CIS’ Efforts Towards Greater Financial Disclosure by ICANN

CIS has been working towards enhancing transparency and accountability at ICANN since 2014. While initial efforts have resulted in ICANN revealing its sources of income in a granular fashion in 2015, we are yet to see this level of transparency become a default approach within ICANN. Here, Padma Venkataraman chronologically maps CIS’ efforts at enhancing financial transparency and accountability at ICANN, while providing an outline of what remains to be done.

With the $135 million sale of .web,^[1] the much protested renewal of the .net agreement^[2] and the continued annual increase in domain name registrations,^[3] among other things, it is no surprise that there are still transparency and accountability concerns within the ICANN Community. CIS, as part of its efforts to examine the functioning of ICANN’s accountability mechanisms, has filed many DIDP requests till date, in a bid for greater transparency of the organisation’s sources of revenues.

In 2014, CIS’ Sunil Abraham demanded greater financial transparency of ICANN at both the Asia Pacific IGF and the ICANN Open Forum at the IGF. Later that year, CIS was provided with a list of ICANN’s sources of revenue for the financial year 2014, including payments from registries, registrars, sponsors, among others, by ICANN India Head Mr. Samiran Gupta.^[4] This was a big step for CIS and the Internet community, as before this, no details on granular income had ever been publicly divulged by ICANN on request.

However, as no details of historical revenue had been provided, CIS filed a DIDP request in December 2014, seeking financial disclosure of revenues for the years 1999 to 2014, in a detailed manner - similar to the 2014 report that had been provided.^[5] It sought a list of individuals and entities who had contributed to ICANN’s revenues over the mentioned time period.

In its response, ICANN stated that it possessed no documents in the format that CIS had requested, that is, it had no reports that broke down domain name income and revenue received by each legal entity and individual.^[6] It stated that as the data for years preceding 2012 were on a different system, compiling reports of the raw data for these years would be time-consuming and overly burdensome. ICANN denied the request citing this specific provision for non-disclosure of information under the DIDP.^[7]

In July 2015, CIS filed a request for disclosure of raw data regarding granular income for the years 1999 to 2014.^[8] ICANN again said that it would be a huge burden ‘to access and review all the raw data for the years 1999 to 2014 in order to identify the raw data applicable to the request’.^[9] However, it mentioned its commitment to preparing detailed reports on a go-forward basis - all of which would be uploaded on its Financials page.^[10]

To follow up on ICANN’s commitment to granularity, CIS sought a detailed report on historical data for income and revenue contributions from domain names for FY 2015 and FY 2016 in June 2017.^[11] In its reply, ICANN stated that the Revenue Detail by Source reports for the last two years would be out by end July and that the report for FY 2012 would be out by end September.^[12]

2.The need for granularity regarding historical revenues

In 2014, CIS asked for disclosure of a list of ICANN’s sources of revenue and detailed granular income for the years 1999 to 2014. ICANN published the first but cited difficulty in preparing reports of the second. In 2015, CIS again sought detailed reports of historical granular revenue for the same period, and ICANN again denied disclosure claiming that it was burdensome to handle the raw data for those years. However, as ICANN agreed to publish detailed reports for future years, CIS recently asked for publication of reports for the FYs 2012, 2015 and 2016. Reports for these three years were uploaded according to the timeline provided by ICANN.

CIS appreciates ICANN’s cooperation with its requests and is grateful for their efforts to make the reports for FYs 2012 to 2016 available (and on a continued basis). However, it is important that detailed information of historical revenue and income from domain names for the years 1999 to 2014 be made publicly available. It is also crucial that consistent accounting and disclosure practices are adopted and made known to the Community, in order to avoid omissions of statements such as Detail Revenue by Source and Lobbying Disclosures, among many others, in the annual reports - as has evidently happened for the years preceding 2012. This is necessary to maintain financial transparency and accountability, as an organisation’s sources of revenues can inform the dependant Community about why it functions the way it does.

It will also allow more informed discussions about problems that the Community has faced in the past and continues to struggle with. For example, while examining problems such as ineffective market competition or biased screening processes for TLD applicants, among others, this data can be useful in assessing the long-term interests, motives and influences of different parties involved.

CIS-A2K Narrative Report (September 2012 – June 2013)

Background to the Access to Knowledge Programme

The Wikimedia Foundation approved a grant to support the growth of Indian language Wikimedia communities to the Centre for Internet & Society (CIS) to expand their Access to Knowledge program (A2K) in India. The grant enabled CIS to work with the Wikimedia community of volunteers in India to expand upon Wikimedia’s Indic language free knowledge projects, including Wikipedia in Indic languages. Further, the grant aims to generate improvements in India-relevant free knowledge in Wikimedia’s English projects and wider distribution of Wikimedia’s free knowledge within India.

Section A: Introduction

Objective of the Narrative Report

This narrative report captures the work done by the A2K program during the period of September 2012 to June 2013. It examines projects and activities and its impact and outcomes over a period of the initial Ten months of the Grant. This report will also inform CIS-A2K program’s strategy for the next one year to achieve the goals set out by its donor, Wikimedia Foundation, and goals listed in our Work Plans (which were developed in consultation with the Wikimedia community in India). Importantly, this Narrative Report is critical for the Wikimedia community in India, Global Wikimedia community and the Wikimedia Foundation to get a comprehensive overview of A2K’s work and to critically assess the A2K program’s eligibility for further support.

Context

Though the mandate of the CIS-A2K program was clearly articulated before the commencement of the program, it should be noted, that the context in which the program had to undertake its work was very disturbed. Majority of the Wikimedia community in India saw CIS-A2K as an extension of the India Program as the entire team of the India Program moved into the CIS’s A2K program, except for the Director. Thus the CIS-A2K program inherited the not so conducive image of the India Program that was operational until August 2012. It should be noted that by August 2012, the Wikimedia community in India was extremely critical of the India Program’s work and achievement.[1]

Further, the community explicitly expressed lack of faith and Trust in the India Program’s method of work.[2] Thus, it is important to note that the CIS-A2K program did not start with a clean slate but had to first address multiple challenges, before it could take on active implementation of various programmatic activities. These challenges include:

building trust with the Wikimedia community in India;
building a collaborative relationship with Wikimedia India Chapter;
finding a new leadership to anchor the program that was left vacant in August 2012.

A2K Program Achievements (September 2012 to June 2013)

CIS Access to Knowledge (A2K) team started working on facilitating the improvement of Indian language Wikimedia projects with special focus on Indic Wikipedias in September 2012. Some key activities during the period of September 2012 to June 2013 are:

CIS hired A2K Programme Director, T. Vishnu Vardhan, through an open and multi-stakeholder process of selection.[3] Representatives from Wikimedia India Chapter, Wikimedia community in India and Wikimedia Foundation were actively part of the selection process. This process was extremely critical and ensured participation of the Wikimedia community in India and the WMIN Chapter in deciding the leadership of the program.

Noted academician Dr. Tejaswini Niranjana was hired as Adviser to A2K.[4] This was done upon the request of the selection committee that was constituted for the selection of the program Director and in consultation with the WMF.

A2K proactively interacted with the WMIN Chapter Executive Committee and built collaborative working relationship.
Most of the A2K programs executed in collaboration with WMIN Chapter and community.
Began a new project on visualisation of the growth of Indic Wikipedias [5] [6] Sajjad Anwar and Sumandro are working on this. Two blog posts have been published so far. This was appreciated by the Wikimedia community in India and the WMF. Further, the WMF has expressed interest in extending these visualizations at a global level.
A2K has successfully reached out to the Wikipedians across Indian Language communities through conducting outreach programs, resolving technical bugs, supporting with required logistics, merchandise and media publicity, building public relations and communications.
Work-plans for the growth of Indic Wikipedias[7] were developed in a participatory manner with active collaboration from Wikimedia community in India and Wikimedia India Chapter Executive Committee.
Proactive open disclosure of A2K budget. and proposed revisions to the budget seeking feedback from the Wikimedia community in India towards building transparency.
CIS-A2K gave significant media visibility to Indian Language Wikipedias both in print and electronic media.

Section B: A2K Programme Impact

In discussing the A2K program’s impact we have presented below both the tangible and intangible aspects of our work.

Intangible Impact

The A2K team has left no stone unturned since the commencement of the program in September 2012 to work in a transparent manner. We have taken the following measures in being transparent:

Periodic publication of A2K work and outcomes through monthly newsletters.
Circulation of A2K monthly newsletters and notifications on various India related Wikimedia mailing lists.
Real-time listing and communication of activities on A2K Meta page.
Active documentation of all events and activities, which were published as blogs on CIS.
Prior announcements of all the events organized or supported by A2K.
Open and collaborative process of hiring Program Director.
Keeping the Wikimedia India Chapter EC in the loop on all programmatic developments since March 2013.
Proactive disclosure of A2K program budget and proposed revised budget to the Indian Wikimedia community.

In addition to this A2K has explored various possibilities of collaboration with the Indian Wikimedia community and Chapter alike. The biggest instance is the A2K Wok Planning exercise for 2013-14, where multiple stakeholders were consulted. These include

Some English-language Wikimedia community members from India;
Wikimedia India chapter Executive Committee;
Indian language Wikimedians and
A few of the Wikimedia Foundation staff.

Some of the collaborative and community building efforts of A2K were:

Support to community-led activities and facilitating community participation and ownership (e.g. Wiki Women’s Month).
Mobilization of the Indian Wikimedia community in organizing mega community events like Telugu Wiki Mahotsavam.
Engagement with WMI Chapter EC and built a collaborative relationship.
Wikipedia Education programs in 4 Indian languages done in collaboration with the local Wikimedia community.
Supporting Wikimedians in conducting outreach events.
Almost all the A2K events since February were done in collaboration with WMI Chapter and the Wikimedia community in India.
A2K team actively participated in various community meet-ups.
A2K has provided significant media visibility to Indian Language Wikipedias, especially in mainstream English press.

