Access India Meet-Up, 16 May 2009

We reproduce a brief report on the meeting of the Access India mailing list hosted at the office of the Centre for Internet and Society on 16 May 2009, between 2.00 pm and 5.00 pm.

The second annual meeting of the members of the Access India mailing list (Bangalore chapter) was held at the office of the Centre for Internet and Society office on 16 May 2009. The meeting was attended by 28 participants.

The agenda included a presentation by representatives from AreaPal, a Bangalore-based social networking group founded by students. AreaPal allows users to locate and connect with people on the basis of their area and neighborhood. It is a genuine neighbourhood networking service. Apart from that, they also provide user-generated news, events and marketplace based information about a user’s area. For further information, please visit www.areapal.com.

This was followed by a presentation by representatives from 3I Infotech, a company which recently launched e-Mudhra, an initiative to roll out digital signatures. The next presentation scheduled was by representatives from iVolunteer, an organization that matches volunteers seeking volunteering opportunities with organizations and individuals looking for volunteers in Bangalore. To learn more about the organization, please visit www.ivolunteer.in

The final presentation was an introduction to Inclusive Planet. Inclusive Planet is in the process of building the largest online portal for disabled persons in India. It is intended to be a comprehensive portal containing various resources including employment resources, educational resources, a match-making channel, accessible books section, discussion boards, resources for medical facilities, sports and entertainment center, etc. Please visit http://www.inclusiveplanet.org/

The Bangalore offline Access India meeting, which took place today at the CIS (Centre for Internet and Society) campus, was a resounding success. About 30 AI members from different parts of the country were present to listen to four presentations made by IVolunteer, 3i Infotec, Area Pal and Inclusive Planet. All the presenters spoke about their services/products/organisations, and this proved to be useful for those present. For instance, the IVolunteer presentation opened the way for many to request volunteer help (as disability services is one of 12 areas for which the organisation helped with volunteers). Obviously, those present were interested in volunteers willing to read/scan books for them and other similar services.

Interestingly, the idea of digital signatures, which the 3i Infotec representative dealt with, prompted discussion on using digital signatures as a means of certifying disabled persons who wanted to buy railway tickets online. Sanjeev, the representative, was positive that this can be done.

Kavi Raj, who is from Area Pal, explained how their online platform linked people in the same neighbourhood/campus helped them exchange news and information relevant to them. Rounding up the interesting evening was Sachin from Inclusive Planet, who spoke about readable.in, an accessible online space where (visually impaired) people can upload/download books and share the books they have. He said the site already contains about 15,000 ebooks and asked for contributions. Inclusive Planet, which looks at services from the disability perspective, is poised to introduce spaces for restaurant/public place ratings (on the basis of their accessibility) and matrimonial services for the disabled where the emphasis will be on their abilities.

The evening was made more fun and interesting by our hostess Nirmita Narasimhan (attending on behalf of CIS), who introduced her organisation to the audience and gave us a chance to hear each other's voices for the first time (by letting us introduce ourselves). Thanks to Nirmita and Geetha's efforts and hard work, the event was a success. And, of course, we shouldn't forget the space and snacks provided by CIS and the wonderful support their staff provided in escorting us back and forth in the office building.

Seminar on Exceptions and Limitations in Copyright

This is a report on a seminar organised by the Department of Higher Education, Ministry of Human Resource Development, and Government of India on 14 and 15 May 2009, in Kochi, Kerala, to look at exceptions and limitations in copyright. Programme Manager Nirmita Narsimhan, of the Centre for Internet and Society, attended the seminar.

CIS Programme Manager Nirmita Narsimhan attended a seminar on exceptions and limitations in copyright, organised by the Department of Higher Education, Ministry of Human Resource Development, and Government of India on 14 and 15 May 2009, in Kochi, Kerala. The seminar was intended to bring up key issues affecting access to knowledge, which are to be taken up by the Standing Committee on Copyright and Related Rights (SCCR) at the World Intellectual Property Organisation (WIPO) later this month. Resource persons identified for different topics were eminent scholars, academicians and practitioners across India. The seminar covered eight topics. On each topic, a paper was presented by a resource person with commentary by an expert in the field, after which there was an open discussion.

