        &lt;b&gt;Anubha Sinha, attending the 37th Session of the World Intellectual Property Organization (“WIPO”) Standing Committee on Copyright and Related Rights (“SCCR”) at Geneva from November 26, 2018 to November 30, 2018, made this statement on the agenda on limitations and exceptions on behalf of CIS on Day 3, November 28. &lt;/b&gt;
        
&lt;p&gt;Thank you, Mr. Chair.&lt;/p&gt;
&lt;p&gt;The Centre for Internet and Society is a civil society
      organisation based in India working on issues of openness and
      access to knowledge, amongst others.&lt;/p&gt;
&lt;p&gt;India is a diverse country with thriving communities working on
      and promoting access to research, data, archival material,
      educational material, and developing material to benefit persons
      with other disabilities. As such, the regional seminars will be an
      excellent opportunity for such communities to interact with
      various stakeholders and government delegates; and help formulate
      concrete principles that should inform the international legal
      instrument that we hope is developed and discussed soon.&lt;/p&gt;
&lt;p&gt;To enable comprehensive and substantive participation and
      discussions, I urge member states and WIPO to undertake steps to
      make the regional seminars as inclusive as possible. I request the
      secretariat and member states to actively work with civil society
      to identify and invite such community leaders.&lt;/p&gt;

        &lt;b&gt;On November 27, Knowledge Ecology International (KEI) organised a side event during deliberations of the 37th Session of the Standing Committee on Copyright and Related Rights (SCCR) of the World Intellectual Property Organization (WIPO). Centre for Internet &amp; Society (CIS), Electronic Information for Libraries (eiFL.net), Corporacion Innovarte, Creative Commons, and Knowledge Ecology International appraised the current text for the proposed WIPO Treaty for the Protection of Broadcasting Organizations (Revised Consolidated Text on Definitions, Object of Protection, Rights to be Granted and Other Issues, SCCR/36/6).

Speakers provided an overview of the treaty, explained the potential risks and problems caused, and proposed solutions to narrow the Treaty’s scope and limit the damage. 

Below is a transcript of the remarks made by Anubha Sinha who represented CIS at this event.&lt;/b&gt;

