A Compilation of Research on the PDP Bill

The most recent step in India’s initiative to create an effective and comprehensive Data Protection regime was the call for comments to the Personal Data Protection Bill, 2019, which closed last month. Leading up to the comments, CIS has published numerous research pieces with the goal of providing a comprehensive overview of how this legislation would place India within the global scheme, and how the local situation has developed, as well as analysing its impacts on citizens’ rights.

In addition to general and clause-by-clause comments and recommendations, we have compiled an annotated version of the Personal Data Protection Bill, which lays out our commentary in an easy-to-follow format.

Pallavi Bedi has put together a note on the Divergence between EU’s General Data Protection Regulation (GDPR) and the Personal Data Protection Bill.

In addition, Pallavi has also contrasted the Personal Data Protection Bill with the GDPR and California Consumer Protection Act, in the contexts of jurisdiction and scope, rights of the data principal, obligations of data fiduciaries, exemptions, data protection authority, and breach of personal data.

On IAPP’s blog Privacy Perspectives, D. Shweta Reddy has assessed whether the Personal Data Protection Bill 2019 is sufficient for India to receive adequacy status from the EU.

Along with Justin Sherman, Arindrajit Basu has outlined the key global takeaways from the Personal Data Protection Bill 2019 on Lawfare.

On The Diplomat, Arindrajit has also traced the narrowing localization provisions in India, as well as Vietnam and Indonesia, and studied the actors and geopolitical tussle that has shaped these provisions.

Through a string of publicly available submissions, press statements, and other media reports, Arindrajit and Amber Sinha have tracked the political evolution of the data protection ecosystem in India, and how this has, and will continue to impact legislative and policy developments on EPW Engage.

Gurshabad Grover and Tanaya Rajwade have written on The Wire about how the Personal Data Protection Bill regulates social media.

Amber was also a guest on Suno India’s Cyber Democracy podcast, with Srinivas Kodali, to discuss how the latest version of the Personal Data Protection Bill will impact the right to privacy.

Workshop: Automotives Sector and the Future of Work in India

The Centre for Internet & Society (CIS) will hold a Workshop on the Automotives Sector and the Future of Work in India on Tuesday, July 31, 2018 . The workshop will take place from 10 a.m. to 5 p.m at The Willow Hall at the Indian Habitat Centre in New Delhi.

We invite you all to participate in this workshop to share and build knowledge about trajectories of Industry 4.0 across sub-sectors of the automotive industry in India and the emergent regulatory and public policy concerns.

The workshop will be a full-day event structured as four, three-speaker moderated panels discussing specific themes within the discourse around Industry 4.0, with an audience of about 35. Our goal is to bring together the various key stakeholders involved in the debate around Industry 4.0 and provoke conversations that will contribute to the discourse as well as compliment CIS's research in the space.

The Potential for the Normative Regulation of Cyberspace: Implications for India

The standards of international law combined with strategic considerations drive a nation's approach to any norms formulation process. CIS has already produced work with the Research and Advisory Group (RAG) of the Global Commission on the Stability of Cyberspace (GCSC), which looks at the negotiation processes and strategies that various players may adopt as they drive the cyber norms agenda.

This report focuses more extensively on the substantive law and principles at play and looks closely at what the global state of the debate means for India

With the cyber norms formulation efforts in a state of flux,India needs to advocate a coherent position that is in sync with the standards of international law while also furthering India's strategic agenda as a key player in the international arena.

This report seeks to draw on the works of scholars and practitioners, both in the field of cybersecurity and International Law to articulate a set of coherent positions on the four issues identified in this report. It also attempts to incorporate, where possible, state practice on thorny issues of International Law. The amount of state practice that may be cited differs with each state in question.

The report provides a bird’s eye-view of the available literature and applicable International Law in each of the briefs and identifies areas for further research, which would be useful for the norms process and in particular for policy-makers in India.Historically, India had used the standards of International Law to inform it's positions on various global regimes-such as UNCLOS and legitimize its position as a leader of alliances such as the Non-Aligned Movement and AALCO. However, of late, India has used international law far less in its approach to International Relations. This Report therefore explores how various debates on international law may be utilised by policy-makers when framing their position on various issues. Rather than creating original academic content,the aim of this report is to inform policy-makers and academics of the discourse on cyber norms.In order to make it easier to follow, each Brief is followed by a short summary highlighting the key aspects discussed in order to allow the reader to access the portion of the brief that he/she feels would be of most relevance. It does not advocate for specific stances but highlights the considerations that should be borne in mind when framing a stance.

