Our newsletter for February month below.

The CIS newsletter aims to highlight developments in copyright and patent, free speech and expression, privacy, cyber security, telecom, etc. as well as Industry 4.0, big data, additive manufacturing and so on which are revolutionizing and moving the digital world forward. Through this newsletter we look to engage you with our research and build a strong bond by bringing you insightful articles and blog posts which will be beneficial for you and your business. Throughout the year we will send you stories and insights from our board, staff and community leaders. We welcome your feedback, suggestions or comments regarding our newsletter or any other aspect of our research.

Highlights for February 2019

Maharashtra is a state which is rich in diversity in terms of language and culture seen in its various regions such as Konkan, Marathwada, Western Maharashtra, Northern Maharashtra and Vidarbha. Awareness needs to be created to make Wikimedia movement inclusive and diverse in these geographical regions as well as in their social strata. Keeping this in view CIS-A2K conducted five workshops in different parts of the state.
Marathi language department of Goa University has initiated the process to document the culture of Goa on Marathi Wikipedia and Commons. Subodh Kulkarni reports this in a blog entry.
Khetrimayum Monish Singh and Rajiv K. Mishra co-authored a research paper which was presented at the Young Scholars International Conference on “Margins and Connections,” organised by the Special Centre for the Study of North East India, Jawaharlal Nehru University, on February 7-8, 2019.
Following consultations with data protection, civil society, industry and others, during the Cybercrime Convention Committee (T-CY) meeting from 29 November 2018 onwards, the Cybercrime Convention Committee had sought additional contributions regarding the provisional draft text for a Second Additional Protocol to the Budapest Convention on Cybercrime (“Budapest Convention”). Vipul Kharbanda submitted comments on behalf of CIS.
CIS responded to the call for submissions from the UN Special Rapporteur on Freedom of Speech and Expression. The submission was on the Surveillance Industry and Human Rights.
CIS and University of Munich, Germany are co-organizing an event 'Internet Speech: Perspectives on Regulation and Policy' at India Habitat Centre on April 5, 2019.
Akriti Bopanna on behalf of CIS provided comments on the proposed draft of ICANN’s FY20 Operating Plan and Budget along with their Five-Year Operating Plan Update.
Harsh Bajpai, Ambika Tandon, and Amber Sinha have co-authored a case study 'The Future of Work in the Automotive Sector in India'. The case study highlights the impact of technologies such as artificial intelligence, industry 4.0, internet of things, and so on at industry workplace. The case study was edited by Rakhi Sehgal. Manav Mehta provided research assistance.
In a response to the Draft of The Information Technology [Intermediary Guidelines (Amendment) Rules] 2018, CIS examined whether the draft rules meet tests of constitutionality and whether they are consistent with the parent Act. The submission also examined potential harms that may arise from the Rules as they are currently framed and make recommendations to the draft rules that may enable government to meet its objectives while remaining situated within the constitutional ambit.
A UN high-level panel on Digital Cooperation issued a call for inputs that called for responses to various questions. CIS responded to the call for inputs. The response was drafted by Aayush Rathi, Ambika Tandon, Arindrajit Basu and Elonnai Hickok.

Access to Knowledge

Our Access to Knowledge programme currently consists of two projects. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

As part of the project grant from the Wikimedia Foundation we have reached out to more than 3500 people across India by organizing more than 100 outreach events and catalysed the release of encyclopaedic and other content under the Creative Commons (CC-BY-3.0) license in four Indian languages (21 books in Telugu, 13 in Odia, 4 volumes of encyclopaedia in Konkani and 6 volumes in Kannada, and 1 book on Odia language history in English).

Highlights
Open Access India recently released a statement to promote openness in science and research communities. CIS contributed to the text and introduced it to the participants of OpenCon 2018, Delhi. Marathi Language day is celebrated all over world on 27th February. Various events and activities were conducted by CIS-A2K in collaboration with community, institutions and government departments. Amber Sinha wrote a short series of three op-eds for Asia Times. The first article examines the debate around consent and the arguments made to discard it. The second article examines the substance of the argument of 'innovation' as a legitimate competing interest with respect to privacy. The third article looks at the two competing arms of regulation - enforcement and compliance, and how a balance of two is needed in India. Amber Sinha developed a visual guide to the story of privacy law in India and the recent judgment of Puttaswamy v. Union of India. Pooja Saxena designed and conceptualized the visual guide. CIS made a submission on the ‘White Paper of the Committee of Experts on a Data Protection Framework for India’ (“White Paper”) released by the Ministry of Electronics and Information Technology. CIS has collaborated with LabEx ICCA (Université Paris 13), UNESCO New Delhi, Centre for Social Sciences and Humanities (CSH), and Centre d'études de l'Inde et de l'Asie du Sud (CEIAS), to organise a Research Symposium on Digital Transitions in Cultural and Creative Industries in India. The symposium gathers researchers and practitioners engaging with the changing landscape of cultural and creative industries in India in the context of the rapid expansion of digital technologies and social media.

Welcome to the February 2017 newsletter of the Centre for Internet & Society (CIS).

We are pleased to bring you the Centre for Internet & Society's February newsletter. Previous issues of the newsletters can be accessed here.

Highlights
Submitted comments on the Vision Document 2030 published by the Department of Empowerment of Persons with Disabilities in February 2017. Our submission recommended that the vision articulate more clearly in terms of quantifiable targets what it seeks to achieve at different points of time and that these targets are not so minimally set as to undermine the aims of the Act and the national commitments outlined therein. Ting-Yi Chang wrote an article on the state of women editors in Wikipedia. In a write-up published by Your Story on February 7, Ting-Yi explored the reasons for the low percentage of women centric articles on the social media platform and how could the gender gap be bridged. In a research paper Anisha Gupta has assessed the privacy protections under 15 e-governance schemes. The paper analysed the schemes rolled out by the government, starting from 2010. Amber Sinha, Vanya Rakesh and Vidushi Marda authored a research paper that has sought to understand the most effective way of researching Big Data in the Global South. The second edition of the Internet Researchers' Conference, an annual conference initiated by CIS to bring researchers, academicians and others on a common platform to share insights and chart the way foreword was held in Bengaluru. Divij Joshi and Aditya Chawla in a report studied five Indian telecommunication companies and three Indian online service providers. The report has evaluated the practices and policies of companies which provide internet infrastructure or internet services, and are integral intermediaries to the everyday experience of the internet in India. General Data Protection Regulation (EU) 2016/679 was passed, which shall replace the present Data Protection Directive DPD 95/46/EC. This step is likely to impact the way of working for many organisations. In this light CIS requests you to take part in a survey aimed at understanding how various organisations view the changes in the Data Protection Regime in the European Union.

India has an estimated 70 million persons with disabilities who don't have access to read printed materials due to some form of physical, sensory, cognitive or other disability. As part of our endeavour to make available accessible content for persons with disabilities, we are developing a text-to-speech software in 15 languages with support from the Hans Foundation. The progress made so far in the project can be accessed here.