&lt;p&gt;&lt;/p&gt;
&lt;p&gt;Good afternoon, everyone.&lt;/p&gt;
&lt;p&gt;My presentation will be in reference to the revised
consolidated text &lt;a class="external-link" href="https://www.wipo.int/edocs/mdocs/copyright/en/sccr_36/sccr_36_6.pdf"&gt;SCCR 36/6&lt;/a&gt; and the US proposal &lt;a class="external-link" href="https://www.wipo.int/edocs/mdocs/copyright/en/sccr_37/sccr_37_7.pdf"&gt;SCCR 37/7&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;In essence, this treaty is trying to create a new set of
rights for broadcasters operating in both mediums (first, traditional –
satellite, airwaves, cables, and second, the internet), ostensibly to counter
signal piracy. We are looking at updating a neighbouring rights or related
rights regime to protect signals across both mediums.&lt;/p&gt;
&lt;p&gt;The intent of treaty is to exclude entities exclusively delivering their
programmes over the internet. I fear that the results would create
an unequal playing field between broadcasters and internet streaming entities.
This would be the first, immediate impact. To then catch up, perhaps, internet
streaming services would look to satisfy the treaty requirements to avail
protection. This would involve satisfying the definition of a broadcasting
organisation (as in SCCR 36/6), and for their country to have ratified the
treaty. The characteristics of a broadcasting organisation can be satisfied by
acquiring any traditional broadcasting service, for such an entity, as per the
current text of the treaty. This would require serious capital, and most start
up innovations in the area would not be in a position to undertake such a step.
And then there is the question of asserting the rights and enforcing them in
other countries – this will be an extremely expensive affair. The point I’m
trying to make is that this treaty seems to be set to protect a narrow slice of
broadcasters, with significant market power in their home markets.&lt;/p&gt;
&lt;p&gt;My
co-panelists will discuss specific harms that this will have on the building
of commons, and other damaging effects on global efforts to build an
affordable and accessible knowledge system. This is unfortunate, and hence we
urgently need text that provides for a mandatory list of limitations and
exceptions, and not work with the soft language that is present right now. We have to accept
that multilateral norm-setting at the international level sets the tone for
countries to enact their own national legislations – indeed, before the
Marakkesh treaty there were hardly any developing countries which had an
expansive beneficial copyright exception for the visually impaired (except India - that I'm aware of), and look
who the first few countries to ratify the treaty were – India, Argentina, El
Salvador, Paraguay, Uruguay, etc – all developing countries leading to adopt this international
standard.&lt;/p&gt;
&lt;p&gt;The &lt;a class="external-link" href="https://www.wipo.int/edocs/mdocs/copyright/en/sccr_37/sccr_37_7.pdf"&gt;US delegation’s proposal&lt;/a&gt;, introduced yesterday, pushes the idea of
limiting exclusive rights granted under this treaty to broadcasting
organisations, so long as the countries provide adequate protection against
piracy in other bodies of law. This seems like a promising idea – one that does
not upend the legal theories of neighbouring rights and also shrinks the
proposed model in the treaty that seeks to grant monopolistic property rights
for a long and unclear period of time to powerful organisations –
organisations that by their very nature and functions are chroniclers of our
times and keepers of valuable cultural heritage.&lt;/p&gt;
&lt;p&gt;At a &lt;a class="external-link" href="https://www.keionline.org/29025"&gt;seminar&lt;/a&gt; on this very
treaty organised last month by KEI, Proffessor Bernt Hugenholtz flagged off the
problematic justifications provided for increasing the strength of this
neighbouring right. He said that the
justifications should indicate a corresponding increase in cost of
disseminating content. Should new exclusive rights be created for
gradation-like increase in investment? He was not convinced that the costs had
gone up significantly, and he also pointed out that this cost should not
account for money spent on acquiring the rights to broadcast the content. &amp;nbsp;Further, going back to the US proposal, the
proposal recognises the persistent conceptual difficulties of distinguishing
between signal protection and content protection. This very difficulty has been
raised by many civil society organisations in the past, and more recently it
cropped up at a discussion on the treaty in New Delhi, where both civil
society organisations and representatives of broadcasters were present. Another
practical challenge (that remains) will be to separate the computer network based operations
from the non-computer network based operation; however, in this age, is it
technically possible to do that?&lt;/p&gt;
&lt;p&gt;To conclude, I think that fundamental concepts and terms
need to be properly clarified to arrive at an understanding that is shared
across all stakeholders; and a corresponding strengthening of limitations and
exceptions is urgently needed.&amp;nbsp;&lt;/p&gt;

        &lt;b&gt;The CRI Guidelines were heavily criticised for their failure to address the ambiguities created by Section 3(k) and for expanding the scope of software patent eligibile subject-matter, inter alia. 

Following several representations and submissions by interested stakeholders, the Controller General has moved the Guidelines into abeyance, until discussions with stakeholders are complete and contentious issues are resolved, and is a welcome step. 

&lt;/b&gt;
        
&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;CIS has consistently made submissions
to the Indian Patent Office on the issue of software patenting( &lt;a class="external-link" href="http://cis-india.org/a2k/blogs/comments-on-the-guidelines-for-examination-of-computer-related-inventions-cris"&gt;2015&lt;/a&gt;, &lt;a href="http://cis-india.org/a2k/blogs/comments-on-draft-guidelines-for-computer-related-inventions"&gt;2013&lt;/a&gt;,
&lt;a href="http://cis-india.org/a2k/blogs/cis-submission-draft-patent-manual-2010"&gt;2010&lt;/a&gt;).
The &lt;a href="http://cis-india.org/a2k/blogs/comments-on-the-guidelines-for-examination-of-computer-related-inventions-cris"&gt;latest
submission &lt;/a&gt;was made in September 2015, in response to the
&lt;a href="http://www.ipindia.nic.in/iponew/CRI_Guidelines_21August2015.pdf"&gt;Guidelines
for Examination of Computer Related Inventions, 2015&lt;/a&gt;(“CRI Guidelines/ Guidelines”)
in which we highlighted several concerns and presented solutions, and
also proposed a definition of "computer programme per se".&lt;/p&gt;
&lt;p&gt;In view of the representations made to
the Patent Office, on 14th December 2015, the Controller General
issued an order to keep the Guidelines in abeyance. &lt;strong&gt;Till the
issues therein are resolved, the existing provisions on S. 3(k) of
chapter 08.03.05.10 of the Manual of Patent Practice and Procedure
will continue to be applicable.&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;The primary fault with the Guidelines
lay in the fact that, legally, its scope of was in excess of section
3(k) of the Indian Patent's Act, 1970 (parent statute). The
Controller General's order acknowledging the representations and
submissions made in response to the Guidelines, and consequently
keeping the Guidelines in abeyance is a welcome step.&lt;/p&gt;

