The DNA Profiling Bill: Developing Best Practices

On the 27th of September 2012 the Centre for Internet & Society invites the public to a meeting and talk with international experts Helen Wallace from GeneWatch UK, and Jeremy Gruber from the Council for Responsible Genetics from the United States. The meeting will take place from 9.00 a.m. to 1.00 p.m. at the India International Centre, Lodhi Road, New Delhi in Conference Room No. 2.

The public meeting and talk will focus on the proposed DNA Profiling Bill pending in Parliament and explore best practices concerning the collection, storage, and retention of DNA samples and best practices concerning the analysis of DNA samples and use of DNA samples as evidence in courts. Case studies from the US and the UK will be explored to understand what India can do better from the experiences of other countries.

Dr Helen Wallace

Dr Helen Wallace is Director of GeneWatch UK, a not-for-profit organisation which aims to engage members of the public in ensuring that genetic science and technologies are used in the public interest. She is the author of numerous articles and book chapters on the social and ethical issues raised by DNA databases and is widely quoted in the UK press. Helen provided expert evidence to the applicants in the case of S. and Marper v. the UK at the European Court of Human Rights, in which the Court ruled unanimously that the indefinite retention of innocent people's DNA database records was in breach of the European Convention on Human Rights. She has supplied both oral and written evidence on this issue to numerous parliamentary committees including the Scottish Parliament’s Justice Committee and the UK Science and Technology, Home Affairs and Constitutional Committees, as well as the scrutiny committee for the Protection of Freedoms Act 2012. This new Act requires the removal of about a million innocent people's records from the UK National DNA Database and the destruction of all stored biological samples.

Jeremy Gruber

Jeremy Gruber is the JD, President and Executive Director of Council for Responsible Genetics. Jeremy joined CRG in March 2009. Previously he served as the legal director of the National Workrights Institute, a human rights organization dedicated to the rights of American workers. Prior to that he served as the field director for the ACLU’s National Taskforce on Civil Liberties in the Workplace. Jeremy has worked for over a decade on genetic non-discrimination legislation at the state and Federal level. He helped author and pass numerous state laws on genetic non-discrimination. Jeremy is a founder and executive committee member of the Coalition for Genetic Fairness, a group of 500 organizations that advocated for genetic non-discrimination legislation on Capitol Hill and played a major role in the recently passed Genetic Information Non-Discrimination Act (GINA) by Congress. He worked closely with members of Congress and staff on GINA language as well as strategy and support. He is a prolific writer on privacy issues and is often consulted by state legislatures. He is regularly featured in print, radio and television. Jeremy holds a Juris Doctor (J.D.) from St. John’s University School of Law and a B.A. in Politics from Brandeis University.

Contracts are ubiquitous in our everyday life. They are also a nuisance. And they typically come attached with a bigger nuisance - lawyers! Interestingly though, contracts are a lot like code. Geek-lawyers, a very small, minuscule tribe on this planet, tend to notice a lot of similarities between the two. If this is true, it opens up a lot of possibilities, including changing the way we do business and in particular generate contracts, negotiate and seal deals.

We'll talk about some of the technology and some of the products we're working on that we think can provide power to a lot of folks.

Vivek Durai

Vivek Durai is a co-founder at Awesome Contracts, a Singapore-India startup that is working on interesting problems in the field of law and contracts. As with just about everyone else, he and co-founder Amith Narayan would like to change the world. Preferably, for the better. Vivek and Amith are both alumnus of the National Law School of India University.

Vivek is a lawyer by training, a geek by nature, and generally human. Most of the time. As far as ideologies go, Vivek is a Pythonista currently flirting with Node and other things. He is also incidentally a Partner at Atman Law Partners, a young three office boutique law firm.

Amith Narayan

Amith Narayan loves hats. He likes them so much in fact, he's been wearing all kinds. He has been a corporate lawyer, a musician, a record producer, a legal recruiter, and now an entrepreneur running this crazy little startup. Amith grew up in Calicut (Kozhikode) Kerala, trained in law at NLSIU, worked in the grand dame of the Indian legal world - Crawford Bayley - before moving to Singapore where he's been living for the past 10 years. Amith will join us over Skype during the talk.

