Are Chinese video apps violating the Indian law?

The apps have benefited mightily from the short-video craze that’s taken hold among preteens and adolescents but this is putting them in danger from predators, experts said.

Chinese video apps have cracked the Bharat code, but that may not be such a good thing. TikTok, Kwai and LIKE have been downloaded by millions of smartphone users in small-town India who are using them to share personal videos, away from the glare of scrutiny that falls on more mainstream social media platforms.

The apps have benefited mightily from the short-video craze that’s taken hold among preteens and adolescents but this is putting them in danger from predators, experts said. Given the mature nature of much of the content and the age of users, the content on these apps could be in violation of the law, they said.

ET reviewed more than 20 Chinese video apps that dominate the mobile entertainment network of tier-2 and tier-3 cities mostly thanks to titillating videos, suggestive notifications, risqué humour and raunchy content.

TikTok, the popular lip-sync app, is filled with 15-second clips of meme-friendly content featuring its youthful users miming to their favorite songs. The videos range from the harmless to the explicit, depending upon the users followed. The app has gone viral, having racked up close to 100 million downloads and with 20 million monthly active users in India.

The Chinese video apps have their own regional stars such as TikTok’s Awez Darbar, who has 4.2 million fans on the platform. TikTok pays creators anywhere between Rs 5,000 and Rs 50,000 per video, depending upon the kind of content and the sphere of influence, said people with knowledge of the matter.

While all the platforms carry a disclaimer stating that they are not directed at children, their target audience encompasses preteens and adolescents in tier-2 and tier-3 cities, experts said.

“If (these apps) are operating in a manner that under-18 children use it, then one needs to check what are the other safeguards they have built for parental consent--this is definitely something that has to be looked into,” said Supratim Chakraborty, associate partner at law firm Khaitan & Co. “From a national security standpoint, children fall under the sensitive category. Today, there is a lack of law to put forward strict compliance.”

Another expert said the user profile violates the stated policy of the apps and IT law.

“Be it TikTok, LIKE, Kwai or any of these video apps, (they) have a significant number of young girls, boys and preteens using the application,” the person said.

Live-streaming applications such as Bigo Live and UpLive focus more on personal interaction but these appear to skirt dangerously close to breaking the law, exposing children to nudity and possibly those who seek to coerce or groom underage users into committing explicit acts.

Users are encouraged to explore further through the notifications. “Press here! Surprising gift waiting for you,” is one sent by Uplive when a user logs on. “Sweet is waiting for you in MeMe live <3, Watch magical girl’s LIVE, Come see me now! Sonam who you’re following posted a new video,” are a few other notifications from the app. These notifications are accompanied by a thumbnail of scantily clad women and an ‘invitation’ to open the app. Users get three to five of these every time they clear the screen.

The apps are available in Indian languages, making them easier to use than Facebook or Instagram. However, the privacy policies are in English, making them that much more difficult to understand if users in such locations want to take the trouble of checking the terms and conditions.

Despite the rapidly growing user base, apps like TikTok don’t have a grievance redressal officer in India. The government is insisting on this for all major social media platforms.

A government official said users should flag concerns over such apps so that the state can take action.

“Even if people upload obscene content with their consent, it still does not absolve (you) of the crime,” said a senior bureaucrat with the ministry of electronics and information technology. “One is ignorance, then there is a burgeoning of technology leading to all these. Somebody must start reporting these cases, be it a victim or a well-wisher of the society for the government to take note.”

As with Indian apps, apart from generic privacy policies that aren’t available in local languages, the Chinese ones don’t have layered consent—allowing users to opt out of certain obligations if they wish to do so. ShareChat is the only Indian regional social media app that has its privacy policy in 10 regional languages.

A reading of the privacy policies of the Chinese apps also suggests that they hoover up a vast quantity of data with a one-click, opt-in button. This includes sharing location, contacts, allowing audio and video recording and full network access.

Apps such as Nonolive do not mention any India-specific clauses in their privacy policy. A few like video chat app Tango comply with the General Data Protection Regulation (GDPR), the European privacy law that has stipulated 13+ as the age of use.

TikTok, which has faced temporary bans in other countries in the past, is an exception with a specific India clause offering limited rights to users. It has an exhaustive 5,000-word privacy policy outlining the data collection, processing and sharing practices it follows. TikTok previously sparked outrage in Hong Kong for not protecting the privacy of children under 10, exposing their identities and uploading inappropriate content.

The Chinese apps pose several potential risks, said Swetha Mohandas, policy officer at the Center for Internet and Society, an advocacy group.

“The draft DP (data protection) Bill in the current stage provides greater responsibility on data fiduciaries to maintain the privacy of the individual and the security of the data,” she said. “There are a lot of questions that these apps pose with respect to the Bill, some of them being the security, the data storage provision, the personal data of children, and most importantly that these apps might have recordings that might be sensitive personal data.”

Most of these apps including TikTok explicitly state that though they have appropriate technical and organisational measures in place, “they cannot guarantee the security of your information transmitted through the platform”. Dubsmash said that it complies with local laws and allows users only above 14 to use its app. The other apps ET reached out to did not respond to queries.