The first day featured, amongst others, a paper presented by Lawrence Liang, Distinguished Fellow, CIS. He spoke at length on the exceptions and limitations for education.

The second day featured a paper by Mr. Madhukar Sinha, former Registrar of Copyright. Mr. Sinha presented on the topic 'Use of works by visually impaired and other miscellaneous exceptions of use of works under Indian Copyright Act: Section 52(1) (q), (r), (s), (t), (u), (v), and (x), (y), (z)'. His paper went into great length on definitions of visual disability and tried to evolve an economic model to support conversion of books into accessible formats for the visually challenged. The paper drew parallels with existing laws and best practices in different countries, made a detailed analysis of exceptions for the blind in the light of the Berne three-step test and the TRIPS agreement, and concluded by recommending that the Copyright Act should be amended to include exceptions and limitations which would permit conversion of books into formats in certain special cases. Mr. Sinha also recommended that India should look at solutions which go beyond the limits of the Copyright Act to solve such problems.

The response to this was prepared by Mr. Rahul Cherian of Indo Juris Law offices. The response paper drew attention to the fact that half of the total blind population of the world is in India and that amounts to a population of more than a crore. In the light of the economic and logistic considerations of our country, the Copyright Act should

Expressly include a limitation to permit conversion of books into accessible formats for visually challenged persons;
Permit conversion by stakeholder organizations as well as interested family members and friends of beneficiaries;
Adopt a functional definition of disability and not a medical one as is currently the case in the Persons with Disabilities Act 1995, and extend the benefit of the exception to all persons, who by reason of any disability are unable to access the work in its original format;and
Not restrict conversion only to those formats which are exclusively for the use of blind persons. Visually challenged persons should be able to make use of available mainstream formats like PDFs or Word as well.

The paper also dealt extensively with the Treaty for Improved access for the Blind, Visually Impaired and Other Reading Disabled, which was proposed by the World Blind Union in WIPO last year and is coming up again for discussion later this month.

The seminar was extremely productive because there was a strong recommendation and support for the inclusion of a limitation for conversion into accessible formats for persons with disabilities in the Indian Copyright Act. All the members present came to a consensus that the Indian Government should take a supportive stand towards the Treaty for the Blind proposed by the WBU at the SCCR this month. A representative of a leading publishing house committed himself to working towards providing books to certain organizations for the blind, if they could assure him that those books would be circulated only to blind persons and not to others.

Report on the Internet Governance Forum

CIS attended the UN Internet Governance Forum in Hyderabad, December 3-7, 2008.

As an outcome of the UN Internet Governance Forum (IGF) which took place in Hyderabad from December 3-7, 2008,

(a) CIS entered into an agreement with the W3C to make translations of the WCAG 2.0 guidelines into some Indian languages; and

(b) CIS, the UN Solutions Exchange group and the Daisy Forum of India (DFI) decided to work together on the web accessibility issue and form a core group of organizations across the disability sector for this purpose.

Follow-up Letter in Support of WIPO Treaty for Reading Disabled

CIS has sent another letter to the Department of Higher Education, Ministry for Human Resource Development, petitioning it to support the WIPO Treaty for the reading disabled.

In November last year, CIS launched a nation wide signature campaign to support the treaty for the blind, visually impaired and other reading disabled proposed by the World Blind Union to the WIPO. Since then, the list of signatories was updated. In May 2009, WIPO's Standing Committee on Copyright and Related Rights (SCCR) held another meeting, and in light of this, the endorsement of the treaty and appeal to the government to support it was resubmitted, by an increased number of signatories, including members of the DAISY Forum of India.