The Asian Edge: 2012 Inter-Asia Cultural Studies Society Summer School

The 2nd Biannual Inter Asia Cultural Studies (IACS) Summer School will be hosted in Bangalore, India by the Centre for the Study of Culture and Society (CSCS) and the Centre for Internet and Society (CIS) with the Inter Asia Cultural Studies Consortium. The event will be held in the first and second week of August 2012.

The IACS Summer School brings together South and East Asian experts from different disciplines as faculty for graduate and advanced research students to engage with key issues of larger social, cultural and political concerns in Cultural Studies in Asia. Any student registered in a post-graduate degree program is eligible for the IACS Summer School. There are limited seats and students will be selected based on their applications. Students registered at universities participating in the Consortium of Inter Asia Cultural Studies Institutions will be given first preference.

The Summer School 2012 proposes to integrate the teaching with core IACS faculty with the larger realities of change in South and East Asia. It proposes a 10 + 4 day structure.

Core Course: Methodologies for Cultural Studies in Asia: The Summer School offers a 10 day core course that works through seminars, taught classrooms, tutorials, open spaces, field trips and workshops. The core course shall address questions of Cultural Identity, Modernity, Nationalism, Gender, Class, Revolution and Asianism to frame an argument about relocating methods, concepts and ideas in contemporary Cultural Studies in Asia.

Technology Evangelists and Religious Evangelists — A Talk by Katherine Sydenham

Katherine Sydenham from the University of Michigan School of Information will deliver a lecture at the Centre for Internet & Society office in Bangalore on August 10, 2012, from 5.00 p.m. to 6.30 p.m.

Abstract

The current investigation explores the possibility of comparison of techniques used by technology evangelists and religious evangelists. The study sought informants from three major categories: proprietary software evangelists, proponents of Free and Open Source Software (FOSS), and religious evangelists of several religious traditions. A preliminary analysis of qualitative data indicates that there are enough similarities in strategies used by members from each group to make the inquiry relevant. Early data also reveal significant differences in each group´s strategy that may inform and shape future efforts on behalf of technology evangelists to reach a wider audience for their products.

Katherine Sydenham

Katherine is a doctoral student at the University of Michigan School of Information. Her research in the Information and Communication Technologies and Development (ICTD) field focuses on technology adoption by marginalized communities. Her background is in Religious Studies and Library and Information Science. Her summer internship at Microsoft Research is exploring the strategic similarities between technology evangelism and religious evangelism.

Securing e-Governance: Ensuring Data Protection and Privacy

Privacy India in partnership with the Centre for Internet & Society, International Development Research Centre, and Society in Action Group is organizing a discussion on E-Governance. It is based on the theme, ‘Security and Privacy Issues’, and will be held in Ahmedabad, Gujarat on June 16, 2012, from 9.30 a.m. to 5.00 p.m. Registration is free and open to the public.

India has witnessed a rapid proliferation of the use of information and communication technology in the delivery of government services. E-government is seen as an instrument to simultaneously increase the efficiency, transparency and accountability of public administration and improve public service delivery. Consequently, this has transformed the traditional delivery of public sector services, this is known as “e-governance”. These developments have implications and pose challenges for privacy and security.

The right to privacy in India has been a neglected area of study and engagement. Although sectoral legislation deals with privacy issues, India does not as yet have a horizontal legislation that deals comprehensively with privacy across all contexts. The absence of a minimum guarantee of privacy is felt most heavily by marginalized communities, including HIV patients, children, women, sexuality minorities, prisoners, etc. — people who most need to know that sensitive information is protected.

Since June 2010, Privacy India in collaboration with Privacy International, based in London, has been engaging in public awareness through workshops and consultations. These provide a platform for policy makers, sectoral experts, NGOs, and the public to discuss and deliberate different questions of privacy, its intersections and its implications with our everyday life. The discussions have ranged from topics of identity and privacy, to minority rights and privacy, and consumer privacy. The workshops have been organized in different cities — Bangalore, Guwahati, Mumbai, Delhi, Kolkata, Chennai, Goa, etc.