These transparency and collaboration efforts resulted in building trust among the Wikimedia India communities, where in they have begun to constructively engage with the A2K program’s work. This is a significant achievement since the closure of India program in August 2012. However, there are still some Wikimedians who prefer to ignore the A2K program, which indicates that the A2K program still needs to prove its worth. Thus it could be said that the A2K program has been partly successful in winning the faith of the Indian Wikimedia communities and still needs to put in more effort in this direction. The A2K team is committed to achieve this by demonstrating success through its work during the next phase of this program.

Tangible Impact

It is difficult for the CIS-A2K program to either take direct credit for the growth or direct blame for the lack of it in the Indian language Wikimedia projects. However, we believe that we have been one of the factors — and sometimes a key factor — in impacting the growth of the Wikimedia projects and communities in India since the commencement of the project.

Though the A2K program has done some amount of work with almost all Indian language Wikipedias, the A2K team has had relatively more involvement in 10 Indic languages - Assamese, Bengali, Gujarati, Hindi, Kannada, Malayalam, Marathi, Odia, Punjabi and Telugu - during September 2012 to June 2013.

In addition to this based on the various outreach work done by A2K we have attempted to present an analysis of direct new Wikipedia users that have emerged in languages impacted by the A2K program, keeping in mind that community mobilization will always be an autonomous activity to some extent.

The growth momentum in Indian languages over the eight month period of September 2012 to June 2013 looks healthy.
Some language Wikipedias have been growing at a phenomenal rate than others in terms of percentage change since September 2012.
Punjabi, Assamese and Odia Wikipedias have a growth rate of 82%, 59%, and 37% respectively and are the top 3 Indian language Wikipedia projects during the ten month period.
In terms of absolute number of articles, Tamil, Malayalam, Punjabi and Hindi Wikipedias have grown by about 5,812; 5,008; 3050; and 2,734 articles respectively.
However, given the small size of the Wikipedia communities in Punjabi, Nepali, Kannada, Odia and Sanskrit the growth achieved by them is much commendable and all efforts have to be put to ensure that this momentum continues by strengthening these communities and also expanding them.

There is a fluctuation in the number of active editors in all Indian language Wikipedias.
The active editors on Assamese, Marathi and Gujarati Wikipedias have been consistently coming down, which is a cause of concern.
It is important to note that Tamil, Telugu, Kannada and Nepali Wikipedias where the number of Active Editors were declining earlier have shown a remarkable turnaround. The efforts of the A2K program, especially in Telugu and Kannada, over the last 4 months could have resulted in this positive change.
It seems the Wikipedia Education Program, Nepal has been instrumental in bringing significant number of new active editors on Nepali Wikipedia.
Overall the active editors on Malayalam Wikipedia have crossed the 100 mark numerous times, making it the first Indian language Wikipedia to reach this benchmark. However, in month of May and June 2013 this dropped to a 2 digit figure again.
Looking at the trends Tamil Wikipedia may soon reach the 100 active editor mark.
Even Bengali community could cross 100 active editors if concerted efforts are put in.
The Assamese Wikipedia, which received support from A2K program until January 2013, had a consistent active editor population which was around 20 people. However, once the support from the A2K dwindled since February a declining trend can be noticed. One could deduce that the A2K program has had critical relevance in the growth of Assamese Wikipedia. The decline over the last 5 months also alerts us to the possibility of building dependencies on the A2K program, which is a concern that we need to address going forward.

On an average 94 new editors have joined Indian language Wikipedias every month.
Bengali, Malayalam and Tamil Wikipedias have consistently seen more than 10 new editors joining almost every month since Jan 2013.
Hindi, Marathi and Telugu have many new editors joining per month.
Total of 849 new people have become editors for Indian language Wikipedia since Sep 2012.
However, the conversion rate of new editors into active editors is still a challenge across all Indian language Wikipedias.

Overall the “Page View” trends of Indian Language Wikipedias until April 2013 look positive. but since the last two months the trend is in the decline. However, it should be noted that the month on month “Page View” trends keep fluctuating.
Bengali, Tamil, Malayalam and Punjabi Wikipedias have shown highest percentage growth in page views since September 2012.
In absolute numbers Bengali Wikipedia has seen a spectacular growth of 3,000,000 page-views, Tamil and Malayalam Wikipedias witnessed a growth of about 927,150 and 365,913 a page-views respectively.
Based on the the absolute numbers of “Page Views” for Indian Wikipedias it could be speculated that there is a significant increase in demand for knowledge and information in Indian languages on the internet.

In the below given Graph 5, we have also looked at the direct impact the A2K programme had in cultivating new editors on Indian language Wikipedias through various outreach programs that conducted during September 2012 to June 2013.

It should be noted that during the 10 month period CIS-A2K reached out to a total of 1,314 participants. This is approximate 130 people per month. However, the username data for more than 700 participants could not be ascertained, due to incorrect inefficient data collection and input. This includes participants giving wrong usernames, trouble with the handwriting of some of the participants, etc. We have already taken note of this issue and have put in measures to efficiently capture the new user data. Hence, we have only presented an analysis of 582 participants, whose usernames are valid.

The analysis of this data reveals that more than 120 users have done more than 5 edits, which is about 21 per cent of the participants with valid usernames. Further, 25 participants have done more than 100 edits on English and various Indian language Wikipedias, which constitutes 4 per cent of the total participants that the A2K programme has reached out to. Further 11 users have become very active editors on Indian language Wikipedias with more than 1000 edits to their credit.

Section C: Learning and Challenges

Outreach

One of the biggest constraints with the existing outreach efforts across India including that of CIS-A2K's is that they are all based on light-touch model. We have learned that a light touch outreach with no follow up, no hand-holding, no support system will not be able to yield desired results. We need to have a thoroughly thought out well-designed outreach programs where there should be continuous interaction with the participants for a minimum of 2-3 months. CIS-A2K approach to outreach should be different from usual Wikipedia editing training. Further, any outreach with an educational institution on the lines of a "Wikipedia Education Program" requires at least 3-4 months commitment from everyone concerned (i.e. student, institution, community and CISA2K).

This in no way means diminish the importance of the light-touch model of 1/2 or 1 day Wikipedia editing training workshops, as seldom you get institutions/groups who are willing to commit to a long-term engagement. Thus a mixed approach is more pragmatic, while more energies need to put in long-term engagements.
There is a strand of criticism about effectiveness of physical outreach in general. However physical outreach for Indian languages is extremely essential as this is the lead exercise by which language communities have strengthened themselves over the years, though this has been very slow. The need to involve human element, face-to-face interaction and two-way communication is an extremely important factor of for growth of Indian language communities.
The need for each language community is different with respect to outreach. There are some communities that are more comfortable with conducting physical outreach while other communities are more efficient with outreach on social networking sites. For instance the Odia Wikipedia community where the average age of the active members is less than 25 is more active on Social Media and extensively uses it to network among themselves and to also discuss about the Wikipedia, whereas the Telugu Wikipedia is more comfortable with physical meetings and primarily uses Village Pump for all community discussions.
Based on the interaction with most of the Indian language Wikimedia communities, CIS-A2K noticed that except for some communities like Malayalam, an institutional partnership is something that might not be easily taken up by community members. This is so because it requires high level of effort, time and strong network, amongst several other things. CIS-A2K has been focusing to address this need in general and in the five focus language areas in particular.

Work Plan Development and Community Communications

Even after sending multiple invitations, it took a lot of effort by CIS-A2K to encourage the larger community to engage and participate actively in the development of language focused work plan. CIS-A2K put its best efforts in inviting the community members through meta pages, village pumps, language and city-wide mailing lists, Indian mailing list, India English mailing list, meet-ups, IRCs, social-media channels to give their valuable suggestions and feedback. However, very few community members showed interest and helped in refining the plans. Better feedback could be gathered during physical and informal meetings with the community members.
Less than 10% active volunteers across all Indian language communities are active on Meta and even less on Indian mailing lists. During some informal conversations some community members expressed that it is too much of an additional burden to also visit Meta and engage. Taking into consideration that most of the language communities have less than 20 active volunteers, pragmatically speaking it is a huge ask to expect them to actively participate on Meta or mailing lists. Thus one cannot have a uniform standard and uniform mode of communication with different language communities. Thus CIS-A2K needs to explore various means of engaging with the Wikimedia community in India and should adopt a mixed channel approach of gauging community feedback. Though this is requires additional efforts on the team.
The mediums listed show a significant effort was made to solicit feedback and participation. It's okay and understandable that strategic planning is not for everyone, that volunteers economize their time devoted to the movement. So CIS-A2K does not necessarily see it as a failure that participation was low. What CIS-A2K aimed to do was to make sure participation was solicited, encouraged, and made possible. Of course ideally we would want higher participation, but CIS-A2K is careful not to confuse and turn higher participation in strategizing into a goal in itself.
In spite of this CIS-A2K took the risk and went ahead with a participatory and continuous mode of evaluation. We foresee a challenge in actively involving the community in quarterly evaluation cycles as this would require them also to introspect. In the five focus language communities such an introspection exercise was not done systematically before and a mandatory imposition may not be productive either for the Community or for CIS-A2K. The challenge would be that in the first 2 quarterly cycles CIS-A2K could miss meeting its own evaluation criteria. However, the opportunity here is to train the community to systematically introspect, which will go a long way in strengthening the Indian language Wikipedias and the associated communities.
Some programs, especially institutional partnerships, have a higher risk of failure than others. Though CIS-A2K committed to a very granular break-down of outcomes, it may require significant revisions. Hence it is extremely important for CIS-A2K to review and revise the plans and goals every 3-4 months.

