, concept or object, rather than just a set of tools and methods that facilitate the enquiry of the humanities. Digitisation significantly alters the cultural artifact, and there is a need to understand and theorise this digital object better. As Padmini Ray Murray points out, the digital is one way to mediate the material object, particularly those that are not textual, since that kind of experiential access can only be provided by the digital, especially in the case of archival objects. A critical understanding of the digital needs to therefore be a key aspect of such an enquiry in DH.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;Alternate Spaces of Humanities Practice&lt;/h2&gt;
&lt;p&gt;While these are the developments within academia or the university space, there are a number of spaces outside this circle that have also been asking similar questions, and producing new kinds of scholarship and research around these ideas. The Indiancine.ma and Pad.ma archives have not only served as rich repository of material on film and video, used by scholars and film enthusiasts alike, but also as a pedagogic tool in spaces like the Media Lab at Jadavpur University. Through an innovative fellowship programme, Pad.ma has supported research and film making using the archive as a platform. An interesting example here would be a documentary film on power plants in Chhattisgarh made by Sunil Kumar. Available as a film treatment/script on Pad.ma, Kumar’s work is based on research in mainly two districts of Chhattisgarh, where he met and spoke with people, collected documents and shot several hours of video, which he then published in the form of 80 footage series on Pad.ma &lt;strong&gt;[13]&lt;/strong&gt;. There are several other examples on Pad.ma, such as the video-art project on the Radia tapes, and the work on "perfume arts" in Bangalore &lt;strong&gt;[14]&lt;/strong&gt;. The Sound and Picture Archives for Research on Women (SPARROW) through its workshops on oral and visual history has tried to engage with the more pedagogic aspects of the archive &lt;strong&gt;[15]&lt;/strong&gt;. While the possibilities are many, the uptake of such platforms in universities has been slow, due to issues that range from lack of internet connectivity to a discomfort or unfamiliarity with the internet and other kinds of technology. This eventually relegates initiatives like these to the space of an alternate, extracurricular or outlier, even though they seem to be asking the same questions as the mainstream institutions and doing similar work.&lt;/p&gt;
&lt;p&gt;What this also refers to is the space for new modes of knowledge production that an increased interaction with digital and internet technologies now engenders or even brings to the fore in already existing practices. With these however, also come the questions about the legitimacy of these forms and methods of knowledge production, as seen in the rather polarised positions around DH in its global discourse. The Wikipedia is one example of this, and illustrates some of the core concerns of and about DH as it calls into question notions about authorship, expertise and established models of pedagogy and learning. Lawrence Liang (2011) describes this as a larger conflict over the authority of knowledge, the origins of which he locates in the history of the book, and specifically in the print revolution and pre-print cultures of the 15th -18th centuries. He likens the debate over Wikipedia’s credibility, or more broadly over technologies of collaborative knowledge production ushered in by the Internet to similar phenomena seen before in early print culture and how it contributed to the construction and articulation of the idea of authority itself. He says:&lt;/p&gt;
&lt;blockquote&gt;The authority of knowledge is often spoken of in a value-neutral and ahistorical manner. It would therefore be useful to situate authority in history, where it is not seen to be an inherent quality but a transitive one 6 located in specific technological changes. For instance, there is often an unstated assumption about the stability of the book as an object of knowledge, but the technology of print originally raised a host of questions about authority. In the same way, the domain of digital collaborative knowledge production raises a set of questions and concerns today, such as the difference between the expert and the amateur, as well as between forms of production: digital versus paper and collaborative versus singular author modes of knowledge production. Can we impose the same questions that emerged over the centuries in the case of print to a technology that is barely ten years old?&lt;/blockquote&gt;
&lt;p&gt;He further goes on to elaborate that the question of the authority of knowledge should ideally be located within a larger ‘knowledge apparatus’, comprising of certain technologies and practices, (in this case that of reading, writing, editing, compilation, classification and creative appropriations) which help inflate the definitions of authority and knowledge even more.&lt;/p&gt;
&lt;p&gt;The above argument throws into sharp relief the notion of the ‘alternate’–often posited as the outlier or a vantage point, or even as being in resistance to a certain dominant discourse or body of knowledge. While resistance itself is discursive; the ‘alternate’ has also always existed in various forms,  such as the pre-print cultures illustrated in the argument above, and particularly in India where several kinds of prominent practices and occupations are but alternatives - from alternative medicine to education - to the already established or mainstream system in place. As mentioned earlier, these practices may just be increasingly visible and acknowledged now. The attempts to subsume these alternate practices under a unifying term such as DH, which began as and may perhaps have been relegated to the status of a sub-culture for long, within academia then seem to be one way of trying to circumvent the authority of knowledge question.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;Humanities and Technology: A Twinned History&lt;/h2&gt;
&lt;p&gt;Another factor in this reduced visibility of the alternate and now re-emergence is the invisible ‘technologised’ history of the humanities, which prompts us to rethink the separation between the humanities and technology as mutually exclusive domains. Therefore by extension then, the term DH itself may be a misnomer or yet another creative re-appropriation of various knowledge practices already in existence. David Berry (2012) in his essay on the computational turn speaks of possibilities that computationality, and specifically new software and code offer in terms of unifying multiple kinds of knowledge in the university. He says that:&lt;/p&gt;