Highlights
The Researchers at Work programme organised the Internet Researchers' Conference 2016 (IRC16) on February 26-28. It was hosted by the Centre for Political Studies at the Jawaharlal Nehru University, and was generously supported by the CSCS Digital Innovation Fund. Subhashish Panigrahi won the Yuva Prerana Samman award. The award was conferred during the 2nd International Conclave of Odia Language (organized by Intellects, a Delhi-based progressive forum of intellectuals) at the India International Centre in New Delhi on February 20, 2016. Odisha News covered the event. Subhashish Panigrahi wrote an article for the Hoot on whether Wikipedia could revive dying Indian languages. Panigrahi stated that by encouraging content and involvement languages could be kept relevant. The article was republished by Pratham Books. Kannada Wikipedia just celebrated its 13th anniversary. As part of the WikipediansSpeak series Subhashish Panigrahi caught up with Vasanth to learn about his contributions to the Kannada Wikipedia. In the discussion Vasanth shared his long time involvement in the Wikimedia movement, and spoke about what drove him every day to edit Wikipedia and helping other fellow Wikimedians. Sunil Abraham's article on Facebook's Free Basics was published by First Post. He stated that there is more to come from TRAI in terms of net neutrality regulations especially for throttling and blocking. Nehaa Chaudhari wrote an article for the Socio Legal Review (National Law School of India University). The article seeks to examine legal and policy lever and the role of regulator in the development of an enabling environment for access to sub-hundred dollar mobile devices. In a recently published paper, Jahnavi Phalkey and Sumandro Chattapadhyay explore public initiatives in technological solutions for educating the poor and the disadvantaged in independent India. The United Nations Educational, Scientific and Cultural Organisation (UNESCO) had published a book in 2014 that examines free speech, expression and media development. The chapter contains a Foreword by Irina Bokova, Director General, UNESCO. Pranesh Prakash contributed to the Independence: Introduction - Global Media Chapter. The book was edited by Courtney C. Radsch. India should apply electronic toll collection systems to roads, and adapt road network concepts in organizing and managing communications networks wrote Shyam Ponappa in an Op-Ed published by the Business Standard.

Accessibility & Inclusion

India has an estimated 70 million persons with disabilities who don't have access to read printed materials due to some form of physical, sensory, cognitive or other disability. As part of our endeavour to make available accessible content for persons with disabilities we are developing a text-to-speech software in 15 languages with support from the Hans Foundation. Access to Knowledge

As part of the Access to Knowledge programme we are doing two projects. The first one (Pervasive Technologies) under a grant from the International Development Research Centre (IDRC) is for research on the complex interplay between pervasive technologies and intellectual property to support intellectual property norms that encourage the proliferation and development of such technologies as a social good. The second one (Wikipedia) under a grant from the Wikimedia Foundation is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

It is my distinct pleasure to share with you the second issue of the CIS newsletter (February 2015).

Earlier this year, I joined the Centre for Internet and Society (CIS) as the Research Director. I have been fortunate to periodically work with CIS in various capacities since mid-2012, mostly focusing on the topics of open data, open access, and visual exploration of data. Most importantly perhaps for my present responsibilities, for the last year or so, I have been in communication with various projects teams at CIS and supported their efforts through workshops on research methodologies, and by discussing and co-designing their research questions and approaches.

As the Research Director, I look forward to take these works forward, along with leading the Researchers at Work (RAW) programme, which has been shaped by Prof. Nishant Shah to host an exciting range of critical research initiatives into how the Internet and digital technologies reconfigure social processes and structures, and vice versa. Please keep an eye on the newsletter for further updates from the RAW programme.

Highlights

Forbes India in an article titled " Minds that (should) matter" names Sunil Abraham as one of the Thinkers who best explain a rapidly-changing India to the world (and the world to India). Errata: This story was shared in the last newsletter but with an error, which is now rectified.

NVDA team organized three workshops during the month for training participants on using eSpeak with NVDA software. The languages covered werePunjabi,Oriya and Hindi.
The Department of Industrial Policy and Promotion (DIPP), Government of India invited comments on the First Draft of India's National IPR Policy. CIS sent its comments . CIS commended the DIPP for this initiative and appreciated the opportunity to provide comments on the National IPR Policy.

CIS sent out three different Right to Information (RTI) requests to find out more details about the constitution and working of the IPR Think Tank to draft the first national IPR Policy.
Anubha Sinha analyses the submission to the DIPP by Academia and Civil Society on the draft National IPR Policy from a public interest perspective.
In an Open Letter to the Prime Minister of India, CIS requests the Government of India to initiate the formation of a patent pool of critical mobile technologies and a five per cent compulsory license.
CIS's Access to Knowledge team (CIS-A2K) in collaboration with the Centre for Indian Languages (CILHE) at TISS, Mumbai conducted a two-day workshop at English and Foreign Languages University (EFLU) at Hyderabad on January 28 - 29, 2015. Tejaswini Niranjana captures the developments in a blog post.

Subhashish Panigrahi wrote an op-ed on the endangered languages in India. This was published by Odia daily Samaja on February 21 which is celebrated as the International Mother Language Day.
CIS-A2K team conducted the " Train the Trainer Program" (TTT 2015) at CEO Centre, Dodda Gubbi, Bangalore. About 25 delegates attended the programme.
CIS has joined an international campaign to allow anyone in the world to request whether Britain's intelligence agency GCHQ has illegally spied on them.
On January 30, 2015, Associated Chambers of Commerce & Industry of India (ASSOCHAM) held a consultation on Internet governance. A committee was set up to draft a report on Internet governance, with a focus on issues relevant to India. CIS is represented on the committee, and has provided its preliminary comments to ASSOCHAM .

As part of CIS's inquiry into 'Network Neutrality' in the developing world a set of definitions of the term from different sources was collected and published as a blog post.
Namita A. Malhotra in a blog entry examines the figure of the pornographer, as a mixed media figure entrenched in various networks of knowledge production, circulation and consumption.

Accessibility and Inclusion

Under a grant from the Hans Foundation we are doing two projects. The first project is on creating a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India. CIS in partnership with CLPR (Centre for Law and Policy Research) compiled the National Compendium of Policies, Programmes and Schemes for Persons with Disabilities (29 states and 6 union territories). The publication has been finalised and is being printed. The draft chapters and the quarterly reports can be accessed on the project page. The second project is on developing text-to-speech software for 15 Indian languages. The progress made so far in the project can be accessed here.

2015 Opensource.com Community Awards : Every year, Opensource.com awards people from our community who have excelled in contributing and sharing stories about open source. Subhashish Panigrahi from the CIS-A2K team won the award under the category 'People's Choice Awards'.