Community Engagement/Development

Indian language communities are able to grow and cultivate new editors who come from similar background as their’s. For example, we find that the Telugu community comprises primarily in the age group of 30-50 years, while on the other hand, the Odia community consists of relatively younger editors between the age group of 20-30 years. Hence, it is essential that the community building programs take this aspect into consideration and work to diversify the community mix by engaging with people belonging to varied backgrounds.
Transparency and accountability are essential to build community trust. CIS-A2K has already taken various measures in this direction. However, there are occasions when more demands are placed on CIS-A2K, which consumes a lot of CIS-A2K's time and effort. The challenge is to struck a balance between the demands of transparency and accountability and the actual work they describe.
Meetups, one-on-one meetings/talk with community members are an essential ingredient to build long-term relationship. This is especially very important for nascent language communities with few editors. These kind of personal interactions help community members to know and connect with other Wikipedians. It also helps build trust and working relationship between community members and the A2K team.
CIS-A2K recognizes the potential role of Wikimedia India Chapter in growing the Wikimedia movement in India. Though CIS-A2K's work doesn't depend on the India Chapter, there is a huge potential for collaboration between the Wikimedia India Chapter and CIS-A2K. CIS-A2K has put in its best efforts to build a cordial working relationship with the India Chapter. However, the extent of the collaboration would depend on the India Chapter's capacity and interest.

The First Punjabi Wikipedia Workshop (by Shiju Alex and Subhashish Panigrahi, September 27, 2012). A total of 25 participants came for this workshop. There were 15 new editors (of which 13 were female).
Punjabi Wikipedia Workshop at Punjabi University, Patiala (by Shiju Alex and Subhashish Panigrahi, September 28, 2012). About 30 participants including students and teachers attended the workshop.

Wikipedia workshop @ Inmantec College, Ghaziabad (by Nitika Tandon, October 19, 2012). The Access to Knowledge team was approached by Gaurav Prashar, Assistant Dean at Inmantec College, Ghaziabad to organize the workshop. Over 120 participants attended the workshop including MCA, BCA, BBA students and faculty members.

Odia Wikipedia Workshop at AML (Academy of Media Learning, Bhubaneswar, November 10, 2012). Odia Wikipedians like Ansuman Giri, Manoranjan Behera and Diptiman Panigrahi participated in this event.
Follow up to Wikipedia Introductory Session (Bharati Vidyapeeth, Delhi, November 19, 2012). A Wikipedia introductory session was organised at Bharati Vidyapeeth Engineering College in Delhi early this year and a follow up session was organised by CIS on November 19, 2012. About 15 participants attended the follow up session.
An Odia Wikipedia Workshop at KMBB (co-organized with CIS and with Odia Wikipedians, KMBB College, Bhubaneswar November 18, 2012). The agenda for the two-and-a-half hour session was to educate students about open source movement, journey of Wikipedia and how to contribute to Odia Wikipedia and how it would help them. Nine active Odia Wikipedians joined to support this event.

Marathi Wiki Workshop at TISS (co-organised with the Wikimedia India Chapter, Tata Institute of Social Science, Mumbai, December 8, 2012). There were about 25 participants (MA and PhD level) and 5 conductors - Yogesh, Nikita, Moksh, Kartik and Nitika.
Wikipedia Workshop at NMAIT (NMAIT, Karkala Taluk, Karnataka December 21, 2012, co-organised in association with Metawings Institute). Subhashish Panigrahi led the session. About 170 engineering students took part in this event.
Wikipedia Workshop at SRM (SRM University, Chennai, Tamil Nadu, December 17, 2012, co-organised in association with Metawings Institute). Noopur Raval participated in the event. About 40 students from different engineering colleges in Chennai participated in the workshop.

Education Programme Updates

Launch of Assamese Wikipedia Education program at Guwahati University (by Nitika Tandon, October 22, 2012). The program was launched on October 14, 2012 with 15 post-graduate students (90 per cent of these are women students) under the guidance of Prof. Dulumoni Goswami, Head of the Department of Education, Guwahati University.
Malayalam Wikipedia Education Program: August to October Updates (by Shiju Alex, October 29, 2012). This program is the first of its kind in an Indic language, and Malayalam community is doing the program in collaboration with the IT@School, a project of the Department of General Education, # Government of Kerala, setup in 2001, to foster the IT education in schools. Gujarati Wikipedia Article Competition – 10 schools, 200 students, 20 articles on Gujarati Wikipedia (by Noopur Raval, October 31, 2012). This was a competition to raise Wikipedia awareness and help students discover the joy of writing articles in their native language and an attempt to connect producers having knowledge in Gujarati to a wide audience of more than 4,00,000 readers.
Gujarat Wikipedia Education program:Rajkot (by Noopur Raval, October 31, 2012). This report analyses a series of meetings and workshops held in Rajkot, a city in Gujarat, India during the month of October 2012 including students from the Galaxy Education System, Christ College students and members from the Wikipedia community.
First Odia Wikipedia Education Program to be Rolled Out (by Subhashish Panigrahi, November 30, 2012). Odia wikipedians launched this program at the Indian Institute of Mass Communications, Dhenkanal on November 8, 2012 to bring students to edit articles on Odia wikipedia through a series of assessments by professors.
Odia Education Program (Indian Institute of Mass Communication, Dhenkanal, Orissa, January 26, 2013). This is the first Odia Education Program which ran for three months and 16 students took active part in contributing on various articles on Odia Wikipedia.

Section E: Indic Wikipedia Visualisation Project

CIS hired Sumandro Chattapadhyay and Sajjad Anwar to work on visualisation of the growth of Indic Wikipedia. Their project takes basic parameters, like page views, total articles and total editors, and compares them over time and across projects:

They have looked into the different aspects of the past and present activities of Indic Wikipedias, and divided the visualisation into three different focus areas:
1. Basic parameters
2. Geographic patterns of edits

They also worked on visualisation of the page views statistics and the project specific pages. The page views indicate the number of unique visits Wikipedia project concerned has received in one month. Readership Dashboard: The Readership Dashboard combines a line graph showing the movement of page view for a project across the years and bar graphs showing a separate variable for the same project.
Motion Charts: The motion charts help compare Indic Wikipedia Projects across Languages on various parameters such as new editors, new articles, active editors, total editors etc.
Calendar Charts: The calendar charts limits each chart section to 12 months allowing the user to focus on more granular movements of the variable concerned, say the number of new editors per month or page views per month, etc.

Section F: The Access to Knowledge Work Plan (2013 – 2014)

The Access to Knowledge team assessed 12 of the active Indic-language communities based on the community dynamics, growth patterns in readership, and community and edit contribution for drafting this work plan. In putting together this work plan the Access to Knowledge team has extensively engaged with various stakeholders. These include: a) some Wikimedia community in India members across various Indian-language Wikimedia projects; b) some English-language Wikimedia community members from India; c) Wikimedia India chapter executive committee; d) some potential institutional partners; e) a few like-minded advocates of free knowledge; f) Access to Knowledge program Adviser Dr. Tejaswini Niranjana; and g) a few of the Wikimedia Foundation staff. Five languages were selected as core language areas. These include: Bengali, Kannada, Konkani, Odia and Telegu. Some key factors that determined the selection of languages areas included:

The Access to Knowledge team's existing ties with knowledge institutions, groups and individuals.
Willingness of language community to interact and engage with the Access to Knowledge team.
Considering Wikimedia India Chapter EC's suggestion that Access to Knowledge team should work on at least one incubation project.
Access to Knowledge team's familiarity with the languages.

However, choosing these five languages do not necessarily mean that the A2K program would not focus on the other languages rather there would be more programmatic support and organizational ties to be built.

Overall Community Support

Besides the specific programs mentioned under individual language area plans, A2K team will provide overall support to all Indian-language Wikipedia communities. This includes but is not limited to:
Creating awareness through online editing videos, editing guides and digital coverage all in local Indian languages.
Supporting outreach activities
Capacity building to multiply outreach efforts. This would include training sessions to improve presentation skills, audience engagement skills with mock presentations and video recording for feedback. The first Train-the-Trainer program is being planned in June.
Facilitate more qualitative interactions amongst community members with an aim to foster creation of new project ideas in the form of physical meet-ups, hangouts/Skype calls, and small/large scale conferences.
Organize language specific IRCs where community members from that specific language could discuss their plans, issues, concerns, and anything at all.
Encourage community members to share feedback, suggestions or details of any kind of support on A2K's Meta help page.

A one-day orientation was organized in CIS where Wikimedia board members Bishakha Datta and Achal Prabhala helped the Access to Knowledge team members to develop an agenda for a period of 6-7 months. They helped team members to find overlaps, prioritise and recognize possibilities to make best use of available resources. The board members also shared learnings, principles and concepts from other movements that could be applied to the Access to Knowledge program.
A one-day orientation program was organized with Wikimedia India Chapter Executive Committee Members to find common minimum program on which both the Chapter and the Access to Knowledge team could work together to achieve common objectives. The orientation also helped define overlapping areas and how the two oragnisations will handle them.
A one-day orientation program was organised with Wikimedia community in India Members such as Tinu Cherian who gave a talk on how to leverage mainstream and social media; Gautam John who organized a workshop on organisational procedures for greater transparency and accountability, and Arun Ramarathnam who spoke about best practices for working with Wikipedia community. This orientation was organized as a part of training and skill development for the Access to Knowledge team members.
Since March 2013 CIS-A2K started having weekly Team Learning Sessions on every Wednesday. However, given the hectic schedules of the Team these could not be organized in a regular manner.

Exits and New Hires

CIS has an office in New Delhi with a five-member team for the Access to Knowledge program. The team is currently headed by T. Vishnu Vardhan, Program Director (Access to Knowledge). Other team members include Tejaswini Niranjana (Distinguished Fellow), Dr. U.B. Pavanaja (Program Officer, Indian Language Initiatives), Nitika Tandon (Program Manager) and Subhashish Panigrahi (Program Officer).

