India - Europe Conference on Building a Sustainable IPR - ICT Ecosystem for Promoting Innovation

Centre for Development of Advanced Computing (C-DAC), Pune organized a one-day conference in Bangalore on November 20, 2015. Rohini Lakshané attended this event.

Intellectual property is at the core of business ventures and critical to successfully compete internationally. However, skills to commercialize technological innovations remain a crucial impediment to innovative entrepreneurs and innovators aspiring to become world leaders in global ICTE markets. A robust IPR-ICT ecosystem can help capitalize on the growth-enhancing effects of innovation vis-à-vis ICTE. In order to fulfill the aspiration of its stakeholders, the IPR-ICT ecosystem has to be global in geographic scope, spearhead shaping appropriate framework conditions for innovation and assist in charting out policy roadmaps for sustainable and inclusive growth.

With this in mind Deity and EPO is working together in developing a close cooperation to promote IPR in ICTE domain, especially with respect to sharing of best practices and procedures for filing and processing ICTE patents in India and Europe by Indian and European firms.

The one day conference on “India-Europe Conference on Building a Sustainable IPR-ICT Ecosystem for Promoting Innovation” organised by Centre for Development of Advanced Computing (C-DAC), a premier R&D organisation, aims to address the challenges in building a sustainable global IPR-ICT ecosystem, discuss IP policy issues relevant to Indian and European ICTE industries and concord on various nuances of patenting technology and activities with an ICTE perspective.

India 'jihadi' web blocking causes anger

A government block on more than 30 high-profile websites has caused anger across India.

The story was published in BBC on January 2, 2015. It was also mirrored in the Puffington Post the same day. Pranesh Prakash is quoted.

India's Department of Telecoms ordered the blocking of the sites in order to prevent the publicising of "jihadi activities".

After considerable pressure, four of the sites - Weebly, Vimeo, Daily Motion and Github - were unblocked.

Officials said the other sites would have their blocks lifted if they complied with the "law of the land".

The Indian Ministry for Communication and Information Technology said in a statement: "It was stated that Anti National group are using social media for mentoring Indian youths to join the Jihadi activities."

It went on to say that the primary concern was that users posting material on the sites did not require any authentication, and that identities could be hidden.

The four websites that have been unblocked were said to have worked with the Indian government to address concerns - although it is unclear what changes, if any, have been made.

Some users were reporting that they were still unable to reach the apparently unblocked sites.

Pranesh Prakash, from the India-based Centre for Internet and Society, said: "Any intelligent person can see these sites don't incite terrorism."

'Many complaints'

Ahead of the ban lifting, a Vimeo spokeswoman said: "It is Vimeo's longstanding policy not to allow videos that promote terrorism, and we remove such videos whenever we become aware of them.

"We have not received notice from the Indian government concerning such videos and have contacted them requesting the blocking order to identify, and evaluate the video in question."

Many internet users in the country are angry that other sites remain blocked, in particular Pastebin - a site used for "dumping" text online anonymously - and The Internet Archive, a US organisation that offers a database of old websites.

The Internet Archive said on Twitter that it had received "many complaints" from users who were unable to access the service.

India has a history of sporadically blocking websites, or issuing warnings about online content.

In August 2012, 245 sites were blocked by the government in an attempt, it said, to quell violence.

Indecent Proposals

If Kapil Sibal’s attempts to police net content fructify, it may even lead to a reversal of some of the forward-looking provisions of the Information Technology (IT) Act, 2000. The new proposal, for instance, will reverse Section 79 which protects intermediaries (websites and carriers) from being prosecuted or made liable for any objectionable content published. Says Pranesh Prakash, programme manager, Centre for Internet and Society: “Unfortunately, what Sibal says turns this upside down as they would now be held responsible for e-content.” Sibal wants to monitor content prior to publication.

The article by Arindam Mukherjee was published in Outlook Magazine on December 19, 2011. Pranesh Prakash was quoted in it.

While there are privacy concerns, any attempt to do real-time monitoring could pose serious legal complications. Says cyber law expert Pavan Duggal: “This proposition could be ultra vires of the Constitution which guarantees fundamental rights under Article 19, which is about freedom of speech and expression subject to reasonable restrictions.” And the reasonable restrictions for monitoring, blocking and interception of internet content are already built into the IT Act.

