&lt;h2 id="1"&gt;1. Introduction&lt;/h2&gt;
&lt;p&gt;This essay explores the concerns related to data protection and digital privacy under the Trans Pacific Partnership (TPP) agreement signed recently between United States of America and eleven countries located around the pacific ocean region, across South America, Australia, and Asia &lt;strong&gt;[1]&lt;/strong&gt;. TPP is a free trade agreement (FTA) that emphasises, among other things, the need for liberalising global digital economy. The essay also analyses the critical document titled ‘Digital 2 Dozen’ (D2D), which compiles the key action items within TPP addressing liberalisation of digital economy, and sets up the relevant goals for the member nations. TPP requires the member countries to facilitate unhindered digital data flow across nations, for commercial and governmental purposes, which evidently have major implications for national and regional data protection and privacy regimes. These implications must also be seen in the context the recent judgement by  the EU Court of Justice against the validity of the EU-USA data transfer agreement of 2000. Further, the essay discusses the potential impacts that TPP/D2D might have on India, in the context of the ongoing USA-India Cyber Relationship dialogue. If the privacy concerns are not raised right now TPP might act as a model framework for future FTAs which will fail to encompass proper data protection and digital privacy regime within it.&lt;/p&gt;
&lt;h2 id="2"&gt;2. Analysis of TPP and D2D&lt;/h2&gt;
&lt;h3 id="2-1"&gt;2.1. Trans Pacific Partnership (TPP)&lt;/h3&gt;
&lt;p&gt;Trans Pacific Partnership (TPP) is a large multi-partner free trade agreement amongst twelve Asia-Pacific countries, which is closely led by geo-political and economic strategies of the USA. Countries started the negotiation of TPP in 2008 when USA joined Pacific Four (P-4) negotiations and in 2015 negotiations of TPP was concluded  and text  was released. Ministers from the member countries signed the agreement on February 4, 2016 &lt;strong&gt;[2]&lt;/strong&gt;. The main aim of TPP is to liberalise trade and investment beyond what is provided for within the WTO. It is also considered to be a strategic move by the US to counter the trade linkages that are being established in the Asian region. TPP largely covers topics of market access, and rules on various related issues such as intellectual property rights, labour laws, and environment standards &lt;strong&gt;[3]&lt;/strong&gt;.&lt;/p&gt;
&lt;p&gt;Between 1992 -2012 there has been an upsurge in bilateral trade agreements being signed in Asia from 25 to 103 and the effect of these FTAs is called the ‘noodle bowl effect’. TPP is seen as framework which will replace these FTAs which  are causing the ‘noodle bowl effect’.While these FTAs are being replaced but with TPP being signed there are various bilateral arrangements signed along with TPP. USA has also stated that TPP will not affect the already existing NAFTA &lt;strong&gt;[4]&lt;/strong&gt;. While TPP is being concluded  there is another free trade agreement being negotiated between USA and EU , which is Trans Trade and Investment Partnership (TTIP). Both  TPP and TTIP  and are considered to be serving similar objective  which is to deal with new and modern trade issues. Also both the  agreements are US led and since negotiation for TPP are now finalised it may have a significant impact on TTIP &lt;strong&gt;[5]&lt;/strong&gt;.&lt;/p&gt;
&lt;p&gt;TPP is one of the first document which deals specifically with digital economy and applies across borders.  The main aims of TPP are to promote free flow of data across borders without data localisation. It aims to remove national clouts and regional internets. It also includes provisions to combat theft of trade secrets. It allows you to create transparent regulatory process with inputs from various stakeholders. It also aims to provide access to tools and procedures for conduct of e-commerce &lt;strong&gt;[6]&lt;/strong&gt;.&lt;/p&gt;
&lt;p&gt;Some of the major criticism to TPP were regarding the issues related to &lt;strong&gt;[7]&lt;/strong&gt;:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;environment, wherein it does not address the issue of climate change  and the language used in the agreement  is very weak;&lt;/li&gt;
&lt;li&gt;labour rights  provision mandates parties to adhere to the ILO provision  but it  does not seem to  provide for effective framework  and might not bring the desired change;&lt;/li&gt;
&lt;li&gt;investment chapter is seen to be controversial because of the investor state dispute settlement clause which will allow foreign investor to sue government over policies that might cause harm to them;&lt;/li&gt;
&lt;li&gt;e-commerce and telecommunication chapter raises major privacy concerns;&lt;/li&gt;
&lt;li&gt;intellectual property chapter wherein it includes controversial rules regarding pharmaceutical companies and data exclusivity apart from the privacy concerns.&lt;/li&gt;&lt;/ul&gt;
&lt;h3 id="2-2"&gt;2.2 Digital 2 Dozen (D2D)&lt;/h3&gt;
&lt;p&gt;D2D is set of rules and aims which is specifically drafted to be followed for the trade agreements related to open internet and digital economy. More specific aims of TPP as provided within the ‘Digital 2 Dozen,’ aiming for more liberalised trade in digital goods and services, are &lt;strong&gt;[8]&lt;/strong&gt;:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;promoting free and open internet,&lt;/li&gt;
&lt;li&gt;prohibiting digital custom duties,&lt;/li&gt;
&lt;li&gt;securing basic non-discrimination principles,&lt;/li&gt;
&lt;li&gt;enabling cross-border data flows,&lt;/li&gt;
&lt;li&gt;preventing localization barriers,&lt;/li&gt;
&lt;li&gt;barring forced technology transfers,&lt;/li&gt;
&lt;li&gt;advancing innovative authentication methods,&lt;/li&gt;
&lt;li&gt;delivering enforceable consumer protections,&lt;/li&gt;
&lt;li&gt;safeguarding network competition,&lt;/li&gt;
&lt;li&gt;fostering innovative encryption products, and&lt;/li&gt;
&lt;li&gt;building an adaptable framework.&lt;/li&gt;&lt;/ul&gt;
&lt;p&gt;Strategic goal of the US in introducing D2D as goals of TPP has been to set up a trend within Asian region for all the trade agreements. It is expected to ensure that if TPP is a success, similar goals and policy frameworks will be followed for other trade agreements as we. For example, the USA-India partnership also enshrines similar aims and so does the USA-Korea partnership. Hence while India is not part of TPP, USA is nonetheless trying to get India into a partnership which is similar to the TPP. The language proposed by the USA in TPP negotiations  has always been supportive for cross border data flows as it claims that companies have mechanism to keep a privacy check and privacy would not be undermined, but countries like New Zealand and Australia which have strong privacy protection laws nationally have raised concerns which will be discussed in further sections &lt;strong&gt;[9]&lt;/strong&gt;. Also not only in  privacy rights but Digital Dozen initiative also affects other digital rights related to - excessive copyright terms  TPP proposed to extend the term of copyright to hundred years which deprive access to knowledge; as in the U.S motive to give more power to private entities , the  ISP obligations enumerated within TPP which puts freedom of expression and privacy at risk as ISPs are allowed to check for copyright infringement and TPP does not put any privacy restriction in this regard; introduction of new fair use rules; ban on circumvention of digital locks or DRMs; no compulsory limitation for persons with disabilities; lack of fair use for journalistic right; while net neutrality is major issue is many developing nations in Asia no effective provision for net neutrality is  aimed at in the D2D initiative; prohibits open source mandates which puts barrier for countries which want to release any software as open source as a policy decision &lt;strong&gt;[10]&lt;/strong&gt;.&lt;/p&gt;
&lt;h2 id="3"&gt;3. Major Issues Related to Data Protection and Privacy in the TPP&lt;/h2&gt;
&lt;h3 id="3-1"&gt;3.1. Data Protection&lt;/h3&gt;
&lt;p&gt;One of the major concern raised against TPP is regarding data protection provisions that have been integrated within the E- Commerce chapter of the agreement. Article 14.11 and Article 14 .13 are the ones that deal with data flow related to consumer information.Article 14.11 in the agreement puts a requirement on the member states to allow transfer of data across border and  Article 14.13 does not allow the companies to host data on local servers.  Concerns were raised in few member states for instance, Australian Privacy Foundation raised concerns over Article 14.11 which requires transfers to be allowed in context of business activities of service suppliers. It claimed that exception to this provision is very narrow and the repercussion for not following the exception is that investor state dispute settlement proceedings can be initiated, which is not sufficient to protect privacy. Also, it highlighted the issue that with the narrow exception provided under Article 14.13 which relates to prohibition on data localisation, it might have adverse effect on the implementation of national privacy laws within Australia &lt;strong&gt;[11]&lt;/strong&gt;.&lt;/p&gt;
&lt;p&gt;Another provision which is of major concern is Article 14.13 which prohibit data localisation. It will raise problems for countries like Indonesia and China which will have to change their local laws to implement the provision &lt;strong&gt;[12]&lt;/strong&gt;. Since there already has been a major concern with regard to USA- EU Safe Harbour Agreement which was later  made subject to the ECJ’s ruling on data protection, which invalidated any arrangement which provides voluntary enterprises responsibility to enforce privacy. But both the USA and EU are in process of renegotiating the agreement.The major concern was that in EU data protection is a fundamental right while in USA data protection is more consumer centric. When similar concerns were raised in TPP negotiations, they were rebutted as USA claimed that FTA does not concern itself with data protection &lt;strong&gt;[13]&lt;/strong&gt;.&lt;/p&gt;
&lt;p&gt;In 2012 Australia proposed an alternative language to TPP which allowed countries to place restriction on data flow as long as it was not a barrier to trade. U.S responded to concerns raised by the Australia through a side letter which ensured Australia that U.S and Australia have a mutual understanding in relation to privacy and U.S will ensure the privacy of  data with regards to  Australia. While Australia’s concern was given acknowledgement other countries which raised similar issues were not given any assurances &lt;strong&gt;[14]&lt;/strong&gt;. US instead proposed ad- hoc strategy that gave private companies power to form privacy policy with implementation through state machinery &lt;strong&gt;[15]&lt;/strong&gt;.&lt;/p&gt;
&lt;h3 id="3-2"&gt;3.2. Digital Privacy&lt;/h3&gt;
&lt;p&gt;Article 14.8 in the E- Commerce chapter of the  agreement states that countries can form legal framework for the protection of rights but the kind of ‘legal framework’ is not defined. Also, nowhere it states that the privacy protection or data protection laws are expressly exempted, rather it states that any such policy implemented by member states will be put under review of TPP standards. The standards which TPP proposes to follow are based on the underlying idea that any such policy should not hinder free trade in any way. This test will be applied by tribunals which are experts in trade and investment and not on data protection or human rights &lt;strong&gt;[16]&lt;/strong&gt;. While Article 14.8 provides for protection of private information of consumers but the footnote to the provision renders it ineffective. The footnote states that member countries can adopt legal framework for the protection of data which can be done by self-regulation by industry and does not provide for any comprehensive data protection obligation upon the member states &lt;strong&gt;[17]&lt;/strong&gt;. Similar to this Article 13.4 of the telecommunications chapter under TPP also states that  the countries can apply regulation regarding confidentiality of the messages as long as it is not “a means of arbitrary or unjustifiable discrimination or a disguised restriction on trade in services" &lt;strong&gt;[18]&lt;/strong&gt;.&lt;/p&gt;
&lt;p&gt;Another chapter which raises major concerns about the privacy rights is intellectual property. It affects privacy  through the provisions related to technological protective measures and the provision that regulate ISP’s liability. Regarding the TPM provision, the TPP follows the DMCA model whereby the exception to anti- circumvention provision is very narrow and does not apply to anti- trafficking provision. The exception allows user to circumvent TPM if it affect the user's privacy in any way, although this provision does not apply to ant- trafficking of TPM. The provision regarding ISP’s liability states that there should be cooperation between ISPs and rights holders and it does not prohibit ISPs to monitor its users. Also TPP proposes the notice for takedown and  identification of the infringer  by the ISP  but this  provision is not in consonance with  laws of member states, like that of Peru which does not have any copyright law on ISP . Also many countries have tried to introduce proper privacy laws along with implementation of ISP liability but that is not done within the TPP &lt;strong&gt;[19]&lt;/strong&gt;. TPP as whole aims to give greater power to private regulators without providing for minimum standard for protection of privacy.&lt;/p&gt;
&lt;p&gt;Although TPP  is not a data protection agreement but it consequently deals with various aspects of data protection, hence it is prospective model for privacy and data protection practices in future trade agreements. If positive obligations are included within the free trade agreements it will have an advancing impact on the data protection regime.&lt;/p&gt;
&lt;h2 id="4"&gt;4.Implications of TPP for RCEP&lt;/h2&gt;
&lt;p&gt;While TPP has such lacunas similar provision are proposed in RCEP to which India is a party and which will have serious implication as many of the countries have inadequate data protection laws nationally and with the introduction of such an FTA the exploitation of privacy rights will be rampant &lt;strong&gt;[20]&lt;/strong&gt;. To avoid this EU directive on data protection should be taken into consideration in the negotiations of such FTAs. But for the RCEP negotiations are still going on and in India many companies like Flipkart, Snapdeal etc. have started preparing for the changing norms. The government claims that it is going to accept best practices in the region which indicates that it is going to have same policies as that of TPP. Although people from industry have raised concerns that while there are national laws but it is difficult to check third party involvement within the business and it is becoming increasingly difficult to keep the consumer data confidential &lt;strong&gt;[21]&lt;/strong&gt;.&lt;/p&gt;
&lt;h2 id="5"&gt;5. Implications of TPP in the Context of  EU Safe-Harbour Judgement&lt;/h2&gt;
&lt;p&gt;Mr. Maximillian Schrems, an Austrian National residing in Austria, has been a user of the Facebook social network since 2008. Any person residing in EU who wishes to use Facebook is required to conclude, at the time of his registration, a contract with Facebook Ireland (a subsidiary of Facebook Inc. which itself is established in Unites States). Some or all of the personal data of the Facebook Ireland’s users who residing in EU is transferred to servers belonging to Facebook Inc. that are located in United States, where it undergoes processing. On 25 June 2013 Mr Schrems made a complaint to the commissioner by which he in essence asked the latter to exercise his statutory powers by prohibiting Facebook Ireland from transferring his personal data to Unites States, and this led to the &lt;em&gt;Maximillian Schrems v Data Protection Commissioner&lt;/em&gt; case &lt;strong&gt;[22]&lt;/strong&gt;. He contended that in his complaint that the law and practice in force in that country did not ensure adequate protection of the personal data held in its territory against the surveillance activities that were engaged in thereby by the public authorities. Mr Schrems referred in this regard to the revelations made by Edward Snowden concerning the activities of the United States intelligence services, in particular those of the NSA.(para 26, 27, 28). The case came in  the court ruled that “that a third country which ensures an adequate level of protection, does not prevent a supervisory authority of a Member State, within the meaning of Article 28 of the EU 94/46 directive as amended, from examining the claim of a person concerning the protection of his rights and freedoms in regard to the processing of personal data relating to him which has been transferred from a Member State to that third country when that person contends that the law and practices in force in the third country do not ensure an adequate level of protection. The ruling implies that personal data cannot be transferred to third country which does not provide adequate level of protection.&lt;/p&gt;
&lt;p&gt;EU safe harbour judgment and EU directive on privacy provide contrasting rules related to privacy. While TPP gives power to private entities to formulate rules regarding privacy while the recent  ECJ judgment  invalidated giving such power to private entities  under EU-US Safe Harbour Agreement. Also in context of the same judgment Hamburg’s Commissioner for Data Privacy And Freedom of Information announced an investigation into the data transfer taking place through Facebook and Google to U.S. Hence in the light of the recent judgment member states within EU are not allowed to permit cross border data flow, in contrast to this one of the main goals of TPP is to maintain free flow of data across border &lt;strong&gt;[23]&lt;/strong&gt;. EU is this regard has also set forth the proposal to introduce General Data Protection Regulation. (GDPR). Although U.S and EU are trying to renegotiate the agreement but the privacy concerns raised cannot be ignored. Hence following the same model as was invalidate  under the ECJ judgment lets US exploit privacy of member states  under TPP. Similar concerns as raised within the judgment are also raised in India as it also following the same model within U.S-India Cyber Relationship Agreement and in RCEP negotiations.&lt;/p&gt;
&lt;h2 id="6"&gt;6. Implications of TPP in the context of USA-India Cyber Relationship&lt;/h2&gt;
&lt;p&gt;While India is not part of TPP  but it might have an effect on the  U.S India Cyber Relationship Agreement. In August 2015 there was re- initiation of the India-U.S cyber dialogue to address common concerns related to cybersecurity and to develop better partnerships between public and private sector for betterment of digital economy &lt;strong&gt;[24]&lt;/strong&gt;. One of the key aim of this agreement is free flow of information between two nations, which suffers from similar problem that it will put privacy of the citizens at risk. Also India does not have any bilateral treaty which ensures cyber data protection in such a scenario the only solution is data localisation, but this agreement will put data at risk &lt;strong&gt;[25]&lt;/strong&gt;. Hence while the TPP negotiations were going on and also RCEP is being discussed the concerns about privacy and data protection need to be raised as mention in earlier section regarding implications of TPP on RCEP, the USA-India Cyber Relationship also faces the same implications..Although  the aim of USA-India Cyber Relationship is to ensure cybersecurity. After the cases of Muzaffarnagar riots, upheaval in  North -Eastern states  and Gujarat riots, India has realised it is important to ensure compliance from the social media companies. India sees the USA-India Cyber Relationship as an opportunity to achieve this goal. The Google Transparency Report states that that India made around three thousand requests to Google for user data &lt;strong&gt;[26]&lt;/strong&gt;, which indicate at the country's interest in having a common data understanding with the major social media companies (almost all of which are located in USA) about requesting and sharing of user activity data. While this concern is being addressed through the agreement, it is difficult to ignore the clause related to free flow of information, and if the meaning of the term is extended and adopted from TPP itself will put digital privacy of Indian citizens at risk &lt;strong&gt;[27]&lt;/strong&gt;.&lt;/p&gt;
&lt;h2 id="7"&gt;7. Conclusion&lt;/h2&gt;
&lt;p&gt;Even though TPP negotiation are completed but the ratification of the agreement is still underway. TPP is  being seen as one of a kind trade agreement because  it is the first time that countries across the globe have come together as a whole to address concerns of modern trade. Although it fails to address some of the key concerns related to  privacy and data protection which are becoming increasingly important. Data protection and privacy issues cannot be seen in isolation  and needs to merged within the modern day trade agreements. The D2D component by the USA is strategic move to have trade dominance in Asia  and to compete with China’s growth . TPP has privacy and data protection lacunae within the e- commerce , telecommunications and intellectual property discussion.Although it might have serious implications on RCEP negotiation and  USA- India Cyber Relationship Dialogue.  Similar concern regarding data protection has already been  addressed by ECJ judgment invalidating USA-EU  Safe Harbour Agreement but the similar ad - hoc strategy has been incorporated within TPP.  Since TPP might be considered as best practice model for  future FTAs in the Asian region it is important to raise and address these privacy concerns now.&lt;/p&gt;