We were extremely gratified that the Government took note of our letter in November, 2008, containing endorsements of 16 organisations urging the government to support the Treaty for the Blind, which was proposed by the World Blind Union in the WIPO SCCR meeting from Nov 1^st-6^th,2008. In light of the fact that there is another SCCR meeting scheduled from May 25^th-29^th, where this issue is to be taken up, we are resubmitting our endorsement and urgent plea to the Government to actively support this treaty, since it will be extremely beneficial to all blind, visually challenged and print disabled persons in India. Report on Second National Workshop on Web Accessibility, 5-7 June 2009

Nirmita Narsimhan reports on the second National Workshop on Web Accessibility for web developers, hosted by CIS in Bangalore from 5 to 7 June 2009, and attended by 15 participants.

The second National Workshop on Web Accessibility for web developers was held at the CIS office in Bangalore, 5-7 June 2009. Although this was intended to be more a city-based workshop, we still got participants from other states such as Kerala, Maharashtra, Tamil Nadu and Andhra Pradesh. There were in all 15 participants predominantly from the web development and web designing backgrounds, college students and even a person from the academic field and 3 trainers. There were also some who had already prior knowledge of accessibility and this helped to raise the level of issues which were being discussed from a basic level to a more advanced level. Overall, the workshop was extremely well received and many of the participants expressed their willingness to participate in more such workshops in the future.

The workshop was structured differently from the last one--the sessions were more practical-oriented and the trainers stressed a lot on group work. There were sessions on understanding disability, WCAG 2.0 principles and group exercises of designing accessible pages. This workshop featured some additional topics such as Flash accessibility, accessibility in documents and role play exercises for problem solving for different disabilities. For instance, in one of the sessions, the participants were asked to prepare a caption for a one minute video. One of the participants, already working on accessibility, demonstrated Orca for Linux.

Specific Outcomes

1. The participants understood the importance of creating accessible web pages and learnt about various techniques, tools and resources for accessibility.
2. All the presentations and lectures were video documented.
3. The participants filled up feed back forms and action points to be undertaken after the workshop. CIS distributed T-Shirts and certificates to all the participants.

Response to the Call from Federation of Indian Chambers of Commerce and Industry for Review of the Copyright Act

This blog entry contains a letter sent by Rahul Cherian of Indojuris and Nirmita Narsimhan of the Centre for Internet and Society in response to a call from the Federation of Indian Chambers of Commerce and Industry for review of the Copyright Act.

The Federation of Indian Chambers of Commerce and Industry (FICCI) has recently constituted a Consultative Working Group to analyse various issues in the Copyright Act. This has been approved by the Department of Industrial Policy and Promotion (DIPP). The group is to be chaired by Shri Amit Khare, Joint Secretary, Department of Higher Education, Ministry of Human Resource Development. The purpose of the Consultative Working Group would be to look into the existing provisions of the copyright law and the proposed amendments, as well as into the international arrangements and suggestions. The Consultative Working Group is expected to submit its report along with amendments or suggestion, as required.

Rahul Cherian of Indojuris and Nirmita Narasimhan of CIS have submitted a report on the provisions of the Copyright Act with respect to the limitations for print disabled persons. This has been submitted in the form of a letter to Sheetal Chopra of FICCI; the letter is reproduced below.

Subject: Consultative Working Group on Copyright Issues – issues to be addressed by the Consultative Working Group.

As required by you we give below the issues to be addressed by the Consultative Working Group. This document is prepared by Nirmita Narasimhan of the Centre for Internet and Society, Bangalore, and Rahul Cherian Jacob of IndoJuris Law Offices, Chennai.

Scope - Exceptions and Limitations for Print Impaired Persons

The scope of the issues raised here are limited to the exceptions and limitations under the Copyright Act that are required to facilitate access of books by the visually impaired and other print impaired persons.