The report focuses on four issues which may be of specific relevance for Indian policy-makers. The first brief, focuses on the Inherent Right of Self-Defense in cyberspace and its value for crafting a stable cyber deterrence regime. The second brief looks at the technical limits of attributability of cyber-attacks and hints at some of the legal and political solutions to these technical hurdles. The third brief looks at the non-proliferation of cyber weapons and the existing global governance framework which india could consider when framing its own strategy. The final brief looks at the legal regime on counter-measures and outlines the various grey zones in legal scholarship in this field. It also maps possible future areas of cooperation with the cyber sector on issues such as Active Cyber Defense and the legal framework that might be required if such cooperation were to become a reality.Each brief covers a broad array of literature and jurisprudence and attempts to explore various debates that exist both among international legal academics and the strategic community.

The ongoing global stalemate over cyber norms casts a grim shadow over the future of cyber-security. However, as seen with the emergence of the nuclear non-proliferation regime, it is not impossible for consensus to emerge in times of global tension. For India, in particular, this stalemate presents an opportunity to pick up the pieces and carve a leadership position for itself as a key norm entrepreneur in cyberspace.

In an article for The Wire, Aman Nair points out that India might miss out on NFT (non-fungible tokens) which is set to become a mainstay in the modern digital zeitgeist. [link]
Arindrajit Basu and Andre Barrinha co-wrote for the EU Cyber Direct, on outer space diplomacy in the 1960s and why cyber (security) diplomacy isn’t quite progressing as well or as fast. [link]
Arindrajit Basu, Irene Poetranto and Justin Lau co-wrote an article for Carnegie Endowment for International Peace which captures some concerns with the United Nations OEWG process dealing with cyber norms and the absence of discussion at the forum on key issues. [link]
In an article for the Observer Research Foundation, Arindrajit Basu writes about how India must avoid getting its data policy caught up in tired existing machinations and instead forge a new path that prioritizes Indian strategic interests. [link]
Aman Nair, Arinjay Vyas, Pallavi Bedi, and Garima Saxena authored a response to the Supreme Court E-committee’s draft vision document of phase III of the E-courts project. This response recommends consideration be given to the digital and gender divide, and lack of clarity in the document on several data-related aspects. [link]

Privacy

The proposed Personal Data Protection Bill, 2019 is being deliberated by the Joint Parliamentary Committee and is expected to be tabled in the Monsoon Session of Parliament. Pallavi Bedi and Amber Sinha co-authored a white paper to examine the personal data implications on welfare delivery models in India and to suggest ways to operationalise key provisions. [link]
Shweta Mohandas authored an article for Rajiv Gandhi National University of Law Student Research Review (RSRR). In this article, which forms a part of RSRR’s ‘Excerpts from Experts Blog Series,’ Shweta examines whether Indian data protection legislation can act as a check on growing workplace surveillance. Aman Nair and Arindrajit Basu examine the changes in the context of data sharing between WhatsApp and Facebook as being an anticompetitive action in violation of the Indian Competition Act, 2002. Having previously examined the implications of WhatsApp’s changes to its privacy policy in 2021, this issue brief is the second output of the series examining the effects of the changes. [link]
In a blog-post, Pallavi Bedi provides recommendations for the Covid vaccine intelligence network (Co-Win) platform. She says that as a first step it is essential that Co-Win has a separate dedicated privacy policy which conforms to the internationally accepted privacy principles and enumerated in the Personal Data Protection Bill. Freedom of Expression, and Intermediary Liability

In February, the Advertising Standards Council of India (ASCI) had issued draft rules for regulation of digital influencers, with an aim to “understand the peculiarities of [online] advertisements and the way consumers view them,” as well as to ensure that: “consumers must be able to distinguish when something is being promoted with an intention to influence their opinion or behaviour for an immediate or eventual commercial gain.” Torsha Sarkar and Shweta Mohandas respond with comments and recommendations to the rules. In a research paper, Noopur Raval offers critical historical insights from the fields of international development, anthropology, and postcolonial history to caution against both the possible harms of gender disaggregated datafication, as well as the consequences of non-participatory datafication of women. Kaarika Das, a research scholar at NIEPA and Sravya C, a researcher in the Humanizing Automation project at IIIT Bangalore published a study on migrants in India's Gig Economy. [link]
Sameet Panda and Vipul Kumar wrote a blog for Privacy International pointing the failures in the digitisation of India’s food security programme in light of the exclusion of married women of Odisha. [link]
Shreya Ghosh, a research scholar at the Centre for Political Studies, Jawaharlal Nehru University, New Delhi authored an article in EPW on access to welfare and health for women during the initial phase of the pandemic. [link]
Ambika Tandon and Aayush Rathi in a research paper, “Fault lines at the Front lines” analyze the changing employment conditions for domestic workers in the growing platform economies of South and Southeast Asia. By analyzing different platform designs and comparing regulations in India, Indonesia, Pakistan and Vietnam, the authors present a thorough picture of the situation for domestic workers in the new economy.