Session Plan

2017 saw the sudden emergence of the hashtag #metoo, both in India and across the world. This has impacted not just the general public of the internet, but also the global movement women's rights movement and feminist discourse around sexual assault, gender and consent. #MeToo allowed (female) survivors of harassment to resort to social media platforms such as Twitter and Facebook as a tool to accuse powerful men of sexual harassment. In 2017, we saw this with Rose McGowan who tweeted about Harvey Weinstein or Raya Sarkar who released #LoSHA, which further erupted in late 2018 into a larger wave of ‘outing’ of Indian perpetrators in media, politics, and other areas of work.

With #LoSHA and the 2018 wave of #metoo in India, there have been a gamut of responses, even some amount of polarisation, especially among Indian civil society. During #LoSHA, we observed resistance from traditional legal and Human Rights activists and practitioners against acknowledging the unique impact of ‘survivors’ testimonies on social media’ for fear of validating a method that lies outside of ‘due process’ and ‘fair trial’. They reason that due to the ungoverned nature of social media, its platforms are without checks and balances and therefore cannot regulate arbitrary misuse. However, one can argue that social media platforms are indeed regulated by the service providers who have the ultimate power to censor complainants by simply suspending or expelling them from the platform altogether. This became evident when Twitter silenced Rose McGowan and Facebook, Raya Sarkar, promptly after their testimonies began to gather accelerated traction. Thus, the accused may always appeal to the ultimate gatekeepers, the platform providers themselves. It is precisely due to the above stated reasons, that the 2017-2018 wave of social media testimonies has garnered considerable support from a typically contemporary civil society, who recognise the disruption as powerful despite the gaps in the methodology.

Our Proposal

The tentative proposal is for our team of 2 researchers to carry out a 15-20 minute lightning talk (a conversation or debate) providing a landscape analysis of #metoo, raising specific points of discussion and interest. Following this, we will open up the discussion with the audience in the form of multiple roundtable conversations, which will seek to address the following 2 questions:

If survivors of sexual harassment are resorting to social media as a ‘means’, or their choice of instrument, what does this imply about the existing fora for due process?
New and emergent imaginaries/perspectives around the end of ‘justice’ that may lie outside the contours of conventional legal frameworks i.e. to what ‘end’ are these survivors disposed?

Our session aims at working towards the following outcomes:

A comprehensive analysis of the advantages and disadvantages of phenomenon of social media - mediation of justice
A current and expanded understanding of 'justice' that is not bound by legal recourse

Session Team

Esther Anne Victoria Moraes (Communications Manager, The YP Foundation) is a feminist activist and researcher who is passionate about expanding the discourse on the evolving forms of rights-based movements. At TYPF, Esther works on building feminist leadership through on-ground programming and on research on youth movements. Esther also works with on communication and public advocacy around issues of health, rights and youth leadership with a focus on young girls and adolescents. She coordinates online and on-ground public advocacy on sexual and reproductive health and rights and access to information through TYPF's national-level campaign, Know Your Body, Know Your Rights.

Manasa Priya Vasudevan (Programme Manager, The YP Foundation) is a feminist activist researcher who is passionate about the theory and praxis of social justice in an increasingly internet-mediated world, especially in the context of urbanization and datafication. She has undertaken research and advocacy on issues at the intersections of information communication technologies and social justice, primarily in the area of internet governance. She has actively engaged with international multi-sectoral movement building and strategy, both online and offline. At TYPF, she manages the Know your body know your rights programme. Prior to this, she worked at IT for Change in Bengaluru.

Session Plan

The internet-based List of Sexual Harassers in Academia (LoSHA), initiated by Dalit feminist and lawyer activist Raya Sarkar in 2017 anonymously crowd-sourced names of academics and activists who were accused of harassing women colleagues and students. While a large number of women in the academia rallied in support of the list and its motivations, it also unleashed anxieties about how the list was put together, and the kind of impact it was feared to have. Variously, it has been equated to Khap Panchayats, vigilantism, mob lynchings etc. Last month, the government of India launched an online National Database on Sexual Offenders (NDSO), which will contain the details—names, photographs, residential address, fingerprints, DNA samples, PAN and Aadhar numbers—of individuals convicted on charges of sexual offences against women and children. An associated portal, the Cyber Crime Prevention Against Women and Children (CCPWC) was also launched where citizens can enter complaints against child pornography and other sexually explicit material. Both are modes of digital enlisting through the use of new media technologies, one that is open access and therefore available for modification, co-option and critique, while the other is to be accessible only to law personnel. This two-member panel locates the list in the context of ongoing debates about the conversion of social justice and rights issues in to data repositories. We take in to account the debates on the Right to be Forgotten or the right to delist from the internet, as a specific concern raised in the Personal Data Protection Bill 2018 submitted by the Justice B.N. Krishna Committee. The Bill recognises data principals (or the individuals to whom personal data belongs) as a central component of the legal framework, and subjects data fiduciaries (or agencies seeking to collect, use and process personal data) to the free, informed and explicit consent of the data principals. Right to be Forgotten has clearly emerged as a logical extension of the demands for one’s Right to Privacy. Given that a number of logics, that of ‘naming and shaming’ of offenders, a digital list (database) as a means of communication, dissemination of information and surveillance etc. underscore both the #LoSHA and the NDSO, how do we navigate the messy terrain of human rights concerns about the freedom of speech and expression on the one hand, and the rights to privacy on the other hand? We also think about this vis-a-vis the larger issues related to the data economy and those of data ownership. We refer to studies on state-generated data on crime in India and elsewhere to understand how such data artefacts can be monopolised and processed by private and non-governmental agencies, and how they co-opt contemporary feminist politics and articulations?