Says Rajya Sabha MP Rajeev Chandrasekhar: “If Sibal was really serious about protecting people, he should have read the IT Act that has a section which allows a victim to legally pursue his/her claim of defamation. If Sibal has his way, DoT bureaucrats will decide what content is ‘appropriate’ or ‘inappropriate’.”

Moreover, the IT Intermediary Guideline Rules, 2011, though still provisional, mandate that once service providers receive instructions, they have to remove objectionable content within 36 hours. The Act also has other specific provisions like Section 69, which provides safeguards for interception, monitoring/decryption of information; Section 69A which gives procedures and safeguards for blocking access of information by the public; Section 69B for monitoring and collecting traffic data or information. There are also provisions for obscenity and defamation, with steep fines prescribed. Following these, the state has blocked 11 websites since ’09

However, what Sibal and his men would have seen is the Act’s inability to act on the content freely flowing in social media sites. Says Duggal: “The IT Act, 2000, was amended in ’08, but doesn’t talk about social media which came up only around that time. There is a need to bring social media within the ambit of the Act. What Sibal is suggesting doesn’t exist anywhere in the world.” Monitoring social media websites would also be a huge challenge as crores of messages and tweets are generated from India everyday.

And privacy? Experts say since India does not have dedicated legislation on privacy, the government could escape any attack on that front. Although some privacy elements were added to the IT Act in 2008, its scope is limited and the concept of data privacy is missing. In fact, the law doesn’t even recognise a person’s right to data privacy!.

Des spécialistes de l'internet ont qualifié vendredi de "complètement illégale" la tentative du gouvernement indien de bloquer des messages et des vidéos soupçonnés d'avoir contribué à attiser de récentes tensions interethniques.

"Les responsables qui ont été chargés de cela ne connaissent pas suffisamment bien la loi et la technologie moderne", a tancé Pranesh Prakash, un gestionnaire de programmes au sein du Centre de recherche sur l'internet (Centre for Internet and Society), dont le siège est à Bangalore (sud).

"C'est contre-productif. Je les accuse d'incompétence monumentale, le principal problème étant qu'ils sont très mal conseillés", a-t-il ajouté, interrogé par l'AFP.

Le gouvernement a demandé aux fournisseurs indiens de services internet de bloquer 309 pages, images et liens présentant un caractère "malfaisant", postés sur des sites tels que Twitter, Facebook, Wikipedia, la chaîne de télévision du Qatar, Al-Jazeera ou la chaîne australienne, ABC.

Des dizaines de milliers de personnes ont récemment fui les villes de Bangalore et de Bombay pour rentrer dans l'Etat de l'Assam (nord-est).

Cet exode a été déclenché par l'envoi de menaces sur les téléphones portables et l'internet affirmant que les Assamais seraient attaqués par des musulmans après la fin du ramadan, en représailles à de récentes violences interethniques qui ont opposé les deux communautés dans cet Etat reculé de l'Inde.

Dans un communiqué, la chaîne de télévision ABC s'est dit "surprise" des mesures gouvernementales après la demande de retrait d'un de ses reportages sur les violences entre musulmans et bouddhistes en Birmanie.

Vivek Sood, avocat auprès de la Cour suprême et auteur d'une loi sur l'internet, a pour sa part jugé que la démarche du gouvernement était illégale.

"C'est complètement illégal en vertu de de la loi indienne sur les hautes technologies. C'est un abus de pouvoir", a-t-il dit au quotidien The Economic Times.

Le gouvernement a toutefois assuré vendredi que son but n'était pas de restreindre les échanges sur internet.

"C'est un succès. Ces pages étaient une menace à la sécurité nationale de l'Inde et nous avons demandé leur suppression immédiate", a commenté auprès de l'AFP un porte-parole du ministère de l'Intérieur, Kuldeep Singh Dhatwalia.

"La propagation de rumeurs encourageant la violence ou provoquant des tensions ne sera pas tolérée. L'idée n'est pas de restreindre la communication", a-t-il assuré.

Inclusive Planet co-founder, Disability Law activist, and Cancer Survivor, Rahul Cherian passes away

Rahul Cherian, the co-founder of Inclusive Planet and an expert on Intellectual Property and disability law, passed away on February 7, 2013 in Goa due to sudden illness.

Along with being Managing Partner at IP firm, Indo Juris, Cherian worked with the Inclusive Planet Centre for Disability and Policy, an organisation which sought amongst other things, to be a medium between the government and the disability sector.