    <title>TRAI recommendations on data privacy raises eyebrows</title>

&lt;p style="text-align: justify; "&gt;Telecom Regulatory Authority of India (TRAI) Chairman RS Sharma though countered that the sectoral watchdog has the jurisdiction to protect consumer interest in the sector, and those who feed off the industry - content providers, or apps, browsers, operating systems, and devices - need to be accountable as far as data protection is concerned.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;TRAI Monday released its recommendations on the subject titled ‘Privacy, Security and Ownership of Data in the Telecom Sector’ which are applicable for apps, browsers, operating systems and handset makers.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;An official of the Ministry of electronics and IT, which is tasked with drafting the data protection law, said that the Act will “prevail” over everything else. “Like any other sector, the data protection Act will be the final thing. In respect of telecom matters, there will be a role for TRAI as sectoral regulator but the basics of privacy will be governed by the data protection Act.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The official also added that TRAI saying that their recommendations will be applicable till the data protection law comes into force "doesn't make sense since it won't have a legal mandate."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Industry bodies such as Internet and Mobile Association of India (IAMAI) and the Indian Cellular Association (ICA) have also criticised TRAI, saying the recommendations were “illegal” and akin to “jumping the gun” ahead of the release of the Srikrishna committee report.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Some of the clauses such as no use of metadata to identify individuals coupled with data minimisation will be detrimental to building the data business in the country, they said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But Sharma was argued Trai was well within its rights to protect telecom consumers.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;"Do I not have the jurisdiction to protect the interest of consumers in the telecom sector? I have that. And data protection of consumers in the telecom sector is an issue which is certainly related to the interest of consumers. I have deliberated on that issue, and I’m not saying that bring all those entities under my jurisdiction,” Sharma said.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He added that there is a regulatory imbalance because entities such as devices, OS, browsers and apps are not following any law. “So, the government can come up with a broad framework but till that time let the telecom rules apply on them too."&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In its recommendations, TRAI said that individual users owned their data, or personal information, and entities such as devices were "mere custodians” and do not have primary rights over that information. It also said that the current framework for protection of personal information is “not sufficient” and suggested expanding the ambit of licence conditions governing telcos to all entities handling customer information.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In its statement, IAMAI, which represents companies such as Facebook and Google, called TRAI’s assertion that the existing framework is not sufficient to protect telecom consumers “contradictory.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“The TRAI recommendations on privacy are premised on a voice and SMS regime. It is not meant for data driven business, which the app companies are. App companies use pseudo anonymous data and app companies do not give Call Detail Records. Incidentally, the Sri Krishna Committee under the Ministry of IT, which is the nodal body for apps as well as for handset manufacturers, is deeply, looking into this issue of consent, which is a fair thing to do.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Voicing similar concerns, the ICA, which represents most of India’s top handset makers, said that the telecom watchdog has absolutely no powers to begin regulating on issues of privacy and ownership of data, leave alone having jurisdiction over devices, operating systems, browsers and applications.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“The industry rejects TRAI's attempts to expand its powers and usurp government's jurisdiction.” It added that TRAI “jumped the gun” by seeking to regulate the digital ecosystem without waiting for the data protection law under consideration by the Justice Srikrishna Committee. “This piecemeal approach is dangerous and unproductive.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Handset makers such as Intex and Karbonn added they should be kept out of the ambit of the proposed regulations because they don't use customer data or monetise from it, which is mostly what apps do. Any additional pressure on indirect costs will lead to wafer-thin margins getting eroded further and consumers will have to bear the brunt, as it will lead to increase in prices of mobile phones.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Trai’s recommendations have been sent to the Department of Telecommunications (DoT) which has to take a final call on whether they will be adopted.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;An official spokesperson for Zomato said that they have not been contacted by any of the regulatory bodies on this, as of now. “Our country is still undergoing the process of setting up a regulatory framework, and what happens between the TRAI recommendations and the B N Srikrishna's committee's draft for Data Protection bill will eventually help set up a much required benchmark.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;In its suggestions, Trai said that as with telcos, all user data flows through smart devices, putting the device manufacturers, browsers, operating systems, and applications etc. in a prime position to collect and process the personal information of users. Since all user data passes through telcos and devices, appropriate steps must be taken to protect user privacy vis-a-vis these entities. “This will ensure, in prevailing circumstances, that the privacy of users is protected and maintained”.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Swaraj Paul Barooah, policy director at Center for Internet and Society, said that the recommendations is worrying at one level since “There is nothing in the telecom sector that requires interim urgent intervention and it may mean that the privacy framework maybe further delayed.”&lt;/p&gt;