&lt;p&gt;I’m speaking on behalf of the Centre for Internet and
Society, India.&lt;/p&gt;
&lt;p&gt;Mr. Chair we would like to congratulate you and the
vice-chair on your election.&lt;/p&gt;
&lt;p&gt;The current draft text of the WIPO Broadcasting
Organisations treaty carries a rather weak framework of limitations and exceptions,
when we consider the long duration of protection of twenty years that has been
proposed.&lt;/p&gt;
&lt;p&gt;The limitations and exceptions are not aligned to the
ongoing discussions on the L&amp;amp;E agenda, where there is an agreement evolving
amongst many member states to revisit and revise limitations and exceptions for
purposes of preservation, online and cross-border uses, and research for
benefit of education, research, libraries, archives and museums.&lt;/p&gt;
&lt;p&gt;The framework does not rise to these standards, and also
makes enacting of limitations and exceptions in national law optional.&lt;/p&gt;
&lt;p&gt;Seen from this perspective, the draft text of the WIPO
Broadcasting Organisations treaty is neither a balanced treaty nor a modern
one.&lt;/p&gt;

&lt;p&gt;I’m speaking on behalf of the Centre for Internet and
Society, India.&lt;/p&gt;
&lt;p&gt;The Proposal by the African Group for a Draft work program
on Exceptions and Limitations has the potential to address issues faced in the
domains of access to information, culture and education, keeping in mind that
there have been systemic shifts in the knowledge ecosystem since pandemic,
which will endure in the long term as well.&lt;/p&gt;
&lt;p&gt;In India, researchers at public and private institutions in
both in science and social science disciplines over the period of 2020-2021,
submitted to a court of law that they faced serious challenges in remotely accessing
research, especially journal articles during the pandemic.In the same vein, a study by the Confederation of Open
Access Repositories found that copyright and licensing were an impediment to discovery of, and access to, COVID-19 research outputs, inhibiting research
collaborations.&lt;/p&gt;
&lt;p&gt;At WIPO, in the past few years, numerous exercises such as action
plans and regional seminars implemented by this committee recognised
limitations and exceptions for education and research as a priority. Digital Preservation emerged as a consensual solution that
could be acted on - as identified in the regional seminar report as well.&lt;/p&gt;
&lt;p&gt;We believe that the Proposal by the African Group for a
Draft work program on Exceptions and Limitations effectively prioritises these
actionable aspects without prejudging the outcome of the negotiations on the
limitations and exceptions agenda. Hence, we look forward to member states
making progress by constructively considering and acting on the way forward
laid in the Proposal.&lt;/p&gt;