We, Samata Biswas and Ria De, will present a collaborative study, organised across two 30 minute long papers, plus a 15 minute discussion time for each totalling to the mandated 90 minute session. The first paper will study the form and scope of the list as a digital artefact through a detailed analysis of the #LoSHA and the NDSO. The second paper will configure the two lists in terms of their status within the data economy.

Ria De is pursuing her PhD in Film Studies at the English and Foreign Languages University, Hyderabad. Her doctoral research was about stardom and intermediality. She is interested in popular culture, network and media studies and gender. Currently, she is interested in the women’s movements in the Indian film industries.

Samata Biswas teaches English Literature at Bethune College, Kolkata, India. Her doctoral research was about body cultures in contemporary India, analysing fitness, weight loss, and diet discourses as present in popular media as well as through narratives of participants. She is interested in visual culture, gender studies, and literature and migration. At present, she is trying to map Kolkata as a sanitary city, focusing on access to clean sanitation or the lack thereof. She runs the blog ‘Refugee Watch Online’. Her latest publication is on “Haldia: Logistics and Its Other(s)” in Brett Neilson, Ned Rossiter, Ranabir Samaddar (Edited) Logistical Asia: The Labour of Making a World Region. Van Bodh Workshop for content development on Forest Resources at Gadchiroli

CIS-A2K has collaborated with Tribal Research and Training Institute (TRTI) to facilitate development of Open knowledge resources on Community Forest Resource and content development in Wikimedia projects with community participation. These contents will become a part of "Van Bodh Knowledge repository".

Mumbai School of Economics and Public Policy, Bombay University has formulated and going to start a "Diploma course in Community Resource Management " with the support of TRTI, Pune from 2nd of oct 2018. This is a historic attempt to impart education of the level of a diploma to rural, especially tribal youth without any condition of academic qualification. The course was conducted at Mendha(Lekha) an hamlet in Dhanora taluk of Gadchiroli District. CIS-A2K has collaborated with TRTI to facilitate development of Open knowledge resources on Community Forest Resource and content development in Wikimedia projects with community participation.

Highlights

Published an article titled "Digital Technology Engaging Pedagogy through Hindi Wikipedia - A Case Study" in International Journal of English Language, Literature in Humanities. The authors of the article were Hindi faculty members of Christ University. Ananth Subray from Centre for Internet & Society provided research assistance.
Ananth Subray wrote an article "History of Wikipedia Education programme at Christ University" which has given an insight of Christ Wikipedia Education Program, how students are involved in different capacities in the program and shares the best practices of the Education Program.

Elonnai Hickok and Arindrajit Basu co-authored a research paper that was published as part of the Briefings from the Research and Advisory Group (RAG) of the Global Commission on the Stability of Cyberspace (GCSC) for the Full Commission Meeting held at Bratislava in 2018.
Arindrajit Basu in an article published by Oxford Human Rights Hub has argued that artificial Intelligence offers the potential to augment many existing bureaucratic processes and improve human capacity, if implemented in accordance with principles of the rule of law and international human rights norms.
Agnidipto Tarafder and Arindrajit Basu in an article published in Socio-Legal Review has traced the journey of the recent 377 (Navtej Johar v Union of India) and assessed its societal implications.
CIS invites applications for *three Research Fellow positions* to undertake field studies of platform-work in two cities, including Bangalore and another city (to be decided). The project seeks to produce a comparative understanding of at least two different kinds of platform-work as unfolding across Indian cities. Each fellow will be responsible for one field study (one form of work in one city) based on their language fluency and research experience.

Access to Knowledge

Our Access to Knowledge programme currently consists of two projects. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

As part of the project grant from the Wikimedia Foundation we have reached out to more than 3500 people across India by organizing more than 100 outreach events and catalysed the release of encyclopaedic and other content under the Creative Commons (CC-BY-3.0) license in four Indian languages (21 books in Telugu, 13 in Odia, 4 volumes of encyclopaedia in Konkani and 6 volumes in Kannada, and 1 book on Odia language history in English).

The areas of focus include digital accessibility for persons with disabilities, access to knowledge, intellectual property rights, openness (including open data, free and open source software, open standards, open access, open educational resources, and open video), internet governance, telecommunication reform, digital privacy, and cyber-security. The academic research at CIS seeks to understand the reconfigurations of social and cultural processes and structures as mediated through the internet and digital media technologies.