	T. Vishnu Vardhan: Vishnu Vardhan was hired as the new program Director-Access to Knowledge at CIS. Vishnu Vardhan has over the last 11 years worked in various capacities as researcher, grant manager, teacher, project consultant, information architect and translator. Vishnu Vardhan managed the Art, Crafts and Culture portfolio of Sir Ratan Tata Trust and also worked as Research Coordinator at the Centre for the Study of Culture and Society in Bangalore.
	Dr. U.B. Pavanaja joined the team as program Officer, India Language Initiatives on March 4, 2013. Dr. Pavanaja holds a Master’s degree from Mysore University and Ph.D. from Mumbai University. He was a scientist at Bhabha Atomic Research Centre, Mumbai, for about 15 years. He is one of the earliest editors of Kannada Wikipedia. He has to his credit many firsts, viz., first Kannada website, first Kannada online magazine, first Indian language (Kannada) website to receive Golden Web Award, first Indian language (Kannada) editor for Palm OS, first Indian language (Kannada) editor for WinCE device (HP Jornado 720), first Indian language version (Kannada) of universally popular Logo (programming language for children) software, etc.
	Tejaswini Niranjana is a Senior Fellow at the Centre for the Study of Culture and Society (CSCS), Bangalore, and Visiting Professor at Tata Institute of Social Sciences (TISS), Mumbai joined A2K as an Adviser. She guides the Access to Knowledge team in expanding the Indian language Wikipedias and helps in increasing the number of active editors through strategic partnerships with Higher Education institutions across India.

Notes:

The above table gives a picture of the A2K program budget utilization (un-audited) for the period Sept. 2012 to June 2013. Thus it is important that these figures be read as provisional figures, which could change post the statutory audit as per the Indian laws binding a Registered Society.
Approximately there is a 31% underspending of the Budget during the ten month period. This is mainly because of the transition of the program to CIS took sometime along with delays in the recruitment of the New Program Director. CIS-A2K has requested the WMF for a reallocation of the Budget since then.

The Centre for Internet & Society (CIS) is seeking applications from prospective candidates who identify themselves as female, for the position of Finance Officer, to support its Access to Knowledge (CIS-A2K) Programme. The job application is open to women only because we feel that a woman Finance Officer will contribute more towards bridging the gender gap in the Wikimedia movement and also it will bring a gender balance in the team. The position is full time and will be based in CIS’ Bangalore office No. 194, 2nd ‘C’ Cross, Domlur, 2nd Stage, Bengaluru, 560071. Finance Officer will work closely with the CIS-A2K Team and would report to the Executive Director/any supervisor in Team.

Position Summary

As a Finance Officer, your job will be to support the A2K Programme and the community members in financial related aspects such as filing the reimbursements, maintaining the books of accounts etc.

Responsibilities

You will be responsible for the overall finance-related aspects of Team that include maintaining the books of accounts, filing the reimbursements.
Assistance in book-keeping to include monthly expenditure, financial statements, accounts receivable, accounts payable, disbursement journal, trial balance, tax reports, etc.
Work in preparation of budgets, proposals, objectives, audits, annual reports.

Requirements

Prior experience of working in a collaborative community, preferably an open movement.
Must be fluent in English and at least in one Indian language.
Minimum of 1-year experience in clerical/bookkeeping/accounting field.
Ability and flexibility to deal with pressure and deadlines.
Good knowledge of formulas in excel sheets.
Basic knowledge of Tally software.

Wikimedians will be given priority.

Location: The position is based out of the CIS’s Bangalore office.

Remuneration: Compensation structure will be determined by the level of expertise, experience and current remuneration.

Contract period

Initial contract will be till 30 June 2019, following the current work-plan of the A2K team

The Centre for Internet & Society (CIS) is seeking applications only from prospective candidates who identify themselves as women, for the position of Programme Officer (Communications, the position is also known as Communication Officer), to support its Access to Knowledge (CIS-A2K) Programme. Context of the CIS-A2K programme

As an affiliate of the Wikimedia Foundation, the nonprofit behind Wikipedia and Wikipedia’s sister project, we design and implement different projects with an aim to create high quality content and cultivate new contributors to Wikimedia projects. The projects will be premised on themes and seek to create a multilingual repository of knowledge using Wikimedia projects as a knowledge platform. You are encouraged to deeply engage with the CIS-A2K work plan before making the application. You will work cohesively with the Wikimedia community and the Wikimedia India Chapter to meet specific goals of each language community in India. Responsibilities

You will be responsible for the overall communications of Team that include storytelling in the form of interviews, blogs, opinion pieces in newspaper/other platforms, regular coverage in both Indian language and English media, and anything beyond.
You will be exploring widely from conventional to new media to spread the stories of the hundreds and thousands of volunteers that make the Indian-language Wikipedia and Wikimedia projects such great knowledge repositories.
Creating original stories of challenges and learning, and successes of Wikimedia community in general and the ones that we closely work with in particular.
Function as an interface between A2K team and the community, and help the team better work collaboratively with the community.
Sharing the work of the community and A2k team in a regular basis in the monthly newsletters and other places.
Providing training on effective communications to the communities in a need basis, and supporting them to independently tell their own stories in their own languages.
Announcement of programmatic activities in the form of announcements, blogs and reports, and microblogging (social media, etc.).

Interviewing Wikimedians under the ambit of the WikipediansSpeak [1] project and beyond, and share the story of the Wikimedia community widely in the media

Required skills

Graduate with a strong track record of success in high performance organisations, preferably in non-profits.
Experience could be during studies or after, primarily in blogging, writing organisation reports, managing social media for organisations, interviewing and covering people’s stories in mainstream media.
Prior experience of working in a collaborative community, preferably and open one like Wikipedia and in online.
Good understanding of the basics of organisational programme design and management.
Strong understanding of the Internet and the forces that underpin the success of Wikipedia. Active participation as a Wikimedia volunteer would be an asset, though not a prerequisite (must be prepared to demonstrate knowledge of how Wikipedia works in interviews).
Experience working in a global, multicultural and diverse team environment will be preferred.
Must be fluent in English and at least in one Indian language.
A good understanding of the cultural and knowledge universe of the Indian language communities.

The Centre for Internet and Society is alarmed by the Draft Geospatial Information Regulation Bill, 2016, and has recommended that the proposed law be withdrawn in its entirety. It offered the following detailed comments as its submission.

1. Preliminary

1.1. This submission presents comments and recommendations by the Centre for Internet and Society (“CIS”) on the draft Geospatial Information Regulation Bill, 2016 (“the draft bill” / “the proposed bill” / “the bill”).

2. Centre for Internet and Society

2.1. The Centre for Internet and Society is a non-profit organisation that undertakes interdisciplinary research on internet and digital technologies from the perspectives of policy and academic research. The areas of focus include accessibility for persons with disabilities, access to knowledge, intellectual property rights, openness (including open data, free and open source software, open standards, open access, open educational resources, and open video), internet governance, telecommunication reform, digital privacy, and cyber-security. The academic research at CIS seeks to understand the reconfiguration of social processes and structures through the internet and digital media technologies, and vice versa.

2.2. This submission is consistent with CIS’ commitment to safeguarding the public interest, and particularly the representing the interests of ordinary citizens and consumers. The comments in this submission aim to further the principles of people’s right to information regarding their own country, openness-by-default in governmental activities, freedom of speech and expression, and the various forms of public good that can emerge from greater availability of open (geospatial) data created by both public and private agencies, and the innovations made possible as a result.

3. Comments

3.1. General Remarks

3.1.1. While CIS welcomes the intentions of the government to prevent use of geospatial information to undermine national security, the proposed bill completely fails to do so, infringes upon Constitutional rights, harms innovation, undermines the national initiatives of Digital India and Startup India, is completely impractical and unworkable, and it will lead to a range of substantial harms if the government actually seeks to enforce it.

3.1.2. There are already laws in place that prevent the use of geospatial information to undermine national security. For instance, the Official Secrets Act, 1923 (“OSA”) already contains provisions — sections 3(2)(a), (b), and (c) — all of which would prevent a person from creating maps that undermine national security and would penalise their doing so. Section 5 of the OSA contains multiple provisions that penalise the possession and communication of maps that undermine “national security.” The penalties under the OSA range from imprisonment of up to 3 years all the way to imprisonment up to 14 years. Given this, there is absolutely no need to create yet another law to deal with maps that undermine “national security.” Indeed, it is the government’s stated policy to reduce the number of laws in India, whereas the proposed bill introduces a redundant new law that adds multiple layers of bureaucracy.

3.1.3. The National Mapping Policy, 2005, already puts in place restrictions on wrongful depictions of India’s international boundaries, and as we explain below in section 3.4 of this document, even the National Mapping Policy is over-broad. Even if the government wishes to provide statutory backing to the policy, it should be a very different law that is far more limited in scope, and restricts itself to criminalising those who misrepresent India’s international boundary with an intention to mislead people into thinking that that is the official boundary of India as recognised by the Survey of India. CIS would support a law of such limited scope and mandate, provided it has an appropriate penalty.

3.1.4. There would be much utility in a law that creates a duty on the Survey of India to make available, in the form of an open standard, an official electronic version of the maps that it creates, and expressly allows and encourages citizens and startups to reuse such official maps, however the Ministry of Home Affairs would not be the nodal ministry for such a law.

3.1.5. We recommend that the proposed law be scrapped in its entirety.

3.1.6. We additionally provide an alternative manner of reducing the harms caused by this bill, in our comments below. By no means should these further comments be seen as a repudiation of our above position, since we do not feel the proposed bill, even with the inclusion of all of our recommendations, would truly further its stated aims. All our below recommendations would do is to reduce the bill’s harmful, and often unintended, consequences.

3.2. Definition of “Geospatial Information” is over-broad, all- encompassing

3.2.1. The second part of the definition of “geospatial information” refers to all “graphic or digital data depicting natural or man-made physical features, phenomenon or boundaries of the earth or any information related thereto” that are “referenced to a co-ordinate system and having attributes.” (Section 2(1)(e)) As per the definition, this will include all geo-referenced information, and data, that is produced by everyday users as an integral part of various everyday uses of digital technologies. This will also include geo-referenced tweets and messages, location of public and private vehicles shared in the real-time with agencies tracking their location (from public transport authorities, to insurance agencies, etc.), location data of mobile phones collected and used by telecommunication service providers, location of mobile phones shared by the user with various kinds of service providers (from taxi companies to delivery agencies), etc.