        &lt;b&gt;Centre for Internet &amp; Society (CIS) made a submission to the Department of Industrial Planning and Promotion (DIPP) on 7 December 2017.&lt;/b&gt;
        &lt;p style="text-align: justify; "&gt;&lt;strong&gt;Centre for Internet and Society, Indiaâ€™s (CIS) Submission to the Department of Industrial Planning and Promotion (DIPP) at Meeting with IP Stakeholders on 07 December, 2017&lt;/strong&gt;&lt;/p&gt;
&lt;ol style="text-align: justify; "&gt;
&lt;li&gt;As the DIPP is aware, the Indian mobile device manufacturing industry is mired in issues related to licensing of standard essential patents (SEPs). Disputes have resulted in imposition of heavy interim royalty rates on Indian manufacturers, payable to foreign SEP holders. Section 146(2) of the Patent Act, 1970 mandates patentees to provide information on working of patents, which is crucial for willing licensees to access patent working information in a timely manner. This requirement, that the details of patent working be disclosed by patentees supports the goal of making unworked patents available for compulsory licensing in India, both to promote economic development and public access to patented products. Penalties for failing to furnish such information (via Form 27) are steep, potentially resulting in fines or imprisonment.&lt;/li&gt;
&lt;li&gt;We note that in 2009, 2013 and 2015 the Controller issued public notices calling on patent owners to comply with their obligations to file statements of working on Form 27. Further, on February 12, 2013, the Indian Patent Office (IPO) announced plans to make Form 27 submissions for the year 2012 available to the public via the IPO website.&lt;/li&gt;
&lt;li&gt;We commend the efforts of the IPO, however, our empirical research on ICT innovations&lt;a name="_ftnref1"&gt;&lt;/a&gt; as well as by Prof. Shamnad Basheer (on ICT and pharmaceutical sector)&lt;a name="_ftnref2"&gt;&lt;/a&gt; reveals that there are serious lapses as far as compliance and enforcement of statutory provisions mandating filing of Form 27 are concerned.&lt;/li&gt;
&lt;li&gt;In the past year, we studied data available from 2009- 2016 for the mobile device sector, and could only identify and access 4,916 valid Forms 27, corresponding to 3,126 mobile device patents, leavingÂ  1,186 Indian patents for which a Form 27 could have been filed, but was not found.&lt;a name="_ftnref3"&gt;&lt;/a&gt; Â For a surprising number of Form 27s (3%) the working status of the relevant patent was not designated.&lt;br /&gt;&lt;br /&gt;Even among the Form 27s that had been obtained, almost none contained useful information regarding the working of the subject patents or fully complying with the informational requirements of the Indian Patent Rules. Many patentees simply omitted required descriptive information from their forms without any explanation.&lt;a name="_ftnref4"&gt;&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;Via our research we also gathered complaints raised by patentees and industry observers regarding the structure of the Form 27 requirement itself. For example, patents covering complex, multi-component products that embody dozens of technical standards and thousands of patents may not necessarily be amenable to the individual-level data requested by Form 27.&lt;/li&gt;
&lt;li&gt;Regardless, we submit that these technical difficulties should not hinder the critical statutory requirement placed on patent holders to diligently comply with Form 27 compliance. In the context of licensing of SEPs, several stakeholders recently suggested solutions as revealed from our study of the submissions made to the TRAI Consultation on Promoting Local Telecom Manufacturing&lt;a name="_ftnref5"&gt;&lt;/a&gt;:&lt;br /&gt;&lt;br /&gt;Two industry associations, namely Telecom Equipment Manufacturers Association of India Â (TEMA) and Telecom Equipment &amp;amp; Services Export Promotion Council (TEPC) and a telecommunication enabler Vihan Network Limited recommended that a modified and longer version of Form 27 (Form 27S) may be designed for SEP holders that should apply right at the filing stage. Section 159 of the Patent Act, 1970 empowers the central government to make such modifications to the form, as necessary.&lt;a name="_ftnref6"&gt;&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;Further, Prof. T Ramakrishna (MHRD Chair on Intellectual Property Rights) at NLSIU, specifically recommended that Form 27 may be amended to include a new column, which may require the patent holder to declare if their patent forms a part of any standard and in case of affirmative answer â€“ the name of the Standard Setting Organisation and corresponding standard of which it is a part.&lt;/li&gt;
&lt;li&gt;Further, we would like to draw attention to how our study was limited by the technical capabilities of the Indian Patent Officeâ€™s online Form 27 repository, such as&lt;a name="_ftnref7"&gt;&lt;/a&gt;:&lt;/li&gt;
&lt;/ol&gt; 
&lt;ul&gt;
&lt;li&gt;IPAIRS returned either a 404 error or Connection Time Out ("site is taking too long to respond") &lt;a href="http://ipindiaonline.gov.in/patentsearch/search/index.aspx"&gt;http://ipindiaonline.gov.in/patentsearch/search/index.aspx&lt;/a&gt;. In our opinion, it could be redirected to InPASS as it uses the same search engine as InPASS. Â Further, &lt;a href="http://ipindia.nic.in/patsea.htm"&gt;http://ipindia.nic.in/patsea.htm&lt;/a&gt; returned a 404 error.&lt;/li&gt;
&lt;li&gt;Some PDFs of the forms comprise scanned image files without OCR of the text. This makes them inaccessible to the visually impaired, and prevents search and discoverability of their content. This also makes them less usable by preventing copying and selection of text.&lt;/li&gt;
&lt;li&gt;In some cases, it was difficult to identify which one in the list of documents associated with a patent is Form 27, because of obscure filenames. &lt;/li&gt;
&lt;li&gt;For example, for Patent Number 262228, Form 27 was named 68.262228.pdf, as found on IPAIRS.&lt;/li&gt;
&lt;li&gt;For Patent number 260603, the filename for Form 27 was "ipindiaonline.gov.in_epatentfiling_online_frmPreview.asp.pdf" on IPAIRS.&lt;/li&gt;
&lt;li&gt;Inconsistency in search results found on IPAIRS. Searching for the peripheral documents of the patents, returned the results, "No PDF found" for one full week. The next week, the documents started showing. Some searches returned results for an entirely different patent number.&lt;/li&gt;
&lt;li&gt;Sometimes, Form 27 found on InPASS was not found on IPAIRS and vice versa.&lt;/li&gt;
&lt;li&gt;Runtime errors occur due to browser caching.&lt;/li&gt;
&lt;/ul&gt;