Role of the US Tech Companies in Government Surveillance: A Lecture by Christopher Soghoian

Christopher Soghoian will deliver a lecture on the role US tech companies play in assisting government surveillance at the Centre for Internet & Society office in Bangalore on August 27, 2012, from 5.00 p.m. to 7.00 p.m.

Your internet, phone and web application providers are all, for the most part, in bed with US and other foreign government agencies. They all routinely disclose their customers' communications and other private data to law enforcement and intelligence agencies. Worse, firms like Google and Microsoft specifically log data in order to assist the government. How many government requests does your ISP get for its customers' communications each year? How many do they comply with? How many do they fight? How much do they charge for the surveillance assistance they provide? Who knows? Most companies have a strict policy of not discussing such topics.

The differences in the privacy practices of the major players in the telecommunications and internet applications market are significant. Some firms retain identifying data for years, while others retain no data at all; some voluntarily provide the government access to user data, while other companies refuse to voluntarily disclose data without a court order; some companies charge government agencies when they request user data, while others disclose it for free. For an individual, later investigated by the police or intelligence services, the data retention practices adopted by their phone company or email provider can significantly impact their freedom.

Unfortunately, although many companies claim to care about end-user privacy, and some even that they compete on their privacy features, none seem to be willing to compete on the extent to which they assist or resist the government in its surveillance activities. Because information about each firms' practices is not publicly known, consumers cannot vote with their wallets, and pick service providers that best protect their privacy.

This talk will pierce the veil of secrecy surrounding these practices. Based upon a combination of Freedom of Information Act requests, off the record conversations with industry lawyers, and investigative journalism, the practices of many of these firms will be revealed.

Christopher's Personal Experience

In the year 2006, the Federal Bureau of Investigation (FBI) raided Christopher’s home at 2.00 a.m. seizing his personal documents and computers. Two attorneys, Stephen Braga and Jennifer Granick came to his defence. With their expert assistance, Christopher was able to get back his possessions within three weeks, and FBI’s criminal and TSA’s civil investigations were closed without any charges being filed.

Jennifer Granick came to Christopher’s assistance once again (joined by Steve Leckar) in 2010 after the Federal Trade Commission’s Inspector General investigated Christopher for using his government badge to attend a closed-door surveillance industry conference. It was at that event that Christopher recorded an executive from wireless carrier ‘Sprint’ bragging about the eight million times his company had obtained GPS data on its customers for law enforcement agencies in the previous years.

About Christopher Soghoian

Christopher Soghoian is a privacy researcher and activist, working at the intersection of technology, law and policy. He is a Principal Technologist and Senior Policy Analyst at the American Civil Liberties Union and is based in Washington, D.C.

Soghoian completed his Ph.D. at Indiana University in 2012, which focused on the role that third party service providers play in facilitating law enforcement surveillance of their customers. In order to gather data, he has made extensive use of the Freedom of Information Act, sued the Department of Justice pro se, and used several other investigative research methods. His research has appeared in publications including the Berkeley Technology Law Journal and been cited by several federal courts, including the Ninth Circuit Court of Appeals.

Between the years, 2009-2010, he was the first ever in-house technologist at the Federal Trade Commission's Division of Privacy and Identity Protection, where he worked on investigations of Facebook, Twitter, MySpace and Netflix. Prior to joining the FTC, he co-created the Do Not Track privacy anti-tracking mechanism now adopted by all of the major web browsers.

He is a TEDGlobal 2012 Fellow, was an Open Society Foundations Fellow between the years, 2011-2012, and was a Student Fellow at the Berkman Center for Internet & Society, Harvard University between 2008 and 2009.