Problem faced by Print Impaired Persons

India has approximately 70 million Print Impaired Persons (loosely defined as persons who are unable to access print as a result of disability and include persons who are visually impaired, persons who have learning disabilities such as dyslexia and persons who due to physical disability are unable to hold a book or turn pages) who do not have access to knowledge due to a lack of reading material in accessible formats. It is estimated that even in developed countries not more than 5% of publications get converted into accessible formats for the benefit of Print Impaired Persons. As a result, Print Impaired Persons are excluded from the education system, are unable to seek meaningful employment and are on the whole excluded from all aspects of civil society.

It is observed that publishers do not make available books in formats accessible by Print Impaired Persons and the Copyright Act does not provide exceptions and limitations to the rights of the copyright owner for third parties to convert and make available books in accessible formats for Print Impaired Persons. This has lead to a “book famine” from the perspective of Print Impaired Persons.

Technological Advances and Accessible Formats

Till a few years ago, Print Impaired Persons had to rely on audio files and Braille (in the case of the persons who became visually impaired at a young age) to enjoy printed matter. Each of these formats have severe limitations. For example audio files have to be played serially and navigation is severely limited. In the case of Braille, the printing costs are expensive, reading a Braille book is up to 4 times slower than a normal book, Braille is extremely difficult to learn if you loose sight at a later age, and persons using Braille can communicate only with others who know Braille. However with the information technology revolution and the creation of text-to-speech screen readers that read out documents in electronic formats to Print Impaired Persons there are now countless ways in which Print Impaired Persons can access books in any easy and simple manner. Specialized electronic formats such as the DAISY Format not only permit the visually impaired to “read” the material using screen readers but also permit a digital file to be printed in Braille for the blind, in large print for the partially sighted and also provide audio with inbuilt search and indexation features for those Print Impaired Persons who have computers. The key is that technological innovation now provides the much-needed flexibility required by Print Impaired Persons to access material in formats they are most comfortable with. However the availability of these technology solutions alone does not solve the problem of dearth of books in formats that can be enjoyed by Print Impaired Persons.

Legal compulsions for providing exceptions and limitations for the benefit of Print Impaired Persons

At present Indian copyright law does not provide exceptions and limitations to the rights of copyright owners for the benefit of Print Impaired Persons. The Indian Constitution expressly provides for “equality” (Article 14), “non-discrimination” (Article 15), “freedom of speech and expression” (Article 19), and “right to life” (Article 21). Indian courts have not yet had the opportunity to pronounce any judgment on whether the Constitution requires copyright law to provide exceptions and limitations for the benefit of Print Impaired Persons. However, Indian courts have routinely upheld the rights of persons with disability and the Supreme Court has specifically recognized that the “right to life” as enshrined in Article 21 of the Constitution includes right to dignity including basic necessities such as reading and writing. Right to education has also been recognized as a fundamental right. For Print Impaired Persons to enjoy their fundamental rights it is essential that they have access to material, including but not limited to educational material, in accessible formats. As present, 70 million Indians cannot enjoy their fundamental rights due to the fact that the Copyright Act does not provide exemptions and limitations for Print Impaired Persons. It is to be noted that about 50 countries around the world already provide copyright exceptions and limitations for the benefit of the visually impaired/printed impaired.

India has also ratified the United Nations Convention on the Rights of Persons with Disabilities and the objects of the aforesaid convention include providing persons with disability, access, on an equal basis with others, to information and communication. Indian courts have read into Indian law provisions of the United Nations Convention on the Rights of Persons with Disabilities. It is also to be noted that the Standing Committee on Copyright and Related Rights of the World Intellectual Property Organisation is currently discussing the proposed WIPO Treaty for Blind, Visually Impaired and Other Reading Disabled Persons.

India has also recognized the requirements of Print Impaired Persons and had circulated draft amendments to the Copyright Act in _________ for feedback and comments from the public. All the leading organisations representing visually impaired persons has submitted their responses stating that the proposed amendments did not adequately meet the requirements of visually impaired persons.

In light of the above the question is not whether exceptions and limitations for the benefit of Print Impaired Persons must be provided (they must), but what form these exceptions and limitations must take.