Digital Technology Engaging Pedagogy through Hindi Wikipedia - A Case Study

The article is titled "Digital Technology Engaging Pedagogy through Hindi Wikipedia - A Case Study". Abstract

Hindi Wikipedia (Hindi Edition of Wikipedia) in the undergraduate language classroom. Wikipedia or Open Source Learning is a powerful tool in the acquisition of knowledge especiallyin today’s digital context.While many of the European languages have already established afoothold in the digital space, the Indian languages are yet to create a niche for themselves. Even after a decade of its launch,the Hindi Wikipediacould not attire the enabled richness of the English Wikipedia.While there are about fifty lakh articles in English, Hindi Wikipedia has only about a lakh.

This paper is an attempt to show how a whole new concept of productive activity for faculty andstudents can be opened through a study of basics in Indian language computing typing and editing Wikipedia articles.It explains the value of Wikis for teaching and learning as compared to traditional teaching and physical paper assignment model, showing the power of Open Source Learning and Wikipedia.Most importantly, it shows how Wikipedia and Global Peer Review can directly and immediately influence the quality and relevance of Teaching and Learning in classrooms and learning spaces today.This pilot study ofstudents’ use of sources in authoring Wikipedia articles shows, how students processed texts from sources to compose their own texts transforming classrooms from a place of knowledge deliveryto a place of creativity and research.Through Wikipedia, students are being empowered tobecome creative writers, efficient editors and successful researchers. Article creation and editingof articles in Hindi for Wikipedia is bound to transform the students’ ability to interpret, analyze,create new knowledge and develop their Research Aptitude. This article addresses the importance of Digital Learning through Wikipedia as Pedagogy in Christ University’s UG language classrooms and discusses the prospects and possibilities of using Wikipedia as a learning tool through a case study.

Pranesh Prakash was a panelist and moderator in a panel discussion on Equitable Access to Knowledge on October 23, 2018 at Indian Institute of Science (IISc), Bangalore. The event was hosted by DST Centre for Policy Research (IISc), Bangalore.

Open Access seeks to return scholarly publishing to its original purpose: to spread knowledge and allow that knowledge to be built upon. Price barriers should not prevent students, researchers (or anyone) from getting access to research they need. Open Access, and the open availability and searchability of scholarly research that it entails, will have a significant positive impact on everything from education to the practice of medicine to the ability of entrepreneurs to innovate.

Spending too much time on social media? Tech abuse may lead to mental health issues

Technology is a boon, no doubt. But where can we, in ourdigital lives, draw the line between convenience and addiction? ET’s Divya J Shekhar finds out how the IT city is dealing with internet addiction and how collective social effort might help find the sweet spot.

Fifty-odd residents in Hebbal switched off all their digital devices between 7 and 9 pm two days ago on World Mental Health Day. This Saturday, they will join other members in their 1,200-strong group to plug out once again. They plan to make this a weekly ritual.

At the centre of this initiative, which is called 'Time Out from Plugins', is a mother who started researching on technology addiction after observing her 16-year-old son play online games for long hours. Tejaswi Uthappa, a freelance writer, said that her otherwise wellbehaved son becoming irritable and snappy after being glued to the gaming console for hours got her thinking about the ill-effects of letting technology take over our lives.

Types of Technology Addiction

“As parents, we might casually complain about our children spending most of their time on television, digital games or laptops. But this is actually far more serious because it impacts their brain, and eventually, their behaviour,” said Uthappa, who now wants to reach out to schools and colleges to help create awareness about technology-addiction among youngsters.

An increasing number of Bengalureans are getting addicted to technology. Just last week, a 26-year-old checked in to the National Institute of Mental Health and Neurosciences (Nimhans) to seek treatment as he had watched Netflix for over seven hours a day for the past six months in order to escape the reality of his unemployment. From excessive PUBG (online game) and social media overdose to need for virtual validation and incessant online shopping, psychiatrists are treating a gamut of technology addictions.

How Much is Too Much?

According to experts at Nimhans, eight out of 10 technology addiction cases are related to online gaming. This is in line with a 2013 survey conducted by the Indian Council for Medical Research in Bengaluru, which revealed that 4.1% people in the IT city between 18 and 60 years of age were addicted to their mobile phones, while 1.3% were internet addicts. This number might have increased with the Telecom Regulatory Authority of India (Trai) stating that as on March 2018, there were 1.18 billion wireless subscribers and 493 million internet or broadband subscribers in the country.

Manoj Kumar Sharma, a clinical psychologist at the Service for Healthy Use of Technology (SHUT) Clinic at Nimhans, said that he caters to almost six-seven patients every week, up from two-three people who checked into the clinic when it launched in 2014. “It goes to show that people are conscious and are actively taking action to correct their addictive tendencies,” he said. Most people between ages 16 and 20 are addicted to social media, Sharma explained, tend to develop body image issues if their online activity or post does not garner enough attention or ‘likes’. This need for validation from virtual friends to make up for their lonely reality is also directly proportional to the number of cosmetic surgeries.