First, there was the recent report in &lt;i&gt;The Tribune &lt;/i&gt;on how one of its reporters was easily able to log in to the Aadhaar website and access any enrolled Indian’s personal information, all for a grand fee of Rs500. While the veracity of this report is still being contested by the Unique Identification Authority of India (UIDAI), it has stirred panic over the security of personal data entrusted to the government. This came close on the heels of reports last month that a telecom company was utilizing the eKYC (know your customer) data of its mobile subscribers to open payment bank accounts without their consent.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;These two instances highlight scenarios where data from the Aadhaar database is vulnerable. In the first, the weaknesses in security measures and processes around the database leave information susceptible to an attack. In the second, providing third-party entities loosely regulated access to an individual’s data leaves scope for abuse.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;There is a need to protect the data belonging to individuals in these situations, providing the government with two possible policy options: it can choose to either overhaul the Aadhaar architecture completely, or it can build in additional security measures to ensure that individual data is not compromised.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Uninventing Aadhaar is not a practical proposal. It would have to include repealing the statute on Aadhaar, disbanding the database already created, and figuring out alternative means of delivering the services that are now dependent on Aadhaar. A more sustainable way forward is to better secure Aadhaar. This will involve not only the secure collection and storage of personal data, but also a safe regulation of the manner in which third parties use it for authentication.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;One way to protect Aadhaar-related communications is to channel them through a secure conduit. This can be achieved through a system of temporary tokens for Aadhaar-based verifications. Sunil Abraham from the Centre for Internet and Society (CIS) has recommended a system of using dummy or virtual Aadhaar numbers along with a smart card to protect information belonging to individuals.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Tokenization is the process of masking sensitive personal data with another innocuous dataset, allowing it to be shared with third parties without the risk of the personal data being exposed. So, every time a service provider asks for identification, the individual can provide a one-time-ID number generated by an Aadhaar app or on UIDAI’s website. The service provider can authenticate the one-time-ID number with the Aadhaar database, without needing to know or store the Aadhaar number. The algorithm used to generate the one-time-ID number must be constructed using hard-to-replicate information and kept a well-guarded secret. No two service providers will have the same one-time ID, making it harder for personal profiles to be constructed by mining data from multiple service providers, thus enabling a higher level of privacy protection.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Allowing such a system of tokenization for every eKYC can create a welcome layer of ambiguity around individuals’ personal data and preserve the individuals’ Aadhaar-related information with the government. This system also breaks the link between the Aadhaar database and any third party having access to an individual’s Aadhaar number. If this link is not broken, then any entity—government or private—would have access to potentially millions of Aadhaar card numbers, opening endless possibilities for data abuse.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The tokenization process allows the authority to arrest any attempts at data abuse. In fact, to make this system of tokens or one-time-ID numbers effective, the law must build in measures to penalize any attempt to recreate an individual’s Aadhaar number from the unique token number. In other words, the service provider is given a token number for authentication, but prohibited from obtaining the Aadhaar number it corresponds to.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Tokenization is an improvement over the status quo, but only in one aspect—making Aadhaar secure. It is imperative that the government pays equal attention to the manner in which all data is collected, stored and disposed of by the authority. There are two facets to be explored here: first, ensuring secure storage of the vast information database, and second, plugging security loopholes that happen at collection by limiting access to the database.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The adoption of appropriate technical safeguards is indispensable to thwart external threats to the Aadhaar database, such as ransomware attacks. Having appropriate security, and having periodic audits to test the adequacy of such security, is indispensable.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Equally, limiting access to the database is crucial for preventing leaks, such as the ones reported in &lt;i&gt;The Tribune&lt;/i&gt;. It is important that only a select few individuals have access to the database and that these personnel are properly vetted before being vested with such responsibility.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;These various facets of the Aadhaar ecosystem are likely to be further examined in the public in the weeks to come as the Supreme Court gears up to hear the petitions on Aadhaar. Regardless of the verdict, there is an urgent need to improve the safety of the Aadhaar ecosystem and the use of tokenization goes some way towards achieving this objective.&lt;/p&gt;

    <title>Token disclosures?</title>

&lt;p class="body" style="text-align: justify; "&gt;This week, roughly around the same time, two  ‘revelations’ made headlines in the world of technology. The first, the  U.S. National Security Agency’s top secret web surveillance programme,  codenamed Xkeyscore, another expose from the house of Edward Snowden  &amp;amp; Co.; and second, microblogging site Twitter’s third biannual  Transparency Report for the first half of 2013.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;The  former exposed a global surveillance net, cast far and wide to freely  (no formal authorisation required) access and mine emails, chats and  browsing histories of millions. The content of the latter report not  only pales in comparison but also raises fundamental questions on just  how much goes on beyond the arguably modest claims made on Twitter’s  transparency charts.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;Documents published by &lt;i&gt;The Guardian &lt;/i&gt;have  the NSA claiming that the “widest-reaching” system mining intelligence  from the web had, over a month in 2012, retrieved and stored no less  than 41 billion records on its Xkeyscore servers. These mind-boggling  numbers make a mockery of Twitter’s few hundred access request  disclosures, advocates of online privacy and freedom point out. Then, it  is hardly surprising that a large chunk of global requests came from  the U.S. government: no less than 902 of the total 1,157 requests,  accounting for 78 per cent. A far second is Japan at 8 per cent followed  by the U.K.&lt;/p&gt;
&lt;h3 class="body" style="text-align: justify; "&gt;India References&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Interestingly, both Twitter’s report and the NSA’s Xkeyscore document  have India references. While a map titled 'Where is Xkeyscore' in the  training manual released showing India as one of 150 sites (hosting a  total of 700 servers) indicates that India's very much on the global  surveillance radar of the United States government; the fact that the  India is a new entrant on Twitter's ‘Country Withheld Content Tool’  means that the government here is also making active interventions in  microblogging content. This is very much in line with stances the Indian  government has taken over the last year, swinging indecisively between  asking internet firms to pre-screen content and asking service providers  to take down what it finds offensive.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;India, A Bit-Player&lt;/h3&gt;
&lt;p class="body" style="text-align: justify; "&gt;The Twitter report states that over the last six months  it has seen an increase in the number of requests received (and eventual  withholding of content) in five new countries: India, Brazil, Japan,  Netherlands and Russia. In terms of numbers, India is still very much a  bit player in the game given it falls under the ‘less than 10 category, a  list where the number of requests for user information made by the  government during this period is fewer than 10. It appears from the  report that Twitter did not honour any of these requests, indicating  that either the requests were too broad or failed to identify individual  accounts.&lt;/p&gt;
&lt;p class="body" style="text-align: justify; "&gt;In the same period, Twitter received two  requests from India to remove content, one from the “government/law  enforcement agency” and the other through a court order. In all, three  tweets were removed by Twitter. No details on the nature of content  removed were available.&lt;/p&gt;
&lt;h3 class="body" style="text-align: justify; "&gt;Transparency Trends&lt;/h3&gt;
&lt;p class="body" style="text-align: justify; "&gt;A late entrant to transparency initiatives, Twitter's  bi-annual reports have been applauded by privacy activists as an  initiative that at least attempted to offer a glimpse into the otherwise  opaque medium/industry. According to 'Who Has Your Back' an initiative  by the Electronic Frontier Foundation, which tracks which corporate  helps protect your data from the government, only a third of the 18  internet majors publish Transparency Reports – in fact, Facebook,  WordPress and Tumblr all don't publish.&lt;/p&gt;

&lt;p class="body" style="text-align: justify; "&gt;While it's  definitely good that Twitter's providing data for India, post-Edward  Snowden and his revealing PRISM leaks, netizens would question to what  extent this data is representative of the magnitude or extent of user  data tracking. Do governments like the U.S. need to approach Twitter (or  other internet service providers) at all to access detailed user  activity logs, content and metadata?&lt;/p&gt;
&lt;h3 class="body" style="text-align: justify; "&gt;Secret Orders Excluded&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Twitter makes it clear that its current report does not include "secret  orders" or FISA disclosures. In another blog related to the Transparency  Report, Jeremy Kessel, Manager, Legal Policy at Twitter Inc, writes  that since 2012, Twitter's seen an uptick in requests to withhold  content from two to seven countries. He writes that while Twitter wants  to publish “numbers of national security requests – including FISA  (Foreign Intelligence Surveillance Act) disclosures – separately from  non-secret requests.” It claims it has “insisted” that the United States  government allow for increased transparency into “secret orders”. “We  believe it’s important to be able to publish numbers of national  security requests – including FISA disclosures – separately from  non-secret requests." Unfortunately, we are still not able to include  such metrics, Twitter states.&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;'Not the Whole Truth'&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;In the absence of these metrics, Sunil Abraham, director of Centre for  Internet and Society, feels transparency reports “may not tell us the  whole truth”. The Xkeyscore revelations then may explain why the U.S.  government has made only 902 information requests. “A rogramme like  XKeyScore potentially allows them to capture the very same data without  having to approach Twitter. This is the very same imperative behind the  CMS project in India. Governments across the world want to automate  private sector involvement in blanket surveillance measures so that it  wont serve as a check on their unbridled appetite for data”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;He warns that there's a likely “race to the bottom”, given that an  unintended consequence of transparency may be that governments, rather  than being shamed into respect for free speech and privacy, would be  emboldened by the scale of surveillance and censorship in the so-called  democracies such as the US and EU members that are on top of the global  blanket surveillance game.&lt;/p&gt;

&lt;p class="S3l" style="text-align: justify; "&gt;To protect information provided by holders of Aadhaar, the Unique Identification Authority of India (UIDAI) on Tuesday cautioned people against opting for plastic or laminated “smart” cards.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Unauthorized printing of the cards could render the QR (quick response) code dysfunctional or even expose personal data without an individual’s informed consent, it said in a statement on Tuesday.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Besides, opting for plastic or laminated cards opened up the possibility of Aadhaar details (personal sensitive demographic information) being shared with devious elements without the informed consent of holders, the statement added.&lt;/p&gt;
&lt;p&gt;According to UIDAI, the Aadhaar letter sent by it, a cutaway portion or downloaded versions of Aadhaar on ordinary paper or mAadhaar are perfectly valid.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“If a person has a paper Aadhaar card, there is absolutely no need to get his/her Aadhaar card laminated or obtain a plastic Aadhaar card or so called smart Aadhaar card by paying money. There is no concept such as smart or plastic Aadhaar card,” UIDAI chief executive officer Ajay Bhushan Pandey said in a statement.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Printing Aadhaar on a plastic/PVC sheet privately can cost anywhere between Rs50 and Rs300 or more, UIDAI said. It added that a printout of the downloaded Aadhaar card, even in black and white, is as valid as the original Aadhaar letter sent by UIDAI.&lt;/p&gt;
&lt;p&gt;It added that in case a person loses his Aadhaar card, he can download the card free from &lt;i&gt;https://eaadhaar.uidai.gov.in.&lt;/i&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Pandey asked holders not to share Aadhaar number or personal details with unauthorized agencies for getting the card laminated, or printed on plastic.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The agency also directed unauthorized agencies not to collect Aadhaar information from people, reminding them that collecting such information or unauthorized printing of Aadhaar card is a criminal offence punishable with imprisonment.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“I feel a lot more has to be done by UIDAI. Sadly, by encouraging people to rely on printed Aadhaar ‘cards’, UIDAI is ending up with the worst of both worlds with respect to personal data protection: photocopies of so-called Aadhaar cards/letter are being circulated to facilitate identity fraud as well as the kind of dangerous personal data disclosures that centralized databases enable,” said Pranesh Prakash, policy director at think tank Centre for Internet and Society.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Last month, UIDAI put in place a two-layer security to reinforce privacy protections for Aadhaar holders—it introduced a virtual identification so that the actual number need not be shared to authenticate their identity. Simultaneously, it further regulated the storage of the Aadhaar numbers within various databases.&lt;/p&gt;