        &lt;b&gt;I attended the Civil BRICS Forum in Moscow last month. My session fell under the Economics and Trade category; and I spoke on the importance of maintaining a balanced IP regime, strengthening access to knowledge and medicines, and ensuring free speech and innovation. The event was held in Moscow from June 29 to July 1, 2015.&lt;/b&gt;
        &lt;p&gt;The working group also invited comments to the Zero draft recommendations and I drafted a quick response to the problematic aspects of the draft. &lt;p style="text-align: justify; "&gt;BRICS is a unique interactive format of the five largest and most dynamically developing countries - Brazil, Russia, India, China, and South Africa. BRICS member states in total occupied about a quarter of the land on the world map. The total population of the BRICS countries is about 40%. The cumulative gross domestic product (GDP) is about 26% of the global one. However, BRICS is not only a club intended to strengthen the economic impact of the rapidly developing countries, but as well a fundamentally new form of international or rather an inter-civilizational dialogue based on the principles of polycentricity, non-hierarchy and networking. Therefore it seems that BRICS is able to propose a new concept of equal interaction over all vectors of interstate cooperation: in the monetary sphere, allocation of resources, trade, political and human relations.&lt;/p&gt;

        &lt;b&gt;The Centre for Internet and Society (CIS) is organising a one-day workshop in Delhi on Tuesday, July 12 on the evolution and state of the set-top box as an access device in India. &lt;/b&gt;
        
&lt;p style="text-align: justify;"&gt;The workshop will be conducted by Dr. Rakesh Mehrotra who is a professor at Sharda University. It will be supported by an advisor from the Telecom Regulatory Authority of India to cover the aspect of regulation. The workshop will focus on the expanding functionality and innovations in set-top box (STB) technologies. It will also include an exposition on the regulatory regime applicable to STBs, around issues of interoperability, competition and privacy, and conclude with an outlook on the future of STBs.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;We will initiate research collaborations with suitable participants to produce papers after the workshop. Certificates of participation will be provided.&lt;/p&gt;