Right to Read Campaign - Kolkata

The nationwide Right to Read campaign which began with its first road show at Loyola College, Chennai is now having its second road show at the West Bengal National University of Juridical Sciences, Kolkata. There will be half day events with publicity. Events shall comprise presentations, debates and demonstrations, book reading sessions and stalls where various accessibility tools will be demonstrated.

Problem Statement

Millions of Indians are unable to read printed material due to disabilities. There are technologies available which can help them read print if the material is converted into an alternate format such as large print, audio, Braille or any electronic format. While the Indian constitution guarantees the “right to read” as a fundamental right, the copyright regime does not permit the conversion of books into accessible formats for the benefit of persons with print impairment, as a result of which a “book famine” is created. International conventions that India is a party to specifically require India to amend its copyright laws for the benefit of persons with disabilities and to make available information and material to persons with disabilities on an equal basis as others. Publishers also do not make books available in accessible formats as a result of which less than 0.5% of books are available in accessible formats in India. As a result persons with print impairments get excluded from the education system and it impacts their career choices.
In addition to this, there are no national Policies or action plan to ensure that publications in accessible formats in all Indian languages are available to persons with print disabilities all over the country.

Open hardware businesses grow by sharing. Companies share design information with customers, the customers create communities that give improvements and fixes back to the company. Sharing is mutually beneficial to the company and community.

Privacy Matters — Consumer Privacy

Privacy India, in partnership with the Centre for Internet & Society, International Development Research Centre, Society in Action Group and Privacy International, invites you to a public conference focused on discussing the challenges and concerns to consumer privacy in India. The event will be held at the Indian International Centre, New Delhi on Saturday, July 7, 2012, from 9 a.m. to 5 p.m.

According to the Consumer Protection Act, 1986, a consumer is a broad label for any person who buys any goods or services for consideration with the intent of using them for a non-commercial purpose. Certain services that consumers use may, by their very nature, put an extraordinary amount of sensitive personal information into the hands of vendors.

Consumer privacy is concerned with accuracy of how a consumers information is collected and used. Because a consumers relationship with another entity is based on an exchange along consented terms, a breach in consumer privacy can be constituted as an action that was not agreed to. In the age of data collection – a breach in privacy occurs when information is used in different ways than was intended. Consumer privacy in India is determined at the sectoral level, and differs depending on the services that is provided for.

As corporations sell data banks, ISP's expose consumer habits, or ones personal information falls in the wrong hands – the consequences are far reaching, and can result in spamming, unwanted marketing, theft, or the violation can impact an individual's ability to buy a home, potential employment opportunities, or gain access to credit.

In India, the right to privacy has been a neglected area of study and engagement. Although sectoral legislation deals with privacy issues, India does not as yet have a horizontal legislation that deals comprehensively with privacy across all contexts. The absence of a minimum guarantee of privacy is felt most heavily by marginalized communities, including HIV patients, children, women, sexuality minorities, prisoners, etc. - people who most need to know that sensitive information is protected.

Since June 2010, Privacy India in collaboration with Privacy International, based in London, has been conducting workshops and engaging in public awareness. Participants include policy makers, researchers, sectoral experts, NGOs, and the public to discuss and deliberate different questions of privacy, its intersections and its implications with our everyday life. The discussions have ranged from topics of online privacy to minority rights and privacy and e-Governance initiatives privacy. The workshops have been organized in different cities - Bangalore, Guwahati, Mumbai, Delhi, Kolkata, Ahmedabad, Chennai, Goa, etc.

Privacy India in partnership with International Development Research Centre, Canada, Indian Institute of Technology, Bombay, the Godrej Culture Lab, Tata Institute of Social Sciences, Mumbai and the Centre for Internet and Society, Bangalore is organising "Privacy Matters", a public conference at IIT, Bombay on 21 January 2012.

The conference will focus on the questions and dilemmas posed by privacy in India today, with a concentration on the "Right to Privacy Bill". The right to privacy in India has been a neglected area of study and engagement. Although sectoral legislation deals with privacy issues, India does not as yet have a horizontal legislation that deals comprehensively with privacy across all contexts. The absence of a minimum guarantee of privacy is felt most heavily by marginalized communities, including HIV patients, children, women, sexuality minorities, prisoners, etc. — people who most need to know that sensitive information is protected.