Prof. Peng Hwa Ang from Nanyang Technology University visited CIS recently. He had a series of interactions with several researchers at CIS and has prepared a brief visit report. Highlights

We published revised chapters for the states of Mizoram, Dadra and Nagar Haveli, Himachal Pradesh and Haryana, as part of our National Resource Kit project.
In the concluding blog post of a three-part study Ananth Padmanabhan looks at the Indian law in the Copyright Act and the Information Technology Act, and concludes that both those laws restrain courts and private companies from ordering an ISP to block a website for copyright infringement.
Telugu Wikipedia celebrated its 10^th anniversary. An event was co-organized in Vijaywada to celebrate the same.
The second Institute on Internet and Society was held in Pune from February 11 to 17. The proceedings from the workshop are captured in a blog post.
CIS announced an Open Call for Comments for the latest draft of the Privacy Bill, 2013 prepared by Bhairav Acharya.
Forbes India published its “30 Under 30 List”. Pranesh Prakash is featured in the list.
As part of the Making Change Project, Denisse Albornoz wrote a blog post that compares the production behind a performance with the process of storytelling.
Beli gives an introduction to spectrum sharing. The post looks at GSM and CDMA, and touches upon LTE, and how they might share spectrum.

CIS is doing a project (under a grant from Privacy International and International Development Research Centre (IDRC)) on conducting research on surveillance and freedom of expression (SAFEGUARDS). So far we have organised seven privacy round-tables and drafted the Privacy (Protection) Bill. Gautam Bhatia gives an analysis of the right to privacy from a constitutional perspective. The Centre for Internet & Society (CIS) wishes you a great year ahead and welcomes you to the second issue of its newsletter for the year 2013. In this issue we bring you an overview of our research programs, updates of events organised by us, events we participated in, news and media coverage, and videos of some of our recent events.

Memorial

Rahul Cherian, an expert and policy activist in disability law, intellectual property and technology law passed away due to an illness while on a visit to Goa on February 7, 2013. Rahul was the founder of the Inclusive Planet Centre for Disability and Policy, and a fellow at CIS. He was also a partner at IndoJuris Law Offices in Chennai and was one of the experts who drafted the Treaty for the Visually Impaired currently being negotiated at the World Intellectual Property Organization. The Hindu (February 8, 2013), First Post (February 8, 2013), Legally India (February 7, 2013), and Bar & Bench (February 8, 2013) covered this story. Lawrence Liang wrote an obituary page, A Lightness of Spirit (The Hindu, February 9, 2013) and Nishant Shah wrote a column One For All (Indian Express, February 17, 2013).

CIS organised a memorial function for Rahul Cherian at the TERI, Southern Regional Centre in Bangalore on February 28, 2013.

Accessibility

CIS is doing two projects in partnership with the Hans Foundation. One of this is to create a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India and another is for developing a screen reader and text-to- speech synthesizer for Indian languages. CIS is also working with the World Blind Union and many other organisations to develop a Treaty for the Visually Impaired helped by the WIPO:

National Resource Kit for Persons with Disabilities

Anandhi Viswanathan from CIS and Manojna Yeluri from the Centre for Law and Policy Research are working in this project. Draft chapters have been published. Feedback and comments are invited from readers for the chapters on Bihar and West Bengal:

The Bihar Chapter (by Manojna Yeluri, February 14, 2013): The state of Bihar is in the process of formulating a comprehensive state policy on disability. The Bihar State Policy on Disability is an extension of the National Policy for Persons with Disabilities and is currently in a draft form awaiting government approval and notification.
The West Bengal Chapter (by Anandhi Viswanathan, February 28, 2013): The state of West Bengal has issued the West Bengal Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Rules, 1999 to implement the provisions under the central Persons with Disabilities (Protection of Rights, Equal Opportunities and Full Participation) Act, 1995.

Access to Knowledge

The Wikimedia Foundation awarded CIS a two year grant of INR 26,000,000 to support and develop the growth of Indic language communities and projects by community collaborations and partnerships. This is being carried out by the Access to Knowledge team based in Delhi. CIS is also doing a project (Pervasive Technologies) on examining the relationship between production of pervasive technologies and intellectual property. The project researches upon the noteworthy opportunities of the new types of low cost mobile devices, content and services as available in the market.

Wikipedia

Beginning from September 1, 2012, Wikimedia Foundation awarded CIS a two-year grant of INR 26,000,000 to support and develop free knowledge in India. The A2K team consists of four members based in Delhi: T. Vishnu Vardhan, Nitika Tandon, Subhashish Panigrahi and Noopur Raval, and one new team member Dr. U.B. Pavanaja who works from Bangalore office.

New Team Member

Dr. U.B. Pavanaja joined the A2K team as Programme Officer, India Language Initiatives on February 19, 2013. Dr. Pavanaja holds a Master’s degree from Mysore University and Ph.D. from Mumbai University. He was a scientist at Bhabha Atomic Research Centre, Mumbai, for about 15 years. He is one of the earliest editors of Kannada Wikipedia. He has to his credit many firsts, viz., first Kannada website, first Kannada online magazine, first Indian language (Kannada) website to receive Golden Web Award, first Indian language (Kannada) editor for Palm OS, first Indian language (Kannada) editor for WinCE device (HP Jornado 720), first Indian language version (Kannada) of universally popular Logo (programming language for children) software, etc. His Kannada logo won the Manthan Award for the year 2006. He was a member of the technical advisory committee setup by the Govt. of Karnataka for Standardization of Kannada on Computers (2000). He is also a member of the Kannada Software Committee of Govt. of Karnataka (2008-current).

Internet Access – Knowledge Repository

CIS in partnership with the Ford Foundation was executing the telecom knowledge repository project which included producing and disseminating modules on various aspects of telecommunications including policy, regulations, infrastructure and market. However, from November 2012 there was a change in the mandate of the project. The new repository will cover the history of the internet, technologies involved, principle and values of internet access, broadband market and universal access. It will also touch upon various polices and regulations which has an impact on internet access and bodies and mechanism which are responsible for formulation policies related to internet access. The blog posts and modules will be published in a new website: www.internet-institute.in.

Upcoming Event

We are hosting an “Institute on Internet and Society” in collaboration with the Ford Foundation India, which is to be held from June 8, 2013 to June 14, 2013. Call for registration and relevant details will be announced soon on our website.

Telecom

While the potential for growth and returns exist for telecommunications in India, a range of issues need to be addressed. From 2012 to 2015, the Researchers At Work series is focusing on building research clusters in the field of Digital Humanities. We organised the first Habits of Living workshops in Bangalore last year. The next workshop is being held in Brown University.

CIS was registered as a society in Bangalore in 2008. As an independent, non-profit research organisation, it runs different policy research programmes such as Accessibility, Access to Knowledge, Openness, Internet Governance, and Telecom. The policy research programmes have resulted in outputs such as the e-Accessibility Policy Handbook for Persons with Disabilities with ITU and G3ict, and Digital Alternatives with a Cause?, Thinkathon Position Papers and the Digital Natives with a Cause? Accessibility

Around 70 million disabled persons in India are unable to participate in information societies as lack of compliance with accessibility standards make interfaces impossible to use, and retrograde copyright and patent policies make it impossible to access knowledge. Accessibility is denied in banking services, web and mobile interfaces, etc. Material for the disabled therefore needs to be converted into accessible formats. The programme has resulted in outputs such as Web Accessibility Policy Making, Making Mobile Phones and Services Accessible for Persons with Disabilities, Accessibility Policy Making: An International Perspective, e-Accessibility Policy Handbook for Persons with Disabilities, Universal Service for Persons with Disabilities: A Global Survey of Policy Interventions and Good Practices, etc.