Under the proposed Right to Privacy Act, such calls would be considered a violation and the company responsible penalised up to Rs 5 lakh. The draft Right to Privacy Bill says that no person with a business in the country can collect or disclose any data relating to any individual without his/her consent.&lt;/b&gt;
        
&lt;p&gt;Doing so will be a punishable offence. Speakers at a seminar here on Saturday organised by the Citizen consumer and civic Action Group (CAG), were unanimous in their call for the Right to Privacy Act coming into force soon. R Revathi, an associate professor at Dr Ambedkar Law University, said the matter of privacy was very tricky. "Recently, a man who came to donate blood for a friend tested positive for HIV. The hospital got to know he was going to be engaged soon and told his fiance? after which the marriage was called off," she said. "The man was not a patient at the hospital but his personal information was made public in the interest of a larger good. These are some of the challenges expected while implementing the bill," she added.&lt;/p&gt;
&lt;p&gt;Others said there was no specific law in the Constitution to safeguard the individual's privacy. Privacy, they said, could be classified into physical and informational privacy. While the former was about the intrusion of physical space, the latter included digital and non-digital data that is personal in nature.&lt;/p&gt;

    <title>Through the looking glass: Analysing transparency reports</title>

&lt;p style="text-align: justify;"&gt;Over the past decade, a few private online intermediaries, by rapid innovation and integration, have turned into regulators of a substantial amount of online speech. Such concentrated power calls for a high level of responsibility on them to ensure that the rights of the users online, including their rights to free speech and privacy, are maintained. Such responsibility may include appealing or refusing to entertain government requests that are technically or legally flawed, or resisting gag orders on requests. For the purposes of measuring a company’s practices regarding refusing flawed requests and standing up for user rights, transparency reporting becomes useful and relevant.Making information regarding the same public also ensures that researchers can build upon such data and recommend ways to improve accountability and enables the user to understand information about when and how governments are restricting their rights.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;For some time in the last decade, Google and Twitter were the only major online platforms that published half-yearly transparency reports documenting the number of content take down and user information requests they received from law enforcement agencies. In 2013 however, that changed, when the Snowden leaks revealed, amongst other things, that these companies were often excessively compliant with requests from US’ intelligence operations, and allowed them backdoor surveillance access to user information. Subsequently, all the major Silicon Valley internet companies have been attempting to publish a variance or other of transparency reports, in hopes of re-building their damaged goodwill, and displaying a measure of accountability to its users.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The number of government requests for user data and content removal has also seen a steady rise. In 2014, for instance Google noted that in the US alone, they observed a 19% rise for the second half of the year, and an overall 250% jump in numbers since Google began providing this information. As per a study done by Comparitech, India sent the maximum number of government requests for content removal and user data in the period of 2009 - 2018.8 This highlights the increasing importance of accessible transparency reporting.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Initiatives analysing the transparency reporting practices of online platforms, like The Electronic Frontier Foundation (EFF)’s Who Has Your Back? reports, for instance, have developed a considerable body of work tracing these reporting practices, but have largely focused at them in the context of the United States (US).&amp;nbsp;In our research, we found that the existing methodology and metrics to assess the transparency reports of online platforms developed by organisations like the EFF are not adequate in the Indian context. We identify two reasons for developing a new methodology:&lt;/p&gt;
&lt;ol&gt;
&lt;li style="text-align: justify;"&gt;Online platforms make available vastly different information for US and India. For instance, Facebook breaks up the legal requests it receives for US into eight different classes (search warrants, subpoenas, etc.). Such a classification is not present for India. These differences are summarised in Annexure &lt;/li&gt;
&lt;li style="text-align: justify;"&gt;The legal regimes and procedural safeguards under which states can compel platforms to share information or take content down also differ. For instance, in India, an order for content takedown can be issued either under section 79 and its allied rules or under section 69A and its rules, each having their own procedures and relevant authorities. A summary of such provisions for Indian agencies is given in Annexure 3.&lt;/li&gt;&lt;/ol&gt;
&lt;p style="text-align: justify;"&gt;These differences may merit differences in the methodology for research into understanding the reporting practices of these platforms, depending on each jurisdiction’s legal context.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;In this report, we would be analyzing the transparency reports of online platforms with a large Indian user-base, specifically focusing on data they publish about user information and takedown requests received from Indian governments’ and courts.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;First, we detail our methodology for this report, including how we selected platforms whose transparency reports we analyse, and then specific metrics relating to information available in those reports. For the latter, we collate relevant metrics from existing frameworks, and propose a standard that can be applicable for our research.&lt;/p&gt;

    <title>Three Years Later, IPaidABribe.com Pays Off</title>

&lt;p style="text-align: justify; "&gt;The student, Shubham Kahndelwal, was asked to give a bribe before  getting a receipt for registering for an identity card called the  AADHAAR card. He at first refused, but then gave in. In response, the  official gave him a receipt for his father's registration (which he had  submitted along with his own) but not his. He &lt;a href="http://www.ipaidabribe.com/comment-pieces/government-acts-i-paid-bribe-complaint-aadhaar-operator-blacklisted"&gt;told&lt;/a&gt; I Paid A Bribe that he “never knew a simple complaint could make such a difference.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Kahndelwal elaborated:&lt;/p&gt;
&lt;blockquote style="text-align: justify; "&gt;
&lt;p&gt;I was in Chennai when the incident happened and after  that I was furious and was searching all over to look for a complaint  mechanism, when I stumbled upon IPaidaBribe.com. It is a great day and  event for me and for me to share with my friends.&lt;/p&gt;
&lt;/blockquote&gt;
&lt;p style="text-align: justify; "&gt;IPaidABribe.com was &lt;a href="http://blogs.wsj.com/indiarealtime/2010/11/15/paid-a-bribe-in-india-vent-here/"&gt;launched in August 2010&lt;/a&gt; by the Bangalore-based nonprofit Janaagraha, which focuses on civic engagement and improving governance.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;When first launched, there were concerns over privacy issues and protecting the users who submit complaints. On the other hand, &lt;a href="http://techpresident.com/news/23934/how-technology-and-isnt-helping-fight-corruption-india"&gt;in an interview this May with techPresident's David Eaves&lt;/a&gt;,  Sunil Abraham, the founder of the Center for Internet &amp;amp; Society,  pointed out that in order to make a difference, I Paid A Bribe would  somehow have to close the loop.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Abraham went on:&lt;/p&gt;
&lt;blockquote style="text-align: justify; "&gt;
&lt;p&gt;some of the things that go on with anonymous reporting  cannot happen, and to close the loop it almost needs to become a  paralegal infrastructure. It has to talk to law enforcement and people  have to be arrested, prosecuted and put away.&lt;/p&gt;
&lt;/blockquote&gt;
&lt;p style="text-align: justify; "&gt;That is apparently what happened in this case. The official in  question has been blacklisted and had disciplinary action taken against  him.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;To put the success in perspective, however, the bribe requested was  Rs 2000 (US$31.95) and the bribe ultimately given was only Rs 350  (US$5.59).&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Abraham also pointed out to Eaves that the real problem in India is “high ticket bribes...at the top of the pyramid.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;So while complaints from people like Kahndelwal are what keep the  feeds at IPaidABribe.com constantly refreshing, they're mere drops in  the bucket when compared to the millions of dollars moving in scandals  like the &lt;a href="http://indiatoday.intoday.in/story/what-is-the-2g-scam-all-about/1/188832.html"&gt;2G spectrum scam&lt;/a&gt;.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Oyo Rooms, the online hotel room booking service, has been receiving brickbats since it disclosed this week that it was sharing real-time data of guests with the police and the government.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Internet and legal experts in Bengaluru say it is a breach of informational privacy, granted as a fundamental right by the Constitution. Couples running away from hostile families and individuals escaping religious and political persecution are at huge risk if their whereabouts are shared, they say.&lt;/p&gt;
&lt;p&gt;Aayush Rathi, policy officer with Centre for Internet and Society, finds the sharing of live guest data disturbing.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“Hotels have always maintained records. Earlier, when information from hotels was needed, a specific query had to be raised by law enforcement, pursuant to an ongoing case. The registry represents a significant departure by facilitating the collection of this data by law enforcement without cause,” he says.&lt;/p&gt;
&lt;p&gt;He also rues the lack of transparency about what the government will do with such data.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“The government is already collecting a lot of data and has little direction on what to do with it. There is no clarity on how this information will be used and protected. The government might say it is necessary for security, a very broad umbrella term, but in the absence of regulations, the data can be used for purposes little to do with security,” says Rathi.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The service had initially marketed itself as a couple-friendly service, while across the country, unmarried, inter-faith couples face various challenges finding a room. “This targeting could get even more enhanced,” he fears.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Recently, passport details were leaked from a popular hotel chain. The leaked data from hotel bookings can be used for multifarious purposes, ranging from selling to potential advertisers to identity theft,” Rathi says.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Lawyer-researcher Nayantara Ranganathan, from the Internet Democracy Project, says the argument that sharing data improves privacy is “absolutely disingenuous.”&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“Sharing all guest records in real-time to state governments and law enforcement is shocking and most definitely a breach of privacy,” she says.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;With the state getting access to such information with the promise of preventive policing, there is no telling how data is going to be used, she says.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;She finds it bizarre that a private company is proactively sharing data, especially at a time when companies are “waking up to the fact that their consumers value their privacy.”&lt;/p&gt;
&lt;h3 style="text-align: justify; "&gt;Why it endangers lives&lt;/h3&gt;
&lt;p style="text-align: justify; "&gt;Vinay Sreenivasa, lawyer and member of Alternative Law Forum, says providing access to such information is ‘criminal.’ “A couple could be running away from moral policing after an inter-caste marriage and people might be tracking them, or someone might be going through a divorce and just need some privacy. There could be several reasons why one seeks a room and such data could put lives at risk,” he says.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Supreme Court has clearly stated one’s data is one’s own and consent has to be taken when any personal information is used. The government has no business accessing such information, he says.&lt;/p&gt;