IT City's Tech Addiction

For those between 24 and 28 years of age, the addiction is usually in the form of pornography or online streaming platforms like Netflix. Experts have also coined the term ‘online infidelity’ to describe a condition where adults satisfy themselves using online platforms rather than through physical intimacy with their respective partners.

“There is a bidirectional relationship between depression and use of technology. The latter can be used as a coping mechanism for stress and anxiety. Conversely, technology abuse can also intensify depression,” said Sharma.

Medical professionals state that ideally, an individual’s daily social media consumption should be broken down to brief 20 minute sessions. “When a digital screen is the last thing you look at before going to sleep, it messes with your hormones. For instance, the heart and pulse rate increase, blood pressure for those with hypertension tends to increase and the body’s response to diabetes medication will vary,” said consulting physician and cardiologist Dr B Ramana Rao.

Increased exposure to technology, he explained, affects eyesight, causes mood alterations, and makes individuals angry and irritable. There are four main criteria, experts said, through which addiction can be determined: if use of technology affects your sleep, productivity, interpersonal relationships and makes you isolate yourself from social activities.

Open Communication

Parents, counsellors, schools and colleges are recognising the need to work together to find solutions and disconnect those vulnerable to internet overuse. Mansoor Ali Khan, member, board of management, Delhi Public School, said that while schools are often considered “uncool” if they do not use technology in classrooms, it is necessary to understand that sometimes, simple, conventional learning works best.

“Children who have been handed iPads and smartphones when they are as young as three years old, have lower concentration levels and learning capability. Moreover, the conversations they have with friends also restricted to TV shows and games,” he said.

Do you have Nomophobia?

The school plans to increase cyber literacy and make the discourse around technology addiction more transparent. Sharma of SHUT Clinic, who launched a Digital Detox app earlier this year, is now developing an intervention module that he wants to take to schools and colleges. This, he said, will help academicians study how to control use of technology as a coping mechanism for peer pressure, boredom and stress. It would also help, he
added, if parents and elders are less judgmental about those needing help.

Sunil Abraham, executive director, The Centre for Internet and Society, told ET that parents must understand the concept of introducing incremental screen time to avoid addiction. This means, children between ages 1 and 3 must have zero screen time, those between 3 and 9 must have one hour of screen time every day, while adolescents between 9 and 15 years of age can access internet only for two hours daily.

“Parents todayccessed by children need to be kept in common areas like the living room,” said Abraham, stressing that parents should never use gadgets to distract children or keep them busy.

Tejaswi Uthappa agrees. According to her, open lines of communication about internet usage and cyberspace helps people seek help. “Our initiative, for instance, started with just me. But now, there are over a thousand adults — parents, working professionals or homemakers - who come on-board the moment they hear that we combat internet addiction. Only our intent and not our method, matters to them,” she said. “So it is a question of stakeholders acknowledging that this as a problem and coming together to find ways to solve it.”

Sting job by Hyderabad scientist exposes fake journals

Scientists have at last found a cure for Schlodomoniasis -- a deadly brain infection caused by the "inter-galactic parasite Klaousmodium cruzi" -- they claim to have identified for the first time.

Beth Smith and co-workers at "Sanchez Institute for Biomedical Sciences for Doopidoo Research" in Morocco have published their discovery in three science journals and also reported a novel method called "Magnetic Oddities Radiation Therapy (MORTY)" to treat the infection. The study was carried out in "Wakandan population".

If readers are breaking their heads to understand the startling findings and decipher the strange words like "Wakandan" and "Doopidoo", Farooq Ali Khan, a college professor and PhD student in Hyderabad and a co-author of the paper, had the last laugh.

"It was not intended to be a scientific paper," he told this correspondent in an email. "It was my sting operation to expose publishers of predatory journals who are churning out fake science for profit."

Open access journals are supposed to provide an online platform for rapid dissemination of latest updates in science and technology. Their publishers don't charge the readers as access to these journals is free, but they charge the authors wanting to have their research papers published in these journals.

Inspired by previous publishing "stings", Khan wanted to test whether open access journals would publish an obviously absurd paper liberally salted with nonsense for the sake of money from gullible authors anxious to publish.

He created a spoof manuscript titled "Newer Tools to Fight Inter-Galactic Parasites and their Transmissibility in Zygirion Simulation", and submitted it to several suspect journals from the list kept online by Jeffrey Beall -- an associate professor and librarian at the University of Colorado who coined the term "predatory journal" -- as a public service to his colleagues.

All the hilarious fake names like "schleem", "dinglebop" and "schwitinization", that do not make any sense, as well as images and graphs published in the paper, were fabricated.

The "Zyrgion simulation", and "intergalactic parasites" are all references to "Rick and Morty" -- a US Cartoon Network's animated science fiction programme about the misadventures of mad scientist Rick Sanchez and his grandson Morty Smith.