3.2.2. We recommend that instead of regulating all kinds of geospatial information, and giving rise to a range of possible harms, the draft bill be revised to specifically address “sensitive geospatial information,” defined as geospatial information related to the “Prohibited Places” as defined in the Official Secrets Act 1923 (section 2(8)) which will allow the bill to effectively respond to its key stated concerns of ensuring “security, sovereignty and integrity of India.” Since the National Map Policy defines “Vulnerable Points” and “Vulnerable Areas” (para 3(b)) as the two main types of geospatial units associated with “Prohibited Places”, these terms should also be referred to in the revised version of the draft bill.

3.3. Unreasonable regulation of acquiring and end-use of geospatial information

3.3.1. Section 3 of the draft bill states that “[s]ave as otherwise provided in this Act, rules or regulations made thereunder, or with the general or special permission of the Security Vetting Authority, no person shall acquire geospatial imagery or data including value addition” and “[e]very person who has already acquired any geospatial imagery or data ... including value addition prior to coming of this Act into effect, shall within one year from the commencement of this Act, make an application alongwith requisite fees to the Security Vetting Authority.” This effectively makes it illegal to acquire and maintain ownership of geospatial information that has not been subjected to security vetting.

3.3.2. This draft bill doesn’t apply just to geospatial information that may undermine national security but covers all manners of geospatial information and modern geospatial technologies embedded in everyday digital devices and intimately connected to various electronic products and services, from cars to mobile phones, result in the creation and acquiring of various kinds of geo-referenced information, ranging from the geo-referenced photographs to locations shared with friends. Even ordinary users who are unknowingly looking at maps that contain sensitive geospatial information, which are illegal under the Official Secrets Act, are committing an illegal act under the draft bill, because the users temporarily acquires such sensitive geospatial information in her/his digital device, as part of the very act of browsing the map concerned. This clearly cannot be the intention of the bill. Thus we recommend deletion of the word “acquire.”

3.3.3. Further, the insertion of the phrase “including value addition” in both Section 3(1) and 3(2) appears to suggest that all users who have created derivative products using geospatial information that includes sensitive data (that is data related to Prohibited Places) may be held liable under this draft bill, even if these users have not themselves collected or created such sensitive geospatial information, which was part of the original geospatial information published by the source map agency. This too cannot be the intention of the bill. Thus, we recommend deletion of the phrase “including value addition.”

3.3.4. In the definition of the “Security Vetting of Geospatial Information” itself, it is mentioned that the process will include “screening of the credentials of the end-users and end-use applications, with the sole objective of protecting national security, sovereignty, safety and integrity.” (Section 2(1)(o)) This appears to indicate that all end-users of all electronic and analog services and products using geospatial information will have to be individually vetted before such services and products are used, which would cover a large proportion of the Indian population. This imposes an enormous and impractical burden on the Indian digital economy in particular, and the entire national economy in general, without improving national security. This too cannot be the intention of the draft bill. Thus, we recommend deletion of this phrase, and ensure that end users are not covered by the law.

3.3.5. Given these specific characteristics of how modern geospatial technologies work, and how they provide a basis for various kinds of everyday use of electronic products and services, we would like to submit that the regulatory focus should be on large-scale and/or commercial dissemination, publication, or distribution of geospatial information, and not on the acts of acquiring, possessing, sharing, and using geospatial information. Further, the regulation in general should be aimed at the party owning the geospatial information in question, and not at the parties involved in its dissemination (say, Internet Service Providers) or in its generation or use (say, end-users).

3.4. Removal of journalistic, political, artistic, creative, and speculative depictions of India from the scope of Section 6

3.4.1. Section 6 of the draft bill states that “[n]o person shall depict, disseminate, publish or distribute any wrong or false topographic information of India including international boundaries through internet platforms or online services or in any electronic or physical form.” Section 15 imposes a penalty for such wrong depiction of maps of India.

3.4.2. Depictions of India, which do not purport to accurately represent the international boundaries as recognised by the Indian government should not be penalised. For instance, a map published in a newspaper article about India’s border disputes that shows the incorrect claims that the Chinese government has made over Indian territory would also be penalised as “wrong or false topographic information of India”, since there is a clear intention to depict the boundary as claimed by China. Criminalising such journalism cannot be the legitimate intent of such a provision.

3.4.3. There are numerous instances which have been willfully depicting inaccurate and inauthentic maps of India with international borders for political ends. For instance, there are often depictions of India which show territories within present day Pakistan, Bangladesh, Bhutan, Nepal and Sri Lanka as part of an “Akhand Bharat.” Depictions of this sort should not be penalised. In doing so, would contradict the freedom of expression guaranteed under Article 19(1)(a) without being a reasonable restriction under Article 19(2).

3.4.4. Even depictions of India for purposes of speculative fiction would be penalised under this proposed bill unless they depict the official borders. This is clearly undesirable and would not be allowed as a reasonable restriction under Article 19(2).

*3.4.5.* Even geography students in schools and colleges who mis-draw the official map of India would be liable to penalties under the draft bill. This plainly, cannot be the intention of the drafters of this bill. The creator of a rough and inaccurate tourist map of an Indian city can also be identified as committing a criminal act under the proposed bill as she would be depicting “… wrong or false topographic information of India …”

3.4.6. In brief: Merely depicting, disseminating, publishing or distributing any “wrong or false topographic information of India” should not be penalised. unless a person publishes and widely circulates an incorrect map of India while claiming that that represents the official international boundaries of India, such should not be penalised.

3.4.7. CIS recommends that the bill should instead state: “No person shall depict, disseminate, publish, or distribute any topographic information purporting to accurately depict the international boundaries of India as recognised by the Survey of India unless he is authorised to do so by the Surveyor General of India; provided that usage by any person of the international boundaries as is electronically and in print made available by the Survey of India shall deemed to be usage that is authorised by the Surveyor General of India.”

3.5. Absence of Publicly Available and Openly Reusable Standardised National Boundary of India

3.5.1. Given the lack of an reusable versions of maps of India, including of India’s official boundary as recognised by the Survey of India, it becomes impossible for people to accurately depict the boundary of India. We recommend that the bill requires the Survey of India to publish all “Open Series Maps,”as defined in the National Mapping Policy, 2005, including maps depicting the official international and subnational political and administrative boundaries of India, using open geospatial standards and under an open licence allowing such geospatial data to be used by citizens and all companies.

3.6. Remove Requirement for Prior License for Acquire, Dissemination, Publication, or Distribution of Geospatial Information

3.6.1. Section 9 of the draft bill refers to “any person who wants to acquire, disseminate, publish, or distribute any geospatial information of India” (emphasis added), which can be interpreted as the need for a prior license before any person decides to acquire (including creation, collection, generation, and buying) geospatial information. This creates at least two problems:

modern digital geospatial technologies have enabled everyday digital devices (like smartphones) to instantaneously acquire, disseminate, publish, and distribute geospatial information all the time when the person holding that device is looking at online digital maps, say Google Maps, or sharing location with their friends, online platforms and services and service providers (both local and foreign); and
the requirement of prior license involves payment of a “requisite fees” to the Security Vetting Authority, which may act as an arbitrary (since the fee might be based upon the volume of geospatial information to be acquired that one may not know fully determine before acquiring) and effective barrier to acquiring, dissemination, publication, or distribution of geospatial information even if it does not violate the concerns of “security, sovereignty, and integrity” in any manner. This requirement also impedes competition in the market, because new entrants to the geospatial industry may not have enough upfront capital to procure licenses.

3.6.2. Further, the requirement of necessary prior license for acquiring geospatial information does not seem to be a crucial component of the security vetting process, since the geospatial information, once acquired by the agency concerned, is in any case directed to be shared with the Security Vetting Authority for undertaking necessary expunging of sensitive or incorrect information.

3.6.3. We recommend revision of this section so that no prior license and/or permission is required for collection, acquiring, distribution, and/or use of geospatial information; instead, a framework may be established for monitoring of published geospatial information for purposes of ensuring geospatial information pertaining to “Prohibited Places,” as defined under the Official Secrets Act, is not made available to the general public by any person or entity under Indian jurisdiction, including, for instance, Indian subsidiaries and branches of foreign corporations.. Such a framework must not address the end-user of such geospatial information, but its publishers.

3.7. Unenforceable jurisdictional scope

3.7.1. Section 5 of the draft bill states “[s]ave as otherwise provided in any international convention, treaty or agreement of which India is signatory or as provided in this Act, rules or regulations made thereunder, or with the general or special permission of the Security Vetting Authority, no person shall, in any manner, make use of, disseminate, publish or distribute any geospatial information of India, outside India, without prior permission from the Security Vetting Authority.”

3.7.2. In compliance with this section, domestic and foreign companies and platforms will be required to obtain permission from the Security Vetting Authority of India prior to publishing, distributing etc. geospatial information. Similarly in the preliminary, the draft bill holds in person who commits an offence beyond India under the scope of the bill. The bill is thus proposing extraterritorial applicability of its provisions, yet the extent and method of enforcement of the same on other jurisdictions are kept unclear.

3.8. Negative implications for rights of citizens

3.8.1. There are a number of sections in the draft bill which have negative implications for the rights of all users and potentially impinge on the constitutional rights of Indian citizens. These include:

a. Section 18(2) which empowers the Enforcement Authority to conduct a search without a judicial search order;

b. Section 17(3) which empowers the Enforcement Authority to conduct undefined surveillance and monitoring to enforce the Act;

c. Chapter (V) which penalises individuals with Rs. 1-100 Crores and/or seven years in prison for an offence under the act;

d. Section 22 which allows the government to take ownership of a person’s land if a financial penalty has not been paid;

e. Section 30(1) which holds, in the case of the offense being committed by a company, every person in charge of and responsible for the conduct of business of the company, guilty and liable.