    <title>There's a Spy Behind Your Gadget Screen Tracking Data </title>

&lt;p style="text-align: justify; "&gt;Thejesh GN, a Bangalore-based technologist, does not have a Facebook app  on his phone, often browses on incognito mode and has installed a tool  that detects and blocks spy ads and trackers. All this is to escape from  the pervasive ads that have now begun to invade his online presence.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;But Thejesh knows it's of little use. Given the proliferation of  ecommerce companies in India, the barrage of ads are unlikely to stop.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“It's an everyday fight.There is no way to get rid of all these ads,“ said Thejesh, cofounder of data science  community Datameet.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Thejesh represents a growing population of  Internet users who are becoming aware of the risks that come with their  online habits specifically, having each data point of their everyday  lives collected by companies and tech startups. This includes an  individual's IP address, browser type, pages viewed, and the date and  time of use.On mobile, the data collected could be more elaborate and  accurate ­ including a user's  location, device type and contact list.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Where does all this data go?&lt;br /&gt;Some are sold to brands via ad  networks, and others are used by companies to streamline the ads shown  to specific users. In India there are no rules explicitly regulating  online behavioural advertising, and thus it is not clear what practices  different companies and internet service providers undertake.  It is not clear what information is collected, how the information is  used, how long the information is stored for, and what access law  enforcement has to this information, the Center for Internet and Society  said in a report titled `Consumer Privacy'.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Siddharth Shankar, a  student of statistics from Patna University, who is also learning  ethical hacking, is of the view that few people care about privacy in  India. “Their simple reply: What will they do with our data?“ said  Shankar, who takes steps similar to Thejesh to protect his privacy  online.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;More people seem to be waking up to the fact that privacy is  important and that ads are intrusive. Of the 50 million users who block  ads using AdBlock Plus, about 1.2 million are from India. AdBlock Plus, a  mobile and browser tool, recently won a case against two publishers in  Germany who wanted it to stop blocking ads on their websites. Most  digital products, including apps and content, are free. To sustain  themselves, the digital product makers sell the data they collect at the  time of app installs or website visits to brands or ad networks.In  other words, the end-users are not their customers ­­ advertisers are.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“It boils down to, `If you are not paying for the product, you are the  product,'“ said Vinod Chandrashekhar, chapter leader of DataKind  Bangalore, a movement to use big   data for the benefit of public causes. “I won't be surprised in the  future if a few firms might charge to erase your data.“&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;And that,  he says, is one of the popular ways for restaurant and company review  apps to make money: prompting owners to buy a premier account or be  charged for ad vertising in order to delete unfavourable reviews.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Privacy breaches also give way to corporate espionage.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;“The South Asian market is, in many ways, similar to what we're  seeing in South America. They are looking for not only security for  their businesses and for their own personal affairs, but they are also  looking for something that is affordable,“ said Jon Callas, cofounder  and chief technology officer at Silent Circle.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Swiss-based  firm provides an end-toend secure access channel ­­ from a smartphone to  a telecommunication network ­­ allowing users to go about their daily  lives without leaking their online footprint.&lt;/p&gt;

&lt;p style="text-align: left;"&gt;Sometimes the best of intentions can camouflage the worst of motives. On the face of it, the government’s bid to bring in a privacy bill is a welcome move, a long-overdue measure. But after an initial&amp;nbsp;approach paper prepared by lawyers and bureaucrats in November last year, the government went into a secretive huddle. Now a leaked April 19, 2011, version of the bill raises several disturbing questions.&lt;/p&gt;

&lt;p style="text-align: left;"&gt;While recognising the need for privacy, the government has also slipped in several clauses that could severely restrict the freedom of the press if enacted in its current form. Worse, it could actually make journalists liable for prosecution as well as imprisonment up to five years. And if that was not bad enough, it does little or nothing to prevent the government from invading a citizen’s privacy. In fact, it will legitimise all forms of intrusion by the state and collection of a wide variety of data from individuals.&lt;/p&gt;
&lt;p style="text-align: left;"&gt;TV news channels could be the most affected by this. Sting operations could become a very risky thing in the future, with section four of the proposed bill saying that any form of filming/recording can be deemed as surveillance and anyone doing so without proper authorisation would be liable for prosecution. So if someone was to secretly catch on camera MPs accepting cash for posing questions in Parliament, or record a bureaucrat demanding bribes, chances are he/she will be doing time in jail.&lt;/p&gt;
&lt;p style="text-align: left;"&gt;While the proposed draft draws a distinction between data and personal information, it still leaves little room for journalists. For instance, if a reporter were to use "personal information" of an individual for an article without his/her written consent, it will amount to a civil offence and immediately attract a penalty of up to Rs. 1 lakh. If the journalists were to repeat the "offence" by publishing another story using the same material, the penalty goes up to Rs. 5 lakh. So, is the UPA government, under the scanner for a plethora of scams, trying to muzzle the media? It certainly seems so.&lt;/p&gt;

&lt;p&gt;Now when it comes to the government’s right to invade a citizen’s privacy, the proposed legislation offers little immunity. It will uphold all existing laws of phone-tapping, interception of communications, collection of statistics and personal data with impunity. "The proposed bill doesn’t change any system or structure of surveillance that are in place today," says Usha Ramanathan, a law researcher who has worked extensively on privacy issues. "Look at the Collection of Statistics Act passed by Parliament last year. You can be penalised for not sharing the information that the government seeks from you. This is very disturbing."&lt;/p&gt;

&lt;p style="text-align: left;"&gt;Ramanathan’s discomfiture has its reasons. "In the past three years, the government has become far more intrusive than it ever was. All this is asserting the sovereignty of the state over the citizen when the Constitution says that the citizen is supreme. This bill, in its current form, also brings in an element of pre-censorship that violates our fundamental right to speech as well as several judgements of the Supreme Court that ruled against pre-censorship."&lt;/p&gt;
&lt;p style="text-align: left;"&gt;On the other hand, former cabinet secretary K.M. Chandrashekhar, a prime mover behind the bill during his tenure, feels that the security needs of the state warrant "lawful" intrusion by it. “The idea was to protect privacy but not short-circuit the current surveillance systems in place for combating terrorism."&lt;/p&gt;

&lt;p style="text-align: left;"&gt;As far as protecting privacy is concerned, of course all is not bad with the proposed bill. Prashant Iyengar, a researcher with the Centre for Internet and Society (CIS), a Bangalore-based NGO that has played a leading role in shaping the public discourse on this issue, is hopeful. "For the first time, this bill creates a strong liability for the government. This means that the government can be held liable and penalised for the violation of privacy. It also establishes a routine civil liability against the government for all its lapses in protecting the privacy of citizens... which is very good.” But Prashant also feels that the bill has a long way to go before it resolves some inherent contradictions. “The proposed Act must recognise the concept of public interest while it protects privacy. That is an element missing from the current discourse."&lt;/p&gt;
&lt;p style="text-align: left;"&gt;Satyananda Mishra, the chief information commissioner and a former secretary, DoPT, has a nuanced view of the proposed bill. He feels public interest must outweigh privacy in every case. "But while we accept the primacy of public interest, we must be very, very careful about what is public interest," he says.&amp;nbsp;&lt;/p&gt;
&lt;p style="text-align: left;"&gt;Mishra, in many ways the country’s biggest trustee of transparency in public life today, suggests a few key modifications in the conditions in the proposed legislature.&amp;nbsp;"We need to understand that after the enactment of the RTI Act, it has become incumbent upon us to have some form of inherent disclosure in all our public dealings. This will also safeguard our privacy from the government."&lt;/p&gt;
&lt;p style="text-align: left;"&gt;The relationship between citizen and government, says Mishra, is guided by a social contract. "People elect governments and trust them with their lives and liberty in the promise that the government will exercise its powers for their welfare. But there could be instances where the government breaks that promise. It could legitimately tap someone’s phone through legal means, but with malicious intent."&lt;/p&gt;
&lt;p style="text-align: left;"&gt;To prevent this, Mishra suggests a modification to the proposed Privacy Act. "Let there be disclosure of all such events, after a reasonable period of time, of any effort by the government to invade the privacy of citizens. For instance, if it needs to tap the phones of a person, then it must be disclosed after a period of time. After all, phones can be tapped legally only to protect the interests of the state. So it should either lead to a criminal prosecution or a disclosure after a reasonable amount of time has elapsed. That is the only way we will be able to curb the intrusive powers of the state and protect the privacy of citizens." Prashant of CIS agrees with Mishra’s suggestion. "In the United States, all wire-tapping laws have a clause for disclosure. This way, a citizen will know if his privacy has been violated lawfully or not."&lt;/p&gt;
&lt;div class="pullquote"&gt;Now if a reporter were to use "personal info" without consent, it will mean a civil offence, a penalty of Rs. 1 lakh.&lt;/div&gt;
&lt;p style="text-align: left;"&gt;While the government will take its time to introduce the bill in Parliament, it needs to be more transparent in its deliberations. Right now two ministries are working simultaneously on the same bill. While the ministry of law and justice under Veerappa Moily is busy shaping its draft, the ministry of personnel, training and public grievances under the prime minister is busy formulating its own version. While they work on it, what both ministries must recognise is that nothing is private about public policy.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Though       social networks were not designed with the intention of letting       someone anonymously abuse another online, the reality is that       people utilize the ability to hide behind online identities to       threaten other users. These could be veiled attacks, direct abuse,       or even threats to “cause bodily harm”.       What can you do if you’re trolled and threatened on any social       network? Follow our five-step guide.       Avoid conversation if you can       The responses could come in relation to something you may have       just posted online. Or perhaps it could be just a random trolling       attempt, to get a response from you. It is important to understand       and identify such intentions. And as difficult as it may be, do       not respond. Getting into a direct interaction with a bully only       makes things worse.       Report to the social network       You should report any instance of cyber bullying or harassment to       the host social network—the website or forum on which the       interaction happened. There are various methods of getting in       touch with the moderators—customer support email, contact       submission forms or even via phone, in certain locations. Describe       the problem in detail, and persist till the offending account is       blocked from the platform.       “Most social networks have systems that allow you to report       abusive content and users. However, there is great variance in the       speed with which they respond across different platforms,       jurisdictions, etc.,” says Sunil Abraham, executive director at       the Bangalore-based non-profit research organization Centre for       Internet and Society. New Delhi-based Anja Kovacs, project       director, at civil society organization Internet Democracy       Project, adds: “Blocking and reporting an account can be two ways       to stop harassment on some social networks, but on other       platforms, such as Twitter, it is possible for the person to       immediately make a new account under a different username, meaning       that these measures do not necessarily stop the harassment.”       Ankhi Das, director, public policy, India and South Asia at social       network Facebook, says: “Every reported piece of content is       reviewed. Serial offenders are notified for non-compliance.”       Facebook’s Community Standards, that prevent harassment and       offensive posts, have an 11-point categorization for reported       content—violence and threats, hate speech, graphic content,       bullying and harassment, to name some.       Raheel Khursheed, head of news, politics and government at Twitter       India, did not respond to our mail about how Twitter handles       trolls at the time of going to press.       On blogs and forums, it may be a bit easier to deal with trolling       and abuse. If it is your own blog, you can delete comments and       block users. If it is a forum, the administrator can do it for       you. But, with social networks having millions of users, it is not       possible to have one administrator managing it all. And it is not       just Facebook and Twitter, all social networks have a method by       which you can register your complaint. LinkedIn, for example,       automatically blocks a user who gets multiple “I don’t know”       responses to invitations to connect. There is a strong monitoring       policy where any reported content (recommendations or direct       messages) is examined and immediate warnings are sent out to       offending parties.       Keep a copy of the offensive posts       Be it a post, or a series of posts, direct message or even an       offending photograph, always save it for future reference. Never       assume that the matter will end soon, and always prepare for the       worst.       Don’t ignore privacy settings       Most people start using Facebook, Twitter and other social       networks without paying much attention to the privacy       settings—what content people can see on your page, and who can       directly contact you. Be conservative in sharing information—the       less you share, the lower the chances of someone picking on you.       “Avoid friending or linking to people whom you don’t know in real       life unless you are certain of the chain of trust that exists       between you and the unknown person,” says Abraham. New Delhi-based       cyber lawyer Apar Gupta, adds: “The privacy settings on most       social networking platforms allow users to prevent (restrict) the       audience for their posts as well as strangers from contacting       them. This will prevent most cases of online harassment.”       Get help from the law       In case social networks are not able to effectively block a user,       or are in some way unwilling to do so, take help from the       law-enforcement authorities. File an FIR in the nearest police       station. Unfortunately, the progress may not be very smooth. The       reality is that not every law-enforcement officer may know about       social networking sites. “You could try and go to the police, but       without support from the social network platform, they are often       at a loss to do much themselves,” warns Kovacs.       The police may look for hints of threat to cause bodily harm or       worse still, to life. In such cases, they may recommend the case       to the Cyber Crime Cell of the Central Bureau of Investigation.       “Generally, while the substantive offences do exist under law, the       process for having them enforced is deficient. These are deeper       structural problems of delay, investigation and conviction which       are prevalent across criminal justice or civil litigation,”       clarifies Gupta. Officials at the Cyber Crime Cell say they take       up cases after reference from the local police, who file the       report first and do a preliminary level of investigation.       But it is important to realize that only the police and the       law-enforcement agencies have the right to demand further details       about the perpetrator from the social networks, starting with       profile       details and Internet Protocol (IP) addresses, which will help       track the person down. Das clarifies: “Facebook has a       point-of-contact system through which the law-enforcement agencies       tell us what the actual case is, depending on severity. The police       may ask us to take down particular content, or even ask for user       information like IP info, to prevent real crime.”       According to Facebook’s Government Requests Report for       July-December 2013, the network restricted access to 4,765 pieces       of content after requests from the Indian government and       law-enforcement agencies.&lt;/p&gt;