Khan, a great fan of "Rick and Morty", submitted the paper with Beth Smith (Rick's granddaughter in the cartoon show) as the corresponding author and himself as co-author. Two other authors' names were made-up, and Sukant Khurana -- a scientist at Central Drug Research Institute in Lucknow, who offered to help Khan in this sting, was another author -- all affiliated to an institution in Morocco that does not exist.

The so-called "Magnetic Oddities Radiation Therapy" developed by the authors to treat the brain infection is again nothing but an expansion of "MORTY", a character in the cartoon show.

Anyone with commonsense would have noticed all the nonsense and consigned the paper to trash, but Khan surprisingly found it was accepted for publication by 10 journals for fees ranging from $75 to $650.

After some bargaining over fees, three scientific journals -- ARC Journal of Pharmaceutical Sciences, IOSR Journal of Pharmacy and Biological Sciences, and Clinical Biotechnology and Microbiology -- published the paper without a second glance.

Khan says his "scientific prank" was intended to expose the seriousness of predatory journal industry and to create awareness among people who are beginning their careers in science. "These predatory journals are polluting the scientific record with junk science and are also resulting in fake news."

"When the Open Access Declaration was drafted in 2002, no one would have imagined that many unscrupulous individuals would pollute the entire system of scholarly communication with predatory journals solely with the idea of making money," Subbiah Arunachalam, renowned information scientist and Distinguished Fellow of the Centre for Internet and Society in Bengaluru, told this correspondent in an email.

"Unfortunately, many Indians -- both individuals and companies -- are in this business," he said. "Predatory journals pose a big threat to the integrity of research."

"These are shameful acts by greedy publishers," Subhash Lakhotia, a professor of zoology at the Benaras Hindu University, told this correspondent in an email. "Until we stop payments of all kinds of open access charges and modify the present faulty assessment system that relies on numbers of publications, predation in one or the other form would continue."

Why Data Localisation Might Lead To Unchecked Surveillance

In recent times, there has been a rash of policies and regulations that propose that the data that Indian entities handle be physically stored on servers in India, in some cases exclusively. In other cases, only a copy needs to be stored.

The article was published in Bloomberg Quint on October 15, 2018 and also mirrored in the Quint.

In April 2018, the Reserve Bank of India put out a circular requiring that all “data relating to payment systems operated by them are stored in a system only in India” within six months. Lesser requirements have been imposed on all Indian companies’ accounting data since 2014 (the back-up of the books of account and other books that are stored electronically must be stored in India, the broadcasting sector under the Foreign Direct Investment policy, must locally store subscriber information, and the telecom sector under the Unified Access licence, may not transfer their subscriber data outside India).

The draft e-commerce policy has a wide-ranging requirement of exclusive local storage for “community data collected by Internet of Things devices in public space” and “data generated by users in India from various sources including e-commerce platforms, social media, search engines, etc.”, as does the draft e-pharmacy regulations, which stipulate that “the data generated” by e-pharmacy portals be stored only locally.

While companies such as Airtel, Reliance, PhonePe (majority-owned by Walmart) and Alibaba, have spoken up in support the government’s data localisation efforts, others like Facebook, Amazon, Microsoft, and Mastercard have led the way in opposing it.

Just this week, two U.S. Senators wrote to the Prime Minister’s office arguing that the RBI’s data localisation regulations along with the proposals in the draft e-commerce and cloud computing policies are “key trade barriers”. In her dissenting note to the Srikrishna Committee's report, Rama Vedashree of the Data Security Council of India notes that, “mandating localisation may potentially become a trade barrier and the key markets for the industry could mandate similar barriers on data flow to India, which could disrupt the IT-BPM (information technology-business process management) industry.”

Justification For Data Localisation

What are the reasons for these moves towards data localisation?

Given the opacity of policymaking in India, many of the policies and regulations provide no justification at all. Even the ones that do, don’t provide cogent reasoning.

The RBI says it needs “unfettered supervisory access” and hence needs data to be stored in India. However, it fails to state why such unfettered access is not possible for data stored outside of India.

As long as an entity can be compelled by Indian laws to engage in local data storage, that same entity can also be compelled by that same law to provide access to their non-local data, which would be just as effective.

What if they don’t provide such access? Would they be blacklisted from operating in India, just as they would if they didn’t engage in local data storage? Is there any investigatory benefit to storing data in India? As any data forensic expert would note, chain of custody and data integrity are what are most important components of data handling in fraud investigation, and not physical access to hard drives. It would be difficult for the government to say that it will block all Google services if the company doesn’t provide all the data that Indian law enforcement agencies request from it. However, it would be facile for the RBI to bar Google Pay from operating in India if Google doesn’t provide it “unfettered supervisory access” to data.

The most exhaustive justification of data localisation in any official Indian policy document is that contained in the Srikrishna Committee’s report on data protection. The report argues that there are several benefits to data localisation:

Effective enforcement,
Avoiding reliance on undersea cables,
Avoiding foreign surveillance on data stored outside India,
Building an “Artificial Intelligence ecosystem”

Of these, the last three reasons are risible.