3.9. Overly broad powers and responsibilities of the Apex Committee and Enforcement Authority, and lack of adequate oversight

3.9.1. Section 7(2) states that “[t]he Apex Committee shall do all such acts and deeds that may be necessary or otherwise desirable to achieve the objectives of the Act, including the following functions:...” The wording in this section is broad and open ended, and allows for the responsibilities of the Apex Committee to be expanded without clear oversight of such expansion.

3.9.2. Similarly, section 17 established an “Enforcement Authority” for the purpose of carrying out surveillance and monitoring for enforcement of the draft bill. The Authority has been given a number of powers including the power of inquiry, the power to adjudicate, and the power to give directions. These powers have direct implications on the rights of individuals, yet the Authority is not subject to oversight or accountability requirements.

3.9.3. We recommend that the powers and responsibilities of the Apex Committee and Enforcement Authority are narrowly defined in the draft bill itself, limited by the principle of necessity, and subject to independent oversight and accountability requirements.

3.10. Remove the Security Vetting Authority’s power of delegation

3.10.1. Section 8(3) allows the Security Vetting Authority to delegate to any constituent member of the Authority, other subordinate committee, or officer powers and functions as it may deem necessary except the power to grant a licence. In practice, this will allow security vetting to be done by another institution and risks potential involvement of private agencies and/or quasi-governmental bodies.

3.10.2. We recommend that the power of delegation should not be granted to the Security Vetting Authority.

3.11. Negative implications for innovation and India’s digital economy

3.11.1. Section 3 of the draft bill states “[s]ave as otherwise provided in this Act, rules or regulations made thereunder, or with the general or special permission of the Security Vetting Authority, no person shall acquire geospatial imagery or data including value addition of any part of India either through any space or aerial platforms such as satellite, aircrafts, airships, balloons, unmanned aerial vehicles or terrestrial vehicles, or any other means whatsoever”. This effectively ensures that each and every user of geospatial data, products, services, and solutions — since all of these either include or are derivatives of geospatial information — would require prior permission from the Security Vetting Authority. This will substantially affect the existing and emerging digital economy in particular, and the entire economy in general.

3.11.2. Further, Section 9 of the draft bill mandates that any person submitting an application for geospatial information to be vetted must pay a fee. As the provisions of the bill mandate that users approach the Security Vetting Authority for license to use geospatial information, this will impose an immense burden on all users of digital devices in and outside of India. CIS submits that imposition of this fee for security vetting be removed.

3.12. Disproportionate penalty for acquisition of geospatial information

3.12.1. Section 12 states that “[p]enalty for illegal acquisition of geospatial information of India.- Whoever acquires any geospatial information of India in contravention of section 3, shall be punished with a fine ranging from Rupees one crore to Rupees one hundred crore and/or imprisonment for a period upto seven years.” Seven years in prison is disproportionate to the offense of acquiring geospatial information without vetting by the authority concerned. This is particularly true given the broad and all-encompassing definition of “geospatial information” in the draft bill, and the fact that the bill applies to individuals and companies both within and outside of India.

3.13. Improper and inconsistent usage of terms in the draft bill

3.13.1. Section 4 of the draft bill regulates the visualization, publication, dissemination and distribution of geospatial information of India, while section 5 regulates use, dissemination, publication, and distribution of geospatial information outside of India. The definition of “visualization” remains unclear, and the act is only regulated in section 4. The section 6 of the draft bill uses the term ‘depict’, which is undefined as well. We submit that in this context terms are interchangeable, and the draft bill should either define them expressly to avoid ambiguity in interpretations, or consistently use only one throughout the draft bill.

3.13.2. Section 11 (3) of the draft bill requires licensees to “[d]isplay the insignia of the clearance of the Security Vetting Authority on the security-vetted geospatial information by appropriate means such as water-marking or licence as relevant, while disseminating or distributing of such geospatial information.” We observe that geospatial information includes graphical representation, location coordinates, inter alia. While the former may be represented visually on an “as is” basis after the completion of the vetting, the latter may be used to perform other complex functions at the “back-end” (i.e., vendor-facing side) in various technologies. Water-marking and/or displaying of insignia would place undue burden on the licensee, depending on the kind of platform, service, or individual.

3.14. Lack of reference to technical implementation guidance

3.14.1. The regulation, harmonisation, and standardisation of the collection, generation, dissemination etc. of geospatial information is a complex process that goes beyond a process of security vetting and that will require extensive technical implementation guidance from the government. At a minimum this could include quality assurance considerations and standard operating procedures, yet the draft bill makes no reference to the need for technical standards or guidance.

CIS' Comments on the Department of Biotechnology and Department of Science Open Access Policy

In July 2014, the Department of Biotechnology and the Department of Science, Ministry of Science and Technology, Government of India released a draft Open Access Policy. CIS participated in discussions along with experts brought on board by the Drafting Committee to develop and review the open access policy. As a follow-up, CIS prepared comments to the draft Policy. This post makes available CIS' comments to the draft Policy.

COMMENTS ON THE

PROPOSED OPEN ACCESS POLICY OF THE DEPARTMENT OF BIOTECHNOLOGY AND DEPARTMENT OF SCIENCE

THE CENTRE FOR INTERNET AND SOCIETY, INDIA

I. PRELIMINARY

1. This submission presents preliminary clause-by-clause comments by the Centre for Internet and Society (“CIS”) on the Proposed Open Access Policy (“the Policy”) of the Department of Biotechnology (“DBT”) and Department of Science (“DST”).

2. This submission is based on the draft document for an open access policy by the DBT/DST. The draft document may be accessed on the website of the DBT.^¹

3. CIS commends the Ministry of Science and Technology, Government of India for its efforts at seeking inputs from various stakeholders prior to the release of its open access policy. CIS is thankful for the opportunity to have been a part of the discussion during the framing of the Policy; and to provide this clause-by-clause submission, in furtherance of the feedback process continuing from the aforesaid draft Policy.

II. OVERVIEW

4. The Centre for Internet and Society is a non-governmental organization engaged in research and policy work in the areas of, inter alia, access to knowledge and openness.^² This clause-by-clause submission is consistent with CIS’ commitment to safeguarding general public interest, and the interests and rights of various stakeholders involved. Accordingly, the comments in this submission aim to further these principles and are limited to those clauses that most directly have an impact on them.

III. CLAUSE-BY-CLAUSE COMMENTS AND ANALYSIS

5. “An important function of DBT/DST is to support basic, translational and applied scientific research through the creation of suitable infrastructure, by providing funding to individual scientists, institutions and start-ups, and through any other means deemed necessary.”

5.1. CIS has observed the superior standard of scientific research and development performed at DST/DBT^³, and the steps taken to create high quality infrastructure by providing direct and indirect funding to several individual scientists, institutions and start-ups.

5.2. CIS strongly supports DBT/DST’s endeavour to extend the benefits of scientific research to the public produced by the persons in the foregoing comment by creating an open access policy.

5.3. CIS believes that the creation of an open access policy will advance the “creation of suitable infrastructure” by DBT/DST. Further, academic literature argues that open access works have a greater impact than works that are not freely available^⁴ and the public ought to benefit from research funded by the taxpayers’ money.^⁵

6. “Since all funds disbursed by DBT/DST are public funds, it is important that the information and knowledge generated through the use of these funds are made publicly available as soon as possible.”

6.1. The Policy proposes usage of the phrase “made publicly available.”

6.2. It is submitted that the phrase “made publicly available” does not sufficiently convey or establish the specific rights of the public with regard to the use of the information and knowledge generated at DBT/DST.

6.3. Under Indian Copyright law^⁶, the Government is the first owner of research “made or published under the control or direction” of any of its department or public undertaking in the absence of a contract to the contrary. Therefore, the Government is the owner of the knowledge and information generated at DBT/DST.^⁷ The author by virtue of section 57 of the Indian Copyright Act, 1957, however, retains the following rights in the publication:

a. Identification right or attribution right;

b. Right to maintain integrity in the work; and

c. Right to prevent destruction of the work.

These rights are collectively known as the author’s moral rights. They remain with the author even after assignment of the copyright or first ownership vesting with the Government. Whereas, the Policy permits unfettered access to research, there are limitations on further use of the work placed on third parties by virtue of the aforementioned rights.

6.4. CIS, therefore, in support of maintaining precision of the Policy recommends use of the phrase “made publicly available as soon as possible, subject to limitations prescribed under Indian law.”

6.5. CIS strongly supports the Policy’s rationale to make all knowledge openly accessible because it is produced by public funding. The rationale also aligns with academic literature advocating that the public ought to benefit from research funded by the taxpayers’ money.^⁸

7. “Research funded by DBT/DST results in new ideas and knowledge. However, DBT/DST will not underwrite article processing charges levied by some journals.”

7.1. CIS observes that while a majority of open access publications may not charge subscription or other access fees, they usually cover their operating expenses through other sources by levying processing fees paid by or on behalf of authors for submission to or publication in the journal.^⁹

7.2. CIS believes that the Policy should not cause detriment to persons performing research under DBT/DST, safeguard each person’s interest and career advancement. DBT/DST must create suitable infrastructure to accommodate prevalent practices and ensure the best support for its researchers.

7.3. CIS, therefore, suggests the need to establish a durable mechanism for underwriting reasonable publication charges for articles written by its faculty and published in fee-based open-access journals and for which other institutions would not be expected to provide funds.^¹⁰

7.4. The following methods may be elected to further the aforementioned comment:

a. DST/DBT may insert a provision to factor Article Processing Charges into the researcher’s grant; or

b. DST/DBT may establish an OA Publishing Fund. Funding may emerge from potential sources such as the institution al research division responsible with tracking and managing grant funding.

c. DST/DBT may purchase an institutional membership with OA publishers. Several major OA publishers discount their processing charges if an author is affiliated with an institution that has a membership.^¹¹

8. “The DBT/DST affirms the principle that the intrinsic merit of the work, and not the title of the journal in which an author’s work is published, should be considered in making future funding decisions. DBT/DST does not recommend the use of journal impact factors, as a surrogate measure of the quality of individual research articles, to assess an individual scientist’s contributions, or in hiring, promotion, or funding decisions.”