&lt;p style="text-align: justify;"&gt;Defining big data is a disputed area in the field of computer science&lt;a name="_ftnref1" href="#_ftn1"&gt;&lt;sup&gt;&lt;sup&gt;[1]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;, there is some consensus on a basic structure to its definition&lt;a name="_ftnref2" href="#_ftn2"&gt;&lt;sup&gt;&lt;sup&gt;[2]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;. Big data is data that is collected in the form of datasets that has three main criteria: size, variety &amp;amp; velocity, all of which operate at an immense scale&lt;a name="_ftnref3" href="#_ftn3"&gt;&lt;sup&gt;&lt;sup&gt;[3]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;. It is ‘big’ in size, often running into petabytes of information, has vast variety within its components, and is created, captured and analysed at an incredibly rapid velocity. All of this also makes big data difficult to handle using traditional technological tools and techniques.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;This paper will attempt to perform a high-level literature review of the most commonly used technological tools and processes in the big data life cycle. The big data life cycle is a conceptual construct that can be used to study the various stages that typically occur in collecting, storing and analysing big data, along with the principles that can govern these processes. The big data life cycle consists of four components, which will also be the key structural points of the paper, namely: Data Acquisition, Data Awareness, Data Analytics &amp;amp; Data Governance.&lt;strong&gt;&lt;sup&gt;4&lt;/sup&gt; &lt;/strong&gt;The paper will focus on the aspects that the author believes are relevant for analysing the technological impact of big data on both technology itself and society at large.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;&lt;strong&gt;Scope: &lt;/strong&gt;The scope of the paper is to study the technology used in big data using the "Life Cycle of Big Data" as model structure to categorise &amp;amp; study the vast range of technologies that are involved in big data. However, the paper will be limited to the study of technology related directly to the big data life cycle. It shall specifically exclude the use/utilisation of big data from its scope since big data is most often being fed into other, unrelated technologies for consumption leading to rather limitless possibilities.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;&lt;strong&gt;Goal:&lt;/strong&gt; Goal of the paper is twofold: a.) to use the available literature on the technological aspects of big data, to perform a brief overview of the technology in the field and b.) to frame the relevant research questions for studying the technology of big data and its possible impact on society.&lt;/p&gt;
&lt;h2 style="text-align: justify;"&gt;Data Acquisition&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;Acquiring big data has two main sub components to it, the first being sensing the existence of the data’ itself and the second, the stage of collecting and storing this data. Both of these subcomponents are incredibly diverse fields, with lots of rapid change occurring in the technology utilised to carry out these tasks. The section will provide a brief overview of the subcomponents and then discuss the technology used to fulfil the tasks.&lt;/p&gt;
&lt;h2 style="text-align: justify;"&gt;Data Sensing&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;Data does not exist in a vacuum and is always created as a part of a larger process, especially in the aspect of modern technology. Therefore, the source of the data itself plays a vital role in determining how it can be captured and analysed in the larger scheme of things. Entities constantly emit information into the environment that can be utilised for the purposes of big data, leading to two main kinds of data: data that is “born digital” or “born analogue.”&lt;a name="_ftnref4" href="#_ftn4"&gt;&lt;sup&gt;&lt;sup&gt;[4]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;&lt;/p&gt;
&lt;h3 style="text-align: justify;"&gt;Born Digital Data&lt;/h3&gt;
&lt;p style="text-align: justify;"&gt;Information that is “born digital,” is created, by a user or by a digital system, specifically for use by a computer or data‐processing system. This is a vast range of information and newer fields are being added to this category on a daily basis. It includes, as a short, indicative list: email and text messaging, any form of digital input, including keyboards, mouse interactions and touch screens, GPS location data, data from daily home appliances (Internet of Things), etc. All of this data can be tracked and tagged to users as well as be aggregated to form a larger picture, massively increasing the scope of what may constitute the ‘data’ in big data.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Some indicative uses of how such born digital data is catalogued by technological solutions on the user side, prior to being sent for collection/storage are:&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;a.) Cookies - There are small, often just text, files that are left on user devices by websites in order to that visit, task or action (for example, logging into an email account) with a subsequent event.&lt;a name="_ftnref5" href="#_ftn5"&gt;&lt;sup&gt;&lt;sup&gt;[5]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; (for example, revisiting the website)&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;b.) Website Analytics&lt;a name="_ftnref6" href="#_ftn6"&gt;&lt;sup&gt;&lt;sup&gt;[6]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; - Various services, such as Google Analytics, Piwik, etc., can use JavaScript and other web development languages to record a very detailed, intimate track of a user's actions on a website, including how long a user hovers above a link, the time spent on the website/application and in some cases, even the time spent specific aspects of the page.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;c.) GPS&lt;a name="_ftnref7" href="#_ftn7"&gt;&lt;sup&gt;&lt;sup&gt;[7]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; - With the almost pervasive usage of smartphones with basic location capabilities, GPS sensors on these devices are used to provide regular, minute driven updates to applications, operating systems and even third parties about the user's location. Modern variations such as A-GPS can be used to provide basic positioning information even without satellite coverage, vastly expanding the indoor capabilities of location collection.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;All of these instances of sensing born digital data are common terms, used in daily parlance by billions of people from all over the world, which is a symbolic of just how deeply they have pervaded into our daily lifestyle. Apart from privacy &amp;amp; security concerns this in turn also leads to an exponential increase in the data available to collect for any interested party.&lt;/p&gt;
&lt;h3 style="text-align: justify;"&gt;Sensor Data&lt;/h3&gt;
&lt;p style="text-align: justify;"&gt;Information is said to be&amp;nbsp; “analogue” when it contains characteristics of the physical world, such as images, video, heartbeats, etc.&amp;nbsp; Such information becomes electronic when processed by a “sensor,” a device that can record physical phenomena and convert it into digital information. Some examples to better illustrate information that is born analogue but collected via digital means are:&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;a.) Voice and/or video content on devices - Apart from phone calls and other forms communication, video and voice based interactions have started to regularly be captured to provide enhanced services. These include Google Now&lt;a name="_ftnref8" href="#_ftn8"&gt;&lt;sup&gt;&lt;sup&gt;[8]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;, Cortana&lt;a name="_ftnref9" href="#_ftn9"&gt;&lt;sup&gt;&lt;sup&gt;[9]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; and other digital assistants as well as voice guided navigation systems in cars, etc.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;b.) Personal health data such as heartbeats, blood pressure, respiration, velocity, etc. - This personal, potentially very powerful information is collected by dedicated sensors on devices such as Fitbit&lt;a name="_ftnref10" href="#_ftn10"&gt;&lt;sup&gt;&lt;sup&gt;[10]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;, Mi Band&lt;a name="_ftnref11" href="#_ftn11"&gt;&lt;sup&gt;&lt;sup&gt;[11]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;, etc. as well as by increasingly sophisticated smartphone applications such as Google Fit that can do so without any special device.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;c.) Camera on Home Appliances - Cameras and sensors on devices such as video game consoles (Kinect&lt;a name="_ftnref12" href="#_ftn12"&gt;&lt;sup&gt;&lt;sup&gt;[12]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; being a relevant example) can record detailed human interactions, which can be mined for vast amounts of information apart from carrying out the basic interactions with the devices itself.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;While not as vast a category as born digital data, the increasingly lower costs of technology and ubiquitous usage of digital, networked devices is leading to information that was traditionally analogue in nature to be captured for use at a rapidly increasing rate.&lt;/p&gt;
&lt;h2 style="text-align: justify;"&gt;Data Collection &amp;amp; Storage&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;Traditional data was normally processed using the Extract, Transform, Load (ETL) methodology, which was used to collect the data from outside sources, modify the data to fit needs, and then upload the data into the data storage system for future use.&lt;a name="_ftnref13" href="#_ftn13"&gt;&lt;sup&gt;&lt;sup&gt;[13]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; Technology such as spreadsheets, RDBMS databases, Structured Query Languages (SQL), etc. were all initially used to carry out these tasks, more often than not manually. &lt;a name="_ftnref14" href="#_ftn14"&gt;&lt;sup&gt;&lt;sup&gt;[14]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;However, for big data, the methodology traditionally followed is both inefficient and insufficient to meet the demands of modern use. Therefore, the Magnetic, Agile, Deep (MAD) process is used to collect and store data&lt;a name="_ftnref15" href="#_ftn15"&gt;&lt;sup&gt;&lt;sup&gt;[15]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;&lt;a name="_ftnref16" href="#_ftn16"&gt;&lt;sup&gt;&lt;sup&gt;[16]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;. The needs and benefits of such a system are: attracting all the data sources regardless of their quality (magnetic), logical and physical contents of storage systems adapting to the rapid data evolution in big data (agile) and complex algorithmic statistical analysis required of big data on a very short notice&lt;a name="_ftnref17" href="#_ftn17"&gt;&lt;sup&gt;&lt;sup&gt;[17]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;. (deep)&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The technology used to perform data storage using the MAD process requires vast amount of processing power, which is very difficult to create in a single, physical space/unit for nonstate or research entities, who cannot afford supercomputers. Therefore, most solutions used in big data rely on two major components to store data: distributed systems and Massive Parallel Processing&lt;a name="_ftnref18" href="#_ftn18"&gt;&lt;sup&gt;&lt;sup&gt;[18]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; (MPP) that run on non-relational (in-memory) database systems. Database performance and reliability is traditionally gauged using pure performance metrics (FLOPS per second, etc.) as well as the Atomicity, consistency, isolation, durability (ACID) criteria.&lt;a name="_ftnref19" href="#_ftn19"&gt;&lt;sup&gt;&lt;sup&gt;[19]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; The most commonly used database systems for big data applications are given below. The specific operational qualities and performance of each of these databases is beyond the scope of this review but the common criteria that makes them well suited for big data storage have been delineated below.&lt;/p&gt;
&lt;h3 style="text-align: justify;"&gt;Non-relational databases&lt;/h3&gt;
&lt;p style="text-align: justify;"&gt;Databases traditionally used to be structured entities that operated solely on the ability to correlate information stored in them using explicitly defined relationships. Even prior to the advent of big data, this outlook was turning out to be a limiting factor in how large amounts of stored information could be leveraged, this led to the evolution of non relational database systems. Before going into them in detail, a basic primer on their data transfer protocols will be helpful in understanding their operation.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;A protocol is a model that structures instructions in a particular manner so that it can be reproduced from one system to another&lt;a name="_ftnref20" href="#_ftn20"&gt;&lt;sup&gt;&lt;sup&gt;[20]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;&lt;a name="_ftnref21" href="#_ftn21"&gt;&lt;sup&gt;&lt;sup&gt;[21]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;. The protocols which govern technology in the case of big data have gone through many stages of evolution, starting off with simple HTML based systems&lt;a name="_ftnref22" href="#_ftn22"&gt;&lt;sup&gt;&lt;sup&gt;[22]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;, which then evolved to XML driven SOAP systems&lt;a name="_ftnref23" href="#_ftn23"&gt;&lt;sup&gt;&lt;sup&gt;[23]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;, which led to JavaScript Object Notation, or JSON&lt;a name="_ftnref24" href="#_ftn24"&gt;&lt;sup&gt;&lt;sup&gt;[24]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;, the currently used form for in most big database systems. JSON is an open format used to transfer data objects, using human-readable text and is the basis for most of the commonly used non-relational database management systems. Examples of Non-relational databases also known as NoSQL databases, include MongoDB&lt;a name="_ftnref25" href="#_ftn25"&gt;&lt;sup&gt;&lt;sup&gt;[25]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;, Couchbase&lt;a name="_ftnref26" href="#_ftn26"&gt;&lt;sup&gt;&lt;sup&gt;[26]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;, etc. They were developed for both managing as well as storing unstructured data. They aim for scaling, flexibility, and simplified development. Such databases rather focus on the high-performance scalable data storage, and allow tasks to be written in the application layer instead of databases specific languages, allowing for greater interoperability.&lt;a name="_ftnref27" href="#_ftn27"&gt;&lt;sup&gt;&lt;sup&gt;[27]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;&lt;/p&gt;
&lt;h3 style="text-align: justify;"&gt;In-Memory Databases&lt;/h3&gt;