Not A Barrier To Surveillance

Requiring mirroring of personal data on Indian servers will not magically give rise to experts skilled in statistics, machine learning, or artificial intelligence, nor will it somehow lead to the development of the infrastructure needed for AI.

The United States and China are both global leaders in AI, yet no one would argue that China’s data localisation policies have helped it or that America’s lack of data localisation polices have hampered it.

On the question of foreign surveillance, data mirroring will not have any impact, since the Srikrishna Committee’s recommendation would not prevent companies from storing most personal data outside of India.

Even for “sensitive personal data” and for “critical personal data”, which may be required to be stored in India alone, such measures are unlikely to prevent agencies like the U.S. National Security Agency or the United Kingdom’s Government Communications Headquarters from being able to indulge in extraterritorial surveillance.

In 2013, slides from an NSA presentation that were leaked by Edward Snowden showed that the NSA’s “BOUNDLESSINFORMANT” programme collected 12.6 billion instances of telephony and Internet metadata (for instance, which websites you visited and who all you called) from India in just one month, making India one of the top 5 targets.

This shows that technically, surveillance in India is not a challenge for the NSA.

So, forcing data mirroring enhances Indian domestic intelligence agencies’ abilities to engage in surveillance, without doing much to diminish the abilities of skilled foreign intelligence agencies.

As I have noted in the past, the technological solution to reducing mass surveillance is to use decentralised and federated services with built-in encryption, using open standards and open source software.

Reducing reliance on undersea cables is, just like reducing foreign surveillance on Indians’ data, a laudable goal. However, a mandate of mirroring personal data in India, which is what the draft Data Protection Bill proposes for all non-sensitive personal data, will not help. Data will stay within India if the processing happens within India. However, if the processing happens outside of India, as is often the case, then undersea cables will still need to be relied upon.

The better way to keep data within India is to incentivise the creation of data centres and working towards reducing the cost of internet interconnection by encouraging more peering among Internet connectivity providers.

While data mirroring will not help in improving the enforcement of any data protection or privacy law, it will aid Indian law enforcement agencies in gaining easier access to personal data.

The MLAT Route

Currently, many forms of law enforcement agency requests for data have to go through onerous channels called ‘mutual legal assistance treaties’. These MLAT requests take time and are ill-suited to the needs of modern criminal investigations. However, the U.S., recognising this, passed a law called the CLOUD Act in March 2018. While the CLOUD Act compels companies like Google and Amazon, which have data stored in Indian data centres, to provide that data upon receiving legal requests from U.S. law enforcement agencies, it also enables easier access to foreign law enforcement agencies to data stored in the U.S. as long as they fulfill certain procedural and rule-of-law checks.

While the Srikrishna Committee does acknowledge the CLOUD Act in a footnote, it doesn’t analyse its impact, doesn’t provide suggestions on how India can do this, and only outlines the negative consequences of MLATs.

Further, it is inconceivable that the millions of foreign services that Indians access and provide their personal data to will suddenly find a data centre in India and will start keeping such personal data in India. Instead, a much likelier outcome, one which the Srikrishna Committee doesn’t even examine, is that many smaller web services may find such requirements too onerous and opt to block users from India, similar to the way that Indiatimes and the Los Angeles Times opted to block all readers from the European Union due to the coming into force of the new data protection law.

The government could be spending its political will on finding solutions to the law enforcement agency data access question, and negotiating solutions at the international level, especially with the U.S. government. However it is not doing so.

Given this, the recent spate of data localisation policies and regulation can only be seen as part of an attempt to increase the scope and ease of the Indian government’s surveillance activities, while India’s privacy laws still remain very weak and offer inadequate legal protection against privacy-violating surveillance. Because of this, we should be wary of such requirements, as well as of the companies that are vocal in embracing data localisation.

Sunil Abraham, in an article in the Hindustan Times, explores what leads to fake news. He has revealed that transparency regulations is the need of the hour especially for election campaigns and political advertising.
Amber Sinha, Elonnai Hickok, Udbhav Tiwari and Arindrajit Basu co-authored a blog post which examines cross-border data sharing. The authors have argued that conventional methods of compelling the presentation of evidence available for investigative agencies often fail when the evidence is not present within the territorial boundaries of the state.
Arindrajit Basu and Elonnai Hickok wrote a blog entry on usage of artificial intelligence in governance sector in India. As per research though artificial intelligence has the potential to ameliorate structural inefficiencies in governmental functions, the deployment of this technology across sub-sectors is still on the horizons.
Amber Sinha, Elonnai Hickok and Arindrajit Basu produced a research paper on the implications of artificial intelligence in India in various sectors such as health, banking, manufacturing, and governance sectors.
Artificial Intelligence in many ways is in direct conflict with traditional data protection principles and requirements including consent, purpose limitation, data minimization, retention and deletion, accountability, and transparency. Authors Elonnai Hickok and Amber Sinha have explained this in a blog entry.
The researchers@work programme has selected 10 essays, based on an open call announced in August, engaging with the thematic of "offline". The abstracts of the selected essays have been published, and the final essays will be published on the upcoming r@w blog.