Web Accessibility Policy Making: An International Perspective: G3ict and the Centre for Internet and Society are pleased to announce the publication of a new, improved edition of the Web Accessibility Policy Making: An International Perspective. The report published in cooperation with the Hans Foundation provides an updated synopsis of the many policies that governments have implemented around the world to ensure that the Internet and websites are accessible to persons with disabilities.

Event

ITU Tutorial on Audiovisual Media Accessibility (India International Centre,New Delhi, March 14 to 15, 2012): At the invitation of the Centre for Internet and Society, in cooperation with the ITU-APT Foundation of India, International Telecommunication Union is organizing a two-day Tutorial on Audio Visual Media Accessibility. The Tutorial will be preceded by the fourth meeting of the Focus Group on Audio Visual Media Accessibility on March 13, 2012. The meeting will take place in the same venue and will be hosted by the Centre for Internet and Society in cooperation with the ITU-APT Foundation of India.

Access to Knowledge

With the emergence of digital technologies and the unprecedented growth of the Internet and other related technologies, intellectual property rights (IPRs) the questions of ownership and control of information have become crucial. The programme focuses on the inequitable distribution of IPR, royalty, outflows, and beneficiaries of intellectual property regimes, the lack of balance in current IPR regimes [local, national and international] between consumer rights and IPR-owners’/corporation’s rights. The programme has produced analyses such as WIPO Treaty for the Print Disabled, WIPO Broadcast Treaty, Copyright Amendment Bill and Parallel Importation of Books.

Openness

The advent of the Internet has radically defined what it means to be open and collaborative. Even the Internet is built upon open standards and free/libre/open source software. The broad rubric of the ‘Openness’ programme focuses to provide evidence based research that will help inform policy and practice of the local, national, regional, bilateral and international policies and practices around Open Government Data, Open Access to Scholarly Literature, Open Access to Law, Open Content, Open Video, Open Standards and Free/Libre/Open Source Software. The programme has resulted in reports such as Open Government Data Study, Online Video Environment in India, a reader on the Wikipedia titled Critical Point of View: A Wikipedia Reader and a film titled People are Knowledge – Experimenting with Oral Citations on Wikipedia.

Internet Governance

Governments and private corporations are engaging in human rights violations online. Many different rights are impacted by internet governance policy changes. The growing phenomenon of illegal electronic surveillance by state and non-state actors and censorship of speech online are some specific problems that the Internet Governance programme seeks to address by providing evidence based research that will help inform policy and practice of the local, national, regional, bilateral and international privacy regime in the interests of the public in sectors key to information societies with a particular focus on information technology, privacy and freedom of expression. The programme has resulted in outputs such as Banking, Telecommunications, Consumer Protection, IT Act, Limitations, Copyright, Internet Protocol, Media, Sexual Minorities, UID and policy submissions such as, NIA Bill, IT Act, National Policy on Electronics, Cyber Café Rules, Security Practices Rules, and Intermediary Due Diligence Rules.

Telecom

The growth in telecommunications in India has been impressive. While the potential for growth and returns exist, a range of issues need to be addressed for this potential to be realized. One aspect is more extensive rural coverage and the second aspect is a countrywide access to broadband which is low at about eight million subscriptions. Both require effective and efficient use of networks and resources, including spectrum. The programme has resulted in reports such as India's untapped potential: Are a billion people losing out because of spectrum?, India Study Tour - Report: The South African Telecommunications Sector: Poised for Change and the Unlicensed Spectrum-Policy Brief for Government of India NTP '11.

Unlicensed Spectrum-Policy Brief for Government of India NTP '11 by Satyen Gupta, Sunil Abraham and Yelena Gyulkhandanyan: The research paper aims to recommend unlicensed spectrum policy to the Government of India based on recent developments in wireless technology, community needs and international best practices, and seeks to demonstrate the need for and importance of unlicensed spectrum as a medium for inexpensive connectivity in rural/remote areas, as well as catalyzing innovation by being a barrier-free and cost-effective platform for the testing and implementing of new technologies.

Digital Natives with a Cause?

Digital Natives with a Cause? is a knowledge programme initiated by the Centre for Internet and Society, India and Hivos, Netherlands. It is a research inquiry that seeks to look at the changing landscape of social change and political participation and the role that young people play through digital and internet technologies, in emerging information societies. The programme has resulted in a four-book collective titled Digital AlterNatives with a Cause? and reports such as Digital Natives with a Cause? A Report and Digital Natives with a Cause? Thinkathon: Position Papers.

Digital Natives Video Contest: Twenty-one candidates have been shortlisted, videos will be online soon. Voting begins from March 10, 2012. The Centre for Internet and Society is co-organising the video contest with Hivos, Netherlands.

Researchers@Work

RAW is a multidisciplinary research initiative. CIS believes that in order to understand the contemporary concerns in the field of Internet and society, it is necessary to produce local and contextual accounts of the interaction between the Internet and socio-cultural and geo-political structures. To build original research knowledge base, the RAW programme has been collaborating with different organisations and individuals to focus on its three year thematic of Histories of the Internets in India. Accessibility

Estimates of the percentage of the world's population that is disabled vary considerably. But what is certain is that if we count functional disability, then a large proportion of the world's population is disabled in one way or another. At CIS we work to ensure that the digital technologies, which empower disabled people and provide them with independence, are allowed to do so in practice and by the law. To this end, we support web accessibility guidelines, and change in copyright laws that currently disempower the persons with disabilities.

Internet Governance

Although there may not be one centralised authority that rules the Internet, the Internet does not just run by its own volition: for it to operate in a stable and reliable manner, there needs to be in place infrastructure, a functional domain name system, ways to curtail cyber crime across borders, etc. The Tunis Agenda of the second World Summit on the Information Society (WSIS), paragraph 34 defined Internet governance as “the development and application by governments, the private sector and civil society, in their respective roles, of shared principles, norms, rules, decision-making procedures, and programmes that shape the evolution and use of the Internet.” CIS involvement in the field of Internet governance has taken the following shape:

CIS is doing a project, ‘Privacy in Asia’. It is funded by Privacy International (PI), UK and the International Development Research Centre, Canada and is being administered in collaboration with the Society and Action Group, Gurgaon. The two-year project commenced on 24^th March 2010 and will be completed as agreed to by the stakeholders. It was set up with the objective of raising awareness, sparking civil action and promoting democratic dialogue around challenges and violations of privacy in India. In furtherance of these goals it aims to draft and promote over-arching privacy legislation in India by drawing upon legal and academic resources and consultations with the public.

FCC’s plan to repeal net neutrality may not impact India

India is unlikely to be impacted by the US Federal Communications Commission’s plan to repeal net neutrality regulations.