Exceptions and Limitations – Issues to be considered

Given below are the issues that must be considered when providing exceptions and limitations for the benefit of Print Impaired Persons.

Beneficiaries – The beneficiaries of any amendment should include all persons with disability who, due to that disability, need an accessible format to access a book to substantially the same degree as a person without a disability. This definition should be functional and not medical since medical definitions cannot be exhaustive.

Formats – Print Impaired Persons should be able to enjoy the benefits of the information technology revolution in the same way that non-disabled persons have been able to. Any amendment should therefore take into account technological developments and should be format neutral to give full flexibility and utility to Print Impaired Persons. As mentioned above Braille as a format has limited application and a majority of visually impaired persons are not able to use Braille. Moreover, Braille cannot be used by persons with other print impairments such as dyslexia or persons with physical disabilities.

Permitted Activities – The activities permitted by any amendment should include the making of accessible formats of a work, supplying that accessible format, or copies of that format, to Print Impaired Persons by any means, including by lending or by electronic communication by wire or wireless means, and undertaking any intermediate steps to achieve these objectives.

Who can conduct the Permitted Activities – It is noted that the cost of making an accessible copy of a book is far higher than the cost of the book itself. It is observed that non-profit organisations have been able to convert only a few thousands books till date due to lack of funds. Print Impaired Persons, their families and other members of their support group also convert books into accessible formats at very high cost. The number of books converted by these persons is also minimal. Keeping in mind the fact that publishers are not selling books in accessible formats there appears to be complete market failure in this area. The solution for this problem appears to be that, apart from non-profit organisations, Print Impaired Persons and their support group being permitted to conduct the Permitted Activities, volunteers and for-profit organisations should also be able to conduct the Permitted Activities. If any of the Permitted Activity is undertaken for profit, then the entity carrying out the Permitted Activity must give notice to, and pay prescribed royalty to the copyright owner. The quantum of royalty payable should be determined keeping in mind the fact that the average income of Print Impaired Persons is far lower than the income of non disabled persons. The possibility of creating a collecting society for this purpose can also be explored.

Conclusion

“Inclusiveness” is the underlying theme of the Indian Constitution and “Inclusion” is a word used liberally by the courts and politicians alike. The Universal Declaration of Human Rights prohibits discrimination on the basis of disability. The United Nations Convention on Rights of Persons of Disabilities aims to support the full and effective participation of persons with disabilities in social life and development; and to advance the rights and protect the dignity of persons with disabilities and to promote equal access to employment, education, information, goods and services.

However, these concepts mean nothing to Print Impaired Persons as long as their most basic fundamental rights continue to be denied due to the fact that Indian copyright law does not provide exceptions and limitations for the benefit of Print Impaired Persons.

In light of the above, appropriate amendments must be made to the Copyright Act as soon as possible to remove the barriers placed before Print Impaired Persons that prevent their exercise of fundamental rights.

An Open Letter on Internet Governance to the UN Internet Governance Forum

This open letter brings up concerns of democratic deficit in internet governance worldwide, and is addressed to the UN Internet Governance Forum (IGF). It is to be delivered at the IGF's 3rd Annual Meeting at Hyderabad, India, from 3rd to 6th December, 2008. The IGF must ACT NOW against the threat to the public-ness and the egalitarian nature of the Internet

The undersigned wish to express their deep concern that the UN Internet Governance Forum (IGF), created by the World Summit on the Information Society in 2005 as an Internet ‘policy dialogue’ forum, is largely failing to address key public interest and policy issues in global Internet governance – including that of democratic deficit.

Who shapes the Internet, as the Internet shapes our new social context?

The Internet represents the single most important technical advance of our society in a long time, so much so that it defines a new emerging social paradigm. The basic characteristics of the Internet determine the contours of the emerging social order in many important ways. The Internet was conceived as, and still largely is, an extensive communication system which is democratizing, and has little respect for established social hierarchies. Interactions and associations built over this new ‘techno-social’ system have, therefore, held the promise of a more egalitarian society.