Access to Knowledge

Our Access to Knowledge programme currently consists of two projects. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

We are inviting applications for the position of a Programme Officer (Communication) to join the Access to Knowledge (CIS-A2K) team at the Centre for Internet and Society. Please find below the description of the position, the eligibility criteria, and the application process.

To contribute to, support, and lead public communication of the work of the CIS-A2K team, we are looking for a creative, dedicated, and enterprising individual to join the team as Programme Officer (Communications). Project Background

The CIS-A2K team is supported by Wikimedia Foundation to work towards catalysing the growth of the open knowledge movement in south Asia and in Indian languages. The current work plan (2018-19) of the CIS-A2K team is focused on working towards creating an inclusive Wiki atmosphere in India, with emphasis on creating safe spaces, and promoting activities to bridge gender gap in Wiki projects across languages. Further, CIS-A2K facilitates exchange and incubation of ideas amongst Indian language Wikimedia communities, which contributes to the growth of these community and enables emergence of community leaders. During the current year, the A2K team is investing resources and energy on 4 programs/ideas that we believe are going to be 'triggers of change': 1) Focus Project Area, 2) MediaWiki Training, 3) Bridging Gender Gap, and 4) Wikisource Conference India. Responsibilities

The CIS-A2K team is primarily based in the Bangalore office of CIS, and the Programme Officer (Communication), henceforth POC, will be expected to work out of the same office. Members of this team are also based in Bhubaneswar (Odisha), Hyderabad (Telangana), and Sangli (Maharashtra), and the POC will be expected to work closely with them - generally remotely, and sometimes by travelling to these locations

To support and drive outreach of the work being done by the CIS-A2K team, the POC will be responsible for the following tasks:

Public communication (60% of monthly work): POC will be responsible for the overall public-facing communication of the work and activities of the CIS-A2K team. This includes planning, driving, and carrying out multi-media documentation of ongoing activities of the team; announcement of programmatic activities in terms of authoring press releases, opinion pieces, short updates, and social media posts, including helping CIS-A2K team members with doing the same; co-authoring and editing the major reports prepared by the team, primarily for submission to Wikimedia Foundation; managing and posting on the Twitter account of the CIS-A2K team; and preparing and publishing a monthly newsletter to share the work of Indian Wikimedia communities and the CIS-A2K team. The CIS-A2K team usually conducts 4 events each month on average.
Innovative media projects (25% of monthly work): POC may explore widely from conventional to new media forms to create original stories of experiences, challenges, and learnings of members of Indian Wikimedia communities in general, and communities engaged with by the CIS-A2K team in particular. This may include storytelling in the form of interviews, blogs, audio and video productions including those native to social media platforms, with a focus on producing content in multiple Indian languages, often with support from CIS-A2K team and members of Wikimedia communities. The focus of these media projects will be on the stories of the volunteers who edit and contribute to Indian language Wikimedia projects, as well as gaps and futures thereof. This task includes interviewing Indian Wikimedians under the ambit of the WikipediansSpeak project.
Liasoning and training (15% of monthly work): POC will function as an interface between A2K team and the Indian (and global) Wikimedia communities as the first point of contact for incoming communications, and inform the CIS-A2K about requests and concerns shared by members of these communities. POC may also be invited to provide training on effective communications for members of Indian Wikimedia communities, as needed, and to support them to independently tell their own stories in their languages.

Basic understanding of functioning of Wikipedia, and ideally of other Wikimedia projects too
Basic ability to produce audio/video content, including recording and editing

Desirable Skills and Experience

Active user of free and open source software
Experience of actively contributing to Wikimedia projects, including Wikipedia and others
Experience of being a member of an Indian Wikimedia community, or taking part in Wikimedia-related events
Experience of being part of a free and open source software / open knowledge community

Location and Remuneration

The position is based out of the Bangalore office of CIS.

Monthly remuneration for the position will be Rs. 40,000-45,000 (including taxes) based on the level of experience and previous salary.

We strongly recommend reading the 2018-19 work plan of the CIS-A2K team while writing this cover letter, as well as for preparation for the interview to follow (if you are shortlisted for interview).
CV: This should provide details of your academic, professional, and other achievements
Work samples: The position will require you to produce effective writing outputs in a regular manner. Please share 2 samples of your writing (published or unpublished). In case you have produced media works (photographs, audio/video interviews, short films, etc.), please share 1 or 2 samples of the same. While sharing media works, please share the URL to the same and not the actual files.

We will prepare a short list of candidates, on the basis of the submitted applications, and inform you of our selection decision by Friday, November 02.

The shortlisted candidates will be interviewed by the CIS team, including members of the CIS-A2K team. If needed, there will be two rounds of interview.

We will take the final hiring decision by early November, inform the shortlisted candidates accordingly, and invite the selected person to join our from December 1, 2018.