India adopted a pro-net neutrality stand by taking a tough call against zero-rated plans such as Facebook’s Free Basics and Airtel Zero last year. According to experts, the Indian telecom regulator showed great courage and conviction by battling any type of preferential treatment of internet websites. This was even after a massive campaign by Facebook in support of its Free Basics programme, which promised access to a few basic services free of cost through partnerships with selected telecom service providers.

“Our regulator now thinks of itself as a forerunner in this space, so we doubt they are going to be influenced by the American move,” said Sunil Abraham, Executive Director of the Centre for Internet and Society in Bengaluru. He called the proposal to withdraw the President Barack Obama era regulations “incredible” since they took almost a decade and lots of debate to be framed. Abraham said there is no evidence to suggest that India copies what the US does and there is a long way to go before the new regulations come in.

“The FCC is just one actor in this game — there are the Congress and the courts along with the Federal Trade Commission,” said Abraham, adding that the proposal is likely to be challenged at multiple levels. “I’m proposing to repeal the heavy-handed Internet regulations imposed by the Obama Administration and to return to the light-touch framework under which the Internet developed and thrived before 2015,” FCC chief Ajit Pai, who worked for Verizon Communications earlier, tweeted on Tuesday. The plan shared by Pai will be put to vote on December 14. Experts expect the plan to go through, given the Republican majority in the FCC and they fear it will allow internet service providers like Verizon, AT&T and Comcast to give preference to some sites and apps in return for a fee or for their own business interests.

“If it goes through, it will take control away from the user and companies will be free to make fast lanes and favour the content they like and play the gatekeepers,” said Mishi Choudhary, president at Software Freedom Law Centre.

She said the conversation has once again moved the power back to internet service providers, which will hurt small companies on the pretext of innovation and getting away from micro managing. “It is certainly not bolstering the position of the US as a leader for free and open internet,” added Choudhary. Streaming service Netflix tweeted in response saying that it supports strong net neutrality and opposes the FCC’s proposal.

The Telecom Regulatory Authority of India (Trai) fought a tough battle in 2016 against plans that promised select internet services to poor people by offering them free of cost. The regulator issued differential pricing regulations by which it banned what’s known as zerorating plans. “Trai showed immense foresight by releasing the rules and this is a good opportunity for India to occupy the vacuum of leadership in this space by providing the right regulatory environment,” said Choudhary.

FB & Google have already monopolised Indian cyberspace

In an interview with Catch, Sunil Abraham, executive director of Center for Internet & Society, puts the recent US-India cyber relationship framework into perspective. Abraham also talks about how Indian surveillance policies are outdated and why the country has failed to check the hegemonic tendencies of companies like Facebook and Google.

US-India signed a cyber relationship framework earlier this month. Could you explain some of the takeouts that may have important implications in the near future?

In the framework, both sides have made a "commitment to the multi-stakeholder model of Internet governance" - in immediate practical terms that means India will accept the Internet Assigned Numbers Authority (IANA) transition proposed for the Internet Corporation for Assigned Names and Numbers (ICANN). Unfortunately, as my colleague Pranesh Prakash points out "U.S. state control over the core of the internet's domain name system is not being removed by the transition that is currently underway."

India along with Brazil and other emerging powers should have insisted that the question of jurisdiction be addressed before the transition. We must remember, that the multi-stakeholder model is just a fancy name for open and participatory self-regulation by the private sector. While the multi-stakeholder model is useful as a complement to traditional state-led regulation, it cannot be used to protect human rights or ensure the security of a nation state.

[That is precisely why - the very next sentence in the announcement for the the framework for the US-India Cyber Relationship says "a recognition of the leading role for governments in cyber security matters relating to national security". This is because ICANN-style multistakeholderism requires all stakeholders to be on "equal footing" without "distinct roles and responsibilities". In other words, the governments are saying that the multistakeholder model is fine for all Internet Governance areas with the exception of Cyber Security. Given the limits of the multistakeholder model this is indeed the wise thing to do. Since American corporations dominate the Internet, US foreign policy has historically pushed for the multistakeholder model as fig leaf for forbearance and reduced foreign regulatory burden American corporations operating in other jurisdictions. Therefore India must not drink the multistakeholder cool-aid whole sale. It cannot afford a laissez-faire approach where it waits for corporations to self-regulate - it must regulate whenever public interest or human rights are harmed. In other words, it must go beyond the multistakeholder model and produce appropriate regulation where necessary. Needless to add - it must also deregulate in areas where harms don't exist. Apart from this many of the details of the announcement are positive steps that will increase security in India and the USA, and indeed the also across the world.]

What are some aspects of Intellectual Property Rights that should be looked at, in the context of the framework?

There is some language around Intellectual Property Rights (IPR) that should be examined carefully too. The US corporations benefit from a maximalist IP regime. But Make in India, Digital India and Startup India all depend on flexibilities to the IP regime and therefore India should refuse signing. Trans-Pacific Partnership (TPP) obligations like the "Digital 2 Dozen" which the US is actively proselytizing across the Pacific. If we make that mistake, we will make zero progress in indigenous security research and product development and also many other areas of our economy, health sector and education sector will be severely compromised. Therefore it would be best to keep IP rights expansion and enforcement out of the framework for the US-India Cyber Relationship.

The PIL seeking a ban on WhatsApp was refused by the SC recently. Encrypted messaging services like Telegram however, have been used in the past by terror groups. What's your take on such end-to-end encryption services?

Privacy and security are two sides of the same coin. You cannot have one without the other. End-to-end encryption is the basis for online privacy. End-to-end encryption is a pre-requisite for many legitimate actions of law abiding citizens online such as commerce, banking, tele-medicine, protection of intellectual property, witness/source protection, client confidentiality etc. Therefore, banning end-to-end encryption would mean the death of individual privacy and national security.

If the government wants to promote cyber security it should promote the use of end-to-end encryption amongst law abiding citizens.

Terrorist have to be stopped through targeted profiling, surveillance and interception. Big data analytics may be useful to watch for patterns in the meta data but there is no replacement for good old fashioned police work.

Once suspects have been identified the encrypted channels can be compromised by:

Placing trojans on the end-user devices
Performing man-in-the-middle attacks and
Using brute force attacks with super computers.

Snowden's revelations have made it very clear that blanket and mass surveillance does not help foil terror attacks or stop organised crime. So far, research and government reports from across the world indicate that only a minority of terrorists use encryption. However, this situation may change.

We don't have any proper encryption policy under the IT Act yet. What's taking so long and what are the key points that any policy in this matter must include in future?

We need many different types of encryption policies. We need a policy that mandates encryption and digital signature for all government personnel and also for all government transactions. We need policies that promote research and development in cryptography and mathematics. We need to update our criminal procedure code so that encrypted communications and data can be targeted by law enforcement and used effectively in the criminal justice process.

However, we should not have any broad encryption policy that tries to regulate encryption as a technology. That would be a highly regressive move and will be impossible to enforce. That would breed contempt for rule of law.

Surveillance and the tech around it has been contentious for various governments. Where do we stand vis-a-vis regulating surveillance measures by the state?