His presentation will look at the trajectory of privacy through the years from a legal perspective.

Her presentation will define the scope of Article 21 under the Indian Constitution, which protects the right to privacy.

He holds a master from Columbia Law School and has authored a Commentary on the Information Technology Act, 2000. His presentation will focus on the limits of a privacy right when it competes and conflicts with the freedom of speech and expression. He will examine certain provisions of the Draft Privacy Bill questioning how privacy arguments may be used to stifle debate or disclosure made in the public interest.
14:45- 15:30	Sexuality Minorities and Privacy Danish Sheikh graduated from Nalsar University of Law with a B.A., LL.B. (Hons.). Currently, he is a researcher at the Alternative Law Forum in Bangalore. He will examine the status of sexual minorities in the light of privacy framework in India. Culling out some real life examples based on various studies, media reports and judgments from the Supreme Court and the High Courts of Delhi and Allahabad, he will bring to light the privacy violations being committed by both individuals as we all state authorities.

She was a Rhodes Scholar at Oxford University, a Gammon Fellow at Harvard Law School, and a gold medalist from the National Law School of India and has law degrees from all three schools. Menaka has advised the United National Development Program and the United Nations Development Fund for Women. She will discuss the relationship between national security and privacy, from the perspective of surveillance by the state etc.

Prime Security: The Mathematics of RSA Encryption

Based on simple properties of prime numbers, RSA encryption protects our money and digital identity. But how does it actually work? The Centre for Internet and Society invites you to a one-day workshop by Rohit Gupta on 9 September 2011.

Workshop

As remarked by one of its inventors, RSA is the scheme that "protects 95 per cent of the electronic commerce in the world". The recent breach of 40 million RSA Secure ID tokens ( widely used in Bangalore ) makes this an urgent issue. Apart from the proposed use of 2048-bit RSA keys in the UIDAI project by the government of India, we unknowingly use this algorithm every time we use a credit card, ATM or provide any kind of digital authentication.

Surprisingly enough, to understand the basic mechanism one need not have any more mathematical background than high school - the concept of prime numbers. From that basic knowledge this hands-on workshop will show the way RSA works in reality, under the hood in most networks, computers and smart devices. We will focus on the core mathematical idea rather than any specific software implementations.

National Workshop on Web Accessibility, June 2009

A workshop on web accessibility (for web developers only) in Bangalore

The Centre for Internet and Society (www.cis-india.org) and Samarthanam Trust for the Disabled (www.samarthanam.org) are organizing a workshop on web accessibility for web developers from the public and private sector from June 5 to 7, 2009. The workshop will take place at the Centre for Internet and Society office on Cunningham Road, Bangalore, between 09:30-17:30 hours each day.

The workshop seeks to bring together practitioners from the private and public sector from all across the country. The primary aim of this workshop is to demonstrate the importance of creating accessible web sites and to educate the developers of government and private web sites on how to incorporate accessibility features into new as well as existing web sites.

The training will comprise both theory-oriented and practical sessions. The trainers will be specialists in various aspects of web accessibility. The main focus will be on WCAG 2.0 guidelines. The participants will be persons already involved in developing web sites with good knowledge of HTML, XML, CSS, etc.

In addition to training web developers in accessibility, the workshop will also serve as a platform for capacity building by training potential accessibility trainers. Many of the sessions will be documented as lessons on accessibility and put up on the CIS web site. As part of one of the outcomes of the workshop, five inaccessible government web sites will be identified and taken up for retrofitting with accessibility features within the next few months.

National Policy on Electronic Accessibility

One of the primary endeavors of several disability organizations around the country is to have a national policy which governs electronic accessibility in India. CIS has been a forerunner in advocating for the policy and is actively working with the government in formulating the policy. As part of its advocacy efforts, CIS is also involved in capacity building through organizing workshops and awareness spreading in the private and public sectors.