&lt;p style="text-align: justify;"&gt;In order to overcome performance limitation of traditional database systems, some modern databases now use in-memory databases. These systems manage the data in the RAM memory of the server, thus eliminating storage disk input/output. This allows for almost realtime responses from the database, in comparisons to minutes or hours required on traditional database systems. This improvement in the performance is so massive that, entirely new applications are being developed for using IMDB systems.&lt;a name="_ftnref28" href="#_ftn28"&gt;&lt;sup&gt;&lt;sup&gt;[28]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; These IMDB systems are also being used for advanced analytics on big data, especially to increase the access speed to data and increase the scoring rate of analytic models for analysis.&lt;a name="_ftnref29" href="#_ftn29"&gt;&lt;sup&gt;&lt;sup&gt;[29]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; Examples of IMDB include VoltDB&lt;a name="_ftnref30" href="#_ftn30"&gt;&lt;sup&gt;&lt;sup&gt;[30]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;, NuoDB&lt;a name="_ftnref31" href="#_ftn31"&gt;&lt;sup&gt;&lt;sup&gt;[31]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;, SolidDB&lt;a name="_ftnref32" href="#_ftn32"&gt;&lt;sup&gt;&lt;sup&gt;[32]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; and Apache Spark&lt;a name="_ftnref33" href="#_ftn33"&gt;&lt;sup&gt;&lt;sup&gt;[33]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;.&lt;/p&gt;
&lt;h2 style="text-align: justify;"&gt;Hybrid Systems&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;These are the two major systems used to store data prior to it being processed or analysed in a big data application. However, the divide between data storage and data management is a slim one and most database systems also contain various unique attributes that cater them to specific kinds of analysis. (as can be seen from the IMDB example above) One example of a very commonly used Hybrid system that deals with storage as well as awareness of the data is Apache Hadoop&lt;sup&gt;33&lt;/sup&gt;, which is detailed below.&lt;/p&gt;
&lt;h2 style="text-align: justify;"&gt;Apache Hadoop&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;Hadoop consists of two main components: the HDFS for the big data storage, and MapReduce for big data analytics, each of which will be detailed in their respective section.&lt;/p&gt;
&lt;ol style="text-align: justify;"&gt;
&lt;li&gt;The HDFS&lt;a name="_ftnref34" href="#_ftn34"&gt;&lt;sup&gt;&lt;sup&gt;[34]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;&lt;a name="_ftnref35" href="#_ftn35"&gt;&lt;sup&gt;&lt;sup&gt;[35]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; storage function in Hadoop provides a reliable distributed file system, stored across multiple systems for processing &amp;amp; redundancy reasons. The file system is optimized for large files, as single files are split into blocks and spread across systems known as cluster nodes.&lt;a name="_ftnref36" href="#_ftn36"&gt;&lt;sup&gt;&lt;sup&gt;[36]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; Additionally, the data is protected among the nodes by a replication mechanism, which ensures availability even if any node fails. Further, there are two types of nodes: Data Nodes and Name Nodes.&lt;a name="_ftnref37" href="#_ftn37"&gt;&lt;sup&gt;&lt;sup&gt;[37]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; Data is stored in the form of file blocks across the multiple Data Nodes while the Name Node acts as an intermediary between the client and the Data Node, where it directs the requesting client to the particular Data Node which contains the requested data.&lt;/li&gt;&lt;/ol&gt;
&lt;p style="text-align: justify;"&gt;This operating structure for storing data also has various variations within Hadoop such as HBase for key/value pair type queries (a NoSQL based system), Hive for relational type queries, etc. Hadoop’s redundancy, speed, ability to run on commodity hardware, industry support and rapid pace of development have led to it being almost co-equivalently associated with big data.&lt;a name="_ftnref38" href="#_ftn38"&gt;&lt;sup&gt;&lt;sup&gt;[38]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;&lt;/p&gt;
&lt;h2 style="text-align: justify;"&gt;Data Awareness&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;Data Awareness, in the context of big data, is the task of creating a scheme of relationships within a set of data, to allow different users of the data to determine a fluid yet valid context and utilise it for their desired tasks.&lt;a name="_ftnref39" href="#_ftn39"&gt;&lt;sup&gt;&lt;sup&gt;[39]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; It is a relatively new field, in which most of the work is currently being done on semantic structures to allow data to gain context in an interoperable format, in contrast to the current system where data is given context using unique, model specific constructs.&lt;a name="_ftnref40" href="#_ftn40"&gt;&lt;sup&gt;&lt;sup&gt;[40]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; (such as XML Schemes, etc.)&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Some of the original work on this field was carried out in the form of utilising the Resource Description Framework (RDF), which was built primarily to allow describing of data in a portable manner, especially being agnostic towards platforms and systems for Semantic Web at the W3C. SPARQL is the language used to implement RDF based designs but both largely remain underutilised in both the public domain as well as big data. Authors such as Kurt&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Cagle&lt;a name="_ftnref41" href="#_ftn41"&gt;&lt;sup&gt;&lt;sup&gt;[41]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; and Bob DuCharme&lt;a name="_ftnref42" href="#_ftn42"&gt;&lt;sup&gt;&lt;sup&gt;[42]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; predict its explosion in the next couple of years. Companies have also started realising the value of interoperable context, with Oracle Spatial&lt;a name="_ftnref43" href="#_ftn43"&gt;&lt;sup&gt;&lt;sup&gt;[43]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; and IBM’s DB2&lt;a name="_ftnref44" href="#_ftn44"&gt;&lt;sup&gt;&lt;sup&gt;[44]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; already including RDF and SPARQL support in the past 3 years.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;While underutilised, the rapid developments taking place in the field will make the impact that data awareness may have on big data as big as Hadoop and maybe even SQL. Some aspects of it are already beginning to be used in Artificial Intelligence, Natural Language Processing, etc. with tremendous scope for development.&lt;a name="_ftnref45" href="#_ftn45"&gt;&lt;sup&gt;&lt;sup&gt;[45]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;&lt;/p&gt;
&lt;h2 style="text-align: justify;"&gt;Data Processing &amp;amp; Analytics&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;Data Processing largely has three primary goals: a. determines if the data collected is internally consistent; b. make the data meaningful to other systems or users using either metaphors or analogy they can understand; and (what many consider most importantly) provide predictions about future events and behaviours based upon past data and trends.&lt;a name="_ftnref46" href="#_ftn46"&gt;&lt;sup&gt;&lt;sup&gt;[46]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Being a very vast field with rapidly changing technologies governing its operation, this section will largely concentrate on the most commonly used technologies in data analytics.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;Data analytics requires four primary conditions to be met in order to carry out effective processing: fast, data loading, fast query processing, efficient utilisation of storage and adaptivity to dynamic workload patterns. The analytical model most commonly associated with meeting this criteria and with big data in general is MapReduce, detailed below. There are other, more niche models and algorithms (such as Project Voldemort&lt;a name="_ftnref47" href="#_ftn47"&gt;&lt;sup&gt;&lt;sup&gt;[47]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; used by LinkedIn), which are used in big data but they are beyond the scope of the review, and more information about them can be read at article linked in the previous citation. (Reference architecture and classification of technologies, products and services for big data system)&lt;/p&gt;
&lt;h2 style="text-align: justify;"&gt;MapReduce&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;MapReduce is a generic parallel programming concept, derived from the “Map” and “Reduce” of functional programming languages, which makes it particularly suited for big data operations. It is at the core of Hadoop&lt;a name="_ftnref48" href="#_ftn48"&gt;&lt;sup&gt;&lt;sup&gt;[48]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;, and performs the data processing and analytics functions in other big data systems as well.&lt;a name="_ftnref49" href="#_ftn49"&gt;&lt;sup&gt;&lt;sup&gt;[49]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; The fundamental premise of MapReduce is scaling out rather than scaling up, i.e., (adding more numerical resources, rather than increasing the power of a single system)&lt;a name="_ftnref50" href="#_ftn50"&gt;&lt;sup&gt;&lt;sup&gt;[50]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;MapReduce operates by breaking a task down into steps and executing the steps in parallel, across many systems. This comes with two advantages, a reduction in the time needed to finish the task and also a decrease in the amount of resources one has to expend to perform the task, in both power and energy. This model makes it ideally suited for the large data sets and quick response times required of big data operations generally.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The first step of a MapReduce job is to correlate the input values to a set of keys/value pairs as output. The “Map” function then partitions the processing tasks into smaller tasks, and assigns them to the appropriate key/value pairs.&lt;a name="_ftnref51" href="#_ftn51"&gt;&lt;sup&gt;&lt;sup&gt;[51]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; This allows unstructured data, such as plain text, to be mapped to a structured key/value pair. As an example, the key could be the punctuation in a sentence and the value of the pair could be the number of occurrences of the punctuation overall. This output of the Map function is then passed on “Reduce” function.&lt;a name="_ftnref52" href="#_ftn52"&gt;&lt;sup&gt;&lt;sup&gt;[52]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; Reduce then collects and combines this output, using identical key/value pairs, to provide the final result of the task.&lt;a name="_ftnref53" href="#_ftn53"&gt;&lt;sup&gt;&lt;sup&gt;[53]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; These steps are carried using the Job Tracker &amp;amp; Task Tracker in Hadoop but different systems have different methodologies to carry out similar tasks.&lt;/p&gt;
&lt;h2 style="text-align: justify;"&gt;Data Governance&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;Data Governance is the act of managing raw big data as well as the processed information that arises from big data in order to meet legal, regulatory and business imposed requirements. While there is no standardized format for data governance, there have been increasing call with various sectors (especially healthcare) to create such a format to ensure reliable, secure and consistent big data utilisation across the board. The following tactics and techniques have been utilised or suggested for data governance, with varying degrees of success:&lt;/p&gt;
&lt;ol style="text-align: justify;"&gt;
&lt;li&gt;&lt;strong&gt;Zero-knowledge systems&lt;/strong&gt;: This technological proposal maintains secrecy with respect to the low-level data while allowing encrypted data to be examined for certain higherlevel abstractions.&lt;a name="_ftnref54" href="#_ftn54"&gt;&lt;sup&gt;&lt;sup&gt;[54]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; For the system to be zero-knowledge, the client’s system will have to encrypt the data and send it to the storage provider. Due to this, the provider stores the data in the encrypted format and cannot decipher the same unless he/she is in possession of the key which will decrypt the data into plaintext. This allows the individual to store his data with a storage provider while also maintaining anonymity of the details contained in such information. However, these are currently just beginning to be used in simple situations. As of now, they are not expandable to unstructured and complex cases and have to be developed marginally before they can be used for research and data mining purposes.&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Homomorphic encryption&lt;/strong&gt;: Homomorphic encryption is a privacy preserving technique which performs searches and other computations over data that is encrypted while also protecting the individual’s privacy.&lt;a name="_ftnref55" href="#_ftn55"&gt;&lt;sup&gt;&lt;sup&gt;[55]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; This technique has however been considered to be impractical and is deemed to be an unlikely policy alternative for near future purposes in the context of preserving privacy in the age of big data.&lt;a name="_ftnref56" href="#_ftn56"&gt;&lt;sup&gt;&lt;sup&gt;[56]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Multi-party computation&lt;/strong&gt;: In this technique, computation is done on encrypted distributed data stores.&lt;a name="_ftnref57" href="#_ftn57"&gt;&lt;sup&gt;&lt;sup&gt;[57]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; This mechanism is closely related to homomorphic encryption where individual data is kept private using encryption algorithms called “collusion-robust” while the same is used to calculate statistics.&lt;a name="_ftnref58" href="#_ftn58"&gt;&lt;sup&gt;&lt;sup&gt;[58]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; The parties involved are aware of some private data and each of them use a protocol which produces results based on the information they are aware of and the information they are not aware of, without revealing the data they are not already aware of.&lt;a name="_ftnref59" href="#_ftn59"&gt;&lt;sup&gt;&lt;sup&gt;[59]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; Multi-party computations thus help in generating useful data for statistical and research purposes without compromising the privacy of the individuals.&lt;/li&gt;&lt;/ol&gt;
&lt;ol style="text-align: justify;"&gt;
&lt;li&gt;&lt;strong&gt;Differential Privacy&lt;/strong&gt;: Although this technological development is related to encryption, it follows a different technique. Differential privacy aims at maximizing the precision of computations and database queries while reducing the identifiability of the data owners who have records in the database, usually through obfuscation of query results.&lt;a name="_ftnref60" href="#_ftn60"&gt;&lt;sup&gt;&lt;sup&gt;[60]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; This is widely applied today in the existence of big data in order to ensure preservation of privacy while trying to reap the benefits of large scale data collection.&lt;a name="_ftnref61" href="#_ftn61"&gt;&lt;sup&gt;&lt;sup&gt;[61]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt;&lt;/li&gt;
&lt;li&gt;&lt;strong&gt;Searchable encryption&lt;/strong&gt;: Through this mechanism, the data subject can make certain data searchable while minimizing exposure and maximizing privacy.&lt;a name="_ftnref62" href="#_ftn62"&gt;&lt;sup&gt;&lt;sup&gt;[62]&lt;/sup&gt;&lt;/sup&gt;&lt;/a&gt; The data owner can make his information available through search engines by providing the data in an encrypted format but by adding tags consisting of certain keywords which can be deciphered by the search engine. &lt;p style="text-align: justify;"&gt;Studying the technology surrounding big data has led to two major observations: the rapid pace of development in the industry and the stark lack of industry standards or government regulations directed towards big data technologies. These observations have been the primary motivating factor for framing further research in the field. Understanding how to deal with big data technologically, rather than just the potential regulation of possible harms after the technological processes have been performed might be critical for the human rights dialogue as these processes become even more extensive, opaque and technologically complicated.&lt;/p&gt;