&lt;blockquote&gt;In trying to understand the digital humanities our first step might be to problematize computationality, so that we are able to think critically about how knowledge in the 21st century is transformed into information through computational techniques, particularly within software. It is interesting that at a time when the idea of the university is itself under serious rethinking and renegotiation, digital technologies are transforming our ability to use and understand information outside of these traditional knowledge structures. This is connected to wider challenges to the traditional narratives that served as unifying ideas for the university and, with their decline, has led to difficulty in justifying and legitimating the postmodern university vis-à-vis government funding. (5)&lt;/blockquote&gt;
&lt;p&gt;Berry therefore indicates that this turn towards computationality is the result of an emerging need to demonstrate the relevance of the university structure to processes of knowledge production, therefore reiterating the ‘crisis’ argument. The notion of the postmodern university has been examined in detail by Bill Readings, who Berry quotes in his paper. Readings (1997) is sceptical of the term postmodern, preferring instead the idea of a post historical university, which is divested from the notion of the nation-state and further culture as a unifying idea, and is moving towards a notion of excellence that he sees as techno-bureaucratic, a result of several factors including globalisation and the fact that processes of knowledge production and institutionalisation are no longer centred around a liberal subject. If the demonstrated project of the university has changed, the emergence of such new discourse, and specifically concepts and terms such as the ‘alt – academy’ has relevance to how one may now imagine new spaces, objects, processes and figures of knowledge itself.&lt;/p&gt;
&lt;p&gt;The significance of the university system to knowledge production has been a recurring point of much debate and discussion in India. Although not explicitly stated as a crisis in humanities by the people interviewed, there are problems of content, pedagogy, infrastructure, and vision that continue to plague higher education at large &lt;strong&gt;[16]&lt;/strong&gt;, and very often technological fixes are seen as a solution to these, in some part due to the imagination of a techno-democracy as described in the introduction to this report. As Berry points out then, computationality is a promise, or possibility to do things differently, which is then also inherently assumed to be a way of doing things better. The computational possibilities of DH still need to be explored, but how much of these contribute qualitatively to addressing or even furthering certain disciplinary concerns, still remains an open question. As Jan and Sebastian point out from their experience of working on Indiancine.ma and Pad.ma, the computational aspects of the archives are still to be developed, as there are still restrictions in terms of speed and feasibility (see chapter on infrastructure &lt;strong&gt;[17]&lt;/strong&gt;); the kind of new questions it produces for cinema studies at large will remain a contention. Further, as Padmini Ray Murray observes, drawing on archival material, or data to develop new computational hypotheses would be a direction to work towards, as not much work has been done in this respect in India (See chapter on archives &lt;strong&gt;[18]&lt;/strong&gt;). The challenges with computationality then demand, as Berry argues, a more critical exploration of the term itself, and in fact can be extended to a critical analysis of the state of digitality more broadly.&lt;/p&gt;
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;h2&gt;Final Notes&lt;/h2&gt;
&lt;p&gt;The problems with the crisis in the humanities and the contribution of technology to these changes could be located to this change in what has traditionally been seen as the space of culture and reason, which has now moved on to something else, a notion of excellence in Readings’ example, thereby changing the questions at the centre as well. This is perhaps the underlying challenge to the ontological and epistemological stake in the field. At best then DH may be seen as the result of a set of changes in the last couple of decades, the advancements in technology being at the forefront of them, whereby certain new and alternative modes of humanities practice have been brought to the foreground, but have also challenged the manner in which we asked questions before to a certain extent. As the field gains institutional stability, it remains to be seen what the new areas of enquiry that emerge shall then be in the years to come. Some of the questions or points or focus that open up are as follows:&lt;/p&gt;
&lt;ol&gt;&lt;li&gt;The role of extra-institutional/non-academic or alternate spaces in humanities practice, and in producing and creating new kinds of knowledge.&lt;/li&gt;
&lt;li&gt;The increased visibility of new objects and methods within informal and marginal spaces of knowledge production. This demands different, and often innovative methods of enquiry, and whether they alter disciplinary modes of humanities practice and research.&lt;/li&gt;
&lt;li&gt;The notion of a moving away from established modes of humanities practice, research and scholarship (therefore the question of a ‘crisis’) which would open up a larger debate around the authority of knowledge.&lt;/li&gt;
&lt;li&gt;The ontological and epistemological stake of DH, in short the kinds of new questions it enables us to ask.&lt;/li&gt;&lt;/ol&gt;
&lt;p&gt;As important and visible as the idea of the alternate is in DH, it also presents the mainstream itself as fractured space that imbibes several contradictions of the practices in question, which cannot be confined to these watertight silos of formal/informal, academic or creative. Nevertheless, the mainstream spaces remain crucial for widening and deepening creative digital practice and research in arts and humanities disciplines, and will be the spaces to watch to understand the development of a substantive DH discourse in India.&lt;/p&gt;