8.1. CIS strongly believes that the policy successfully creates a level playing field for assessment of quality of publications by making the title of the journal irrelevant.

8.2. CIS observes that the particular clause uses “title of the journal” to imply that the title is irrelevant as a factor to judge the merit of the work; whereas in the following sentence uses “DBT/DST does not recommend the use of journal impact factors” as a factor to assess quality of the work. The synonymous use creates an impression that “journal impact factor” is similar to “title of the journal”, which is a specious representation.

8.3. CIS submits that “journal impact factor” is a measure reflecting the average number of citations to recent articles published in the journal, and is only one of the many methods of calculating quality of a publication.^¹²

8.4. CIS suggests that the clause may be amended as follows, insofar as the preceding comments are concerned:

“The DBT/DST affirms the principle that the intrinsic merit of the work, and not the title of the journal in which an author’s work is published, should be considered in making future funding decisions. DBT/DST does not recommend the use of journal impact factors either, as a surrogate measure of the quality of individual research articles, to assess an individual scientist’s contributions, or in hiring, promotion, or funding decisions.”

8.5. Further, CIS submits that open access is in a nascent stage in Indian academia, and a person performing research under DBT/DST may lose external benefits by adhering to this clause. In reality, open access journals are yet to cultivate the high quality readership that certain subscription based journals enjoy. The clause prematurely puts a burden on researchers to not publish in subscription based journals enjoying a stellar reputation. Further, mere posting in online repositories will not ensure that the research will be successfully read and critiqued by other members of the academia.

8.6. CIS believes that DBT/DST should provide sufficient infrastructure and freedom to allow researchers to publish by a method of their choice, and not put unnecessary restrictions on the same.

9. “The DBT/DST believe/s that maximizing the distribution of these publications by providing free online access by depositing them in a gratis open access repository is the most effective way of ensuring that the research it funds can be accessed, read and built upon. This, in turn, will foster a richer research culture.”

9.1. CIS strongly agrees with DBT/DST’s method of disseminating research. The method is in harmony with the principles of open access since it provides free online access by depositing manuscripts in an open access repository.

9.2. CIS submits that the clause may include depositing full-text, metadata and supplementary materials in addition to the paper, in consonance with Clause 12 of this submission.

10. “Grantees can make their papers open-access by publishing in an open-access journal or, if they choose to publish in a subscription journal, by posting the final accepted manuscript to an online repository.”

10.1. The clause indicates that papers may be made open access via two routes, firstly, publishing the paper in an open-access journal, and secondly, publishing the paper in a subscription journal. Publishing the paper in a subscription journal entails the grantee to also post the final manuscript to an online repository.

10.2. CIS strongly supports the Policy’s direction to grantees to deposit “the final accepted manuscript to an online repository” upon adoption of the second route.

10.3. However, CIS believes that to ensure that ends of open access completely meet; the papers should be mandatorily deposited in online repositories which are freely accessible to the public i.e. following the Green OA route completely.

10.4. To strengthen foregoing comment, CIS strongly suggests establishment of a central online repository under the aegis of DST/DBT. This will guarantee open access to the manuscript in the unfortunate case of the institutional repository failing or delaying in tying up with other institutional repositories and the central repository.

10.4. It is submitted that the clause may be accordingly amended as follows^¹³:

“Grantees can make their papers open-access by publishing in an open-access journal and posting the final manuscript to a central online repository, or by publishing in a subscription journal and posting the final accepted manuscript i.e. the pre-print version to the central online repository. A preprint is any version of the paper prior to peer-review and publication, usually the version submitted to a journal.”

What should be deposited?

11. “The final accepted manuscript (after refereeing, revision, etc.) resulting from research projects fully or partially funded by DBT/DST or performed using infrastructure built with the support of DBT/DST and to appear in peer-reviewed professional journals. This also includes review articles, both invited and author initiated, for those who received funding from DBT/DST during that period.”

11.1. It is submitted that the clause fails to declare the applicability of the Policy to non-peer reviewed works, inter alia, doctoral dissertations.

11.2. CIS observed that the DBT offers post-graduate programs, including the DBT Postdoctoral Fellowship (DBT- PDF) programme and Post-Graduate programs, inter alia.^¹⁴

11.3. CIS supports the extension of the policy to works produced under all programs at DBT/DST (mentioned in the foregoing comment) to increase the efficacy of the Policy and to fulfil greatest dissemination of public funded research.

12. “The full-text of the paper and metadata should be deposited. Supplementary materials should be made available along with the publication. At the end of the full-text the acknowledgement should carry the grant number.”

12.1. CIS strongly supports the deposit of metadata, full-text of the paper to be made available along with other supplementary materials.

12.2. This clause rightly seeks supplementary material to ensure holistic access to the research.

12.3. CIS believes that DST/DBT should ensure that the aforementioned material is deposited in a machine readable format thereby permitting accurate search across the open access infrastructure and supporting interoperability. This will lead to a high degree of openness and foster a more rigorous academic culture.

12.4. In furtherance of the preceding comment, CIS submits that DBT/DST may use Digital Object Identifiers (“DOI”) to create persistent citations of publications available online. DOI ensures interoperability across systems and accurate linking of all material in relation to a publication. OECD has successfully implemented the system in its library system, namely, the OECD iLibrary.^¹⁵

12.4. CIS encourages DBT/DST to develop a more detailed policy on issues affecting the infrastructure required to successfully implement open access at it.

13. “Papers resulting from funds received from the fiscal year 2012-13 onwards are required to be deposited. Authors are strongly urged to also deposit final accepted manuscripts from funding received in earlier years.”

13.1. CIS strongly agrees with the scheme of depositing papers.

13.2. It is submitted that this clause will dispel ambiguity for requirement of depositing papers published prior to 2012.

Where to deposit?

14. “The manuscript should be deposited in the grantee’s own institution’s interoperable institutional repository (IR). If the institution does not yet have an IR of its own, then the paper should be deposited in the central repository, which will be created by DBT/DST.”

14.1. CIS strongly supports depositing papers in the aforementioned repositories.

14.2. It is submitted that the manuscript may be mandatorily be deposited in a central online repository (as suggested in the preceding comments), in addition to the grantee’s own institution’s interoperable institutional repository.^¹⁶ This will guarantee open access to the manuscript in the unfortunate case of the institutional repository failing or delaying in tying up with other institutional repositories and the central online repository.

When to deposit?

15. “Deposits should be made within one week of acceptance by the journal. However, if the journal insists on an embargo, the material should still be deposited, but the repository will keep the deposited papers non-OA and only make it fully OA at the end of the embargo period.²Suggest that the period of embargo not be greater than one year.”

15.1. CIS strongly supports the time-frame provided for depositing the paper, and the subsequent clause for keeping the paper “dark OA” in the case of an embargo placed on the paper by the publisher.

15.2. CIS suggests that the sentence “Suggest that the period of embargo not be greater than one year” be re-framed to reflect a conclusive position of the DST/DBT.

15.3. CIS submits that the clause may be amended as follows:

“Deposits should be made within one week of acceptance by the journal. However, if the journal insists on an embargo, the material should still be deposited, but the repository will keep the deposited papers non-OA and only make it fully OA at the end of the embargo period. The embargo should operate for a maximum period of one year.”

Who should deposit?

16. “This policy applies to individual scientists/institutions who have directly received ad-hoc funding or other support/benefits/infrastructure from DBT/DST as well as to scientists working at DBT/DST-aided autonomous institutions who benefit directly or indirectly from the infrastructure and core funding provided by DBT/DST.”

16.1. CIS strongly supports the inclusion of scientists and researchers into the scope of the Policy.

16.2. It is submitted that extending the scope of the Policy to apply to direct beneficiaries as well as indirect beneficiaries of DBT/DST funding/infrastructure shall ensure open access to a large amount of invaluable research.

16.3. The clause may be amended as follows:

“This policy applies to individual scientists/researchers/institutions who have directly received ad-hoc funding or other support/benefits/infrastructure from DBT/DST as well as to scientists/researchers working at DBT/DST-aided autonomous institutions who benefit directly or indirectly from the infrastructure and core funding provided by DBT/DST.”

17. “The principal investigator (PI) or someone authorized by the PI, or anyone authorized by the head of the institution where the work is carried out (such as the librarian), can deposit the papers. Both the PI and the head of the institution will be responsible for timely deposit of the paper.”

17.1. CIS supports the process chalked out to deposit the papers.

17.2. It is submitted that a formal procedure shall ensure efficient and timely deposit of the papers.

Depositing in a repository is mandatory

18. “Unless the deposit ID is quoted in the project report as well as in future proposals for funding, the proposals will not be considered.

In the rare case where the PI or head of the institution has some valid reasons for not complying with these requirements they should give a suitable explanation in the final report.

For research carried out in institutions under the administrative control of DBT/DST:

Authors of papers that will have no such deposit ID shall not be considered for promotion/appointment/ award/Fellowship/Research Grant.”

18.1. CIS supports the procedure to ensure mandatory deposits in a repository.

18.2. It is submitted that creating unique deposit IDs shall ensure that the PI or head of the institution oversees the process of making a paper open access more efficiently. Further, the clause incentivises authors to gain a deposit ID by depositing their papers in a repository, thereby maximizing open access.

How to deposit?

19. “In case of IRs, the IR administrator (and his/her team) will deposit the material on behalf of the authors. If one wants to deposit the material in the central repository, the author (or one of the authors in case of many) should forward the material to the administrator of the central repository. Those who want to self-archive in an IR may obtain the credentials from the administrators.”

19.1. The clause prescribes the methods prescribed in the Policy to deposit a paper.

19.2. However, CIS believes that depositing papers in the Central repository should be mandatory, since tie-ups with the institutional repositories may fail or get delayed. The Policy should aim at reducing administrative barriers in interest of making papers open access in the least amount of time.