&lt;p style="text-align: justify;"&gt;Structured data available in open format and open license for public access and use, usually termed as “Open Data,” is of prime importance in the contemporary world. Data also is one of the most valuable resources of modern governance, sharing of which enables various and non-exclusive usages for both commercial and non-commercial purposes. Licenses, however, are crucial to ensure that such data is not misused or misinterpreted (for example, by insisting on proper attribution), and that all users have the same and permanent right to use the data.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;The open government data initiative started in India with the notification of the National Data Sharing and Accessibility Policy (NDSAP), submitted to the Union Cabinet by the Department of Science and Technology, on 17th March 2012 &lt;strong&gt;[1]&lt;/strong&gt;. The NDSAP identified the Department of Electronics &amp;amp; Information Technology (DeitY) as the nodal department for the implementation of the policy through National Informatics Centre, while the Department of Science and Technology continues to be the nodal department on policy matters. In pursuance of the Policy, the Open Government Data Platform India &lt;strong&gt;[2]&lt;/strong&gt; was launched in 2012.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;While, the appropriate open formats and related aspects for implementation of the Policy has been defined in the “NDSAP Implementation Guidelines” prepared by an inter- ministerial Task Force constituted by the National Informatics Centre &lt;strong&gt;[3]&lt;/strong&gt;, the open license for data sets published under NDSAP and through the OGD Platform remained unspecified till now.&lt;/p&gt;
&lt;h2&gt;2. Definitions&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;a. &lt;strong&gt;“Data”&lt;/strong&gt; means a representation of Information, numerical compilations and observations, documents, facts, maps, images, charts, tables and figures, concepts in digital and/or analog form, and includes metadata &lt;strong&gt;[4]&lt;/strong&gt;, that is all information about data, and/or clarificatory notes provided by data provider(s), without which the data concerned cannot be interpreted or used &lt;strong&gt;[5]&lt;/strong&gt;.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;b. &lt;strong&gt;“Information”&lt;/strong&gt; means processed data &lt;strong&gt;[6]&lt;/strong&gt;.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;c. &lt;strong&gt;“Data Provider(s)”&lt;/strong&gt; means person(s) publishing and providing the data under this license.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;d. &lt;strong&gt;“License”&lt;/strong&gt; means this document.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;e. &lt;strong&gt;“Licensor”&lt;/strong&gt;means any data provider(s) that has the authority to offer the data concerned under the terms of this licence.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;f. &lt;strong&gt;“User”&lt;/strong&gt; means natural or legal persons, or body of persons corporate or incorporate, acquiring rights in the data (whether the data is obtained directly from the licensor or otherwise) under this licence.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;g. &lt;strong&gt;“Use”&lt;/strong&gt; includes lawful distribution, making copies, adaptation, and all modification and representation of the data, subject to the provisions of this License.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;h. &lt;strong&gt;“Adapt”&lt;/strong&gt; means to transform, build upon, or to make any use of the data by itsre-arrangement or alteration &lt;strong&gt;[7]&lt;/strong&gt;.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;i. &lt;strong&gt;“Redistribute”&lt;/strong&gt; means sharing of the data by the user, either in original or in adapted form (including a subset of the original data), accompanied by appropriate attribute statement, under the same or other suitable license.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;j. &lt;strong&gt;“Attribution Statement”&lt;/strong&gt; means a standard notice to be published by all users of data published under this license, that contains the details of the provider, source, and license of the data concerned &lt;strong&gt;[8]&lt;/strong&gt;.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;k. &lt;strong&gt;“Personal Information”&lt;/strong&gt; means any Information that relates to a natural person,which, either directly or indirectly, in combination with other Information available or likely to be available with a body corporate, is capable of identifying such person &lt;strong&gt;[9]&lt;/strong&gt;.&lt;/p&gt;
&lt;h2&gt;3. Permissible Use of Data&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;Subject to the conditions listed under section 7, the user may:&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;a. Access, use, adapt, and redistribute data published under this license for all lawful and non-exclusive purposes, without payment of any royalty or fee;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;b. Apply this license worldwide, and in perpetuity;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;c. Access, study, copy, share, adapt, publish, redistribute and transmit the data in any medium or format; and&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;d. Use, adapt, and redistribute the data, either in itself, or by combining it with other data, or by including it within a product/application/service, for all commercial and/or non-commercial purposes.&lt;/p&gt;