Cherian, a cancer survivor who underwent reconstructive surgery in 2005, was also a Fellow at the Centre for Internet and Society.

Cherian, a graduate of National Law School of India University, Bangalore was deeply involved in the drafting of the Treaty for the Improved Access for Blind, Visually Impaired and other Reading Disabled Persons, a treaty which was designed to grant visually impaired individuals “greater access to copyrighted materials.” The Treaty is currently being debated at WIPO.

Inaugural EPT Award for Open Access

The Electronic Publishing Trust for Development is pleased to announce the winners of a new annual award to be made to individuals working in developing countries who have made a significant personal contribution to advancing the cause of open access (OA) and the free exchange of research findings.

We received 30 proposals from organisations in 17 developing countries on four continents, naming individuals who have worked hard to promote OA and who have achieved substantial progress. The selection of a single winner was extremely difficult as we received nominations for so many individuals who have made impressive strides by any or all of the following means:

establishing OA institutional repositories;

setting up or encouraging conversion to OA journals;
achieving establishment of OA mandates requiring research to be OA on publication, or other policy developments;
advocating OA via seminars, publications, workshops, videos;
training others in the technology of setting up IRs;
preparing and establishing e-learning projects;
working towards the acceptance of Creative Commons licensing arrangements for research publications;
developing software for use in OA practices.

Because of the high standard of the applicants, we have decided to name a single winner, but also to recognise three other individuals who were very close runners-up. All will receive a certificate and the winner will receive in addition an engraved plaque in the next few weeks.

We are very happy to announce that the winner of the inaugural award is Dr Francis Jayakanth of the National Centre for Science Information, Indian Institute of Science, Bangalore, India. Dr Jayakanth played a significant role in the establishment of India’s first institutional repository (IR) (http://eprints.iisc.ernet.in). He now manages the IR and has provided technical support for establishing IRs in many other universities and institutes in India. He has been the key resource person at many events to train people in setting up IRs and OA journals. He has delivered presentations on IRs, OA journals, the OAI protocol, OAI compliance, the benefits of OA to authors and institutions and the role of libraries. He has developed a free and open source software tool (CDSOAI), which is widely used.

The Indian Institute of Science is the most prestigious institute in India and its IR now holds >31,400 records, making the century-old institute's research far more globally visible than before. The University Grants Commission in India has been impressed by the IISC’s IR and has directed all universities in India to replicate this effort.

Dr Francis Jayakanth can indeed be considered an OA ‘renaissance man’, an advocate and technical expert in all aspect of Open Access development and an inspiration to all, both at the research and policy level.
The EPT is proud to congratulate Dr Jayakanth as our first Award winner. We believe this Award and the example of our first winner will inspire many others and lead to similarly impressive nominations in 2012.

What is Open Access?

Open Access provides the means to maximize the visibility, and thus the uptake and use, of research outputs. Open Access is the immediate (upon or before publication), online, free availability of research outputs without any of the restrictions on use commonly imposed by publisher copyright agreements. It is definitely not vanity publishing or self-publishing, nor about the literature that scholars might normally expect to be paid for, such as books for which they hope to earn royalty payments. It concerns the outputs that scholars normally give away free to be published – journal articles, conference papers and datasets of various kinds.

Not only scholars benefit from Open Access. They are the most obvious beneficiaries, perhaps, because their work gains instant worldwide visibility, and they also gain as readers if much more world research is available on an Open Access basis for them to access freely and read. But there are many other beneficiaries, too.

Research institutions benefit from having a management information tool that enables them to assess and monitor their research programmes, and they have a marketing tool that enables them to provide a shop window for their research efforts. The same advantages apply to external research funders who need to be able to access and keep track of outputs from their funding, and measure and assess how effectively their money has been spent. They also can ensure that the results of their spending have had the widest possible dissemination.

It is because Open Access is so much in the interest of research funders and employers that an increasing number of them around the world are introducing Open Access policies that require their funded researchers to provide Open Access to their work.

The advantages of Open Access for science and scholarship are, in brief:

Open Access brings greater visibility and impact
Open Access moves research along faster
Open Access enables better management and assessment of research
Open Access provides the material on which the new semantic web tools for data-mining and text-mining can work, generating new knowledge from existing findings