The era of innocence of the Internet however appears to be fast approaching its end. Today, the Internet of the future – the very near future – is being shaped insidiously by dominant forces to further their interests. (See the fact-sheet on the following page for some illustrations of this.) Unfortunately, global policy forums have largely failed to articulate, much less act on, crucial Internet policy issues, which concern the democratic possibilities for our societies.

The IGF needs to act now!

As the Internet Governance Forum convenes for its third annual meeting, between 3rd and 6th December, 2008, in Hyderabad, India, it must take immediate steps to anchor and discuss important global public interest and policy issues involved in Internet governance. If it does not act now, it may get seen as a space that only provides an illusion of a public policy dialogue, and, consequently, as being co-opted in furthering the agenda of dominant forces that are shaping the Internet as per their narrow interests. We therefore strongly urge the IGF to directly address the following key global public interest and policy issues:

Increasing corporatisation of the Internet
Increasing proprietisation of standards and code that go into building the Internet
Increasing points of control being embedded into the Internet in the name of security and intellectual property violations
Huge democratic deficit in global Internet governance

We exhort the IGF to adopt clear directions for engaging with these crucial public policy issues. The IGF should come out with a clear work plan at its forthcoming meeting in Hyderabad to address the four key areas listed above.

The global community – comprising not only people who currently have access to the Internet, but also the un-connected billions who are being impacted by it nevertheless – will judge the meaningfulness and legitimacy of the IGF in terms of what progress it is able to make on these issues.

How the Public-ness and Egalitarian Nature of the Internet is Threatened
– Some Examples

Corporatisation of the Internet
Largely unsuspected by most of its users, the Internet is rapidly changing from being a vast ‘public sphere’, with a fully public ownership and a non-proprietary nature, to a set of corporatised privately-owned networks.

On the one hand, telecom companies are carving out the Internet into privately-owned networks – controlling the nature of transactions over these networks. They seek to differentially charge content providers, while also building wholly private networks offering exclusive content relay services. Developments like video/TV over Internet Protocol and the provision of controlled and selective Internet services over mobiles are contributing to increasing network-operators’ control over the Internet, with a corresponding erosion of its public-ness.

On the other hand, the commons of the Internet is also being overwhelmed and squeezed out by a complete domination of a few privately owned mega-applications such as Google, Facebook, Youtube etc.

Proprietarisation of standards and code that build the Internet

One of the main ways of appropriating the commons of the Internet is through the increasing use of proprietary and closed standards and code in building the Internet system. Such appropriation allows the extortion of illegitimate rent out of the many new forms of commons-based activities that are being made possible through the Internet.

Embedding control points in the Internet

A growing confluence of corporatist and statist interests has led to the embedding of more and more means of control into the Internet in a manner that greatly compromises citizens’ rights and freedoms. Whether it is the pressure on Internet
Service Providers to examine Internet traffic for ‘intellectual property’ violations; or imposition of cultural and political controls on the Internet by states within their boundaries; or ITU’s work on IP trace-back mechanisms; or the tightening of US
control over the global Internet infrastructure in the name of securing the root zone file and the domain name system, these new forms of controlling the Internet are being negotiated among dominant interests away from public scrutiny and wider public interest-based engagements.

Democratic deficit in global Internet governance
The current global Internet governance regime – a new-age privatized governance system professing allegiance mostly to a single country, the US – has proven to be an active instrument of perpetuation of dominant commercial and geo-political interests. Lately, OECD countries have begun some work on developing public policy principles that, due to the inherently global nature of the Internet, can be expected to become globally applicable. It is quite unacceptable that OECD countries shirk from discussing the same public policy issues at global public policy forums like the IGF that they discuss among themselves at OECD meetings. Apparently, developing countries are expected to focus on finding ways to reach connectivity to their people, and not burden themselves with higher-level Internet governance issues!

People’s and communities’ right to self-determination and participation in governance of issues that impact their lives should underpin global Internet governance.