&lt;h2&gt;4. Terms and Conditions of Use of Data&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;a. &lt;strong&gt;Attribution:&lt;/strong&gt; The user must acknowledge the provider, source, and license of data by explicitly publishing the attribution statement, including the DOI (Digital Object Identifier), or the URL (Uniform Resource Locator), or the URI (Uniform Resource Identifier) of the data concerned.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;b. &lt;strong&gt;Attribution of Multiple Data:&lt;/strong&gt; If the user is using multiple data together and/or listing of sources of multiple data is not possible, the user may provide a link to a separate page/list that includes the attribution statements and specific URL/URI of all data used.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt; c. &lt;strong&gt;Non-endorsement:&lt;/strong&gt; The User must not indicate or suggest in any manner that the data provider(s) endorses their use and/or the user.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;d. &lt;strong&gt;No Warranty:&lt;/strong&gt; The data provider(s) are not liable for any errors or omissions, and will not under any circumstances be liable for any direct, indirect, special, incidental, consequential, or other loss, injury or damage caused by its use or otherwise arising in connection with this license or the data, even if specifically advised of the possibility of such loss, injury or damage. Under any circumstances, the user may not hold the data provider(s) responsible for: i) any error, omission or loss of data, and/or ii) any undesirable consequences due to the use of the data as part of an application/product/service (including violation of any prevalent law).&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;e. &lt;strong&gt;Permanent Disclosure and Versioning:&lt;/strong&gt; The data provider(s) will ensure that a data package once published under this license will always remain publicly available for reference and use. If an already published data is updated by the provider, then the earlier appropriate version(s) must also be kept publicly available with accordance with the archival policy of the National Informatics Centre.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;f. &lt;strong&gt;Continuity of Provision:&lt;/strong&gt;The data provider(s) will strive for continuously updating the data concerned, as new data regarding the same becomes available. However, the data provider(s) do not guarantee the continued supply of updated or up-to-date versions of the data, and will not be held liable in case the continued supply of updated data is not provided.&lt;/p&gt;
&lt;h2&gt;5. Template for Attribution Statement&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;Unless the user is citing the data using an internationally accepted data citation format &lt;strong&gt;[10]&lt;/strong&gt;, an attribution notice in the following format must be explicitly included:&lt;/p&gt;
&lt;p&gt;“Data has been published by [Name of Data Provider] and sourced from Open Government Data (OGD) Platform of India: [Name of Data]. ([date of Publication: dd/mm/yyyy]) .[DOI / URL / URI]. Published under Open Government Data License - India: [URL of Open Data License – India].”&lt;/p&gt;
&lt;p&gt;For example, “Data has been published by Ministry of Statistics and Programme Implementation and sourced from Open Government Data (OGD) Platform of India: Overall Balance of Payments. (08/09/2015). &lt;a href="https://data.gov.in/catalog/overall-balance-payments"&gt;https://data.gov.in/catalog/overall-balance-payments&lt;/a&gt;. Published under Open Government Data License - India: [URL of Open Data License - India].”&lt;/p&gt;
&lt;h2&gt;6. Exemptions&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;The license does not grant the right to access, use, adapt, and redistribute the following kinds of data:&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;a. Personal information;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;b. Data that the data provider(s) is not authorised to licence;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;c. Names, crests, logos and other official symbols of the data provider(s);&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;d. Data subject to other intellectual property rights, including patents, trade-marks and official marks;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;e. Military insignia;&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;f. Identity documents; and&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;g. Any data publication of which may violate section 8 of the Right to Information Act, 2005 &lt;strong&gt;11&lt;/strong&gt;.&lt;/p&gt;
&lt;h2&gt;7. Termination&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;a. Failure to comply with stipulated terms and conditions will cause the user’s rights under this license to end automatically.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;b. Where the user’s rights to use data have terminated under the aforementioned clauses or any other Indian law, it reinstates:&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;i. automatically, as of the date the violation is cured, provided it is cured within 30 days of the discovery of the violation; or&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;ii. upon express reinstatement by the Licensor.&lt;/p&gt;
&lt;p style="text-align: justify;"&gt;c. For avoidance of doubt, this section does not affect any rights the licensor may have to seek remedies for violation of this license.&lt;/p&gt;
&lt;h2&gt;8. Dispute Redressal Mechanism&lt;/h2&gt;
&lt;p style="text-align: justify;"&gt;This license is governed by Indian law, and the copyright of any data shared under this license vests with the licensor, under the Indian Copyright Act.&lt;/p&gt;