Our surveillance and interception laws are outdated. They need to be modernized to deal with advancements in technology and also global developments when it comes to data protection and privacy law.

In fact, our organisation was part of a global effort called Necessary and Proportionate which identified 13 principles to modernise surveillance which are connected to various aspects such as Legality, Legitimate aim, Competent judicial authority, Integrity of communications and systems and more. Some of these principles may have to be customised for the Indian context. [For example, given the load on courts perhaps India should stay with executive authorization of interceptions and data access requests. However, getting the law correct is only half the job. For the law cannot fix what the technology has broken. Some surveillance projects are well designed. For ex. the NATGRID - from what I understand it is a standard and platform that which will allow 12 security, intelligence and law enforcement agencies to temporarily make unions of sub-sets of 21 data sources. These automated temporary databases will be created under existing data access provisions of the law. I also hope the NATGRID is also using cryptography to ensure the maintenance of a non-repudiable log that will identify all officers involved in authorizing the each request and accessing the resultant data. Unfortunately, other surveillance projects are unmitigated disasters. For example, UID or Aadhaar. Many Indians don't realize that Aadhaar is a surveillance project. Biometrics is just a fancy name for remote, covert and non-consensual identification technology. Using the UID database the government can identify every single Indian without their consent. The so called "consent layer" in the India Stack is being developed by volunteers outside the UIDAI to avoid transparency under the Right to Information Act. Nothing in the current layer of the "consent layer" allows citizens to revoke consent. There is no facility in the UID Act to delete yourself from the database. Identity information aka the UID number and authentication information aka your biometrics for about a billion Indians have been collected and stored in a centralized location. It is as if our parliamentarians have written an open letter to criminals and foreign governments says "here is the information you need to wreck whole sale damage - come and get it". Hopefully the Supreme Court will save us from this impending disaster.]

With a sluggish US market, India has the biggest potential for companies like FB & Google, next only to China. Do you feel that in the quest to take over the Indian market, FB & Google are going to monopolise cyberspace in India?

I have news for you - they have already monopolised Indian cyberspace. They have completely wiped out competition in certain domains.

One of the many reasons they have done this is because we don't have laws and regulations to temper their hegemonic tendencies. For example, we could use data portability and interoperability mandates for social media to spark competition in markets where there are entrenched monopolies.

Competition law can be used to protect other firms from abuse of market power. Consumer protection law and privacy law could be used to ensure that user's rights are not compromised in the race for market share. In addition, a modern privacy law compliant with the best practices in the European Data Protection Regulation 2016, would allow emerging Indian companies to compete with giants like Facebook and Google on a level playing field. [Speaking of level playing field - only recently has the government introduced the "equalization levy". This was long overdue. Imagine the amount of tax that could have been collected so far and damage that has been done to competition. Regardless the current NDA government deserves our kudos for ensuring that Facebook and Google contribute their fair share of taxes. The new IPR Policy was also an opportunity to address the monopoly of Google and Facebook. There should have been a concerted attempt to use free/open source software, open standard and open content to bolster Indic language technologies. A billion dollars from every spectrum auction should be used to create incentives for Indian private sector, research and academic organisation who can contribute openly to the Indic cyberspace. This is the market where we can still build a highly competitive market. Today, given government inaction - millions of Indians are training Google's language platforms every time they use machine translation or speech to text technologies. This corpus of information will not be available for public interest research. Ideally we should also have Indians contributing to commons-based peer production projects like Wikipedia for their Indic language needs. Unfortunately the government totally missed this opportunity.]

Fallacies, Lies, and Video Pirates

At a recent conference on counterfeiting and piracy, industry representatives variously pushed for stiffer laws for IP violation, more stringent enforcement of existing IP laws, and championed IP as the most important thing for businesses today. This blog post tries to show how their arguments are flawed.

The Confederation of Indian Industry (CII) organized its third annual conference on counterfeiting and piracy, with support from the United States Embassy and the Quality Brands Protection Committee of China (a body comprising more than 80 multinational companies). Last week we criticised the conference in an open letter. This week, we examine a few of the recurring themes that came up at the conference.

Something being substandard is not the same as something being counterfeit.

This was a mistake made by many whenever they invoked 'counterfeit' in the sense of something that is violative of one's patent and trademark rights. The Indian Drugs and Cosmetics Act itself distinguishes between 'misbranded', 'adulterated', and 'spurious' drugs, thus recognizing that something that is made without proper authorization from rights owners isn't necessarily of a bad quality. Indeed, this was substantiated by an audience member, a lawyer from Dr. Reddy's Lab. She spoke of a mandi in Agra where they seized medicines being sold under the Dr. Reddy's name, but produced by local manufacturers. Upon lab testing, it turned out, much to their surprise, that the medicines were of the highest quality and were not substandard. Similarly, many large companies including trusted FMCG companies like Hindustan Unilever and ITC are upbraided by authorities for violations of the Drugs and Cosmetics Act (for the cosmetics they produce) as well as the Prevention of Food Adulteration Act. Thus, even legitimate businesses can produce substandard products. Thus, a product can be unauthorized but not substandard, just as a product can be substandard but not counterfeit.

This distinction becomes very important when we talk about patents, and especially drug patents. A generic drug is by definition identical or within an acceptable bio-equivalent range to the brand name counterpart with respect to pharmacokinetic and pharmacodynamic properties. Thus, this entire category of high-quality drugs is often sought to be made illegal or counterfeit by large pharma companies. Some countries like Kenya have capitulated. But so far the World Health Assembly has been forced by developing countries to keep the issue of substandard medicines separate from patent-bypassing medicines.

The industry, for all their talk about "out of the box" thinking on the issue, still only consider metrics such the number of piracy raids conducted as measures of success. A question was put forth by Manisha Shridhar of the Intellectual Property & Trade Unit of the World Health Organization upon learning of the quality of the drugs seized at the Agra mandi: Why not cut a licensing deal with those manufacturers, who obviously have excellent production facilities? That kind of thinking, which helped HMV in India in the 1980s, and copying innovative features from video pirates and pricing their products competitively has helped an Indian company, Moserbaer, do extremely well.

Counterfeiters and pirates are not always seeking to fool consumers.

Only lawyers hired by the industry would think that a consumer aspiring towards a Rolex watch would actually think that the one he purchased off the streets for one-hundredth the original's price was in fact original. Street-side DVD hawkers are not thought by the general public to be selling original wares. Still, despite knowing the difference between the original and the fake, consumers many times opt for the latter.

Having said that, counterfeiting, by using someone else's trademark and trying to pass off fake goods as real ones, is quite obviously wrong. It harms customers, and it harms the manufacturers. Thus, a distinction deserves to be made here between the counterfeiters who try to deceive consumers (for instance by copying authenticity marks, like holograms, etc.) and those who are just providing them with highly cheaper alternatives (pirated DVDs, etc.). In this light, it is also important here to distinguish between counterfeiting, traditionally taken to be trademark violation, and piracy, traditionally taken to be a violation of international law, but now generally meaning a large-scale violation of copyright law. While the former can lead to consumer confusion, the latter scarcely ever does. This is ignored by industry people who evoke the image of the consumer quite often, but only when it helps them, and not in any meaningful manner. They negate consumer choice when it comes to consciously purchasing pirated goods, and consumer freedoms when it comes to usage of copyrighted materials.