    <title>The Surveillance Industry in India – An Analysis of Indian Security Expos</title>

&lt;p style="text-align: justify; "&gt;The 'Spy Files', a series of documents released by whistleblower website WikiLeaks over the last few years, exposed the tremendous growth of the private 	surveillance industry across the world - a multi-billion dollar industry thriving on increasing governmental and private capabilities for mass surveillance 	of individuals.&lt;a href="#_ftn1" name="_ftnref1"&gt;[1]&lt;/a&gt; These documents showed how mass surveillance is increasingly made possible through new 	technologies developed by private players, often exploiting the framework of nascent but burgeoning information and communication technologies like the 	internet and communication satellites. Moreover, the unregulated and undiscerning nature of the industry means that it has enabled governments (and also 	private agencies) across the world - from repressive dictatorships to governments in western democracies with a growing track record of privacy and civil 	liberties infringements - to indulge in secretive, undemocratic and often illegal surveillance of their citizens. The Spy Files and related research have 	revealed how the mass surveillance industry utilizes the rhetoric of national security and counter-terrorism to couch technologies of surveillance.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt; &lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;'Security' and the Normalization Of Surveillance&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;New technologies undoubtedly create a potential for both malicious as well as beneficial use for society. Surveillance technologies are a prime example, 	having both enabled improvements in law enforcement and security, but at the same time creating unresolved implications for privacy and civil liberties. 	These technologies expose what Lawrence Lessig describes as 'latent ambiguities' in the law - ambiguities that require us to assess the implications and 	effects of new technologies and how to govern them, and most importantly, to choose between conflicting values regarding the use of technologies, for 	example, increased security as against decreased privacy.&lt;a href="#_ftn2" name="_ftnref2"&gt;[2]&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Unfortunately, In India, the ambiguity seems to have been resolved squarely in favour of surveillance - under the existing regulatory regime, surveillance 	is either expressly mandated or unregulated, and requires surveillance to be built into the architecture and design of public spaces like internet and 	telephone networks, or even public roads and parks. Most of these regulations or mechanisms are framed without democratic debate, through executive 	mechanisms and private contracts with technology providers, without and public accountability or transparency.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;For example, under the telecom licensing regime in India, the ISP and UASL licenses specifically require lawful interception mechanisms through hardware or 	software to be installed by the licensees, for information (Call Data Records, Packet Mirroring, Call Location) to be provided to 'law enforcement 	agencies', as specified by the Government.&lt;a href="#_ftn3" name="_ftnref3"&gt;[3]&lt;/a&gt; Section 69 of the Information Technology Act, the main 	legislation governing the Internet in India, read with the rules framed under the Act, makes it incumbent upon 'intermediaries' to provide surveillance 	facilities at the behest of government agencies.&lt;a href="#_ftn4" name="_ftnref4"&gt;[4]&lt;/a&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Beyond this, the State and its agencies Section 69 and 69B of the IT Act empower the government to intercept and monitor any data on the Internet. The 	Telegraph Act also permits wiretapping of telephony.&lt;a href="#_ftn5" name="_ftnref5"&gt;[5]&lt;/a&gt; The proposed Central Monitoring System by the Central 	Government would give state agencies centralized access to all telecommunications in real time, on telephony or on the Internet. Other surveillance schemes include the Keyword Tracking system NETRA, as well as several state government proposed comprehensive CCTV-surveillance schemes for cities.	&lt;a href="#_ftn6" name="_ftnref6"&gt;[6]&lt;/a&gt; Clearly, therefore, there is a massive market for surveillance technologies in India.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;&lt;b&gt;Tracking the Surveillance Market&lt;/b&gt;&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;The Mass surveillance industry by its very nature is closed, secretive and without democratic oversight, Insights into the prevalence, nature and scope of 	the companies that form this industry, or the technologies that are utilized are far and few. No democratic debate about surveillance can take place in 	such a paradigm. In this context, security expos and exhibitions provide critical insight into this industry. Several of the important revelations about 	the industry in the past have been from examinations of large exhibitions in which the various governmental and industry actors participate, and therefore, 	such analysis is critical to the debate surrounding mass surveillance. Such exhibitions are a logical starting point because they are one of the few 	publically accessible showcases of surveillance-ware, and are also a congregation of most major players who are part of this market both as suppliers and 	purchasers.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Our research identified at least 13 exhibitions in India that specifically cater to the surveillance industry. A brief outline of each of these exhibitions 	is provided below:&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;An analysis of the above companies and their wares give us some insight into what is being bought and sold in the surveillance industry, and by whom. 	Broadly, the surveillance technologies can be grouped in the following categories:&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;Video surveillance is gradually infiltrating public spaces in most major cities, with Governments promoting large-scale video surveillance schemes for 	security, with no legal sanctions or safeguards for protecting privacy.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;India has begun the implementation of the Unique Identification Programme for its 1.2 billion strong population, combining a host of identification 	technologies to provide a unique identification number and Aadhar Card - promoted as an all-purpose ID. However, this remains without legislative sanction, 	and continues in the face of severe privacy concerns. Such centralized, accessible databases of ostensibly private information present a grave threat to 	privacy. RFID, Smart Cards and Biometric Identification technologies (like the Aadhar) all make individual monitoring and surveillance significantly easier 	by enabling tracking of individual movements, consumer habits, attendance, etc.&lt;/p&gt;

&lt;p style="text-align: justify; "&gt;The age of Big Data has led to big surveillance. Information and communication technologies now host significant amounts of individual data, and the 	surveillance industry makes all of this data accessible to a surveyor. Government mandated surveillance means any and all forms of communication and data 	monitoring are being implemented in India - there are network taps on telephony and deep packet inspection on internet lines, which makes telephone calls, 	SMS, VoIP, Internet searches and browsing and email all vulnerable to surveillance, constantly monitored through systems like the Central Monitoring 	System. Moreover, centralized information stores enable data mining - extracting and extrapolating data to enable better surveillance, which is what 	India's NATGRID aims to do.&lt;/p&gt;
&lt;p style="text-align: justify; "&gt;Hacking Team Italy, Blue Coat USA and Amesys France, three of the five companies identified as 'enemies of the internet' for enabling dictatorships to use 	surveillance to quell dissent and violate human rights,&lt;a href="#_ftn12" name="_ftnref12"&gt;[12]&lt;/a&gt; have all presented surveillance solutions at 	Defexpo India. Cyberoam USA and ZTE China also market Deep Packet Inspection technology,&lt;a href="#_ftn13" name="_ftnref13"&gt;[13]&lt;/a&gt; while ESRI's Big Data suite allows analysis through mass surveillance and analysis of social media and publically available sources.	&lt;a href="#_ftn14" name="_ftnref14"&gt;[14]&lt;/a&gt;&lt;/p&gt;