Copyright

20. “In case the scientist produces research as part of her employment with a government body, the copyright vests in the government body, unless otherwise agreed upon to the contrary. Therefore, if the copyright continues to vest in the Government, transfer of rights would have to be by the Government, or by the scientist after prior permission from the Government. If the research has been produced by the scientist in the course of her employment with any institution, copyrights vests in the institution concerned, unless otherwise agreed upon to the contrary. The institution should retain the right to make the articles freely available gratis, whether the journal is open- access or subscription-based.”

20.1. CIS strongly supports the Policy in regard to informing the author about their ownership rights in the research.

20.2. CIS strongly supports a legal arrangement whereby the author is transferred complete copyright in his/her work; and the Government retains a non-exclusive, irrevocable and perpetual licence to disseminate the work publicly for the purposes of this Policy.

20.3. In furtherance of the preceding comment, the clause may be amended as follows:

“In case the scientist/researcher produces research as part of her employment with a government body, the copyright legally vests in the government body, unless otherwise agreed upon to the contrary. In the interest of the authors, the Government will transfer copyright in the work to the author, subject to reservation of certain rights. The Government should retain the right to reproduction of works, to issue copies of the works freely available gratis, whether the journal is open- access or subscription-based.”

21. “The DBT/DST recommend/s that all authors receiving funds from DBT/DST should, at the time of returning the copyright transfer form, inform the publisher that they would retain the right to place the full-text of the final author version in the institution’s IR and DBT/DST Central. This can be achieved by attaching to the copyright transfer agreement the DBT/DST author addendum.”

21.1. CIS strongly supports the pre-condition to be placed by the authors before the publisher before permitting publication of their papers.

21.2. It is submitted that retaining the right to deposit papers in the appropriate repositories shall ensure open access to research produced by the authors, and place a legal obligation on the publisher to honour the principle of open access by virtue of the copyright transfer agreement.

IV. CONCLUDING OBSERVATIONS

22. The Centre for Internet and Society welcomes the opportunity to comment on the proposed Open Access Policy of the Department of Biotechnology and Department of Science and commends the Ministry of Science and Technology, Government of India for its initiative in seeking inputs from the stakeholders.

23. To that end, reiterating its commitment to the values of access to knowledge, openness, freedom of information, protection of general public interest and safeguarding various stakeholders’ interests and rights, the Centre for Internet and Society presents the following concluding observations:

a. That the Policy uses the phrase “made publicly available as soon as possible, subject to limitations prescribed under Indian laws” to adequately convey its purposes.

b. That the Policy may create various mechanisms for underwriting reasonable publication charges for articles written by its faculty and published in fee-based open-access journals and for which the respective institutions would not be expected to provide funds. The mechanisms are as follows:

(i) DST/DBT may insert a provision to factor Article Processing Charges into the researcher’s grant; or

(ii) DST/DBT may establish an OA Publishing Fund. Funding may emerge from potential sources such as the institutional research division responsible with tracking and managing grant funding.

(iii) DST/DBT may purchase an institutional membership with OA publishers.

c. That the Policy should clearly distinguish between journal impact factors and title of the journal in respect of assessing the quality of the publication

d. That to ensure that ends of open access completely meet; the papers should be mandatorily deposited in a central online repository (established by DBT/DST) which is freely accessible to the public i.e. following the Green OA route in toto.

e. That non- peer reviewed works produced at DBT/DST, in addition to peer reviewed works also be deposited by the authors and therefore be included in the appropriate clause.

f. That to ensure that the full-text, meta data and supplementary material is deposited in a machine readable format thereby permitting accurate search across the open access infrastructure; The policy may develop a more rigorous plan for creating adequate infrastructure to ensure interoperability.

g. That the Policy may consider using DOI to establish a robust infrastructure.

h. That the manuscript may be mandatorily deposited a central online repository, in addition to the grantee’s own institution’s interoperable institutional repository to ensure that ends of open access are met.

i. That the copyright should vest with the author and the Government may retain rights to reproduction of the work in order to issue free copies of the work to the public.

j. That certain sentences be suitably modified, as discussed in the preceding sections of these comments.

k. That the Policy fails to establish a target timeline to achieve the objectives and setting up of required infrastructure, thereby rendering the collaborative obligations and duties of various stakeholders undefined. The Policy may insert a clause for the same as follows:

“Targets of the DST-DBT Open Access Policy Implementation (broadly):

Conclude the final terms and conditions of the Policy by <insert date>.
Create a central online repository for authors to submit their material by <insert date>.¹⁷
Encourage institutions to create respective institutional repositories.
Create a website with a user-friendly interface to enable access to the public by <insert date>”

That the Policy fails to address the remedies for non-compliance of its terms and condtitions by any party i.e Government, institution, researcher/scientist. A clause may be inserted as follows:

“Compliance

Researcher/scientist

1. In the event of the researcher/scientist entering into an agreement with a journal publisher, which stipulates unreasonable conditions on the accessiblity, thereby being incompatible with the Policy, the terms of the Policy shall have an overriding effect with regard to making the material publicly accessible.

Institution

2. The insititution shall faciliate and assist the author in depositing the required material in the central online repository.

Government

3. The Government shall enter into a copyright transfer agreement with the author contemporaneously alongwith the conclusion of the employment agreement, and agree to transfer the copyright to the author whilst reserving a non-exclusive, irrevocable and perputal right of reproduction and dissemination of the material deposited. In the absence/violation of a copyright transfer agreement, the Policy grants the researcher/scientist the copyright in the material so authored.”

24. The Centre for Internet and Society would be willing discuss these submissions with the Ministry of Science and Technology, Government of India; and supplement these with further submissions if necessary, and offer any other assistance towards the efforts at developing an open access policy for the DBT/DST.

CIS Welcomes Standing Committee Report on IT Rules

The Centre for Internet and Society welcomes the report by the Standing Committee on Subordinate Legislation, in which it has lambasted the government and has recommended that the government amend the Rules it passed in April 2011 under section 79 of the Information Technology Act.

These rules have been noted by many, including CIS, Software Freedom Law Centre, and Society for Knowledge Commons, and many eminent lawyers, as being unconstitutional. The Standing Committee, noting this, has asked the government to make changes to the Rules to ensure that the fundamental rights to freedom of speech and privacy are safeguarded, and that the principles of natural justice are respected when a person’s freedom of speech or privacy are curtailed.

Ambiguous and Over-reaching Language

The Standing Committee has noted the inherent ambiguity of words like "blasphemy", "disparaging", etc., which are used in the Intermediary Guidelines Rules, and has pointed out that unclear language can lead to harassment of people as has happened with Section 66A of the IT Act, and can lead to legitimate speech being removed. Importantly, the Standing Committee recognizes that many categories of speech prohibited by the Intermediary Guidelines Rules are not prohibited by any statute, and hence cannot be prohibited by the government through these Rules. Accordingly, the Standing Committee has asked the government to ensure "no new category of crimes or offences is created" by these Rules.

Government Confused Whether Rules Are Mandatory or Advisory

The Standing Committee further notes that there is a discrepancy in the government’s stand that the Intermediary Guidelines Rules are not mandatory, and are only "of advisory nature and self-regulation", and that "it is not mandatory for the Intermediary to disable the information, the rule does not lead to any kind of censorship". The Standing Committee points out the flaw in this, and notes that the language used in the rules is mandatory language (“shall act” within 36 hours). Thus, it rightly notes that there is a "need for clarity on the aforesaid contradiction". Further, it also notes that there is "there should be safeguards to protect against any abuse", since this is a form of private censorship by intermediaries."

Evidence Needed Against Foreign Websites

The government has told the Standing Committee that "foreign websites repeatedly refused to honour our laws", however, it has not provided any proof for this assertion. The government should make public all evidence that foreign web services are refusing to honour Indian laws, and should encourage a public debate on how we should tackle this problem in light of the global nature of the Internet.

Cyber Cafes Rules Violate Citizens’ Privacy

The Standing Committee also pointed out that the Cyber Cafe Rules violated citizens’ right to privacy in requiring that "screens of the computers installed other than in partitions and cubicles should face open space of the cyber café". Unfortunately, the Standing Committee did not consider the privacy argument against retention of extensive and intrusive logs. Under the Cyber Cafe Rules, cyber cafes are required to retain (for a minimum of one year) extensive logs, including that of "history of websites accessed using computer resource at cyber café" in such a manner that each website accessed can be linked to a person. The Committee only considered the argument that this would impose financial burdens on small cybercafes, and rejected that argument. CIS wishes the Committee had examined the provision on log maintenance on grounds of privacy as well."

Government’s Half-Truths

In one response, the government notes that "rules under Section 79 in particular have undergone scrutiny by High Courts in the country. Based on the Rules, the courts have given reliefs to a number of individuals and organizations in the country. No provision of the Rules notified under Sections 43A and 79 of the IT Act, 2000 have been held ultra vires."

What the government says is a half-truth. So far, courts have not struck down any of the IT Rules. But that is because none of the High Court cases in which the vires of the Rules have been challenged has concluded. So it is disingenuous of the government to claim that the Rule have "undergone scrutiny by High Courts". And in those cases where relief has been granted under the Intermediary Guidelines, the cases have been ex-parte or have been cases where the vires of the Rules have not been challenged. The government, if it wants to defend the Rules, should point out to any case in which the vires of the Rules have been upheld. Not a single court till date has declared the Rules to be constitutional when that question was before it.

Lack of Representation of Stakeholders in Policy Formulation

Lastly, the Standing Committee noted that it is not clear whether the Cyber Regulatory Advisory Committee (CRAC), which is responsible for policy guidance on the IT Act, has "members representing the interests of principally affected or having special knowledge of the subject matter as expressly stipulated in Section 88(2) of the IT Act". This is a problem that we at CIS also noted in November 2012, when the CRAC was reconstituted after having been defunct for more than a decade.

CIS hopes that the government finally takes note of the view of legal experts, the Standing Committee on Delegated Legislation, the Parliamentary motion against the Rules, and numerous articles and editorials in the press, and withdraws the Intermediary Guidelines Rules and the Cyber Cafe Rules, and instead replaces them with rules that do not infringe our constitutional rights.