While commercial film piracy funds terrorists, so does pretty much every business activity.

A favourite of the MPAA (and by association, the MPA) is the RAND report on Film Piracy and its Connection to Organized Crime and Terrorism. This report, which was funded by the MPAA, predictably concludes that film piracy funds organized crime and terrorism. Even if we are to believe its findings wholesale, it leaves us wondering whether all business activities from which terrorists derive funds should be banned.

In India, there is a substantiated link between organized crime and film and music production, and terrorists have been said to make money off the stock market. If the MPA's arguments are taken to their logical conclusions, then film production and equity trading should also be prosecuted. Furthermore, while the mafia and terrorists are the ostensible targets, the laws that are brought about to tackle it affect poor roadside vendors and non-commercial online file sharers. To tackle the funding of terrorists, roadside piracy shouldn't become the target just as film production per se shouldn't. The invocation of the RAND report is thus only meant for rhetorical effect, as it is hard to find logic in there.

"To copy without authorization is to steal", the death penalty, and drug peddling.

At the conference, Dominic Keating of the US Embassy pointed out that "to copy without authorization is to steal" and David Brener of US Customs and Border Protection kept emphasising, on at least two occasions, that "drug peddling merits an automatic death sentence in many countries". There are numerous arguments one can make to show the lack of thought in the former. One could point out that 'stealing' and 'theft' are things that happen to tangible property, and that not only is copyright not tangible, but it is barely property. Copying without authorization creates one more of what existed, without depriving the authorizer (usually a corporation) of its original. This goes against our notion of 'stealing'. If the argument is to be shifted to the terrain of control over one's property/copyright, Mark Lemley in an illuminative article shows how the economic theories behind externalities in property and copyright are vastly different, and that complete control over either has never been, nor should it ever be, an aim of the law. Simply put, someone free riding on your property leaves you worse off than earlier, while someone free riding on your copyright usually doesn't.

One could also point out that 'stealing' is endemic in activities involving human creativity. T.S. Eliot notes that "Immature poets imitate; mature poets steal; bad poets deface what they take, and good poets make it into something better, or at least something different". He does not even consider the possibility that artistic borrowing, whether by imitation or by 'stealing' does not happen. Even Y.S. Rajan, Principal Adviser to CII recognized this when during the conference he noted that "imitation and innovation have an interesting and intertwining philosophical history". If we are to take Mr. Keating's admonishment seriously, we would indeed have a very illustrious list of thieves on our hands, including the Walt Disney Corporation, William Shakespeare, Vladamir Nabokov, Public Enemy, and pretty much every creative person who has ever lived. Books can be written about this (and indeed, numerous books have been), so we shall not dwell on this issue.

Mr. Brener's repeatedly spoke of how drug peddling attracts death penalty in many countries (though in neither the US nor in India has anyone ever received capital punishment for drug peddling), but he also clarified that he is not advocating for the death penalty for copyright violations. That made one wonder why he was bringing up the death penalty at all. He also made the dubious, non-substantiated claim (noting it as "true fact") that pirating movies is more profitable than selling heroin. This claim appears in an article about a report produced by the Australian Federation Against Counterfeit Theft (AFACT), but the original report is nowhere to be found. The article about the AFACT report also claims that the pirates are using their illicit profits promote drug smuggling. The seeming contradiction of film pirates investing in something that is riskier and less profitable doesn't seem to have caught the eye of the writers. One version of the 'drugs are less profitable than pirated DVDs' claim (with marijuana taking heroin's place) was debunked on the Commons Law mailing list. Pirated DVDs are sold for a fraction of the cost of the original. It would be obvious to anyone that DVDs that are typically sold for Rs.30-50, where the cost of manufacture alone may be estimable to be around Rs. 10, cannot be more profitable than heroin peddling. That apart, most online file sharing (deemed to be "piracy") is non-commercial. Thus the question of profit does not really arise. Still, for the industry, absence of a profit is equal to a loss.

Thus, the rhetoric of crime, and that too heinous crime, is continually used, despite its being completely inapposite. Why does used to try to make IP enforcement a matter of state concern, rather than a matter of private, and civil, interest. This way, illegitimate statistics and factoids are used to make individual file-sharers who earn no money get lengthy prison sentences. This and other ways in which IP enforcement has expanded are carefully documented in this paper by Susan Sell.

Repeating false 'statistics' does not make them true.

Again, we were subjected to a number of dubious claims during the conference: If only counterfeiting and piracy were eliminated, India's fiscal deficit would disappear; the Indian entertainment industry loses 16000 crore (USD 4 billion) yearly to piracy; 820,000 direct jobs are lost due to film piracy; software piracy costs the industry USD 2.7 billion annually, etc. These reports' methodologies have been thorougly discredited. Even The Economist, a very conservative and pro-industry newspaper, believes that the BSA-IDC annual reports on software piracy are utterly distorted. Similarly, in the U.S., the figure of 750,000 jobs (around 8% of the U.S. unemployed in 2008) being lost due to piracy were touted by everyone from the Department of Commerce, the Chamber of Commerce, U.S. Border and Customs Protection, and the MPAA, RIAA, and BSA. The amount of money lost each year in the U.S. due to IP infringement has been estimated to be between USD 200-250 billion (that's more than the combined 2005 gross domestic revenues of the movie, music, software, and video game industries). In a lengthy piece in Ars Technica, Julian Sanchez traces back the history of both these figures, and shows how they are just large numbers used for lobbying, and are not based on actual studies. The industry-commissioned Ernst & Young report ("The Effects of Counterfeiting and Piracy on India's Entertainment Industry") was never made available to the public at large, thereby making it impossible to judge the methodological soundness of the survey and the veracity of the figures.

IP expansion and more stringent enforcement is counter-productive.

Chander Mohan Lall, copyright lawyer to various film studios (including Warner Bros.) in India, used a number of short film clips in presentation during the conference. Upon being questioned about it, he admitted that he did not have permissions of the copyright holders, but claimed that his use fell under "the education exception" in Indian copyright law. While I wish he were correct (because what he was doing was indeed educational use), as per the law he is wrong. Section 52(1)(i) of the Copyright Act only exempts educational usage of cinematograph film recordings when "audience is limited to such staff and students [of an educational institution], the parents and guardians of the students and persons directly connected with the activities of the institution". While there are other arguments he could seek to use to make his usage of the film clilps non-infringing, being excepted by the educational fair dealings clauses isn't one of them. Thus, more stringent enforcement of IP rights actually engenders such unauthorized, but perfectly legitimate copying and communication to the public such as that done by Mr. Lall.