Trainers

Rahul Gonsalves

Rahul has been building accessible websites since 2005 (sample work at http://rahulgonsalves.com/projects/). He has been actively involved in promoting web and accessibility standards. He spoke at the first international accessibility and technology conference in India, Techshare 2008, where he made a case for accessibility and conducted a workshop on retrofitting accessibility to existing websites, a concern for most large institutions with an existing online presence (slides available at http://www.barrierbreak.com/events-conference/techshare_presentations2008.php#track3)

In September 2008, he presented a paper examining ways in which people with various impairments - both physical and mental – engage with online content, and demonstrated practical ways in which authors can make online content accessible at the National Conference on ICT for Differently Abled People. He is a supporter of the push for having a national policy for governing electronic accessibility in India.

Dinesh Kaushal

Dinesh has been involved in the area of accessibility, specifically product development throughout his career. He started with developing SAFA (Screen Access for All), which is the first Indian language screen reader. He worked independently on this for a year, during which time he got a good understanding of the complete software development life cycle. SAFA was envisioned to facilitate reading and writing in Indian languages at affordable cost, with a view to enabling better jobs and education for persons with blindness and low vision. SAFA is a unique software as it has to interact with other applications to get information and present this information to the users in the format convenient for them. SAFA is currently being used by blind persons in their jobs, for their studies, and even for their exams and is available in 11 iIdian languages for which text to speech synthesizers are available. His subsequent work involved leading a team to develop a Daisy book player. Daisy books are xml based marked-up digital books which provide efficient access to the information for persons with blindness. His responsibilities were team coordination, software requirement specification, design specification, and monitoring testing. He is presently working with Code Factory as Lead Developer (Braille) for screen readers for the windows mobile platform. This software enables persons with blindness to get access to mobile phones and PDAs, making it possible to access information at par with their sighted colleagues. His role is to provide this information via Braille displays. The Braille display allows blind persons to read SMS, work with contacts and documents, navigate with the help of GPS, etc using electronic Braille. This product is available for more than 20 languages and is available all over the world.

Ajay Kolhatkar

Dr. Ajay Kolhatkar co-leads the web usability and accessibility research at the Web 2.0 Research Labs at SETLabs. Presently he manages the evangelization of Web Accessibility Assessment and Remediation product called Infosys iProwe developed by their lab. Ajay has a PhD in technology marketing from IIT Bombay. His research there focused on Consumer's Acceptance of Technology Based Services. The key research problem was modeling the attitude-behaviour linkage for technology acceptance and the critical role played by personality factors and situational factors. The context for the study was Automated Teller Machines. Presently his research interests include usability of self-service channels; technology adoption; consumer behaviour in technology interfaces etc. An electrical engineer from the College of Engineering, Pune and an MBA in Marketing from Symbiosis Institute, Pune, Ajay has over 16 years of industry experience. The training comprises both theory-oriented and practical sessions. The trainers are specialists in various aspects of web accessibility. The main focus will be on WCAG 2.0 guidelines. Such is the unique nature of the Internet that its governance often calls for institutional innovations. The proposed workshop will look at a range of national level IG mechanisms across the world. While the discussion will refer to good models and practices in different countries, it will not be organized around simple show-casing of different national IG mechanisms. The discussion will centre around key contexts, requirements, challenges and possibilities. It will be directed towards examining key institutional design issues, functions and outcomes with regard to national level IG mechanisms with the purpose to help countries make appropriate decisions in their specific contexts. Some of these are; - How should the national commons of Internet resources be managed?- What kinds of mechanisms are appropriate for technical matters, what for those that are partly technical and partly social, and what for larger public policy matters, requiring more political responses? - Should there be a common single mechanism to address all the above kinds of issues, or different ones? How to coordinate different mechanisms, and different parts of the national governance machinery dealing with different aspects or kinds of IG issues? - How to ensure meaningful participation of all stakeholders in a manner that focuses on public interest?- How can the surplus from domain name registration fees etc collected by national IG agencies be employed for public interest purposes, especially, for taking up Internet related research.