Another way in which IP enforcement is being sought to be increased is by way of the so-called Goonda Acts. These are generally statutes aimed at criminals and lumpen elements in society. The Maharastra version, the Maharashtra Prevention of Dangerous Activities of Slumlords, Bootleggers, Drug-Offenders and Dangerous Persons Act, 1981, just became the Maharashtra Prevention of Dangerous Activities of Slumlords, Bootleggers, Drug-Offenders, Dangerous Persons and Video Pirates Act. The term "video pirate" is very widely defined, to include any copyright infringement-chargesheeter who is "engaged or is making preparations for engaging in any of his activities as a video pirates, which affect adversely or likely to affect adversely, the maintenance of public order". Public order is deemed to be disturbed by "producing and distributing pirated copies of music or film products, thereby resulting in a loss of confidence in administration". Thus video pirates can possibly be interpreted to include individual sitting at home and using P2P networks to share films. The only requirement is that they should have had a chargesheet lodged against them previously -- they needn't even have been convicted; being chargesheeted suffices. Thus, non-commercial activities of file-sharing are equated to bootleggers and drug smugglers, and preventive detention (an anti-civil rights relic of India's colonial past) is applicable to them.

IP expansion is happening without the ostensible justifications for IP being kept in mind. That Tirupathi ladoos are going to get GI (geographical indicator) protection was announced at the conference with great pride. Geographical indicators are used to protect consumer interests, to ensure that no one outside a particular region (Champagne) can lay claim to be producing that product (Champagne) if the production of that product is intrinsically linked to special features found in that region (climate, etc.). However, no devout person would want to purchase anything advertised as "Tirupathi ladoo" if it were produced outside the Venkateswara temple at Tirupathi, thus the question of consumer confusion does not arise. What if someone malignantly advertises something as Tirupathi ladoo and claims it was made in Tirupathi (and not just that it tastes like the ladoo made there)? Such a person can be taken to task for deceptive advertising, and there is no need for something to have IP protection to do so. This represents a senseless expansionism of IP. It is now IP for IP's sake.

One of the speakers, Mr. V.N. Deshmukh, who though pro-stringent IP enforcement, astutely noted that, "When local demand is not met, they [consumers] turn to counterfeiters and pirates." Local demand can be unsatisfied because of lack of supply, or because the supply is overpriced, or because the supply is not easy to access, or because what is supplied is inferior to what is demanded. At the end of the day, as William Patry, Google's lead counsel, has noted, what companies sell to the public are products and services, and not IP. It would thus be wise for businesses to be innovative and compete rather than trying to extend their monopolies and engaging in rent-seeking behaviour that is economical harmful to consumers. They would also do well to remember that IP is not only a product but an input as well, so they are ultimately consumers themselves. All the harsher laws and enforcement mechanisms that they push for right now will have unintended consequences, and come to affect them adversely.

Fair process frameworks for cross-border online spaces

Theme: Legal Frameworks and Cyber-crime (Spam, Cyber-security, etc.)

This workshop is organized by the Internet & Jurisdiction Project, a global multi-stakeholder dialogue process launched in January 2012, which engages key actors from states, international organizations, companies, civil society, academia and the technical community from all around the world to address the tension between the cross-border Internet and national jurisdictions.

Over 2,5 billion Internet users interact in shared cross-border online spaces where they can post content potentially accessible worldwide. On the one hand platforms’ Terms of Service try to set transnational rules on acceptable postings, but on the other hand content that is legal in one jurisdiction can be illegal or sensitive in other territories. No clear frameworks exist yet to handle the tensions between these competing normative orders or values and enable peaceful cohabitation in cross-border cyberspaces. This challenge constitutes a rare issue of common concern for all stakeholder groups.

Building upon the intersessional work conducted by the Internet & Jurisdiction Project since the 2012 IGF, the roundtable will address the following topics:

At the IGF 2012, after a year of interaction with different stakeholders, the Internet & Jurisdiction Project organized two workshops titled: “What is the Geography of Cyberspace?” and “What frameworks for cross-border online communities and services?” These sessions explored the roots of the tension between the Internet and the patchwork of national jurisdictions and examined how to address this common concern. Both these two workshops and the ongoing dialogue facilitated by the I&JProject in 2013 (including several preparatory meetings around the world) confirmed the need to explore how to develop appropriate frameworks to handle the tension in a multi-stakeholder setting. Therefore, the I&J Project will gather involved stakeholders at the 2013 workshop “Fair process frameworks for cross-border online spaces” to discuss the way forward: How could appropriate frameworks be developed and what commonly agreed interoperability procedures could ensure fair process?

How could appropriate multi-stakeholder frameworks be developed?

Inclusiveness of the Session

The format of the workshop is going to be an open roundtable discussion between a diverse group of stakeholders on the basis of a structured agenda, without formal presentations. Taking stock of the preparatory process with meetings around the world, the participants will be able to discuss the outcomes of the multi-stakeholder dialogue process, explore the components of possible frameworks and how to move forward. The objective is to produce a structured but fluid and dynamic discussion that includes the audience in the debate.

Suitability for Remote Participation

In addition to the remote participation tools provided by the IGF, the session will be covered live on Twitter with a dedicated hashtag and questions can also be submitted through tweets to open the discussion and engage new stakeholders. Moreover, participants of the Internet & Jurisdiction dialogue process around the world will be encouraged to participate remotely in the discussion.

About the Installation

In the light of recent legal debates concerning street food vending, the video installations question habits of consumption and politics of public spaces complemented by a radio transmission of the audioscape, representing tactical ownership of available spectrum resource within private spaces.

About the Talk

Using urban street food vending as an example, this paper explores the possibilities of a contextualised normative outlook towards competitive markets, competition law, and economic policy in India. I argue that such an outlook would need to creatively engage with the phenomenon of substantial employment informality in India while also judiciously avoiding the allure of dogmatic half-truths based on empirically contestable assumptions about efficiency, illegality and welfare. In India the informal food sector caters to a vast population of desperately poor (and hungry) consumers who cannot afford a qualitatively substitutable product that is retailed through the formal production process. Private enterprise at generating affordable access to food in public spaces remains legally ambiguous, and the narratives of street food law, and street vending more generally, indicate confusion over how to understand the informal sector’s role in competitive urban retail trade. This paper suggests that a distinctively Indian perspective of constitutional economics is required to help us realign our (presently misguided) economic development models to appropriately recognize the empirical realities of the entrepreneurs in our midst, the pre-commitments of our unique constitutional order and competition policy, and the real demands of our customers as citizens.

Notes on the Speakers:

Abhayraj Naik works on issues in legal theory, philosophy, criminal justice, urban governance, ecology, and technology. He holds law degrees from the National Law School of India University (Bangalore) and the Yale Law School (New Haven).

Sharath Chandra Ram has research and pedagogical interests in citizen science, multimodal interaction, accessibility and digital humanities. He graduated from the University of Edinburgh specializing in Artificial Intelligence and interactive virtual environments and is Faculty at Srishti School of Art Design & Technology. As a researcher at the Centre for Internet & Society, he coordinates activities of the Metaculture Media Lab , an open citizen lab, now part of Columbia University's 'Dorkbot' collective.
